Section <bold>19-2-104</bold> is amended to read:</secline><catline lineno="20"><bold>19-2-104<parens/>. Powers of board.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="21" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The board may make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="22" slineno="1-4"/>Administrative Rulemaking Act:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="23" slineno="1-5" level="2"><display>(a)</display>regarding the control, abatement, and prevention of air pollution from all sources and <ln numlevel="1" lineno="24" slineno="1-6"/>the establishment of the maximum quantity of air pollutants that may be emitted by <ln numlevel="1" lineno="25" slineno="1-7"/>an air pollutant source;</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="26" slineno="1-8" level="2"><display>(b)</display>establishing air quality standards;</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="27" slineno="1-9" level="2"><display>(c)</display>requiring persons engaged in operations that result in air pollution to:<subsection ssid="2-null-5" dnum="i-o" numlevel="1" lineno="28" slineno="1-10" level="3"><display>(i)</display>install, maintain, and use emission monitoring devices, as the board finds <ln numlevel="1" lineno="29" slineno="1-11"/>necessary;</subsection><subsection ssid="2-null-6" dnum="ii-o" numlevel="1" lineno="30" slineno="1-12" level="3"><display>(ii)</display>file periodic reports containing information relating to the rate, period of <ln numlevel="1" lineno="31" slineno="1-13"/>emission, and composition of the air pollutant; and</subsection><subsection ssid="2-null-7" dnum="iii-o" numlevel="1" lineno="32" slineno="1-14" level="3"><display>(iii)</display>provide access to records relating to emissions which cause or contribute to air <ln numlevel="1" lineno="33" slineno="1-15"/>pollution;</subsection></subsection><subsection ssid="2-null-8" dnum="d-o" numlevel="1" lineno="34" slineno="1-16" level="2" space="false"><display>(d)</display><subsection ssid="2-null-9" dnum="i-o" level="3" placement="sameline"><display>(i)</display>implementing:<subsection ssid="2-null-10" dnum="A-o" numlevel="1" lineno="35" slineno="1-17" level="4" tab="1"><display>(A)</display>Toxic Substances Control Act, Subchapter II, Asbestos Hazard Emergency <ln numlevel="1" lineno="36" slineno="1-18"/>Response, 15 U.S.C. 2601 et seq.;</subsection><subsection ssid="2-null-11" dnum="B-o" numlevel="1" lineno="37" slineno="1-19" level="4" tab="1"><display>(B)</display>40 C.F.R. <ext_ref depth="2" refnumber="19-2-763" start="2" type="Code of Federal Regulations">Part 763</ext_ref>, Asbestos; and</subsection><subsection ssid="2-null-12" dnum="C-o" numlevel="1" lineno="38" slineno="1-20" level="4" tab="1"><display>(C)</display>40 C.F.R. <ext_ref depth="2" refnumber="19-2-61" start="2" type="Code of Federal Regulations">Part 61</ext_ref>, National Emission Standards for Hazardous Air Pollutants, <ln numlevel="1" lineno="39" slineno="1-21"/>Subpart M, National Emission Standard for Asbestos; and</subsection></subsection><subsection ssid="2-null-13" dnum="ii-o" numlevel="1" lineno="40" slineno="1-22" level="3"><display>(ii)</display>reviewing and approving asbestos management plans submitted by local <ln numlevel="1" lineno="41" slineno="1-23"/>education agencies under the Toxic Substances Control Act, Subchapter II, <ln numlevel="1" lineno="42" slineno="1-24"/>Asbestos Hazard Emergency Response, 15 U.S.C. 2601 et seq.;</subsection></subsection><subsection ssid="2-null-14" dnum="e-o" numlevel="1" lineno="43" slineno="1-25" level="2"><display>(e)</display>establishing a requirement for a diesel emission opacity inspection and maintenance <ln numlevel="1" lineno="44" slineno="1-26"/>program for diesel-powered motor vehicles;</subsection><subsection ssid="2-null-15" dnum="f-o" numlevel="1" lineno="45" slineno="1-27" level="2"><display>(f)</display>implementing an operating permit program as required by and in conformity with <ln numlevel="1" lineno="46" slineno="1-28"/>Titles IV and V of the federal Clean Air Act Amendments of 1990;</subsection><subsection ssid="2-null-16" dnum="g-o" numlevel="1" lineno="47" slineno="1-29" level="2"><display>(g)</display>establishing requirements for county emissions inspection and maintenance <ln numlevel="1" lineno="48" slineno="1-30"/>programs after obtaining agreement from the counties that would be affected by the <ln numlevel="1" lineno="49" slineno="1-31"/>requirements;</subsection><subsection ssid="2-null-17" dnum="h-o" numlevel="1" lineno="50" slineno="1-32" level="2"><display>(h)</display>with the approval of the governor, implementing in air quality nonattainment areas <ln numlevel="1" lineno="51" slineno="1-33"/>employer-based trip reduction programs applicable to businesses having more than <ln numlevel="1" lineno="52" slineno="1-34"/>100 employees at a single location and applicable to federal, state, and local <ln numlevel="1" lineno="53" slineno="1-35"/>governments to the extent necessary to attain and maintain ambient air quality <ln numlevel="1" lineno="54" slineno="1-36"/>standards consistent with the state implementation plan and federal requirements <ln numlevel="1" lineno="55" slineno="1-37"/>under the standards set forth in Subsection <xref depth="4" refnumber="19-2-104(2)" start="0">(2)</xref>;</subsection><subsection ssid="2-null-18" dnum="i-o" numlevel="1" lineno="56" slineno="1-38" level="2"><display>(i)</display>implementing lead-based paint training, certification, and performance requirements <ln numlevel="1" lineno="57" slineno="1-39"/>in accordance with 15 U.S.C. 2601 et seq., Toxic Substances Control Act, Subchapter <ln numlevel="1" lineno="58" slineno="1-40"/>IV -- Lead Exposure Reduction, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">Sections</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Secs.</amend> 402 and 406; and</subsection><subsection ssid="2-null-19" dnum="j-o" numlevel="1" lineno="59" slineno="1-41" level="2"><display>(j)</display>to implement the requirements of Section <xref depth="3" refnumber="19-2-107.5" start="0">19-2-107.5</xref>.</subsection></subsection><subsection ssid="2-null-20" dnum="2-o" numlevel="1" lineno="60" slineno="1-42" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">When</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">In</amend> implementing Subsection <xref depth="4" refnumber="19-2-104(1)(h)" start="0">(1)(h)</xref><amend anum="0" ea="amend" pairid="10" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> the board shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">take into consideration</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="61" slineno="1-43"/>consider</amend>:<subsection ssid="2-null-21" dnum="a-o" numlevel="1" lineno="62" slineno="1-44" level="2"><display>(a)</display>the impact of the business on overall air quality; and</subsection><subsection ssid="2-null-22" dnum="b-o" numlevel="1" lineno="63" slineno="1-45" level="2"><display>(b)</display>the need of the business to use automobiles in order to carry out<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both"> its</amend><amendoutend style="2"/> business <ln numlevel="1" lineno="64" slineno="1-46"/>purposes.</subsection></subsection><subsection ssid="2-null-23" dnum="3-o" numlevel="1" lineno="65" slineno="1-47" level="1" space="false"><display>(3)</display><subsection ssid="2-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board may:<subsection ssid="2-null-25" dnum="i-o" numlevel="1" lineno="66" slineno="1-48" level="3" tab="1"><display>(i)</display>hold a hearing that is not an adjudicative proceeding relating to any aspect of, or <ln numlevel="1" lineno="67" slineno="1-49"/>matter in, the administration of this chapter;</subsection><subsection ssid="2-null-26" dnum="ii-o" numlevel="1" lineno="68" slineno="1-50" level="3" tab="1"><display>(ii)</display>recommend that the director:<subsection ssid="2-null-27" dnum="A-o" numlevel="1" lineno="69" slineno="1-51" level="4"><display>(A)</display>issue orders necessary to enforce the provisions of this chapter;</subsection><subsection ssid="2-null-28" dnum="B-o" numlevel="1" lineno="70" slineno="1-52" level="4"><display>(B)</display>enforce the orders by appropriate administrative and judicial proceedings;</subsection><subsection ssid="2-null-29" dnum="C-o" numlevel="1" lineno="71" slineno="1-53" level="4"><display>(C)</display>institute judicial proceedings to secure compliance with this chapter; or</subsection><subsection ssid="2-null-30" dnum="D-o" numlevel="1" lineno="72" slineno="1-54" level="4"><display>(D)</display>advise, consult, contract, and cooperate with other agencies of the state, local <ln numlevel="1" lineno="73" slineno="1-55"/>governments, industries, other states, interstate or interlocal agencies, the <ln numlevel="1" lineno="74" slineno="1-56"/>federal government, or interested persons or groups; and</subsection></subsection><subsection ssid="2-null-31" dnum="iii-o" numlevel="1" lineno="75" slineno="1-57" level="3" tab="1"><display>(iii)</display>establish certification requirements for asbestos project monitors, which shall <ln numlevel="1" lineno="76" slineno="1-58"/>provide for experience-based certification of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an individual</amend> who:<subsection ssid="2-null-32" dnum="A-o" numlevel="1" lineno="77" slineno="1-59" level="4"><display>(A)</display>receives relevant asbestos training, as defined by rule; and</subsection><subsection ssid="2-null-33" dnum="B-o" numlevel="1" lineno="78" slineno="1-60" level="4"><display>(B)</display>has acquired a minimum of 1,000 hours of asbestos project monitoring related <ln numlevel="1" lineno="79" slineno="1-61"/>work experience.</subsection></subsection></subsection><subsection ssid="2-null-34" dnum="b-o" numlevel="1" lineno="80" slineno="1-62" level="2"><display>(b)</display>The board shall:<subsection ssid="2-null-35" dnum="i-o" numlevel="1" lineno="81" slineno="1-63" level="3"><display>(i)</display>to ensure compliance with applicable statutes and regulations:<subsection ssid="2-null-36" dnum="A-o" numlevel="1" lineno="82" slineno="1-64" level="4"><display>(A)</display>review a settlement negotiated by the director in accordance with Subsection <xref depth="4" refnumber="19-2-107(2)(b)(viii)" start="0"><ln numlevel="1" lineno="83" slineno="1-65"/>19-2-107(2)(b)(viii)</xref> that requires a civil penalty of $25,000 or more; and</subsection><subsection ssid="2-null-37" dnum="B-o" numlevel="1" lineno="84" slineno="1-66" level="4"><display>(B)</display>approve or disapprove the settlement;</subsection></subsection><subsection ssid="2-null-38" dnum="ii-o" numlevel="1" lineno="85" slineno="1-67" level="3"><display>(ii)</display>encourage voluntary cooperation by persons and affected groups to achieve the <ln numlevel="1" lineno="86" slineno="1-68"/>purposes of this chapter;</subsection><subsection ssid="2-null-39" dnum="iii-o" numlevel="1" lineno="87" slineno="1-69" level="3"><display>(iii)</display>meet the requirements of federal air pollution laws;</subsection><subsection ssid="2-null-40" dnum="iv-o" numlevel="1" lineno="88" slineno="1-70" level="3"><display>(iv)</display>by rule made in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="89" slineno="1-71"/>Rulemaking Act, establish work practice and certification requirements for <ln numlevel="1" lineno="90" slineno="1-72"/>persons <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend>:<subsection ssid="2-null-41" dnum="A-o" numlevel="1" lineno="91" slineno="1-73" level="4"><display>(A)</display>contract for hire to conduct demolition, renovation, salvage, encapsulation <ln numlevel="1" lineno="92" slineno="1-74"/>work involving friable asbestos-containing materials, or asbestos inspections if:<subsection ssid="2-null-42" dnum="I-o" numlevel="1" lineno="93" slineno="1-75" level="5"><display>(I)</display>the contract work is done on a site other than a residential property with <ln numlevel="1" lineno="94" slineno="1-76"/>four or fewer units; or</subsection><subsection ssid="2-null-43" dnum="II-o" numlevel="1" lineno="95" slineno="1-77" level="5"><display>(II)</display>the contract work is done on a residential property with four or fewer units <ln numlevel="1" lineno="96" slineno="1-78"/>where a tested sample contained greater than 1% of asbestos;</subsection></subsection><subsection ssid="2-null-44" dnum="B-o" numlevel="1" lineno="97" slineno="1-79" level="4"><display>(B)</display>conduct work described in Subsection <xref depth="4" refnumber="19-2-104(3)(b)(iv)(A)" start="0">(3)(b)(iv)(A)</xref> in areas to which the <ln numlevel="1" lineno="98" slineno="1-80"/>general public has unrestrained access or in school buildings that are subject to <ln numlevel="1" lineno="99" slineno="1-81"/>the federal Asbestos Hazard Emergency Response Act of 1986;</subsection><subsection ssid="2-null-45" dnum="C-o" numlevel="1" lineno="100" slineno="1-82" level="4"><display>(C)</display>conduct asbestos inspections in facilities subject to 15 U.S.C. 2601 et seq., <ln numlevel="1" lineno="101" slineno="1-83"/>Toxic Substances Control Act, Subchapter II - Asbestos Hazard Emergency <ln numlevel="1" lineno="102" slineno="1-84"/>Response; or</subsection><subsection ssid="2-null-46" dnum="D-o" numlevel="1" lineno="103" slineno="1-85" level="4"><display>(D)</display>conduct lead-based paint inspections in facilities subject to 15 U.S.C. 2601 et <ln numlevel="1" lineno="104" slineno="1-86"/>seq., Toxic Substances Control Act, Subchapter IV -- Lead Exposure <ln numlevel="1" lineno="105" slineno="1-87"/>Reduction;</subsection></subsection><subsection ssid="2-null-47" dnum="v-o" numlevel="1" lineno="106" slineno="1-88" level="3"><display>(v)</display>establish certification requirements for a person required under 15 U.S.C. 2601 et <ln numlevel="1" lineno="107" slineno="1-89"/>seq., Toxic Substances Control Act, Subchapter II - Asbestos Hazard Emergency <ln numlevel="1" lineno="108" slineno="1-90"/>Response, to be accredited as an inspector, management planner, abatement <ln numlevel="1" lineno="109" slineno="1-91"/>project designer, asbestos abatement contractor and supervisor, or an asbestos <ln numlevel="1" lineno="110" slineno="1-92"/>abatement worker;</subsection><subsection ssid="2-null-48" dnum="vi-o" numlevel="1" lineno="111" slineno="1-93" level="3"><display>(vi)</display>establish certification requirements for a person required under 15 U.S.C. 2601 et <ln numlevel="1" lineno="112" slineno="1-94"/>seq., Toxic Control Act, Subchapter IV - Lead Exposure Reduction, to be <ln numlevel="1" lineno="113" slineno="1-95"/>accredited as an inspector, risk assessor, supervisor, project designer, abatement <ln numlevel="1" lineno="114" slineno="1-96"/>worker, renovator, or dust sampling technician; and</subsection><subsection ssid="2-null-49" dnum="vii-o" numlevel="1" lineno="115" slineno="1-97" level="3"><display>(vii)</display>assist the State Board of Education in adopting school bus idling reduction <ln numlevel="1" lineno="116" slineno="1-98"/>standards and implementing an idling reduction program in accordance with <ln numlevel="1" lineno="117" slineno="1-99"/>Section <xref depth="3" refnumber="41-6a-1308" start="0">41-6a-1308</xref>.</subsection></subsection></subsection><subsection ssid="2-null-50" dnum="4-o" numlevel="1" lineno="118" slineno="1-100" level="1"><display>(4)</display>A rule adopted under this chapter shall be consistent with provisions of federal laws, if <ln numlevel="1" lineno="119" slineno="1-101"/>any, relating to control of motor vehicles or motor vehicle emissions.</subsection><subsection ssid="2-null-51" dnum="5-o" numlevel="1" lineno="120" slineno="1-102" level="1"><display>(5)</display>Nothing in this chapter authorizes the board to require installation of or payment for any <ln numlevel="1" lineno="121" slineno="1-103"/>monitoring equipment by the owner or operator of a source if the owner or operator has <ln numlevel="1" lineno="122" slineno="1-104"/>installed or is operating monitoring equipment that is equivalent to equipment which the <ln numlevel="1" lineno="123" slineno="1-105"/>board would require under this section.</subsection><subsection ssid="2-null-52" dnum="6-o" numlevel="1" lineno="124" slineno="1-106" level="1" space="false"><display>(6)</display><subsection ssid="2-null-53" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>The board may not require testing for asbestos or related materials on a <ln numlevel="1" lineno="125" slineno="1-107"/>residential property<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both"> with four or fewer units,</amend><amendoutend style="2"/> unless:<subsection ssid="2-null-54" dnum="i-o:a-i" numlevel="1" lineno="126" slineno="1-108" level="2" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>the property's construction was completed before January 1, 1981; or</subsection><subsection ssid="2-72" dnum="_-o:b-i" numlevel="1" lineno="127" slineno="1-109" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" tab="1" space="false"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="2-73" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">the property's construction was completed between January 1, 1981, and <ln numlevel="1" lineno="128" slineno="1-110"/>January 1, 1991; and</amend></subsection><subsection ssid="2-null-55" dnum="ii-o" numlevel="1" lineno="129" slineno="1-111" level="3"><display>(ii)</display>the testing is for:<subsection ssid="2-null-56" dnum="A-o" numlevel="1" lineno="130" slineno="1-112" level="4"><display>(A)</display>a sprayed-on or painted on ceiling treatment that contained or may contain <ln numlevel="1" lineno="131" slineno="1-113"/>asbestos fiber;</subsection><subsection ssid="2-null-57" dnum="B-o" numlevel="1" lineno="132" slineno="1-114" level="4"><display>(B)</display>asbestos cement siding or roofing materials;</subsection><subsection ssid="2-null-58" dnum="C-o" numlevel="1" lineno="133" slineno="1-115" level="4"><display>(C)</display>resilient flooring products including vinyl asbestos tile, sheet vinyl products, <ln numlevel="1" lineno="134" slineno="1-116"/>resilient flooring backing material, whether attached or unattached, and mastic;</subsection><subsection ssid="2-null-59" dnum="D-o" numlevel="1" lineno="135" slineno="1-117" level="4"><display>(D)</display>thermal-system insulation or tape on a duct or furnace; or</subsection><subsection ssid="2-null-60" dnum="E-o" numlevel="1" lineno="136" slineno="1-118" level="4"><display>(E)</display>vermiculite type insulation materials.</subsection></subsection></subsection></subsection></subsection><subsection ssid="2-null-61" dnum="b-o:7-i" numlevel="1" lineno="137" slineno="1-119" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1062" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>A residential property with four or fewer units is subject to an abatement rule made <ln numlevel="1" lineno="138" slineno="1-120"/>under Subsection <xref depth="4" refnumber="19-2-104(1)" start="0">(1)</xref> or <xref depth="4" refnumber="19-2-104(3)(b)(iv)" start="0">(3)(b)(iv)</xref> if:<subsection ssid="2-null-62" dnum="i-o:a-i" numlevel="1" lineno="139" slineno="1-121" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>a sample from the property is tested for asbestos; and</subsection><subsection ssid="2-null-63" dnum="ii-o:b-i" numlevel="1" lineno="140" slineno="1-122" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>the sample contains asbestos measuring greater than 1%.</subsection></subsection><subsection ssid="2-null-64" dnum="7-o:8-i" numlevel="1" lineno="141" slineno="1-123" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>The board may not issue, amend, renew, modify, revoke, or terminate any of the <ln numlevel="1" lineno="142" slineno="1-124"/>following that are subject to the authority granted to the director under Section <xref depth="3" refnumber="19-2-107" start="0">19-2-107</xref> <ln numlevel="1" lineno="143" slineno="1-125"/>or <xref depth="3" refnumber="19-2-108" start="0">19-2-108</xref>:<subsection ssid="2-null-65" dnum="a-o" numlevel="1" lineno="144" slineno="1-126" level="2"><display>(a)</display>a permit;</subsection><subsection ssid="2-null-66" dnum="b-o" numlevel="1" lineno="145" slineno="1-127" level="2"><display>(b)</display>a license;</subsection><subsection ssid="2-null-67" dnum="c-o" numlevel="1" lineno="146" slineno="1-128" level="2"><display>(c)</display>a registration;</subsection><subsection ssid="2-null-68" dnum="d-o" numlevel="1" lineno="147" slineno="1-129" level="2"><display>(d)</display>a certification; or</subsection><subsection ssid="2-null-69" dnum="e-o" numlevel="1" lineno="148" slineno="1-130" level="2"><display>(e)</display>another administrative authorization made by the director.</subsection></subsection><subsection ssid="2-null-70" dnum="8-o:9-i" numlevel="1" lineno="149" slineno="1-131" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1071" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>A board member may not speak or act for the board unless the board member is <ln numlevel="1" lineno="150" slineno="1-132"/>authorized by a majority of a quorum of the board in a vote taken at a meeting of the <ln numlevel="1" lineno="151" slineno="1-133"/>board.</subsection><subsection ssid="2-null-71" dnum="9-o:10-i" numlevel="1" lineno="152" slineno="1-134" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>Notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="19-2-104(7)" start="0">(7)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)</amend>, the board may exercise all authority granted <ln numlevel="1" lineno="153" slineno="1-135"/>to the board by a federally enforceable state implementation plan.</subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="154" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="154">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="155"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-18-26 9:32 AM</tm></rev></foot></leg>
