Kohler</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to the incorporation of a preliminary municipality.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that:<hl numlevel="1" lineno="9" slineno="0-9" level="2">a person may not apply to incorporate an area as a preliminary municipality after <ln numlevel="1" lineno="10" slineno="0-10"/>February 1, 2026; and</hl><hl numlevel="1" lineno="11" slineno="0-11" level="2">a person who applies to incorporate an area as a preliminary municipality by filing a <ln numlevel="1" lineno="12" slineno="0-12"/>feasibility request on or before February 1, 2026, may proceed in accordance with <ln numlevel="1" lineno="13" slineno="0-13"/>Title 10, Chapter 2a, Part 5, Incorporation of a Preliminary Municipality, after <ln numlevel="1" lineno="14" slineno="0-14"/>February 1, 2026;</hl></hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">requires:<hl numlevel="1" lineno="16" slineno="0-16" level="2">a proposed preliminary municipality to agree that initial landowners will fully <ln numlevel="1" lineno="17" slineno="0-17"/>compensate the county for damages to county property or infrastructure before the <ln numlevel="1" lineno="18" slineno="0-18"/>preliminary municipality can transition into a town;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="2">a preliminary municipality to comply with terms, conditions, or restrictions that were <ln numlevel="1" lineno="20" slineno="0-20"/>established in a development agreement between the initial landowners and the <ln numlevel="1" lineno="21" slineno="0-21"/>county before the feasibility request was filed; and</hl><hl numlevel="1" lineno="22" slineno="0-22" level="2">that a petition to transition a preliminary municipality into a town shall certify that <ln numlevel="1" lineno="23" slineno="0-23"/>damages to county property or infrastructure have been paid in full; and</hl></hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="25" slineno="0-25" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="26">None</moniNone><oc numlevel="1" lineno="27" slineno="0-27">Other Special Clauses:<ocl type="retro" sort="7" numlevel="1" lineno="28" slineno="0-28">This bill provides retrospective operation.</ocl></oc><sa numlevel="1" lineno="29" slineno="0-29">Utah Code Sections Affected:<saamd numlevel="1" lineno="30" slineno="0-30"><snhead>AMENDS:</snhead><sn num="10-2a-502" src="code" uid="C10-2a-S502_2026050620260506" buid="2" sort="10 02a05020020260506" numlevel="1" lineno="31" slineno="0-31"><bold>10-2a-502</bold>, as enacted by Laws of Utah 2024, Chapter 534</sn><sn num="10-2a-507" src="code" uid="C10-2a-S507_2026050620260506" buid="4" sort="10 02a05070020260506" numlevel="1" lineno="32" slineno="0-32"><bold>10-2a-507</bold>, as enacted by Laws of Utah 2024, Chapter 534</sn><sn num="10-2a-509" src="code" uid="C10-2a-S509_2026050620260506" buid="5" sort="10 02a05090020260506" numlevel="1" lineno="33" slineno="0-33"><bold>10-2a-509</bold>, as enacted by Laws of Utah 2024, Chapter 534</sn><sn num="10-2a-510" src="code" uid="C10-2a-S510_2026050620260506" buid="6" sort="10 02a05100020260506" numlevel="1" lineno="34" slineno="0-34"><bold>10-2a-510</bold>, as enacted by Laws of Utah 2024, Chapter 534</sn></saamd></sa></lt><enacthead lineno="35"/><enact numlevel="1" lineno="36" slineno="0-36">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="2" num="10-2a-502" type="amend" src="code" uid="C10-2a-S502_2026050620260506" sort="10 02a05020020260506" numlevel="1" lineno="37" slineno="1-1" sn="1"><section number="10-2a-502" numlevel="1" lineno="38" slineno="1-2" type="amend"><secline lineno="37">Section 1. Section <bold>10-2a-502</bold> is amended to read:</secline><catline lineno="38"><bold>10-2a-502<parens/>. Incorporation of a preliminary municipality --  Feasibility request -- <ln numlevel="1" lineno="39" slineno="1-3"/>Requirements.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-52" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">A </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="10-2a-502(1)(b)">(1)(b)</xref>, a </amend>person may apply to incorporate an <ln numlevel="1" lineno="41" slineno="1-5"/>area as a preliminary municipality by filing a feasibility request in accordance with <ln numlevel="1" lineno="42" slineno="1-6"/>this section.</subsection><subsection ssid="2-53" dnum="_-o:b-i" numlevel="1" lineno="43" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not file a feasibility request to incorporate an area as a preliminary <ln numlevel="1" lineno="44" slineno="1-8"/>municipality after February 1, 2026.</amend></subsection><subsection ssid="2-54" dnum="_-o:c-i" numlevel="1" lineno="45" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="10-2a-502(6)(b)">(6)(b)</xref>, a person who, on or before February 1, 2026, files a <ln numlevel="1" lineno="46" slineno="1-10"/>feasibility request under this section may:</amend><subsection ssid="2-55" dnum="_-o:i-i" numlevel="1" lineno="47" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">modify the request after February 1, 2026, in accordance with Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>; <ln numlevel="1" lineno="48" slineno="1-12"/>or</amend></subsection><subsection ssid="2-56" dnum="_-o:ii-i" numlevel="1" lineno="49" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">proceed in accordance with this part after February 1, 2026.</amend></subsection></subsection></subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="50" slineno="1-14" level="1"><display>(2)</display>Subject to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">Subsection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <xref depth="4" refnumber="10-2a-502(1)">(1)</xref> and</amend> <xref depth="4" refnumber="10-2a-502(6)">(6)</xref>, a person may file a feasibility request in <ln numlevel="1" lineno="51" slineno="1-15"/>relation to an area that the person seeks to incorporate as a preliminary municipality if:<subsection ssid="2-null-3" dnum="a-o" numlevel="1" lineno="52" slineno="1-16" level="2"><display>(a)</display>the area is contiguous;</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="53" slineno="1-17" level="2"><display>(b)</display>no part of the area is within a county of the first class or second class;</subsection><subsection ssid="2-null-5" dnum="c-o" numlevel="1" lineno="54" slineno="1-18" level="2"><display>(c)</display>no part of the area is within, or within .25 miles of, a municipality;</subsection><subsection ssid="2-null-6" dnum="d-o" numlevel="1" lineno="55" slineno="1-19" level="2"><display>(d)</display>on the day on which the person files the feasibility request:<subsection ssid="2-null-7" dnum="i-o" numlevel="1" lineno="56" slineno="1-20" level="3"><display>(i)</display>the area is owned by no more than three persons, all of whom consent to <ln numlevel="1" lineno="57" slineno="1-21"/>incorporation as a preliminary municipality; and</subsection><subsection ssid="2-null-8" dnum="ii-o" numlevel="1" lineno="58" slineno="1-22" level="3"><display>(ii)</display>at least 50% of the area is undeveloped;</subsection></subsection><subsection ssid="2-null-9" dnum="e-o" numlevel="1" lineno="59" slineno="1-23" level="2"><display>(e)</display>the persons who sign the feasibility request intend to develop the area to the point <ln numlevel="1" lineno="60" slineno="1-24"/>that:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="61" slineno="1-25" level="3"><display>(i)</display>at least 100 individuals reside in the area;</subsection><subsection ssid="2-null-11" dnum="ii-o" numlevel="1" lineno="62" slineno="1-26" level="3"><display>(ii)</display>the area will have an average population density of no less than seven individuals <ln numlevel="1" lineno="63" slineno="1-27"/>per square mile, unless:<subsection ssid="2-null-12" dnum="A-o" numlevel="1" lineno="64" slineno="1-28" level="4"><display>(A)</display>a population density of less than seven individuals per square mile is <ln numlevel="1" lineno="65" slineno="1-29"/>necessary in order to connect separate areas that share a demonstrable <ln numlevel="1" lineno="66" slineno="1-30"/>community interest; and</subsection><subsection ssid="2-null-13" dnum="B-o" numlevel="1" lineno="67" slineno="1-31" level="4"><display>(B)</display>the average population of the area has a population density of no less than <ln numlevel="1" lineno="68" slineno="1-32"/>seven individuals per square mile if the land necessary to connect the separate <ln numlevel="1" lineno="69" slineno="1-33"/>areas described in Subsection <xref depth="4" refnumber="10-2a-502(2)(e)(ii)(a)">(2)(e)(ii)(A)</xref> is not included in the calculation; <ln numlevel="1" lineno="70" slineno="1-34"/>and</subsection></subsection><subsection ssid="2-null-14" dnum="iii-o" numlevel="1" lineno="71" slineno="1-35" level="3"><display>(iii)</display>at least 10% of the housing in the preliminary municipality is affordable housing;</subsection></subsection><subsection ssid="2-null-15" dnum="f-o" numlevel="1" lineno="72" slineno="1-36" level="2"><display>(f)</display>the area does not include land owned by the United States government unless:<subsection ssid="2-null-16" dnum="i-o" numlevel="1" lineno="73" slineno="1-37" level="3"><display>(i)</display>the area, including the land owned by the United States government, is <ln numlevel="1" lineno="74" slineno="1-38"/>contiguous; and</subsection><subsection ssid="2-null-17" dnum="ii-o" numlevel="1" lineno="75" slineno="1-39" level="3" space="false"><display>(ii)</display><subsection ssid="2-null-18" dnum="A-o" level="4" placement="sameline"><display>(A)</display>incorporating the land is necessary to connect separate areas that share a <ln numlevel="1" lineno="76" slineno="1-40"/>demonstrable community interest; or</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="77" slineno="1-41" level="4"><display>(B)</display>excluding the land from the area would create an unincorporated island within <ln numlevel="1" lineno="78" slineno="1-42"/>the proposed preliminary municipality;</subsection></subsection></subsection><subsection ssid="2-null-20" dnum="g-o" numlevel="1" lineno="79" slineno="1-43" level="2"><display>(g)</display>the area is entirely within one county; and</subsection><subsection ssid="2-null-21" dnum="h-o" numlevel="1" lineno="80" slineno="1-44" level="2"><display>(h)</display>the feasibility request complies with Subsection <xref depth="4" refnumber="10-2a-502(3)">(3)</xref>.</subsection></subsection><subsection ssid="2-null-22" dnum="3-o" numlevel="1" lineno="81" slineno="1-45" level="1" space="false"><display>(3)</display><subsection ssid="2-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A proposed preliminary municipality area may not include all or part of a pending <ln numlevel="1" lineno="82" slineno="1-46"/>annexation area, unless:<subsection ssid="2-null-24" dnum="i-o" numlevel="1" lineno="83" slineno="1-47" level="3" tab="1"><display>(i)</display>the portion of the pending annexation area included in the proposed preliminary <ln numlevel="1" lineno="84" slineno="1-48"/>municipality area does not exceed 20% of the proposed preliminary municipality <ln numlevel="1" lineno="85" slineno="1-49"/>area; and</subsection><subsection ssid="2-null-25" dnum="ii-o" numlevel="1" lineno="86" slineno="1-50" level="3" tab="1"><display>(ii)</display>the feasibility request would comply with the requirements of this section <ln numlevel="1" lineno="87" slineno="1-51"/>regardless of whether the portion of the pending annexation area included in the <ln numlevel="1" lineno="88" slineno="1-52"/>proposed preliminary municipality area is excluded from, or remains included in, <ln numlevel="1" lineno="89" slineno="1-53"/>the proposed preliminary municipality area.</subsection></subsection><subsection ssid="2-null-26" dnum="b-o" numlevel="1" lineno="90" slineno="1-54" level="2"><display>(b)</display>A proposed preliminary municipality area may not include all or part of an area that <ln numlevel="1" lineno="91" slineno="1-55"/>is the subject of a completed feasibility study or supplemental feasibility study that <ln numlevel="1" lineno="92" slineno="1-56"/>qualifies to proceed under Subsection <xref depth="4" refnumber="10-2a-205(5)(a)">10-2a-205(5)(a)</xref>, unless:<subsection ssid="2-null-27" dnum="i-o" numlevel="1" lineno="93" slineno="1-57" level="3"><display>(i)</display>the proposed incorporation that is the subject of the completed feasibility study or <ln numlevel="1" lineno="94" slineno="1-58"/>supplemental feasibility study has been defeated by the voters at an election under <ln numlevel="1" lineno="95" slineno="1-59"/>Section <xref depth="3" refnumber="10-2a-210">10-2a-210</xref>; or</subsection><subsection ssid="2-null-28" dnum="ii-o" numlevel="1" lineno="96" slineno="1-60" level="3"><display>(ii)</display>the time described in Subsection <xref depth="4" refnumber="10-2a-208(1)">10-2a-208(1)</xref> for filing an incorporation petition <ln numlevel="1" lineno="97" slineno="1-61"/>based on the completed feasibility study or supplemental feasibility study has <ln numlevel="1" lineno="98" slineno="1-62"/>elapsed without the sponsors filing an incorporation petition under Section <xref depth="3" refnumber="10-2a-208"><ln numlevel="1" lineno="99" slineno="1-63"/>10-2a-208</xref>.</subsection></subsection><subsection ssid="2-null-29" dnum="c-o" numlevel="1" lineno="100" slineno="1-64" level="2"><display>(c)</display>A proposed preliminary municipality area may not include all or part of an area that <ln numlevel="1" lineno="101" slineno="1-65"/>is the subject of a completed feasibility study or supplemental feasibility study whose <ln numlevel="1" lineno="102" slineno="1-66"/>results comply with Subsection <xref depth="4" refnumber="10-2a-504(4)">10-2a-504(4)</xref>, unless the time described in Subsection <xref depth="4" refnumber="10-2a-507(1)"><ln numlevel="1" lineno="103" slineno="1-67"/>10-2a-507(1)</xref> for filing a petition for incorporation based on the completed feasibility <ln numlevel="1" lineno="104" slineno="1-68"/>study or supplemental feasibility study has elapsed without the sponsors filing a <ln numlevel="1" lineno="105" slineno="1-69"/>petition for incorporation under Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>.</subsection></subsection><subsection ssid="2-null-30" dnum="4-o" numlevel="1" lineno="106" slineno="1-70" level="1"><display>(4)</display>Except as provided in Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, the lieutenant governor shall consider each <ln numlevel="1" lineno="107" slineno="1-71"/>feasibility request that includes an area described in Subsection <xref depth="4" refnumber="10-2a-502(3)(a)">(3)(a)</xref> as if the request <ln numlevel="1" lineno="108" slineno="1-72"/>does not include the area described in Subsection <xref depth="4" refnumber="10-2a-502(3)(a)">(3)(a)</xref>.</subsection><subsection ssid="2-null-31" dnum="5-o" numlevel="1" lineno="109" slineno="1-73" level="1"><display>(5)</display>A person who files a feasibility request under this section shall file the feasibility <ln numlevel="1" lineno="110" slineno="1-74"/>request with the lieutenant governor, including in the feasibility request:<subsection ssid="2-null-32" dnum="a-o" numlevel="1" lineno="111" slineno="1-75" level="2"><display>(a)</display>the signatures of all owners of real property included in the proposed preliminary <ln numlevel="1" lineno="112" slineno="1-76"/>municipality area, showing that the owners consent to including the real property in <ln numlevel="1" lineno="113" slineno="1-77"/>the proposed preliminary municipality area;</subsection><subsection ssid="2-null-33" dnum="b-o" numlevel="1" lineno="114" slineno="1-78" level="2"><display>(b)</display>the name, address, and phone number of each owner signing the feasibility request;</subsection><subsection ssid="2-null-34" dnum="c-o" numlevel="1" lineno="115" slineno="1-79" level="2"><display>(c)</display>a designation of one individual who signs the feasibility request as the primary <ln numlevel="1" lineno="116" slineno="1-80"/>sponsor contact for the feasibility request;</subsection><subsection ssid="2-null-35" dnum="d-o" numlevel="1" lineno="117" slineno="1-81" level="2"><display>(d)</display>a description of the proposed preliminary municipality area;</subsection><subsection ssid="2-null-36" dnum="e-o" numlevel="1" lineno="118" slineno="1-82" level="2"><display>(e)</display>an accurate map or plat, prepared by a licensed surveyor, showing:<subsection ssid="2-null-37" dnum="i-o" numlevel="1" lineno="119" slineno="1-83" level="3"><display>(i)</display>a legal description of the boundaries of the proposed preliminary municipality area <ln numlevel="1" lineno="120" slineno="1-84"/>and each phase of the proposed preliminary municipality area;</subsection><subsection ssid="2-null-38" dnum="ii-o" numlevel="1" lineno="121" slineno="1-85" level="3"><display>(ii)</display>all development planned for the proposed preliminary municipality area; and</subsection><subsection ssid="2-null-39" dnum="iii-o" numlevel="1" lineno="122" slineno="1-86" level="3"><display>(iii)</display>that the first phase of the proposed preliminary municipality area is projected to <ln numlevel="1" lineno="123" slineno="1-87"/>have at least 100 residents when completed; and</subsection></subsection><subsection ssid="2-null-40" dnum="f-o" numlevel="1" lineno="124" slineno="1-88" level="2"><display>(f)</display>a request that the lieutenant governor commission a study to determine the feasibility <ln numlevel="1" lineno="125" slineno="1-89"/>of incorporating the area as a preliminary municipality.</subsection></subsection><subsection ssid="2-null-41" dnum="6-o" numlevel="1" lineno="126" slineno="1-90" level="1" space="false"><display>(6)</display><subsection ssid="2-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The provisions of this part, providing for the incorporation of a preliminary <ln numlevel="1" lineno="127" slineno="1-91"/>municipality, is a pilot project that ends on January 1, 2031.</subsection><subsection ssid="2-null-43" dnum="b-o" numlevel="1" lineno="128" slineno="1-92" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2a-502(7)">(7)</xref>, a person may not file a feasibility request <ln numlevel="1" lineno="129" slineno="1-93"/>under this part in a calendar year during which two or more requests have already <ln numlevel="1" lineno="130" slineno="1-94"/>been filed in the state.</subsection></subsection><subsection ssid="2-null-44" dnum="7-o" numlevel="1" lineno="131" slineno="1-95" level="1"><display>(7)</display>A feasibility request does not count towards the limit described in Subsection <xref depth="4" refnumber="10-2a-502(6)(b)">(6)(b)</xref> if:<subsection ssid="2-null-45" dnum="a-o" numlevel="1" lineno="132" slineno="1-96" level="2"><display>(a)</display>the sponsors who file the request withdraw the request;</subsection><subsection ssid="2-null-46" dnum="b-o" numlevel="1" lineno="133" slineno="1-97" level="2"><display>(b)</display>the lieutenant governor rejects the feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(4)">10-2a-503(4)</xref> <ln numlevel="1" lineno="134" slineno="1-98"/>or <xref depth="4" refnumber="10-2a-502(5)(b)">(5)(b)</xref>, and the sponsors:<subsection ssid="2-null-47" dnum="i-o" numlevel="1" lineno="135" slineno="1-99" level="3"><display>(i)</display>do not timely amend the feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(7)(b)">10-2a-503(7)(b)</xref>; or</subsection><subsection ssid="2-null-48" dnum="ii-o" numlevel="1" lineno="136" slineno="1-100" level="3"><display>(ii)</display>are prohibited from amending the feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(7)(c)"><ln numlevel="1" lineno="137" slineno="1-101"/>10-2a-503(7)(c)</xref>; or</subsection></subsection><subsection ssid="2-null-49" dnum="c-o" numlevel="1" lineno="138" slineno="1-102" level="2"><display>(c)</display>the process to incorporate is prohibited from proceeding under Subsection <xref depth="4" refnumber="10-2a-504(5)(a)"><ln numlevel="1" lineno="139" slineno="1-103"/>10-2a-504(5)(a)</xref> and the sponsors:<subsection ssid="2-null-50" dnum="i-o" numlevel="1" lineno="140" slineno="1-104" level="3"><display>(i)</display>do not timely file a modified feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(1)(b)(i)"><ln numlevel="1" lineno="141" slineno="1-105"/>10-2a-505(1)(b)(i)</xref>; or</subsection><subsection ssid="2-null-51" dnum="ii-o" numlevel="1" lineno="142" slineno="1-106" level="3"><display>(ii)</display>are prohibited from filing a modified feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(3)"><ln numlevel="1" lineno="143" slineno="1-107"/>10-2a-505(3)</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="4" num="10-2a-507" type="amend" src="code" uid="C10-2a-S507_2026050620260506" sort="10 02a05070020260506" numlevel="1" lineno="144" slineno="2-1" sn="2"><section number="10-2a-507" numlevel="1" lineno="145" slineno="2-2" type="amend"><secline lineno="144">Section 2. Section <bold>10-2a-507</bold> is amended to read:</secline><catline lineno="145"><bold>10-2a-507<parens/>. Petition for incorporation -- Requirements and form.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="146" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>At any time within one year after the day on which the lieutenant governor completes <ln numlevel="1" lineno="147" slineno="2-4"/>the public hearings required under Section <xref depth="3" refnumber="10-2a-506">10-2a-506</xref>, the owners of the property who <ln numlevel="1" lineno="148" slineno="2-5"/>filed the feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref> for the proposed preliminary <ln numlevel="1" lineno="149" slineno="2-6"/>municipality area may proceed with the incorporation process by filing a petition for <ln numlevel="1" lineno="150" slineno="2-7"/>incorporation of the proposed preliminary municipality that:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="151" slineno="2-8" level="2"><display>(a)</display>includes the typed or printed name, signature, address, and phone number of the <ln numlevel="1" lineno="152" slineno="2-9"/>initial landowners;</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="153" slineno="2-10" level="2"><display>(b)</display>describes the proposed preliminary municipality area, as described in the feasibility <ln numlevel="1" lineno="154" slineno="2-11"/>request or the modified feasibility request;</subsection><subsection ssid="4-null-4" dnum="c-o" numlevel="1" lineno="155" slineno="2-12" level="2"><display>(c)</display>demonstrates compliance with Subsection <xref depth="4" refnumber="10-2a-504(4)">10-2a-504(4)</xref>;</subsection><subsection ssid="4-null-5" dnum="d-o" numlevel="1" lineno="156" slineno="2-13" level="2"><display>(d)</display>states the proposed name for the proposed preliminary municipality;</subsection><subsection ssid="4-null-6" dnum="e-o" numlevel="1" lineno="157" slineno="2-14" level="2"><display>(e)</display>designates the primary sponsor contact for the proposed preliminary municipality;</subsection><subsection ssid="4-null-7" dnum="f-o" numlevel="1" lineno="158" slineno="2-15" level="2"><display>(f)</display>designates the board chair and three of the four board members who will serve as a <ln numlevel="1" lineno="159" slineno="2-16"/>five member council form of government for the preliminary municipality, described <ln numlevel="1" lineno="160" slineno="2-17"/>in Section <xref depth="3" refnumber="10-3b-402">10-3b-402</xref>, for the preliminary municipality;</subsection><subsection ssid="4-null-8" dnum="g-o" numlevel="1" lineno="161" slineno="2-18" level="2"><display>(g)</display>is accompanied by an accurate map or plat, prepared by a licensed surveyor, showing:<subsection ssid="4-null-9" dnum="i-o" numlevel="1" lineno="162" slineno="2-19" level="3"><display>(i)</display>the boundaries of the proposed preliminary municipality;<amend anum="0" ea="amend" pairid="25" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="4-null-10" dnum="ii-o" numlevel="1" lineno="163" slineno="2-20" level="3"><display>(ii)</display>a single development plan for the proposed municipality, depicting each phase of <ln numlevel="1" lineno="164" slineno="2-21"/>the development;</subsection></subsection><subsection ssid="4-null-11" dnum="h-o" numlevel="1" lineno="165" slineno="2-22" level="2"><display>(h)</display>is accompanied by a bond, cash deposit, or letter of credit that:<subsection ssid="4-null-12" dnum="i-o" numlevel="1" lineno="166" slineno="2-23" level="3"><display>(i)</display>is posted by the initial landowners;</subsection><subsection ssid="4-null-13" dnum="ii-o" numlevel="1" lineno="167" slineno="2-24" level="3"><display>(ii)</display>is in favor of the proposed preliminary municipality, to guarantee that the initial <ln numlevel="1" lineno="168" slineno="2-25"/>landowners will complete the system infrastructure no later than six years after the <ln numlevel="1" lineno="169" slineno="2-26"/>day on which the initial landowners file the petition for incorporation described in <ln numlevel="1" lineno="170" slineno="2-27"/>this section; and</subsection><subsection ssid="4-null-14" dnum="iii-o" numlevel="1" lineno="171" slineno="2-28" level="3"><display>(iii)</display>will be refunded to the initial landowners in percentages that reflect the progress <ln numlevel="1" lineno="172" slineno="2-29"/>toward completing the system infrastructure; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="4-null-15" dnum="i-o" numlevel="1" lineno="173" slineno="2-30" level="2"><display>(i)</display>is accompanied by payment in full, from the initial landowners, of the costs incurred <ln numlevel="1" lineno="174" slineno="2-31"/>by the lieutenant governor for the feasibility study, the public notices, the hearings, <ln numlevel="1" lineno="175" slineno="2-32"/>and the other expenses incurred by the lieutenant governor to comply with the <ln numlevel="1" lineno="176" slineno="2-33"/>requirements of this part in relation to the proposed preliminary municipality<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="4-22" dnum="_-o:j-i" numlevel="1" lineno="177" slineno="2-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">is accompanied by an agreement executed by the initial landowners providing that, <ln numlevel="1" lineno="178" slineno="2-35"/>before the preliminary municipality can transition into a town, the county will be <ln numlevel="1" lineno="179" slineno="2-36"/>fully compensated for any damages to county property or infrastructure that are <ln numlevel="1" lineno="180" slineno="2-37"/>directly attributable to development of the preliminary municipality area.</amend></subsection></subsection><subsection ssid="4-null-16" dnum="2-o" numlevel="1" lineno="181" slineno="2-38" level="1"><display>(2)</display>If, within six years after the day on which the initial landowners file a petition for <ln numlevel="1" lineno="182" slineno="2-39"/>incorporation under Subsection <xref depth="4" refnumber="10-2a-507(1)">(1)</xref>, the system infrastructure for the preliminary <ln numlevel="1" lineno="183" slineno="2-40"/>municipality is not completed, the portion of the bond, cash deposit, or letter of credit <ln numlevel="1" lineno="184" slineno="2-41"/>described in Subsection <xref depth="4" refnumber="10-2a-507(1)(h)">(1)(h)</xref> that has not been refunded to the initial landowners shall <ln numlevel="1" lineno="185" slineno="2-42"/>forfeit to the preliminary municipality.</subsection><subsection ssid="4-null-17" dnum="3-o" numlevel="1" lineno="186" slineno="2-43" level="1"><display>(3)</display>If, within four years after the day on which the first residential certificate of occupancy <ln numlevel="1" lineno="187" slineno="2-44"/>is issued for the development described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(5)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <xref depth="4" refnumber="10-2a-502(5)(d)"><ln numlevel="1" lineno="188" slineno="2-45"/>10-2a-502(5)(d)</xref> and <xref depth="4" refnumber="10-2a-507(e)">(e)</xref></amend>, or six years after the day on which the initial landowners file a <ln numlevel="1" lineno="189" slineno="2-46"/>petition for incorporation under Subsection <xref depth="4" refnumber="10-2a-507(1)">(1)</xref>, the preliminary municipality has not <ln numlevel="1" lineno="190" slineno="2-47"/>transitioned to a town:<subsection ssid="4-null-18" dnum="a-o" numlevel="1" lineno="191" slineno="2-48" level="2"><display>(a)</display>the lieutenant governor shall issue a certificate dissolving the preliminary <ln numlevel="1" lineno="192" slineno="2-49"/>municipality;</subsection><subsection ssid="4-null-19" dnum="b-o" numlevel="1" lineno="193" slineno="2-50" level="2"><display>(b)</display>all roads and infrastructure within the preliminary municipality revert to the county <ln numlevel="1" lineno="194" slineno="2-51"/>in which the preliminary municipality is located;</subsection><subsection ssid="4-null-20" dnum="c-o" numlevel="1" lineno="195" slineno="2-52" level="2"><display>(c)</display>the area within the proposed municipality falls under the jurisdiction of the county <ln numlevel="1" lineno="196" slineno="2-53"/>and is no longer incorporated; and</subsection><subsection ssid="4-null-21" dnum="d-o" numlevel="1" lineno="197" slineno="2-54" level="2"><display>(d)</display>the initial landowners are liable to the county for damages caused to the county due <ln numlevel="1" lineno="198" slineno="2-55"/>to the dissolution of the preliminary municipality.</subsection></subsection></section></bsec><bsec buid="5" num="10-2a-509" type="amend" src="code" uid="C10-2a-S509_2026050620260506" sort="10 02a05090020260506" numlevel="1" lineno="199" slineno="3-1" sn="3"><section number="10-2a-509" numlevel="1" lineno="200" slineno="3-2" type="amend"><secline lineno="199">Section 3. Section <bold>10-2a-509</bold> is amended to read:</secline><catline lineno="200"><bold>10-2a-509<parens/>. Governance of preliminary municipality -- Utilities -- Road <ln numlevel="1" lineno="201" slineno="3-3"/>maintenance. </bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="202" slineno="3-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 30 days after the day on which the lieutenant governor issues a certificate <ln numlevel="1" lineno="203" slineno="3-5"/>of incorporation described in Subsection <xref depth="4" refnumber="10-2a-508(1)(b)(i)">10-2a-508(1)(b)(i)</xref>, the county in which the <ln numlevel="1" lineno="204" slineno="3-6"/>preliminary municipality is located shall appoint one board member for the <ln numlevel="1" lineno="205" slineno="3-7"/>preliminary municipality.</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="206" slineno="3-8" level="2"><display>(b)</display>If the county fails to timely comply with Subsection <xref depth="4" refnumber="10-2a-509(1)(a)">(1)(a)</xref>, the board chair and the <ln numlevel="1" lineno="207" slineno="3-9"/>three board members appointed under Subsection <xref depth="4" refnumber="10-2a-508(1)(b)(i)">10-2a-508(1)(b)(i)</xref> shall, by <ln numlevel="1" lineno="208" slineno="3-10"/>majority vote, appoint the final board member.</subsection></subsection><subsection ssid="5-null-4" dnum="2-o" numlevel="1" lineno="209" slineno="3-11" level="1"><display>(2)</display>The board chair and board members, described in Subsection <xref depth="4" refnumber="10-2a-509(1)">(1)</xref>, of a preliminary <ln numlevel="1" lineno="210" slineno="3-12"/>municipality:<subsection ssid="5-null-5" dnum="a-o" numlevel="1" lineno="211" slineno="3-13" level="2"><display>(a)</display>are not required to be residents of the preliminary municipality; and</subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="212" slineno="3-14" level="2"><display>(b)</display>shall serve as the board for the preliminary municipality until replaced by election <ln numlevel="1" lineno="213" slineno="3-15"/>under Section <xref depth="3" refnumber="10-2a-510">10-2a-510</xref>.</subsection></subsection><subsection ssid="5-null-7" dnum="3-o" numlevel="1" lineno="214" slineno="3-16" level="1" space="false"><display>(3)</display><subsection ssid="5-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 14 days after the day on which the first residential certificate of occupancy <ln numlevel="1" lineno="215" slineno="3-17"/>is issued for the development described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">Subsection 10-2a-503(5)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <xref depth="4" refnumber="10-2a-502(5)(d)"><ln numlevel="1" lineno="216" slineno="3-18"/>10-2a-502(5)(d)</xref> and <xref depth="4" refnumber="10-2a-509(e)">(e)</xref></amend>, the engineer described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="10-2a-509(6)" depth="4">10-2a-509(6)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(7)</amend>, <ln numlevel="1" lineno="217" slineno="3-19"/>shall notify the county and the lieutenant governor, in writing:<subsection ssid="5-null-9" dnum="i-o" numlevel="1" lineno="218" slineno="3-20" level="3" tab="1"><display>(i)</display>that the first residential certificate of occupancy has been issued for the <ln numlevel="1" lineno="219" slineno="3-21"/>preliminary municipality;</subsection><subsection ssid="5-null-10" dnum="ii-o" numlevel="1" lineno="220" slineno="3-22" level="3" tab="1"><display>(ii)</display>of the date on which the first residential certificate of occupancy was issued; and</subsection><subsection ssid="5-null-11" dnum="iii-o" numlevel="1" lineno="221" slineno="3-23" level="3" tab="1"><display>(iii)</display>of the physical address for which the first residential certificate of occupancy <ln numlevel="1" lineno="222" slineno="3-24"/>was issued.</subsection></subsection><subsection ssid="5-null-12" dnum="b-o" numlevel="1" lineno="223" slineno="3-25" level="2"><display>(b)</display>No later than the next municipal general election, or regular general election, that is <ln numlevel="1" lineno="224" slineno="3-26"/>at least 30 days after the date described in Subsection <xref depth="4" refnumber="10-2a-509(3)(a)(ii)">(3)(a)(ii)</xref>, the initial landowners <ln numlevel="1" lineno="225" slineno="3-27"/>shall:<subsection ssid="5-null-13" dnum="i-o" numlevel="1" lineno="226" slineno="3-28" level="3"><display>(i)</display>replace the board chair or a board member with an individual who is a resident of <ln numlevel="1" lineno="227" slineno="3-29"/>the preliminary municipality; and</subsection><subsection ssid="5-null-14" dnum="ii-o" numlevel="1" lineno="228" slineno="3-30" level="3"><display>(ii)</display>notify the county and the lieutenant governor of the appointment, in writing.</subsection></subsection></subsection><subsection ssid="5-null-15" dnum="4-o" numlevel="1" lineno="229" slineno="3-31" level="1" space="false"><display>(4)</display><subsection ssid="5-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="10-2a-509(4)(b)">(4)(b)</xref>, a preliminary municipality has all the powers and <ln numlevel="1" lineno="230" slineno="3-32"/>duties of a municipality.</subsection><subsection ssid="5-null-17" dnum="b-o" numlevel="1" lineno="231" slineno="3-33" level="2"><display>(b)</display>A preliminary municipality:<subsection ssid="5-null-18" dnum="i-o" numlevel="1" lineno="232" slineno="3-34" level="3"><display>(i)</display>may not impose a tax;</subsection><subsection ssid="5-null-19" dnum="ii-o" numlevel="1" lineno="233" slineno="3-35" level="3"><display>(ii)</display>may enter into an interlocal agreement with a special district to provide utility <ln numlevel="1" lineno="234" slineno="3-36"/>services to the preliminary municipality;</subsection><subsection ssid="5-null-20" dnum="iii-o" numlevel="1" lineno="235" slineno="3-37" level="3"><display>(iii)</display>has the same authority as another municipality to make decisions regarding <ln numlevel="1" lineno="236" slineno="3-38"/>zoning and land use;</subsection><subsection ssid="5-null-21" dnum="iv-o" numlevel="1" lineno="237" slineno="3-39" level="3"><display>(iv)</display>may not receive an allocation of sales tax or gas tax;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-22" dnum="v-o" numlevel="1" lineno="238" slineno="3-40" level="3"><display>(v)</display>may not exercise eminent domain authority<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both"><marker pairid="24">.</marker></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><marker pairid="25">;</marker></amend></subsection><subsection ssid="5-32" dnum="_-o:vi-i" numlevel="1" lineno="239" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">shall comply with terms, conditions, or restrictions that were established in a <ln numlevel="1" lineno="240" slineno="3-42"/>development agreement, if any, between the initial landowners and the county <ln numlevel="1" lineno="241" slineno="3-43"/>before the feasibility request was filed; and</amend></subsection><subsection ssid="5-33" dnum="_-o:vii-i" numlevel="1" lineno="242" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">may not modify or terminate any terms, conditions, or restrictions described in <ln numlevel="1" lineno="243" slineno="3-45"/>Subsection <xref depth="4" refnumber="10-2a-509(4)(b)(vi)">(4)(b)(vi)</xref> without the county's approval.</amend></subsection></subsection></subsection><subsection ssid="5-null-23" dnum="5-o" numlevel="1" lineno="244" slineno="3-46" level="1"><display>(5)</display>As needed, the county shall provide all services and utility connections to the <ln numlevel="1" lineno="245" slineno="3-47"/>preliminary municipality that the county provides other areas in the county if the <ln numlevel="1" lineno="246" slineno="3-48"/>preliminary municipality:<subsection ssid="5-null-24" dnum="a-o" numlevel="1" lineno="247" slineno="3-49" level="2"><display>(a)</display>pays the uniformly assessed rates for the services and utilities and reasonable <ln numlevel="1" lineno="248" slineno="3-50"/>connection fees; and</subsection><subsection ssid="5-null-25" dnum="b-o" numlevel="1" lineno="249" slineno="3-51" level="2"><display>(b)</display>complies with the county's established regulations and specifications for the <ln numlevel="1" lineno="250" slineno="3-52"/>construction and connection of the local improvements.</subsection></subsection><subsection ssid="5-null-26" dnum="6-o" numlevel="1" lineno="251" slineno="3-53" level="1"><display>(6)</display>The preliminary municipality shall maintain and repair any roadway that, on the day on <ln numlevel="1" lineno="252" slineno="3-54"/>which the individual filed the feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>:<subsection ssid="5-null-27" dnum="a-o" numlevel="1" lineno="253" slineno="3-55" level="2"><display>(a)</display>existed within the preliminary municipality;</subsection><subsection ssid="5-null-28" dnum="b-o" numlevel="1" lineno="254" slineno="3-56" level="2"><display>(b)</display>was within a public right of way that abuts the preliminary municipality; or</subsection><subsection ssid="5-null-29" dnum="c-o" numlevel="1" lineno="255" slineno="3-57" level="2"><display>(c)</display>was within 1/2 mile of the preliminary municipality and connected to, or was <ln numlevel="1" lineno="256" slineno="3-58"/>proposed in the feasibility request to be connected to, the preliminary municipality.</subsection></subsection><subsection ssid="5-null-30" dnum="7-o" numlevel="1" lineno="257" slineno="3-59" level="1"><display>(7)</display>Before the preliminary municipality submits a petition to transition to a town, the <ln numlevel="1" lineno="258" slineno="3-60"/>preliminary municipality shall select an independent third-party engineer to review and <ln numlevel="1" lineno="259" slineno="3-61"/>approve all building permit applications within the preliminary municipality to ensure <ln numlevel="1" lineno="260" slineno="3-62"/>compliance with the law.</subsection><subsection ssid="5-null-31" dnum="8-o" numlevel="1" lineno="261" slineno="3-63" level="1"><display>(8)</display>Chapter 2, Classification, Boundaries, Consolidation, and Dissolution of Municipalities, <ln numlevel="1" lineno="262" slineno="3-64"/>does not apply to a preliminary municipality.</subsection></section></bsec><bsec buid="6" num="10-2a-510" type="amend" src="code" uid="C10-2a-S510_2026050620260506" sort="10 02a05100020260506" numlevel="1" lineno="263" slineno="4-1" sn="4"><section number="10-2a-510" numlevel="1" lineno="264" slineno="4-2" type="amend"><secline lineno="263">Section 4. Section <bold>10-2a-510</bold> is amended to read:</secline><catline lineno="264"><bold>10-2a-510<parens/>. Transitioning from a preliminary municipality to a town -- Petition -- <ln numlevel="1" lineno="265" slineno="4-3"/>Election of officers.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="266" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>Within 30 days after the day on which the population of a preliminary municipality <ln numlevel="1" lineno="267" slineno="4-5"/>exceeds 99 people, a person who filed the application to incorporate as a preliminary <ln numlevel="1" lineno="268" slineno="4-6"/>municipality or a resident of the preliminary municipality shall file with the lieutenant <ln numlevel="1" lineno="269" slineno="4-7"/>governor a petition to transition the preliminary municipality into a town.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="270" slineno="4-8" level="1"><display>(2)</display>A petition to transition a preliminary municipality into a town shall include:<subsection ssid="6-null-3" dnum="a-o" numlevel="1" lineno="271" slineno="4-9" level="2"><display>(a)</display>a request that the lieutenant governor certify the transition of the preliminary <ln numlevel="1" lineno="272" slineno="4-10"/>municipality to, and the incorporation of the preliminary municipality as, a town;</subsection><subsection ssid="6-null-4" dnum="b-o" numlevel="1" lineno="273" slineno="4-11" level="2"><display>(b)</display>the name, address, and phone number of the person filing the request;</subsection><subsection ssid="6-null-5" dnum="c-o" numlevel="1" lineno="274" slineno="4-12" level="2"><display>(c)</display>the map or plat of the preliminary municipality;</subsection><subsection ssid="6-null-6" dnum="d-o" numlevel="1" lineno="275" slineno="4-13" level="2"><display>(d)</display>a legal description of the boundaries of the preliminary municipality;</subsection><subsection ssid="6-null-7" dnum="e-o" numlevel="1" lineno="276" slineno="4-14" level="2"><display>(e)</display>information regarding the preliminary municipality, including:<subsection ssid="6-null-8" dnum="i-o" numlevel="1" lineno="277" slineno="4-15" level="3"><display>(i)</display>the number of residences in the preliminary municipality;</subsection><subsection ssid="6-null-9" dnum="ii-o" numlevel="1" lineno="278" slineno="4-16" level="3"><display>(ii)</display>the population of the preliminary municipality;</subsection><subsection ssid="6-null-10" dnum="iii-o" numlevel="1" lineno="279" slineno="4-17" level="3"><display>(iii)</display>the number of adults and the number of children who reside in the preliminary <ln numlevel="1" lineno="280" slineno="4-18"/>municipality; and</subsection><subsection ssid="6-null-11" dnum="iv-o" numlevel="1" lineno="281" slineno="4-19" level="3"><display>(iv)</display>information regarding the providers of municipal services and emergency <ln numlevel="1" lineno="282" slineno="4-20"/>services to the preliminary municipality;</subsection></subsection><subsection ssid="6-null-12" dnum="f-o" numlevel="1" lineno="283" slineno="4-21" level="2"><display>(f)</display>the proposed name for the town;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-13" dnum="g-o" numlevel="1" lineno="284" slineno="4-22" level="2"><display>(g)</display>a signature sheet containing the names, addresses, and signatures of a majority of the <ln numlevel="1" lineno="285" slineno="4-23"/>adult residents of the preliminary municipality, supporting the proposed name for the <ln numlevel="1" lineno="286" slineno="4-24"/>town<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="6-61" dnum="_-o:h-i" numlevel="1" lineno="287" slineno="4-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">certification that:</amend><subsection ssid="6-62" dnum="_-o:i-i" numlevel="1" lineno="288" slineno="4-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">all damages to county property or infrastructure resulting from development of the <ln numlevel="1" lineno="289" slineno="4-27"/>area have been assessed and paid in full; or</amend></subsection><subsection ssid="6-63" dnum="_-o:ii-i" numlevel="1" lineno="290" slineno="4-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">no damages described in Subsection <xref depth="4" refnumber="10-2a-510(2)(h)(i)">(2)(h)(i)</xref> exist; and</amend></subsection></subsection><subsection ssid="6-64" dnum="_-o:i-i" numlevel="1" lineno="291" slineno="4-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">an agreement by the initial landowners to accept liability for any damages to county <ln numlevel="1" lineno="292" slineno="4-30"/>property or infrastructure that:</amend><subsection ssid="6-65" dnum="_-o:i-i" numlevel="1" lineno="293" slineno="4-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">occurred before the preliminary municipality's transition into a town but are <ln numlevel="1" lineno="294" slineno="4-32"/>discovered after the transition; and</amend></subsection><subsection ssid="6-66" dnum="_-o:ii-i" numlevel="1" lineno="295" slineno="4-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">are directly attributable to development of the area.</amend></subsection></subsection></subsection><subsection ssid="6-null-14" dnum="3-o" numlevel="1" lineno="296" slineno="4-34" level="1"><display>(3)</display>Within 30 days after the day on which a person files a petition to transition a <ln numlevel="1" lineno="297" slineno="4-35"/>preliminary municipality into a town, the lieutenant governor shall:<subsection ssid="6-null-15" dnum="a-o" numlevel="1" lineno="298" slineno="4-36" level="2"><display>(a)</display>determine whether the preliminary municipality has a population of more than 99 <ln numlevel="1" lineno="299" slineno="4-37"/>people;</subsection><subsection ssid="6-null-16" dnum="b-o" numlevel="1" lineno="300" slineno="4-38" level="2"><display>(b)</display>examine the petition to determine whether the petition complies with Subsection <xref depth="4" refnumber="10-2a-510(2)">(2)</xref>;</subsection><subsection ssid="6-null-17" dnum="c-o" numlevel="1" lineno="301" slineno="4-39" level="2"><display>(c)</display>if the lieutenant governor determines that the preliminary municipality has a <ln numlevel="1" lineno="302" slineno="4-40"/>population of more than 99 people and that the petition complies with Subsection <xref depth="4" refnumber="10-2a-510(2)">(2)</xref>, <ln numlevel="1" lineno="303" slineno="4-41"/>proceed to transition the preliminary municipality as a town in accordance with <ln numlevel="1" lineno="304" slineno="4-42"/>Subsection <xref depth="4" refnumber="10-2a-510(4)">(4)</xref>;</subsection><subsection ssid="6-null-18" dnum="d-o" numlevel="1" lineno="305" slineno="4-43" level="2"><display>(d)</display>if the lieutenant governor determines that the preliminary municipality has a <ln numlevel="1" lineno="306" slineno="4-44"/>population of less than 100 people, deny the petition, inform the person who filed the <ln numlevel="1" lineno="307" slineno="4-45"/>petition of the determination, and request that the person refile the petition when the <ln numlevel="1" lineno="308" slineno="4-46"/>population exceeds 99 people; and</subsection><subsection ssid="6-null-19" dnum="e-o" numlevel="1" lineno="309" slineno="4-47" level="2"><display>(e)</display>if the lieutenant governor determines that the petition fails to comply with Subsection <xref depth="4" refnumber="10-2a-510(2)"><ln numlevel="1" lineno="310" slineno="4-48"/>(2)</xref>, deny the petition, inform the person who filed the petition of the denial and the <ln numlevel="1" lineno="311" slineno="4-49"/>reason for the denial, and request that the person correct and refile the petition.</subsection></subsection><subsection ssid="6-null-20" dnum="4-o" numlevel="1" lineno="312" slineno="4-50" level="1"><display>(4)</display>After making the determination described in Subsection <xref depth="4" refnumber="10-2a-510(3)(c)">(3)(c)</xref>, the lieutenant governor <ln numlevel="1" lineno="313" slineno="4-51"/>shall:<subsection ssid="6-null-21" dnum="a-o" numlevel="1" lineno="314" slineno="4-52" level="2"><display>(a)</display>inform the person who filed the petition of the determination;</subsection><subsection ssid="6-null-22" dnum="b-o" numlevel="1" lineno="315" slineno="4-53" level="2"><display>(b)</display>inform the county in which the preliminary municipality is located of the <ln numlevel="1" lineno="316" slineno="4-54"/>determination; and</subsection><subsection ssid="6-null-23" dnum="c-o" numlevel="1" lineno="317" slineno="4-55" level="2"><display>(c)</display>direct the county to conduct an election for mayor and city council of the future <ln numlevel="1" lineno="318" slineno="4-56"/>town, to be held on the date of the next regular general election described in Section <xref depth="3" refnumber="20A-1-201"><ln numlevel="1" lineno="319" slineno="4-57"/>20A-1-201</xref>, or the next municipal general election described in Section <xref depth="3" refnumber="20A-1-202">20A-1-202</xref>, <ln numlevel="1" lineno="320" slineno="4-58"/>that is at least 65 days after the day on which the lieutenant governor directs the <ln numlevel="1" lineno="321" slineno="4-59"/>county to hold the election.</subsection></subsection><subsection ssid="6-null-24" dnum="5-o" numlevel="1" lineno="322" slineno="4-60" level="1"><display>(5)</display>The county shall:<subsection ssid="6-null-25" dnum="a-o" numlevel="1" lineno="323" slineno="4-61" level="2"><display>(a)</display>comply with the direction given by the lieutenant governor under Subsection <xref depth="4" refnumber="10-2a-510(4)(c)">(4)(c)</xref>;</subsection><subsection ssid="6-null-26" dnum="b-o" numlevel="1" lineno="324" slineno="4-62" level="2"><display>(b)</display>determine the initial terms of the mayor and municipal council members to ensure <ln numlevel="1" lineno="325" slineno="4-63"/>that:<subsection ssid="6-null-27" dnum="i-o" numlevel="1" lineno="326" slineno="4-64" level="3"><display>(i)</display>the mayor and two of the municipal county members are elected in the next <ln numlevel="1" lineno="327" slineno="4-65"/>municipal general election;</subsection><subsection ssid="6-null-28" dnum="ii-o" numlevel="1" lineno="328" slineno="4-66" level="3"><display>(ii)</display>the remaining municipal council members are elected at elections that result in <ln numlevel="1" lineno="329" slineno="4-67"/>the staggering of council member terms; and</subsection><subsection ssid="6-null-29" dnum="iii-o" numlevel="1" lineno="330" slineno="4-68" level="3"><display>(iii)</display>the council members who receive the highest number of votes are assigned the <ln numlevel="1" lineno="331" slineno="4-69"/>longer initial terms; and</subsection></subsection><subsection ssid="6-null-30" dnum="c-o" numlevel="1" lineno="332" slineno="4-70" level="2"><display>(c)</display>provide notice of the election for the preliminary municipality as a class B notice <ln numlevel="1" lineno="333" slineno="4-71"/>under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least three weeks before the day of the election.</subsection></subsection><subsection ssid="6-null-31" dnum="6-o" numlevel="1" lineno="334" slineno="4-72" level="1"><display>(6)</display>The notice described in Subsection <xref depth="4" refnumber="10-2a-510(5)(c)">(5)(c)</xref> shall include:<subsection ssid="6-null-32" dnum="a-o" numlevel="1" lineno="335" slineno="4-73" level="2"><display>(a)</display>a statement of the contents of the petition to transition the preliminary municipality <ln numlevel="1" lineno="336" slineno="4-74"/>to a town;</subsection><subsection ssid="6-null-33" dnum="b-o" numlevel="1" lineno="337" slineno="4-75" level="2"><display>(b)</display>a description of the area to be incorporated as a town;</subsection><subsection ssid="6-null-34" dnum="c-o" numlevel="1" lineno="338" slineno="4-76" level="2"><display>(c)</display>the name of the town;</subsection><subsection ssid="6-null-35" dnum="d-o" numlevel="1" lineno="339" slineno="4-77" level="2"><display>(d)</display>information about the deadline for an individual to file a declaration of candidacy to <ln numlevel="1" lineno="340" slineno="4-78"/>become a candidate for mayor or municipal council;</subsection><subsection ssid="6-null-36" dnum="e-o" numlevel="1" lineno="341" slineno="4-79" level="2"><display>(e)</display>information about the initial terms of office;</subsection><subsection ssid="6-null-37" dnum="f-o" numlevel="1" lineno="342" slineno="4-80" level="2"><display>(f)</display>a statement of the date and time of the election and the location of polling places; and</subsection><subsection ssid="6-null-38" dnum="g-o" numlevel="1" lineno="343" slineno="4-81" level="2"><display>(g)</display>a statement that the purpose of the election is to elect a mayor and a council to <ln numlevel="1" lineno="344" slineno="4-82"/>govern the town upon the town's incorporation.</subsection></subsection><subsection ssid="6-null-39" dnum="7-o" numlevel="1" lineno="345" slineno="4-83" level="1" space="false"><display>(7)</display><subsection ssid="6-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to the notice described in Subsection <xref depth="4" refnumber="10-2a-510(6)">(6)</xref>, the county clerk shall publish <ln numlevel="1" lineno="346" slineno="4-84"/>and distribute, before the election is held, a voter information pamphlet:<subsection ssid="6-null-41" dnum="i-o" numlevel="1" lineno="347" slineno="4-85" level="3" tab="1"><display>(i)</display>in accordance with the procedures and requirements of Section <xref depth="3" refnumber="20A-7-402">20A-7-402</xref>;</subsection><subsection ssid="6-null-42" dnum="ii-o" numlevel="1" lineno="348" slineno="4-86" level="3" tab="1"><display>(ii)</display>in consultation with the lieutenant governor; and</subsection><subsection ssid="6-null-43" dnum="iii-o" numlevel="1" lineno="349" slineno="4-87" level="3" tab="1"><display>(iii)</display>in a manner that the county clerk determines is adequate.</subsection></subsection><subsection ssid="6-null-44" dnum="b-o" numlevel="1" lineno="350" slineno="4-88" level="2"><display>(b)</display>The voter information pamphlet described in Subsection <xref depth="4" refnumber="10-2a-510(7)(a)">(7)(a)</xref>:<subsection ssid="6-null-45" dnum="i-o" numlevel="1" lineno="351" slineno="4-89" level="3"><display>(i)</display>shall inform the public of the election and the purpose of the election; and</subsection><subsection ssid="6-null-46" dnum="ii-o" numlevel="1" lineno="352" slineno="4-90" level="3"><display>(ii)</display>may include additional information regarding the election of the elected officials <ln numlevel="1" lineno="353" slineno="4-91"/>and the incorporation of the town.</subsection></subsection></subsection><subsection ssid="6-null-47" dnum="8-o" numlevel="1" lineno="354" slineno="4-92" level="1"><display>(8)</display>An individual may not vote in the election described in this section unless the individual <ln numlevel="1" lineno="355" slineno="4-93"/>is a registered voter who is a resident, as defined in Section <xref depth="3" refnumber="20A-1-102">20A-1-102</xref>, within the <ln numlevel="1" lineno="356" slineno="4-94"/>boundaries of the preliminary municipality.</subsection><subsection ssid="6-null-48" dnum="9-o" numlevel="1" lineno="357" slineno="4-95" level="1"><display>(9)</display>The town, incorporated under Subsection <xref depth="4" refnumber="10-2a-510(10)(b)">(10)(b)</xref>, shall pay to the county the cost of <ln numlevel="1" lineno="358" slineno="4-96"/>running the election described in this section.</subsection><subsection ssid="6-null-49" dnum="10-o" numlevel="1" lineno="359" slineno="4-97" level="1"><display>(10)</display>On the day after the day on which the canvass for the election is completed:<subsection ssid="6-null-50" dnum="a-o" numlevel="1" lineno="360" slineno="4-98" level="2"><display>(a)</display>the elected mayor and council members shall take office and replace the board chair <ln numlevel="1" lineno="361" slineno="4-99"/>and board members of the preliminary municipality;</subsection><subsection ssid="6-null-51" dnum="b-o" numlevel="1" lineno="362" slineno="4-100" level="2"><display>(b)</display>the lieutenant governor shall issue a certification that the preliminary municipality <ln numlevel="1" lineno="363" slineno="4-101"/>has transitioned to, and is incorporated as, a town; and</subsection><subsection ssid="6-null-52" dnum="c-o" numlevel="1" lineno="364" slineno="4-102" level="2"><display>(c)</display>subject to Subsection <xref depth="4" refnumber="10-2a-510(14)">(14)</xref>, the town holds all authority and power of a town.</subsection></subsection><subsection ssid="6-null-53" dnum="11-o" numlevel="1" lineno="365" slineno="4-103" level="1"><display>(11)</display>The former mayor and council members for the preliminary municipality shall assist <ln numlevel="1" lineno="366" slineno="4-104"/>the newly-elected mayor of the town and the newly-elected council members of the <ln numlevel="1" lineno="367" slineno="4-105"/>town with the transition to a town and the transfer of power to the elected government of <ln numlevel="1" lineno="368" slineno="4-106"/>the town.</subsection><subsection ssid="6-null-54" dnum="12-o" numlevel="1" lineno="369" slineno="4-107" level="1"><display>(12)</display>The initial government of a town incorporated under this section is the five member <ln numlevel="1" lineno="370" slineno="4-108"/>council form of government described in Chapter 3b, Part 4, Five-Member Council <ln numlevel="1" lineno="371" slineno="4-109"/>Form of Municipal Government, with the mayor and counsel members elected at large.</subsection><subsection ssid="6-null-55" dnum="13-o" numlevel="1" lineno="372" slineno="4-110" level="1"><display>(13)</display>Within 30 days after the day on which the mayor takes office under Subsection <xref depth="4" refnumber="10-2a-510(10)(a)">(10)(a)</xref>, <ln numlevel="1" lineno="373" slineno="4-111"/>the mayor shall record the certification described in Subsection <xref depth="4" refnumber="10-2a-510(10)(b)">(10)(b)</xref>, and a copy of <ln numlevel="1" lineno="374" slineno="4-112"/>the plat for the municipality, with the county recorder.</subsection><subsection ssid="6-null-56" dnum="14-o" numlevel="1" lineno="375" slineno="4-113" level="1"><display>(14)</display>Until the mayor complies with Subsection <xref depth="4" refnumber="10-2a-510(13)">(13)</xref>, the municipality may not:<subsection ssid="6-null-57" dnum="a-o" numlevel="1" lineno="376" slineno="4-114" level="2"><display>(a)</display>levy or collect a property tax on property within the municipality;</subsection><subsection ssid="6-null-58" dnum="b-o" numlevel="1" lineno="377" slineno="4-115" level="2"><display>(b)</display>levy or collect an assessment on property within the municipality;
