Stratton</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses social services funding.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that interest earned on money in the Medicaid ACA Fund shall be deposited into <ln numlevel="1" lineno="9" slineno="0-9"/>the General Fund;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">requires immunosuppressive drugs to be added to the Medicaid preferred drug list;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires the Department of Health and Human Services (department) to:<hl numlevel="1" lineno="12" slineno="0-12" level="2"> transition the state's Children's Health Insurance Program from a separate program, to <ln numlevel="1" lineno="13" slineno="0-13"/>providing benefits under the state's Medicaid program; and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">after the transition, to the extent possible, provide dental services to individuals <ln numlevel="1" lineno="15" slineno="0-15"/>covered by the Children's Health Insurance Program through the University of Utah <ln numlevel="1" lineno="16" slineno="0-16"/>School of Dentistry;</hl></hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">requires certain funds to be distributed from the Electronic Cigarette Substance and <ln numlevel="1" lineno="18" slineno="0-18"/>Nicotine Product Proceeds Restricted Account for substance use treatment and <ln numlevel="1" lineno="19" slineno="0-19"/>prevention services; Medicaid ACA Fund.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="43" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>There is created an expendable special revenue fund known as the "Medicaid ACA <ln numlevel="1" lineno="44" slineno="1-4"/>Fund."</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="45" slineno="1-5" level="1"><display>(2)</display>The fund consists of:<subsection ssid="6-null-3" dnum="a-o" numlevel="1" lineno="46" slineno="1-6" level="2"><display>(a)</display>assessments collected under Chapter 3, Part 5, Inpatient Hospital Assessment;</subsection><subsection ssid="6-null-4" dnum="b-o" numlevel="1" lineno="47" slineno="1-7" level="2"><display>(b)</display>intergovernmental transfers under Section <xref depth="3" refnumber="26B-3-508">26B-3-508</xref>;</subsection><subsection ssid="6-null-5" dnum="c-o" numlevel="1" lineno="48" slineno="1-8" level="2"><display>(c)</display>savings attributable to the health coverage improvement program, as defined in <ln numlevel="1" lineno="49" slineno="1-9"/>Section <xref depth="3" refnumber="26B-3-501">26B-3-501</xref>, as determined by the department;</subsection><subsection ssid="6-null-6" dnum="d-o" numlevel="1" lineno="50" slineno="1-10" level="2"><display>(d)</display>savings attributable to the enhancement waiver program, as defined in Section <xref depth="3" refnumber="26B-3-501"><ln numlevel="1" lineno="51" slineno="1-11"/>26B-3-501</xref>, as determined by the department;</subsection><subsection ssid="6-null-7" dnum="e-o" numlevel="1" lineno="52" slineno="1-12" level="2"><display>(e)</display>savings attributable to the Medicaid waiver expansion, as defined in Section <xref depth="3" refnumber="26B-3-501"><ln numlevel="1" lineno="53" slineno="1-13"/>26B-3-501</xref>, as determined by the department;</subsection><subsection ssid="6-null-8" dnum="f-o" numlevel="1" lineno="54" slineno="1-14" level="2"><display>(f)</display>revenues collected from the sales tax described in Subsection <xref depth="4" refnumber="59-12-103(11)">59-12-103(11)</xref>;</subsection><subsection ssid="6-null-9" dnum="g-o" numlevel="1" lineno="55" slineno="1-15" level="2"><display>(g)</display>gifts, grants, donations, or any other conveyance of money that may be made to the <ln numlevel="1" lineno="56" slineno="1-16"/>fund from private sources;<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both"> and</amend></subsection><subsection ssid="6-null-10" dnum="h-o:_-i" numlevel="1" lineno="57" slineno="1-17" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="start">(h)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="ahaskell" level="1" deltag="end">interest earned on money in the fund; and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-11" dnum="i-o:h-i" numlevel="1" lineno="58" slineno="1-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>additional amounts as appropriated by the Legislature.</subsection></subsection><subsection ssid="6-null-12" dnum="3-o" numlevel="1" lineno="59" slineno="1-19" level="1" space="false"><display>(3)</display><subsection ssid="6-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The fund shall earn interest.</subsection><subsection ssid="6-null-14" dnum="b-o" numlevel="1" lineno="60" slineno="1-20" level="2"><display>(b)</display>All interest earned on fund money<amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both"> in a fiscal year beginning on or after July 1, 2025,</amend> <ln numlevel="1" lineno="61" slineno="1-21"/>shall be deposited into the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="ahaskell" level="1" deltag="both">fund</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">General Fund</amend>.</subsection></subsection><subsection ssid="6-null-15" dnum="4-o" numlevel="1" lineno="62" slineno="1-22" level="1" space="false"><display>(4)</display><subsection ssid="6-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A state agency administering the provisions of Chapter 3, Part 5, Inpatient <ln numlevel="1" lineno="63" slineno="1-23"/>Hospital Assessment, may use money from the fund to pay the costs, not otherwise <ln numlevel="1" lineno="64" slineno="1-24"/>paid for with federal funds or other revenue sources, of:<subsection ssid="6-null-17" dnum="i-o" numlevel="1" lineno="65" slineno="1-25" level="3" tab="1"><display>(i)</display>the health coverage improvement program as defined in Section <xref depth="3" refnumber="26B-3-501">26B-3-501</xref>;</subsection><subsection ssid="6-null-18" dnum="ii-o" numlevel="1" lineno="66" slineno="1-26" level="3" tab="1"><display>(ii)</display>the enhancement waiver program as defined in Section <xref depth="3" refnumber="26B-3-501">26B-3-501</xref>;</subsection><subsection ssid="6-null-19" dnum="iii-o" numlevel="1" lineno="67" slineno="1-27" level="3" tab="1"><display>(iii)</display>a Medicaid waiver expansion as defined in Section <xref depth="3" refnumber="26B-3-501">26B-3-501</xref>; and</subsection><subsection ssid="6-null-20" dnum="iv-o" numlevel="1" lineno="68" slineno="1-28" level="3" tab="1"><display>(iv)</display>the outpatient upper payment limit supplemental payments under Section <xref depth="3" refnumber="26B-3-511"><ln numlevel="1" lineno="69" slineno="1-29"/>26B-3-511</xref>.</subsection></subsection><subsection ssid="6-null-21" dnum="b-o" numlevel="1" lineno="70" slineno="1-30" level="2"><display>(b)</display>A state agency administering the provisions of Chapter 3, Part 5, Inpatient Hospital <ln numlevel="1" lineno="71" slineno="1-31"/>Assessment, may not use:<subsection ssid="6-null-22" dnum="i-o" numlevel="1" lineno="72" slineno="1-32" level="3"><display>(i)</display>funds described in Subsection <xref depth="4" refnumber="26B-1-315(2)(b)">(2)(b)</xref> to pay the cost of private outpatient upper <ln numlevel="1" lineno="73" slineno="1-33"/>payment limit supplemental payments; or</subsection><subsection ssid="7-null-23" dnum="ii-o" numlevel="1" lineno="108" slineno="2-34" level="3"><display>(ii)</display>money in the fund for any purpose not described in Subsection <xref depth="4" refnumber="26B-1-315(4)(a)">(4)(a)</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="1" num="26B-3-105" type="amend" src="code" uid="C26B-3-S105_2026050620260506" sort="26B03 01050020260506" numlevel="1" lineno="109" slineno="3-1" sn="3"><section number="26B-3-105" numlevel="1" lineno="110" slineno="3-2" type="amend"><secline lineno="109">Section 3. Section <bold>26B-3-105</bold> is amended to read:</secline><catline lineno="110"><bold>26B-3-105<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Medicaid drug program -- Preferred drug list.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="111" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="112" slineno="3-4" level="2"><display>(a)</display>"Immunosuppressive drug" means a drug that:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="113" slineno="3-5" level="3"><display>(i)</display> is used in immunosuppressive therapy to inhibit or prevent activity of the immune <ln numlevel="1" lineno="114" slineno="3-6"/>system to aid the body in preventing the rejection of transplanted organs and <ln numlevel="1" lineno="115" slineno="3-7"/>tissue; and</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="116" slineno="3-8" level="3"><display>(ii)</display>does not include drugs used for the treatment of autoimmune disease or diseases <ln numlevel="1" lineno="117" slineno="3-9"/>that are most likely of autoimmune origin.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="118" slineno="3-10" level="2"><display>(b)</display>"Psychotropic drug" means the following classes of drugs:<subsection ssid="1-null-6" dnum="i-o" numlevel="1" lineno="119" slineno="3-11" level="3"><display>(i)</display>anti-depressant;</subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="120" slineno="3-12" level="3"><display>(ii)</display>anti-convulsant/mood stabilizer;</subsection><subsection ssid="1-null-8" dnum="iii-o" numlevel="1" lineno="121" slineno="3-13" level="3"><display>(iii)</display>anti-anxiety; and</subsection><subsection ssid="1-null-9" dnum="iv-o" numlevel="1" lineno="122" slineno="3-14" level="3"><display>(iv)</display>attention deficit hyperactivity disorder stimulant.</subsection></subsection><subsection ssid="1-null-10" dnum="c-o" numlevel="1" lineno="123" slineno="3-15" level="2"><display>(c)</display>"Stabilized" means a health care provider has documented in the patient's medical <ln numlevel="1" lineno="124" slineno="3-16"/>chart that a patient has achieved a stable or steadfast medical state within the past 90 <ln numlevel="1" lineno="125" slineno="3-17"/>days.</subsection></subsection><subsection ssid="1-null-11" dnum="2-o" numlevel="1" lineno="126" slineno="3-18" level="1"><display>(2)</display>A Medicaid drug program developed by the department under Subsection <xref depth="4" refnumber="26B-3-104(2)(f)" start="0"><ln numlevel="1" lineno="127" slineno="3-19"/>26B-3-104(2)(f)</xref>:<subsection ssid="1-null-12" dnum="a-o" numlevel="1" lineno="128" slineno="3-20" level="2"><display>(a)</display>shall, notwithstanding Subsection <xref depth="4" refnumber="26B-3-104(1)(b)" start="0">26B-3-104(1)(b)</xref>, be based on clinical and <ln numlevel="1" lineno="129" slineno="3-21"/>cost-related factors which include medical necessity as determined by a provider in <ln numlevel="1" lineno="130" slineno="3-22"/>accordance with administrative rules established by the Drug Utilization Review <ln numlevel="1" lineno="131" slineno="3-23"/>Board;</subsection><subsection ssid="1-null-13" dnum="b-o" numlevel="1" lineno="132" slineno="3-24" level="2"><display>(b)</display>may include therapeutic categories of drugs that may be exempted from the drug <ln numlevel="1" lineno="133" slineno="3-25"/>program;</subsection><subsection ssid="1-null-14" dnum="c-o" numlevel="1" lineno="134" slineno="3-26" level="2"><display>(c)</display>notwithstanding Section <xref depth="3" refnumber="58-17b-606">58-17b-606</xref>, may include placing some drugs on a preferred <ln numlevel="1" lineno="135" slineno="3-27"/>drug list:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="136" slineno="3-28" level="3"><display>(i)</display>to the extent determined appropriate by the department; and</subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="137" slineno="3-29" level="3"><display>(ii)</display>in the manner described in Subsection <xref depth="4" refnumber="26B-3-105(4)">(4)</xref> for atypical anti-psychotic drugs; </subsection></subsection><subsection ssid="1-null-17" dnum="d-o" numlevel="1" lineno="138" slineno="3-30" level="2"><display>(d)</display>notwithstanding the requirements of Sections <xref depth="3" refnumber="26B-3-302" start="0">26B-3-302</xref> through <xref depth="3" refnumber="26B-3-309" start="0">26B-3-309</xref> <ln numlevel="1" lineno="139" slineno="3-31"/>regarding the Drug Utilization Review Board,  and except as provided in Subsection <xref depth="4" refnumber="26B-3-105(4)"><ln numlevel="1" lineno="140" slineno="3-32"/>(4)</xref>,  shall immediately implement the prior authorization requirements for a <ln numlevel="1" lineno="141" slineno="3-33"/>nonpreferred drug that is in the same therapeutic class as a drug that is:<subsection ssid="1-null-18" dnum="i-o" numlevel="1" lineno="142" slineno="3-34" level="3"><display>(i)</display>on the preferred drug list on the date <marker pairid="29">that </marker><marker pairid="30">this act</marker> takes effect; or</subsection><subsection ssid="1-null-19" dnum="ii-o" numlevel="1" lineno="143" slineno="3-35" level="3"><display>(ii)</display>added to the preferred drug list after<marker pairid="31"> </marker><marker pairid="33">this act</marker><marker pairid="32"> </marker>takes effect; and</subsection></subsection><subsection ssid="1-null-20" dnum="e-o" numlevel="1" lineno="144" slineno="3-36" level="2"><display>(e)</display>except as prohibited by Subsections <xref depth="4" refnumber="58-17b-606(4)" start="0">58-17b-606(4)</xref> and <xref depth="4" refnumber="58-17b-606(5)" start="0">(5)</xref>, shall establish the prior <ln numlevel="1" lineno="145" slineno="3-37"/>authorization requirements which shall permit a health care provider or the health <ln numlevel="1" lineno="146" slineno="3-38"/>care provider's agent to obtain a prior authorization override of the preferred drug list <ln numlevel="1" lineno="147" slineno="3-39"/>through the department's pharmacy prior authorization review process, and which <ln numlevel="1" lineno="148" slineno="3-40"/>shall:<subsection ssid="1-null-21" dnum="i-o" numlevel="1" lineno="149" slineno="3-41" level="3"><display>(i)</display>provide either telephone or fax approval or denial of the request within 24 hours of <ln numlevel="1" lineno="150" slineno="3-42"/>the receipt of a request that is submitted during normal business hours of Monday <ln numlevel="1" lineno="151" slineno="3-43"/>through Friday from 8 a.m. to 5 p.m.;</subsection><subsection ssid="1-null-22" dnum="ii-o" numlevel="1" lineno="152" slineno="3-44" level="3"><display>(ii)</display>provide for the dispensing of a limited supply of a requested drug as determined <ln numlevel="1" lineno="153" slineno="3-45"/>appropriate by the department in an emergency situation, if the request for an <ln numlevel="1" lineno="154" slineno="3-46"/>override is received outside of the department's normal business hours; and</subsection><subsection ssid="1-null-23" dnum="iii-o" numlevel="1" lineno="155" slineno="3-47" level="3"><display>(iii)</display>require the health care provider to provide the department with documentation of <ln numlevel="1" lineno="156" slineno="3-48"/>the medical need for the preferred drug list override in accordance with criteria <ln numlevel="1" lineno="157" slineno="3-49"/>established by the department in consultation with the Pharmacy and Therapeutics <ln numlevel="1" lineno="158" slineno="3-50"/>Committee.</subsection></subsection></subsection><subsection ssid="1-null-24" dnum="3-o" numlevel="1" lineno="159" slineno="3-51" level="1" space="false"><display>(3)</display><subsection ssid="1-null-25" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-41" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both">(i)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="20" style="2" owner="ahaskell" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="26B-3-105(3)(a)(ii)">(3)(a)(ii)</xref>, a</amend> preferred drug list <ln numlevel="1" lineno="160" slineno="3-52"/>developed under the provisions of this section may not include an <ln numlevel="1" lineno="161" slineno="3-53"/>immunosuppressive drug.</subsection><subsection ssid="1-42" dnum="_-o:ii-i" numlevel="1" lineno="162" slineno="3-54" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">Beginning on March 1, 2027, the department shall include immunosuppressive <ln numlevel="1" lineno="163" slineno="3-55"/>drugs on the preferred drug list.</amend></subsection></subsection><subsection ssid="1-null-26" dnum="i-o:b-i" numlevel="1" lineno="164" slineno="3-56" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>The state Medicaid program shall reimburse for a prescription for an <ln numlevel="1" lineno="165" slineno="3-57"/>immunosuppressive drug as written by the health care provider for a patient who has <ln numlevel="1" lineno="166" slineno="3-58"/>undergone an organ transplant.</subsection><subsection ssid="1-null-27" dnum="ii-o:c-i" numlevel="1" lineno="167" slineno="3-59" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>For purposes of Subsection <xref depth="4" refnumber="58-17b-606(4)" start="0">58-17b-606(4)</xref>, and with respect to patients who <ln numlevel="1" lineno="168" slineno="3-60"/>have undergone an organ transplant, the prescription for a particular <ln numlevel="1" lineno="169" slineno="3-61"/>immunosuppressive drug as written by a health care provider meets the criteria of <ln numlevel="1" lineno="170" slineno="3-62"/>demonstrating to the department a medical necessity for dispensing the prescribed <ln numlevel="1" lineno="171" slineno="3-63"/>immunosuppressive drug.</subsection><subsection ssid="1-null-28" dnum="iii-o:d-i" numlevel="1" lineno="172" slineno="3-64" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>Notwithstanding the requirements of Sections <xref depth="3" refnumber="26B-3-302" start="0">26B-3-302</xref> through <xref depth="3" refnumber="26B-3-309" start="0">26B-3-309</xref> <ln numlevel="1" lineno="173" slineno="3-65"/>regarding the Drug Utilization Review Board, the state Medicaid drug program may <ln numlevel="1" lineno="174" slineno="3-66"/>not require the use of step therapy for immunosuppressive drugs without the written <ln numlevel="1" lineno="175" slineno="3-67"/>or oral consent of the health care provider and the patient.</subsection></subsection><subsection ssid="1-null-29" dnum="4-o" numlevel="1" lineno="176" slineno="3-68" level="1" space="false"><display>(4)</display><subsection ssid="1-null-30" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-31" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The department shall include atypical anti-psychotic drugs on the preferred <ln numlevel="1" lineno="177" slineno="3-69"/>drug list.</subsection><subsection ssid="1-null-32" dnum="ii-o" numlevel="1" lineno="178" slineno="3-70" level="3" tab="1"><display>(ii)</display>The department shall allow a health care provider to override the preferred drug <ln numlevel="1" lineno="179" slineno="3-71"/>list for an atypical anti-psychotic drug by writing "dispense as written" on the <ln numlevel="1" lineno="180" slineno="3-72"/>prescription for the atypical anti-psychotic drug.</subsection><subsection ssid="1-null-33" dnum="iii-o" numlevel="1" lineno="181" slineno="3-73" level="3" tab="1"><display>(iii)</display>A health care provider may not override Section <xref depth="3" refnumber="58-17b-606" start="0">58-17b-606</xref> by writing <ln numlevel="1" lineno="182" slineno="3-74"/>"dispense as written" on a prescription.</subsection></subsection><subsection ssid="1-null-34" dnum="b-o" numlevel="1" lineno="183" slineno="3-75" level="2"><display>(b)</display>The department, and a Medicaid accountable care organization that is responsible for <ln numlevel="1" lineno="184" slineno="3-76"/>providing behavioral health, shall<amend anum="0" ea="amend" pairid="28" groupid="25" style="1" owner="ahaskell" level="1" amendtag="both"> </amend>establish a system to:<subsection ssid="1-null-35" dnum="i-o" numlevel="1" lineno="185" slineno="3-77" level="3"><display>(i)</display>track health care provider prescribing patterns for atypical anti-psychotic drugs;</subsection><subsection ssid="1-null-36" dnum="ii-o" numlevel="1" lineno="186" slineno="3-78" level="3"><display>(ii)</display>educate health care providers who are not complying with the preferred drug list; <ln numlevel="1" lineno="187" slineno="3-79"/>and</subsection><subsection ssid="1-null-37" dnum="iii-o" numlevel="1" lineno="188" slineno="3-80" level="3"><display>(iii)</display>implement peer to peer education for health care providers whose prescribing <ln numlevel="1" lineno="189" slineno="3-81"/>practices continue to not comply with the preferred drug list.</subsection></subsection></subsection><subsection ssid="1-null-38" dnum="5-o" numlevel="1" lineno="190" slineno="3-82" level="1"><display>(5)</display>For enrollees that begin a psychotropic drug treatment on or after July 1, 2025, the <ln numlevel="1" lineno="191" slineno="3-83"/>department shall pay for a psychotropic drug that is not on the preferred drug list if the <ln numlevel="1" lineno="192" slineno="3-84"/>department, based on patient claims history or health care provider attestation, has <ln numlevel="1" lineno="193" slineno="3-85"/>evidence of:<subsection ssid="1-null-39" dnum="a-o" numlevel="1" lineno="194" slineno="3-86" level="2"><display>(a)</display>an enrollee's trial and failure of a psychotropic drug on the preferred drug list that is <ln numlevel="1" lineno="195" slineno="3-87"/>equivalent or similar to the drug that is not on the preferred drug list in the last 365 <ln numlevel="1" lineno="196" slineno="3-88"/>days; or</subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="197" slineno="3-89" level="2"><display>(b)</display>the enrollee being stabilized on the psychotropic drug that is not on the preferred <ln numlevel="1" lineno="198" slineno="3-90"/>drug list at the time of enrollment.</subsection></subsection></section></bsec><bsec buid="11" num="26B-3-902" type="amend" src="code" uid="C26B-3-S902_2026050620260506" sort="26B03 09020020260506" numlevel="1" lineno="199" slineno="4-1" sn="4"><section number="26B-3-902" numlevel="1" lineno="200" slineno="4-2" type="amend"><secline lineno="199">Section 4. Section <bold>26B-3-902</bold> is amended to read:</secline><catline lineno="200"><bold>26B-3-902<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Creation and administration of the Utah <ln numlevel="1" lineno="201" slineno="4-3"/>Children's Health Insurance Program.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="202" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>There is created the Utah Children's Health Insurance Program to be administered by <ln numlevel="1" lineno="203" slineno="4-5"/>the department in accordance with the provisions of:<subsection ssid="11-null-2" dnum="a-o" numlevel="1" lineno="204" slineno="4-6" level="2"><display>(a)</display>this part; and</subsection><subsection ssid="11-null-3" dnum="b-o" numlevel="1" lineno="205" slineno="4-7" level="2"><display>(b)</display>the State Children's Health Insurance Program, 42 U.S.C. Sec. 1397aa et seq.</subsection></subsection><subsection ssid="11-null-4" dnum="2-o" numlevel="1" lineno="206" slineno="4-8" level="1"><display>(2)</display>The department shall:<subsection ssid="11-null-5" dnum="a-o" numlevel="1" lineno="207" slineno="4-9" level="2"><display>(a)</display>prepare and submit the state's children's health insurance plan before May 1, 1998, <ln numlevel="1" lineno="208" slineno="4-10"/>and any amendments to the United States Department of Health and Human Services <ln numlevel="1" lineno="209" slineno="4-11"/>in accordance with 42 U.S.C. Sec. 1397ff; and</subsection><subsection ssid="11-null-6" dnum="b-o" numlevel="1" lineno="210" slineno="4-12" level="2"><display>(b)</display>make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="211" slineno="4-13"/>Rulemaking Act</xref>, regarding:<subsection ssid="11-null-7" dnum="i-o" numlevel="1" lineno="212" slineno="4-14" level="3"><display>(i)</display>eligibility requirements consistent with Section <xref depth="3" refnumber="26B-3-108" start="0">26B-3-108</xref>;</subsection><subsection ssid="11-null-8" dnum="ii-o" numlevel="1" lineno="213" slineno="4-15" level="3"><display>(ii)</display>program benefits;</subsection><subsection ssid="11-null-9" dnum="iii-o" numlevel="1" lineno="214" slineno="4-16" level="3"><display>(iii)</display>the level of coverage for each program benefit;</subsection><subsection ssid="11-null-10" dnum="iv-o" numlevel="1" lineno="215" slineno="4-17" level="3"><display>(iv)</display>cost-sharing requirements for members, which may not:<subsection ssid="11-null-11" dnum="A-o" numlevel="1" lineno="216" slineno="4-18" level="4"><display>(A)</display>exceed the guidelines set forth in 42 U.S.C. Sec. 1397ee; or</subsection><subsection ssid="11-null-12" dnum="B-o" numlevel="1" lineno="217" slineno="4-19" level="4"><display>(B)</display>impose deductible, copayment, or coinsurance requirements on a member for <ln numlevel="1" lineno="218" slineno="4-20"/>well-child, well-baby, and immunizations;</subsection></subsection><subsection ssid="11-null-13" dnum="v-o" numlevel="1" lineno="219" slineno="4-21" level="3"><display>(v)</display>the administration of the program; and</subsection><subsection ssid="11-null-14" dnum="vi-o" numlevel="1" lineno="220" slineno="4-22" level="3"><display>(vi)</display>a requirement that:<subsection ssid="11-null-15" dnum="A-o" numlevel="1" lineno="221" slineno="4-23" level="4"><display>(A)</display>members in the program shall participate in the electronic exchange of clinical <ln numlevel="1" lineno="222" slineno="4-24"/>health records established in accordance with Section <xref depth="3" refnumber="26B-8-411" start="0">26B-8-411</xref> unless the <ln numlevel="1" lineno="223" slineno="4-25"/>member opts out of participation;</subsection><subsection ssid="11-null-16" dnum="B-o" numlevel="1" lineno="224" slineno="4-26" level="4"><display>(B)</display>prior to enrollment in the electronic exchange of clinical health records the <ln numlevel="1" lineno="225" slineno="4-27"/>member shall receive notice of the enrollment in the electronic exchange of <ln numlevel="1" lineno="226" slineno="4-28"/>clinical health records and the right to opt out of participation at any time; and</subsection><subsection ssid="11-null-17" dnum="C-o" numlevel="1" lineno="227" slineno="4-29" level="4"><display>(C)</display>beginning July 1, 2012, when the program sends enrollment or renewal <ln numlevel="1" lineno="228" slineno="4-30"/>information to the member and when the member logs onto the program's <ln numlevel="1" lineno="229" slineno="4-31"/>website, the member shall receive notice of the right to opt out of the electronic <ln numlevel="1" lineno="230" slineno="4-32"/>exchange of clinical health records.</subsection></subsection></subsection></subsection><subsection ssid="11-18" dnum="_-o:3-i" numlevel="1" lineno="231" slineno="4-33" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="11-19" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">Before July 1, 2026, the department shall apply for a state plan amendment to <ln numlevel="1" lineno="232" slineno="4-34"/>transition the state's Children's Health Insurance Program from a separate program <ln numlevel="1" lineno="233" slineno="4-35"/>under 42 U.S.C. Sec. 1397aa(a)(1), to providing benefits under the state's Medicaid <ln numlevel="1" lineno="234" slineno="4-36"/>program under 42 U.S.C. Sec. 1397aa(1)(2).</amend></subsection><subsection ssid="11-20" dnum="_-o:b-i" numlevel="1" lineno="235" slineno="4-37" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">If the application described in Subsection <xref depth="4" refnumber="26B-3-902(3)(a)">(3)(a)</xref> is approved, and the state's <ln numlevel="1" lineno="236" slineno="4-38"/>Children's Health Insurance Program transitions as described in Subsection <xref depth="4" refnumber="26B-3-902(3)(a)">(3)(a)</xref>, to <ln numlevel="1" lineno="237" slineno="4-39"/>the extent possible, dental services for individuals covered by the state's Children's <ln numlevel="1" lineno="238" slineno="4-40"/>Health Insurance Program shall be provided through the University of Utah School of <ln numlevel="1" lineno="239" slineno="4-41"/>Dentistry and the University of Utah School of Dentistry's associated statewide <ln numlevel="1" lineno="240" slineno="4-42"/>network.</amend></subsection></subsection></section></bsec><bsec buid="24" num="59-14-807" type="amend" src="code" uid="C59-14-S807_2026050620260506" sort="59 14 08070020260506" numlevel="1" lineno="241" slineno="5-1" sn="5"><section number="59-14-807" numlevel="1" lineno="242" slineno="5-2" type="amend"><secline lineno="241">Section 5. Electronic <ln numlevel="1" lineno="243" slineno="5-3"/>Cigarette Substance and Nicotine Product Proceeds Restricted Account.</bold></catline><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="244" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>There is created within the General Fund a restricted account known as the "Electronic <ln numlevel="1" lineno="245" slineno="5-5"/>Cigarette Substance and Nicotine Product Proceeds Restricted Account."</subsection><subsection ssid="24-null-2" dnum="2-o" numlevel="1" lineno="246" slineno="5-6" level="1"><display>(2)</display>The Electronic Cigarette Substance and Nicotine Product Proceeds Restricted Account <ln numlevel="1" lineno="247" slineno="5-7"/>consists of:<subsection ssid="24-null-3" dnum="a-o" numlevel="1" lineno="248" slineno="5-8" level="2"><display>(a)</display>revenue collected from the tax imposed by Section <xref depth="3" refnumber="59-14-804">59-14-804</xref>;</subsection><subsection ssid="24-null-4" dnum="b-o" numlevel="1" lineno="249" slineno="5-9" level="2"><display>(b)</display>fees and penalties collected under Section <xref depth="3" refnumber="59-14-810">59-14-810</xref>;</subsection><subsection ssid="24-null-5" dnum="c-o" numlevel="1" lineno="250" slineno="5-10" level="2"><display>(c)</display>all money received by the attorney general or the Department of Commerce as a <ln numlevel="1" lineno="251" slineno="5-11"/>result of any judgment, settlement, or compromise of claims pertaining to alleged <ln numlevel="1" lineno="252" slineno="5-12"/>violations of law related to the manufacture, marketing, distribution, or sale of <ln numlevel="1" lineno="253" slineno="5-13"/>electronic cigarette products, as defined in Section <xref depth="3" refnumber="76-9-1101">76-9-1101</xref>:<subsection ssid="24-null-6" dnum="i-o" numlevel="1" lineno="254" slineno="5-14" level="3"><display>(i)</display>if the total amount of the judgment, settlement, or compromise received by the <ln numlevel="1" lineno="255" slineno="5-15"/>state exceeds $1,000,000; and</subsection><subsection ssid="24-null-7" dnum="ii-o" numlevel="1" lineno="256" slineno="5-16" level="3"><display>(ii)</display>after reimbursement to the attorney general and the Department of Commerce for <ln numlevel="1" lineno="257" slineno="5-17"/>expenses related to the matters described in this Subsection <xref depth="4" refnumber="59-14-807(2)(c)">(2)(c)</xref>; and</subsection></subsection><subsection ssid="24-null-8" dnum="d-o" numlevel="1" lineno="258" slineno="5-18" level="2"><display>(d)</display>amounts appropriated by the Legislature.</subsection></subsection><subsection ssid="24-null-9" dnum="3-o" numlevel="1" lineno="259" slineno="5-19" level="1" space="false"><display>(3)</display><subsection ssid="24-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsections <xref depth="4" refnumber="59-14-807(3)(b)">(3)(b)</xref> and <xref depth="4" refnumber="59-14-807(c)">(c)</xref>, for each fiscal year and subject to <ln numlevel="1" lineno="260" slineno="5-20"/>appropriation by the Legislature, the Division of Finance shall distribute from the <ln numlevel="1" lineno="261" slineno="5-21"/>Electronic Cigarette Substance and Nicotine Product Proceeds Restricted Account:<subsection ssid="24-null-11" dnum="i-o" numlevel="1" lineno="262" slineno="5-22" level="3" tab="1"><display>(i)</display>$2,000,000 to the Department of Health and Human Services for enforcement <ln numlevel="1" lineno="263" slineno="5-23"/>services aimed at disrupting organizations and networks that provide tobacco <ln numlevel="1" lineno="264" slineno="5-24"/>products, electronic cigarette products, nicotine products, or other illegal <ln numlevel="1" lineno="265" slineno="5-25"/>controlled substances to minors, which the Department of Health and Human <ln numlevel="1" lineno="266" slineno="5-26"/>Services shall allocate to the local health departments using the formula created in <ln numlevel="1" lineno="267" slineno="5-27"/>accordance with Section <xref depth="3" refnumber="26A-1-116">26A-1-116</xref>;</subsection><subsection ssid="24-null-12" dnum="ii-o" numlevel="1" lineno="268" slineno="5-28" level="3" tab="1"><display>(ii)</display>$1,180,000 to the Department of Public Safety for law enforcement officers <ln numlevel="1" lineno="269" slineno="5-29"/>aimed at disrupting organizations and networks that provide tobacco products, <ln numlevel="1" lineno="270" slineno="5-30"/>electronic cigarette products, nicotine products, and other illegal controlled <ln numlevel="1" lineno="271" slineno="5-31"/>substances to minors;</subsection><subsection ssid="24-null-13" dnum="iii-o" numlevel="1" lineno="272" slineno="5-32" level="3" tab="1"><display>(iii)</display>$1,000,000 to the Department of Health and Human Services for enforcement <ln numlevel="1" lineno="273" slineno="5-33"/>services aimed at disrupting organizations and networks that provide tobacco <ln numlevel="1" lineno="274" slineno="5-34"/>products, electronic cigarette products, nicotine products, and other illegal <ln numlevel="1" lineno="275" slineno="5-35"/>controlled substances to minors;</subsection><subsection ssid="24-null-14" dnum="iv-o" numlevel="1" lineno="276" slineno="5-36" level="3" tab="1"><display>(iv)</display>$3,000,000 to the Department of Health and Human Services for community <ln numlevel="1" lineno="277" slineno="5-37"/>partner prevention programs, which the Department of Health and Human <ln numlevel="1" lineno="278" slineno="5-38"/>Services shall allocate to the local health departments using the formula created in <ln numlevel="1" lineno="279" slineno="5-39"/>accordance with Section <xref depth="3" refnumber="26A-1-116">26A-1-116</xref>;</subsection><subsection ssid="24-null-15" dnum="v-o" numlevel="1" lineno="280" slineno="5-40" level="3" tab="1"><display>(v)</display>$1,000,000 to the Department of Health and Human Services for statewide <ln numlevel="1" lineno="281" slineno="5-41"/>cessation programs and prevention education;</subsection><subsection ssid="24-null-16" dnum="vi-o" numlevel="1" lineno="282" slineno="5-42" level="3" tab="1"><display>(vi)</display>$2,000,000 to the Department of Health and Human Services for alcohol, <ln numlevel="1" lineno="283" slineno="5-43"/>tobacco, and other drug prevention, reduction, cessation, and control programs <ln numlevel="1" lineno="284" slineno="5-44"/>that promote unified messages and make use of media outlets, including radio, <ln numlevel="1" lineno="285" slineno="5-45"/>newspaper, billboards, and television; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="ahaskell" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="24-45" dnum="_-o:vii-i" numlevel="1" lineno="286" slineno="5-46" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">$759,700 to the Department of Health and Human Services for the Office of <ln numlevel="1" lineno="287" slineno="5-47"/>Substance Use and Mental Health to provide substance use treatment and <ln numlevel="1" lineno="288" slineno="5-48"/>prevention services, including Medicaid matching funds for substance use <ln numlevel="1" lineno="289" slineno="5-49"/>treatment services; and</amend></subsection><subsection ssid="24-null-17" dnum="vii-o:viii-i" numlevel="1" lineno="290" slineno="5-50" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1125" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="both" space="true">(viii)</amend></display>$5,084,200 to the State Board of Education for school-based prevention <ln numlevel="1" lineno="291" slineno="5-51"/>programs.</subsection></subsection><subsection ssid="24-null-18" dnum="b-o" numlevel="1" lineno="292" slineno="5-52" level="2"><display>(b)</display>If the amount in the Electronic Cigarette Substance and Nicotine Product Proceeds <ln numlevel="1" lineno="293" slineno="5-53"/>Restricted Account is insufficient to cover the distributions described in Subsection <xref depth="4" refnumber="59-14-807(3)(a)"><ln numlevel="1" lineno="294" slineno="5-54"/>(3)(a)</xref>, the Division of Finance shall make the distributions under Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>:<subsection ssid="24-null-19" dnum="i-o" numlevel="1" lineno="295" slineno="5-55" level="3"><display>(i)</display>sequentially in the order of priority the distributions are listed under Subsection <xref depth="4" refnumber="59-14-807(3)(a)"><ln numlevel="1" lineno="296" slineno="5-56"/>(3)(a)</xref>;</subsection><subsection ssid="24-null-20" dnum="ii-o" numlevel="1" lineno="297" slineno="5-57" level="3"><display>(ii)</display>in full or, if insufficient funds are available to satisfy the next distribution in the <ln numlevel="1" lineno="298" slineno="5-58"/>sequence, in part; and</subsection><subsection ssid="24-null-21" dnum="iii-o" numlevel="1" lineno="299" slineno="5-59" level="3"><display>(iii)</display>until the available funds in the Electronic Cigarette Substance and Nicotine <ln numlevel="1" lineno="300" slineno="5-60"/>Product Proceeds Restricted Account are exhausted.</subsection></subsection><subsection ssid="24-null-22" dnum="c-o" numlevel="1" lineno="301" slineno="5-61" level="2"><display>(c)</display>For each fiscal year and subject to appropriation by the Legislature, the Division of <ln numlevel="1" lineno="302" slineno="5-62"/>Finance shall distribute from the funds deposited under Section <xref depth="3" refnumber="59-14-810">59-14-810</xref> into the <ln numlevel="1" lineno="303" slineno="5-63"/>Electronic Cigarette Substance and Nicotine Product Proceeds Restricted Account:<subsection ssid="24-null-23" dnum="i-o" numlevel="1" lineno="304" slineno="5-64" level="3"><display>(i)</display>to the commission, in an amount equal to the amount necessary to create and <ln numlevel="1" lineno="305" slineno="5-65"/>maintain the registry described in Section <xref depth="3" refnumber="59-14-810">59-14-810</xref>;</subsection><subsection ssid="24-null-24" dnum="ii-o" numlevel="1" lineno="306" slineno="5-66" level="3"><display>(ii)</display>to the Department of Health and Human Services, in an amount necessary for <ln numlevel="1" lineno="307" slineno="5-67"/>completing duties described in Section <xref depth="3" refnumber="59-14-810">59-14-810</xref>; and</subsection><subsection ssid="24-null-25" dnum="iii-o" numlevel="1" lineno="308" slineno="5-68" level="3"><display>(iii)</display>to the Department of Health and Human Services, the remainder to be divided <ln numlevel="1" lineno="309" slineno="5-69"/>among the local health departments for inspection and enforcement described in <ln numlevel="1" lineno="310" slineno="5-70"/>Sections <xref depth="3" refnumber="26A-1-131">26A-1-131</xref> and <xref depth="3" refnumber="59-14-810">59-14-810</xref>.</subsection></subsection></subsection><subsection ssid="24-null-26" dnum="4-o" numlevel="1" lineno="311" slineno="5-71" level="1" space="false"><display>(4)</display><subsection ssid="24-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The local health departments shall use the money received in accordance with <ln numlevel="1" lineno="312" slineno="5-72"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref> for enforcing:<subsection ssid="24-null-28" dnum="i-o" numlevel="1" lineno="313" slineno="5-73" level="3" tab="1"><display>(i)</display>the regulation provisions described in Section <xref depth="3" refnumber="26B-7-505">26B-7-505</xref>;</subsection><subsection ssid="24-null-29" dnum="ii-o" numlevel="1" lineno="314" slineno="5-74" level="3" tab="1"><display>(ii)</display>the labeling requirement described in Section <xref depth="3" refnumber="26B-7-505">26B-7-505</xref>; and</subsection><subsection ssid="24-null-30" dnum="iii-o" numlevel="1" lineno="315" slineno="5-75" level="3" tab="1"><display>(iii)</display>the penalty provisions described in Section <xref depth="3" refnumber="26B-7-518">26B-7-518</xref>.</subsection></subsection><subsection ssid="24-null-31" dnum="b-o" numlevel="1" lineno="316" slineno="5-76" level="2"><display>(b)</display>The Department of Health and Human Services shall use the money received in <ln numlevel="1" lineno="317" slineno="5-77"/>accordance with Subsection <xref tempid="776" depth="4" refnumber="59-14-807(3)(a)(v)">(3)(a)(v)</xref> for the Youth Electronic Cigarette, Marijuana, <ln numlevel="1" lineno="318" slineno="5-78"/>and Other Drug Prevention Program created in Section <xref depth="3" refnumber="26B-1-428">26B-1-428</xref>.</subsection><subsection ssid="24-null-32" dnum="c-o" numlevel="1" lineno="319" slineno="5-79" level="2"><display>(c)</display>The local health departments shall use the money received in accordance with <ln numlevel="1" lineno="320" slineno="5-80"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)(iv)">(3)(a)(iv)</xref> to issue grants under the Electronic Cigarette, Marijuana, and <ln numlevel="1" lineno="321" slineno="5-81"/>Other Drug Prevention Grant Program created in Section <xref depth="3" refnumber="26A-1-129">26A-1-129</xref>.</subsection><subsection ssid="24-null-33" dnum="d-o" numlevel="1" lineno="322" slineno="5-82" level="2"><display>(d)</display>The State Board of Education shall use the money received in accordance with <ln numlevel="1" lineno="323" slineno="5-83"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)(vii)">(3)(a)(vii)</xref> to distribute to local education agencies to pay for:<subsection ssid="24-null-34" dnum="i-o" numlevel="1" lineno="324" slineno="5-84" level="3" space="false"><display>(i)</display><subsection ssid="24-null-35" dnum="A-o" level="4" placement="sameline"><display>(A)</display>stipends for positive behaviors specialists as described in Subsection <xref depth="4" refnumber="53G-10-407(4)(a)(i)"><ln numlevel="1" lineno="325" slineno="5-85"/>53G-10-407(4)(a)(i)</xref>;</subsection><subsection ssid="24-null-36" dnum="B-o" numlevel="1" lineno="326" slineno="5-86" level="4"><display>(B)</display>the cost of administering the positive behaviors plan as described in <ln numlevel="1" lineno="327" slineno="5-87"/>Subsection <xref depth="4" refnumber="53G-10-407(4)(a)(ii)">53G-10-407(4)(a)(ii)</xref>; and</subsection><subsection ssid="24-null-37" dnum="C-o" numlevel="1" lineno="328" slineno="5-88" level="4"><display>(C)</display>the cost of implementing an Underage Drinking and Substance Abuse <ln numlevel="1" lineno="329" slineno="5-89"/>Prevention Program in grade 4 or 5, as described in Subsection <xref depth="4" refnumber="53G-10-406(3)(b)"><ln numlevel="1" lineno="330" slineno="5-90"/>53G-10-406(3)(b)</xref>; or</subsection></subsection><subsection ssid="24-null-38" dnum="ii-o" numlevel="1" lineno="331" slineno="5-91" level="3"><display>(ii)</display>a comprehensive prevention plan, as that term is defined in Section <xref depth="3" refnumber="53F-2-525">53F-2-525</xref>.</subsection></subsection></subsection><subsection ssid="24-null-39" dnum="5-o" numlevel="1" lineno="332" slineno="5-92" level="1" space="false"><display>(5)</display><subsection ssid="24-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The fund shall earn interest.</subsection><subsection ssid="24-null-41" dnum="b-o" numlevel="1" lineno="333" slineno="5-93" level="2"><display>(b)</display>All interest earned on fund money shall be deposited into the fund.</subsection></subsection><subsection ssid="24-null-42" dnum="6-o" numlevel="1" lineno="334" slineno="5-94" level="1"><display>(6)</display>Subject to legislative appropriations, funds remaining in the Electronic Cigarette <ln numlevel="1" lineno="335" slineno="5-95"/>Substance and Nicotine Product Proceeds Restricted Account after the distribution <ln numlevel="1" lineno="336" slineno="5-96"/>described in Subsection <xref depth="4" refnumber="59-14-807(3)">(3)</xref> may only be used for:<subsection ssid="24-null-43" dnum="a-o" numlevel="1" lineno="337" slineno="5-97" level="2"><display>(a)</display>funding commission personnel to enforce compliance with the tax collection <ln numlevel="1" lineno="338" slineno="5-98"/>requirements of this part; and</subsection><subsection ssid="24-null-44" dnum="b-o" numlevel="1" lineno="339" slineno="5-99" level="2"><display>(b)</display>programs and activities related to the prevention and cessation of electronic cigarette, <ln numlevel="1" lineno="340" slineno="5-100"/>nicotine products, marijuana, and other drug use.</subsection></subsection></section></bsec><bsec buid="30" type="uncod" untype="approp" src="uncod" uid="APP2026" sort="UP0002026" langlock="false" numlevel="1" lineno="341" slineno="6-1" sn="6"><section type="uncod" nodeid="2" fy="2026" untype="approp" display="false" src="uncod"><secline lineno="341">Section 6.  <bold>FY 2026 Appropriations.</bold></secline><sectionText lineno="342"><summary numlevel="1" lineno="342" slineno="6-2">The following sums of money are appropriated for the fiscal year beginning July 1, <ln numlevel="1" lineno="343" slineno="6-3"/>2025, and ending June 30, 2026.
