Section <bold>81-4-401</bold> is amended to read:</secline><catline lineno="23"><bold>81-4-401<parens/>. Definitions for part.</bold></catline><sectionText lineno="24"><tab/>As used in this part:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-4" level="1"><display>(1)</display>"Cohabitation" means the same as the term, "cohabit," is defined in Section <xref depth="3" refnumber="81-4-501">81-4-501</xref>.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="26" slineno="1-5" level="1"><display>(2)</display>"Mandatory courses" means:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="27" slineno="1-6" level="2"><display>(a)</display>the mandatory divorce orientation course described in Section <xref depth="3" refnumber="81-4-105">81-4-105</xref>; and</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="28" slineno="1-7" level="2"><display>(b)</display>the mandatory parenting course described in Section <xref depth="3" refnumber="81-9-103">81-9-103</xref>.</subsection></subsection><subsection ssid="3-7" dnum="_-o:3-i" numlevel="1" lineno="29" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="3-14" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">"Marital property" means any property, debt, or obligation acquired by a spouse, <ln numlevel="1" lineno="30" slineno="1-9"/>or both spouses, during the marriage.</amend></subsection><subsection ssid="3-24" dnum="_-o:b-i" numlevel="1" lineno="31" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">"Marital property" includes:</amend><subsection ssid="3-16" dnum="_-o:i-i" numlevel="1" lineno="32" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">any property, debt, or obligation that was acquired before the marriage by a <ln numlevel="1" lineno="33" slineno="1-12"/>spouse and the property, debt, or obligation has become mixed in with a property, <ln numlevel="1" lineno="34" slineno="1-13"/>debt, or obligation acquired during the marriage, to the extent that it is no longer <ln numlevel="1" lineno="35" slineno="1-14"/>reasonably possible to distinguish between the property, debt, or obligation that <ln numlevel="1" lineno="36" slineno="1-15"/>was acquired before the marriage; or</amend></subsection><subsection ssid="3-17" dnum="_-o:ii-i" numlevel="1" lineno="37" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">a spouse's property, debt, or obligation that was acquired before the marriage for <ln numlevel="1" lineno="38" slineno="1-17"/>which the other spouse has augmented, maintained, or protected and acquired an <ln numlevel="1" lineno="39" slineno="1-18"/>equitable interest in the property, debt, or obligation.</amend></subsection></subsection><subsection ssid="3-18" dnum="_-o:c-i" numlevel="1" lineno="40" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">"Marital property" does not include:</amend><subsection ssid="3-28" dnum="_-o:i-i" numlevel="1" lineno="41" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection <xref depth="4" refnumber="81-4-401(3)(b)">(</xref>3)(b), any property, debt, or obligation acquired <ln numlevel="1" lineno="42" slineno="1-21"/>before the marriage;</amend></subsection><subsection ssid="3-20" dnum="_-o:ii-i" numlevel="1" lineno="43" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">any property acquired by gift, bequest, devise, or descent;</amend></subsection><subsection ssid="3-21" dnum="_-o:iii-i" numlevel="1" lineno="44" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">any property acquired in exchange for property acquired before the marriage or <ln numlevel="1" lineno="45" slineno="1-24"/>in exchange for property acquired by gift, bequest, devise, or descent;</amend></subsection><subsection ssid="3-22" dnum="_-o:iv-i" numlevel="1" lineno="46" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">any property, debt, or obligation excluded by valid agreement of the spouses; or</amend></subsection><subsection ssid="3-23" dnum="_-o:v-i" numlevel="1" lineno="47" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">any increase in value of property described in Subsection <xref depth="4" refnumber="81-4-401(3)(c)(i)">(3)(c)(i)</xref> through <xref depth="4" refnumber="81-4-401(iv)">(iv)</xref>.</amend></subsection></subsection></subsection><subsection ssid="3-null-5" dnum="3-o:4-i" numlevel="1" lineno="48" slineno="1-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Petitioner" means the individual who brings a petition for divorce.</subsection><subsection ssid="3-null-6" dnum="4-o:5-i" numlevel="1" lineno="49" slineno="1-28" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Respondent" means the individual against whom a petition for divorce is brought.</subsection></section></bsec><bsec buid="1" num="81-4-406" type="amend" src="code" uid="C81-4-S406_2026050620260506" sort="81 04 04060020260506" numlevel="1" lineno="50" slineno="2-1" sn="2"><section number="81-4-406" numlevel="1" lineno="51" slineno="2-2" type="amend"><secline lineno="50">Section 2. Section <bold>81-4-406</bold> is amended to read:</secline><catline lineno="51"><bold>81-4-406<parens/>. Decree of divorce -- When decree becomes absolute -- Remarriage -- <ln numlevel="1" lineno="52" slineno="2-3"/>Jurisdiction to modify a decree for a child born after the decree.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="53" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall enter a decree of divorce upon the evidence or the petitioner's <ln numlevel="1" lineno="54" slineno="2-5"/>affidavit in the case of default as described in Subsection <xref depth="4" refnumber="81-4-406(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="55" slineno="2-6" level="2"><display>(b)</display>A court may not grant a divorce upon default, unless there is evidence to support a <ln numlevel="1" lineno="56" slineno="2-7"/>decree of divorce upon an affidavit by the petitioner as provided by Rule 104 of the <ln numlevel="1" lineno="57" slineno="2-8"/>Utah Rules of Civil Procedure.</subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="58" slineno="2-9" level="1"><display>(2)</display>Unless the requirement is waived by the court under Subsection <xref depth="4" refnumber="81-4-402(5)">81-4-402(5)</xref>, a court <ln numlevel="1" lineno="59" slineno="2-10"/>may not grant a decree of divorce for parties with a minor child until:<subsection ssid="1-null-5" dnum="a-o" numlevel="1" lineno="60" slineno="2-11" level="2"><display>(a)</display>both parties have attended the mandatory courses described in Sections <xref depth="3" refnumber="81-4-105">81-4-105</xref> and <xref depth="3" refnumber="81-4-106"><ln numlevel="1" lineno="61" slineno="2-12"/>81-4-106</xref>; and</subsection><subsection ssid="1-null-6" dnum="b-o" numlevel="1" lineno="62" slineno="2-13" level="2"><display>(b)</display>both parties have presented a certificate of course completion for each course to the <ln numlevel="1" lineno="63" slineno="2-14"/>court.</subsection></subsection><subsection ssid="1-null-7" dnum="3-o" numlevel="1" lineno="64" slineno="2-15" level="1"><display>(3)</display>In a decree of divorce, the court shall:<subsection ssid="1-null-8" dnum="a-o" numlevel="1" lineno="65" slineno="2-16" level="2"><display>(a)</display>specify which party is responsible for the payment of joint debts, obligations, or <ln numlevel="1" lineno="66" slineno="2-17"/>liabilities of the parties contracted or incurred during marriage in accordance with <ln numlevel="1" lineno="67" slineno="2-18"/>Section <xref depth="3" refnumber="15-4-6.5">15-4-6.5</xref>;</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="68" slineno="2-19" level="2"><display>(b)</display>require the parties to notify respective creditors or obligees, regarding the court's <ln numlevel="1" lineno="69" slineno="2-20"/>division of debts, obligations, or liabilities and regarding the parties' separate and <ln numlevel="1" lineno="70" slineno="2-21"/>current addresses in accordance with Section <xref depth="3" refnumber="15-4-6.5">15-4-6.5</xref>;</subsection><subsection ssid="1-null-10" dnum="c-o" numlevel="1" lineno="71" slineno="2-22" level="2"><display>(c)</display>provide for the enforcement of the orders described in Subsections <xref depth="4" refnumber="81-4-406(1)(a)">(1)(a)</xref> and <xref depth="4" refnumber="81-4-406(b)">(b)</xref>;</subsection><subsection ssid="1-null-11" dnum="d-o" numlevel="1" lineno="72" slineno="2-23" level="2"><display>(d)</display>if a party owns a life insurance policy or an annuity contract, include an <ln numlevel="1" lineno="73" slineno="2-24"/>acknowledgment by the court that the party:<subsection ssid="1-null-12" dnum="i-o" numlevel="1" lineno="74" slineno="2-25" level="3"><display>(i)</display>has reviewed and updated, where appropriate, the list of beneficiaries;</subsection><subsection ssid="1-null-13" dnum="ii-o" numlevel="1" lineno="75" slineno="2-26" level="3"><display>(ii)</display>has affirmed that those listed as beneficiaries are in fact the intended beneficiaries <ln numlevel="1" lineno="76" slineno="2-27"/>after the divorce becomes final; and</subsection><subsection ssid="1-null-14" dnum="iii-o" numlevel="1" lineno="77" slineno="2-28" level="3"><display>(iii)</display>understands that, if no changes are made to the policy or contract, the <ln numlevel="1" lineno="78" slineno="2-29"/>beneficiaries currently listed will receive any funds paid by the insurance <ln numlevel="1" lineno="79" slineno="2-30"/>company under the terms of the policy or contract; and</subsection></subsection><subsection ssid="1-null-15" dnum="e-o" numlevel="1" lineno="80" slineno="2-31" level="2"><display>(e)</display>if the parties have a child as defined in Section <xref depth="3" refnumber="81-6-101">81-6-101</xref>, include:<subsection ssid="1-null-16" dnum="i-o" numlevel="1" lineno="81" slineno="2-32" level="3"><display>(i)</display>an order for child support and medical expenses as described in Chapter 6, Child <ln numlevel="1" lineno="82" slineno="2-33"/>Support;</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="83" slineno="2-34" level="3"><display>(ii)</display>a provision in the child support order that requires payment of an ongoing <ln numlevel="1" lineno="84" slineno="2-35"/>expense for child care subject to the procedures and requirements of Section <xref depth="3" refnumber="81-6-209.5"><ln numlevel="1" lineno="85" slineno="2-36"/>81-6-209.5</xref>; and</subsection><subsection ssid="1-null-18" dnum="iii-o" numlevel="1" lineno="86" slineno="2-37" level="3"><display>(iii)</display>a statement providing notice that the Office of Recovery Services provides <ln numlevel="1" lineno="87" slineno="2-38"/>services to individuals who are seeking assistance in the collection or enforcement <ln numlevel="1" lineno="88" slineno="2-39"/>of child support orders.</subsection></subsection></subsection><subsection ssid="1-null-19" dnum="4-o" numlevel="1" lineno="89" slineno="2-40" level="1"><display>(4)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="50" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Subsection <xref depth="4" refnumber="81-4-406(5)">(5)</xref>, the</amend> court may include in the divorce decree any <ln numlevel="1" lineno="90" slineno="2-41"/>equitable orders relating to:<subsection ssid="1-null-20" dnum="a-o" numlevel="1" lineno="91" slineno="2-42" level="2"><display>(a)</display>the parties, including any alimony to be awarded to a party in accordance with Part 5, <ln numlevel="1" lineno="92" slineno="2-43"/>Spousal Support;</subsection><subsection ssid="1-null-21" dnum="b-o" numlevel="1" lineno="93" slineno="2-44" level="2"><display>(b)</display>a child of the parties; and</subsection><subsection ssid="1-null-22" dnum="c-o" numlevel="1" lineno="94" slineno="2-45" level="2"><display>(c)</display>any <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">property, debts, or obligations</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">marital property</amend>.</subsection></subsection><subsection ssid="1-32" dnum="_-o:5-i" numlevel="1" lineno="95" slineno="2-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="1-41" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">The court shall presume under Subsection <xref depth="4" refnumber="81-4-406(4)">(4)</xref> that marital property be divided <ln numlevel="1" lineno="96" slineno="2-47"/>equally between the parties.</amend></subsection><subsection ssid="1-33" dnum="_-o:b-i" numlevel="1" lineno="97" slineno="2-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">A party may overcome the presumption described in Subsection <xref depth="4" refnumber="81-4-406(5)(a)">(5)(a)</xref> by <ln numlevel="1" lineno="98" slineno="2-49"/>establishing that there is an exceptional circumstance that warrants marital property <ln numlevel="1" lineno="99" slineno="2-50"/>be divided unequally between the parties.</amend></subsection><subsection ssid="1-39" dnum="_-o:c-i" numlevel="1" lineno="100" slineno="2-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">An exceptional circumstance under Subsection <xref depth="4" refnumber="81-4-406(5)(b)">(5)(b)</xref> includes:</amend><subsection ssid="1-40" dnum="_-o:i-i" numlevel="1" lineno="101" slineno="2-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">a party substantially undermining the financial stability of the other party or a <ln numlevel="1" lineno="102" slineno="2-53"/>minor child of the parties; or</amend></subsection><subsection ssid="1-42" dnum="_-o:ii-i" numlevel="1" lineno="103" slineno="2-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">the wasteful, irresponsible, or intentional depletion of marital property by a party <ln numlevel="1" lineno="104" slineno="2-55"/>in anticipation of a divorce.</amend></subsection></subsection></subsection><subsection ssid="1-null-23" dnum="5-o:6-i" numlevel="1" lineno="105" slineno="2-56" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>A decree of divorce becomes absolute:<subsection ssid="1-null-24" dnum="a-o" numlevel="1" lineno="106" slineno="2-57" level="2"><display>(a)</display>on the date it is signed by the court and entered by the clerk in the register of actions;</subsection><subsection ssid="1-null-25" dnum="b-o" numlevel="1" lineno="107" slineno="2-58" level="2"><display>(b)</display>at the expiration of a period of time the court may specifically designate, unless an <ln numlevel="1" lineno="108" slineno="2-59"/>appeal or other proceedings for review are pending;</subsection><subsection ssid="1-null-26" dnum="c-o" numlevel="1" lineno="109" slineno="2-60" level="2"><display>(c)</display>if an appeal is taken, when the decree is affirmed; or</subsection><subsection ssid="1-null-27" dnum="d-o" numlevel="1" lineno="110" slineno="2-61" level="2"><display>(d)</display>when the court, before the decree becomes absolute, for sufficient cause otherwise <ln numlevel="1" lineno="111" slineno="2-62"/>orders.</subsection></subsection><subsection ssid="1-null-28" dnum="6-o:7-i" numlevel="1" lineno="112" slineno="2-63" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>The court, upon application or on the court's own motion for good cause shown, <ln numlevel="1" lineno="113" slineno="2-64"/>may waive, alter, or extend a designated period of time before the decree becomes <ln numlevel="1" lineno="114" slineno="2-65"/>absolute, but not to exceed six months from the signing and entry of the decree.</subsection><subsection ssid="1-null-29" dnum="7-o:8-i" numlevel="1" lineno="115" slineno="2-66" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>A party to a divorce proceeding may not marry another individual other than the <ln numlevel="1" lineno="116" slineno="2-67"/>other party for whom the divorce was granted until the party's divorce becomes absolute.</subsection><subsection ssid="1-null-30" dnum="8-o:9-i" numlevel="1" lineno="117" slineno="2-68" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>The court has jurisdiction to modify a decree of divorce to address child support, <ln numlevel="1" lineno="118" slineno="2-69"/>parent-time, and other matters related to a minor child born to the parties after the decree <ln numlevel="1" lineno="119" slineno="2-70"/>of divorce is entered.</subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="120" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="120">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="121"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-26-26 9:00 AM</tm></rev></foot></leg>
