Wilcox</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill concerns the use of surveillance and investigatory technology.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">establishes limitations on the ability of a law enforcement agency to use a surveillance or <ln numlevel="1" lineno="10" slineno="0-10"/>investigatory technology;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">provides for the exclusion of information obtained in violation of law in certain <ln numlevel="1" lineno="12" slineno="0-12"/>circumstances; </hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">creates a private right of action against a law enforcement agency for the law enforcement <ln numlevel="1" lineno="14" slineno="0-14"/>agency's prohibited use of a surveillance or investigatory technology, and waives <ln numlevel="1" lineno="15" slineno="0-15"/>governmental immunity for the private right of action;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">requires a law enforcement agency to annually report information concerning the law <ln numlevel="1" lineno="17" slineno="0-17"/>enforcement agency's use of certain technology to the State Commission on Criminal <ln numlevel="1" lineno="18" slineno="0-18"/>and Juvenile Justice (commission);</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">requires the commission to annually collect and report information received from law <ln numlevel="1" lineno="20" slineno="0-20"/>enforcement agencies regarding the use of certain technology to the Law Enforcement <ln numlevel="1" lineno="21" slineno="0-21"/>and Criminal Justice Interim Committee; Section <bold>63G-7-301</bold> is amended to read:</secline><catline lineno="45"><bold>63G-7-301<parens/>. Waivers of immunity.</bold></catline><subsection ssid="49-null-1" dnum="1-o" numlevel="1" lineno="46" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="49-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Immunity from suit of each governmental entity is waived as to any contractual <ln numlevel="1" lineno="47" slineno="1-4"/>obligation.</subsection><subsection ssid="49-null-3" dnum="b-o" numlevel="1" lineno="48" slineno="1-5" level="2"><display>(b)</display>Actions arising out of contractual rights or obligations are not subject to the <ln numlevel="1" lineno="49" slineno="1-6"/>requirements of Section <xref depth="3" refnumber="63G-7-401">63G-7-401</xref>, <xref depth="3" refnumber="63G-7-402">63G-7-402</xref>, <xref depth="3" refnumber="63G-7-403">63G-7-403</xref>, or <xref depth="3" refnumber="63G-7-601">63G-7-601</xref>.</subsection><subsection ssid="49-null-4" dnum="c-o" numlevel="1" lineno="50" slineno="1-7" level="2"><display>(c)</display>The Division of Water Resources is not liable for failure to deliver water from a <ln numlevel="1" lineno="51" slineno="1-8"/>reservoir or associated facility authorized by Title <xref depth="1" refnumber="73-26">73, Chapter 26</xref>, Bear River <ln numlevel="1" lineno="52" slineno="1-9"/>Development Act, if the failure to deliver the contractual amount of water is due to <ln numlevel="1" lineno="53" slineno="1-10"/>drought, other natural condition, or safety condition that causes a deficiency in the <ln numlevel="1" lineno="54" slineno="1-11"/>amount of available water.</subsection></subsection><subsection ssid="49-null-5" dnum="2-o" numlevel="1" lineno="55" slineno="1-12" level="1"><display>(2)</display>Immunity from suit of each governmental entity is waived:<subsection ssid="49-null-6" dnum="a-o" numlevel="1" lineno="56" slineno="1-13" level="2"><display>(a)</display>as to any action brought to recover, obtain possession of, or quiet title to real or <ln numlevel="1" lineno="57" slineno="1-14"/>personal property;</subsection><subsection ssid="49-null-7" dnum="b-o" numlevel="1" lineno="58" slineno="1-15" level="2"><display>(b)</display>as to any action brought to foreclose mortgages or other liens on real or personal <ln numlevel="1" lineno="59" slineno="1-16"/>property, to determine any adverse claim on real or personal property, or to obtain an <ln numlevel="1" lineno="60" slineno="1-17"/>adjudication about any mortgage or other lien that the governmental entity may have <ln numlevel="1" lineno="61" slineno="1-18"/>or claim on real or personal property;</subsection><subsection ssid="49-null-8" dnum="c-o" numlevel="1" lineno="62" slineno="1-19" level="2"><display>(c)</display>as to any action based on the negligent destruction, damage, or loss of goods, <ln numlevel="1" lineno="63" slineno="1-20"/>merchandise, or other property while it is in the possession of any governmental <ln numlevel="1" lineno="64" slineno="1-21"/>entity or employee, if the property was seized for the purpose of forfeiture under any <ln numlevel="1" lineno="65" slineno="1-22"/>provision of state law;</subsection><subsection ssid="49-null-9" dnum="d-o" numlevel="1" lineno="66" slineno="1-23" level="2"><display>(d)</display>subject to Section <xref depth="3" refnumber="63G-7-302">63G-7-302</xref>, as to any action brought under the authority of Utah <ln numlevel="1" lineno="67" slineno="1-24"/>Constitution, Article I, Section 22, for the recovery of compensation from the <ln numlevel="1" lineno="68" slineno="1-25"/>governmental entity when the governmental entity has taken or damaged private <ln numlevel="1" lineno="69" slineno="1-26"/>property for public uses without just compensation;</subsection><subsection ssid="49-null-10" dnum="e-o" numlevel="1" lineno="70" slineno="1-27" level="2"><display>(e)</display>as to any claim for attorney fees or costs under Section <xref depth="3" refnumber="63G-2-209">63G-2-209</xref>, <xref depth="3" refnumber="63G-2-405">63G-2-405</xref>, or <xref depth="3" refnumber="63G-2-802"><ln numlevel="1" lineno="71" slineno="1-28"/>63G-2-802</xref>;</subsection><subsection ssid="49-null-11" dnum="f-o" numlevel="1" lineno="72" slineno="1-29" level="2"><display>(f)</display>for actual damages under Title <xref depth="1" refnumber="67-21">67, Chapter 21</xref>, Utah Protection of Public Employees <ln numlevel="1" lineno="73" slineno="1-30"/>Act;</subsection><subsection ssid="49-null-12" dnum="g-o" numlevel="1" lineno="74" slineno="1-31" level="2"><display>(g)</display>as to any action brought to obtain relief from a land use regulation that imposes a <ln numlevel="1" lineno="75" slineno="1-32"/>substantial burden on the free exercise of religion under Title <xref depth="1" refnumber="63L-5">63L, Chapter 5</xref>, Utah <ln numlevel="1" lineno="76" slineno="1-33"/>Religious Land Use Act;</subsection><subsection ssid="49-null-13" dnum="h-o" numlevel="1" lineno="77" slineno="1-34" level="2"><display>(h)</display>except as provided in Subsection <xref depth="4" refnumber="63G-7-201(3)">63G-7-201(3)</xref>, as to any injury caused by:<subsection ssid="49-null-14" dnum="i-o" numlevel="1" lineno="78" slineno="1-35" level="3"><display>(i)</display>a defective, unsafe, or dangerous condition of any highway, road, street, alley, <ln numlevel="1" lineno="79" slineno="1-36"/>crosswalk, sidewalk, culvert, tunnel, bridge, viaduct, or other structure located on <ln numlevel="1" lineno="80" slineno="1-37"/>them; or</subsection><subsection ssid="49-null-15" dnum="ii-o" numlevel="1" lineno="81" slineno="1-38" level="3"><display>(ii)</display>any defective or dangerous condition of a public building, structure, dam, <ln numlevel="1" lineno="82" slineno="1-39"/>reservoir, or other public improvement;</subsection></subsection><subsection ssid="49-null-16" dnum="i-o" numlevel="1" lineno="83" slineno="1-40" level="2"><display>(i)</display>subject to Subsections <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref> and <xref depth="4" refnumber="63G-7-201(4)">63G-7-201(4)</xref>, as to any injury proximately <ln numlevel="1" lineno="84" slineno="1-41"/>caused by a negligent act or omission of an employee committed within the scope of <ln numlevel="1" lineno="85" slineno="1-42"/>employment;</subsection><subsection ssid="49-null-17" dnum="j-o" numlevel="1" lineno="86" slineno="1-43" level="2"><display>(j)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, as to a claim for an injury resulting from a <ln numlevel="1" lineno="87" slineno="1-44"/>sexual battery, as provided in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, committed:<subsection ssid="49-null-18" dnum="i-o" numlevel="1" lineno="88" slineno="1-45" level="3"><display>(i)</display>against a student of a public elementary or secondary school, including a charter <ln numlevel="1" lineno="89" slineno="1-46"/>school; and</subsection><subsection ssid="49-null-19" dnum="ii-o" numlevel="1" lineno="90" slineno="1-47" level="3"><display>(ii)</display>by an employee of a public elementary or secondary school or charter school who:<subsection ssid="49-null-20" dnum="A-o" numlevel="1" lineno="91" slineno="1-48" level="4"><display>(A)</display>at the time of the sexual battery, held a position of special trust, as defined in <ln numlevel="1" lineno="92" slineno="1-49"/>Section <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, with respect to the student;</subsection><subsection ssid="49-null-21" dnum="B-o" numlevel="1" lineno="93" slineno="1-50" level="4"><display>(B)</display>is criminally charged in connection with the sexual battery; and</subsection><subsection ssid="49-null-22" dnum="C-o" numlevel="1" lineno="94" slineno="1-51" level="4"><display>(C)</display>the public elementary or secondary school or charter school knew or in the <ln numlevel="1" lineno="95" slineno="1-52"/>exercise of reasonable care should have known, at the time of the employee's <ln numlevel="1" lineno="96" slineno="1-53"/>hiring, to be a sex offender, a kidnap offender, or a child abuse offender as <ln numlevel="1" lineno="97" slineno="1-54"/>described in Section <xref depth="3" refnumber="53-29-202">53-29-202</xref>, required to register under Title 53, Chapter 29, <ln numlevel="1" lineno="98" slineno="1-55"/>Sex, Kidnap, and Child Abuse Offender Registry, whose status as a sex <ln numlevel="1" lineno="99" slineno="1-56"/>offender, kidnap offender, or child abuse offender would have been revealed in <ln numlevel="1" lineno="100" slineno="1-57"/>a background check under Section <xref depth="3" refnumber="53G-11-402">53G-11-402</xref>;</subsection></subsection></subsection><subsection ssid="49-null-23" dnum="k-o" numlevel="1" lineno="101" slineno="1-58" level="2"><display>(k)</display>as to any action brought under Section <xref depth="3" refnumber="78B-6-2303">78B-6-2303</xref>; </subsection><subsection ssid="49-null-24" dnum="l-o" numlevel="1" lineno="102" slineno="1-59" level="2"><display>(l)</display>as to any action brought to obtain relief under Title <xref depth="2" refnumber="53H-7-7">53H, Chapter 7, Part 7</xref>, Student <ln numlevel="1" lineno="103" slineno="1-60"/>Legal Representation;</subsection><subsection ssid="49-null-25" dnum="m-o" numlevel="1" lineno="104" slineno="1-61" level="2"><display>(m)</display>as to any action brought under Section <xref depth="3" refnumber="53-30-301">53-30-301</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="49-null-26" dnum="n-o" numlevel="1" lineno="105" slineno="1-62" level="2"><display>(n)</display>as to any action or suit brought under Section <xref depth="3" refnumber="20A-19-301">20A-19-301</xref> and as to any <ln numlevel="1" lineno="106" slineno="1-63"/>compensation or expenses awarded under Subsection <xref depth="4" refnumber="20A-19-301(5)">20A-19-301(5)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1" groupid="1" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="49-70" dnum="_-o:o-i" numlevel="1" lineno="107" slineno="1-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(o)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">as to any action brought under Section <xref depth="3" refnumber="77-23e-204">77-23e-204</xref>.</amend></subsection></subsection><subsection ssid="49-null-27" dnum="3-o" numlevel="1" lineno="108" slineno="1-65" level="1" space="false"><display>(3)</display><subsection ssid="49-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-301(3)">(3)</xref>:<subsection ssid="49-null-29" dnum="i-o" numlevel="1" lineno="109" slineno="1-66" level="3" tab="1"><display>(i)</display>"Code of conduct" means a code of conduct that:<subsection ssid="49-null-30" dnum="A-o" numlevel="1" lineno="110" slineno="1-67" level="4"><display>(A)</display>is not less stringent than a model code of conduct, created by the State Board <ln numlevel="1" lineno="111" slineno="1-68"/>of Education, establishing a professional standard of care for preventing the <ln numlevel="1" lineno="112" slineno="1-69"/>conduct described in Subsection <xref depth="4" refnumber="63G-7-301(3)(a)(i)(d)">(3)(a)(i)(D)</xref>;</subsection><subsection ssid="49-null-31" dnum="B-o" numlevel="1" lineno="113" slineno="1-70" level="4"><display>(B)</display>is adopted by the applicable local education governing body;</subsection><subsection ssid="49-null-32" dnum="C-o" numlevel="1" lineno="114" slineno="1-71" level="4"><display>(C)</display>regulates behavior of a school employee toward a student; and</subsection><subsection ssid="49-null-33" dnum="D-o" numlevel="1" lineno="115" slineno="1-72" level="4"><display>(D)</display>includes a prohibition against any sexual conduct between an employee and a <ln numlevel="1" lineno="116" slineno="1-73"/>student and against the employee and student sharing any sexually explicit or <ln numlevel="1" lineno="117" slineno="1-74"/>lewd communication, image, or photograph.</subsection></subsection><subsection ssid="49-null-34" dnum="ii-o" numlevel="1" lineno="118" slineno="1-75" level="3" tab="1"><display>(ii)</display>"Local education agency" means:<subsection ssid="49-null-35" dnum="A-o" numlevel="1" lineno="119" slineno="1-76" level="4"><display>(A)</display>a school district;</subsection><subsection ssid="49-null-36" dnum="B-o" numlevel="1" lineno="120" slineno="1-77" level="4"><display>(B)</display>a charter school; or</subsection><subsection ssid="49-null-37" dnum="C-o" numlevel="1" lineno="121" slineno="1-78" level="4"><display>(C)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="49-null-38" dnum="iii-o" numlevel="1" lineno="122" slineno="1-79" level="3" tab="1"><display>(iii)</display>"Local education governing board" means:<subsection ssid="49-null-39" dnum="A-o" numlevel="1" lineno="123" slineno="1-80" level="4"><display>(A)</display>for a school district, the local school board;</subsection><subsection ssid="49-null-40" dnum="B-o" numlevel="1" lineno="124" slineno="1-81" level="4"><display>(B)</display>for a charter school, the charter school governing board; or</subsection><subsection ssid="49-null-41" dnum="C-o" numlevel="1" lineno="125" slineno="1-82" level="4"><display>(C)</display>for the Utah Schools for the Deaf and the Blind, the state board.</subsection></subsection><subsection ssid="49-null-42" dnum="iv-o" numlevel="1" lineno="126" slineno="1-83" level="3" tab="1"><display>(iv)</display>"Public school" means a public elementary or secondary school.</subsection><subsection ssid="49-null-43" dnum="v-o" numlevel="1" lineno="127" slineno="1-84" level="3" tab="1"><display>(v)</display>"Sexual abuse" means the offense described in Subsection <xref depth="4" refnumber="76-5-404.1(2)">76-5-404.1(2)</xref>.</subsection><subsection ssid="49-null-44" dnum="vi-o" numlevel="1" lineno="128" slineno="1-85" level="3" tab="1"><display>(vi)</display>"Sexual battery" means the offense described in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, considering <ln numlevel="1" lineno="129" slineno="1-86"/>the term "child" in that section to include an individual under 18 years old.</subsection></subsection><subsection ssid="49-null-45" dnum="b-o" numlevel="1" lineno="130" slineno="1-87" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, immunity from suit is waived as to a <ln numlevel="1" lineno="131" slineno="1-88"/>claim against a local education agency for an injury resulting from a sexual battery or <ln numlevel="1" lineno="132" slineno="1-89"/>sexual abuse committed against a student of a public school by a paid employee of <ln numlevel="1" lineno="133" slineno="1-90"/>the public school who is criminally charged in connection with the sexual battery or <ln numlevel="1" lineno="134" slineno="1-91"/>sexual abuse, unless:<subsection ssid="49-null-46" dnum="i-o" numlevel="1" lineno="135" slineno="1-92" level="3"><display>(i)</display>at the time of the sexual battery or sexual abuse, the public school was subject to a <ln numlevel="1" lineno="136" slineno="1-93"/>code of conduct; and</subsection><subsection ssid="49-null-47" dnum="ii-o" numlevel="1" lineno="137" slineno="1-94" level="3"><display>(ii)</display>before the sexual battery or sexual abuse occurred, the public school had:<subsection ssid="49-null-48" dnum="A-o" numlevel="1" lineno="138" slineno="1-95" level="4"><display>(A)</display>provided training on the code of conduct to the employee; and</subsection><subsection ssid="49-null-49" dnum="B-o" numlevel="1" lineno="139" slineno="1-96" level="4"><display>(B)</display>required the employee to sign a statement acknowledging that the employee <ln numlevel="1" lineno="140" slineno="1-97"/>has read and understands the code of conduct.</subsection></subsection></subsection></subsection><subsection ssid="49-null-50" dnum="4-o" numlevel="1" lineno="141" slineno="1-98" level="1" space="false"><display>(4)</display><subsection ssid="49-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-301(4)">(4)</xref>:<subsection ssid="49-null-52" dnum="i-o" numlevel="1" lineno="142" slineno="1-99" level="3" tab="1"><display>(i)</display>"Institution of higher education" means the same as that term is defined in Section <xref depth="3" refnumber="53H-1-101"><ln numlevel="1" lineno="143" slineno="1-100"/>53H-1-101</xref>.</subsection><subsection ssid="49-null-53" dnum="ii-o" numlevel="1" lineno="144" slineno="1-101" level="3" tab="1"><display>(ii)</display>"Policy governing behavior" means a policy adopted by a higher education <ln numlevel="1" lineno="145" slineno="1-102"/>institution or the Utah Board of Higher Education that:<subsection ssid="49-null-54" dnum="A-o" numlevel="1" lineno="146" slineno="1-103" level="4"><display>(A)</display>establishes a professional standard of care for preventing the conduct <ln numlevel="1" lineno="147" slineno="1-104"/>described in Subsections <xref depth="4" refnumber="63G-7-301(4)(a)(ii)(c)">(4)(a)(ii)(C)</xref> and <xref depth="4" refnumber="63G-7-301(d)">(D)</xref>;</subsection><subsection ssid="49-null-55" dnum="B-o" numlevel="1" lineno="148" slineno="1-105" level="4"><display>(B)</display>regulates behavior of a special trust employee toward a subordinate student;</subsection><subsection ssid="49-null-56" dnum="C-o" numlevel="1" lineno="149" slineno="1-106" level="4"><display>(C)</display>includes a prohibition against any sexual conduct between a special trust <ln numlevel="1" lineno="150" slineno="1-107"/>employee and a subordinate student; and</subsection><subsection ssid="49-null-57" dnum="D-o" numlevel="1" lineno="151" slineno="1-108" level="4"><display>(D)</display>includes a prohibition against a special trust employee and subordinate student <ln numlevel="1" lineno="152" slineno="1-109"/>sharing any sexually explicit or lewd communication, image, or photograph.</subsection></subsection><subsection ssid="49-null-58" dnum="iii-o" numlevel="1" lineno="153" slineno="1-110" level="3" tab="1"><display>(iii)</display>"Sexual battery" means the offense described in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>.</subsection><subsection ssid="49-null-59" dnum="iv-o" numlevel="1" lineno="154" slineno="1-111" level="3" tab="1"><display>(iv)</display>"Special trust employee" means an employee of an institution of higher education <ln numlevel="1" lineno="155" slineno="1-112"/>who is in a position of special trust, as defined in Section <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, with a <ln numlevel="1" lineno="156" slineno="1-113"/>higher education student.</subsection><subsection ssid="49-null-60" dnum="v-o" numlevel="1" lineno="157" slineno="1-114" level="3" tab="1"><display>(v)</display>"Subordinate student" means a student:<subsection ssid="49-null-61" dnum="A-o" numlevel="1" lineno="158" slineno="1-115" level="4"><display>(A)</display>of an institution of higher education; and</subsection><subsection ssid="49-null-62" dnum="B-o" numlevel="1" lineno="159" slineno="1-116" level="4"><display>(B)</display>whose educational opportunities could be adversely impacted by a special <ln numlevel="1" lineno="160" slineno="1-117"/>trust employee.</subsection></subsection></subsection><subsection ssid="49-null-63" dnum="b-o" numlevel="1" lineno="161" slineno="1-118" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, immunity from suit is waived as to a <ln numlevel="1" lineno="162" slineno="1-119"/>claim for an injury resulting from a sexual battery committed against a subordinate <ln numlevel="1" lineno="163" slineno="1-120"/>student by a special trust employee, unless:<subsection ssid="49-null-64" dnum="i-o" numlevel="1" lineno="164" slineno="1-121" level="3"><display>(i)</display>the institution of higher education proves that the special trust employee's <ln numlevel="1" lineno="165" slineno="1-122"/>behavior that otherwise would constitute a sexual battery was:<subsection ssid="49-null-65" dnum="A-o" numlevel="1" lineno="166" slineno="1-123" level="4"><display>(A)</display>with a subordinate student who was at least 18 years old at the time of the <ln numlevel="1" lineno="167" slineno="1-124"/>behavior; and</subsection><subsection ssid="49-null-66" dnum="B-o" numlevel="1" lineno="168" slineno="1-125" level="4"><display>(B)</display>with the student's consent; or</subsection></subsection><subsection ssid="49-null-67" dnum="ii-o" numlevel="1" lineno="169" slineno="1-126" level="3" space="false"><display>(ii)</display><subsection ssid="49-null-68" dnum="A-o" level="4" placement="sameline"><display>(A)</display>at the time of the sexual battery, the institution of higher education was <ln numlevel="1" lineno="170" slineno="1-127"/>subject to a policy governing behavior; and</subsection><subsection ssid="49-null-69" dnum="B-o" numlevel="1" lineno="171" slineno="1-128" level="4"><display>(B)</display>before the sexual battery occurred, the higher education institution had taken <ln numlevel="1" lineno="172" slineno="1-129"/>steps to implement and enforce the policy investigation of alleged criminal activity, using:</amend><subsection ssid="11-27" dnum="_-o:a-i" numlevel="1" lineno="270" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="210" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="end">biometric surveillance information;</amend></subsection><subsection ssid="11-38" dnum="_-o:b-i" numlevel="1" lineno="271" slineno="4-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" or</amend></subsection><subsection ssid="13-13" dnum="_-o:ii-i" numlevel="1" lineno="292" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">the law enforcement agency obtains information from the use of a surveillance or <ln numlevel="1" lineno="293" slineno="5-14"/>investigatory technology by requesting or directing another entity to use the <ln numlevel="1" lineno="294" slineno="5-15"/>surveillance or investigatory technology on the law enforcement agency's behalf.</amend></subsection></subsection></subsection><subsection ssid="13-2" dnum="_-o:2-i" numlevel="1" lineno="295" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">A law enforcement agency may use a surveillance or investigatory technology that is <ln numlevel="1" lineno="296" slineno="5-17"/>not specifically permitted by state statute if the use of the surveillance or investigatory <ln numlevel="1" lineno="297" slineno="5-18"/>technology is:</amend><subsection ssid="13-5" dnum="_-o:a-i" numlevel="1" lineno="298" slineno="5-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">limited to one 30-day period; and</amend></subsection><subsection ssid="13-6" dnum="_-o:b-i" numlevel="1" lineno="299" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">in response to a declared emergency.</amend></subsection></subsection><subsection ssid="13-17" dnum="_-o:3-i" numlevel="1" lineno="300" slineno="5-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="13-18" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="77-23e-202(3)(b)">(3)(b)</xref>, an update or upgrade to, or expansion of, <ln numlevel="1" lineno="301" slineno="5-22"/>a surveillance or investigatory technology that is authorized for use under Subsection <xref depth="4" refnumber="77-23e-202(1)(a)"><ln numlevel="1" lineno="302" slineno="5-23"/>(1)(a)</xref> is not considered a new surveillance or investigatory technology that requires a <ln numlevel="1" lineno="303" slineno="5-24"/>new statutory authorization under Subsection <xref depth="4" refnumber="77-23e-202(1)(a)">(1)(a)</xref>.</amend></subsection><subsection ssid="13-20" dnum="_-o:b-i" numlevel="1" lineno="304" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">An update or upgrade to, or expansion of, an existing surveillance or investigatory <ln numlevel="1" lineno="305" slineno="5-26"/>technology authorized under Subsection <xref depth="4" refnumber="77-23e-202(1)(a)">(1)(a)</xref> requires a new statutory authorization <ln numlevel="1" lineno="306" slineno="5-27"/>if the update, upgrade, or expansion adds or enables a new operational capability or <ln numlevel="1" lineno="307" slineno="5-28"/>data collection or analysis function.</amend></subsection></subsection><subsection ssid="13-23" dnum="_-o:4-i" numlevel="1" lineno="308" slineno="5-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this section permits the use of any technology that is prohibited under state <ln numlevel="1" lineno="309" slineno="5-30"/>or federal law, and a surveillance or investigatory technology may only be used as <ln numlevel="1" lineno="310" slineno="5-31"/>permitted under applicable state and federal law.</amend></subsection></section></bsec><bsec buid="42" num="77-23e-203" type="enact" src="code" uid="C77-23e-S203_2026050620260506" sort="77 23e02030020260506" numlevel="1" lineno="311" slineno="6-1" sn="6"><section numlevel="1" lineno="312" slineno="6-2" number="77-23e-203" type="enact"><secline lineno="311">Section 6. Right of action for violation.</bold></catline><subsection ssid="44-36-13" dnum="_-o:1-i" numlevel="1" lineno="318" slineno="7-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Section <xref depth="3" refnumber="78B-3-101.3">78B-3-101.3</xref>, a person who has been injured by a law enforcement <ln numlevel="1" lineno="319" slineno="7-4"/>agency's use of a surveillance or investigatory technology in violation of Section <xref depth="3" refnumber="77-23e-202"><ln numlevel="1" lineno="320" slineno="7-5"/>77-23e-202</xref> may bring an action against the law enforcement agency for the relief <ln numlevel="1" lineno="321" slineno="7-6"/>described in Subsection <xref depth="4" refnumber="77-23e-204(2)">(2)</xref> if:</amend><subsection ssid="44-18" dnum="_-o:a-i" numlevel="1" lineno="322" slineno="7-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">the law enforcement agency's use of the surveillance or investigatory technology was <ln numlevel="1" lineno="323" slineno="7-8"/>a knowing or reckless violation of Section <xref depth="3" refnumber="77-23e-202">77-23e-202</xref>; and</amend></subsection><subsection ssid="44-19" dnum="_-o:b-i" numlevel="1" lineno="324" slineno="7-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">the information obtained as a result of the violation described in Subsection <xref depth="4" refnumber="77-23e-204(1)(a)">(1)(a)</xref> <ln numlevel="1" lineno="325" slineno="7-10"/>caused the person's injury.</amend></subsection></subsection><subsection ssid="44-36-14" dnum="_-o:2-i" numlevel="1" lineno="326" slineno="7-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">If in the action described in Subsection <xref depth="4" refnumber="77-23e-204(1)">(1)</xref> the court finds by a preponderance of the <ln numlevel="1" lineno="327" slineno="7-12"/>evidence a violation described in Subsection <xref depth="4" refnumber="77-23e-204(1)">(1)</xref>, the court shall award:</amend><subsection ssid="44-36-15" dnum="_-o:a-i" numlevel="1" lineno="328" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">compensatory damages established by the plaintiff, or $2,000, whichever is greater;</amend></subsection><subsection ssid="44-36-16" dnum="_-o:b-i" numlevel="1" lineno="329" slineno="7-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">preliminary and other equitable or declaratory relief; and</amend></subsection><subsection ssid="44-36-17" dnum="_-o:c-i" numlevel="1" lineno="330" slineno="7-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">reasonable attorney fees and reasonably incurred litigation costs.</amend></subsection></subsection><subsection ssid="44-20" dnum="_-o:3-i" numlevel="1" lineno="331" slineno="7-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">It is a complete defense to an action brought under this section if the law enforcement <ln numlevel="1" lineno="332" slineno="7-17"/>agency acted under a good faith determination that Section <xref depth="3" refnumber="77-23e-202">77-23e-202</xref> permitted the <ln numlevel="1" lineno="333" slineno="7-18"/>conduct that caused the violation of Section <xref depth="3" refnumber="77-23e-202">77-23e-202</xref>. </amend></subsection></section></bsec><bsec buid="46" num="77-23e-205" type="enact" src="code" uid="C77-23e-S205_2026050620260506" sort="77 23e02050020260506" numlevel="1" lineno="334" slineno="8-1" sn="8"><section numlevel="1" lineno="335" slineno="8-2" number="77-23e-205" type="enact"><secline lineno="334">Section 8. Section <bold>77-23e-205</bold> is enacted to read:</secline><catline lineno="335"><bold>77-23e-205<parens/>. Annual reporting requirements for law enforcement agency use of a <ln numlevel="1" lineno="336" slineno="8-3"/>surveillance or investigatory technology.</bold></catline><subsection ssid="46-40-24" dnum="_-o:1-i" numlevel="1" lineno="337" slineno="8-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning on July 1, 2028, a law enforcement agency shall annually, on or before July 1 <ln numlevel="1" lineno="338" slineno="8-5"/>of each year, report to the State Commission on Criminal and Juvenile Justice:</amend><subsection ssid="46-40-25" dnum="_-o:a-i" numlevel="1" lineno="339" slineno="8-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the type and, if applicable, the name and vendor, for each surveillance or <ln numlevel="1" lineno="340" slineno="8-7"/>investigatory technology that the law enforcement agency used during the preceding <ln numlevel="1" lineno="341" slineno="8-8"/>year; and</amend></subsection><subsection ssid="46-40-26" dnum="_-o:b-i" numlevel="1" lineno="342" slineno="8-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">the authorization under Section <xref depth="3" refnumber="77-23e-202">77-23e-202</xref> for each item described in Subsection <xref depth="4" refnumber="77-23e-205(1)(a)"><ln numlevel="1" lineno="343" slineno="8-10"/>(1)(a)</xref>, including:</amend><subsection ssid="46-40-27" dnum="_-o:i-i" numlevel="1" lineno="344" slineno="8-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">for an authorization under Subsection <xref depth="4" refnumber="77-23e-202(1)(a)">77-23e-202(1)(a)</xref>, for a surveillance or <ln numlevel="1" lineno="345" slineno="8-12"/>investigatory technology that is authorized by state statute, the citation to the state <ln numlevel="1" lineno="346" slineno="8-13"/>statute that authorizes the use of the surveillance or investigatory technology; and</amend></subsection><subsection ssid="46-35" dnum="_-o:ii-i" numlevel="1" lineno="347" slineno="8-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">for an authorization under Subsection <xref depth="4" refnumber="77-23e-202(2)">77-23e-202(2)</xref>, for a surveillance or <ln numlevel="1" lineno="348" slineno="8-15"/>investigatory technology temporarily used in response to a declared emergency:</amend><subsection ssid="46-40-28" dnum="_-o:A-i" numlevel="1" lineno="349" slineno="8-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">the dates that the surveillance or investigatory technology were used by the <ln numlevel="1" lineno="350" slineno="8-17"/>law enforcement agency;</amend></subsection><subsection ssid="46-40-29" dnum="_-o:B-i" numlevel="1" lineno="351" slineno="8-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">the date of the declared emergency; and </amend></subsection><subsection ssid="46-40-30" dnum="_-o:C-i" numlevel="1" lineno="352" slineno="8-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">the entity that declared the emergency.</amend></subsection></subsection></subsection></subsection><subsection ssid="46-40-32" dnum="_-o:2-i" numlevel="1" lineno="353" slineno="8-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">The State Commission on Criminal and Juvenile Justice shall:</amend><subsection ssid="46-40-33" dnum="_-o:a-i" numlevel="1" lineno="354" slineno="8-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">compile a report of the data submitted under Subsection <xref depth="4" refnumber="77-23e-205(1)">(1)</xref>;
