Concurrent Resolution on State Management of Federal Public Lands</st><sessionhead>2026 GENERAL SESSION</sessionhead><statehead>STATE OF UTAH</statehead><sponsorhead>Chief Sponsor: Steve Eliason</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This resolution urges the federal government and state entities to identify public lands for <ln numlevel="1" lineno="6" slineno="0-6"/>the state to manage for outdoor recreation.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This resolution:<hl numlevel="1" lineno="9" slineno="0-9" level="1">highlights the need to develop and maintain state parks, monuments, and campgrounds to <ln numlevel="1" lineno="10" slineno="0-10"/>provide the people of Utah with outdoor recreational opportunities;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">suggests land that the Division of State Parks (division) may consider for a potential state <ln numlevel="1" lineno="12" slineno="0-12"/>park, state monument, or state campground; </hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">encourages the division to work with federal agencies to acquire, lease, or manage <ln numlevel="1" lineno="14" slineno="0-14"/>properties considered suitable for use as a state park, monument, or campground;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">urges Congress to establish a framework for state operation of federal public lands, under <ln numlevel="1" lineno="16" slineno="0-16"/>a joint management agreement, to improve public land management and reduce federal <ln numlevel="1" lineno="17" slineno="0-17"/>expenditures;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">requests that the division petition the Bureau of Land Management to transfer land to the <ln numlevel="1" lineno="19" slineno="0-19"/>state for the creation of the Little Sahara State Park;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">requests that the division negotiate with the United States Forest Service to transfer the <ln numlevel="1" lineno="21" slineno="0-21"/>Antelope Flat Campground to the state for the creation of the Flaming Gorge State Park; <ln numlevel="1" lineno="22" slineno="0-22"/>and</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">requests that the division update the Natural Resources, Agriculture, and Environment <ln numlevel="1" lineno="24" slineno="0-24"/>Interim Committee on the division's study regarding new state parks and state <ln numlevel="1" lineno="25" slineno="0-25"/>campgrounds.</hl></hp><moni numlevel="1" lineno="26" slineno="0-26" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="27">None</moniNone><oc numlevel="1" lineno="28" slineno="0-28">Other Special Clauses:</oc><ocNone lineno="29">None</ocNone></lt><enacthead lineno="30"/><enact numlevel="1" lineno="31" slineno="0-31">Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:</enact><bdy><bsec buid="1" type="enact" src="reso" uid="RESO" sort="00000R" numlevel="1" lineno="32" slineno="1-1" sn="1"><section type="enact" display="false" src="reso"><amend anum="0" ea="amend" pairid="1" groupid="1" style="X" owner="jchristopherson" level="1" amendtag="both">WHEREAS, the Legislature is committed to protecting and enhancing the state's <ln numlevel="1" lineno="33" slineno="1-2"/>recreational opportunities, experiences, and facilities for the people of Utah;<eol numlevel="1" lineno="34" slineno="1-3" display="tab"/>WHEREAS, state parks, state monuments, and state campgrounds provide valuable outdoor <ln numlevel="1" lineno="35" slineno="1-4"/>recreational opportunities and play a critical role in preserving the state's distinctive natural <ln numlevel="1" lineno="36" slineno="1-5"/>and cultural resources;<eol numlevel="1" lineno="37" slineno="1-6" display="tab"/>WHEREAS, the state's growing population and vibrant tourism industry will require the <ln numlevel="1" lineno="38" slineno="1-7"/>state to develop new outdoor recreational opportunities and maintain existing state parks, state <ln numlevel="1" lineno="39" slineno="1-8"/>monuments, and state campgrounds;<eol numlevel="1" lineno="40" slineno="1-9" display="tab"/>WHEREAS, the Monte Cristo area located in Cache, Rich, and Weber counties offers <ln numlevel="1" lineno="41" slineno="1-10"/>unique recreational opportunities that the Division of State Parks (division) may evaluate for <ln numlevel="1" lineno="42" slineno="1-11"/>designation as a state park, state monument, or state campground;<eol numlevel="1" lineno="43" slineno="1-12" display="tab"/>WHEREAS, Mueller Park Canyon located in Davis County offers unique recreational <ln numlevel="1" lineno="44" slineno="1-13"/>opportunities that the division may evaluate for designation as a state park;<eol numlevel="1" lineno="45" slineno="1-14" display="tab"/>WHEREAS, Pineview Reservoir located in Weber County offers unique recreational <ln numlevel="1" lineno="46" slineno="1-15"/>opportunities that the division may evaluate for designation as a state park;<eol numlevel="1" lineno="47" slineno="1-16" display="tab"/>WHEREAS, various school and institutional trust lands, including trust lands in the San <ln numlevel="1" lineno="48" slineno="1-17"/>Rafael Swell area, may present opportunities for public recreation while generating revenue for <ln numlevel="1" lineno="49" slineno="1-18"/>trust beneficiaries;<eol numlevel="1" lineno="50" slineno="1-19" display="tab"/>WHEREAS, the state has experience and capability in effectively managing state parks and <ln numlevel="1" lineno="51" slineno="1-20"/>other public lands;<eol numlevel="1" lineno="52" slineno="1-21" display="tab"/>WHEREAS, state management has the potential to enhance economic opportunities while <ln numlevel="1" lineno="53" slineno="1-22"/>ensuring continued public access and resource protection;<eol numlevel="1" lineno="54" slineno="1-23" display="tab"/>WHEREAS, the state is well positioned to understand and respond to local needs and <ln numlevel="1" lineno="55" slineno="1-24"/>conditions affecting public lands within the state;<eol numlevel="1" lineno="56" slineno="1-25" display="tab"/>WHEREAS, the federal government manages numerous public lands within the state, many <ln numlevel="1" lineno="57" slineno="1-26"/>of which face significant maintenance backlogs and operational challenges that impact visitor <ln numlevel="1" lineno="58" slineno="1-27"/>experiences and resource conservation;<eol numlevel="1" lineno="59" slineno="1-28" display="tab"/>WHEREAS, the United States Forest Service has decommissioned campgrounds in the <ln numlevel="1" lineno="60" slineno="1-29"/>state due to the degradation of campground infrastructure, including the Sunset Campground <ln numlevel="1" lineno="61" slineno="1-30"/>in Farmington Canyon;<eol numlevel="1" lineno="62" slineno="1-31" display="tab"/>WHEREAS, there are several scenic public lands managed by federal agencies, including <ln numlevel="1" lineno="63" slineno="1-32"/>the Little Sahara Recreation Area, the Antelope Flat Campground near Flaming Gorge <ln numlevel="1" lineno="64" slineno="1-33"/>Reservoir, and land near Farmington Canyon and Skyline Drive in Bountiful, that could be <ln numlevel="1" lineno="65" slineno="1-34"/>managed by the state for public recreation;<eol numlevel="1" lineno="66" slineno="1-35" display="tab"/>WHEREAS, the division has attempted in the past to enter into an agreement for the <ln numlevel="1" lineno="67" slineno="1-36"/>management of the Little Sahara Recreation Area as a state park, an area that receives 300,000 <ln numlevel="1" lineno="68" slineno="1-37"/>visitors annually;<eol numlevel="1" lineno="69" slineno="1-38" display="tab"/>WHEREAS, in accordance with Utah Code Section <xref depth="3" refnumber="79-4-606">79-4-606</xref>, the division may enter into <ln numlevel="1" lineno="70" slineno="1-39"/>an agreement with the United States Bureau of Land Management (BLM) for the use of the <ln numlevel="1" lineno="71" slineno="1-40"/>Little Sahara Recreation Area as a state park;<eol numlevel="1" lineno="72" slineno="1-41" display="tab"/>WHEREAS, in accordance with Utah Code Subsection <xref depth="4" refnumber="79-4-203(4)">79-4-203(4)</xref>, the division may <ln numlevel="1" lineno="73" slineno="1-42"/>acquire property in the name of the state by legal and proper means;<eol numlevel="1" lineno="74" slineno="1-43" display="tab"/>WHEREAS, if a land transfer agreement is not possible, the division may seek to purchase <ln numlevel="1" lineno="75" slineno="1-44"/>or lease the land from the BLM under the Recreation and Public Purposes Act, 43 U.S.C. Sec. <ln numlevel="1" lineno="76" slineno="1-45"/>869;<eol numlevel="1" lineno="77" slineno="1-46" display="tab"/>WHEREAS, state public lands and federally managed public lands could be enhanced and <ln numlevel="1" lineno="78" slineno="1-47"/>reclaimed for recreation and conservation purposes if cooperatively managed by the state;<eol numlevel="1" lineno="79" slineno="1-48" display="tab"/>WHEREAS, a voluntary framework for state operation of federally managed public lands <ln numlevel="1" lineno="80" slineno="1-49"/>could help address maintenance backlogs while preserving federal obligations and <ln numlevel="1" lineno="81" slineno="1-50"/>environmental protections;<eol numlevel="1" lineno="82" slineno="1-51" display="tab"/>WHEREAS, Utah's congressional delegation is uniquely positioned to understand the <ln numlevel="1" lineno="83" slineno="1-52"/>state's capacity and desire to manage public lands within the state; and<eol numlevel="1" lineno="84" slineno="1-53" display="tab"/>WHEREAS, leadership from Utah's congressional delegation on this issue could establish a <ln numlevel="1" lineno="85" slineno="1-54"/>model framework benefiting all states:<eol numlevel="1" lineno="86" slineno="1-55" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the <ln numlevel="1" lineno="87" slineno="1-56"/>Governor concurring therein, urges Utah's congressional delegation to lead the effort in <ln numlevel="1" lineno="88" slineno="1-57"/>Congress to establish a framework that allows the state to voluntarily assume operational <ln numlevel="1" lineno="89" slineno="1-58"/>responsibility, under a joint management agreement, for federally managed public lands within <ln numlevel="1" lineno="90" slineno="1-59"/>the state.<eol numlevel="1" lineno="91" slineno="1-60" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor encourage the <ln numlevel="1" lineno="92" slineno="1-61"/>division to once again petition the BLM to transfer title to the state of Utah all land necessary <ln numlevel="1" lineno="93" slineno="1-62"/>for the creation of the Little Sahara State Park.<eol numlevel="1" lineno="94" slineno="1-63" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor encourage the <ln numlevel="1" lineno="95" slineno="1-64"/>division to negotiate with the United States Forest Service to transfer the Antelope Flat <ln numlevel="1" lineno="96" slineno="1-65"/>Campground to the state for the creation of Flaming Gorge State Park.<eol numlevel="1" lineno="97" slineno="1-66" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor encourage the <ln numlevel="1" lineno="98" slineno="1-67"/>division to work with federal agencies to acquire, lease, or manage any other properties <ln numlevel="1" lineno="99" slineno="1-68"/>considered suitable for a state park, state monument, or state campground.<eol numlevel="1" lineno="100" slineno="1-69" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor urge the division to <ln numlevel="1" lineno="101" slineno="1-70"/>evaluate recreational and scenic locations in the state, including the Monte Cristo area and <ln numlevel="1" lineno="102" slineno="1-71"/>trust lands in the San Rafael Swell, for designation as new state parks, state monuments, and <ln numlevel="1" lineno="103" slineno="1-72"/>state campgrounds.<eol numlevel="1" lineno="104" slineno="1-73" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor encourage the <ln numlevel="1" lineno="105" slineno="1-74"/>division to study the feasibility of a potential state park or state campground near Skyline <ln numlevel="1" lineno="106" slineno="1-75"/>Drive in Davis County, including the Buckland Flats Campground, the Bountiful Peak <ln numlevel="1" lineno="107" slineno="1-76"/>Campground, and the former Farmington Canyon Sunset Campground areas.<eol numlevel="1" lineno="108" slineno="1-77" display="tab"/>BE IT FURTHER RESOLVED that the Legislature and the Governor request that the <ln numlevel="1" lineno="109" slineno="1-78"/>division submit an annual report to the Natural Resources, Agriculture, and Environment <ln numlevel="1" lineno="110" slineno="1-79"/>Interim Committee regarding the progress and status of the division's study before the <ln numlevel="1" lineno="111" slineno="1-80"/>November interim meetings in 2026, 2027, and 2028.</amend><sectionText/></section></bsec></bdy><foot><rev><tm>1-6-26 1:39 PM</tm></rev></foot></leg>
