It is proposed to amend Utah Constitution, Article VI, Section 6 to read</secline><catline lineno="24"><bold>Article VI, Section 6<parens/>. [Who is ineligible as legislator.]</bold></catline><subsection ssid="11-1" dnum="_-o:1-i" numlevel="1" lineno="25" slineno="1-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>No person holding any public office of profit or trust under authority of the United <ln numlevel="1" lineno="26" slineno="1-4"/>States, or of this State, shall be a member of the Legislature: Provided That <ln numlevel="1" lineno="27" slineno="1-5"/>appointments in the State Militia, and the offices of notary public, justice of the peace, <ln numlevel="1" lineno="28" slineno="1-6"/>United States commissioner, and postmaster of the fourth class, shall not, within the <ln numlevel="1" lineno="29" slineno="1-7"/>meaning of this section, be considered offices of profit or trust.</subsection><subsection ssid="11-2" dnum="_-o:2-i" numlevel="1" lineno="30" slineno="1-8" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="11-11" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="ahaskell" level="1" amendtag="end">Subject to Subsections <xref refnumber="11-5">(2)(b)</xref> through (2)(d), no person elected as a legislator may <ln numlevel="1" lineno="31" slineno="1-9"/>serve in the same house for more than eight cumulative years.</amend></subsection><subsection ssid="11-5" dnum="_-o:b-i" numlevel="1" lineno="32" slineno="1-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">The eight-year limitation applies to years served on or after January 1, 2027.</amend></subsection><subsection ssid="11-7" dnum="_-o:c-i" numlevel="1" lineno="33" slineno="1-11" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">The eight-year limitation does not apply to the years served when the person is <ln numlevel="1" lineno="34" slineno="1-12"/>elected or appointed to fill a mid-term vacancy in the Legislature before the person is <ln numlevel="1" lineno="35" slineno="1-13"/>elected to a full term as a legislator.</amend></subsection><subsection ssid="11-6" dnum="_-o:d-i" numlevel="1" lineno="36" slineno="1-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><subsection ssid="11-10" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="36" style="1" owner="ahaskell" level="1" amendtag="end">A person may not be elected or appointed to a remaining term of a member of <ln numlevel="1" lineno="37" slineno="1-15"/>the Senate or the House of Representatives if serving the remaining term would <ln numlevel="1" lineno="38" slineno="1-16"/>cause the person to serve for more than eight years in that respective house.</amend></subsection><subsection ssid="11-8" dnum="_-o:ii-i" numlevel="1" lineno="39" slineno="1-17" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="38" style="1" owner="ahaskell" level="1" amendtag="end">A person may not be elected to the Senate or the House of Representatives if <ln numlevel="1" lineno="40" slineno="1-18"/>serving a full term would cause the person to serve for more than eight years in <ln numlevel="1" lineno="41" slineno="1-19"/>that respective house.</amend></subsection></subsection></subsection></section></bsec><bsec buid="13" num="Article VI, Section 30" type="amend" src="const" uid="UC_AVI_S30_2026050620260506" sort="00I06 00300020260506" numlevel="1" lineno="42" slineno="2-1" sn="2"><section number="Article VI, Section 30" numlevel="1" lineno="43" slineno="2-2" type="amend"><secline lineno="42">Section 2. It is proposed to amend Utah Constitution, Article VI, Section 30 to read</secline><catline lineno="43"><bold>Article VI, Section 30<parens/>. [Continuity in government.]</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="44" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Notwithstanding any general or special provisions of the Constitution<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both"> other than the <ln numlevel="1" lineno="45" slineno="2-4"/>eight-year service limitation provisions</amend>, in order to insure continuity of state and local <ln numlevel="1" lineno="46" slineno="2-5"/>government operations when such operations are seriously disrupted as a result of <ln numlevel="1" lineno="47" slineno="2-6"/>natural or man-made disaster or disaster caused by enemy attack, the Legislature may:<subsection ssid="13-null-2" dnum="a-o" numlevel="1" lineno="48" slineno="2-7" level="2"><display>(a)</display>provide for prompt and temporary succession to the powers and duties of any elected <ln numlevel="1" lineno="49" slineno="2-8"/>or appointed public office, the incumbents of which may become unavailable for <ln numlevel="1" lineno="50" slineno="2-9"/>carrying on the powers and duties of such offices; and</subsection><subsection ssid="13-null-3" dnum="b-o" numlevel="1" lineno="51" slineno="2-10" level="2"><display>(b)</display>adopt measures necessary and proper for insuring the continuity of governmental <ln numlevel="1" lineno="52" slineno="2-11"/>operations including, but not limited to, the financing thereof.</subsection></subsection><subsection ssid="13-null-4" dnum="2-o" numlevel="1" lineno="53" slineno="2-12" level="1"><display>(2)</display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both">The Legislature may provide a successor who exceeds the eight-year service limitation <ln numlevel="1" lineno="54" slineno="2-13"/>provisions if the Legislature determines that no eligible person is available.</amend></subsection><subsection ssid="13-6" dnum="_-o:3-i" numlevel="1" lineno="55" slineno="2-14" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both">(3)</amend></display>Subsection <xref depth="4" refnumber="Article VI, Section 30(1)" start="0">(1)</xref> does not permit these temporary public officers to act or these temporary <ln numlevel="1" lineno="56" slineno="2-15"/>measures to be contrary to the Constitution and applicable law.</subsection></section></bsec><bsec buid="12" num="Article VII, Section 3" type="amend" src="const" uid="UC_AVII_S3_2026050620260506" sort="00I07 00030020260506" numlevel="1" lineno="57" slineno="3-1" sn="3"><section number="Article VII, Section 3" numlevel="1" lineno="58" slineno="3-2" type="amend"><secline lineno="57">Section 3. It is proposed to amend Utah Constitution, Article VII, Section 3 to read</secline><catline lineno="58"><bold>Article VII, Section 3<parens/>. [Qualifications of officers.]</bold></catline><subsection ssid="12-null-1" dnum="1-o" numlevel="1" lineno="59" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>To be eligible for the office of Governor or Lieutenant Governor a person shall be 30 <ln numlevel="1" lineno="60" slineno="3-4"/>years of age or older at the time of election.</subsection><subsection ssid="12-null-2" dnum="2-o" numlevel="1" lineno="61" slineno="3-5" level="1"><display>(2)</display>To be eligible for the office of Attorney General a person shall be 25 years of age or <ln numlevel="1" lineno="62" slineno="3-6"/>older, at the time of election, admitted to practice before the Supreme Court of the State <ln numlevel="1" lineno="63" slineno="3-7"/>of Utah, and in good standing at the bar.</subsection><subsection ssid="12-null-3" dnum="3-o" numlevel="1" lineno="64" slineno="3-8" level="1"><display>(3)</display>To be eligible for the office of State Auditor or State Treasurer a person shall be 25 <ln numlevel="1" lineno="65" slineno="3-9"/>years of age or older at the time of election.</subsection><subsection ssid="12-null-4" dnum="4-o" numlevel="1" lineno="66" slineno="3-10" level="1"><display>(4)</display>No person is eligible to any of the offices provided for in Section 1 unless at the time of <ln numlevel="1" lineno="67" slineno="3-11"/>election that person is a qualified voter and has been a resident citizen of the state for <ln numlevel="1" lineno="68" slineno="3-12"/>five years next preceding the election.</subsection><subsection ssid="12-5" dnum="_-o:5-i" numlevel="1" lineno="69" slineno="3-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="12-6" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">Subject to Subsection <xref refnumber="12-8">(5)(b)</xref>, no person elected to an office identified in Article <ln numlevel="1" lineno="70" slineno="3-14"/>VII, Section 1, may serve in that position for more than eight cumulative years.</amend></subsection><subsection ssid="12-8" dnum="_-o:b-i" numlevel="1" lineno="71" slineno="3-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="ahaskell" level="1" amendtag="end">The eight-year limitation applies to years of office served on or after January 1, 2027.</amend></subsection><subsection ssid="12-14" dnum="_-o:c-i" numlevel="1" lineno="72" slineno="3-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="ahaskell" level="1" amendtag="end">A person may not be elected or appointed to the office of Lieutenant Governor if the <ln numlevel="1" lineno="73" slineno="3-17"/>person has previously served as Governor for more than one term.</amend></subsection></subsection></section></bsec><bsec buid="15" num="Article VII, Section 11" type="amend" src="const" uid="UC_AVII_S11_2026050620260506" sort="00I07 00110020260506" numlevel="1" lineno="74" slineno="4-1" sn="4"><section number="Article VII, Section 11" numlevel="1" lineno="75" slineno="4-2" type="amend"><secline lineno="74">Section 4. It is proposed to amend Utah Constitution, Article VII, Section 11 to read</secline><catline lineno="75"><bold>Article VII, Section 11<parens/>. [Vacancy in office of Governor -- Determination of <ln numlevel="1" lineno="76" slineno="4-3"/>disability.]</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="77" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>A vacancy in the office of Governor occurs when:<subsection ssid="15-null-2" dnum="a-o" numlevel="1" lineno="78" slineno="4-5" level="2"><display>(a)</display>the Governor dies, resigns, is removed from office following impeachment, ceases to <ln numlevel="1" lineno="79" slineno="4-6"/>reside within the state, or is determined, as provided in Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, to have a <ln numlevel="1" lineno="80" slineno="4-7"/>disability that renders the Governor unable to discharge the duties of office for the <ln numlevel="1" lineno="81" slineno="4-8"/>remainder of the Governor's term of office; or</subsection><subsection ssid="15-null-3" dnum="b-o" numlevel="1" lineno="82" slineno="4-9" level="2"><display>(b)</display>the Governor-elect fails to take office because of the Governor-elect's death, failure <ln numlevel="1" lineno="83" slineno="4-10"/>to qualify for office, or disability, determined as provided in Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, that <ln numlevel="1" lineno="84" slineno="4-11"/>renders the Governor-elect unable to discharge the duties of office for the <ln numlevel="1" lineno="85" slineno="4-12"/>Governor-elect's full term of office.</subsection></subsection><subsection ssid="15-null-4" dnum="2-o" numlevel="1" lineno="86" slineno="4-13" level="1"><display>(2)</display>If a vacancy in the office of Governor occurs, the Lieutenant Governor shall become <ln numlevel="1" lineno="87" slineno="4-14"/>Governor, to serve:<subsection ssid="15-null-5" dnum="a-o" numlevel="1" lineno="88" slineno="4-15" level="2"><display>(a)</display>until the first Monday in January of the year following the next regular general <ln numlevel="1" lineno="89" slineno="4-16"/>election after the vacancy occurs, if the vacancy occurs during the first year of the <ln numlevel="1" lineno="90" slineno="4-17"/>term of office; or</subsection><subsection ssid="15-null-6" dnum="b-o" numlevel="1" lineno="91" slineno="4-18" level="2"><display>(b)</display>for the remainder of the unexpired term, if the vacancy occurs after the first year of <ln numlevel="1" lineno="92" slineno="4-19"/>the term of office.</subsection></subsection><subsection ssid="15-null-7" dnum="3-o" numlevel="1" lineno="93" slineno="4-20" level="1" space="false"><display>(3)</display><subsection ssid="15-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="ahaskell" level="1" deltag="both">In</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Subject to Subsection <xref refnumber="15-null-11">(3)(b)</xref>, in</amend> the event of simultaneous vacancies in the <ln numlevel="1" lineno="94" slineno="4-21"/>offices of Governor and Lieutenant Governor, the President of the Senate shall <ln numlevel="1" lineno="95" slineno="4-22"/>become Governor, to serve:<subsection ssid="15-null-9" dnum="i-o" numlevel="1" lineno="96" slineno="4-23" level="3" tab="1"><display>(i)</display>until the first Monday in January of the year following the next regular general <ln numlevel="1" lineno="97" slineno="4-24"/>election after the vacancy occurs, if the vacancy occurs during the first year of the <ln numlevel="1" lineno="98" slineno="4-25"/>term of office; or</subsection><subsection ssid="15-null-10" dnum="ii-o" numlevel="1" lineno="99" slineno="4-26" level="3" tab="1"><display>(ii)</display>for the remainder of the unexpired term, if the vacancy occurs after the first year <ln numlevel="1" lineno="100" slineno="4-27"/>of the term of office.</subsection></subsection><subsection ssid="15-null-11" dnum="b-o" numlevel="1" lineno="101" slineno="4-28" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">In</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Subject to Subsection <xref refnumber="15-32">(3)(c)</xref>, in</amend> the event of simultaneous vacancies in the offices <ln numlevel="1" lineno="102" slineno="4-29"/>of Governor, Lieutenant Governor, and President of the Senate,<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both"> or if the President of <ln numlevel="1" lineno="103" slineno="4-30"/>the Senate has previously served as Governor and filling the vacancy will result in <ln numlevel="1" lineno="104" slineno="4-31"/>the President of the Senate serving more than eight years as Governor,</amend> the Speaker of <ln numlevel="1" lineno="105" slineno="4-32"/>the House of Representatives shall become Governor, to serve:<subsection ssid="15-null-12" dnum="i-o" numlevel="1" lineno="106" slineno="4-33" level="3"><display>(i)</display>until the first Monday in January of the year following the next regular general <ln numlevel="1" lineno="107" slineno="4-34"/>election after the vacancy occurs, if the vacancy occurs during the first year of the <ln numlevel="1" lineno="108" slineno="4-35"/>term of office; or</subsection><subsection ssid="15-null-13" dnum="ii-o" numlevel="1" lineno="109" slineno="4-36" level="3"><display>(ii)</display>for the remainder of the unexpired term, if the vacancy occurs after the first year <ln numlevel="1" lineno="110" slineno="4-37"/>of the term of office.</subsection></subsection><subsection ssid="15-32" dnum="_-o:c-i" numlevel="1" lineno="111" slineno="4-38" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="30" style="1" owner="ahaskell" level="1" amendtag="end">If the Speaker of the House of Representatives has previously served as Governor <ln numlevel="1" lineno="112" slineno="4-39"/>and filling the vacancy will result in the Speaker of the House of Representatives <ln numlevel="1" lineno="113" slineno="4-40"/>serving more than eight years as Governor, succession to the vacancy shall be as <ln numlevel="1" lineno="114" slineno="4-41"/>provided in statute, provided that the succession plan recognizes the eight-year <ln numlevel="1" lineno="115" slineno="4-42"/>limitation on service as Governor.</amend></subsection></subsection><subsection ssid="15-null-14" dnum="4-o" numlevel="1" lineno="116" slineno="4-43" level="1"><display>(4)</display>If a vacancy in the office of Governor occurs during the first year of the term of office, <ln numlevel="1" lineno="117" slineno="4-44"/>an election shall be held at the next regular general election after the vacancy occurs to <ln numlevel="1" lineno="118" slineno="4-45"/>elect a Governor and Lieutenant Governor, as provided in Article VII, Section 2, to <ln numlevel="1" lineno="119" slineno="4-46"/>serve the remainder of the unexpired term.</subsection><subsection ssid="15-null-15" dnum="5-o" numlevel="1" lineno="120" slineno="4-47" level="1" space="false"><display>(5)</display><subsection ssid="15-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the Governor is temporarily unable to discharge the duties of the office because <ln numlevel="1" lineno="121" slineno="4-48"/>of the Governor's temporary disability, as determined under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, or if the <ln numlevel="1" lineno="122" slineno="4-49"/>Governor-elect is temporarily unable to assume the office of Governor because of the <ln numlevel="1" lineno="123" slineno="4-50"/>Governor-elect's temporary disability, as determined under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, the <ln numlevel="1" lineno="124" slineno="4-51"/>powers and duties of the Governor shall be discharged by the Lieutenant Governor <ln numlevel="1" lineno="125" slineno="4-52"/>who, in addition to discharging the duties of the office of Lieutenant Governor, shall, <ln numlevel="1" lineno="126" slineno="4-53"/>without additional compensation, act as Governor until the disability ceases.</subsection><subsection ssid="15-null-17" dnum="b-o" numlevel="1" lineno="127" slineno="4-54" level="2" space="false"><display>(b)</display><subsection ssid="15-null-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If, during a temporary disability of the Governor or Governor-elect, as <ln numlevel="1" lineno="128" slineno="4-55"/>determined under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, a vacancy in the office of Lieutenant Governor <ln numlevel="1" lineno="129" slineno="4-56"/>occurs or the Lieutenant Governor is temporarily unable to discharge the duties of <ln numlevel="1" lineno="130" slineno="4-57"/>the office of Governor because of the Lieutenant Governor's temporary disability, <ln numlevel="1" lineno="131" slineno="4-58"/>as determined under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, the powers and duties of the Governor shall <ln numlevel="1" lineno="132" slineno="4-59"/>be discharged by the President of the Senate who shall act as Governor until the <ln numlevel="1" lineno="133" slineno="4-60"/>Governor or Governor-elect's disability ceases or, in the case of the Lieutenant <ln numlevel="1" lineno="134" slineno="4-61"/>Governor's temporary disability, the Lieutenant Governor's disability ceases, <ln numlevel="1" lineno="135" slineno="4-62"/>whichever occurs first.</subsection><subsection ssid="15-null-19" dnum="ii-o" numlevel="1" lineno="136" slineno="4-63" level="3"><display>(ii)</display>If, during a temporary disability of the Governor or Governor-elect, as <ln numlevel="1" lineno="137" slineno="4-64"/>determined under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, neither the Lieutenant Governor nor the <ln numlevel="1" lineno="138" slineno="4-65"/>President of the Senate is able to discharge the duties of the office of Governor <ln numlevel="1" lineno="139" slineno="4-66"/>because of a vacancy in the office of Lieutenant Governor or President of the <ln numlevel="1" lineno="140" slineno="4-67"/>Senate, or both, or because of a temporary disability of either or both officers, as <ln numlevel="1" lineno="141" slineno="4-68"/>determined under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)" start="0">(6)</xref>, or a combination of vacancy and temporary <ln numlevel="1" lineno="142" slineno="4-69"/>disability, the powers and duties of the Governor shall be discharged by the <ln numlevel="1" lineno="143" slineno="4-70"/>Speaker of the House of Representatives who shall act as Governor until the <ln numlevel="1" lineno="144" slineno="4-71"/>Governor's disability ceases or until the vacancy, if applicable, in the office of <ln numlevel="1" lineno="145" slineno="4-72"/>President of the Senate is filled or the temporary disability, if applicable, of the <ln numlevel="1" lineno="146" slineno="4-73"/>Lieutenant Governor or President of the Senate ceases, whichever occurs first.</subsection></subsection><subsection ssid="15-null-20" dnum="c-o" numlevel="1" lineno="147" slineno="4-74" level="2" space="false"><display>(c)</display><subsection ssid="15-null-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>During the time that the President of the Senate acts as Governor under this <ln numlevel="1" lineno="148" slineno="4-75"/>Subsection <xref depth="4" refnumber="Article VII, Section 11(5)" start="0">(5)</xref>, the President may not exercise the powers and duties of President <ln numlevel="1" lineno="149" slineno="4-76"/>of the Senate or Senator.  The powers and duties of President of the Senate may be <ln numlevel="1" lineno="150" slineno="4-77"/>exercised during that time by an acting President, chosen by the Senate.</subsection><subsection ssid="15-null-22" dnum="ii-o" numlevel="1" lineno="151" slineno="4-78" level="3"><display>(ii)</display>During the time that the Speaker of the House of Representatives acts as <ln numlevel="1" lineno="152" slineno="4-79"/>Governor under this Subsection <xref depth="4" refnumber="Article VII, Section 11(5)" start="0">(5)</xref>, the Speaker may not exercise the powers and <ln numlevel="1" lineno="153" slineno="4-80"/>duties of Speaker of the House of Representatives or Representative.  The powers <ln numlevel="1" lineno="154" slineno="4-81"/>and duties of Speaker of the House of Representatives may be exercised during <ln numlevel="1" lineno="155" slineno="4-82"/>that time by an acting Speaker, chosen by the House of Representatives.</subsection></subsection><subsection ssid="15-null-23" dnum="d-o" numlevel="1" lineno="156" slineno="4-83" level="2"><display>(d)</display>When acting as Governor under this Subsection <xref depth="4" refnumber="Article VII, Section 11(5)" start="0">(5)</xref>, the President of the Senate or <ln numlevel="1" lineno="157" slineno="4-84"/>Speaker of the House of Representatives, as the case may be, shall be entitled to <ln numlevel="1" lineno="158" slineno="4-85"/>receive the salary and emoluments of the office of Governor.</subsection></subsection><subsection ssid="15-null-24" dnum="6-o" numlevel="1" lineno="159" slineno="4-86" level="1" space="false"><display>(6)</display><subsection ssid="15-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A disability of the Governor, Governor-elect, or person acting as Governor shall <ln numlevel="1" lineno="160" slineno="4-87"/>be determined by:<subsection ssid="15-null-26" dnum="i-o" numlevel="1" lineno="161" slineno="4-88" level="3" tab="1"><display>(i)</display>the written declaration of the Governor, Governor-elect, or person acting as <ln numlevel="1" lineno="162" slineno="4-89"/>Governor, transmitted to the Supreme Court, stating an inability to discharge the <ln numlevel="1" lineno="163" slineno="4-90"/>powers and duties of the office; or</subsection><subsection ssid="15-null-27" dnum="ii-o" numlevel="1" lineno="164" slineno="4-91" level="3" tab="1"><display>(ii)</display>a majority of the Supreme Court upon the joint request of the President or, if <ln numlevel="1" lineno="165" slineno="4-92"/>applicable, acting President of the Senate and the Speaker or, if applicable, acting <ln numlevel="1" lineno="166" slineno="4-93"/>Speaker of the House of Representatives.</subsection></subsection><subsection ssid="15-null-28" dnum="b-o" numlevel="1" lineno="167" slineno="4-94" level="2"><display>(b)</display>The Governor or person acting as Governor shall resume or, in the case of a <ln numlevel="1" lineno="168" slineno="4-95"/>Governor-elect, shall assume the powers and duties of the office following a <ln numlevel="1" lineno="169" slineno="4-96"/>temporary disability upon the written declaration of the Governor, Governor-elect, or <ln numlevel="1" lineno="170" slineno="4-97"/>person acting as Governor, transmitted to the Supreme Court, that no disability exists, <ln numlevel="1" lineno="171" slineno="4-98"/>unless the Supreme Court, upon the joint request of the President or, if applicable, <ln numlevel="1" lineno="172" slineno="4-99"/>acting President of the Senate and the Speaker or, if applicable, acting Speaker of the <ln numlevel="1" lineno="173" slineno="4-100"/>House of Representatives, or upon its own initiative, determines that the temporary <ln numlevel="1" lineno="174" slineno="4-101"/>disability continues and that the Governor, Governor-elect, or person acting as <ln numlevel="1" lineno="175" slineno="4-102"/>Governor is unable to discharge the powers and duties of the office.</subsection><subsection ssid="15-null-29" dnum="c-o" numlevel="1" lineno="176" slineno="4-103" level="2"><display>(c)</display>Each determination of a disability under Subsection <xref depth="4" refnumber="Article VII, Section 11(6)(a)" start="0">(6)(a)</xref> shall be final and <ln numlevel="1" lineno="177" slineno="4-104"/>conclusive.</subsection></subsection><subsection ssid="15-null-30" dnum="7-o" numlevel="1" lineno="178" slineno="4-105" level="1"><display>(7)</display>The Supreme Court has exclusive jurisdiction to determine all questions arising under <ln numlevel="1" lineno="179" slineno="4-106"/>this section.</subsection></section></bsec><bsec buid="2" type="uncod" untype="votesub" src="uncod" uid="VS0000" sort="UB" langlock="false" numlevel="1" lineno="180" slineno="5-1" sn="5"><section type="uncod" untype="votesub" display="false" src="uncod"><secline lineno="180">Section 5.  <bold>Submittal to voters.</bold></secline><sectionText lineno="181"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">The lieutenant governor is directed to submit this proposed amendment to the voters of <ln numlevel="1" lineno="182" slineno="5-3"/>the state at the next regular general election in the manner provided by law.</amend></sectionText></section></bsec><bsec buid="1" type="uncod" untype="contingent" src="uncod" uid="CT0000" sort="UC" langlock="false" numlevel="1" lineno="183" slineno="6-1" sn="6"><section type="uncod" untype="contingent" display="false" src="uncod"><secline lineno="183">Section 6.  <bold>Contingent effective date.</bold></secline><sectionText lineno="184"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">If the amendment proposed by this joint resolution is approved by a majority of those <ln numlevel="1" lineno="185" slineno="6-3"/>voting on it at the next regular general election, the amendment shall take effect on January 1, <ln numlevel="1" lineno="186" slineno="6-4"/>2027.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-30-25 3:50 PM</tm></rev></foot></leg>
