Kyle</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This joint resolution of the Utah Legislature proposes to amend the Utah Constitution to <ln numlevel="1" lineno="6" slineno="0-6"/>modify the judicial nominating process.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This resolution proposes to amend the Utah Constitution to:<hl numlevel="1" lineno="9" slineno="0-9" level="1">authorize the Governor to request a list of nominees from a judicial nominating <ln numlevel="1" lineno="10" slineno="0-10"/>commission when the Governor is filling a judicial vacancy;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">authorize the Governor to appoint any qualified candidate even if the candidate is not <ln numlevel="1" lineno="12" slineno="0-12"/>nominated by the nominating commission; </hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">remove the time constraint on the Governor to make an appointment; and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">remove the authority of the chief justice of the Supreme Court to fill a judicial vacancy if <ln numlevel="1" lineno="15" slineno="0-15"/>the Governor fails to fill the vacancy.</hl></hp><oc numlevel="1" lineno="16" slineno="0-16">Other Special Clauses:<ocl type="votesub" sort="1" numlevel="1" lineno="17" slineno="0-17">This resolution directs the lieutenant governor to submit this proposal to voters.</ocl><ocl type="contingent" sort="10" numlevel="1" lineno="18" slineno="0-18">This resolution provides a contingent effective date of <effdate>January 1, 2027</effdate> for this proposal.</ocl></oc><ca numlevel="1" lineno="19" slineno="0-19">Utah Constitution Sections Affected:<caamd numlevel="1" lineno="20" slineno="0-20"><snhead>AMENDS:</snhead><sn num="Article VIII, Section 8" src="const" uid="UC_AVIII_S8_2026050620260506" buid="3" sort="00I08 00080020260506" numlevel="1" lineno="21" slineno="0-21"><bold>Article VIII, Section 8</bold>, </sn></caamd></ca></lt><enacthead lineno="22"/><enact numlevel="1" lineno="23" slineno="0-23">Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each <ln numlevel="1" lineno="24" slineno="0-24"/>of the two houses voting in favor thereof:</enact><bdy><bsec buid="3" num="Article VIII, Section 8" type="amend" src="const" uid="UC_AVIII_S8_2026050620260506" sort="00I08 00080020260506" numlevel="1" lineno="25" slineno="1-1" sn="1"><section number="Article VIII, Section 8" numlevel="1" lineno="26" slineno="1-2" type="amend"><secline lineno="25">Section 1. It is proposed to amend Utah Constitution, Article VIII, Section 8 to read</secline><catline lineno="26"><bold>Article VIII, Section 8<parens/>. [Vacancies -- Nominating commissions -- Senate <ln numlevel="1" lineno="27" slineno="1-3"/>approval.]</bold></catline><subsection ssid="3-null-1" dnum="1-o:_-i" numlevel="1" lineno="28" slineno="1-4" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" placement="noreturn"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1000" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="29" groupid="26" style="2" owner="jchristopherson" level="1" deltag="end">When a vacancy occurs in a court of record, the governor shall fill the vacancy by <ln numlevel="1" lineno="29" slineno="1-5"/>appointment from a list of at least three nominees certified to the governor by the <ln numlevel="1" lineno="30" slineno="1-6"/>Judicial Nominating Commission having authority over the vacancy.  The governor shall <ln numlevel="1" lineno="31" slineno="1-7"/>fill the vacancy within 30 days after receiving the list of nominees.  If the governor fails <ln numlevel="1" lineno="32" slineno="1-8"/>to fill the vacancy within the time prescribed, the chief justice of the Supreme Court <ln numlevel="1" lineno="33" slineno="1-9"/>shall within 20 days make the appointment from the list of nominees.</amend><amendoutend style="2"/></subsection><subsection ssid="3-5" dnum="_-o:1-i" numlevel="1" lineno="34" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">When a vacancy occurs in a court of record, the Governor shall fill the vacancy by <ln numlevel="1" lineno="35" slineno="1-11"/>appointment. The Governor may request the Judicial Nominating Commission for the <ln numlevel="1" lineno="36" slineno="1-12"/>court in which the vacancy occurs to provide a list of nominees, but the Governor may <ln numlevel="1" lineno="37" slineno="1-13"/>appoint any candidate who meets the qualifications established by this Constitution.</amend></subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="38" slineno="1-14" level="1"><display>(2)</display>The Legislature by statute shall provide for the nominating commissions' composition <ln numlevel="1" lineno="39" slineno="1-15"/>and procedures.  No member of the Legislature may serve as a member of, nor may the <ln numlevel="1" lineno="40" slineno="1-16"/>Legislature appoint members to, any Judicial Nominating Commission.</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="41" slineno="1-17" level="1"><display>(3)</display>The Senate shall consider and render a decision on each judicial appointment within 60 <ln numlevel="1" lineno="42" slineno="1-18"/>days of the date of appointment.  If necessary, the Senate shall convene itself in <ln numlevel="1" lineno="43" slineno="1-19"/>extraordinary session for the purpose of considering judicial appointments.  The <ln numlevel="1" lineno="44" slineno="1-20"/>appointment shall be effective upon approval of a majority of all members of the Senate.  <ln numlevel="1" lineno="45" slineno="1-21"/>If the Senate fails to approve the appointment, the office shall be considered vacant and <ln numlevel="1" lineno="46" slineno="1-22"/>a new nominating process shall commence.</subsection><subsection ssid="3-null-4" dnum="4-o" numlevel="1" lineno="47" slineno="1-23" level="1"><display>(4)</display>Selection of judges shall be based solely upon consideration of fitness for office without <ln numlevel="1" lineno="48" slineno="1-24"/>regard to any partisan political consideration.</subsection></section></bsec><bsec buid="2" type="uncod" untype="votesub" src="uncod" uid="VS0000" sort="UB" langlock="false" numlevel="1" lineno="49" slineno="2-1" sn="2"><section type="uncod" untype="votesub" display="false" src="uncod"><secline lineno="49">Section 2.  <bold>Submittal to voters.</bold></secline><sectionText lineno="50"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">The lieutenant governor is directed to submit this proposed amendment to the voters of <ln numlevel="1" lineno="51" slineno="2-3"/>the state at the next regular general election in the manner provided by law.</amend></sectionText></section></bsec><bsec buid="1" type="uncod" untype="contingent" src="uncod" uid="CT0000" sort="UC" langlock="false" numlevel="1" lineno="52" slineno="3-1" sn="3"><section type="uncod" untype="contingent" display="false" src="uncod"><secline lineno="52">Section 3.  <bold>Contingent effective date.</bold></secline><sectionText lineno="53"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">If the amendment proposed by this joint resolution is approved by a majority of those <ln numlevel="1" lineno="54" slineno="3-3"/>voting on it at the next regular general election, the amendment shall take effect on January 1, <ln numlevel="1" lineno="55" slineno="3-4"/>2027.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-2-26 4:23 PM</tm></rev></foot></leg>
