Effective date of bills.</bold></catline><subsection ssid="1-null-22" dnum="1-o" numlevel="1" lineno="22" slineno="1-3" level="1" placement="noreturn"><display>(1)</display><amend anum="0" ea="amend" pairid="78" groupid="59" style="1" owner="ahaskell" level="1" amendtag="both">As used in this rule:</amend><subsection ssid="1-51" dnum="_-o:a-i" numlevel="1" lineno="23" slineno="1-4" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">"Bill that addresses public education" means a bill whose primary effect is to enact, <ln numlevel="1" lineno="24" slineno="1-5"/>amend, or repeal one or more provisions of the Utah Code that affect Utah's public <ln numlevel="1" lineno="25" slineno="1-6"/>education system, including Utah Code provisions within:</amend><subsection ssid="1-55" dnum="_-o:i-i" numlevel="1" lineno="26" slineno="1-7" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="91" style="1" owner="ahaskell" level="1" amendtag="end">Title 53E, Public Education System -- State Administration;</amend></subsection><subsection ssid="1-56" dnum="_-o:ii-i" numlevel="1" lineno="27" slineno="1-8" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="95" style="1" slineno="1-12" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both">(2)</amend></display><subsection ssid="1-null-23" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-53" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Unless otherwise directed by the Legislature and subject to Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="104" groupid="81" style="2" owner="ahaskell" level="1" deltag="both">(2) numlevel="1" lineno="33" slineno="1-14"/>session at which <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="30" style="2" owner="ahaskell" level="1" deltag="both">it</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="29" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the bill is</amend> passed.</subsection><subsection ssid="1-null-24" dnum="b-o:ii-i" numlevel="1" lineno="34" slineno="1-15" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>The 60 days begins to run the day after the<amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both"> day on which the</amend> Legislature <ln numlevel="1" lineno="35" slineno="1-16"/>adjourns sine die.</subsection></subsection><subsection ssid="1-54" dnum="_-o:b-i" numlevel="1" lineno="36" slineno="1-17" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="JR4-1-203(2)(a)">(2)(a)</xref>, unless otherwise directed by the Legislature, the <ln numlevel="1" lineno="37" slineno="1-18"/>effective date of a bill that addresses public education is July 1 of the calendar year <ln numlevel="1" lineno="38" slineno="1-19"/>immediately following the calendar year of the session at which the bill is passed.</amend></subsection></subsection><subsection ssid="1-null-25" dnum="2-o:3-i" numlevel="1" lineno="39" slineno="1-20" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display><subsection ssid="1-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The effective date of a bill may not be a date later than January 1 of the <ln numlevel="1" lineno="40" slineno="1-21"/>second calendar year immediately following the calendar year of the session at which <ln numlevel="1" lineno="41" slineno="1-22"/>the bill is passed.</subsection><subsection ssid="1-null-27" dnum="b-o" numlevel="1" lineno="42" slineno="1-23" level="2"><display>(b)</display>A bill with a contingent effective date is not subject to Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="108" groupid="85" style="2" owner="ahaskell" level="1" deltag="both">(2)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="101" groupid="78" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="JR4-1-203(3)(a)">(3)(a)</xref></amend>.</subsection></subsection><subsection ssid="1-null-28" dnum="3-o:4-i" numlevel="1" lineno="43" slineno="1-24" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display><subsection ssid="1-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the effective date of a bill is contingent, before the bill may be introduced:<subsection ssid="1-null-30" dnum="i-o" numlevel="1" lineno="44" slineno="1-25" level="3" tab="1"><display>(i)</display>the bill sponsor shall inform the legislative general counsel of the contingent <ln numlevel="1" lineno="45" slineno="1-26"/>effective date; and</subsection><subsection ssid="1-null-31" dnum="ii-o" numlevel="1" lineno="46" slineno="1-27" level="3" tab="1"><display>(ii)</display>the legislative general counsel shall, on behalf of the bill sponsor, request <ln numlevel="1" lineno="47" slineno="1-28"/>approval of the contingent effective date from the president and speaker.</subsection></subsection><subsection ssid="1-null-32" dnum="b-o" numlevel="1" lineno="48" slineno="1-29" level="2"><display>(b)</display>A bill that has a contingent effective date that is not approved by the president and <ln numlevel="1" lineno="49" slineno="1-30"/>the speaker may not be introduced.</subsection><subsection ssid="1-null-33" dnum="c-o" numlevel="1" lineno="50" slineno="1-31" level="2"><display>(c)</display>Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="109" groupid="86" style="2" owner="ahaskell" level="1" deltag="both">(3)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="127" groupid="101" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="JR4-1-203(4)(a)">(4)(a)</xref></amend> and <xref depth="4" refnumber="JR4-1-203(3)(b)" start="0">(b)</xref> do not apply to a bill that has a contingent effective <ln numlevel="1" lineno="51" slineno="1-32"/>date that is contingent on voter approval of an amendment to the Utah Constitution.</subsection></subsection><subsection ssid="1-null-34" dnum="4-o:5-i" numlevel="1" lineno="52" slineno="1-33" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>A rules committee, a standing committee, the Senate, or the House of <ln numlevel="1" lineno="53" slineno="1-34"/>Representatives is prohibited from suspending the provisions of Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="110" groupid="87" style="2" owner="ahaskell" level="1" deltag="both">(2) or (3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="103" groupid="80" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="JR4-1-203(3)"><ln numlevel="1" lineno="54" slineno="1-35"/>(3)</xref> or <xref depth="4" refnumber="JR4-1-203(4)">(4)</xref></amend>.</subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="false" numlevel="1" lineno="55"
