It is proposed to amend Utah Constitution, Article VIII, Section 9 to read</secline><catline lineno="25"><bold>Article VIII, Section 9<parens/>. [Judicial retention elections.]</bold></catline><subsection ssid="3-1" dnum="_-o:1-i" numlevel="1" lineno="26" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>Each appointee to a court of record shall be subject to an unopposed retention <ln numlevel="1" lineno="27" slineno="1-4"/>election at the first general election held more than three years after appointment.  <ln numlevel="1" lineno="28" slineno="1-5"/>Following initial voter approval, each Supreme Court justice every tenth year, and each <ln numlevel="1" lineno="29" slineno="1-6"/>judge of other courts of record every sixth year, shall be subject to an unopposed <ln numlevel="1" lineno="30" slineno="1-7"/>retention election at the corresponding general election.  Judicial retention elections shall <ln numlevel="1" lineno="31" slineno="1-8"/>be held on a nonpartisan ballot in a manner provided by statute.  If geographic divisions <ln numlevel="1" lineno="32" slineno="1-9"/>are provided for any court of record, the judges of those courts shall stand for retention <ln numlevel="1" lineno="33" slineno="1-10"/>election only in the geographic division to which they are selected.</subsection><subsection ssid="3-4" dnum="_-o:2-i" numlevel="1" lineno="34" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">If the Legislature determines that a judge is unfit or incompetent, persistently fails to <ln numlevel="1" lineno="35" slineno="1-12"/>make timely decisions in a case, or has engaged in conduct that violates the judge's oath <ln numlevel="1" lineno="36" slineno="1-13"/>of office, is improper, or creates an appearance of impropriety, the Legislature may <ln numlevel="1" lineno="37" slineno="1-14"/>initiate a process for the judge to be subject to a special retention election as soon as <ln numlevel="1" lineno="38" slineno="1-15"/>practicable.  The Legislature may initiate the special retention election process even if <ln numlevel="1" lineno="39" slineno="1-16"/>the judge could be liable to impeachment under Article VI, Section 19, or subject to <ln numlevel="1" lineno="40" slineno="1-17"/>investigation and discipline under Article VIII, Section 13.</amend></subsection><subsection ssid="3-8" dnum="_-o:3-i" numlevel="1" lineno="41" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">The Legislature shall provide, in statute, for the process to subject a judge to a special <ln numlevel="1" lineno="42" slineno="1-19"/>retention election, the manner and timing of the special retention election, and the <ln numlevel="1" lineno="43" slineno="1-20"/>resolution of any conflicting outcomes from actions under this section, Article VI, <ln numlevel="1" lineno="44" slineno="1-21"/>Section 19, or Article VIII, Section 13.</amend></subsection><subsection ssid="3-5" dnum="_-o:4-i" numlevel="1" lineno="45" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">A judge who is subject to a special retention election is still subject to the regular <ln numlevel="1" lineno="46" slineno="1-23"/>retention elections described in Subsection <xref depth="4" refnumber="Article VIII, Section 9(1)">(1)</xref>, except that if the regular retention <ln numlevel="1" lineno="47" slineno="1-24"/>election would occur in the same year as a special retention election, the special <ln numlevel="1" lineno="48" slineno="1-25"/>retention election may replace the regular retention election for that year only.</amend></subsection></section></bsec><bsec buid="2" type="uncod" untype="votesub" src="uncod" uid="VS0000" sort="UB" langlock="false" numlevel="1" lineno="49" slineno="2-1" sn="2"><section type="uncod" untype="votesub" display="false" src="uncod"><secline lineno="49">Section 2.  <bold>Submittal to voters.</bold></secline><sectionText lineno="50"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">The lieutenant governor is directed to submit this proposed amendment to the voters of <ln numlevel="1" lineno="51" slineno="2-3"/>the state at the next regular general election in the manner provided by law.</amend></sectionText></section></bsec><bsec buid="1" type="uncod" untype="contingent" src="uncod" uid="CT0000" sort="UC" langlock="false" numlevel="1" lineno="52" slineno="3-1" sn="3"><section type="uncod" untype="contingent" display="false" src="uncod"><secline lineno="52">Section 3.  <bold>Contingent effective date.</bold></secline><sectionText lineno="53"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">If the amendment proposed by this joint resolution is approved by a majority of those <ln numlevel="1" lineno="54" slineno="3-3"/>voting on it at the next regular general election, the amendment shall take effect on January 1, <ln numlevel="1" lineno="55" slineno="3-4"/>2027.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-16-26 10:51 AM</tm></rev></foot></leg>
