Signing of pleadings, motions, affidavits, and other papers; <ln numlevel="1" lineno="31" slineno="1-3"/>representations to court; sanctions.</bold></catline><sectionText lineno="32"><tab/><bold>(a) Signature.</bold><eol numlevel="1" lineno="33" slineno="1-5" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(1) Every pleading, written motion, and other paper must be signed by at least one <ln numlevel="1" lineno="34" slineno="1-6"/>attorney of record, or, if the party is not represented, by the party.<eol numlevel="1" lineno="35" slineno="1-7" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1" groupid="1" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(2) A person may sign a paper using any form of signature recognized by law as <ln numlevel="1" lineno="36" slineno="1-8"/>binding. Unless required by statute, a paper need not be accompanied by affidavit or have a <ln numlevel="1" lineno="37" slineno="1-9"/>notarized, verified or acknowledged signature. If a rule requires an affidavit or a notarized, <ln numlevel="1" lineno="38" slineno="1-10"/>verified or acknowledged signature, the person may submit an unsworn declaration as <ln numlevel="1" lineno="39" slineno="1-11"/>described in Title 78B, Chapter 18a, Uniform Unsworn Declarations Act. If an affidavit or a <ln numlevel="1" lineno="40" slineno="1-12"/>paper with a notarized, verified or acknowledged signature is filed, the party must comply with <ln numlevel="1" lineno="41" slineno="1-13"/>Rule 5(f).<eol numlevel="1" lineno="42" slineno="1-14" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(3) An unsigned paper will be stricken unless omission of the signature is corrected <ln numlevel="1" lineno="43" slineno="1-15"/>promptly after being called to the attention of the attorney or party.<eol numlevel="1" lineno="44" slineno="1-16" display="tab"/><bold>(b) Representations to court.</bold> By presenting a pleading, written motion, or other paper to the <ln numlevel="1" lineno="45" slineno="1-17"/>court (whether by signing, filing, submitting, or advocating), an attorney or unrepresented <ln numlevel="1" lineno="46" slineno="1-18"/>party is certifying that to the best of the person's knowledge, information, and belief, formed <ln numlevel="1" lineno="47" slineno="1-19"/>after an inquiry reasonable under the circumstances<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><eol numlevel="1" lineno="48" slineno="1-20" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(1) it is not being presented for any improper purpose, such as to harass or to cause <ln numlevel="1" lineno="49" slineno="1-21"/>unnecessary delay or needless increase in the cost of litigation;<eol numlevel="1" lineno="50" slineno="1-22" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(2) the claims, defenses, and other legal contentions are warranted by existing law <ln numlevel="1" lineno="51" slineno="1-23"/>or by a nonfrivolous argument for the extension, modification, or reversal of existing law or <ln numlevel="1" lineno="52" slineno="1-24"/>the establishment of new law;<eol numlevel="1" lineno="53" slineno="1-25" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(3) the allegations and other factual contentions have evidentiary support or, if <ln numlevel="1" lineno="54" slineno="1-26"/>specifically so identified, are likely to have evidentiary support after a reasonable opportunity <ln numlevel="1" lineno="55" slineno="1-27"/>for further investigation or discovery; and<eol numlevel="1" lineno="56" slineno="1-28" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(4) the denials of factual contentions are warranted on the evidence or, if <ln numlevel="1" lineno="57" slineno="1-29"/>specifically so identified, are reasonably based on a lack of information or belief.<eol numlevel="1" lineno="58" slineno="1-30" display="tab"/><bold>(c) Sanctions.</bold> If, after notice and a reasonable opportunity to respond, the court determines <ln numlevel="1" lineno="59" slineno="1-31"/>that paragraph (b) has been violated, the court may, subject to the conditions stated below, <ln numlevel="1" lineno="60" slineno="1-32"/>impose an appropriate sanction upon the attorneys, law firms, or parties that have violated <ln numlevel="1" lineno="61" slineno="1-33"/>paragraph (b) or are responsible for the violation.<eol numlevel="1" lineno="62" slineno="1-34" display="tab"/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/>(1) How initiated.</bold><eol numlevel="1" lineno="63" slineno="1-35" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">(c)(1)</amend><amendoutend style="2"/>(A) By motion.</bold> A motion for sanctions under this rule must be made separately <ln numlevel="1" lineno="64" slineno="1-36"/>from other motions or requests and must describe the specific conduct alleged to violate <ln numlevel="1" lineno="65" slineno="1-37"/>paragraph (b). It must be served as provided in Rule 5, but may not be filed with or presented <ln numlevel="1" lineno="66" slineno="1-38"/>to the court unless, within 21 days after service of the motion (or such other period as the court <ln numlevel="1" lineno="67" slineno="1-39"/>may prescribe), the challenged paper, claim, defense, contention, allegation, or denial is not <ln numlevel="1" lineno="68" slineno="1-40"/>withdrawn or appropriately corrected. If warranted, the court may award to the party prevailing <ln numlevel="1" lineno="69" slineno="1-41"/>on the motion the reasonable expenses and attorney fees incurred in presenting or opposing the <ln numlevel="1" lineno="70" slineno="1-42"/>motion. In appropriate circumstances, a law firm may be held jointly responsible for violations <ln numlevel="1" lineno="71" slineno="1-43"/>committed by its partners, members, and employees.<eol numlevel="1" lineno="72" slineno="1-44" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">(c)(1)</amend><amendoutend style="2"/>(B) On court's initiative.</bold> On its own initiative, the court may enter an order <ln numlevel="1" lineno="73" slineno="1-45"/>describing the specific conduct that appears to violate paragraph (b) and directing an attorney, <ln numlevel="1" lineno="74" slineno="1-46"/>law firm, or party to show cause why it has not violated paragraph (b) with respect thereto.<eol numlevel="1" lineno="75" slineno="1-47" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/>(2) Nature of sanction; limitations.</bold> <amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="76" slineno="1-48" display="tab"/><para/><tab/>(A) </amend>A sanction imposed for violation of this rule must be limited to what is sufficient <ln numlevel="1" lineno="77" slineno="1-49"/>to deter repetition of such conduct or comparable conduct by others similarly situated.<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both"> Subject <ln numlevel="1" lineno="78" slineno="1-50"/>to the limitations in paragraphs (c)(2)(A) and (c)(2)(B), the sanction may consist of, or include, <ln numlevel="1" lineno="79" slineno="1-51"/>directives of a nonmonetary nature, an order to pay a penalty into court, or, if imposed on <ln numlevel="1" lineno="80" slineno="1-52"/>motion and warranted for effective deterrence, an order directing payment to the movant of <ln numlevel="1" lineno="81" slineno="1-53"/>some or all of the reasonable attorney fees and other expenses incurred as a direct result of the <ln numlevel="1" lineno="82" slineno="1-54"/>violation.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="83" slineno="1-55" display="tab"/><para/><tab/>(B) Subject to the limitations described in paragraphs (c)(2)(C) and (c)(2)(D), the <ln numlevel="1" lineno="84" slineno="1-56"/>court may order a sanction that consists of, or includes:<eol numlevel="1" lineno="85" slineno="1-57" display="tab"/><para/><tab/><tab/>(i) a directive of a nonmonetary nature;<eol numlevel="1" lineno="86" slineno="1-58" display="tab"/><para/><tab/><tab/>(ii) an order to pay a penalty to the court;<eol numlevel="1" lineno="87" slineno="1-59" display="tab"/><para/><tab/><tab/>(iii) an order to pay a charitable contribution to a nonprofit organization that offers <ln numlevel="1" lineno="88" slineno="1-60"/>free or low-cost legal assistance, is approved by the court, and is not operating under the <ln numlevel="1" lineno="89" slineno="1-61"/>authority or direct control of the Judiciary; or<eol numlevel="1" lineno="90" slineno="1-62" display="tab"/><para/><tab/><tab/>(iv) if imposed on motion and warranted for effective deterrence, an order <ln numlevel="1" lineno="91" slineno="1-63"/>directing the attorney, law firm, or party to pay some or all of the reasonable attorney fees and <ln numlevel="1" lineno="92" slineno="1-64"/>other expenses incurred as a direct result of the violation.</amend><eol numlevel="1" lineno="93" slineno="1-65" display="tab"/><para/><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">(c)(2)(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(C)</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">Monetary sanctions may not be awarded</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A court may not award <ln numlevel="1" lineno="94" slineno="1-66"/>monetary sanctions</amend> against a represented party for a violation of paragraph (b)(2).<eol numlevel="1" lineno="95" slineno="1-67" display="tab"/><para/><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">(c)(2)(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(D)</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">Monetary sanctions may not be awarded</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A court may not award <ln numlevel="1" lineno="96" slineno="1-68"/>monetary sanctions</amend> on the court's initiative unless the court issues its order to show cause <ln numlevel="1" lineno="97" slineno="1-69"/>before a voluntary dismissal or settlement of the claims made by or against the party which is, <ln numlevel="1" lineno="98" slineno="1-70"/>or whose attorneys are, to be sanctioned.<amend anum="0" ea="amend" pairid="27" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both"><tab/><tab/></amend><eol numlevel="1" lineno="99" slineno="1-71" display="tab"/><para/><bold><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/>(3) Order.</bold> When imposing sanctions, the court will describe the conduct determined <ln numlevel="1" lineno="100" slineno="1-72"/>to constitute a violation of this rule and explain the basis for the sanction imposed.</sectionText></section></bsec><bsec buid="7" type="uncod" untype="rule" rtype="civil" atype="amend" num="Rule 41" src="rule" uid="URV00000041" sort="URV00041" langlock="false" numlevel="1" lineno="101" slineno="2-1" sn="2"><section number="Rule 41" numlevel="1" lineno="102" slineno="2-2" type="uncod" untype="rule" atype="amend"><secline lineno="101">Section 2. <bold>Rule 41</bold>, Utah Rules of Civil Procedure is amended to read:</secline><catline lineno="102"><bold>Rule 41<parens/>. Dismissal of actions.</bold></catline><sectionText lineno="103"><tab/><bold>(a) Voluntary dismissal; effect.</bold><eol numlevel="1" lineno="104" slineno="2-4" display="tab"/><bold> (1) By the plaintiff.</bold><eol numlevel="1" lineno="105" slineno="2-5" display="tab"/><para/>(A) Subject to Rule 23(e) and any applicable statute, the plaintiff may dismiss an action, <ln numlevel="1" lineno="106" slineno="2-6"/>a claim, or a party without a court order by filing:<eol numlevel="1" lineno="107" slineno="2-7" display="tab"/><para/><tab/>(i) a notice of dismissal before any opposing party serves an answer or a motion for <ln numlevel="1" lineno="108" slineno="2-8"/>summary judgment; or<eol numlevel="1" lineno="109" slineno="2-9" display="tab"/><para/><tab/>(ii) a stipulation of dismissal signed by all parties who have appeared.<eol numlevel="1" lineno="110" slineno="2-10" display="tab"/><para/>(B) Unless the notice or stipulation states otherwise, the dismissal is without prejudice. <ln numlevel="1" lineno="111" slineno="2-11"/>But if the plaintiff previously dismissed any federal- or state-court action based on or including <ln numlevel="1" lineno="112" slineno="2-12"/>the same claim, a notice of dismissal operates as an adjudication on the merits.<eol numlevel="1" lineno="113" slineno="2-13" display="tab"/><bold>(2) By court order.</bold> Except as provided in paragraph (a)(1), an action, a claim, or a party <ln numlevel="1" lineno="114" slineno="2-14"/>may be dismissed at the plaintiff's request by court order only on terms the court considers <ln numlevel="1" lineno="115" slineno="2-15"/>proper. If a defendant has pleaded a counterclaim before being served with the plaintiff's <ln numlevel="1" lineno="116" slineno="2-16"/>motion to dismiss, the action may be dismissed over the defendant's objection only if the <ln numlevel="1" lineno="117" slineno="2-17"/>counterclaim can remain pending for independent adjudication by the court. Unless the order <ln numlevel="1" lineno="118" slineno="2-18"/>states otherwise, a dismissal under this paragraph is without prejudice.<eol numlevel="1" lineno="119" slineno="2-19" display="tab"/><bold>(b) Involuntary dismissal; effect.</bold> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">If the plaintiff fails to prosecute or to comply with these <ln numlevel="1" lineno="120" slineno="2-20"/>rules or any court order, a defendant may move to dismiss the action or any claim against it.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="121" slineno="2-21" display="tab"/><para/>(1) A defendant may move to dismiss an action, or any claim in an action, against the <ln numlevel="1" lineno="122" slineno="2-22"/>defendant if:<eol numlevel="1" lineno="123" slineno="2-23" display="tab"/><para/><tab/>(A) the plaintiff fails to prosecute or to comply with these rules or any court order; or<eol numlevel="1" lineno="124" slineno="2-24" display="tab"/><para/><tab/>(B) the plaintiff, or the plaintiff's attorney, named the defendant in the action solely <ln numlevel="1" lineno="125" slineno="2-25"/>because the defendant is an attorney of record for a party in the action or a related action.</amend> <amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="126" slineno="2-26" display="tab"/><para/>(2) </amend>Unless the dismissal order otherwise states, a dismissal under this paragraph and any <ln numlevel="1" lineno="127" slineno="2-27"/>dismissal not under this rule, other than a dismissal for lack of jurisdiction, improper venue, or <ln numlevel="1" lineno="128" slineno="2-28"/>failure to join a party under Rule 19, operates as an adjudication on the merits.<eol numlevel="1" lineno="129" slineno="2-29" display="tab"/><bold>(c) Dismissal of counterclaim, crossclaim, or third-party claim.</bold> This rule applies to the <ln numlevel="1" lineno="130" slineno="2-30"/>dismissal of any counterclaim, crossclaim, or third-party claim. A claimant's voluntary <ln numlevel="1" lineno="131" slineno="2-31"/>dismissal under paragraph (a)(1) must be made before a responsive pleading is served or, if <ln numlevel="1" lineno="132" slineno="2-32"/>there is no responsive pleading, before evidence is introduced at a trial or hearing.<eol numlevel="1" lineno="133" slineno="2-33" display="tab"/><bold>(d) Costs of previously-dismissed action.</bold> <amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="134" slineno="2-34" display="tab"/><para/>(1) </amend>If a plaintiff who previously dismissed an action in any court files an action based on <ln numlevel="1" lineno="135" slineno="2-35"/>or including the same claim against the same defendant, the court may order the plaintiff to <ln numlevel="1" lineno="136" slineno="2-36"/>pay all or part of the costs of the previous action and may stay the proceedings until the <ln numlevel="1" lineno="137" slineno="2-37"/>plaintiff has complied.<amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="138" slineno="2-38" display="tab"/><para/>(2) The court shall order a plaintiff, or a plaintiff's attorney or law firm, to pay <ln numlevel="1" lineno="139" slineno="2-39"/>reasonable attorney fees and other expenses incurred by a defendant if:<eol numlevel="1" lineno="140" slineno="2-40" display="tab"/><para/><tab/>(A) the action or claim against the defendant is dismissed under paragraph (b)(1)(B); <ln numlevel="1" lineno="141" slineno="2-41"/>and<eol numlevel="1" lineno="142" slineno="2-42" display="tab"/><para/><tab/>(B) the court determines, by a preponderance of the evidence:<eol numlevel="1" lineno="143" slineno="2-43" display="tab"/><para/><tab/><tab/>(i) the action or claim against the defendant was frivolous or has no reasonable <ln numlevel="1" lineno="144" slineno="2-44"/>basis in law or fact; and<eol numlevel="1" lineno="145" slineno="2-45" display="tab"/><para/><tab/><tab/>(ii) the plaintiff, or the plaintiff's attorney, brought the action or claim to harass, <ln numlevel="1" lineno="146" slineno="2-46"/>cause unreasonable delay, needlessly increase the cost of litigation, or abuse the judicial <ln numlevel="1" lineno="147" slineno="2-47"/>process.</amend><eol numlevel="1" lineno="148" slineno="2-48" display="tab"/><bold>(e) Bond or undertaking to be delivered to opposing party.</bold> If a party dismisses a complaint, <ln numlevel="1" lineno="149" slineno="2-49"/>counterclaim, crossclaim, or third-party claim, under paragraph (a)(1) after a provisional <ln numlevel="1" lineno="150" slineno="2-50"/>remedy has been allowed the party, the bond or undertaking filed in support of the provisional <ln numlevel="1" lineno="151" slineno="2-51"/>remedy must be delivered to the party against whom the provisional remedy was obtained.</sectionText></section></bsec><bsec buid="6" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="false" numlevel="1" lineno="152" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="152">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="153"><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">As provided in Utah Constitution, Article VIII, Section 4, this resolution takes effect <ln numlevel="1" lineno="154" slineno="3-3"/>upon a two-thirds vote of all members elected to each house.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-11-26 4:31 PM</tm></rev></foot></leg>
