General provisions; definition.</bold></catline><sectionText lineno="34"><tab/><bold><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">(1) </amend>Scope of rules.</bold> These rules govern the procedure in the courts of the state of Utah in <ln numlevel="1" lineno="35" slineno="1-4"/>all actions of a civil nature, whether cognizable at law or in equity, and in all statutory <ln numlevel="1" lineno="36" slineno="1-5"/>proceedings, except as governed by other rules promulgated by this court or statutes enacted <ln numlevel="1" lineno="37" slineno="1-6"/>by the Legislature, and except as stated in Rule 81. They must be liberally construed and <ln numlevel="1" lineno="38" slineno="1-7"/>applied to achieve the just, speedy, and inexpensive determination of every action. These rules <ln numlevel="1" lineno="39" slineno="1-8"/>govern all actions brought after they take effect and all further proceedings in actions then <ln numlevel="1" lineno="40" slineno="1-9"/>pending. If, in the opinion of the court, applying a rule in an action pending when the rule <ln numlevel="1" lineno="41" slineno="1-10"/>takes effect would not be feasible or would be unjust, the former procedure applies.<amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="42" slineno="1-11" display="tab"/><bold>(2) Definition.</bold> As used in these rules, "district court panel" means a panel of three district <ln numlevel="1" lineno="43" slineno="1-12"/>court judges that is convened to hear and decide an action.</amend></sectionText></section></bsec><bsec buid="2" type="uncod" untype="rule" rtype="civil" atype="amend" num="Rule 42" src="rule" uid="URV00000042" sort="URV00042" langlock="false" numlevel="1" lineno="44" slineno="2-1" sn="2"><section number="Rule 42" numlevel="1" lineno="45" slineno="2-2" type="uncod" untype="rule" atype="amend"><secline lineno="44">Section 2. <bold>Rule 42</bold>, Utah Rules of Civil Procedure is amended to read:</secline><catline lineno="45"><bold>Rule 42<parens/>. Consolidation; separate trials; transfer of an action.</bold></catline><sectionText lineno="46"><tab/><bold>(a) Consolidation.</bold> When actions involving a common question of law or fact or arising <ln numlevel="1" lineno="47" slineno="2-4"/>from the same transaction or occurrence are pending before the court in one or more judicial <ln numlevel="1" lineno="48" slineno="2-5"/>districts, the court may, on motion of any party or on the court's own initiative: order that the <ln numlevel="1" lineno="49" slineno="2-6"/>actions are consolidated in whole or in part for any purpose, including for discovery, other <ln numlevel="1" lineno="50" slineno="2-7"/>pretrial matters, or a joint hearing or trial; stay any or all of the proceedings in any action <ln numlevel="1" lineno="51" slineno="2-8"/>subject to the order; transfer any or all further proceedings in the actions to a location in which <ln numlevel="1" lineno="52" slineno="2-9"/>any of the actions is pending after consulting with the presiding judge of the receiving court; <ln numlevel="1" lineno="53" slineno="2-10"/>and make other such orders concerning proceedings therein as may tend to avoid unnecessary <ln numlevel="1" lineno="54" slineno="2-11"/>costs or delay.<eol numlevel="1" lineno="55" slineno="2-12" display="tab"/><para/>(1) In determining whether to order consolidation and the appropriate location for the <ln numlevel="1" lineno="56" slineno="2-13"/>consolidated proceedings, the court may consider, among other factors: the complexity of the <ln numlevel="1" lineno="57" slineno="2-14"/>actions; the importance of any common question of fact or law to the determination of the <ln numlevel="1" lineno="58" slineno="2-15"/>actions; the risk of duplicative or inconsistent rulings, orders, or judgments; the case and <ln numlevel="1" lineno="59" slineno="2-16"/>records classification of each case as described in Rule 4-202.02 of the Utah Code of Judicial <ln numlevel="1" lineno="60" slineno="2-17"/>Administration; the relative procedural postures of the actions; the risk that consolidation may <ln numlevel="1" lineno="61" slineno="2-18"/>unreasonably delay the progress, increase the expense, or complicate the processing of any <ln numlevel="1" lineno="62" slineno="2-19"/>action; prejudice to any party that far outweighs the overall benefits of consolidation; the <ln numlevel="1" lineno="63" slineno="2-20"/>convenience of the parties, witnesses, and counsel; and the efficient utilization of judicial <ln numlevel="1" lineno="64" slineno="2-21"/>resources and the facilities and personnel of the court.<eol numlevel="1" lineno="65" slineno="2-22" display="tab"/><para/>(2) A motion to consolidate may be filed or opposed by any party to either action to be <ln numlevel="1" lineno="66" slineno="2-23"/>consolidated, without seeking permission to intervene. The motion must be filed in and heard <ln numlevel="1" lineno="67" slineno="2-24"/>by the judge assigned to the first action filed and must be served on all parties in each action <ln numlevel="1" lineno="68" slineno="2-25"/>pursuant to Rule 5. The movant must file in each action notice of the motion and notice of the <ln numlevel="1" lineno="69" slineno="2-26"/>order denying or granting the motion.<eol numlevel="1" lineno="70" slineno="2-27" display="tab"/><para/>(3) If the court orders consolidation, the consolidated case will be heard by the judge <ln numlevel="1" lineno="71" slineno="2-28"/>assigned to the first action filed, unless otherwise ordered by the presiding judge or agreed <ln numlevel="1" lineno="72" slineno="2-29"/>upon by the originally assigned judges. The court will order that a single case number be used <ln numlevel="1" lineno="73" slineno="2-30"/>for all subsequent filings in the consolidated case.<eol numlevel="1" lineno="74" slineno="2-31" display="tab"/><bold>(b) Consolidation or severance in whole or in part.</bold> For convenience or to avoid prejudice, <ln numlevel="1" lineno="75" slineno="2-32"/>the court may: <eol numlevel="1" lineno="76" slineno="2-33" display="tab"/><para/>(1) order that the consolidated matters be tried together or that a separate trial be held on <ln numlevel="1" lineno="77" slineno="2-34"/>any one or more claims, crossclaims, counterclaims, third-party claims, or separate issues; or<eol numlevel="1" lineno="78" slineno="2-35" display="tab"/><para/>(2) order that the consolidated matters be severed at any point and provide that the <ln numlevel="1" lineno="79" slineno="2-36"/>matters be treated as separate actions going forward, including that the severed matters be tried <ln numlevel="1" lineno="80" slineno="2-37"/>by either the judge in the consolidated matter or the originally assigned judge.<eol numlevel="1" lineno="81" slineno="2-38" display="tab"/><bold>(c) Reassignment. </bold>If the consolidation of actions would be otherwise appropriate but is not <ln numlevel="1" lineno="82" slineno="2-39"/>administratively possible, the judge assigned to the first action may order the court clerk to <ln numlevel="1" lineno="83" slineno="2-40"/>reassign the other actions to the judge assigned to the first action. Such actions will be treated <ln numlevel="1" lineno="84" slineno="2-41"/>for all purposes as if they were consolidated except that the actions will retain their separate <ln numlevel="1" lineno="85" slineno="2-42"/>case numbers, which must be included on all filings.<bold/><eol numlevel="1" lineno="86" slineno="2-43" display="tab"/><bold>(d) <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">Venue Transfer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Transfer of an action</amend>.</bold><eol numlevel="1" lineno="87" slineno="2-44" display="tab"/><para/><bold>(1)<amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"> Transfer to proper venue.</amend> </bold><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="88" slineno="2-45" display="tab"/><para/><tab/>(A) </amend>On timely motion of any party, where transfer to a proper venue is available, the <ln numlevel="1" lineno="89" slineno="2-46"/>court must transfer any action filed in an improper venue.<eol numlevel="1" lineno="90" slineno="2-47" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">(2) </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(B) </amend>The court must give substantial deference to a plaintiff's choice of a proper <ln numlevel="1" lineno="91" slineno="2-48"/>venue. On timely motion of any party, a court may: transfer venue of any action, in whole or in <ln numlevel="1" lineno="92" slineno="2-49"/>part, to any other venue for any purpose, including for discovery, other pretrial matters, or a <ln numlevel="1" lineno="93" slineno="2-50"/>joint hearing or trial; stay any or all of the proceedings in the action; and make other such <ln numlevel="1" lineno="94" slineno="2-51"/>orders concerning proceedings therein to pursue the interests of justice and avoid unnecessary <ln numlevel="1" lineno="95" slineno="2-52"/>costs or delay. In determining whether to transfer venue and the appropriate venue for the <ln numlevel="1" lineno="96" slineno="2-53"/>transferred proceedings, the court may consider, among other factors, whether transfer will: <ln numlevel="1" lineno="97" slineno="2-54"/>increase the likelihood of a fair and impartial determination in the action; minimize expense or <ln numlevel="1" lineno="98" slineno="2-55"/>inconvenience to parties, witnesses, or the court; decrease delay; avoid hardship or injustice <ln numlevel="1" lineno="99" slineno="2-56"/>otherwise caused by venue requirements; and advance the interests of justice. <eol numlevel="1" lineno="100" slineno="2-57" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(C)</amend> The court may direct that specified parties pay the expenses, if any, of transfer.<amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="101" slineno="2-58" display="tab"/><para/><bold>(2) Transfer to district court panel</bold><bold>. </bold><eol numlevel="1" lineno="102" slineno="2-59" display="tab"/><para/><tab/>(A) The Attorney General, the Governor, or the L<marker pairid="18"/>egislature may file a notice to <ln numlevel="1" lineno="103" slineno="2-60"/>convene a district court panel, as described in Utah Code section 78A-5-102.7, in an action if <ln numlevel="1" lineno="104" slineno="2-61"/>the notice to convene is filed within 45 days after:<eol numlevel="1" lineno="105" slineno="2-62" display="tab"/><para/><tab/><tab/>(i) the day on which the action is commenced;<eol numlevel="1" lineno="106" slineno="2-63" display="tab"/><para/><tab/><tab/>(ii) if the complaint in the action is amended, the day on which the amended <ln numlevel="1" lineno="107" slineno="2-64"/>complaint is filed; or<eol numlevel="1" lineno="108" slineno="2-65" display="tab"/><para/><tab/><tab/>(iii) the effective date of this resolution if the action is pending in the district court <ln numlevel="1" lineno="109" slineno="2-66"/>on the effective date of this resolution.<eol numlevel="1" lineno="110" slineno="2-67" display="tab"/><para/><tab/><marker pairid="20"/>(B) If the Attorney General, the Governor, or the Legislature files a notice to convene <ln numlevel="1" lineno="111" slineno="2-68"/>a district court panel, the district court must:<bold/><marker pairid="21"/><eol numlevel="1" lineno="112" slineno="2-69" display="tab"/><para/><tab/><tab/>(i) notify the presiding officer of the Judicial Council that the action must be <ln numlevel="1" lineno="113" slineno="2-70"/>transferred to a district court panel; and<eol numlevel="1" lineno="114" slineno="2-71" display="tab"/><para/><tab/><tab/>(ii) transfer the action to the district court panel convened to hear and decide the <ln numlevel="1" lineno="115" slineno="2-72"/>action.<eol numlevel="1" lineno="116" slineno="2-73" display="tab"/><para/><tab/>(C) Upon the filing of a notice to convene a district court panel, the district court may <ln numlevel="1" lineno="117" slineno="2-74"/>not sever any matter from the action or take any further action.</amend></sectionText></section></bsec><bsec buid="6" type="uncod" untype="rule" rtype="civil" atype="amend" num="Rule 63" src="rule" uid="URV00000063" sort="URV00063" langlock="false" numlevel="1" lineno="118" slineno="3-1" sn="3"><section number="Rule 63" numlevel="1" lineno="119" slineno="3-2" type="uncod" untype="rule" atype="amend"><secline lineno="118">Section 3. <bold>Rule 63</bold>, Utah Rules of Civil Procedure is amended to read:</secline><catline lineno="119"><bold>Rule 63<parens/>. Disability or disqualification of a judge.</bold></catline><sectionText lineno="120"><tab/><bold>(a) Substitute judge; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">Prior</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">prior</amend> testimony.</bold> If the judge to whom an action has been <ln numlevel="1" lineno="121" slineno="3-4"/>assigned is unable to perform his or her duties, then any other judge of that district or any <ln numlevel="1" lineno="122" slineno="3-5"/>judge assigned pursuant to Judicial Council rule is authorized to perform those duties. The <ln numlevel="1" lineno="123" slineno="3-6"/>judge to whom the case is reassigned may rehear the evidence or some part of it.<eol numlevel="1" lineno="124" slineno="3-7" display="tab"/><bold>(b) Motion to disqualify; affidavit or declaration.</bold><eol numlevel="1" lineno="125" slineno="3-8" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(1) A party to an action or the party's attorney may file a motion to disqualify a <ln numlevel="1" lineno="126" slineno="3-9"/>judge. <amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="127" slineno="3-10" display="tab"/><para/><tab/>(2) </amend>The motion must be accompanied by a certificate that the motion is filed in good <ln numlevel="1" lineno="128" slineno="3-11"/>faith and must be supported by an affidavit or unsworn declaration as described in Title 78B, <ln numlevel="1" lineno="129" slineno="3-12"/>Chapter 18a, Uniform Unsworn Declarations Act stating facts sufficient to show bias, <ln numlevel="1" lineno="130" slineno="3-13"/>prejudice or conflict of interest. The motion must also be accompanied by a request to submit <ln numlevel="1" lineno="131" slineno="3-14"/>for decision.<eol numlevel="1" lineno="132" slineno="3-15" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">(b)(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)<marker pairid="21"/><marker pairid="22"/><marker pairid="23"/></amend> The motion must be filed after commencement of the action, but not later <ln numlevel="1" lineno="133" slineno="3-16"/>than 21 days after the last of the following:<eol numlevel="1" lineno="134" slineno="3-17" display="tab"/><para/><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">(b)(2)</amend><amendoutend style="2"/>(A) assignment of the action or hearing to the judge;<eol numlevel="1" lineno="135" slineno="3-18" display="tab"/><para/><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">(b)(2)</amend><amendoutend style="2"/>(B) appearance of the party or the party's attorney; The judge must take no further action in the case <ln numlevel="1" lineno="152" slineno="3-35"/>until the motion is decided. If the judge grants the motion, the order will direct the presiding <ln numlevel="1" lineno="153" slineno="3-36"/>judge of the court to assign another judge to the action or hearing. copy of the notice to the assigned judge and the <ln numlevel="1" lineno="246" slineno="4-73"/>presiding judge.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="247" slineno="4-74" display="tab"/><para/><tab/><tab/>(C) Except as provided in paragraph (b)(1)(D), the parties must file a copy of the <ln numlevel="1" lineno="248" slineno="4-75"/>notice with the assigned judge and send a copy of the notice to the presiding judge.<eol numlevel="1" lineno="249" slineno="4-76" display="tab"/><para/><tab/>(D) If the action is before a district court panel, the parties must file a copy of the <ln numlevel="1" lineno="250" slineno="4-77"/>notice with the district court panel and send a copy of the notice to the presiding officer of the <ln numlevel="1" lineno="251" slineno="4-78"/>Judicial Council.</amend><eol numlevel="1" lineno="252" slineno="4-79" as parties; and (5) that a good faith effort has been made to serve all parties named <ln numlevel="1" lineno="256" slineno="4-83"/>in the pleadings.<eol numlevel="1" lineno="257" slineno="4-84" no circumstances <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="109" groupid="107" style="2" owner="jchristopherson" level="1" deltag="both">shall</amend><amendoutend style="2"/><amend owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(2) <bold>Time for filing a notice.</bold><eol numlevel="1" lineno="262" slineno="4-89" display="tab"/><para/><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both">(b)(2)</amend><amendoutend the action.<amend anum="0" ea="amend" pairid="81" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="280" slineno="4-107" display="tab"/><para/><tab/>(D) If a notice is filed for a change of judge on a district court panel:<eol numlevel="1" lineno="281" slineno="4-108" display="tab"/><para/><tab/><tab/><tab/>(i) the presiding officer of the Judicial Council must promptly determine <ln numlevel="1" lineno="282" slineno="4-109"/>whether the notice is proper; and<eol numlevel="1" lineno="283" slineno="4-110" display="tab"/><para/><tab/><tab/><tab/>(ii) if the notice is proper, a new judge must be promptly<marker pairid="128"/> assigned in <ln numlevel="1" lineno="284" slineno="4-111"/>accordance with the random selection process described in the Utah Code of Judicial <ln numlevel="1" lineno="285" slineno="4-112"/>Administration for a district court panel.</amend><eol numlevel="1" lineno="286" slineno="4-113" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(4) <bold>Nondisclosure to court.</bold> No party shall communicate to the court, or cause <ln numlevel="1" lineno="287" slineno="4-114"/>another to communicate to the court, the fact of any party's seeking consent to a notice of <ln numlevel="1" lineno="288" slineno="4-115"/>change.<eol numlevel="1" lineno="289" slineno="4-116" display="tab"/>(c) <bold>Rule 63 unaffected.</bold> Nothing in this rule precludes the right of any party to seek <ln numlevel="1" lineno="290" slineno="4-117"/>disqualification of a judge under Rule 63.</sectionText></section></bsec><bsec buid="9"
