Definitions.</bold></catline><sectionText lineno="32"><tab/>As used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-4" level="1"><display>(1)</display>"Department head" means the same as that term is defined in Utah Code Section <xref depth="3" refnumber="63A-17-807" start="0"><ln numlevel="1" lineno="34" slineno="1-5"/>63A-17-807</xref> or a department head's designee.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="35" slineno="1-6" level="1"><display>(2)</display>"Former legislator" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an individual</amend> who is not a current member of the <ln numlevel="1" lineno="36" slineno="1-7"/>Legislature, but who served in the Utah House or Utah Senate at one time.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="37" slineno="1-8" level="1" space="false"><display>(3)</display><subsection ssid="1-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Guest" means an individual who is afforded access to the House space under a <ln numlevel="1" lineno="38" slineno="1-9"/>provision of this chapter, who is not an individual described in Subsection <xref depth="4" refnumber="HR2-4-101(3)(c)">(3)(c)</xref> or a <ln numlevel="1" lineno="39" slineno="1-10"/>special guest as described under <xref depth="4" refnumber="HR2-4-101.2(5)" start="0">HR2-4-101.2(5)</xref>.</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="40" slineno="1-11" level="2"><display>(b)</display>"Guest" includes:<subsection ssid="1-null-6" dnum="i-o" numlevel="1" lineno="41" slineno="1-12" level="3"><display>(i)</display>the governor, the lieutenant governor, the state attorney general, the state treasurer, <ln numlevel="1" lineno="42" slineno="1-13"/>the state auditor, and governor's staff; and</subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="43" slineno="1-14" level="3"><display>(ii)</display>a former legislator who is an individual described in Subsection <xref depth="4" refnumber="HR2-4-101(3)(b)(i)">(3)(b)(i)</xref>.</subsection></subsection><subsection ssid="1-null-8" dnum="c-o" numlevel="1" lineno="44" slineno="1-15" level="2"><display>(c)</display>"Guest" does not mean a legislator, a member of House or Senate staff, a member of <ln numlevel="1" lineno="45" slineno="1-16"/>professional legislative staff, a House intern, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">or a lobbyist</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a lobbyist, or a volunteer <ln numlevel="1" lineno="46" slineno="1-17"/>lobbyist</amend>.</subsection></subsection><subsection ssid="1-null-9" dnum="4-o" numlevel="1" lineno="47" slineno="1-18" level="1"><display>(4)</display>"House conference rooms" means one of the conference rooms adjacent to the House <ln numlevel="1" lineno="48" slineno="1-19"/>lounge, speaker's office, or the majority caucus room.</subsection><subsection ssid="1-null-10" dnum="5-o" numlevel="1" lineno="49" slineno="1-20" level="1"><display>(5)</display>"House halls" means the passageways that allow access to:<subsection ssid="1-null-11" dnum="a-o" numlevel="1" lineno="50" slineno="1-21" level="2"><display>(a)</display>the House chamber;</subsection><subsection ssid="1-null-12" dnum="b-o" numlevel="1" lineno="51" slineno="1-22" level="2"><display>(b)</display>the House lounge;</subsection><subsection ssid="1-null-13" dnum="c-o" numlevel="1" lineno="52" slineno="1-23" level="2"><display>(c)</display>the House offices; or</subsection><subsection ssid="1-null-14" dnum="d-o" numlevel="1" lineno="53" slineno="1-24" level="2"><display>(d)</display>any other nonpublic areas adjoining the House chamber.</subsection></subsection><subsection ssid="1-null-15" dnum="6-o" numlevel="1" lineno="54" slineno="1-25" level="1"><display>(6)</display>"House intern" means an individual who is:<subsection ssid="1-null-16" dnum="a-o" numlevel="1" lineno="55" slineno="1-26" level="2"><display>(a)</display>an official participant in the student intern program sponsored by the Utah <ln numlevel="1" lineno="56" slineno="1-27"/>Legislature and administered by the Office of Legislative Services; and</subsection><subsection ssid="1-null-17" dnum="b-o" numlevel="1" lineno="57" slineno="1-28" level="2"><display>(b)</display>is assigned to a representative.</subsection></subsection><subsection ssid="1-null-18" dnum="7-o" numlevel="1" lineno="58" slineno="1-29" level="1"><display>(7)</display>"House offices" means:<subsection ssid="1-null-19" dnum="a-o" numlevel="1" lineno="59" slineno="1-30" level="2"><display>(a)</display>Representatives' offices adjacent to the House chamber;</subsection><subsection ssid="1-null-20" dnum="b-o" numlevel="1" lineno="60" slineno="1-31" level="2"><display>(b)</display>Representatives' offices on the third and fourth floors of the capitol building;</subsection><subsection ssid="1-null-21" dnum="c-o" numlevel="1" lineno="61" slineno="1-32" level="2"><display>(c)</display>Representatives' offices in the House building; and</subsection><subsection ssid="1-null-22" dnum="d-o" numlevel="1" lineno="62" slineno="1-33" level="2"><display>(d)</display>kitchens, restrooms, elevators, and any auxiliary rooms in the nonpublic areas <ln numlevel="1" lineno="63" slineno="1-34"/>connected with the offices listed above.</subsection></subsection><subsection ssid="1-null-23" dnum="8-o" numlevel="1" lineno="64" slineno="1-35" level="1"><display>(8)</display>"House or Senate staff" means an individual who is employed directly by the House or <ln numlevel="1" lineno="65" slineno="1-36"/>Senate.</subsection><subsection ssid="1-null-24" dnum="9-o" numlevel="1" lineno="66" slineno="1-37" level="1" space="false"><display>(9)</display><subsection ssid="1-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"House space" means the House chamber, House lounge, House offices, House <ln numlevel="1" lineno="67" slineno="1-38"/>halls, and House conference rooms.</subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="68" slineno="1-39" level="2"><display>(b)</display>"House space" does not mean the common public space outside the House chamber.</subsection></subsection><subsection ssid="1-null-27" dnum="10-o" numlevel="1" lineno="69" slineno="1-40" level="1"><display>(10)</display>"Immediate family" means any parent, spouse, child, grandparent, grandchild, <ln numlevel="1" lineno="70" slineno="1-41"/>great-grandparent, great-grandchild, sibling, aunt, uncle, niece, or nephew of a member <ln numlevel="1" lineno="71" slineno="1-42"/>of the House, provided that the individual is not a lobbyist<amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both"> or volunteer lobbyist</amend>.</subsection><subsection ssid="1-null-28" dnum="11-o" numlevel="1" lineno="72" slineno="1-43" level="1"><display>(11)</display>"Lobbying" means communicating with a legislator for the purpose of influencing the <ln numlevel="1" lineno="73" slineno="1-44"/>passage, defeat, amendment, or postponement of legislative action.</subsection><subsection ssid="1-null-29" dnum="12-o" numlevel="1" lineno="74" slineno="1-45" level="1"><display>(12)</display>"Lobbyist" <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">means an individual who is required to register as a lobbyist by Utah Code <ln numlevel="1" lineno="75" slineno="1-46"/>Section <xref depth="3" refnumber="36-11-103" start="0">36-11-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">means the same as that term is defined in <xref depth="3" refnumber="HR5-1-101">HR5-1-101</xref></amend>.</subsection><subsection ssid="1-null-30" dnum="13-o" numlevel="1" lineno="76" slineno="1-47" level="1"><display>(13)</display>"Professional legislative staff" means an individual employed by<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both"> one of the <ln numlevel="1" lineno="77" slineno="1-48"/>Legislature's profession-based staff offices, namely the Office of Legislative Research <ln numlevel="1" lineno="78" slineno="1-49"/>and General Counsel, the Office of the Legislative Fiscal Analyst, the Office of the <ln numlevel="1" lineno="79" slineno="1-50"/>Legislative Auditor General, or the Office of Legislative Services</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-40" dnum="_-o:a-i" numlevel="1" lineno="80" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">the Office of Legislative Research and General Counsel;</amend></subsection><subsection ssid="1-41" dnum="_-o:b-i" numlevel="1" lineno="81" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">the Office of the Legislative Fiscal Analyst;</amend></subsection><subsection ssid="1-42" dnum="_-o:c-i" numlevel="1" lineno="82" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">the Office of the Legislative Auditor General; or</amend></subsection><subsection ssid="1-43" dnum="_-o:d-i" numlevel="1" lineno="83" slineno="1-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">the Office of Legislative Services</amend>.</subsection></subsection><subsection ssid="1-38" dnum="_-o:14-i" numlevel="1" lineno="84" slineno="1-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">"Volunteer lobbyist" means the same as that term is defined in <xref depth="3" refnumber="HR5-1-101">HR5-1-101</xref>.</amend></subsection></section></bsec><bsec buid="2" num="HR2-4-101.2" type="amend" src="rule" uid="HR2-4-S101.2_1800010118000101" sort="H02 04 01010218000101" numlevel="1" lineno="85" slineno="2-1" sn="2"><section number="HR2-4-101.2" numlevel="1" lineno="86" slineno="2-2" type="amend"><secline lineno="85">Section 2. <bold>HR2-4-101.2</bold> is amended to read:</secline><catline lineno="86"><bold>HR2-4-101.2<parens/>. Admittance to House floor -- Prohibition against lobbying.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="87" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Subject to the requirements of this rule, while the House is convened in annual general <ln numlevel="1" lineno="88" slineno="2-4"/>session or special session, only the following individuals are permitted on the House <ln numlevel="1" lineno="89" slineno="2-5"/>floor:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="90" slineno="2-6" level="2"><display>(a)</display>a legislator;</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="91" slineno="2-7" level="2"><display>(b)</display>a member of House or Senate staff;</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="92" slineno="2-8" level="2"><display>(c)</display>a member of professional legislative staff;</subsection><subsection ssid="2-null-5" dnum="d-o" numlevel="1" lineno="93" slineno="2-9" level="2"><display>(d)</display>a House intern;</subsection><subsection ssid="2-null-6" dnum="e-o" numlevel="1" lineno="94" slineno="2-10" level="2"><display>(e)</display>a former legislator who is not:<subsection ssid="2-null-7" dnum="i-o" numlevel="1" lineno="95" slineno="2-11" level="3"><display>(i)</display>a lobbyist; </subsection><subsection ssid="2-26" dnum="_-o:ii-i" numlevel="1" lineno="96" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">a volunteer lobbyist; </amend>or</subsection><subsection ssid="2-null-8" dnum="ii-o:iii-i" numlevel="1" lineno="97" slineno="2-13" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1043" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the governor, lieutenant governor, state attorney general, state treasurer, or <ln numlevel="1" lineno="98" slineno="2-14"/>state auditor;</subsection></subsection><subsection ssid="2-null-9" dnum="f-o" numlevel="1" lineno="99" slineno="2-15" level="2"><display>(f)</display>a guest; and</subsection><subsection ssid="2-null-10" dnum="g-o" numlevel="1" lineno="100" slineno="2-16" level="2"><display>(g)</display>a department head.</subsection></subsection><subsection ssid="2-null-11" dnum="2-o" numlevel="1" lineno="101" slineno="2-17" level="1" space="false"><display>(2)</display><subsection ssid="2-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>While the House is convened in annual general session or special session, a <ln numlevel="1" lineno="102" slineno="2-18"/>representative may invite one guest who is not a lobbyist<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> or volunteer lobbyist</amend> to <ln numlevel="1" lineno="103" slineno="2-19"/>accompany the representative on the House floor, provided that:<subsection ssid="2-null-13" dnum="i-o" numlevel="1" lineno="104" slineno="2-20" level="3" tab="1"><display>(i)</display>the guest sits next to the representative;</subsection><subsection ssid="2-null-14" dnum="ii-o" numlevel="1" lineno="105" slineno="2-21" level="3" tab="1"><display>(ii)</display>the representative ensures that the guest does not impede staff work, distract from <ln numlevel="1" lineno="106" slineno="2-22"/>the work of the House, or encroach on a neighboring representative's desk;</subsection><subsection ssid="2-null-15" dnum="iii-o" numlevel="1" lineno="107" slineno="2-23" level="3" tab="1"><display>(iii)</display>the guest complies with the requirements of this rule, <xref depth="3" refnumber="HR2-4-102" start="0">HR2-4-102</xref>, and <xref depth="3" refnumber="HR2-4-103" start="0">HR2-4-103</xref>; <ln numlevel="1" lineno="108" slineno="2-24"/>and</subsection><subsection ssid="2-null-16" dnum="iv-o" numlevel="1" lineno="109" slineno="2-25" level="3" tab="1"><display>(iv)</display>no representative objects.</subsection></subsection><subsection ssid="2-null-17" dnum="b-o" numlevel="1" lineno="110" slineno="2-26" level="2"><display>(b)</display>A representative may have no more than one guest on the House floor at any one <ln numlevel="1" lineno="111" slineno="2-27"/>time.</subsection><subsection ssid="2-null-18" dnum="c-o" numlevel="1" lineno="112" slineno="2-28" level="2"><display>(c)</display>An individual described in Subsections <xref depth="4" refnumber="HR2-4-101.2(1)(e)" start="0">(1)(e)</xref> through <xref depth="4" refnumber="HR2-4-101.2(1)(g)" start="0">(g)</xref> is prohibited from lobbying <ln numlevel="1" lineno="113" slineno="2-29"/>on the House floor.</subsection></subsection><subsection ssid="2-null-19" dnum="3-o" numlevel="1" lineno="114" slineno="2-30" level="1"><display>(3)</display>While the House is convened in annual general session or special session, a lobbyist <amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">or <ln numlevel="1" lineno="115" slineno="2-31"/>volunteer lobbyist </amend>is not permitted on the House floor.</subsection><subsection ssid="2-null-20" dnum="4-o" numlevel="1" lineno="116" slineno="2-32" level="1"><display>(4)</display>The speaker or the speaker's designee may authorize special guests to be present in the <ln numlevel="1" lineno="117" slineno="2-33"/>House chamber or on the House floor.</subsection><subsection ssid="2-null-21" dnum="5-o" numlevel="1" lineno="118" slineno="2-34" level="1" space="false"><display>(5)</display><subsection ssid="2-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A representative sponsoring a piece of legislation being debated by the House <ln numlevel="1" lineno="119" slineno="2-35"/>may, with the permission of the speaker, invite one department head with expertise <ln numlevel="1" lineno="120" slineno="2-36"/>on the legislation to assist the sponsor during the course of debate.</subsection><subsection ssid="2-null-23" dnum="b-o" numlevel="1" lineno="121" slineno="2-37" level="2"><display>(b)</display>A representative who invites a department head to assist the representative under <ln numlevel="1" lineno="122" slineno="2-38"/>Subsection <xref depth="4" refnumber="HR2-4-101.2(5)(a)" start="0">(5)(a)</xref> shall ensure that the department head:<subsection ssid="2-null-24" dnum="i-o" numlevel="1" lineno="123" slineno="2-39" level="3"><display>(i)</display>does not engage in lobbying while on the House floor; and</subsection><subsection ssid="6-null-15" dnum="d-o" numlevel="1" lineno="166" slineno="4-21" level="2"><display>(d)</display>the office of another representative with the consent of that representative.</subsection></subsection><subsection ssid="6-null-16" dnum="3-o" numlevel="1" lineno="167" slineno="4-22" level="1" space="false"><display>(3)</display><subsection ssid="6-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A representative may invite a small number of lobbyists<amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">, volunteer lobbyists,</amend> or <ln numlevel="1" lineno="168" slineno="4-23"/>guests to meet with the representative in the representative's House office or a House <ln numlevel="1" lineno="169" slineno="4-24"/>conference room to discuss specific legislative issues.</subsection><subsection ssid="6-null-18" dnum="b-o" numlevel="1" lineno="170" slineno="4-25" level="2"><display>(b)</display>The representative shall ensure that the lobbyists<amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both">, volunteer lobbyists,</amend> and guests <ln numlevel="1" lineno="171" slineno="4-26"/>leave the House space when the meeting is over.</subsection></subsection><subsection ssid="6-null-19" dnum="4-o" numlevel="1" lineno="172" slineno="4-27" level="1" space="false"><display>(4)</display><subsection ssid="6-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>While the House is convened as a body on the House floor, and except as <ln numlevel="1" lineno="173" slineno="4-28"/>provided in Subsection <xref depth="4" refnumber="HR2-4-101.4(4)(b)" start="0">(4)(b)</xref>, only the following individuals are allowed in the <ln numlevel="1" lineno="174" slineno="4-29"/>House halls:<subsection ssid="6-null-21" dnum="i-o" numlevel="1" lineno="175" slineno="4-30" level="3" tab="1"><display>(i)</display>a legislator;</subsection><subsection ssid="6-null-22" dnum="ii-o" numlevel="1" lineno="176" slineno="4-31" level="3" tab="1"><display>(ii)</display>a member of House or Senate staff;</subsection><subsection ssid="6-null-23" dnum="iii-o" numlevel="1" lineno="177" slineno="4-32" level="3" tab="1"><display>(iii)</display>a member of professional legislative staff;</subsection><subsection ssid="6-null-24" dnum="iv-o" numlevel="1" lineno="178" slineno="4-33" level="3" tab="1"><display>(iv)</display>a House intern;</subsection><subsection ssid="6-null-25" dnum="v-o" numlevel="1" lineno="179" slineno="4-34" level="3" tab="1"><display>(v)</display>an administrative assistant who is not a House intern; </amend>or</subsection><subsection ssid="6-null-28" dnum="B-o:C-i" numlevel="1" lineno="183" slineno="4-38" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1104" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>the governor, lieutenant governor, state attorney general, state treasurer, <ln numlevel="1" lineno="184" slineno="4-39"/>or state auditor.</subsection></subsection></subsection><subsection ssid="6-null-29" dnum="b-o" numlevel="1" lineno="185" slineno="4-40" level="2"><display>(b)</display>Immediate family of a representative, a lobbyist, <amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">a volunteer lobbyist, </amend>a guest, an <ln numlevel="1" lineno="186" slineno="4-41"/>administrative assistant who is not a House intern, or any other authorized individual <ln numlevel="1" lineno="187" slineno="4-42"/>who is in transit to the House chamber, House lounge, or House offices may pass <ln numlevel="1" lineno="188" slineno="4-43"/>through the House halls when traveling to and from an authorized destination.</subsection></subsection><subsection ssid="6-null-30" dnum="5-o" numlevel="1" lineno="189" slineno="4-44" level="1"><display>(5)</display>An administrative assistant to a representative who is a not a House intern is not <ln numlevel="1" lineno="190" slineno="4-45"/>permitted to use or be issued an access badge that grants access to the House floor, <ln numlevel="1" lineno="191" slineno="4-46"/>House lounge, House offices, House conference rooms, or House hallways.</subsection></section></bsec><bsec buid="10" num="HR5-1-101" type="amend" src="rule" uid="HR5-1-S101_1800010118000101" sort="H05 01 01010018000101" numlevel="1" lineno="192" slineno="5-1" sn="5"><section number="HR5-1-101" numlevel="1" lineno="193" slineno="5-2" type="amend"><secline lineno="192">Section 5. <bold>HR5-1-101</bold> is amended to read:</secline><catline lineno="193"><bold>HR5-1-101<parens/>. and</subsection><subsection ssid="10-null-4" dnum="ii-o" numlevel="1" lineno="198" slineno="5-7" level="3" tab="1"><display>(ii)</display>an individual appointed to or employed in a full-time or part-time position by <ln numlevel="1" lineno="199" slineno="5-8"/>state or local government when acting within the scope of employment or within <ln numlevel="1" lineno="200" slineno="5-9"/>the individual's official capacity.</subsection></subsection><subsection ssid="10-null-5" dnum="b-o" numlevel="1" lineno="201" slineno="5-10" level="2"><display>(b)</display>"Government official" does not <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">mean</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">include</amend> a member of the legislative branch of <ln numlevel="1" lineno="202" slineno="5-11"/>state government.</subsection></subsection><subsection ssid="10-null-6" dnum="2-o" numlevel="1" lineno="203" slineno="5-12" level="1"><display>(2)</display>"Lobbyist" <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">has the meaning identified in Utah Code Subsections <xref depth="4" refnumber="36-11-102(11)(a)" start="0">36-11-102(11)(a)</xref> and <xref depth="4" refnumber="36-11-102(11)(b)" start="0"><ln numlevel="1" lineno="204" slineno="5-13"/>(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">means an individual who is required to register as a lobbyist under Utah Code Title <ln numlevel="1" lineno="205" slineno="5-14"/>36, Chapter 11, Lobbyist Disclosure and Regulation Act</amend>.</subsection><subsection ssid="10-null-7" dnum="3-o" numlevel="1" lineno="206" slineno="5-15" level="1" space="false"><display>(3)</display><subsection ssid="10-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Volunteer lobbyist" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">a person not registered as a lobbyist who engages in <ln numlevel="1" lineno="207" slineno="5-16"/>lobbying within the meaning of Utah Code Subsection <xref depth="4" refnumber="36-11-102(10)" start="0">36-11-102(10)</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an individual <ln numlevel="1" lineno="208" slineno="5-17"/>who:</amend><subsection ssid="10-10" dnum="_-o:i-i" numlevel="1" lineno="209" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">engages in lobbying as defined in <xref depth="3" refnumber="HR2-4-101">HR2-4-101</xref>; Lobbyist code of ethics.</bold></catline><sectionText lineno="217"><tab/>A lobbyist, volunteer lobbyist, or government official may not:</sectionText><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="218" slineno="6-4" level="1"><display>(1)</display>attempt to influence a representative, elected or appointed state official, state employee, <ln numlevel="1" lineno="219" slineno="6-5"/>or legislative employee by means of deceit or by threat of violence or economic or <ln numlevel="1" lineno="220" slineno="6-6"/>political reprisal against any person or property, with intent by doing so to alter or affect <ln numlevel="1" lineno="221" slineno="6-7"/>the representative's, elected or appointed state official's, state employee's, or legislative <ln numlevel="1" lineno="222" slineno="6-8"/>employee's decision, vote, opinion, or action concerning any matter that is to be <ln numlevel="1" lineno="223" slineno="6-9"/>considered or performed by the representative, official, or employee or the agency or <ln numlevel="1" lineno="224" slineno="6-10"/>body of which the representative, official, or employee is a member;</subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="225" slineno="6-11" level="1"><display>(2)</display>knowingly provide false information to a representative, elected or appointed state <ln numlevel="1" lineno="226" slineno="6-12"/>official, state employee, or legislative employee as to any material fact pertaining to any <ln numlevel="1" lineno="227" slineno="6-13"/>legislation;</subsection><subsection ssid="4-null-3" dnum="3-o" numlevel="1" lineno="228" slineno="6-14" level="1"><display>(3)</display>knowingly omit, conceal, or falsify in any manner information required by the lobbyist <ln numlevel="1" lineno="229" slineno="6-15"/>registration and lobbyist disclosure reports;</subsection><subsection ssid="4-null-4" dnum="4-o" numlevel="1" lineno="230" slineno="6-16" level="1"><display>(4)</display>participate in committee assignments or leadership races of the House of <ln numlevel="1" lineno="231" slineno="6-17"/>Representatives;</subsection><subsection ssid="4-null-5" dnum="5-o" numlevel="1" lineno="232" slineno="6-18" level="1"><display>(5)</display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">participate in the prioritization of legislation for floor action or referral to a standing <ln numlevel="1" lineno="233" slineno="6-19"/>committee;</amend></subsection><subsection ssid="4-15" dnum="_-o:6-i" numlevel="1" lineno="234" slineno="6-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="both">(6)</amend></display>cause or influence the introduction of any piece of legislation, substitute, or amendment <ln numlevel="1" lineno="235" slineno="6-21"/>for the purpose of afterwards becoming employed to secure its passage or defeat;</subsection><subsection ssid="4-null-6" dnum="6-o:7-i" numlevel="1" lineno="236" slineno="6-22" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1124" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>misappropriate or misuse legislative office supplies;</subsection><subsection ssid="4-null-7" dnum="7-o:8-i" numlevel="1" lineno="237" slineno="6-23" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" amendtag="both"> identification badge,</amend> or parking space <ln numlevel="1" lineno="240" slineno="6-26"/>without explicit permission;</subsection><subsection ssid="4-null-9" dnum="9-o:10-i" numlevel="1" lineno="241" slineno="6-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1127" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>attempt to remove or remove any document from any representative's or <ln numlevel="1" lineno="242" slineno="6-28"/>legislative employee's office, desk, file cabinet, reproduction machine, facsimile <ln numlevel="1" lineno="243" slineno="6-29"/>machine, or any other place without explicit permission;</subsection><subsection ssid="4-null-10" dnum="10-o:11-i" numlevel="1" lineno="244" slineno="6-30" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1128" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>engage in discriminatory conduct, as defined in Legislative Management <ln numlevel="1" lineno="245" slineno="6-31"/>Committee Policy E -- Legislative Workplace Discrimination Prevention, toward a <ln numlevel="1" lineno="246" slineno="6-32"/>representative or legislative employee;</subsection><subsection ssid="4-null-11" dnum="11-o:12-i" numlevel="1" lineno="247" slineno="6-33" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1129" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1130" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>offer employment to a representative or legislative employee that impairs the <ln numlevel="1" lineno="248" slineno="6-34"/>representative's or legislative employee's independence of judgement as to their official <ln numlevel="1" lineno="249" slineno="6-35"/>duties;</subsection><subsection ssid="4-null-12" dnum="12-o:13-i" numlevel="1" lineno="250" slineno="6-36" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1130" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>offer employment that would require or induce a representative or legislative <ln numlevel="1" lineno="251" slineno="6-37"/>employee to disclose records classified as private, protected, or controlled;</subsection><subsection ssid="4-null-13" dnum="13-o:14-i" numlevel="1" lineno="252" slineno="6-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1131" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>use or disclose for personal financial gain any records classified as private, <ln numlevel="1" lineno="253" slineno="6-39"/>protected, or controlled that were obtained from a representative or legislative employee <ln numlevel="1" lineno="254" slineno="6-40"/>or conspire with any person for that purpose; or</subsection><subsection ssid="4-null-14" dnum="14-o:15-i" numlevel="1" lineno="255" slineno="6-41" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1132" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>induce or seek to induce a representative or legislative employee to commit a <ln numlevel="1" lineno="256" slineno="6-42"/>violation of any provision of this House rule.</subsection></section></bsec><bsec buid="9" type="uncod"
