Authority of the state board -- Rulemaking -- Superintendent -- <ln numlevel="1" lineno="38" slineno="1-3"/>Advisory council.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="39" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="22-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board is the governing board of the Utah Schools for the Deaf and the <ln numlevel="1" lineno="40" slineno="1-5"/>Blind.</subsection><subsection ssid="22-null-3" dnum="b-o" numlevel="1" lineno="41" slineno="1-6" level="2"><display>(b)</display>The state board shall, as the state board determines necessary, establish committees, <ln numlevel="1" lineno="42" slineno="1-7"/>policies, or processes necessary to the function and oversight of the Utah Schools for <ln numlevel="1" lineno="43" slineno="1-8"/>the Deaf and the Blind.</subsection></subsection><subsection ssid="22-null-4" dnum="2-o" numlevel="1" lineno="44" slineno="1-9" level="1" space="false"><display>(2)</display><subsection ssid="22-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall appoint a superintendent for the Utah Schools for the Deaf <ln numlevel="1" lineno="45" slineno="1-10"/>and the Blind.</subsection><subsection ssid="22-null-6" dnum="b-o" numlevel="1" lineno="46" slineno="1-11" level="2"><display>(b)</display>The state board shall make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="47" slineno="1-12"/>Administrative Rulemaking Act</xref>, regarding the qualifications, terms of employment, <ln numlevel="1" lineno="48" slineno="1-13"/>and duties of the superintendent for the Utah Schools for the Deaf and the Blind.</subsection><subsection ssid="22-23" dnum="_-o:c-i" numlevel="1" lineno="49" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="22-24" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">The state board may appoint the state superintendent as the superintendent for <ln numlevel="1" lineno="50" slineno="1-15"/>the Utah Schools for the Deaf and the Blind under Subsection <xref depth="4" refnumber="53E-8-204(2)(a)">(2)(a)</xref>.</amend></subsection><subsection ssid="22-25" dnum="_-o:ii-i" numlevel="1" lineno="51" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">If the state board appoints the state superintendent as the superintendent under <ln numlevel="1" lineno="52" slineno="1-17"/>Subsection <xref depth="4" refnumber="53E-8-204(2)(c)(i)">(2)(c)(i)</xref>, the state superintendent may delegate duties regarding the <ln numlevel="1" lineno="53" slineno="1-18"/>role of superintendent for the Utah Schools for the Deaf and the Blind to another <ln numlevel="1" lineno="54" slineno="1-19"/>employee of the state board.</amend></subsection></subsection></subsection><subsection ssid="22-null-7" dnum="3-o" numlevel="1" lineno="55" slineno="1-20" level="1"><display>(3)</display>The superintendent shall:<subsection ssid="22-null-8" dnum="a-o" numlevel="1" lineno="56" slineno="1-21" level="2"><display>(a)</display>subject to the approval of the state board, appoint an associate superintendent to <ln numlevel="1" lineno="57" slineno="1-22"/>administer the Utah School for the Deaf based on:<subsection ssid="22-null-9" dnum="i-o" numlevel="1" lineno="58" slineno="1-23" level="3"><display>(i)</display>demonstrated competency as an expert educator of deaf persons; and</subsection><subsection ssid="22-null-10" dnum="ii-o" numlevel="1" lineno="59" slineno="1-24" level="3"><display>(ii)</display>knowledge of school management and the instruction of deaf persons; and</subsection></subsection><subsection ssid="22-null-11" dnum="b-o" numlevel="1" lineno="60" slineno="1-25" level="2"><display>(b)</display>subject to the approval of the state board, appoint an associate superintendent to <ln numlevel="1" lineno="61" slineno="1-26"/>administer the Utah School for the Blind based on:<subsection ssid="22-null-12" dnum="i-o" numlevel="1" lineno="62" slineno="1-27" level="3"><display>(i)</display>demonstrated competency as an expert educator of blind persons; and</subsection><subsection ssid="22-null-13" dnum="ii-o" numlevel="1" lineno="63" slineno="1-28" level="3"><display>(ii)</display>knowledge of school management and the instruction of blind persons, including <ln numlevel="1" lineno="64" slineno="1-29"/>an understanding of the unique needs and education of deafblind persons.</subsection></subsection></subsection><subsection ssid="22-null-14" dnum="4-o" numlevel="1" lineno="65" slineno="1-30" level="1"><display>(4)</display>The state board shall:<subsection ssid="22-null-15" dnum="a-o" numlevel="1" lineno="66" slineno="1-31" level="2"><display>(a)</display>approve the annual budget and expenditures of the Utah Schools for the Deaf and the <ln numlevel="1" lineno="67" slineno="1-32"/>Blind; and</subsection><subsection ssid="22-null-16" dnum="b-o" numlevel="1" lineno="68" slineno="1-33" level="2"><display>(b)</display>administer the financial operations of the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="22-null-17" dnum="5-o" numlevel="1" lineno="69" slineno="1-34" level="1" space="false"><display>(5)</display><subsection ssid="22-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall submit a report in accordance with Section <xref depth="3" refnumber="53E-1-201" start="0">53E-1-201</xref> on the <ln numlevel="1" lineno="70" slineno="1-35"/>Utah Schools for the Deaf and the Blind.</subsection><subsection ssid="22-null-19" dnum="b-o" numlevel="1" lineno="71" slineno="1-36" level="2"><display>(b)</display>The state board shall ensure that the report described in Subsection <xref depth="4" refnumber="53E-8-204(5)(a)" start="0">(5)(a)</xref> includes:<subsection ssid="22-null-20" dnum="i-o" numlevel="1" lineno="72" slineno="1-37" level="3"><display>(i)</display>a financial report;</subsection><subsection ssid="22-null-21" dnum="ii-o" numlevel="1" lineno="73" slineno="1-38" level="3"><display>(ii)</display>a report on Utah Schools for the Deaf and the Blind programs and activities; and</subsection><subsection ssid="22-null-22" dnum="iii-o" numlevel="1" lineno="74" slineno="1-39" level="3"><display>(iii)</display>a report of student academic performance.</subsection></subsection></subsection></section></bsec><bsec buid="3" num="53G-8-213" type="amend" src="code" uid="C53G-8-S213_2026050620260506" sort="53G08 02130020260506" numlevel="1" lineno="75" slineno="2-1" sn="2"><section number="53G-8-213" numlevel="1" lineno="76" slineno="2-2" type="amend"><secline lineno="75">Section 2, Section <bold>53G-8-213</bold> is amended to read:</secline><catline lineno="76"><bold>53G-8-213. Reintegration plan for student alleged to have committed violent <ln numlevel="1" lineno="77" slineno="2-3"/>felony or weapon offense.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="78" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>As used in this section,"multidisciplinary team" means: <subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="79" slineno="2-5" level="2"><display>(a)</display>the local education agency; </subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="80" slineno="2-6" level="2"><display>(b)</display>the juvenile court; </subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="81" slineno="2-7" level="2"><display>(c)</display>the Division of Juvenile Justice and Youth Services; </subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="82" slineno="2-8" level="2"><display>(d)</display>a school safety and security specialist designated under Section <xref depth="3" refnumber="53G-8-701.6">53G-8-701.6</xref>;</subsection><subsection ssid="3-null-6" dnum="e-o" numlevel="1" lineno="83" slineno="2-9" level="2"><display>(e)</display>school safety and security director designated under Section <xref depth="3" refnumber="53G-8-701.8">53G-8-701.8</xref>;</subsection><subsection ssid="3-null-7" dnum="f-o" numlevel="1" lineno="84" slineno="2-10" level="2"><display>(f)</display>a school resource officer if applicable; and </subsection><subsection ssid="3-null-8" dnum="g-o" numlevel="1" lineno="85" slineno="2-11" level="2"><display>(g)</display>any other relevant party that should be involved in a reintegration plan.</subsection></subsection><subsection ssid="3-null-9" dnum="2-o" numlevel="1" lineno="86" slineno="2-12" level="1"><display>(2)</display>If a school district receives a notification from the juvenile court or a law enforcement <ln numlevel="1" lineno="87" slineno="2-13"/>agency that a student was arrested for, charged with, or adjudicated in the juvenile court <ln numlevel="1" lineno="88" slineno="2-14"/>for a serious offense, the school shall develop a reintegration plan for the student with a <ln numlevel="1" lineno="89" slineno="2-15"/>multidisciplinary team, the student, and the student's parent or guardian, within five <ln numlevel="1" lineno="90" slineno="2-16"/>school days after the day on which the school receives a notification.</subsection><subsection ssid="3-null-10" dnum="3-o" numlevel="1" lineno="91" slineno="2-17" level="1"><display>(3)</display>The school may deny admission to the student until the school completes the <ln numlevel="1" lineno="92" slineno="2-18"/>reintegration plan under Subsection <xref depth="4" refnumber="53G-8-213(2)">(2)</xref>.</subsection><subsection ssid="3-null-11" dnum="4-o" numlevel="1" lineno="93" slineno="2-19" level="1"><display>(4)</display>The reintegration plan under Subsection <xref depth="4" refnumber="53G-8-213(2)">(2)</xref> shall address:<subsection ssid="3-null-12" dnum="a-o" numlevel="1" lineno="94" slineno="2-20" level="2"><display>(a)</display>a behavioral intervention for the student;</subsection><subsection ssid="3-null-13" dnum="b-o" numlevel="1" lineno="95" slineno="2-21" level="2"><display>(b)</display>a short-term mental health or counseling service for the student;</subsection><subsection ssid="3-null-14" dnum="c-o" numlevel="1" lineno="96" slineno="2-22" level="2"><display>(c)</display>an academic intervention for the student; and</subsection><subsection ssid="3-null-15" dnum="d-o" numlevel="1" lineno="97" slineno="2-23" level="2"><display>(d)</display>if the serious offense was directed at a school employee or another student within the <ln numlevel="1" lineno="98" slineno="2-24"/>school, notification of the reintegration plan to that school employee or student and <ln numlevel="1" lineno="99" slineno="2-25"/>the student's parent.</subsection></subsection><subsection ssid="3-null-16" dnum="5-o" numlevel="1" lineno="100" slineno="2-26" level="1"><display>(5)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">A school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An LEA</amend> may not reintegrate a student into a school where:<subsection ssid="3-null-17" dnum="a-o" numlevel="1" lineno="101" slineno="2-27" level="2"><display>(a)</display>a student or staff member has a protective order against the student being <ln numlevel="1" lineno="102" slineno="2-28"/>reintegrated; or</subsection><subsection ssid="3-null-18" dnum="b-o" numlevel="1" lineno="103" slineno="2-29" level="2"><display>(b)</display>a student or staff member is the victim of a sexual crime or forcible felony <ln numlevel="1" lineno="104" slineno="2-30"/>committed by the student being reintegrated.</subsection></subsection><subsection ssid="3-null-19" dnum="6-o" numlevel="1" lineno="105" slineno="2-31" level="1" space="false"><display>(6)</display><subsection ssid="3-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref refnumber="53G-8-213(2)" depth="4">(2)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">a school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an LEA</amend> may elect to not <ln numlevel="1" lineno="106" slineno="2-32"/>integrate a student into a school if the student has committed, or allegedly committed, <ln numlevel="1" lineno="107" slineno="2-33"/>a forcible felony.</subsection><subsection ssid="3-null-21" dnum="b-o" numlevel="1" lineno="108" slineno="2-34" level="2"><display>(b)</display>If <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">a school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an LEA</amend> elects to not integrate a student under Subsection <xref refnumber="53G-8-213(6)(a)" depth="4">(6)(a)</xref>, <ln numlevel="1" lineno="109" slineno="2-35"/>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">LEA</amend> shall provide alternative education options for the student.</subsection></subsection><subsection ssid="3-null-22" dnum="7-o" numlevel="1" lineno="110" slineno="2-36" level="1"><display>(7)</display>A reintegration plan under this section is classified as a protected record under Section <xref depth="3" refnumber="63G-2-305"><ln numlevel="1" lineno="111" slineno="2-37"/>63G-2-305</xref>.</subsection><subsection ssid="3-null-23" dnum="8-o" numlevel="1" lineno="112" slineno="2-38" level="1"><display>(8)</display>All other records of disclosures under this section are governed by Title 63G, Chapter 2, <ln numlevel="1" lineno="113" slineno="2-39"/>Government Records Access and Management Act, and the Family Educational Rights <ln numlevel="1" lineno="114" slineno="2-40"/>and Privacy Act, 20 U.S.C. School safety needs assessment -- School safety personnel -- <ln numlevel="1" lineno="117" slineno="3-3"/>Alternative requirements.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="118" slineno="3-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="9-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Subsections <xref depth="4" refnumber="53G-8-701.5(1)(c)">(1)(c)</xref> through <xref depth="4" refnumber="53G-8-701.5(e)">(e)</xref>, no later than October 15 of an <ln numlevel="1" lineno="119" slineno="3-5"/>applicable year, an LEA shall:<subsection ssid="9-null-3" dnum="i-o" numlevel="1" lineno="120" slineno="3-6" level="3" tab="1"><display>(i)</display>ensure a school safety needs assessment the state security chief selects in <ln numlevel="1" lineno="121" slineno="3-7"/>collaboration with the school safety center is conducted in accordance with <ln numlevel="1" lineno="122" slineno="3-8"/>Subsection <xref depth="4" refnumber="53G-8-701.5(1)(b)">(1)(b)</xref> for each school or K-12 campus within the LEA to determine <ln numlevel="1" lineno="123" slineno="3-9"/>the needs and deficiencies regarding:<subsection ssid="9-null-4" dnum="A-o" numlevel="1" lineno="124" slineno="3-10" level="4"><display>(A)</display>appropriate school safety personnel, including necessary supports, training, <ln numlevel="1" lineno="125" slineno="3-11"/>and policy creation for the personnel;</subsection><subsection ssid="9-null-5" dnum="B-o" numlevel="1" lineno="126" slineno="3-12" level="4"><display>(B)</display>physical building security and safety, including required upgrades to facilities <ln numlevel="1" lineno="127" slineno="3-13"/>and safety technology;</subsection><subsection ssid="9-null-6" dnum="C-o" numlevel="1" lineno="128" slineno="3-14" level="4"><display>(C)</display>a school's current threat and emergency response protocols, including any <ln numlevel="1" lineno="129" slineno="3-15"/>emergency response agreements with local law enforcement; </subsection><subsection ssid="9-null-7" dnum="D-o" numlevel="1" lineno="130" slineno="3-16" level="4"><display>(D)</display>cardiac emergency preparedness, including an inventory of whether <ln numlevel="1" lineno="131" slineno="3-17"/>automated external defibrillators are present and accessible, maintenance <ln numlevel="1" lineno="132" slineno="3-18"/>status, and current staff training offerings; and</subsection><subsection ssid="9-null-8" dnum="E-o" numlevel="1" lineno="133" slineno="3-19" level="4"><display>(E)</display>compliance with universal access key box requirements under Section <xref depth="3" refnumber="53G-8-805"><ln numlevel="1" lineno="134" slineno="3-20"/>53G-8-805</xref>; and</subsection></subsection><subsection ssid="9-null-9" dnum="ii-o" numlevel="1" lineno="135" slineno="3-21" level="3" tab="1"><display>(ii)</display>report the results of the school safety needs assessment for each school within the <ln numlevel="1" lineno="136" slineno="3-22"/>LEA to the state security chief and the School Safety Center.</subsection></subsection><subsection ssid="9-null-10" dnum="b-o" numlevel="1" lineno="137" slineno="3-23" level="2" space="false"><display>(b)</display><subsection ssid="9-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The school safety specialist described in Section <xref depth="3" refnumber="53G-8-701.6">53G-8-701.6</xref>, in collaboration <ln numlevel="1" lineno="138" slineno="3-24"/>with the county security chief<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"> or, regarding the Utah Schools for the Deaf and the <ln numlevel="1" lineno="139" slineno="3-25"/>Blind, the state security chief</amend>, and with the local law enforcement of relevant <ln numlevel="1" lineno="140" slineno="3-26"/>jurisdiction over the school as described in Section <xref depth="3" refnumber="53-25-701">53-25-701</xref>, shall conduct the <ln numlevel="1" lineno="141" slineno="3-27"/>school safety needs assessment for each school.</subsection><subsection ssid="9-null-12" dnum="ii-o" numlevel="1" lineno="142" slineno="3-28" level="3"><display>(ii)</display>A school safety and security director may fulfill the role of a school safety and <ln numlevel="1" lineno="143" slineno="3-29"/>security specialist in conducting the school safety needs assessment.</subsection></subsection><subsection ssid="9-null-13" dnum="c-o" numlevel="1" lineno="144" slineno="3-30" level="2"><display>(c)</display>The school safety needs assessment required under Subsection <xref depth="4" refnumber="53G-8-701.5(1)(a)(i)">(1)(a)(i)</xref> shall be <ln numlevel="1" lineno="145" slineno="3-31"/>conducted at least once every three years for each school or K-12 campus.</subsection><subsection ssid="9-null-14" dnum="d-o" numlevel="1" lineno="146" slineno="3-32" level="2"><display>(d)</display>An LEA may implement a rotating or staggered schedule for conducting school <ln numlevel="1" lineno="147" slineno="3-33"/>safety needs assessments among the buildings within the LEA, provided that:<subsection ssid="9-null-15" dnum="i-o" numlevel="1" lineno="148" slineno="3-34" level="3"><display>(i)</display> each school within a K-12 campus is assessed at least once every three years; and</subsection><subsection ssid="9-null-16" dnum="ii-o" numlevel="1" lineno="149" slineno="3-35" level="3"><display>(ii)</display>the LEA documents the rotating or staggered assessment schedule and shares this <ln numlevel="1" lineno="150" slineno="3-36"/>schedule with the state security chief, the School Safety Center, the county <ln numlevel="1" lineno="151" slineno="3-37"/>security chief<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> regarding a school other than the Utah Schools for the Deaf and the <ln numlevel="1" lineno="152" slineno="3-38"/>Blind</amend>, and the local law enforcement of relevant jurisdiction as described in <ln numlevel="1" lineno="153" slineno="3-39"/>Section <xref depth="3" refnumber="53-25-701">53-25-701</xref>.</subsection></subsection><subsection ssid="9-null-17" dnum="e-o" numlevel="1" lineno="154" slineno="3-40" level="2"><display>(e)</display>The LEA shall update the assessment schedule as necessary to ensure compliance <ln numlevel="1" lineno="155" slineno="3-41"/>with the three-year assessment requirement under Subsection <xref depth="4" refnumber="53G-8-701.5(1)(c)">(1)(c)</xref>.</subsection><subsection ssid="9-null-18" dnum="f-o" numlevel="1" lineno="156" slineno="3-42" level="2"><display>(f)</display>The state board shall use the results of the school safety needs assessment for each <ln numlevel="1" lineno="157" slineno="3-43"/>school within an LEA to award a grant to an LEA in accordance with Section <xref depth="3" refnumber="53F-5-220"><ln numlevel="1" lineno="158" slineno="3-44"/>53F-5-220</xref>.</subsection><subsection ssid="9-null-19" dnum="g-o" numlevel="1" lineno="159" slineno="3-45" level="2"><display>(g)</display>Any information or record detailing a school's needs assessment results is:<subsection ssid="9-null-20" dnum="i-o" numlevel="1" lineno="160" slineno="3-46" level="3"><display>(i)</display>a private, controlled, or protected record under Title 63G, Chapter 2, Government <ln numlevel="1" lineno="161" slineno="3-47"/>Records Access and Management Act; and</subsection><subsection ssid="9-null-21" dnum="ii-o" numlevel="1" lineno="162" slineno="3-48" level="3"><display>(ii)</display>available only to:<subsection ssid="9-null-22" dnum="A-o" numlevel="1" lineno="163" slineno="3-49" level="4"><display>(A)</display>the state security chief;</subsection><subsection ssid="9-null-23" dnum="B-o" numlevel="1" lineno="164" slineno="3-50" level="4"><display>(B)</display>the School Safety Center;</subsection><subsection ssid="9-null-24" dnum="C-o" numlevel="1" lineno="165" slineno="3-51" level="4"><display>(C)</display>members of an LEA governing board;</subsection><subsection ssid="9-null-25" dnum="D-o" numlevel="1" lineno="166" slineno="3-52" level="4"><display>(D)</display>administrators of the LEA and school the needs assessment concerns;</subsection><subsection ssid="9-null-26" dnum="E-o" numlevel="1" lineno="167" slineno="3-53" level="4"><display>(E)</display>only to the extent necessary to award a grant under Section <xref depth="3" refnumber="53F-5-220">53F-5-220</xref>, the <ln numlevel="1" lineno="168" slineno="3-54"/>state board;</subsection><subsection ssid="9-null-27" dnum="F-o" numlevel="1" lineno="169" slineno="3-55" level="4"><display>(F)</display>the applicable school safety personnel described in Subsection <xref depth="4" refnumber="53G-8-701.5(2)">(2)</xref>;</subsection><subsection ssid="9-null-28" dnum="G-o" numlevel="1" lineno="170" slineno="3-56" level="4"><display>(G)</display>a local law enforcement agency that would respond to the school in case of an <ln numlevel="1" lineno="171" slineno="3-57"/>emergency; and</subsection><subsection ssid="9-null-29" dnum="H-o" numlevel="1" lineno="172" slineno="3-58" level="4"><display>(H)</display>the county security chief<amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> regarding a school other than the Utah Schools for <ln numlevel="1" lineno="173" slineno="3-59"/>the Deaf and the Blind</amend>.</subsection></subsection></subsection><subsection ssid="9-null-30" dnum="h-o" numlevel="1" lineno="174" slineno="3-60" level="2"><display>(h)</display>An individual who intentionally or knowingly provides the information described in <ln numlevel="1" lineno="175" slineno="3-61"/>Subsection <xref depth="4" refnumber="53G-8-701.5(1)(g)">(1)(g)</xref> to an individual or entity not listed in Subsection <xref depth="4" refnumber="53G-8-701.5(1)(g)(ii)">(1)(g)(ii)</xref> is guilty <ln numlevel="1" lineno="176" slineno="3-62"/>of a class B misdemeanor.</subsection></subsection><subsection ssid="9-null-31" dnum="2-o" numlevel="1" lineno="177" slineno="3-63" level="1" space="false"><display>(2)</display><subsection ssid="9-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA shall ensure each school within the LEA has the following school safety <ln numlevel="1" lineno="178" slineno="3-64"/>personnel:<subsection ssid="9-null-33" dnum="i-o" numlevel="1" lineno="179" slineno="3-65" level="3" tab="1"><display>(i)</display>a school safety and security specialist described in Section <xref depth="3" refnumber="53G-8-701.6">53G-8-701.6</xref>; and</subsection><subsection ssid="9-null-34" dnum="ii-o" numlevel="1" lineno="180" slineno="3-66" level="3" tab="1"><display>(ii)</display>based on the results of the needs assessment described in Subsection <xref depth="4" refnumber="53G-8-701.5(1)">(1)</xref>, at least <ln numlevel="1" lineno="181" slineno="3-67"/>one of the following:<subsection ssid="9-null-35" dnum="A-o" numlevel="1" lineno="182" slineno="3-68" level="4"><display>(A)</display>a school resource officer;</subsection><subsection ssid="9-null-36" dnum="B-o" numlevel="1" lineno="183" slineno="3-69" level="4"><display>(B)</display>a school guardian; or</subsection><subsection ssid="9-null-37" dnum="C-o" numlevel="1" lineno="184" slineno="3-70" level="4"><display>(C)</display>an armed school security guard.</subsection></subsection></subsection><subsection ssid="9-null-38" dnum="b-o" numlevel="1" lineno="185" slineno="3-71" level="2"><display>(b)</display>In addition to the school safety personnel described in Subsection <xref depth="4" refnumber="53G-8-701.5(2)(a)">(2)(a)</xref>, an LEA <ln numlevel="1" lineno="186" slineno="3-72"/>shall designate a school safety and security director described in Section <xref depth="3" refnumber="53G-8-701.8">53G-8-701.8</xref>.</subsection><subsection ssid="9-null-39" dnum="c-o" numlevel="1" lineno="187" slineno="3-73" level="2"><display>(c)</display>The same individual may serve in more than one of the roles listed in Subsections <xref depth="4" refnumber="53G-8-701.5(2)(a)"><ln numlevel="1" lineno="188" slineno="3-74"/>(2)(a)</xref> and <xref depth="4" refnumber="53G-8-701.5(b)">(b)</xref> if the school notifies the School Safety Center and the state security <ln numlevel="1" lineno="189" slineno="3-75"/>chief of the decision to have the same individual serve in multiple roles as described <ln numlevel="1" lineno="190" slineno="3-76"/>in this Subsection <xref refnumber="53G-8-701.5(2)" depth="4">(2)</xref>.</subsection><subsection ssid="9-null-40" dnum="d-o" numlevel="1" lineno="191" slineno="3-77" level="2"><display>(d)</display>An LEA may implement the requirements of Subsection <xref depth="4" refnumber="53G-8-701.5(2)(a)(ii)">(2)(a)(ii)</xref> before the LEA <ln numlevel="1" lineno="192" slineno="3-78"/>has completed the school safety needs assessment described in Subsection <xref depth="4" refnumber="53G-8-701.5(1)">(1)</xref>.</subsection><subsection ssid="9-null-41" dnum="e-o" numlevel="1" lineno="193" slineno="3-79" level="2"><display>(e)</display>The state security chief in consultation with the School Safety Center shall establish <ln numlevel="1" lineno="194" slineno="3-80"/>a timeline for an LEA to comply with the school safety personnel requirements of <ln numlevel="1" lineno="195" slineno="3-81"/>this Subsection <xref depth="4" refnumber="53G-8-701.5(2)">(2)</xref>.</subsection></subsection><subsection ssid="9-null-42" dnum="3-o" numlevel="1" lineno="196" slineno="3-82" level="1" space="false"><display>(3)</display><subsection ssid="9-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA, school administrator, or private school may apply to the state security <ln numlevel="1" lineno="197" slineno="3-83"/>chief for an approved alternative to the requirements described in:<subsection ssid="9-null-44" dnum="i-o" numlevel="1" lineno="198" slineno="3-84" level="3" tab="1"><display>(i)</display>Section <xref depth="3" refnumber="53-22-105">53-22-105</xref>;</subsection><subsection ssid="9-null-45" dnum="ii-o" numlevel="1" lineno="199" slineno="3-85" level="3" tab="1"><display>(ii)</display>this section;</subsection><subsection ssid="9-null-46" dnum="iii-o" numlevel="1" lineno="200" slineno="3-86" level="3" tab="1"><display>(iii)</display>Section <xref depth="3" refnumber="53G-8-701.6">53G-8-701.6</xref>;</subsection><subsection ssid="9-null-47" dnum="iv-o" numlevel="1" lineno="201" slineno="3-87" level="3" tab="1"><display>(iv)</display>Section <xref depth="3" refnumber="53G-8-701.8">53G-8-701.8</xref>; and</subsection><subsection ssid="9-null-48" dnum="v-o" numlevel="1" lineno="202" slineno="3-88" level="3" tab="1"><display>(v)</display>Section <xref depth="3" refnumber="53G-8-704">53G-8-704</xref>.</subsection></subsection><subsection ssid="9-null-49" dnum="b-o" numlevel="1" lineno="203" slineno="3-89" level="2"><display>(b)</display>In approving or denying an application described in Subsection <xref depth="4" refnumber="53G-8-701.5(3)(a)">(3)(a)</xref>, the state <ln numlevel="1" lineno="204" slineno="3-90"/>security chief may consider factors that impact a school or LEA's ability to adhere to <ln numlevel="1" lineno="205" slineno="3-91"/>the requirements of this section, including the school or LEA's:<subsection ssid="9-null-50" dnum="i-o" numlevel="1" lineno="206" slineno="3-92" level="3"><display>(i)</display>population size;</subsection><subsection ssid="9-null-51" dnum="ii-o" numlevel="1" lineno="207" slineno="3-93" level="3"><display>(ii)</display>staffing needs or capacity;</subsection><subsection ssid="9-null-52" dnum="iii-o" numlevel="1" lineno="208" slineno="3-94" level="3"><display>(iii)</display>geographic location;</subsection><subsection ssid="9-null-53" dnum="iv-o" numlevel="1" lineno="209" slineno="3-95" level="3"><display>(iv)</display>available funding; or</subsection><subsection ssid="9-null-54" dnum="v-o" numlevel="1" lineno="210" slineno="3-96" level="3"><display>(v)</display>general demonstration of need for an alternative to the requirements of this <ln numlevel="1" lineno="211" slineno="3-97"/>section.</subsection></subsection></subsection><subsection ssid="9-null-55" dnum="4-o" numlevel="1" lineno="212" slineno="3-98" level="1"><display>(4)</display>A private school shall identify an individual at the private school to serve as the safety <ln numlevel="1" lineno="213" slineno="3-99"/>liaison with the local law enforcement of relevant jurisdiction and the state security chief.</subsection></section></bsec><bsec buid="10" num="53G-8-701.6" type="amend" src="code" uid="C53G-8-S701.6_2026050620260506" sort="53G08 07010620260506" numlevel="1" lineno="214" slineno="4-1" sn="4"><section number="53G-8-701.6" numlevel="1" lineno="215" slineno="4-2" type="amend"><secline lineno="214">Section 4, Section <bold>53G-8-701.6</bold> is amended to read:</secline><catline lineno="215"><bold>53G-8-701.6. School safety and security specialist.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="216" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "principal" means the chief administrator at a public school, <ln numlevel="1" lineno="217" slineno="4-4"/>including:<subsection ssid="10-null-2" dnum="a-o" numlevel="1" lineno="218" slineno="4-5" level="2"><display>(a)</display>a school principal;</subsection><subsection ssid="10-null-3" dnum="b-o" numlevel="1" lineno="219" slineno="4-6" level="2"><display>(b)</display>a charter school director; or</subsection><subsection ssid="10-null-4" dnum="c-o" numlevel="1" lineno="220" slineno="4-7" level="2"><display>(c)</display>the superintendent of the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="10-null-5" dnum="2-o" numlevel="1" lineno="221" slineno="4-8" level="1" space="false"><display>(2)</display><subsection ssid="10-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="53G-8-701.6(2)(b)">(2)(b)</xref> and except as provided in Subsection <xref depth="4" refnumber="53G-8-701.5(3)">53G-8-701.5(3)</xref>, <ln numlevel="1" lineno="222" slineno="4-9"/>every campus within an LEA shall designate a school safety and security specialist <ln numlevel="1" lineno="223" slineno="4-10"/>from the employees of the relevant campus.</subsection><subsection ssid="10-null-7" dnum="b-o" numlevel="1" lineno="224" slineno="4-11" level="2"><display>(b)</display>The school safety and security specialist:<subsection ssid="10-null-8" dnum="i-o" numlevel="1" lineno="225" slineno="4-12" level="3"><display>(i)</display>may not be a principal; and</subsection><subsection ssid="10-null-9" dnum="ii-o" numlevel="1" lineno="226" slineno="4-13" level="3"><display>(ii)</display>may be the school safety and security director at one campus within the LEA.</subsection></subsection></subsection><subsection ssid="10-null-10" dnum="3-o" numlevel="1" lineno="227" slineno="4-14" level="1"><display>(3)</display>The school safety and security specialist shall:<subsection ssid="10-null-11" dnum="a-o" numlevel="1" lineno="228" slineno="4-15" level="2"><display>(a)</display>report directly to the principal;</subsection><subsection ssid="10-null-12" dnum="b-o" numlevel="1" lineno="229" slineno="4-16" level="2"><display>(b)</display>oversee school safety and security practices to ensure a safe and secure school <ln numlevel="1" lineno="230" slineno="4-17"/>environment for students and staff;</subsection><subsection ssid="10-null-13" dnum="c-o" numlevel="1" lineno="231" slineno="4-18" level="2"><display>(c)</display>ensure adherence with all policies, procedures, protocols, rules, and regulations <ln numlevel="1" lineno="232" slineno="4-19"/>relating to school safety and security through collaborating and maintaining effective <ln numlevel="1" lineno="233" slineno="4-20"/>communications with the following as applicable:<subsection ssid="10-null-14" dnum="i-o" numlevel="1" lineno="234" slineno="4-21" level="3"><display>(i)</display>the principal;</subsection><subsection ssid="10-null-15" dnum="ii-o" numlevel="1" lineno="235" slineno="4-22" level="3"><display>(ii)</display>school staff;</subsection><subsection ssid="10-null-16" dnum="iii-o" numlevel="1" lineno="236" slineno="4-23" level="3"><display>(iii)</display>the school resource officer;</subsection><subsection ssid="10-null-17" dnum="iv-o" numlevel="1" lineno="237" slineno="4-24" level="3"><display>(iv)</display>the armed school security guard;</subsection><subsection ssid="10-null-18" dnum="v-o" numlevel="1" lineno="238" slineno="4-25" level="3"><display>(v)</display>the school guardian;</subsection><subsection ssid="10-null-19" dnum="vi-o" numlevel="1" lineno="239" slineno="4-26" level="3"><display>(vi)</display>local law enforcement;</subsection><subsection ssid="10-null-20" dnum="vii-o" numlevel="1" lineno="240" slineno="4-27" level="3"><display>(vii)</display>the county security chief<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> regarding a school other than the Utah Schools for the <ln numlevel="1" lineno="241" slineno="4-28"/>Deaf and the Blind</amend>;</subsection><subsection ssid="10-null-21" dnum="viii-o" numlevel="1" lineno="242" slineno="4-29" level="3"><display>(viii)</display>the school safety and security director;</subsection><subsection ssid="10-null-22" dnum="ix-o" numlevel="1" lineno="243" slineno="4-30" level="3"><display>(ix)</display>the LEA; and</subsection><subsection ssid="10-null-23" dnum="x-o" numlevel="1" lineno="244" slineno="4-31" level="3"><display>(x)</display>school-based behavioral and mental health professionals;</subsection></subsection><subsection ssid="10-null-24" dnum="d-o" numlevel="1" lineno="245" slineno="4-32" level="2"><display>(d)</display>in collaboration with the county security chief <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">or, regarding the Utah Schools for the <ln numlevel="1" lineno="246" slineno="4-33"/>Deaf and the Blind, the state security chief, </amend>and with the local law enforcement of <ln numlevel="1" lineno="247" slineno="4-34"/>relevant jurisdiction over the school as described in Section <xref depth="3" refnumber="53-25-701">53-25-701</xref>:<subsection ssid="10-null-25" dnum="i-o" numlevel="1" lineno="248" slineno="4-35" level="3"><display>(i)</display>conduct the school safety needs assessment described in Section <xref depth="3" refnumber="53G-8-701.5">53G-8-701.5</xref>; </subsection><subsection ssid="10-null-26" dnum="ii-o" numlevel="1" lineno="249" slineno="4-36" level="3"><display>(ii)</display>in accordance with Sections <xref depth="3" refnumber="53-25-701">53-25-701</xref> and <xref depth="3" refnumber="53G-8-701.5">53G-8-701.5</xref>, submit the completed <ln numlevel="1" lineno="250" slineno="4-37"/>assessments to the School Safety Center created in Section <xref depth="3" refnumber="53G-8-802">53G-8-802</xref> by October <ln numlevel="1" lineno="251" slineno="4-38"/>15 of each year; and</subsection><subsection ssid="10-null-27" dnum="iii-o" numlevel="1" lineno="252" slineno="4-39" level="3"><display>(iii)</display>review the results of the school safety needs assessment to recommend and <ln numlevel="1" lineno="253" slineno="4-40"/>implement improvements to school facilities, policies, procedures, protocols, <ln numlevel="1" lineno="254" slineno="4-41"/>rules, and regulations relating to school safety and security;</subsection></subsection><subsection ssid="10-null-28" dnum="e-o" numlevel="1" lineno="255" slineno="4-42" level="2"><display>(e)</display>participate on the multidisciplinary team that the school establishes;</subsection><subsection ssid="10-null-29" dnum="f-o" numlevel="1" lineno="256" slineno="4-43" level="2"><display>(f)</display>conduct a behavioral threat assessment when the school safety and security specialist <ln numlevel="1" lineno="257" slineno="4-44"/>deems necessary using an evidence-based tool the state security chief recommends in <ln numlevel="1" lineno="258" slineno="4-45"/>consultation with the school safety center and the Office of Substance Use and <ln numlevel="1" lineno="259" slineno="4-46"/>Mental Health;</subsection><subsection ssid="10-null-30" dnum="g-o" numlevel="1" lineno="260" slineno="4-47" level="2"><display>(g)</display>regularly monitor and report to the principal, local law enforcement, and, if <ln numlevel="1" lineno="261" slineno="4-48"/>applicable, the LEA superintendent or designee, security risks for the school resulting <ln numlevel="1" lineno="262" slineno="4-49"/>from:<subsection ssid="10-null-31" dnum="i-o" numlevel="1" lineno="263" slineno="4-50" level="3"><display>(i)</display>issues with school facilities; or</subsection><subsection ssid="10-null-32" dnum="ii-o" numlevel="1" lineno="264" slineno="4-51" level="3"><display>(ii)</display>the implementation of practices, policies, procedures, and protocols relating to <ln numlevel="1" lineno="265" slineno="4-52"/>school safety and security;</subsection></subsection><subsection ssid="10-null-33" dnum="h-o" numlevel="1" lineno="266" slineno="4-53" level="2"><display>(h)</display>coordinate with local first responder agencies to implement and monitor safety and <ln numlevel="1" lineno="267" slineno="4-54"/>security drills in accordance with policy and applicable procedures and protocols;</subsection><subsection ssid="10-null-34" dnum="i-o" numlevel="1" lineno="268" slineno="4-55" level="2"><display>(i)</display>ensure that school staff, and, when appropriate, students, receive training on and <ln numlevel="1" lineno="269" slineno="4-56"/>remain current on the school's safety and security procedures and protocols;</subsection><subsection ssid="10-null-35" dnum="j-o" numlevel="1" lineno="270" slineno="4-57" level="2"><display>(j)</display>following an event where security of the school has been significantly compromised, <ln numlevel="1" lineno="271" slineno="4-58"/>organize a debriefing with the individuals listed in Subsection <xref depth="4" refnumber="53G-8-701.6(3)(c)">(3)(c)</xref> following the <ln numlevel="1" lineno="272" slineno="4-59"/>recommendations from the state security chief, in collaboration with the School <ln numlevel="1" lineno="273" slineno="4-60"/>Safety Center, regarding strengthening school safety and security practices, policies, <ln numlevel="1" lineno="274" slineno="4-61"/>procedures, and protocols;</subsection><subsection ssid="10-null-36" dnum="k-o" numlevel="1" lineno="275" slineno="4-62" level="2"><display>(k)</display>abide by any LEA, school, or law enforcement agency policy outlining the chain of <ln numlevel="1" lineno="276" slineno="4-63"/>command;</subsection><subsection ssid="10-null-37" dnum="l-o" numlevel="1" lineno="277" slineno="4-64" level="2"><display>(l)</display>during an emergency, coordinate with the following individuals as applicable, the:<subsection ssid="10-null-38" dnum="i-o" numlevel="1" lineno="278" slineno="4-65" level="3"><display>(i)</display>school resource officer;</subsection><subsection ssid="10-null-39" dnum="ii-o" numlevel="1" lineno="279" slineno="4-66" level="3"><display>(ii)</display>school guardians;</subsection><subsection ssid="10-null-40" dnum="iii-o" numlevel="1" lineno="280" slineno="4-67" level="3"><display>(iii)</display>armed school security guards;</subsection><subsection ssid="10-null-41" dnum="iv-o" numlevel="1" lineno="281" slineno="4-68" level="3"><display>(iv)</display>school administrators; and</subsection><subsection ssid="10-null-42" dnum="v-o" numlevel="1" lineno="282" slineno="4-69" level="3"><display>(v)</display>responding law enforcement officers;</subsection></subsection><subsection ssid="10-null-43" dnum="m-o" numlevel="1" lineno="283" slineno="4-70" level="2"><display>(m)</display>follow any LEA, school, or law enforcement agency student privacy policies, <ln numlevel="1" lineno="284" slineno="4-71"/>including state and federal privacy laws;</subsection><subsection ssid="10-null-44" dnum="n-o" numlevel="1" lineno="285" slineno="4-72" level="2"><display>(n)</display>participate in an annual training the state security chief selects in consultation with <ln numlevel="1" lineno="286" slineno="4-73"/>the School Safety Center; and</subsection><subsection ssid="10-null-45" dnum="o-o" numlevel="1" lineno="287" slineno="4-74" level="2"><display>(o)</display>remain current on:<subsection ssid="10-null-46" dnum="i-o" numlevel="1" lineno="288" slineno="4-75" level="3"><display>(i)</display>a comprehensive school guideline the state security chief selects;</subsection><subsection ssid="10-null-47" dnum="ii-o" numlevel="1" lineno="289" slineno="4-76" level="3"><display>(ii)</display>the duties of a school safety and security specialist described in this Subsection <xref depth="4" refnumber="53G-8-701.6(3)">(3)</xref>; <ln numlevel="1" lineno="290" slineno="4-77"/>and</subsection><subsection ssid="10-null-48" dnum="iii-o" numlevel="1" lineno="291" slineno="4-78" level="3"><display>(iii)</display>the school's emergency response plan.</subsection></subsection></subsection><subsection ssid="10-null-49" dnum="4-o" numlevel="1" lineno="292" slineno="4-79" level="1"><display>(4)</display>During an active emergency at the school, the school safety and security specialist is <ln numlevel="1" lineno="293" slineno="4-80"/>subordinate to any responding law enforcement officers.</subsection></section></bsec><bsec buid="20" num="53G-8-701.8" type="amend" src="code" uid="C53G-8-S701.8_2026050620260506" sort="53G08 07010820260506" numlevel="1" lineno="294" slineno="5-1" sn="5"><section number="53G-8-701.8" numlevel="1" lineno="295" slineno="5-2" type="amend"><secline lineno="294">Section 5, Section <bold>53G-8-701.8</bold> is amended to read:</secline><catline lineno="295"><bold>53G-8-701.8. School safety and security director.</bold></catline><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="296" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-8-701.5(3)">53G-8-701.5(3)</xref>, an LEA shall designate a school <ln numlevel="1" lineno="297" slineno="5-4"/>safety and security director as the LEA point of contact for the county security chief<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> <ln numlevel="1" lineno="298" slineno="5-5"/>regarding a school other than the Utah Schools for the Deaf and the Blind</amend>, local law <ln numlevel="1" lineno="299" slineno="5-6"/>enforcement, and the state security chief.</subsection><subsection ssid="20-null-2" dnum="2-o" numlevel="1" lineno="300" slineno="5-7" level="1"><display>(2)</display>A school safety and security director shall:<subsection ssid="20-null-3" dnum="a-o" numlevel="1" lineno="301" slineno="5-8" level="2"><display>(a)</display>participate in and satisfy the training requirements as follows:<subsection ssid="20-null-4" dnum="i-o" numlevel="1" lineno="302" slineno="5-9" level="3"><display>(i)</display>only once, the training requirements described in Section <xref depth="3" refnumber="53-22-105">53-22-105</xref> for school <ln numlevel="1" lineno="303" slineno="5-10"/>guardians; and</subsection><subsection ssid="20-null-5" dnum="ii-o" numlevel="1" lineno="304" slineno="5-11" level="3"><display>(ii)</display>the school resource officer and administrator training the state security chief <ln numlevel="1" lineno="305" slineno="5-12"/>approves in consultation with the School Safety Center; </subsection></subsection><subsection ssid="20-null-6" dnum="b-o" numlevel="1" lineno="306" slineno="5-13" level="2"><display>(b)</display>if serving as a backup school guardian, satisfy all requirements described in <xref depth="3" refnumber="53-22-105"><ln numlevel="1" lineno="307" slineno="5-14"/>53-22-105</xref>;</subsection><subsection ssid="20-null-7" dnum="c-o" numlevel="1" lineno="308" slineno="5-15" level="2"><display>(c)</display>if the designee is an employee of an LEA, participate on the multidisciplinary team <ln numlevel="1" lineno="309" slineno="5-16"/>the LEA establishes;</subsection><subsection ssid="20-null-8" dnum="d-o" numlevel="1" lineno="310" slineno="5-17" level="2"><display>(d)</display>coordinate security responses among, if applicable, the following individuals in the <ln numlevel="1" lineno="311" slineno="5-18"/>LEA that employs the school safety and security director:<subsection ssid="20-null-9" dnum="i-o" numlevel="1" lineno="312" slineno="5-19" level="3"><display>(i)</display>school safety and security specialists;</subsection><subsection ssid="20-null-10" dnum="ii-o" numlevel="1" lineno="313" slineno="5-20" level="3"><display>(ii)</display>school resource officers;</subsection><subsection ssid="20-null-11" dnum="iii-o" numlevel="1" lineno="314" slineno="5-21" level="3"><display>(iii)</display>armed school security guards; and</subsection><subsection ssid="20-null-12" dnum="iv-o" numlevel="1" lineno="315" slineno="5-22" level="3"><display>(iv)</display>school guardians; and</subsection></subsection><subsection ssid="20-null-13" dnum="e-o" numlevel="1" lineno="316" slineno="5-23" level="2"><display>(e)</display>collaborate and maintain effective communications with local law enforcement, a <ln numlevel="1" lineno="317" slineno="5-24"/>county security chief<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> or, regarding the Utah Schools for the Deaf and the Blind, the <ln numlevel="1" lineno="318" slineno="5-25"/>state security chief</amend>, the LEA, and school-based behavioral and mental health <ln numlevel="1" lineno="319" slineno="5-26"/>professionals to ensure adherence with all policies, procedures, protocols, rules, and <ln numlevel="1" lineno="320" slineno="5-27"/>regulations relating to school safety and security.</subsection></subsection><subsection ssid="20-null-14" dnum="3-o" numlevel="1" lineno="321" slineno="5-28" level="1"><display>(3)</display>A school safety and security director:<subsection ssid="20-null-15" dnum="a-o" numlevel="1" lineno="322" slineno="5-29" level="2"><display>(a)</display>does not have authority to act in a law enforcement capacity; and</subsection><subsection ssid="20-null-16" dnum="b-o" numlevel="1" lineno="323" slineno="5-30" level="2"><display>(b)</display>may, at the LEA that employs the director:<subsection ssid="20-null-17" dnum="i-o" numlevel="1" lineno="324" slineno="5-31" level="3"><display>(i)</display>take actions necessary to prevent or abate an active threat; and</subsection><subsection ssid="20-null-18" dnum="ii-o" numlevel="1" lineno="325" slineno="5-32" level="3"><display>(ii)</display>temporarily detain an individual when the school safety and security director has <ln numlevel="1" lineno="326" slineno="5-33"/>reasonable cause to believe the individual has committed or is about to commit a <ln numlevel="1" lineno="327" slineno="5-34"/>forcible felony.</subsection></subsection></subsection><subsection ssid="20-null-19" dnum="4-o" numlevel="1" lineno="328" slineno="5-35" level="1"><display>(4)</display>Notwithstanding Subsection <xref depth="4" refnumber="76-11-205(4)">76-11-205(4)</xref>, if a school safety and security director is <ln numlevel="1" lineno="329" slineno="5-36"/>carrying a firearm, the school safety and security director shall carry the school safety <ln numlevel="1" lineno="330" slineno="5-37"/>and security director's firearm in a concealed manner and may not, unless during an <ln numlevel="1" lineno="331" slineno="5-38"/>active threat, display or open carry a firearm while on school grounds.</subsection><subsection ssid="20-null-20" dnum="5-o" numlevel="1" lineno="332" slineno="5-39" level="1"><display>(5)</display>A school may use the services of the school safety and security director on a temporary <ln numlevel="1" lineno="333" slineno="5-40"/>basis to satisfy the school safety personnel requirement of Subsection <xref depth="4" refnumber="53G-8-701.5(2)">53G-8-701.5(2)</xref>.</subsection><subsection ssid="20-null-21" dnum="6-o" numlevel="1" lineno="334" slineno="5-41" level="1"><display>(6)</display>The state security chief shall:<subsection ssid="20-null-22" dnum="a-o" numlevel="1" lineno="335" slineno="5-42" level="2"><display>(a)</display>for each school safety and security director, track each school safety and security <ln numlevel="1" lineno="336" slineno="5-43"/>director by collecting the photograph and the name and contact information for each <ln numlevel="1" lineno="337" slineno="5-44"/>school safety and security director; and</subsection><subsection ssid="20-null-23" dnum="b-o" numlevel="1" lineno="338" slineno="5-45" level="2"><display>(b)</display>make the information described in Subsection <xref depth="4" refnumber="53G-8-701.8(6)(a)">(6)(a)</xref> readily available to each law <ln numlevel="1" lineno="339" slineno="5-46"/>enforcement agency in the state categorized by LEA.</subsection></subsection></section></bsec><bsec buid="6" num="53G-9-702" type="amend" src="code" uid="C53G-9-S702_2026050620260506" sort="53G09 07020020260506" numlevel="1" lineno="340" slineno="6-1" sn="6"><section number="53G-9-702" numlevel="1" lineno="341" slineno="6-2" type="amend"><secline lineno="340">Section 6, Section <bold>53G-9-702</bold> is amended to read:</secline><catline lineno="341"><bold>53G-9-702. Youth suicide prevention programs -- State board to develop model <ln numlevel="1" lineno="342" slineno="6-3"/>programs.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="343" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>As used in the section:<subsection ssid="6-null-2" dnum="a-o" numlevel="1" lineno="344" slineno="6-5" level="2"><display>(a)</display>"Elementary grades" means:<subsection ssid="6-null-3" dnum="i-o" numlevel="1" lineno="345" slineno="6-6" level="3"><display>(i)</display>kindergarten through grade 5; and</subsection><subsection ssid="6-null-4" dnum="ii-o" numlevel="1" lineno="346" slineno="6-7" level="3"><display>(ii)</display>if the associated middle or junior high school does not include grade 6, grade 6.</subsection></subsection><subsection ssid="6-null-5" dnum="b-o" numlevel="1" lineno="347" slineno="6-8" level="2"><display>(b)</display>"Intervention" means an effort to prevent a student from attempting suicide.</subsection><subsection ssid="6-null-6" dnum="c-o" numlevel="1" lineno="348" slineno="6-9" level="2"><display>(c)</display>"Postvention" means mental health intervention after a suicide attempt or death to <ln numlevel="1" lineno="349" slineno="6-10"/>prevent or contain contagion.</subsection><subsection ssid="6-null-7" dnum="d-o" numlevel="1" lineno="350" slineno="6-11" level="2"><display>(d)</display>"Program" means a youth suicide prevention program described in Subsection <xref depth="4" refnumber="53G-9-702(2)" start="0">(2)</xref>.</subsection><subsection ssid="6-null-8" dnum="e-o" numlevel="1" lineno="351" slineno="6-12" level="2"><display>(e)</display>"Public education suicide prevention coordinator" means an individual designated by <ln numlevel="1" lineno="352" slineno="6-13"/>the state board as described in Subsection <xref depth="4" refnumber="53G-9-702(4)" start="0">(4)</xref>.</subsection><subsection ssid="6-null-9" dnum="f-o" numlevel="1" lineno="353" slineno="6-14" level="2"><display>(f)</display>"Secondary grades" means:<subsection ssid="6-null-10" dnum="i-o" numlevel="1" lineno="354" slineno="6-15" level="3"><display>(i)</display>grades 7 through 12; and</subsection><subsection ssid="6-null-11" dnum="ii-o" numlevel="1" lineno="355" slineno="6-16" level="3"><display>(ii)</display>if a middle or junior high school includes grade 6, grade 6.</subsection></subsection><subsection ssid="6-null-12" dnum="g-o" numlevel="1" lineno="356" slineno="6-17" level="2"><display>(g)</display>"State suicide prevention coordinator" means the state suicide prevention coordinator <ln numlevel="1" lineno="357" slineno="6-18"/>described in Section <xref depth="3" refnumber="26B-5-611" start="0">26B-5-611</xref>.</subsection></subsection><subsection ssid="6-null-13" dnum="2-o" numlevel="1" lineno="358" slineno="6-19" level="1"><display>(2)</display>In collaboration with the public education suicide prevention coordinator, a school <ln numlevel="1" lineno="359" slineno="6-20"/>district or charter school shall implement a youth suicide prevention program, which, in <ln numlevel="1" lineno="360" slineno="6-21"/>collaboration with the training, programs, and initiatives described in Section <xref depth="3" refnumber="53G-9-607" start="0">53G-9-607</xref>, <ln numlevel="1" lineno="361" slineno="6-22"/>shall include programs and training to address:<subsection ssid="6-null-14" dnum="a-o" numlevel="1" lineno="362" slineno="6-23" level="2"><display>(a)</display>for elementary grades and secondary grades:<subsection ssid="6-null-15" dnum="i-o" numlevel="1" lineno="363" slineno="6-24" level="3"><display>(i)</display>life-affirming education, including on the concepts of resiliency, healthy habits, <ln numlevel="1" lineno="364" slineno="6-25"/>self-care, problem solving, and conflict resolution;</subsection><subsection ssid="6-null-16" dnum="ii-o" numlevel="1" lineno="365" slineno="6-26" level="3"><display>(ii)</display>methods of strengthening the family; and</subsection><subsection ssid="6-null-17" dnum="iii-o" numlevel="1" lineno="366" slineno="6-27" level="3"><display>(iii)</display>methods of strengthening a youth's relationships in the school and community; <ln numlevel="1" lineno="367" slineno="6-28"/>and</subsection></subsection><subsection ssid="6-null-18" dnum="b-o" numlevel="1" lineno="368" slineno="6-29" level="2"><display>(b)</display>for secondary grades:<subsection ssid="6-null-19" dnum="i-o" numlevel="1" lineno="369" slineno="6-30" level="3"><display>(i)</display>prevention of youth suicide;</subsection><subsection ssid="6-null-20" dnum="ii-o" numlevel="1" lineno="370" slineno="6-31" level="3"><display>(ii)</display>decreasing the risk of suicide among youth who are:<subsection ssid="6-null-21" dnum="A-o" numlevel="1" lineno="371" slineno="6-32" level="4"><display>(A)</display>not accepted by family for any reason, including lesbian, gay, bisexual, <ln numlevel="1" lineno="372" slineno="6-33"/>transgender, or questioning youth; or</subsection><subsection ssid="6-null-22" dnum="B-o" numlevel="1" lineno="373" slineno="6-34" level="4"><display>(B)</display>suffer from bullying;</subsection></subsection><subsection ssid="6-null-23" dnum="iii-o" numlevel="1" lineno="374" slineno="6-35" level="3"><display>(iii)</display>youth suicide intervention; and</subsection><subsection ssid="6-null-24" dnum="iv-o" numlevel="1" lineno="375" slineno="6-36" level="3"><display>(iv)</display>postvention for family, students, and faculty.</subsection></subsection></subsection><subsection ssid="6-null-25" dnum="3-o" numlevel="1" lineno="376" slineno="6-37" level="1"><display>(3)</display>Each school district and charter school shall ensure that the youth suicide prevention <ln numlevel="1" lineno="377" slineno="6-38"/>program described in Subsection <xref depth="4" refnumber="53G-9-702(2)" start="0">(2)</xref>:<subsection ssid="6-null-26" dnum="a-o" numlevel="1" lineno="378" slineno="6-39" level="2"><display>(a)</display>considers appropriate coordination with the following prevention programs:<subsection ssid="6-null-27" dnum="i-o" numlevel="1" lineno="379" slineno="6-40" level="3"><display>(i)</display>the prevention of bullying and cyber-bullying, as those terms are defined in <ln numlevel="1" lineno="380" slineno="6-41"/>Section <xref depth="3" refnumber="53G-9-601" start="0">53G-9-601</xref>; and</subsection><subsection ssid="6-null-28" dnum="ii-o" numlevel="1" lineno="381" slineno="6-42" level="3"><display>(ii)</display>the prevention of underage drinking of alcohol and substance abuse under Section <xref depth="3" refnumber="53G-10-406" start="0"><ln numlevel="1" lineno="382" slineno="6-43"/>53G-10-406</xref>; and</subsection></subsection><subsection ssid="6-null-29" dnum="b-o" numlevel="1" lineno="383" slineno="6-44" level="2"><display>(b)</display>includes provisions to ensure that the school district or charter school promptly <ln numlevel="1" lineno="384" slineno="6-45"/>communicates with the parent or guardian of a student in accordance with Section <xref depth="3" refnumber="53G-9-604" start="0"><ln numlevel="1" lineno="385" slineno="6-46"/>53G-9-604</xref>.</subsection></subsection><subsection ssid="6-null-30" dnum="4-o" numlevel="1" lineno="386" slineno="6-47" level="1"><display>(4)</display>The state board shall:<subsection ssid="6-null-31" dnum="a-o" numlevel="1" lineno="387" slineno="6-48" level="2"><display>(a)</display>designate a public education suicide prevention coordinator; and</subsection><subsection ssid="6-null-32" dnum="b-o" numlevel="1" lineno="388" slineno="6-49" level="2"><display>(b)</display>in collaboration with the Department of Health and Human Services and the state <ln numlevel="1" lineno="389" slineno="6-50"/>suicide prevention coordinator, develop model programs to provide to school districts <ln numlevel="1" lineno="390" slineno="6-51"/>and charter schools:<subsection ssid="6-null-33" dnum="i-o" numlevel="1" lineno="391" slineno="6-52" level="3"><display>(i)</display>program training; and</subsection><subsection ssid="6-null-34" dnum="ii-o" numlevel="1" lineno="392" slineno="6-53" level="3"><display>(ii)</display>resources regarding the required components described in Subsections <xref depth="4" refnumber="53G-9-702(2)(a)" start="0">(2)(a)</xref> and <xref depth="4" refnumber="53G-9-702(2)(b)" start="0"><ln numlevel="1" lineno="393" slineno="6-54"/>(b)</xref>.</subsection></subsection></subsection><subsection ssid="6-null-35" dnum="5-o" numlevel="1" lineno="394" slineno="6-55" level="1"><display>(5)</display>The public education suicide prevention coordinator shall:<subsection ssid="6-null-36" dnum="a-o" numlevel="1" lineno="395" slineno="6-56" level="2"><display>(a)</display>oversee the youth suicide prevention programs of school districts and charter <ln numlevel="1" lineno="396" slineno="6-57"/>schools; and</subsection><subsection ssid="6-null-37" dnum="b-o" numlevel="1" lineno="397" slineno="6-58" level="2"><display>(b)</display>coordinate prevention and postvention programs, services, and efforts with the state <ln numlevel="1" lineno="398" slineno="6-59"/>suicide prevention coordinator.</subsection></subsection><subsection ssid="6-null-38" dnum="6-o" numlevel="1" lineno="399" slineno="6-60" level="1"><display>(6)</display>A public school suicide prevention program may allow school personnel to ask a <ln numlevel="1" lineno="400" slineno="6-61"/>student questions related to youth suicide prevention, intervention, or postvention.</subsection><subsection ssid="6-null-39" dnum="7-o" numlevel="1" lineno="401" slineno="6-62" level="1" space="false"><display>(7)</display><subsection ssid="6-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to legislative appropriation and except as provided in Section <xref depth="3" refnumber="53F-2-525" start="0">53F-2-525</xref>, <ln numlevel="1" lineno="402" slineno="6-63"/>the state board may distribute money to a school district or charter school to be used <ln numlevel="1" lineno="403" slineno="6-64"/>to implement evidence-based practices and programs, or emerging best practices and <ln numlevel="1" lineno="404" slineno="6-65"/>programs, for preventing suicide in the school district or charter school.</subsection><subsection ssid="6-null-41" dnum="b-o" numlevel="1" lineno="405" slineno="6-66" level="2"><display>(b)</display>The state board shall ensure that an LEA's allocation of funds from the board's <ln numlevel="1" lineno="406" slineno="6-67"/>distribution of money under Subsection <xref depth="4" refnumber="53G-9-702(7)(a)" start="0">(7)(a)</xref> provides<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="6-46" dnum="_-o:i-i" numlevel="1" lineno="407" slineno="6-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>an amount equal to at least $1,000 per school<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="6-47" dnum="_-o:ii-i" numlevel="1" lineno="408" slineno="6-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">if appropriations are not available to provide the amount described in Subsection <xref depth="4" refnumber="53G-9-702(7)(b)"><ln numlevel="1" lineno="409" slineno="6-70"/>(7)(b)</xref>(i), a commensurately lesser amount.</amend></subsection></subsection><subsection ssid="6-null-42" dnum="c-o" numlevel="1" lineno="410" slineno="6-71" level="2" space="false"><display>(c)</display><subsection ssid="6-null-43" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A school shall use money allocated to the school under Subsection <xref depth="4" refnumber="53G-9-702(7)(b)" start="0">(7)(b)</xref> to <ln numlevel="1" lineno="411" slineno="6-72"/>implement evidence-based practices and programs, or emerging best practices and <ln numlevel="1" lineno="412" slineno="6-73"/>programs, for preventing suicide.</subsection><subsection ssid="6-null-44" dnum="ii-o" numlevel="1" lineno="413" slineno="6-74" level="3"><display>(ii)</display>Each school may select the evidence-based practices and programs, or emerging <ln numlevel="1" lineno="414" slineno="6-75"/>best practices and programs, for preventing suicide that the school implements.</subsection></subsection></subsection><subsection ssid="6-null-45" dnum="8-o" numlevel="1" lineno="415" slineno="6-76" level="1"><display>(8)</display>An LEA may not charge indirect costs to the program.</subsection></section></bsec><bsec buid="23" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="416" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="416">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="417"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-19-25 2:55 PM</tm></rev></foot></leg>
