placement="noreturn"><display>(1)</display>The department shall carry out transportation studies described in this section as <ln numlevel="1" lineno="45" slineno="2-5"/>resources allow.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="46" slineno="2-6" level="1" space="false"><display>(2)</display><subsection ssid="2-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall study items related to advanced air mobility as described in <ln numlevel="1" lineno="47" slineno="2-7"/>this Subsection <xref depth="4" refnumber="72-1-217(2)" start="0">(2)</xref>.</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="48" slineno="2-8" level="2"><display>(b)</display>The department shall study vertiport locations and infrastructure, including:<subsection ssid="2-null-5" dnum="i-o" numlevel="1" lineno="49" slineno="2-9" level="3"><display>(i)</display>identification of suitable locations for vertiport infrastructure and parking <ln numlevel="1" lineno="50" slineno="2-10"/>infrastructure for vertiports in metropolitan areas;</subsection><subsection ssid="2-null-6" dnum="ii-o" numlevel="1" lineno="51" slineno="2-11" level="3"><display>(ii)</display>identification of commuter rail stations that may be suitable for vertiport <ln numlevel="1" lineno="52" slineno="2-12"/>placement; and</subsection><subsection ssid="2-null-7" dnum="iii-o" numlevel="1" lineno="53" slineno="2-13" level="3"><display>(iii)</display>identification of underutilized parking lots and parking structures for vertiport <ln numlevel="1" lineno="54" slineno="2-14"/>infrastructure placement.</subsection></subsection><subsection ssid="2-null-8" dnum="c-o" numlevel="1" lineno="55" slineno="2-15" level="2"><display>(c)</display>The department shall study best practices and implementation of advanced air <ln numlevel="1" lineno="56" slineno="2-16"/>mobility technologies, including:<subsection ssid="2-null-9" dnum="i-o" numlevel="1" lineno="57" slineno="2-17" level="3"><display>(i)</display>seeking input through community engagement;</subsection><subsection ssid="2-null-10" dnum="ii-o" numlevel="1" lineno="58" slineno="2-18" level="3"><display>(ii)</display>state and local regulations;</subsection><subsection ssid="2-null-11" dnum="iii-o" numlevel="1" lineno="59" slineno="2-19" level="3"><display>(iii)</display>unmanned aircraft system traffic management; and</subsection><subsection ssid="2-null-12" dnum="iv-o" numlevel="1" lineno="60" slineno="2-20" level="3"><display>(iv)</display>weather reporting and monitoring for advanced air mobility safety.</subsection></subsection><subsection ssid="2-null-13" dnum="d-o" numlevel="1" lineno="61" slineno="2-21" level="2"><display>(d)</display>The department shall study unmanned aircraft traffic management infrastructure, <ln numlevel="1" lineno="62" slineno="2-22"/>including:<subsection ssid="2-null-14" dnum="i-o" numlevel="1" lineno="63" slineno="2-23" level="3"><display>(i)</display>unmanned aircraft system traffic management development, implementation, <ln numlevel="1" lineno="64" slineno="2-24"/>procedures, policies, and infrastructure; and</subsection><subsection ssid="2-null-15" dnum="ii-o" numlevel="1" lineno="65" slineno="2-25" level="3"><display>(ii)</display>obtaining a full understanding of unmanned aircraft system traffic management, <ln numlevel="1" lineno="66" slineno="2-26"/>including:<subsection ssid="2-null-16" dnum="A-o" numlevel="1" lineno="67" slineno="2-27" level="4"><display>(A)</display>designation of airspace for advanced air mobility;</subsection><subsection ssid="2-null-17" dnum="B-o" numlevel="1" lineno="68" slineno="2-28" level="4"><display>(B)</display>creation of geographic categorical areas;</subsection><subsection ssid="2-null-18" dnum="C-o" numlevel="1" lineno="69" slineno="2-29" level="4"><display>(C)</display>identifying the appropriate number and location of advanced air mobility <ln numlevel="1" lineno="70" slineno="2-30"/>sensors; and</subsection><subsection ssid="2-null-19" dnum="D-o" numlevel="1" lineno="71" slineno="2-31" level="4"><display>(D)</display>other state specific details regarding unmanned aircraft system traffic <ln numlevel="1" lineno="72" slineno="2-32"/>management.</subsection></subsection></subsection><subsection ssid="2-null-20" dnum="e-o" numlevel="1" lineno="73" slineno="2-33" level="2"><display>(e)</display>The department shall study the creation of an advanced air mobility sandbox, <ln numlevel="1" lineno="74" slineno="2-34"/>including:<subsection ssid="2-null-21" dnum="i-o" numlevel="1" lineno="75" slineno="2-35" level="3"><display>(i)</display>potential locations for the sandbox testing area and desirable attributes of a <ln numlevel="1" lineno="76" slineno="2-36"/>suitable sandbox location;</subsection><subsection ssid="2-null-22" dnum="ii-o" numlevel="1" lineno="77" slineno="2-37" level="3"><display>(ii)</display>requirements to create a geographical advanced air mobility testing area and the <ln numlevel="1" lineno="78" slineno="2-38"/>parameters for the types of technology that may be utilized in the testing area; and</subsection><subsection ssid="2-null-23" dnum="iii-o" numlevel="1" lineno="79" slineno="2-39" level="3"><display>(iii)</display>testing and studying different types of advanced air mobility transportation of <ln numlevel="1" lineno="80" slineno="2-40"/>manned and unmanned aerial vehicles, including:<subsection ssid="2-null-24" dnum="A-o" numlevel="1" lineno="81" slineno="2-41" level="4"><display>(A)</display>aerial vehicle size;</subsection><subsection ssid="2-null-25" dnum="B-o" numlevel="1" lineno="82" slineno="2-42" level="4"><display>(B)</display>aerial vehicles that carry cargo, including medical cargo;</subsection><subsection ssid="2-null-26" dnum="C-o" numlevel="1" lineno="83" slineno="2-43" level="4"><display>(C)</display>commercial aerial vehicles; and</subsection><subsection ssid="2-null-27" dnum="D-o" numlevel="1" lineno="84" slineno="2-44" level="4"><display>(D)</display>public transportation aerial vehicles.</subsection></subsection></subsection><subsection ssid="2-null-28" dnum="f-o" numlevel="1" lineno="85" slineno="2-45" level="2"><display>(f)</display>On or before September 30, 2023, the department shall provide a report to the <ln numlevel="1" lineno="86" slineno="2-46"/>Transportation Interim Committee of the department's findings from the study items <ln numlevel="1" lineno="87" slineno="2-47"/>described in Subsections <xref depth="4" refnumber="72-1-217(2)(b)" start="0">(2)(b)</xref> through <xref depth="4" refnumber="72-1-217(2)(e)" start="0">(2)(e)</xref>.</subsection><subsection ssid="2-null-29" dnum="g-o" numlevel="1" lineno="88" slineno="2-48" level="2"><display>(g)</display>The department may only use existing funds to cover the expenses incurred from the <ln numlevel="1" lineno="89" slineno="2-49"/>study of items described in Subsections <xref depth="4" refnumber="72-1-217(2)(b)" start="0">(2)(b)</xref> through <xref depth="4" refnumber="72-1-217(2)(e)" start="0">(2)(e)</xref>.</subsection></subsection><subsection ssid="2-null-30" dnum="3-o" numlevel="1" lineno="90" slineno="2-50" level="1" space="false"><display>(3)</display><subsection ssid="2-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department and a large public transit district shall jointly study programs <ln numlevel="1" lineno="91" slineno="2-51"/>offered by government entities related to human services transportation, including:<subsection ssid="2-null-32" dnum="i-o" numlevel="1" lineno="92" slineno="2-52" level="3" tab="1"><display>(i)</display>coordinated mobility services;</subsection><subsection ssid="2-null-33" dnum="ii-o" numlevel="1" lineno="93" slineno="2-53" level="3" tab="1"><display>(ii)</display>paratransit services;</subsection><subsection ssid="2-null-34" dnum="iii-o" numlevel="1" lineno="94" slineno="2-54" level="3" tab="1"><display>(iii)</display>nonemergency medical transportation;</subsection><subsection ssid="2-null-35" dnum="iv-o" numlevel="1" lineno="95" slineno="2-55" level="3" tab="1"><display>(iv)</display>youth transportation programs, excluding school bus transportation; and</subsection><subsection ssid="2-null-36" dnum="v-o" numlevel="1" lineno="96" slineno="2-56" level="3" tab="1"><display>(v)</display>other similar fare-based or fee-based programs provided or coordinated within the <ln numlevel="1" lineno="97" slineno="2-57"/>boundary of the large public transit district, including those involving the <ln numlevel="1" lineno="98" slineno="2-58"/>department, a large public transit district, local governments, or other government <ln numlevel="1" lineno="99" slineno="2-59"/>agencies and nonprofit entities that provide similar services.</subsection></subsection><subsection ssid="2-null-37" dnum="b-o" numlevel="1" lineno="100" slineno="2-60" level="2"><display>(b)</display>The study shall evaluate strategies to consolidate the transportation services <ln numlevel="1" lineno="101" slineno="2-61"/>described in Subsection <xref refnumber="72-1-217(3)(a)" depth="4">(3)(a)</xref> to improve efficiency and service.</subsection><subsection ssid="2-null-38" dnum="c-o" numlevel="1" lineno="102" slineno="2-62" level="2"><display>(c)</display>The department and large public transit district shall:<subsection ssid="2-null-39" dnum="i-o" numlevel="1" lineno="103" slineno="2-63" level="3"><display>(i)</display>provide a preliminary report on the study to the Transportation Interim Committee <ln numlevel="1" lineno="104" slineno="2-64"/>on or before November 1, 2025; and</subsection><subsection ssid="2-null-40" dnum="ii-o" numlevel="1" lineno="105" slineno="2-65" level="3"><display>(ii)</display>prepare and present recommendations to the Transportation Interim Committee <ln numlevel="1" lineno="106" slineno="2-66"/>on or before November 1, 2026, for the consolidation of the services described in <ln numlevel="1" lineno="107" slineno="2-67"/>Subsection <xref refnumber="72-1-217(3)(a)" depth="4">(3)(a)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-41" dnum="4-o" numlevel="1" lineno="108" slineno="2-68" level="1" space="false"><display>(4)</display><subsection ssid="2-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="72-1-217(4)">(4)</xref>:<subsection ssid="2-null-43" dnum="i-o" numlevel="1" lineno="109" slineno="2-69" level="3" tab="1"><display>(i)</display>"City" means Salt Lake City.</subsection><subsection ssid="2-null-44" dnum="ii-o" numlevel="1" lineno="110" slineno="2-70" level="3" tab="1"><display>(ii)</display>"Highway reduction strategy" means any strategy that has the potential to <ln numlevel="1" lineno="111" slineno="2-71"/>permanently decrease the number of vehicles that can travel on an arterial or a <ln numlevel="1" lineno="112" slineno="2-72"/>collector highway per hour, including:<subsection ssid="2-null-45" dnum="A-o" numlevel="1" lineno="113" slineno="2-73" level="4"><display>(A)</display>reducing the number of motorized vehicle travel lanes on an arterial or <ln numlevel="1" lineno="114" slineno="2-74"/>collector highway;</subsection><subsection ssid="2-null-46" dnum="B-o" numlevel="1" lineno="115" slineno="2-75" level="4"><display>(B)</display>narrowing existing motorized vehicle travel lanes on an arterial or collector <ln numlevel="1" lineno="116" slineno="2-76"/>highway; or</subsection><subsection ssid="2-null-47" dnum="C-o" numlevel="1" lineno="117" slineno="2-77" level="4"><display>(C)</display>any other strategy that when implemented may increase congestion or impede <ln numlevel="1" lineno="118" slineno="2-78"/>traffic flow for motor vehicles driving on an arterial or collector highway.</subsection></subsection><subsection ssid="2-null-48" dnum="iii-o" numlevel="1" lineno="119" slineno="2-79" level="3" tab="1"><display>(iii)</display>"Mobility and environmental impact analysis" means a study that assesses the <ln numlevel="1" lineno="120" slineno="2-80"/>impacts within the study area of implementing a highway reduction strategy on <ln numlevel="1" lineno="121" slineno="2-81"/>arterial or collector highways, including the impacts to other state and local <ln numlevel="1" lineno="122" slineno="2-82"/>highways, mobility, traffic flow, pedestrian and nonmotorized vehicle flow, the <ln numlevel="1" lineno="123" slineno="2-83"/>economy, public health, quality of life, air quality, maintenance, and operations.</subsection><subsection ssid="2-null-49" dnum="iv-o" numlevel="1" lineno="124" slineno="2-84" level="3" tab="1"><display>(iv)</display>"Study area" means the area within Salt Lake City that is west of Foothill Drive, <ln numlevel="1" lineno="125" slineno="2-85"/>north of 2100 South, east of I-15, and south of 600 North.</subsection></subsection><subsection ssid="2-null-50" dnum="b-o" numlevel="1" lineno="126" slineno="2-86" level="2" space="false"><display>(b)</display><subsection ssid="2-null-51" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as described in Subsection <xref depth="4" refnumber="72-1-217(4)(c)">(4)(c)</xref>, a city may not implement or begin a <ln numlevel="1" lineno="127" slineno="2-87"/>project as part of a highway reduction strategy on an arterial or a collector <ln numlevel="1" lineno="128" slineno="2-88"/>highway within the study area unless the project is part of a mobility plan <ln numlevel="1" lineno="129" slineno="2-89"/>approved by the department as described in this Subsection <xref depth="4" refnumber="72-1-217(4)(b)">(4)(b)</xref>.</subsection><subsection ssid="2-null-52" dnum="ii-o" numlevel="1" lineno="130" slineno="2-90" level="3"><display>(ii)</display>For a mobility plan described under Subsection <xref depth="4" refnumber="72-1-217(4)(b)(i)">(4)(b)(i)</xref>, the city shall:<subsection ssid="2-null-53" dnum="A-o" numlevel="1" lineno="131" slineno="2-91" level="4"><display>(A)</display>assess the alternate routes for traffic and impacts on surrounding highways <ln numlevel="1" lineno="132" slineno="2-92"/>due to any lane reduction;</subsection><subsection ssid="2-null-54" dnum="B-o" numlevel="1" lineno="133" slineno="2-93" level="4"><display>(B)</display>evaluate impacts to vehicle trip time;</subsection><subsection ssid="2-null-55" dnum="C-o" numlevel="1" lineno="134" slineno="2-94" level="4"><display>(C)</display>evaluate impacts to air quality;</subsection><subsection ssid="2-null-56" dnum="D-o" numlevel="1" lineno="135" slineno="2-95" level="4"><display>(D)</display>evaluate the cumulative multimodal and safety impact of the proposed <ln numlevel="1" lineno="136" slineno="2-96"/>highway reduction strategies, including the cumulative impact from previous <ln numlevel="1" lineno="137" slineno="2-97"/>highway reduction strategies implemented over the previous five years;</subsection><subsection ssid="2-null-57" dnum="E-o" numlevel="1" lineno="138" slineno="2-98" level="4"><display>(E)</display>provide options to mitigate negative impacts to vehicle traffic, vehicle trip <ln numlevel="1" lineno="139" slineno="2-99"/>time, air quality, or adjacent travel routes;</subsection><subsection ssid="2-null-58" dnum="F-o" numlevel="1" lineno="140" slineno="2-100" level="4"><display>(F)</display>in collaboration with the department, assess impacts to state highways;</subsection><subsection ssid="2-null-59" dnum="G-o" numlevel="1" lineno="141" slineno="2-101" level="4"><display>(G)</display>proactively seek out and consult with relevant stakeholders, including <ln numlevel="1" lineno="142" slineno="2-102"/>business owners, commuters, and residents impacted by the mobility plan and <ln numlevel="1" lineno="143" slineno="2-103"/>each proposed project within the mobility plan;</subsection><subsection ssid="2-null-60" dnum="H-o" numlevel="1" lineno="144" slineno="2-104" level="4"><display>(H)</display>present the plan in an open and public meeting, including public comment;</subsection><subsection ssid="2-null-61" dnum="I-o" numlevel="1" lineno="145" slineno="2-105" level="4"><display>(I)</display>provide an open house or other event to allow public interaction and feedback <ln numlevel="1" lineno="146" slineno="2-106"/>regarding the impacts of the mobility plan;</subsection><subsection ssid="2-null-62" dnum="J-o" numlevel="1" lineno="147" slineno="2-107" level="4"><display>(J)</display>present the plan to the membership of the city's chamber of commerce and <ln numlevel="1" lineno="148" slineno="2-108"/>other business groups; and</subsection><subsection ssid="2-null-63" dnum="K-o" numlevel="1" lineno="149" slineno="2-109" level="4"><display>(K)</display>provide the plan to the department for the department's review.</subsection></subsection><subsection ssid="2-null-64" dnum="iii-o" numlevel="1" lineno="150" slineno="2-110" level="3" space="false"><display>(iii)</display><subsection ssid="2-null-65" dnum="A-o" level="4" placement="sameline"><display>(A)</display>After the department receives a complete mobility plan as described in <ln numlevel="1" lineno="151" slineno="2-111"/>Subsection <xref depth="4" refnumber="72-1-217(4)(b)(ii)">(4)(b)(ii)</xref>, the department shall determine if the mobility plan and <ln numlevel="1" lineno="152" slineno="2-112"/>each project included in the mobility plan meet the requirements of this section <ln numlevel="1" lineno="153" slineno="2-113"/>and shall approve or reject the plan within two months of receiving the <ln numlevel="1" lineno="154" slineno="2-114"/>mobility plan.</subsection><subsection ssid="2-null-66" dnum="B-o" numlevel="1" lineno="155" slineno="2-115" level="4"><display>(B)</display>As part of the mobility plan, the city shall demonstrate to the department the <ln numlevel="1" lineno="156" slineno="2-116"/>manners in which the city involved and received input from the business <ln numlevel="1" lineno="157" slineno="2-117"/>community, the public, and other stakeholders as required in Subsection <xref depth="4" refnumber="72-1-217(4)(b)(ii)"><ln numlevel="1" lineno="158" slineno="2-118"/>(4)(b)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-67" dnum="c-o" numlevel="1" lineno="159" slineno="2-119" level="2" space="false"><display>(c)</display><subsection ssid="2-null-68" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The city may begin or continue construction on an arterial or collector highway <ln numlevel="1" lineno="160" slineno="2-120"/>project related to any reduction strategy within the study area if the project has <ln numlevel="1" lineno="161" slineno="2-121"/>been advertised on or before February 25, 2025.</subsection><subsection ssid="2-null-69" dnum="ii-o" numlevel="1" lineno="162" slineno="2-122" level="3" space="false"><display>(ii)</display><subsection ssid="2-null-70" dnum="A-o" level="4" placement="sameline"><display>(A)</display>For a project related to any highway reduction strategy that was <ln numlevel="1" lineno="163" slineno="2-123"/>programmed by the department on or before July 1, 2024, but has not been <ln numlevel="1" lineno="164" slineno="2-124"/>advertised on or before February 25, 2025, the department may conduct an <ln numlevel="1" lineno="165" slineno="2-125"/>expedited review of the project.</subsection><subsection ssid="2-null-71" dnum="B-o" numlevel="1" lineno="166" slineno="2-126" level="4"><display>(B)</display>If the department approves a project after an expedited review as described in <ln numlevel="1" lineno="167" slineno="2-127"/>Subsection <xref depth="4" refnumber="72-1-217(4)(c)(ii)(a)">(4)(c)(ii)(A)</xref>, the city may begin or continue construction on the <ln numlevel="1" lineno="168" slineno="2-128"/>project.</subsection></subsection></subsection><subsection ssid="2-null-72" dnum="d-o" numlevel="1" lineno="169" slineno="2-129" level="2"><display>(d)</display>The department shall, in partnership with the city, conduct a mobility and <ln numlevel="1" lineno="170" slineno="2-130"/>environmental impact analysis to determine the impacts of highway reduction <ln numlevel="1" lineno="171" slineno="2-131"/>strategies within the study area that the city has implemented on or after July 1, 2015, <ln numlevel="1" lineno="172" slineno="2-132"/>or has plans to implement on or before July 1, 2035.</subsection><subsection ssid="2-null-73" dnum="e-o" numlevel="1" lineno="173" slineno="2-133" level="2"><display>(e)</display>As part of the mobility and environmental impact analysis, the department shall:<subsection ssid="2-null-74" dnum="i-o" numlevel="1" lineno="174" slineno="2-134" level="3"><display>(i)</display>assess the cumulative impact of each highway reduction strategy within the study <ln numlevel="1" lineno="175" slineno="2-135"/>area that the city has implemented or has plans to implement between July 1, <ln numlevel="1" lineno="176" slineno="2-136"/>2015, and July 1, 2035; and</subsection><subsection ssid="2-null-75" dnum="ii-o" numlevel="1" lineno="177" slineno="2-137" level="3"><display>(ii)</display>consult with relevant stakeholders, including business owners, commuters, and <ln numlevel="1" lineno="178" slineno="2-138"/>residents impacted by the highway reduction strategy.</subsection></subsection><subsection ssid="2-null-76" dnum="f-o" numlevel="1" lineno="179" slineno="2-139" level="2"><display>(f)</display>A city subject to a mobility and environmental impact analysis under this Subsection <xref depth="4" refnumber="72-1-217(4)"><ln numlevel="1" lineno="180" slineno="2-140"/>(4)</xref> shall provide to the department any information the department determines <ln numlevel="1" lineno="181" slineno="2-141"/>necessary for conducting the mobility and environmental impact analysis, including <ln numlevel="1" lineno="182" slineno="2-142"/>any plans that city has adopted or discussed with regards to a highway reduction <ln numlevel="1" lineno="183" slineno="2-143"/>strategy.</subsection><subsection ssid="2-null-77" dnum="g-o" numlevel="1" lineno="184" slineno="2-144" level="2" space="false"><display>(g)</display><subsection ssid="2-null-78" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The department shall provide the mobility and environmental impact analysis <ln numlevel="1" lineno="185" slineno="2-145"/>to the Transportation Interim Committee on or before October 15, 2025.</subsection><subsection ssid="2-null-79" dnum="ii-o" numlevel="1" lineno="186" slineno="2-146" level="3"><display>(ii)</display>The city shall provide a response to the mobility and environmental impact <ln numlevel="1" lineno="187" slineno="2-147"/>analysis to the Transportation Interim Committee on or before November 1, 2025.</subsection></subsection><subsection ssid="2-null-80" dnum="h-o" numlevel="1" lineno="188" slineno="2-148" level="2" space="false"><display>(h)</display><subsection ssid="2-null-81" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As provided in Section <xref depth="3" refnumber="63I-1-272">63I-1-272</xref>, this Subsection <xref refnumber="72-1-217(4)" depth="4">(4)</xref> is subject to a sunset <ln numlevel="1" lineno="189" slineno="2-149"/>review by the Transportation Interim Committee during the 2028 interim.</subsection><subsection ssid="2-null-82" dnum="ii-o" numlevel="1" lineno="190" slineno="2-150" level="3"><display>(ii)</display>The Transportation Interim Committee may also evaluate the mobility plan <ln numlevel="1" lineno="191" slineno="2-151"/>process described in this Subsection <xref depth="4" refnumber="72-1-217(4)">(4)</xref> during the 2027 interim.</subsection></subsection></subsection><subsection ssid="2-83" dnum="_-o:5-i" numlevel="1" lineno="192" slineno="2-152" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="2-107" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">In conjunction with applicable stakeholders, the department shall study items <ln numlevel="1" lineno="193" slineno="2-153"/>related to the efficiency of the commission and the commission's ability to meet the <ln numlevel="1" lineno="194" slineno="2-154"/>future needs of the state as described in this Subsection <xref depth="4" refnumber="72-1-217(5)">(5)</xref>.</amend></subsection><subsection ssid="2-108" dnum="_-o:b-i" numlevel="1" lineno="195" slineno="2-155" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">In conjunction with applicable stakeholders, the department shall study the <ln numlevel="1" lineno="196" slineno="2-156"/>composition of members of the commission, including:</amend><subsection ssid="2-109" dnum="_-o:i-i" numlevel="1" lineno="197" slineno="2-157" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">the distribution of members;</amend></subsection><subsection ssid="2-110" dnum="_-o:ii-i" numlevel="1" lineno="198" slineno="2-158" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">the number of members; and</amend></subsection><subsection ssid="2-111" dnum="_-o:iii-i" numlevel="1" lineno="199" slineno="2-159" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">the efficiency of the commission in light of the factors described in Subsections <xref depth="4" refnumber="72-1-217(5)(b)(i)"><ln numlevel="1" lineno="200" slineno="2-160"/>(5)(b)(i)</xref> and <xref depth="4" refnumber="72-1-217(ii)">(ii)</xref>.</amend></subsection></subsection><subsection ssid="2-106" dnum="_-o:c-i" numlevel="1" lineno="201" slineno="2-161" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall report the findings of the studies described in Subsections <xref depth="4" refnumber="72-1-217(5)(a)">(5)(a)</xref> <ln numlevel="1" lineno="202" slineno="2-162"/>and <xref depth="4" refnumber="72-1-217(b)">(b)</xref> to the Transportation Interim Committee on or before November 1, 2026.</amend></subsection></subsection><subsection ssid="2-85" dnum="_-o:6-i" numlevel="1" lineno="203" slineno="2-163" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="2-112" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">the number of regions;</amend></subsection><subsection ssid="2-88" dnum="_-o:iii-i" numlevel="1" lineno="207" slineno="2-167" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the efficiency of the regions; and</amend></subsection><subsection ssid="2-89" dnum="_-o:iv-i" numlevel="1" lineno="208" slineno="2-168" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">the use of resources of each region.</amend></subsection></subsection><subsection ssid="2-113" and</subsection><subsection ssid="6-null-11" dnum="ii-o" numlevel="1" lineno="235" slineno="3-20" level="3" tab="1"><display>(ii)</display>subject to the restriction in Subsection <xref depth="4" refnumber="72-1-301(2)(b)" start="0">(2)(b)</xref>, three commissioners selected from <ln numlevel="1" lineno="236" slineno="3-21"/>the state at large.</subsection></subsection><subsection ssid="6-null-12" dnum="b-o" numlevel="1" lineno="237" slineno="3-22" level="2" space="false"><display>(b)</display><subsection ssid="6-null-13" dnum="i-o" level="3" placement="sameline"><display>(i)</display>At least one of the three commissioners appointed under Subsection <xref depth="4" refnumber="72-1-301(2)(a)(ii)" start="0">(2)(a)(ii)</xref> <ln numlevel="1" lineno="238" slineno="3-23"/>shall be selected from a rural county.</subsection><subsection ssid="6-null-14" dnum="ii-o" numlevel="1" lineno="239" slineno="3-24" level="3"><display>(ii)</display>For purposes of this Subsection <xref depth="4" refnumber="72-1-301(2)(b)" start="0">(2)(b)</xref>, a rural county is a county of the third, <ln numlevel="1" lineno="240" slineno="3-25"/>fourth, fifth, or sixth class.</subsection></subsection><subsection ssid="6-null-15" dnum="c-o" numlevel="1" lineno="241" slineno="3-26" level="2"><display>(c)</display>No more than two commissioners appointed under Subsection <xref depth="4" refnumber="72-1-301(2)(a)" start="0">(2)(a)</xref> may be selected <ln numlevel="1" lineno="242" slineno="3-27"/>from any one of the four regions established by the department.</subsection></subsection><subsection ssid="6-null-16" dnum="3-o" numlevel="1" lineno="243" slineno="3-28" level="1"><display>(3)</display>A member may not receive compensation or benefits for the member's service, but may <ln numlevel="1" lineno="244" slineno="3-29"/>receive per diem and travel expenses in accordance with:<subsection ssid="6-null-17" dnum="a-o" numlevel="1" lineno="245" slineno="3-30" level="2"><display>(a)</display>Section <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref>;</subsection><subsection ssid="6-null-18" dnum="b-o" numlevel="1" lineno="246" slineno="3-31" level="2"><display>(b)</display>Section <xref depth="3" refnumber="63A-3-107" start="0">63A-3-107</xref>; and</subsection><subsection ssid="6-null-19" dnum="c-o" numlevel="1" lineno="247" slineno="3-32" level="2"><display>(c)</display>rules made by the Division of Finance<amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> in accordance with</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/> Sections <xref depth="3" refnumber="63A-3-106" start="0"><ln numlevel="1" lineno="248" slineno="3-33"/>63A-3-106</xref> and <xref depth="3" refnumber="63A-3-107" start="0">63A-3-107</xref>.</subsection></subsection><subsection ssid="6-null-20" dnum="4-o" numlevel="1" lineno="249" slineno="3-34" level="1" space="false"><display>(4)</display><subsection ssid="6-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>One member of the commission shall be designated by the governor as chair.</subsection><subsection ssid="6-null-22" dnum="b-o" numlevel="1" lineno="250" slineno="3-35" level="2"><display>(b)</display>The commission may select one member as vice chair to act in the chair's absence.</subsection></subsection><subsection ssid="6-null-23" dnum="5-o" numlevel="1" lineno="251" slineno="3-36" level="1"><display>(5)</display>Any four commissioners constitute a quorum.</subsection><subsection ssid="6-null-24" dnum="6-o" numlevel="1" lineno="252" slineno="3-37" level="1"><display>(6)</display>Each member of the commission shall qualify by taking the constitutional oath of office.</subsection><subsection ssid="6-null-25" dnum="7-o" numlevel="1" lineno="253" slineno="3-38" level="1"><display>(7)</display>Each member of the commission is subject to the conflict of interest provisions <ln numlevel="1" lineno="254" slineno="3-39"/>described in <xref depth="2" refnumber="63G-24-3" start="0">Title 63G, Chapter 24, Part 3, Conflicts of Interest</xref>.</subsection><subsection ssid="6-null-26" dnum="8-o" numlevel="1" lineno="255" slineno="3-40" level="1"><display>(8)</display>For the purposes of Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, the commission is not considered an agency.</subsection></section></bsec><bsec buid="4" num="72-1-303" type="amend" src="code" uid="C72-1-S303_2026050620260506" sort="72 01 03030020260506" numlevel="1" lineno="256" slineno="4-1" sn="4"><section number="72-1-303" numlevel="1" lineno="257" slineno="4-2" type="amend"><secline lineno="256">Section 4. Section <bold>72-1-303</bold> is amended to read:</secline><catline lineno="257"><bold>72-1-303<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Duties of commission.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="258" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>The commission has the following duties:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="259" slineno="4-4" level="2"><display>(a)</display>determining priorities and funding levels of projects and programs in the state <ln numlevel="1" lineno="260" slineno="4-5"/>transportation systems and the capital development of new public transit facilities for <ln numlevel="1" lineno="261" slineno="4-6"/>each fiscal year based on project lists compiled by the department and taking into <ln numlevel="1" lineno="262" slineno="4-7"/>consideration the strategic initiatives described in Section <xref depth="3" refnumber="72-1-211">72-1-211</xref>;</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="263" slineno="4-8" level="2"><display>(b)</display>determining additions and deletions to state highways under Chapter 4, Designation <ln numlevel="1" lineno="264" slineno="4-9"/>of State Highways Act;</subsection><subsection ssid="4-null-4" dnum="c-o" numlevel="1" lineno="265" slineno="4-10" level="2"><display>(c)</display>holding public meetings and otherwise providing for public input in transportation <ln numlevel="1" lineno="266" slineno="4-11"/>matters;</subsection><subsection ssid="4-null-5" dnum="d-o" numlevel="1" lineno="267" slineno="4-12" level="2"><display>(d)</display>making policies and rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="268" slineno="4-13"/>Administrative Rulemaking Act, necessary to perform the commission's duties <ln numlevel="1" lineno="269" slineno="4-14"/>described under this section;</subsection><subsection ssid="4-null-6" dnum="e-o" numlevel="1" lineno="270" slineno="4-15" level="2"><display>(e)</display>in accordance with Section <xref depth="3" refnumber="63G-4-301">63G-4-301</xref>, reviewing orders issued by the executive <ln numlevel="1" lineno="271" slineno="4-16"/>director in adjudicative proceedings held in accordance with Title 63G, Chapter 4, <ln numlevel="1" lineno="272" slineno="4-17"/>Administrative Procedures Act;</subsection><subsection ssid="4-null-7" dnum="f-o" numlevel="1" lineno="273" slineno="4-18" level="2"><display>(f)</display>advising the department on state transportation systems policy;</subsection><subsection ssid="4-null-8" dnum="g-o" numlevel="1" lineno="274" slineno="4-19" level="2"><display>(g)</display>approving settlement agreements of condemnation cases subject to Section <xref depth="3" refnumber="63G-10-401"><ln numlevel="1" lineno="275" slineno="4-20"/>63G-10-401</xref>;</subsection><subsection ssid="4-null-9" dnum="h-o" numlevel="1" lineno="276" slineno="4-21" level="2"><display>(h)</display>in accordance with Section <xref depth="3" refnumber="17B-2a-807">17B-2a-807</xref>, appointing a commissioner to serve as a <ln numlevel="1" lineno="277" slineno="4-22"/>nonvoting member or a voting member on the board of trustees of a<amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both"> small</amend> public <ln numlevel="1" lineno="278" slineno="4-23"/>transit district;</subsection><subsection ssid="4-null-10" dnum="i-o" numlevel="1" lineno="279" slineno="4-24" level="2"><display>(i)</display>in accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">Section</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Sections</amend> <xref depth="3" refnumber="17B-2a-808">17B-2a-808</xref><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both"> and <xref depth="3" refnumber="17B-2a-808.1">17B-2a-808.1</xref></amend>, reviewing, at <ln numlevel="1" lineno="280" slineno="4-25"/>least annually, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="41" style="2" owner="jchristopherson" level="1" deltag="both">short-term and long-range public transit plans</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">plans submitted by <ln numlevel="1" lineno="281" slineno="4-26"/>small and large public transit districts</amend>; </subsection><subsection ssid="4-null-11" dnum="j-o" numlevel="1" lineno="282" slineno="4-27" level="2"><display>(j)</display>determining the priorities and funding levels of public transit innovation grants, as <ln numlevel="1" lineno="283" slineno="4-28"/>defined in Section <xref depth="3" refnumber="72-2-401">72-2-401</xref>;</subsection><subsection ssid="4-null-12" dnum="k-o" numlevel="1" lineno="284" slineno="4-29" level="2"><display>(k)</display>approving grant awards administered by the Utah Broadband Center in accordance <ln numlevel="1" lineno="285" slineno="4-30"/>with Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both">17-19-301</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="3" refnumber="72-19-301">72-19-301</xref></amend>; and</subsection><subsection ssid="4-null-13" dnum="l-o" numlevel="1" lineno="286" slineno="4-31" level="2"><display>(l)</display>reviewing administrative rules made, substantively amended, or repealed by the <ln numlevel="1" lineno="287" slineno="4-32"/>department.</subsection></subsection><subsection ssid="4-null-14" dnum="2-o" numlevel="1" lineno="288" slineno="4-33" level="1" space="false"><display>(2)</display><subsection ssid="4-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">For projects prioritized with funding provided under Sections <xref depth="3" refnumber="72-2-124">72-2-124</xref> and <xref depth="3" refnumber="72-2-125"><ln numlevel="1" lineno="289" slineno="4-34"/>72-2-125</xref>, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The</amend> commission shall annually report to the Transportation and <ln numlevel="1" lineno="290" slineno="4-35"/>Infrastructure Appropriations Subcommittee:<subsection ssid="4-null-16" dnum="i-o" numlevel="1" lineno="291" slineno="4-36" level="3" tab="1"><display>(i)</display>a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">prioritized </amend><amendoutend style="2"/>list of the new transportation capacity projects in the state <ln numlevel="1" lineno="292" slineno="4-37"/>transportation system and the funding levels <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">available </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or shortages </amend>for those <ln numlevel="1" lineno="293" slineno="4-38"/>projects; and</subsection><subsection ssid="4-null-17" dnum="ii-o" numlevel="1" lineno="294" slineno="4-39" level="3" tab="1"><display>(ii)</display>the unfunded highway construction and maintenance needs within the state.</subsection></subsection><subsection ssid="4-null-18" dnum="b-o" numlevel="1" lineno="295" slineno="4-40" level="2"><display>(b)</display>The Transportation and Infrastructure Appropriations Subcommittee shall:<subsection ssid="4-null-19" dnum="i-o" numlevel="1" lineno="296" slineno="4-41" level="3"><display>(i)</display>review the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both">list </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">information </amend>reported by the Transportation Commission; and</subsection><subsection ssid="4-null-20" dnum="ii-o" numlevel="1" lineno="297" slineno="4-42" level="3"><display>(ii)</display>make a recommendation to the Legislature on:<subsection ssid="4-null-21" dnum="A-o" numlevel="1" lineno="298" slineno="4-43" level="4"><display>(A)</display>the amount of additional funding to allocate to transportation; and</subsection><subsection ssid="4-null-22" dnum="B-o" numlevel="1" lineno="299" slineno="4-44" level="4"><display>(B)</display>the source of revenue for the additional funding allocation under Subsection <xref depth="4" refnumber="72-1-303(2)(b)(ii)(a)"><ln numlevel="1" lineno="300" slineno="4-45"/>(2)(b)(ii)(A)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="4-null-23" dnum="3-o" numlevel="1" lineno="301" slineno="4-46" level="1"><display>(3)</display>The commission shall review and may approve plans for the construction of a highway <ln numlevel="1" lineno="302" slineno="4-47"/>facility over sovereign lakebed lands in accordance with Chapter 6, Part 3, Approval of <ln numlevel="1" lineno="303" slineno="4-48"/>Highway Facilities on Sovereign Lands Act.</subsection><subsection ssid="4-null-24" dnum="4-o" numlevel="1" lineno="304" slineno="4-49" level="1"><display>(4)</display>One or more associations representing airport operators or pilots in the state shall <ln numlevel="1" lineno="305" slineno="4-50"/>annually report to the commission recommended airport improvement projects and any <ln numlevel="1" lineno="306" slineno="4-51"/>other information related to the associations' expertise and relevant to the commission's <ln numlevel="1" lineno="307" slineno="4-52"/>duties.</subsection></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="308" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="308">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="309"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-19-25 4:24 PM</tm></rev></foot></leg>
