Section <bold>4-45-104</bold> is amended to read:</secline><catline lineno="27"><bold>4-45-104<parens/>. Kratom processor requirements -- Criminal penalty.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>A kratom processor may not prepare, distribute, sell, or offer for sale a kratom product:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="29" slineno="1-4" level="2"><display>(a)</display>that is mixed or packed with a nonkratom substance that affects the quality or <ln numlevel="1" lineno="30" slineno="1-5"/>strength of the kratom product to such a degree as to render the kratom product <ln numlevel="1" lineno="31" slineno="1-6"/>injurious to a consumer;</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="32" slineno="1-7" level="2"><display>(b)</display>that contains a poisonous or otherwise deleterious nonkratom ingredient, including a <ln numlevel="1" lineno="33" slineno="1-8"/>controlled substance as defined in Section <xref depth="3" refnumber="58-37-2" start="0">58-37-2</xref>;</subsection><subsection ssid="8-null-4" dnum="c-o" numlevel="1" lineno="34" slineno="1-9" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">containing a level of 7-hydroxymitragynine in the alkaloid fraction that is greater <ln numlevel="1" lineno="35" slineno="1-10"/>than 2% of the alkaloid composition of the kratom product</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that would be considered <ln numlevel="1" lineno="36" slineno="1-11"/>a controlled substance under Section <xref depth="3" refnumber="58-37-4">58-37-4</xref></amend>;</subsection><subsection ssid="8-null-5" dnum="d-o" numlevel="1" lineno="37" slineno="1-12" level="2"><display>(d)</display>containing a synthetic alkaloid, including synthetic mitragynine, synthetic <ln numlevel="1" lineno="38" slineno="1-13"/>7-hydroxymitragynine, or any other synthetically derived compound of the kratom <ln numlevel="1" lineno="39" slineno="1-14"/>plant; or</subsection><subsection ssid="8-null-6" dnum="e-o" numlevel="1" lineno="40" slineno="1-15" level="2"><display>(e)</display>that does not include a product label on the kratom product packaging that states the <ln numlevel="1" lineno="41" slineno="1-16"/>amount of mitragynine and 7-hydroxymitragynine contained in the packaged kratom <ln numlevel="1" lineno="42" slineno="1-17"/>product.</subsection></subsection><subsection ssid="8-null-7" dnum="2-o" numlevel="1" lineno="43" slineno="1-18" level="1"><display>(2)</display>A kratom processor who violates Subsection <xref depth="4" refnumber="4-45-104(1)" start="0">(1)</xref> is guilty of a class C misdemeanor for <ln numlevel="1" lineno="44" slineno="1-19"/>each violation.</subsection><subsection ssid="8-null-8" dnum="3-o" numlevel="1" lineno="45" slineno="1-20" level="1"><display>(3)</display>A kratom processor does not violate Subsection <xref depth="4" refnumber="4-45-104(1)" start="0">(1)</xref> if the kratom processor shows by a <ln numlevel="1" lineno="46" slineno="1-21"/>preponderance of the evidence that the kratom processor relied in good faith upon the <ln numlevel="1" lineno="47" slineno="1-22"/>representation of a manufacturer, processor, packer, or distributor of food represented to <ln numlevel="1" lineno="48" slineno="1-23"/>be a kratom product.</subsection><subsection ssid="8-null-9" dnum="4-o" numlevel="1" lineno="49" slineno="1-24" level="1"><display>(4)</display>A kratom processor may not prepare, distribute, sell, or offer for sale a kratom product <ln numlevel="1" lineno="50" slineno="1-25"/>that is not registered with the department in accordance with this chapter.</subsection><subsection ssid="8-null-10" dnum="5-o" numlevel="1" lineno="51" slineno="1-26" level="1"><display>(5)</display>A kratom processor shall register as a food establishment in accordance with Section <xref depth="3" refnumber="4-5-301" start="0"><ln numlevel="1" lineno="52" slineno="1-27"/>4-5-301</xref>.</subsection></section></bsec><bsec buid="3" num="58-37-2" type="amend" src="code" uid="C58-37-S2_1800010118000101" sort="58 37 00020018000101" numlevel="1" lineno="53" slineno="2-1" sn="2"><section number="58-37-2" numlevel="1" lineno="54" slineno="2-2" type="amend"><secline lineno="53">Section 2. Section <bold>58-37-2</bold> is amended to read:</secline><catline lineno="54"><bold>58-37-2<parens/>. Definitions.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="55" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this chapter:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="56" slineno="2-4" level="2"><display>(a)</display>"Administer" means the direct application of a controlled substance, whether by <ln numlevel="1" lineno="57" slineno="2-5"/>injection, inhalation, ingestion, or any other means, to the body of a patient or <ln numlevel="1" lineno="58" slineno="2-6"/>research subject by:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="59" slineno="2-7" level="3"><display>(i)</display>a practitioner or, in the practitioner's presence, by the practitioner's authorized <ln numlevel="1" lineno="60" slineno="2-8"/>agent; or</subsection><subsection ssid="3-null-4" dnum="ii-o" numlevel="1" lineno="61" slineno="2-9" level="3"><display>(ii)</display>the patient or research subject at the direction and in the presence of the <ln numlevel="1" lineno="62" slineno="2-10"/>practitioner.</subsection></subsection><subsection ssid="3-null-5" dnum="b-o" numlevel="1" lineno="63" slineno="2-11" level="2"><display>(b)</display>"Agent" means an authorized person who acts on behalf of or at the direction of a <ln numlevel="1" lineno="64" slineno="2-12"/>manufacturer, distributor, or practitioner but does not include a motor carrier, public <ln numlevel="1" lineno="65" slineno="2-13"/>warehouseman, or employee of any of them.</subsection><subsection ssid="3-null-6" dnum="c-o" numlevel="1" lineno="66" slineno="2-14" level="2"><display>(c)</display>"Consumption" means ingesting or having any measurable amount of a controlled <ln numlevel="1" lineno="67" slineno="2-15"/>substance in a person's body, but this Subsection <xref depth="4" refnumber="58-37-2(1)(c)">(1)(c)</xref> does not include the <ln numlevel="1" lineno="68" slineno="2-16"/>metabolite of a controlled substance.</subsection><subsection ssid="3-null-7" dnum="d-o" numlevel="1" lineno="69" slineno="2-17" level="2"><display>(d)</display>"Continuing criminal enterprise" means any individual, sole proprietorship, <ln numlevel="1" lineno="70" slineno="2-18"/>partnership, corporation, business trust, association, or other legal entity, and any <ln numlevel="1" lineno="71" slineno="2-19"/>union or groups of individuals associated in fact although not a legal entity, and <ln numlevel="1" lineno="72" slineno="2-20"/>includes illicit as well as licit entities created or maintained for the purpose of <ln numlevel="1" lineno="73" slineno="2-21"/>engaging in conduct which constitutes the commission of episodes of activity made <ln numlevel="1" lineno="74" slineno="2-22"/>unlawful by this chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter 37b, <ln numlevel="1" lineno="75" slineno="2-23"/>Imitation Controlled Substances Act, Chapter 37c, Utah Controlled Substance <ln numlevel="1" lineno="76" slineno="2-24"/>Precursor Act, or Chapter 37d, Clandestine Drug Lab Act, which episodes are not <ln numlevel="1" lineno="77" slineno="2-25"/>isolated, but have the same or similar purposes, results, participants, victims, methods <ln numlevel="1" lineno="78" slineno="2-26"/>of commission, or otherwise are interrelated by distinguishing characteristics.  Taken <ln numlevel="1" lineno="79" slineno="2-27"/>together, the episodes shall demonstrate continuing unlawful conduct and be related <ln numlevel="1" lineno="80" slineno="2-28"/>either to each other or to the enterprise.</subsection><subsection ssid="3-null-8" dnum="e-o" numlevel="1" lineno="81" slineno="2-29" level="2"><display>(e)</display>"Control" means to add, remove, or change the placement of a drug, substance, or <ln numlevel="1" lineno="82" slineno="2-30"/>immediate precursor under Section <xref depth="3" refnumber="58-37-3">58-37-3</xref>.</subsection><subsection ssid="3-null-9" dnum="f-o" numlevel="1" lineno="83" slineno="2-31" level="2" space="false"><display>(f)</display><subsection ssid="3-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Controlled substance" means a drug or substance:<subsection ssid="3-null-11" dnum="A-o" numlevel="1" lineno="84" slineno="2-32" level="4" tab="1"><display>(A)</display>included in Schedules I, II, III, IV, or V of Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>;</subsection><subsection ssid="3-null-12" dnum="B-o" numlevel="1" lineno="85" slineno="2-33" level="4" tab="1"><display>(B)</display>included in Schedules I, II, III, IV, or V of the federal Controlled Substances <ln numlevel="1" lineno="86" slineno="2-34"/>Act, Title II, P.L. 91-513;</subsection><subsection ssid="3-null-13" dnum="C-o" numlevel="1" lineno="87" slineno="2-35" level="4" tab="1"><display>(C)</display>that is a controlled substance analog; or</subsection><subsection ssid="3-null-14" dnum="D-o" numlevel="1" lineno="88" slineno="2-36" level="4" tab="1"><display>(D)</display>listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>.</subsection></subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="89" slineno="2-37" level="3"><display>(ii)</display>"Controlled substance" does not include:<subsection ssid="3-null-16" dnum="A-o" numlevel="1" lineno="90" slineno="2-38" level="4"><display>(A)</display>distilled spirits, wine, or malt beverages, as those terms are defined in Title <ln numlevel="1" lineno="91" slineno="2-39"/>32B, Alcoholic Beverage Control Act;</subsection><subsection ssid="3-null-17" dnum="B-o" numlevel="1" lineno="92" slineno="2-40" level="4"><display>(B)</display>any drug intended for lawful use in the diagnosis, cure, mitigation, treatment, <ln numlevel="1" lineno="93" slineno="2-41"/>or prevention of disease in human or other animals, which contains ephedrine, <ln numlevel="1" lineno="94" slineno="2-42"/>pseudoephedrine, norpseudoephedrine, or phenylpropanolamine if the drug is <ln numlevel="1" lineno="95" slineno="2-43"/>lawfully purchased, sold, transferred, or furnished as an over-the-counter <ln numlevel="1" lineno="96" slineno="2-44"/>medication without prescription; or</subsection><subsection ssid="3-null-18" dnum="C-o" numlevel="1" lineno="97" slineno="2-45" level="4"><display>(C)</display>dietary supplements, vitamins, minerals, herbs, or other similar substances <ln numlevel="1" lineno="98" slineno="2-46"/>including concentrates or extracts, which:<subsection ssid="3-null-19" dnum="I-o" numlevel="1" lineno="99" slineno="2-47" level="5"><display>(I)</display>are not otherwise regulated by law; and</subsection><subsection ssid="3-null-20" dnum="II-o" numlevel="1" lineno="100" slineno="2-48" level="5"><display>(II)</display>may contain naturally occurring amounts of chemical or substances listed <ln numlevel="1" lineno="101" slineno="2-49"/>in this chapter, or in rules adopted pursuant to Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="102" slineno="2-50"/>Administrative Rulemaking Act.</subsection></subsection></subsection></subsection><subsection ssid="3-null-21" dnum="g-o" numlevel="1" lineno="103" slineno="2-51" level="2" space="false"><display>(g)</display><subsection ssid="3-null-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Controlled substance analog" means:<subsection ssid="3-null-23" dnum="A-o" numlevel="1" lineno="104" slineno="2-52" level="4" tab="1"><display>(A)</display>a substance the chemical structure of which is substantially similar to the <ln numlevel="1" lineno="105" slineno="2-53"/>chemical structure of a controlled substance listed in Schedules I and II of <ln numlevel="1" lineno="106" slineno="2-54"/>Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>, a substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>, or in Schedules I and <ln numlevel="1" lineno="107" slineno="2-55"/>II of the federal Controlled Substances Act, Title II, P.L. 91-513;</subsection><subsection ssid="3-null-24" dnum="B-o" numlevel="1" lineno="108" slineno="2-56" level="4" tab="1"><display>(B)</display>a substance that has a stimulant, depressant, or hallucinogenic effect on the <ln numlevel="1" lineno="109" slineno="2-57"/>central nervous system substantially similar to the stimulant, depressant, or <ln numlevel="1" lineno="110" slineno="2-58"/>hallucinogenic effect on the central nervous system of controlled substances <ln numlevel="1" lineno="111" slineno="2-59"/>listed in Schedules I and II of Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>, substances listed in Section <xref depth="3" refnumber="58-37-4.2"><ln numlevel="1" lineno="112" slineno="2-60"/>58-37-4.2</xref>, or substances listed in Schedules I and II of the federal Controlled <ln numlevel="1" lineno="113" slineno="2-61"/>Substances Act, Title II, P.L. 91-513; or</subsection><subsection ssid="3-null-25" dnum="C-o" numlevel="1" lineno="114" slineno="2-62" level="4" tab="1"><display>(C)</display>A substance that, with respect to a particular individual, is represented or <ln numlevel="1" lineno="115" slineno="2-63"/>intended to have a stimulant, depressant, or hallucinogenic effect on the central <ln numlevel="1" lineno="116" slineno="2-64"/>nervous system substantially similar to the stimulant, depressant, or <ln numlevel="1" lineno="117" slineno="2-65"/>hallucinogenic effect on the central nervous system of controlled substances <ln numlevel="1" lineno="118" slineno="2-66"/>listed in Schedules I and II of Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>, substances listed in Section <xref depth="3" refnumber="58-37-4.2"><ln numlevel="1" lineno="119" slineno="2-67"/>58-37-4.2</xref>, or substances listed in Schedules I and II of the federal Controlled <ln numlevel="1" lineno="120" slineno="2-68"/>Substances Act, Title II, P.L. 91-513.</subsection></subsection><subsection ssid="3-null-26" dnum="ii-o" numlevel="1" lineno="121" slineno="2-69" level="3"><display>(ii)</display>"Controlled substance analog" does not include:<subsection ssid="3-null-27" dnum="A-o" numlevel="1" lineno="122" slineno="2-70" level="4"><display>(A)</display>a controlled substance currently scheduled in Schedules I through V of <ln numlevel="1" lineno="123" slineno="2-71"/>Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>;</subsection><subsection ssid="3-null-28" dnum="B-o" numlevel="1" lineno="124" slineno="2-72" level="4"><display>(B)</display>a substance for which there is an approved new drug application;</subsection><subsection ssid="3-null-29" dnum="C-o" numlevel="1" lineno="125" slineno="2-73" level="4"><display>(C)</display>a substance with respect to which an exemption is in effect for investigational <ln numlevel="1" lineno="126" slineno="2-74"/>use by a particular person under Section 505 of the Food, Drug, and Cosmetic <ln numlevel="1" lineno="127" slineno="2-75"/>Act, 21 U.S.C. 355, to the extent the conduct with respect to the substance is <ln numlevel="1" lineno="128" slineno="2-76"/>permitted by the exemption;</subsection><subsection ssid="3-null-30" dnum="D-o" numlevel="1" lineno="129" slineno="2-77" level="4"><display>(D)</display>any substance to the extent not intended for human consumption before an <ln numlevel="1" lineno="130" slineno="2-78"/>exemption takes effect with respect to the substance;</subsection><subsection ssid="3-null-31" dnum="E-o" numlevel="1" lineno="131" slineno="2-79" level="4"><display>(E)</display>any drug intended for lawful use in the diagnosis, cure, mitigation, treatment, <ln numlevel="1" lineno="132" slineno="2-80"/>or prevention of disease in man or other animals, which contains ephedrine, <ln numlevel="1" lineno="133" slineno="2-81"/>pseudoephedrine, norpseudoephedrine, or phenylpropanolamine if the drug is <ln numlevel="1" lineno="134" slineno="2-82"/>lawfully purchased, sold, transferred, or furnished as an over-the-counter <ln numlevel="1" lineno="135" slineno="2-83"/>medication without prescription; or</subsection><subsection ssid="3-null-32" dnum="F-o" numlevel="1" lineno="136" slineno="2-84" level="4"><display>(F)</display>dietary supplements, vitamins, minerals, herbs, or other similar substances <ln numlevel="1" lineno="137" slineno="2-85"/>including concentrates or extracts, which are not otherwise regulated by law, <ln numlevel="1" lineno="138" slineno="2-86"/>which may contain naturally occurring amounts of chemical or substances <ln numlevel="1" lineno="139" slineno="2-87"/>listed in this chapter, or in rules adopted pursuant to Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="140" slineno="2-88"/>Administrative Rulemaking Act.</subsection></subsection></subsection><subsection ssid="3-null-33" dnum="h-o" numlevel="1" lineno="141" slineno="2-89" level="2" space="false"><display>(h)</display><subsection ssid="3-null-34" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Conviction" means a determination of guilt by verdict, whether jury or bench, <ln numlevel="1" lineno="142" slineno="2-90"/>or plea, whether guilty or no contest, for any offense proscribed by:<subsection ssid="3-null-35" dnum="A-o" numlevel="1" lineno="143" slineno="2-91" level="4" tab="1"><display>(A)</display>this chapter;</subsection><subsection ssid="3-null-36" dnum="B-o" numlevel="1" lineno="144" slineno="2-92" level="4" tab="1"><display>(B)</display>Chapter 37a, Utah Drug Paraphernalia Act;</subsection><subsection ssid="3-null-37" dnum="C-o" numlevel="1" lineno="145" slineno="2-93" level="4" tab="1"><display>(C)</display>Chapter 37b, Imitation Controlled Substances Act;</subsection><subsection ssid="3-null-38" dnum="D-o" numlevel="1" lineno="146" slineno="2-94" level="4" tab="1"><display>(D)</display>Chapter 37c, Utah Controlled Substance Precursor Act; or</subsection><subsection ssid="3-null-39" dnum="E-o" numlevel="1" lineno="147" slineno="2-95" level="4" tab="1"><display>(E)</display>Chapter 37d, Clandestine Drug Lab Act; or</subsection></subsection><subsection ssid="3-null-40" dnum="ii-o" numlevel="1" lineno="148" slineno="2-96" level="3"><display>(ii)</display>for any offense under the laws of the United States and any other state which, if <ln numlevel="1" lineno="149" slineno="2-97"/>committed in this state, would be an offense under:<subsection ssid="3-null-41" dnum="A-o" numlevel="1" lineno="150" slineno="2-98" level="4"><display>(A)</display>this chapter;</subsection><subsection ssid="3-null-42" dnum="B-o" numlevel="1" lineno="151" slineno="2-99" level="4"><display>(B)</display>Chapter 37a, Utah Drug Paraphernalia Act;</subsection><subsection ssid="3-null-43" dnum="C-o" numlevel="1" lineno="152" slineno="2-100" level="4"><display>(C)</display>Chapter 37b, Imitation Controlled Substances Act;</subsection><subsection ssid="3-null-44" dnum="D-o" numlevel="1" lineno="153" slineno="2-101" level="4"><display>(D)</display>Chapter 37c, Utah Controlled Substance Precursor Act; or</subsection><subsection ssid="3-null-45" dnum="E-o" numlevel="1" lineno="154" slineno="2-102" level="4"><display>(E)</display>Chapter 37d, Clandestine Drug Lab Act.</subsection></subsection></subsection><subsection ssid="3-null-46" dnum="i-o" numlevel="1" lineno="155" slineno="2-103" level="2"><display>(i)</display>"Counterfeit substance" means:<subsection ssid="3-null-47" dnum="i-o" numlevel="1" lineno="156" slineno="2-104" level="3"><display>(i)</display>any controlled substance or container or labeling of any controlled substance that:<subsection ssid="3-null-48" dnum="A-o" numlevel="1" lineno="157" slineno="2-105" level="4"><display>(A)</display>without authorization bears the trademark, trade name, or other identifying <ln numlevel="1" lineno="158" slineno="2-106"/>mark, imprint, number, device, or any likeness of them, of a manufacturer, <ln numlevel="1" lineno="159" slineno="2-107"/>distributor, or dispenser other than the person or persons who in fact <ln numlevel="1" lineno="160" slineno="2-108"/>manufactured, distributed, or dispensed the substance which falsely purports to <ln numlevel="1" lineno="161" slineno="2-109"/>be a controlled substance distributed by any other manufacturer, distributor, or <ln numlevel="1" lineno="162" slineno="2-110"/>dispenser; and</subsection><subsection ssid="3-null-49" dnum="B-o" numlevel="1" lineno="163" slineno="2-111" level="4"><display>(B)</display>a reasonable person would believe to be a controlled substance distributed by <ln numlevel="1" lineno="164" slineno="2-112"/>an authorized manufacturer, distributor, or dispenser based on the appearance <ln numlevel="1" lineno="165" slineno="2-113"/>of the substance as described under Subsection <xref depth="4" refnumber="58-37-2(1)(i)(i)(a)">(1)(i)(i)(A)</xref> or the appearance of <ln numlevel="1" lineno="166" slineno="2-114"/>the container of that controlled substance; or</subsection></subsection><subsection ssid="3-null-50" dnum="ii-o" numlevel="1" lineno="167" slineno="2-115" level="3"><display>(ii)</display>any substance other than under Subsection <xref depth="4" refnumber="58-37-2(1)(i)(i)">(1)(i)(i)</xref> that:<subsection ssid="3-null-51" dnum="A-o" numlevel="1" lineno="168" slineno="2-116" level="4"><display>(A)</display>is falsely represented to be any legally or illegally manufactured controlled <ln numlevel="1" lineno="169" slineno="2-117"/>substance; and</subsection><subsection ssid="3-null-52" dnum="B-o" numlevel="1" lineno="170" slineno="2-118" level="4"><display>(B)</display>a reasonable person would believe to be a legal or illegal controlled substance.</subsection></subsection></subsection><subsection ssid="3-null-53" dnum="j-o" numlevel="1" lineno="171" slineno="2-119" level="2"><display>(j)</display>"Deliver" or "delivery" means the actual, constructive, or attempted transfer of a <ln numlevel="1" lineno="172" slineno="2-120"/>controlled substance or a listed chemical, whether or not an agency relationship exists.</subsection><subsection ssid="3-null-54" dnum="k-o" numlevel="1" lineno="173" slineno="2-121" level="2"><display>(k)</display>"Department" means the Department of Commerce.</subsection><subsection ssid="3-null-55" dnum="l-o" numlevel="1" lineno="174" slineno="2-122" level="2"><display>(l)</display>"Depressant or stimulant substance" means:<subsection ssid="3-null-56" dnum="i-o" numlevel="1" lineno="175" slineno="2-123" level="3"><display>(i)</display>a drug which contains any quantity of barbituric acid or any of the salts of <ln numlevel="1" lineno="176" slineno="2-124"/>barbituric acid;</subsection><subsection ssid="3-null-57" dnum="ii-o" numlevel="1" lineno="177" slineno="2-125" level="3"><display>(ii)</display>a drug which contains any quantity of:<subsection ssid="3-null-58" dnum="A-o" numlevel="1" lineno="178" slineno="2-126" level="4"><display>(A)</display>amphetamine or any of its optical isomers;</subsection><subsection ssid="3-null-59" dnum="B-o" numlevel="1" lineno="179" slineno="2-127" level="4"><display>(B)</display>any salt of amphetamine or any salt of an optical isomer of amphetamine; or</subsection><subsection ssid="3-null-60" dnum="C-o" numlevel="1" lineno="180" slineno="2-128" level="4"><display>(C)</display>any substance which the Secretary of Health and Human Services or the <ln numlevel="1" lineno="181" slineno="2-129"/>Attorney General of the United States after investigation has found and by <ln numlevel="1" lineno="182" slineno="2-130"/>regulation designated habit-forming because of its stimulant effect on the <ln numlevel="1" lineno="183" slineno="2-131"/>central nervous system;</subsection></subsection><subsection ssid="3-null-61" dnum="iii-o" numlevel="1" lineno="184" slineno="2-132" level="3"><display>(iii)</display>lysergic acid diethylamide; or</subsection><subsection ssid="3-null-62" dnum="iv-o" numlevel="1" lineno="185" slineno="2-133" level="3"><display>(iv)</display>any drug which contains any quantity of a substance which the Secretary of <ln numlevel="1" lineno="186" slineno="2-134"/>Health and Human Services or the Attorney General of the United States after <ln numlevel="1" lineno="187" slineno="2-135"/>investigation has found to have, and by regulation designated as having, a <ln numlevel="1" lineno="188" slineno="2-136"/>potential for abuse because of its depressant or stimulant effect on the central <ln numlevel="1" lineno="189" slineno="2-137"/>nervous system or its hallucinogenic effect.</subsection></subsection><subsection ssid="3-null-63" dnum="m-o" numlevel="1" lineno="190" slineno="2-138" level="2"><display>(m)</display>"Dispense" means the delivery of a controlled substance by a pharmacist to an <ln numlevel="1" lineno="191" slineno="2-139"/>ultimate user pursuant to the lawful order or prescription of a practitioner, and <ln numlevel="1" lineno="192" slineno="2-140"/>includes distributing to, leaving with, giving away, or disposing of that substance as <ln numlevel="1" lineno="193" slineno="2-141"/>well as the packaging, labeling, or compounding necessary to prepare the substance <ln numlevel="1" lineno="194" slineno="2-142"/>for delivery.</subsection><subsection ssid="3-null-64" dnum="n-o" numlevel="1" lineno="195" slineno="2-143" level="2"><display>(n)</display>"Dispenser" means a pharmacist who dispenses a controlled substance.</subsection><subsection ssid="3-null-65" dnum="o-o" numlevel="1" lineno="196" slineno="2-144" level="2"><display>(o)</display>"Distribute" means to deliver other than by administering or dispensing a controlled <ln numlevel="1" lineno="197" slineno="2-145"/>substance or a listed chemical.</subsection><subsection ssid="3-null-66" dnum="p-o" numlevel="1" lineno="198" slineno="2-146" level="2"><display>(p)</display>"Distributor" means a person who distributes controlled substances.</subsection><subsection ssid="3-null-67" dnum="q-o" numlevel="1" lineno="199" slineno="2-147" level="2"><display>(q)</display>"Division" means the Division of Professional Licensing created in Section <xref depth="3" refnumber="58-1-103">58-1-103</xref>.</subsection><subsection ssid="3-null-68" dnum="r-o" numlevel="1" lineno="200" slineno="2-148" level="2" space="false"><display>(r)</display><subsection ssid="3-null-69" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Drug" means:<subsection ssid="3-null-70" dnum="A-o" numlevel="1" lineno="201" slineno="2-149" level="4" tab="1"><display>(A)</display>a substance recognized in the official United States Pharmacopoeia, Official <ln numlevel="1" lineno="202" slineno="2-150"/>Homeopathic Pharmacopoeia of the United States, or Official National <ln numlevel="1" lineno="203" slineno="2-151"/>Formulary, or any supplement to any of them, intended for use in the <ln numlevel="1" lineno="204" slineno="2-152"/>diagnosis, cure, mitigation, treatment, or prevention of disease in humans or <ln numlevel="1" lineno="205" slineno="2-153"/>animals;</subsection><subsection ssid="3-null-71" dnum="B-o" numlevel="1" lineno="206" slineno="2-154" level="4" tab="1"><display>(B)</display>a substance that is required by any applicable federal or state law or rule to be <ln numlevel="1" lineno="207" slineno="2-155"/>dispensed by prescription only or is restricted to administration by practitioners <ln numlevel="1" lineno="208" slineno="2-156"/>only;</subsection><subsection ssid="3-null-72" dnum="C-o" numlevel="1" lineno="209" slineno="2-157" level="4" tab="1"><display>(C)</display>a substance other than food intended to affect the structure or any function of <ln numlevel="1" lineno="210" slineno="2-158"/>the body of humans or other animals; and</subsection><subsection ssid="3-null-73" dnum="D-o" numlevel="1" lineno="211" slineno="2-159" level="4" tab="1"><display>(D)</display>substances intended for use as a component of any substance specified in <ln numlevel="1" lineno="212" slineno="2-160"/>Subsections <xref depth="4" refnumber="58-37-2(1)(r)(i)(a)">(1)(r)(i)(A)</xref>, (B), and (C).</subsection></subsection><subsection ssid="3-null-74" dnum="ii-o" numlevel="1" lineno="213" slineno="2-161" level="3"><display>(ii)</display>"Drug" does not include dietary supplements.</subsection><subsection ssid="3-null-75" dnum="iii-o" numlevel="1" lineno="214" slineno="2-162" level="3"><display>(iii)</display>"Drug" includes a food intended for human consumption that intentionally <ln numlevel="1" lineno="215" slineno="2-163"/>contains a vaccine or vaccine material as provided in Section <xref depth="3" refnumber="4-5-107">4-5-107</xref>.</subsection></subsection><subsection ssid="3-null-76" dnum="s-o" numlevel="1" lineno="216" slineno="2-164" level="2"><display>(s)</display>"Drug dependent person" means any individual who unlawfully and habitually uses <ln numlevel="1" lineno="217" slineno="2-165"/>any controlled substance to endanger the public morals, health, safety, or welfare, or <ln numlevel="1" lineno="218" slineno="2-166"/>who is so dependent upon the use of controlled substances as to have lost the power <ln numlevel="1" lineno="219" slineno="2-167"/>of self-control with reference to the individual's dependency.</subsection><subsection ssid="3-null-77" dnum="t-o" numlevel="1" lineno="220" slineno="2-168" level="2" space="false"><display>(t)</display><subsection ssid="3-null-78" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Food" means:<subsection ssid="3-null-79" dnum="A-o" numlevel="1" lineno="221" slineno="2-169" level="4" tab="1"><display>(A)</display>any nutrient or substance of plant, mineral, or animal origin other than a drug <ln numlevel="1" lineno="222" slineno="2-170"/>as specified in this chapter, and normally ingested by human beings; and</subsection><subsection ssid="3-null-80" dnum="B-o" numlevel="1" lineno="223" slineno="2-171" level="4" tab="1"><display>(B)</display>foods for special dietary uses as exist by reason of a physical, physiological, <ln numlevel="1" lineno="224" slineno="2-172"/>pathological, or other condition including the conditions of disease, <ln numlevel="1" lineno="225" slineno="2-173"/>convalescence, pregnancy, lactation, allergy, hypersensitivity to food, <ln numlevel="1" lineno="226" slineno="2-174"/>underweight, and overweight; uses for supplying a particular dietary need <ln numlevel="1" lineno="227" slineno="2-175"/>which exist by reason of age including the ages of infancy and childbirth, and <ln numlevel="1" lineno="228" slineno="2-176"/>also uses for supplementing and for fortifying the ordinary or unusual diet with <ln numlevel="1" lineno="229" slineno="2-177"/>any vitamin, mineral, or other dietary property for use of a food.  </subsection></subsection><subsection ssid="3-null-81" dnum="ii-o" numlevel="1" lineno="230" slineno="2-178" level="3"><display>(ii)</display>Any particular use of a food is a special dietary use regardless of the nutritional <ln numlevel="1" lineno="231" slineno="2-179"/>purposes.</subsection></subsection><subsection ssid="3-null-82" dnum="u-o" numlevel="1" lineno="232" slineno="2-180" level="2"><display>(u)</display>"Immediate precursor" means a substance which the Attorney General of the United <ln numlevel="1" lineno="233" slineno="2-181"/>States has found to be, and by regulation designated as being, the principal compound <ln numlevel="1" lineno="234" slineno="2-182"/>used or produced primarily for use in the manufacture of a controlled substance, or <ln numlevel="1" lineno="235" slineno="2-183"/>which is an immediate chemical intermediary used or likely to be used in the <ln numlevel="1" lineno="236" slineno="2-184"/>manufacture of a controlled substance, the control of which is necessary to prevent, <ln numlevel="1" lineno="237" slineno="2-185"/>curtail, or limit the manufacture of the controlled substance.</subsection><subsection ssid="3-null-83" dnum="v-o" numlevel="1" lineno="238" slineno="2-186" level="2"><display>(v)</display>"Indian" means a member of an Indian tribe.</subsection><subsection ssid="3-null-84" dnum="w-o" numlevel="1" lineno="239" slineno="2-187" level="2"><display>(w)</display>"Indian religion" means a religion:<subsection ssid="3-null-85" dnum="i-o" numlevel="1" lineno="240" slineno="2-188" level="3"><display>(i)</display>the origin and interpretation of which is from within a traditional Indian culture or <ln numlevel="1" lineno="241" slineno="2-189"/>community; and</subsection><subsection ssid="3-null-86" dnum="ii-o" numlevel="1" lineno="242" slineno="2-190" level="3"><display>(ii)</display>that is practiced by Indians.</subsection></subsection><subsection ssid="3-null-87" dnum="x-o" numlevel="1" lineno="243" slineno="2-191" level="2"><display>(x)</display>"Indian tribe" means any tribe, band, nation, pueblo, or other organized group or <ln numlevel="1" lineno="244" slineno="2-192"/>community of Indians, including any Alaska Native village, which is legally <ln numlevel="1" lineno="245" slineno="2-193"/>recognized as eligible for and is consistent with the special programs, services, and <ln numlevel="1" lineno="246" slineno="2-194"/>entitlements provided by the United States to Indians because of their status as <ln numlevel="1" lineno="247" slineno="2-195"/>Indians.</subsection><subsection ssid="3-null-88" dnum="y-o" numlevel="1" lineno="248" slineno="2-196" level="2"><display>(y)</display>"Manufacture" means the production, preparation, propagation, compounding, or <ln numlevel="1" lineno="249" slineno="2-197"/>processing of a controlled substance, either directly or indirectly by extraction from <ln numlevel="1" lineno="250" slineno="2-198"/>substances of natural origin, or independently by means of chemical synthesis or by a <ln numlevel="1" lineno="251" slineno="2-199"/>combination of extraction and chemical synthesis.</subsection><subsection ssid="3-null-89" dnum="z-o" numlevel="1" lineno="252" slineno="2-200" level="2"><display>(z)</display>"Manufacturer" includes any person who packages, repackages, or labels any <ln numlevel="1" lineno="253" slineno="2-201"/>container of any controlled substance, except pharmacists who dispense or compound <ln numlevel="1" lineno="254" slineno="2-202"/>prescription orders for delivery to the ultimate consumer.</subsection><subsection ssid="3-null-90" dnum="aa-o" numlevel="1" lineno="255" slineno="2-203" level="2" space="false"><display>(aa)</display><subsection ssid="3-null-91" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Marijuana" means all species of the genus cannabis and all parts of the genus, <ln numlevel="1" lineno="256" slineno="2-204"/>whether growing or not, including:<subsection ssid="3-null-92" dnum="A-o" numlevel="1" lineno="257" slineno="2-205" level="4" tab="1"><display>(A)</display>seeds;</subsection><subsection ssid="3-null-93" dnum="B-o" numlevel="1" lineno="258" slineno="2-206" level="4" tab="1"><display>(B)</display>resin extracted from any part of the plant, including the resin extracted from <ln numlevel="1" lineno="259" slineno="2-207"/>the mature stalks;</subsection><subsection ssid="3-null-94" dnum="C-o" numlevel="1" lineno="260" slineno="2-208" level="4" tab="1"><display>(C)</display>every compound, manufacture, salt, derivative, mixture, or preparation of the <ln numlevel="1" lineno="261" slineno="2-209"/>plant, seeds, or resin;</subsection><subsection ssid="3-null-95" dnum="D-o" numlevel="1" lineno="262" slineno="2-210" level="4" tab="1"><display>(D)</display>any synthetic equivalents of the substances contained in the plant cannabis <ln numlevel="1" lineno="263" slineno="2-211"/>sativa or any other species of the genus cannabis which are chemically <ln numlevel="1" lineno="264" slineno="2-212"/>indistinguishable and pharmacologically active; and</subsection><subsection ssid="3-null-96" dnum="E-o" numlevel="1" lineno="265" slineno="2-213" level="4" tab="1"><display>(E)</display>any component part or cannabinoid extracted or isolated from the plant, <ln numlevel="1" lineno="266" slineno="2-214"/>including extracted or isolated tetrahydrocannabinols.</subsection></subsection><subsection ssid="3-null-97" dnum="ii-o" numlevel="1" lineno="267" slineno="2-215" level="3"><display>(ii)</display>"Marijuana" does not include:<subsection ssid="3-null-98" dnum="A-o" numlevel="1" lineno="268" slineno="2-216" level="4"><display>(A)</display>the mature stalks of the plant;</subsection><subsection ssid="3-null-99" dnum="B-o" numlevel="1" lineno="269" slineno="2-217" level="4"><display>(B)</display>fiber produced from the stalks;</subsection><subsection ssid="3-null-100" dnum="C-o" numlevel="1" lineno="270" slineno="2-218" level="4"><display>(C)</display>oil or cake made from the seeds of the plant;</subsection><subsection ssid="3-null-101" dnum="D-o" numlevel="1" lineno="271" slineno="2-219" level="4"><display>(D)</display>except as provided in Subsection <xref depth="4" refnumber="58-37-2(1)(aa)(i)">(1)(aa)(i)</xref>, any other compound, <ln numlevel="1" lineno="272" slineno="2-220"/>manufacture, salt, derivative, mixture, or preparation of the mature stalks, <ln numlevel="1" lineno="273" slineno="2-221"/>fiber, oil or cake;</subsection><subsection ssid="3-null-102" dnum="E-o" numlevel="1" lineno="274" slineno="2-222" level="4"><display>(E)</display>the sterilized seed of the plant which is incapable of germination;</subsection><subsection ssid="3-null-103" dnum="F-o" numlevel="1" lineno="275" slineno="2-223" level="4"><display>(F)</display>any compound, mixture, or preparation approved by the federal Food and <ln numlevel="1" lineno="276" slineno="2-224"/>Drug Administration under the federal Food, Drug, and Cosmetic Act, 21 <ln numlevel="1" lineno="277" slineno="2-225"/>U.S.C. Sec. 301 et seq. that is not listed in a schedule of controlled substances <ln numlevel="1" lineno="278" slineno="2-226"/>in Section <xref depth="3" refnumber="58-37-4">58-37-4</xref> or in the federal Controlled Substances Act, Title II, P.L. <ln numlevel="1" lineno="279" slineno="2-227"/>91-513; or</subsection><subsection ssid="3-null-104" dnum="G-o" numlevel="1" lineno="280" slineno="2-228" level="4"><display>(G)</display>transportable industrial hemp concentrate as that term is defined in Section <xref depth="3" refnumber="4-41-102"><ln numlevel="1" lineno="281" slineno="2-229"/>4-41-102</xref>.</subsection></subsection></subsection><subsection ssid="3-null-105" dnum="bb-o" numlevel="1" lineno="282" slineno="2-230" level="2"><display>(bb)</display>"Money" means officially issued coin and currency of the United States or any <ln numlevel="1" lineno="283" slineno="2-231"/>foreign country.</subsection><subsection ssid="3-null-106" dnum="cc-o" numlevel="1" lineno="284" slineno="2-232" level="2"><display>(cc)</display>"Narcotic drug" means any of the following, whether produced directly or indirectly <ln numlevel="1" lineno="285" slineno="2-233"/>by extraction from substances of vegetable origin, or independently by means of <ln numlevel="1" lineno="286" slineno="2-234"/>chemical synthesis, or by a combination of extraction and chemical synthesis:<subsection ssid="3-null-107" dnum="i-o" numlevel="1" lineno="287" slineno="2-235" level="3"><display>(i)</display>opium, coca leaves, and opiates;</subsection><subsection ssid="3-null-108" dnum="ii-o" numlevel="1" lineno="288" slineno="2-236" level="3"><display>(ii)</display>a compound, manufacture, salt, derivative, or preparation of opium, coca leaves, <ln numlevel="1" lineno="289" slineno="2-237"/>or opiates;</subsection><subsection ssid="3-null-109" dnum="iii-o" numlevel="1" lineno="290" slineno="2-238" level="3"><display>(iii)</display>opium poppy and poppy straw; or</subsection><subsection ssid="3-null-110" dnum="iv-o" numlevel="1" lineno="291" slineno="2-239" level="3"><display>(iv)</display>a substance, and any compound, manufacture, salt, derivative, or preparation of <ln numlevel="1" lineno="292" slineno="2-240"/>the substance, which is chemically identical with any of the substances referred to <ln numlevel="1" lineno="293" slineno="2-241"/>in Subsection <xref depth="4" refnumber="58-37-2(1)(cc)(i)">(1)(cc)(i)</xref>, (ii), or (iii), except narcotic drug does not include <ln numlevel="1" lineno="294" slineno="2-242"/>decocainized coca leaves or extracts of coca leaves which do not contain cocaine <ln numlevel="1" lineno="295" slineno="2-243"/>or ecgonine.</subsection></subsection><subsection ssid="3-null-111" dnum="dd-o" numlevel="1" lineno="296" slineno="2-244" level="2"><display>(dd)</display>"Negotiable instrument" means documents, containing an unconditional promise to <ln numlevel="1" lineno="297" slineno="2-245"/>pay a sum of money, which are legally transferable to another party by endorsement <ln numlevel="1" lineno="298" slineno="2-246"/>or delivery.</subsection><subsection ssid="3-null-112" dnum="ee-o" numlevel="1" lineno="299" slineno="2-247" level="2"><display>(ee)</display>"Opiate" means any drug or other substance having an addiction-forming or <ln numlevel="1" lineno="300" slineno="2-248"/>addiction-sustaining liability similar to morphine or being capable of conversion into <ln numlevel="1" lineno="301" slineno="2-249"/>a drug having addiction-forming or addiction-sustaining liability.</subsection><subsection ssid="3-null-113" dnum="ff-o" numlevel="1" lineno="302" slineno="2-250" level="2"><display>(ff)</display>"Opium poppy" means the plant of the species papaver somniferum L., except the <ln numlevel="1" lineno="303" slineno="2-251"/>seeds of the plant.</subsection><subsection ssid="3-null-114" dnum="gg-o" numlevel="1" lineno="304" slineno="2-252" level="2"><display>(gg)</display>"Person" means any corporation, association, partnership, trust, other institution or <ln numlevel="1" lineno="305" slineno="2-253"/>entity or one or more individuals.</subsection><subsection ssid="3-null-115" dnum="hh-o" numlevel="1" lineno="306" slineno="2-254" level="2"><display>(hh)</display>"Poppy straw" means all parts, except the seeds, of the opium poppy, after mowing.</subsection><subsection ssid="3-null-116" dnum="ii-o" numlevel="1" lineno="307" slineno="2-255" level="2"><display>(ii)</display>"Possession" or "use" means the joint or individual ownership, control, occupancy, <ln numlevel="1" lineno="308" slineno="2-256"/>holding, retaining, belonging, maintaining, or the application, inhalation, swallowing, <ln numlevel="1" lineno="309" slineno="2-257"/>injection, or consumption, as distinguished from distribution, of controlled <ln numlevel="1" lineno="310" slineno="2-258"/>substances and includes individual, joint, or group possession or use of controlled <ln numlevel="1" lineno="311" slineno="2-259"/>substances.  For a person to be a possessor or user of a controlled substance, it is not <ln numlevel="1" lineno="312" slineno="2-260"/>required that the person be shown to have individually possessed, used, or controlled <ln numlevel="1" lineno="313" slineno="2-261"/>the substance, but it is sufficient if it is shown that the person jointly participated with <ln numlevel="1" lineno="314" slineno="2-262"/>one or more persons in the use, possession, or control of any substances with <ln numlevel="1" lineno="315" slineno="2-263"/>knowledge that the activity was occurring, or the controlled substance is found in a <ln numlevel="1" lineno="316" slineno="2-264"/>place or under circumstances indicating that the person had the ability and the intent <ln numlevel="1" lineno="317" slineno="2-265"/>to exercise dominion and control over the controlled substance.</subsection><subsection ssid="3-null-117" dnum="jj-o" numlevel="1" lineno="318" slineno="2-266" level="2"><display>(jj)</display>"Practitioner" means a physician, dentist, naturopathic physician, veterinarian, <ln numlevel="1" lineno="319" slineno="2-267"/>pharmacist, scientific investigator, pharmacy, hospital, or other person licensed, <ln numlevel="1" lineno="320" slineno="2-268"/>registered, or otherwise permitted to distribute, dispense, conduct research with <ln numlevel="1" lineno="321" slineno="2-269"/>respect to, administer, or use in teaching or chemical analysis a controlled substance <ln numlevel="1" lineno="322" slineno="2-270"/>in the course of professional practice or research in this state.</subsection><subsection ssid="3-null-118" dnum="kk-o" numlevel="1" lineno="323" slineno="2-271" level="2"><display>(kk)</display>"Prescribe" means to issue a prescription:<subsection ssid="3-null-119" dnum="i-o" numlevel="1" lineno="324" slineno="2-272" level="3"><display>(i)</display>orally or in writing; or</subsection><subsection ssid="3-null-120" dnum="ii-o" numlevel="1" lineno="325" slineno="2-273" level="3"><display>(ii)</display>by telephone, facsimile transmission, computer, or other electronic means of <ln numlevel="1" lineno="326" slineno="2-274"/>communication as defined by division rule.</subsection></subsection><subsection ssid="3-null-121" dnum="ll-o" numlevel="1" lineno="327" slineno="2-275" level="2"><display>(ll)</display>"Prescription" means an order issued:<subsection ssid="3-null-122" dnum="i-o" numlevel="1" lineno="328" slineno="2-276" level="3"><display>(i)</display>by a licensed practitioner, in the course of that practitioner's professional practice <ln numlevel="1" lineno="329" slineno="2-277"/>or by collaborative pharmacy practice agreement; and</subsection><subsection ssid="3-null-123" dnum="ii-o" numlevel="1" lineno="330" slineno="2-278" level="3"><display>(ii)</display>for a controlled substance or other prescription drug or device for use by a patient <ln numlevel="1" lineno="331" slineno="2-279"/>or an animal.</subsection></subsection><subsection ssid="3-null-124" dnum="mm-o" numlevel="1" lineno="332" slineno="2-280" level="2"><display>(mm)</display>"Production" means the manufacture, planting, cultivation, growing, or harvesting <ln numlevel="1" lineno="333" slineno="2-281"/>of a controlled substance.</subsection><subsection ssid="3-null-125" dnum="nn-o" numlevel="1" lineno="334" slineno="2-282" level="2"><display>(nn)</display>"Securities" means any stocks, bonds, notes, or other evidences of debt or of <ln numlevel="1" lineno="335" slineno="2-283"/>property.</subsection><subsection ssid="3-null-126" dnum="oo-o" numlevel="1" lineno="336" slineno="2-284" level="2"><display>(oo)</display>"State" means the state of Utah.</subsection><subsection ssid="3-130" dnum="_-o:pp-i" numlevel="1" lineno="337" slineno="2-285" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(pp)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">"Total kratom alkaloid composition" means the total amount of all alkaloids derived <ln numlevel="1" lineno="338" slineno="2-286"/>from the Mitragyna speciosa plant.</amend></subsection><subsection ssid="3-null-127" dnum="pp-o:qq-i" numlevel="1" lineno="339" slineno="2-287" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1137" style="2" owner="o" level="1" deltag="both">(pp)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="both" space="true">(qq)</amend></display>"Ultimate user" means any person who lawfully possesses a controlled <ln numlevel="1" lineno="340" slineno="2-288"/>substance for the person's own use, for the use of a member of the person's <ln numlevel="1" lineno="341" slineno="2-289"/>household, or for administration to an animal owned by the person or a member of <ln numlevel="1" lineno="342" slineno="2-290"/>the person's household.</subsection></subsection><subsection ssid="3-null-128" dnum="2-o" numlevel="1" lineno="343" slineno="2-291" level="1"><display>(2)</display>If a term used in this chapter is not defined, the definition and terms of Title 76, Utah <ln numlevel="1" lineno="344" slineno="2-292"/>Criminal Code, shall apply.</subsection></section></bsec><bsec buid="1" num="58-37-4" type="amend" src="code" uid="C58-37-S4_1800010118000101" sort="58 37 00040018000101" numlevel="1" lineno="345" slineno="3-1" sn="3"><section number="58-37-4" numlevel="1" lineno="346" slineno="3-2" type="amend"><secline lineno="345">Section 3. <ln numlevel="1" lineno="882" slineno="3-538"/>salts, isomers whether optical, position, or geometric isomers, and salts of the <ln numlevel="1" lineno="883" slineno="3-539"/>isomers when the existence of the salts, isomers, and salts of isomers is possible <ln numlevel="1" lineno="884" slineno="3-540"/>within the specific chemical designation:<subsection ssid="1-null-336" dnum="A-o" numlevel="1" lineno="885" slineno="3-541" level="4"><display>(A)</display>Cathine ((+)-norpseudoephedrine);</subsection><subsection ssid="1-null-337" dnum="B-o" numlevel="1" lineno="886" level="4"><display>(C)</display>Fencamfamine;</subsection><subsection ssid="1-null-339" dnum="D-o" numlevel="1" lineno="888" slineno="3-544" level="4"><display>(D)</display>Fenproprex;</subsection><subsection ssid="1-null-340" dnum="E-o" numlevel="1" lineno="889" slineno="3-545" level="4"><display>(E)</display>Mazindol;</subsection><subsection ssid="1-null-341" dnum="F-o" numlevel="1" lineno="890" slineno="3-546" level="4"><display>(F)</display>Mefenorex;</subsection><subsection ssid="1-null-342" dnum="G-o" numlevel="1" lineno="891" slineno="3-547" organometallic complexes and chelates thereof;</subsection><subsection ssid="1-null-344" dnum="I-o" numlevel="1" lineno="893" slineno="3-549" level="4"><display>(I)</display>Phentermine;</subsection><subsection ssid="1-null-345" dnum="J-o" numlevel="1" lineno="894" slineno="3-550" level="4"><display>(J)</display>Pipradrol;</subsection><subsection ssid="1-null-346" dnum="K-o" numlevel="1" lineno="895" slineno="3-551" level="4"><display>(K)</display>Sibutramine; and</subsection><subsection ssid="1-null-347" dnum="L-o" numlevel="1" lineno="896" slineno="3-552" level="4"><display>(L)</display>SPA ((-)-1-dimethylamino-1,2-diphenylethane).</subsection></subsection><subsection ssid="1-null-348" dnum="v-o" numlevel="1" lineno="897" slineno="3-553" level="3"><display>(v)</display>Unless specifically excepted or unless listed in another schedule, any material, <ln numlevel="1" lineno="898" slineno="3-554"/>compound, mixture, or preparation which contains any quantity of <ln numlevel="1" lineno="899" slineno="3-555"/>dextropropoxyphene (alpha-(+)-4-dimethylamino-1, <ln numlevel="1" lineno="900" slineno="3-556"/>2-diphenyl-3-methyl-2-propionoxybutane), including its salts.</subsection><subsection ssid="1-null-349" dnum="vi-o" numlevel="1" lineno="901" slineno="3-557" level="3"><display>(vi)</display>A drug product or preparation that contains any component of marijuana and is <ln numlevel="1" lineno="902" slineno="3-558"/>approved by the United States Food and Drug Administration and scheduled by <ln numlevel="1" lineno="903" slineno="3-559"/>the Drug Enforcement Administration in Schedule IV of the federal Controlled <ln numlevel="1" lineno="904" slineno="3-560"/>Substances Act, Title II, P.L. 91-513.</subsection></subsection><subsection ssid="1-null-350" dnum="e-o" numlevel="1" lineno="905" slineno="3-561" level="2"><display>(e)</display>Schedule V:<subsection ssid="1-null-351" dnum="i-o" numlevel="1" lineno="906" slineno="3-562" level="3"><display>(i)</display>Any compound, mixture, or preparation containing any of the following limited <ln numlevel="1" lineno="907" slineno="3-563"/>quantities of narcotic drugs, or their salts calculated as the free anhydrous base or <ln numlevel="1" lineno="908" slineno="3-564"/>alkaloid, which includes one or more non-narcotic active medicinal ingredients in <ln numlevel="1" lineno="909" slineno="3-565"/>sufficient proportion to confer upon the compound, mixture, or preparation <ln numlevel="1" lineno="910" slineno="3-566"/>valuable medicinal qualities other than those possessed by the narcotic drug alone:<subsection ssid="1-null-352" dnum="A-o" numlevel="1" lineno="911" slineno="3-567" level="4"><display>(A)</display>not more than 200 milligrams of codeine per 100 milliliters or per 100 grams;</subsection><subsection ssid="1-null-353" dnum="B-o" numlevel="1" lineno="912" slineno="3-568" level="4"><display>(B)</display>not more than 100 milligrams of dihydrocodeine per 100 milliliters or per 100 <ln numlevel="1" lineno="913" slineno="3-569"/>grams;</subsection><subsection ssid="1-null-354" dnum="C-o" numlevel="1" lineno="914" slineno="3-570" level="4"><display>(C)</display>not more than 100 milligrams of ethylmorphine per 100 milliliters or per 100 <ln numlevel="1" lineno="915" slineno="3-571"/>grams;</subsection><subsection ssid="1-null-355" dnum="D-o" numlevel="1" lineno="916" slineno="3-572" level="4"><display>(D)</display>not more than 2.5 milligrams of diphenoxylate and not less than 25 <ln numlevel="1" lineno="917" slineno="3-573"/>micrograms of atropine sulfate per dosage unit;</subsection><subsection ssid="1-null-356" dnum="E-o" numlevel="1" lineno="918" slineno="3-574" level="4"><display>(E)</display>not more than 100 milligrams of opium per 100 milliliters or per 100 grams;</subsection><subsection ssid="1-null-357" dnum="F-o" numlevel="1" lineno="919" slineno="3-575" level="4"><display>(F)</display>not more than 0.5 milligram of difenoxin and not less than 25 micrograms of <ln numlevel="1" lineno="920" slineno="3-576"/>atropine sulfate per dosage unit; and</subsection><subsection ssid="1-null-358" dnum="G-o" numlevel="1" lineno="921" slineno="3-577" level="4"><display>(G)</display>unless specifically exempted or excluded or unless listed in another schedule, <ln numlevel="1" lineno="922" slineno="3-578"/>any material, compound, mixture, or preparation which contains Pyrovalerone <ln numlevel="1" lineno="923" slineno="3-579"/>having a stimulant effect on the central nervous system, including its salts, <ln numlevel="1" lineno="924" slineno="3-580"/>isomers, and salts of isomers.</subsection></subsection><subsection ssid="1-null-359" dnum="ii-o" numlevel="1" lineno="925" slineno="3-581" level="3"><display>(ii)</display>A drug product or preparation that contains any component of marijuana, <ln numlevel="1" lineno="926" slineno="3-582"/>including cannabidiol, and is approved by the United States Food and Drug <ln numlevel="1" lineno="927" slineno="3-583"/>Administration and scheduled by the Drug Enforcement Administration in <ln numlevel="1" lineno="928" slineno="3-584"/>Schedule V of the federal Controlled Substances Act, Title II, P.L. 91-513. </subsection><subsection ssid="1-null-360" dnum="iii-o" numlevel="1" lineno="929" slineno="3-585" level="3"><display>(iii)</display>Gabapentin.</subsection></subsection></subsection></section></bsec><bsec buid="24" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="930" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="930">Section 4.  <bold>Effective Date.</bold></secline><sectionText
