reduction.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">allows a funeral service establishment to offer natural organic reduction;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">requires that a funeral service director meet certain requirements if the funeral service <ln numlevel="1" lineno="11" slineno="0-11"/>director offers natural organic reduction;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">grants immunity to a funeral service establishment that relies on a natural organic <ln numlevel="1" lineno="13" slineno="0-13"/>reduction authorization form in carrying out natural organic reduction;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">updates a funeral service establishment's recordkeeping requirements;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">provides requirements for accepting remains for natural organic reduction;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">limits liability for a funeral service establishment providing natural organic reduction;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">provides the requirements for authorizing natural organic reduction;</hl><hl numlevel="1" Section <bold>26B-8-201</bold> is amended to read:</secline><catline lineno="49"><bold>26B-8-201<parens/>. Definitions.</bold></catline><sectionText lineno="50"><tab/>As used in this part:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="51" slineno="1-4" level="1"><display>(1)</display>"Dead body" means the same as that term is defined in Section <xref depth="3" refnumber="26B-8-101">26B-8-101</xref>.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="52" slineno="1-5" level="1" space="false"><display>(2)</display><subsection ssid="1-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Death by violence" means death that resulted by the decedent's exposure to <ln numlevel="1" lineno="53" slineno="1-6"/>physical, mechanical, or chemical forces.</subsection><subsection ssid="1-null-4" dnum="b-o" numlevel="1" lineno="54" slineno="1-7" level="2"><display>(b)</display>"Death by violence" includes death that appears to have been due to<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="ahaskell" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="86" groupid="76" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-29" dnum="_-o:i-i" numlevel="1" lineno="55" slineno="1-8" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>homicide<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="11" style="2" lineno="57" slineno="1-10"/>robbery, burglary, housebreaking, extortion, or blackmail accompanied by threats <ln numlevel="1" lineno="58" slineno="1-11"/>of violence<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="20" style="2" owner="ahaskell" level="1" deltag="both">, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="1-31" dnum="_-o:iii-i" numlevel="1" lineno="59" slineno="1-12" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display>assault with a dangerous weapon<amendoutstart punishable by imprisonment for more <ln numlevel="1" lineno="61" slineno="1-14"/>than one year<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="40" style="2" owner="ahaskell" level="1" deltag="both">, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="38" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="1-33" dnum="_-o:v-i" numlevel="1" lineno="62" slineno="1-15" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both">(v)</amend></display>arson punishable by imprisonment for more than one year<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="47" style="2" owner="ahaskell" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="46" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend> or<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="48" style="2" owner="ahaskell" level="1" deltag="both"> </amend><amendoutend style="2"/></subsection><subsection ssid="1-34" dnum="_-o:vi-i" numlevel="1" lineno="63" slineno="1-16" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both">(vi)</amend></display>any attempt to commit any of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="63" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="82" style="1" owner="ahaskell" level="1" amendtag="end">a physician assistant licensed under Title 58, Chapter 70a, Utah Physician Assistant <ln numlevel="1" lineno="70" slineno="1-23"/>Act; or</amend></subsection><subsection ssid="1-40" dnum="_-o:c-i" numlevel="1" lineno="71" slineno="1-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="84" style="1" owner="ahaskell" level="1" amendtag="end">an advance practice registered nurse licensed under Subsection <xref depth="4" refnumber="58-31b-301(2)(e)">58-31b-301(2)(e)</xref>.</amend></subsection></subsection><subsection ssid="1-null-5" dnum="3-o:4-i" Chapter 68, Utah Osteopathic Medical Practice Act;</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-8" dnum="b-o:_-i" numlevel="1" lineno="78" slineno="1-31" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="110" groupid="92" style="2" owner="ahaskell" level="1" deltag="end">a physician assistant licensed under Title 58, Chapter 70a, Utah Physician Assistant <ln numlevel="1" lineno="79" slineno="1-32"/>Act; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-9" dnum="c-o:_-i" numlevel="1" lineno="80" slineno="1-33" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="111" groupid="93" style="2" owner="ahaskell" level="1" deltag="end">an advance practice registered nurse licensed under Subsection <xref depth="4" refnumber="58-31b-301(2)(e)">58-31b-301(2)(e)</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-10" dnum="5-o" numlevel="1" lineno="81" slineno="1-34" level="1"><display>(5)</display>"Medical examiner" means the state medical examiner appointed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="73" groupid="66" style="2" owner="ahaskell" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="66" groupid="59" style="1" owner="ahaskell" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="82" slineno="1-35"/>accordance with</amend> Section <xref depth="3" refnumber="26B-8-202">26B-8-202</xref> or a deputy appointed by the medical examiner.</subsection><subsection ssid="1-null-11" dnum="6-o" numlevel="1" lineno="83" slineno="1-36" level="1"><display>(6)</display>"Medical examiner record" means:<subsection ssid="1-null-12" dnum="a-o" numlevel="1" lineno="84" slineno="1-37" level="2"><display>(a)</display>all information that the medical examiner obtains regarding a decedent;</subsection><subsection ssid="1-null-13" dnum="b-o" numlevel="1" lineno="85" slineno="1-38" level="2"><display>(b)</display>reports that the medical examiner makes regarding a decedent; and</subsection><subsection ssid="1-null-14" dnum="c-o" numlevel="1" lineno="86" slineno="1-39" level="2"><display>(c)</display>all administrative forms and correspondence related to a decedent's case.</subsection></subsection><subsection ssid="1-null-15" dnum="7-o" numlevel="1" practice medicine and surgery in the state, appointed by the medical <ln numlevel="1" lineno="89" slineno="1-42"/>examiner <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="67" style="2" owner="ahaskell" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="60" style="1" owner="ahaskell" level="1" amendtag="both" space="true">in accordance with</amend> Subsection <xref depth="4" refnumber="26B-8-202(3)">26B-8-202(3)</xref>.</subsection><subsection ssid="1-null-16" dnum="8-o" numlevel="1" lineno="90" slineno="1-43" level="1"><display>(8)</display>"Sudden death while in apparent good health" means apparently instantaneous death <ln numlevel="1" lineno="91" slineno="1-44"/>without obvious natural cause, death during or following an unexplained syncope or <ln numlevel="1" lineno="92" slineno="1-45"/>coma, or death during an acute or unexplained rapidly fatal illness.</subsection><subsection ssid="1-null-17" dnum="9-o" numlevel="1" lineno="93" slineno="1-46" level="1"><display>(9)</display>"Sudden unexpected infant death" means the death of a child who was thought to be in <ln numlevel="1" lineno="94" slineno="1-47"/>good health or whose terminal illness appeared to be so mild that the possibility of a <ln numlevel="1" lineno="95" slineno="1-48"/>fatal outcome was not anticipated.</subsection><subsection ssid="1-null-18" dnum="10-o" numlevel="1" lineno="96" slineno="1-49" level="1"><display>(10)</display>"Suicide" means death caused by an intentional and voluntary act of an individual who <ln numlevel="1" lineno="97" slineno="1-50"/>understands the physical nature of the act and intends by such act to accomplish <ln numlevel="1" lineno="98" slineno="1-51"/>self-destruction.</subsection><subsection ssid="1-null-19" dnum="11-o" numlevel="1" lineno="99" slineno="1-52" level="1"><display>(11)</display>"Unattended death" means a death that occurs more than 365 days after the day on <ln numlevel="1" lineno="100" slineno="1-53"/>which a health care professional examined or treated the deceased individual for any <ln numlevel="1" lineno="101" slineno="1-54"/>purpose, including writing a prescription.</subsection><subsection ssid="1-null-20" dnum="12-o" numlevel="1" lineno="102" slineno="1-55" level="1" space="false"><display>(12)</display><subsection ssid="1-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Unavailable for postmortem investigation" means that a dead body is:<subsection ssid="1-null-22" dnum="i-o" numlevel="1" lineno="103" slineno="1-56" level="3" tab="1"><display>(i)</display>transported out of state;</subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="104" slineno="1-57" level="3" tab="1"><display>(ii)</display>buried at sea;</subsection><subsection ssid="1-null-24" dnum="iii-o" numlevel="1" lineno="105" slineno="1-58" level="3" tab="1"><display>(iii)</display>cremated;</subsection><subsection ssid="1-null-25" dnum="iv-o" numlevel="1" lineno="106" slineno="1-59" level="3" tab="1"><display>(iv)</display>processed by alkaline hydrolysis;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="79" groupid="71" style="2" owner="ahaskell" level="1" deltag="both"> style="2"/><amend anum="0" ea="erase" pairid="24" groupid="21" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both" space="true">"Alkaline hydrolysis"</amend> includes the disposal of the liquid and the processing and <ln numlevel="1" lineno="122" hydrolysis chamber" means the enclosed space within which the alkaline <ln numlevel="1" lineno="124" slineno="2-10"/>hydrolysis process takes place and that is used exclusively for alkaline hydrolysis of <ln numlevel="1" lineno="125" slineno="2-11"/>human remains.</subsection><subsection ssid="2-null-3" dnum="3-o" numlevel="1" lineno="126" slineno="2-12" level="1"><display>(3)</display>"Alkaline hydrolysis container" means a container:<subsection ssid="2-null-4" dnum="a-o" numlevel="1" lineno="127" slineno="2-13" level="2"><display>(a)</display>in which human remains are transported to a funeral service establishment and <ln numlevel="1" lineno="128" slineno="2-14"/>placed in an alkaline hydrolysis chamber for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="23" style="2" owner="ahaskell" level="1" deltag="both">resomation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the alkaline hydrolysis <ln numlevel="1" lineno="129" slineno="2-15"/>process</amend>; and</subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="130" slineno="2-16" level="2"><display>(b)</display>that meets substantially all of the following standards:<subsection ssid="2-null-6" dnum="i-o" numlevel="1" lineno="131" slineno="2-17" level="3"><display>(i)</display>able to be closed in order to provide a complete covering for the human remains;</subsection><subsection ssid="2-null-7" dnum="ii-o" numlevel="1" lineno="132" slineno="2-18" level="3"><display>(ii)</display>resistant to leakage or spillage;</subsection><subsection ssid="2-null-8" dnum="iii-o" numlevel="1" lineno="133" slineno="2-19" level="3"><display>(iii)</display>rigid enough for handling with ease; and</subsection><subsection ssid="2-null-9" dnum="iv-o" numlevel="1" lineno="134" slineno="2-20" level="3"><display>(iv)</display>able to provide protection for the health, safety, and personal integrity of <ln numlevel="1" lineno="135" slineno="2-21"/>crematory personnel.</subsection></subsection></subsection><subsection ssid="2-null-10" dnum="4-o" numlevel="1" lineno="136" slineno="2-22" level="1"><display>(4)</display>"Authorizing agent" means a person legally entitled to authorize the cremation<amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="ahaskell" level="1" amendtag="both">, natural <ln numlevel="1" lineno="137" slineno="2-23"/>organic reduction,</amend> or the alkaline hydrolysis process of human remains.</subsection><subsection ssid="2-null-11" dnum="5-o" numlevel="1" lineno="138" slineno="2-24" level="1"><display>(5)</display>"Beneficiary" means the individual who, at the time of the individual's death, is to <ln numlevel="1" lineno="139" slineno="2-25"/>receive the benefit of the property and services purchased under a preneed funeral <ln numlevel="1" lineno="140" slineno="2-26"/>arrangement.</subsection><subsection ssid="2-null-12" dnum="6-o" numlevel="1" lineno="141" slineno="2-27" level="1"><display>(6)</display>"Board" means the Board of Funeral Service created in Section <xref depth="3" refnumber="58-9-201" start="0">58-9-201</xref>.</subsection><subsection ssid="2-null-13" dnum="7-o" numlevel="1" lineno="142" slineno="2-28" level="1"><display>(7)</display>"Body part" means:<subsection ssid="2-null-14" dnum="a-o" numlevel="1" lineno="143" slineno="2-29" level="2"><display>(a)</display>a limb or other portion of the anatomy that is removed from <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="31" style="2" owner="ahaskell" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an individual</amend> <ln numlevel="1" lineno="144" slineno="2-30"/>or human remains for medical purposes during treatment, surgery, biopsy, autopsy, or <ln numlevel="1" lineno="145" slineno="2-31"/>medical research; or</subsection><subsection ssid="2-null-15" dnum="b-o" numlevel="1" lineno="146" slineno="2-32" level="2"><display>(b)</display>a human body or any portion of a body that has been donated to science for medical <ln numlevel="1" lineno="147" slineno="2-33"/>research purposes.</subsection></subsection><subsection ssid="2-null-16" dnum="8-o" numlevel="1" lineno="148" slineno="2-34" level="1"><display>(8)</display>"Buyer" means a person <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="32" style="2" owner="ahaskell" level="1" deltag="both">who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="29" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> purchases a preneed funeral arrangement.</subsection><subsection ssid="2-null-17" dnum="9-o" numlevel="1" lineno="149" slineno="2-35" level="1"><display>(9)</display>"Calcination" means a process in which a dead human body is reduced by intense heat <ln numlevel="1" lineno="150" slineno="2-36"/>to a residue that is not as substantive as the residue that follows cremation.</subsection><subsection ssid="2-null-18" dnum="10-o" numlevel="1" lineno="151" slineno="2-37" level="1"><display>(10)</display>"Cremated remains" means all the remains of a cremated body recovered after the <ln numlevel="1" lineno="152" slineno="2-38"/>completion of the cremation process, including pulverization <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="34" style="2" owner="ahaskell" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> leaves only <ln numlevel="1" lineno="153" slineno="2-39"/>bone fragments reduced to unidentifiable dimensions and may possibly include the <ln numlevel="1" lineno="154" slineno="2-40"/>residue of foreign matter including casket material, bridgework, or eyeglasses that were <ln numlevel="1" lineno="155" slineno="2-41"/>cremated with the human remains.</subsection><subsection ssid="2-null-19" dnum="11-o" numlevel="1" lineno="156" slineno="2-42" level="1" space="false"><display>(11)</display><subsection ssid="2-122" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Cremation" means the technical process, using direct flame and heat, or a <ln numlevel="1" lineno="157" slineno="2-43"/>chemical process, that reduces human remains to bone fragments through heat and <ln numlevel="1" lineno="158" slineno="2-44"/>evaporation, or a chemical process<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="39" style="2" owner="ahaskell" level="1" deltag="both">, and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="87" groupid="76" style="1" owner="ahaskell" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="2-123" dnum="_-o:b-i" numlevel="1" lineno="159" slineno="2-45" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="38" style="1" owner="ahaskell" level="1" amendtag="end">"Cremation" </amend>includes the processing and usually the pulverization of the bone <ln numlevel="1" lineno="160" slineno="2-46"/>fragments.</subsection></subsection><subsection ssid="2-null-20" dnum="12-o" numlevel="1" lineno="161" slineno="2-47" level="1"><display>(12)</display>"Cremation chamber" means the enclosed space within which the cremation process <ln numlevel="1" lineno="162" slineno="2-48"/>takes place and which is used exclusively for the cremation of human remains.</subsection><subsection ssid="2-null-21" dnum="13-o" numlevel="1" lineno="163" slineno="2-49" level="1"><display>(13)</display>"Cremation container" means the container:<subsection ssid="2-null-22" dnum="a-o" numlevel="1" lineno="164" slineno="2-50" level="2"><display>(a)</display>in which the human remains are transported to the crematory and placed in the <ln numlevel="1" lineno="165" slineno="2-51"/>cremation chamber for cremation; and</subsection><subsection ssid="2-null-23" dnum="b-o" numlevel="1" lineno="166" slineno="2-52" level="2"><display>(b)</display>that meets substantially all of the following standards:<subsection ssid="2-null-24" dnum="i-o" numlevel="1" lineno="167" slineno="2-53" level="3"><display>(i)</display>composed of readily combustible or consumable materials suitable for cremation;</subsection><subsection ssid="2-null-25" dnum="ii-o" numlevel="1" lineno="168" slineno="2-54" level="3"><display>(ii)</display>able to be closed in order to provide a complete covering for the human remains;</subsection><subsection ssid="2-null-26" dnum="iii-o" numlevel="1" lineno="169" slineno="2-55" level="3"><display>(iii)</display>resistant to leakage or spillage;</subsection><subsection ssid="2-null-27" dnum="iv-o" numlevel="1" lineno="170" slineno="2-56" level="3"><display>(iv)</display>rigid enough for handling with ease; and</subsection><subsection ssid="2-null-28" dnum="v-o" numlevel="1" lineno="171" slineno="2-57" level="3"><display>(v)</display>able to provide protection for the health, safety, and personal integrity of <ln numlevel="1" lineno="172" slineno="2-58"/>crematory personnel.</subsection></subsection></subsection><subsection ssid="2-null-29" dnum="14-o" numlevel="1" lineno="173" slineno="2-59" level="1"><display>(14)</display>"Crematory" means the building or portion of a building that houses the cremation <ln numlevel="1" lineno="174" slineno="2-60"/>chamber and the holding facility.</subsection><subsection ssid="2-null-30" dnum="15-o" numlevel="1" lineno="175" slineno="2-61" level="1"><display>(15)</display>"Direct disposition" means the disposition of a dead human body:<subsection ssid="2-null-31" dnum="a-o" numlevel="1" lineno="176" slineno="2-62" level="2"><display>(a)</display>as quickly as law allows;</subsection><subsection ssid="2-null-32" dnum="b-o" numlevel="1" lineno="177" slineno="2-63" level="2"><display>(b)</display>without preparation of the body by embalming; and</subsection><subsection ssid="2-null-33" dnum="c-o" numlevel="1" lineno="178" slineno="2-64" level="2"><display>(c)</display>without an attendant funeral service or graveside service.</subsection></subsection><subsection ssid="2-null-34" dnum="16-o" numlevel="1" lineno="179" slineno="2-65" level="1"><display>(16)</display>"Disposition" means the final disposal of a dead human body by:<subsection ssid="2-null-35" dnum="a-o" numlevel="1" lineno="180" slineno="2-66" level="2"><display>(a)</display>earth interment;</subsection><subsection ssid="2-null-36" dnum="b-o" numlevel="1" lineno="181" slineno="2-67" level="2"><display>(b)</display>above ground burial;</subsection><subsection ssid="2-null-37" dnum="c-o" numlevel="1" lineno="182" slineno="2-68" level="2"><display>(c)</display>cremation;</subsection><subsection ssid="2-null-38" dnum="d-o" numlevel="1" lineno="183" slineno="2-69" level="2"><display>(d)</display>calcination;</subsection><subsection ssid="2-null-39" dnum="e-o" numlevel="1" lineno="184" slineno="2-70" level="2"><display>(e)</display>alkaline hydrolysis;</subsection><subsection ssid="2-null-40" dnum="f-o" numlevel="1" lineno="185" slineno="2-71" level="2"><display>(f)</display>burial at sea;</subsection><subsection ssid="2-null-41" dnum="g-o" numlevel="1" lineno="186" slineno="2-72" level="2"><display>(g)</display>delivery to a medical institution;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="45" style="2" owner="ahaskell" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="2-124" dnum="_-o:h-i" numlevel="1" lineno="187" slineno="2-73" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">natural organic reduction; or</amend></subsection><subsection ssid="2-null-42" dnum="h-o:i-i" numlevel="1" lineno="188" slineno="2-74" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1085" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>other lawful means.</subsection></subsection><subsection ssid="2-null-43" dnum="17-o" numlevel="1" lineno="189" slineno="2-75" level="1"><display>(17)</display>"Embalming" means replacing body fluids in a dead human body with preserving and <ln numlevel="1" lineno="190" slineno="2-76"/>disinfecting chemicals.</subsection><subsection ssid="2-null-44" dnum="18-o" numlevel="1" lineno="191" slineno="2-77" level="1" space="false"><display>(18)</display><subsection ssid="2-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Funeral merchandise" means any of the following into which a dead human <ln numlevel="1" lineno="192" slineno="2-78"/>body is placed in connection with the transportation or disposition of the body:<subsection ssid="2-null-46" dnum="i-o" numlevel="1" lineno="193" slineno="2-79" level="3" tab="1"><display>(i)</display>a vault;</subsection><subsection ssid="2-null-47" dnum="ii-o" numlevel="1" lineno="194" slineno="2-80" level="3" tab="1"><display>(ii)</display>a casket; or</subsection><subsection ssid="2-null-48" dnum="iii-o" numlevel="1" lineno="195" slineno="2-81" level="3" tab="1"><display>(iii)</display>other personal property.</subsection></subsection><subsection ssid="2-null-49" dnum="b-o" numlevel="1" lineno="196" slineno="2-82" level="2"><display>(b)</display>"Funeral merchandise" does not include:<subsection ssid="2-null-50" dnum="i-o" numlevel="1" lineno="197" slineno="2-83" level="3"><display>(i)</display>a mausoleum crypt;</subsection><subsection ssid="2-null-51" dnum="ii-o" numlevel="1" lineno="198" slineno="2-84" level="3"><display>(ii)</display>an interment receptacle preset in a cemetery; or</subsection><subsection ssid="2-null-52" dnum="iii-o" numlevel="1" lineno="199" slineno="2-85" level="3"><display>(iii)</display>a columbarium niche.</subsection></subsection></subsection><subsection ssid="2-null-53" dnum="19-o" numlevel="1" lineno="200" slineno="2-86" level="1"><display>(19)</display>"Funeral service" means a service, rite, or ceremony performed:<subsection ssid="2-null-54" dnum="a-o" numlevel="1" lineno="201" slineno="2-87" level="2"><display>(a)</display>with respect to the death of a human; and</subsection><subsection ssid="2-null-55" dnum="b-o" numlevel="1" lineno="202" slineno="2-88" level="2"><display>(b)</display>with the body of the deceased present.</subsection></subsection><subsection ssid="2-null-56" dnum="20-o" numlevel="1" lineno="203" slineno="2-89" level="1"><display>(20)</display>"Funeral service director" means an individual licensed under this chapter who may <ln numlevel="1" lineno="204" slineno="2-90"/>engage in all lawful professional activities regulated and defined under the practice of <ln numlevel="1" lineno="205" slineno="2-91"/>funeral service.</subsection><subsection ssid="2-null-57" dnum="21-o" numlevel="1" lineno="206" slineno="2-92" level="1" space="false"><display>(21)</display><subsection ssid="2-null-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Funeral service establishment" means a place of business at a specific street <ln numlevel="1" lineno="207" slineno="2-93"/>address or location licensed under this chapter that is devoted to:<subsection ssid="2-null-59" dnum="i-o" numlevel="1" lineno="208" slineno="2-94" level="3" tab="1"><display>(i)</display>the embalming, care, custody, shelter, preparation for burial, and final disposition <ln numlevel="1" lineno="209" slineno="2-95"/>of dead human bodies; and</subsection><subsection ssid="2-null-60" dnum="ii-o" numlevel="1" lineno="210" slineno="2-96" level="3" tab="1"><display>(ii)</display>the furnishing of services, merchandise, and products purchased from the <ln numlevel="1" lineno="211" slineno="2-97"/>establishment as a preneed provider under a preneed funeral arrangement.</subsection></subsection><subsection ssid="2-null-61" dnum="b-o" numlevel="1" lineno="212" slineno="2-98" level="2"><display>(b)</display>"Funeral service establishment" includes:<subsection ssid="2-null-62" dnum="i-o" numlevel="1" lineno="213" slineno="2-99" level="3"><display>(i)</display>all portions of the business premises and all tools, instruments, and supplies used <ln numlevel="1" lineno="214" slineno="2-100"/>in the preparation and embalming of dead human bodies for burial, cremation, <ln numlevel="1" lineno="215" slineno="2-101"/>alkaline hydrolysis, <amend anum="0" ea="amend" pairid="64" groupid="55" style="1" owner="ahaskell" level="1" amendtag="both">natural organic reduction, </amend>and final disposition <amend anum="0" ea="amend" pairid="65" groupid="56" style="1" owner="ahaskell" level="1" amendtag="both">by other <ln numlevel="1" lineno="216" slineno="2-102"/>lawful means </amend>as defined by division rule; and</subsection><subsection ssid="2-null-63" dnum="ii-o" numlevel="1" lineno="217" slineno="2-103" level="3"><display>(ii)</display>a facility used by the business in which funeral services may be conducted.</subsection></subsection></subsection><subsection ssid="2-null-64" dnum="22-o" numlevel="1" lineno="218" slineno="2-104" level="1"><display>(22)</display>"Funeral service intern" means an individual licensed under this chapter who is <ln numlevel="1" lineno="219" slineno="2-105"/>permitted to:<subsection ssid="2-null-65" dnum="a-o" numlevel="1" lineno="220" slineno="2-106" level="2"><display>(a)</display>assist a funeral service director in the embalming or other preparation of a dead <ln numlevel="1" lineno="221" slineno="2-107"/>human body for disposition;</subsection><subsection ssid="2-null-66" dnum="b-o" numlevel="1" lineno="222" slineno="2-108" level="2"><display>(b)</display>assist a funeral service director in the cremation, calcination, alkaline hydrolysis, <amend anum="0" ea="amend" pairid="66" groupid="57" style="1" owner="ahaskell" level="1" amendtag="both"><ln numlevel="1" lineno="223" slineno="2-109"/>natural organic reduction, </amend>or pulverization of a dead human body or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="59" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="58" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the body's</amend> <ln numlevel="1" lineno="224" slineno="2-110"/>remains; and</subsection><subsection ssid="2-null-67" dnum="c-o" numlevel="1" lineno="225" slineno="2-111" level="2"><display>(c)</display>perform other funeral service activities under the supervision of a funeral service <ln numlevel="1" lineno="226" slineno="2-112"/>director.</subsection></subsection><subsection ssid="2-null-68" dnum="23-o" numlevel="1" lineno="227" slineno="2-113" level="1"><display>(23)</display>"Graveside service" means a funeral service held at the location of disposition.</subsection><subsection ssid="2-null-69" dnum="24-o" numlevel="1" lineno="228" slineno="2-114" level="1"><display>(24)</display>"Memorial service" means a service, rite, or ceremony performed:<subsection ssid="2-null-70" dnum="a-o" numlevel="1" lineno="229" slineno="2-115" level="2"><display>(a)</display>with respect to the death of a human; and</subsection><subsection ssid="2-null-71" dnum="b-o" numlevel="1" lineno="230" slineno="2-116" level="2"><display>(b)</display>without the body of the deceased present.</subsection></subsection><subsection ssid="2-125" dnum="_-o:25-i" numlevel="1" lineno="231" slineno="2-117" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(25)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">"Natural organic reduction" means the contained, accelerated conversion of human <ln numlevel="1" lineno="232" slineno="2-118"/>remains to soil.</amend></subsection><subsection ssid="2-null-72" dnum="25-o:26-i" numlevel="1" lineno="233" slineno="2-119" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1116" style="2" owner="o" level="1" deltag="both">(25)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="both" space="true">(26)</amend></display>"Practice of funeral service" means:<subsection ssid="2-null-73" dnum="a-o" numlevel="1" lineno="234" slineno="2-120" level="2"><display>(a)</display>supervising the receipt of custody and transportation of a dead human body to <ln numlevel="1" lineno="235" slineno="2-121"/>prepare the body for:<subsection ssid="2-null-74" dnum="i-o" numlevel="1" lineno="236" slineno="2-122" level="3"><display>(i)</display>disposition; or</subsection><subsection ssid="2-null-75" dnum="ii-o" numlevel="1" lineno="237" slineno="2-123" level="3"><display>(ii)</display>shipment to another location;</subsection></subsection><subsection ssid="2-null-76" dnum="b-o" numlevel="1" lineno="238" slineno="2-124" level="2"><display>(b)</display>entering into a contract with a person to provide professional services regulated <ln numlevel="1" lineno="239" slineno="2-125"/>under this chapter;</subsection><subsection ssid="2-null-77" dnum="c-o" numlevel="1" lineno="240" slineno="2-126" level="2"><display>(c)</display>embalming or otherwise preparing a dead human body for disposition;</subsection><subsection ssid="2-null-78" dnum="d-o" numlevel="1" lineno="241" slineno="2-127" level="2"><display>(d)</display>supervising the arrangement or conduct of:<subsection ssid="2-null-79" dnum="i-o" numlevel="1" lineno="242" slineno="2-128" level="3"><display>(i)</display>a funeral service;</subsection><subsection ssid="2-null-80" dnum="ii-o" numlevel="1" lineno="243" slineno="2-129" level="3"><display>(ii)</display>a graveside service; or</subsection><subsection ssid="2-null-81" dnum="iii-o" numlevel="1" lineno="244" slineno="2-130" level="3"><display>(iii)</display>a memorial service;</subsection></subsection><subsection ssid="2-null-82" dnum="e-o" numlevel="1" lineno="245" slineno="2-131" level="2"><display>(e)</display>cremation, calcination, alkaline hydrolysis, <amend anum="0" ea="amend" pairid="77" groupid="66" style="1" owner="ahaskell" level="1" amendtag="both">natural organic reduction, </amend>or <ln numlevel="1" lineno="246" slineno="2-132"/>pulverization of a dead human body or the body's remains;</subsection><subsection ssid="2-null-83" dnum="f-o" numlevel="1" lineno="247" slineno="2-133" level="2"><display>(f)</display>supervising the arrangement of:<subsection ssid="2-null-84" dnum="i-o" numlevel="1" lineno="248" slineno="2-134" level="3"><display>(i)</display>a disposition; or</subsection><subsection ssid="2-null-85" dnum="ii-o" numlevel="1" lineno="249" slineno="2-135" level="3"><display>(ii)</display>a direct disposition;</subsection></subsection><subsection ssid="2-null-86" dnum="g-o" numlevel="1" lineno="250" slineno="2-136" level="2"><display>(g)</display>facilitating:<subsection ssid="2-null-87" dnum="i-o" numlevel="1" lineno="251" slineno="2-137" level="3"><display>(i)</display>a disposition; or</subsection><subsection ssid="2-null-88" dnum="ii-o" numlevel="1" lineno="252" slineno="2-138" level="3"><display>(ii)</display>a direct disposition;</subsection></subsection><subsection ssid="2-null-89" dnum="h-o" numlevel="1" lineno="253" slineno="2-139" level="2"><display>(h)</display>supervising the sale of funeral merchandise by a funeral establishment;</subsection><subsection ssid="2-null-90" dnum="i-o" numlevel="1" lineno="254" slineno="2-140" level="2"><display>(i)</display>managing or otherwise being responsible for the practice of funeral service in a <ln numlevel="1" lineno="255" slineno="2-141"/>licensed funeral service establishment;</subsection><subsection ssid="2-null-91" dnum="j-o" numlevel="1" lineno="256" slineno="2-142" level="2"><display>(j)</display>supervising the sale of a preneed funeral arrangement; and</subsection><subsection ssid="2-null-92" dnum="k-o" numlevel="1" lineno="257" slineno="2-143" level="2"><display>(k)</display>contracting with or employing individuals to sell a preneed funeral arrangement.</subsection></subsection><subsection ssid="2-null-93" dnum="26-o:27-i" numlevel="1" lineno="258" slineno="2-144" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1137" style="2" owner="o" level="1" deltag="both">(26)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="both" space="true">(27)</amend></display><subsection ssid="2-null-94" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Preneed funeral arrangement" means a written or oral agreement sold in <ln numlevel="1" lineno="259" slineno="2-145"/>advance of the death of the beneficiary under which a person agrees with a buyer to <ln numlevel="1" lineno="260" slineno="2-146"/>provide at the death of the beneficiary any of the following as are typically provided <ln numlevel="1" lineno="261" slineno="2-147"/>in connection with a disposition:<subsection ssid="2-null-95" dnum="i-o" numlevel="1" lineno="262" slineno="2-148" level="3" tab="1"><display>(i)</display>goods;</subsection><subsection ssid="2-null-96" dnum="ii-o" numlevel="1" lineno="263" slineno="2-149" level="3" tab="1"><display>(ii)</display>services, including:<subsection ssid="2-null-97" dnum="A-o" numlevel="1" lineno="264" slineno="2-150" level="4"><display>(A)</display>embalming services; and</subsection><subsection ssid="2-null-98" dnum="B-o" numlevel="1" lineno="265" slineno="2-151" level="4"><display>(B)</display>funeral directing services;</subsection></subsection><subsection ssid="2-null-99" dnum="iii-o" numlevel="1" lineno="266" slineno="2-152" level="3" tab="1"><display>(iii)</display>real property; or</subsection><subsection ssid="2-null-100" dnum="iv-o" numlevel="1" lineno="267" slineno="2-153" level="3" tab="1"><display>(iv)</display>personal property, including:<subsection ssid="2-null-101" dnum="A-o" numlevel="1" lineno="268" slineno="2-154" level="4"><display>(A)</display>a casket;</subsection><subsection ssid="2-null-102" dnum="B-o" numlevel="1" lineno="269" slineno="2-155" level="4"><display>(B)</display>another primary container;</subsection><subsection ssid="2-null-103" dnum="C-o" numlevel="1" lineno="270" slineno="2-156" level="4"><display>(C)</display>a cremation, alkaline hydrolysis, <amend anum="0" ea="amend" pairid="78" groupid="67" style="1" owner="ahaskell" level="1" amendtag="both">natural organic reduction, </amend>or transportation <ln numlevel="1" lineno="271" slineno="2-157"/>container;</subsection><subsection ssid="2-null-104" dnum="D-o" numlevel="1" lineno="272" slineno="2-158" level="4"><display>(D)</display>an outer burial container;</subsection><subsection ssid="2-null-105" dnum="E-o" numlevel="1" lineno="273" slineno="2-159" level="4"><display>(E)</display>a vault;</subsection><subsection ssid="2-null-106" dnum="F-o" numlevel="1" lineno="274" slineno="2-160" level="4"><display>(F)</display>a grave liner;</subsection><subsection ssid="2-null-107" dnum="G-o" numlevel="1" lineno="275" slineno="2-161" level="4"><display>(G)</display>funeral clothing and accessories;</subsection><subsection ssid="2-null-108" dnum="H-o" numlevel="1" lineno="276" slineno="2-162" level="4"><display>(H)</display>a monument;</subsection><subsection ssid="2-null-109" dnum="I-o" numlevel="1" lineno="277" slineno="2-163" level="4"><display>(I)</display>a grave marker; and</subsection><subsection ssid="2-null-110" dnum="J-o" numlevel="1" lineno="278" slineno="2-164" level="4"><display>(J)</display>a cremation or alkaline hydrolysis urn.</subsection></subsection></subsection><subsection ssid="2-null-111" dnum="b-o" numlevel="1" lineno="279" slineno="2-165" level="2"><display>(b)</display>"Preneed funeral arrangement" does not include a policy or product of life insurance <ln numlevel="1" lineno="280" slineno="2-166"/>providing a death benefit cash payment upon the death of the beneficiary <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="82" groupid="71" style="2" owner="ahaskell" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="68" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> <ln numlevel="1" lineno="281" slineno="2-167"/>is not limited to providing the products or services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="73" dnum="28-o:29-i" numlevel="1" lineno="286" slineno="2-172" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1157" style="2" owner="o" level="1" deltag="both">(28)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="both" space="true">(29)</amend></display>"Pulverization" means the reduction of identifiable bone fragments after the <ln numlevel="1" lineno="287" slineno="2-173"/>completion of the cremation or alkaline hydrolysis and processing to granulated particles <ln numlevel="1" lineno="288" slineno="2-174"/>by manual or mechanical means.</subsection><subsection ssid="2-null-114" dnum="29-o:_-i" numlevel="1" lineno="289" slineno="2-175" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1158" style="2" owner="o" level="1" deltag="start">(29)</amend></display><amend anum="0" ea="erase" pairid="85" groupid="74" style="2" owner="ahaskell" level="1" deltag="end">"Resomation" means the alkaline hydrolysis process.</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-115" dnum="30-o" numlevel="1" lineno="290" slineno="2-176" level="1"><display>(30)</display>"Sales agent" means an individual licensed under this chapter as a preneed funeral <ln numlevel="1" lineno="291" slineno="2-177"/>arrangement sales agent.</subsection><subsection ssid="2-null-116" dnum="31-o" numlevel="1" lineno="292" slineno="2-178" level="1"><display>(31)</display>"Temporary container" means a receptacle for cremated or alkaline hydrolysis remains <ln numlevel="1" lineno="293" slineno="2-179"/>usually made of cardboard, plastic, or similar material designed to hold the cremated <ln numlevel="1" lineno="294" slineno="2-180"/>remains until an urn or other permanent container is acquired.</subsection><subsection ssid="2-null-117" dnum="32-o" numlevel="1" lineno="295" slineno="2-181" level="1"><display>(32)</display>"Unlawful conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501" start="0">58-1-501</xref> and <xref depth="3" refnumber="58-9-501" start="0"><ln numlevel="1" lineno="296" slineno="2-182"/>58-9-501</xref>.</subsection><subsection ssid="2-null-118" dnum="33-o" numlevel="1" lineno="297" slineno="2-183" level="1"><display>(33)</display>"Unprofessional conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501" start="0">58-1-501</xref> <ln numlevel="1" lineno="298" slineno="2-184"/>and <xref depth="3" refnumber="58-9-502" start="0">58-9-502</xref>.</subsection><subsection ssid="2-null-119" dnum="34-o" numlevel="1" lineno="299" slineno="2-185" level="1"><display>(34)</display>"Urn" means a receptacle designed to permanently encase cremated or alkaline <ln numlevel="1" lineno="300" slineno="2-186"/>hydrolysis remains.</subsection></section></bsec><bsec buid="3" num="58-9-302" type="amend" src="code" uid="C58-9-S302_2026050620260506" sort="58 09 03020020260506" numlevel="1" lineno="301" slineno="3-1" sn="3"><section number="58-9-302" numlevel="1" lineno="302" slineno="3-2" type="amend"><secline lineno="301">Section 3. Section <bold>58-9-302</bold> is amended to read:</secline><catline lineno="302"><bold>58-9-302<parens/>. Qualifications for licensure.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="303" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Each applicant for licensure as a funeral service director shall:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="304" slineno="3-4" level="2"><display>(a)</display>submit an application in a form <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="ahaskell" level="1" deltag="both">prescribed by </amend><amendoutend style="2"/>the division<amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both"> approves</amend>;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="305" slineno="3-5" level="2"><display>(b)</display>pay a fee as determined by the department under Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>;</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="306" slineno="3-6" level="2"><display>(c)</display>have obtained a high school diploma or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the</amend> equivalent or a higher education <ln numlevel="1" lineno="307" slineno="3-7"/>degree;</subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="308" slineno="3-8" level="2"><display>(d)</display>have obtained an associate degree, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the</amend> equivalent, in mortuary science from a <ln numlevel="1" lineno="309" slineno="3-9"/>school of funeral service accredited by the American Board of Funeral Service <ln numlevel="1" lineno="310" slineno="3-10"/>Education or other accrediting body recognized by the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="44" style="2" owner="ahaskell" level="1" deltag="both">U.S.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="43" style="1" owner="ahaskell" level="1" amendtag="both" space="true">United States</amend> <ln numlevel="1" lineno="311" slineno="3-11"/>Department of Education;</subsection><subsection ssid="3-null-6" dnum="e-o" numlevel="1" lineno="312" slineno="3-12" level="2"><display>(e)</display>have completed not less than 2,000 hours and 50 embalmings of satisfactory <ln numlevel="1" lineno="313" slineno="3-13"/>performance in training as a licensed funeral service intern under the supervision of a <ln numlevel="1" lineno="314" slineno="3-14"/>licensed funeral service director; and</subsection><subsection ssid="3-null-7" dnum="f-o" numlevel="1" lineno="315" slineno="3-15" level="2"><display>(f)</display>obtain a passing score on examinations approved by the division in collaboration <ln numlevel="1" lineno="316" slineno="3-16"/>with the board.</subsection></subsection><subsection ssid="3-null-8" dnum="2-o" numlevel="1" lineno="317" slineno="3-17" level="1"><display>(2)</display>Each applicant for licensure as a funeral service intern shall:<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="318" slineno="3-18" level="2"><display>(a)</display>submit an application in a form <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="ahaskell" level="1" deltag="both">prescribed by </amend><amendoutend style="2"/>the division<amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both"> approves</amend>;</subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="319" slineno="3-19" level="2"><display>(b)</display>pay a fee as determined by the department under Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>;</subsection><subsection ssid="3-null-11" dnum="c-o" numlevel="1" lineno="320" slineno="3-20" level="2"><display>(c)</display>have obtained a high school diploma or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="31" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the</amend> equivalent or a higher education <ln numlevel="1" lineno="321" slineno="3-21"/>degree; and</subsection><subsection ssid="3-null-12" dnum="d-o" numlevel="1" lineno="322" slineno="3-22" level="2"><display>(d)</display>obtain a passing score on an examination approved by the division in collaboration <ln numlevel="1" lineno="323" slineno="3-23"/>with the board.</subsection></subsection><subsection ssid="3-null-13" dnum="3-o" numlevel="1" lineno="324" slineno="3-24" level="1"><display>(3)</display>Each applicant for licensure as a funeral service establishment and each funeral service <ln numlevel="1" lineno="325" slineno="3-25"/>establishment licensee shall:<subsection ssid="3-null-14" dnum="a-o" numlevel="1" lineno="326" slineno="3-26" level="2"><display>(a)</display>submit an application in a form <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="33" style="2" owner="ahaskell" level="1" deltag="both">prescribed by </amend><amendoutend style="2"/>the division<amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both"> approves</amend>;</subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="327" slineno="3-27" level="2"><display>(b)</display>pay a fee as determined by the department under Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>;</subsection><subsection ssid="3-null-16" dnum="c-o" numlevel="1" lineno="328" slineno="3-28" level="2"><display>(c)</display>have in place:<subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="329" slineno="3-29" level="3"><display>(i)</display>an embalming room for preparing dead human bodies for burial or final <ln numlevel="1" lineno="330" slineno="3-30"/>disposition, which may serve one or more facilities operated by the applicant;</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="331" slineno="3-31" level="3"><display>(ii)</display>a refrigeration room that maintains a temperature of not more than 40 degrees <ln numlevel="1" lineno="332" slineno="3-32"/>fahrenheit for preserving dead human bodies <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="35" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> burial or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="36" style="2" owner="ahaskell" level="1" deltag="both">final </amend><amendoutend style="2"/><ln numlevel="1" lineno="333" slineno="3-33"/>disposition, which may serve one or more facilities operated by the applicant; and</subsection><subsection ssid="3-null-19" dnum="iii-o" numlevel="1" lineno="334" slineno="3-34" level="3"><display>(iii)</display>maintain at all times a licensed funeral service director who is responsible for the <ln numlevel="1" lineno="335" slineno="3-35"/>day-to-day operation of the funeral service establishment and who is personally <ln numlevel="1" lineno="336" slineno="3-36"/>available to perform the services for which the license is required;</subsection></subsection><subsection ssid="3-null-20" dnum="d-o" numlevel="1" lineno="337" slineno="3-37" level="2"><display>(d)</display>affiliate with a licensed preneed funeral arrangement sales agent or funeral service <ln numlevel="1" lineno="338" slineno="3-38"/>director if the funeral service establishment sells preneed funeral arrangements;</subsection><subsection ssid="3-null-21" dnum="e-o" numlevel="1" lineno="339" slineno="3-39" level="2"><display>(e)</display>file with the completed application a copy of each form of contract or agreement the <ln numlevel="1" lineno="340" slineno="3-40"/>applicant will use in the sale of preneed funeral arrangements;</subsection><subsection ssid="3-null-22" dnum="f-o" numlevel="1" lineno="341" slineno="3-41" level="2"><display>(f)</display>provide evidence of appropriate licensure with the Insurance Department if the <ln numlevel="1" lineno="342" slineno="3-42"/>applicant intends to engage in the sale of any preneed funeral arrangements funded in <ln numlevel="1" lineno="343" slineno="3-43"/>whole or in part by an insurance policy or product to be sold by the provider or the <ln numlevel="1" lineno="344" slineno="3-44"/>provider's sales agent; and</subsection><subsection ssid="3-null-23" dnum="g-o" numlevel="1" lineno="345" slineno="3-45" level="2"><display>(g)</display>if the applicant intends to offer alkaline hydrolysis<amend anum="0" ea="amend" pairid="19" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic reduction</amend> in a <ln numlevel="1" lineno="346" slineno="3-46"/>funeral service establishment, provide evidence that in accordance with rules made <ln numlevel="1" lineno="347" slineno="3-47"/>by the division in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="348" slineno="3-48"/>Rulemaking Act:<subsection ssid="3-null-24" dnum="i-o" numlevel="1" lineno="349" slineno="3-49" level="3"><display>(i)</display>the funeral service establishment meets the minimum standards for the handling, <ln numlevel="1" lineno="350" slineno="3-50"/>holding, and processing of deceased human remains in a safe, clean, private, and <ln numlevel="1" lineno="351" slineno="3-51"/>respectful manner; and</subsection><subsection ssid="3-null-25" dnum="ii-o" numlevel="1" lineno="352" slineno="3-52" level="3"><display>(ii)</display>all operators of the alkaline hydrolysis <amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic reduction </amend>equipment <ln numlevel="1" lineno="353" slineno="3-53"/>have received adequate training.</subsection></subsection></subsection><subsection ssid="3-null-26" dnum="4-o" numlevel="1" lineno="354" slineno="3-54" level="1"><display>(4)</display>Each applicant for licensure as a preneed funeral arrangement sales agent shall:<subsection ssid="3-null-27" dnum="a-o" numlevel="1" lineno="355" slineno="3-55" level="2"><display>(a)</display>submit an application in a form <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="39" style="2" owner="ahaskell" level="1" deltag="both">prescribed by </amend><amendoutend style="2"/>the division<amend anum="0" ea="amend" pairid="21" groupid="21" style="1" owner="ahaskell" level="1" amendtag="both"> approves</amend>;</subsection><subsection ssid="3-null-28" dnum="b-o" numlevel="1" lineno="356" slineno="3-56" level="2"><display>(b)</display>pay a fee as determined by the department under Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>;</subsection><subsection ssid="3-null-29" dnum="c-o" numlevel="1" lineno="357" slineno="3-57" level="2"><display>(c)</display>have obtained a high school diploma or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="41" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="22" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the</amend> equivalent or a higher education <ln numlevel="1" lineno="358" slineno="3-58"/>degree;</subsection><subsection ssid="3-null-30" dnum="d-o" numlevel="1" lineno="359" slineno="3-59" level="2"><display>(d)</display>have obtained a passing score on an examination approved by the division in <ln numlevel="1" lineno="360" slineno="3-60"/>collaboration with the board;</subsection><subsection ssid="3-null-31" dnum="e-o" numlevel="1" lineno="361" slineno="3-61" level="2"><display>(e)</display>affiliate with a licensed funeral service establishment; and</subsection><subsection ssid="3-null-32" dnum="f-o" numlevel="1" lineno="362" slineno="3-62" level="2"><display>(f)</display>provide evidence of appropriate licensure with the Insurance Department if the <ln numlevel="1" lineno="363" slineno="3-63"/>applicant intends to engage in the sale of any preneed funeral arrangements funded in <ln numlevel="1" lineno="364" slineno="3-64"/>whole or in part by an insurance policy or product.</subsection></subsection></section></bsec><bsec buid="4" num="58-9-501" type="amend" src="code" uid="C58-9-S501_2026050620260506" sort="58 09 05010020260506" numlevel="1" lineno="365" slineno="4-1" sn="4"><section number="58-9-501" numlevel="1" lineno="366" slineno="4-2" type="amend"><secline lineno="365">Section 4. or</subsection><subsection ssid="5-null-11" dnum="b-o" numlevel="1" lineno="415" slineno="6-20" level="2"><display>(b)</display>the fact that the will may not be offered or admitted to probate until a later date.</subsection></subsection><subsection ssid="5-null-12" dnum="4-o" numlevel="1" lineno="416" slineno="6-21" level="1"><display>(4)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="32" style="2" owner="ahaskell" level="1" deltag="both">A person </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="26" style="1" owner="ahaskell" level="1" amendtag="both" space="true">An individual </amend>may change or cancel written directions prepared under this <ln numlevel="1" lineno="417" slineno="6-22"/>section at any time <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="33" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="27" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="34" style="2" owner="ahaskell" level="1" deltag="both">person's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual's</amend> death by providing written <ln numlevel="1" lineno="418" slineno="6-23"/>notice to all applicable persons, including:<subsection ssid="5-null-13" dnum="a-o" numlevel="1" lineno="419" slineno="6-24" level="2"><display>(a)</display>if the written directions designate a funeral service establishment or funeral service <ln numlevel="1" lineno="420" slineno="6-25"/>director, the funeral service establishment or funeral service director designated in the <ln numlevel="1" lineno="421" slineno="6-26"/>written directions; Right to rely -- Immunity.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="426" slineno="7-3" level="1" placement="noreturn"><display>(1)</display>A person signing a funeral service agreement, cremation authorization form, alkaline <ln numlevel="1" lineno="427" slineno="7-4"/>hydrolysis authorization form, <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="both">natural organic reduction authorization form, </amend>or other <ln numlevel="1" lineno="428" slineno="7-5"/>authorization for a decedent's disposition warrants the truthfulness of the facts set forth <ln numlevel="1" lineno="429" slineno="7-6"/>in the document, including the identity of the decedent and the person's authority to <ln numlevel="1" lineno="430" slineno="7-7"/>order the disposition.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="431" slineno="7-8" level="1"><display>(2)</display>A funeral service establishment has the right to rely on a contract or authorization <ln numlevel="1" lineno="432" slineno="7-9"/>executed under Subsection <xref depth="4" refnumber="58-9-606(1)" start="0">(1)</xref> and may carry out the instructions of the person whom <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="433" slineno="7-10"/>the funeral service establishment's</amend> funeral service director reasonably believes holds the <ln numlevel="1" lineno="434" slineno="7-11"/>right of disposition.</subsection><subsection ssid="6-null-3" dnum="3-o" numlevel="1" lineno="435" slineno="7-12" level="1"><display>(3)</display>A funeral service director incurs no civil or criminal liability for failure to contact or <ln numlevel="1" lineno="436" slineno="7-13"/>independently investigate the existence of any next-of-kin or relative of the decedent.</subsection><subsection ssid="6-null-4" dnum="4-o" numlevel="1" lineno="437" slineno="7-14" level="1"><display>(4)</display>If there are at least two persons in the nearest class of the next-of-kin who are equal in <ln numlevel="1" lineno="438" slineno="7-15"/>priority and a funeral service director has no knowledge of an objection by other <ln numlevel="1" lineno="439" slineno="7-16"/>members of the class, the funeral service director may rely on and act according to the <ln numlevel="1" lineno="440" slineno="7-17"/>instructions of the first person in the class to make funeral and disposition arrangements.</subsection><subsection ssid="6-null-5" dnum="5-o" numlevel="1" lineno="441" slineno="7-18" level="1"><display>(5)</display>A funeral service establishment or funeral service director who relies in good faith on <ln numlevel="1" lineno="442" slineno="7-19"/>the instructions of a person claiming the right of disposition under this part is immune <ln numlevel="1" lineno="443" slineno="7-20"/>from civil and criminal liability and disciplinary action in carrying out the disposition of <ln numlevel="1" lineno="444" slineno="7-21"/>a decedent's remains in accordance with that person's instructions.</subsection></section></bsec><bsec buid="7" num="58-9-613" type="amend" src="code" uid="C58-9-S613_2026050620260506" sort="58 09 06130020260506" numlevel="1" lineno="445" slineno="8-1" sn="8"><section number="58-9-613" numlevel="1" lineno="446" slineno="8-2" type="amend"><secline lineno="445">Section 8. Section <bold>58-9-613</bold> is amended to read:</secline><catline lineno="446"><bold>58-9-613<parens/>. Authorization for alkaline hydrolysis -- Penalties for removal of items <ln numlevel="1" lineno="447" slineno="8-3"/>from human remains.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="448" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided in this section, a funeral service establishment may not <ln numlevel="1" lineno="449" slineno="8-5"/>perform alkaline hydrolysis on human remains until the funeral service establishment <ln numlevel="1" lineno="450" slineno="8-6"/>has received:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="451" slineno="8-7" level="2"><display>(a)</display>an alkaline hydrolysis authorization form signed by an authorizing agent;</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="452" slineno="8-8" level="2"><display>(b)</display>a completed and executed burial transit permit or similar document, as provided by <ln numlevel="1" lineno="453" slineno="8-9"/>state law, indicating that disposition of the human remains is to be by alkaline <ln numlevel="1" lineno="454" slineno="8-10"/>hydrolysis; and</subsection><subsection ssid="7-null-4" dnum="c-o" numlevel="1" lineno="455" slineno="8-11" level="2"><display>(c)</display>any other documentation required by the state, county, or municipality.</subsection></subsection><subsection ssid="7-null-5" dnum="2-o" numlevel="1" lineno="456" slineno="8-12" level="1" space="false"><display>(2)</display><subsection ssid="7-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The alkaline hydrolysis authorization form shall contain, at a minimum, the <ln numlevel="1" lineno="457" slineno="8-13"/>following information:<subsection ssid="7-null-7" dnum="i-o" numlevel="1" lineno="458" slineno="8-14" level="3" tab="1"><display>(i)</display>the identity of the human remains and the time and date of death, including a <ln numlevel="1" lineno="459" slineno="8-15"/>signed declaration of visual identification of the deceased or refusal to visually <ln numlevel="1" lineno="460" slineno="8-16"/>identify the deceased;</subsection><subsection ssid="7-null-8" dnum="ii-o" numlevel="1" lineno="461" slineno="8-17" level="3" tab="1"><display>(ii)</display>the name of the funeral director and funeral service establishment that obtained <ln numlevel="1" lineno="462" slineno="8-18"/>the alkaline hydrolysis authorization;</subsection><subsection ssid="7-null-9" dnum="iii-o" numlevel="1" lineno="463" slineno="8-19" level="3" tab="1"><display>(iii)</display>notification as to whether the death occurred from a disease declared by the <ln numlevel="1" lineno="464" slineno="8-20"/>Department of Health <amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both">and Human Services </amend>to be infectious, contagious, <ln numlevel="1" lineno="465" slineno="8-21"/>communicable, or dangerous to the public health;</subsection><subsection ssid="7-null-10" dnum="iv-o" numlevel="1" lineno="466" slineno="8-22" level="3" tab="1"><display>(iv)</display>the name of the authorizing agent and the relationship between the authorizing <ln numlevel="1" lineno="467" slineno="8-23"/>agent and the decedent;</subsection><subsection ssid="7-null-11" dnum="v-o" numlevel="1" lineno="468" slineno="8-24" level="3" tab="1"><display>(v)</display>a representation that the authorizing agent has the right to authorize the <ln numlevel="1" lineno="469" slineno="8-25"/>disposition of the decedent by alkaline hydrolysis and that the authorizing agent is <ln numlevel="1" lineno="470" slineno="8-26"/>not aware of any living <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="23" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> with a superior or equal priority right to <ln numlevel="1" lineno="471" slineno="8-27"/>that of the authorizing agent, except that if there is another living <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="24" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="472" slineno="8-28"/>individual</amend> with a superior or equal priority right, the alkaline hydrolysis <ln numlevel="1" lineno="473" slineno="8-29"/>authorization form shall contain a representation that the authorizing agent has:<subsection ssid="7-null-12" dnum="A-o" numlevel="1" lineno="474" slineno="8-30" level="4"><display>(A)</display>made reasonable efforts to contact that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="26" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend>;</subsection><subsection ssid="7-null-13" dnum="B-o" numlevel="1" lineno="475" slineno="8-31" level="4"><display>(B)</display>been unable to do so; and</subsection><subsection ssid="7-null-14" dnum="C-o" numlevel="1" lineno="476" slineno="8-32" level="4"><display>(C)</display>no reason to believe that the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="28" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> would object to the disposition <ln numlevel="1" lineno="477" slineno="8-33"/>of the decedent by alkaline hydrolysis;</subsection></subsection><subsection ssid="7-null-15" dnum="vi-o" numlevel="1" lineno="478" slineno="8-34" level="3" tab="1"><display>(vi)</display>authorization for the funeral service establishment to use alkaline hydrolysis for <ln numlevel="1" lineno="479" slineno="8-35"/>the disposition of the human remains;</subsection><subsection ssid="7-null-16" dnum="vii-o" numlevel="1" lineno="480" slineno="8-36" level="3" tab="1"><display>(vii)</display>the name of the person authorized to receive the human remains from the funeral <ln numlevel="1" lineno="481" slineno="8-37"/>service establishment;</subsection><subsection ssid="7-null-17" dnum="viii-o" numlevel="1" lineno="482" slineno="8-38" level="3" tab="1"><display>(viii)</display>the manner in which the final disposition of the human remains is to take place, <ln numlevel="1" lineno="483" slineno="8-39"/>if known;</subsection><subsection ssid="7-null-18" dnum="ix-o" numlevel="1" lineno="484" slineno="8-40" level="3" tab="1"><display>(ix)</display>a listing of each item of value to be delivered to the funeral service establishment <ln numlevel="1" lineno="485" slineno="8-41"/>along with the human remains, and instructions as to how each item should be <ln numlevel="1" lineno="486" slineno="8-42"/>handled;</subsection><subsection ssid="7-null-19" dnum="x-o" numlevel="1" lineno="487" slineno="8-43" level="3" tab="1"><display>(x)</display>the signature of the authorizing agent, attesting to the accuracy of all <ln numlevel="1" lineno="488" slineno="8-44"/>representations contained on the alkaline hydrolysis authorization form;</subsection><subsection ssid="7-null-20" dnum="xi-o" numlevel="1" lineno="489" slineno="8-45" level="3" tab="1"><display>(xi)</display>if the alkaline hydrolysis authorization form is being executed on a preneed <ln numlevel="1" lineno="490" slineno="8-46"/>basis, the disclosure required for preneed programs under this chapter; and</subsection><subsection ssid="7-null-21" dnum="xii-o" numlevel="1" lineno="491" slineno="8-47" level="3" tab="1"><display>(xii)</display>except for a preneed alkaline hydrolysis authorization, the signature of the <ln numlevel="1" lineno="492" slineno="8-48"/>funeral director of the funeral service establishment that obtained the alkaline <ln numlevel="1" lineno="493" slineno="8-49"/>hydrolysis authorization.</subsection></subsection><subsection ssid="7-null-22" dnum="b-o" numlevel="1" lineno="494" slineno="8-50" level="2" space="false"><display>(b)</display><subsection ssid="7-null-23" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="52" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="61" groupid="51" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> referred to in Subsection <xref depth="4" refnumber="58-9-613(2)(a)(xii)" start="0">(2)(a)(xii)</xref> shall execute the <ln numlevel="1" lineno="495" slineno="8-51"/>alkaline hydrolysis authorization form as a witness and is not responsible for any <ln numlevel="1" lineno="496" slineno="8-52"/>of the representations made by the authorizing agent.</subsection><subsection ssid="7-null-24" dnum="ii-o" numlevel="1" lineno="497" slineno="8-53" level="3"><display>(ii)</display>The funeral director or the funeral service establishment shall warrant that the <ln numlevel="1" lineno="498" slineno="8-54"/>human remains delivered to the funeral service establishment have been positively <ln numlevel="1" lineno="499" slineno="8-55"/>identified by the authorizing agent or a designated representative of the <ln numlevel="1" lineno="500" slineno="8-56"/>authorizing agent as the decedent listed on the alkaline hydrolysis authorization <ln numlevel="1" lineno="501" slineno="8-57"/>form.</subsection><subsection ssid="7-null-25" dnum="iii-o" numlevel="1" lineno="502" slineno="8-58" level="3"><display>(iii)</display>The authorizing agent or the agent's designee may make the identification <ln numlevel="1" lineno="503" slineno="8-59"/>referred to in Subsection <xref depth="4" refnumber="58-9-613(2)(b)(ii)" start="0">(2)(b)(ii)</xref> in person or by photograph.</subsection></subsection></subsection><subsection ssid="7-null-26" dnum="3-o" numlevel="1" lineno="504" slineno="8-60" level="1" space="false"><display>(3)</display><subsection ssid="7-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A funeral service establishment may not accept unidentified human remains for <ln numlevel="1" lineno="505" slineno="8-61"/>alkaline hydrolysis.</subsection><subsection ssid="7-null-28" dnum="b-o" numlevel="1" lineno="506" slineno="8-62" level="2"><display>(b)</display>If a funeral service establishment takes custody of an alkaline hydrolysis container <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="30" style="2" owner="ahaskell" level="1" deltag="both"><ln numlevel="1" lineno="507" slineno="8-63"/>subsequent to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="ahaskell" level="1" amendtag="both" space="true">after</amend> the human remains <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="31" style="2" owner="ahaskell" level="1" deltag="both">being</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="ahaskell" level="1" amendtag="both" space="true">were</amend> placed within the container, the <ln numlevel="1" lineno="508" slineno="8-64"/>funeral service establishment <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="33" style="2" owner="ahaskell" level="1" deltag="both">can</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="ahaskell" level="1" amendtag="both" space="true">may</amend> rely on the identification made before the <ln numlevel="1" lineno="509" slineno="8-65"/>remains were placed in the container.</subsection><subsection ssid="7-null-29" dnum="c-o" numlevel="1" lineno="510" slineno="8-66" level="2"><display>(c)</display>The funeral service establishment shall place appropriate identification on the <ln numlevel="1" lineno="511" slineno="8-67"/>exterior of the alkaline hydrolysis container based on the prior identification.</subsection></subsection><subsection ssid="7-null-30" dnum="4-o:_-i" numlevel="1" lineno="512" slineno="8-68" ea="erase" anum="0" owner="ahaskell" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1260" style="2" owner="o" level="1" deltag="start">(4)</amend></display><subsection ssid="7-null-31" dnum="a-o:_-i" ea="erase" anum="0" owner="ahaskell" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1261" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="40" groupid="34" style="2" owner="ahaskell" level="1" deltag="end">A person who removes or possesses dental gold or silver, jewelry, or mementos <ln numlevel="1" lineno="513" slineno="8-69"/>from human remains:</amend><amendoutend style="2"/><subsection ssid="7-null-32" dnum="i-o:_-i" numlevel="1" lineno="514" slineno="8-70" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1262" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="41" groupid="35" style="2" owner="ahaskell" level="1" deltag="end">with purpose to deprive another over control of the property is guilty of an <ln numlevel="1" lineno="515" slineno="8-71"/>offense and subject to the punishments provided in Section <xref depth="3" refnumber="76-6-404" start="0">76-6-404</xref>;</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-33" dnum="ii-o:_-i" numlevel="1" lineno="516" slineno="8-72" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1263" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="44" groupid="38" style="2" owner="ahaskell" level="1" deltag="end">with purpose to exercise unauthorized control and with intent to temporarily <ln numlevel="1" lineno="517" slineno="8-73"/>deprive another of control over the property is guilty of an offense and subject to <ln numlevel="1" lineno="518" slineno="8-74"/>the punishments provided in Section <xref depth="3" refnumber="76-6-404.5" start="0">76-6-404.5</xref>; and</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-34" dnum="iii-o:_-i" numlevel="1" lineno="519" slineno="8-75" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1264" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="47" groupid="41" style="2" owner="ahaskell" level="1" deltag="end">under circumstances not amounting to Subsection <xref depth="4" refnumber="58-9-613(4)(a)(i)" start="0">(4)(a)(i)</xref> or <xref depth="4" refnumber="58-9-613(4)(a)(ii)" start="0">(ii)</xref> and without <ln numlevel="1" lineno="520" slineno="8-76"/>specific written permission of the individual who has the right to control those <ln numlevel="1" lineno="521" slineno="8-77"/>remains is guilty of a class B misdemeanor.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="7-null-35" dnum="b-o:_-i" numlevel="1" lineno="522" slineno="8-78" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1265" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="52" groupid="46" style="2" owner="ahaskell" level="1" deltag="end">The fact that residue or any unavoidable dental gold or dental silver or other <ln numlevel="1" lineno="523" slineno="8-79"/>precious metals remain in alkaline hydrolysis equipment or a container used in a prior <ln numlevel="1" lineno="524" slineno="8-80"/>alkaline hydrolysis process is not a violation of Subsection <xref depth="4" refnumber="58-9-613(4)(a)" start="0">(4)(a)</xref>.</amend><amendoutend style="2"/></subsection></subsection></section></bsec><bsec buid="12" num="58-9-613.5" type="enact" src="code" uid="C58-9-S613.5_2026050620260506" sort="58 09 06130520260506" numlevel="1" lineno="525" slineno="9-1" sn="9"><section numlevel="1" lineno="526" slineno="9-2" number="58-9-613.5" type="enact"><secline lineno="525">Section 9. Section <bold>58-9-613.5</bold> is enacted to read:</secline><catline lineno="526"><bold>58-9-613.5<parens/>. Authorization for natural organic reduction.</bold></catline><subsection ssid="12-1" dnum="_-o:1-i" numlevel="1" lineno="527" slineno="9-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">a natural organic reduction authorization form signed by an authorizing agent;</amend></subsection><subsection ssid="12-4" dnum="_-o:b-i" numlevel="1" lineno="531" slineno="9-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1268" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="ahaskell" level="1" amendtag="end">a completed and executed burial transit permit or similar document, as provided by <ln numlevel="1" lineno="532" slineno="9-8"/>state law, indicating that disposition of the human remains is to be by natural organic <ln numlevel="1" lineno="533" slineno="9-9"/>reduction; and</amend></subsection><subsection ssid="12-5" dnum="_-o:c-i" numlevel="1" lineno="534" slineno="9-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1269" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">any other documentation required by the state, county, or municipality.</amend></subsection></subsection><subsection ssid="12-6" dnum="_-o:2-i" numlevel="1" lineno="535" slineno="9-11" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1270" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">Except as provided in Subsection <xref tempid="483">(3)</xref>, the natural organic reduction authorization form <ln numlevel="1" lineno="536" slineno="9-12"/>shall contain, at a minimum, the following information:</amend><subsection ssid="12-7" dnum="_-o:a-i" numlevel="1" lineno="537" slineno="9-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1271" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="31" style="1" owner="ahaskell" level="1" amendtag="end">the identity of the human remains and the time and date of death, including a signed <ln numlevel="1" lineno="538" slineno="9-14"/>declaration of visual identification of the deceased or refusal to visually identify the <ln numlevel="1" authorization;</amend></subsection><subsection ssid="12-9" dnum="_-o:c-i" numlevel="1" lineno="542" slineno="9-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1273" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">notification as to whether the death occurred from a disease declared by the <ln numlevel="1" lineno="543" slineno="9-19"/>Department of Health and Human Services to be infectious, contagious, <ln numlevel="1" lineno="544" slineno="9-20"/>communicable, or dangerous to public health;</amend></subsection><subsection ssid="12-10" dnum="_-o:d-i" numlevel="1" lineno="545" slineno="9-21" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1274" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">a representation that the death did not occur due to ebola, tuberculosis, or a prion <ln numlevel="1" lineno="546" slineno="9-22"/>disease;</amend></subsection><subsection ssid="12-11" dnum="_-o:e-i" numlevel="1" lineno="547" slineno="9-23" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">the name of the authorizing agent and the relationship between the authorizing agent <ln numlevel="1" lineno="548" slineno="9-24"/>and the decedent;</amend></subsection><subsection ssid="12-12" dnum="_-o:f-i" numlevel="1" lineno="549" slineno="9-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="52" style="1" owner="ahaskell" level="1" amendtag="end">a representation that the authorizing agent has the right to authorize the disposition of <ln numlevel="1" lineno="550" slineno="9-26"/>the decedent by natural organic reduction and that the authorizing agent is not aware <ln numlevel="1" lineno="551" slineno="9-27"/>of any living individual with a superior or equal priority right to that of the <ln numlevel="1" lineno="552" slineno="9-28"/>authorizing agent, except that if there is another living individual with a superior or <ln numlevel="1" lineno="553" slineno="9-29"/>equal priority right, the natural organic reduction authorization form shall contain a <ln numlevel="1" lineno="554" slineno="9-30"/>representation that the authorizing agent has:</amend><subsection ssid="12-13" dnum="_-o:i-i" numlevel="1" lineno="555" slineno="9-31" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="56" style="1" owner="ahaskell" level="1" amendtag="end">made reasonable efforts to contact that individual;</amend></subsection><subsection ssid="12-14" dnum="_-o:ii-i" numlevel="1" lineno="556" slineno="9-32" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1278" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="60" style="1" owner="ahaskell" level="1" amendtag="end">been unable to contact the individual; and</amend></subsection><subsection ssid="12-15" dnum="_-o:iii-i" numlevel="1" lineno="557" slineno="9-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1279" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="64" style="1" owner="ahaskell" level="1" amendtag="end">no reason to believe that the individual would object to the disposition of the <ln numlevel="1" lineno="558" slineno="9-34"/>decedent by natural organic reduction;</amend></subsection></subsection><subsection ssid="12-16" dnum="_-o:g-i" numlevel="1" lineno="559" slineno="9-35" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1280" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="68" style="1" owner="ahaskell" level="1" amendtag="end">authorization for the funeral service establishment to use natural organic reduction <ln numlevel="1" lineno="560" slineno="9-36"/>for the disposition of the human remains;</amend></subsection><subsection ssid="12-17" dnum="_-o:h-i" numlevel="1" lineno="561" slineno="9-37" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1281" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">the name of the individual authorized to receive the human remains from the funeral <ln numlevel="1" lineno="562" slineno="9-38"/>service establishment;</amend></subsection><subsection ssid="12-18" dnum="_-o:i-i" numlevel="1" lineno="563" slineno="9-39" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="76" style="1" owner="ahaskell" level="1" amendtag="end">the manner in which the final disposition of the human remains is to take place, if <ln numlevel="1" lineno="564" slineno="9-40"/>known;</amend></subsection><subsection ssid="12-19" dnum="_-o:j-i" numlevel="1" lineno="565" slineno="9-41" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="86" style="1" owner="ahaskell" level="1" amendtag="end">a listing of each item of value to be delivered to the funeral service establishment <ln numlevel="1" lineno="566" slineno="9-42"/>along with the human remains, and instructions as to how each item should be <ln numlevel="1" lineno="567" slineno="9-43"/>handled;</amend></subsection><subsection ssid="12-20" dnum="_-o:k-i" numlevel="1" lineno="568" slineno="9-44" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1284" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="85" style="1" owner="ahaskell" level="1" amendtag="end">the signature of the authorizing agent, attesting to the accuracy of all representations <ln numlevel="1" lineno="569" slineno="9-45"/>contained on the natural organic reduction authorization form; and</amend></subsection><subsection ssid="12-21" dnum="_-o:l-i" numlevel="1" lineno="570" slineno="9-46" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1285" style="1" owner="i" level="1" amendtag="start">(l)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">the signature of the funeral director of the funeral service establishment that obtained <ln numlevel="1" lineno="571" slineno="9-47"/>the natural organic reduction authorization.</amend></subsection></subsection><subsection ssid="12-22" dnum="_-o:3-i" numlevel="1" lineno="572" slineno="9-48" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1286" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="94" style="1" owner="ahaskell" level="1" amendtag="end">If the natural organic reduction form is being executed as part of a preneed funeral <ln numlevel="1" lineno="573" slineno="9-49"/>arrangement, the natural organic reduction authorization form shall:</amend><subsection ssid="12-23" dnum="_-o:a-i" numlevel="1" lineno="574" slineno="9-50" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1287" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="104" style="1" owner="ahaskell" level="1" amendtag="end">contain the disclosure requirements for preneed programs under this chapter; and</amend></subsection><subsection ssid="12-24" dnum="_-o:b-i" numlevel="1" lineno="575" slineno="9-51" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1288" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="103" style="1" owner="ahaskell" level="1" amendtag="end">contain, at a minimum, the following information:</amend><subsection ssid="12-25" dnum="_-o:i-i" numlevel="1" lineno="576" slineno="9-52" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1289" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="108" style="1" owner="ahaskell" level="1" amendtag="end">the identity of the individual who, upon the individual's death, desires that the <ln numlevel="1" lineno="577" slineno="9-53"/>individual's remains undergo the natural organic reduction process;</amend></subsection><subsection ssid="12-26" dnum="_-o:ii-i" numlevel="1" lineno="578" slineno="9-54" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1290" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">the name of the authorizing agent and the relationship between the authorizing <ln numlevel="1" lineno="579" slineno="9-55"/>agent and the individual described in Subsection <xref tempid="846">(3)(b)(i)</xref>;</amend></subsection><subsection ssid="12-27" dnum="_-o:iii-i" numlevel="1" lineno="580" slineno="9-56" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1291" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">a representation that the authorizing agent has the right to authorize the <ln numlevel="1" lineno="581" slineno="9-57"/>disposition of the individual's remains described in Subsection <xref tempid="909">(3)(b)(i)</xref> by natural <ln numlevel="1" lineno="582" slineno="9-58"/>organic reduction and that the individual described in Subsection <xref tempid="165">(3)(b)(i)</xref> <ln numlevel="1" lineno="583" slineno="9-59"/>consents to the authorizing agent's disposition of the individual's remains;</amend></subsection><subsection ssid="12-28" dnum="_-o:iv-i" numlevel="1" lineno="584" slineno="9-60" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1292" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="120" style="1" owner="ahaskell" level="1" amendtag="end">authorization for the funeral service establishment to use natural organic <ln numlevel="1" lineno="585" slineno="9-61"/>reduction for the disposition of human remains;</amend></subsection><subsection ssid="12-29" dnum="_-o:v-i" numlevel="1" lineno="586" slineno="9-62" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1293" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="124" style="1" owner="ahaskell" level="1" amendtag="end">the name of the individual authorized to receive the human remains from the <ln numlevel="1" lineno="587" slineno="9-63"/>funeral service establishment;</amend></subsection><subsection ssid="12-30" dnum="_-o:vi-i" numlevel="1" lineno="588" slineno="9-64" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="128" style="1" owner="ahaskell" level="1" amendtag="end">the manner in which the final disposition of the human remains is to take place, if <ln numlevel="1" lineno="589" slineno="9-65"/>known;</amend></subsection><subsection ssid="12-31" dnum="_-o:vii-i" numlevel="1" lineno="590" slineno="9-66" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="132" style="1" owner="ahaskell" level="1" amendtag="end">a listing of each item of value to be delivered to the funeral service <ln numlevel="1" lineno="591" slineno="9-67"/>establishment along with the human remains, and instructions as to how each item <ln numlevel="1" lineno="592" slineno="9-68"/>should be handled; and</amend></subsection><subsection ssid="12-32" dnum="_-o:viii-i" numlevel="1" lineno="593" slineno="9-69" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1296" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="136" style="1" owner="ahaskell" level="1" amendtag="end">the signature of the authorizing agent, attesting to the accuracy of all <ln numlevel="1" lineno="594" slineno="9-70"/>representations contained on the natural organic reduction authorization form.</amend></subsection></subsection></subsection><subsection ssid="12-33" dnum="_-o:4-i" numlevel="1" lineno="595" slineno="9-71" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1297" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="12-34" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1298" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="183" groupid="144" style="1" owner="ahaskell" level="1" amendtag="end">The individual referred to in Subsection <xref tempid="282">(2)</xref>(l) shall execute the natural organic <ln numlevel="1" lineno="596" slineno="9-72"/>reduction authorization form as a witness and is not responsible for any of the <ln numlevel="1" lineno="597" slineno="9-73"/>representations made by the authorizing agent.</amend></subsection><subsection ssid="12-35" dnum="_-o:b-i" numlevel="1" lineno="598" slineno="9-74" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1299" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="149" style="1" owner="ahaskell" level="1" amendtag="end">The funeral director or the funeral service establishment shall warrant that the human <ln numlevel="1" lineno="599" slineno="9-75"/>remains delivered to the funeral service establishment have been positively identified <ln numlevel="1" lineno="600" slineno="9-76"/>by the authorizing agent or a designated representative of the authorizing agent as the <ln numlevel="1" lineno="601" slineno="9-77"/>decedent listed on the natural organic reduction authorization form.</amend></subsection><subsection ssid="12-36" dnum="_-o:c-i" numlevel="1" lineno="602" slineno="9-78" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1300" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="196" groupid="153" style="1" owner="ahaskell" level="1" amendtag="end">The authorizing agent or the authorizing agent's designee may make the <ln numlevel="1" lineno="603" slineno="9-79"/>identification referred to in Subsection <xref tempid="588">(4)(b)</xref> in person or by photograph.</amend></subsection></subsection><subsection ssid="12-37" dnum="_-o:5-i" numlevel="1" lineno="604" slineno="9-80" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1301" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="12-38" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1302" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="164" style="1" owner="ahaskell" level="1" amendtag="end">A funeral service establishment may not accept unidentified human remains for <ln numlevel="1" lineno="605" slineno="9-81"/>natural organic reduction.</amend></subsection><subsection ssid="12-39" dnum="_-o:b-i" numlevel="1" lineno="606" slineno="9-82" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1303" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="210" groupid="163" style="1" owner="ahaskell" level="1" amendtag="end">If a funeral service establishment takes custody of a natural organic reduction <ln numlevel="1" lineno="607" slineno="9-83"/>container after the human remains were placed within the container, the funeral <ln numlevel="1" lineno="608" slineno="9-84"/>service establishment may rely on the identification made before the remains were <ln numlevel="1" lineno="609" slineno="9-85"/>placed in the container.</amend></subsection><subsection ssid="12-40" dnum="_-o:c-i" numlevel="1" lineno="610" slineno="9-86" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="168" style="1" owner="ahaskell" level="1" amendtag="end">The funeral service establishment shall place appropriate identification on the <ln numlevel="1" lineno="611" slineno="9-87"/>exterior of the natural organic reduction container based on the prior identification.</amend></subsection></subsection></section></bsec><bsec buid="8" num="58-9-614" type="amend" Recordkeeping.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="614" slineno="10-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="8-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A funeral service establishment shall furnish to the person <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="ahaskell" level="1" deltag="both">who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> delivers <ln numlevel="1" lineno="615" slineno="10-4"/>human remains to the establishment for alkaline hydrolysis<amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic <ln numlevel="1" lineno="616" slineno="10-5"/>reduction</amend> a receipt signed by a representative of the establishment and the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="21" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="617" slineno="10-6"/>individual</amend> making the delivery, showing:<subsection ssid="8-null-3" dnum="i-o" numlevel="1" lineno="618" slineno="10-7" level="3" tab="1"><display>(i)</display>the date and time of the delivery;</subsection><subsection ssid="8-null-4" dnum="ii-o" numlevel="1" lineno="619" slineno="10-8" level="3" tab="1"><display>(ii)</display>the type of casket or alternative container delivered;</subsection><subsection ssid="8-null-5" dnum="iii-o" numlevel="1" lineno="620" slineno="10-9" level="3" tab="1"><display>(iii)</display>the name of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> from whom the human remains were received;</subsection><subsection ssid="8-null-6" dnum="iv-o" numlevel="1" lineno="621" slineno="10-10" level="3" tab="1"><display>(iv)</display>the name of the funeral establishment or other entity with whom the person <ln numlevel="1" lineno="622" slineno="10-11"/>making the delivery is affiliated;</subsection><subsection ssid="8-null-7" dnum="v-o" numlevel="1" lineno="623" slineno="10-12" level="3" tab="1"><display>(v)</display>the name of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> who received the human remains on behalf of <ln numlevel="1" lineno="624" slineno="10-13"/>the funeral service establishment; and</subsection><subsection ssid="8-null-8" dnum="vi-o" numlevel="1" lineno="625" slineno="10-14" level="3" tab="1"><display>(vi)</display>the name of the decedent.</subsection></subsection><subsection ssid="8-null-9" dnum="b-o" numlevel="1" lineno="626" slineno="10-15" level="2"><display>(b)</display>The funeral service establishment shall keep a copy of the receipt in the funeral <ln numlevel="1" lineno="627" slineno="10-16"/>service establishment's permanent records for a period of seven years.</subsection></subsection><subsection ssid="8-null-10" dnum="2-o" numlevel="1" lineno="628" slineno="10-17" level="1" space="false"><display>(2)</display><subsection ssid="8-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon release of human remains after alkaline hydrolysis<amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic <ln numlevel="1" lineno="629" slineno="10-18"/>reduction</amend>, a funeral service establishment shall furnish to the person <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="ahaskell" level="1" deltag="both">who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> <ln numlevel="1" lineno="630" slineno="10-19"/>receives the human remains a receipt signed by a representative of the funeral service <ln numlevel="1" lineno="631" slineno="10-20"/>establishment and the person who receives the human remains, showing:<subsection ssid="8-null-12" dnum="i-o" numlevel="1" lineno="632" slineno="10-21" level="3" tab="1"><display>(i)</display>the date and time of the release;</subsection><subsection ssid="8-null-13" dnum="ii-o" numlevel="1" lineno="633" slineno="10-22" level="3" tab="1"><display>(ii)</display>the name of the person to whom the human remains were released; and</subsection><subsection ssid="8-null-14" dnum="iii-o" numlevel="1" lineno="634" slineno="10-23" level="3" tab="1"><display>(iii)</display>if applicable:<subsection ssid="8-null-15" dnum="A-o" numlevel="1" lineno="635" slineno="10-24" level="4"><display>(A)</display>the name of the funeral establishment, cemetery, or other entity with whom <ln numlevel="1" lineno="636" slineno="10-25"/>the person receiving the human remains is affiliated;</subsection><subsection ssid="8-null-16" dnum="B-o" numlevel="1" lineno="637" slineno="10-26" level="4"><display>(B)</display>the name of the person who released the human remains on behalf of the <ln numlevel="1" lineno="638" slineno="10-27"/>funeral service establishment; and</subsection><subsection ssid="8-null-17" dnum="C-o" numlevel="1" lineno="639" slineno="10-28" level="4"><display>(C)</display>the name of the decedent.</subsection></subsection></subsection><subsection ssid="8-null-18" dnum="b-o" numlevel="1" lineno="640" slineno="10-29" level="2" space="false"><display>(b)</display><subsection ssid="8-null-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The receipt shall contain a representation from the person receiving the human <ln numlevel="1" lineno="641" slineno="10-30"/>remains confirming that the remains will not be used for any improper purpose.</subsection><subsection ssid="8-null-20" dnum="ii-o" numlevel="1" lineno="642" slineno="10-31" level="3"><display>(ii)</display>Upon release of the human remains, the person to whom the human remains were <ln numlevel="1" lineno="643" slineno="10-32"/>released may transport the human remains in any manner in the state, without a <ln numlevel="1" lineno="644" slineno="10-33"/>permit, and dispose of the human remains in accordance with this chapter.</subsection></subsection><subsection ssid="8-null-21" dnum="c-o" numlevel="1" lineno="645" slineno="10-34" level="2"><display>(c)</display>The funeral service establishment shall retain a copy of the receipt in the funeral <ln numlevel="1" lineno="646" slineno="10-35"/>service establishment's permanent records for a period of seven years.</subsection></subsection><subsection ssid="8-null-22" dnum="3-o" numlevel="1" lineno="647" slineno="10-36" level="1" space="false"><display>(3)</display><subsection ssid="8-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The funeral service establishment shall maintain at the funeral service <ln numlevel="1" lineno="648" slineno="10-37"/>establishment's place of business a permanent record of each disposition by alkaline <ln numlevel="1" lineno="649" slineno="10-38"/>hydrolysis <amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic reduction </amend>that took place at the funeral service <ln numlevel="1" lineno="650" slineno="10-39"/>establishment.</subsection><subsection ssid="8-null-24" dnum="b-o" numlevel="1" lineno="651" slineno="10-40" level="2"><display>(b)</display>The permanent record shall contain:<subsection ssid="8-null-25" dnum="i-o" numlevel="1" lineno="652" slineno="10-41" level="3"><display>(i)</display>the name of the decedent;</subsection><subsection ssid="8-null-26" dnum="ii-o" numlevel="1" lineno="653" slineno="10-42" level="3"><display>(ii)</display>the date of disposition by alkaline hydrolysis<amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic reduction</amend>;</subsection><subsection ssid="8-null-27" dnum="iii-o" numlevel="1" lineno="654" slineno="10-43" level="3"><display>(iii)</display>the final disposition of the human remains; and</subsection><subsection ssid="8-null-28" dnum="iv-o" numlevel="1" lineno="655" slineno="10-44" level="3"><display>(iv)</display>any other document required by this chapter.</subsection></subsection></subsection></section></bsec><bsec buid="9" num="58-9-615" type="amend" src="code" uid="C58-9-S615_2026050620260506" sort="58 09 06150020260506" numlevel="1" lineno="656" slineno="11-1" sn="11"><section number="58-9-615" numlevel="1" lineno="657" slineno="11-2" type="amend"><secline lineno="656">Section 11. Section <bold>58-9-615</bold> is amended to read:</secline><catline lineno="657"><bold>58-9-615<parens/>. Accepting remains for alkaline hydrolysis or natural organic reduction.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="658" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>A funeral service establishment may not make or enforce a rule requiring that human <ln numlevel="1" lineno="659" slineno="11-4"/>remains be placed in a casket before alkaline hydrolysis<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic reduction</amend>.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="660" slineno="11-5" level="1"><display>(2)</display>A funeral service establishment may not refuse to accept human remains for alkaline <ln numlevel="1" lineno="661" slineno="11-6"/>hydrolysis<amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic reduction</amend> because the human remains are not in a casket.</subsection><subsection ssid="9-3" dnum="_-o:3-i" numlevel="1" lineno="662" slineno="11-7" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1335" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="end">When using natural organic reduction to dispose of human remains, a funeral service <ln numlevel="1" lineno="663" slineno="11-8"/>establishment shall ensure that all materials in the container holding the human remains <ln numlevel="1" lineno="664" slineno="11-9"/>are readily reducible by natural organic reduction.</amend></subsection></section></bsec><bsec buid="10" num="58-9-618" type="amend" src="code" uid="C58-9-S618_2026050620260506" sort="58 09 06180020260506" numlevel="1" lineno="665" slineno="12-1" sn="12"><section number="58-9-618" numlevel="1" lineno="666" slineno="12-2" type="amend"><secline lineno="665">Section 12. Section <bold>58-9-618</bold> is amended to read:</secline><catline lineno="666"><bold>58-9-618<parens/>. Limitation of liability.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="667" slineno="12-3" level="1" placement="noreturn"><display>(1)</display>An authorizing agent who signs an alkaline hydrolysis <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic reduction </amend><ln numlevel="1" lineno="668" slineno="12-4"/>authorization form warrants the truthfulness of the facts set forth on the form, including:<subsection ssid="10-null-2" dnum="a-o" numlevel="1" lineno="669" slineno="12-5" level="2"><display>(a)</display>the identity of the deceased whose remains are to undergo the alkaline hydrolysis <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both">or <ln numlevel="1" lineno="670" slineno="12-6"/>natural organic reduction </amend>process; and</subsection><subsection ssid="10-null-3" dnum="b-o" numlevel="1" lineno="671" slineno="12-7" level="2"><display>(b)</display>the authorizing agent's authority to order the alkaline hydrolysis <amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic <ln numlevel="1" lineno="672" slineno="12-8"/>reduction </amend>process.</subsection></subsection><subsection ssid="10-null-4" dnum="2-o" numlevel="1" lineno="673" slineno="12-9" level="1"><display>(2)</display>A funeral service establishment may rely upon the representations made by an <ln numlevel="1" lineno="674" slineno="12-10"/>authorizing agent under Subsection <xref depth="4" refnumber="58-9-618(1)" start="0">(1)</xref>.</subsection><subsection ssid="10-null-5" dnum="3-o" numlevel="1" lineno="675" slineno="12-11" level="1"><display>(3)</display>The authorizing agent is personally and individually liable for all damage resulting from <ln numlevel="1" lineno="676" slineno="12-12"/>a misstatement or misrepresentation made under Subsection <xref depth="4" refnumber="58-9-618(1)" start="0">(1)</xref>.</subsection><subsection ssid="10-null-6" dnum="4-o" numlevel="1" lineno="677" slineno="12-13" level="1" space="false"><display>(4)</display><subsection ssid="10-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A funeral service establishment may arrange for the alkaline hydrolysis <amend anum="0" ea="amend" pairid="33" groupid="33" style="1" owner="ahaskell" level="1" amendtag="both">or natural <ln numlevel="1" lineno="678" slineno="12-14"/>organic reduction </amend>process upon receipt of an alkaline hydrolysis<amend anum="0" ea="amend" pairid="38" groupid="38" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic <ln numlevel="1" lineno="679" slineno="12-15"/>reduction</amend> authorization form signed by an authorizing agent.</subsection><subsection ssid="10-null-8" dnum="b-o" numlevel="1" lineno="680" slineno="12-16" level="2"><display>(b)</display>A funeral service establishment that arranges the alkaline hydrolysis <amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both">or natural <ln numlevel="1" lineno="681" slineno="12-17"/>organic reduction </amend>process or releases or disposes of human remains from the alkaline <ln numlevel="1" lineno="682" slineno="12-18"/>hydrolysis<amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both"> or natural organic reduction</amend> process pursuant to an alkaline hydrolysis <amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both">or a <ln numlevel="1" lineno="683" slineno="12-19"/>natural organic reduction </amend>authorization form is not liable for an action the funeral <ln numlevel="1" lineno="684" slineno="12-20"/>service establishment takes pursuant to that authorization.</subsection></subsection><subsection ssid="10-null-9" dnum="5-o" numlevel="1" lineno="685" slineno="12-21" level="1"><display>(5)</display>A funeral service establishment is not responsible or liable for any valuables delivered <ln numlevel="1" lineno="686" slineno="12-22"/>to the establishment with human remains.</subsection><subsection ssid="10-null-10" dnum="6-o" numlevel="1" lineno="687" slineno="12-23" level="1"><display>(6)</display>A funeral service establishment may refuse to arrange for the alkaline hydrolysis <amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both">or <ln numlevel="1" lineno="688" slineno="12-24"/>natural organic reduction </amend>process of a decedent, to accept human remains for the <ln numlevel="1" lineno="689" slineno="12-25"/>alkaline hydrolysis <amend anum="0" ea="amend" pairid="19" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic reduction </amend>process, or to perform the alkaline <ln numlevel="1" lineno="690" slineno="12-26"/>hydrolysis <amend anum="0" ea="amend" pairid="21" groupid="21" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic reduction </amend>process:<subsection ssid="10-null-11" dnum="a-o" numlevel="1" lineno="691" slineno="12-27" level="2"><display>(a)</display>if the <amend anum="0" ea="amend" pairid="26" groupid="26" style="1" owner="ahaskell" level="1" amendtag="both">funeral service </amend>establishment is aware of a dispute concerning the disposition <ln numlevel="1" lineno="692" slineno="12-28"/>of the human remains and the funeral service establishment has not received a court <ln numlevel="1" lineno="693" slineno="12-29"/>order or other suitable confirmation that the dispute has been resolved;</subsection><subsection ssid="10-null-12" dnum="b-o" numlevel="1" lineno="694" slineno="12-30" level="2"><display>(b)</display>if the<amend anum="0" ea="amend" pairid="27" groupid="27" style="1" owner="ahaskell" level="1" amendtag="both"> funeral service</amend> establishment has a reasonable basis for questioning any of the <ln numlevel="1" lineno="695" slineno="12-31"/>representations made by an authorizing agent; or</subsection><subsection ssid="10-null-13" dnum="c-o" numlevel="1" lineno="696" slineno="12-32" level="2"><display>(c)</display>for any other lawful reason.</subsection></subsection><subsection ssid="10-null-14" dnum="7-o" numlevel="1" lineno="697" slineno="12-33" level="1" space="false"><display>(7)</display><subsection ssid="10-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a funeral service establishment is aware of a dispute concerning the release or <ln numlevel="1" lineno="698" slineno="12-34"/>disposition of remains from the alkaline hydrolysis <amend anum="0" ea="amend" pairid="34" groupid="34" style="1" owner="ahaskell" level="1" amendtag="both">or natural organic reduction </amend><ln numlevel="1" lineno="699" slineno="12-35"/>process in the funeral service establishment's possession, the<amend anum="0" ea="amend" pairid="36" groupid="36" style="1" owner="ahaskell" level="1" amendtag="both"> funeral service</amend> <ln numlevel="1" lineno="700" slineno="12-36"/>establishment may refuse to release the remains until:<subsection ssid="10-null-16" dnum="i-o" numlevel="1" lineno="701" slineno="12-37" level="3" tab="1"><display>(i)</display>the dispute has been resolved; or</subsection><subsection ssid="10-null-17" dnum="ii-o" numlevel="1" lineno="702" slineno="12-38" level="3" tab="1"><display>(ii)</display>the funeral service establishment has received a court order authorizing the <ln numlevel="1" lineno="703" slineno="12-39"/>release or disposition of the remains.</subsection></subsection><subsection ssid="10-null-18" dnum="b-o" numlevel="1" lineno="704" slineno="12-40" level="2"><display>(b)</display>A funeral service establishment is not liable for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the funeral service <ln numlevel="1" lineno="705" slineno="12-41"/>establishment's</amend> refusal to release or dispose of remains from the alkaline hydrolysis <amend anum="0" ea="amend" pairid="29" groupid="29" style="1" owner="ahaskell" level="1" amendtag="both"><ln numlevel="1" lineno="706" slineno="12-42"/>or natural organic reduction </amend>process in accordance with this Subsection <xref depth="4" refnumber="58-9-618(7)" start="0">(7)</xref>.</subsection></subsection></section></bsec><bsec buid="13" num="58-9-620" type="enact" src="code" uid="C58-9-S620_2026050620260506" sort="58 09 06200020260506" numlevel="1" lineno="707" slineno="13-1" sn="13"><section numlevel="1" lineno="708" slineno="13-2" number="58-9-620" type="enact"><secline lineno="707">Section 13. Section <bold>58-9-620</bold> is enacted to read:</secline><catline lineno="708"><bold>58-9-620<parens/>. Penalties for removal of items from human remains.</bold></catline><subsection ssid="13-1" dnum="_-o:1-i" numlevel="1" lineno="709" slineno="13-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1354" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">An individual who removes or possesses dental gold or silver, jewelry, or mementos <ln numlevel="1" lineno="710" slineno="13-4"/>from human remains:</amend><subsection ssid="13-2" dnum="_-o:a-i" numlevel="1" lineno="711" slineno="13-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1355" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">with purpose to deprive another over control of the property is guilty of an offense <ln numlevel="1" lineno="712" slineno="13-6"/>described in Section <xref depth="3" refnumber="76-6-404">76-6-404</xref>;</amend></subsection><subsection ssid="13-3" dnum="_-o:b-i" numlevel="1" lineno="713" slineno="13-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1356" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">with purpose to exercise unauthorized control and with intent to temporarily deprive <ln numlevel="1" lineno="714" slineno="13-8"/>another over control of the property is guilty of an offense described in Section <xref depth="3" refnumber="76-6-404.5"><ln numlevel="1" lineno="715" slineno="13-9"/>76-6-404.5</xref>; and</amend></subsection><subsection ssid="13-4" dnum="_-o:c-i" numlevel="1" lineno="716" slineno="13-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1357" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">under circumstances that do not amount to the activities described in Subsection <xref depth="4" refnumber="58-9-620(1)(a)"><ln numlevel="1" lineno="717" slineno="13-11"/>(1)(a)</xref> or <xref depth="4" refnumber="58-9-620(b)">(b)</xref>, and without specific written permission of the individual who has the <ln numlevel="1" lineno="718" slineno="13-12"/>right to control those remains, is guilty of a class B misdemeanor.</amend></subsection></subsection><subsection ssid="13-5" dnum="_-o:2-i" numlevel="1" lineno="719" slineno="13-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1358" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">The fact that residue or any unavoidable dental gold or dental silver or other precious <ln numlevel="1" lineno="720" slineno="13-14"/>metal remain in alkaline hydrolysis equipment or a container used in a prior alkaline <ln numlevel="1" lineno="721" slineno="13-15"/>hydrolysis process is not a violation of Subsection <xref tempid="824">(1)</xref>.</amend></subsection></section></bsec><bsec buid="14" num="58-9-621" type="enact" src="code" uid="C58-9-S621_2026050620260506" sort="58 09 06210020260506" numlevel="1" lineno="722" slineno="14-1" sn="14"><section numlevel="1" lineno="723" slineno="14-2" number="58-9-621" type="enact"><secline lineno="722">Section 14. Section <bold>58-9-621</bold> is enacted to read:</secline><catline lineno="723"><bold>58-9-621<parens/>. Procedure for natural organic reduction.</bold></catline><subsection ssid="14-1" dnum="_-o:1-i" numlevel="1" lineno="724" slineno="14-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1359" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">A funeral service establishment may not perform natural organic reduction on human <ln numlevel="1" lineno="725" slineno="14-4"/>remains unless the funeral service establishment:</amend><subsection ssid="14-2" dnum="_-o:a-i" numlevel="1" lineno="726" slineno="14-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1360" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">completes and files a death certificate with the Office of Vital Records and Statistics <ln numlevel="1" lineno="727" slineno="14-6"/>and the county health department as indicated on the regular medical certificate of <ln numlevel="1" lineno="728" slineno="14-7"/>death or the medical examiner's certificate; and</amend></subsection><subsection ssid="14-3" dnum="_-o:b-i" numlevel="1" lineno="729" slineno="14-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1361" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="ahaskell" level="1" amendtag="end">complies with the provisions of Section <xref depth="3" refnumber="26B-8-230">26B-8-230</xref>.</amend></subsection></subsection><subsection ssid="14-4" dnum="_-o:2-i" numlevel="1" lineno="730" slineno="14-9" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1362" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="ahaskell" level="1" amendtag="end">A funeral service establishment may not perform simultaneous natural organic reduction <ln numlevel="1" lineno="731" slineno="14-10"/>of the human remains of more than one individual within the same natural organic <ln numlevel="1" lineno="732" slineno="14-11"/>reduction container.</amend></subsection><subsection ssid="14-5" dnum="_-o:3-i" numlevel="1" lineno="733" slineno="14-12" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1363" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">A funeral service establishment shall:</amend><subsection ssid="14-6" dnum="_-o:a-i" numlevel="1" lineno="734" slineno="14-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1364" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="ahaskell" level="1" amendtag="end">verify the identification of human remains as indicated on a natural organic reduction <ln numlevel="1" lineno="735" slineno="14-14"/>container immediately before performing natural organic reduction;</amend></subsection><subsection ssid="14-8" dnum="_-o:b-i" numlevel="1" lineno="736" slineno="14-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1365" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">attach an identification tag to the natural organic reduction container; and</amend></subsection><subsection ssid="14-10" dnum="_-o:c-i" numlevel="1" lineno="737" slineno="14-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1366" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">ensure that the identification tag remains on the natural organic reduction container <ln numlevel="1" lineno="738" slineno="14-17"/>until the natural organic reduction process is complete.</amend></subsection></subsection><subsection ssid="14-11" dnum="_-o:4-i" numlevel="1" lineno="739" slineno="14-18" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="ahaskell" level="1" amendtag="end">Upon completion of the natural organic reduction process, the funeral service <ln numlevel="1" lineno="740" slineno="14-19"/>establishment shall:</amend><subsection ssid="14-12" dnum="_-o:a-i" numlevel="1" lineno="741" slineno="14-20" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1368" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="43" style="1" owner="ahaskell" level="1" amendtag="end">to the extent possible, remove all of the recoverable residue of the remains of the <ln numlevel="1" lineno="742" slineno="14-21"/>natural organic reduction process from the natural organic reduction container;</amend></subsection><subsection ssid="14-13" dnum="_-o:b-i" numlevel="1" lineno="743" slineno="14-22" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="ahaskell" level="1" amendtag="end">separate all other residue from the natural organic reduction process from remaining <ln numlevel="1" lineno="744" slineno="14-23"/>bone fragment, to the extent possible, and process the bone fragments to reduce the <ln numlevel="1" lineno="745" slineno="14-24"/>bone fragments to unidentifiable particles; and</amend></subsection><subsection ssid="14-14" dnum="_-o:c-i" numlevel="1" lineno="746" slineno="14-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1370" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="51" style="1" owner="ahaskell" level="1" amendtag="end">remove anything other than the unidentifiable bone particles from the remains of the <ln numlevel="1" lineno="747" slineno="14-26"/>natural organic reduction process, to the extent possible, and dispose of that material.</amend></subsection></subsection><subsection ssid="14-15" dnum="_-o:5-i" numlevel="1" lineno="748" slineno="14-27" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1371" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="14-16" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1372" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="63" style="1" owner="ahaskell" level="1" amendtag="end">A funeral service establishment shall pack the unidentifiable bone particles <ln numlevel="1" lineno="749" slineno="14-28"/>described in Subsection <xref tempid="861">(4)</xref> and the identification tag described in Subsection <xref tempid="670">(3)</xref> in <ln numlevel="1" lineno="750" slineno="14-29"/>an urn or temporary container ordered by the authorizing agent.</amend></subsection><subsection ssid="14-17" dnum="_-o:b-i" numlevel="1" lineno="751" slineno="14-30" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1373" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="62" style="1" owner="ahaskell" level="1" amendtag="end">The funeral service establishment shall pack any urn or temporary container in clean <ln numlevel="1" lineno="752" slineno="14-31"/>packing materials and prevent contamination with any other object, unless otherwise <ln numlevel="1" lineno="753" slineno="14-32"/>directed by the authorizing agent.</amend></subsection><subsection ssid="14-18" dnum="_-o:c-i" numlevel="1" lineno="754" slineno="14-33" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1374" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">If the remains of the natural organic reduction process cannot fit within the <ln numlevel="1" lineno="755" slineno="14-34"/>designated urn or temporary container, the funeral service establishment shall:</amend><subsection ssid="14-19" dnum="_-o:i-i" numlevel="1" lineno="756" slineno="14-35" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1375" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="71" style="1" owner="ahaskell" level="1" amendtag="end">return the excess remains to the authorizing agent or the agent's representative in a <ln numlevel="1" lineno="757" slineno="14-36"/>separate temporary container; and</amend></subsection><subsection ssid="14-20" dnum="_-o:ii-i" numlevel="1" lineno="758" slineno="14-37" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1376" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="76" style="1" owner="ahaskell" level="1" amendtag="end">mark both a designated urn and a temporary container on the outside with the <ln numlevel="1" lineno="759" slineno="14-38"/>name of the decedent and an indication that the remains of the named decedent are <ln numlevel="1" lineno="760" slineno="14-39"/>in both the designated urn and the temporary container.</amend></subsection></subsection></subsection><subsection ssid="14-21" dnum="_-o:6-i" numlevel="1" lineno="761" slineno="14-40" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1377" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="14-22" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1378" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="87" style="1" owner="ahaskell" level="1" amendtag="end">If the remains are to be shipped, the funeral service establishment shall pack any <ln numlevel="1" lineno="762" slineno="14-41"/>designated urn or temporary container.</amend></subsection><subsection ssid="14-23" dnum="_-o:b-i" numlevel="1" lineno="763" slineno="14-42" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1379" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="86" style="1" owner="ahaskell" level="1" amendtag="end">The funeral service establishment shall have the remains shipped only by a method <ln numlevel="1" lineno="764" slineno="14-43"/>that:</amend><subsection ssid="14-24" dnum="_-o:i-i" numlevel="1" lineno="765" slineno="14-44" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1380" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="91" style="1" owner="ahaskell" level="1" amendtag="end">has an available tracking system; and</amend></subsection><subsection ssid="14-25" dnum="_-o:ii-i" numlevel="1" lineno="766" slineno="14-45" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1381" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="95" style="1" owner="ahaskell" level="1" amendtag="end">provides a receipt signed by the individual accepting the delivery.</amend></subsection></subsection></subsection></section></bsec><bsec buid="15" num="58-9-622" type="enact" src="code" uid="C58-9-S622_2026050620260506" sort="58 09 06220020260506" numlevel="1" lineno="767" slineno="15-1" sn="15"><section numlevel="1" lineno="768" slineno="15-2" number="58-9-622" type="enact"><secline lineno="767">Section 15. Section <bold>58-9-622</bold> is enacted to read:</secline><catline lineno="768"><bold>58-9-622<parens/>. Disposition of remains from the natural organic reduction process.</bold></catline><subsection ssid="15-1" dnum="_-o:1-i" numlevel="1" lineno="769" slineno="15-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1382" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">As used in this section, "remains" means the remaining soil left after the decomposition <ln numlevel="1" lineno="770" slineno="15-4"/>of a body through the natural organic reduction process.</amend></subsection><subsection ssid="15-2" dnum="_-o:2-i" numlevel="1" lineno="771" slineno="15-5" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1383" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="15-3" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1384" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">The authorizing agent is responsible for the disposition of the remains.</amend></subsection><subsection ssid="15-4" dnum="_-o:b-i" numlevel="1" lineno="772" slineno="15-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1385" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="ahaskell" level="1" amendtag="end">An authorizing agent shall provide the person with which natural organic reduction <ln numlevel="1" lineno="773" slineno="15-7"/>arrangements are made a signed statement specifying the disposition of the remains, <ln numlevel="1" lineno="774" slineno="15-8"/>if known.</amend></subsection><subsection ssid="15-5" dnum="_-o:c-i" numlevel="1" lineno="775" slineno="15-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1386" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">The person to which the authorizing agent provides the signed statement described in <ln numlevel="1" lineno="776" slineno="15-10"/>Subsection <xref tempid="388">(2)(b)</xref> shall retain a copy of the statement.</amend></subsection><subsection ssid="15-6" dnum="_-o:d-i" numlevel="1" lineno="777" slineno="15-11" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1387" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">If the authorizing agent or the agent's representative has not specified the ultimate <ln numlevel="1" lineno="778" slineno="15-12"/>disposition of or claimed the remains within 60 days after the day on which the <ln numlevel="1" lineno="779" slineno="15-13"/>natural organic reduction process occurs, the funeral service establishment may <ln numlevel="1" lineno="780" slineno="15-14"/>dispose of the remains in any manner permitted by law, except scattering.</amend></subsection><subsection ssid="15-7" dnum="_-o:e-i" numlevel="1" lineno="781" slineno="15-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1388" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">The authorizing agent shall reimburse the funeral service establishment for all <ln numlevel="1" lineno="782" slineno="15-16"/>reasonable costs incurred in disposing of the remains under Subsection <xref tempid="537">(2)(d)</xref>.</amend></subsection><subsection ssid="15-8" dnum="_-o:f-i" numlevel="1" lineno="783" slineno="15-17" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1389" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">The person disposing of remains under this section:</amend><subsection ssid="15-9" dnum="_-o:i-i" numlevel="1" lineno="784" slineno="15-18" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1390" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="37" style="1" owner="ahaskell" level="1" amendtag="end">shall make and keep a record of the final disposition of the remains; and</amend></subsection><subsection ssid="15-11" dnum="_-o:ii-i" numlevel="1" lineno="785" slineno="15-19" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1391" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="42" style="1" owner="ahaskell" level="1" amendtag="end">is discharged from any legal obligation or liability concerning the remains once <ln numlevel="1" lineno="786" slineno="15-20"/>the final disposition has been made.</amend></subsection></subsection></subsection><subsection ssid="15-12" dnum="_-o:3-i" numlevel="1" lineno="787" slineno="15-21" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1392" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">An authorizing agent may direct a funeral service establishment to dispose of or arrange <ln numlevel="1" lineno="788" slineno="15-22"/>for the final disposition of remains:</amend><subsection ssid="15-14" dnum="_-o:a-i" numlevel="1" lineno="789" slineno="15-23" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1393" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="59" style="1" owner="ahaskell" level="1" amendtag="end">in a crypt, niche, grave, or scattering garden located in a dedicated cemetery;</amend></subsection><subsection ssid="15-15" dnum="_-o:b-i" numlevel="1" lineno="790" slineno="15-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1394" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="58" style="1" owner="ahaskell" level="1" amendtag="end">by placing the remains in uninhabited public land, the sea, or other public waterways <ln numlevel="1" lineno="791" slineno="15-25"/>subject to health and environmental laws and regulations; or</amend></subsection><subsection ssid="15-16" dnum="_-o:c-i" numlevel="1" lineno="792" slineno="15-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1395" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="63" style="1" owner="ahaskell" level="1" amendtag="end">except as provided in Section <xref depth="3" refnumber="58-9-501">58-9-501</xref> and subject to Subsection (4), in any manner <ln numlevel="1" lineno="793" slineno="15-27"/>on the private property of a consenting owner.</amend></subsection></subsection><subsection ssid="15-17" dnum="_-o:4-i" numlevel="1" lineno="794" slineno="15-28" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1396" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">If remains are to be disposed of on private property, other than dedicated cemetery <ln numlevel="1" lineno="795" slineno="15-29"/>property:</amend><subsection ssid="15-22" dnum="_-o:a-i" numlevel="1" lineno="796" slineno="15-30" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1397" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="87" style="1" owner="ahaskell" level="1" amendtag="end">the authorizing agent shall provide the funeral service establishment with the written <ln numlevel="1" lineno="797" slineno="15-31"/>consent of the property owner before disposal of the remains; and</amend></subsection><subsection ssid="15-23" dnum="_-o:b-i" numlevel="1" lineno="798" slineno="15-32" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1398" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="91" style="1" owner="ahaskell" level="1" amendtag="end">the owner of the private property shall:</amend><subsection ssid="15-24" dnum="_-o:i-i" numlevel="1" lineno="799" slineno="15-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1399" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="95" style="1" owner="ahaskell" level="1" amendtag="end">ensure that the remains are placed on the private property within a removable <ln numlevel="1" lineno="800" slineno="15-34"/>container;</amend></subsection><subsection ssid="15-25" dnum="_-o:ii-i" numlevel="1" lineno="801" slineno="15-35" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1400" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="99" style="1" owner="ahaskell" level="1" amendtag="end">place a physical marker directly adjacent to the removable container indicating <ln numlevel="1" lineno="802" slineno="15-36"/>the placement of the remains; and</amend></subsection><subsection ssid="15-26" dnum="_-o:iii-i" numlevel="1" lineno="803" slineno="15-37" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1401" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="103" style="1" owner="ahaskell" level="1" amendtag="end">before conveying the property on which the final disposition of the remains <ln numlevel="1" lineno="804" slineno="15-38"/>occurs, disclose to the person to whom the owner intends to convey the property:</amend><subsection ssid="15-27" dnum="_-o:A-i" numlevel="1" lineno="805" slineno="15-39" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1402" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="108" style="1" owner="ahaskell" level="1" amendtag="end">the existence of the remains on the property;</amend></subsection><subsection ssid="15-28" dnum="_-o:B-i" numlevel="1" lineno="806" slineno="15-40" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1403" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">the location of the remains on the property;
