Section <bold>58-9-102</bold> is amended to read:</secline><catline lineno="24"><bold>58-9-102<parens/>. Definitions.</bold></catline><sectionText lineno="25"><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="15" style="2" owner="ahaskell" level="1" deltag="both">In addition to the definitions in Section <xref depth="3" refnumber="58-1-102" start="0">58-1-102</xref>, as</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both" space="true">As</amend> used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-4" level="1" space="false"><display>(1)</display><subsection ssid="1-122" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Alkaline hydrolysis" means a water-based dissolution process using alkaline <ln numlevel="1" lineno="27" slineno="1-5"/>chemicals, heat, and sometimes agitation or pressure that reduces human remains to a <ln numlevel="1" lineno="28" slineno="1-6"/>liquid and to dry bone residue<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="18" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="78" groupid="65" style="1" owner="ahaskell" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="1-123" dnum="_-o:b-i" numlevel="1" lineno="29" slineno="1-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">"Alkaline hydrolysis"</amend> includes the disposal of the liquid and the processing and <ln numlevel="1" lineno="30" slineno="1-8"/>pulverization of the dry bone residue.</subsection></subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="31" slineno="1-9" level="1"><display>(2)</display>"Alkaline hydrolysis chamber" means the enclosed space within which the alkaline <ln numlevel="1" lineno="32" slineno="1-10"/>hydrolysis process takes place and that is used exclusively for alkaline hydrolysis of <ln numlevel="1" lineno="33" slineno="1-11"/>human remains.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="34" slineno="1-12" level="1"><display>(3)</display>"Alkaline hydrolysis container" means a container:<subsection ssid="1-null-4" dnum="a-o" numlevel="1" lineno="35" slineno="1-13" level="2"><display>(a)</display>in which human remains are transported to a funeral service establishment and <ln numlevel="1" lineno="36" slineno="1-14"/>placed in an alkaline hydrolysis chamber for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="32" style="2" owner="ahaskell" level="1" deltag="both">resomation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="29" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the alkaline hydrolysis <ln numlevel="1" lineno="37" slineno="1-15"/>process</amend>; and</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="38" slineno="1-16" level="2"><display>(b)</display>that meets substantially all of the following standards:<subsection ssid="1-null-6" dnum="i-o" numlevel="1" lineno="39" slineno="1-17" level="3"><display>(i)</display>able to be closed in order to provide a complete covering for the human remains;</subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="40" slineno="1-18" level="3"><display>(ii)</display>resistant to leakage or spillage;</subsection><subsection ssid="1-null-8" dnum="iii-o" numlevel="1" lineno="41" slineno="1-19" level="3"><display>(iii)</display>rigid enough for handling with ease; and</subsection><subsection ssid="1-null-9" dnum="iv-o" numlevel="1" lineno="42" slineno="1-20" level="3"><display>(iv)</display>able to provide protection for the health, safety, and personal integrity of <ln numlevel="1" lineno="43" slineno="1-21"/>crematory personnel.</subsection></subsection></subsection><subsection ssid="1-null-10" dnum="4-o" numlevel="1" lineno="44" slineno="1-22" level="1"><display>(4)</display>"Authorizing agent" means a person legally entitled to authorize the cremation or the <ln numlevel="1" lineno="45" slineno="1-23"/>alkaline hydrolysis process of human remains.</subsection><subsection ssid="1-null-11" dnum="5-o" numlevel="1" lineno="46" slineno="1-24" level="1"><display>(5)</display>"Beneficiary" means the individual who, at the time of the individual's death, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="63" style="2" owner="ahaskell" level="1" deltag="both">is to <ln numlevel="1" lineno="47" slineno="1-25"/>receive</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="75" groupid="62" style="1" owner="ahaskell" level="1" amendtag="both" space="true">receives</amend> the benefit of the property and services purchased under a preneed <ln numlevel="1" lineno="48" slineno="1-26"/>funeral arrangement.</subsection><subsection ssid="1-null-12" dnum="6-o" numlevel="1" lineno="49" slineno="1-27" level="1"><display>(6)</display>"Board" means the Board of Funeral Service created in Section <xref depth="3" refnumber="58-9-201" start="0">58-9-201</xref>.</subsection><subsection ssid="1-null-13" dnum="7-o" numlevel="1" lineno="50" slineno="1-28" level="1"><display>(7)</display>"Body part" means:<subsection ssid="1-null-14" dnum="a-o" numlevel="1" lineno="51" slineno="1-29" level="2"><display>(a)</display>a limb or other portion of the anatomy that is removed from <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="67" style="2" owner="ahaskell" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="66" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an individual</amend> <ln numlevel="1" lineno="52" slineno="1-30"/>or human remains for medical purposes during treatment, surgery, biopsy, autopsy, or <ln numlevel="1" lineno="53" slineno="1-31"/>medical research; or</subsection><subsection ssid="1-null-15" dnum="b-o" numlevel="1" lineno="54" slineno="1-32" level="2"><display>(b)</display>a human body or any portion of a body that has been donated to science for medical <ln numlevel="1" lineno="55" slineno="1-33"/>research purposes.</subsection></subsection><subsection ssid="1-null-16" dnum="8-o" numlevel="1" lineno="56" slineno="1-34" level="1"><display>(8)</display>"Buyer" means a person who purchases a preneed funeral arrangement.</subsection><subsection ssid="1-null-17" dnum="9-o" numlevel="1" lineno="57" slineno="1-35" level="1"><display>(9)</display>"Calcination" means a process in which a dead human body is reduced by intense heat <ln numlevel="1" lineno="58" slineno="1-36"/>to a residue that is not as substantive as the residue that follows cremation.</subsection><subsection ssid="1-null-18" dnum="10-o" numlevel="1" lineno="59" slineno="1-37" level="1"><display>(10)</display>"Cremated remains" means all the remains of a cremated body recovered after the <ln numlevel="1" lineno="60" slineno="1-38"/>completion of the cremation process, including pulverization <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="35" style="2" owner="ahaskell" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="31" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> leaves only <ln numlevel="1" lineno="61" slineno="1-39"/>bone fragments reduced to unidentifiable dimensions and may possibly include the <ln numlevel="1" lineno="62" slineno="1-40"/>residue of foreign matter including casket material, bridgework, or eyeglasses that were <ln numlevel="1" lineno="63" slineno="1-41"/>cremated with the human remains.</subsection><subsection ssid="1-null-19" dnum="11-o" numlevel="1" lineno="64" slineno="1-42" level="1" space="false"><display>(11)</display><subsection ssid="1-124" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Cremation" means the technical process, using direct flame and heat, or a <ln numlevel="1" lineno="65" slineno="1-43"/>chemical process, that reduces human remains to bone fragments through heat and <ln numlevel="1" lineno="66" slineno="1-44"/>evaporation, or a chemical process<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="37" style="2" owner="ahaskell" level="1" deltag="both">, and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="ahaskell" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="1-125" dnum="_-o:b-i" numlevel="1" lineno="67" slineno="1-45" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">"Cremation" </amend>includes the processing and usually the pulverization of the bone <ln numlevel="1" lineno="68" slineno="1-46"/>fragments.</subsection></subsection><subsection ssid="1-null-20" dnum="12-o" numlevel="1" lineno="69" slineno="1-47" level="1"><display>(12)</display>"Cremation chamber" means the enclosed space within which the cremation process <ln numlevel="1" lineno="70" slineno="1-48"/>takes place and which is used exclusively for the cremation of human remains.</subsection><subsection ssid="1-null-21" dnum="13-o" numlevel="1" lineno="71" slineno="1-49" level="1"><display>(13)</display>"Cremation container" means the container:<subsection ssid="1-null-22" dnum="a-o" numlevel="1" lineno="72" slineno="1-50" level="2"><display>(a)</display>in which the human remains are transported to the crematory and placed in the <ln numlevel="1" lineno="73" slineno="1-51"/>cremation chamber for cremation; and</subsection><subsection ssid="1-null-23" dnum="b-o" numlevel="1" lineno="74" slineno="1-52" level="2"><display>(b)</display>that meets substantially all of the following standards:<subsection ssid="1-null-24" dnum="i-o" numlevel="1" lineno="75" slineno="1-53" level="3"><display>(i)</display>composed of readily combustible or consumable materials suitable for cremation;</subsection><subsection ssid="1-null-25" dnum="ii-o" numlevel="1" lineno="76" slineno="1-54" level="3"><display>(ii)</display>able to be closed in order to provide a complete covering for the human remains;</subsection><subsection ssid="1-null-26" dnum="iii-o" numlevel="1" lineno="77" slineno="1-55" level="3"><display>(iii)</display>resistant to leakage or spillage;</subsection><subsection ssid="1-null-27" dnum="iv-o" numlevel="1" lineno="78" slineno="1-56" level="3"><display>(iv)</display>rigid enough for handling with ease; and</subsection><subsection ssid="1-null-28" dnum="v-o" numlevel="1" lineno="79" slineno="1-57" level="3"><display>(v)</display>able to provide protection for the health, safety, and personal integrity of <ln numlevel="1" lineno="80" slineno="1-58"/>crematory personnel.</subsection></subsection></subsection><subsection ssid="1-null-29" dnum="14-o" numlevel="1" lineno="81" slineno="1-59" level="1"><display>(14)</display>"Crematory" means the building or portion of a building that houses the cremation <ln numlevel="1" lineno="82" slineno="1-60"/>chamber and the holding facility.</subsection><subsection ssid="1-null-30" dnum="15-o" numlevel="1" lineno="83" slineno="1-61" level="1"><display>(15)</display>"Direct disposition" means the disposition of a dead human body:<subsection ssid="1-null-31" dnum="a-o" numlevel="1" lineno="84" slineno="1-62" level="2"><display>(a)</display>as quickly as law allows;</subsection><subsection ssid="1-null-32" dnum="b-o" numlevel="1" lineno="85" slineno="1-63" level="2"><display>(b)</display>without preparation of the body by embalming; and</subsection><subsection ssid="1-null-33" dnum="c-o" numlevel="1" lineno="86" slineno="1-64" level="2"><display>(c)</display>without an attendant funeral service or graveside service.</subsection></subsection><subsection ssid="1-null-34" dnum="16-o" numlevel="1" lineno="87" slineno="1-65" level="1"><display>(16)</display>"Disposition" means the final disposal of a dead human body by:<subsection ssid="1-null-35" dnum="a-o" numlevel="1" lineno="88" slineno="1-66" level="2"><display>(a)</display>earth interment;</subsection><subsection ssid="1-null-36" dnum="b-o" numlevel="1" lineno="89" slineno="1-67" level="2"><display>(b)</display>above ground burial;</subsection><subsection ssid="1-null-37" dnum="c-o" numlevel="1" lineno="90" slineno="1-68" level="2"><display>(c)</display>cremation;</subsection><subsection ssid="1-null-38" dnum="d-o" numlevel="1" lineno="91" slineno="1-69" level="2"><display>(d)</display>calcination;</subsection><subsection ssid="1-null-39" dnum="e-o" numlevel="1" lineno="92" slineno="1-70" level="2"><display>(e)</display>alkaline hydrolysis;</subsection><subsection ssid="1-null-40" dnum="f-o" numlevel="1" lineno="93" slineno="1-71" level="2"><display>(f)</display>burial at sea;</subsection><subsection ssid="1-null-41" dnum="g-o" numlevel="1" lineno="94" slineno="1-72" level="2"><display>(g)</display>delivery to a medical institution; or</subsection><subsection ssid="1-null-42" dnum="h-o" numlevel="1" lineno="95" slineno="1-73" level="2"><display>(h)</display>other lawful means.</subsection></subsection><subsection ssid="1-null-43" dnum="17-o" numlevel="1" lineno="96" slineno="1-74" level="1"><display>(17)</display>"Embalming" means replacing body fluids in a dead human body with preserving and <ln numlevel="1" lineno="97" slineno="1-75"/>disinfecting chemicals.</subsection><subsection ssid="1-null-44" dnum="18-o" numlevel="1" lineno="98" slineno="1-76" level="1" space="false"><display>(18)</display><subsection ssid="1-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Funeral merchandise" means any of the following into which a dead human <ln numlevel="1" lineno="99" slineno="1-77"/>body is placed in connection with the transportation or disposition of the body:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="100" slineno="1-78" level="3" tab="1"><display>(i)</display>a vault;</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="101" slineno="1-79" level="3" tab="1"><display>(ii)</display>a casket; or</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="102" slineno="1-80" level="3" tab="1"><display>(iii)</display>other personal property.</subsection></subsection><subsection ssid="1-null-49" dnum="b-o" numlevel="1" lineno="103" slineno="1-81" level="2"><display>(b)</display>"Funeral merchandise" does not include:<subsection ssid="1-null-50" dnum="i-o" numlevel="1" lineno="104" slineno="1-82" level="3"><display>(i)</display>a mausoleum crypt;</subsection><subsection ssid="1-null-51" dnum="ii-o" numlevel="1" lineno="105" slineno="1-83" level="3"><display>(ii)</display>an interment receptacle preset in a cemetery; or</subsection><subsection ssid="1-null-52" dnum="iii-o" numlevel="1" lineno="106" slineno="1-84" level="3"><display>(iii)</display>a columbarium niche.</subsection></subsection></subsection><subsection ssid="1-null-53" dnum="19-o" numlevel="1" lineno="107" slineno="1-85" level="1"><display>(19)</display>"Funeral service" means a service, rite, or ceremony performed:<subsection ssid="1-null-54" dnum="a-o" numlevel="1" lineno="108" slineno="1-86" level="2"><display>(a)</display>with respect to the death of a human; and</subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="109" slineno="1-87" level="2"><display>(b)</display>with the body of the deceased present.</subsection></subsection><subsection ssid="1-null-56" dnum="20-o" numlevel="1" lineno="110" slineno="1-88" level="1"><display>(20)</display>"Funeral service director" means an individual licensed under this chapter who may <ln numlevel="1" lineno="111" slineno="1-89"/>engage in all lawful professional activities regulated and defined under the practice of <ln numlevel="1" lineno="112" slineno="1-90"/>funeral service.</subsection><subsection ssid="1-null-57" dnum="21-o" numlevel="1" lineno="113" slineno="1-91" level="1" space="false"><display>(21)</display><subsection ssid="1-null-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Funeral service establishment" means a place of business at a specific street <ln numlevel="1" lineno="114" slineno="1-92"/>address or location licensed under this chapter that is devoted to:<subsection ssid="1-null-59" dnum="i-o" numlevel="1" lineno="115" slineno="1-93" level="3" tab="1"><display>(i)</display>the embalming, care, custody, shelter, preparation for burial, and final disposition <ln numlevel="1" lineno="116" slineno="1-94"/>of dead human bodies; and</subsection><subsection ssid="1-null-60" dnum="ii-o" numlevel="1" lineno="117" slineno="1-95" level="3" tab="1"><display>(ii)</display>the furnishing of services, merchandise, and products purchased from the <ln numlevel="1" lineno="118" slineno="1-96"/>establishment as a preneed provider under a preneed funeral arrangement.</subsection></subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="119" slineno="1-97" level="2"><display>(b)</display>"Funeral service establishment" includes:<subsection ssid="1-null-62" dnum="i-o" numlevel="1" lineno="120" slineno="1-98" level="3"><display>(i)</display>all portions of the business premises and all tools, instruments, and supplies used <ln numlevel="1" lineno="121" slineno="1-99"/>in the preparation and embalming of dead human bodies for burial, cremation, <ln numlevel="1" lineno="122" slineno="1-100"/>alkaline hydrolysis, and final disposition as defined by division rule; and</subsection><subsection ssid="1-null-63" dnum="ii-o" numlevel="1" lineno="123" slineno="1-101" level="3"><display>(ii)</display>a facility used by the business in which funeral services may be conducted.</subsection></subsection></subsection><subsection ssid="1-null-64" dnum="22-o" numlevel="1" lineno="124" slineno="1-102" level="1"><display>(22)</display>"Funeral service intern" means an individual licensed under this chapter who is <ln numlevel="1" lineno="125" slineno="1-103"/>permitted to:<subsection ssid="1-null-65" dnum="a-o" numlevel="1" lineno="126" slineno="1-104" level="2"><display>(a)</display>assist a funeral service director in the embalming or other preparation of a dead <ln numlevel="1" lineno="127" slineno="1-105"/>human body for disposition;</subsection><subsection ssid="1-null-66" dnum="b-o" numlevel="1" lineno="128" slineno="1-106" level="2"><display>(b)</display>assist a funeral service director in the cremation, calcination, alkaline hydrolysis, or <ln numlevel="1" lineno="129" slineno="1-107"/>pulverization of a dead human body or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="50" style="2" owner="ahaskell" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="47" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the body's</amend> remains; and</subsection><subsection ssid="1-null-67" dnum="c-o" numlevel="1" lineno="130" slineno="1-108" level="2"><display>(c)</display>perform other funeral service activities under the supervision of a funeral service <ln numlevel="1" lineno="131" slineno="1-109"/>director.</subsection></subsection><subsection ssid="1-null-68" dnum="23-o" numlevel="1" lineno="132" slineno="1-110" level="1"><display>(23)</display>"Graveside service" means a funeral service held at the location of disposition.</subsection><subsection ssid="1-null-69" dnum="24-o" numlevel="1" lineno="133" slineno="1-111" level="1"><display>(24)</display>"Memorial service" means a service, rite, or ceremony performed:<subsection ssid="1-null-70" dnum="a-o" numlevel="1" lineno="134" slineno="1-112" level="2"><display>(a)</display>with respect to the death of a human; and</subsection><subsection ssid="1-null-71" dnum="b-o" numlevel="1" lineno="135" slineno="1-113" level="2"><display>(b)</display>without the body of the deceased present.</subsection></subsection><subsection ssid="1-null-72" dnum="25-o" numlevel="1" lineno="136" slineno="1-114" level="1"><display>(25)</display>"Practice of funeral service" means:<subsection ssid="1-null-73" dnum="a-o" numlevel="1" lineno="137" slineno="1-115" level="2"><display>(a)</display>supervising the receipt of custody and transportation of a dead human body to <ln numlevel="1" lineno="138" slineno="1-116"/>prepare the body for:<subsection ssid="1-null-74" dnum="i-o" numlevel="1" lineno="139" slineno="1-117" level="3"><display>(i)</display>disposition; or</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="140" slineno="1-118" level="3"><display>(ii)</display>shipment to another location;</subsection></subsection><subsection ssid="1-null-76" dnum="b-o" numlevel="1" lineno="141" slineno="1-119" level="2"><display>(b)</display>entering into a contract with a person to provide professional services regulated <ln numlevel="1" lineno="142" slineno="1-120"/>under this chapter;</subsection><subsection ssid="1-null-77" dnum="c-o" numlevel="1" lineno="143" slineno="1-121" level="2"><display>(c)</display>embalming or otherwise preparing a dead human body for disposition;</subsection><subsection ssid="1-null-78" dnum="d-o" numlevel="1" lineno="144" slineno="1-122" level="2"><display>(d)</display>supervising the arrangement or conduct of:<subsection ssid="1-null-79" dnum="i-o" numlevel="1" lineno="145" slineno="1-123" level="3"><display>(i)</display>a funeral service;</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="146" slineno="1-124" level="3"><display>(ii)</display>a graveside service; or</subsection><subsection ssid="1-null-81" dnum="iii-o" numlevel="1" lineno="147" slineno="1-125" level="3"><display>(iii)</display>a memorial service;</subsection></subsection><subsection ssid="1-null-82" dnum="e-o" numlevel="1" lineno="148" slineno="1-126" level="2"><display>(e)</display>cremation, calcination, alkaline hydrolysis, or pulverization of a dead human body or <ln numlevel="1" lineno="149" slineno="1-127"/>the body's remains;</subsection><subsection ssid="1-null-83" dnum="f-o" numlevel="1" lineno="150" slineno="1-128" level="2"><display>(f)</display>supervising the arrangement of:<subsection ssid="1-null-84" dnum="i-o" numlevel="1" lineno="151" slineno="1-129" level="3"><display>(i)</display>a disposition; or</subsection><subsection ssid="1-null-85" dnum="ii-o" numlevel="1" lineno="152" slineno="1-130" level="3"><display>(ii)</display>a direct disposition;</subsection></subsection><subsection ssid="1-null-86" dnum="g-o" numlevel="1" lineno="153" slineno="1-131" level="2"><display>(g)</display>facilitating:<subsection ssid="1-null-87" dnum="i-o" numlevel="1" lineno="154" slineno="1-132" level="3"><display>(i)</display>a disposition; or</subsection><subsection ssid="1-null-88" dnum="ii-o" numlevel="1" lineno="155" slineno="1-133" level="3"><display>(ii)</display>a direct disposition;</subsection></subsection><subsection ssid="1-null-89" dnum="h-o" numlevel="1" lineno="156" slineno="1-134" level="2"><display>(h)</display>supervising the sale of funeral merchandise by a funeral establishment;</subsection><subsection ssid="1-null-90" dnum="i-o" numlevel="1" lineno="157" slineno="1-135" level="2"><display>(i)</display>managing or otherwise being responsible for the practice of funeral service in a <ln numlevel="1" lineno="158" slineno="1-136"/>licensed funeral service establishment;</subsection><subsection ssid="1-null-91" dnum="j-o" numlevel="1" lineno="159" slineno="1-137" level="2"><display>(j)</display>supervising the sale of a preneed funeral arrangement; and</subsection><subsection ssid="1-null-92" dnum="k-o" numlevel="1" lineno="160" slineno="1-138" level="2"><display>(k)</display>contracting with or employing individuals to sell a preneed funeral arrangement.</subsection></subsection><subsection ssid="1-null-93" dnum="26-o" numlevel="1" lineno="161" slineno="1-139" level="1" space="false"><display>(26)</display><subsection ssid="1-null-94" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Preneed funeral arrangement" means a written <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="ahaskell" level="1" deltag="both">or oral </amend><amendoutend style="2"/>agreement sold in <ln numlevel="1" lineno="162" slineno="1-140"/>advance of the death of the beneficiary under which a person agrees with a buyer to <ln numlevel="1" lineno="163" slineno="1-141"/>provide at the death of the beneficiary any of the following as are typically provided <ln numlevel="1" lineno="164" slineno="1-142"/>in connection with a disposition:<subsection ssid="1-null-95" dnum="i-o" numlevel="1" lineno="165" slineno="1-143" level="3" tab="1"><display>(i)</display>goods;</subsection><subsection ssid="1-null-96" dnum="ii-o" numlevel="1" lineno="166" slineno="1-144" level="3" tab="1"><display>(ii)</display>services, including:<subsection ssid="1-null-97" dnum="A-o" numlevel="1" lineno="167" slineno="1-145" level="4"><display>(A)</display>embalming services; and</subsection><subsection ssid="1-null-98" dnum="B-o" numlevel="1" lineno="168" slineno="1-146" level="4"><display>(B)</display>funeral directing services;</subsection></subsection><subsection ssid="1-null-99" dnum="iii-o" numlevel="1" lineno="169" slineno="1-147" level="3" tab="1"><display>(iii)</display>real property; or</subsection><subsection ssid="1-null-100" dnum="iv-o" numlevel="1" lineno="170" slineno="1-148" level="3" tab="1"><display>(iv)</display>personal property, including:<subsection ssid="1-null-101" dnum="A-o" numlevel="1" lineno="171" slineno="1-149" level="4"><display>(A)</display>a casket;</subsection><subsection ssid="1-null-102" dnum="B-o" numlevel="1" lineno="172" slineno="1-150" level="4"><display>(B)</display>another primary container;</subsection><subsection ssid="1-null-103" dnum="C-o" numlevel="1" lineno="173" slineno="1-151" level="4"><display>(C)</display>a cremation, alkaline hydrolysis, or transportation container;</subsection><subsection ssid="1-null-104" dnum="D-o" numlevel="1" lineno="174" slineno="1-152" level="4"><display>(D)</display>an outer burial container;</subsection><subsection ssid="1-null-105" dnum="E-o" numlevel="1" lineno="175" slineno="1-153" level="4"><display>(E)</display>a vault;</subsection><subsection ssid="1-null-106" dnum="F-o" numlevel="1" lineno="176" slineno="1-154" level="4"><display>(F)</display>a grave liner;</subsection><subsection ssid="1-null-107" dnum="G-o" numlevel="1" lineno="177" slineno="1-155" level="4"><display>(G)</display>funeral clothing and accessories;</subsection><subsection ssid="1-null-108" dnum="H-o" numlevel="1" lineno="178" slineno="1-156" level="4"><display>(H)</display>a monument;</subsection><subsection ssid="1-null-109" dnum="I-o" numlevel="1" lineno="179" slineno="1-157" level="4"><display>(I)</display>a grave marker; and</subsection><subsection ssid="1-null-110" dnum="J-o" numlevel="1" lineno="180" slineno="1-158" level="4"><display>(J)</display>a cremation or alkaline hydrolysis urn.</subsection></subsection></subsection><subsection ssid="1-null-111" dnum="b-o" numlevel="1" lineno="181" slineno="1-159" level="2"><display>(b)</display>"Preneed funeral arrangement" does not include a policy or product of life insurance <ln numlevel="1" lineno="182" slineno="1-160"/>providing a death benefit cash payment upon the death of the beneficiary <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="64" groupid="52" style="2" owner="ahaskell" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="60" groupid="48" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> <ln numlevel="1" lineno="183" slineno="1-161"/>is not limited to providing the products or services described in Subsection <xref depth="4" refnumber="58-9-102(26)(a)">(26)(a)</xref>.</subsection></subsection><subsection ssid="1-null-112" dnum="27-o" numlevel="1" lineno="184" slineno="1-162" level="1"><display>(27)</display>"Processing" means the reduction of identifiable bone fragments after the completion <ln numlevel="1" lineno="185" slineno="1-163"/>of the cremation or the alkaline hydrolysis process to unidentifiable bone fragments by <ln numlevel="1" lineno="186" slineno="1-164"/>manual means.</subsection><subsection ssid="1-null-113" dnum="28-o" numlevel="1" lineno="187" slineno="1-165" level="1"><display>(28)</display>"Pulverization" means the reduction of identifiable bone fragments after the <ln numlevel="1" lineno="188" slineno="1-166"/>completion of the cremation or alkaline hydrolysis and processing to granulated particles <ln numlevel="1" lineno="189" slineno="1-167"/>by manual or mechanical means.</subsection><subsection ssid="1-null-114" dnum="29-o:_-i" numlevel="1" lineno="190" slineno="1-168" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1117" style="2" owner="o" level="1" deltag="start">(29)</amend></display><amend anum="0" ea="erase" pairid="15" groupid="9" style="2" owner="ahaskell" level="1" deltag="end">"Resomation" means the alkaline hydrolysis process.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-115" dnum="30-o:29-i" numlevel="1" lineno="191" slineno="1-169" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1118" style="2" owner="o" level="1" deltag="both">(30)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="both" space="true">(29)</amend></display>"Sales agent" means an individual licensed under this chapter as a preneed <ln numlevel="1" lineno="192" slineno="1-170"/>funeral arrangement sales agent.</subsection><subsection ssid="1-null-116" dnum="31-o:30-i" numlevel="1" lineno="193" slineno="1-171" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1119" style="2" owner="o" level="1" deltag="both">(31)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="both" space="true">(30)</amend></display>"Temporary container" means a receptacle for cremated or alkaline hydrolysis <ln numlevel="1" lineno="194" slineno="1-172"/>remains usually made of cardboard, plastic, or similar material designed to hold the <ln numlevel="1" lineno="195" slineno="1-173"/>cremated remains until an urn or other permanent container is acquired.</subsection><subsection ssid="1-null-117" dnum="32-o:31-i" numlevel="1" lineno="196" slineno="1-174" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1120" style="2" owner="o" level="1" deltag="both">(32)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="both" space="true">(31)</amend></display>"Unlawful conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501" start="0">58-1-501</xref> <ln numlevel="1" lineno="197" slineno="1-175"/>and <xref depth="3" refnumber="58-9-501" start="0">58-9-501</xref>.</subsection><subsection ssid="1-null-118" dnum="33-o:32-i" numlevel="1" lineno="198" slineno="1-176" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" lineno="201" slineno="1-179"/>hydrolysis remains.</subsection></section></bsec><bsec buid="3" num="58-9-611" type="amend" src="code" uid="C58-9-S611_2026050620260506" sort="58 09 06110020260506" numlevel="1" lineno="202" slineno="2-1" sn="2"><section number="58-9-611" numlevel="1" lineno="203" slineno="2-2" type="amend"><secline lineno="202">Section 2. Section <bold>58-9-611</bold> is amended to read:</secline><catline lineno="203"><bold>58-9-611<parens/>. Disposition of cremated remains.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="204" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent shall provide the person with whom cremation arrangements <ln numlevel="1" lineno="205" slineno="2-4"/>are made with a signed statement specifying the final disposition of the cremated <ln numlevel="1" lineno="206" slineno="2-5"/>remains, if known.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="207" slineno="2-6" level="2"><display>(b)</display>The funeral services establishment shall retain a copy of the statement.</subsection></subsection><subsection ssid="3-null-4" dnum="2-o" numlevel="1" lineno="208" slineno="2-7" level="1" space="false"><display>(2)</display><subsection ssid="3-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The authorizing agent is responsible for the disposition of the cremated remains.</subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="209" slineno="2-8" level="2"><display>(b)</display>If the authorizing agent or the agent's representative has not specified the ultimate <ln numlevel="1" lineno="210" slineno="2-9"/>disposition of or claimed the cremated remains within 60 days from the date of the <ln numlevel="1" lineno="211" slineno="2-10"/>cremation, the funeral service establishment may dispose of the remains in any <ln numlevel="1" lineno="212" slineno="2-11"/>manner permitted by law, except scattering.</subsection><subsection ssid="3-null-7" dnum="c-o" numlevel="1" lineno="213" slineno="2-12" level="2"><display>(c)</display>The authorizing agent shall reimburse the funeral services establishment for all <ln numlevel="1" lineno="214" slineno="2-13"/>reasonable costs incurred in disposing of the cremated remains under Subsection <xref depth="4" refnumber="58-9-611(2)(b)" start="0"><ln numlevel="1" lineno="215" slineno="2-14"/>(2)(b)</xref>.</subsection><subsection ssid="3-null-8" dnum="d-o" numlevel="1" lineno="216" slineno="2-15" level="2"><display>(d)</display>The person or entity disposing of cremated remains under this section:<subsection ssid="3-null-9" dnum="i-o" numlevel="1" lineno="217" slineno="2-16" level="3"><display>(i)</display>shall make and keep a record of the disposition of the remains; and</subsection><subsection ssid="3-null-10" dnum="ii-o" numlevel="1" lineno="218" slineno="2-17" level="3"><display>(ii)</display>is discharged from any legal obligation or liability concerning the remains once <ln numlevel="1" lineno="219" slineno="2-18"/>the disposition has been made.</subsection></subsection><subsection ssid="3-null-11" dnum="e-o" numlevel="1" lineno="220" slineno="2-19" level="2"><display>(e)</display>Subsection <xref depth="4" refnumber="58-9-611(2)(d)(ii)" start="0">(2)(d)(ii)</xref> applies to cremated remains in the possession of a funeral <ln numlevel="1" lineno="221" slineno="2-20"/>services establishment or other responsible party as of May 5, 2008, or any time after <ln numlevel="1" lineno="222" slineno="2-21"/>that date.</subsection></subsection><subsection ssid="3-null-12" dnum="3-o" numlevel="1" lineno="223" slineno="2-22" level="1" space="false"><display>(3)</display><subsection ssid="3-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent may direct a funeral service establishment to dispose of or <ln numlevel="1" lineno="224" slineno="2-23"/>arrange for the disposition of cremated remains:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="225" slineno="2-24" level="3" tab="1"><display>(i)</display>in a crypt, niche, grave, or scattering garden located in a dedicated cemetery;</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="226" slineno="2-25" level="3" tab="1"><display>(ii)</display>by scattering the cremated remains over uninhabited public land, the sea, or other <ln numlevel="1" lineno="227" slineno="2-26"/>public waterways subject to health and environmental laws and regulations; or</subsection><subsection ssid="3-null-16" dnum="iii-o" numlevel="1" lineno="228" slineno="2-27" level="3" tab="1"><display>(iii)</display>in any manner on the private property of a consenting owner.</subsection></subsection><subsection ssid="3-null-17" dnum="b-o" numlevel="1" lineno="229" slineno="2-28" level="2"><display>(b)</display>If <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="ahaskell" level="1" deltag="both">cremated remains are to be disposed of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the authorizing agent intends to dispose <ln numlevel="1" lineno="230" slineno="2-29"/>cremated remains</amend> on private property, other than dedicated cemetery property, the <ln numlevel="1" lineno="231" slineno="2-30"/>authorizing agent shall provide the funeral service establishment with the written <ln numlevel="1" lineno="232" slineno="2-31"/>consent of the property owner prior to disposal of the remains.</subsection><subsection ssid="3-null-18" dnum="c-o" numlevel="1" lineno="233" slineno="2-32" level="2"><display>(c)</display>In order to scatter cremated remains under Subsection <xref depth="4" refnumber="58-9-611(3)(a)(ii)" start="0">(3)(a)(ii)</xref> or <xref depth="4" refnumber="58-9-611(3)(a)(iii)" start="0">(iii)</xref>, the remains <ln numlevel="1" lineno="234" slineno="2-33"/>must be reduced to a particle size of one-eighth inch or less and removed from their <ln numlevel="1" lineno="235" slineno="2-34"/>closed container.</subsection></subsection><subsection ssid="3-null-19" dnum="4-o:_-i" numlevel="1" lineno="236" slineno="2-35" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1141" style="2" owner="o" level="1" deltag="start">(4)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="14" style="2" owner="ahaskell" level="1">A funeral service establishment may not release cremated remains for scattering under <ln numlevel="1" lineno="237" slineno="2-36"/>this section to the authorizing agent or the agent's designated representative until the <ln numlevel="1" lineno="238" slineno="2-37"/>funeral service establishment is given a receipt that shows </amend><amend anum="0" ea="erase" pairid="23" groupid="19" style="2" owner="ahaskell" level="1" deltag="end">the proper filing has been <ln numlevel="1" lineno="239" slineno="2-38"/>made with the local registrar of births and deaths.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="4" num="58-9-617" type="amend" src="code" uid="C58-9-S617_2026050620260506" sort="58 09 06170020260506" numlevel="1" lineno="240" slineno="3-1" sn="3"><section number="58-9-617" numlevel="1" lineno="241" slineno="3-2" type="amend"><secline lineno="240">Section 3. Final disposition of remains from the alkaline hydrolysis process.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="242" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent shall provide the person with whom <amend anum="0" ea="amend" pairid="28" groupid="24" style="1" owner="ahaskell" level="1" amendtag="both">the authorizing agent <ln numlevel="1" lineno="243" slineno="3-4"/>makes </amend>alkaline hydrolysis arrangements <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="25" style="2" owner="ahaskell" level="1" deltag="both">are made with </amend><amendoutend style="2"/>a signed statement <ln numlevel="1" lineno="244" slineno="3-5"/>specifying the final disposition of the remains from the alkaline hydrolysis process, if <ln numlevel="1" lineno="245" slineno="3-6"/>known.</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="246" slineno="3-7" level="2"><display>(b)</display>The funeral service establishment shall retain a copy of the statement.</subsection></subsection><subsection ssid="4-null-4" dnum="2-o" numlevel="1" lineno="247" slineno="3-8" level="1" space="false"><display>(2)</display><subsection ssid="4-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The authorizing agent is responsible for the final disposition of the remains from <ln numlevel="1" lineno="248" slineno="3-9"/>the alkaline hydrolysis process.</subsection><subsection ssid="4-null-6" dnum="b-o" numlevel="1" lineno="249" slineno="3-10" level="2"><display>(b)</display>If the authorizing agent or the agent's representative has not specified the ultimate <ln numlevel="1" lineno="250" slineno="3-11"/>disposition of or claimed the remains from the alkaline hydrolysis process within 60 <ln numlevel="1" lineno="251" slineno="3-12"/>days from the date of the alkaline hydrolysis process, the funeral service <ln numlevel="1" lineno="252" slineno="3-13"/>establishment may dispose of the remains in any manner permitted by law, except <ln numlevel="1" lineno="253" slineno="3-14"/>scattering.</subsection><subsection ssid="4-null-7" dnum="c-o" numlevel="1" lineno="254" slineno="3-15" level="2"><display>(c)</display>The authorizing agent shall reimburse the funeral service establishment for all <ln numlevel="1" lineno="255" slineno="3-16"/>reasonable costs incurred in disposing of the remains from the alkaline hydrolysis <ln numlevel="1" lineno="256" slineno="3-17"/>process under Subsection <xref depth="4" refnumber="58-9-617(2)(b)" start="0">(2)(b)</xref>.</subsection><subsection ssid="4-null-8" dnum="d-o" numlevel="1" lineno="257" slineno="3-18" level="2"><display>(d)</display>The person or entity disposing of remains from the alkaline hydrolysis process under <ln numlevel="1" lineno="258" slineno="3-19"/>this section:<subsection ssid="4-null-9" dnum="i-o" numlevel="1" lineno="259" slineno="3-20" level="3"><display>(i)</display>shall make and keep a record of the final disposition of the remains; and</subsection><subsection ssid="4-null-10" dnum="ii-o" numlevel="1" lineno="260" slineno="3-21" level="3"><display>(ii)</display>is discharged from any legal obligation or liability concerning the remains once <ln numlevel="1" lineno="261" slineno="3-22"/>the final disposition has been made.</subsection></subsection></subsection><subsection ssid="4-null-11" dnum="3-o" numlevel="1" lineno="262" slineno="3-23" level="1" space="false"><display>(3)</display><subsection ssid="4-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent may direct a funeral service establishment to dispose of or <ln numlevel="1" lineno="263" slineno="3-24"/>arrange for the final disposition of remains from the alkaline hydrolysis process:<subsection ssid="4-null-13" dnum="i-o" numlevel="1" lineno="264" slineno="3-25" level="3" tab="1"><display>(i)</display>in a crypt, niche, grave, or scattering garden located in a dedicated cemetery;</subsection><subsection ssid="4-null-14" dnum="ii-o" numlevel="1" lineno="265" slineno="3-26" level="3" tab="1"><display>(ii)</display>by scattering the remains over uninhabited public land, the sea, or other public <ln numlevel="1" lineno="266" slineno="3-27"/>waterways subject to health and environmental laws and regulations; or</subsection><subsection ssid="4-null-15" dnum="iii-o" numlevel="1" lineno="267" slineno="3-28" level="3" tab="1"><display>(iii)</display>in any manner on the private property of a consenting owner.</subsection></subsection><subsection ssid="4-null-16" dnum="b-o" numlevel="1" lineno="268" slineno="3-29" level="2"><display>(b)</display>If <amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both">the authorizing agent intends to dispose of the </amend>remains from the alkaline <ln numlevel="1" lineno="269" slineno="3-30"/>hydrolysis process <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="ahaskell" level="1" deltag="both">are to be disposed of </amend><amendoutend style="2"/>on private property, other than dedicated <ln numlevel="1" lineno="270" slineno="3-31"/>cemetery property, the authorizing agent shall provide the funeral service <ln numlevel="1" lineno="271" slineno="3-32"/>establishment with the written consent of the property owner before disposal of the <ln numlevel="1" lineno="272" slineno="3-33"/>remains.</subsection><subsection ssid="4-null-17" dnum="c-o" numlevel="1" lineno="273" slineno="3-34" level="2"><display>(c)</display>In order to scatter remains from the alkaline hydrolysis process under Subsection <xref depth="4" refnumber="58-9-617(3)(a)(ii)" start="0"><ln numlevel="1" lineno="274" slineno="3-35"/>(3)(a)(ii)</xref> or <xref depth="4" refnumber="58-9-617(3)(a)(iii)" start="0">(iii)</xref>, the remains must be reduced to a particle size of one-eighth inch or <ln numlevel="1" lineno="275" slineno="3-36"/>less and removed from the remains' closed container.</subsection></subsection><subsection ssid="4-null-18" dnum="4-o:_-i" numlevel="1" lineno="276" slineno="3-37" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1159" style="2" owner="o" level="1" deltag="start">(4)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="ahaskell" level="1" deltag="end">Under this section, a funeral service establishment may not release remains from the <ln numlevel="1" lineno="277" slineno="3-38"/>alkaline hydrolysis process to the authorizing agent or the agent's designated <ln numlevel="1" lineno="278" slineno="3-39"/>representative for scattering until the funeral service establishment is given a receipt that <ln numlevel="1" lineno="279" slineno="3-40"/>shows the proper filing has been made with the local registrar of births and deaths.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="11" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="280" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="280">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="281"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-30-25 11:42 AM</tm></rev></foot></leg>
