Section <bold>58-9-102</bold> is amended to read:</secline><catline lineno="28"><bold>58-9-102<parens/>. Definitions.</bold></catline><sectionText lineno="29"><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">In addition to the definitions in Section <xref depth="3" refnumber="58-1-102" start="0">58-1-102</xref>, as</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">As</amend> used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-4" level="1" space="false"><display>(1)</display><subsection ssid="1-128" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Alkaline hydrolysis" means a water-based dissolution process using alkaline <ln numlevel="1" lineno="31" slineno="1-5"/>chemicals, heat, and sometimes agitation or pressure that reduces human remains to a <ln numlevel="1" lineno="32" slineno="1-6"/>liquid and to dry bone residue<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="78" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="1-123" dnum="_-o:b-i" numlevel="1" lineno="33" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">"Alkaline hydrolysis"</amend> includes the disposal of the liquid and the processing and <ln numlevel="1" lineno="34" slineno="1-8"/>pulverization of the dry bone residue.</subsection></subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="35" slineno="1-9" level="1"><display>(2)</display>"Alkaline hydrolysis chamber" means the enclosed space within which the alkaline <ln numlevel="1" lineno="36" slineno="1-10"/>hydrolysis process takes place and that is used exclusively for alkaline hydrolysis of <ln numlevel="1" lineno="37" slineno="1-11"/>human remains.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="38" slineno="1-12" level="1"><display>(3)</display>"Alkaline hydrolysis container" means a container:<subsection ssid="1-null-4" dnum="a-o" numlevel="1" lineno="39" slineno="1-13" level="2"><display>(a)</display>in which human remains are transported to a funeral service establishment and <ln numlevel="1" lineno="40" slineno="1-14"/>placed in an alkaline hydrolysis chamber for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">resomation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the alkaline hydrolysis <ln numlevel="1" lineno="41" slineno="1-15"/>process</amend>; and</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="42" slineno="1-16" level="2"><display>(b)</display>that meets substantially all of the following standards:<subsection ssid="1-null-6" dnum="i-o" numlevel="1" lineno="43" slineno="1-17" level="3"><display>(i)</display>able to be closed in order to provide a complete covering for the human remains;</subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="44" slineno="1-18" level="3"><display>(ii)</display>resistant to leakage or spillage;</subsection><subsection ssid="1-null-8" dnum="iii-o" numlevel="1" lineno="45" slineno="1-19" level="3"><display>(iii)</display>rigid enough for handling with ease; and</subsection><subsection ssid="1-null-9" dnum="iv-o" numlevel="1" lineno="46" slineno="1-20" level="3"><display>(iv)</display>able to provide protection for the health, safety, and personal integrity of <ln numlevel="1" lineno="47" slineno="1-21"/>crematory personnel.</subsection></subsection></subsection><subsection ssid="1-null-10" dnum="4-o" numlevel="1" lineno="48" slineno="1-22" level="1"><display>(4)</display>"Authorizing agent" means a person legally entitled to authorize the cremation or the <ln numlevel="1" lineno="49" slineno="1-23"/>alkaline hydrolysis process of human remains.</subsection><subsection ssid="1-null-11" dnum="5-o" numlevel="1" lineno="50" slineno="1-24" level="1"><display>(5)</display>"Beneficiary" means the individual who, at the time of the individual's death, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">is to <ln numlevel="1" lineno="51" slineno="1-25"/>receive</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="75" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">receives</amend> the benefit of the property and services purchased under a preneed <ln numlevel="1" lineno="52" slineno="1-26"/>funeral arrangement.</subsection><subsection ssid="1-null-12" dnum="6-o" numlevel="1" lineno="53" slineno="1-27" level="1"><display>(6)</display>"Board" means the Board of Funeral Service created in Section <xref depth="3" refnumber="58-9-201" start="0">58-9-201</xref>.</subsection><subsection ssid="1-null-13" dnum="7-o" numlevel="1" lineno="54" slineno="1-28" level="1"><display>(7)</display>"Body part" means:<subsection ssid="1-null-14" dnum="a-o" numlevel="1" lineno="55" slineno="1-29" level="2"><display>(a)</display>a limb or other portion of the anatomy that is removed from <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an individual</amend> <ln numlevel="1" lineno="56" slineno="1-30"/>or human remains for medical purposes during treatment, surgery, biopsy, autopsy, or <ln numlevel="1" lineno="57" slineno="1-31"/>medical research; or</subsection><subsection ssid="1-null-15" dnum="b-o" numlevel="1" lineno="58" slineno="1-32" level="2"><display>(b)</display>a human body or any portion of a body that has been donated to science for medical <ln numlevel="1" lineno="59" slineno="1-33"/>research purposes.</subsection></subsection><subsection ssid="1-null-16" dnum="8-o" numlevel="1" lineno="60" slineno="1-34" level="1"><display>(8)</display>"Buyer" means a person who purchases a preneed funeral arrangement.</subsection><subsection ssid="1-null-17" dnum="9-o" numlevel="1" lineno="61" slineno="1-35" level="1"><display>(9)</display>"Calcination" means a process in which a dead human body is reduced by intense heat <ln numlevel="1" lineno="62" slineno="1-36"/>to a residue that is not as substantive as the residue that follows cremation.</subsection><subsection ssid="1-null-18" dnum="10-o" numlevel="1" lineno="63" slineno="1-37" level="1"><display>(10)</display>"Cremated remains" means all the remains of a cremated body recovered after the <ln numlevel="1" lineno="64" slineno="1-38"/>completion of the cremation process, including pulverization <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend> leaves only <ln numlevel="1" lineno="65" slineno="1-39"/>bone fragments reduced to unidentifiable dimensions and may possibly include the <ln numlevel="1" lineno="66" slineno="1-40"/>residue of foreign matter including casket material, bridgework, or eyeglasses that were <ln numlevel="1" lineno="67" slineno="1-41"/>cremated with the human remains.</subsection><subsection ssid="1-null-19" dnum="11-o" numlevel="1" lineno="68" slineno="1-42" level="1" space="false"><display>(11)</display><subsection ssid="1-124" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Cremation" means the technical process, using direct flame and heat, or a <ln numlevel="1" lineno="69" slineno="1-43"/>chemical process, that reduces human remains to bone fragments through heat and <ln numlevel="1" lineno="70" slineno="1-44"/>evaporation, or a chemical process<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">, and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="1-125" dnum="_-o:b-i" numlevel="1" lineno="71" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">"Cremation" </amend>includes the processing and usually the pulverization of the bone <ln numlevel="1" lineno="72" slineno="1-46"/>fragments.</subsection></subsection><subsection ssid="1-null-20" dnum="12-o" numlevel="1" lineno="73" slineno="1-47" level="1"><display>(12)</display>"Cremation chamber" means the enclosed space within which the cremation process <ln numlevel="1" lineno="74" slineno="1-48"/>takes place and which is used exclusively for the cremation of human remains.</subsection><subsection ssid="1-null-21" dnum="13-o" numlevel="1" lineno="75" slineno="1-49" level="1"><display>(13)</display>"Cremation container" means the container:<subsection ssid="1-null-22" dnum="a-o" numlevel="1" lineno="76" slineno="1-50" level="2"><display>(a)</display>in which the human remains are transported to the crematory and placed in the <ln numlevel="1" lineno="77" slineno="1-51"/>cremation chamber for cremation; and</subsection><subsection ssid="1-null-23" dnum="b-o" numlevel="1" lineno="78" slineno="1-52" level="2"><display>(b)</display>that meets substantially all of the following standards:<subsection ssid="1-null-24" dnum="i-o" numlevel="1" lineno="79" slineno="1-53" level="3"><display>(i)</display>composed of readily combustible or consumable materials suitable for cremation;</subsection><subsection ssid="1-null-25" dnum="ii-o" numlevel="1" lineno="80" slineno="1-54" level="3"><display>(ii)</display>able to be closed in order to provide a complete covering for the human remains;</subsection><subsection ssid="1-null-26" dnum="iii-o" numlevel="1" lineno="81" slineno="1-55" level="3"><display>(iii)</display>resistant to leakage or spillage;</subsection><subsection ssid="1-null-27" dnum="iv-o" numlevel="1" lineno="82" slineno="1-56" level="3"><display>(iv)</display>rigid enough for handling with ease; and</subsection><subsection ssid="1-null-28" dnum="v-o" numlevel="1" lineno="83" slineno="1-57" level="3"><display>(v)</display>able to provide protection for the health, safety, and personal integrity of <ln numlevel="1" lineno="84" slineno="1-58"/>crematory personnel.</subsection></subsection></subsection><subsection ssid="1-null-29" dnum="14-o" numlevel="1" lineno="85" slineno="1-59" level="1"><display>(14)</display>"Crematory" means the building or portion of a building that houses the cremation <ln numlevel="1" lineno="86" slineno="1-60"/>chamber and the holding facility.</subsection><subsection ssid="1-null-30" dnum="15-o" numlevel="1" lineno="87" slineno="1-61" level="1"><display>(15)</display>"Direct disposition" means the disposition of a dead human body:<subsection ssid="1-null-31" dnum="a-o" numlevel="1" lineno="88" slineno="1-62" level="2"><display>(a)</display>as quickly as law allows;</subsection><subsection ssid="1-null-32" dnum="b-o" numlevel="1" lineno="89" slineno="1-63" level="2"><display>(b)</display>without preparation of the body by embalming; and</subsection><subsection ssid="1-null-33" dnum="c-o" numlevel="1" lineno="90" slineno="1-64" level="2"><display>(c)</display>without an attendant funeral service or graveside service.</subsection></subsection><subsection ssid="1-null-34" dnum="16-o" numlevel="1" lineno="91" slineno="1-65" level="1"><display>(16)</display>"Disposition" means the final disposal of a dead human body by:<subsection ssid="1-null-35" dnum="a-o" numlevel="1" lineno="92" slineno="1-66" level="2"><display>(a)</display>earth interment;</subsection><subsection ssid="1-null-36" dnum="b-o" numlevel="1" lineno="93" slineno="1-67" level="2"><display>(b)</display>above ground burial;</subsection><subsection ssid="1-null-37" dnum="c-o" numlevel="1" lineno="94" slineno="1-68" level="2"><display>(c)</display>cremation;</subsection><subsection ssid="1-null-38" dnum="d-o" numlevel="1" lineno="95" slineno="1-69" level="2"><display>(d)</display>calcination;</subsection><subsection ssid="1-null-39" dnum="e-o" numlevel="1" lineno="96" slineno="1-70" level="2"><display>(e)</display>alkaline hydrolysis;</subsection><subsection ssid="1-null-40" dnum="f-o" numlevel="1" lineno="97" slineno="1-71" level="2"><display>(f)</display>burial at sea;</subsection><subsection ssid="1-null-41" dnum="g-o" numlevel="1" lineno="98" slineno="1-72" level="2"><display>(g)</display>delivery to a medical institution; or</subsection><subsection ssid="1-null-42" dnum="h-o" numlevel="1" lineno="99" slineno="1-73" level="2"><display>(h)</display>other lawful means.</subsection></subsection><subsection ssid="1-null-43" dnum="17-o" numlevel="1" lineno="100" slineno="1-74" level="1"><display>(17)</display>"Embalming" means replacing body fluids in a dead human body with preserving and <ln numlevel="1" lineno="101" slineno="1-75"/>disinfecting chemicals.</subsection><subsection ssid="1-127" dnum="_-o:18-i" numlevel="1" lineno="102" slineno="1-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(18)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">"Final placement of remains" means, if a disposition yields any remaining residual <ln numlevel="1" lineno="103" slineno="1-77"/>matter as a direct result of the disposition, the final storage, placement, or other manner <ln numlevel="1" lineno="104" slineno="1-78"/>of disposing of the remaining residual matter.</amend></subsection><subsection ssid="1-null-44" dnum="18-o:19-i" numlevel="1" lineno="105" slineno="1-79" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="both">(18)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="both" space="true">(19)</amend></display><subsection ssid="1-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Funeral merchandise" means any of the following into which a dead <ln numlevel="1" lineno="106" slineno="1-80"/>human body is placed in connection with the transportation or disposition of the body:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="107" slineno="1-81" level="3" tab="1"><display>(i)</display>a vault;</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="108" slineno="1-82" level="3" tab="1"><display>(ii)</display>a casket; or</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="109" slineno="1-83" level="3" tab="1"><display>(iii)</display>other personal property.</subsection></subsection><subsection ssid="1-null-49" dnum="b-o" numlevel="1" lineno="110" slineno="1-84" level="2"><display>(b)</display>"Funeral merchandise" does not include:<subsection ssid="1-null-50" dnum="i-o" numlevel="1" lineno="111" slineno="1-85" level="3"><display>(i)</display>a mausoleum crypt;</subsection><subsection ssid="1-null-51" dnum="ii-o" numlevel="1" lineno="112" slineno="1-86" level="3"><display>(ii)</display>an interment receptacle preset in a cemetery; or</subsection><subsection ssid="1-null-52" dnum="iii-o" numlevel="1" lineno="113" slineno="1-87" level="3"><display>(iii)</display>a columbarium niche.</subsection></subsection></subsection><subsection ssid="1-null-53" dnum="19-o:20-i" numlevel="1" lineno="114" slineno="1-88" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(19)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(20)</amend></display>"Funeral service" means a service, rite, or ceremony performed:<subsection ssid="1-null-54" dnum="a-o" numlevel="1" lineno="115" slineno="1-89" level="2"><display>(a)</display>with respect to the death of a human; and</subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="116" slineno="1-90" level="2"><display>(b)</display>with the body of the deceased present.</subsection></subsection><subsection ssid="1-null-56" dnum="20-o:21-i" numlevel="1" lineno="117" slineno="1-91" lineno="118" slineno="1-92"/>may engage in all lawful professional activities regulated and defined under the practice <ln numlevel="1" lineno="119" slineno="1-93"/>of funeral service.</subsection><subsection ssid="1-null-57" dnum="21-o:22-i" numlevel="1" lineno="120" slineno="1-94" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="both">(21)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="both" space="true">(22)</amend></display><subsection ssid="1-null-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Funeral service establishment" means a place of business at a specific <ln numlevel="1" lineno="121" slineno="1-95"/>street address or location licensed under this chapter that is devoted to:<subsection ssid="1-null-59" dnum="i-o" numlevel="1" lineno="122" slineno="1-96" level="3" tab="1"><display>(i)</display>the embalming, care, custody, shelter, preparation for burial, and final disposition <amend anum="0" ea="amend" pairid="84" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="both"><ln numlevel="1" lineno="123" slineno="1-97"/>or final placement of remains </amend>of dead human bodies; and</subsection><subsection ssid="1-null-60" dnum="ii-o" numlevel="1" lineno="124" slineno="1-98" level="3" tab="1"><display>(ii)</display>the furnishing of services, merchandise, and products purchased from the <ln numlevel="1" lineno="125" slineno="1-99"/>establishment as a preneed provider under a preneed funeral arrangement.</subsection></subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="126" slineno="1-100" level="2"><display>(b)</display>"Funeral service establishment" includes:<subsection ssid="1-null-62" dnum="i-o" numlevel="1" lineno="127" slineno="1-101" level="3"><display>(i)</display>all portions of the business premises and all tools, instruments, and supplies used <ln numlevel="1" lineno="128" slineno="1-102"/>in the preparation and embalming of dead human bodies for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="91" groupid="77" style="2" owner="jchristopherson" level="1" deltag="both">burial, cremation, <ln numlevel="1" lineno="129" slineno="1-103"/>alkaline hydrolysis, and final disposition as defined by division rule</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="88" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">disposition</amend>; <ln numlevel="1" lineno="130" slineno="1-104"/>and</subsection><subsection ssid="1-null-63" dnum="ii-o" numlevel="1" lineno="131" slineno="1-105" level="3"><display>(ii)</display>a facility used by the business in which funeral services may be conducted.</subsection></subsection></subsection><subsection ssid="1-null-64" dnum="22-o:23-i" numlevel="1" lineno="132" slineno="1-106" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1068" style="2" owner="o" level="1" deltag="both">(22)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="both" space="true">(23)</amend></display>"Funeral service intern" means an individual licensed under this chapter who is <ln numlevel="1" lineno="133" slineno="1-107"/>permitted to:<subsection ssid="1-null-65" dnum="a-o" numlevel="1" lineno="134" slineno="1-108" level="2"><display>(a)</display>assist a funeral service director in the embalming or other preparation of a dead <ln numlevel="1" lineno="135" slineno="1-109"/>human body for disposition;</subsection><subsection ssid="1-null-66" dnum="b-o" numlevel="1" lineno="136" slineno="1-110" level="2"><display>(b)</display>assist a funeral service director in the cremation, calcination, alkaline hydrolysis, or <ln numlevel="1" lineno="137" slineno="1-111"/>pulverization of a dead human body or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="50" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the body's</amend> remains; and</subsection><subsection ssid="1-null-67" dnum="c-o" numlevel="1" lineno="138" slineno="1-112" level="2"><display>(c)</display>perform other funeral service activities under the supervision of a funeral service <ln numlevel="1" lineno="139" slineno="1-113"/>director.</subsection></subsection><subsection ssid="1-null-68" dnum="23-o:24-i" numlevel="1" lineno="140" slineno="1-114" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(23)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(24)</amend></display>"Graveside service" means a funeral service held at the location of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="92" groupid="78" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="89" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="141" slineno="1-115"/>an earth internment</amend>.</subsection><subsection ssid="1-null-69" dnum="24-o:25-i" numlevel="1" lineno="142" slineno="1-116" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="both">(24)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="both" space="true">(25)</amend></display>"Memorial service" means a service, rite, or ceremony performed:<subsection ssid="1-null-70" dnum="a-o" numlevel="1" lineno="143" slineno="1-117" level="2"><display>(a)</display>with respect to the death of a human; and</subsection><subsection ssid="1-null-71" dnum="b-o" numlevel="1" lineno="144" slineno="1-118" level="2"><display>(b)</display>without the body of the deceased present.</subsection></subsection><subsection ssid="1-null-72" dnum="25-o:26-i" numlevel="1" lineno="145" slineno="1-119" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1076" style="2" owner="o" level="1" deltag="both">(25)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="both" space="true">(26)</amend></display>"Practice of funeral service" means:<subsection ssid="1-null-73" dnum="a-o" numlevel="1" lineno="146" slineno="1-120" level="2"><display>(a)</display>supervising the receipt of custody and transportation of a dead human body to <ln numlevel="1" lineno="147" slineno="1-121"/>prepare the body for:<subsection ssid="1-null-74" dnum="i-o" numlevel="1" lineno="148" slineno="1-122" level="3"><display>(i)</display>disposition; or</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="149" slineno="1-123" level="3"><display>(ii)</display>shipment to another location;</subsection></subsection><subsection ssid="1-null-76" dnum="b-o" numlevel="1" lineno="150" slineno="1-124" level="2"><display>(b)</display>entering into a contract with a person to provide professional services regulated <ln numlevel="1" lineno="151" slineno="1-125"/>under this chapter;</subsection><subsection ssid="1-null-77" dnum="c-o" numlevel="1" lineno="152" slineno="1-126" level="2"><display>(c)</display>embalming or otherwise preparing a dead human body for disposition;</subsection><subsection ssid="1-null-78" dnum="d-o" numlevel="1" lineno="153" slineno="1-127" level="2"><display>(d)</display>supervising the arrangement or conduct of:<subsection ssid="1-null-79" dnum="i-o" numlevel="1" lineno="154" slineno="1-128" level="3"><display>(i)</display>a funeral service;</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="155" slineno="1-129" level="3"><display>(ii)</display>a graveside service; or</subsection><subsection ssid="1-null-81" dnum="iii-o" numlevel="1" lineno="156" slineno="1-130" level="3"><display>(iii)</display>a memorial service;</subsection></subsection><subsection ssid="1-null-82" dnum="e-o" numlevel="1" lineno="157" slineno="1-131" level="2"><display>(e)</display>cremation, calcination, alkaline hydrolysis, or pulverization of a dead human body or <ln numlevel="1" lineno="158" slineno="1-132"/>the body's remains;</subsection><subsection ssid="1-null-83" dnum="f-o" numlevel="1" lineno="159" slineno="1-133" level="2"><display>(f)</display>supervising the arrangement of:<subsection ssid="1-null-84" dnum="i-o" numlevel="1" lineno="160" slineno="1-134" level="3"><display>(i)</display>a disposition; or</subsection><subsection ssid="1-null-85" dnum="ii-o" numlevel="1" lineno="161" slineno="1-135" level="3"><display>(ii)</display>a direct disposition;</subsection></subsection><subsection ssid="1-null-86" dnum="g-o" numlevel="1" lineno="162" slineno="1-136" level="2"><display>(g)</display>facilitating:<subsection ssid="1-null-87" dnum="i-o" numlevel="1" lineno="163" slineno="1-137" level="3"><display>(i)</display>a disposition; or</subsection><subsection ssid="1-null-88" dnum="ii-o" numlevel="1" lineno="164" slineno="1-138" level="3"><display>(ii)</display>a direct disposition;</subsection></subsection><subsection ssid="1-null-89" dnum="h-o" numlevel="1" lineno="165" slineno="1-139" level="2"><display>(h)</display>supervising the sale of funeral merchandise by a funeral establishment;</subsection><subsection ssid="1-null-90" dnum="i-o" numlevel="1" lineno="166" slineno="1-140" level="2"><display>(i)</display>managing or otherwise being responsible for the practice of funeral service in a <ln numlevel="1" lineno="167" slineno="1-141"/>licensed funeral service establishment;</subsection><subsection ssid="1-null-91" dnum="j-o" numlevel="1" lineno="168" slineno="1-142" level="2"><display>(j)</display>supervising the sale of a preneed funeral arrangement; and</subsection><subsection ssid="1-null-92" dnum="k-o" numlevel="1" lineno="169" slineno="1-143" level="2"><display>(k)</display>contracting with or employing individuals to sell a preneed funeral arrangement.</subsection></subsection><subsection ssid="1-null-93" dnum="26-o:27-i" numlevel="1" lineno="170" slineno="1-144" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1097" style="2" owner="o" level="1" deltag="both">(26)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="both" space="true">(27)</amend></display><subsection ssid="1-null-94" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Preneed funeral arrangement" means a written <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">or oral </amend><amendoutend style="2"/>agreement sold in <ln numlevel="1" lineno="171" slineno="1-145"/>advance of the death of the beneficiary under which a person agrees with a buyer to <ln numlevel="1" lineno="172" slineno="1-146"/>provide at the death of the beneficiary any of the following as are typically provided <ln numlevel="1" lineno="173" slineno="1-147"/>in connection with a disposition:<subsection ssid="1-null-95" dnum="i-o" numlevel="1" lineno="174" slineno="1-148" level="3" tab="1"><display>(i)</display>goods;</subsection><subsection ssid="1-null-96" dnum="ii-o" numlevel="1" lineno="175" slineno="1-149" level="3" tab="1"><display>(ii)</display>services, including:<subsection ssid="1-null-97" dnum="A-o" numlevel="1" lineno="176" slineno="1-150" level="4"><display>(A)</display>embalming services; and</subsection><subsection ssid="1-null-98" dnum="B-o" numlevel="1" lineno="177" slineno="1-151" level="4"><display>(B)</display>funeral directing services;</subsection></subsection><subsection ssid="1-null-99" dnum="iii-o" numlevel="1" lineno="178" slineno="1-152" level="3" tab="1"><display>(iii)</display>real property; or</subsection><subsection ssid="1-null-100" dnum="iv-o" numlevel="1" lineno="179" slineno="1-153" level="3" tab="1"><display>(iv)</display>personal property, including:<subsection ssid="1-null-101" dnum="A-o" numlevel="1" lineno="180" slineno="1-154" level="4"><display>(A)</display>a casket;</subsection><subsection ssid="1-null-102" dnum="B-o" numlevel="1" lineno="181" slineno="1-155" level="4"><display>(B)</display>another primary container;</subsection><subsection ssid="1-null-103" dnum="C-o" numlevel="1" lineno="182" slineno="1-156" level="4"><display>(C)</display>a cremation, alkaline hydrolysis, or transportation container;</subsection><subsection ssid="1-null-104" dnum="D-o" numlevel="1" lineno="183" slineno="1-157" level="4"><display>(D)</display>an outer burial container;</subsection><subsection ssid="1-null-105" dnum="E-o" numlevel="1" lineno="184" slineno="1-158" level="4"><display>(E)</display>a vault;</subsection><subsection ssid="1-null-106" dnum="F-o" numlevel="1" lineno="185" slineno="1-159" level="4"><display>(F)</display>a grave liner;</subsection><subsection ssid="1-null-107" dnum="G-o" numlevel="1" lineno="186" slineno="1-160" level="4"><display>(G)</display>funeral clothing and accessories;</subsection><subsection ssid="1-null-108" dnum="H-o" numlevel="1" lineno="187" slineno="1-161" level="4"><display>(H)</display>a monument;</subsection><subsection ssid="1-null-109" dnum="I-o" numlevel="1" lineno="188" slineno="1-162" level="4"><display>(I)</display>a grave marker; and</subsection><subsection ssid="1-null-110" dnum="J-o" numlevel="1" lineno="189" slineno="1-163" level="4"><display>(J)</display>a cremation or alkaline hydrolysis urn.</subsection></subsection></subsection><subsection ssid="1-null-111" dnum="b-o" numlevel="1" lineno="190" slineno="1-164" level="2"><display>(b)</display>"Preneed funeral arrangement" does not include a policy or product of life insurance <ln numlevel="1" lineno="191" slineno="1-165"/>providing a death benefit cash payment upon the death of the beneficiary <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="64" groupid="52" style="2" owner="jchristopherson" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="60" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" style="2"/><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="both" space="true">(29)</amend></display>"Pulverization" means the reduction of identifiable bone fragments slineno="1-176"/>arrangement sales agent.</subsection><subsection ssid="1-null-116" dnum="31-o" numlevel="1" lineno="203" slineno="1-177" level="1"><display>(31)</display>"Temporary container" means a receptacle for cremated or alkaline hydrolysis remains <ln numlevel="1" lineno="204" slineno="1-178"/>usually made of cardboard, plastic, or similar material designed to hold the cremated <ln numlevel="1" lineno="205" slineno="1-179"/>remains until an urn or other permanent container is acquired.</subsection><subsection ssid="1-null-117" dnum="32-o" numlevel="1" lineno="206" slineno="1-180" level="1"><display>(32)</display>"Unlawful conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501" start="0">58-1-501</xref> and <xref depth="3" refnumber="58-9-501" start="0"><ln numlevel="1" lineno="207" slineno="1-181"/>58-9-501</xref>.</subsection><subsection ssid="1-null-118" dnum="33-o" numlevel="1" lineno="208" slineno="1-182" level="1"><display>(33)</display>"Unprofessional conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501" start="0">58-1-501</xref> <ln numlevel="1" lineno="209" slineno="1-183"/>and <xref depth="3" refnumber="58-9-502" start="0">58-9-502</xref>.</subsection><subsection ssid="1-null-119" dnum="34-o" numlevel="1" lineno="210" slineno="1-184" level="1"><display>(34)</display>"Urn" means a receptacle designed to permanently encase cremated or alkaline <ln numlevel="1" lineno="211" slineno="1-185"/>hydrolysis Final placement of remains from cremation.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="214" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent shall provide the person with whom cremation arrangements <ln numlevel="1" lineno="215" slineno="2-4"/>are made with a signed statement specifying the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="59" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement</amend> of the <amend anum="0" ea="amend" pairid="41" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both"><ln numlevel="1" lineno="216" slineno="2-5"/>remains from cremation</amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">cremated remains</amend><amendoutend style="2"/>, if known.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="217" slineno="2-6" level="2"><display>(b)</display>The funeral services establishment shall retain a copy of the statement.</subsection></subsection><subsection ssid="3-null-4" dnum="2-o" numlevel="1" lineno="218" slineno="2-7" level="1" space="false"><display>(2)</display><subsection ssid="3-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The authorizing agent is responsible for the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">disposition of the cremated remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="219" slineno="2-8"/>final placement of remains from cremation</amend>.</subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="220" slineno="2-9" level="2"><display>(b)</display>If the authorizing agent or the agent's representative has not specified the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="61" style="2" owner="jchristopherson" level="1" deltag="both">ultimate <ln numlevel="1" lineno="221" slineno="2-10"/>disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">final placement</amend> of <amend anum="0" ea="amend" pairid="44" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both">remains from cremation </amend>or claimed the cremated <ln numlevel="1" lineno="222" slineno="2-11"/>remains within 60 days <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">from the date of the cremation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">after the day on which the <ln numlevel="1" lineno="223" slineno="2-12"/>cremation occurs</amend>, the funeral service establishment may <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">dispose of the remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="46" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="224" slineno="2-13"/>conduct the final placement of remains</amend> in any manner permitted by law, except <ln numlevel="1" lineno="225" slineno="2-14"/>scattering.</subsection><subsection ssid="3-null-7" dnum="c-o" numlevel="1" lineno="226" slineno="2-15" level="2"><display>(c)</display>The authorizing agent shall reimburse the funeral services establishment for all <ln numlevel="1" lineno="227" slineno="2-16"/>reasonable costs incurred in disposing of the cremated remains under Subsection <xref depth="4" refnumber="58-9-611(2)(b)" start="0"><ln numlevel="1" lineno="228" slineno="2-17"/>(2)(b)</xref>.</subsection><subsection ssid="3-null-8" dnum="d-o" numlevel="1" lineno="229" slineno="2-18" level="2"><display>(d)</display>The person or entity <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">disposing of cremated remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="47" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conducting the final placement <ln numlevel="1" lineno="230" slineno="2-19"/>of remains from cremation</amend> under this section:<subsection ssid="3-null-9" dnum="i-o" numlevel="1" lineno="231" slineno="2-20" level="3"><display>(i)</display>shall make and keep a record of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both">disposition of the remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">final placement of <ln numlevel="1" lineno="232" slineno="2-21"/>remains</amend>; and</subsection><subsection ssid="3-null-10" dnum="ii-o" numlevel="1" lineno="233" slineno="2-22" level="3"><display>(ii)</display>is discharged from any legal obligation or liability concerning the remains once <ln numlevel="1" lineno="234" slineno="2-23"/>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">disposition has been made</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">person conducts the final placement of remains</amend>.</subsection></subsection><subsection ssid="3-null-11" dnum="e-o" numlevel="1" lineno="235" slineno="2-24" level="2"><display>(e)</display>Subsection <xref depth="4" refnumber="58-9-611(2)(d)(ii)" start="0">(2)(d)(ii)</xref> applies to cremated remains in the possession of a funeral <ln numlevel="1" lineno="236" slineno="2-25"/>services establishment or other responsible party as of May 5, 2008, or any time after <ln numlevel="1" lineno="237" slineno="2-26"/>that date.</subsection></subsection><subsection ssid="3-null-12" dnum="3-o" numlevel="1" lineno="238" slineno="2-27" level="1" space="false"><display>(3)</display><subsection ssid="3-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent may direct a funeral service establishment to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">dispose of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="239" slineno="2-28"/>conduct the final placement of remains</amend> or arrange for the<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both"> disposition of cremated <ln numlevel="1" lineno="240" slineno="2-29"/>remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> final placement of remains from cremation</amend>:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="241" slineno="2-30" level="3" tab="1"><display>(i)</display>in a crypt, niche, grave, or scattering garden located in a dedicated cemetery;</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="242" slineno="2-31" level="3" tab="1"><display>(ii)</display>by scattering the cremated remains over uninhabited public land, the sea, or other <ln numlevel="1" lineno="243" slineno="2-32"/>public waterways subject to health and environmental laws and regulations; or</subsection><subsection ssid="3-null-16" dnum="iii-o" numlevel="1" lineno="244" slineno="2-33" level="3" tab="1"><display>(iii)</display>in any manner on the private property of a consenting owner.</subsection></subsection><subsection ssid="3-null-17" dnum="b-o" numlevel="1" lineno="245" slineno="2-34" level="2"><display>(b)</display>If <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">cremated remains are to be disposed of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the authorizing agent intends to conduct <ln numlevel="1" lineno="246" slineno="2-35"/>the final placement of remains</amend> on private property, other than dedicated cemetery <ln numlevel="1" lineno="247" slineno="2-36"/>property, the authorizing agent shall provide the funeral service establishment with <ln numlevel="1" lineno="248" slineno="2-37"/>the written consent of the property owner <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="73" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both">prior to disposal of the remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before the <ln numlevel="1" lineno="249" slineno="2-38"/>final placement of remains</amend>.</subsection><subsection ssid="3-null-18" dnum="c-o" numlevel="1" lineno="250" slineno="2-39" level="2"><display>(c)</display>In order to scatter cremated remains under Subsection <xref depth="4" refnumber="58-9-611(3)(a)(ii)" start="0">(3)(a)(ii)</xref> or <xref depth="4" refnumber="58-9-611(3)(a)(iii)" start="0">(iii)</xref>, the remains <ln numlevel="1" lineno="251" slineno="2-40"/>must be reduced to a particle size of one-eighth inch or less and removed from <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both">their</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="252" slineno="2-41"/>the remains'</amend> closed container.</subsection></subsection><subsection ssid="3-null-19" dnum="4-o:_-i" numlevel="1" lineno="253" slineno="2-42" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1142" style="2" owner="o" level="1" deltag="start">(4)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">A funeral service establishment may not release cremated remains for scattering under <ln numlevel="1" lineno="254" slineno="2-43"/>this section to the authorizing agent or the agent's designated representative until the <ln numlevel="1" lineno="255" slineno="2-44"/>funeral service establishment is given a receipt that shows the proper filing has been <ln numlevel="1" lineno="256" slineno="2-45"/>made with the local registrar of births and deaths.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="12" num="58-9-613" type="amend" src="code" uid="C58-9-S613_2026050620260506" sort="58 09 06130020260506" numlevel="1" lineno="257" slineno="3-1" sn="3"><section number="58-9-613" numlevel="1" lineno="258" slineno="3-2" type="amend"><secline lineno="257">Section 3. Section <bold>58-9-613</bold> is amended to read:</secline><catline lineno="258"><bold>58-9-613<parens/>. Authorization for alkaline hydrolysis -- Penalties for removal of items <ln numlevel="1" lineno="259" slineno="3-3"/>from human remains.</bold></catline><subsection ssid="12-null-1" dnum="1-o" numlevel="1" lineno="260" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided in this section, a funeral service establishment may not <ln numlevel="1" lineno="261" slineno="3-5"/>perform alkaline hydrolysis on human remains until the funeral service establishment <ln numlevel="1" lineno="262" slineno="3-6"/>has received:<subsection ssid="12-null-2" dnum="a-o" numlevel="1" lineno="263" slineno="3-7" level="2"><display>(a)</display>an alkaline hydrolysis authorization form signed by an authorizing agent;</subsection><subsection ssid="12-null-3" dnum="b-o" numlevel="1" lineno="264" slineno="3-8" level="2"><display>(b)</display>a completed and executed burial transit permit or similar document, as provided by <ln numlevel="1" lineno="265" slineno="3-9"/>state law, indicating that disposition of the human remains is to be by alkaline <ln numlevel="1" lineno="266" slineno="3-10"/>hydrolysis; and</subsection><subsection ssid="12-null-4" dnum="c-o" numlevel="1" lineno="267" slineno="3-11" level="2"><display>(c)</display>any other documentation required by the state, county, or municipality.</subsection></subsection><subsection ssid="12-null-5" dnum="2-o" numlevel="1" lineno="268" slineno="3-12" level="1" space="false"><display>(2)</display><subsection ssid="12-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The alkaline hydrolysis authorization form shall contain, at a minimum, the <ln numlevel="1" lineno="269" slineno="3-13"/>following information:<subsection ssid="12-null-7" dnum="i-o" numlevel="1" lineno="270" slineno="3-14" level="3" tab="1"><display>(i)</display>the identity of the human remains and the time and date of death, including a <ln numlevel="1" lineno="271" slineno="3-15"/>signed declaration of visual identification of the deceased or refusal to visually <ln numlevel="1" lineno="272" slineno="3-16"/>identify the deceased;</subsection><subsection ssid="12-null-8" dnum="ii-o" numlevel="1" lineno="273" slineno="3-17" level="3" tab="1"><display>(ii)</display>the name of the funeral director and funeral service establishment that obtained <ln numlevel="1" lineno="274" slineno="3-18"/>the alkaline hydrolysis authorization;</subsection><subsection ssid="12-null-9" dnum="iii-o" numlevel="1" lineno="275" slineno="3-19" level="3" tab="1"><display>(iii)</display>notification as to whether the death occurred from a disease declared by the <ln numlevel="1" lineno="276" slineno="3-20"/>Department of Health <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">and Human Services </amend>to be infectious, contagious, <ln numlevel="1" lineno="277" slineno="3-21"/>communicable, or dangerous to the public health;</subsection><subsection ssid="12-null-10" dnum="iv-o" numlevel="1" lineno="278" slineno="3-22" level="3" tab="1"><display>(iv)</display>the name of the authorizing agent and the relationship between the authorizing <ln numlevel="1" lineno="279" slineno="3-23"/>agent and the decedent;</subsection><subsection ssid="12-null-11" dnum="v-o" numlevel="1" lineno="280" slineno="3-24" level="3" tab="1"><display>(v)</display>a representation that the authorizing agent has the right to authorize the <ln numlevel="1" lineno="281" slineno="3-25"/>disposition of the decedent by alkaline hydrolysis and that the authorizing agent is <ln numlevel="1" lineno="282" slineno="3-26"/>not aware of any living <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> with a superior or equal priority right to <ln numlevel="1" lineno="283" slineno="3-27"/>that of the authorizing agent, except that if there is another living <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="284" slineno="3-28"/>individual</amend> with a superior or equal priority right, the alkaline hydrolysis <ln numlevel="1" lineno="285" slineno="3-29"/>authorization form shall contain a representation that the authorizing agent has:<subsection ssid="12-null-12" dnum="A-o" numlevel="1" lineno="286" slineno="3-30" level="4"><display>(A)</display>made reasonable efforts to contact that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend>;</subsection><subsection ssid="12-null-13" dnum="B-o" numlevel="1" lineno="287" slineno="3-31" level="4"><display>(B)</display>been unable to do so; and</subsection><subsection ssid="12-null-14" dnum="C-o" numlevel="1" lineno="288" slineno="3-32" level="4"><display>(C)</display>no reason to believe that the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> would object to the disposition <ln numlevel="1" lineno="289" slineno="3-33"/>of the decedent by alkaline hydrolysis;</subsection></subsection><subsection ssid="12-null-15" dnum="vi-o" numlevel="1" lineno="290" slineno="3-34" level="3" tab="1"><display>(vi)</display>authorization for the funeral service establishment to use alkaline hydrolysis for <ln numlevel="1" lineno="291" slineno="3-35"/>the disposition of the human remains;</subsection><subsection ssid="12-null-16" dnum="vii-o" numlevel="1" lineno="292" slineno="3-36" level="3" tab="1"><display>(vii)</display>the name of the person authorized to receive the human remains from the funeral <ln numlevel="1" lineno="293" slineno="3-37"/>service establishment;</subsection><subsection ssid="12-null-17" dnum="viii-o" numlevel="1" lineno="294" slineno="3-38" level="3" tab="1"><display>(viii)</display>the manner in which the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">disposition of the human remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement of <ln numlevel="1" lineno="295" slineno="3-39"/>remains</amend> is to take place, if known;</subsection><subsection ssid="12-null-18" dnum="ix-o" numlevel="1" lineno="296" slineno="3-40" level="3" tab="1"><display>(ix)</display>a listing of each item of value to be delivered to the funeral service establishment <ln numlevel="1" lineno="297" slineno="3-41"/>along with the human remains, and instructions as to how each item should be <ln numlevel="1" lineno="298" slineno="3-42"/>handled;</subsection><subsection ssid="12-null-19" dnum="x-o" numlevel="1" lineno="299" slineno="3-43" level="3" tab="1"><display>(x)</display>the signature of the authorizing agent, attesting to the accuracy of all <ln numlevel="1" lineno="300" slineno="3-44"/>representations contained on the alkaline hydrolysis authorization form;</subsection><subsection ssid="12-null-20" dnum="xi-o" numlevel="1" lineno="301" slineno="3-45" level="3" tab="1"><display>(xi)</display>if the alkaline hydrolysis authorization form is being executed on a preneed <ln numlevel="1" lineno="302" slineno="3-46"/>basis, the disclosure required for preneed programs under this chapter; and</subsection><subsection ssid="12-null-21" dnum="xii-o" numlevel="1" lineno="303" slineno="3-47" level="3" tab="1"><display>(xii)</display>except for a preneed alkaline hydrolysis authorization, the signature of the <ln numlevel="1" lineno="304" slineno="3-48"/>funeral director of the funeral service establishment that obtained the alkaline <ln numlevel="1" lineno="305" slineno="3-49"/>hydrolysis authorization.</subsection></subsection><subsection ssid="12-null-22" dnum="b-o" numlevel="1" lineno="306" slineno="3-50" level="2" space="false"><display>(b)</display><subsection ssid="12-null-23" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> referred to in Subsection <xref depth="4" refnumber="58-9-613(2)(a)(xii)" start="0">(2)(a)(xii)</xref> shall execute the <ln numlevel="1" lineno="307" slineno="3-51"/>alkaline hydrolysis authorization form as a witness and is not responsible for any <ln numlevel="1" lineno="308" slineno="3-52"/>of the representations made by the authorizing agent.</subsection><subsection ssid="12-null-24" dnum="ii-o" numlevel="1" lineno="309" slineno="3-53" level="3"><display>(ii)</display>The funeral director or the funeral service establishment shall warrant that the <ln numlevel="1" lineno="310" slineno="3-54"/>human remains delivered to the funeral service establishment have been positively <ln numlevel="1" lineno="311" slineno="3-55"/>identified by the authorizing agent or a designated representative of the <ln numlevel="1" lineno="312" slineno="3-56"/>authorizing agent as the decedent listed on the alkaline hydrolysis authorization <ln numlevel="1" lineno="313" slineno="3-57"/>form.</subsection><subsection ssid="12-null-25" dnum="iii-o" numlevel="1" lineno="314" slineno="3-58" level="3"><display>(iii)</display>The authorizing agent or the agent's designee may make the identification <ln numlevel="1" lineno="315" slineno="3-59"/>referred to in Subsection <xref depth="4" refnumber="58-9-613(2)(b)(ii)" start="0">(2)(b)(ii)</xref> in person or by photograph.</subsection></subsection></subsection><subsection ssid="12-null-26" dnum="3-o" numlevel="1" lineno="316" slineno="3-60" level="1" space="false"><display>(3)</display><subsection ssid="12-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A funeral service establishment may not accept unidentified human remains for <ln numlevel="1" lineno="317" slineno="3-61"/>alkaline hydrolysis.</subsection><subsection ssid="12-null-28" dnum="b-o" numlevel="1" lineno="318" slineno="3-62" level="2"><display>(b)</display>If a funeral service establishment takes custody of an alkaline hydrolysis container <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="319" slineno="3-63"/>subsequent to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">after</amend> the human remains <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">being</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">were</amend> placed within the container, the <ln numlevel="1" lineno="320" slineno="3-64"/>funeral service establishment can rely on the identification made before the remains <ln numlevel="1" lineno="321" slineno="3-65"/>were placed in the container.</subsection><subsection ssid="12-null-29" dnum="c-o" numlevel="1" lineno="322" slineno="3-66" level="2"><display>(c)</display>The funeral service establishment shall place appropriate identification on the <ln numlevel="1" lineno="323" slineno="3-67"/>exterior of the alkaline hydrolysis container based on the prior identification.</subsection></subsection><subsection ssid="12-null-30" dnum="4-o" numlevel="1" lineno="324" slineno="3-68" level="1" space="false"><display>(4)</display><subsection ssid="12-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person who removes or possesses dental gold or silver, jewelry, or mementos <ln numlevel="1" lineno="325" slineno="3-69"/>from human remains:<subsection ssid="12-null-32" dnum="i-o" numlevel="1" lineno="326" slineno="3-70" level="3" tab="1"><display>(i)</display>with purpose to deprive another over control of the property is guilty of an offense <ln numlevel="1" lineno="327" slineno="3-71"/>and subject to the punishments provided in Section <xref depth="3" refnumber="76-6-404" start="0">76-6-404</xref>;</subsection><subsection ssid="12-null-33" dnum="ii-o" numlevel="1" lineno="328" slineno="3-72" level="3" tab="1"><display>(ii)</display>with purpose to exercise unauthorized control and with intent to temporarily <ln numlevel="1" lineno="329" slineno="3-73"/>deprive another of control over the property is guilty of an offense and subject to <ln numlevel="1" lineno="330" slineno="3-74"/>the punishments provided in Section <xref depth="3" refnumber="76-6-404.5" start="0">76-6-404.5</xref>; and</subsection><subsection ssid="12-null-34" dnum="iii-o" numlevel="1" lineno="331" slineno="3-75" level="3" tab="1"><display>(iii)</display>under circumstances not amounting to Subsection <xref depth="4" refnumber="58-9-613(4)(a)(i)" start="0">(4)(a)(i)</xref> or <xref depth="4" refnumber="58-9-613(4)(a)(ii)" start="0">(ii)</xref> and without <ln numlevel="1" lineno="332" slineno="3-76"/>specific written permission of the individual who has the right to control those <ln numlevel="1" lineno="333" slineno="3-77"/>remains is guilty of a class B misdemeanor.</subsection></subsection><subsection ssid="12-null-35" dnum="b-o" numlevel="1" lineno="334" slineno="3-78" level="2"><display>(b)</display>The fact that residue or any unavoidable dental gold or dental silver or other precious <ln numlevel="1" lineno="335" slineno="3-79"/>metals remain in alkaline hydrolysis equipment or a container used in a prior alkaline <ln numlevel="1" lineno="336" slineno="3-80"/>hydrolysis process is not a violation of Subsection <xref depth="4" refnumber="58-9-613(4)(a)" start="0">(4)(a)</xref>.</subsection></subsection></section></bsec><bsec buid="14" num="58-9-614" type="amend" src="code" uid="C58-9-S614_2026050620260506" sort="58 09 06140020260506" numlevel="1" lineno="337" slineno="4-1" sn="4"><section number="58-9-614" numlevel="1" lineno="338" slineno="4-2" type="amend"><secline lineno="337">Section 4. Section <bold>58-9-614</bold> is amended to read:</secline><catline lineno="338"><bold>58-9-614<parens/>. Recordkeeping.</bold></catline><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="339" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="14-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A funeral service establishment shall furnish to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> who <ln numlevel="1" lineno="340" slineno="4-4"/>delivers human remains to the establishment for alkaline hydrolysis a receipt signed <ln numlevel="1" lineno="341" slineno="4-5"/>by a representative of the establishment and the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> making the <ln numlevel="1" lineno="342" slineno="4-6"/>delivery, showing:<subsection ssid="14-null-3" dnum="i-o" numlevel="1" lineno="343" slineno="4-7" level="3" tab="1"><display>(i)</display>the date and time of the delivery;</subsection><subsection ssid="14-null-4" dnum="ii-o" numlevel="1" lineno="344" slineno="4-8" level="3" tab="1"><display>(ii)</display>the type of casket or alternative container delivered;</subsection><subsection ssid="14-null-5" dnum="iii-o" numlevel="1" lineno="345" slineno="4-9" level="3" tab="1"><display>(iii)</display>the name of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> from whom the human remains were received;</subsection><subsection ssid="14-null-6" dnum="iv-o" numlevel="1" lineno="346" slineno="4-10" level="3" tab="1"><display>(iv)</display>the name of the funeral establishment or other entity with whom the person <ln numlevel="1" lineno="347" slineno="4-11"/>making the delivery is affiliated;</subsection><subsection ssid="14-null-7" dnum="v-o" numlevel="1" lineno="348" slineno="4-12" level="3" tab="1"><display>(v)</display>the name of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> who received the human remains on behalf of <ln numlevel="1" lineno="349" slineno="4-13"/>the funeral service establishment; and</subsection><subsection ssid="14-null-8" dnum="vi-o" numlevel="1" lineno="350" slineno="4-14" level="3" tab="1"><display>(vi)</display>the name of the decedent.</subsection></subsection><subsection ssid="14-null-9" dnum="b-o" numlevel="1" lineno="351" slineno="4-15" level="2"><display>(b)</display>The funeral service establishment shall keep a copy of the receipt in the funeral <ln numlevel="1" lineno="352" slineno="4-16"/>service establishment's permanent records for a period of seven years.</subsection></subsection><subsection ssid="14-null-10" dnum="2-o" numlevel="1" lineno="353" slineno="4-17" level="1" space="false"><display>(2)</display><subsection ssid="14-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon release of human remains after alkaline hydrolysis, a funeral service <ln numlevel="1" lineno="354" slineno="4-18"/>establishment shall furnish to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> who receives the human remains <ln numlevel="1" lineno="355" slineno="4-19"/>a receipt signed by a representative of the funeral service establishment and the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="356" slineno="4-20"/>person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> who receives the human remains, showing:<subsection ssid="14-null-12" dnum="i-o" numlevel="1" lineno="357" slineno="4-21" level="3" tab="1"><display>(i)</display>the date and time of the release;</subsection><subsection ssid="14-null-13" dnum="ii-o" numlevel="1" lineno="358" slineno="4-22" level="3" tab="1"><display>(ii)</display>the name of the person to whom the human remains were released; and</subsection><subsection ssid="14-null-14" dnum="iii-o" numlevel="1" lineno="359" slineno="4-23" level="3" tab="1"><display>(iii)</display>if applicable:<subsection ssid="14-null-15" dnum="A-o" numlevel="1" lineno="360" slineno="4-24" level="4"><display>(A)</display>the name of the funeral establishment, cemetery, or other entity with whom <ln numlevel="1" lineno="361" slineno="4-25"/>the person receiving the human remains is affiliated;</subsection><subsection ssid="14-null-16" dnum="B-o" numlevel="1" lineno="362" slineno="4-26" level="4"><display>(B)</display>the name of the person who released the human remains on behalf of the <ln numlevel="1" lineno="363" slineno="4-27"/>funeral service establishment; and</subsection><subsection ssid="14-null-17" dnum="C-o" numlevel="1" lineno="364" slineno="4-28" level="4"><display>(C)</display>the name of the decedent.</subsection></subsection></subsection><subsection ssid="14-null-18" dnum="b-o" numlevel="1" lineno="365" slineno="4-29" level="2" space="false"><display>(b)</display><subsection ssid="14-null-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The receipt shall contain a representation from the person receiving the human <ln numlevel="1" lineno="366" slineno="4-30"/>remains confirming that the remains will not be used for any improper purpose.</subsection><subsection ssid="14-null-20" dnum="ii-o" numlevel="1" lineno="367" slineno="4-31" level="3"><display>(ii)</display>Upon release of the human remains, the person to whom the human remains were <ln numlevel="1" lineno="368" slineno="4-32"/>released may transport the human remains in any manner in the state, without a <ln numlevel="1" lineno="369" slineno="4-33"/>permit, and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">dispose of the human remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conduct the final placement of remains</amend> <ln numlevel="1" lineno="370" slineno="4-34"/>in accordance with this chapter.</subsection></subsection><subsection ssid="14-null-21" dnum="c-o" numlevel="1" lineno="371" slineno="4-35" level="2"><display>(c)</display>The funeral service establishment shall retain a copy of the receipt in the funeral <ln numlevel="1" lineno="372" slineno="4-36"/>service establishment's permanent records for a period of seven years.</subsection></subsection><subsection ssid="14-null-22" dnum="3-o" numlevel="1" lineno="373" slineno="4-37" level="1" space="false"><display>(3)</display><subsection ssid="14-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The funeral service establishment shall maintain at the funeral service <ln numlevel="1" lineno="374" slineno="4-38"/>establishment's place of business a permanent record of each disposition by alkaline <ln numlevel="1" lineno="375" slineno="4-39"/>hydrolysis that took place at the funeral service establishment.</subsection><subsection ssid="14-null-24" dnum="b-o" numlevel="1" lineno="376" slineno="4-40" level="2"><display>(b)</display>The permanent record shall contain:<subsection ssid="14-null-25" dnum="i-o" numlevel="1" lineno="377" slineno="4-41" level="3"><display>(i)</display>the name of the decedent;</subsection><subsection ssid="14-null-26" dnum="ii-o" numlevel="1" lineno="378" slineno="4-42" level="3"><display>(ii)</display>the date of disposition by alkaline hydrolysis;</subsection><subsection ssid="14-null-27" dnum="iii-o" numlevel="1" lineno="379" slineno="4-43" level="3"><display>(iii)</display>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">final disposition of the human remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">final placement of remains</amend>; and</subsection><subsection ssid="14-null-28" dnum="iv-o" numlevel="1" lineno="380" slineno="4-44" level="3"><display>(iv)</display>any other document required by this chapter.</subsection></subsection></subsection></section></bsec><bsec buid="4" num="58-9-617" type="amend" src="code" uid="C58-9-S617_2026050620260506" sort="58 09 06170020260506" numlevel="1" lineno="381" slineno="5-1" sn="5"><section number="58-9-617" numlevel="1" lineno="382" slineno="5-2" type="amend"><secline lineno="381">Section 5. Section <bold>58-9-617</bold> is amended to read:</secline><catline lineno="382"><bold>58-9-617<parens/>. Final placement of remains from the alkaline hydrolysis process.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="383" slineno="5-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent shall provide the person with whom <amend anum="0" ea="amend" pairid="28" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both">the authorizing agent <ln numlevel="1" lineno="384" slineno="5-4"/>makes </amend>alkaline hydrolysis arrangements <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">are made with </amend><amendoutend style="2"/>a signed statement <ln numlevel="1" lineno="385" slineno="5-5"/>specifying the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="59" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement</amend> of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both">the </amend><amendoutend style="2"/>remains from the alkaline <ln numlevel="1" lineno="386" slineno="5-6"/>hydrolysis process, if known.</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="387" slineno="5-7" level="2"><display>(b)</display>The funeral service establishment shall retain a copy of the statement.</subsection></subsection><subsection ssid="4-null-4" dnum="2-o" numlevel="1" lineno="388" slineno="5-8" level="1" space="false"><display>(2)</display><subsection ssid="4-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The authorizing agent is responsible for the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="61" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="47" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement</amend> of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">the </amend><amendoutend style="2"/><ln numlevel="1" lineno="389" slineno="5-9"/>remains from the alkaline hydrolysis process.</subsection><subsection ssid="4-null-6" dnum="b-o" numlevel="1" lineno="390" slineno="5-10" level="2"><display>(b)</display>If the authorizing agent or the agent's representative has not specified the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">ultimate <ln numlevel="1" lineno="391" slineno="5-11"/>disposition of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">final placement of remains</amend> or claimed the remains from the alkaline <ln numlevel="1" lineno="392" slineno="5-12"/>hydrolysis process within 60 days <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">from the date of the alkaline hydrolysis process</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="393" slineno="5-13"/>after the day on which the alkaline hydrolysis process occurs</amend>, the funeral service <ln numlevel="1" lineno="394" slineno="5-14"/>establishment may <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both">dispose of the remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conduct the final placement of remains</amend> in <ln numlevel="1" lineno="395" slineno="5-15"/>any manner permitted by law, except scattering.</subsection><subsection ssid="4-null-7" dnum="c-o" numlevel="1" lineno="396" slineno="5-16" level="2"><display>(c)</display>The authorizing agent shall reimburse the funeral service establishment for all <ln numlevel="1" lineno="397" slineno="5-17"/>reasonable costs incurred in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both">disposing of the remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conducting the final placement <ln numlevel="1" lineno="398" slineno="5-18"/>of remains</amend> from the alkaline hydrolysis process under Subsection <xref depth="4" refnumber="58-9-617(2)(b)" start="0">(2)(b)</xref>.</subsection><subsection ssid="4-null-8" dnum="d-o" numlevel="1" lineno="399" slineno="5-19" level="2"><display>(d)</display>The person or entity <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="75" groupid="71" style="2" owner="jchristopherson" level="1" deltag="both">disposing of remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conducting the final placement</amend> from the <ln numlevel="1" lineno="400" slineno="5-20"/>alkaline hydrolysis process under this section:<subsection ssid="4-null-9" dnum="i-o" numlevel="1" lineno="401" slineno="5-21" level="3"><display>(i)</display>shall make and keep a record of the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="72" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement</amend> of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="78" groupid="74" style="2" owner="jchristopherson" level="1" deltag="both">the </amend><amendoutend style="2"/>remains; <ln numlevel="1" lineno="402" slineno="5-22"/>and</subsection><subsection ssid="4-null-10" dnum="ii-o" numlevel="1" lineno="403" slineno="5-23" level="3"><display>(ii)</display>is discharged from any legal obligation or liability concerning the remains once <ln numlevel="1" lineno="404" slineno="5-24"/>the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="81" groupid="77" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement of remains</amend> has been made.</subsection></subsection></subsection><subsection ssid="4-null-11" dnum="3-o" numlevel="1" lineno="405" slineno="5-25" level="1" space="false"><display>(3)</display><subsection ssid="4-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizing agent may direct a funeral service establishment to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="79" style="2" owner="jchristopherson" level="1" deltag="both">dispose of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="55" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="406" slineno="5-26"/>conduct the final placement of remains</amend> or arrange for the final <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="80" style="2" owner="jchristopherson" level="1" deltag="both">disposition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">placement</amend> <ln numlevel="1" lineno="407" slineno="5-27"/>of remains from the alkaline hydrolysis process:<subsection ssid="4-null-13" dnum="i-o" numlevel="1" lineno="408" slineno="5-28" level="3" tab="1"><display>(i)</display>in a crypt, niche, grave, or scattering garden located in a dedicated cemetery;</subsection><subsection ssid="4-null-14" dnum="ii-o" numlevel="1" lineno="409" slineno="5-29" level="3" tab="1"><display>(ii)</display>by scattering the remains over uninhabited public land, the sea, or other public <ln numlevel="1" lineno="410" slineno="5-30"/>waterways subject to health and environmental laws and regulations; or</subsection><subsection ssid="4-null-15" dnum="iii-o" numlevel="1" lineno="411" slineno="5-31" level="3" tab="1"><display>(iii)</display>in any manner on the private property of a consenting owner.</subsection></subsection><subsection ssid="4-null-16" dnum="b-o" numlevel="1" lineno="412" slineno="5-32" level="2"><display>(b)</display>If <amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">the authorizing agent intends to conduct the final placement of </amend>remains from the <ln numlevel="1" lineno="413" slineno="5-33"/>alkaline hydrolysis process <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">are to be disposed of </amend><amendoutend style="2"/>on private property, other than <ln numlevel="1" lineno="414" slineno="5-34"/>dedicated cemetery property, the authorizing agent shall provide the funeral service <ln numlevel="1" lineno="415" slineno="5-35"/>establishment with the written consent of the property owner before <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="85" groupid="81" style="2" owner="jchristopherson" level="1" deltag="both">disposal</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="57" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the <ln numlevel="1" lineno="416" slineno="5-36"/>final placement</amend> of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="87" groupid="83" style="2" owner="jchristopherson" level="1" deltag="both">the </amend><amendoutend style="2"/>remains.</subsection><subsection ssid="4-null-17" dnum="c-o" numlevel="1" lineno="417" slineno="5-37" level="2"><display>(c)</display>In order to scatter remains from the alkaline hydrolysis process under Subsection <xref depth="4" refnumber="58-9-617(3)(a)(ii)" start="0"><ln numlevel="1" lineno="418" slineno="5-38"/>(3)(a)(ii)</xref> or <xref depth="4" refnumber="58-9-617(3)(a)(iii)" start="0">(iii)</xref>, the remains must be reduced to a particle size of one-eighth inch or <ln numlevel="1" lineno="419" slineno="5-39"/>less and removed from the remains' closed container.</subsection></subsection><subsection ssid="4-null-18" dnum="4-o:_-i" numlevel="1" lineno="420" slineno="5-40" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1223" style="2" owner="o" level="1" deltag="start">(4)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="jchristopherson" level="1" deltag="end">Under this section, a funeral service establishment may not release remains from the <ln numlevel="1" lineno="421" slineno="5-41"/>alkaline hydrolysis process to the authorizing agent or the agent's designated <ln numlevel="1" lineno="422" slineno="5-42"/>representative for scattering until the funeral service establishment is given a receipt that <ln numlevel="1" lineno="423" slineno="5-43"/>shows the proper filing has been made with the local registrar of births and deaths.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="16" num="58-9-618" type="amend" src="code" uid="C58-9-S618_2026050620260506" sort="58 09 06180020260506" numlevel="1" lineno="424" slineno="6-1" sn="6"><section number="58-9-618" numlevel="1" lineno="425" slineno="6-2" type="amend"><secline lineno="424">Section 6. Section <bold>58-9-618</bold> is amended to read:</secline><catline lineno="425"><bold>58-9-618<parens/>. Limitation of liability.</bold></catline><subsection ssid="16-null-1" dnum="1-o" numlevel="1" lineno="426" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>An authorizing agent who signs an alkaline hydrolysis authorization form warrants the <ln numlevel="1" lineno="427" slineno="6-4"/>truthfulness of the facts set forth on the form, including:<subsection ssid="16-null-2" dnum="a-o" numlevel="1" lineno="428" slineno="6-5" level="2"><display>(a)</display>the identity of the deceased whose remains are to undergo the alkaline hydrolysis <ln numlevel="1" lineno="429" slineno="6-6"/>process; and</subsection><subsection ssid="16-null-3" dnum="b-o" numlevel="1" lineno="430" slineno="6-7" level="2"><display>(b)</display>the authorizing agent's authority to order the alkaline hydrolysis process.</subsection></subsection><subsection ssid="16-null-4" dnum="2-o" numlevel="1" lineno="431" slineno="6-8" level="1"><display>(2)</display>A funeral service establishment may rely upon the representations made by an <ln numlevel="1" lineno="432" slineno="6-9"/>authorizing agent under Subsection <xref depth="4" refnumber="58-9-618(1)" start="0">(1)</xref>.</subsection><subsection ssid="16-null-5" dnum="3-o" numlevel="1" lineno="433" slineno="6-10" level="1"><display>(3)</display>The authorizing agent is personally and individually liable for all damage resulting from <ln numlevel="1" lineno="434" slineno="6-11"/>a misstatement or misrepresentation made under Subsection <xref depth="4" refnumber="58-9-618(1)" start="0">(1)</xref>.</subsection><subsection ssid="16-null-6" dnum="4-o" numlevel="1" lineno="435" slineno="6-12" level="1" space="false"><display>(4)</display><subsection ssid="16-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A funeral service establishment may arrange for the alkaline hydrolysis process <ln numlevel="1" lineno="436" slineno="6-13"/>upon receipt of an alkaline hydrolysis authorization form signed by an authorizing <ln numlevel="1" lineno="437" slineno="6-14"/>agent.</subsection><subsection ssid="16-null-8" dnum="b-o" numlevel="1" lineno="438" slineno="6-15" level="2"><display>(b)</display>A funeral service establishment that arranges the alkaline hydrolysis process or <ln numlevel="1" lineno="439" slineno="6-16"/>releases or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">disposes of human</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conducts the final placement of</amend> remains from the <ln numlevel="1" lineno="440" slineno="6-17"/>alkaline hydrolysis process pursuant to an alkaline hydrolysis authorization form is <ln numlevel="1" lineno="441" slineno="6-18"/>not liable for an action the funeral service establishment takes <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="442" slineno="6-19"/>accordance with</amend> that authorization.</subsection></subsection><subsection ssid="16-null-9" dnum="5-o" numlevel="1" lineno="443" slineno="6-20" level="1"><display>(5)</display>A funeral service establishment is not responsible or liable for any valuables delivered <ln numlevel="1" lineno="444" slineno="6-21"/>to the establishment with human remains.</subsection><subsection ssid="16-null-10" dnum="6-o" numlevel="1" lineno="445" slineno="6-22" level="1"><display>(6)</display>A funeral service establishment may refuse to arrange for the alkaline hydrolysis <ln numlevel="1" lineno="446" slineno="6-23"/>process of a decedent, to accept human remains for the alkaline hydrolysis process, or to <ln numlevel="1" lineno="447" slineno="6-24"/>perform the alkaline hydrolysis process:<subsection ssid="16-null-11" dnum="a-o" numlevel="1" lineno="448" slineno="6-25" level="2"><display>(a)</display>if the <amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">funeral service </amend>establishment is aware of a dispute concerning the disposition <ln numlevel="1" lineno="449" slineno="6-26"/>of the human remains and the funeral service establishment has not received a court <ln numlevel="1" lineno="450" slineno="6-27"/>order or other suitable confirmation that the dispute has been resolved;</subsection><subsection ssid="16-null-12" dnum="b-o" numlevel="1" lineno="451" slineno="6-28" level="2"><display>(b)</display>if the <amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">funeral service </amend>establishment has a reasonable basis for questioning any of the <ln numlevel="1" lineno="452" slineno="6-29"/>representations made by an authorizing agent; or</subsection><subsection ssid="16-null-13" dnum="c-o" numlevel="1" lineno="453" slineno="6-30" level="2"><display>(c)</display>for any other lawful reason.</subsection></subsection><subsection ssid="16-null-14" dnum="7-o" numlevel="1" lineno="454" slineno="6-31" level="1" space="false"><display>(7)</display><subsection ssid="16-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a funeral service establishment is aware of a dispute concerning the release or <ln numlevel="1" lineno="455" slineno="6-32"/>disposition of remains from the alkaline hydrolysis process in the funeral service <ln numlevel="1" lineno="456" slineno="6-33"/>establishment's possession, the establishment may refuse to release the remains until:<subsection ssid="16-null-16" dnum="i-o" numlevel="1" lineno="457" slineno="6-34" level="3" tab="1"><display>(i)</display>the dispute has been resolved; or</subsection><subsection ssid="16-null-17" dnum="ii-o" numlevel="1" lineno="458" slineno="6-35" level="3" tab="1"><display>(ii)</display>the funeral service establishment has received a court order authorizing the <ln numlevel="1" lineno="459" slineno="6-36"/>release or disposition of the remains.</subsection></subsection><subsection ssid="16-null-18" dnum="b-o" numlevel="1" lineno="460" slineno="6-37" level="2"><display>(b)</display>A funeral service establishment is not liable for its refusal to release or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">dispose of <ln numlevel="1" lineno="461" slineno="6-38"/>remains</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">conduct the final placement of remains</amend> from the alkaline hydrolysis process <ln numlevel="1" lineno="462" slineno="6-39"/>in accordance with this Subsection <xref depth="4" refnumber="58-9-618(7)" start="0">(7)</xref>.</subsection></subsection></section></bsec><bsec buid="17" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="463" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="463">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="464"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-20-26 8:03 PM</tm></rev></foot></leg>
