Wilcox</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill concerns impermissible law enforcement quotas.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">requires the State Commission on Criminal and Juvenile Justice to collect reports of <ln numlevel="1" lineno="10" slineno="0-10"/>alleged violations of the impermissible law enforcement quota prohibition and annually <ln numlevel="1" lineno="11" slineno="0-11"/>report the data to the Law Enforcement and Criminal Justice Interim Committee;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">prohibits a political subdivision or law enforcement agency from:<hl numlevel="1" lineno="13" slineno="0-13" level="2">requiring or directing a peace officer to meet an impermissible quota; or</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">transferring, promoting, disciplining, or taking other actions against a peace officer for <ln numlevel="1" lineno="15" slineno="0-15"/>reasons relating to an impermissible quota; and</hl></hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="17" slineno="0-17" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="18">None</moniNone><oc numlevel="1" lineno="19" slineno="0-19">Other Special Clauses:</oc><ocNone lineno="20">None</ocNone><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="63M-7-204" src="code" uid="C63M-7-S204_2026050620260506" buid="1" sort="63M07 02040020260506" numlevel="1" lineno="23" slineno="0-23"><bold>63M-7-204</bold>, as last amended by Laws of Utah 2025, Chapters 51, 135, 252, 494, and 510</sn><sn num="77-7-27" src="code" uid="C77-7-S27_2026050620260506" buid="2" sort="77 07 00270020260506" numlevel="1" lineno="24" slineno="0-24"><bold>77-7-27</bold>, as enacted by Laws of Utah 2018, Chapter 289</sn></saamd></sa></lt><enacthead lineno="25"/><enact numlevel="1" lineno="26" slineno="0-26">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="63M-7-204" type="amend" src="code" uid="C63M-7-S204_2026050620260506" sort="63M07 02040020260506" numlevel="1" lineno="27" slineno="1-1" sn="1"><section number="63M-7-204" numlevel="1" lineno="28" slineno="1-2" type="amend"><secline lineno="27">Section 1. Section <bold>63M-7-204</bold> is amended to read:</secline><catline lineno="28"><bold>63M-7-204<parens/>. Duties of commission.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The commission shall:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="30" slineno="1-4" level="2"><display>(a)</display>promote the commission's purposes as enumerated in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>;</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="31" slineno="1-5" level="2"><display>(b)</display>promote the communication and coordination of all criminal and juvenile justice <ln numlevel="1" lineno="32" slineno="1-6"/>agencies;</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="33" slineno="1-7" level="2"><display>(c)</display>study, evaluate, and report on the status of crime in the state and on the effectiveness <ln numlevel="1" lineno="34" slineno="1-8"/>of criminal justice policies, procedures, and programs that are directed toward the <ln numlevel="1" lineno="35" slineno="1-9"/>reduction of crime in the state;</subsection><subsection ssid="1-null-5" dnum="d-o" numlevel="1" lineno="36" slineno="1-10" level="2"><display>(d)</display>study, evaluate, and report on programs initiated by state and local agencies to <ln numlevel="1" lineno="37" slineno="1-11"/>address reducing recidivism, including changes in penalties and sentencing <ln numlevel="1" lineno="38" slineno="1-12"/>guidelines intended to reduce recidivism, costs savings associated with the reduction <ln numlevel="1" lineno="39" slineno="1-13"/>in the number of inmates, and evaluation of expenses and resources needed to meet <ln numlevel="1" lineno="40" slineno="1-14"/>goals regarding the use of treatment as an alternative to incarceration, as resources <ln numlevel="1" lineno="41" slineno="1-15"/>allow;</subsection><subsection ssid="1-null-6" dnum="e-o" numlevel="1" lineno="42" slineno="1-16" level="2"><display>(e)</display>study, evaluate, and report on policies, procedures, and programs of other <ln numlevel="1" lineno="43" slineno="1-17"/>jurisdictions <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend> have effectively reduced crime;</subsection><subsection ssid="1-null-7" dnum="f-o" numlevel="1" lineno="44" slineno="1-18" level="2"><display>(f)</display>identify and promote the implementation of specific policies and programs the <ln numlevel="1" lineno="45" slineno="1-19"/>commission determines will significantly reduce crime in Utah;</subsection><subsection ssid="1-null-8" dnum="g-o" numlevel="1" lineno="46" slineno="1-20" level="2"><display>(g)</display>provide analysis and recommendations on all criminal and juvenile justice <ln numlevel="1" lineno="47" slineno="1-21"/>legislation, state budget, and facility requests, including program and fiscal impact on <ln numlevel="1" lineno="48" slineno="1-22"/>all components of the criminal and juvenile justice system;</subsection><subsection ssid="1-null-9" dnum="h-o" numlevel="1" lineno="49" slineno="1-23" level="2"><display>(h)</display>provide analysis, accountability, recommendations, and supervision for state and <ln numlevel="1" lineno="50" slineno="1-24"/>federal criminal justice grant money;</subsection><subsection ssid="1-null-10" dnum="i-o" numlevel="1" lineno="51" slineno="1-25" level="2"><display>(i)</display>provide public information on the criminal and juvenile justice system and give <ln numlevel="1" lineno="52" slineno="1-26"/>technical assistance to agencies or local units of government on methods to promote <ln numlevel="1" lineno="53" slineno="1-27"/>public awareness;</subsection><subsection ssid="1-null-11" dnum="j-o" numlevel="1" lineno="54" slineno="1-28" level="2"><display>(j)</display>promote research and program evaluation as an integral part of the criminal and <ln numlevel="1" lineno="55" slineno="1-29"/>juvenile justice system;</subsection><subsection ssid="1-null-12" dnum="k-o" numlevel="1" lineno="56" slineno="1-30" level="2"><display>(k)</display>provide a comprehensive criminal justice plan annually;</subsection><subsection ssid="1-null-13" dnum="l-o" numlevel="1" lineno="57" slineno="1-31" level="2"><display>(l)</display>review agency forecasts regarding future demands on the criminal and juvenile <ln numlevel="1" lineno="58" slineno="1-32"/>justice systems, including specific projections for secure bed space;</subsection><subsection ssid="1-null-14" dnum="m-o" numlevel="1" lineno="59" slineno="1-33" level="2"><display>(m)</display>promote the development of criminal and juvenile justice information systems that <ln numlevel="1" lineno="60" slineno="1-34"/>are consistent with common standards for data storage and are capable of <ln numlevel="1" lineno="61" slineno="1-35"/>appropriately sharing information with other criminal justice information systems by:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="62" slineno="1-36" level="3"><display>(i)</display>developing and maintaining common data standards for use by all state criminal <ln numlevel="1" lineno="63" slineno="1-37"/>justice agencies;</subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="64" slineno="1-38" level="3"><display>(ii)</display>annually performing audits of criminal history record information maintained by <ln numlevel="1" lineno="65" slineno="1-39"/>state criminal justice agencies to assess their accuracy, completeness, and <ln numlevel="1" lineno="66" slineno="1-40"/>adherence to standards;</subsection><subsection ssid="1-null-17" dnum="iii-o" numlevel="1" lineno="67" slineno="1-41" level="3"><display>(iii)</display>defining and developing state and local programs and projects associated with <ln numlevel="1" lineno="68" slineno="1-42"/>the improvement of information management for law enforcement and the <ln numlevel="1" lineno="69" slineno="1-43"/>administration of justice; and</subsection><subsection ssid="1-null-18" dnum="iv-o" numlevel="1" lineno="70" slineno="1-44" level="3"><display>(iv)</display>establishing general policies concerning criminal and juvenile justice information <ln numlevel="1" lineno="71" slineno="1-45"/>systems and making rules as necessary to carry out the duties under Subsection <xref depth="4" refnumber="63M-7-204(1)(k)"><ln numlevel="1" lineno="72" slineno="1-46"/>(1)(k)</xref> and this Subsection <xref depth="4" refnumber="63M-7-204(1)(m)">(1)(m)</xref>;</subsection></subsection><subsection ssid="1-null-19" dnum="n-o" numlevel="1" lineno="73" slineno="1-47" level="2"><display>(n)</display>allocate and administer grants, from money made available, for approved education <ln numlevel="1" lineno="74" slineno="1-48"/>programs to help prevent the sexual exploitation of children;</subsection><subsection ssid="1-null-20" dnum="o-o" numlevel="1" lineno="75" slineno="1-49" level="2"><display>(o)</display>allocate and administer grants for law enforcement operations and programs related <ln numlevel="1" lineno="76" slineno="1-50"/>to reducing illegal drug activity and related criminal activity;</subsection><subsection ssid="1-null-21" dnum="p-o" numlevel="1" lineno="77" slineno="1-51" level="2"><display>(p)</display>request, receive, and evaluate data and recommendations collected and reported by:<subsection ssid="1-null-22" dnum="i-o" numlevel="1" lineno="78" slineno="1-52" level="3"><display>(i)</display>agencies and contractors related to policies recommended by the commission <ln numlevel="1" lineno="79" slineno="1-53"/>regarding recidivism reduction, including the data described in Section <xref depth="3" refnumber="13-53-111">13-53-111</xref> <ln numlevel="1" lineno="80" slineno="1-54"/>and Subsection <xref depth="4" refnumber="26B-5-102(2)(jj)">26B-5-102(2)(jj)</xref>; and</subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="81" slineno="1-55" level="3"><display>(ii)</display>state agencies under Section <xref depth="3" refnumber="67-28-102">67-28-102</xref>;</subsection></subsection><subsection ssid="1-null-24" dnum="q-o" numlevel="1" lineno="82" slineno="1-56" level="2"><display>(q)</display>establish and administer a performance incentive grant program that allocates funds <ln numlevel="1" lineno="83" slineno="1-57"/>appropriated by the Legislature to programs and practices implemented by counties <ln numlevel="1" lineno="84" slineno="1-58"/>that reduce recidivism and reduce the number of offenders per capita who are <ln numlevel="1" lineno="85" slineno="1-59"/>incarcerated;</subsection><subsection ssid="1-null-25" dnum="r-o" numlevel="1" lineno="86" slineno="1-60" level="2"><display>(r)</display>oversee or designate an entity to oversee the implementation of juvenile justice <ln numlevel="1" lineno="87" slineno="1-61"/>reforms;</subsection><subsection ssid="1-null-26" dnum="s-o" numlevel="1" lineno="88" slineno="1-62" level="2"><display>(s)</display>make rules and administer the juvenile holding room standards and juvenile jail <ln numlevel="1" lineno="89" slineno="1-63"/>standards to align with the Juvenile Justice and Delinquency Prevention Act <ln numlevel="1" lineno="90" slineno="1-64"/>requirements pursuant to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">42 U.S.C. Sec. 5633</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">34 U.S.C. Sec. 11133</amend>;</subsection><subsection ssid="1-null-27" dnum="t-o" numlevel="1" lineno="91" slineno="1-65" level="2"><display>(t)</display>allocate and administer grants, from money made available, for pilot qualifying <ln numlevel="1" lineno="92" slineno="1-66"/>education programs;</subsection><subsection ssid="1-null-28" dnum="u-o" numlevel="1" lineno="93" slineno="1-67" level="2"><display>(u)</display>request, receive, and evaluate the aggregate data collected from prosecutorial <ln numlevel="1" lineno="94" slineno="1-68"/>agencies and the Administrative Office of the Courts, in accordance with Sections <xref depth="3" refnumber="63M-7-216"><ln numlevel="1" lineno="95" slineno="1-69"/>63M-7-216</xref>, <xref depth="3" refnumber="63M-7-216.1">63M-7-216.1</xref>, and <xref depth="3" refnumber="78A-2-109.5">78A-2-109.5</xref>;</subsection><subsection ssid="1-null-29" dnum="v-o" numlevel="1" lineno="96" slineno="1-70" level="2"><display>(v)</display>report annually to the Law Enforcement and Criminal Justice Interim Committee on <ln numlevel="1" lineno="97" slineno="1-71"/>the progress made on each of the following goals of the Justice Reinvestment <ln numlevel="1" lineno="98" slineno="1-72"/>Initiative:<subsection ssid="1-null-30" dnum="i-o" numlevel="1" lineno="99" slineno="1-73" level="3"><display>(i)</display>ensuring oversight and accountability;</subsection><subsection ssid="1-null-31" dnum="ii-o" numlevel="1" lineno="100" slineno="1-74" level="3"><display>(ii)</display>supporting local corrections systems;</subsection><subsection ssid="1-null-32" dnum="iii-o" numlevel="1" lineno="101" slineno="1-75" level="3"><display>(iii)</display>improving and expanding reentry and treatment services; and</subsection><subsection ssid="1-null-33" dnum="iv-o" numlevel="1" lineno="102" slineno="1-76" level="3"><display>(iv)</display>strengthening probation and parole supervision;</subsection></subsection><subsection ssid="1-null-34" dnum="w-o" numlevel="1" lineno="103" slineno="1-77" level="2"><display>(w)</display>compile a report of findings based on the data and recommendations provided under <ln numlevel="1" lineno="104" slineno="1-78"/>Section <xref depth="3" refnumber="13-53-111">13-53-111</xref> that<amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>separates the data provided under Section <xref depth="3" refnumber="13-53-111">13-53-111</xref> by each <ln numlevel="1" lineno="105" slineno="1-79"/>residential vocational or life skills program;</subsection><subsection ssid="1-null-35" dnum="x-o" numlevel="1" lineno="106" slineno="1-80" level="2"><display>(x)</display>publish the report described in Subsection <xref depth="4" refnumber="63M-7-204(1)(w)">(1)(w)</xref> on the commission's website and <ln numlevel="1" lineno="107" slineno="1-81"/>annually provide the report to the Judiciary Interim Committee, the Health and <ln numlevel="1" lineno="108" slineno="1-82"/>Human Services Interim Committee, the Law Enforcement and Criminal Justice <ln numlevel="1" lineno="109" slineno="1-83"/>Interim Committee, and the related appropriations subcommittees;</subsection><subsection ssid="1-null-36" dnum="y-o" numlevel="1" lineno="110" slineno="1-84" level="2"><display>(y)</display>receive, compile, and publish on the commission's website the data provided under:<subsection ssid="1-null-37" dnum="i-o" numlevel="1" lineno="111" slineno="1-85" level="3"><display>(i)</display>Section <xref depth="3" refnumber="53-25-202">53-25-202</xref>;</subsection><subsection ssid="1-null-38" dnum="ii-o" numlevel="1" lineno="112" slineno="1-86" level="3"><display>(ii)</display>Section <xref depth="3" refnumber="53-25-301">53-25-301</xref>; and</subsection><subsection ssid="1-null-39" dnum="iii-o" numlevel="1" lineno="113" slineno="1-87" level="3"><display>(iii)</display>Section <xref depth="3" refnumber="53-25-401">53-25-401</xref>;</subsection></subsection><subsection ssid="1-null-40" dnum="z-o" numlevel="1" lineno="114" slineno="1-88" level="2"><display>(z)</display>review, research, advise, and make recommendations to the three branches of <ln numlevel="1" lineno="115" slineno="1-89"/>government regarding evidence-based sex offense management policies and <ln numlevel="1" lineno="116" slineno="1-90"/>practices, including supervision standards, treatment standards, and the sex offender <ln numlevel="1" lineno="117" slineno="1-91"/>registry;</subsection><subsection ssid="1-null-41" dnum="aa-o" numlevel="1" lineno="118" slineno="1-92" level="2"><display>(aa)</display>receive and evaluate a referral from the Department of Public Safety received under <ln numlevel="1" lineno="119" slineno="1-93"/>Section <xref depth="3" refnumber="53-21-104.3">53-21-104.3</xref> involving a denial of mental health resources to an eligible <ln numlevel="1" lineno="120" slineno="1-94"/>individual, including, if appropriate in the commission's discretion, deny the relevant <ln numlevel="1" lineno="121" slineno="1-95"/>entity from receiving any grant of state funds under Section <xref depth="3" refnumber="63M-7-218">63M-7-218</xref> for a <ln numlevel="1" lineno="122" slineno="1-96"/>specified period of time;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="1-47" dnum="_-o:bb-i" numlevel="1" lineno="123" slineno="1-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(bb)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">receive, compile, and annually submit a report to the Law Enforcement and <ln numlevel="1" lineno="124" slineno="1-98"/>Criminal Justice Interim Committee of alleged violations of the impermissible law <ln numlevel="1" lineno="125" slineno="1-99"/>enforcement quota prohibition under Subsection <xref depth="4" refnumber="77-7-27(4)">77-7-27(4)</xref>; and</amend></subsection><subsection ssid="1-null-42" dnum="bb-o:cc-i" numlevel="1" lineno="126" slineno="1-100" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="both">(bb)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="both" space="true">(cc)</amend></display>accept public comment.</subsection></subsection><subsection ssid="1-null-43" dnum="2-o" numlevel="1" lineno="127" slineno="1-101" level="1" space="false"><display>(2)</display><subsection ssid="1-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission may designate an entity to perform the duties described in this <ln numlevel="1" lineno="128" slineno="1-102"/>part.</subsection><subsection ssid="1-null-45" dnum="b-o" numlevel="1" lineno="129" slineno="1-103" level="2"><display>(b)</display>If the commission designates an entity under Subsection <xref depth="4" refnumber="63M-7-204(2)(a)">(2)(a)</xref>, the commission shall <ln numlevel="1" lineno="130" slineno="1-104"/>ensure that the membership of the designated entity includes representation from <ln numlevel="1" lineno="131" slineno="1-105"/>relevant stakeholder groups from the parts of the justice system implicated in the <ln numlevel="1" lineno="132" slineno="1-106"/>policy area.</subsection></subsection><subsection ssid="1-null-46" dnum="3-o" numlevel="1" lineno="133" slineno="1-107" level="1"><display>(3)</display>In fulfilling the commission's duties under Subsection <xref depth="4" refnumber="63M-7-204(1)">(1)</xref>, the commission may seek <ln numlevel="1" lineno="134" slineno="1-108"/>input and request assistance from groups with knowledge and expertise in criminal <ln numlevel="1" lineno="135" slineno="1-109"/>justice, including other boards and commissions affiliated or housed within the <ln numlevel="1" lineno="136" slineno="1-110"/>commission.</subsection></section></bsec><bsec buid="2" num="77-7-27" type="amend" src="code" uid="C77-7-S27_2026050620260506" sort="77 07 00270020260506" numlevel="1" lineno="137" slineno="2-1" sn="2"><section number="77-7-27" numlevel="1" lineno="138" slineno="2-2" type="amend"><secline lineno="137">Section 2. Section <bold>77-7-27</bold> is amended to read:</secline><catline lineno="138"><bold>77-7-27<parens/>. Quotas for arrest, citation prohibited.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="139" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="140" slineno="2-4" level="2" space="false"><display>(a)</display><subsection ssid="2-7" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">"Impermissible quota" means a requirement or minimum standard regarding the <ln numlevel="1" lineno="141" slineno="2-5"/>number or percentage of citations made by a law enforcement officer.</amend></subsection><subsection ssid="2-8" dnum="_-o:ii-i" numlevel="1" lineno="142" slineno="2-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">"Impermissible quota" does not include targeted overtime shifts for which a law <ln numlevel="1" lineno="143" slineno="2-7"/>enforcement agency receives grant money or other reimbursement.</amend></subsection></subsection><subsection ssid="2-6" dnum="_-o:b-i" numlevel="1" lineno="144" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>"Law enforcement agency" means an entity of the state, or a political subdivision of <ln numlevel="1" lineno="145" slineno="2-9"/>the state, that exists primarily to prevent and detect crime and enforce criminal laws, <ln numlevel="1" lineno="146" slineno="2-10"/>statutes, or ordinances.</subsection><subsection ssid="2-null-3" dnum="b-o:_-i" numlevel="1" lineno="147" slineno="2-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="23" groupid="17" style="2" owner="jchristopherson" level="1" deltag="end">"Law enforcement quota" means any requirement or minimum standard regarding <ln numlevel="1" lineno="148" slineno="2-12"/>the number or percentage of citations or arrests made by a law enforcement officer.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-null-4" dnum="2-o" numlevel="1" lineno="149" slineno="2-13" level="1"><display>(2)</display>A political subdivision or law enforcement agency employing a peace officer may not<amend anum="0" ea="amend" pairid="29" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="2-13" dnum="_-o:a-i" numlevel="1" lineno="150" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>require or direct that a peace officer meet <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">a law enforcement</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an impermissible</amend> quota<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="2-10" dnum="_-o:b-i" numlevel="1" lineno="151" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">evaluate, promote, compensate, reward, or discipline a peace officer on the basis of <ln numlevel="1" lineno="152" slineno="2-16"/>an impermissible quota; or</amend></subsection><subsection ssid="2-11" dnum="_-o:c-i" numlevel="1" lineno="153" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">transfer a peace officer's employment assignment on the basis of an impermissible <ln numlevel="1" lineno="154" slineno="2-18"/>quota.</amend></subsection></subsection><subsection ssid="2-null-5" dnum="3-o" numlevel="1" lineno="155" slineno="2-19" level="1"><display>(3)</display>Subsection <xref depth="4" refnumber="77-7-27(2)" start="0">(2)</xref> does not prohibit a political subdivision or law enforcement agency from <ln numlevel="1" lineno="156" slineno="2-20"/>including a peace officer's engagement with the community or enforcement activity<amend anum="0" ea="amend" pairid="54" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both">, <ln numlevel="1" lineno="157" slineno="2-21"/>including a metric based on the peace officer's interactions with members of the <ln numlevel="1" lineno="158" slineno="2-22"/>community,</amend> as part of an overall determination of the peace officer's performance.</subsection><subsection ssid="2-12" dnum="_-o:4-i" numlevel="1" lineno="159" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">A person may report an alleged violation of this section to the State Commission on <ln numlevel="1" lineno="160" slineno="2-24"/>Criminal and Juvenile Justice.</amend></subsection></section></bsec><bsec buid="3" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="161" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="161">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="162"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-2-26 3:46 PM</tm></rev></foot></leg>
