Section <bold>57-22-8</bold> is enacted to read:</secline><catline lineno="30"><bold>57-22-8<parens/>. Renter credit reporting.</bold></catline><subsection ssid="1-null-42" dnum="_-o:1-i" numlevel="1" lineno="31" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-null-43" dnum="_-o:a-i" numlevel="1" lineno="32" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">"Nationwide consumer reporting agency" means the same as the term "consumer <ln numlevel="1" lineno="33" slineno="1-5"/>reporting agency that compiles and maintains files on consumers on a nationwide <ln numlevel="1" lineno="34" slineno="1-6"/>basis" is defined in 15 U.S.C. Sec. 1681a(p).</amend></subsection><subsection ssid="1-null-44" dnum="_-o:b-i" numlevel="1" lineno="35" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">"Offer of rent reporting" means a written statement that states:</amend><subsection ssid="1-null-45" dnum="_-o:i-i" numlevel="1" lineno="36" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">the owner reporting the renter's rent payments is optional;</amend></subsection><subsection ssid="1-null-46" dnum="_-o:ii-i" numlevel="1" lineno="37" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">the nationwide consumer reporting agency to which the owner will report the <ln numlevel="1" lineno="38" slineno="1-10"/>renter's rent payments;</amend></subsection><subsection ssid="1-null-47" dnum="_-o:iii-i" numlevel="1" lineno="39" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">if the owner will charge the renter in accordance with Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref>, the dollar <ln numlevel="1" lineno="40" slineno="1-12"/>amount of the fee;</amend></subsection><subsection ssid="1-null-48" dnum="_-o:iv-i" numlevel="1" lineno="41" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">that a renter may enroll and unenroll in rent reporting at any time during the <ln numlevel="1" lineno="42" slineno="1-14"/>duration of the rental agreement;</amend></subsection><subsection ssid="1-null-49" dnum="_-o:v-i" numlevel="1" lineno="43" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">instructions on how the renter may enroll and unenroll in rent reporting; and </amend></subsection><subsection ssid="1-null-50" dnum="_-o:vi-i" numlevel="1" lineno="44" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">if the renter opts out of rent reporting or fails to pay the fee described in <ln numlevel="1" lineno="45" slineno="1-17"/>Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref>, that the renter may not reenroll in rent reporting for six months <ln numlevel="1" lineno="46" slineno="1-18"/>after the day on which the renter opts out or fails to pay the fee.</amend></subsection></subsection><subsection ssid="1-null-51" dnum="_-o:c-i" numlevel="1" lineno="47" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">"Rent reporting" means a service an owner offers in which a renter may enroll where <ln numlevel="1" lineno="48" slineno="1-20"/>an owner reports each rent payment that a renter makes to a nationwide consumer <ln numlevel="1" lineno="49" slineno="1-21"/>reporting agency, regardless of whether that rent payment complies with the terms of <ln numlevel="1" lineno="50" slineno="1-22"/>the rental agreement.</amend></subsection></subsection><subsection ssid="1-null-52" dnum="_-o:2-i" numlevel="1" lineno="51" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">On or after May 6, 2026, at the time an owner enters into a rental agreement with a <ln numlevel="1" lineno="52" slineno="1-24"/>renter, the owner may provide the renter an offer of rent reporting.</amend></subsection><subsection ssid="1-null-55" dnum="_-o:3-i" numlevel="1" lineno="53" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">An owner may charge a fee for reporting a renter's rent payment that may not exceed the <ln numlevel="1" lineno="54" slineno="1-26"/>owner's actual cost of reporting a renter's rent payment.</amend></subsection><subsection ssid="1-null-56" dnum="_-o:4-i" numlevel="1" lineno="55" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">If a renter fails to pay the fee described in Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref>:</amend><subsection ssid="1-null-57" dnum="_-o:a-i" numlevel="1" lineno="56" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">an owner:</amend><subsection ssid="1-null-58" dnum="_-o:i-i" numlevel="1" lineno="57" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">may stop reporting the renter's rent payments; and</amend></subsection><subsection ssid="1-null-59" dnum="_-o:ii-i" numlevel="1" lineno="58" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">may not:</amend><subsection ssid="1-null-60" dnum="_-o:A-i" numlevel="1" lineno="59" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">impose a fee for failing to pay the fee described in Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref>;</amend></subsection><subsection ssid="1-null-61" dnum="_-o:B-i" numlevel="1" lineno="60" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">treat the renter's failure to pay the fee described in Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref> as a <ln numlevel="1" lineno="61" slineno="1-33"/>violation of the rental agreement; or</amend></subsection><subsection ssid="1-null-62" dnum="_-o:C-i" numlevel="1" lineno="62" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">treat the renter's failure to pay the fee described in Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref> as grounds <ln numlevel="1" lineno="63" slineno="1-35"/>for evicting the renter.</amend></subsection></subsection></subsection><subsection ssid="1-null-63" dnum="_-o:b-i" numlevel="1" lineno="64" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">if the owner stops reporting the renter's rent payments in accordance with Subsection <xref depth="4" refnumber="57-22-8(4)(a)(i)"><ln numlevel="1" lineno="65" slineno="1-37"/>(4)(a)(i)</xref>, the renter may not reenroll in rent reporting for at least six months after the <ln numlevel="1" lineno="66" slineno="1-38"/>day on which the renter fails to pay the fee described in Subsection <xref depth="4" refnumber="57-22-8(3)">(3)</xref>.</amend></subsection></subsection><subsection ssid="1-null-64" dnum="_-o:5-i" numlevel="1" lineno="67" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="1-null-65" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">A renter may:</amend><subsection ssid="1-null-66" dnum="_-o:i-i" numlevel="1" lineno="68" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsections <xref depth="4" refnumber="57-22-8(4)(b)">(4)(b)</xref> and <xref depth="4" refnumber="57-22-8(5)(b)(i)">(5)(b)(i)</xref>, enroll and reenroll in rent reporting at <ln numlevel="1" lineno="69" slineno="1-41"/>any time during the duration of the rental agreement; and</amend></subsection><subsection ssid="1-null-67" dnum="_-o:ii-i" numlevel="1" lineno="70" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">unenroll in rent reporting at any time during the duration of the rental agreement <ln numlevel="1" lineno="71" slineno="1-43"/>by submitting a written statement to the owner that states the renter opts out of <ln numlevel="1" lineno="72" slineno="1-44"/>rent reporting.</amend></subsection></subsection><subsection ssid="1-null-68" dnum="_-o:b-i" numlevel="1" lineno="73" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="end">If a renter opts out of rent reporting in accordance with this Subsection <xref depth="4" refnumber="57-22-8(5)">(5)</xref>:</amend><subsection ssid="1-null-69" dnum="_-o:i-i" numlevel="1" lineno="74" slineno="1-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="127" style="1" owner="jchristopherson" level="1" amendtag="end">the renter may not reenroll in rent reporting for six months after the day on which <ln numlevel="1" lineno="75" slineno="1-47"/>the renter opts out; and</amend></subsection><subsection ssid="1-null-70" dnum="_-o:ii-i" numlevel="1" lineno="76" slineno="1-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">the owner may not report a rent payment the renter makes after the renter <ln numlevel="1" lineno="77" slineno="1-49"/>unenrolls from rent reporting unless the renter reenrolls in rent reporting.</amend></subsection></subsection></subsection><subsection ssid="1-null-71" dnum="_-o:6-i" numlevel="1" lineno="78" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="190" groupid="140" style="1" owner="jchristopherson" level="1" amendtag="end">The provisions of this section apply only to:</amend><subsection ssid="1-72" dnum="_-o:a-i" numlevel="1" lineno="79" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="197" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">an entity that is an owner that owns one or more residential rental units;
