Section <bold>53E-10-307</bold> is amended to read:</secline><catline lineno="26"><bold>53E-10-307<parens/>. Concurrent enrollment courses for accelerated foreign language <ln numlevel="1" lineno="27" slineno="1-3"/>students.</bold></catline><subsection ssid="4-null-57" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-null-58" dnum="a-o" numlevel="1" lineno="29" slineno="1-5" level="2"><display>(a)</display>"Accelerated foreign language student" means an eligible student who has passed a <ln numlevel="1" lineno="30" slineno="1-6"/>world language Advanced Placement exam.</subsection><subsection ssid="4-null-59" dnum="b-o" numlevel="1" lineno="31" slineno="1-7" level="2"><display>(b)</display>"Blended learning delivery model" means an education delivery model in which a <ln numlevel="1" lineno="32" slineno="1-8"/>student learns, at least in part:<subsection ssid="4-null-60" dnum="i-o" numlevel="1" lineno="33" slineno="1-9" level="3"><display>(i)</display>through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="249" groupid="203" style="2" owner="ahaskell" level="1" deltag="both">online learning with an element of student control over time, place, path, <ln numlevel="1" lineno="34" slineno="1-10"/>and pace</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="248" groupid="202" style="1" owner="ahaskell" level="1" amendtag="both" space="true">synchronous online learning</amend>; and</subsection><subsection ssid="4-null-61" dnum="ii-o" numlevel="1" lineno="35" slineno="1-11" level="3"><display>(ii)</display>in the physical presence of an instructor.</subsection></subsection><subsection ssid="4-105" dnum="_-o:c-i" numlevel="1" lineno="36" slineno="1-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="242" style="1" owner="ahaskell" level="1" amendtag="end">"Partner language" means the same as that term is defined in Section <xref depth="3" refnumber="53F-2-502">53F-2-502</xref>.</amend></subsection><subsection ssid="4-null-62" dnum="_-o:d-i" numlevel="1" lineno="37" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="ahaskell" level="1" amendtag="end">"Program" means the Utah Language Bridge Program, the foreign language <ln numlevel="1" lineno="38" slineno="1-14"/>concurrent enrollment program described in this section.</amend></subsection><subsection ssid="4-95" dnum="_-o:e-i" numlevel="1" lineno="39" slineno="1-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><subsection ssid="4-103" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="270" groupid="220" style="1" owner="ahaskell" level="1" amendtag="end">"Qualified instructor" means:</amend><subsection ssid="4-96" dnum="_-o:A-i" numlevel="1" lineno="40" slineno="1-16" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="274" groupid="223" style="1" owner="ahaskell" level="1" amendtag="end">a university instructor of record:</amend><subsection ssid="4-114" dnum="_-o:I-i" numlevel="1" lineno="41" slineno="1-17" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(I)</amend></display><amend anum="0" ea="amend" pairid="329" groupid="262" style="1" owner="ahaskell" level="1" amendtag="end">who holds a master's degree or higher or has at least 18 completed credit <ln numlevel="1" lineno="42" slineno="1-18"/>hours of graduate course work in an academic field related to the program;</amend></subsection><subsection ssid="4-98" dnum="_-o:II-i" numlevel="1" lineno="43" slineno="1-19" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(II)</amend></display><amend anum="0" ea="amend" pairid="280" groupid="227" style="1" owner="ahaskell" level="1" amendtag="end">who demonstrates language proficiency of advanced-high or higher on a <ln numlevel="1" lineno="44" slineno="1-20"/>verbal and written exam using a nationally recognized assessment that <ln numlevel="1" lineno="45" slineno="1-21"/>assesses an instructor's language proficiency or holds a bachelor's degree <ln numlevel="1" lineno="46" slineno="1-22"/>from a relevant country of origin of the target language; and</amend></subsection><subsection ssid="4-99" dnum="_-o:III-i" numlevel="1" lineno="47" slineno="1-23" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(III)</amend></display><amend anum="0" ea="amend" pairid="283" groupid="229" style="1" owner="ahaskell" level="1" amendtag="end">whom an institution hires according to the standards of the institution;</amend></subsection></subsection><subsection ssid="4-100" dnum="_-o:B-i" numlevel="1" lineno="48" slineno="1-24" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="286" groupid="231" style="1" owner="ahaskell" level="1" amendtag="end">an LEA employee teaching the course individually who:</amend><subsection ssid="4-112" dnum="_-o:I-i" numlevel="1" lineno="49" slineno="1-25" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(I)</amend></display><amend anum="0" ea="amend" pairid="322" groupid="257" style="1" owner="ahaskell" level="1" amendtag="end">holds a master's degree or higher, has at least 18 completed credit hours of <ln numlevel="1" lineno="50" slineno="1-26"/>graduate work in an academic field related to the program, or acquires <ln numlevel="1" lineno="51" slineno="1-27"/>exception for approval without a master's degree from the partnering <ln numlevel="1" lineno="52" slineno="1-28"/>institution and the LEA; and</amend></subsection><subsection ssid="4-102" dnum="_-o:II-i" numlevel="1" lineno="53" slineno="1-29" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(II)</amend></display><amend anum="0" ea="amend" pairid="292" groupid="235" style="1" owner="ahaskell" level="1" amendtag="end">demonstrates language proficiency of advanced-high or higher on a verbal <ln numlevel="1" lineno="54" slineno="1-30"/>and written exam from a nationally recognized assessment used that <ln numlevel="1" lineno="55" slineno="1-31"/>measures an instructor's language proficiency or holds a bachelor's degree <ln numlevel="1" lineno="56" slineno="1-32"/>from a relevant country of origin of the target language; or</amend></subsection></subsection><subsection ssid="4-106" dnum="_-o:C-i" numlevel="1" lineno="57" slineno="1-33" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="311" groupid="248" style="1" owner="ahaskell" level="1" amendtag="end">an LEA employee co-teaching with a Utah System of Higher Education <ln numlevel="1" lineno="58" slineno="1-34"/>faculty member who:</amend><subsection ssid="4-107" dnum="_-o:I-i" numlevel="1" lineno="59" slineno="1-35" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(I)</amend></display><amend anum="0" ea="amend" pairid="316" groupid="252" style="1" owner="ahaskell" level="1" amendtag="end">has qualifying experience, including demonstrated language proficiency of <ln numlevel="1" lineno="60" slineno="1-36"/>advanced-mid or higher on a verbal and written exam using nationally <ln numlevel="1" lineno="61" slineno="1-37"/>recognized standards to assess an instructor's language proficiency; or</amend></subsection><subsection ssid="4-109" dnum="_-o:II-i" numlevel="1" lineno="62" slineno="1-38" ea="amend" anum="0" owner="ahaskell" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(II)</amend></display><amend anum="0" ea="amend" pairid="321" groupid="256" style="1" owner="ahaskell" level="1" amendtag="end">holds a bachelor's degree from a relevant country of origin in the target <ln numlevel="1" lineno="63" slineno="1-39"/>language.</amend></subsection></subsection></subsection><subsection ssid="4-104" dnum="_-o:ii-i" numlevel="1" lineno="64" slineno="1-40" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="302" groupid="241" style="1" owner="ahaskell" level="1" amendtag="end">"Qualified instructor" does not include an instructor with qualifications based on <ln numlevel="1" lineno="65" slineno="1-41"/>years of experience alone.</amend></subsection></subsection><subsection ssid="4-null-63" dnum="_-o:f-i" numlevel="1" lineno="66" slineno="1-42" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">"Service area" means the geographic area, as board policy determines, where a state <ln numlevel="1" lineno="67" slineno="1-43"/>university has primary responsibility for providing educational programs and services.</amend></subsection><subsection ssid="4-null-64" dnum="c-o:g-i" numlevel="1" lineno="68" slineno="1-44" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"State university" means an institution of higher education that offers courses <ln numlevel="1" lineno="69" slineno="1-45"/>leading to a bachelor's degree.</subsection></subsection><subsection ssid="4-null-74" dnum="2-o" numlevel="1" lineno="70" slineno="1-46" level="1"><display>(2)</display>The University of Utah shall partner with all state universities to develop<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both"> and maintain</amend>, <ln numlevel="1" lineno="71" slineno="1-47"/>as part of the concurrent enrollment program described in this part, concurrent <ln numlevel="1" lineno="72" slineno="1-48"/>enrollment courses that:<subsection ssid="4-null-75" dnum="a-o" numlevel="1" lineno="73" slineno="1-49" level="2"><display>(a)</display>are age-appropriate foreign language courses for accelerated foreign language <ln numlevel="1" lineno="74" slineno="1-50"/>students<amend anum="0" ea="amend" pairid="19" groupid="16" style="1" owner="ahaskell" level="1" amendtag="both"> participating in the program</amend>;</subsection><subsection ssid="4-null-76" dnum="b-o" numlevel="1" lineno="75" slineno="1-51" level="2"><display>(b)</display>count toward a foreign language degree offered by an institution of higher education; <ln numlevel="1" lineno="76" slineno="1-52"/>and</subsection><subsection ssid="4-null-77" dnum="c-o" numlevel="1" lineno="77" slineno="1-53" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="177" groupid="141" style="2" owner="ahaskell" level="1" deltag="both">are delivered</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="175" groupid="139" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the university delivers</amend>:<subsection ssid="4-null-78" dnum="i-o" numlevel="1" lineno="78" slineno="1-54" level="3"><display>(i)</display>using <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="252" groupid="206" style="2" owner="ahaskell" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="251" groupid="205" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an in-person or</amend> blended learning delivery model; and</subsection><subsection ssid="4-null-79" dnum="ii-o" numlevel="1" lineno="79" slineno="1-55" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="245" groupid="199" style="2" owner="ahaskell" level="1" deltag="both">by an eligible</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="176" groupid="140" style="1" owner="ahaskell" level="1" amendtag="both" space="true">through a qualified</amend> instructor<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="246" groupid="200" style="2" owner="ahaskell" level="1" deltag="both"> described in Subsection <xref depth="4" refnumber="53E-10-302(6)(a)" start="0"><ln numlevel="1" lineno="80" slineno="1-56"/>53E-10-302(6)(a)</xref></amend><amendoutend style="2"/>.</subsection></subsection></subsection><subsection ssid="4-null-80" dnum="3-o" numlevel="1" lineno="81" slineno="1-57" level="1"><display>(3)</display>Subject to budget constraints, in addition to the base increases described in Section <xref depth="3" refnumber="53F-2-208" start="0"><ln numlevel="1" lineno="82" slineno="1-58"/>53F-2-208</xref>, the Legislature shall annually increase the money appropriated for <ln numlevel="1" lineno="83" slineno="1-59"/>concurrent enrollment courses for accelerated foreign language students<amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both"> participating in <ln numlevel="1" lineno="84" slineno="1-60"/>the program</amend> in proportion to the percentage increase over the previous school year in the <ln numlevel="1" lineno="85" slineno="1-61"/>value of the weighted pupil unit.</subsection><subsection ssid="4-null-81" dnum="_-o:4-i" numlevel="1" lineno="86" slineno="1-62" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="4-null-82" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="36" style="1" owner="ahaskell" level="1" amendtag="end">A state university that offers an upper-division course under the program shall <ln numlevel="1" lineno="87" slineno="1-63"/>ensure that a qualified instructor teaches or co-teaches the upper-division course.</amend></subsection><subsection ssid="4-null-83" dnum="_-o:b-i" numlevel="1" lineno="88" slineno="1-64" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">If a state university cannot provide a qualified instructor to an LEA in the state <ln numlevel="1" lineno="89" slineno="1-65"/>university's service area before April 1 of each year, in accordance with Subsection <xref refnumber="53E-10-307(4)(a)" depth="4"><ln numlevel="1" lineno="90" slineno="1-66"/>(4)(a)</xref>, an LEA shall:</amend><subsection ssid="4-null-84" dnum="_-o:i-i" numlevel="1" lineno="91" slineno="1-67" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="76" style="1" owner="ahaskell" level="1" amendtag="end">partner with a state institution from outside the service area that contains the LEA <ln numlevel="1" lineno="92" slineno="1-68"/>to provide an upper-division course under this program; and</amend></subsection><subsection ssid="4-null-85" dnum="_-o:ii-i" numlevel="1" lineno="93" slineno="1-69" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="81" style="1" owner="ahaskell" level="1" amendtag="end">enter into a contract with a state institution from outside the service area that <ln numlevel="1" lineno="94" slineno="1-70"/>contains the LEA, in accordance with Section <xref depth="3" refnumber="53E-10-303">53E-10-303</xref>, to provide the program <ln numlevel="1" lineno="95" slineno="1-71"/>at the LEA.</amend></subsection></subsection></subsection><subsection ssid="4-null-86" dnum="_-o:5-i" numlevel="1" lineno="96" slineno="1-72" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="193" groupid="156" style="1" owner="ahaskell" level="1" amendtag="end">A state university that offers an upper-division course under this section shall ensure the <ln numlevel="1" lineno="97" slineno="1-73"/>course counts toward a foreign language degree an institution of higher education offers.</amend></subsection><subsection ssid="4-87" dnum="_-o:6-i" numlevel="1" lineno="98" slineno="1-74" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="256" groupid="209" style="1" owner="ahaskell" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="99" slineno="1-75"/>state board shall make rules to extend the current proficiency assessment for dual <ln numlevel="1" lineno="100" slineno="1-76"/>immersion students to grades 3 through 12 for each partner language, in accordance with <ln numlevel="1" lineno="101" slineno="1-77"/>Section <xref depth="3" refnumber="53F-2-502">53F-2-502</xref>.</amend></subsection></section></bsec><bsec buid="7" num="53F-2-502" type="amend" src="code" uid="C53F-2-S502_2026070120260701" sort="53F02 05020020260701" numlevel="1" lineno="102" slineno="2-1" sn="2"><section number="53F-2-502" numlevel="1" lineno="103" slineno="2-2" type="amend"><secline lineno="102">Section 2. Section <bold>53F-2-502</bold> is amended to read:</secline><catline lineno="103"><bold>53F-2-502<parens/>. Dual language immersion.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="104" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="105" slineno="2-4" level="2"><display>(a)</display>"Dual language immersion" means an instructional setting in which a student <ln numlevel="1" lineno="106" slineno="2-5"/>receives a portion of instruction in English and a portion of instruction exclusively in <ln numlevel="1" lineno="107" slineno="2-6"/>a partner language.</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="108" slineno="2-7" level="2"><display>(b)</display>"Local education agency" or "LEA" means a school district or a charter school.</subsection><subsection ssid="7-null-4" dnum="c-o" numlevel="1" lineno="109" slineno="2-8" level="2"><display>(c)</display>"Participating LEA" means an LEA selected by the state board to receive a grant <ln numlevel="1" lineno="110" slineno="2-9"/>described in this section.</subsection><subsection ssid="7-null-5" dnum="d-o" numlevel="1" lineno="111" slineno="2-10" level="2"><display>(d)</display>"Partner language" means a language other than English in which instruction is <ln numlevel="1" lineno="112" slineno="2-11"/>provided in dual language immersion.</subsection><subsection ssid="7-null-6" dnum="e-o" numlevel="1" lineno="113" slineno="2-12" level="2"><display>(e)</display>"Restricted foreign entity" means the same as that term is defined in Section <xref depth="3" refnumber="53H-8-501"><ln numlevel="1" lineno="114" slineno="2-13"/>53H-8-501</xref>.</subsection></subsection><subsection ssid="7-null-7" dnum="2-o" numlevel="1" lineno="115" slineno="2-14" level="1"><display>(2)</display>The state board shall:<subsection ssid="7-null-8" dnum="a-o" numlevel="1" lineno="116" slineno="2-15" level="2"><display>(a)</display>establish a dual language immersion program;</subsection><subsection ssid="7-null-9" dnum="b-o" numlevel="1" lineno="117" slineno="2-16" level="2"><display>(b)</display>in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="118" slineno="2-17"/>make rules that establish:<subsection ssid="7-null-10" dnum="i-o" numlevel="1" lineno="119" slineno="2-18" level="3"><display>(i)</display>a grant program for an LEA to receive funding for dual language immersion;</subsection><subsection ssid="7-null-11" dnum="ii-o" numlevel="1" lineno="120" slineno="2-19" level="3"><display>(ii)</display>the required qualifications for an LEA to be a participating LEA;</subsection><subsection ssid="7-null-12" dnum="iii-o" numlevel="1" lineno="121" slineno="2-20" level="3"><display>(iii)</display>subject to this section, requirements of a participating LEA;</subsection><subsection ssid="7-null-13" dnum="iv-o" numlevel="1" lineno="122" slineno="2-21" level="3"><display>(iv)</display>a proficiency assessment for each partner language; and</subsection><subsection ssid="7-null-14" dnum="v-o" numlevel="1" lineno="123" slineno="2-22" level="3"><display>(v)</display>a progression of how a school in a participating LEA adds grade levels in which <ln numlevel="1" lineno="124" slineno="2-23"/>the school offers dual language immersion; and</subsection></subsection><subsection ssid="7-null-15" dnum="c-o" numlevel="1" lineno="125" slineno="2-24" level="2"><display>(c)</display>subject to legislative appropriations:<subsection ssid="7-null-16" dnum="i-o" numlevel="1" lineno="126" slineno="2-25" level="3"><display>(i)</display>select participating LEAs; and</subsection><subsection ssid="7-null-17" dnum="ii-o" numlevel="1" lineno="127" slineno="2-26" level="3"><display>(ii)</display>award to a participating LEA a grant to support dual language immersion in the <ln numlevel="1" lineno="128" slineno="2-27"/>LEA.</subsection></subsection></subsection><subsection ssid="7-null-18" dnum="3-o" numlevel="1" lineno="129" slineno="2-28" level="1"><display>(3)</display>A participating LEA shall:<subsection ssid="7-null-19" dnum="a-o" numlevel="1" lineno="130" slineno="2-29" level="2"><display>(a)</display>establish in a school a full-day dual language immersion instructional model that <ln numlevel="1" lineno="131" slineno="2-30"/>provides at least 50% of instruction exclusively in a partner language;</subsection><subsection ssid="7-null-20" dnum="b-o" numlevel="1" lineno="132" slineno="2-31" level="2"><display>(b)</display>in accordance with the state board rules described in Subsection <xref depth="4" refnumber="53F-2-502(2)(b)" start="0">(2)(b)</xref>, add grades in <ln numlevel="1" lineno="133" slineno="2-32"/>which dual language immersion is provided in a school; and</subsection><subsection ssid="7-null-21" dnum="c-o" numlevel="1" lineno="134" slineno="2-33" level="2"><display>(c)</display>annually administer to each student in grades 3 through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both">8</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true">12</amend> who participates in <ln numlevel="1" lineno="135" slineno="2-34"/>dual language immersion an assessment described in Subsection <xref depth="4" refnumber="53F-2-502(2)(b)(iv)" start="0">(2)(b)(iv)</xref>.</subsection></subsection><subsection ssid="7-null-22" dnum="4-o" numlevel="1" lineno="136" slineno="2-35" level="1"><display>(4)</display>The state board shall:<subsection ssid="7-null-23" dnum="a-o" numlevel="1" lineno="137" slineno="2-36" level="2"><display>(a)</display>provide support to a participating LEA, including by:<subsection ssid="7-null-24" dnum="i-o" numlevel="1" lineno="138" slineno="2-37" level="3"><display>(i)</display>offering professional learning for dual language immersion educators;</subsection><subsection ssid="7-null-25" dnum="ii-o" numlevel="1" lineno="139" slineno="2-38" level="3"><display>(ii)</display>developing curriculum related to dual language immersion; or</subsection><subsection ssid="7-null-26" dnum="iii-o" numlevel="1" lineno="140" slineno="2-39" level="3"><display>(iii)</display>providing instructional support for a partner language;</subsection></subsection><subsection ssid="7-null-27" dnum="b-o" numlevel="1" lineno="141" slineno="2-40" level="2"><display>(b)</display>conduct a program evaluation of the dual language immersion program established <ln numlevel="1" lineno="142" slineno="2-41"/>under Subsection <xref depth="4" refnumber="53F-2-502(2)(a)" start="0">(2)(a)</xref>; and</subsection><subsection ssid="7-null-28" dnum="c-o" numlevel="1" lineno="143" slineno="2-42" level="2"><display>(c)</display>on or before November 1, 2019, report to the Education Interim Committee and the <ln numlevel="1" lineno="144" slineno="2-43"/>Public Education Appropriations Subcommittee on the results of the program <ln numlevel="1" lineno="145" slineno="2-44"/>evaluation described in Subsection <xref depth="4" refnumber="53F-2-502(4)(b)" start="0">(4)(b)</xref>.</subsection></subsection><subsection ssid="7-null-29" dnum="5-o" numlevel="1" lineno="146" slineno="2-45" level="1"><display>(5)</display>The state board may, in accordance with <xref depth="1" refnumber="63G-6a" start="0">Title 63G, Chapter 6a, Utah Procurement Code</xref>, <ln numlevel="1" lineno="147" slineno="2-46"/>contract with a third party to conduct the program evaluation described in Subsection <xref depth="4" refnumber="53F-2-502(4)(b)" start="0"><ln numlevel="1" lineno="148" slineno="2-47"/>(4)(b)</xref>.</subsection><subsection ssid="7-null-30" dnum="6-o" numlevel="1" lineno="149" slineno="2-48" level="1"><display>(6)</display>Regardless of whether an LEA is a participating LEA or provides language instruction <ln numlevel="1" lineno="150" slineno="2-49"/>through another method, beginning July 1, 2024, an LEA may not seek or accept <ln numlevel="1" lineno="151" slineno="2-50"/>funding support from a restricted foreign entity or an entity that passes on funding <ln numlevel="1" lineno="152" slineno="2-51"/>support from a restricted foreign entity.</subsection><subsection ssid="7-null-31" dnum="7-o" numlevel="1" lineno="153" slineno="2-52" level="1"><display>(7)</display>Subject to budget constraints, in addition to the base increases described in Section <xref depth="3" refnumber="53F-2-208" start="0"><ln numlevel="1" lineno="154" slineno="2-53"/>53F-2-208</xref>, the Legislature shall annually increase the money appropriated for dual <ln numlevel="1" lineno="155" slineno="2-54"/>language immersion in proportion to the percentage increase over the previous school <ln numlevel="1" lineno="156" slineno="2-55"/>year in the value of the weighted pupil unit.</subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="157" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="157">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="158"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-26-26 9:36 AM</tm></rev></foot></leg>
