Section <bold>53F-2-526</bold> is amended to read:</secline><catline lineno="23"><bold>53F-2-526<parens/>. Excellence in Education and Leadership Supplement.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="24" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="25" slineno="1-4" level="2"><display>(a)</display>"Center" means the Center for the School of the Future at Utah State University <ln numlevel="1" lineno="26" slineno="1-5"/>established in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="400" groupid="341" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="53H-3-304">53H-3-304</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="399" groupid="340" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="3" refnumber="53H-4-304">53H-4-304</xref></amend>.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="27" slineno="1-6" level="2" space="false"><display>(b)</display><subsection ssid="1-200" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>"Eligible teacher" means a teacher who is a top-performing teacher that the <ln numlevel="1" lineno="28" slineno="1-7"/>center determines using an LEA's assessment methods, including:<subsection ssid="1-null-4" dnum="i-o:A-i" numlevel="1" lineno="29" slineno="1-8" level="4" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>student growth or achievement measures;</subsection><subsection ssid="1-null-5" dnum="ii-o:B-i" numlevel="1" lineno="30" slineno="1-9" level="4" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>professional evaluations;</subsection><subsection ssid="1-null-6" dnum="iii-o:C-i" numlevel="1" lineno="31" slineno="1-10" level="4" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>parent or student surveys; and</subsection><subsection ssid="1-null-7" dnum="iv-o:D-i" numlevel="1" lineno="32" slineno="1-11" level="4" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both" space="true">(D)</amend></display>other data-driven criteria the LEA establishes and the center verifies for <ln numlevel="1" lineno="33" slineno="1-12"/>validity.</subsection></subsection><subsection ssid="1-null-8" dnum="c-o:ii-i" numlevel="1" lineno="34" slineno="1-13" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>"Eligible teacher" includes an individual whom an LEA participating in the <ln numlevel="1" lineno="35" slineno="1-14"/>program employs and who holds:<subsection ssid="1-null-9" dnum="i-o:A-i" numlevel="1" lineno="36" slineno="1-15" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>a license the state board issues; and</subsection><subsection ssid="1-null-10" dnum="ii-o:B-i" numlevel="1" lineno="37" slineno="1-16" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>a position that includes a current classroom teaching assignment.</subsection></subsection></subsection><subsection ssid="1-null-11" dnum="d-o:c-i" numlevel="1" lineno="38" slineno="1-17" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"High poverty school" means the same as that term is defined in Section <xref depth="3" refnumber="53F-2-513"><ln numlevel="1" lineno="39" slineno="1-18"/>53F-2-513</xref>.</subsection><subsection ssid="1-null-12" dnum="e-o:d-i" numlevel="1" lineno="40" slineno="1-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"LEA" means:<subsection ssid="1-null-13" dnum="i-o" numlevel="1" lineno="41" slineno="1-20" level="3"><display>(i)</display>a school district;</subsection><subsection ssid="1-null-14" dnum="ii-o" numlevel="1" lineno="42" slineno="1-21" level="3"><display>(ii)</display>a charter school; </subsection><subsection ssid="1-null-15" dnum="iii-o" numlevel="1" lineno="43" slineno="1-22" level="3"><display>(iii)</display>the Utah Schools for the Deaf and the Blind; and</subsection><subsection ssid="1-null-16" dnum="iv-o" numlevel="1" lineno="44" slineno="1-23" level="3"><display>(iv)</display>a regional education service agency.</subsection></subsection><subsection ssid="1-null-17" dnum="f-o:e-i" numlevel="1" lineno="45" slineno="1-24" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Program" means the Excellence in Education and Leadership Supplement <ln numlevel="1" lineno="46" slineno="1-25"/>created in Subsection <xref depth="4" refnumber="53F-2-526(2)">(2)</xref>.</subsection><subsection ssid="1-149" dnum="_-o:f-i" numlevel="1" lineno="47" slineno="1-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="ahaskell" level="1" amendtag="end">"Self-nomination teacher" means a teacher who qualifies under Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>.</amend></subsection><subsection ssid="1-null-18" dnum="g-o" numlevel="1" lineno="48" slineno="1-27" level="2"><display>(g)</display>"Tier performance level" means the following levels of performance for a teacher in <ln numlevel="1" lineno="49" slineno="1-28"/>comparison to all teachers the center determines in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="10" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(8)">(7)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="50" slineno="1-29"/>(8)</amend>:<subsection ssid="1-null-19" dnum="i-o" numlevel="1" lineno="51" slineno="1-30" level="3"><display>(i)</display>the top 5% of  teachers;</subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="52" slineno="1-31" level="3"><display>(ii)</display>the next 6%-10% of teachers; and</subsection><subsection ssid="1-null-21" dnum="iii-o" numlevel="1" lineno="53" slineno="1-32" level="3"><display>(iii)</display>the next 11%-25% of teachers.</subsection></subsection><subsection ssid="1-null-22" dnum="h-o" numlevel="1" lineno="54" slineno="1-33" level="2"><display>(h)</display>"Top-performing" means the top 25% of teachers in comparison to all teachers the <ln numlevel="1" lineno="55" slineno="1-34"/>center determines using the methods described in Subsection <xref depth="4" refnumber="53F-2-526(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="1-151" dnum="_-o:i-i" numlevel="1" lineno="56" slineno="1-35" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="ahaskell" level="1" amendtag="end">"Value-added growth model" means the student growth model the center uses <ln numlevel="1" lineno="57" slineno="1-36"/>statewide under Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref> to calculate an individual teacher's contribution to <ln numlevel="1" lineno="58" slineno="1-37"/>student academic growth and determine comparative performance among teachers.</amend></subsection></subsection><subsection ssid="1-null-23" dnum="2-o" numlevel="1" lineno="59" slineno="1-38" level="1"><display>(2)</display>Beginning July 1, 2024, there is created a five-year pilot program known as the <ln numlevel="1" lineno="60" slineno="1-39"/>Excellence in Education and Leadership Supplement to provide a performance-based <ln numlevel="1" lineno="61" slineno="1-40"/>award to an eligible teacher<amend anum="0" ea="amend" pairid="300" groupid="258" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nominating teacher</amend> in recognition for outstanding <ln numlevel="1" lineno="62" slineno="1-41"/>instructional talent<amend anum="0" ea="amend" pairid="301" groupid="259" style="1" owner="ahaskell" level="1" amendtag="both"> which is evidenced by value added learning growth</amend>.</subsection><subsection ssid="1-null-24" dnum="3-o" numlevel="1" lineno="63" slineno="1-42" level="1" space="false"><display>(3)</display><subsection ssid="1-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>No later than December 31, 2024, an LEA shall declare the LEA's intent to <ln numlevel="1" lineno="64" slineno="1-43"/>participate in the program to the center.</subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="65" slineno="1-44" level="2"><display>(b)</display>If an LEA declares an intent to participate in the program, the LEA shall:<subsection ssid="1-null-27" dnum="i-o" numlevel="1" lineno="66" slineno="1-45" level="3"><display>(i)</display>develop a process for a school principal or the principal's designee to assess a <ln numlevel="1" lineno="67" slineno="1-46"/>teacher's performance consistent with this section to determine if a teacher is an <ln numlevel="1" lineno="68" slineno="1-47"/>eligible teacher, including the corresponding tier performance level; and</subsection><subsection ssid="1-null-28" dnum="ii-o" numlevel="1" lineno="69" slineno="1-48" level="3"><display>(ii)</display>create an appeals process for an employee who is not nominated to be an eligible <ln numlevel="1" lineno="70" slineno="1-49"/>teacher.</subsection></subsection></subsection><subsection ssid="1-null-29" dnum="4-o" numlevel="1" lineno="71" slineno="1-50" level="1"><display>(4)</display>No later than July 1, 2025, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="40" style="2" owner="ahaskell" level="1" deltag="both">an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">a participating</amend> LEA shall:<subsection ssid="1-null-30" dnum="a-o" numlevel="1" lineno="72" slineno="1-51" level="2"><display>(a)</display>attend a training that the center creates regarding the guidelines for developing a <ln numlevel="1" lineno="73" slineno="1-52"/>process described in Subsection <xref depth="4" refnumber="53F-2-526(3)">(3)</xref>; and</subsection><subsection ssid="1-null-31" dnum="b-o" numlevel="1" lineno="74" slineno="1-53" level="2"><display>(b)</display>develop and submit for approval the<amend anum="0" ea="amend" pairid="403" groupid="344" style="1" owner="ahaskell" level="1" amendtag="both"> participating</amend> LEA's process described in <ln numlevel="1" lineno="75" slineno="1-54"/>Subsection <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> to the center.</subsection></subsection><subsection ssid="1-null-32" dnum="5-o" numlevel="1" lineno="76" slineno="1-55" level="1" space="false"><display>(5)</display><subsection ssid="1-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The center shall review the <amend anum="0" ea="amend" pairid="35" groupid="30" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA's process described in Subsection <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> <ln numlevel="1" lineno="77" slineno="1-56"/>and approve the process or request that the LEA make changes to the submitted <ln numlevel="1" lineno="78" slineno="1-57"/>process.</subsection><subsection ssid="1-null-34" dnum="b-o" numlevel="1" lineno="79" slineno="1-58" level="2"><display>(b)</display>If the center requests changes to the <amend anum="0" ea="amend" pairid="36" groupid="31" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA's submitted process, the <amend anum="0" ea="amend" pairid="37" groupid="32" style="1" owner="ahaskell" level="1" amendtag="both"><ln numlevel="1" lineno="80" slineno="1-59"/>participating </amend>LEA shall work with the center to make necessary changes to receive <ln numlevel="1" lineno="81" slineno="1-60"/>final approval from the center.</subsection><subsection ssid="1-null-35" dnum="c-o" numlevel="1" lineno="82" slineno="1-61" level="2"><display>(c)</display>No later than August 15, 2025, the center shall provide final approval or denial of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="41" style="2" owner="ahaskell" level="1" deltag="both">an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="33" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="83" slineno="1-62"/>a participating</amend> LEA's process.</subsection></subsection><subsection ssid="1-null-36" dnum="6-o" numlevel="1" lineno="84" slineno="1-63" level="1"><display>(6)</display>Before August 31, 2025, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="42" style="2" owner="ahaskell" level="1" deltag="both">an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="34" style="1" owner="ahaskell" level="1" amendtag="both" space="true">a participating</amend> LEA with an approved process as described <ln numlevel="1" lineno="85" slineno="1-64"/>in Subsection <xref depth="4" refnumber="53F-2-526(5)">(5)</xref> shall:<subsection ssid="1-null-37" dnum="a-o" numlevel="1" lineno="86" slineno="1-65" level="2"><display>(a)</display>ensure each school principal or the principal's designee attends a training that the <ln numlevel="1" lineno="87" slineno="1-66"/>center creates regarding:<subsection ssid="1-null-38" dnum="i-o" numlevel="1" lineno="88" slineno="1-67" level="3"><display>(i)</display>how to effectively use the <amend anum="0" ea="amend" pairid="40" groupid="35" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA's approved process to select and <ln numlevel="1" lineno="89" slineno="1-68"/>submit to the center nominations for eligible teachers, including the corresponding <ln numlevel="1" lineno="90" slineno="1-69"/>tier performance level; and</subsection><subsection ssid="1-null-39" dnum="ii-o" numlevel="1" lineno="91" slineno="1-70" level="3"><display>(ii)</display>how to protect student and educator data privacy when submitting nominations <ln numlevel="1" lineno="92" slineno="1-71"/>and applications, as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="43" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(10)(b)(ii)">(9)(b)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="36" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(10)(b)(ii)</amend>;</subsection></subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="93" slineno="1-72" level="2"><display>(b)</display>provide information to teachers within the <amend anum="0" ea="amend" pairid="42" groupid="37" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA regarding the program <ln numlevel="1" lineno="94" slineno="1-73"/>and how the school's principal or principal's designee will use the approved <amend anum="0" ea="amend" pairid="43" groupid="38" style="1" owner="ahaskell" level="1" amendtag="both"><ln numlevel="1" lineno="95" slineno="1-74"/>participating </amend>LEA process to make nominations of eligible teachers; and</subsection><subsection ssid="1-null-41" dnum="c-o" numlevel="1" lineno="96" slineno="1-75" level="2"><display>(c)</display>ensure each school principal or the principal's designee is able to use the<amend anum="0" ea="amend" pairid="44" groupid="39" style="1" owner="ahaskell" level="1" amendtag="both"> participating</amend> <ln numlevel="1" lineno="97" slineno="1-76"/>LEA's approved process to evaluate and select which teachers within the school to <ln numlevel="1" lineno="98" slineno="1-77"/>nominate as eligible teachers, including the corresponding tier performance level.</subsection></subsection><subsection ssid="1-152" dnum="_-o:7-i" numlevel="1" lineno="99" slineno="1-78" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="1-154" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="46" style="1" owner="ahaskell" level="1" amendtag="end">An individual employed as a classroom teacher in an LEA that does not <ln numlevel="1" lineno="100" slineno="1-79"/>participate in the program under Subsection <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> may enter a self-nomination pathway <ln numlevel="1" lineno="101" slineno="1-80"/>to be considered for a performance-based award under this section if the teacher:</amend><subsection ssid="1-155" dnum="_-o:i-i" numlevel="1" lineno="102" slineno="1-81" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">teaches a subject and grade for which the state administers a statewide assessment <ln numlevel="1" lineno="103" slineno="1-82"/>measuring student academic growth or achievement;</amend></subsection><subsection ssid="1-156" dnum="_-o:ii-i" numlevel="1" lineno="104" slineno="1-83" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="50" style="1" owner="ahaskell" level="1" amendtag="end">receives a value-added growth model score the center calculates using statewide <ln numlevel="1" lineno="105" slineno="1-84"/>data within the top 40% of all statewide value-added growth model results for <ln numlevel="1" lineno="106" slineno="1-85"/>teachers not employed in a participating LEA, and in the teacher's taught and <ln numlevel="1" lineno="107" slineno="1-86"/>assessed subjects and grades; and</amend></subsection><subsection ssid="1-157" dnum="_-o:iii-i" numlevel="1" lineno="108" slineno="1-87" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="52" style="1" owner="ahaskell" level="1" amendtag="end">receives certification from the state board that the teacher's license is not the <ln numlevel="1" lineno="109" slineno="1-88"/>subject of a pending or active action before the Utah Professional Practices <ln numlevel="1" lineno="110" slineno="1-89"/>Advisory Commission.</amend></subsection></subsection><subsection ssid="1-158" dnum="_-o:b-i" numlevel="1" lineno="111" slineno="1-90" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="54" style="1" owner="ahaskell" level="1" amendtag="end">The center shall identify the top 40% of teachers from non-participating LEAs <ln numlevel="1" lineno="112" slineno="1-91"/>described in Subsection <xref depth="4" refnumber="53F-2-526(7)(a)">(7)(a)</xref> and issue an invitation through the state superintendent <ln numlevel="1" lineno="113" slineno="1-92"/>to those teachers to apply under the self-nomination pathway.</amend></subsection><subsection ssid="1-159" dnum="_-o:c-i" numlevel="1" lineno="114" slineno="1-93" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="56" style="1" owner="ahaskell" level="1" amendtag="end">A self-nomination teacher is not employed by a participating LEA and is not required <ln numlevel="1" lineno="115" slineno="1-94"/>to be nominated by an LEA under Subsection <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> and is not subject to the <ln numlevel="1" lineno="116" slineno="1-95"/>LEA-developed process described in Subsections <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> and <xref depth="4" refnumber="53F-2-526(4)">(4)</xref>.</amend></subsection></subsection><subsection ssid="1-null-42" dnum="7-o:8-i" numlevel="1" lineno="117" slineno="1-96" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" or self-nominating <ln numlevel="1" lineno="118" slineno="1-97"/>teacher</amend>, the center shall create an assessment process that:<subsection ssid="1-null-43" dnum="a-o:i-i" numlevel="1" lineno="119" slineno="1-98" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>uses the methods described in Subsection <xref depth="4" refnumber="53F-2-526(1)(b)">(1)(b)</xref>;</subsection><subsection ssid="1-null-44" dnum="b-o:ii-i" numlevel="1" lineno="120" slineno="1-99" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1054" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>calibrates<amend anum="0" ea="amend" pairid="81" groupid="65" style="1" owner="ahaskell" level="1" amendtag="both">:</amend> <subsection ssid="1-161" dnum="_-o:A-i" numlevel="1" lineno="121" slineno="1-100" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">for the eligible teacher pathway, </amend>the submissions an LEA submits to <ln numlevel="1" lineno="122" slineno="1-101"/>determine, for all nominated teachers statewide, which teachers are eligible <ln numlevel="1" lineno="123" slineno="1-102"/>teachers, including the corresponding tier performance level;<amend anum="0" ea="amend" pairid="89" groupid="72" style="1" owner="ahaskell" level="1" amendtag="both"> or</amend></subsection><subsection ssid="1-163" dnum="_-o:B-i" numlevel="1" lineno="124" slineno="1-103" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="74" style="1" owner="ahaskell" level="1" amendtag="end">for the self-nomination teacher pathway, the submissions of applications from <ln numlevel="1" lineno="125" slineno="1-104"/>all self-nomination teachers to determine, for all self-nomination teachers <ln numlevel="1" lineno="126" slineno="1-105"/>statewide, which teachers qualify for a performance-based award because the <ln numlevel="1" lineno="127" slineno="1-106"/>teacher falls within the top 25% statewide using the same assessment <ln numlevel="1" lineno="128" slineno="1-107"/>weighting and tier performance level methodology described in this Subsection <xref depth="4" refnumber="53F-2-526(8)"><ln numlevel="1" lineno="129" slineno="1-108"/>(8)</xref>;</amend></subsection></subsection><subsection ssid="1-null-45" dnum="c-o:iii-i" numlevel="1" lineno="130" slineno="1-109" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>may use additional criteria as determined by the center in consultation with <ln numlevel="1" lineno="131" slineno="1-110"/>participating LEAs;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="382" groupid="325" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-46" dnum="d-o:iv-i" numlevel="1" lineno="132" slineno="1-111" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1058" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>establishes a scoring rubric including the scores required for a designation in <ln numlevel="1" lineno="133" slineno="1-112"/>each tier performance level<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="104" groupid="84" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="101" groupid="81" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-165" dnum="_-o:v-i" numlevel="1" lineno="134" slineno="1-113" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="88" style="1" owner="ahaskell" level="1" amendtag="end">for purposes of a self-nomination teacher under Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>, applies the same <ln numlevel="1" lineno="135" slineno="1-114"/>weighting of value-added growth measures as used for eligible teachers and may <ln numlevel="1" lineno="136" slineno="1-115"/>not include any additional LEA-developed criteria or measures beyond those <ln numlevel="1" lineno="137" slineno="1-116"/>described in this section.</amend></subsection></subsection><subsection ssid="1-167" dnum="_-o:b-i" numlevel="1" lineno="138" slineno="1-117" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">For a self-nomination teacher, the center shall perform the functions otherwise <ln numlevel="1" lineno="139" slineno="1-118"/>carried out by a participating LEA under Subsections <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> through <xref depth="4" refnumber="53F-2-526(6)">(6)</xref>.</amend></subsection></subsection><subsection ssid="1-null-47" dnum="8-o:9-i" numlevel="1" lineno="140" slineno="1-119" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display><subsection ssid="1-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The center shall collaborate with <amend anum="0" ea="amend" pairid="126" groupid="102" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEAs to create:<subsection ssid="1-null-49" dnum="i-o" numlevel="1" lineno="141" slineno="1-120" level="3" tab="1"><display>(i)</display>selection and submission guidelines for:<subsection ssid="1-null-50" dnum="A-o" numlevel="1" lineno="142" slineno="1-121" level="4"><display>(A)</display>the approval of the <amend anum="0" ea="amend" pairid="127" groupid="103" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA's process as described in Subsection <xref depth="4" refnumber="53F-2-526(5)">(5)</xref>; <ln numlevel="1" lineno="143" slineno="1-122"/>and</subsection><subsection ssid="1-null-51" dnum="B-o" numlevel="1" lineno="144" slineno="1-123" level="4"><display>(B)</display>the list of nominated eligible teachers described in Subsection <xref depth="4" refnumber="53F-2-526(6)">(6)</xref>;</subsection></subsection><subsection ssid="1-null-52" dnum="ii-o" numlevel="1" lineno="145" slineno="1-124" level="3" tab="1"><display>(ii)</display>methods to determine student growth and achievement measures for subject areas <ln numlevel="1" lineno="146" slineno="1-125"/>that do not have standardized assessment data;</subsection><subsection ssid="1-null-53" dnum="iii-o" numlevel="1" lineno="147" slineno="1-126" level="3" tab="1"><display>(iii)</display>the weightings for each element of the assessment process described in <ln numlevel="1" lineno="148" slineno="1-127"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="134" groupid="110" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(8)">(7)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="128" groupid="104" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref refnumber="53F-2-526(8)" depth="4">(8)</xref></amend>; and</subsection><subsection ssid="1-null-54" dnum="iv-o" numlevel="1" lineno="149" slineno="1-128" level="3" tab="1"><display>(iv)</display>the trainings described in this section.</subsection></subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="150" slineno="1-129" level="2"><display>(b)</display>In addition to the requirements in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="135" groupid="111" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(9)(a)">(8)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="129" groupid="105" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(9)(a)</amend>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="136" groupid="112" style="2" owner="ahaskell" level="1" deltag="both">an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="130" groupid="106" style="1" owner="ahaskell" level="1" amendtag="both" space="true">a participating</amend> LEA <ln numlevel="1" lineno="151" slineno="1-130"/>may include the following if the <amend anum="0" ea="amend" pairid="131" groupid="107" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA collaborates with the center to do <ln numlevel="1" lineno="152" slineno="1-131"/>so:<subsection ssid="1-null-56" dnum="i-o" numlevel="1" lineno="153" slineno="1-132" level="3"><display>(i)</display>methods to determine student growth and achievement measures for subject areas <ln numlevel="1" lineno="154" slineno="1-133"/>that have standardized assessment data; and </subsection><subsection ssid="1-null-57" dnum="ii-o" numlevel="1" lineno="155" slineno="1-134" level="3"><display>(ii)</display>methods for combining measures described in Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="137" groupid="113" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(9)(a)(ii)">(8)(a)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="132" groupid="108" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(9)(a)(ii)</amend> <ln numlevel="1" lineno="156" slineno="1-135"/>and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="138" groupid="114" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(9)(b)(i)">(8)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="133" groupid="109" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(9)(b)(i)</amend> as appropriate to assure compatibility across all subject <ln numlevel="1" lineno="157" slineno="1-136"/>areas.</subsection></subsection><subsection ssid="1-null-58" dnum="c-o" numlevel="1" lineno="158" slineno="1-137" level="2"><display>(c)</display>The center may provide program related technical assistance to an LEA.</subsection><subsection ssid="1-168" dnum="_-o:d-i" numlevel="1" lineno="159" slineno="1-138" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="100" style="1" owner="ahaskell" level="1" amendtag="end">The center may:</amend><subsection ssid="1-169" dnum="_-o:i-i" numlevel="1" lineno="160" slineno="1-139" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">not incorporate LEA-developed additional measures when evaluating a <ln numlevel="1" lineno="161" slineno="1-140"/>self-nomination teacher; and</amend></subsection><subsection ssid="1-170" dnum="_-o:ii-i" numlevel="1" lineno="162" slineno="1-141" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="118" style="1" owner="ahaskell" level="1" amendtag="end">create standardized measures similar to those described in Subsection <xref depth="4" refnumber="53F-2-526(9)(b)">(9)(b)</xref> that <ln numlevel="1" lineno="163" slineno="1-142"/>apply to the cohort within the self-nomination teacher pathway.</amend></subsection></subsection></subsection><subsection ssid="1-null-59" dnum="9-o:10-i" numlevel="1" lineno="164" slineno="1-143" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1076" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display><subsection ssid="1-null-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="167" groupid="140" style="2" owner="ahaskell" level="1" deltag="both">An</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="158" groupid="131" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A participating</amend> LEA shall:<subsection ssid="1-null-61" dnum="i-o" numlevel="1" lineno="165" slineno="1-144" level="3" tab="1"><display>(i)</display>apply to the center on behalf of the nominated eligible teachers within the LEA <ln numlevel="1" lineno="166" slineno="1-145"/>through a process and format that the center determines; and</subsection><subsection ssid="1-null-62" dnum="ii-o" numlevel="1" lineno="167" slineno="1-146" level="3" tab="1"><display>(ii)</display>ensure a school principal or the principal's designee reevaluates an eligible <ln numlevel="1" lineno="168" slineno="1-147"/>teacher's designation under this section every three years.</subsection></subsection><subsection ssid="1-null-63" dnum="b-o" numlevel="1" lineno="169" slineno="1-148" level="2"><display>(b)</display>The center shall:<subsection ssid="1-null-64" dnum="i-o" numlevel="1" lineno="170" slineno="1-149" level="3"><display>(i)</display>create an application process for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="168" groupid="141" style="2" owner="ahaskell" level="1" deltag="both">an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="159" groupid="132" style="1" owner="ahaskell" level="1" amendtag="both" space="true">a participating</amend> LEA to submit the list of <ln numlevel="1" lineno="171" slineno="1-150"/>nominated eligible teachers described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="169" groupid="142" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(10)(a)">(9)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="160" groupid="133" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(10)(a)</amend>, including a <ln numlevel="1" lineno="172" slineno="1-151"/>deadline for submission of the list of nominated teachers to the center;</subsection><subsection ssid="1-null-65" dnum="ii-o" numlevel="1" lineno="173" slineno="1-152" level="3"><display>(ii)</display>coordinate with the state board in the creation of the application process described <ln numlevel="1" lineno="174" slineno="1-153"/>in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="170" groupid="143" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(10)(b)(i)">(9)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="161" groupid="134" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="53F-2-526(10)(b)(i)">(10)(b)(i)</xref></amend> to ensure that any sharing of student and <ln numlevel="1" lineno="175" slineno="1-154"/>educator data during the application process:<subsection ssid="1-null-66" dnum="A-o" numlevel="1" lineno="176" slineno="1-155" level="4"><display>(A)</display>complies with the Family Educational Rights and Privacy Act, 34 C.F.R. Part <ln numlevel="1" lineno="177" slineno="1-156"/>99;</subsection><subsection ssid="1-null-67" dnum="B-o" numlevel="1" lineno="178" slineno="1-157" level="4"><display>(B)</display>complies with Title <xref depth="1" refnumber="53E-9">53E, Chapter 9</xref>, Student Privacy and Data Protection; and</subsection><subsection ssid="1-null-68" dnum="C-o" numlevel="1" lineno="179" slineno="1-158" level="4"><display>(C)</display>uses disclosure avoidance techniques, including aggregating and otherwise <ln numlevel="1" lineno="180" slineno="1-159"/>de-identifying data;</subsection></subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="181" slineno="1-160" level="3"><display>(iii)</display>no later than <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="406" groupid="347" style="2" owner="ahaskell" level="1" deltag="both">October 1, 2026</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="405" groupid="346" style="1" owner="ahaskell" level="1" amendtag="both" space="true">December 1, 2026</amend>, determine if a nominated <ln numlevel="1" lineno="182" slineno="1-161"/>teacher is an eligible teacher through the process described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="171" groupid="144" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(8)">(7)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="162" groupid="135" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="53F-2-526(8)">(8)</xref></amend>;</subsection><subsection ssid="1-null-70" dnum="iv-o" numlevel="1" lineno="183" slineno="1-162" level="3"><display>(iv)</display>verify:<subsection ssid="1-null-71" dnum="A-o" numlevel="1" lineno="184" slineno="1-163" level="4"><display>(A)</display>the validity of the <amend anum="0" ea="amend" pairid="163" groupid="136" style="1" owner="ahaskell" level="1" amendtag="both">participating </amend>LEA's process and assessment of an eligible <ln numlevel="1" lineno="185" slineno="1-164"/>teacher as described in Subsections <xref depth="4" refnumber="53F-2-526(4)">(4)</xref> and <xref depth="4" refnumber="53F-2-526(5)">(5)</xref>; and</subsection><subsection ssid="1-null-72" dnum="B-o" numlevel="1" lineno="186" slineno="1-165" level="4"><display>(B)</display>the nominations described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="172" groupid="145" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(8)">(7)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="164" groupid="137" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(8)</amend> with the LEA and school <ln numlevel="1" lineno="187" slineno="1-166"/>administrators;</subsection></subsection><subsection ssid="1-null-73" dnum="v-o" numlevel="1" lineno="188" slineno="1-167" level="3"><display>(v)</display>certify a list of eligible teachers<amend anum="0" ea="amend" pairid="165" groupid="138" style="1" owner="ahaskell" level="1" amendtag="both"> and self-nomination teachers</amend>, including the total <ln numlevel="1" lineno="189" slineno="1-168"/>amount of funding the LEA receives for the LEA's eligible teachers<amend anum="0" ea="amend" pairid="166" groupid="139" style="1" owner="ahaskell" level="1" amendtag="both"> or <ln numlevel="1" lineno="190" slineno="1-169"/>self-nomination teachers</amend>; and</subsection><subsection ssid="1-null-74" dnum="vi-o" numlevel="1" lineno="191" slineno="1-170" level="3"><display>(vi)</display>provide the list described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="387" groupid="330" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(10)(b)(v)">(9)(b)(v)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="385" groupid="328" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(10)(b)(v)</amend> to the state board.</subsection></subsection><subsection ssid="1-171" dnum="_-o:c-i" numlevel="1" lineno="192" slineno="1-171" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="129" style="1" owner="ahaskell" level="1" amendtag="end">The center shall create a separate application process for a self-nomination teacher <ln numlevel="1" lineno="193" slineno="1-172"/>under Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>, which shall:</amend><subsection ssid="1-172" dnum="_-o:i-i" numlevel="1" lineno="194" slineno="1-173" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="174" groupid="147" style="1" owner="ahaskell" level="1" amendtag="end">allow an invited teacher described in Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref> to submit an application <ln numlevel="1" lineno="195" slineno="1-174"/>directly to the center;</amend></subsection><subsection ssid="1-173" dnum="_-o:ii-i" numlevel="1" lineno="196" slineno="1-175" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="149" style="1" owner="ahaskell" level="1" amendtag="end">require the license certification described in Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>; and</amend></subsection><subsection ssid="1-174" dnum="_-o:iii-i" numlevel="1" lineno="197" slineno="1-176" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="151" style="1" owner="ahaskell" level="1" amendtag="end">collect all data necessary for tier performance level determination under <ln numlevel="1" lineno="198" slineno="1-177"/>Subsection <xref depth="4" refnumber="53F-2-526(8)">(8)</xref>.</amend></subsection></subsection></subsection><subsection ssid="1-null-75" dnum="10-o:11-i" numlevel="1" lineno="199" slineno="1-178" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display><subsection ssid="1-null-76" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to legislative appropriations, the state board shall:<subsection ssid="1-null-77" dnum="i-o" numlevel="1" lineno="200" slineno="1-179" level="3" tab="1"><display>(i)</display>within 45 days of receiving the list described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="188" groupid="158" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(10)(b)(v)">(9)(b)(v)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="186" groupid="156" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(10)(b)(v)</amend> <ln numlevel="1" lineno="201" slineno="1-180"/>from the center, disburse funding to an LEA in the amount the center verifies that <ln numlevel="1" lineno="202" slineno="1-181"/>an LEA qualifies to receive for performance-based awards under this section;</subsection><subsection ssid="1-null-78" dnum="ii-o" numlevel="1" lineno="203" slineno="1-182" level="3" tab="1"><display>(ii)</display>allocate up to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="381" groupid="324" style="2" owner="ahaskell" level="1" deltag="both">4.25%</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="187" groupid="157" style="1" owner="ahaskell" level="1" amendtag="both" space="true">5.05%</amend> of the funds appropriated under this section to the <ln numlevel="1" lineno="204" slineno="1-183"/>center; and</subsection><subsection ssid="1-null-79" dnum="iii-o" numlevel="1" lineno="205" slineno="1-184" level="3" tab="1"><display>(iii)</display><amend anum="0" ea="amend" pairid="185" groupid="155" style="1" owner="ahaskell" level="1" amendtag="both">except as provided in Subsection <xref depth="4" refnumber="53F-2-526(11)(d)(ii)">(11)(d)(ii)</xref>, </amend>develop a method to compensate an <ln numlevel="1" lineno="206" slineno="1-185"/>LEA for program administration that:<subsection ssid="1-null-80" dnum="A-o" numlevel="1" lineno="207" slineno="1-186" level="4"><display>(A)</display>does not exceed 4% of the total funds appropriated under this section;</subsection><subsection ssid="1-null-81" dnum="B-o" numlevel="1" lineno="208" slineno="1-187" level="4"><display>(B)</display>first compensates an LEA for fixed efforts associated with development and <ln numlevel="1" lineno="209" slineno="1-188"/>management of the LEA's teacher performance-based award program; and</subsection><subsection ssid="1-null-82" dnum="C-o" numlevel="1" lineno="210" slineno="1-189" level="4"><display>(C)</display>allocates any remaining balance to compensate an LEA for variable efforts <ln numlevel="1" lineno="211" slineno="1-190"/>associated with ongoing program administration and management.</subsection></subsection></subsection><subsection ssid="1-null-83" dnum="b-o" numlevel="1" lineno="212" slineno="1-191" level="2"><display>(b)</display>The annual performance-based award for an eligible teacher<amend anum="0" ea="amend" pairid="202" groupid="170" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination <ln numlevel="1" lineno="213" slineno="1-192"/>teacher</amend> is:<subsection ssid="1-null-84" dnum="i-o" numlevel="1" lineno="214" slineno="1-193" level="3"><display>(i)</display>$10,000 for a teacher in the top 5% of teachers;</subsection><subsection ssid="1-null-85" dnum="ii-o" numlevel="1" lineno="215" slineno="1-194" level="3"><display>(ii)</display>$5,000 for a teacher in the next 6%-10% of teachers; and</subsection><subsection ssid="1-null-86" dnum="iii-o" numlevel="1" lineno="216" slineno="1-195" level="3"><display>(iii)</display>$2,000 for a teacher in the next 11%-25% of teachers.</subsection></subsection><subsection ssid="1-null-87" dnum="c-o" numlevel="1" lineno="217" slineno="1-196" level="2"><display>(c)</display>If the eligible teacher<amend anum="0" ea="amend" pairid="203" groupid="171" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination teacher</amend> is employed at a high poverty <ln numlevel="1" lineno="218" slineno="1-197"/>school, the eligible teacher <amend anum="0" ea="amend" pairid="204" groupid="172" style="1" owner="ahaskell" level="1" amendtag="both">or self-nomination teacher </amend>shall receive an additional <ln numlevel="1" lineno="219" slineno="1-198"/>performance-based award that is equal in amount to the eligible teacher's<amend anum="0" ea="amend" pairid="205" groupid="173" style="1" owner="ahaskell" level="1" amendtag="both"> or <ln numlevel="1" lineno="220" slineno="1-199"/>self-nomination teacher's</amend> performance-based award described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="207" groupid="175" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(11)(b)">(10)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="206" groupid="174" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="221" slineno="1-200"/>(11)(b)</amend>.</subsection><subsection ssid="1-175" dnum="_-o:d-i" numlevel="1" lineno="222" slineno="1-201" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><subsection ssid="1-177" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="178" style="1" owner="ahaskell" level="1" amendtag="end">Notwithstanding Subsections <xref depth="4" refnumber="53F-2-526(11)(a)">(11)(a)</xref>, (b), and (c), for a self-nomination teacher <ln numlevel="1" lineno="223" slineno="1-202"/>under Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>:</amend><subsection ssid="1-178" dnum="_-o:A-i" numlevel="1" lineno="224" slineno="1-203" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="215" groupid="180" style="1" owner="ahaskell" level="1" amendtag="end">the self-nomination teacher's employing LEA shall serve solely as fiscal agent <ln numlevel="1" lineno="225" slineno="1-204"/>for payment of the performance-based award;</amend></subsection><subsection ssid="1-179" dnum="_-o:B-i" numlevel="1" lineno="226" slineno="1-205" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="218" groupid="182" style="1" owner="ahaskell" level="1" amendtag="end">the employing LEA is not required to implement or maintain an LEA process <ln numlevel="1" lineno="227" slineno="1-206"/>under Subsection <xref depth="4" refnumber="53F-2-526(3)">(3)</xref> or <xref depth="4" refnumber="53F-2-526(4)">(4)</xref>;</amend></subsection><subsection ssid="1-180" dnum="_-o:C-i" numlevel="1" lineno="228" slineno="1-207" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="221" groupid="184" style="1" owner="ahaskell" level="1" amendtag="end">the center shall certify the self-nomination teacher's tier performance level <ln numlevel="1" lineno="229" slineno="1-208"/>directly to the state board; and</amend></subsection><subsection ssid="1-181" dnum="_-o:D-i" numlevel="1" lineno="230" slineno="1-209" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="186" style="1" owner="ahaskell" level="1" amendtag="end">the performance-based award shall match the award amounts of a <ln numlevel="1" lineno="231" slineno="1-210"/>participating LEA awardee and shall be disbursed in equal installments through <ln numlevel="1" lineno="232" slineno="1-211"/>the teacher's regularly occurring compensation and conclude by the end of the <ln numlevel="1" lineno="233" slineno="1-212"/>program.</amend></subsection></subsection><subsection ssid="1-182" dnum="_-o:ii-i" numlevel="1" lineno="234" slineno="1-213" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="227" groupid="188" style="1" owner="ahaskell" level="1" amendtag="end">A non-participating LEA acting as fiscal agent under this Subsection <xref depth="4" refnumber="53F-2-526(11)(d)">(11)(d)</xref> is <ln numlevel="1" lineno="235" slineno="1-214"/>not eligible for administrative compensation under Subsection <xref depth="4" refnumber="53F-2-526(11)(a)(iii)">(11)(a)(iii)</xref>.</amend></subsection></subsection></subsection><subsection ssid="1-null-88" dnum="11-o:12-i" numlevel="1" lineno="236" slineno="1-215" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1116" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display><subsection ssid="1-null-89" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA shall:<subsection ssid="1-null-90" dnum="i-o" numlevel="1" lineno="237" slineno="1-216" level="3" tab="1"><display>(i)</display>within 45 days of receiving the LEA's funds from the state board for all eligible <ln numlevel="1" lineno="238" slineno="1-217"/>teachers<amend anum="0" ea="amend" pairid="244" groupid="204" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination teachers</amend>, use the program funds to provide a <ln numlevel="1" lineno="239" slineno="1-218"/>performance-based award equal to the amount specified in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="257" groupid="217" style="2" owner="ahaskell" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="245" groupid="205" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(11)</amend> <ln numlevel="1" lineno="240" slineno="1-219"/>for each eligible teacher<amend anum="0" ea="amend" pairid="247" groupid="207" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination teacher</amend> in each tier performance level; <ln numlevel="1" lineno="241" slineno="1-220"/>and</subsection><subsection ssid="1-null-91" dnum="ii-o" numlevel="1" lineno="242" slineno="1-221" level="3" tab="1"><display>(ii)</display>provide the performance-based award in an eligible teacher's <amend anum="0" ea="amend" pairid="248" groupid="208" style="1" owner="ahaskell" level="1" amendtag="both">or self-nomination <ln numlevel="1" lineno="243" slineno="1-222"/>teacher's </amend>regularly occurring compensation in equal amounts through the <ln numlevel="1" lineno="244" slineno="1-223"/>contracted school years related to the performance-based award.</subsection></subsection><subsection ssid="1-null-92" dnum="b-o" numlevel="1" lineno="245" slineno="1-224" level="2"><display>(b)</display>An LEA:<subsection ssid="1-null-93" dnum="i-o" numlevel="1" lineno="246" slineno="1-225" level="3"><display>(i)</display>may use money appropriated to the LEA for the performance-based award for <ln numlevel="1" lineno="247" slineno="1-226"/>employer-paid benefits;</subsection><subsection ssid="1-null-94" dnum="ii-o" numlevel="1" lineno="248" slineno="1-227" level="3"><display>(ii)</display>may not include a performance-based award received under this section:<subsection ssid="1-null-95" dnum="A-o" numlevel="1" lineno="249" slineno="1-228" level="4"><display>(A)</display>in a retirement calculation; or</subsection><subsection ssid="1-null-96" dnum="B-o" numlevel="1" lineno="250" slineno="1-229" level="4"><display>(B)</display>as part of retirement contributions; and</subsection></subsection><subsection ssid="1-null-97" dnum="iii-o" numlevel="1" lineno="251" slineno="1-230" level="3"><display>(iii)</display>may not reduce an eligible teacher's <amend anum="0" ea="amend" pairid="249" groupid="209" style="1" owner="ahaskell" level="1" amendtag="both">or self-nomination teacher's </amend>award to ensure <ln numlevel="1" lineno="252" slineno="1-231"/>the LEA maintains the funds described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="258" groupid="218" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(11)(a)(iii)">(10)(a)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="250" groupid="210" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref refnumber="53F-2-526(11)(a)(iii)" depth="4">(11)(a)(iii)</xref></amend>.</subsection></subsection><subsection ssid="1-null-98" dnum="c-o" numlevel="1" lineno="253" slineno="1-232" level="2"><display>(c)</display>The performance-based award is not part of an eligible teacher's <amend anum="0" ea="amend" pairid="251" groupid="211" style="1" owner="ahaskell" level="1" amendtag="both">or self-nomination <ln numlevel="1" lineno="254" slineno="1-233"/>teacher's </amend>base pay, and is subject to the eligible teacher's <amend anum="0" ea="amend" pairid="392" groupid="335" style="1" owner="ahaskell" level="1" amendtag="both">or self-nomination teacher's </amend><ln numlevel="1" lineno="255" slineno="1-234"/>designation as an eligible teacher<amend anum="0" ea="amend" pairid="253" groupid="213" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination teacher</amend>.</subsection></subsection><subsection ssid="1-null-99" dnum="12-o:13-i" numlevel="1" lineno="256" slineno="1-235" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1127" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>Except as provided for in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="259" groupid="219" style="2" owner="ahaskell" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="254" groupid="214" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(12)</amend>, if the appropriation for the <ln numlevel="1" lineno="257" slineno="1-236"/>program is insufficient to cover the costs associated with performance-based awards, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="309" groupid="266" style="2" owner="ahaskell" level="1" deltag="both">an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="307" groupid="264" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="258" slineno="1-237"/>a participating</amend> LEA may distribute the funds to each eligible teacher of the same tier of <ln numlevel="1" lineno="259" slineno="1-238"/>performance level on a pro rata basis.</subsection><subsection ssid="1-null-100" dnum="13-o:14-i" numlevel="1" lineno="260" slineno="1-239" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1128" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display><subsection ssid="1-null-101" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-102" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>In accordance with state and federal privacy laws, the state board <ln numlevel="1" lineno="261" slineno="1-240"/>shall provide the following data to the center:<subsection ssid="1-null-103" dnum="A-o" numlevel="1" lineno="262" slineno="1-241" level="4" tab="2"><display>(A)</display>relevant student achievement data;</subsection><subsection ssid="1-null-104" dnum="B-o" numlevel="1" lineno="263" slineno="1-242" level="4" tab="2"><display>(B)</display>relevant teacher data; and</subsection><subsection ssid="1-null-105" dnum="C-o" numlevel="1" lineno="264" slineno="1-243" level="4" tab="2"><display>(C)</display>any other relevant data as the center determines.</subsection></subsection><subsection ssid="1-null-106" dnum="ii-o" numlevel="1" lineno="265" slineno="1-244" level="3" tab="1"><display>(ii)</display>If the center needs data from a non-participating LEA for purposes of the <ln numlevel="1" lineno="266" slineno="1-245"/>program, the state board:<subsection ssid="1-null-107" dnum="A-o" numlevel="1" lineno="267" slineno="1-246" level="4"><display>(A)</display>shall provide the data; and</subsection><subsection ssid="1-null-108" dnum="B-o" numlevel="1" lineno="268" slineno="1-247" level="4"><display>(B)</display><amend anum="0" ea="amend" pairid="243" groupid="203" style="1" owner="ahaskell" level="1" amendtag="both">except as provided in Subsection <xref depth="4" refnumber="53F-2-526(14)(b)">(14)(b)</xref>, </amend>may provide the data in a <ln numlevel="1" lineno="269" slineno="1-248"/>de-identified manner, including providing an individual teacher's or student's <ln numlevel="1" lineno="270" slineno="1-249"/>data with a unique identifier that is not associated with the teacher's or student's <ln numlevel="1" lineno="271" slineno="1-250"/>name or school provided identification number. </subsection></subsection></subsection><subsection ssid="1-183" dnum="_-o:b-i" numlevel="1" lineno="272" slineno="1-251" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="260" groupid="220" style="1" owner="ahaskell" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="53F-2-526(14)(a)(ii)">(14)(a)(ii)</xref>, the state board shall provide reasonable <ln numlevel="1" lineno="273" slineno="1-252"/>additional data to the center if current data the center receives is incomplete or <ln numlevel="1" lineno="274" slineno="1-253"/>insufficient for purposes of identifying and inviting teachers under Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>.</amend></subsection><subsection ssid="1-null-109" dnum="b-o:c-i" numlevel="1" lineno="275" slineno="1-254" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1138" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>The state board shall:<subsection ssid="1-null-110" dnum="i-o" numlevel="1" lineno="276" slineno="1-255" level="3"><display>(i)</display>consult with the center; and </subsection><subsection ssid="1-null-111" dnum="ii-o" numlevel="1" lineno="277" slineno="1-256" level="3"><display>(ii)</display>contract with a third party to obtain and house a secure web-based portal for <ln numlevel="1" lineno="278" slineno="1-257"/>authorized LEA and state board users to:<subsection ssid="1-null-112" dnum="A-o" numlevel="1" lineno="279" slineno="1-258" level="4"><display>(A)</display>allow a teacher to track the teacher's students' academic achievement and <ln numlevel="1" lineno="280" slineno="1-259"/>growth and assess within the teacher's LEA the teacher's individual progress <ln numlevel="1" lineno="281" slineno="1-260"/>toward becoming an eligible teacher nominee;</subsection><subsection ssid="1-null-113" dnum="B-o" numlevel="1" lineno="282" slineno="1-261" level="4"><display>(B)</display>report results of the chosen model or models at the district, school, and subject <ln numlevel="1" lineno="283" slineno="1-262"/>or grade levels;</subsection><subsection ssid="1-null-114" dnum="C-o" numlevel="1" lineno="284" slineno="1-263" level="4"><display>(C)</display>provide diagnostic data showing the growth and achievement trends for <ln numlevel="1" lineno="285" slineno="1-264"/>different groups of students associated with a teacher, school, charter system, <ln numlevel="1" lineno="286" slineno="1-265"/>or district; and</subsection><subsection ssid="1-null-115" dnum="D-o" numlevel="1" lineno="287" slineno="1-266" level="4"><display>(D)</display>provide resources for teachers to interpret the model results, training modules, <ln numlevel="1" lineno="288" slineno="1-267"/>and receive or request technical support.</subsection></subsection></subsection><subsection ssid="1-null-116" dnum="c-o:d-i" numlevel="1" lineno="289" slineno="1-268" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1145" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>The state board shall use up to 2.5% of the total funds appropriated under this <ln numlevel="1" lineno="290" slineno="1-269"/>section for the web-based access portal described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="390" groupid="333" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(14)(c)">(13)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="389" groupid="332" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(14)(c)</amend>.</subsection></subsection><subsection ssid="1-null-117" dnum="14-o:15-i" numlevel="1" lineno="291" slineno="1-270" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1146" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display><subsection ssid="1-null-118" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An eligible teacher<amend anum="0" ea="amend" pairid="272" groupid="231" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination teacher</amend> that receives a <ln numlevel="1" lineno="292" slineno="1-271"/>performance-based award under the program has no vested property right in the <ln numlevel="1" lineno="293" slineno="1-272"/>performance-based award or the designation as an eligible teacher<amend anum="0" ea="amend" pairid="273" groupid="232" style="1" owner="ahaskell" level="1" amendtag="both"> or self-nomination <ln numlevel="1" lineno="294" slineno="1-273"/>teacher</amend>.</subsection><subsection ssid="1-null-119" dnum="b-o" numlevel="1" lineno="295" slineno="1-274" level="2"><display>(b)</display>An eligible teacher's <amend anum="0" ea="amend" pairid="274" groupid="233" style="1" owner="ahaskell" level="1" amendtag="both">or self-nomination teacher's </amend>performance-based award and <ln numlevel="1" lineno="296" slineno="1-275"/>designation under this section are void if the school principal or principal's designee, <ln numlevel="1" lineno="297" slineno="1-276"/>LEA, or the center made or certified the designation improperly.</subsection></subsection><subsection ssid="1-null-120" dnum="15-o:16-i" numlevel="1" lineno="298" slineno="1-277" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1149" style="2" owner="o" level="1" deltag="both">(15)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display><subsection ssid="1-null-121" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to prioritization of the <amend anum="0" ea="amend" pairid="386" groupid="329" style="1" owner="ahaskell" level="1" amendtag="both">Legislative </amend>Audit Subcommittee, unless the <ln numlevel="1" lineno="299" slineno="1-278"/>state board contracts a private auditor in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="280" groupid="239" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(16)(b)">(15)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="275" groupid="234" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(16)(b)</amend>, <ln numlevel="1" lineno="300" slineno="1-279"/>the Office of the Legislative Auditor General established under Section <xref depth="3" refnumber="36-12-15">36-12-15</xref> <ln numlevel="1" lineno="301" slineno="1-280"/>shall, in any fiscal year:<subsection ssid="1-null-122" dnum="i-o" numlevel="1" lineno="302" slineno="1-281" level="3" tab="1"><display>(i)</display>conduct an audit of the program including:<subsection ssid="1-null-123" dnum="A-o" numlevel="1" lineno="303" slineno="1-282" level="4"><display>(A)</display>an evaluation of the implementation of the program; and</subsection><subsection ssid="1-null-124" dnum="B-o" numlevel="1" lineno="304" slineno="1-283" level="4"><display>(B)</display>the efficacy of the program, including program outcomes; and</subsection></subsection><subsection ssid="1-null-125" dnum="ii-o" numlevel="1" lineno="305" slineno="1-284" level="3" tab="1"><display>(ii)</display>prepare and submit a written report for an audit described in this section in <ln numlevel="1" lineno="306" slineno="1-285"/>accordance with Subsection <xref depth="4" refnumber="36-12-15(6)(b)">36-12-15(6)(b)</xref>.</subsection></subsection><subsection ssid="1-null-126" dnum="b-o" numlevel="1" lineno="307" slineno="1-286" level="2"><display>(b)</display>Subject to legislative appropriations, the state board may contract with an external <ln numlevel="1" lineno="308" slineno="1-287"/>auditor to perform the audit described in this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="281" groupid="240" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(16)">(15)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="276" groupid="235" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(16)</amend>.</subsection></subsection><subsection ssid="1-null-127" dnum="16-o:17-i" numlevel="1" lineno="309" slineno="1-288" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1156" style="2" owner="o" level="1" deltag="both">(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display><subsection ssid="1-null-128" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The center shall report to the Education Interim Committee no later than <ln numlevel="1" lineno="310" slineno="1-289"/>the 2024 October meeting the following:<subsection ssid="1-null-129" dnum="i-o" numlevel="1" lineno="311" slineno="1-290" level="3" tab="1"><display>(i)</display>the methodology and process the center develops to achieve the requirements of <ln numlevel="1" lineno="312" slineno="1-291"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="282" groupid="241" style="2" owner="ahaskell" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="277" groupid="236" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(8)</amend>;</subsection><subsection ssid="1-null-130" dnum="ii-o" numlevel="1" lineno="313" slineno="1-292" level="3" tab="1"><display>(ii)</display>relevant data and updates resulting from the collaborations described in <ln numlevel="1" lineno="314" slineno="1-293"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="283" groupid="242" style="2" owner="ahaskell" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="278" groupid="237" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(9)</amend>;</subsection><subsection ssid="1-null-131" dnum="iii-o" numlevel="1" lineno="315" slineno="1-294" level="3" tab="1"><display>(iii)</display>any recommendations for future legislation; and</subsection><subsection ssid="1-null-132" dnum="iv-o" numlevel="1" lineno="316" slineno="1-295" level="3" tab="1"><display>(iv)</display>data regarding performance-based award programs, including:<subsection ssid="1-null-133" dnum="A-o" numlevel="1" lineno="317" slineno="1-296" level="4"><display>(A)</display>different approaches used to reward teacher performance, including different <ln numlevel="1" lineno="318" slineno="1-297"/>evaluation methods;</subsection><subsection ssid="1-null-134" dnum="B-o" numlevel="1" lineno="319" slineno="1-298" level="4"><display>(B)</display>research outlining the effectiveness and impact of different performance-based <ln numlevel="1" lineno="320" slineno="1-299"/>award amounts on teacher retention; and</subsection><subsection ssid="1-null-135" dnum="C-o" numlevel="1" lineno="321" slineno="1-300" level="4"><display>(C)</display>other considerations for impactful performance-based award programs in <ln numlevel="1" lineno="322" slineno="1-301"/>relation to teacher retention.</subsection></subsection></subsection><subsection ssid="1-null-136" dnum="b-o" numlevel="1" lineno="323" slineno="1-302" level="2"><display>(b)</display>Beginning <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="310" groupid="267" style="2" owner="ahaskell" level="1" deltag="both">November</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="308" groupid="265" style="1" owner="ahaskell" level="1" amendtag="both" space="true">December</amend> 1, 2026, the center shall provide an annual report <ln numlevel="1" lineno="324" slineno="1-303"/>to the Education Interim Committee regarding:<subsection ssid="1-null-137" dnum="i-o" numlevel="1" lineno="325" slineno="1-304" level="3"><display>(i)</display>the statewide metrics used in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="284" groupid="243" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="53F-2-526(8)">(7)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="279" groupid="238" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(8)</amend>;</subsection><subsection ssid="1-null-138" dnum="ii-o" numlevel="1" lineno="326" slineno="1-305" level="3"><display>(ii)</display>de-identified and aggregated data showing the number of:<subsection ssid="1-null-139" dnum="A-o" numlevel="1" lineno="327" slineno="1-306" level="4"><display>(A)</display>performance-based awards per school, including total number of eligible <ln numlevel="1" lineno="328" slineno="1-307"/>teachers <amend anum="0" ea="amend" pairid="271" groupid="230" style="1" owner="ahaskell" level="1" amendtag="both">and self-nomination teachers </amend>in each school;</subsection><subsection ssid="1-null-140" dnum="B-o" numlevel="1" lineno="329" slineno="1-308" level="4"><display>(B)</display>eligible teachers<amend anum="0" ea="amend" pairid="290" groupid="248" style="1" owner="ahaskell" level="1" amendtag="both"> and self-nomination teachers</amend> in high poverty schools;</subsection><subsection ssid="1-null-141" dnum="C-o" numlevel="1" lineno="330" slineno="1-309" level="4"><display>(C)</display>eligible teachers<amend anum="0" ea="amend" pairid="291" groupid="249" style="1" owner="ahaskell" level="1" amendtag="both"> and self-nomination teachers</amend> in each tier performance level;</subsection><subsection ssid="1-null-142" dnum="D-o" numlevel="1" lineno="331" slineno="1-310" level="4"><display>(D)</display>eligible teachers<amend anum="0" ea="amend" pairid="293" groupid="251" style="1" owner="ahaskell" level="1" amendtag="both"> and self-nomination teachers</amend> in subject areas that do not have <ln numlevel="1" lineno="332" slineno="1-311"/>standardized assessments; and</subsection><subsection ssid="1-null-143" dnum="E-o" numlevel="1" lineno="333" slineno="1-312" level="4"><display>(E)</display>performance-based award denials per school, including the reasons for a <ln numlevel="1" lineno="334" slineno="1-313"/>denial;</subsection></subsection><subsection ssid="1-null-144" dnum="iii-o" numlevel="1" lineno="335" slineno="1-314" level="3"><display>(iii)</display>proportion of eligible teachers<amend anum="0" ea="amend" pairid="295" groupid="253" style="1" owner="ahaskell" level="1" amendtag="both"> and self-nomination teachers</amend> in:<subsection ssid="1-null-145" dnum="A-o" numlevel="1" lineno="336" slineno="1-315" level="4"><display>(A)</display>school districts; and</subsection><subsection ssid="1-null-146" dnum="B-o" numlevel="1" lineno="337" slineno="1-316" level="4"><display>(B)</display>charter schools; and</subsection></subsection><subsection ssid="1-null-147" dnum="iv-o" numlevel="1" lineno="338" slineno="1-317" level="3"><display>(iv)</display>teacher retention data for a school where an eligible teacher<amend anum="0" ea="amend" pairid="297" groupid="255" style="1" owner="ahaskell" level="1" amendtag="both"> and self-nomination <ln numlevel="1" lineno="339" slineno="1-318"/>teacher</amend> is employed.</subsection></subsection></subsection><subsection ssid="1-184" dnum="_-o:18-i" numlevel="1" lineno="340" slineno="1-319" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="start">(18)</amend></display><amend anum="0" ea="amend" pairid="304" groupid="262" style="1" owner="ahaskell" level="1" amendtag="end">Notwithstanding any deadlines described in this section, for the self-nomination <ln numlevel="1" lineno="341" slineno="1-320"/>teacher pathway described in Subsection <xref depth="4" refnumber="53F-2-526(7)">(7)</xref>, the following deadlines apply:</amend><subsection ssid="1-185" dnum="_-o:a-i" numlevel="1" lineno="342" slineno="1-321" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="315" groupid="271" style="1" owner="ahaskell" level="1" amendtag="end">no later than December 1, 2026, the center shall provide to the state superintendent:</amend><subsection ssid="1-186" dnum="_-o:i-i" numlevel="1" lineno="343" slineno="1-322" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="275" style="1" owner="ahaskell" level="1" amendtag="end">the email addresses for invited applicants to the self-nomination program; and</amend></subsection><subsection ssid="1-187" dnum="_-o:ii-i" numlevel="1" lineno="344" slineno="1-323" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="325" groupid="279" style="1" owner="ahaskell" level="1" amendtag="end">any state board system specific identifier numbers for the invited applicants;</amend></subsection></subsection><subsection ssid="1-188" dnum="_-o:b-i" numlevel="1" lineno="345" slineno="1-324" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="330" groupid="283" style="1" owner="ahaskell" level="1" amendtag="end">no later than December 15, 2026, the state superintendent shall:</amend><subsection ssid="1-190" dnum="_-o:i-i" numlevel="1" lineno="346" slineno="1-325" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="335" groupid="287" style="1" owner="ahaskell" level="1" amendtag="end">ensure that all invited applicants have received an email invitation; and</amend></subsection><subsection ssid="1-191" dnum="_-o:ii-i" numlevel="1" lineno="347" slineno="1-326" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="340" groupid="291" style="1" owner="ahaskell" level="1" amendtag="end">report to the center any email delivery failures;</amend></subsection></subsection><subsection ssid="1-192" dnum="_-o:c-i" numlevel="1" lineno="348" slineno="1-327" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="345" groupid="295" style="1" owner="ahaskell" level="1" amendtag="end">no later than February 15, 2027, an invited self-nomination teacher shall indicate in <ln numlevel="1" lineno="349" slineno="1-328"/>the center's system the teacher's intent to submit a self-nomination application;</amend></subsection><subsection ssid="1-193" dnum="_-o:d-i" numlevel="1" lineno="350" slineno="1-329" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="350" groupid="299" style="1" owner="ahaskell" level="1" amendtag="end">no later than April 15, 2027, a self-nomination teacher shall complete and submit the <ln numlevel="1" lineno="351" slineno="1-330"/>teacher's self-nomination application to the center;</amend></subsection><subsection ssid="1-194" dnum="_-o:e-i" numlevel="1" lineno="352" slineno="1-331" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="355" groupid="303" style="1" owner="ahaskell" level="1" amendtag="end">no later than May 15, 2027, the center shall notify:</amend><subsection ssid="1-195" dnum="_-o:i-i" numlevel="1" lineno="353" slineno="1-332" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="360" groupid="307" style="1" owner="ahaskell" level="1" amendtag="end">each recognized self-nomination teacher of the teacher's tier performance level <ln numlevel="1" lineno="354" slineno="1-333"/>and the amount of the performance-based award;</amend></subsection><subsection ssid="1-196" dnum="_-o:ii-i" numlevel="1" lineno="355" slineno="1-334" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="311" style="1" owner="ahaskell" level="1" amendtag="end">each recognized self-nomination teacher's employing LEA of the teacher's tier <ln numlevel="1" lineno="356" slineno="1-335"/>performance level and the amount of the performance-based award; and</amend></subsection><subsection ssid="1-197" dnum="_-o:iii-i" numlevel="1" lineno="357" slineno="1-336" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="370" groupid="315" style="1" owner="ahaskell" level="1" amendtag="end">the state board of each recognized self-nomination teacher's tier performance <ln numlevel="1" lineno="358" slineno="1-337"/>level and the amount of the performance-based award;</amend></subsection></subsection><subsection ssid="1-198" dnum="_-o:f-i" numlevel="1" lineno="359" slineno="1-338" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="375" groupid="319" style="1" owner="ahaskell" level="1" amendtag="end">no later than June 1, 2027, the state board shall disburse the performance-based <ln numlevel="1" lineno="360" slineno="1-339"/>award funds to the employing LEA of each recognized self-nomination teacher; and</amend></subsection><subsection ssid="1-199" dnum="_-o:g-i" numlevel="1" lineno="361" slineno="1-340" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="380" groupid="323" style="1" owner="ahaskell" level="1" amendtag="end">beginning July 15, 2027, an employing LEA shall disburse the performance-based <ln numlevel="1" lineno="362" slineno="1-341"/>award to each recognized self-nomination teacher in equal installments through the <ln numlevel="1" lineno="363" slineno="1-342"/>teacher's regularly occurring compensation so that all awarded funds are disbursed <ln numlevel="1" lineno="364" slineno="1-343"/>before the conclusion of the program described in Subsection <xref depth="4" refnumber="53F-2-526(2)">(2)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="365" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="365">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="366"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-2-26 2:02 PM</tm></rev></foot></leg>
