Section <bold>64-13-48</bold> is amended to read:</secline><catline lineno="22"><bold>64-13-48<parens/>. Educational and career-readiness programs.</bold></catline><subsection ssid="1-null-35" dnum="1-o" numlevel="1" lineno="23" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The department shall, in accordance with Subsection <xref depth="3" refnumber="64-13-6">64-13-6</xref>(1)(c), ensure that <ln numlevel="1" lineno="24" slineno="1-4"/>appropriate evidence-based and evidence-informed educational or career-readiness <ln numlevel="1" lineno="25" slineno="1-5"/>programs are made available to an inmate as soon as practicable after the creation of the <ln numlevel="1" lineno="26" slineno="1-6"/>inmate's case action plan.</subsection><subsection ssid="1-null-36" dnum="2-o" numlevel="1" lineno="27" slineno="1-7" level="1"><display>(2)</display>The department shall provide incarcerated women with substantially equivalent <ln numlevel="1" lineno="28" slineno="1-8"/>educational and career-readiness opportunities as incarcerated men.</subsection><subsection ssid="1-null-37" dnum="3-o" numlevel="1" lineno="29" slineno="1-9" level="1"><display>(3)</display>Before an inmate begins an educational or career-readiness program, the department <ln numlevel="1" lineno="30" slineno="1-10"/>shall provide reasonable access to resources necessary for an inmate to apply for grants <ln numlevel="1" lineno="31" slineno="1-11"/>or other available financial aid that may be available to pay for the inmate's program.</subsection><subsection ssid="1-null-38" dnum="4-o" numlevel="1" lineno="32" slineno="1-12" level="1" space="false"><display>(4)</display><subsection ssid="1-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall consider an inmate's current participation in an educational <ln numlevel="1" lineno="33" slineno="1-13"/>or career-readiness program when the department makes a decision with regard to an <ln numlevel="1" lineno="34" slineno="1-14"/>inmate's:<subsection ssid="1-null-40" dnum="i-o" numlevel="1" lineno="35" slineno="1-15" level="3" tab="1"><display>(i)</display>transfer to another area or facility; or</subsection><subsection ssid="1-null-41" dnum="ii-o" numlevel="1" lineno="36" slineno="1-16" level="3" tab="1"><display>(ii)</display>appropriate disciplinary sanction.</subsection></subsection><subsection ssid="1-null-42" dnum="b-o" numlevel="1" lineno="37" slineno="1-17" level="2"><display>(b)</display>When possible, the department shall use best efforts to allow an inmate to continue <ln numlevel="1" lineno="38" slineno="1-18"/>the inmate's participation in an educational or career-readiness program while the <ln numlevel="1" lineno="39" slineno="1-19"/>facility is under lockdown, quarantine, or a similar status.</subsection></subsection><subsection ssid="1-null-43" dnum="5-o" numlevel="1" lineno="40" slineno="1-20" level="1" space="false"><display>(5)</display><subsection ssid="1-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall maintain records on an inmate's educational progress, <ln numlevel="1" lineno="41" slineno="1-21"/>including completed life skills, certifications, and credit- and non-credit-bearing <ln numlevel="1" lineno="42" slineno="1-22"/>courses, made while the inmate is incarcerated.</subsection><subsection ssid="1-null-45" dnum="b-o" numlevel="1" lineno="43" slineno="1-23" level="2"><display>(b)</display>The department shall facilitate the transfer of information related to the inmate's <ln numlevel="1" lineno="44" slineno="1-24"/>educational process upon the inmate's release, including the inmate's post-release <ln numlevel="1" lineno="45" slineno="1-25"/>contact information and the records described in Subsection <xref depth="4" refnumber="64-13-48(5)(a)">(5)(a)</xref>, to:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="46" slineno="1-26" level="3"><display>(i)</display>the inmate; or</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="47" slineno="1-27" level="3"><display>(ii)</display>an entity that the inmate has authorized to receive the inmate's records or <ln numlevel="1" lineno="48" slineno="1-28"/>post-release contact information, including an institution:<subsection ssid="1-null-48" dnum="A-o" numlevel="1" lineno="49" slineno="1-29" level="4"><display>(A)</display>from which the inmate received educational instruction while the inmate was <ln numlevel="1" lineno="50" slineno="1-30"/>incarcerated; or</subsection><subsection ssid="1-null-49" dnum="B-o" numlevel="1" lineno="51" slineno="1-31" level="4"><display>(B)</display>at which the inmate plans to continue the inmate's post-incarceration <ln numlevel="1" lineno="52" slineno="1-32"/>education.</subsection></subsection></subsection></subsection><subsection ssid="1-null-50" dnum="6-o" numlevel="1" lineno="53" slineno="1-33" level="1"><display>(6)</display>Beginning May 1, 2023, the department shall provide an annual report to the Higher <ln numlevel="1" lineno="54" slineno="1-34"/>Education Appropriations Subcommittee regarding educational and career-readiness <ln numlevel="1" lineno="55" slineno="1-35"/>programs for inmates, which shall include:<subsection ssid="1-null-51" dnum="a-o" numlevel="1" lineno="56" slineno="1-36" level="2"><display>(a)</display>the number of inmates who are participating in an educational or career-readiness <ln numlevel="1" lineno="57" slineno="1-37"/>program, including an accredited postsecondary education program;</subsection><subsection ssid="1-null-52" dnum="b-o" numlevel="1" lineno="58" slineno="1-38" level="2"><display>(b)</display>the percentage of inmates who are participating in an educational or career-readiness <ln numlevel="1" lineno="59" slineno="1-39"/>program as compared to the total inmate population;</subsection><subsection ssid="1-null-53" dnum="c-o" numlevel="1" lineno="60" slineno="1-40" level="2"><display>(c)</display>inmate program completion and graduation data, including the number of <ln numlevel="1" lineno="61" slineno="1-41"/>completions and graduations in each educational or career-readiness program;</subsection><subsection ssid="1-null-54" dnum="d-o" numlevel="1" lineno="62" slineno="1-42" level="2"><display>(d)</display>the potential effect of educational or career-readiness programs on recidivism, as <ln numlevel="1" lineno="63" slineno="1-43"/>determined by a comparison of:<subsection ssid="1-null-55" dnum="i-o" numlevel="1" lineno="64" slineno="1-44" level="3"><display>(i)</display>the total number of inmates who return to incarceration after a previous <ln numlevel="1" lineno="65" slineno="1-45"/>incarceration; and</subsection><subsection ssid="1-null-56" dnum="ii-o" numlevel="1" lineno="66" slineno="1-46" level="3"><display>(ii)</display>the number of inmates who return to incarceration after a previous incarceration <ln numlevel="1" lineno="67" slineno="1-47"/>who participated in or completed an educational or career-readiness program;</subsection></subsection><subsection ssid="1-null-57" dnum="e-o" numlevel="1" lineno="68" slineno="1-48" level="2"><display>(e)</display>the number of inmates who were transferred to a different facility while currently <ln numlevel="1" lineno="69" slineno="1-49"/>participating in an educational or career-readiness program, including the number of <ln numlevel="1" lineno="70" slineno="1-50"/>inmates who were unable to continue a program after a transfer to a different facility; <ln numlevel="1" lineno="71" slineno="1-51"/>and</subsection><subsection ssid="1-null-58" dnum="f-o" numlevel="1" lineno="72" slineno="1-52" level="2"><display>(f)</display>the department's:<subsection ssid="1-null-59" dnum="i-o" numlevel="1" lineno="73" slineno="1-53" level="3"><display>(i)</display>recommendation for resources that may increase inmates' access to and <ln numlevel="1" lineno="74" slineno="1-54"/>participation in an educational or career-readiness program; and</subsection><subsection ssid="1-null-60" dnum="ii-o" numlevel="1" lineno="75" slineno="1-55" level="3"><display>(ii)</display>estimate of how many additional inmates would participate in an educational or <ln numlevel="1" lineno="76" slineno="1-56"/>career-readiness program if the resources were provided.</subsection></subsection></subsection><subsection ssid="1-null-61" dnum="7-o" numlevel="1" lineno="77" slineno="1-57" level="1"><display>(7)</display>The department shall:<subsection ssid="1-null-62" dnum="a-o" numlevel="1" lineno="78" slineno="1-58" level="2"><display>(a)</display>ensure that an inmate enrolled in an educational or career-readiness program has <ln numlevel="1" lineno="79" slineno="1-59"/>access to modern technology determined by the provider of the program as necessary <ln numlevel="1" lineno="80" slineno="1-60"/>for an inmate to participate in the program; and</subsection><subsection ssid="1-null-63" dnum="b-o" numlevel="1" lineno="81" slineno="1-61" level="2"><display>(b)</display>assist an inmate in applying for jobs within 30 days before the day on which the <ln numlevel="1" lineno="82" slineno="1-62"/>inmate is released from the department's custody.</subsection></subsection><subsection ssid="1-null-64" dnum="8-o" numlevel="1" lineno="83" slineno="1-63" level="1"><display>(8)</display>The department may not offer training for an inmate to become a certified nursing <ln numlevel="1" lineno="84" slineno="1-64"/>assistant certified by the Department of Health and Human Services.</subsection><subsection ssid="1-null-65" dnum="_-o:9-i" numlevel="1" lineno="85" slineno="1-65" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><subsection ssid="1-null-66" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">The department shall provide inmates with the opportunity to take a financial <ln numlevel="1" lineno="86" slineno="1-66"/>literacy class.</amend></subsection><subsection ssid="1-null-67" dnum="_-o:b-i" numlevel="1" lineno="87" slineno="1-67" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="ahaskell" level="1" amendtag="end">The financial literacy class described in Subsection <xref refnumber="64-13-48(9)(a)" depth="4">(9)(a)</xref> shall include instruction on <ln numlevel="1" lineno="88" slineno="1-68"/>strategies for saving and managing money earned through employment, including <ln numlevel="1" lineno="89" slineno="1-69"/>any employment during incarceration.</amend></subsection></subsection><subsection ssid="1-null-68" dnum="9-o:10-i" numlevel="1" lineno="90" slineno="1-70" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>The department may make rules in accordance with Section <xref depth="3" refnumber="64-13-10">64-13-10</xref> and Title <ln numlevel="1" lineno="91" slineno="1-71"/>63G, Chapter 3, Utah Administrative Rulemaking Act, to carry out the provisions of this <ln numlevel="1" lineno="92" slineno="1-72"/>section.</subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="93" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="93">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="94"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-7-26 10:50 AM</tm></rev></foot></leg>
