Section <bold>26B-5-121</bold> is amended to read:</secline><catline lineno="25"><bold>26B-5-121<parens/>. Voluntary referrals to substance use and mental health services by <ln numlevel="1" lineno="26" slineno="1-3"/>first responders -- Immunity from liability -- Reporting -- Rulemaking.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="28" slineno="1-5" level="2"><display>(a)</display>"First responder" means:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="29" slineno="1-6" level="3"><display>(i)</display>a law enforcement officer, as that term is defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>;</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="30" slineno="1-7" level="3"><display>(ii)</display>emergency medical service personnel, as that term is defined in Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>;</subsection><subsection ssid="1-null-5" dnum="iii-o" numlevel="1" lineno="31" slineno="1-8" level="3"><display>(iii)</display>an emergency medical technician, as that term is defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="1-null-6" dnum="iv-o" numlevel="1" lineno="32" slineno="1-9" level="3"><display>(iv)</display>an advanced emergency medical technician, as that term is defined in Section <xref depth="3" refnumber="53-2e-101"><ln numlevel="1" lineno="33" slineno="1-10"/>53-2e-101</xref>;</subsection><subsection ssid="1-null-7" dnum="v-o" numlevel="1" lineno="34" slineno="1-11" level="3"><display>(v)</display>a firefighter, as that term is defined in Section <xref depth="3" refnumber="53H-11-306">53H-11-306</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-8" dnum="vi-o" numlevel="1" lineno="35" slineno="1-12" level="3"><display>(vi)</display>a dispatcher, as that term is defined in Section <xref depth="3" refnumber="53-6-102">53-6-102</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="1-22" dnum="_-o:vii-i" numlevel="1" lineno="36" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">an animal control officer, as that term is defined in Section <xref depth="3" refnumber="11-46-102">11-46-102</xref>.</amend></subsection></subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="37" slineno="1-14" level="2"><display>(b)</display>"Local services list" means a comprehensive list of local substance use or mental <ln numlevel="1" lineno="38" slineno="1-15"/>health services, as described in Subsections <xref depth="4" refnumber="17-77-201(5)(b)(iii)">17-77-201(5)(b)(iii)</xref> and <xref depth="4" refnumber="17-77-301(5)(c)">17-77-301(5)(c)</xref>.</subsection></subsection><subsection ssid="1-null-10" dnum="2-o" numlevel="1" lineno="39" slineno="1-16" level="1"><display>(2)</display>As and when appropriate, a first responder is encouraged to offer a referral to substance <ln numlevel="1" lineno="40" slineno="1-17"/>use or mental health services to an individual who experiences an intentional or <ln numlevel="1" lineno="41" slineno="1-18"/>accidental overdose.</subsection><subsection ssid="1-null-11" dnum="3-o" numlevel="1" lineno="42" slineno="1-19" level="1"><display>(3)</display>If an individual expresses interest in substance use or mental health services, a first <ln numlevel="1" lineno="43" slineno="1-20"/>responder may, as appropriate:<subsection ssid="1-null-12" dnum="a-o" numlevel="1" lineno="44" slineno="1-21" level="2"><display>(a)</display>facilitate a real-time connection with an appropriate local service provider;</subsection><subsection ssid="1-null-13" dnum="b-o" numlevel="1" lineno="45" slineno="1-22" level="2"><display>(b)</display>contact the statewide 988 crisis line for assistance; or</subsection><subsection ssid="1-null-14" dnum="c-o" numlevel="1" lineno="46" slineno="1-23" level="2"><display>(c)</display>if the individual does not wish to speak with a service provider at that time, provide <ln numlevel="1" lineno="47" slineno="1-24"/>the individual with a physical copy of a local services list.</subsection></subsection><subsection ssid="1-null-15" dnum="4-o" numlevel="1" lineno="48" slineno="1-25" level="1" space="false"><display>(4)</display><subsection ssid="1-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This section does not create a duty for a first responder to offer or provide a <ln numlevel="1" lineno="49" slineno="1-26"/>referral to substance use or mental health services.</subsection><subsection ssid="1-null-17" dnum="b-o" numlevel="1" lineno="50" slineno="1-27" level="2"><display>(b)</display>A first responder and an employer of a first responder are not liable under this <ln numlevel="1" lineno="51" slineno="1-28"/>section for a first responder's action or failure to act in regards to offering or <ln numlevel="1" lineno="52" slineno="1-29"/>providing a referral to substance use or mental health services as described in this <ln numlevel="1" lineno="53" slineno="1-30"/>section.</subsection><subsection ssid="1-null-18" dnum="c-o" numlevel="1" lineno="54" slineno="1-31" level="2"><display>(c)</display>This section does not affect any privilege or immunity from liability, exemption from <ln numlevel="1" lineno="55" slineno="1-32"/>law, ordinance, or rule, or any other benefit that applies to a first responder or an <ln numlevel="1" lineno="56" slineno="1-33"/>employer of a first responder.</subsection></subsection><subsection ssid="1-null-19" dnum="5-o" numlevel="1" lineno="57" slineno="1-34" level="1" space="false"><display>(5)</display><subsection ssid="1-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a first responder offers a referral to substance use or mental health services as <ln numlevel="1" lineno="58" slineno="1-35"/>described in this section, the first responder's employer shall report annually to the <ln numlevel="1" lineno="59" slineno="1-36"/>division the total number of individuals who accepted a referral from all first <ln numlevel="1" lineno="60" slineno="1-37"/>responders employed by the employer.</subsection><subsection ssid="1-null-21" dnum="b-o" numlevel="1" lineno="61" slineno="1-38" level="2"><display>(b)</display>The division shall make rules, in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="62" slineno="1-39"/>Administrative Rulemaking Act</xref>, specifying how the reports required by Subsection <xref depth="4" refnumber="26B-5-121(5)(a)"><ln numlevel="1" lineno="63" slineno="1-40"/>(5)(a)</xref> shall be submitted.</subsection></subsection></section></bsec><bsec buid="3" num="34A-2-102" type="amend" src="code" uid="C34A-2-S102_2026050620260506" sort="34A02 01020020260506" numlevel="1" lineno="64" slineno="2-1" sn="2"><section number="34A-2-102" numlevel="1" lineno="65" slineno="2-2" type="amend"><secline lineno="64">Section 2. Section <bold>34A-2-102</bold> is amended to read:</secline><catline lineno="65"><bold>34A-2-102<parens/>. Definition of terms.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="66" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this chapter:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="67" slineno="2-4" level="2"><display>(a)</display>"Average weekly wages" means the average weekly wages as determined under <ln numlevel="1" lineno="68" slineno="2-5"/>Section <xref depth="3" refnumber="34A-2-409" start="0">34A-2-409</xref>.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="69" slineno="2-6" level="2"><display>(b)</display>"Award" means a final order of the commission as to the amount of compensation <ln numlevel="1" lineno="70" slineno="2-7"/>due:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="71" slineno="2-8" level="3"><display>(i)</display>an injured employee; or</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="72" slineno="2-9" level="3"><display>(ii)</display>a dependent of a deceased employee.</subsection></subsection><subsection ssid="3-null-6" dnum="c-o" numlevel="1" lineno="73" slineno="2-10" level="2"><display>(c)</display>"Compensation" means the payments and benefits provided for in this chapter or <xref depth="1" refnumber="34A-3" start="1"><ln numlevel="1" lineno="74" slineno="2-11"/>Chapter 3, Utah Occupational Disease Act</xref>.</subsection><subsection ssid="3-null-7" dnum="d-o" numlevel="1" lineno="75" slineno="2-12" level="2" space="false"><display>(d)</display><subsection ssid="3-null-8" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Decision" means a ruling of:<subsection ssid="3-null-9" dnum="A-o" numlevel="1" lineno="76" slineno="2-13" level="4" tab="1"><display>(A)</display>an administrative law judge; or</subsection><subsection ssid="3-null-10" dnum="B-o" numlevel="1" lineno="77" slineno="2-14" level="4" tab="1"><display>(B)</display>in accordance with Section <xref depth="3" refnumber="34A-2-801" start="0">34A-2-801</xref>:<subsection ssid="3-null-11" dnum="I-o" numlevel="1" lineno="78" slineno="2-15" level="5"><display>(I)</display>the commissioner; or</subsection><subsection ssid="3-null-12" dnum="II-o" numlevel="1" lineno="79" slineno="2-16" level="5"><display>(II)</display>the Appeals Board.</subsection></subsection></subsection><subsection ssid="3-null-13" dnum="ii-o" numlevel="1" lineno="80" slineno="2-17" level="3"><display>(ii)</display>"Decision" includes:<subsection ssid="3-null-14" dnum="A-o" numlevel="1" lineno="81" slineno="2-18" level="4"><display>(A)</display>an award or denial of a medical, disability, death, or other related benefit <ln numlevel="1" lineno="82" slineno="2-19"/>under this chapter or <xref depth="1" refnumber="34A-3" start="1">Chapter 3, Utah Occupational Disease Act</xref>; or</subsection><subsection ssid="3-null-15" dnum="B-o" numlevel="1" lineno="83" slineno="2-20" level="4"><display>(B)</display>another adjudicative ruling in accordance with this chapter or <xref depth="1" refnumber="34A-3" start="1">Chapter 3, Utah <ln numlevel="1" lineno="84" slineno="2-21"/>Occupational Disease Act</xref>.</subsection></subsection></subsection><subsection ssid="3-null-16" dnum="e-o" numlevel="1" lineno="85" slineno="2-22" level="2"><display>(e)</display>"Director" means the director of the division, unless the context requires otherwise.</subsection><subsection ssid="3-null-17" dnum="f-o" numlevel="1" lineno="86" slineno="2-23" level="2"><display>(f)</display>"Disability" means an administrative determination that may result in an entitlement <ln numlevel="1" lineno="87" slineno="2-24"/>to compensation as a consequence of becoming medically impaired as to function.  <amend anum="0" ea="amend" pairid="18" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both"><ln numlevel="1" lineno="88" slineno="2-25"/>Disability</amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="ahaskell" level="1" deltag="both">Disability</amend><amendoutend style="2"/> can be total or partial, temporary or permanent, industrial or <ln numlevel="1" lineno="89" slineno="2-26"/>nonindustrial.</subsection><subsection ssid="3-null-18" dnum="g-o" numlevel="1" lineno="90" slineno="2-27" level="2"><display>(g)</display>"Division" means the Division of Industrial Accidents.</subsection><subsection ssid="3-null-19" dnum="h-o" numlevel="1" lineno="91" slineno="2-28" level="2"><display>(h)</display>"First responder" means:<subsection ssid="3-null-20" dnum="i-o" numlevel="1" lineno="92" slineno="2-29" level="3"><display>(i)</display>a law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>;</subsection><subsection ssid="3-null-21" dnum="ii-o" numlevel="1" lineno="93" slineno="2-30" level="3"><display>(ii)</display>an emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101" start="0">53-2e-101</xref>;</subsection><subsection ssid="3-null-22" dnum="iii-o" numlevel="1" lineno="94" slineno="2-31" level="3"><display>(iii)</display>an advanced emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101" start="0">53-2e-101</xref>;</subsection><subsection ssid="3-null-23" dnum="iv-o" numlevel="1" lineno="95" slineno="2-32" level="3"><display>(iv)</display>a paramedic, as defined in Section <xref depth="3" refnumber="53-2e-101" start="0">53-2e-101</xref>;</subsection><subsection ssid="3-null-24" dnum="v-o" numlevel="1" lineno="96" slineno="2-33" level="3"><display>(v)</display>a firefighter, as defined in Section <xref depth="3" refnumber="34A-3-113" start="0">34A-3-113</xref>;</subsection><subsection ssid="3-null-25" dnum="vi-o" numlevel="1" lineno="97" slineno="2-34" level="3"><display>(vi)</display>a dispatcher, as defined in Section <xref depth="3" refnumber="53-6-102" start="0">53-6-102</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-26" dnum="vii-o" numlevel="1" lineno="98" slineno="2-35" level="3"><display>(vii)</display>a correctional officer, as defined in Section <xref depth="3" refnumber="53-13-104" start="0">53-13-104</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="3-38" dnum="_-o:viii-i" numlevel="1" lineno="99" slineno="2-36" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">an animal control officer, as defined in Section <xref depth="3" refnumber="11-46-102">11-46-102</xref>.</amend></subsection></subsection><subsection ssid="3-null-27" dnum="i-o" numlevel="1" lineno="100" slineno="2-37" level="2"><display>(i)</display>"Impairment" is a purely medical condition reflecting an anatomical or functional <ln numlevel="1" lineno="101" slineno="2-38"/>abnormality or loss.  Impairment may be either temporary or permanent, industrial or <ln numlevel="1" lineno="102" slineno="2-39"/>nonindustrial.</subsection><subsection ssid="3-null-28" dnum="j-o" numlevel="1" lineno="103" slineno="2-40" level="2"><display>(j)</display>"Order" means an action of the commission that determines the legal rights, duties, <ln numlevel="1" lineno="104" slineno="2-41"/>privileges, immunities, or other interests of one or more specific persons, but not a <ln numlevel="1" lineno="105" slineno="2-42"/>class of persons.</subsection><subsection ssid="3-null-29" dnum="k-o" numlevel="1" lineno="106" slineno="2-43" level="2" space="false"><display>(k)</display><subsection ssid="3-null-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Personal injury by accident arising out of and in the course of employment" <ln numlevel="1" lineno="107" slineno="2-44"/>includes an injury caused by the willful act of a third person directed against an <ln numlevel="1" lineno="108" slineno="2-45"/>employee because of the employee's employment.</subsection><subsection ssid="3-null-31" dnum="ii-o" numlevel="1" lineno="109" slineno="2-46" level="3"><display>(ii)</display>"Personal injury by accident arising out of and in the course of employment" does <ln numlevel="1" lineno="110" slineno="2-47"/>not include a disease, except as the disease results from the injury.</subsection></subsection><subsection ssid="3-null-32" dnum="l-o" numlevel="1" lineno="111" slineno="2-48" level="2"><display>(l)</display>"Safe" and "safety," as applied to employment or a place of employment, means the <ln numlevel="1" lineno="112" slineno="2-49"/>freedom from danger to the life or health of employees reasonably permitted by the <ln numlevel="1" lineno="113" slineno="2-50"/>nature of the employment.</subsection></subsection><subsection ssid="3-null-33" dnum="2-o" numlevel="1" lineno="114" slineno="2-51" level="1"><display>(2)</display>As used in this chapter and <xref depth="1" refnumber="34A-3" start="1">Chapter 3, Utah Occupational Disease Act</xref>:<subsection ssid="3-null-34" dnum="a-o" numlevel="1" lineno="115" slineno="2-52" level="2"><display>(a)</display>"Brother or sister" includes a half brother or sister.</subsection><subsection ssid="3-null-35" dnum="b-o" numlevel="1" lineno="116" slineno="2-53" level="2"><display>(b)</display>"Child" includes:<subsection ssid="3-null-36" dnum="i-o" numlevel="1" lineno="117" slineno="2-54" level="3"><display>(i)</display>a posthumous child; or</subsection><subsection ssid="3-null-37" dnum="ii-o" numlevel="1" lineno="118" slineno="2-55" level="3"><display>(ii)</display>a child legally adopted <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> an injury.</subsection></subsection></subsection></section></bsec><bsec buid="22" num="53-3-207" type="amend" src="code" uid="C53-3-S207_2026050620260506" sort="53 03 02070020260506" numlevel="1" lineno="119" slineno="3-1" sn="3"><section number="53-3-207" numlevel="1" lineno="120" slineno="3-2" type="amend"><secline lineno="119">Section 3. Section <bold>53-3-207</bold> is amended to read:</secline><catline lineno="120"><bold>53-3-207<parens/>. License certificates or driving privilege cards issued to drivers by class <ln numlevel="1" lineno="121" slineno="3-3"/>of motor vehicle -- Contents -- Release of anatomical gift information -- Temporary <ln numlevel="1" lineno="122" slineno="3-4"/>licenses or driving privilege cards -- Minors' licenses, cards, and permits -- Violation.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="123" slineno="3-5" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="22-null-2" dnum="a-o" numlevel="1" lineno="124" slineno="3-6" level="2"><display>(a)</display>"Authorized guardian" means:<subsection ssid="22-null-3" dnum="i-o" numlevel="1" lineno="125" slineno="3-7" level="3"><display>(i)</display>the parent or legal guardian of a child who:<subsection ssid="22-null-4" dnum="A-o" numlevel="1" lineno="126" slineno="3-8" level="4"><display>(A)</display>is under 18 years old; and</subsection><subsection ssid="22-null-5" dnum="B-o" numlevel="1" lineno="127" slineno="3-9" level="4"><display>(B)</display>has an invisible condition; or</subsection></subsection><subsection ssid="22-null-6" dnum="ii-o" numlevel="1" lineno="128" slineno="3-10" level="3"><display>(ii)</display>the legal guardian or conservator of an adult who:<subsection ssid="22-null-7" dnum="A-o" numlevel="1" lineno="129" slineno="3-11" level="4"><display>(A)</display>is 18 years old or older; and</subsection><subsection ssid="22-null-8" dnum="B-o" numlevel="1" lineno="130" slineno="3-12" level="4"><display>(B)</display>has an invisible condition.</subsection></subsection></subsection><subsection ssid="22-null-9" dnum="b-o" numlevel="1" lineno="131" slineno="3-13" level="2"><display>(b)</display>"Driving privilege" means the privilege granted under this chapter to drive a motor <ln numlevel="1" lineno="132" slineno="3-14"/>vehicle.</subsection><subsection ssid="22-null-10" dnum="c-o" numlevel="1" lineno="133" slineno="3-15" level="2"><display>(c)</display>"First responder" means:<subsection ssid="22-null-11" dnum="i-o" numlevel="1" lineno="134" slineno="3-16" level="3"><display>(i)</display>a law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>;</subsection><subsection ssid="22-null-12" dnum="ii-o" numlevel="1" lineno="135" slineno="3-17" level="3"><display>(ii)</display>an emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101" start="0">53-2e-101</xref>;</subsection><subsection ssid="22-null-13" dnum="iii-o" numlevel="1" lineno="136" slineno="3-18" level="3"><display>(iii)</display>an advanced emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101" start="0">53-2e-101</xref>;</subsection><subsection ssid="22-null-14" dnum="iv-o" numlevel="1" lineno="137" slineno="3-19" level="3"><display>(iv)</display>a paramedic, as defined in Section <xref depth="3" refnumber="53-2e-101" start="0">53-2e-101</xref>;</subsection><subsection ssid="22-null-15" dnum="v-o" numlevel="1" lineno="138" slineno="3-20" level="3"><display>(v)</display>a firefighter, as defined in Section <xref depth="3" refnumber="53H-11-306">53H-11-306</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="22-null-16" dnum="vi-o" numlevel="1" lineno="139" slineno="3-21" level="3"><display>(vi)</display>a dispatcher, as defined in Section <xref depth="3" refnumber="53-6-102" start="0">53-6-102</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="22-112" dnum="_-o:vii-i" numlevel="1" lineno="140" slineno="3-22" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">an animal control officer as defined in Section <xref depth="3" refnumber="11-46-102">11-46-102</xref>.</amend></subsection></subsection><subsection ssid="22-null-17" dnum="d-o" numlevel="1" lineno="141" slineno="3-23" level="2"><display>(d)</display>"Governmental entity" means the state or a political subdivision of the state.</subsection><subsection ssid="22-null-18" dnum="e-o" numlevel="1" lineno="142" slineno="3-24" level="2"><display>(e)</display>"Health care professional" means:<subsection ssid="22-null-19" dnum="i-o" numlevel="1" lineno="143" slineno="3-25" level="3"><display>(i)</display>a licensed physician, physician assistant, nurse practitioner, or mental health <ln numlevel="1" lineno="144" slineno="3-26"/>therapist; or</subsection><subsection ssid="22-null-20" dnum="ii-o" numlevel="1" lineno="145" slineno="3-27" level="3"><display>(ii)</display>any other licensed health care professional the division designates by rule made in <ln numlevel="1" lineno="146" slineno="3-28"/>accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>.</subsection></subsection><subsection ssid="22-null-21" dnum="f-o" numlevel="1" lineno="147" slineno="3-29" level="2"><display>(f)</display>"Invisible condition" means a physical or mental condition that may interfere with an <ln numlevel="1" lineno="148" slineno="3-30"/>individual's ability to communicate with a first responder, including:<subsection ssid="22-null-22" dnum="i-o" numlevel="1" lineno="149" slineno="3-31" level="3"><display>(i)</display>a communication impediment;</subsection><subsection ssid="22-null-23" dnum="ii-o" numlevel="1" lineno="150" slineno="3-32" level="3"><display>(ii)</display>hearing loss;</subsection><subsection ssid="22-null-24" dnum="iii-o" numlevel="1" lineno="151" slineno="3-33" level="3"><display>(iii)</display>blindness or a visual impairment;</subsection><subsection ssid="22-null-25" dnum="iv-o" numlevel="1" lineno="152" slineno="3-34" level="3"><display>(iv)</display>autism spectrum disorder;</subsection><subsection ssid="22-null-26" dnum="v-o" numlevel="1" lineno="153" slineno="3-35" level="3"><display>(v)</display>a drug allergy;</subsection><subsection ssid="22-null-27" dnum="vi-o" numlevel="1" lineno="154" slineno="3-36" level="3"><display>(vi)</display>Alzheimer's disease or dementia;</subsection><subsection ssid="22-null-28" dnum="vii-o" numlevel="1" lineno="155" slineno="3-37" level="3"><display>(vii)</display>post-traumatic stress disorder;</subsection><subsection ssid="22-null-29" dnum="viii-o" numlevel="1" lineno="156" slineno="3-38" level="3"><display>(viii)</display>traumatic brain injury;</subsection><subsection ssid="22-null-30" dnum="ix-o" numlevel="1" lineno="157" slineno="3-39" level="3"><display>(ix)</display>schizophrenia;</subsection><subsection ssid="22-null-31" dnum="x-o" numlevel="1" lineno="158" slineno="3-40" level="3"><display>(x)</display>epilepsy;</subsection><subsection ssid="22-null-32" dnum="xi-o" numlevel="1" lineno="159" slineno="3-41" level="3"><display>(xi)</display>a developmental disability;</subsection><subsection ssid="22-null-33" dnum="xii-o" numlevel="1" lineno="160" slineno="3-42" level="3"><display>(xii)</display>Down syndrome;</subsection><subsection ssid="22-null-34" dnum="xiii-o" numlevel="1" lineno="161" slineno="3-43" level="3"><display>(xiii)</display>diabetes;</subsection><subsection ssid="22-null-35" dnum="xiv-o" numlevel="1" lineno="162" slineno="3-44" level="3"><display>(xiv)</display>a heart condition; or</subsection><subsection ssid="22-null-36" dnum="xv-o" numlevel="1" lineno="163" slineno="3-45" level="3"><display>(xv)</display>any other condition approved by the department.</subsection></subsection><subsection ssid="22-null-37" dnum="g-o" numlevel="1" lineno="164" slineno="3-46" level="2"><display>(g)</display>"Invisible condition identification symbol" means a symbol or alphanumeric code <ln numlevel="1" lineno="165" slineno="3-47"/>that indicates that an individual is an individual with an invisible condition.</subsection><subsection ssid="22-null-38" dnum="h-o" numlevel="1" lineno="166" slineno="3-48" level="2"><display>(h)</display>"Political subdivision" means any county, city, town, school district, public transit <ln numlevel="1" lineno="167" slineno="3-49"/>district, community reinvestment agency, special improvement or taxing district, <ln numlevel="1" lineno="168" slineno="3-50"/>special district, special service district, an entity created by an interlocal agreement <ln numlevel="1" lineno="169" slineno="3-51"/>adopted under <xref depth="1" refnumber="11-13" start="0">Title 11, Chapter 13, Interlocal Cooperation Act</xref>, or other <ln numlevel="1" lineno="170" slineno="3-52"/>governmental subdivision or public corporation.</subsection><subsection ssid="22-null-39" dnum="i-o" numlevel="1" lineno="171" slineno="3-53" level="2"><display>(i)</display>"State" means this state, and includes any office, department, agency, authority, <ln numlevel="1" lineno="172" slineno="3-54"/>commission, board, institution, hospital, college, university, children's justice center, <ln numlevel="1" lineno="173" slineno="3-55"/>or other instrumentality of the state.</subsection></subsection><subsection ssid="22-null-40" dnum="2-o" numlevel="1" lineno="174" slineno="3-56" level="1" space="false"><display>(2)</display><subsection ssid="22-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall issue to every individual privileged to drive a motor vehicle, a <ln numlevel="1" lineno="175" slineno="3-57"/>regular license certificate, a limited-term license certificate, or a driving privilege <ln numlevel="1" lineno="176" slineno="3-58"/>card indicating the type or class of motor vehicle the individual may drive.</subsection><subsection ssid="22-null-42" dnum="b-o" numlevel="1" lineno="177" slineno="3-59" level="2"><display>(b)</display>An individual may not drive a class of motor vehicle unless granted the privilege in <ln numlevel="1" lineno="178" slineno="3-60"/>that class.</subsection></subsection><subsection ssid="22-null-43" dnum="3-o" numlevel="1" lineno="179" slineno="3-61" level="1" space="false"><display>(3)</display><subsection ssid="22-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Every regular license certificate, limited-term license certificate, or driving <ln numlevel="1" lineno="180" slineno="3-62"/>privilege card shall bear:<subsection ssid="22-null-45" dnum="i-o" numlevel="1" lineno="181" slineno="3-63" level="3" tab="1"><display>(i)</display>the distinguishing number assigned to the individual by the division;</subsection><subsection ssid="22-null-46" dnum="ii-o" numlevel="1" lineno="182" slineno="3-64" level="3" tab="1"><display>(ii)</display>the name, birth date, and Utah residence address of the individual;</subsection><subsection ssid="22-null-47" dnum="iii-o" numlevel="1" lineno="183" slineno="3-65" level="3" tab="1"><display>(iii)</display>a brief description of the individual for the purpose of identification;</subsection><subsection ssid="22-null-48" dnum="iv-o" numlevel="1" lineno="184" slineno="3-66" level="3" tab="1"><display>(iv)</display>any restrictions imposed on the license under Section <xref depth="3" refnumber="53-3-208" start="0">53-3-208</xref>;</subsection><subsection ssid="22-null-49" dnum="v-o" numlevel="1" lineno="185" slineno="3-67" level="3" tab="1"><display>(v)</display>a photograph of the individual;</subsection><subsection ssid="22-null-50" dnum="vi-o" numlevel="1" lineno="186" slineno="3-68" level="3" tab="1"><display>(vi)</display>a photograph or other facsimile of the individual's signature;</subsection><subsection ssid="22-null-51" dnum="vii-o" numlevel="1" lineno="187" slineno="3-69" level="3" tab="1"><display>(vii)</display>an indication whether the individual intends to make an anatomical gift under <xref depth="2" refnumber="26B-8-3" start="0"><ln numlevel="1" lineno="188" slineno="3-70"/>Title 26B, Chapter 8, Part 3, Revised Uniform Anatomical Gift Act</xref>, unless the <ln numlevel="1" lineno="189" slineno="3-71"/>driving privilege is extended under Subsection <xref depth="4" refnumber="53-3-214(3)" start="0">53-3-214(3)</xref>; and</subsection><subsection ssid="22-null-52" dnum="viii-o" numlevel="1" lineno="190" slineno="3-72" level="3" tab="1"><display>(viii)</display>except as provided in Subsection <xref depth="4" refnumber="53-3-207(3)(b)" start="0">(3)(b)</xref>, if the individual states that the <ln numlevel="1" lineno="191" slineno="3-73"/>individual is a veteran of the United States military on the application for a driver <ln numlevel="1" lineno="192" slineno="3-74"/>license in accordance with Section <xref depth="3" refnumber="53-3-205" start="0">53-3-205</xref> and provides verification that the <ln numlevel="1" lineno="193" slineno="3-75"/>individual was granted an honorable or general discharge from the United States <ln numlevel="1" lineno="194" slineno="3-76"/>Armed Forces, an indication that the individual is a United States military veteran <ln numlevel="1" lineno="195" slineno="3-77"/>for a regular license certificate or limited-term license certificate issued on or after <ln numlevel="1" lineno="196" slineno="3-78"/>July 1, 2011.</subsection></subsection><subsection ssid="22-null-53" dnum="b-o" numlevel="1" lineno="197" slineno="3-79" level="2"><display>(b)</display>A regular license certificate or limited-term license certificate issued to an individual <ln numlevel="1" lineno="198" slineno="3-80"/>younger than 21 years old on a portrait-style format as required in Subsection <xref depth="4" refnumber="53-3-207(7)(b)" start="0">(7)(b)</xref> <ln numlevel="1" lineno="199" slineno="3-81"/>is not required to include an indication that the individual is a United States military <ln numlevel="1" lineno="200" slineno="3-82"/>veteran under Subsection <xref depth="4" refnumber="53-3-207(3)(a)(viii)" start="0">(3)(a)(viii)</xref>.</subsection><subsection ssid="22-null-54" dnum="c-o" numlevel="1" lineno="201" slineno="3-83" level="2"><display>(c)</display>A new license certificate issued by the division may not bear the individual's social <ln numlevel="1" lineno="202" slineno="3-84"/>security number.</subsection><subsection ssid="22-null-55" dnum="d-o" numlevel="1" lineno="203" slineno="3-85" level="2" space="false"><display>(d)</display><subsection ssid="22-null-56" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The regular license certificate, limited-term license certificate, or driving <ln numlevel="1" lineno="204" slineno="3-86"/>privilege card shall be of an impervious material, resistant to wear, damage, and <ln numlevel="1" lineno="205" slineno="3-87"/>alteration.</subsection><subsection ssid="22-null-57" dnum="ii-o" numlevel="1" lineno="206" slineno="3-88" level="3"><display>(ii)</display>The size, form, and color of the regular license certificate, limited-term license <ln numlevel="1" lineno="207" slineno="3-89"/>certificate, or driving privilege card shall be as prescribed by the commissioner.</subsection><subsection ssid="22-null-58" dnum="iii-o" numlevel="1" lineno="208" slineno="3-90" level="3"><display>(iii)</display>The commissioner may also prescribe the issuance of a special type of limited <ln numlevel="1" lineno="209" slineno="3-91"/>regular license certificate, limited-term license certificate, or driving privilege card <ln numlevel="1" lineno="210" slineno="3-92"/>under Subsection <xref depth="4" refnumber="53-3-220(4)" start="0">53-3-220(4)</xref>.</subsection></subsection></subsection><subsection ssid="22-null-59" dnum="4-o" numlevel="1" lineno="211" slineno="3-93" level="1" space="false"><display>(4)</display><subsection ssid="22-null-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall include or affix an invisible condition identification symbol on <ln numlevel="1" lineno="212" slineno="3-94"/>an individual's regular license certificate, limited-term license certificate, or driving <ln numlevel="1" lineno="213" slineno="3-95"/>privilege card if the individual or the individual's authorized guardian, on a form <ln numlevel="1" lineno="214" slineno="3-96"/>prescribed by the department:<subsection ssid="22-null-61" dnum="i-o" numlevel="1" lineno="215" slineno="3-97" level="3" tab="1"><display>(i)</display>requests the division to include the invisible condition identification symbol;</subsection><subsection ssid="22-null-62" dnum="ii-o" numlevel="1" lineno="216" slineno="3-98" level="3" tab="1"><display>(ii)</display>provides written verification from a health care professional that the individual is <ln numlevel="1" lineno="217" slineno="3-99"/>an individual with an invisible condition; and</subsection><subsection ssid="22-null-63" dnum="iii-o" numlevel="1" lineno="218" slineno="3-100" level="3" tab="1"><display>(iii)</display>signs a waiver of liability for the release of any medical information to:<subsection ssid="22-null-64" dnum="A-o" numlevel="1" lineno="219" slineno="3-101" level="4"><display>(A)</display>the department;</subsection><subsection ssid="22-null-65" dnum="B-o" numlevel="1" lineno="220" slineno="3-102" level="4"><display>(B)</display>any person who has access to the individual's medical information as recorded <ln numlevel="1" lineno="221" slineno="3-103"/>on the individual's driving record or the Utah Criminal Justice Information <ln numlevel="1" lineno="222" slineno="3-104"/>System under this chapter; </subsection><subsection ssid="22-null-66" dnum="C-o" numlevel="1" lineno="223" slineno="3-105" level="4"><display>(C)</display>any other person who may view or receive notice of the individual's medical <ln numlevel="1" lineno="224" slineno="3-106"/>information by seeing the individual's regular license certificate, limited-term <ln numlevel="1" lineno="225" slineno="3-107"/>license certificate, or driving privilege card or the individual's information in <ln numlevel="1" lineno="226" slineno="3-108"/>the Utah Criminal Justice Information System;</subsection><subsection ssid="22-null-67" dnum="D-o" numlevel="1" lineno="227" slineno="3-109" level="4"><display>(D)</display>a local law enforcement agency that receives a copy of the form described in <ln numlevel="1" lineno="228" slineno="3-110"/>this Subsection <xref depth="4" refnumber="53-3-207(4)(a)" start="0">(4)(a)</xref> and enters the contents of the form into the local law <ln numlevel="1" lineno="229" slineno="3-111"/>enforcement agency's record management system or computer-aided dispatch <ln numlevel="1" lineno="230" slineno="3-112"/>system; and</subsection><subsection ssid="22-null-68" dnum="E-o" numlevel="1" lineno="231" slineno="3-113" level="4"><display>(E)</display>a dispatcher who accesses the information regarding the individual's invisible <ln numlevel="1" lineno="232" slineno="3-114"/>condition through the use of a local law enforcement agency's record <ln numlevel="1" lineno="233" slineno="3-115"/>management system or computer-aided dispatch system.</subsection></subsection></subsection><subsection ssid="22-null-69" dnum="b-o" numlevel="1" lineno="234" slineno="3-116" level="2"><display>(b)</display>As part of the form described in Subsection <xref depth="4" refnumber="53-3-207(4)(a)" start="0">(4)(a)</xref>, the department shall advise the <ln numlevel="1" lineno="235" slineno="3-117"/>individual or the individual's authorized guardian that by submitting the signed <ln numlevel="1" lineno="236" slineno="3-118"/>waiver, the individual or the individual's authorized guardian consents to the release <ln numlevel="1" lineno="237" slineno="3-119"/>of the individual's medical information to any person described in Subsections <xref depth="4" refnumber="53-3-207(4)(a)(iii)(A)" start="0"><ln numlevel="1" lineno="238" slineno="3-120"/>(4)(a)(iii)(A)</xref> through <xref depth="4" refnumber="53-3-207(4)(a)(iii)(E)" start="0">(E)</xref>, even if the person is otherwise ineligible to access the <ln numlevel="1" lineno="239" slineno="3-121"/>individual's medical information under state or federal law.</subsection><subsection ssid="22-null-70" dnum="c-o" numlevel="1" lineno="240" slineno="3-122" level="2"><display>(c)</display>The division may not:<subsection ssid="22-null-71" dnum="i-o" numlevel="1" lineno="241" slineno="3-123" level="3"><display>(i)</display>charge a fee to include the invisible condition identification symbol on the <ln numlevel="1" lineno="242" slineno="3-124"/>individual's regular license certificate, limited-term license certificate, or driving <ln numlevel="1" lineno="243" slineno="3-125"/>privilege card; or</subsection><subsection ssid="22-null-72" dnum="ii-o" numlevel="1" lineno="244" slineno="3-126" level="3"><display>(ii)</display>after including the invisible condition identification symbol on the individual's <ln numlevel="1" lineno="245" slineno="3-127"/>previously issued regular license certificate, limited-term license certificate, or <ln numlevel="1" lineno="246" slineno="3-128"/>driving privilege card, require the individual to provide subsequent written <ln numlevel="1" lineno="247" slineno="3-129"/>verification described in Subsection <xref depth="4" refnumber="53-3-207(4)(a)(ii)" start="0">(4)(a)(ii)</xref> to include the invisible condition <ln numlevel="1" lineno="248" slineno="3-130"/>identification symbol on the individual's renewed or extended regular license <ln numlevel="1" lineno="249" slineno="3-131"/>certificate, limited-term license certificate, or driving privilege card.</subsection></subsection><subsection ssid="22-null-73" dnum="d-o" numlevel="1" lineno="250" slineno="3-132" level="2"><display>(d)</display>The division shall confirm with the Division of Professional Licensing that the health <ln numlevel="1" lineno="251" slineno="3-133"/>care professional described in Subsection <xref depth="4" refnumber="53-3-207(4)(a)(ii)" start="0">(4)(a)(ii)</xref> holds a current state license.</subsection><subsection ssid="22-null-74" dnum="e-o" numlevel="1" lineno="252" slineno="3-134" level="2"><display>(e)</display>The inclusion of an invisible condition identification symbol on an individual's <ln numlevel="1" lineno="253" slineno="3-135"/>license certificate, limited-term license certificate, or driving privilege card in <ln numlevel="1" lineno="254" slineno="3-136"/>accordance with Subsection <xref depth="4" refnumber="53-3-207(4)(a)" start="0">(4)(a)</xref> does not confer any legal rights or privileges on <ln numlevel="1" lineno="255" slineno="3-137"/>the individual, including parking privileges for individuals with disabilities under <ln numlevel="1" lineno="256" slineno="3-138"/>Section <xref depth="3" refnumber="41-1a-414" start="0">41-1a-414</xref>.</subsection><subsection ssid="22-null-75" dnum="f-o" numlevel="1" lineno="257" slineno="3-139" level="2"><display>(f)</display>For each individual issued a regular license certificate, limited-term license <ln numlevel="1" lineno="258" slineno="3-140"/>certificate, or driving privilege card under this section that includes an invisible <ln numlevel="1" lineno="259" slineno="3-141"/>condition identification symbol, the division shall include in the division's database a <ln numlevel="1" lineno="260" slineno="3-142"/>brief description of the nature of the individual's invisible condition in the <ln numlevel="1" lineno="261" slineno="3-143"/>individual's record and provide the brief description to the Utah Criminal Justice <ln numlevel="1" lineno="262" slineno="3-144"/>Information System.</subsection><subsection ssid="22-null-76" dnum="g-o" numlevel="1" lineno="263" slineno="3-145" level="2"><display>(g)</display>Except as provided in this section, the division may not release the information <ln numlevel="1" lineno="264" slineno="3-146"/>described in Subsection <xref depth="4" refnumber="53-3-207(4)(f)" start="0">(4)(f)</xref>.</subsection><subsection ssid="22-null-77" dnum="h-o" numlevel="1" lineno="265" slineno="3-147" level="2"><display>(h)</display>Within 30 days after the day on which the division receives an individual's or the <ln numlevel="1" lineno="266" slineno="3-148"/>individual's authorized guardian's written request, the division shall:<subsection ssid="22-null-78" dnum="i-o" numlevel="1" lineno="267" slineno="3-149" level="3"><display>(i)</display>remove from the individual's record in the division's database the invisible <ln numlevel="1" lineno="268" slineno="3-150"/>condition identification symbol and the brief description described in Subsection <xref depth="4" refnumber="53-3-207(4)(f)" start="0"><ln numlevel="1" lineno="269" slineno="3-151"/>(4)(f)</xref>; and</subsection><subsection ssid="22-null-79" dnum="ii-o" numlevel="1" lineno="270" slineno="3-152" level="3"><display>(ii)</display>provide the individual's updated record to the Utah Criminal Justice Information <ln numlevel="1" lineno="271" slineno="3-153"/>System.</subsection></subsection></subsection><subsection ssid="22-null-80" dnum="5-o" numlevel="1" lineno="272" slineno="3-154" level="1"><display>(5)</display>As provided in Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>, the information described in Subsection <xref depth="4" refnumber="53-3-207(4)(a)" start="0">(4)(a)</xref> is a <ln numlevel="1" lineno="273" slineno="3-155"/>private record for purposes of <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="274" slineno="3-156"/>Management Act</xref>.</subsection><subsection ssid="22-null-81" dnum="6-o" numlevel="1" lineno="275" slineno="3-157" level="1" space="false"><display>(6)</display><subsection ssid="22-null-82" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="22-null-83" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The division, upon determining after an examination that an applicant is <ln numlevel="1" lineno="276" slineno="3-158"/>mentally and physically qualified to be granted a driving privilege, may issue to <ln numlevel="1" lineno="277" slineno="3-159"/>an applicant a receipt for the fee if the applicant is eligible for a regular license <ln numlevel="1" lineno="278" slineno="3-160"/>certificate or limited-term license certificate.</subsection><subsection ssid="22-null-84" dnum="ii-o" numlevel="1" lineno="279" slineno="3-161" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="22-null-85" dnum="A-o" level="4" placement="sameline"><display>(A)</display>The division shall issue a temporary regular license certificate or <ln numlevel="1" lineno="280" slineno="3-162"/>temporary limited-term license certificate allowing the individual to drive a <ln numlevel="1" lineno="281" slineno="3-163"/>motor vehicle while the division is completing the division's investigation to <ln numlevel="1" lineno="282" slineno="3-164"/>determine whether the individual is entitled to be granted a driving privilege.</subsection><subsection ssid="22-null-86" dnum="B-o" numlevel="1" lineno="283" slineno="3-165" level="4"><display>(B)</display>A temporary regular license certificate or a temporary limited-term license <ln numlevel="1" lineno="284" slineno="3-166"/>certificate issued under this Subsection <xref depth="4" refnumber="53-3-207(6)" start="0">(6)</xref> shall be recognized and have the <ln numlevel="1" lineno="285" slineno="3-167"/>same rights and privileges as a regular license certificate or a limited-term <ln numlevel="1" lineno="286" slineno="3-168"/>license certificate.</subsection></subsection></subsection><subsection ssid="22-null-87" dnum="b-o" numlevel="1" lineno="287" slineno="3-169" level="2"><display>(b)</display>The temporary regular license certificate or temporary limited-term license <ln numlevel="1" lineno="288" slineno="3-170"/>certificate shall be in the individual's immediate possession while driving a motor <ln numlevel="1" lineno="289" slineno="3-171"/>vehicle, and the temporary regular license certificate or temporary limited-term <ln numlevel="1" lineno="290" slineno="3-172"/>license certificate is invalid when the individual's regular license certificate or <ln numlevel="1" lineno="291" slineno="3-173"/>limited-term license certificate has been issued or when, for good cause, the privilege <ln numlevel="1" lineno="292" slineno="3-174"/>has been refused.</subsection><subsection ssid="22-null-88" dnum="c-o" numlevel="1" lineno="293" slineno="3-175" level="2"><display>(c)</display>The division shall indicate on the temporary regular license certificate or temporary <ln numlevel="1" lineno="294" slineno="3-176"/>limited-term license certificate a date after which the temporary regular license <ln numlevel="1" lineno="295" slineno="3-177"/>certificate or temporary limited-term license certificate is not valid as a temporary <ln numlevel="1" lineno="296" slineno="3-178"/>license.</subsection><subsection ssid="22-null-89" dnum="d-o" numlevel="1" lineno="297" slineno="3-179" level="2" space="false"><display>(d)</display><subsection ssid="22-null-90" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="53-3-207(6)(d)(ii)" start="0">(6)(d)(ii)</xref>, the division may not issue a <ln numlevel="1" lineno="298" slineno="3-180"/>temporary driving privilege card or other temporary permit to an applicant for a <ln numlevel="1" lineno="299" slineno="3-181"/>driving privilege card.</subsection><subsection ssid="22-null-91" dnum="ii-o" numlevel="1" lineno="300" slineno="3-182" level="3"><display>(ii)</display>The division may issue a learner permit issued in accordance with Section <xref depth="3" refnumber="53-3-210.5" start="0"><ln numlevel="1" lineno="301" slineno="3-183"/>53-3-210.5</xref> to an applicant for a driving privilege card.</subsection></subsection></subsection><subsection ssid="22-null-92" dnum="7-o" numlevel="1" lineno="302" slineno="3-184" level="1" space="false"><display>(7)</display><subsection ssid="22-null-93" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall distinguish learner permits, temporary permits, regular license <ln numlevel="1" lineno="303" slineno="3-185"/>certificates, limited-term license certificates, and driving privilege cards issued to any <ln numlevel="1" lineno="304" slineno="3-186"/>individual younger than 21 years old by use of plainly printed information or the use <ln numlevel="1" lineno="305" slineno="3-187"/>of a color or other means not used for other regular license certificates, limited-term <ln numlevel="1" lineno="306" slineno="3-188"/>license certificates, or driving privilege cards.</subsection><subsection ssid="22-null-94" dnum="b-o" numlevel="1" lineno="307" slineno="3-189" level="2"><display>(b)</display>The division shall distinguish a regular license certificate, limited-term license <ln numlevel="1" lineno="308" slineno="3-190"/>certificate, or driving privilege card issued to an individual younger than 21 years old <ln numlevel="1" lineno="309" slineno="3-191"/>by use of a portrait-style format not used for other regular license certificates, <ln numlevel="1" lineno="310" slineno="3-192"/>limited-term license certificates, or driving privilege cards and by plainly printing the <ln numlevel="1" lineno="311" slineno="3-193"/>date the regular license certificate, limited-term license certificate, or driving <ln numlevel="1" lineno="312" slineno="3-194"/>privilege card holder is 21 years old.</subsection></subsection><subsection ssid="22-null-95" dnum="8-o" numlevel="1" lineno="313" slineno="3-195" level="1"><display>(8)</display>The division shall distinguish a limited-term license certificate by clearly indicating on <ln numlevel="1" lineno="314" slineno="3-196"/>the document:<subsection ssid="22-null-96" dnum="a-o" numlevel="1" lineno="315" slineno="3-197" level="2"><display>(a)</display>that the limited-term license certificate is temporary; and</subsection><subsection ssid="22-null-97" dnum="b-o" numlevel="1" lineno="316" slineno="3-198" level="2"><display>(b)</display>the limited-term license certificate's expiration date.</subsection></subsection><subsection ssid="22-null-98" dnum="9-o" numlevel="1" lineno="317" slineno="3-199" level="1" space="false"><display>(9)</display><subsection ssid="22-null-99" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall only issue a driving privilege card to an individual whose <ln numlevel="1" lineno="318" slineno="3-200"/>privilege was obtained without providing evidence of lawful presence in the United <ln numlevel="1" lineno="319" slineno="3-201"/>States as required under Subsection <xref depth="4" refnumber="53-3-205(8)" start="0">53-3-205(8)</xref>.</subsection><subsection ssid="22-null-100" dnum="b-o" numlevel="1" lineno="320" slineno="3-202" level="2"><display>(b)</display>The division shall distinguish a driving privilege card from a license certificate by:<subsection ssid="22-null-101" dnum="i-o" numlevel="1" lineno="321" slineno="3-203" level="3"><display>(i)</display>use of a format, color, font, or other means; and</subsection><subsection ssid="22-null-102" dnum="ii-o" numlevel="1" lineno="322" slineno="3-204" level="3"><display>(ii)</display>clearly displaying on the front of the driving privilege card a phrase substantially <ln numlevel="1" lineno="323" slineno="3-205"/>similar to "FOR DRIVING PRIVILEGES ONLY -- NOT VALID FOR <ln numlevel="1" lineno="324" slineno="3-206"/>IDENTIFICATION".</subsection></subsection></subsection><subsection ssid="22-null-103" dnum="10-o" numlevel="1" lineno="325" slineno="3-207" level="1"><display>(10)</display>The provisions of Subsection <xref depth="4" refnumber="53-3-207(7)(b)" start="0">(7)(b)</xref> do not apply to a learner permit, temporary permit, <ln numlevel="1" lineno="326" slineno="3-208"/>temporary regular license certificate, temporary limited-term license certificate, or any <ln numlevel="1" lineno="327" slineno="3-209"/>other temporary permit.</subsection><subsection ssid="22-null-104" dnum="11-o" numlevel="1" lineno="328" slineno="3-210" level="1"><display>(11)</display>The division shall issue temporary license certificates of the same nature, except as to <ln numlevel="1" lineno="329" slineno="3-211"/>duration, as the license certificates that they temporarily replace, as are necessary to <ln numlevel="1" lineno="330" slineno="3-212"/>implement applicable provisions of this section and Section <xref depth="3" refnumber="53-3-223" start="0">53-3-223</xref>.</subsection><subsection ssid="22-null-105" dnum="12-o" numlevel="1" lineno="331" slineno="3-213" level="1" space="false"><display>(12)</display><subsection ssid="22-null-106" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity may not accept a driving privilege card as proof of <ln numlevel="1" lineno="332" slineno="3-214"/>personal identification.</subsection><subsection ssid="22-null-107" dnum="b-o" numlevel="1" lineno="333" slineno="3-215" level="2"><display>(b)</display>A driving privilege card may not be used as a document providing proof of an <ln numlevel="1" lineno="334" slineno="3-216"/>individual's age for any government required purpose.</subsection></subsection><subsection ssid="22-null-108" dnum="13-o" numlevel="1" lineno="335" slineno="3-217" level="1"><display>(13)</display>An individual who violates Subsection <xref depth="4" refnumber="53-3-207(2)(b)" start="0">(2)(b)</xref> is guilty of an infraction.</subsection><subsection ssid="22-null-109" dnum="14-o" numlevel="1" lineno="336" slineno="3-218" level="1"><display>(14)</display>Unless otherwise provided, the provisions, requirements, classes, endorsements, fees, <ln numlevel="1" lineno="337" slineno="3-219"/>restrictions, and sanctions under this code apply to a:<subsection ssid="22-null-110" dnum="a-o" numlevel="1" lineno="338" slineno="3-220" level="2"><display>(a)</display>driving privilege in the same way as a license or limited-term license issued under <ln numlevel="1" lineno="339" slineno="3-221"/>this chapter; and</subsection><subsection ssid="22-null-111" dnum="b-o" numlevel="1" lineno="340" slineno="3-222" level="2"><display>(b)</display>limited-term license certificate or driving privilege card in the same way as a regular <ln numlevel="1" lineno="341" slineno="3-223"/>license certificate issued under this chapter.</subsection></subsection></section></bsec><bsec buid="5" num="53-21-101" type="amend" src="code" uid="C53-21-S101_2026050620260506" sort="53 21 01010020260506" numlevel="1" lineno="342" slineno="4-1" sn="4"><section number="53-21-101" numlevel="1" lineno="343" slineno="4-2" type="amend"><secline lineno="342">Section 4. Section <bold>53-21-101</bold> is amended to read:</secline><catline lineno="343"><bold>53-21-101<parens/>. Definitions.</bold></catline><sectionText lineno="344"><tab/>As used in this chapter:</sectionText><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="345" slineno="4-4" level="1"><display>(1)</display>"Crime scene investigator technician" means an individual employed by a law <ln numlevel="1" lineno="346" slineno="4-5"/>enforcement agency to collect and analyze evidence from crime scenes and <ln numlevel="1" lineno="347" slineno="4-6"/>crime-related incidents.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="348" slineno="4-7" level="1"><display>(2)</display>"Designated mental health resources liaison" means a non-leadership human resources <ln numlevel="1" lineno="349" slineno="4-8"/>or other administrative employee designated by a first responder agency who receives <ln numlevel="1" lineno="350" slineno="4-9"/>and processes a request for mental health resources on behalf of the first responder <ln numlevel="1" lineno="351" slineno="4-10"/>agency under this chapter.</subsection><subsection ssid="5-null-3" dnum="3-o" numlevel="1" lineno="352" slineno="4-11" level="1"><display>(3)</display>"First responder" means:<subsection ssid="5-null-4" dnum="a-o" numlevel="1" lineno="353" slineno="4-12" level="2"><display>(a)</display>a law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>;</subsection><subsection ssid="5-null-5" dnum="b-o" numlevel="1" lineno="354" slineno="4-13" level="2"><display>(b)</display>an emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="5-null-6" dnum="c-o" numlevel="1" lineno="355" slineno="4-14" level="2"><display>(c)</display>an advanced emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="5-null-7" dnum="d-o" numlevel="1" lineno="356" slineno="4-15" level="2"><display>(d)</display>a paramedic, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="5-null-8" dnum="e-o" numlevel="1" lineno="357" slineno="4-16" level="2"><display>(e)</display>a firefighter, as defined in Section <xref depth="3" refnumber="34A-3-113">34A-3-113</xref>;</subsection><subsection ssid="5-null-9" dnum="f-o" numlevel="1" lineno="358" slineno="4-17" level="2"><display>(f)</display>a dispatcher, as defined in Section <xref depth="3" refnumber="53-6-102">53-6-102</xref>;</subsection><subsection ssid="5-null-10" dnum="g-o" numlevel="1" lineno="359" slineno="4-18" level="2"><display>(g)</display>a correctional officer, as defined in Section <xref depth="3" refnumber="53-13-104">53-13-104</xref>;</subsection><subsection ssid="5-null-11" dnum="h-o" numlevel="1" lineno="360" slineno="4-19" level="2"><display>(h)</display>a special function officer, as defined in Section <xref depth="3" refnumber="53-13-105">53-13-105</xref>, employed by a local <ln numlevel="1" lineno="361" slineno="4-20"/>sheriff;</subsection><subsection ssid="5-45" dnum="_-o:i-i" numlevel="1" lineno="362" slineno="4-21" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">an animal control officer, as defined in Section <xref depth="3" refnumber="11-46-102">11-46-102</xref>;</amend></subsection><subsection ssid="5-null-12" dnum="i-o:j-i" numlevel="1" lineno="363" slineno="4-22" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1184" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>a search and rescue worker under the supervision of a local sheriff;</subsection><subsection ssid="5-null-13" dnum="j-o:k-i" numlevel="1" lineno="364" slineno="4-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1185" style="2" owner="o" level="1" deltag="both">(j)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="both" space="true">(k)</amend></display>a forensic interviewer or victim advocate employed by a children's justice center <ln numlevel="1" lineno="365" slineno="4-24"/>established in accordance with Section <xref depth="3" refnumber="67-5b-102">67-5b-102</xref>;</subsection><subsection ssid="5-null-14" dnum="k-o:l-i" numlevel="1" lineno="366" slineno="4-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1186" style="2" owner="o" level="1" deltag="both">(k)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="both" space="true">(l)</amend></display>a credentialed criminal justice system victim advocate as defined in Section <xref depth="3" refnumber="77-38-403"><ln numlevel="1" lineno="367" slineno="4-26"/>77-38-403</xref> who responds to incidents with a law enforcement officer;</subsection><subsection ssid="5-null-15" dnum="l-o:m-i" numlevel="1" lineno="368" slineno="4-27" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1187" style="2" owner="o" level="1" deltag="both">(l)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="both" space="true">(m)</amend></display>a crime scene investigator technician;</subsection><subsection ssid="5-null-16" dnum="m-o:n-i" numlevel="1" lineno="369" slineno="4-28" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1188" style="2" owner="o" level="1" deltag="both">(m)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="both" space="true">(n)</amend></display>a wildland firefighter;</subsection><subsection ssid="5-null-17" dnum="n-o:o-i" numlevel="1" lineno="370" slineno="4-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1189" style="2" owner="o" level="1" deltag="both">(n)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="both" space="true">(o)</amend></display>an investigator or prosecutor of cases involving sexual crimes against children; <ln numlevel="1" lineno="371" slineno="4-30"/>or</subsection><subsection ssid="5-null-18" dnum="o-o:p-i" numlevel="1" lineno="372" slineno="4-31" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1190" style="2" owner="o" level="1" deltag="both">(o)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="both" space="true">(p)</amend></display>a civilian employee of a first responder agency who has been authorized to view <ln numlevel="1" lineno="373" slineno="4-32"/>or otherwise access information concerning crimes, accidents, or other traumatic <ln numlevel="1" lineno="374" slineno="4-33"/>events.</subsection></subsection><subsection ssid="5-null-19" dnum="4-o" numlevel="1" lineno="375" slineno="4-34" level="1"><display>(4)</display>"First responder agency" means:<subsection ssid="5-null-20" dnum="a-o" numlevel="1" lineno="376" slineno="4-35" level="2"><display>(a)</display>a special district, municipality, interlocal entity, or other political subdivision that <ln numlevel="1" lineno="377" slineno="4-36"/>employs a first responder to provide fire protection, paramedic, law enforcement, or <ln numlevel="1" lineno="378" slineno="4-37"/>emergency services; or</subsection><subsection ssid="5-null-21" dnum="b-o" numlevel="1" lineno="379" slineno="4-38" level="2"><display>(b)</display>a certified private law enforcement agency as defined in Section <xref depth="3" refnumber="53-19-102">53-19-102</xref>.</subsection></subsection><subsection ssid="5-null-22" dnum="5-o" numlevel="1" lineno="380" slineno="4-39" level="1" space="false"><display>(5)</display><subsection ssid="5-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Mental health resources" means:<subsection ssid="5-null-24" dnum="i-o" numlevel="1" lineno="381" slineno="4-40" level="3" tab="1"><display>(i)</display>an assessment to determine appropriate mental health treatment that is performed <ln numlevel="1" lineno="382" slineno="4-41"/>by a mental health therapist;</subsection><subsection ssid="5-null-25" dnum="ii-o" numlevel="1" lineno="383" slineno="4-42" level="3" tab="1"><display>(ii)</display>outpatient mental health treatment provided by a mental health therapist; or</subsection><subsection ssid="5-null-26" dnum="iii-o" numlevel="1" lineno="384" slineno="4-43" level="3" tab="1"><display>(iii)</display>peer support services provided by a peer support specialist who is qualified to <ln numlevel="1" lineno="385" slineno="4-44"/>provide peer support services under Subsection <xref depth="4" refnumber="26B-5-102(2)(gg)">26B-5-102(2)(gg)</xref>.</subsection></subsection><subsection ssid="5-null-27" dnum="b-o" numlevel="1" lineno="386" slineno="4-45" level="2"><display>(b)</display>"Mental health resources" includes, at a minimum, the following services:<subsection ssid="5-null-28" dnum="i-o" numlevel="1" lineno="387" slineno="4-46" level="3"><display>(i)</display>regular periodic screenings for all employees within the first responder agency;</subsection><subsection ssid="5-null-29" dnum="ii-o" numlevel="1" lineno="388" slineno="4-47" level="3"><display>(ii)</display>assessments and availability to mental health services for personnel directly <ln numlevel="1" lineno="389" slineno="4-48"/>involved in a critical incident within 48 hours of the incident; and</subsection><subsection ssid="5-null-30" dnum="iii-o" numlevel="1" lineno="390" slineno="4-49" level="3"><display>(iii)</display>regular and continuing access to the mental health program for:<subsection ssid="5-null-31" dnum="A-o" numlevel="1" lineno="391" slineno="4-50" level="4"><display>(A)</display>spouses and children of first responders;</subsection><subsection ssid="5-null-32" dnum="B-o" numlevel="1" lineno="392" slineno="4-51" level="4"><display>(B)</display>first responders who have retired or separated from the agency; and</subsection><subsection ssid="5-null-33" dnum="C-o" numlevel="1" lineno="393" slineno="4-52" level="4"><display>(C)</display>spouses of first responders who have retired or separated from the agency.</subsection></subsection></subsection></subsection><subsection ssid="5-null-34" dnum="6-o" numlevel="1" lineno="394" slineno="4-53" level="1"><display>(6)</display>"Mental health therapist" means the same as that term is defined in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>.</subsection><subsection ssid="5-null-35" dnum="7-o" numlevel="1" lineno="395" slineno="4-54" level="1"><display>(7)</display>"Plan" means a plan to implement or expand a program that provides mental health <ln numlevel="1" lineno="396" slineno="4-55"/>resources to first responders for which the division awards a grant under this chapter.</subsection><subsection ssid="5-null-36" dnum="8-o" numlevel="1" lineno="397" slineno="4-56" level="1"><display>(8)</display>"Retired" means the status of an individual who has become eligible, applies for, and <ln numlevel="1" lineno="398" slineno="4-57"/>may receive an allowance under Title 49, Utah State Retirement and Insurance Benefit <ln numlevel="1" lineno="399" slineno="4-58"/>Act.</subsection><subsection ssid="5-null-37" dnum="9-o" numlevel="1" lineno="400" slineno="4-59" level="1"><display>(9)</display>"Separated" means the status of an individual who has separated from employment as a <ln numlevel="1" lineno="401" slineno="4-60"/>first responder from a first responder agency as a result of a critical incident involving <ln numlevel="1" lineno="402" slineno="4-61"/>the first responder.</subsection><subsection ssid="5-null-38" dnum="10-o" numlevel="1" lineno="403" slineno="4-62" level="1"><display>(10)</display>"Small first responder agency" means a first responder agency that:<subsection ssid="5-null-39" dnum="a-o" numlevel="1" lineno="404" slineno="4-63" level="2"><display>(a)</display>has 10 or fewer employees;</subsection><subsection ssid="5-null-40" dnum="b-o" numlevel="1" lineno="405" slineno="4-64" level="2"><display>(b)</display>is primarily staffed by volunteers; or</subsection><subsection ssid="5-null-41" dnum="c-o" numlevel="1" lineno="406" slineno="4-65" level="2"><display>(c)</display>is located in:<subsection ssid="5-null-42" dnum="i-o" numlevel="1" lineno="407" slineno="4-66" level="3"><display>(i)</display>a county of the third, fourth, fifth, or sixth class;</subsection><subsection ssid="5-null-43" dnum="ii-o" numlevel="1" lineno="408" slineno="4-67" level="3"><display>(ii)</display>a city of the third, fourth, fifth, or sixth class; or</subsection><subsection ssid="5-null-44" dnum="iii-o" numlevel="1" lineno="409" slineno="4-68" level="3"><display>(iii)</display>a town.</subsection></subsection></subsection></section></bsec><bsec buid="10" num="53H-11-411" type="amend" src="code" uid="C53H-11-S411_2026050620260506" sort="53H11 04110020260506" numlevel="1" lineno="410" slineno="5-1" sn="5"><section number="53H-11-411" numlevel="1" lineno="411" slineno="5-2" type="amend"><secline lineno="410">Section 5. Section <bold>53H-11-411</bold> is amended to read:</secline><catline lineno="411"><bold>53H-11-411<parens/>. First Responder Mental Health Services Grant Program.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="412" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="10-null-2" dnum="a-o" numlevel="1" lineno="413" slineno="5-4" level="2"><display>(a)</display>"First responder" means an individual who works in Utah as:<subsection ssid="10-null-3" dnum="i-o" numlevel="1" lineno="414" slineno="5-5" level="3"><display>(i)</display>a law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>;</subsection><subsection ssid="10-null-4" dnum="ii-o" numlevel="1" lineno="415" slineno="5-6" level="3"><display>(ii)</display>an emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="10-null-5" dnum="iii-o" numlevel="1" lineno="416" slineno="5-7" level="3"><display>(iii)</display>an advanced emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="10-null-6" dnum="iv-o" numlevel="1" lineno="417" slineno="5-8" level="3"><display>(iv)</display>a paramedic, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="10-null-7" dnum="v-o" numlevel="1" lineno="418" slineno="5-9" level="3"><display>(v)</display>a firefighter, as defined in Section <xref depth="3" refnumber="53H-11-306">53H-11-306</xref>;</subsection><subsection ssid="10-null-8" dnum="vi-o" numlevel="1" lineno="419" slineno="5-10" level="3"><display>(vi)</display>a dispatcher, as defined in Section <xref depth="3" refnumber="53-6-102">53-6-102</xref>;</subsection><subsection ssid="10-null-9" dnum="vii-o" numlevel="1" lineno="420" slineno="5-11" level="3"><display>(vii)</display>a correctional officer, as defined in Section <xref depth="3" refnumber="53-13-104">53-13-104</xref>;</subsection><subsection ssid="10-55" dnum="_-o:viii-i" numlevel="1" lineno="421" slineno="5-12" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">an animal control officer, as defined in Section <xref depth="3" refnumber="11-46-102">11-46-102</xref>;</amend></subsection><subsection ssid="10-null-10" dnum="viii-o:ix-i" numlevel="1" lineno="422" slineno="5-13" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1227" style="2" owner="o" level="1" deltag="both">(viii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="both" space="true">(ix)</amend></display>a special function officer, as defined in Section <xref depth="3" refnumber="53-13-105">53-13-105</xref>, employed by a <ln numlevel="1" lineno="423" slineno="5-14"/>local sheriff;</subsection><subsection ssid="10-null-11" dnum="ix-o:x-i" numlevel="1" lineno="424" slineno="5-15" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1228" style="2" owner="o" level="1" deltag="both">(ix)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="both" space="true">(x)</amend></display>a search and rescue worker under the supervision of a local sheriff;</subsection><subsection ssid="10-null-12" dnum="x-o:xi-i" numlevel="1" lineno="425" slineno="5-16" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1229" style="2" owner="o" level="1" deltag="both">(x)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="both" space="true">(xi)</amend></display>a forensic interviewer or victim advocate employed by a children's justice <ln numlevel="1" lineno="426" slineno="5-17"/>center established in accordance with Section <xref depth="3" refnumber="67-5b-102">67-5b-102</xref>;</subsection><subsection ssid="10-null-13" dnum="xi-o:xii-i" numlevel="1" lineno="427" slineno="5-18" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1230" style="2" owner="o" level="1" deltag="both">(xi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="both" space="true">(xii)</amend></display>a credentialed criminal justice system victim advocate as defined in Section <xref depth="3" refnumber="77-38-403"><ln numlevel="1" lineno="428" slineno="5-19"/>77-38-403</xref> who responds to incidents with a law enforcement officer;</subsection><subsection ssid="10-null-14" dnum="xii-o:xiii-i" numlevel="1" lineno="429" slineno="5-20" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1231" style="2" owner="o" level="1" deltag="both">(xii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="both" space="true">(xiii)</amend></display>a crime scene investigator technician;</subsection><subsection ssid="10-null-15" dnum="xiii-o:xiv-i" numlevel="1" lineno="430" slineno="5-21" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1232" style="2" owner="o" level="1" deltag="both">(xiii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="both" space="true">(xiv)</amend></display>a wildland firefighter;</subsection><subsection ssid="10-null-16" dnum="xiv-o:xv-i" numlevel="1" lineno="431" slineno="5-22" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1233" style="2" owner="o" level="1" deltag="both">(xiv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="both" space="true">(xv)</amend></display>an investigator or prosecutor of cases involving sexual crimes against <ln numlevel="1" lineno="432" slineno="5-23"/>children; or</subsection><subsection ssid="10-null-17" dnum="xv-o:xvi-i" numlevel="1" lineno="433" slineno="5-24" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1234" style="2" owner="o" level="1" deltag="both">(xv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="both" space="true">(xvi)</amend></display>a civilian employee of a first responder agency who has been authorized <ln numlevel="1" lineno="434" slineno="5-25"/>to view or otherwise access information concerning crimes, accidents, or other <ln numlevel="1" lineno="435" slineno="5-26"/>traumatic events.</subsection></subsection><subsection ssid="10-null-18" dnum="b-o" numlevel="1" lineno="436" slineno="5-27" level="2"><display>(b)</display>"First responder agency" means the same as that term is defined in Section <xref depth="3" refnumber="53-21-101">53-21-101</xref>.</subsection><subsection ssid="10-null-19" dnum="c-o" numlevel="1" lineno="437" slineno="5-28" level="2"><display>(c)</display>"First responder volunteer" means:<subsection ssid="10-null-20" dnum="i-o" numlevel="1" lineno="438" slineno="5-29" level="3"><display>(i)</display>an individual who donates services as a first responder to a first responder agency <ln numlevel="1" lineno="439" slineno="5-30"/>located in Utah without pay or other compensation except:<subsection ssid="10-null-21" dnum="A-o" numlevel="1" lineno="440" slineno="5-31" level="4"><display>(A)</display>expenses that the individual actually and reasonably incurs as the supervising <ln numlevel="1" lineno="441" slineno="5-32"/>first responder agency approves; and</subsection><subsection ssid="10-null-22" dnum="B-o" numlevel="1" lineno="442" slineno="5-33" level="4"><display>(B)</display>health insurance that a participant in the Volunteer Emergency Medical <ln numlevel="1" lineno="443" slineno="5-34"/>Service Personnel <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="4" style="2" owner="ahaskell" level="1" deltag="both">Health</amend><amendoutend style="2"/> Insurance Program described in Section <xref depth="3" refnumber="53-2d-703">53-2d-703</xref> <ln numlevel="1" lineno="444" slineno="5-35"/>receives; or</subsection></subsection><subsection ssid="10-null-23" dnum="ii-o" numlevel="1" lineno="445" slineno="5-36" level="3"><display>(ii)</display>a volunteer firefighter who is not regularly employed as a firefighter service <ln numlevel="1" lineno="446" slineno="5-37"/>employee, but who:<subsection ssid="10-null-24" dnum="A-o" numlevel="1" lineno="447" slineno="5-38" level="4"><display>(A)</display>has received training in firefighter techniques and skills;</subsection><subsection ssid="10-null-25" dnum="B-o" numlevel="1" lineno="448" slineno="5-39" level="4"><display>(B)</display>continues to receive regular firefighter training; and</subsection><subsection ssid="10-null-26" dnum="C-o" numlevel="1" lineno="449" slineno="5-40" level="4"><display>(C)</display>is on the rolls of a legally organized volunteer fire department that provides <ln numlevel="1" lineno="450" slineno="5-41"/>ongoing training and serves a political subdivision of the state.</subsection></subsection></subsection><subsection ssid="10-null-27" dnum="d-o" numlevel="1" lineno="451" slineno="5-42" level="2"><display>(d)</display>"Retiree" means the same as that term is defined in Section <xref depth="3" refnumber="49-11-102">49-11-102</xref>.</subsection></subsection><subsection ssid="10-null-28" dnum="2-o" numlevel="1" lineno="452" slineno="5-43" level="1"><display>(2)</display>This section creates the First Responder Mental Health Services Grant Program.</subsection><subsection ssid="10-null-29" dnum="3-o" numlevel="1" lineno="453" slineno="5-44" level="1"><display>(3)</display>Subject to legislative appropriations and Subsection <xref depth="4" refnumber="53B-8-117(8)">(8)</xref>, the board shall award a grant to <ln numlevel="1" lineno="454" slineno="5-45"/>an applicant who:<subsection ssid="10-null-30" dnum="a-o" numlevel="1" lineno="455" slineno="5-46" level="2"><display>(a)</display>is a first responder, a first responder volunteer, or a retiree who worked as a first <ln numlevel="1" lineno="456" slineno="5-47"/>responder in the state; and</subsection><subsection ssid="10-null-31" dnum="b-o" numlevel="1" lineno="457" slineno="5-48" level="2"><display>(b)</display>is seeking a post-secondary degree or certification to become a mental health <ln numlevel="1" lineno="458" slineno="5-49"/>therapist, as that term is defined in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>, from:<subsection ssid="10-null-32" dnum="i-o" numlevel="1" lineno="459" slineno="5-50" level="3"><display>(i)</display>an institution of higher education described in Section <xref depth="3" refnumber="53H-1-102">53H-1-102</xref>; or</subsection><subsection ssid="10-null-33" dnum="ii-o" numlevel="1" lineno="460" slineno="5-51" level="3"><display>(ii)</display>a private postsecondary educational institution.</subsection></subsection></subsection><subsection ssid="10-null-34" dnum="4-o" numlevel="1" lineno="461" slineno="5-52" level="1" space="false"><display>(4)</display><subsection ssid="10-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="53B-8-117(4)(b)">(4)(b)</xref>, the board may award a qualified applicant a grant in <ln numlevel="1" lineno="462" slineno="5-53"/>an amount that is equal to the difference between:<subsection ssid="10-null-36" dnum="i-o" numlevel="1" lineno="463" slineno="5-54" level="3" tab="1"><display>(i)</display>the total cost of tuition and fees for the program in which the recipient is enrolled; <ln numlevel="1" lineno="464" slineno="5-55"/>and</subsection><subsection ssid="10-null-37" dnum="ii-o" numlevel="1" lineno="465" slineno="5-56" level="3" tab="1"><display>(ii)</display>the total value of all other grants, tuition waivers, fee waivers, and scholarships <ln numlevel="1" lineno="466" slineno="5-57"/>that the recipient receives to attend the institution.</subsection></subsection><subsection ssid="10-null-38" dnum="b-o" numlevel="1" lineno="467" slineno="5-58" level="2"><display>(b)</display>A grant award under Subsection <xref depth="4" refnumber="53B-8-117(4)(a)">(4)(a)</xref> is limited to:<subsection ssid="10-null-39" dnum="i-o" numlevel="1" lineno="468" slineno="5-59" level="3"><display>(i)</display>a maximum of $6,000 each academic year; and</subsection><subsection ssid="10-null-40" dnum="ii-o" numlevel="1" lineno="469" slineno="5-60" level="3"><display>(ii)</display>a maximum of four academic years.</subsection></subsection></subsection><subsection ssid="10-null-41" dnum="5-o" numlevel="1" lineno="470" slineno="5-61" level="1"><display>(5)</display>The board shall design the program to ensure that institutions combine loans, grants, <ln numlevel="1" lineno="471" slineno="5-62"/>employment, and family and individual contributions toward financing the cost of <ln numlevel="1" lineno="472" slineno="5-63"/>attendance.</subsection><subsection ssid="10-null-42" dnum="6-o" numlevel="1" lineno="473" slineno="5-64" level="1"><display>(6)</display>The board shall:<subsection ssid="10-null-43" dnum="a-o" numlevel="1" lineno="474" slineno="5-65" level="2"><display>(a)</display>select two periods during each calendar year to accept applications for the program; <ln numlevel="1" lineno="475" slineno="5-66"/>and</subsection><subsection ssid="10-null-44" dnum="b-o" numlevel="1" lineno="476" slineno="5-67" level="2"><display>(b)</display>accept applications for no fewer than 30 days during each period described in <ln numlevel="1" lineno="477" slineno="5-68"/>Subsection <xref depth="4" refnumber="53B-8-117(6)(a)">(6)(a)</xref>.</subsection></subsection><subsection ssid="10-null-45" dnum="7-o" numlevel="1" lineno="478" slineno="5-69" level="1" space="false"><display>(7)</display><subsection ssid="10-null-46" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board shall make rules in accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah <ln numlevel="1" lineno="479" slineno="5-70"/>Administrative Rulemaking Act, to:<subsection ssid="10-null-47" dnum="i-o" numlevel="1" lineno="480" slineno="5-71" level="3" tab="1"><display>(i)</display>set deadlines for receiving grant applications and supporting documentation; and</subsection><subsection ssid="10-null-48" dnum="ii-o" numlevel="1" lineno="481" slineno="5-72" level="3" tab="1"><display>(ii)</display>establish the application process and an appeal process for the First Responder <ln numlevel="1" lineno="482" slineno="5-73"/>Mental Health Services Grant Program.</subsection></subsection><subsection ssid="10-null-49" dnum="b-o" numlevel="1" lineno="483" slineno="5-74" level="2"><display>(b)</display>The board shall include a disclosure on all applications and related materials that the <ln numlevel="1" lineno="484" slineno="5-75"/>amount of the awarded grants may be subject to funding or be reduced, in accordance <ln numlevel="1" lineno="485" slineno="5-76"/>with Subsection <xref depth="4" refnumber="53B-8-117(8)">(8)</xref>.</subsection></subsection><subsection ssid="10-null-50" dnum="8-o" numlevel="1" lineno="486" slineno="5-77" level="1" space="false"><display>(8)</display><subsection ssid="10-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to future budget constraints, the Legislature shall make an annual <ln numlevel="1" lineno="487" slineno="5-78"/>appropriation from the Income Tax Fund to the board for the costs associated with <ln numlevel="1" lineno="488" slineno="5-79"/>the First Responder Mental Health Services Grant Program authorized under this <ln numlevel="1" lineno="489" slineno="5-80"/>section.</subsection><subsection ssid="10-null-52" dnum="b-o" numlevel="1" lineno="490" slineno="5-81" level="2"><display>(b)</display>Notwithstanding the provisions of this section, if the appropriation under this section <ln numlevel="1" lineno="491" slineno="5-82"/>is insufficient to cover the costs associated with the First Responder Mental Health <ln numlevel="1" lineno="492" slineno="5-83"/>Services Grant Program, the board may:<subsection ssid="10-null-53" dnum="i-o" numlevel="1" lineno="493" slineno="5-84" level="3"><display>(i)</display>reduce the amount of a grant; or</subsection><subsection ssid="10-null-54" dnum="ii-o" numlevel="1" lineno="494" slineno="5-85" level="3"><display>(ii)</display>distribute grants on a pro rata basis to all eligible applicants who submitted a <ln numlevel="1" lineno="495" slineno="5-86"/>complete application before the application deadline.</subsection></subsection></subsection></section></bsec><bsec buid="8" num="78B-4-501" type="amend" src="code" uid="C78B-4-S501_2026050620260506" sort="78B04 05010020260506" numlevel="1" lineno="496" slineno="6-1" sn="6"><section number="78B-4-501" numlevel="1" lineno="497" slineno="6-2" type="amend"><secline lineno="496">Section 6. Section <bold>78B-4-501</bold> is amended to read:</secline><catline lineno="497"><bold>78B-4-501<parens/>. Good Samaritan Law.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="498" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="499" slineno="6-4" level="2"><display>(a)</display>"Child" means an individual of such an age that a reasonable person would perceive <ln numlevel="1" lineno="500" slineno="6-5"/>the individual as unable to open the door of a locked motor vehicle, but in any case <ln numlevel="1" lineno="501" slineno="6-6"/>younger than 18 years<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="ahaskell" level="1" deltag="both"> of age</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true"> old</amend>.</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="502" slineno="6-7" level="2"><display>(b)</display>"Emergency" means an unexpected occurrence involving injury, threat of injury, or <ln numlevel="1" lineno="503" slineno="6-8"/>illness to a person or the public, including motor vehicle accidents, disasters, actual <ln numlevel="1" lineno="504" slineno="6-9"/>or threatened discharges, removal or disposal of hazardous materials, and other <ln numlevel="1" lineno="505" slineno="6-10"/>accidents or events of a similar nature.</subsection><subsection ssid="8-null-4" dnum="c-o" numlevel="1" lineno="506" slineno="6-11" level="2"><display>(c)</display>"Emergency care" includes actual assistance or advice offered to avoid, mitigate, or <ln numlevel="1" lineno="507" slineno="6-12"/>attempt to mitigate the effects of an emergency.</subsection><subsection ssid="8-null-5" dnum="d-o" numlevel="1" lineno="508" slineno="6-13" level="2"><display>(d)</display>"First responder" means a state or local:<subsection ssid="8-null-6" dnum="i-o" numlevel="1" lineno="509" slineno="6-14" level="3"><display>(i)</display>law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>;</subsection><subsection ssid="8-null-7" dnum="ii-o" numlevel="1" lineno="510" slineno="6-15" level="3"><display>(ii)</display>firefighter, as defined in Section <xref depth="3" refnumber="34A-3-113" start="0">34A-3-113</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="8-null-8" dnum="iii-o" numlevel="1" lineno="511" slineno="6-16" level="3"><display>(iii)</display>emergency medical service provider, as defined in Section <xref depth="3" refnumber="53-2d-101" start="0">53-2d-101</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="8-25" dnum="_-o:iv-i" numlevel="1" lineno="512" slineno="6-17" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1280" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">animal control officer, as defined in Section <xref depth="3" refnumber="11-46-102">11-46-102</xref>.</amend></subsection></subsection><subsection ssid="8-null-9" dnum="e-o" numlevel="1" lineno="513" slineno="6-18" level="2"><display>(e)</display>"Motor vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection></subsection><subsection ssid="8-null-10" dnum="2-o" numlevel="1" lineno="514" slineno="6-19" level="1"><display>(2)</display>A person who renders emergency care at or near the scene of, or during, an emergency, <ln numlevel="1" lineno="515" slineno="6-20"/>gratuitously and in good faith, is not liable for any civil damages or penalties as a result <ln numlevel="1" lineno="516" slineno="6-21"/>of any act or omission by the person rendering the emergency care, unless the person is <ln numlevel="1" lineno="517" slineno="6-22"/>grossly negligent or caused the emergency.</subsection><subsection ssid="8-null-11" dnum="3-o" numlevel="1" lineno="518" slineno="6-23" level="1" space="false"><display>(3)</display><subsection ssid="8-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person who gratuitously, and in good faith, assists a governmental agency or <ln numlevel="1" lineno="519" slineno="6-24"/>political subdivision in an activity described in Subsections <xref depth="4" refnumber="78B-4-501(3)(a)(i)" start="0">(3)(a)(i)</xref> through <xref depth="4" refnumber="78B-4-501(3)(a)(iii)" start="0">(iii)</xref> is <ln numlevel="1" lineno="520" slineno="6-25"/>not liable for any civil damages or penalties as a result of any act or omission, unless <ln numlevel="1" lineno="521" slineno="6-26"/>the person rendering assistance is grossly negligent in:<subsection ssid="8-null-13" dnum="i-o" numlevel="1" lineno="522" slineno="6-27" level="3" tab="1"><display>(i)</display>implementing measures to control the causes of epidemic and communicable <ln numlevel="1" lineno="523" slineno="6-28"/>diseases and other conditions significantly affecting the public health, or <ln numlevel="1" lineno="524" slineno="6-29"/>necessary to protect the public health as set out in <xref depth="1" refnumber="26A-1" start="0">Title 26A, Chapter 1, Local <ln numlevel="1" lineno="525" slineno="6-30"/>Health Departments</xref>;</subsection><subsection ssid="8-null-14" dnum="ii-o" numlevel="1" lineno="526" slineno="6-31" level="3" tab="1"><display>(ii)</display>investigating and controlling suspected bioterrorism and disease as set out in <xref depth="2" refnumber="26B-7-3" start="1">Title <ln numlevel="1" lineno="527" slineno="6-32"/>26B, Chapter 7, Part 3, Treatment, Isolation, and Quarantine Procedures for <ln numlevel="1" lineno="528" slineno="6-33"/>Communicable Diseases</xref>; and</subsection><subsection ssid="8-null-15" dnum="iii-o" numlevel="1" lineno="529" slineno="6-34" level="3" tab="1"><display>(iii)</display>responding to a national, state, or local emergency, a public health emergency as <ln numlevel="1" lineno="530" slineno="6-35"/>defined in Section <xref depth="3" refnumber="26B-7-301" start="0">26B-7-301</xref>, or a declaration by the president of the United <ln numlevel="1" lineno="531" slineno="6-36"/>States or other federal official requesting public health-related activities.</subsection></subsection><subsection ssid="8-null-16" dnum="b-o" numlevel="1" lineno="532" slineno="6-37" level="2"><display>(b)</display>The immunity in this Subsection <xref depth="4" refnumber="78B-4-501(3)" start="0">(3)</xref> is in addition to any immunity or protection in <ln numlevel="1" lineno="533" slineno="6-38"/>state or federal law that may apply.</subsection></subsection><subsection ssid="8-null-17" dnum="4-o" numlevel="1" lineno="534" slineno="6-39" level="1" space="false"><display>(4)</display><subsection ssid="8-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person who uses reasonable force to enter a locked and unattended motor <ln numlevel="1" lineno="535" slineno="6-40"/>vehicle to remove a confined child is not liable for damages in a civil action if all of <ln numlevel="1" lineno="536" slineno="6-41"/>the following apply:<subsection ssid="8-null-19" dnum="i-o" numlevel="1" lineno="537" slineno="6-42" level="3" tab="1"><display>(i)</display>the person has a good faith belief that the confined child is in imminent danger of <ln numlevel="1" lineno="538" slineno="6-43"/>suffering physical injury or death unless the confined child is removed from the <ln numlevel="1" lineno="539" slineno="6-44"/>motor vehicle;</subsection><subsection ssid="8-null-20" dnum="ii-o" numlevel="1" lineno="540" slineno="6-45" level="3" tab="1"><display>(ii)</display>the person determines that the motor vehicle is locked and there is no reasonable <ln numlevel="1" lineno="541" slineno="6-46"/>manner in which the person can remove the confined child from the motor vehicle;</subsection><subsection ssid="8-null-21" dnum="iii-o" numlevel="1" lineno="542" slineno="6-47" level="3" tab="1"><display>(iii)</display>before entering the motor vehicle, the person notifies a first responder of the <ln numlevel="1" lineno="543" slineno="6-48"/>confined child;</subsection><subsection ssid="8-null-22" dnum="iv-o" numlevel="1" lineno="544" slineno="6-49" level="3" tab="1"><display>(iv)</display>the person does not use more force than is necessary under the circumstances to <ln numlevel="1" lineno="545" slineno="6-50"/>enter the motor vehicle and remove the confined child from the vehicle; and</subsection><subsection ssid="8-null-23" dnum="v-o" numlevel="1" lineno="546" slineno="6-51" level="3" tab="1"><display>(v)</display>the person remains with the child until a first responder arrives at the motor <ln numlevel="1" lineno="547" slineno="6-52"/>vehicle.</subsection></subsection><subsection ssid="8-null-24" dnum="b-o" numlevel="1" lineno="548" slineno="6-53" level="2"><display>(b)</display>A person is not immune from civil liability under this Subsection <xref depth="4" refnumber="78B-4-501(4)" start="0">(4)</xref> if the person <ln numlevel="1" lineno="549" slineno="6-54"/>fails to abide by any of the provisions of Subsection <xref depth="4" refnumber="78B-4-501(4)(a)" start="0">(4)(a)</xref> or commits any <ln numlevel="1" lineno="550" slineno="6-55"/>unnecessary or malicious damage to the motor vehicle.</subsection></subsection></section></bsec><bsec buid="23" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="551" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="551">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="552"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-7-26 3:10 PM</tm></rev></foot></leg>
