Riebe</sponsorhead><otherSponsorhead>House Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses the defense of justification when using force in defense of person or <ln numlevel="1" lineno="6" slineno="0-6"/>property.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">amends the defense of justification when using force in defense of person or property to <ln numlevel="1" lineno="10" slineno="0-10"/>remove the actor's ability to claim the defense if the actor is charged with recklessly, or <ln numlevel="1" lineno="11" slineno="0-11"/>with criminal negligence, causing an injury to, or the death of, an innocent individual <ln numlevel="1" lineno="12" slineno="0-12"/>while using force that would otherwise be justified against a different individual;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">amends the pretrial justification hearing procedures to deny the hearing to defendant who <ln numlevel="1" lineno="14" slineno="0-14"/>is charged with recklessly, or with criminal negligence, causing an injury to, or the death <ln numlevel="1" lineno="15" slineno="0-15"/>of, another individual while using force the defendant alleges was justified against a <ln numlevel="1" lineno="16" slineno="0-16"/>different individual; and</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="18" slineno="0-18" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="19">None</moniNone><oc numlevel="1" lineno="20" slineno="0-20">Other Special Clauses:</oc><ocNone lineno="21">None</ocNone><sa numlevel="1" lineno="22" slineno="0-22">Utah Code Sections Affected:<saamd numlevel="1" lineno="23" slineno="0-23"><snhead>AMENDS:</snhead><sn num="76-2-309" src="code" uid="C76-2-S309_2026050620260506" buid="3" sort="76 02 03090020260506" numlevel="1" lineno="24" slineno="0-24"><bold>76-2-309</bold>, as enacted by Laws of Utah 2021, Chapter 147</sn><sn num="76-2-401" src="code" uid="C76-2-S401_2026050620260506" buid="1" sort="76 02 04010020260506" numlevel="1" lineno="25" slineno="0-25"><bold>76-2-401</bold>, as last amended by Laws of Utah 2025, Chapter 284</sn></saamd></sa></lt><enacthead lineno="26"/><enact numlevel="1" lineno="27" slineno="0-27">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="3" num="76-2-309" type="amend" src="code" uid="C76-2-S309_2026050620260506" sort="76 02 03090020260506" numlevel="1" lineno="28" slineno="1-1" sn="1"><section number="76-2-309" numlevel="1" lineno="29" slineno="1-2" type="amend"><secline lineno="28">Section 1. Section <bold>76-2-309</bold> is amended to read:</secline><catline lineno="29"><bold>76-2-309<parens/>. Justified use of force.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>An individual who uses or threatens to use force as permitted in Section <xref depth="3" refnumber="76-2-402" start="0">76-2-402</xref>, <xref depth="3" refnumber="76-2-404" start="0"><ln numlevel="1" lineno="31" slineno="1-4"/>76-2-404</xref>, <xref depth="3" refnumber="76-2-405" start="0">76-2-405</xref>, <xref depth="3" refnumber="76-2-406" start="0">76-2-406</xref>, <amend anum="0" ea="amend" pairid="43" groupid="37" style="1" owner="ahaskell" level="1" amendtag="both">or </amend><xref depth="3" refnumber="76-2-407" start="0">76-2-407</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="38" style="2" owner="ahaskell" level="1" deltag="both">, or <xref depth="3" refnumber="76-2-408" start="0">76-2-408</xref></amend><amendoutend style="2"/> is justified in that conduct.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="32" slineno="1-5" level="1"><display>(2)</display>The pretrial justification hearing process described in Subsections <xref depth="4" refnumber="76-2-309(3)(a)" start="0">(3)(a)</xref> and <xref depth="4" refnumber="76-2-309(3)(b)" start="0">(b)</xref> does <ln numlevel="1" lineno="33" slineno="1-6"/>not apply if:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="34" slineno="1-7" level="2" space="false"><display>(a)</display><subsection ssid="3-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the individual against whom force was used or threatened is a law enforcement <ln numlevel="1" lineno="35" slineno="1-8"/>officer, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>;</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="36" slineno="1-9" level="3"><display>(ii)</display>the officer was acting lawfully in the performance of the officer's official duties; <ln numlevel="1" lineno="37" slineno="1-10"/>and</subsection><subsection ssid="3-null-6" dnum="iii-o" numlevel="1" lineno="38" slineno="1-11" level="3" space="false"><display>(iii)</display><subsection ssid="3-null-7" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the officer was identified as an officer by the officer in accordance with <ln numlevel="1" lineno="39" slineno="1-12"/>applicable law; or</subsection><subsection ssid="3-null-8" dnum="B-o" numlevel="1" lineno="40" slineno="1-13" level="4"><display>(B)</display>the individual using or threatening to use force knew or reasonably should <ln numlevel="1" lineno="41" slineno="1-14"/>have known that the officer was a law enforcement officer;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="39" style="2" owner="ahaskell" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="3-null-9" dnum="b-o" numlevel="1" lineno="42" slineno="1-15" level="2"><display>(b)</display>the charge filed against the defendant for which the defendant seeks a pretrial <ln numlevel="1" lineno="43" slineno="1-16"/>justification hearing is an infraction, a class B or C misdemeanor, or a domestic <ln numlevel="1" lineno="44" slineno="1-17"/>violence offense as defined in Section <xref depth="3" refnumber="77-36-1" start="0">77-36-1</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="47" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="45" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="3-44" dnum="_-o:c-i" numlevel="1" lineno="45" slineno="1-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">the defendant is charged with recklessly, or with criminal negligence, injuring, or <ln numlevel="1" lineno="46" slineno="1-19"/>causing the death of, another individual while using force the defendant alleges was <ln numlevel="1" lineno="47" slineno="1-20"/>justified against a different individual.</amend></subsection></subsection><subsection ssid="3-null-10" dnum="3-o" numlevel="1" lineno="48" slineno="1-21" level="1" space="false"><display>(3)</display><subsection ssid="3-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon motion of the defendant filed in accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="50" style="2" owner="ahaskell" level="1" deltag="both">Rule 12 of the </amend><amendoutend style="2"/>Utah <ln numlevel="1" lineno="49" slineno="1-22"/>Rules of Criminal Procedure,<amend anum="0" ea="amend" pairid="56" groupid="49" style="1" owner="ahaskell" level="1" amendtag="both"> Rule 12,</amend> the court shall hear evidence on the issue of <ln numlevel="1" lineno="50" slineno="1-23"/>justification under this section and shall determine as a matter of fact and law <ln numlevel="1" lineno="51" slineno="1-24"/>whether the defendant was justified in the use or threatened use of force.</subsection><subsection ssid="3-null-12" dnum="b-o" numlevel="1" lineno="52" slineno="1-25" level="2"><display>(b)</display>At the pretrial justification hearing, after the defendant makes a prima facie claim of <ln numlevel="1" lineno="53" slineno="1-26"/>justification, the state has the burden to prove by clear and convincing evidence that <ln numlevel="1" lineno="54" slineno="1-27"/>the defendant's use or threatened use of force was not justified.</subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="55" slineno="1-28" level="2" space="false"><display>(c)</display><subsection ssid="3-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the court determines that the state has not met the state's burden described in <ln numlevel="1" lineno="56" slineno="1-29"/>Subsection <xref depth="4" refnumber="76-2-309(3)(b)" start="0">(3)(b)</xref>, the court shall dismiss the charge with prejudice.</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="57" slineno="1-30" level="3"><display>(ii)</display>The state may appeal a court's order dismissing a charge under Subsection <xref depth="4" refnumber="76-2-309(3)(c)(i)" start="0"><ln numlevel="1" lineno="58" slineno="1-31"/>(3)(c)(i)</xref> in accordance with Section <xref depth="3" refnumber="77-18a-1" start="0">77-18a-1</xref>.</subsection><subsection ssid="3-null-16" dnum="iii-o" numlevel="1" lineno="59" slineno="1-32" level="3"><display>(iii)</display>If a court determines after the pretrial justification hearing that the state has met <ln numlevel="1" lineno="60" slineno="1-33"/>the state's burden described in Subsection <xref depth="4" refnumber="76-2-309(3)(b)" start="0">(3)(b)</xref>, the issue of justification may be <ln numlevel="1" lineno="61" slineno="1-34"/>raised by the defendant to the jury at trial and, if raised by the defendant, the state <ln numlevel="1" lineno="62" slineno="1-35"/>shall have the burden to prove beyond a reasonable doubt that the defendant's use <ln numlevel="1" lineno="63" slineno="1-36"/>or threatened use of force was not justified.</subsection><subsection ssid="3-null-17" dnum="iv-o" numlevel="1" lineno="64" slineno="1-37" level="3"><display>(iv)</display>At trial, a court's determination that the state met the state's burden under <ln numlevel="1" lineno="65" slineno="1-38"/>Subsection <xref depth="4" refnumber="76-2-309(3)(c)(iii)" start="0">(3)(c)(iii)</xref> is not admissible and may not be referenced by the <ln numlevel="1" lineno="66" slineno="1-39"/>prosecution.</subsection></subsection></subsection></section></bsec><bsec buid="1" num="76-2-401" type="amend" src="code" uid="C76-2-S401_2026050620260506" sort="76 02 04010020260506" numlevel="1" lineno="67" slineno="2-1" sn="2"><section number="76-2-401" numlevel="1" lineno="68" slineno="2-2" type="amend"><secline lineno="67">Section 2. Section <bold>76-2-401</bold> is amended to read:</secline><catline lineno="68"><bold>76-2-401<parens/>. Justification as defense -- When allowed.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="69" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Conduct <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="60" style="2" owner="ahaskell" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="58" style="1" owner="ahaskell" level="1" amendtag="both" space="true">that</amend> is justified is a defense to prosecution for any offense based on the <ln numlevel="1" lineno="70" slineno="2-4"/>conduct<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="50" style="2" owner="ahaskell" level="1" deltag="both">.  The defense of justification</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="46" style="1" owner="ahaskell" level="1" amendtag="both" space="true"> and</amend> may be claimed:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="71" slineno="2-5" level="2"><display>(a)</display>when the actor's conduct is in defense of persons or property under the circumstances <ln numlevel="1" lineno="72" slineno="2-6"/>described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="61" style="2" owner="ahaskell" level="1" deltag="both">Sections</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="59" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Section</amend> <xref depth="3" refnumber="76-2-402" start="0">76-2-402</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="64" style="2" owner="ahaskell" level="1" deltag="both"> through <xref depth="3" refnumber="76-2-406" start="0">76-2-406</xref> of this part</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="57" style="1" owner="ahaskell" level="1" amendtag="both" space="true">, <xref depth="3" refnumber="76-2-403">76-2-403</xref>, <xref depth="3" refnumber="76-2-404"><ln numlevel="1" lineno="73" slineno="2-7"/>76-2-404</xref>, <xref depth="3" refnumber="76-2-405">76-2-405</xref>, <xref depth="3" refnumber="76-2-406">76-2-406</xref>, or <xref depth="3" refnumber="76-2-407">76-2-407</xref></amend>;</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="74" slineno="2-8" level="2"><display>(b)</display>when the actor's conduct is reasonable and in fulfillment of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="67" style="2" owner="ahaskell" level="1" deltag="both">his</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="73" groupid="63" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the actor's</amend> duties as a <ln numlevel="1" lineno="75" slineno="2-9"/>governmental officer or employee;</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="76" slineno="2-10" level="2"><display>(c)</display>when the actor's conduct is reasonable discipline of minors by parents, guardians, <ln numlevel="1" lineno="77" slineno="2-11"/>teachers, or other persons in loco parentis, as limited by Subsection <xref depth="4" refnumber="76-2-401(2)" start="0">(2)</xref>;</subsection><subsection ssid="1-null-5" dnum="d-o" numlevel="1" lineno="78" slineno="2-12" level="2"><display>(d)</display>when the actor's conduct is reasonable discipline of persons in custody under the <ln numlevel="1" lineno="79" slineno="2-13"/>laws of the state; or</subsection><subsection ssid="1-null-6" dnum="e-o" numlevel="1" lineno="80" slineno="2-14" level="2"><display>(e)</display>when the actor's conduct is justified for any other reason under the laws of this state.</subsection></subsection><subsection ssid="1-null-7" dnum="2-o" numlevel="1" lineno="81" slineno="2-15" level="1"><display>(2)</display>The defense of justification<amend anum="0" ea="amend" pairid="38" groupid="31" style="1" owner="ahaskell" level="1" amendtag="both"> is not available</amend> under<amend anum="0" ea="amend" pairid="44" groupid="36" style="1" owner="ahaskell" level="1" amendtag="both">:</amend><subsection ssid="1-15" dnum="_-o:a-i" numlevel="1" lineno="82" slineno="2-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">Subsection <xref depth="4" refnumber="76-2-401(1)(a)">(1)(a)</xref> when an actor is justified in using force against an individual under <ln numlevel="1" lineno="83" slineno="2-17"/>Section <xref depth="3" refnumber="76-2-402">76-2-402</xref>, <xref depth="3" refnumber="76-2-403">76-2-403</xref>, <xref depth="3" refnumber="76-2-404">76-2-404</xref>, <xref depth="3" refnumber="76-2-405">76-2-405</xref>, <xref depth="3" refnumber="76-2-406">76-2-406</xref>, or <xref depth="3" refnumber="76-2-407">76-2-407</xref>, but is <ln numlevel="1" lineno="84" slineno="2-18"/>charged with an offense involving recklessly, or with criminal negligence, causing an <ln numlevel="1" lineno="85" slineno="2-19"/>injury to, or the death of, another individual;
