and </hl><hl numlevel="1" lineno="13" slineno="0-13" level="2">the individuals marrying are not located in the same location in the state when the <ln numlevel="1" lineno="14" slineno="0-14"/>marriage is solemnized;</hl></hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">provides that a marriage that is not properly solemnized is invalid unless a court or <ln numlevel="1" lineno="16" slineno="0-16"/>administrative order legally recognized the marriage before May 6, 2026; Section <bold>81-2-302</bold> is amended to read:</secline><catline lineno="33"><bold>81-2-302<parens/>. Marriage licenses -- Use within state -- Expiration.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>A marriage may not be solemnized in this state without a license issued by the county <ln numlevel="1" lineno="35" slineno="1-4"/>clerk of any county of this state.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="36" slineno="1-5" level="1" space="false"><display>(2)</display><subsection ssid="5-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A license issued within this state by a county clerk may only be used within this <ln numlevel="1" lineno="37" slineno="1-6"/>state.</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="38" slineno="1-7" level="2"><display>(b)</display>A license is considered used within this state if the officiant <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">and at least one of the <ln numlevel="1" lineno="39" slineno="1-8"/>parties to the marriage </amend>is physically present in the state at the time of solemnization <ln numlevel="1" lineno="40" slineno="1-9"/>of the marriage.</subsection></subsection><subsection ssid="5-null-5" dnum="3-o" numlevel="1" lineno="41" slineno="1-10" level="1"><display>(3)</display>A marriage is considered solemnized if:<subsection ssid="5-null-6" dnum="a-o" numlevel="1" lineno="42" slineno="1-11" level="2"><display>(a)</display>the parties to the marriage have a valid marriage license;</subsection><subsection ssid="5-null-7" dnum="b-o" numlevel="1" lineno="43" slineno="1-12" level="2"><display>(b)</display>each party to the marriage willingly, and without duress, declares their intent to enter <ln numlevel="1" lineno="44" slineno="1-13"/>into the marriage;</subsection><subsection ssid="5-null-8" dnum="c-o" numlevel="1" lineno="45" slineno="1-14" level="2"><display>(c)</display>each party to the marriage has filed all required affidavits with the county clerk that <ln numlevel="1" lineno="46" slineno="1-15"/>issued the marriage license as required under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"><xref tempid="244" depth="4" refnumber="81-2-303(4)(a)">81-2-303(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="81-2-303(5)(a)"><ln numlevel="1" lineno="47" slineno="1-16"/>81-2-303(5)(a)</xref></amend>;</subsection><subsection ssid="5-null-9" dnum="d-o" numlevel="1" lineno="48" slineno="1-17" level="2"><display>(d)</display>an officiant pronounces the parties as married; and</subsection><subsection ssid="5-null-10" dnum="e-o" numlevel="1" lineno="49" slineno="1-18" level="2"><display>(e)</display>at least two individuals 18 years old or older witness the declarations of intent and <ln numlevel="1" lineno="50" slineno="1-19"/>the pronouncement.</subsection></subsection><subsection ssid="5-null-11" dnum="4-o" numlevel="1" lineno="51" slineno="1-20" level="1"><display>(4)</display>A license that is not used within 32 days after the day on which the license is issued is <ln numlevel="1" lineno="52" slineno="1-21"/>invalid.</subsection></section></bsec><bsec buid="7" num="81-2-303" type="amend" src="code" uid="C81-2-S303_2026050620260506" sort="81 02 03030020260506" numlevel="1" lineno="53" slineno="2-1" sn="2"><section number="81-2-303" numlevel="1" lineno="54" slineno="2-2" type="amend"><secline lineno="53">Section 2. Section <bold>81-2-303</bold> is amended to read:</secline><catline lineno="54"><bold>81-2-303<parens/>. Application for marriage license -- Contents.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="55" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>A county clerk may issue a marriage license only after<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> </amend><subsection ssid="7-null-2" dnum="a-o:_-i" numlevel="1" lineno="56" slineno="2-4" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>an application is filed with the county clerk's office, requiring the following <ln numlevel="1" lineno="57" slineno="2-5"/>information:<subsection ssid="7-null-3" dnum="i-o:a-i" numlevel="1" lineno="58" slineno="2-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>the full names of the applicants, including the maiden or bachelor name of each <ln numlevel="1" lineno="59" slineno="2-7"/>applicant;</subsection><subsection ssid="7-null-4" dnum="ii-o:b-i" numlevel="1" lineno="60" slineno="2-8" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>the social security numbers of the applicants, unless an applicant has not been <ln numlevel="1" lineno="61" slineno="2-9"/>assigned a number;</subsection><subsection ssid="7-null-5" dnum="iii-o:c-i" numlevel="1" lineno="62" slineno="2-10" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>the current address of each applicant;</subsection><subsection ssid="7-null-6" dnum="iv-o:d-i" numlevel="1" lineno="63" slineno="2-11" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>the date and place of birth, including the town or city, county, state or country, <ln numlevel="1" lineno="64" slineno="2-12"/>if possible;</subsection><subsection ssid="7-null-7" dnum="v-o:e-i" numlevel="1" lineno="65" slineno="2-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>the names of the applicants' respective parents, including the maiden name of a <ln numlevel="1" lineno="66" slineno="2-14"/>mother;</subsection><subsection ssid="7-null-8" dnum="vi-o:f-i" numlevel="1" lineno="67" slineno="2-15" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>the birthplaces of the applicants' respective parents, including the town or city, <ln numlevel="1" lineno="68" slineno="2-16"/>county, state or country, if possible; and</subsection><subsection ssid="7-null-9" dnum="vii-o:g-i" numlevel="1" lineno="69" slineno="2-17" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>the age, legal name, and identity of each applicant is verified.</subsection></subsection></subsection><subsection ssid="7-null-10" dnum="2-o" numlevel="1" lineno="70" slineno="2-18" level="1"><display>(2)</display>A power of attorney may not be used to secure a marriage license on behalf of a party to <ln numlevel="1" lineno="71" slineno="2-19"/>a marriage.</subsection><subsection ssid="7-null-11" dnum="3-o" numlevel="1" lineno="72" slineno="2-20" level="1" space="false"><display>(3)</display><subsection ssid="7-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If one or both of the applicants is a minor, the county clerk shall provide each <ln numlevel="1" lineno="73" slineno="2-21"/>minor with a standard petition on a form provided by the Judicial Council to be <ln numlevel="1" lineno="74" slineno="2-22"/>presented to the juvenile court to obtain the authorization required by Section <xref depth="3" refnumber="81-2-304"><ln numlevel="1" lineno="75" slineno="2-23"/>81-2-304</xref>.</subsection><subsection ssid="7-null-13" dnum="b-o" numlevel="1" lineno="76" slineno="2-24" level="2"><display>(b)</display>The form described in Subsection <xref depth="4" refnumber="81-2-303(3)(a)">(3)(a)</xref> shall include:<subsection ssid="7-null-14" dnum="i-o" numlevel="1" lineno="77" slineno="2-25" level="3"><display>(i)</display>all information described in Subsection <xref depth="4" refnumber="81-2-303(1)">(1)</xref>;</subsection><subsection ssid="7-null-15" dnum="ii-o" numlevel="1" lineno="78" slineno="2-26" level="3"><display>(ii)</display>a place for the parent or legal guardian to indicate the parent or legal guardian's <ln numlevel="1" lineno="79" slineno="2-27"/>relationship to the minor in accordance with Subsection <xref depth="4" refnumber="81-2-304(1)(a)">81-2-304(1)(a)</xref>;</subsection><subsection ssid="7-null-16" dnum="iii-o" numlevel="1" lineno="80" slineno="2-28" level="3"><display>(iii)</display>an affidavit for the parent or legal guardian to acknowledge the penalty described <ln numlevel="1" lineno="81" slineno="2-29"/>in Section <xref depth="3" refnumber="81-2-304">81-2-304</xref> signed under penalty of perjury;</subsection><subsection ssid="7-null-17" dnum="iv-o" numlevel="1" lineno="82" slineno="2-30" level="3"><display>(iv)</display>an affidavit for each applicant regarding the accuracy of the information <ln numlevel="1" lineno="83" slineno="2-31"/>contained in the marriage application signed under penalty of perjury; and</subsection><subsection ssid="7-null-18" dnum="v-o" numlevel="1" lineno="84" slineno="2-32" level="3"><display>(v)</display>a place for the clerk to sign that indicates that the following have provided <ln numlevel="1" lineno="85" slineno="2-33"/>documentation to support the information contained in the form:<subsection ssid="7-null-19" dnum="A-o" numlevel="1" lineno="86" slineno="2-34" level="4"><display>(A)</display>each applicant; and</subsection><subsection ssid="7-null-20" dnum="B-o" numlevel="1" lineno="87" slineno="2-35" level="4"><display>(B)</display>the minor's parent or legal guardian.</subsection></subsection></subsection></subsection><subsection ssid="7-null-21" dnum="4-o" numlevel="1" lineno="88" slineno="2-36" level="1" space="false"><display>(4)</display><subsection ssid="7-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The social security numbers obtained under the authority of this section may not <ln numlevel="1" lineno="89" slineno="2-37"/>be recorded on the marriage license and are not open to inspection as a part of the <ln numlevel="1" lineno="90" slineno="2-38"/>vital statistics files.</subsection><subsection ssid="7-null-23" dnum="b-o" numlevel="1" lineno="91" slineno="2-39" level="2"><display>(b)</display>The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">Department of Health and Human Services, </amend><amendoutend style="2"/>Office of Vital Record<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">s</amend> and <ln numlevel="1" lineno="92" slineno="2-40"/>Statistics shall, upon request, supply the social security numbers to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">Department <ln numlevel="1" lineno="93" slineno="2-41"/>of Health and Human Services, </amend><amendoutend style="2"/>Office of Recovery Services.</subsection><subsection ssid="7-null-24" dnum="c-o" numlevel="1" lineno="94" slineno="2-42" level="2"><display>(c)</display>The Office of Recovery Services may not use a social security number obtained <ln numlevel="1" lineno="95" slineno="2-43"/>under the authority of this section for any reason other than the administration of <ln numlevel="1" lineno="96" slineno="2-44"/>child support services.</subsection></subsection><subsection ssid="7-null-25" dnum="5-o" numlevel="1" lineno="97" slineno="2-45" level="1" space="false"><display>(5)</display><subsection ssid="7-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county clerk may not issue a marriage license until the county clerk receives:<subsection ssid="7-null-27" dnum="i-o" numlevel="1" lineno="98" slineno="2-46" level="3" tab="1"><display>(i)</display>an affidavit from each party applying for the marriage license, stating that there is <ln numlevel="1" lineno="99" slineno="2-47"/>no lawful reason preventing the marriage; and</subsection><subsection ssid="7-null-28" dnum="ii-o" numlevel="1" lineno="100" slineno="2-48" level="3" tab="1"><display>(ii)</display>if one of the parties will not be physically present in the state at the time of <ln numlevel="1" lineno="101" slineno="2-49"/>solemnization of the marriage, an affidavit from each party applying for the <ln numlevel="1" lineno="102" slineno="2-50"/>marriage license, stating that the party consents to personal jurisdiction of the <ln numlevel="1" lineno="103" slineno="2-51"/>state, and of the county issuing the marriage license, for the purposes of filing a <ln numlevel="1" lineno="104" slineno="2-52"/>divorce or annulment of the marriage. </subsection></subsection><subsection ssid="7-null-29" dnum="b-o" numlevel="1" lineno="105" slineno="2-53" level="2"><display>(b)</display>A county clerk shall file and preserve each affidavit provided under this section.</subsection><subsection ssid="7-null-30" dnum="c-o" numlevel="1" lineno="106" slineno="2-54" level="2"><display>(c)</display>A party who makes an affidavit described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="81-2-303(5)(a)">(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(a)</amend>, or a <ln numlevel="1" lineno="107" slineno="2-55"/>subscribing witness to the affidavit, who falsely swears in the affidavit is guilty of <ln numlevel="1" lineno="108" slineno="2-56"/>perjury and may be prosecuted and punished as provided in Title 76, Chapter 8, Part <ln numlevel="1" lineno="109" slineno="2-57"/>5, Falsification in Official Matters.</subsection></subsection><subsection ssid="7-null-31" dnum="6-o" numlevel="1" lineno="110" slineno="2-58" level="1"><display>(6)</display>A county clerk who knowingly issues a marriage license for any prohibited marriage is <ln numlevel="1" lineno="111" slineno="2-59"/>guilty of a class A misdemeanor.</subsection></section></bsec><bsec buid="3" num="81-2-403" type="amend" src="code" uid="C81-2-S403_2026050620260506" sort="81 02 04030020260506" numlevel="1" lineno="112" slineno="3-1" sn="3"><section number="81-2-403" numlevel="1" lineno="113" slineno="3-2" type="amend"><secline lineno="112">Section 3. Section <bold>81-2-403</bold> is amended to read:</secline><catline lineno="113"><bold>81-2-403<parens/>. Marriages prohibited and void.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="114" slineno="3-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">The following marriages are prohibited and declared void:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A marriage is prohibited <ln numlevel="1" lineno="115" slineno="3-4"/>and void if:</amend><subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="116" slineno="3-5" level="2"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both">when </amend><amendoutend style="2"/>there is a spouse living from whom the individual marrying has not been <ln numlevel="1" lineno="117" slineno="3-6"/>divorced;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="118" slineno="3-7" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="81-2-403(2)">(2)</xref>, the individual marrying is under 18 years old;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> <ln numlevel="1" lineno="119" slineno="3-8"/>or</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-4" dnum="c-o:_-i" numlevel="1" lineno="120" slineno="3-9" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="111" groupid="82" style="2" owner="jchristopherson" level="1" deltag="end">between a divorced individual and any individual other than the one from whom the <ln numlevel="1" lineno="121" slineno="3-10"/>divorce was secured until:</amend><amendoutend style="2"/><subsection ssid="3-null-5" dnum="i-o:_-i" numlevel="1" lineno="122" slineno="3-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="115" groupid="86" style="2" owner="jchristopherson" level="1" deltag="end">the divorce decree becomes absolute; or</amend></subsection></subsection></subsection><subsection ssid="3-10" dnum="_-o:d-i" numlevel="1" lineno="128" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection <xref depth="4" refnumber="81-2-403(3)">(3)</xref>:</amend><subsection ssid="3-11" dnum="_-o:i-i" numlevel="1" lineno="129" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the marriage is solemnized remotely through electronic means;</amend></subsection><subsection ssid="3-12" dnum="_-o:ii-i" numlevel="1" lineno="130" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">both of the individuals marrying are not residents of the state; and</amend></subsection><subsection ssid="3-14" dnum="_-o:iii-i" numlevel="1" lineno="131" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">the two individuals marrying are not in the same physical location within the <ln numlevel="1" lineno="132" slineno="3-21"/>state when the marriage is solemnized.</amend></subsection></subsection></subsection><subsection ssid="3-null-7" dnum="2-o" numlevel="1" lineno="133" slineno="3-22" level="1"><display>(2)</display>A marriage of an individual under 18 years old is not void if the individual:<subsection ssid="3-null-8" dnum="a-o" numlevel="1" lineno="134" slineno="3-23" level="2"><display>(a)</display>is 16 or 17 years old and obtains consent from a parent or guardian and juvenile court <ln numlevel="1" lineno="135" slineno="3-24"/>authorization in accordance with Section <xref depth="3" refnumber="81-2-304">81-2-304</xref>; or</subsection><subsection ssid="3-null-9" dnum="b-o" numlevel="1" lineno="136" slineno="3-25" level="2"><display>(b)</display>lawfully marries before May 14, 2019.</subsection></subsection><subsection ssid="3-15" dnum="_-o:3-i" numlevel="1" lineno="137" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">A marriage described in Subsection <xref depth="4" refnumber="81-2-403(1)(d)">(1)(d)</xref> is not void if the marriage:</amend><subsection ssid="3-16" dnum="_-o:a-i" numlevel="1" lineno="138" slineno="3-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">was solemnized before May 6, 2026; and</amend></subsection><subsection ssid="3-18" dnum="_-o:b-i" numlevel="1" lineno="139" slineno="3-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">is otherwise lawful.</amend></subsection></subsection></section></bsec><bsec buid="1" num="81-2-408" type="repreenact" src="code" uid="C81-2-S408_2026050620260506" sort="81 02 04080020260506" numlevel="1" lineno="140" slineno="4-1" sn="4"><section numlevel="1" lineno="141" slineno="4-2" number="81-2-408" type="repreenact"><secline lineno="140">Section 4. Section <bold>81-2-408</bold> is repealed and reenacted to read:</secline><catline lineno="141"><bold>81-2-408<parens/>. Validity of marriage not solemnized or solemnized before an <ln numlevel="1" lineno="142" slineno="4-3"/>unauthorized individual.</bold></catline><sectionText lineno="143"><para/><amend anum="0" ea="amend" pairid="17" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">A marriage that is not solemnized in accordance with this chapter is invalid unless a <ln numlevel="1" lineno="144" slineno="4-5"/>court or administrative order legally recognized the marriage before May 6, 2026.</amend></sectionText></section></bsec><bsec buid="9" num="81-4-104" type="amend" src="code" uid="C81-4-S104_2026050620260506" sort="81 04 01040020260506" numlevel="1" lineno="145" slineno="5-1" sn="5"><section number="81-4-104" numlevel="1" lineno="146" slineno="5-2" type="amend"><secline lineno="145">Section 5. Section <bold>81-4-104</bold> is amended to read:</secline><catline lineno="146"><bold>81-4-104<parens/>. Temporary separation order.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="147" slineno="5-3" level="1" placement="noreturn"><display>(1)</display> An individual may file an action for a temporary separation order, without filing a <ln numlevel="1" lineno="148" slineno="5-4"/>petition for divorce, by filing a petition for temporary separation and motion for <ln numlevel="1" lineno="149" slineno="5-5"/>temporary orders if:<subsection ssid="9-null-2" dnum="a-o" numlevel="1" lineno="150" slineno="5-6" level="2"><display>(a)</display>the individual is lawfully married to the individual from whom the separation is <ln numlevel="1" lineno="151" slineno="5-7"/>sought; and</subsection><subsection ssid="9-null-3" dnum="b-o" numlevel="1" lineno="152" slineno="5-8" level="2" space="false"><display>(b)</display><subsection ssid="9-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>both parties are residents of the state for at least 90 days before the day on <ln numlevel="1" lineno="153" slineno="5-9"/>which the action is filed; or</subsection><subsection ssid="9-null-5" dnum="ii-o" numlevel="1" lineno="154" slineno="5-10" level="3"><display>(ii)</display>both parties to the marriage have consented to personal jurisdiction for divorce or <ln numlevel="1" lineno="155" slineno="5-11"/>annulment under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="81-2-303(4)(a)(ii)">81-2-303(4)(a)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="81-2-303(5)(a)(ii)">81-2-303(5)(a)(ii)</xref></amend>.</subsection></subsection></subsection><subsection ssid="9-null-6" dnum="2-o" numlevel="1" lineno="156" slineno="5-12" level="1"><display>(2)</display>The temporary orders are valid for one year after the day on which the hearing for the <ln numlevel="1" lineno="157" slineno="5-13"/>order is held or until one of the following occurs:<subsection ssid="9-null-7" dnum="a-o" numlevel="1" lineno="158" slineno="5-14" level="2"><display>(a)</display>a petition for divorce is filed and consolidated with the petition for temporary <ln numlevel="1" lineno="159" slineno="5-15"/>separation; or</subsection><subsection ssid="9-null-8" dnum="b-o" numlevel="1" lineno="160" slineno="5-16" level="2"><display>(b)</display>the case is dismissed.</subsection></subsection><subsection ssid="9-null-9" dnum="3-o" numlevel="1" lineno="161" slineno="5-17" level="1"><display>(3)</display>If a petition for divorce is filed and consolidated with the petition for temporary <ln numlevel="1" lineno="162" slineno="5-18"/>separation, orders entered in the temporary separation shall continue in the consolidated <ln numlevel="1" lineno="163" slineno="5-19"/>case.</subsection><subsection ssid="9-null-10" dnum="4-o" numlevel="1" lineno="164" slineno="5-20" level="1" space="false"><display>(4)</display><subsection ssid="9-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the parties to the temporary separation action have a minor child, the parties <ln numlevel="1" lineno="165" slineno="5-21"/>shall attend the divorce orientation course described in Section <xref depth="3" refnumber="81-4-105">81-4-105</xref>:<subsection ssid="9-null-12" dnum="i-o" numlevel="1" lineno="166" slineno="5-22" level="3" tab="1"><display>(i)</display>for the petitioner, within 60 days after the day on which the petition is filed; and</subsection><subsection ssid="9-null-13" dnum="ii-o" numlevel="1" lineno="167" slineno="5-23" level="3" tab="1"><display>(ii)</display>for the respondent, within 30 days after the day on which the respondent is served.</subsection></subsection><subsection ssid="9-null-14" dnum="b-o" numlevel="1" lineno="168" slineno="5-24" level="2"><display>(b)</display>If the parties to the temporary separation action do not have a minor child, the parties <ln numlevel="1" lineno="169" slineno="5-25"/>may choose to attend the divorce orientation course described in Section <xref depth="3" refnumber="81-4-105">81-4-105</xref>.</subsection><subsection ssid="9-null-15" dnum="c-o" numlevel="1" lineno="170" slineno="5-26" level="2"><display>(c)</display>The clerk of the court shall provide notice to a petitioner of the divorce orientation <ln numlevel="1" lineno="171" slineno="5-27"/>course requirement.</subsection><subsection ssid="9-null-16" dnum="d-o" numlevel="1" lineno="172" slineno="5-28" level="2"><display>(d)</display>A petition shall include information regarding the divorce orientation course <ln numlevel="1" lineno="173" slineno="5-29"/>requirement when the petition is served on the respondent.</subsection></subsection><subsection ssid="9-null-17" dnum="5-o" numlevel="1" lineno="174" slineno="5-30" level="1"><display>(5)</display>For a party that is unable to pay the costs of the divorce orientation course, and before <ln numlevel="1" lineno="175" slineno="5-31"/>the court enters a decree of divorce in the action, the court shall:<subsection ssid="9-null-18" dnum="a-o" numlevel="1" lineno="176" slineno="5-32" level="2"><display>(a)</display>make a final determination of indigency; and</subsection><subsection ssid="9-null-19" dnum="b-o" numlevel="1" lineno="177" slineno="5-33" level="2"><display>(b)</display>order the party to pay the costs of the divorce orientation course if the court <ln numlevel="1" lineno="178" slineno="5-34"/>determines the party is not indigent.</subsection></subsection><subsection ssid="9-null-20" dnum="6-o" numlevel="1" lineno="179" slineno="5-35" level="1" space="false"><display>(6)</display><subsection ssid="9-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except for a temporary restraining order under <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">Rule 65A of the </amend><amendoutend style="2"/>Utah Rules of <ln numlevel="1" lineno="180" slineno="5-36"/>Civil Procedure,<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> Rule 65A,</amend> a party may file, but the court may not hear, a motion for <ln numlevel="1" lineno="181" slineno="5-37"/>an order related to the temporary separation petition until the moving party completes <ln numlevel="1" lineno="182" slineno="5-38"/>the divorce orientation course.</subsection><subsection ssid="9-null-22" dnum="b-o" numlevel="1" lineno="183" slineno="5-39" level="2"><display>(b)</display>It is an affirmative defense in a temporary separation action that a party has not <ln numlevel="1" lineno="184" slineno="5-40"/>completed the divorce orientation course and the action may not continue until a <ln numlevel="1" lineno="185" slineno="5-41"/>party has complied with the divorce orientation course.</subsection></subsection><subsection ssid="9-null-23" dnum="7-o" numlevel="1" lineno="186" slineno="5-42" level="1" space="false"><display>(7)</display><subsection ssid="9-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsections <xref depth="4" refnumber="81-4-104(4)">(4)</xref> and <xref depth="4" refnumber="81-4-104(6)(b)">(6)(b)</xref>, the court may waive the requirement <ln numlevel="1" lineno="187" slineno="5-43"/>that the parties attend the divorce orientation course, on the court's own motion or on <ln numlevel="1" lineno="188" slineno="5-44"/>the motion of one of the parties, if the court determines course attendance and <ln numlevel="1" lineno="189" slineno="5-45"/>completion are not necessary, appropriate, feasible, or in the best interest of the <ln numlevel="1" lineno="190" slineno="5-46"/>parties.</subsection><subsection ssid="9-null-25" dnum="b-o" numlevel="1" lineno="191" slineno="5-47" level="2"><display>(b)</display>If the requirement is waived, the court may permit the temporary separation action to <ln numlevel="1" lineno="192" slineno="5-48"/>proceed.</subsection></subsection><subsection ssid="9-null-26" dnum="8-o" numlevel="1" lineno="193" slineno="5-49" level="1"><display>(8)</display>The petitioner shall serve the petition for a temporary separation order in accordance <ln numlevel="1" lineno="194" slineno="5-50"/>with the Utah Rules of Civil Procedure.</subsection><subsection ssid="9-null-27" dnum="9-o" numlevel="1" lineno="195" slineno="5-51" level="1"><display>(9)</display>If a party files for divorce within one year after the day on which the petition for <ln numlevel="1" lineno="196" slineno="5-52"/>temporary separation is filed, the filing fee for a petition for temporary separation shall <ln numlevel="1" lineno="197" slineno="5-53"/>be credited towards the filing fee for a divorce.</subsection></section></bsec><bsec buid="10" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="198" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="198">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="199"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-22-26 9:36 AM</tm></rev></foot></leg>
