Section <bold>53E-4-409</bold> is enacted to read:</secline><catline lineno="31"><bold>53E-4-409<parens/>. Open educational resources -- Development and implementation.</bold></catline><subsection ssid="7-1" dnum="_-o:1-i" numlevel="1" lineno="32" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="7-2" dnum="_-o:a-i" numlevel="1" lineno="33" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Open educational resources" means teaching, learning, and research materials that <ln numlevel="1" lineno="34" slineno="1-5"/>are in the public domain or released under an open license that permits free use, <ln numlevel="1" lineno="35" slineno="1-6"/>adaptation, and distribution.</amend></subsection><subsection ssid="7-3" dnum="_-o:b-i" numlevel="1" lineno="36" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"Utah core standards" means the standards described in Section <xref depth="3" refnumber="53E-4-202">53E-4-202</xref>.</amend></subsection></subsection><subsection ssid="7-4" dnum="_-o:2-i" numlevel="1" lineno="37" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding any other provision in this part, and subject to legislative <ln numlevel="1" lineno="38" slineno="1-9"/>appropriation, the state board shall:</amend><subsection ssid="7-5" dnum="_-o:a-i" numlevel="1" lineno="39" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">contract with one or more qualified entities to develop comprehensive open <ln numlevel="1" lineno="40" slineno="1-11"/>educational resources for elementary grades that:</amend><subsection ssid="7-6" dnum="_-o:i-i" numlevel="1" lineno="41" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">align with Utah core standards;</amend></subsection><subsection ssid="7-7" dnum="_-o:ii-i" numlevel="1" lineno="42" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">meet the instructional needs of students in kindergarten through grade 8 suitable <ln numlevel="1" lineno="43" slineno="1-14"/>for the age of students at the grade level for which the materials are developed;</amend></subsection><subsection ssid="7-8" dnum="_-o:iii-i" numlevel="1" lineno="44" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">reflect Utah values and priorities;</amend></subsection><subsection ssid="7-9" dnum="_-o:iv-i" numlevel="1" lineno="45" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">provide accessibility to students with disabilities in compliance with federal and <ln numlevel="1" lineno="46" slineno="1-17"/>state law; and</amend></subsection></subsection><subsection ssid="7-18" dnum="_-o:e-i" numlevel="1" lineno="74" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">make the open educational resources available through a centralized digital platform <ln numlevel="1" lineno="75" slineno="1-46"/>accessible to all LEAs and the public.</amend></subsection></subsection><subsection ssid="7-26" dnum="_-o:3-i" numlevel="1" lineno="76" slineno="1-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall ensure that the Instructional Materials Commission does not <ln numlevel="1" lineno="77" slineno="1-48"/>review or approve the open educational resources developed under this section.</amend></subsection><subsection ssid="7-19" dnum="_-o:4-i" numlevel="1" lineno="78" slineno="1-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">In developing open educational resources under this section, the state board shall:</amend><subsection ssid="7-20" dnum="_-o:a-i" numlevel="1" lineno="79" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">consult with LEAs, teachers, curriculum specialists, and other education stakeholders;</amend></subsection><subsection ssid="7-21" dnum="_-o:b-i" numlevel="1" lineno="80" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">establish timelines for phased development and implementation;</amend></subsection><subsection ssid="7-22" dnum="_-o:c-i" numlevel="1" lineno="81" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">provide opportunities for pilot programs and field testing before statewide release; <ln numlevel="1" lineno="82" slineno="1-53"/>and</amend></subsection><subsection ssid="7-23" dnum="_-o:d-i" numlevel="1" lineno="83" slineno="1-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">ensure ongoing review and updates to maintain alignment with Utah core standards <ln numlevel="1" lineno="84" slineno="1-55"/>and educational best practices.</amend></subsection></subsection><subsection ssid="7-24" dnum="_-o:5-i" numlevel="1" lineno="85" slineno="1-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">The state board may not require an LEA to adopt or use the open educational resources <ln numlevel="1" lineno="86" slineno="1-57"/>developed under this section.</amend></subsection><subsection ssid="7-25" dnum="_-o:6-i" numlevel="1" lineno="87" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="7-29" dnum="_-o:a-i" numlevel="1" lineno="88" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">make rules in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="89" slineno="1-60"/>Rulemaking Act, to:</amend><subsection ssid="7-30" dnum="_-o:i-i" numlevel="1" lineno="90" slineno="1-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">establish standards and procedures for contracting under this section;</amend></subsection><subsection ssid="7-31" dnum="_-o:ii-i" numlevel="1" lineno="91" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">establish quality standards and suitability rubrics for open educational resources <ln numlevel="1" lineno="92" slineno="1-63"/>developed under this section;</amend></subsection><subsection ssid="7-32" dnum="_-o:iii-i" numlevel="1" lineno="93" slineno="1-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="end">establish procedures for LEA access to and use of the open educational <ln numlevel="1" lineno="94" slineno="1-65"/>resources; and</amend></subsection><subsection ssid="7-39" dnum="_-o:v-i" numlevel="1" lineno="103" slineno="1-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="183" groupid="143" style="1" owner="jchristopherson" level="1" amendtag="end">plans and progress for updates, maintenance, and expansion of the open <ln numlevel="1" lineno="104" slineno="1-75"/>educational resources.</amend></subsection></subsection></subsection></section></bsec><bsec buid="10" num="53F-9-204" type="amend" src="code" uid="C53F-9-S204_2026070120260701" sort="53F09 02040020260701" numlevel="1" lineno="105" slineno="2-1" sn="2"><section number="53F-9-204" numlevel="1" lineno="106" slineno="2-2" type="amend"><secline lineno="105">Section 2. Section <bold>53F-9-204</bold> is amended to read:</secline><catline lineno="106"><bold>53F-9-204<parens/>. Public Education Economic Stabilization Restricted Account.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="107" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>There is created within the Uniform School Fund a restricted account known as the <ln numlevel="1" lineno="108" slineno="2-4"/>"Public Education Economic Stabilization Restricted Account."</subsection><subsection ssid="10-null-2" dnum="2-o" numlevel="1" lineno="109" slineno="2-5" level="1" space="false"><display>(2)</display><subsection ssid="10-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53F-9-204(2)(b)">(2)(b)</xref>, the account shall be funded from the <ln numlevel="1" lineno="110" slineno="2-6"/>following revenue sources:<subsection ssid="10-null-4" dnum="i-o" numlevel="1" lineno="111" slineno="2-7" level="3" tab="1"><display>(i)</display>15% of the difference between, as determined by the Office of the Legislative <ln numlevel="1" lineno="112" slineno="2-8"/>Fiscal Analyst:<subsection ssid="10-null-5" dnum="A-o" numlevel="1" lineno="113" slineno="2-9" level="4"><display>(A)</display>the estimated amount of ongoing Income Tax Fund and Uniform School Fund <ln numlevel="1" lineno="114" slineno="2-10"/>revenue available for the Legislature to appropriate for the next fiscal year; and</subsection><subsection ssid="10-null-6" dnum="B-o" numlevel="1" lineno="115" slineno="2-11" level="4"><display>(B)</display>the amount of ongoing appropriations from the Income Tax Fund and Uniform <ln numlevel="1" lineno="116" slineno="2-12"/>School Fund in the current fiscal year; and</subsection></subsection><subsection ssid="10-null-7" dnum="ii-o" numlevel="1" lineno="117" slineno="2-13" level="3" tab="1"><display>(ii)</display>other appropriations as the Legislature may designate.</subsection></subsection><subsection ssid="10-null-8" dnum="b-o" numlevel="1" lineno="118" slineno="2-14" level="2"><display>(b)</display>If the appropriation described in Subsection <xref depth="4" refnumber="53F-9-204(2)(a)">(2)(a)</xref> would cause the ongoing <ln numlevel="1" lineno="119" slineno="2-15"/>appropriations to the account to exceed 11% of Uniform School Fund appropriations <ln numlevel="1" lineno="120" slineno="2-16"/>described in Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref> for the same fiscal year, the Legislature shall <ln numlevel="1" lineno="121" slineno="2-17"/>appropriate only those funds necessary to ensure that the ongoing appropriations to <ln numlevel="1" lineno="122" slineno="2-18"/>the account equal 11% of Uniform School Fund appropriations for that fiscal year.</subsection></subsection><subsection ssid="10-null-9" dnum="3-o" numlevel="1" lineno="123" slineno="2-19" level="1" format="full"><display>(3)</display>Subject to the availability of ongoing appropriations to the account, in accordance with <eol numlevel="1" lineno="124" slineno="2-20"/>Utah Constitution, Article X, Section 5, Subsection <xref depth="4" refnumber="53F-9-204(4)">(4)</xref>, the ongoing appropriation to the <ln numlevel="1" lineno="125" slineno="2-21"/>account shall be used to fund:<subsection ssid="10-null-10" dnum="a-o" numlevel="1" lineno="126" slineno="2-22" level="2"><display>(a)</display>except for a year described in Subsection <xref depth="4" refnumber="53F-9-204(3)(b)">(3)(b)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both"> or </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, </amend><xref depth="4" refnumber="53F-9-204(c)">(c)</xref>, <amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">or (d), </amend>one-time <ln numlevel="1" lineno="127" slineno="2-23"/>appropriations to the public education system, including at least $65,000,000 to the <ln numlevel="1" lineno="128" slineno="2-24"/>Catalyst Center Grant Program described in Section <xref depth="3" refnumber="53E-3-507.1">53E-3-507.1</xref>;</subsection><subsection ssid="10-null-11" dnum="b-o" numlevel="1" lineno="129" slineno="2-25" level="2"><display>(b)</display>the Minimum School Program for a year in which Income Tax Fund revenue and <ln numlevel="1" lineno="130" slineno="2-26"/>Uniform School Fund revenue are insufficient to fund:<subsection ssid="10-null-12" dnum="i-o" numlevel="1" lineno="131" slineno="2-27" level="3"><display>(i)</display>ongoing appropriations to the public education system; and</subsection><subsection ssid="10-null-13" dnum="ii-o" numlevel="1" lineno="132" slineno="2-28" level="3"><display>(ii)</display>enrollment growth and inflation estimates, as defined in Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="10-28" dnum="_-o:c-i" numlevel="1" lineno="133" slineno="2-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">the Minimum School Program for a year in which changes in federal tax policy cause <ln numlevel="1" lineno="134" slineno="2-30"/>Income Tax Fund revenue to decrease by an amount equal to or greater than the <ln numlevel="1" lineno="135" slineno="2-31"/>amount required to fund enrollment growth and inflation estimates, as defined in <ln numlevel="1" lineno="136" slineno="2-32"/>Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref>; or</amend></subsection><subsection ssid="10-null-14" dnum="c-o:d-i" numlevel="1" lineno="137" slineno="2-33" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>the minimum basic local amount as defined in Section <xref depth="3" refnumber="53F-2-301">53F-2-301</xref> for a year in <ln numlevel="1" lineno="138" slineno="2-34"/>which the minimum basic tax rate, as defined in Section <xref depth="3" refnumber="53F-2-301">53F-2-301</xref>, is insufficient to <ln numlevel="1" lineno="139" slineno="2-35"/>generate the amount described in Subsection <xref refnumber="53F-2-301(2)(a)" depth="4">53F-2-301(2)(a)</xref>.</subsection></subsection><subsection ssid="10-null-15" dnum="4-o" numlevel="1" lineno="140" slineno="2-36" level="1" space="false"><display>(4)</display><subsection ssid="10-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The account shall earn interest.</subsection><subsection ssid="10-null-17" dnum="b-o" numlevel="1" lineno="141" slineno="2-37" level="2"><display>(b)</display>All interest earned on account money shall be deposited in the account.</subsection></subsection><subsection ssid="10-null-18" dnum="5-o" numlevel="1" lineno="142" slineno="2-38" level="1"><display>(5)</display>On or before December 31, 2023, and every three years thereafter, the Office of the <ln numlevel="1" lineno="143" slineno="2-39"/>Legislative Fiscal Analyst shall:<subsection ssid="10-null-19" dnum="a-o" numlevel="1" lineno="144" slineno="2-40" level="2"><display>(a)</display>review the percentages described in Subsections <xref depth="4" refnumber="53F-9-204(2)(a)(i)">(2)(a)(i)</xref> and <xref depth="4" refnumber="53F-9-204(2)(b)">(2)(b)</xref>; and</subsection><subsection ssid="10-null-20" dnum="b-o" numlevel="1" lineno="145" slineno="2-41" level="2"><display>(b)</display>recommend to the Executive Appropriations Committee any changes based on the <ln numlevel="1" lineno="146" slineno="2-42"/>review described in Subsection <xref depth="4" refnumber="53F-9-204(5)(a)">(5)(a)</xref>.</subsection></subsection><subsection ssid="10-null-21" dnum="6-o" numlevel="1" lineno="147" slineno="2-43" level="1"><display>(6)</display>In preparing budget bills for a given fiscal year, the Executive Appropriations <ln numlevel="1" lineno="148" slineno="2-44"/>Committee shall make the one-time appropriations described in Subsection <xref depth="4" refnumber="53F-9-204(3)(a)">(3)(a)</xref> by <ln numlevel="1" lineno="149" slineno="2-45"/>appropriating at least the lesser of 10% of the total amount of the one-time <ln numlevel="1" lineno="150" slineno="2-46"/>appropriations to:<subsection ssid="10-null-22" dnum="a-o" numlevel="1" lineno="151" slineno="2-47" level="2"><display>(a)</display>the cost of providing 32 paid professional hours for teachers in accordance with <ln numlevel="1" lineno="152" slineno="2-48"/>Section <xref depth="3" refnumber="53F-7-203">53F-7-203</xref>;</subsection><subsection ssid="10-null-23" dnum="b-o" numlevel="1" lineno="153" slineno="2-49" level="2"><display>(b)</display>the amount to make the distribution required under Section <xref depth="3" refnumber="53F-2-527">53F-2-527</xref>;</subsection><subsection ssid="10-null-24" dnum="c-o" numlevel="1" lineno="154" slineno="2-50" level="2"><display>(c)</display>the cost of the Stipends for Future Educators Grant Program described in Section <xref depth="3" refnumber="53F-5-223"><ln numlevel="1" lineno="155" slineno="2-51"/>53F-5-223</xref>; and</subsection><subsection ssid="10-null-25" dnum="d-o" numlevel="1" lineno="156" slineno="2-52" level="2"><display>(d)</display>the cost of the Rural School Sports Facilities Grant Program described in Section <xref depth="3" refnumber="53F-10-303"><ln numlevel="1" lineno="157" slineno="2-53"/>53F-10-303</xref>.</subsection></subsection><subsection ssid="10-null-26" dnum="7-o" numlevel="1" lineno="158" slineno="2-54" level="1"><display>(7)</display>No later than October 15 of each year, the state board shall report to the Office of the <ln numlevel="1" lineno="159" slineno="2-55"/>Legislative Fiscal Analyst an estimated cost for each of the one-time appropriations <ln numlevel="1" lineno="160" slineno="2-56"/>described in Subsection <xref refnumber="53F-9-204(6)" depth="4">(6)</xref>.</subsection></section></bsec><bsec buid="3" num="53G-7-203" type="amend" src="code" uid="C53G-7-S203_2026070120260701" sort="53G07 02030020260701" numlevel="1" lineno="161" slineno="3-1" sn="3"><section number="53G-7-203" numlevel="1" lineno="162" slineno="3-2" type="amend"><secline lineno="161">Section 3. Section <bold>53G-7-203</bold> is amended to read:</secline><catline lineno="162"><bold>53G-7-203<parens/>. Kindergartens -- Establishment -- Funding -- Assessment.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="163" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Kindergartens are an integral part of the state's public education system.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="164" slineno="3-4" level="1" space="false"><display>(2)</display><subsection ssid="3-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each LEA governing board shall provide kindergarten classes free of charge for <ln numlevel="1" lineno="165" slineno="3-5"/>kindergarten children residing within the district or attending <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> charter school.</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="166" slineno="3-6" level="2"><display>(b)</display>Each LEA governing board shall:<subsection ssid="3-null-5" dnum="i-o" numlevel="1" lineno="167" slineno="3-7" level="3"><display>(i)</display>provide a half-day kindergarten option for a student that comprises the minimum <ln numlevel="1" lineno="168" slineno="3-8"/>standards for half-day kindergarten that the state board establishes, in accordance <ln numlevel="1" lineno="169" slineno="3-9"/>with Subsection <xref depth="4" refnumber="53G-7-203(4)(a)(iii)">(4)(a)(iii)</xref>, if the student's parent requests a half-day option; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="170" slineno="3-10" level="3" space="false"><display>(ii)</display><subsection ssid="3-null-7" dnum="A-o" level="4" placement="sameline"><display>(A)</display>inform parents of the availability of the option to register for a designated <ln numlevel="1" lineno="171" slineno="3-11"/>full-curriculum half-day kindergarten option at the time of all kindergarten <ln numlevel="1" lineno="172" slineno="3-12"/>registration, by email, posters, or other announcements when a parent requests <ln numlevel="1" lineno="173" slineno="3-13"/>kindergarten registration; and</subsection><subsection ssid="3-null-8" dnum="B-o" numlevel="1" lineno="174" slineno="3-14" level="4"><display>(B)</display>provide the option to register for a designated half-day kindergarten option at <ln numlevel="1" lineno="175" slineno="3-15"/>the time of registration;</subsection></subsection><subsection ssid="3-null-9" dnum="iii-o" numlevel="1" lineno="176" slineno="3-16" level="3"><display>(iii)</display>provide a dedicated kindergarten class specifically designated as a half-day <ln numlevel="1" lineno="177" slineno="3-17"/>kindergarten class when enrollment of half-day kindergarten students at an <ln numlevel="1" lineno="178" slineno="3-18"/>individual school or a regional school exceeds a minimum of 18 students;</subsection><subsection ssid="3-null-10" dnum="iv-o" numlevel="1" lineno="179" slineno="3-19" level="3"><display>(iv)</display>when enrollment of half-day kindergarten students at an individual school <ln numlevel="1" lineno="180" slineno="3-20"/>exceeds a minimum of 18 students, designate the school as a half-day <ln numlevel="1" lineno="181" slineno="3-21"/>kindergarten provider for the improvement of recruiting teachers that prefer <ln numlevel="1" lineno="182" slineno="3-22"/>half-day teaching;</subsection><subsection ssid="3-null-11" dnum="v-o" numlevel="1" lineno="183" slineno="3-23" level="3"><display>(v)</display>inform parents regarding the additional educational resources and opportunities <ln numlevel="1" lineno="184" slineno="3-24"/>available to parents who select the half-day kindergarten option; and</subsection><subsection ssid="3-null-12" dnum="vi-o" numlevel="1" lineno="185" slineno="3-25" level="3"><display>(vi)</display>ensure that a half-day kindergarten student who is registered in a class that <ln numlevel="1" lineno="186" slineno="3-26"/>includes full-day kindergarten students receives instruction that at least meets the <ln numlevel="1" lineno="187" slineno="3-27"/>minimum standards for half-day kindergarten that the state board establishes, in <ln numlevel="1" lineno="188" slineno="3-28"/>accordance with Subsection <xref depth="4" refnumber="53G-7-203(4)(a)(iii)">(4)(a)(iii)</xref>.</subsection></subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="189" slineno="3-29" level="2"><display>(c)</display>Nothing in this Subsection <xref depth="4" refnumber="53G-7-203(2)">(2)</xref>:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="190" slineno="3-30" level="3"><display>(i)</display>allows an LEA governing board to require a student to participate in a full-day <ln numlevel="1" lineno="191" slineno="3-31"/>kindergarten program;</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="192" slineno="3-32" level="3"><display>(ii)</display>modifies the non-compulsory status of kindergarten under Chapter 6, Part 2, <ln numlevel="1" lineno="193" slineno="3-33"/>Compulsory Education; or</subsection><subsection ssid="3-null-16" dnum="iii-o" numlevel="1" lineno="194" slineno="3-34" level="3"><display>(iii)</display>requires a student who only attends a half day of kindergarten to participate in <ln numlevel="1" lineno="195" slineno="3-35"/>dual enrollment under Section <xref depth="3" refnumber="53G-6-702">53G-6-702</xref>.</subsection></subsection></subsection><subsection ssid="3-null-17" dnum="3-o" numlevel="1" lineno="196" slineno="3-36" level="1"><display>(3)</display>Kindergartens established under Subsection <xref depth="4" refnumber="53G-7-203(2)">(2)</xref> shall receive state money under Title <ln numlevel="1" lineno="197" slineno="3-37"/>53F, Public Education System -- Funding.</subsection><subsection ssid="3-null-18" dnum="4-o" numlevel="1" lineno="198" slineno="3-38" level="1" space="false"><display>(4)</display><subsection ssid="3-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall:<subsection ssid="3-null-20" dnum="i-o" numlevel="1" lineno="199" slineno="3-39" level="3" tab="1"><display>(i)</display>develop and collect data from a kindergarten assessment that the board selects by <ln numlevel="1" lineno="200" slineno="3-40"/>rule;</subsection><subsection ssid="3-null-21" dnum="ii-o" numlevel="1" lineno="201" slineno="3-41" level="3" tab="1"><display>(ii)</display>make rules, in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="202" slineno="3-42"/>Rulemaking Act, regarding the administration of and reporting regarding the <ln numlevel="1" lineno="203" slineno="3-43"/>assessment described in Subsection <xref depth="4" refnumber="53G-7-203(4)(a)(i)">(4)(a)(i)</xref>; and</subsection><subsection ssid="3-null-22" dnum="iii-o" numlevel="1" lineno="204" slineno="3-44" level="3" tab="1"><display>(iii)</display>establish minimum standards for half-day kindergarten.</subsection></subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="205" slineno="3-45" level="2"><display>(b)</display>An LEA shall:<subsection ssid="3-null-24" dnum="i-o" numlevel="1" lineno="206" slineno="3-46" level="3"><display>(i)</display>administer the assessment described in Subsection <xref depth="4" refnumber="53G-7-203(4)(a)">(4)(a)</xref> to each kindergarten <ln numlevel="1" lineno="207" slineno="3-47"/>student; and</subsection><subsection ssid="3-null-25" dnum="ii-o" numlevel="1" lineno="208" slineno="3-48" level="3"><display>(ii)</display>report to the state board the results of the assessment described in Subsection <xref depth="4" refnumber="53G-7-203(4)(b)(i)"><ln numlevel="1" lineno="209" slineno="3-49"/>(4)(b)(i)</xref> in relation to each kindergarten student in the LEA.</subsection></subsection></subsection><subsection ssid="3-null-26" dnum="5-o" numlevel="1" lineno="210" slineno="3-50" level="1"><display>(5)</display>The state board shall require LEAs to report average daily membership for all <ln numlevel="1" lineno="211" slineno="3-51"/>kindergarten students who attend kindergarten on a schedule that is equivalent in length <ln numlevel="1" lineno="212" slineno="3-52"/>to the schedule for grades 1 through 3 with the October 1 data described in Section <xref depth="3" refnumber="53F-2-302"><ln numlevel="1" lineno="213" slineno="3-53"/>53F-2-302</xref>.</subsection><subsection ssid="3-null-27" dnum="6-o:_-i" numlevel="1" lineno="214" slineno="3-54" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1105" style="2" owner="o" level="1" deltag="start">(6)</amend></display><amend anum="0" ea="erase" pairid="8" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="215" slineno="3-55"/>state board shall make rules to:</amend><amendoutend style="2"/><subsection ssid="3-null-28" dnum="a-o:_-i" numlevel="1" lineno="216" slineno="3-56" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1106" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="9" groupid="6" style="2" owner="jchristopherson" level="1" deltag="end">beginning with the 2025-2026 school year, require a student to be toilet trained <ln numlevel="1" lineno="217" slineno="3-57"/>before being enrolled in public school;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-29" dnum="b-o:_-i" numlevel="1" lineno="218" slineno="3-58" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1107" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">establish requirements for an LEA's enrollment process to include assurances from a <ln numlevel="1" lineno="219" slineno="3-59"/>parent that the parent's student is toilet trained; and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-30" dnum="c-o:_-i" numlevel="1" lineno="220" slineno="3-60" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1108" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">create exemptions from the requirement in Subsection (6)(a) for a student who is not <ln numlevel="1" lineno="221" slineno="3-61"/>able to be toilet trained before enrolling because of a condition that is subject to <ln numlevel="1" lineno="222" slineno="3-62"/>federal child find requirements or described in an IEP or Section 504 accommodation <ln numlevel="1" lineno="223" slineno="3-63"/>plan.</amend><amendoutend style="2"/></subsection></subsection></section></bsec><bsec buid="1" num="53G-7-228" type="enact" src="code" uid="C53G-7-S228_2026070120260701" sort="53G07 02280020260701" numlevel="1" lineno="224" slineno="4-1" sn="4"><section numlevel="1" lineno="225" slineno="4-2" number="53G-7-228" type="enact"><secline lineno="224">Section 4. Section <bold>53G-7-228</bold> is enacted to read:</secline><catline lineno="225"><bold>53G-7-228<parens/>. Personal care independence standards -- School enrollment.</bold></catline><sectionText lineno="226"><para/><amend anum="0" ea="amend" pairid="11" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the state <ln numlevel="1" lineno="227" slineno="4-4"/>board shall make rules to:</amend></sectionText><subsection ssid="1-5" dnum="_-o:1-i" numlevel="1" lineno="228" slineno="4-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">beginning with the 2026-2027 school year, require a student to demonstrate personal <ln numlevel="1" lineno="229" slineno="4-6"/>care independence by being toilet trained before being enrolled in a public school;</amend></subsection><subsection ssid="1-6" dnum="_-o:2-i" numlevel="1" lineno="230" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">establish requirements for an LEA's enrollment process to include assurances from a <ln numlevel="1" lineno="231" slineno="4-8"/>parent that the parent's student meets the personal care independence requirements <ln numlevel="1" lineno="232" slineno="4-9"/>described in Subsection <xref depth="4" refnumber="53G-7-228(1)">(1)</xref>; and</amend></subsection><subsection ssid="1-7" dnum="_-o:3-i" numlevel="1" lineno="233" slineno="4-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">create exemptions from the requirement in Subsection <xref depth="4" refnumber="53G-7-228(1)">(1)</xref> for a student who is not able <ln numlevel="1" lineno="234" slineno="4-11"/>to meet personal care independence requirements because of a condition that is subject <ln numlevel="1" lineno="235" slineno="4-12"/>to federal child find requirements found in Section 20 U.S.C. 1412(a)(3), Individuals <ln numlevel="1" lineno="236" slineno="4-13"/>with Disabilities Education Act, and 34 C.F.R. Sec. 300.111 or described in an IEP or <ln numlevel="1" lineno="237" slineno="4-14"/>Section 504 accommodation plan.</amend></subsection></section></bsec><bsec buid="11" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="238" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="238">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="239"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-12-26 11:21 AM</tm></rev></foot></leg>
