Section <bold>79-6-401</bold> is amended to read:</secline><catline lineno="35"><bold>79-6-401<parens/>. Office of Energy Development -- Creation -- Director -- Purpose -- <ln numlevel="1" lineno="36" slineno="1-3"/>Rulemaking regarding confidential information -- Fees -- Transition for employees. </bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="37" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>There is created an Office of Energy Development within the Department of Natural <ln numlevel="1" lineno="38" slineno="1-5"/>Resources to be administered by a director.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="39" slineno="1-6" level="1" space="false"><display>(2)</display><subsection ssid="1-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governor shall appoint the director with the advice and consent of the Senate.</subsection><subsection ssid="1-null-4" dnum="b-o" numlevel="1" lineno="40" slineno="1-7" level="2"><display>(b)</display>The director shall: <subsection ssid="1-null-5" dnum="i-o" numlevel="1" lineno="41" slineno="1-8" level="3"><display>(i)</display>have demonstrated the necessary administrative and professional ability through <ln numlevel="1" lineno="42" slineno="1-9"/>education and experience to efficiently and effectively manage the office's affairs;</subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="43" slineno="1-10" level="3"><display>(ii)</display>serve at the pleasure of the governor; and</subsection><subsection ssid="1-null-7" dnum="iii-o" numlevel="1" lineno="44" slineno="1-11" level="3"><display>(iii)</display>report to the executive director on matters concerning the office as the executive <ln numlevel="1" lineno="45" slineno="1-12"/>director may require.</subsection></subsection></subsection><subsection ssid="1-null-8" dnum="3-o" numlevel="1" lineno="46" slineno="1-13" level="1"><display>(3)</display>The purposes of the office are to:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="47" slineno="1-14" level="2"><display>(a)</display>serve as the primary resource for advancing energy and mineral development in the <ln numlevel="1" lineno="48" slineno="1-15"/>state;</subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="49" slineno="1-16" level="2"><display>(b)</display>implement:<subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="50" slineno="1-17" level="3"><display>(i)</display>the state energy policy under Section <xref depth="3" refnumber="79-6-301">79-6-301</xref>; and</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="51" slineno="1-18" level="3"><display>(ii)</display>the governor's energy and mineral development goals and objectives;</subsection></subsection><subsection ssid="1-null-13" dnum="c-o" numlevel="1" lineno="52" slineno="1-19" level="2"><display>(c)</display>advance energy education, outreach, and research, including the creation of <ln numlevel="1" lineno="53" slineno="1-20"/>elementary, higher education, and technical college energy education programs;</subsection><subsection ssid="1-null-14" dnum="d-o" numlevel="1" lineno="54" slineno="1-21" level="2"><display>(d)</display>promote energy and mineral development workforce initiatives; </subsection><subsection ssid="1-null-15" dnum="e-o" numlevel="1" lineno="55" slineno="1-22" level="2"><display>(e)</display>support collaborative research initiatives targeted at Utah-specific energy and <ln numlevel="1" lineno="56" slineno="1-23"/>mineral development;</subsection><subsection ssid="1-null-16" dnum="f-o" numlevel="1" lineno="57" slineno="1-24" level="2"><display>(f)</display>in coordination with the Department of Environmental Quality and other relevant <ln numlevel="1" lineno="58" slineno="1-25"/>state agencies:<subsection ssid="1-null-17" dnum="i-o" numlevel="1" lineno="59" slineno="1-26" level="3"><display>(i)</display>develop effective policy strategies to advocate for and protect the state's interests <ln numlevel="1" lineno="60" slineno="1-27"/>relating to federal energy and environmental entities, programs, and regulations;</subsection><subsection ssid="1-null-18" dnum="ii-o" numlevel="1" lineno="61" slineno="1-28" level="3"><display>(ii)</display>participate in the federal environmental rulemaking process by:<subsection ssid="1-null-19" dnum="A-o" numlevel="1" lineno="62" slineno="1-29" level="4"><display>(A)</display>advocating for positive reform of federal energy and environmental <ln numlevel="1" lineno="63" slineno="1-30"/>regulations and permitting;</subsection><subsection ssid="1-null-20" dnum="B-o" numlevel="1" lineno="64" slineno="1-31" level="4"><display>(B)</display>coordinating with other states to develop joint advocacy strategies; and</subsection><subsection ssid="1-null-21" dnum="C-o" numlevel="1" lineno="65" slineno="1-32" level="4"><display>(C)</display>conducting other government relations efforts; and</subsection></subsection><subsection ssid="1-null-22" dnum="iii-o" numlevel="1" lineno="66" slineno="1-33" level="3"><display>(iii)</display>direct the funding of legal efforts to combat federal overreach and unreasonable <ln numlevel="1" lineno="67" slineno="1-34"/>delays regarding energy and environmental permitting; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-23" dnum="g-o" numlevel="1" lineno="68" slineno="1-35" level="2"><display>(g)</display>fund the development of detailed and accurate forecasts of the state's long-term <ln numlevel="1" lineno="69" slineno="1-36"/>energy supply and demand, including a baseline projection of expected supply and <ln numlevel="1" lineno="70" slineno="1-37"/>demand and analysis of potential alternative scenarios<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-92" dnum="_-o:h-i" numlevel="1" lineno="71" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">coordinate with public and private entities regarding nuclear fuel recycling facility <ln numlevel="1" lineno="72" slineno="1-39"/>development in the state as provided in Part 15, Nuclear Fuel Recycling.</amend></subsection></subsection><subsection ssid="1-null-24" dnum="4-o" numlevel="1" lineno="73" slineno="1-40" level="1"><display>(4)</display>By following the procedures and requirements of Title 63J, Chapter 5, Federal Funds <ln numlevel="1" lineno="74" slineno="1-41"/>Procedures Act, the office may:<subsection ssid="1-null-25" dnum="a-o" numlevel="1" lineno="75" slineno="1-42" level="2"><display>(a)</display>seek federal grants or loans;</subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="76" slineno="1-43" level="2"><display>(b)</display>seek to participate in federal programs; and</subsection><subsection ssid="1-null-27" dnum="c-o" numlevel="1" lineno="77" slineno="1-44" level="2"><display>(c)</display>in accordance with applicable federal program guidelines, administer federally <ln numlevel="1" lineno="78" slineno="1-45"/>funded state energy programs.</subsection></subsection><subsection ssid="1-null-28" dnum="5-o" numlevel="1" lineno="79" slineno="1-46" level="1"><display>(5)</display>The office shall perform the duties required by Sections <xref depth="3" refnumber="11-42a-106">11-42a-106</xref>, <xref depth="3" refnumber="59-5-302">59-5-302</xref>, <xref depth="3" refnumber="59-7-614.7"><ln numlevel="1" lineno="80" slineno="1-47"/>59-7-614.7</xref>, <amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">and </amend><xref depth="3" refnumber="59-10-1029">59-10-1029</xref>, Part 5, Alternative Energy Development Tax Credit Act, <ln numlevel="1" lineno="81" slineno="1-48"/>and Part 6, High Cost Infrastructure Development Tax Credit Act.</subsection><subsection ssid="1-null-29" dnum="6-o" numlevel="1" lineno="82" slineno="1-49" level="1" space="false"><display>(6)</display><subsection ssid="1-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For purposes of administering this section, the office may make rules, by <ln numlevel="1" lineno="83" slineno="1-50"/>following Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to maintain as <ln numlevel="1" lineno="84" slineno="1-51"/>confidential, and not as a public record, information that the office receives from any <ln numlevel="1" lineno="85" slineno="1-52"/>source.</subsection><subsection ssid="1-null-31" dnum="b-o" numlevel="1" lineno="86" slineno="1-53" level="2"><display>(b)</display>The office shall maintain information the office receives from any source at the level <ln numlevel="1" lineno="87" slineno="1-54"/>of confidentiality assigned by the source.</subsection></subsection><subsection ssid="1-null-32" dnum="7-o" numlevel="1" lineno="88" slineno="1-55" level="1"><display>(7)</display>The office may charge application, filing, and processing fees in amounts determined by <ln numlevel="1" lineno="89" slineno="1-56"/>the office in accordance with Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref> as dedicated credits for performing <ln numlevel="1" lineno="90" slineno="1-57"/>office duties described in this part.</subsection><subsection ssid="1-null-33" dnum="8-o" numlevel="1" lineno="91" slineno="1-58" level="1" space="false"><display>(8)</display><subsection ssid="1-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An employee of the office on April 30, 2024, is an at-will employee.</subsection><subsection ssid="1-null-35" dnum="b-o" numlevel="1" lineno="92" slineno="1-59" level="2"><display>(b)</display>For an employee described in Subsection <xref depth="4" refnumber="79-6-401(8)(a)">(8)(a)</xref> who was employed by the office on <ln numlevel="1" lineno="93" slineno="1-60"/>April 30, 2024, the employee shall have the same salary and benefit options an <ln numlevel="1" lineno="94" slineno="1-61"/>employee had when the office was part of the office of the governor.</subsection><subsection ssid="1-null-36" dnum="c-o" numlevel="1" lineno="95" slineno="1-62" level="2"><display>(c)</display>An employee of the office hired on or after May 1, 2024, shall receive compensation <ln numlevel="1" lineno="96" slineno="1-63"/>as provided in Title 63A, Chapter 17, Utah State Personnel Management Act.</subsection></subsection><subsection ssid="1-null-37" dnum="9-o" numlevel="1" lineno="97" slineno="1-64" level="1" space="false"><display>(9)</display><subsection ssid="1-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The office shall prepare a strategic energy plan to achieve the state's energy <ln numlevel="1" lineno="98" slineno="1-65"/>policy, including:<subsection ssid="1-null-39" dnum="i-o" numlevel="1" lineno="99" slineno="1-66" level="3" tab="1"><display>(i)</display>technological and infrastructure innovation needed to meet future energy demand <ln numlevel="1" lineno="100" slineno="1-67"/>including:<subsection ssid="1-null-40" dnum="A-o" numlevel="1" lineno="101" slineno="1-68" level="4"><display>(A)</display>energy production technologies;</subsection><subsection ssid="1-null-41" dnum="B-o" numlevel="1" lineno="102" slineno="1-69" level="4"><display>(B)</display>battery and storage technologies;</subsection><subsection ssid="1-null-42" dnum="C-o" numlevel="1" lineno="103" slineno="1-70" level="4"><display>(C)</display>smart grid technologies;</subsection><subsection ssid="1-null-43" dnum="D-o" numlevel="1" lineno="104" slineno="1-71" level="4"><display>(D)</display>energy efficiency technologies; and</subsection><subsection ssid="1-null-44" dnum="E-o" numlevel="1" lineno="105" slineno="1-72" level="4"><display>(E)</display>any other developing energy technology, energy infrastructure planning, or <ln numlevel="1" lineno="106" slineno="1-73"/>investments that will assist the state in meeting energy demand;</subsection></subsection><subsection ssid="1-null-45" dnum="ii-o" numlevel="1" lineno="107" slineno="1-74" level="3" tab="1"><display>(ii)</display>the state's efficient use and development of:<subsection ssid="1-null-46" dnum="A-o" numlevel="1" lineno="108" slineno="1-75" level="4"><display>(A)</display>energy resources, including natural gas, coal, clean coal, hydrogen,  oil, oil <ln numlevel="1" lineno="109" slineno="1-76"/>shale, and oil sands;</subsection><subsection ssid="1-null-47" dnum="B-o" numlevel="1" lineno="110" slineno="1-77" level="4"><display>(B)</display>renewable energy resources, including geothermal, solar, hydrogen, wind, <ln numlevel="1" lineno="111" slineno="1-78"/>biomass, biofuel, and hydroelectric;</subsection><subsection ssid="1-null-48" dnum="C-o" numlevel="1" lineno="112" slineno="1-79" level="4"><display>(C)</display>nuclear power; and</subsection><subsection ssid="1-null-49" dnum="D-o" numlevel="1" lineno="113" slineno="1-80" level="4"><display>(D)</display>earth minerals;</subsection></subsection><subsection ssid="1-null-50" dnum="iii-o" numlevel="1" lineno="114" slineno="1-81" level="3" tab="1"><display>(iii)</display>areas of energy-related academic research;</subsection><subsection ssid="1-null-51" dnum="iv-o" numlevel="1" lineno="115" slineno="1-82" level="3" tab="1"><display>(iv)</display>specific areas of workforce development necessary for an evolving energy <ln numlevel="1" lineno="116" slineno="1-83"/>industry;</subsection><subsection ssid="1-null-52" dnum="v-o" numlevel="1" lineno="117" slineno="1-84" level="3" tab="1"><display>(v)</display>the development of partnerships with national laboratories; and</subsection><subsection ssid="1-null-53" dnum="vi-o" numlevel="1" lineno="118" slineno="1-85" level="3" tab="1"><display>(vi)</display>a proposed state budget for economic development and investment.</subsection></subsection><subsection ssid="1-null-54" dnum="b-o" numlevel="1" lineno="119" slineno="1-86" level="2"><display>(b)</display>In preparing the strategic energy plan, the office shall:<subsection ssid="1-null-55" dnum="i-o" numlevel="1" lineno="120" slineno="1-87" level="3"><display>(i)</display> consult with stakeholders, including representatives from:<subsection ssid="1-null-56" dnum="A-o" numlevel="1" lineno="121" slineno="1-88" level="4"><display>(A)</display>energy companies in the state;</subsection><subsection ssid="1-null-57" dnum="B-o" numlevel="1" lineno="122" slineno="1-89" level="4"><display>(B)</display>private and public institutions of higher education within the state conducting <ln numlevel="1" lineno="123" slineno="1-90"/>energy-related research; and</subsection><subsection ssid="1-null-58" dnum="C-o" numlevel="1" lineno="124" slineno="1-91" level="4"><display>(C)</display>other state agencies; and</subsection></subsection><subsection ssid="1-null-59" dnum="ii-o" numlevel="1" lineno="125" slineno="1-92" level="3"><display>(ii)</display>use modeling and industry standard data to:<subsection ssid="1-null-60" dnum="A-o" numlevel="1" lineno="126" slineno="1-93" level="4"><display>(A)</display>define the energy services required by a growing economy;</subsection><subsection ssid="1-null-61" dnum="B-o" numlevel="1" lineno="127" slineno="1-94" level="4"><display>(B)</display>calculate energy needs;</subsection><subsection ssid="1-null-62" dnum="C-o" numlevel="1" lineno="128" slineno="1-95" level="4"><display>(C)</display>develop state strategy for energy transportation, including transmission lines, <ln numlevel="1" lineno="129" slineno="1-96"/>pipelines, and other infrastructure needs;</subsection><subsection ssid="1-null-63" dnum="D-o" numlevel="1" lineno="130" slineno="1-97" level="4"><display>(D)</display>optimize investments to meet energy needs at the least cost and least risk <ln numlevel="1" lineno="131" slineno="1-98"/>while meeting the policy outlined in this section;</subsection><subsection ssid="1-null-64" dnum="E-o" numlevel="1" lineno="132" slineno="1-99" level="4"><display>(E)</display>address state needs and investments through a prospective 30-year period, <ln numlevel="1" lineno="133" slineno="1-100"/>divided into five-year working plans; and</subsection><subsection ssid="1-null-65" dnum="F-o" numlevel="1" lineno="134" slineno="1-101" level="4"><display>(F)</display>update the plan at least every two years.</subsection></subsection></subsection><subsection ssid="1-null-66" dnum="c-o" numlevel="1" lineno="135" slineno="1-102" level="2"><display>(c)</display>The office shall report annually to the Public Utilities, Energy, and Technology <ln numlevel="1" lineno="136" slineno="1-103"/>Interim Committee on or before the October interim meeting describing:<subsection ssid="1-null-67" dnum="i-o" numlevel="1" lineno="137" slineno="1-104" level="3"><display>(i)</display>progress towards creation and implementation of the strategic energy plan; </subsection><subsection ssid="1-null-68" dnum="ii-o" numlevel="1" lineno="138" slineno="1-105" level="3"><display>(ii)</display>the plan's compliance with the state energy policy; and</subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="139" slineno="1-106" level="3"><display>(iii)</display>a proposed budget for the office to continue development of the strategic energy <ln numlevel="1" lineno="140" slineno="1-107"/>plan.</subsection></subsection></subsection><subsection ssid="1-null-70" dnum="10-o" numlevel="1" lineno="141" slineno="1-108" level="1"><display>(10)</display>The director shall:<subsection ssid="1-null-71" dnum="a-o" numlevel="1" lineno="142" slineno="1-109" level="2"><display>(a)</display>annually review and propose updates to the state's energy policy, as contained in <ln numlevel="1" lineno="143" slineno="1-110"/>Section <xref depth="3" refnumber="79-6-301">79-6-301</xref>;</subsection><subsection ssid="1-null-72" dnum="b-o" numlevel="1" lineno="144" slineno="1-111" level="2"><display>(b)</display>promote as the governor considers necessary:<subsection ssid="1-null-73" dnum="i-o" numlevel="1" lineno="145" slineno="1-112" level="3"><display>(i)</display>the development of cost-effective energy resources both renewable and <ln numlevel="1" lineno="146" slineno="1-113"/>nonrenewable; and</subsection><subsection ssid="1-null-74" dnum="ii-o" numlevel="1" lineno="147" slineno="1-114" level="3"><display>(ii)</display>educational programs, including programs supporting conservation and energy <ln numlevel="1" lineno="148" slineno="1-115"/>efficiency measures;</subsection></subsection><subsection ssid="1-null-75" dnum="c-o" numlevel="1" lineno="149" slineno="1-116" level="2"><display>(c)</display>coordinate across state agencies to assure consistency with state energy policy, <ln numlevel="1" lineno="150" slineno="1-117"/>including:<subsection ssid="1-null-76" dnum="i-o" numlevel="1" lineno="151" slineno="1-118" level="3"><display>(i)</display>working with the State Energy Program to promote access to federal assistance for <ln numlevel="1" lineno="152" slineno="1-119"/>energy-related projects for state agencies and members of the public;</subsection><subsection ssid="1-null-77" dnum="ii-o" numlevel="1" lineno="153" slineno="1-120" level="3"><display>(ii)</display>working with the Division of Emergency Management to assist the governor in <ln numlevel="1" lineno="154" slineno="1-121"/>carrying out the governor's energy emergency powers under Title 53, Chapter 2a, <ln numlevel="1" lineno="155" slineno="1-122"/>Part 10, Energy Emergency Powers of the Governor Act;</subsection><subsection ssid="1-null-78" dnum="iii-o" numlevel="1" lineno="156" slineno="1-123" level="3"><display>(iii)</display>participating in the annual review of the energy emergency plan and the <ln numlevel="1" lineno="157" slineno="1-124"/>maintenance of the energy emergency plan and a current list of contact persons <ln numlevel="1" lineno="158" slineno="1-125"/>required by Section <xref depth="3" refnumber="53-2a-902">53-2a-902</xref>; and</subsection><subsection ssid="1-null-79" dnum="iv-o" numlevel="1" lineno="159" slineno="1-126" level="3"><display>(iv)</display>identifying and proposing measures necessary to facilitate low-income <ln numlevel="1" lineno="160" slineno="1-127"/>consumers' access to energy services;</subsection></subsection><subsection ssid="1-null-80" dnum="d-o" numlevel="1" lineno="161" slineno="1-128" level="2"><display>(d)</display>coordinate with the Division of Emergency Management ongoing activities designed <ln numlevel="1" lineno="162" slineno="1-129"/>to test an energy emergency plan to ensure coordination and information sharing <ln numlevel="1" lineno="163" slineno="1-130"/>among state agencies and political subdivisions in the state, public utilities and other <ln numlevel="1" lineno="164" slineno="1-131"/>energy suppliers, and other relevant public sector persons as required by Sections <xref depth="3" refnumber="53-2a-902"><ln numlevel="1" lineno="165" slineno="1-132"/>53-2a-902</xref>, <xref depth="3" refnumber="53-2a-1004">53-2a-1004</xref>, <xref depth="3" refnumber="53-2a-1008">53-2a-1008</xref>, and <xref depth="3" refnumber="53-2a-1010">53-2a-1010</xref>;</subsection><subsection ssid="1-null-81" dnum="e-o" numlevel="1" lineno="166" slineno="1-133" level="2"><display>(e)</display>coordinate with requisite state agencies to study:<subsection ssid="1-null-82" dnum="i-o" numlevel="1" lineno="167" slineno="1-134" level="3"><display>(i)</display>the creation of a centralized state repository for energy-related information;</subsection><subsection ssid="1-null-83" dnum="ii-o" numlevel="1" lineno="168" slineno="1-135" level="3"><display>(ii)</display>methods for streamlining state review and approval processes for energy-related <ln numlevel="1" lineno="169" slineno="1-136"/>projects; and</subsection><subsection ssid="1-null-84" dnum="iii-o" numlevel="1" lineno="170" slineno="1-137" level="3"><display>(iii)</display>the development of multistate energy transmission and transportation <ln numlevel="1" lineno="171" slineno="1-138"/>infrastructure;</subsection></subsection><subsection ssid="1-null-85" dnum="f-o" numlevel="1" lineno="172" slineno="1-139" level="2"><display>(f)</display>coordinate energy-related regulatory processes within the state;</subsection><subsection ssid="1-null-86" dnum="g-o" numlevel="1" lineno="173" slineno="1-140" level="2"><display>(g)</display>compile, and make available to the public, information about federal, state, and local <ln numlevel="1" lineno="174" slineno="1-141"/>approval requirements for energy-related projects;</subsection><subsection ssid="1-null-87" dnum="h-o" numlevel="1" lineno="175" slineno="1-142" level="2"><display>(h)</display>act as the state's advocate before federal and local authorities for energy-related <ln numlevel="1" lineno="176" slineno="1-143"/>infrastructure projects or coordinate with the appropriate state agency; and</subsection><subsection ssid="1-null-88" dnum="i-o" numlevel="1" lineno="177" slineno="1-144" level="2"><display>(i)</display>help promote the Division of Facilities Construction and Management's measures to <ln numlevel="1" lineno="178" slineno="1-145"/>improve energy efficiency in state buildings.</subsection></subsection><subsection ssid="1-null-89" dnum="11-o" numlevel="1" lineno="179" slineno="1-146" level="1"><display>(11)</display>The director has standing to testify on behalf of the governor at the Public Service <ln numlevel="1" lineno="180" slineno="1-147"/>Commission created in Section <xref depth="3" refnumber="54-1-1">54-1-1</xref>.</subsection><subsection ssid="1-null-90" dnum="12-o" numlevel="1" lineno="181" slineno="1-148" level="1"><display>(12)</display>The office shall include best practices in developing actionable goals and <ln numlevel="1" lineno="182" slineno="1-149"/>recommendations as part of preparing and updating every two years the strategic energy <ln numlevel="1" lineno="183" slineno="1-150"/>plan required under Subsection <xref depth="4" refnumber="79-6-401(9)">(9)</xref>.</subsection><subsection ssid="1-null-91" dnum="13-o" numlevel="1" lineno="184" slineno="1-151" level="1"><display>(13)</display>The office shall maintain and regularly update a public website that provides an <ln numlevel="1" lineno="185" slineno="1-152"/>accessible dashboard of relevant metrics and reports and makes available the data used <ln numlevel="1" lineno="186" slineno="1-153"/>to create the strategic energy plan.</subsection></section></bsec><bsec buid="2" num="79-6-405" type="amend" src="code" uid="C79-6-S405_2026050620260506" sort="79 06 04050020260506" numlevel="1" lineno="187" slineno="2-1" sn="2"><section number="79-6-405" numlevel="1" lineno="188" slineno="2-2" type="amend"><secline lineno="187">Section 2. Section <bold>79-6-405</bold> is amended to read:</secline><catline lineno="188"><bold>79-6-405<parens/>. Reports -- Study.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="189" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The director shall report annually to the Public Utilities, Energy, and Technology <ln numlevel="1" lineno="190" slineno="2-4"/>Interim Committee.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="191" slineno="2-5" level="1"><display>(2)</display>The report required in Subsection <xref depth="4" refnumber="79-6-405(1)">(1)</xref> shall:<subsection ssid="2-null-3" dnum="a-o" numlevel="1" lineno="192" slineno="2-6" level="2"><display>(a)</display>summarize the status and development of the state's energy resources;</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="193" slineno="2-7" level="2"><display>(b)</display>summarize the activities and accomplishments of the office;</subsection><subsection ssid="2-null-5" dnum="c-o" numlevel="1" lineno="194" slineno="2-8" level="2"><display>(c)</display>address the director's activities under this part; </subsection><subsection ssid="2-null-6" dnum="d-o" numlevel="1" lineno="195" slineno="2-9" level="2"><display>(d)</display>recommend any energy-related executive or legislative action the director or office <ln numlevel="1" lineno="196" slineno="2-10"/>considers beneficial to the state, including updates to the state energy policy under <ln numlevel="1" lineno="197" slineno="2-11"/>Section <xref depth="3" refnumber="79-6-301">79-6-301</xref>; and</subsection><subsection ssid="8-null-7" dnum="v-o" numlevel="1" lineno="216" slineno="3-9" level="3"><display>(v)</display>stakeholder coordination;</subsection></subsection><subsection ssid="8-null-8" dnum="b-o" numlevel="1" lineno="217" slineno="3-10" level="2"><display>(b)</display>assess and facilitate electrical energy infrastructure development by:<subsection ssid="8-null-9" dnum="i-o" numlevel="1" lineno="218" slineno="3-11" level="3"><display>(i)</display>evaluating infrastructure needs and opportunities;</subsection><subsection ssid="8-null-10" dnum="ii-o" numlevel="1" lineno="219" slineno="3-12" level="3"><display>(ii)</display>coordinating with transmission and pipeline developers;</subsection><subsection ssid="8-null-11" dnum="iii-o" numlevel="1" lineno="220" slineno="3-13" level="3"><display>(iii)</display>supporting utility planning efforts; and</subsection><subsection ssid="8-null-17" dnum="iv-o" numlevel="1" lineno="226" slineno="3-19" level="3"><display>(iv)</display>criteria for evaluating proposed electrical energy development zones;</subsection></subsection><subsection ssid="8-null-18" dnum="d-o" numlevel="1" lineno="227" slineno="3-20" level="2"><display>(d)</display>review and approve:<subsection ssid="8-null-19" dnum="i-o" numlevel="1" lineno="228" slineno="3-21" level="3"><display>(i)</display>research project proposals from the board; and</subsection><subsection ssid="8-null-24" dnum="iii-o" numlevel="1" lineno="233" slineno="3-26" level="3"><display>(iii)</display>opportunities for coordinated development of electrical energy projects on state <ln numlevel="1" lineno="234" slineno="3-27"/>lands;</subsection></subsection><subsection ssid="8-null-25" dnum="f-o" numlevel="1" lineno="235" slineno="3-28" level="2"><display>(f)</display>administer the Electrical Energy Development Investment Fund created in Section <xref depth="3" refnumber="79-6-1105"><ln numlevel="1" lineno="236" slineno="3-29"/>79-6-1105</xref>;</subsection><subsection ssid="8-null-26" dnum="g-o" numlevel="1" lineno="237" slineno="3-30" level="2"><display>(g)</display>make recommendations regarding electrical energy policy to state and local <ln numlevel="1" lineno="238" slineno="3-31"/>governments;</subsection><subsection ssid="8-null-27" dnum="h-o" numlevel="1" lineno="239" slineno="3-32" level="2"><display>(h)</display>identify and recommend solutions to barriers affecting electrical energy development;</subsection><subsection ssid="8-null-28" dnum="i-o" numlevel="1" lineno="240" slineno="3-33" level="2"><display>(i)</display>assess and address potential public health impacts of electrical energy development <ln numlevel="1" lineno="241" slineno="3-34"/>zones;</subsection><subsection ssid="8-null-29" dnum="j-o" numlevel="1" lineno="242" slineno="3-35" level="2"><display>(j)</display>enter into contracts necessary to fulfill the council's duties;</subsection><subsection ssid="8-null-30" dnum="k-o" numlevel="1" lineno="243" slineno="3-36" level="2"><display>(k)</display>report annually by October 31 to the Public Utilities, Energy, and Technology <ln numlevel="1" lineno="244" slineno="3-37"/>Interim Committee and the Natural Resources, Agriculture, and Environment Interim <ln numlevel="1" lineno="245" slineno="3-38"/>Committee regarding:<subsection ssid="8-null-31" dnum="i-o" numlevel="1" lineno="246" slineno="3-39" level="3"><display>(i)</display>the council's activities;</subsection><subsection ssid="8-null-32" dnum="ii-o" numlevel="1" lineno="247" slineno="3-40" level="3"><display>(ii)</display>energy development opportunities;</subsection><subsection ssid="8-null-33" dnum="iii-o" numlevel="1" lineno="248" slineno="3-41" level="3"><display>(iii)</display>infrastructure needs;</subsection><subsection ssid="8-null-34" dnum="iv-o" numlevel="1" lineno="249" slineno="3-42" level="3"><display>(iv)</display>the status of designated electrical energy development zones;</subsection><subsection ssid="8-null-35" dnum="v-o" numlevel="1" lineno="250" slineno="3-43" level="3"><display>(v)</display>recommendations for how the property tax differential revenue collected under <ln numlevel="1" lineno="251" slineno="3-44"/>Section <xref depth="3" refnumber="79-6-1104">79-6-1104</xref> should be divided and distributed between the state, counties, <ln numlevel="1" lineno="252" slineno="3-45"/>and municipalities;</subsection><subsection ssid="8-null-36" dnum="vi-o" numlevel="1" lineno="253" slineno="3-46" level="3"><display>(vi)</display>investment decisions made by the council; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="8-null-37" dnum="vii-o" numlevel="1" lineno="254" slineno="3-47" level="3"><display>(vii)</display>recommended policy changes;<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="8-65" dnum="_-o:viii-i" numlevel="1" lineno="255" slineno="3-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">recommendations regarding nuclear fuel recycling facility development;</amend></subsection></subsection><subsection ssid="8-null-38" dnum="l-o" numlevel="1" lineno="256" slineno="3-49" level="2"><display>(l)</display>create and implement a strategic plan for a decommissioned asset, taking into <ln numlevel="1" lineno="257" slineno="3-50"/>consideration:<subsection ssid="8-null-39" dnum="i-o" numlevel="1" lineno="258" slineno="3-51" level="3"><display>(i)</display>the state energy policy, as provided in Section <xref depth="3" refnumber="79-6-301">79-6-301</xref>;</subsection><subsection ssid="8-null-40" dnum="ii-o" numlevel="1" lineno="259" slineno="3-52" level="3"><display>(ii)</display>reliability of electrical generation; and</subsection><subsection ssid="8-null-41" dnum="iii-o" numlevel="1" lineno="260" slineno="3-53" level="3"><display>(iii)</display>economic viability;</subsection></subsection><subsection ssid="8-null-42" dnum="m-o" numlevel="1" lineno="261" slineno="3-54" level="2"><display>(m)</display>establish policies and procedures for the management of a decommissioned asset;</subsection><subsection ssid="8-null-43" dnum="n-o" numlevel="1" lineno="262" slineno="3-55" level="2"><display>(n)</display>administer contracts for the management and operations of a decommissioned asset;</subsection><subsection ssid="8-null-44" dnum="o-o" numlevel="1" lineno="263" slineno="3-56" level="2"><display>(o)</display>enter into contracts necessary for the operation and management of a <ln numlevel="1" lineno="264" slineno="3-57"/>decommissioned asset;</subsection><subsection ssid="8-null-45" dnum="p-o" numlevel="1" lineno="265" slineno="3-58" level="2"><display>(p)</display>acquire, hold, and dispose of property related to a decommissioned asset;</subsection><subsection ssid="8-null-46" dnum="q-o" numlevel="1" lineno="266" slineno="3-59" level="2"><display>(q)</display>select an operator for a decommissioned asset as provided in Section <xref depth="3" refnumber="79-6-1107">79-6-1107</xref>; and</subsection><subsection ssid="8-null-47" dnum="r-o" numlevel="1" lineno="267" slineno="3-60" level="2"><display>(r)</display>report annually to the Legislative Management Committee regarding:<subsection ssid="8-null-48" dnum="i-o" numlevel="1" lineno="268" slineno="3-61" level="3"><display>(i)</display>the status and progress of the asset transfer;</subsection><subsection ssid="8-null-49" dnum="ii-o" numlevel="1" lineno="269" slineno="3-62" level="3"><display>(ii)</display>operational and financial status of the asset under council control;</subsection><subsection ssid="8-null-50" dnum="iii-o" numlevel="1" lineno="270" slineno="3-63" level="3"><display>(iii)</display>status of the operator contract;</subsection><subsection ssid="8-null-51" dnum="iv-o" numlevel="1" lineno="271" slineno="3-64" level="3"><display>(iv)</display>environmental compliance status; and</subsection><subsection ssid="8-null-52" dnum="v-o" numlevel="1" lineno="272" slineno="3-65" level="3"><display>(v)</display>recommendations for legislation.</subsection></subsection></subsection><subsection ssid="8-null-53" dnum="2-o" numlevel="1" lineno="273" slineno="3-66" level="1"><display>(2)</display>The council shall negotiate with the applicable county or municipality regarding the <ln numlevel="1" lineno="274" slineno="3-67"/>distribution of property tax differential revenue collected under Section <xref depth="3" refnumber="79-6-1104">79-6-1104</xref>.</subsection><subsection ssid="8-null-54" dnum="3-o" numlevel="1" lineno="275" slineno="3-68" level="1"><display>(3)</display>Any portion of the property tax differential that is not distributed to the council shall be <ln numlevel="1" lineno="276" slineno="3-69"/>distributed to the applicable county or municipality for impact mitigation and affordable <ln numlevel="1" lineno="277" slineno="3-70"/>housing.</subsection><subsection ssid="8-null-55" dnum="4-o" numlevel="1" lineno="278" slineno="3-71" level="1" space="false"><display>(4)</display><subsection ssid="8-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The portion of the property tax differential that is distributed to the municipality <ln numlevel="1" lineno="279" slineno="3-72"/>shall be used for:<subsection ssid="8-null-57" dnum="i-o" numlevel="1" lineno="280" slineno="3-73" level="3" tab="1"><display>(i)</display>at least 10% of the total distribution shall be used for affordable housing <ln numlevel="1" lineno="281" slineno="3-74"/>programs; and</subsection><subsection ssid="8-null-58" dnum="ii-o" numlevel="1" lineno="282" slineno="3-75" level="3" tab="1"><display>(ii)</display>the remaining portion shall be used to mitigate impacts within the municipality <ln numlevel="1" lineno="283" slineno="3-76"/>resulting from electrical energy development.</subsection></subsection><subsection ssid="8-null-59" dnum="b-o" numlevel="1" lineno="284" slineno="3-77" level="2"><display>(b)</display>The portion of the property tax differential that is distributed to the county shall be <ln numlevel="1" lineno="285" slineno="3-78"/>used for:<subsection ssid="8-null-60" dnum="i-o" numlevel="1" lineno="286" slineno="3-79" level="3"><display>(i)</display>at least 10% of the total distribution shall be placed in a registered non-profit <ln numlevel="1" lineno="287" slineno="3-80"/>established to administer housing programs on behalf of an association <ln numlevel="1" lineno="288" slineno="3-81"/>representing 10 or more counties in the state; and</subsection><subsection ssid="8-null-61" dnum="ii-o" numlevel="1" lineno="289" slineno="3-82" level="3"><display>(ii)</display>the remaining portion shall be used to mitigate impacts within the county <ln numlevel="1" lineno="290" slineno="3-83"/>resulting from electrical energy development.</subsection></subsection></subsection><subsection ssid="8-null-62" dnum="5-o" numlevel="1" lineno="291" slineno="3-84" level="1"><display>(5)</display>If the council acquires a project entity asset under Section <xref depth="3" refnumber="11-13-318">11-13-318</xref>, the council shall <ln numlevel="1" lineno="292" slineno="3-85"/>enter into an agreement with the project entity that:<subsection ssid="8-null-63" dnum="a-o" numlevel="1" lineno="293" slineno="3-86" level="2"><display>(a)</display>provides for the transfer, disposition, and future operation of the asset; and</subsection><subsection ssid="8-null-64" dnum="b-o" numlevel="1" lineno="294" slineno="3-87" level="2"><display>(b)</display>ensures the transfer, disposition, and future operation does not interfere with the <ln numlevel="1" lineno="295" slineno="3-88"/>project entity's ownership or operation of electrical generation facilities powered by <ln numlevel="1" lineno="296" slineno="3-89"/>natural gas, hydrogen, or a combination of natural gas and hydrogen.</subsection></subsection></section></bsec><bsec buid="4" num="79-6-1501" type="enact" src="code" uid="C79-6-S1501_2026050620260506" sort="79 06 15010020260506" numlevel="1" lineno="297" slineno="4-1" sn="4"><section numlevel="1" lineno="299" slineno="4-3" number="79-6-1501" type="enact"><secline lineno="297">Section 4. facilities.</amend></subsection><subsection ssid="4-3" dnum="_-o:4-i" numlevel="1" lineno="306" slineno="4-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"Nuclear fuel recycling" means the processing of spent nuclear fuel to recover usable <ln numlevel="1" lineno="307" slineno="4-11"/>materials.</amend></subsection><subsection ssid="4-4" dnum="_-o:5-i" numlevel="1" lineno="308" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">"Nuclear fuel recycling facility" means a facility designed to process spent nuclear fuel <ln numlevel="1" lineno="309" slineno="4-13"/>to recover reusable materials.</amend></subsection><subsection ssid="4-5" dnum="_-o:6-i" numlevel="1" lineno="310" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">"Office" means the Office of Energy Development created in Section <xref depth="3" refnumber="79-6-401">79-6-401</xref>.</amend></subsection><subsection ssid="4-6" dnum="_-o:7-i" numlevel="1" lineno="311" slineno="4-15" ea="amend" anum="0" lineno="313" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">identification of general geographic areas that may be suitable based on existing <ln numlevel="1" lineno="314" slineno="4-18"/>infrastructure, transportation access, and land use compatibility;</amend></subsection><subsection ssid="4-9" dnum="_-o:ii-i" numlevel="1" lineno="315" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">coordination with private entities, and</amend></subsection><subsection ssid="5-6" dnum="_-o:iii-i" numlevel="1" lineno="333" slineno="5-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">potential partnerships between the state and federal agencies;</amend></subsection></subsection><subsection ssid="5-7" dnum="_-o:c-i" numlevel="1" lineno="334" slineno="5-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">serving as a liaison between private entities and local communities regarding nuclear <ln numlevel="1" lineno="335" slineno="5-11"/>fuel recycling facility development opportunities;</amend></subsection><subsection ssid="5-8" dnum="_-o:d-i" numlevel="1" lineno="336" slineno="5-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">convening meetings and discussions among:</amend><subsection ssid="5-9" dnum="_-o:i-i" numlevel="1" lineno="337" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">private entities;</amend></subsection><subsection ssid="5-10" dnum="_-o:ii-i" numlevel="1" lineno="338" slineno="5-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">federal agencies;</amend></subsection><subsection ssid="5-11" dnum="_-o:iii-i" numlevel="1" lineno="339" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">local governments;
