Section <bold>10-3-928</bold> is amended to read:</secline><catline lineno="25"><bold>10-3-928<parens/>. Attorney duties -- Deputy attorneys.</bold></catline><sectionText lineno="26"><tab/>In cities with a city attorney, the city attorney:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1"><display>(1)</display>may prosecute violations of city ordinances;</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="28" slineno="1-5" level="1"><display>(2)</display>may prosecute, under state law, infractions and misdemeanors occurring within the <ln numlevel="1" lineno="29" slineno="1-6"/>boundaries of the municipality;</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="30" slineno="1-7" level="1"><display>(3)</display>has the same powers in respect to violations as are exercised by a county attorney or <ln numlevel="1" lineno="31" slineno="1-8"/>district attorney, except that a city attorney's authority to grant immunity shall be limited <ln numlevel="1" lineno="32" slineno="1-9"/>to:<subsection ssid="1-null-4" dnum="a-o" numlevel="1" lineno="33" slineno="1-10" level="2"><display>(a)</display>granting transactional immunity for violations of city ordinances; and</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="34" slineno="1-11" level="2"><display>(b)</display>granting transactional immunity under state law for infractions and misdemeanors <ln numlevel="1" lineno="35" slineno="1-12"/>occurring within the boundaries of the municipality;</subsection></subsection><subsection ssid="1-null-6" dnum="4-o" numlevel="1" lineno="36" slineno="1-13" level="1"><display>(4)</display>shall represent the interests of the state or the municipality in the appeal of any matter <ln numlevel="1" lineno="37" slineno="1-14"/>prosecuted in any trial court by the city attorney;</subsection><subsection ssid="1-null-7" dnum="5-o" numlevel="1" lineno="38" slineno="1-15" level="1"><display>(5)</display>may cooperate with the Office of the Attorney General during investigations;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-8" dnum="6-o" numlevel="1" lineno="39" slineno="1-16" level="1"><display>(6)</display>may designate a city attorney from another municipality or a public prosecutor to <ln numlevel="1" lineno="40" slineno="1-17"/>prosecute a matter, in the court having jurisdiction over the matter, if the city attorney <ln numlevel="1" lineno="41" slineno="1-18"/>has a conflict of interest regarding the matter being prosecuted<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="1-9" dnum="_-o:7-i" numlevel="1" lineno="42" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">may employ a deputy attorney to perform the duties of public prosecutor or civil <ln numlevel="1" lineno="43" slineno="1-20"/>counsel; and</amend></subsection><subsection ssid="1-10" dnum="_-o:8-i" numlevel="1" lineno="44" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">may specially deputize, for a limited time or limited purpose, an attorney licensed to <ln numlevel="1" lineno="45" slineno="1-22"/>practice law in the state and in good standing with the Utah State Bar as a deputy to <ln numlevel="1" lineno="46" slineno="1-23"/>assist in any public prosecutor or civil counsel duties specified in the special <ln numlevel="1" lineno="47" slineno="1-24"/>deputization.</amend></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="48" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="48">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="49"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-19-26 3:53 PM</tm></rev></foot></leg>
