Section <bold>53E-3-501</bold> is amended to read:</secline><catline lineno="28"><bold>53E-3-501<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>07/01/26</date></paren><paren sort="00" type="original" show="true"><effect>Partially Repealed </effect><date>07/01/28</date></paren></parens>. State board to <ln numlevel="1" lineno="29" slineno="1-3"/>establish miscellaneous minimum standards for public schools.</bold></catline><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>The state board shall establish rules and minimum standards for the public schools that <ln numlevel="1" lineno="31" slineno="1-5"/>are consistent with this public education code, including rules and minimum standards <ln numlevel="1" lineno="32" slineno="1-6"/>governing the following:<subsection ssid="14-null-2" dnum="a-o" numlevel="1" lineno="33" slineno="1-7" level="2" space="false"><display>(a)</display><subsection ssid="14-null-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the qualification and certification of educators and ancillary personnel who <ln numlevel="1" lineno="34" slineno="1-8"/>provide direct student services;</subsection><subsection ssid="14-null-4" dnum="ii-o" numlevel="1" lineno="35" slineno="1-9" level="3"><display>(ii)</display>required school administrative and supervisory services; and</subsection><subsection ssid="14-null-5" dnum="iii-o" numlevel="1" lineno="36" slineno="1-10" level="3"><display>(iii)</display>the evaluation of instructional personnel;</subsection></subsection><subsection ssid="14-null-6" dnum="b-o" numlevel="1" lineno="37" slineno="1-11" level="2" space="false"><display>(b)</display><subsection ssid="14-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>access to programs;</subsection><subsection ssid="14-null-8" dnum="ii-o" numlevel="1" lineno="38" slineno="1-12" level="3"><display>(ii)</display>attendance;</subsection><subsection ssid="14-null-9" dnum="iii-o" numlevel="1" lineno="39" slineno="1-13" level="3"><display>(iii)</display>competency levels;</subsection><subsection ssid="14-null-10" dnum="iv-o" numlevel="1" lineno="40" slineno="1-14" level="3"><display>(iv)</display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">in accordance with Subsection <xref depth="4" refnumber="53E-3-501(8)">(8)</xref>, </amend>graduation requirements; and</subsection><subsection ssid="14-null-11" dnum="v-o" numlevel="1" lineno="41" slineno="1-15" level="3"><display>(v)</display>discipline and control;</subsection></subsection><subsection ssid="14-null-12" dnum="c-o" numlevel="1" lineno="42" slineno="1-16" level="2" space="false"><display>(c)</display><subsection ssid="14-null-13" dnum="i-o" level="3" placement="sameline"><display>(i)</display>school accreditation;</subsection><subsection ssid="14-null-14" dnum="ii-o" numlevel="1" lineno="43" slineno="1-17" level="3"><display>(ii)</display>the academic year;</subsection><subsection ssid="14-null-15" dnum="iii-o" numlevel="1" lineno="44" slineno="1-18" level="3"><display>(iii)</display>alternative and pilot programs;</subsection><subsection ssid="14-null-16" dnum="iv-o" numlevel="1" lineno="45" slineno="1-19" level="3"><display>(iv)</display>curriculum and instruction requirements; and</subsection><subsection ssid="14-null-17" dnum="v-o" numlevel="1" lineno="46" slineno="1-20" level="3"><display>(v)</display>school libraries;</subsection></subsection><subsection ssid="14-null-18" dnum="d-o" numlevel="1" lineno="47" slineno="1-21" level="2"><display>(d)</display>services to:<subsection ssid="14-null-19" dnum="i-o" numlevel="1" lineno="48" slineno="1-22" level="3"><display>(i)</display>persons with a disability as defined by and covered under:<subsection ssid="14-null-20" dnum="A-o" numlevel="1" lineno="49" slineno="1-23" level="4"><display>(A)</display>the Americans with Disabilities Act of 1990, 42 U.S.C. Sec. 12102;</subsection><subsection ssid="14-null-21" dnum="B-o" numlevel="1" lineno="50" slineno="1-24" level="4"><display>(B)</display>the Rehabilitation Act of 1973, 29 U.S.C. Sec. 705(20)(A); and</subsection><subsection ssid="14-null-22" dnum="C-o" numlevel="1" lineno="51" slineno="1-25" level="4"><display>(C)</display>the Individuals with Disabilities Education Act, 20 U.S.C. Sec. 1401(3); and</subsection></subsection><subsection ssid="14-null-23" dnum="ii-o" numlevel="1" lineno="52" slineno="1-26" level="3"><display>(ii)</display>other special groups;</subsection></subsection><subsection ssid="14-null-24" dnum="e-o" numlevel="1" lineno="53" slineno="1-27" level="2" space="false"><display>(e)</display><subsection ssid="14-null-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>state reimbursed bus routes;</subsection><subsection ssid="14-null-26" dnum="ii-o" numlevel="1" lineno="54" slineno="1-28" level="3"><display>(ii)</display>bus safety and operational requirements; and</subsection><subsection ssid="14-null-27" dnum="iii-o" numlevel="1" lineno="55" slineno="1-29" level="3"><display>(iii)</display>other transportation needs;</subsection></subsection><subsection ssid="14-null-28" dnum="f-o" numlevel="1" lineno="56" slineno="1-30" level="2" space="false"><display>(f)</display><subsection ssid="14-null-29" dnum="i-o" level="3" placement="sameline"><display>(i)</display>school productivity and cost effectiveness measures;</subsection><subsection ssid="14-null-30" dnum="ii-o" numlevel="1" lineno="57" slineno="1-31" level="3"><display>(ii)</display>federal programs;</subsection><subsection ssid="14-null-31" dnum="iii-o" numlevel="1" lineno="58" slineno="1-32" level="3"><display>(iii)</display>school budget formats; and</subsection><subsection ssid="14-null-32" dnum="iv-o" numlevel="1" lineno="59" slineno="1-33" level="3"><display>(iv)</display>financial, statistical, and student accounting requirements; and</subsection></subsection><subsection ssid="14-null-33" dnum="g-o" numlevel="1" lineno="60" slineno="1-34" level="2"><display>(g)</display>data collection and reporting by LEAs.</subsection></subsection><subsection ssid="14-null-34" dnum="2-o" numlevel="1" lineno="61" slineno="1-35" level="1"><display>(2)</display>Except as provided in Subsection <xref depth="4" refnumber="53E-3-501(3)" start="0">(3)</xref>, the state board shall determine if:<subsection ssid="14-null-35" dnum="a-o" numlevel="1" lineno="62" slineno="1-36" level="2"><display>(a)</display>the minimum standards have been met; and</subsection><subsection ssid="14-null-36" dnum="b-o" numlevel="1" lineno="63" slineno="1-37" level="2"><display>(b)</display>required reports are properly submitted.</subsection></subsection><subsection ssid="14-null-37" dnum="3-o" numlevel="1" lineno="64" slineno="1-38" level="1"><display>(3)</display>When the state board makes a request of an LEA under Subsection <xref depth="4" refnumber="53E-3-501(1)(f)" start="0">(1)(f)</xref> or <xref depth="4" refnumber="53E-3-501(1)(g)" start="0">(g)</xref>, the <ln numlevel="1" lineno="65" slineno="1-39"/>state board shall include:<subsection ssid="14-null-38" dnum="a-o" numlevel="1" lineno="66" slineno="1-40" level="2"><display>(a)</display>the justification for the requested information;</subsection><subsection ssid="14-null-39" dnum="b-o" numlevel="1" lineno="67" slineno="1-41" level="2"><display>(b)</display>a statement confirming that the information is not available elsewhere;</subsection><subsection ssid="14-null-40" dnum="c-o" numlevel="1" lineno="68" slineno="1-42" level="2"><display>(c)</display>a deadline by which the LEA must provide the information in accordance with state <ln numlevel="1" lineno="69" slineno="1-43"/>board rule; and</subsection><subsection ssid="14-null-41" dnum="d-o" numlevel="1" lineno="70" slineno="1-44" level="2"><display>(d)</display>penalties, including withholding of funds, for non-compliance in accordance with <ln numlevel="1" lineno="71" slineno="1-45"/>state and federal law.</subsection></subsection><subsection ssid="14-null-42" dnum="4-o" numlevel="1" lineno="72" slineno="1-46" level="1"><display>(4)</display>The state board may apply for, receive, administer, and distribute to eligible applicants <ln numlevel="1" lineno="73" slineno="1-47"/>funds made available through programs of the federal government.</subsection><subsection ssid="14-null-43" dnum="5-o" numlevel="1" lineno="74" slineno="1-48" level="1" space="false"><display>(5)</display><subsection ssid="14-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A technical college listed in Section <xref depth="3" refnumber="53H-3-1202">53H-3-1202</xref> shall provide competency-based <ln numlevel="1" lineno="75" slineno="1-49"/>career and technical education courses that fulfill high school graduation <ln numlevel="1" lineno="76" slineno="1-50"/>requirements, as requested and authorized by the state board.</subsection><subsection ssid="14-null-45" dnum="b-o" numlevel="1" lineno="77" slineno="1-51" level="2"><display>(b)</display>A school district may grant a high school diploma to a student participating in a <ln numlevel="1" lineno="78" slineno="1-52"/>course described in Subsection <xref depth="4" refnumber="53E-3-501(5)(a)" start="0">(5)(a)</xref> that is provided by a technical college listed in <ln numlevel="1" lineno="79" slineno="1-53"/>Section <xref depth="3" refnumber="53H-3-1202">53H-3-1202</xref>.</subsection></subsection><subsection ssid="14-null-46" dnum="6-o" numlevel="1" lineno="80" slineno="1-54" level="1" space="false"><display>(6)</display><subsection ssid="14-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="53E-3-501(6)" start="0">(6)</xref>, "generally accepted accounting principles" means a <ln numlevel="1" lineno="81" slineno="1-55"/>common framework of accounting rules and standards for financial reporting <ln numlevel="1" lineno="82" slineno="1-56"/>promulgated by the Governmental Accounting Standards Board.</subsection><subsection ssid="14-null-48" dnum="b-o" numlevel="1" lineno="83" slineno="1-57" level="2"><display>(b)</display>Subject to Subsections <xref depth="4" refnumber="53E-3-501(6)(c)" start="0">(6)(c)</xref> and <xref depth="4" refnumber="53E-3-501(6)(d)" start="0">(d)</xref>, the state board shall ensure the rules and <ln numlevel="1" lineno="84" slineno="1-58"/>standards described in Subsections <xref depth="4" refnumber="53E-3-501(1)(f)" start="0">(1)(f)</xref> and <xref depth="4" refnumber="53E-3-501(1)(g)" start="0">(g)</xref> allow for an LEA to make <ln numlevel="1" lineno="85" slineno="1-59"/>adjustments to the LEA's general entry ledger, in accordance with generally accepted <ln numlevel="1" lineno="86" slineno="1-60"/>accounting principles, to accurately reflect the LEA's use of funds for allowable costs <ln numlevel="1" lineno="87" slineno="1-61"/>and activities:<subsection ssid="14-null-49" dnum="i-o" numlevel="1" lineno="88" slineno="1-62" level="3"><display>(i)</display>during a fiscal year; and</subsection><subsection ssid="14-null-50" dnum="ii-o" numlevel="1" lineno="89" slineno="1-63" level="3"><display>(ii)</display>at the close of a fiscal year.</subsection></subsection><subsection ssid="14-null-51" dnum="c-o" numlevel="1" lineno="90" slineno="1-64" level="2"><display>(c)</display>If the state board determines under Subsection <xref depth="4" refnumber="53E-3-501(2)" start="0">(2)</xref> that an LEA has not met the <ln numlevel="1" lineno="91" slineno="1-65"/>minimum standards described in Subsection <xref depth="4" refnumber="53E-3-501(1)(f)" start="0">(1)(f)</xref> or <xref depth="4" refnumber="53E-3-501(1)(g)" start="0">(g)</xref> or has not properly <ln numlevel="1" lineno="92" slineno="1-66"/>submitted a required report, the state board shall allow the LEA an opportunity to <ln numlevel="1" lineno="93" slineno="1-67"/>cure the relevant defect through an adjustment described in Subsection <xref depth="4" refnumber="53E-3-501(6)(b)" start="0">(6)(b)</xref>.</subsection><subsection ssid="14-null-52" dnum="d-o" numlevel="1" lineno="94" slineno="1-68" level="2"><display>(d)</display>An LEA may not, in an adjustment described in Subsection <xref depth="4" refnumber="53E-3-501(6)(b)" start="0">(6)(b)</xref>, reflect the use of <ln numlevel="1" lineno="95" slineno="1-69"/>restricted federal or state funds for a cost or activity that is not an allowable cost or <ln numlevel="1" lineno="96" slineno="1-70"/>activity for the restricted funds.</subsection></subsection><subsection ssid="14-null-53" dnum="7-o" numlevel="1" lineno="97" slineno="1-71" level="1" space="false"><display>(7)</display><subsection ssid="14-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref refnumber="53E-3-501(7)" depth="4">(7)</xref>:<subsection ssid="14-null-55" dnum="i-o" numlevel="1" lineno="98" slineno="1-72" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="14-null-56" dnum="A-o" level="4" placement="sameline"><display>(A)</display>"Comparable course" means a course that fulfills the same graduation credit <ln numlevel="1" lineno="99" slineno="1-73"/>requirements as a course for which a student seeks to improve a grade.</subsection><subsection ssid="14-null-57" dnum="B-o" numlevel="1" lineno="100" slineno="1-74" level="4"><display>(B)</display>"Comparable course" does not include a course a student completes through <ln numlevel="1" lineno="101" slineno="1-75"/>the packet method.</subsection></subsection><subsection ssid="14-null-58" dnum="ii-o" numlevel="1" lineno="102" slineno="1-76" level="3" tab="1"><display>(ii)</display>"Grade replacement" means credit a student earns by retaking a teacher-led <ln numlevel="1" lineno="103" slineno="1-77"/>course for a letter grade to improve a previous grade, which:<subsection ssid="14-null-59" dnum="A-o" numlevel="1" lineno="104" slineno="1-78" level="4"><display>(A)</display>may raise the student's grade point average if the new grade is higher; and</subsection><subsection ssid="14-null-60" dnum="B-o" numlevel="1" lineno="105" slineno="1-79" level="4"><display>(B)</display>replaces the lower grade on the student's transcript.</subsection></subsection><subsection ssid="14-null-61" dnum="iii-o" numlevel="1" lineno="106" slineno="1-80" level="3" tab="1"><display>(iii)</display>"Original credit" means credit a student earns through the successful completion <ln numlevel="1" lineno="107" slineno="1-81"/>of a course for the first time.</subsection><subsection ssid="14-null-62" dnum="iv-o" numlevel="1" lineno="108" slineno="1-82" level="3" tab="1"><display>(iv)</display>"Packet" means a collection of instructional materials and assessments used to <ln numlevel="1" lineno="109" slineno="1-83"/>receive credit through the packet method.</subsection><subsection ssid="14-null-63" dnum="v-o" numlevel="1" lineno="110" slineno="1-84" level="3" tab="1"><display>(v)</display>"Packet method" means an educational approach where:<subsection ssid="14-null-64" dnum="A-o" numlevel="1" lineno="111" slineno="1-85" level="4"><display>(A)</display>a high school student receives a collection of instructional materials from an <ln numlevel="1" lineno="112" slineno="1-86"/>institution, organization, or LEA;</subsection><subsection ssid="14-null-65" dnum="B-o" numlevel="1" lineno="113" slineno="1-87" level="4"><display>(B)</display>the high school student works through the materials independently with <ln numlevel="1" lineno="114" slineno="1-88"/>minimal or no direct instruction from a teacher; and</subsection><subsection ssid="14-null-66" dnum="C-o" numlevel="1" lineno="115" slineno="1-89" level="4"><display>(C)</display>assessment is primarily based on completion of assignments within the <ln numlevel="1" lineno="116" slineno="1-90"/>instructional materials.</subsection></subsection><subsection ssid="14-null-67" dnum="vi-o" numlevel="1" lineno="117" slineno="1-91" level="3" tab="1"><display>(vi)</display>"Replacement credit" means a pass-fail credit a student earns for a course the <ln numlevel="1" lineno="118" slineno="1-92"/>student did not pass or complete, which:<subsection ssid="14-null-68" dnum="A-o" numlevel="1" lineno="119" slineno="1-93" level="4"><display>(A)</display>does not affect the student's grade point average; and</subsection><subsection ssid="14-null-69" dnum="B-o" numlevel="1" lineno="120" slineno="1-94" level="4"><display>(B)</display>allows the student to fulfill high school graduation requirements.</subsection></subsection></subsection><subsection ssid="14-null-70" dnum="b-o" numlevel="1" lineno="121" slineno="1-95" level="2"><display>(b)</display>An LEA may award a grade for original credit or replacement credit through the <ln numlevel="1" lineno="122" slineno="1-96"/>packet method if the packet adheres to the standards prescribed in state board rule <ln numlevel="1" lineno="123" slineno="1-97"/>and:<subsection ssid="14-null-71" dnum="i-o" numlevel="1" lineno="124" slineno="1-98" level="3"><display>(i)</display>the LEA approves the packet for use as an instructional material in accordance <ln numlevel="1" lineno="125" slineno="1-99"/>with:<subsection ssid="14-null-72" dnum="A-o" numlevel="1" lineno="126" slineno="1-100" level="4"><display>(A)</display>Subsection <xref tempid="424" depth="4" refnumber="53G-4-402(27)">53G-4-402(27)</xref> for a district school; or</subsection><subsection ssid="14-null-73" dnum="B-o" numlevel="1" lineno="127" slineno="1-101" level="4"><display>(B)</display>Section <xref depth="3" refnumber="53G-5-404">53G-5-404</xref> for a charter school; or</subsection></subsection><subsection ssid="14-null-74" dnum="ii-o" numlevel="1" lineno="128" slineno="1-102" level="3"><display>(ii)</display>the state board recommends the packet after going through the state instructional <ln numlevel="1" lineno="129" slineno="1-103"/>materials process described in Title <xref depth="2" refnumber="53E-4-4">53E, Chapter 4, Part 4</xref>, State Instructional <ln numlevel="1" lineno="130" slineno="1-104"/>Materials.</subsection></subsection><subsection ssid="14-null-75" dnum="c-o" numlevel="1" lineno="131" slineno="1-105" level="2"><display>(c)</display>An LEA may not use the packet method, or classify a packet as original credit, to <ln numlevel="1" lineno="132" slineno="1-106"/>improve a previous course grade of a high school student as described in Subsection <xref refnumber="53E-3-501(7)(d)" depth="4"><ln numlevel="1" lineno="133" slineno="1-107"/>(7)(d)</xref>.</subsection><subsection ssid="14-null-76" dnum="d-o" numlevel="1" lineno="134" slineno="1-108" level="2"><display>(d)</display>A high school student may improve a grade through grade replacement by:<subsection ssid="14-null-77" dnum="i-o" numlevel="1" lineno="135" slineno="1-109" level="3"><display>(i)</display>repeating a course one or more times; or</subsection><subsection ssid="14-null-78" dnum="ii-o" numlevel="1" lineno="136" slineno="1-110" level="3"><display>(ii)</display>enrolling in and completing a comparable course that is teacher-led.</subsection></subsection><subsection ssid="14-null-79" dnum="e-o" numlevel="1" lineno="137" slineno="1-111" level="2"><display>(e)</display>The state board shall:<subsection ssid="14-null-80" dnum="i-o" numlevel="1" lineno="138" slineno="1-112" level="3"><display>(i)</display>in accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="139" slineno="1-113"/>make rules or policies that:<subsection ssid="14-null-81" dnum="A-o" numlevel="1" lineno="140" slineno="1-114" level="4"><display>(A)</display>establish standards for the use of the packet method to award original credit <ln numlevel="1" lineno="141" slineno="1-115"/>and replacement credit;</subsection><subsection ssid="14-null-82" dnum="B-o" numlevel="1" lineno="142" slineno="1-116" level="4"><display>(B)</display>include alignment with core standards the state board establishes under <ln numlevel="1" lineno="143" slineno="1-117"/>Sections <xref depth="3" refnumber="53E-3-501">53E-3-501</xref> and <xref depth="3" refnumber="53E-4-202">53E-4-202</xref>; and</subsection><subsection ssid="14-null-83" dnum="C-o" numlevel="1" lineno="144" slineno="1-118" level="4"><display>(C)</display>maintain a comprehensive list of state board approved packets in the state <ln numlevel="1" lineno="145" slineno="1-119"/>board's Recommended Instructional Materials System on the state board's <ln numlevel="1" lineno="146" slineno="1-120"/>website; and</subsection></subsection><subsection ssid="14-null-84" dnum="ii-o" numlevel="1" lineno="147" slineno="1-121" level="3"><display>(ii)</display>report annually to the Education Interim Committee the number of students in <ln numlevel="1" lineno="148" slineno="1-122"/>each LEA who receive academic credit through the packet method.</subsection></subsection><subsection ssid="14-null-85" dnum="f-o" numlevel="1" lineno="149" slineno="1-123" level="2"><display>(f)</display>An LEA shall:<subsection ssid="14-null-86" dnum="i-o" numlevel="1" lineno="150" slineno="1-124" level="3"><display>(i)</display>assign a distinct course name and number for credit earned through the packet <ln numlevel="1" lineno="151" slineno="1-125"/>method to easily identify the use of the packet method on a student transcript; and</subsection><subsection ssid="14-null-87" dnum="ii-o" numlevel="1" lineno="152" slineno="1-126" level="3"><display>(ii)</display>track and record the number of packets an LEA uses to award original credit or <ln numlevel="1" lineno="153" slineno="1-127"/>replacement credit each school year.</subsection></subsection></subsection><subsection ssid="14-88" dnum="_-o:8-i" numlevel="1" lineno="154" slineno="1-128" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">In establishing rules and minimum standards under Subsection <xref depth="4" refnumber="53E-3-501(1)(b)(iv)">(1)(b)(iv)</xref> regarding <ln numlevel="1" lineno="155" slineno="1-129"/>graduation requirements, the state board shall ensure that the rules and standards require <ln numlevel="1" lineno="156" slineno="1-130"/>an LEA to comply with Section <xref depth="3" refnumber="53G-4-416">53G-4-416</xref> regarding student participation in graduation <ln numlevel="1" lineno="157" slineno="1-131"/>activities.</amend></subsection></section></bsec><bsec buid="3" num="53E-4-204" type="amend" src="code" uid="C53E-4-S204_2026070120260701" sort="53E04 02040020260701" numlevel="1" lineno="158" slineno="2-1" sn="2"><section number="53E-4-204" numlevel="1" lineno="159" slineno="2-2" type="amend"><secline lineno="158">Section 2. Section <bold>53E-4-204</bold> is amended to read:</secline><catline lineno="159"><bold>53E-4-204<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Standards and graduation requirements.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="160" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The state board shall establish rigorous core standards for Utah public schools and <ln numlevel="1" lineno="161" slineno="2-4"/>graduation requirements under Section <xref depth="3" refnumber="53E-3-501" start="0">53E-3-501</xref> for grades 9 through 12 that:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="162" slineno="2-5" level="2"><display>(a)</display>are consistent with state law and federal regulations;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="163" slineno="2-6" level="2"><display>(b)</display>use competency-based standards and assessments;</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="164" slineno="2-7" level="2"><display>(c)</display>include instruction that stresses general financial literacy from basic budgeting to <ln numlevel="1" lineno="165" slineno="2-8"/>financial investments, including bankruptcy education and a general financial literacy <ln numlevel="1" lineno="166" slineno="2-9"/>test-out option;</subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="167" slineno="2-10" level="2"><display>(d)</display>include graduation requirements in language arts, mathematics, and science that <ln numlevel="1" lineno="168" slineno="2-11"/>exceed:<subsection ssid="3-null-6" dnum="i-o" numlevel="1" lineno="169" slineno="2-12" level="3"><display>(i)</display>3.0 units in language arts including up to 0.5 units emphasizing verbal <ln numlevel="1" lineno="170" slineno="2-13"/>communication completed in a course or a school sponsored activity;</subsection><subsection ssid="3-null-7" dnum="ii-o" numlevel="1" lineno="171" slineno="2-14" level="3"><display>(ii)</display>2.0 units in mathematics; and</subsection><subsection ssid="3-null-8" dnum="iii-o" numlevel="1" lineno="172" slineno="2-15" level="3"><display>(iii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and </amend><amendoutend style="2"/>2.0 units in science; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-null-9" dnum="e-o" numlevel="1" lineno="173" slineno="2-16" level="2"><display>(e)</display>include a graduation requirement in social studies that is equal to or exceeds 3.5 <ln numlevel="1" lineno="174" slineno="2-17"/>units, including at least 1.0 unit in American constitutional government and <ln numlevel="1" lineno="175" slineno="2-18"/>citizenship as described in Section <xref depth="3" refnumber="53E-4-205.2">53E-4-205.2</xref>;<amend anum="0" ea="amend" pairid="18" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="3-null-10" dnum="f-o" numlevel="1" lineno="176" slineno="2-19" level="2"><display>(f)</display>ensure up to 0.5 units described in Subsection <xref depth="4" refnumber="53E-4-204(1)(e)">(1)(e)</xref> may be earned by:<subsection ssid="3-null-11" dnum="i-o" numlevel="1" lineno="177" slineno="2-20" level="3"><display>(i)</display>completing a course or a school sponsored activity emphasizing verbal <ln numlevel="1" lineno="178" slineno="2-21"/>communication provided that a significant portion of the course or activity is <ln numlevel="1" lineno="179" slineno="2-22"/>dedicated to civic education, including:<subsection ssid="3-null-12" dnum="A-o" numlevel="1" lineno="180" slineno="2-23" level="4"><display>(A)</display>policy analysis;</subsection><subsection ssid="3-null-13" dnum="B-o" numlevel="1" lineno="181" slineno="2-24" level="4"><display>(B)</display>governmental systems; and</subsection><subsection ssid="3-null-14" dnum="C-o" numlevel="1" lineno="182" slineno="2-25" level="4"><display>(C)</display>civic engagement; or</subsection></subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="183" slineno="2-26" level="3"><display>(ii)</display>participation in the Junior Reserve Officers' Training Corps described in 10 U.S.C <ln numlevel="1" lineno="184" slineno="2-27"/>Sec. 2031.</subsection></subsection></subsection><subsection ssid="3-null-16" dnum="2-o" numlevel="1" lineno="185" slineno="2-28" level="1"><display>(2)</display>The state board shall establish competency-based standards and assessments for elective <ln numlevel="1" lineno="186" slineno="2-29"/>courses.</subsection><subsection ssid="3-null-17" dnum="3-o" numlevel="1" lineno="187" slineno="2-30" level="1"><display>(3)</display>The state board shall study requiring all LEAs to issue a high school diploma to students <ln numlevel="1" lineno="188" slineno="2-31"/>who receive:<subsection ssid="3-null-18" dnum="a-o" numlevel="1" lineno="189" slineno="2-32" level="2"><display>(a)</display>an associate's degree with at least 60 credit hours from an accredited post-secondary <ln numlevel="1" lineno="190" slineno="2-33"/>institution; or</subsection><subsection ssid="3-null-19" dnum="b-o" numlevel="1" lineno="191" slineno="2-34" level="2"><display>(b)</display>an industry certification with at least 500 hours of instruction from a business, trade <ln numlevel="1" lineno="192" slineno="2-35"/>association, or other industry group in accordance with Section <xref depth="3" refnumber="53E-3-501" start="0">53E-3-501</xref>.</subsection></subsection><subsection ssid="3-20" dnum="_-o:4-i" numlevel="1" lineno="193" slineno="2-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall ensure that an LEA complies with the requirements of Section <xref depth="3" refnumber="53G-4-416"><ln numlevel="1" lineno="194" slineno="2-37"/>53G-4-416</xref> regarding student graduation participation requirements.</amend></subsection></section></bsec><bsec buid="1" num="53G-4-416" type="enact" src="code" uid="C53G-4-S416_2026070120260701" sort="53G04 04160020260701" numlevel="1" lineno="195" slineno="3-1" sn="3"><section numlevel="1" lineno="196" slineno="3-2" number="53G-4-416" type="enact"><secline lineno="195">Section 3. Section <bold>53G-4-416</bold> is enacted to read:</secline><catline lineno="196"><bold>53G-4-416<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Student graduation participation and diploma <ln numlevel="1" lineno="197" slineno="3-3"/>requirements.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="198" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "graduation activities" means graduation ceremonies, <ln numlevel="1" lineno="199" slineno="3-5"/>commencement exercises, graduation celebrations, honors ceremonies, or other <ln numlevel="1" lineno="200" slineno="3-6"/>activities associated with graduation recognition.</amend></subsection><subsection ssid="1-4" dnum="_-o:2-i" numlevel="1" lineno="201" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="1-15" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall allow a student to participate in graduation activities if the LEA <ln numlevel="1" lineno="202" slineno="3-8"/>awards or will award a diploma to the student, including a student participating in an <ln numlevel="1" lineno="203" slineno="3-9"/>online program.</amend></subsection><subsection ssid="1-16" dnum="_-o:b-i" numlevel="1" lineno="204" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="53G-4-416(2)(a)">(2)(a)</xref>, an LEA may prohibit a student from participating <ln numlevel="1" lineno="205" slineno="3-11"/>in graduation activities if the LEA determines the student's participation presents <ln numlevel="1" lineno="206" slineno="3-12"/>significant safety concerns.</amend></subsection></subsection></section></bsec><bsec buid="17" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="207" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="207">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="208"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-20-26 3:20 PM</tm></rev></foot></leg>
