or</amend></subsection><subsection ssid="7-15" dnum="_-o:v-i" numlevel="1" lineno="45" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">a bonus.</amend></subsection></subsection><subsection ssid="7-7" dnum="_-o:b-i" numlevel="1" lineno="46" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">"Employer" means a person that employs at least 15 individuals in the state.</amend></subsection></subsection><subsection ssid="7-2" dnum="_-o:2-i" numlevel="1" lineno="47" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">For each position the employer advertises in a job listing, an employer shall disclose in <ln numlevel="1" lineno="48" slineno="2-13"/>the job listing:</amend><subsection ssid="7-3" dnum="_-o:a-i" numlevel="1" lineno="49" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the projected minimum wages;</amend></subsection><subsection ssid="7-4" dnum="_-o:b-i" numlevel="1" lineno="50" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the projected maximum wages; and</amend></subsection><subsection ssid="7-5" dnum="_-o:c-i" numlevel="1" lineno="51" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">each benefit that an employee may receive in the position.</amend></subsection></subsection></section></bsec><bsec buid="1" num="34-40-102" type="amend" src="code" uid="C34-40-S102_2026050620260506" sort="34 40 01020020260506" numlevel="1" lineno="52" slineno="3-1" sn="3"><section number="34-40-102" numlevel="1" lineno="53" slineno="3-2" type="amend"><secline lineno="52">Section 3. Section <bold>34-40-102</bold> is amended to read:</secline><catline lineno="53"><bold>34-40-102<parens/>. Definitions -- Joint employees -- Franchisors.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="54" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Subject to Subsection <xref depth="4" refnumber="34-40-102(3)" start="0">(3)</xref>, this chapter and the terms used in it, including the <ln numlevel="1" lineno="55" slineno="3-4"/>computation of wages, shall be interpreted consistently with the Fair Labor Standards <ln numlevel="1" lineno="56" slineno="3-5"/>Act of 1938, 29 U.S.C. Sec. 201 et seq., as amended, to the extent that act relates to the <ln numlevel="1" lineno="57" slineno="3-6"/>payment of a minimum wage.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="58" slineno="3-7" level="1"><display>(2)</display>As used in this chapter:<subsection ssid="1-18" dnum="_-o:a-i" numlevel="1" lineno="59" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Adjust for inflation" means an increase or a decrease in accordance with the <ln numlevel="1" lineno="60" slineno="3-9"/>seasonally adjusted Consumer Price Index for all urban consumers the that Bureau of <ln numlevel="1" lineno="61" slineno="3-10"/>Labor Statistics within the United States Department of Labor publishes.</amend></subsection><subsection ssid="1-null-3" dnum="a-o:b-i" numlevel="1" lineno="62" slineno="3-11" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>"Cash wage obligation" means an hourly wage that an employer pays a tipped <ln numlevel="1" lineno="63" slineno="3-12"/>employee regardless of the tips or gratuities a tipped employee receives.</subsection><subsection ssid="1-null-4" dnum="b-o:c-i" numlevel="1" lineno="64" slineno="3-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Commission" means the Labor Commission.</subsection><subsection ssid="1-null-5" dnum="c-o:d-i" numlevel="1" lineno="65" slineno="3-14" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Division" means the Division of Antidiscrimination and Labor in the <ln numlevel="1" lineno="66" slineno="3-15"/>commission.</subsection><subsection ssid="1-null-6" dnum="d-o:e-i" numlevel="1" lineno="67" slineno="3-16" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Federal executive agency" means an executive agency, as <amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">that term is </amend>defined <ln numlevel="1" lineno="68" slineno="3-17"/>in 5 U.S.C. Sec. 105, of the federal government.</subsection><subsection ssid="1-null-7" dnum="e-o:f-i" numlevel="1" lineno="69" slineno="3-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Franchise" means the same as that term is defined in 16 C.F.R. Sec. 436.1.</subsection><subsection ssid="1-null-8" dnum="f-o:g-i" numlevel="1" lineno="70" slineno="3-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Franchisee" means the same as that term is defined in 16 C.F.R. Sec. 436.1.</subsection><subsection ssid="1-null-9" dnum="g-o:h-i" numlevel="1" lineno="71" slineno="3-20" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>"Franchisor" means the same as that term is defined in 16 C.F.R. Sec. 436.1.</subsection><subsection ssid="1-null-10" dnum="h-o:i-i" numlevel="1" lineno="72" slineno="3-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>"Minimum wage" means the state minimum hourly wage for adult employees as <ln numlevel="1" lineno="73" slineno="3-22"/>established under this chapter, unless the context clearly indicates otherwise.</subsection><subsection ssid="1-null-11" dnum="i-o:j-i" numlevel="1" lineno="74" slineno="3-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>"Tipped employee" means an employee who customarily and regularly receives <ln numlevel="1" lineno="75" slineno="3-24"/>tips or gratuities.</subsection></subsection><subsection ssid="1-null-12" dnum="3-o" numlevel="1" lineno="76" slineno="3-25" level="1"><display>(3)</display>Notwithstanding Subsection <xref depth="4" refnumber="34-40-102(1)" start="0">(1)</xref>, for purposes of determining whether two or more <ln numlevel="1" lineno="77" slineno="3-26"/>persons are considered joint employers under this chapter, an administrative ruling of a <ln numlevel="1" lineno="78" slineno="3-27"/>federal executive agency may not be considered a generally applicable law unless that <ln numlevel="1" lineno="79" slineno="3-28"/>administrative ruling is determined to be generally applicable by a court of law, or <ln numlevel="1" lineno="80" slineno="3-29"/>adopted by statute or rule.</subsection><subsection ssid="1-null-13" dnum="4-o" numlevel="1" lineno="81" slineno="3-30" level="1" space="false"><display>(4)</display><subsection ssid="1-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For purposes of this chapter, a franchisor is not considered to be an employer of:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="82" slineno="3-31" level="3" tab="1"><display>(i)</display>a franchisee; or</subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="83" slineno="3-32" level="3" tab="1"><display>(ii)</display>a franchisee's employee.</subsection></subsection><subsection ssid="1-null-17" dnum="b-o" numlevel="1" lineno="84" slineno="3-33" level="2"><display>(b)</display>With respect to a specific claim for relief under this chapter made by a franchisee or <ln numlevel="1" lineno="85" slineno="3-34"/>a franchisee's employee, this Subsection <xref depth="4" refnumber="34-40-102(4)" start="0">(4)</xref> does not apply to a franchisor under a <ln numlevel="1" lineno="86" slineno="3-35"/>franchise that exercises a type or degree of control over the franchisee or the <ln numlevel="1" lineno="87" slineno="3-36"/>franchisee's employee not customarily exercised by a franchisor for the purpose of <ln numlevel="1" lineno="88" slineno="3-37"/>protecting the franchisor's trademarks and brand.</subsection></subsection></section></bsec><bsec buid="2" num="34-40-103" type="amend" src="code" uid="C34-40-S103_2026050620260506" sort="34 40 01030020260506" numlevel="1" lineno="89" slineno="4-1" sn="4"><section number="34-40-103" numlevel="1" lineno="90" slineno="4-2" type="amend"><secline lineno="89">Section 4. Section <bold>34-40-103</bold> is amended to read:</secline><catline lineno="90"><bold>34-40-103<parens/>. Minimum wage -- Commission to review and modify minimum wage.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="91" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-null-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1031" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="54" groupid="45" style="2" owner="jchristopherson" level="1" deltag="end">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">On or after May 6, 2026, the</amend> minimum wage for all private and public <ln numlevel="1" lineno="92" slineno="4-4"/>employees within the state <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">shall be $3.35 </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is $20 </amend>per hour.</subsection><subsection ssid="2-null-3" dnum="b-o:_-i" numlevel="1" lineno="93" slineno="4-5" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">Effective April 1, 1990, the minimum wage shall be $3.80 per hour.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-null-4" dnum="2-o" numlevel="1" lineno="94" slineno="4-6" level="1" space="false"><display>(2)</display><subsection ssid="2-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">After July 1, 1990, the </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="34-40-103(2)(b)">(2)(b)</xref>, the </amend>commission <ln numlevel="1" lineno="95" slineno="4-7"/>may by rule establish the minimum wage or wages as provided in this chapter that <ln numlevel="1" lineno="96" slineno="4-8"/>may be paid to employees in public and private employment within the state.</subsection><subsection ssid="2-null-6" dnum="b-o" numlevel="1" lineno="97" slineno="4-9" level="2"><display>(b)</display>The minimum wage,<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="48" style="2" owner="jchristopherson" level="1" deltag="both"> as established by the commission,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> that the commission <ln numlevel="1" lineno="98" slineno="4-10"/>establishes,</amend> may <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">not exceed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">not at any time be lower than:</amend><subsection ssid="2-13" dnum="_-o:i-i" numlevel="1" lineno="99" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both">(i)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>the federal minimum wage as provided in 29 U.S.C. Sec. 201 et seq., the Fair <ln numlevel="1" lineno="100" slineno="4-12"/>Labor Standards Act of 1938, as amended, in effect at the time of implementation <ln numlevel="1" lineno="101" slineno="4-13"/>of this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="2-14" dnum="_-o:ii-i" numlevel="1" lineno="102" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">the minimum wage established in Subsection <xref depth="4" refnumber="34-40-103(1)">(1)</xref>.</amend></subsection></subsection></subsection><subsection ssid="2-null-7" dnum="c-o:3-i" numlevel="1" lineno="103" slineno="4-15" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The commission:<subsection ssid="2-null-8" dnum="i-o:a-i" numlevel="1" lineno="104" slineno="4-16" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1039" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>may review the minimum wage at any time;</subsection><subsection ssid="2-null-9" dnum="ii-o:_-i" numlevel="1" lineno="105" slineno="4-17" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1040" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="41" groupid="34" style="2" owner="jchristopherson" level="1" deltag="end">shall review the minimum wage at least every three years; and</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-10" dnum="iii-o:b-i" numlevel="1" lineno="106" slineno="4-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>shall review the minimum wage whenever the federal minimum wage is <ln numlevel="1" lineno="107" slineno="4-19"/>changed<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="2-15" dnum="_-o:c-i" numlevel="1" lineno="108" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">shall, in accordance with Subsection <xref depth="4" refnumber="34-40-103(2)(a)">(2)(a)</xref>, adjust for inflation the minimum wage at <ln numlevel="1" lineno="109" slineno="4-21"/>least once per calendar year.</amend></subsection></subsection><subsection ssid="2-null-11" dnum="3-o:_-i" numlevel="1" lineno="110" slineno="4-22" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1043" style="2" owner="o" level="1" deltag="start">(3)</amend></display><amend anum="0" ea="erase" pairid="38" groupid="32" style="2" owner="jchristopherson" level="1" deltag="end">The commission may provide for separate minimum hourly wages for minors.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="3" num="34-40-106" type="amend" src="code" uid="C34-40-S106_2026050620260506" sort="34 40 01060020260506" numlevel="1" lineno="111" slineno="5-1" sn="5"><section number="34-40-106" numlevel="1" lineno="112" slineno="5-2" type="amend"><secline lineno="111">Section 5. Section <bold>34-40-106</bold> is amended to read:</secline><catline lineno="112"><bold>34-40-106<parens/>. Limitations on minimum wage imposed by cities, towns, or counties.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="113" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>A city, town, or county may not establish, mandate, or require a minimum wage that <ln numlevel="1" lineno="114" slineno="5-4"/>exceeds <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">the federal minimum wage as provided in 29 U.S.C. Sec. 201 et seq., Fair <ln numlevel="1" lineno="115" slineno="5-5"/>Labor Standards Act of 1938</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the established minimum wage under Section <xref depth="3" refnumber="34-40-103">34-40-103</xref></amend>.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="116" slineno="5-6" level="1" space="false"><display>(2)</display><subsection ssid="3-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A city, town, or county may not require that a person who contracts with the city, <ln numlevel="1" lineno="117" slineno="5-7"/>town, or county pay that person's employees a wage that exceeds the federal <ln numlevel="1" lineno="118" slineno="5-8"/>minimum wage as provided in 29 U.S.C. Sec. 201 et seq., Fair Labor Standards Act <ln numlevel="1" lineno="119" slineno="5-9"/>of 1938.</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="120" slineno="5-10" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="34-40-106(2)(a)" start="0">(2)(a)</xref> does not apply when federal law requires the payment of a <ln numlevel="1" lineno="121" slineno="5-11"/>specified wage to persons working on projects funded in whole or in part by federal <ln numlevel="1" lineno="122" slineno="5-12"/>funds.</subsection><subsection ssid="3-null-5" dnum="c-o" numlevel="1" lineno="123" slineno="5-13" level="2"><display>(c)</display>Subsection <xref depth="4" refnumber="34-40-106(2)(a)" start="0">(2)(a)</xref> applies to contracts executed on or after April 30, 2001.</subsection></subsection><subsection ssid="3-null-6" dnum="3-o" numlevel="1" lineno="124" slineno="5-14" level="1" space="false"><display>(3)</display><subsection ssid="3-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a city, town, or county contracts with a person for the direct purchase of goods <ln numlevel="1" lineno="125" slineno="5-15"/>or services, in awarding or otherwise executing that contract, the city, town, or <ln numlevel="1" lineno="126" slineno="5-16"/>county may not give any preferential treatment to a person on the basis that the <ln numlevel="1" lineno="127" slineno="5-17"/>person pays that person's employees a wage that exceeds the minimum wage as <ln numlevel="1" lineno="128" slineno="5-18"/>provided in 29 U.S.C. 201 et seq., Fair Labor Standards Act of 1938.</subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="129" slineno="5-19" level="2"><display>(b)</display>This Subsection <xref depth="4" refnumber="34-40-106(3)" start="0">(3)</xref> does not apply when federal law requires the consideration of <ln numlevel="1" lineno="130" slineno="5-20"/>whether a person pays the person's employees a specified wage to persons working <ln numlevel="1" lineno="131" slineno="5-21"/>on projects funded in whole or in part by federal funds.</subsection><subsection ssid="3-null-9" dnum="c-o" numlevel="1" lineno="132" slineno="5-22" level="2"><display>(c)</display>This Subsection <xref depth="4" refnumber="34-40-106(3)" start="0">(3)</xref> applies to contracts executed on or after May 2, 2005.</subsection></subsection><subsection ssid="3-null-10" dnum="4-o" numlevel="1" lineno="133" slineno="5-23" level="1" space="false"><display>(4)</display><subsection ssid="3-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The restrictions of this section on a city, town, or county apply to any entity <ln numlevel="1" lineno="134" slineno="5-24"/>created by the city, town, or county.</subsection><subsection ssid="3-null-12" dnum="b-o" numlevel="1" lineno="135" slineno="5-25" level="2"><display>(b)</display>This Subsection <xref depth="4" refnumber="34-40-106(4)" start="0">(4)</xref> applies to contracts executed on or after May 2, 2005.</subsection></subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="136" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="136">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="137"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-21-26 2:23 PM</tm></rev></foot></leg>
