Section <bold>32B-2-304</bold> is amended to read:</secline><catline lineno="34"><bold>32B-2-304<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Liquor price -- Remittance of markup -- School <ln numlevel="1" lineno="35" slineno="1-3"/>lunch program.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>For purposes of this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="37" slineno="1-5" level="2" space="false"><display>(a)</display><subsection ssid="1-null-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Landed case cost" means the sum of:<subsection ssid="1-null-4" dnum="A-o" numlevel="1" lineno="38" slineno="1-6" level="4" tab="1"><display>(A)</display>the cost of the product; </subsection><subsection ssid="1-null-5" dnum="B-o" numlevel="1" lineno="39" slineno="1-7" level="4" tab="1"><display>(B)</display>inbound shipping costs the department incurs; and</subsection><subsection ssid="1-null-6" dnum="C-o" numlevel="1" lineno="40" slineno="1-8" level="4" tab="1"><display>(C)</display>case handling costs the department incurs.</subsection></subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="41" slineno="1-9" level="3"><display>(ii)</display>"Landed case cost" does not include the outbound shipping cost from a <ln numlevel="1" lineno="42" slineno="1-10"/>warehouse of the department to a state store.</subsection></subsection><subsection ssid="1-null-8" dnum="b-o" numlevel="1" lineno="43" slineno="1-11" level="2"><display>(b)</display>"Proof gallon" means the same as that term is defined in 26 U.S.C. Sec. 5002.</subsection></subsection><subsection ssid="1-null-9" dnum="2-o" numlevel="1" lineno="44" slineno="1-12" level="1"><display>(2)</display>Except as provided in Subsections <xref depth="4" refnumber="32B-2-304(3)">(3)</xref> and <xref depth="4" refnumber="32B-2-304(4)">(4)</xref>:<subsection ssid="1-null-10" dnum="a-o" numlevel="1" lineno="45" slineno="1-13" level="2"><display>(a)</display>spirituous liquor sold by the department within the state shall be marked up in an <ln numlevel="1" lineno="46" slineno="1-14"/>amount not less than 88.5% above the landed case cost to the department;</subsection><subsection ssid="1-null-11" dnum="b-o" numlevel="1" lineno="47" slineno="1-15" level="2"><display>(b)</display>wine sold by the department within the state shall be marked up in an amount not <ln numlevel="1" lineno="48" slineno="1-16"/>less than 88.5% above the landed case cost to the department;</subsection><subsection ssid="1-null-12" dnum="c-o" numlevel="1" lineno="49" slineno="1-17" level="2"><display>(c)</display>heavy beer sold by the department within the state shall be marked up in an amount <ln numlevel="1" lineno="50" slineno="1-18"/>not less than 66.5% above the landed case cost to the department; and</subsection><subsection ssid="1-null-13" dnum="d-o" numlevel="1" lineno="51" slineno="1-19" level="2"><display>(d)</display>a flavored malt beverage sold by the department within the state shall be marked up <ln numlevel="1" lineno="52" slineno="1-20"/>in an amount not less than 88.5% above the landed case cost to the department.</subsection></subsection><subsection ssid="1-null-14" dnum="3-o" numlevel="1" lineno="53" slineno="1-21" level="1" space="false"><display>(3)</display><subsection ssid="1-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Liquor sold by the department to a military installation in Utah shall be marked up <ln numlevel="1" lineno="54" slineno="1-22"/>in an amount not less than 17% above the landed case cost to the department.</subsection><subsection ssid="1-null-16" dnum="b-o" numlevel="1" lineno="55" slineno="1-23" level="2"><display>(b)</display>Except for spirituous liquor sold by the department to a military installation in Utah, <ln numlevel="1" lineno="56" slineno="1-24"/>spirituous liquor that is sold by the department within the state shall be marked up <ln numlevel="1" lineno="57" slineno="1-25"/>49% above the landed case cost to the department if:<subsection ssid="1-null-17" dnum="i-o" numlevel="1" lineno="58" slineno="1-26" level="3"><display>(i)</display>the spirituous liquor is manufactured by a manufacturer producing less than <ln numlevel="1" lineno="59" slineno="1-27"/>30,000 proof gallons of spirituous liquor in a calendar year; and</subsection><subsection ssid="1-null-18" dnum="ii-o" numlevel="1" lineno="60" slineno="1-28" level="3"><display>(ii)</display>the manufacturer applies to the department for a reduced markup.</subsection></subsection><subsection ssid="1-null-19" dnum="c-o" numlevel="1" lineno="61" slineno="1-29" level="2"><display>(c)</display>Except for wine sold by the department to a military installation in Utah, wine that is <ln numlevel="1" lineno="62" slineno="1-30"/>sold by the department within the state shall be marked up 49% above the landed <ln numlevel="1" lineno="63" slineno="1-31"/>case cost to the department if:<subsection ssid="1-null-20" dnum="i-o" numlevel="1" lineno="64" slineno="1-32" level="3" space="false"><display>(i)</display><subsection ssid="1-null-21" dnum="A-o" level="4" placement="sameline"><display>(A)</display>except as provided in Subsection <xref depth="4" refnumber="32B-2-304(3)(c)(i)(b)">(3)(c)(i)(B)</xref>, the wine is manufactured by a <ln numlevel="1" lineno="65" slineno="1-33"/>manufacturer producing less than 20,000 gallons of wine in a calendar year; or</subsection><subsection ssid="1-null-22" dnum="B-o" numlevel="1" lineno="66" slineno="1-34" level="4"><display>(B)</display>for hard cider, the hard cider is manufactured by a manufacturer producing <ln numlevel="1" lineno="67" slineno="1-35"/>less than 620,000 gallons of hard cider in a calendar year; and</subsection></subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="68" slineno="1-36" level="3"><display>(ii)</display>the manufacturer applies to the department for a reduced markup.</subsection></subsection><subsection ssid="1-null-24" dnum="d-o" numlevel="1" lineno="69" slineno="1-37" level="2"><display>(d)</display>Except for heavy beer sold by the department to a military installation in Utah, heavy <ln numlevel="1" lineno="70" slineno="1-38"/>beer that is sold by the department within the state shall be marked up 32% above the <ln numlevel="1" lineno="71" slineno="1-39"/>landed case cost to the department if:<subsection ssid="1-null-25" dnum="i-o" numlevel="1" lineno="72" slineno="1-40" level="3"><display>(i)</display>a small brewer manufactures the heavy beer; and</subsection><subsection ssid="1-null-26" dnum="ii-o" numlevel="1" lineno="73" slineno="1-41" level="3"><display>(ii)</display>the small brewer applies to the department for a reduced markup.</subsection></subsection><subsection ssid="1-null-27" dnum="e-o" numlevel="1" lineno="74" slineno="1-42" level="2"><display>(e)</display>The department shall:<subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="75" slineno="1-43" level="3"><display>(i)</display>for purposes of Subsections <xref depth="4" refnumber="32B-2-304(3)(b)">(3)(b)</xref> and <xref depth="4" refnumber="32B-2-304(c)">(c)</xref>, calculate the production amount of a <ln numlevel="1" lineno="76" slineno="1-44"/>manufacturer:<subsection ssid="1-null-29" dnum="A-o" numlevel="1" lineno="77" slineno="1-45" level="4"><display>(A)</display>by, if the manufacturer is part of a controlled group of manufacturers, <ln numlevel="1" lineno="78" slineno="1-46"/>including the combined volume totals of spirituous liquor, wine, or cider, as <ln numlevel="1" lineno="79" slineno="1-47"/>applicable, for all manufacturers that constitute the controlled group of <ln numlevel="1" lineno="80" slineno="1-48"/>manufacturers; and</subsection><subsection ssid="1-null-30" dnum="B-o" numlevel="1" lineno="81" slineno="1-49" level="4"><display>(B)</display>without considering the manufacturer's production of any other type of <ln numlevel="1" lineno="82" slineno="1-50"/>alcoholic product; and</subsection></subsection><subsection ssid="1-null-31" dnum="ii-o" numlevel="1" lineno="83" slineno="1-51" level="3"><display>(ii)</display>verify that a manufacturer meets a production amount described in Subsection <xref depth="4" refnumber="32B-2-304(3)(b)"><ln numlevel="1" lineno="84" slineno="1-52"/>(3)(b)</xref> or <xref depth="4" refnumber="32B-2-304(c)">(c)</xref> and the production amount of a small brewer under a federal or other <ln numlevel="1" lineno="85" slineno="1-53"/>verifiable production report.</subsection></subsection><subsection ssid="1-null-32" dnum="f-o" numlevel="1" lineno="86" slineno="1-54" level="2"><display>(f)</display>A manufacturer seeking to obtain a reduced markup under Subsection <xref depth="4" refnumber="32B-2-304(3)(b)">(3)(b)</xref>, (c), or <ln numlevel="1" lineno="87" slineno="1-55"/>(d), shall provide to the department any documentation or information the department <ln numlevel="1" lineno="88" slineno="1-56"/>determines necessary to determine if the manufacturer is part of a controlled group of <ln numlevel="1" lineno="89" slineno="1-57"/>manufacturers.</subsection><subsection ssid="1-null-33" dnum="g-o" numlevel="1" lineno="90" slineno="1-58" level="2"><display>(g)</display>The department may, at any time, revoke a reduced markup granted to a <ln numlevel="1" lineno="91" slineno="1-59"/>manufacturer under Subsection <xref depth="4" refnumber="32B-2-304(3)(b)">(3)(b)</xref>, (c), or (d), if the department determines the <ln numlevel="1" lineno="92" slineno="1-60"/>manufacturer no longer qualifies for the reduced markup.</subsection></subsection><subsection ssid="1-null-34" dnum="4-o" numlevel="1" lineno="93" slineno="1-61" level="1"><display>(4)</display>Wine the department purchases on behalf of a subscriber through the wine subscription <ln numlevel="1" lineno="94" slineno="1-62"/>program established in Section <xref depth="3" refnumber="32B-2-702">32B-2-702</xref> shall be marked up not less than 88.5% above <ln numlevel="1" lineno="95" slineno="1-63"/>the cost of the subscription for the interval in which the wine is purchased.</subsection><subsection ssid="1-null-35" dnum="5-o" numlevel="1" lineno="96" slineno="1-64" level="1" space="false"><display>(5)</display><subsection ssid="1-48" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The department shall deposit 10% of the total gross revenue from sales of liquor <ln numlevel="1" lineno="97" slineno="1-65"/>with the state treasurer to be credited to the Uniform School Fund and used to support <ln numlevel="1" lineno="98" slineno="1-66"/>the school meals program <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">administered by the State Board of Education</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the State <ln numlevel="1" lineno="99" slineno="1-67"/>Board of Education administers</amend> under Section <xref depth="3" refnumber="53E-3-510">53E-3-510</xref>.</subsection><subsection ssid="1-49" dnum="_-o:b-i" numlevel="1" lineno="100" slineno="1-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="5" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="47" m-groupid="14" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">The State Board of Education shall use up to 5% of the funds credited to the Uniform <ln numlevel="1" lineno="101" slineno="1-69"/>School Fund under Subsection <xref depth="4" refnumber="32B-2-304(5)(a)">(5)(a)</xref> to pay the cost of lunch for an eligible student, <ln numlevel="1" lineno="102" slineno="1-70"/>as that term is defined in Subsection <xref depth="4" refnumber="53F-2-423(1)(b)">53F-2-423(1)(b)</xref>:</amend><subsection ssid="1-50" dnum="_-o:i-i" numlevel="1" lineno="103" slineno="1-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">that does not qualify for reduce-price meals under the National School Lunch <ln numlevel="1" lineno="104" slineno="1-72"/>Program; and</amend></subsection><subsection ssid="1-51" dnum="_-o:ii-i" numlevel="1" lineno="105" slineno="1-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">whose family income is at or below 200% of the federal poverty level.</amend></subsection></subsection></subsection><subsection ssid="1-null-36" dnum="6-o" numlevel="1" lineno="106" slineno="1-74" level="1" space="false"><display>(6)</display><subsection ssid="1-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each month, the department shall collect from each package agency located at a <ln numlevel="1" lineno="107" slineno="1-75"/>manufacturing facility owned or operated by a person licensed under Chapter 11, <ln numlevel="1" lineno="108" slineno="1-76"/>Manufacturing and Related Licenses Act, 12.295% of the package agency's reported <ln numlevel="1" lineno="109" slineno="1-77"/>monthly revenue and deposit the money as follows:<subsection ssid="1-null-38" dnum="i-o" numlevel="1" lineno="110" slineno="1-78" level="3" tab="1"><display>(i)</display>1.695% of the reported monthly revenue into the Alcoholic Beverage Control Act <ln numlevel="1" lineno="111" slineno="1-79"/>Enforcement Fund;</subsection><subsection ssid="1-null-39" dnum="ii-o" numlevel="1" lineno="112" slineno="1-80" level="3" tab="1"><display>(ii)</display>10% of the reported monthly revenue into the Uniform School Fund and used to <ln numlevel="1" lineno="113" slineno="1-81"/>support the school meals program administered by the State Board of Education <ln numlevel="1" lineno="114" slineno="1-82"/>under Section <xref depth="3" refnumber="53E-3-510">53E-3-510</xref>; and</subsection><subsection ssid="1-null-40" dnum="iii-o" numlevel="1" lineno="115" slineno="1-83" level="3" tab="1"><display>(iii)</display>0.60% of the reported monthly revenue into the Underage Drinking Prevention <ln numlevel="1" lineno="116" slineno="1-84"/>Media and Education Campaign Restricted Account.</subsection></subsection><subsection ssid="1-null-41" dnum="b-o" numlevel="1" lineno="117" slineno="1-85" level="2"><display>(b)</display>The department may collect a fee established in accordance with Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref> <ln numlevel="1" lineno="118" slineno="1-86"/>from a package agency described in this subsection to cover the costs of regulation.</subsection></subsection><subsection ssid="1-null-42" dnum="7-o" numlevel="1" lineno="119" slineno="1-87" level="1"><display>(7)</display>This section does not prohibit the department from selling discontinued items at a <ln numlevel="1" lineno="120" slineno="1-88"/>discount.</subsection><subsection ssid="1-null-43" dnum="8-o" numlevel="1" lineno="121" slineno="1-89" level="1"><display>(8)</display>The Legislature shall annually appropriate to support substance use disorder treatment <ln numlevel="1" lineno="122" slineno="1-90"/>services, an amount equal to the revenue generated from a 0.5% markup above the <ln numlevel="1" lineno="123" slineno="1-91"/>landed case cost to the department on spirituous liquor.</subsection></section></bsec><bsec buid="11" num="53E-1-201" type="amend" src="code" uid="C53E-1-S201_2026070120260701" sort="53E01 02010020260701" numlevel="1" lineno="124" slineno="2-1" sn="2"><section number="53E-1-201" numlevel="1" lineno="125" slineno="2-2" type="amend"><secline lineno="124">Section 2. School meal program.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="242" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="243" slineno="4-4" level="2"><display>(a)</display>"Education model health and wellness policy on nutrition" means state board policy <ln numlevel="1" lineno="244" slineno="4-5"/>emphasizing that an LEA promote efficient meal scheduling, provide adequate time <ln numlevel="1" lineno="245" slineno="4-6"/>for eating, and implement practices that help reduce food waste.</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="246" slineno="4-7" level="2"><display>(b)</display>"Eligible student" means a student<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="141" groupid="115" style="2" owner="jchristopherson" level="1" deltag="both"> enrolled in </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="4-25" dnum="_-o:i-i" numlevel="1" lineno="247" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">enrolled in </amend>kindergarten through grade 12 who qualifies for reduced-price meals <ln numlevel="1" lineno="248" slineno="4-9"/>based on household size and income levels under the National School Lunch <ln numlevel="1" lineno="249" slineno="4-10"/>Program<amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both">; or</amend></subsection><subsection ssid="4-24" dnum="_-o:ii-i" numlevel="1" lineno="250" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="4-47" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="120" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="12" m-groupid="11" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">enrolled at a school participating in the National School Lunch Program, <ln numlevel="1" lineno="251" slineno="4-12"/>enrolled in kindergarten through grade 6; and</amend></subsection><subsection ssid="4-48" dnum="_-o:B-i" numlevel="1" lineno="252" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">whose family income is at or below 200% of the federal poverty level</amend>.</subsection></subsection></subsection><subsection ssid="4-null-4" dnum="c-o" numlevel="1" lineno="253" slineno="4-14" level="2"><display>(c)</display>"National School Lunch Program" means the same as that term is defined in 7 C.F.R. <ln numlevel="1" lineno="254" slineno="4-15"/>Sec. 210.2.</subsection><subsection ssid="4-null-5" dnum="d-o" numlevel="1" lineno="255" slineno="4-16" level="2"><display>(d)</display>"Share table program" means a system in a school where a student may return <ln numlevel="1" lineno="256" slineno="4-17"/>unopened, uneaten food or beverages to a designated location for redistribution to <ln numlevel="1" lineno="257" slineno="4-18"/>other students.</subsection></subsection><subsection ssid="4-null-6" dnum="2-o" numlevel="1" lineno="258" slineno="4-19" level="1"><display>(2)</display>An LEA participating in the National School Lunch Program shall provide lunch to an <ln numlevel="1" lineno="259" slineno="4-20"/>eligible student on a school day at no charge.</subsection><subsection ssid="4-null-7" dnum="3-o" numlevel="1" lineno="260" slineno="4-21" level="1"><display>(3)</display>The state board:<subsection ssid="4-null-8" dnum="a-o" numlevel="1" lineno="261" slineno="4-22" level="2"><display>(a)</display>shall:<subsection ssid="4-null-9" dnum="i-o" numlevel="1" lineno="262" slineno="4-23" level="3"><display>(i)</display><amend anum="0" ea="amend" pairid="127" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="both">except for the eligible students described in Subsection <xref depth="4" refnumber="53F-2-423(3)(a)(ii)">(3)(a)(ii)</xref> and </amend>subject to <ln numlevel="1" lineno="263" slineno="4-24"/>legislative appropriations, reimburse an LEA for each reimbursable lunch <ln numlevel="1" lineno="264" slineno="4-25"/>provided under this section in an amount equal to the difference between the <ln numlevel="1" lineno="265" slineno="4-26"/>federal reimbursement rates for a meal and a reduced-price meal, as determined <ln numlevel="1" lineno="266" slineno="4-27"/>annually by the United States Department of Agriculture;</subsection><subsection ssid="4-40" dnum="_-o:ii-i" numlevel="1" lineno="267" slineno="4-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">subject to legislative appropriations, reimburse an LEA for each reimbursable <ln numlevel="1" lineno="268" slineno="4-29"/>lunch an LEA provides to an eligible student described in Subsection <xref depth="4" refnumber="53F-2-423(1)(b)(ii)">(1)(b)(ii)</xref> in <ln numlevel="1" lineno="269" slineno="4-30"/>an amount equal to the lower of the:</amend><subsection ssid="4-41" dnum="_-o:A-i" numlevel="1" lineno="270" slineno="4-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">price the LEA establishes for a paid lunch; or</amend></subsection><subsection ssid="4-43" dnum="_-o:B-i" numlevel="1" lineno="271" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">the statewide average price for a paid lunch, as the state board determines <ln numlevel="1" lineno="272" slineno="4-33"/>annually;</amend></subsection></subsection><subsection ssid="4-null-10" dnum="ii-o:iii-i" numlevel="1" lineno="273" slineno="4-34" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1113" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>establish a reimbursement system where the board provides a monthly <ln numlevel="1" lineno="274" slineno="4-35"/>reimbursement to an LEA that provides a meal under Subsection <xref refnumber="53F-2-422(2)" depth="4">(2)</xref>;</subsection><subsection ssid="4-27" dnum="_-o:iv-i" numlevel="1" lineno="275" slineno="4-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">on or before the October 2026 interim meetings of the Education Interim <ln numlevel="1" lineno="276" slineno="4-37"/>Committee and the Public Education Appropriations Subcommittee, report to the <ln numlevel="1" lineno="277" slineno="4-38"/>Education Interim Committee and the Public Education Appropriations <ln numlevel="1" lineno="278" slineno="4-39"/>Subcommittee the information the state board receives from each LEA under the <ln numlevel="1" lineno="279" slineno="4-40"/>report described in Subsection <xref depth="4" refnumber="53F-2-423(5)(b)">(5)(b)</xref>;</amend> and</subsection><subsection ssid="4-null-11" dnum="iii-o:v-i" numlevel="1" lineno="280" slineno="4-41" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1115" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>accept private donations and grants for the purpose of funding the school <ln numlevel="1" lineno="281" slineno="4-42"/>meal program described in this section; and</subsection></subsection><subsection ssid="4-null-12" dnum="b-o" numlevel="1" lineno="282" slineno="4-43" level="2"><display>(b)</display>may provide guidance and support to a school implementing the food waste <ln numlevel="1" lineno="283" slineno="4-44"/>prevention strategies described in Subsection <xref refnumber="53F-2-422(6)" depth="4">(6)</xref>.</subsection></subsection><subsection ssid="4-null-13" dnum="4-o" numlevel="1" lineno="284" slineno="4-45" level="1"><display>(4)</display>An LEA may not:<subsection ssid="4-null-14" dnum="a-o" numlevel="1" lineno="285" slineno="4-46" level="2"><display>(a)</display>publicly identify or stigmatize a student unable to pay for a meal; or</subsection><subsection ssid="4-null-15" dnum="b-o" numlevel="1" lineno="286" slineno="4-47" level="2"><display>(b)</display>require a student to perform chores to pay for a meal unless the requirement applies <ln numlevel="1" lineno="287" slineno="4-48"/>equally to all students regardless of whether the student pays for the meal.</subsection></subsection><subsection ssid="4-null-16" dnum="5-o" numlevel="1" lineno="288" slineno="4-49" level="1"><display>(5)</display>An LEA shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="4-29" dnum="_-o:a-i" numlevel="1" lineno="289" slineno="4-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">on or before October 1, 2026, submit a report to the state board that includes:</amend><subsection ssid="4-30" dnum="_-o:i-i" numlevel="1" lineno="290" slineno="4-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">detailed accounting of any funds the LEA receives from liquor revenues described <ln numlevel="1" lineno="291" slineno="4-52"/>in Section <xref depth="3" refnumber="32B-2-304">32B-2-304</xref>;</amend></subsection><subsection ssid="4-31" dnum="_-o:ii-i" numlevel="1" lineno="292" slineno="4-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">a description of how the LEA expends liquor revenues, including the specific <ln numlevel="1" lineno="293" slineno="4-54"/>programs, services, or purposes for which the LEA uses the funds;</amend></subsection><subsection ssid="4-32" dnum="_-o:iii-i" numlevel="1" lineno="294" slineno="4-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">the total cost that the LEA incurred to provide meals to students during the <ln numlevel="1" lineno="295" slineno="4-56"/>2025-2026 school year; and</amend></subsection><subsection ssid="4-34" dnum="_-o:iv-i" numlevel="1" lineno="296" slineno="4-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">the amount of state and local funds that the LEA uses to supplement federal <ln numlevel="1" lineno="297" slineno="4-58"/>funds for student meals; and</amend></subsection></subsection><subsection ssid="4-28" dnum="_-o:b-i" numlevel="1" lineno="298" slineno="4-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>direct communications regarding a student's meal debt only to the student's parent.</subsection></subsection><subsection ssid="4-null-17" dnum="6-o" numlevel="1" lineno="299" slineno="4-60" level="1"><display>(6)</display>An LEA participating in the National School Lunch Program shall consider, where <ln numlevel="1" lineno="300" slineno="4-61"/>feasible, reducing food waste by:<subsection ssid="4-null-18" dnum="a-o" numlevel="1" lineno="301" slineno="4-62" level="2"><display>(a)</display>following the education model health and wellness policy on nutrition; and</subsection><subsection ssid="4-null-19" dnum="b-o" numlevel="1" lineno="302" slineno="4-63" level="2"><display>(b)</display>establishing a share table program.</subsection></subsection><subsection ssid="4-null-20" dnum="7-o" numlevel="1" lineno="303" slineno="4-64" level="1" space="false"><display>(7)</display><subsection ssid="4-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref tempid="726" depth="4" refnumber="53F-2-422(3)(a)(i)">(3)(a)(i)</xref>, if appropriations are insufficient to fully <ln numlevel="1" lineno="304" slineno="4-65"/>reimburse each LEA for the cost of a reimbursable lunch described in this section, the <ln numlevel="1" lineno="305" slineno="4-66"/>state board shall distribute the available funds in the fourth quarter of the fiscal year <ln numlevel="1" lineno="306" slineno="4-67"/>to each LEA on a pro rata basis, not exceeding the available funds.</subsection><subsection ssid="4-null-22" dnum="b-o" numlevel="1" lineno="307" slineno="4-68" level="2"><display>(b)</display>An LEA may ask the parent of an eligible student to cover the remaining cost of a <ln numlevel="1" lineno="308" slineno="4-69"/>subsidized lunch under this section.</subsection></subsection><subsection ssid="4-44" dnum="_-o:8-i" numlevel="1" lineno="309" slineno="4-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="53F-2-423(2)">(2)</xref>, an LEA or school is exempt from the requirement to <ln numlevel="1" lineno="310" slineno="4-71"/>provide lunch at no charge under this section if the LEA or school:</amend><subsection ssid="4-45" dnum="_-o:a-i" numlevel="1" lineno="311" slineno="4-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">participates in the federal Community Eligibility Provision, or any other federal <ln numlevel="1" lineno="312" slineno="4-73"/>program that provides universal free meals to students; or</amend></subsection><subsection ssid="4-46" dnum="_-o:b-i" numlevel="1" lineno="313" slineno="4-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">chooses to provide free meals separate from the programs described in Subsection <xref depth="4" refnumber="53F-2-423(8)(a)"><ln numlevel="1" lineno="314" slineno="4-75"/>(8)(a)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="8" num="53F-9-204" type="amend" src="code" uid="C53F-9-S204_2026070120260701" sort="53F09 02040020260701" numlevel="1" lineno="315" slineno="5-1" sn="5"><section number="53F-9-204" numlevel="1" lineno="316" slineno="5-2" type="amend"><secline lineno="315">Section 5. Public Education Economic Stabilization <ln numlevel="1" lineno="317" slineno="5-3"/>Restricted Account.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="318" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>There is created within the Uniform School Fund a restricted account known as the <ln numlevel="1" lineno="319" slineno="5-5"/>"Public Education Economic Stabilization Restricted Account."</subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="320" slineno="5-6" level="1" space="false"><display>(2)</display><subsection ssid="8-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53F-9-204(2)(b)">(2)(b)</xref>, the account shall be funded from the <ln numlevel="1" lineno="321" slineno="5-7"/>following revenue sources:<subsection ssid="8-null-4" dnum="i-o" numlevel="1" lineno="322" slineno="5-8" level="3" tab="1"><display>(i)</display>15% of the difference between, as determined by the Office of the Legislative <ln numlevel="1" lineno="323" slineno="5-9"/>Fiscal Analyst:<subsection ssid="8-null-5" dnum="A-o" numlevel="1" lineno="324" slineno="5-10" level="4"><display>(A)</display>the estimated amount of ongoing Income Tax Fund and Uniform School Fund <ln numlevel="1" lineno="325" slineno="5-11"/>revenue available for the Legislature to appropriate for the next fiscal year; and</subsection><subsection ssid="8-null-6" dnum="B-o" numlevel="1" lineno="326" slineno="5-12" level="4"><display>(B)</display>the amount of ongoing appropriations from the Income Tax Fund and Uniform <ln numlevel="1" lineno="327" slineno="5-13"/>School Fund in the current fiscal year; and</subsection></subsection><subsection ssid="8-null-7" dnum="ii-o" numlevel="1" lineno="328" slineno="5-14" level="3" tab="1"><display>(ii)</display>other appropriations as the Legislature may designate.</subsection></subsection><subsection ssid="8-null-8" dnum="b-o" numlevel="1" lineno="329" slineno="5-15" level="2"><display>(b)</display>If the appropriation described in Subsection <xref depth="4" refnumber="53F-9-204(2)(a)">(2)(a)</xref> would cause the ongoing <ln numlevel="1" lineno="330" slineno="5-16"/>appropriations to the account to exceed 11% of Uniform School Fund appropriations <ln numlevel="1" lineno="331" slineno="5-17"/>described in Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref> for the same fiscal year, the Legislature shall <ln numlevel="1" lineno="332" slineno="5-18"/>appropriate only those funds necessary to ensure that the ongoing appropriations to <ln numlevel="1" lineno="333" slineno="5-19"/>the account equal 11% of Uniform School Fund appropriations for that fiscal year.</subsection></subsection><subsection ssid="8-null-9" dnum="3-o" numlevel="1" lineno="334" slineno="5-20" level="1"><display>(3)</display>Subject to the availability of ongoing appropriations to the account, in accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both"><eol numlevel="1" lineno="335" slineno="5-21"/></amend><amendoutend style="2"/>Utah Constitution, Article X, Section 5, Subsection <xref depth="4" refnumber="53F-9-204(4)">(4)</xref>, the ongoing appropriation to <ln numlevel="1" lineno="336" slineno="5-22"/>the account shall be used to fund:<subsection ssid="8-null-10" dnum="a-o" numlevel="1" lineno="337" slineno="5-23" level="2"><display>(a)</display>except for a year described in Subsection <xref depth="4" refnumber="53F-9-204(3)(b)">(3)(b)</xref> or <xref depth="4" refnumber="53F-9-204(c)">(c)</xref>, one-time appropriations to the <ln numlevel="1" lineno="338" slineno="5-24"/>public education system, including<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="8-29" dnum="_-o:i-i" numlevel="1" lineno="339" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>at least $65,000,000 to the Catalyst Center Grant Program described in Section <xref depth="3" refnumber="53E-3-507.1"><ln numlevel="1" lineno="340" slineno="5-26"/>53E-3-507.1</xref>;<amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="8-28" dnum="_-o:ii-i" numlevel="1" lineno="341" slineno="5-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">if the liquor revenue described in Subsection <xref depth="4" refnumber="53F-2-423(5)(b)">53F-2-423(5)(b)</xref> is insufficient to <ln numlevel="1" lineno="342" slineno="5-28"/>cover the costs of the school meal program described in Section <xref depth="3" refnumber="53F-2-423">53F-2-423</xref>, up to <ln numlevel="1" lineno="343" slineno="5-29"/>$5,000,000 to cover the costs associated with the school meal program;</amend></subsection></subsection><subsection ssid="8-null-11" dnum="b-o" numlevel="1" lineno="344" slineno="5-30" level="2"><display>(b)</display>the Minimum School Program for a year in which Income Tax Fund revenue and <ln numlevel="1" lineno="345" slineno="5-31"/>Uniform School Fund revenue are insufficient to fund:<subsection ssid="8-null-12" dnum="i-o" numlevel="1" lineno="346" slineno="5-32" level="3"><display>(i)</display>ongoing appropriations to the public education system; and</subsection><subsection ssid="8-null-13" dnum="ii-o" numlevel="1" lineno="347" slineno="5-33" level="3"><display>(ii)</display>enrollment growth and inflation estimates, as defined in Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref>; and</subsection></subsection><subsection ssid="8-null-14" dnum="c-o" numlevel="1" lineno="348" slineno="5-34" level="2"><display>(c)</display>the minimum basic local amount as defined in Section <xref depth="3" refnumber="53F-2-301">53F-2-301</xref> for a year in which <ln numlevel="1" lineno="349" slineno="5-35"/>the minimum basic tax rate, as defined in Section <xref depth="3" refnumber="53F-2-301">53F-2-301</xref>, is insufficient to <ln numlevel="1" lineno="350" slineno="5-36"/>generate the amount described in Subsection <xref refnumber="53F-2-301(2)(a)" depth="4">53F-2-301(2)(a)</xref>.</subsection></subsection><subsection ssid="8-null-15" dnum="4-o" numlevel="1" lineno="351" slineno="5-37" level="1" space="false"><display>(4)</display><subsection ssid="8-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The account shall earn interest.</subsection><subsection ssid="8-null-17" dnum="b-o" numlevel="1" lineno="352" slineno="5-38" level="2"><display>(b)</display>All interest earned on account money shall be deposited in the account.</subsection></subsection><subsection ssid="8-null-18" dnum="5-o" numlevel="1" lineno="353" slineno="5-39" level="1"><display>(5)</display>On or before December 31, 2023, and every three years thereafter, the Office of the <ln numlevel="1" lineno="354" slineno="5-40"/>Legislative Fiscal Analyst shall:<subsection ssid="8-null-19" dnum="a-o" numlevel="1" lineno="355" slineno="5-41" level="2"><display>(a)</display>review the percentages described in Subsections <xref depth="4" refnumber="53F-9-204(2)(a)(i)">(2)(a)(i)</xref> and <xref depth="4" refnumber="53F-9-204(2)(b)">(2)(b)</xref>; and</subsection><subsection ssid="8-null-20" dnum="b-o" numlevel="1" lineno="356" slineno="5-42" level="2"><display>(b)</display>recommend to the Executive Appropriations Committee any changes based on the <ln numlevel="1" lineno="357" slineno="5-43"/>review described in Subsection <xref depth="4" refnumber="53F-9-204(5)(a)">(5)(a)</xref>.</subsection></subsection><subsection ssid="8-null-21" dnum="6-o" numlevel="1" lineno="358" slineno="5-44" level="1"><display>(6)</display>In preparing budget bills for a given fiscal year, the Executive Appropriations <ln numlevel="1" lineno="359" slineno="5-45"/>Committee shall make the one-time appropriations described in Subsection <xref depth="4" refnumber="53F-9-204(3)(a)">(3)(a)</xref> by <ln numlevel="1" lineno="360" slineno="5-46"/>appropriating at least the lesser of 10% of the total amount of the one-time <ln numlevel="1" lineno="361" slineno="5-47"/>appropriations to:<subsection ssid="8-null-22" dnum="a-o" numlevel="1" lineno="362" slineno="5-48" level="2"><display>(a)</display>the cost of providing 32 paid professional hours for teachers in accordance with <ln numlevel="1" lineno="363" slineno="5-49"/>Section <xref depth="3" refnumber="53F-7-203">53F-7-203</xref>;</subsection><subsection ssid="8-null-23" dnum="b-o" numlevel="1" lineno="364" slineno="5-50" level="2"><display>(b)</display>the amount to make the distribution required under Section <xref depth="3" refnumber="53F-2-527">53F-2-527</xref>;</subsection><subsection ssid="8-null-24" dnum="c-o" numlevel="1" lineno="365" slineno="5-51" level="2"><display>(c)</display>the cost of the Stipends for Future Educators Grant Program described in Section <xref depth="3" refnumber="53F-5-223"><ln numlevel="1" lineno="366" slineno="5-52"/>53F-5-223</xref>; and</subsection><subsection ssid="8-null-25" dnum="d-o" numlevel="1" lineno="367" slineno="5-53" level="2"><display>(d)</display>the cost of the Rural School Sports Facilities Grant Program described in Section <xref depth="3" refnumber="53F-10-303"><ln numlevel="1" lineno="368" slineno="5-54"/>53F-10-303</xref>.</subsection></subsection><subsection ssid="8-null-26" dnum="7-o" numlevel="1" lineno="369" slineno="5-55" level="1"><display>(7)</display>No later than October 15 of each year, the state board shall report to the Office of the <ln numlevel="1" lineno="370" slineno="5-56"/>Legislative Fiscal Analyst an estimated cost for each of the one-time appropriations <ln numlevel="1" lineno="371" slineno="5-57"/>described in Subsection <xref refnumber="53F-9-204(6)" depth="4">(6)</xref>.</subsection></section></bsec><bsec buid="14" num="63I-2-253" type="amend" src="code" uid="C63I-2-S253_2026070120260701" sort="63I02 02530020260701" numlevel="1" lineno="372" slineno="6-1" sn="6"><section number="63I-2-253" numlevel="1" lineno="373" slineno="6-2" type="amend"><secline lineno="372">Section 6.
