Pierucci</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill establishes a charter school base funding study and creates a charter school <ln numlevel="1" lineno="6" slineno="0-6"/>educational service agency.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">requires a study of charter school administrative costs and funding options;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">establishes a charter school base funding study group with specific membership; </hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires the study group to examine charter school administrative costs and funding <ln numlevel="1" lineno="12" slineno="0-12"/>options;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">directs the State Board of Education to report to the Legislature by December 1, 2026; and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">makes technical changes.</hl></hp><moni numlevel="1" lineno="15" slineno="0-15" display="normal">Money Appropriated in this Bill:<fy fy="2027" ltid="2" seq="2027" numlevel="1" lineno="16" slineno="0-16"><ltcat ltid="3" seq="1">This bill appropriates <ltamt>$3,600,000</ltamt> in operating and capital budgets for fiscal year 2027, all <ln numlevel="1" lineno="17" slineno="0-17"/>of which is from the various sources as detailed in this bill.</ltcat></fy></moni><oc numlevel="1" lineno="18" slineno="0-18">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="19" slineno="0-19">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="20" slineno="0-20">Utah Code Sections Affected:<saamd numlevel="1" lineno="21" slineno="0-21"><snhead>AMENDS:</snhead><sn num="53F-2-706" src="code" uid="C53F-2-S706_1800010118000101" buid="1" sort="53F02 07060018000101" numlevel="1" lineno="22" slineno="0-22"><bold>53F-2-706</bold><parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>upon governor's approval</date></paren></parens> , as last amended by Laws of Utah 2023, <ln numlevel="1" lineno="23" slineno="0-23"/>Chapter 467</sn></saamd></sa></lt><enacthead lineno="24"/><enact numlevel="1" lineno="25" slineno="0-25">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="53F-2-706" type="amend" src="code" uid="C53F-2-S706_1800010118000101" sort="53F02 07060018000101" numlevel="1" lineno="26" slineno="1-1" sn="1"><section number="53F-2-706" numlevel="1" lineno="27" slineno="1-2" type="amend"><secline lineno="26">Section 1. Section <bold>53F-2-706</bold> is amended to read:</secline><catline lineno="27"><bold>53F-2-706<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>upon governor's approval</date></paren></parens>. Small charter school base <ln numlevel="1" lineno="28" slineno="1-3"/>funding -- Base funding study.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>Subject to legislative appropriation, the state board shall distribute small charter school <ln numlevel="1" lineno="30" slineno="1-5"/>base funding to charter schools with 2,000 or fewer students in the amount of the greater <ln numlevel="1" lineno="31" slineno="1-6"/>of $40,000 or $115 per student.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="32" slineno="1-7" level="1"><display>(2)</display>A charter school's eligibility for small charter school base funding is determined by the <ln numlevel="1" lineno="33" slineno="1-8"/>charter school's student enrollment on October 1 of a given year.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="34" slineno="1-9" level="1"><display>(3)</display>Notwithstanding this section and subject to legislative appropriations<amend anum="0" ea="amend" pairid="286" groupid="218" style="1" owner="ahaskell" level="1" amendtag="both">, including intent <ln numlevel="1" lineno="35" slineno="1-10"/>language for the applicable fiscal year</amend>, the state board may distribute to charter schools, <ln numlevel="1" lineno="36" slineno="1-11"/>regardless of size, one-time funding that the Legislature appropriates<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="287" groupid="219" style="2" owner="ahaskell" level="1" deltag="both"> to mitigate <ln numlevel="1" lineno="37" slineno="1-12"/>funding losses as described in legislative appropriations</amend><amendoutend style="2"/>.</subsection><subsection ssid="1-38" dnum="_-o:4-i" numlevel="1" lineno="38" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-66" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="121" style="1" owner="ahaskell" level="1" amendtag="end">Subject to legislative appropriations, the state board shall coordinate and facilitate <ln numlevel="1" lineno="39" slineno="1-14"/>a comprehensive study of administrative and base funding <marker pairid="374">costs</marker><marker pairid="375"> for charter schools.</marker></amend></subsection><subsection ssid="1-67" dnum="_-o:b-i" numlevel="1" lineno="40" slineno="1-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="295" groupid="223" style="1" owner="ahaskell" level="1" amendtag="end">The study described in Subsection <xref depth="4" refnumber="53F-2-706(4)(a)">(4)(a)</xref> shall include the following members to <ln numlevel="1" lineno="41" slineno="1-16"/>constitute the study group:</amend><subsection ssid="1-70" dnum="_-o:i-i" numlevel="1" lineno="42" slineno="1-17" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="310" groupid="235" style="1" owner="ahaskell" level="1" amendtag="end">a charter school business administrator from a small charter school whom the <ln numlevel="1" lineno="43" slineno="1-18"/>chair of the state board appoints;</amend></subsection><subsection ssid="1-71" dnum="_-o:ii-i" numlevel="1" lineno="44" slineno="1-19" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="315" groupid="239" style="1" owner="ahaskell" level="1" amendtag="end">a charter school director from a large charter school whom the chair of the state <ln numlevel="1" lineno="45" slineno="1-20"/>board appoints;</amend></subsection><subsection ssid="1-78" dnum="_-o:iii-i" numlevel="1" lineno="46" slineno="1-21" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="347" groupid="264" style="1" owner="ahaskell" level="1" amendtag="end">a school district business administrator whom the chair of the state board <ln numlevel="1" lineno="47" slineno="1-22"/>appoints;</amend></subsection><subsection ssid="1-72" dnum="_-o:iv-i" numlevel="1" lineno="48" slineno="1-23" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="243" style="1" owner="ahaskell" level="1" amendtag="end">the director of each charter school association that has a member charter school <ln numlevel="1" lineno="49" slineno="1-24"/>operating in the state, or the director's designee;</amend></subsection><subsection ssid="1-79" dnum="_-o:v-i" numlevel="1" lineno="50" slineno="1-25" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="351" groupid="267" style="1" owner="ahaskell" level="1" amendtag="end">a member of the Utah State Charter School Board whom the chair of the state <ln numlevel="1" lineno="51" slineno="1-26"/>board appoints;</amend></subsection><subsection ssid="1-80" dnum="_-o:vi-i" numlevel="1" lineno="52" slineno="1-27" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="357" groupid="272" style="1" owner="ahaskell" level="1" amendtag="end">a member of the state board whom the chair of the state board appoints;</amend></subsection><subsection ssid="1-81" dnum="_-o:vii-i" numlevel="1" lineno="53" slineno="1-28" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="364" groupid="276" style="1" owner="ahaskell" level="1" amendtag="end">relevant staff from the state board whom the chair of the state board appoints; <ln numlevel="1" lineno="54" slineno="1-29"/>and</amend></subsection><subsection ssid="1-74" dnum="_-o:viii-i" numlevel="1" lineno="55" slineno="1-30" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="330" groupid="251" style="1" owner="ahaskell" level="1" amendtag="end">a representative <marker pairid="373">from</marker> the Governor's Office of Planning and Budget whom the <ln numlevel="1" lineno="56" slineno="1-31"/>director of the Governor's Office of Planning and Budget appoints.</amend></subsection></subsection><subsection ssid="1-75" dnum="_-o:c-i" numlevel="1" lineno="57" slineno="1-32" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="331" groupid="252" style="1" owner="ahaskell" level="1" amendtag="end">The chair of the state board shall:</amend><subsection ssid="1-76" dnum="_-o:i-i" numlevel="1" lineno="58" slineno="1-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="338" groupid="257" style="1" owner="ahaskell" level="1" amendtag="end">convene the first meeting of the study group no later than April 1, 2026; and</amend></subsection><subsection ssid="1-77" dnum="_-o:ii-i" numlevel="1" lineno="59" slineno="1-34" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="343" groupid="261" style="1" owner="ahaskell" level="1" amendtag="end">designate a member of the study group to serve as chair of the study group.</amend></subsection></subsection></subsection><subsection ssid="1-39" dnum="_-o:5-i" numlevel="1" lineno="60" slineno="1-35" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="174" groupid="132" style="1" owner="ahaskell" level="1" amendtag="end">The study group described in Subsection <xref depth="4" refnumber="53F-2-706(4)(b)">(4)(b)</xref> shall:</amend><subsection ssid="1-40" dnum="_-o:a-i" numlevel="1" lineno="61" slineno="1-36" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="133" style="1" owner="ahaskell" level="1" amendtag="end">examine how factors such as school size, enrollment scale, and operational models <ln numlevel="1" lineno="62" slineno="1-37"/>impact the relative costs of operating charter schools;</amend></subsection><subsection ssid="1-41" dnum="_-o:b-i" numlevel="1" lineno="63" slineno="1-38" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="179" groupid="136" style="1" owner="ahaskell" level="1" amendtag="end">analyze the adequacy and effectiveness of the charter school base funding formula in <ln numlevel="1" lineno="64" slineno="1-39"/>addressing economies of scale challenges faced by charter schools of varying sizes;</amend></subsection><subsection ssid="1-42" dnum="_-o:c-i" numlevel="1" lineno="65" slineno="1-40" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="184" groupid="140" style="1" owner="ahaskell" level="1" amendtag="end">compare administrative and operational cost structures across charter schools of <ln numlevel="1" lineno="66" slineno="1-41"/>different sizes and configurations and applicable districts;</amend></subsection><subsection ssid="1-43" dnum="_-o:d-i" numlevel="1" lineno="67" slineno="1-42" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="144" style="1" owner="ahaskell" level="1" amendtag="end">evaluate whether current funding mechanisms appropriately account for:</amend><subsection ssid="1-44" dnum="_-o:i-i" numlevel="1" lineno="68" slineno="1-43" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="148" style="1" owner="ahaskell" level="1" amendtag="end">fixed costs that do not scale proportionally with enrollment;</amend></subsection><subsection ssid="1-45" dnum="_-o:ii-i" numlevel="1" lineno="69" slineno="1-44" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="199" groupid="152" style="1" owner="ahaskell" level="1" amendtag="end">administrative requirements mandated by state and federal law; and</amend></subsection><subsection ssid="1-46" dnum="_-o:iii-i" numlevel="1" lineno="70" slineno="1-45" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="156" style="1" owner="ahaskell" level="1" amendtag="end">operational efficiencies or challenges unique to charter schools;</amend></subsection></subsection><subsection ssid="1-47" dnum="_-o:e-i" numlevel="1" lineno="71" slineno="1-46" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="159" style="1" owner="ahaskell" level="1" amendtag="end">consider funding models used in other states or jurisdictions that may provide <ln numlevel="1" lineno="72" slineno="1-47"/>insights for the charter school funding system; and</amend></subsection><subsection ssid="1-48" dnum="_-o:f-i" numlevel="1" lineno="73" slineno="1-48" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="162" style="1" owner="ahaskell" level="1" amendtag="end">identify any additional factors that significantly impact charter school operational <ln numlevel="1" lineno="74" slineno="1-49"/>costs beyond those currently considered in the funding formula.</amend></subsection></subsection><subsection ssid="1-49" dnum="_-o:6-i" numlevel="1" lineno="75" slineno="1-50" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="166" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall submit a report to the Public Education Appropriations <ln numlevel="1" lineno="76" slineno="1-51"/>Subcommittee no later than December 1, 2026, that includes:</amend><subsection ssid="1-50" dnum="_-o:a-i" numlevel="1" lineno="77" slineno="1-52" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="170" style="1" owner="ahaskell" level="1" amendtag="end">findings from the study described in this section;</amend></subsection><subsection ssid="1-51" dnum="_-o:b-i" numlevel="1" lineno="78" slineno="1-53" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="229" groupid="174" style="1" owner="ahaskell" level="1" amendtag="end">recommendations for any modifications to the charter school base funding formula;</amend></subsection><subsection ssid="1-52" dnum="_-o:c-i" numlevel="1" lineno="79" slineno="1-54" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="234" groupid="178" style="1" owner="ahaskell" level="1" amendtag="end">proposed criteria or metrics for evaluating the ongoing adequacy of charter school <ln numlevel="1" lineno="80" slineno="1-55"/>base funding;</amend></subsection><subsection ssid="1-53" dnum="_-o:d-i" numlevel="1" lineno="81" slineno="1-56" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="239" groupid="182" style="1" owner="ahaskell" level="1" amendtag="end">estimated fiscal impacts of any recommended changes; and</amend></subsection><subsection ssid="1-54" dnum="_-o:e-i" numlevel="1" lineno="82" slineno="1-57" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="244" groupid="186" style="1" owner="ahaskell" level="1" amendtag="end">a proposed timeline for implementation of any recommended modifications.</amend></subsection></subsection><subsection ssid="1-55" dnum="_-o:7-i" numlevel="1" lineno="83" slineno="1-58" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="248" groupid="189" style="1" owner="ahaskell" level="1" amendtag="end">Subject to legislative appropriations, the state board may contract with a qualified third <ln numlevel="1" lineno="84" slineno="1-59"/>party, including institutions of higher education or research organizations, to conduct <ln numlevel="1" lineno="85" slineno="1-60"/>part of the study described in this section.</amend></subsection></section></bsec><bsec buid="16" type="uncod" untype="approp" src="uncod" uid="APP2027" sort="UP0002027" langlock="false" numlevel="1" lineno="86" slineno="2-1" sn="2"><section type="uncod" nodeid="2" fy="2027" untype="approp" display="false" src="uncod"><secline lineno="86">Section 2.  <bold>FY 2027 Appropriations.</bold></secline><sectionText lineno="87"><summary numlevel="1" lineno="87" slineno="2-2">The following sums of money are appropriated for the fiscal year beginning July 1, <ln numlevel="1" lineno="88" slineno="2-3"/>2026, and ending June 30, 2027. These are additions to amounts previously appropriated for <ln numlevel="1" lineno="89" slineno="2-4"/>fiscal year 2027. </summary><licat nodeid="3" numlevel="1" lineno="90" slineno="2-5"><number>Subsection 2(a).</number><display display="true">Operating and Capital Budgets</display><summary numlevel="1" lineno="91" slineno="2-6">Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the <ln numlevel="1" lineno="92" slineno="2-7"/>Legislature appropriates the following sums of money from the funds or accounts indicated for <ln numlevel="1" lineno="93" slineno="2-8"/>the use and support of the government of the state of Utah.</summary><committee nodeid="4" name="Public Education" seq="70"><display display="false">PUBLIC EDUCATION</display><agency nodeid="5" seq="29020000" name="State Board of Education -
