Section <bold>53F-10-401</bold> is enacted to read:</secline><headpart number="53F-10-4" numlevel="1" lineno="29" slineno="1-2">4. High Growth District Grant Program</headpart><catline lineno="30"><bold>53F-10-401<parens/>. General provisions -- Definitions.</bold></catline><sectionText lineno="31"><para/><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="1-4" dnum="_-o:1-i" numlevel="1" lineno="32" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">"ADM" means average daily membership, as defined in Section <xref depth="3" refnumber="53F-2-102">53F-2-102</xref>, excluding a <ln numlevel="1" lineno="33" slineno="1-6"/>pupil who is fully enrolled in an online education program for at least 180 days.</amend></subsection><subsection ssid="1-5" dnum="_-o:2-i" numlevel="1" lineno="34" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Average annual net enrollment increase" means the sum of a school district's net <ln numlevel="1" lineno="35" slineno="1-8"/>enrollment increase for each year during the three school years immediately preceding <ln numlevel="1" lineno="36" slineno="1-9"/>the fiscal year for which the school district applies for a grant divided by three.</amend></subsection><subsection ssid="1-7" dnum="_-o:3-i" numlevel="1" lineno="37" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Eligible district" means a school district that meets the requirements described in <ln numlevel="1" lineno="38" slineno="1-11"/>Section <xref depth="3" refnumber="53F-10-403">53F-10-403</xref>.</amend></subsection><subsection ssid="1-8" dnum="_-o:4-i" numlevel="1" lineno="39" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">"High growth district" means a school district whose average annual net enrollment <ln numlevel="1" lineno="40" slineno="1-13"/>increase represents at least 10% of the state's total net enrollment increase as calculated <ln numlevel="1" lineno="41" slineno="1-14"/>by the state board under Section <xref depth="3" refnumber="53F-10-403">53F-10-403</xref>.</amend></subsection><subsection ssid="1-9" dnum="_-o:5-i" numlevel="1" lineno="42" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">"Net enrollment increase" means:</amend><subsection ssid="1-10" dnum="_-o:a-i" numlevel="1" lineno="43" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">for a fiscal year, the difference, if positive, between a school district's ADM for the <ln numlevel="1" lineno="44" slineno="1-17"/>fiscal year and the school district's ADM for the previous fiscal year; or</amend></subsection><subsection ssid="1-11" dnum="_-o:b-i" numlevel="1" lineno="45" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">for a projected year, the difference, if positive, between a school district's projected <ln numlevel="1" lineno="46" slineno="1-19"/>ADM for the fiscal year and the school district's ADM for the most recent fiscal year <ln numlevel="1" lineno="47" slineno="1-20"/>for which data is available.</amend></subsection></subsection><subsection ssid="1-12" dnum="_-o:6-i" numlevel="1" lineno="48" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">"Program" means the High Growth District Grant Program created in Section <xref depth="3" refnumber="53F-10-402"><ln numlevel="1" lineno="49" slineno="1-22"/>53F-10-402</xref>.</amend></subsection></section></bsec><bsec buid="2" num="53F-10-402" type="enact" src="code" uid="C53F-10-S402_2026050620260506" sort="53F10 04020020260506" numlevel="1" lineno="50" slineno="2-1" sn="2"><section numlevel="1" lineno="51" slineno="2-2" number="53F-10-402" type="enact"><secline lineno="50">Section 2. Section <bold>53F-10-402</bold> is enacted to read:</secline><catline lineno="51"><bold>53F-10-402<parens/>. High Growth District Grant Program created -- Purpose -- State <ln numlevel="1" lineno="52" slineno="2-3"/>board duties.</bold></catline><subsection ssid="2-1" dnum="_-o:1-i" numlevel="1" lineno="53" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">The High Growth District Grant Program is created to provide funding to high growth <ln numlevel="1" lineno="54" slineno="2-5"/>districts for:</amend><subsection ssid="2-2" dnum="_-o:a-i" numlevel="1" lineno="55" slineno="2-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">land acquisition for future school sites; and</amend></subsection><subsection ssid="2-3" dnum="_-o:b-i" numlevel="1" lineno="56" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">transportation infrastructure expansion to accommodate rapid enrollment growth.</amend></subsection></subsection><subsection ssid="2-4" dnum="_-o:2-i" numlevel="1" lineno="57" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="2-5" dnum="_-o:a-i" numlevel="1" lineno="58" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">evaluate applications for program grants from eligible districts;</amend></subsection><subsection ssid="2-6" dnum="_-o:b-i" numlevel="1" lineno="59" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">determine which eligible districts qualify as high growth districts in accordance with <ln numlevel="1" lineno="60" slineno="2-11"/>Section <xref depth="3" refnumber="53F-10-403">53F-10-403</xref>;</amend></subsection><subsection ssid="2-7" dnum="_-o:c-i" numlevel="1" lineno="61" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">distribute program funds to eligible districts in accordance with Section <xref depth="3" refnumber="53F-10-404">53F-10-404</xref>;</amend></subsection><subsection ssid="2-8" dnum="_-o:d-i" numlevel="1" lineno="62" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">establish an application process, timeline, and reporting requirements by rule in <ln numlevel="1" lineno="63" slineno="2-14"/>accordance with Section <xref depth="3" refnumber="53F-10-405">53F-10-405</xref>; and</amend></subsection><subsection ssid="2-9" dnum="_-o:e-i" numlevel="1" lineno="64" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">upon request, report to the Public Education Appropriations Subcommittee regarding:</amend><subsection ssid="2-10" dnum="_-o:i-i" numlevel="1" lineno="65" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">the number of applications received;</amend></subsection><subsection ssid="2-11" dnum="_-o:ii-i" numlevel="1" lineno="66" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">the amount of program funds distributed;</amend></subsection><subsection ssid="2-12" dnum="_-o:iii-i" numlevel="1" lineno="67" slineno="2-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">how eligible districts use program funds; and</amend></subsection><subsection ssid="2-13" dnum="_-o:iv-i" numlevel="1" lineno="68" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">enrollment growth trends in eligible districts.</amend></subsection></subsection></subsection></section></bsec><bsec buid="3" num="53F-10-403" type="enact" src="code" uid="C53F-10-S403_2026050620260506" sort="53F10 04030020260506" numlevel="1" lineno="69" slineno="3-1" sn="3"><section numlevel="1" lineno="70" slineno="3-2" number="53F-10-403" type="enact"><secline lineno="69">Section 3. Section <bold>53F-10-403</bold> is enacted to read:</secline><catline lineno="70"><bold>53F-10-403<parens/>. Eligibility requirements -- High growth district determination.</bold></catline><subsection ssid="3-1" dnum="_-o:1-i" numlevel="1" lineno="71" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">A school district is an eligible district if:</amend><subsection ssid="3-2" dnum="_-o:a-i" numlevel="1" lineno="72" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the school district has a positive average annual net enrollment increase; and</amend></subsection><subsection ssid="3-3" dnum="_-o:b-i" numlevel="1" lineno="73" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the state board determines that the school district is a high growth district under <ln numlevel="1" lineno="74" slineno="3-6"/>Subsection <xref depth="4" refnumber="53F-10-403(2)">(2)</xref>.</amend></subsection></subsection><subsection ssid="3-4" dnum="_-o:2-i" numlevel="1" lineno="75" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="3-5" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall determine which eligible districts qualify as high growth <ln numlevel="1" lineno="76" slineno="3-8"/>districts by calculating each school district's share of the state's total net enrollment <ln numlevel="1" lineno="77" slineno="3-9"/>increase.</amend></subsection><subsection ssid="3-6" dnum="_-o:b-i" numlevel="1" lineno="78" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">In making a determination under Subsection <xref depth="4" refnumber="53F-10-403(2)(a)">(2)(a)</xref>, the state board shall:</amend><subsection ssid="3-7" dnum="_-o:i-i" numlevel="1" lineno="79" slineno="3-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">calculate the sum of average annual net enrollment increases for all school <ln numlevel="1" lineno="80" slineno="3-12"/>districts that have a positive average annual net enrollment increase, excluding <ln numlevel="1" lineno="81" slineno="3-13"/>school districts with stable or declining enrollment;</amend></subsection><subsection ssid="3-8" dnum="_-o:ii-i" numlevel="1" lineno="82" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">for each school district described in Subsection <xref depth="4" refnumber="53F-10-403(2)(b)(i)">(2)(b)(i)</xref>, calculate the ratio of the <ln numlevel="1" lineno="83" slineno="3-15"/>school district's average annual net enrollment increase to the sum calculated <ln numlevel="1" lineno="84" slineno="3-16"/>under Subsection <xref depth="4" refnumber="53F-10-403(2)(b)(i)">(2)(b)(i)</xref>; and</amend></subsection><subsection ssid="3-9" dnum="_-o:iii-i" numlevel="1" lineno="85" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">designate as a high growth district each school district whose ratio calculated <ln numlevel="1" lineno="86" slineno="3-18"/>under Subsection <xref depth="4" refnumber="53F-10-403(2)(b)(ii)">(2)(b)(ii)</xref> is equal to or greater than 0.10.</amend></subsection></subsection></subsection><subsection ssid="3-10" dnum="_-o:3-i" numlevel="1" lineno="87" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">In calculating net enrollment increases under this section, the state board:</amend><subsection ssid="3-11" dnum="_-o:a-i" numlevel="1" lineno="88" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">shall use ADM data from the three most recent fiscal years for which data is <ln numlevel="1" lineno="89" slineno="3-21"/>available; and</amend></subsection><subsection ssid="3-12" dnum="_-o:b-i" numlevel="1" lineno="90" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">may include projected enrollment data for the upcoming fiscal year if:</amend><subsection ssid="3-13" dnum="_-o:i-i" numlevel="1" lineno="91" slineno="3-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">the school district provides documentation supporting the projection; and</amend></subsection><subsection ssid="3-18" dnum="_-o:D-i" numlevel="1" lineno="97" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">other demographic data the state board considers relevant.</amend></subsection></subsection></subsection></subsection><subsection ssid="3-19" dnum="_-o:4-i" numlevel="1" lineno="98" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall recalculate high growth district designations annually.</amend></subsection><subsection ssid="3-21" dnum="_-o:5-i" numlevel="1" lineno="99" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="3-22" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">For purposes of calculating net enrollment increase under this section, if a school <ln numlevel="1" lineno="100" slineno="3-32"/>district is created through a split, consolidation, or reorganization of one or more <ln numlevel="1" lineno="101" slineno="3-33"/>existing school districts:</amend><subsection ssid="3-23" dnum="_-o:i-i" numlevel="1" lineno="102" slineno="3-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">for the fiscal year in which the new or reorganized school district is created, the <ln numlevel="1" lineno="103" slineno="3-35"/>state board shall calculate the new or reorganized school district's net enrollment <ln numlevel="1" lineno="104" slineno="3-36"/>increase by:</amend><subsection ssid="3-24" dnum="_-o:A-i" numlevel="1" lineno="105" slineno="3-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">using as the baseline ADM the number of students from the geographic <ln numlevel="1" lineno="106" slineno="3-38"/>territory served by the new or reorganized school district who were enrolled in <ln numlevel="1" lineno="107" slineno="3-39"/>the predecessor district or districts for the fiscal year immediately preceding <ln numlevel="1" lineno="108" slineno="3-40"/>the creation or reorganization; and</amend></subsection><subsection ssid="3-25" dnum="_-o:B-i" numlevel="1" lineno="109" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">comparing the baseline ADM under Subsection <xref depth="4" refnumber="53F-10-403(5)(a)(i)(a)">(5)(a)(i)(A)</xref> to the new or <ln numlevel="1" lineno="110" slineno="3-42"/>reorganized school district's actual ADM for the fiscal year;</amend></subsection></subsection><subsection ssid="3-26" dnum="_-o:ii-i" numlevel="1" lineno="111" slineno="3-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">for the two fiscal years immediately following the fiscal year described in <ln numlevel="1" lineno="112" slineno="3-44"/>Subsection <xref depth="4" refnumber="53F-10-403(5)(a)(i)">(5)(a)(i)</xref>, the state board shall calculate the new or reorganized school <ln numlevel="1" lineno="113" slineno="3-45"/>district's average annual net enrollment increase using:</amend><subsection ssid="3-27" dnum="_-o:A-i" numlevel="1" lineno="114" slineno="3-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">the calculation described in Subsection <xref depth="4" refnumber="53F-10-403(5)(a)(i)">(5)(a)(i)</xref> for the fiscal year in which <ln numlevel="1" lineno="115" slineno="3-47"/>the district was created or reorganized;</amend></subsection><subsection ssid="3-28" dnum="_-o:B-i" numlevel="1" lineno="116" slineno="3-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">actual year-over-year ADM changes for each subsequent fiscal year; and</amend></subsection><subsection ssid="3-29" dnum="_-o:C-i" numlevel="1" lineno="117" slineno="3-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">projected enrollment data under Subsection <xref depth="4" refnumber="53F-10-403(3)(b)">(3)(b)</xref> if applicable; and</amend></subsection></subsection><subsection ssid="3-30" dnum="_-o:iii-i" numlevel="1" lineno="118" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">beginning with the third fiscal year after the creation or reorganization, the state <ln numlevel="1" lineno="119" slineno="3-51"/>board shall calculate the school district's average annual net enrollment increase <ln numlevel="1" lineno="120" slineno="3-52"/>using the standard methodology described in Subsection <xref depth="4" refnumber="53F-10-403(2)">(2)</xref>.</amend></subsection></subsection><subsection ssid="3-31" dnum="_-o:b-i" numlevel="1" lineno="121" slineno="3-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">For purposes of calculating net enrollment increase under this section, if a school <ln numlevel="1" lineno="122" slineno="3-54"/>district loses territory or students due to a split, consolidation, or reorganization:</amend><subsection ssid="3-32" dnum="_-o:i-i" numlevel="1" lineno="123" slineno="3-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">for the fiscal year in which the split, consolidation, or reorganization occurs, the <ln numlevel="1" lineno="124" slineno="3-56"/>state board shall calculate the remaining school district's net enrollment increase <ln numlevel="1" lineno="125" slineno="3-57"/>by:</amend><subsection ssid="3-33" dnum="_-o:A-i" numlevel="1" lineno="126" slineno="3-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">using as the baseline ADM the remaining school district's ADM for the fiscal <ln numlevel="1" lineno="127" slineno="3-59"/>year immediately preceding the split, consolidation, or reorganization, adjusted <ln numlevel="1" lineno="128" slineno="3-60"/>to exclude the ADM of students who were transferred to another district; and</amend></subsection><subsection ssid="3-34" dnum="_-o:B-i" numlevel="1" lineno="129" slineno="3-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="end">comparing the adjusted baseline ADM under Subsection <xref depth="4" refnumber="53F-10-403(5)(b)(i)(a)">(5)(b)(i)(A)</xref> to the <ln numlevel="1" lineno="130" slineno="3-62"/>remaining school district's actual ADM for the fiscal year;</amend></subsection></subsection><subsection ssid="3-35" dnum="_-o:ii-i" numlevel="1" lineno="131" slineno="3-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">for the two fiscal years immediately following the fiscal year described in <ln numlevel="1" lineno="132" slineno="3-64"/>Subsection <xref depth="4" refnumber="53F-10-403(5)(b)(i)">(5)(b)(i)</xref>, the state board shall calculate the remaining school district's <ln numlevel="1" lineno="133" slineno="3-65"/>average annual net enrollment increase using:</amend><subsection ssid="3-36" dnum="_-o:A-i" numlevel="1" lineno="134" slineno="3-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">the calculation described in Subsection <xref depth="4" refnumber="53F-10-403(5)(b)(i)">(5)(b)(i)</xref> for the fiscal year in which <ln numlevel="1" lineno="135" slineno="3-67"/>the split, consolidation, or reorganization occurred;</amend></subsection><subsection ssid="3-37" dnum="_-o:B-i" numlevel="1" lineno="136" slineno="3-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">actual year-over-year ADM changes for each subsequent fiscal year; and</amend></subsection><subsection ssid="3-38" dnum="_-o:C-i" numlevel="1" lineno="137" slineno="3-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">projected enrollment data under Subsection <xref depth="4" refnumber="53F-10-403(3)(b)">(3)(b)</xref> if applicable; and</amend></subsection></subsection><subsection ssid="3-39" dnum="_-o:iii-i" numlevel="1" lineno="138" slineno="3-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">beginning with the third fiscal year after the split, consolidation, or <ln numlevel="1" lineno="139" slineno="3-71"/>reorganization, the state board shall calculate the school district's average annual <ln numlevel="1" lineno="140" slineno="3-72"/>net enrollment increase using the standard methodology described in Subsection <xref depth="4" refnumber="53F-10-403(2)"><ln numlevel="1" lineno="141" slineno="3-73"/>(2)</xref><marker pairid="208">.</marker></amend></subsection></subsection><subsection ssid="3-40" dnum="_-o:c-i" numlevel="1" lineno="142" slineno="3-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="185" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="143" slineno="3-75"/>Administrative Rulemaking Act, to establish:</amend><subsection ssid="3-41" dnum="_-o:i-i" numlevel="1" lineno="144" slineno="3-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="190" groupid="146" style="1" owner="jchristopherson" level="1" amendtag="end">procedures for implementing the calculations described in Subsections <xref depth="4" refnumber="53F-10-403(5)(a)">(5)(a)</xref> and <xref depth="4" refnumber="53F-10-403(5)(b)"><ln numlevel="1" lineno="145" slineno="3-77"/>(5)(b)</xref>;</amend></subsection><subsection ssid="3-42" dnum="_-o:ii-i" numlevel="1" lineno="146" slineno="3-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="195" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">documentation requirements for school districts affected by a split, consolidation, <ln numlevel="1" lineno="147" slineno="3-79"/>or reorganization;</amend></subsection><subsection ssid="3-43" dnum="_-o:iii-i" numlevel="1" lineno="148" slineno="3-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="200" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">methods for allocating historical enrollment growth among successor districts <ln numlevel="1" lineno="149" slineno="3-81"/>when necessary to implement this subsection; and</amend></subsection><subsection ssid="3-44" dnum="_-o:iv-i" numlevel="1" lineno="150" slineno="3-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="158" style="1" owner="jchristopherson" level="1" amendtag="end">methods for determining the baseline ADM for each new or reorganized district's <ln numlevel="1" lineno="151" slineno="3-83"/>geographic territory when historical data for the specific territory is not readily <ln numlevel="1" lineno="152" slineno="3-84"/>available.</amend></subsection></subsection></subsection></section></bsec><bsec buid="4" num="53F-10-404" type="enact" src="code" uid="C53F-10-S404_2026050620260506" sort="53F10 04040020260506" numlevel="1" lineno="153" slineno="4-1" sn="4"><section numlevel="1" lineno="154" slineno="4-2" number="53F-10-404" type="enact"><secline lineno="153">Section 4. Section <bold>53F-10-404</bold> is enacted to read:</secline><catline lineno="154"><bold>53F-10-404<parens/>. Grant distribution formula -- Allowable uses.</bold></catline><subsection ssid="4-1" dnum="_-o:1-i" numlevel="1" lineno="155" slineno="4-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to available appropriations, the state board shall annually allocate program <ln numlevel="1" lineno="156" slineno="4-4"/>funds to eligible districts in accordance with this section.</amend></subsection><subsection ssid="4-2" dnum="_-o:2-i" numlevel="1" lineno="157" slineno="4-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall distribute to each eligible district an amount equal to the product <ln numlevel="1" lineno="158" slineno="4-6"/>of:</amend><subsection ssid="4-3" dnum="_-o:a-i" numlevel="1" lineno="159" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the quotient of:</amend><subsection ssid="4-4" dnum="_-o:i-i" numlevel="1" lineno="160" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">the eligible district's average annual net enrollment increase; Application process and administration.</bold></catline><subsection ssid="5-1" dnum="_-o:1-i" numlevel="1" lineno="184" slineno="5-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall make rules, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="185" slineno="5-4"/>Administrative Rulemaking Act, to establish:</amend><subsection ssid="5-2" dnum="_-o:a-i" numlevel="1" lineno="186" slineno="5-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">an application process for school districts to apply for program grants, including:</amend><subsection ssid="5-3" dnum="_-o:i-i" numlevel="1" lineno="187" slineno="5-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">the application format and required documentation;</amend></subsection><subsection ssid="5-4" dnum="_-o:ii-i" numlevel="1" lineno="188" slineno="5-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">the timeline for submitting applications;</amend></subsection><subsection ssid="5-5" dnum="_-o:iii-i" numlevel="1" lineno="189" slineno="5-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">the criteria the state board uses to evaluate applications;</amend></subsection><subsection ssid="5-6" dnum="_-o:iv-i" numlevel="1" lineno="190" slineno="5-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">a process for school districts to demonstrate projected enrollment growth under <ln numlevel="1" lineno="191" slineno="5-10"/>Subsection <xref depth="4" refnumber="53F-10-403(3)(b)">53F-10-403(3)(b)</xref>; and</amend></subsection><subsection ssid="5-7" dnum="_-o:v-i" numlevel="1" lineno="192" slineno="5-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">a process for prioritizing applications if appropriated funds are insufficient to <ln numlevel="1" lineno="193" slineno="5-12"/>fully fund all eligible districts;</amend></subsection></subsection><subsection ssid="5-8" dnum="_-o:b-i" numlevel="1" lineno="194" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">reporting requirements for eligible districts that receive program grants, including:</amend><subsection ssid="5-9" dnum="_-o:i-i" numlevel="1" lineno="195" slineno="5-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">how the eligible district uses grant funds;</amend></subsection><subsection ssid="5-10" dnum="_-o:ii-i" numlevel="1" lineno="196" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">progress toward completing projects funded by grant funds;</amend></subsection><subsection ssid="5-11" dnum="_-o:iii-i" numlevel="1" lineno="197" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">updates on enrollment growth; and</amend></subsection><subsection ssid="5-12" dnum="_-o:iv-i" numlevel="1" lineno="198" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">the impact of grant funds on the eligible district's ability to accommodate <ln numlevel="1" lineno="199" slineno="5-18"/>enrollment growth; and</amend></subsection></subsection><subsection ssid="5-13" dnum="_-o:c-i" numlevel="1" lineno="200" slineno="5-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">procedures for monitoring eligible districts' compliance with the requirements of this <ln numlevel="1" lineno="201" slineno="5-20"/>part and rules made under this section.</amend></subsection></subsection><subsection ssid="5-14" dnum="_-o:2-i" numlevel="1" lineno="202" slineno="5-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">An eligible district shall submit reports required under rules made under Subsection <xref depth="4" refnumber="53F-10-405(1)(b)"><ln numlevel="1" lineno="203" slineno="5-22"/>(1)(b)</xref>:</amend><subsection ssid="5-15" dnum="_-o:a-i" numlevel="1" lineno="204" slineno="5-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">annually while the eligible district is using grant funds received under this part; and</amend></subsection><subsection ssid="5-16" dnum="_-o:b-i" numlevel="1" lineno="205" slineno="5-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">within one year after the eligible district completes a project funded by grant funds.</amend></subsection></subsection><subsection ssid="5-17" dnum="_-o:3-i" numlevel="1" lineno="206" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">If an eligible district uses grant funds in a manner that does not comply with Section <xref depth="3" refnumber="53F-10-404"><ln numlevel="1" lineno="207" slineno="5-26"/>53F-10-404</xref>, the state board may:</amend><subsection ssid="5-18" dnum="_-o:a-i" numlevel="1" lineno="208" slineno="5-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">require the eligible district to return the improperly used funds to the state board;
