Section <bold>53F-10-401</bold> is enacted to read:</secline><headpart number="53F-10-4" numlevel="1" lineno="32" slineno="1-2">4. High Growth District Grant Program</headpart><catline lineno="33"><bold>53F-10-401<parens/>. General provisions -- Definitions.</bold></catline><sectionText lineno="34"><para/><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="1-13" dnum="_-o:1-i" numlevel="1" lineno="35" slineno="1-5" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">"Account" means the High Growth District Revolving Account created in Section <xref depth="3" refnumber="53F-10-402"><ln numlevel="1" lineno="36" slineno="1-6"/>53F-10-402</xref>.</amend></subsection><subsection ssid="1-4" dnum="_-o:2-i" numlevel="1" lineno="37" slineno="1-7" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="6" style="1" owner="ahaskell" level="1" amendtag="end">"ADM" means average daily membership, as defined in Section <xref depth="3" refnumber="53F-2-102">53F-2-102</xref>, excluding a <ln numlevel="1" lineno="38" slineno="1-8"/>pupil who is fully enrolled in an online education program for at least 180 days.</amend></subsection><subsection ssid="1-5" dnum="_-o:3-i" numlevel="1" lineno="39" slineno="1-9" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">"Average annual net enrollment increase" means the average percentage increase in a <ln numlevel="1" lineno="40" slineno="1-10"/>school district's ADM for each of the three school years immediately <marker pairid="60">preceding</marker> the <ln numlevel="1" lineno="41" slineno="1-11"/>fiscal year for which the school district applies for a loan, calculated by:</amend><subsection ssid="1-14" dnum="_-o:a-i" numlevel="1" lineno="42" slineno="1-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">dividing each year's net enrollment increase by the school district's ADM for the <marker pairid="62"><ln numlevel="1" lineno="43" slineno="1-13"/>preceding</marker> fiscal year; and</amend></subsection><subsection ssid="1-15" dnum="_-o:b-i" numlevel="1" lineno="44" slineno="1-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">averaging the resulting percentages.</amend></subsection></subsection><subsection ssid="1-7" dnum="_-o:4-i" numlevel="1" lineno="45" slineno="1-15" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">"Eligible district" means a school district that meets the requirements described in <ln numlevel="1" lineno="46" slineno="1-16"/>Section <xref depth="3" refnumber="53F-10-403">53F-10-403</xref>.</amend></subsection><subsection ssid="1-8" dnum="_-o:5-i" numlevel="1" lineno="47" slineno="1-17" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">"High growth district" means , as calculated by the state board under Section <ln numlevel="1" lineno="48" slineno="1-18"/>53F-10-403:</amend><subsection ssid="1-16" dnum="_-o:a-i" numlevel="1" lineno="49" slineno="1-19" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><subsection ssid="1-17" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">a school district that is ranked in the top 10% of all school districts with <ln numlevel="1" lineno="50" slineno="1-20"/>positive average annual net enrollment increases; or</amend></subsection><subsection ssid="1-18" dnum="_-o:ii-i" numlevel="1" lineno="51" slineno="1-21" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">if fewer than 10 school districts have positive average annual net enrollment <ln numlevel="1" lineno="52" slineno="1-22"/>increases, a school district that has an average annual net enrollment increase of:</amend><subsection ssid="1-19" dnum="_-o:A-i" numlevel="1" lineno="53" slineno="1-23" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="57" style="1" owner="ahaskell" level="1" amendtag="end">at least 100 students; or</amend></subsection><subsection ssid="1-20" dnum="_-o:B-i" numlevel="1" lineno="54" slineno="1-24" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">at least 2% of the school district's ADM; or</amend></subsection></subsection></subsection><subsection ssid="1-21" dnum="_-o:b-i" numlevel="1" lineno="55" slineno="1-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="65" style="1" owner="ahaskell" level="1" amendtag="end">a school district whose average annual net enrollment increase totals at least 10% of <ln numlevel="1" lineno="56" slineno="1-26"/>the total average annual net enrollment increase from all school districts with positive <ln numlevel="1" lineno="57" slineno="1-27"/>average annual net enrollment increases.</amend></subsection></subsection><subsection ssid="1-9" dnum="_-o:6-i" numlevel="1" lineno="58" slineno="1-28" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">"Net enrollment increase" means:</amend><subsection ssid="1-10" dnum="_-o:a-i" numlevel="1" lineno="59" slineno="1-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="ahaskell" level="1" amendtag="end">for a fiscal year, the difference, if positive, between a school district's ADM for the <ln numlevel="1" lineno="60" slineno="1-30"/>fiscal year and the school district's ADM for the previous fiscal year; or</amend></subsection><subsection ssid="1-11" dnum="_-o:b-i" numlevel="1" lineno="61" slineno="1-31" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="32" style="1" owner="ahaskell" level="1" amendtag="end">for a projected year, the difference, if positive, between a school district's projected <ln numlevel="1" lineno="62" slineno="1-32"/>ADM for the fiscal year and the school district's ADM for the most recent fiscal year <ln numlevel="1" lineno="63" slineno="1-33"/>for which data is available.</amend></subsection></subsection><subsection ssid="1-12" dnum="_-o:7-i" numlevel="1" lineno="64" slineno="1-34" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">"Program" means the High Growth District Loan Program <marker pairid="63">created</marker> in Section <xref depth="3" refnumber="53F-10-402"><ln numlevel="1" lineno="65" slineno="1-35"/>53F-10-402</xref>.</amend></subsection></section></bsec><bsec buid="2" num="53F-10-402" type="enact" src="code" uid="C53F-10-S402_2026050620260506" sort="53F10 04020020260506" numlevel="1" lineno="66" slineno="2-1" sn="2"><section numlevel="1" lineno="67" slineno="2-2" number="53F-10-402" type="enact"><secline lineno="66">Section 2. Section <bold>53F-10-402</bold> is enacted to read:</secline><catline lineno="67"><bold>53F-10-402<parens/>. High Growth District Loan Program and account created -- <ln numlevel="1" lineno="68" slineno="2-3"/>Purpose -- Loan authority -- State board duties.</bold></catline><subsection ssid="2-1" dnum="_-o:1-i" numlevel="1" lineno="69" slineno="2-4" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="ahaskell" level="1" amendtag="end">The High Growth District Loan Program is created to provide loans to high growth <ln numlevel="1" lineno="70" slineno="2-5"/>districts for:</amend><subsection ssid="2-15" dnum="_-o:a-i" numlevel="1" lineno="71" slineno="2-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">acquiring land and facilities to accommodate enrollment growth, including <ln numlevel="1" lineno="72" slineno="2-7"/>purchasing land for future school sites, purchasing existing buildings, and related <ln numlevel="1" lineno="73" slineno="2-8"/>construction or renovation; and</amend></subsection><subsection ssid="2-16" dnum="_-o:b-i" numlevel="1" lineno="74" slineno="2-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="ahaskell" level="1" amendtag="end">expanding transportation infrastructure to accommodate enrollment growth, <ln numlevel="1" lineno="75" slineno="2-10"/>including purchasing school buses and constructing or expanding transportation <ln numlevel="1" lineno="76" slineno="2-11"/>facilities.</amend></subsection></subsection><subsection ssid="2-17" dnum="_-o:2-i" numlevel="1" lineno="77" slineno="2-12" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="2-18" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="ahaskell" level="1" amendtag="end">There is created within the Uniform School Fund a restricted account known as <ln numlevel="1" lineno="78" slineno="2-13"/>the "High Growth District Revolving Account" to provide loans to eligible districts <ln numlevel="1" lineno="79" slineno="2-14"/>under this part.</amend></subsection><subsection ssid="2-19" dnum="_-o:b-i" numlevel="1" lineno="80" slineno="2-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall administer the High Growth District Revolving Account in <ln numlevel="1" lineno="81" slineno="2-16"/>accordance with this part and rules adopted by the state board under Section <xref depth="3" refnumber="53F-10-405"><ln numlevel="1" lineno="82" slineno="2-17"/>53F-10-405</xref>.</amend></subsection></subsection><subsection ssid="2-20" dnum="_-o:3-i" numlevel="1" lineno="83" slineno="2-18" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">The account consists of:</amend><subsection ssid="2-21" dnum="_-o:a-i" numlevel="1" lineno="84" slineno="2-19" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="ahaskell" level="1" amendtag="end">money appropriated to the account by the Legislature;</amend></subsection><subsection ssid="2-22" dnum="_-o:b-i" numlevel="1" lineno="85" slineno="2-20" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">money received from the repayment of loans made from the account;</amend></subsection><subsection ssid="2-23" dnum="_-o:c-i" numlevel="1" lineno="86" slineno="2-21" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="ahaskell" level="1" amendtag="end">interest and other charges received on loans made from the account; and</amend></subsection><subsection ssid="2-24" dnum="_-o:d-i" numlevel="1" lineno="87" slineno="2-22" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="43" style="1" owner="ahaskell" level="1" amendtag="end">interest earned on money in the account.</amend></subsection></subsection><subsection ssid="2-25" dnum="_-o:4-i" numlevel="1" lineno="88" slineno="2-23" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="ahaskell" level="1" amendtag="end">The state superintendent shall make loans to eligible districts from the account to pay <ln numlevel="1" lineno="89" slineno="2-24"/>for the costs described in Subsection <xref depth="4" refnumber="53F-10-402(1)">(1)</xref>.</amend></subsection><subsection ssid="2-26" dnum="_-o:5-i" numlevel="1" lineno="90" slineno="2-25" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="51" style="1" owner="ahaskell" level="1" amendtag="end">Loans to eligible districts with urgent facility needs or limited financial capacity may be <ln numlevel="1" lineno="91" slineno="2-26"/>given priority.</amend></subsection><subsection ssid="2-27" dnum="_-o:6-i" numlevel="1" lineno="92" slineno="2-27" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="55" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall:</amend><subsection ssid="2-28" dnum="_-o:a-i" numlevel="1" lineno="93" slineno="2-28" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="59" style="1" owner="ahaskell" level="1" amendtag="end">determine which eligible districts qualify as high growth districts in accordance with <ln numlevel="1" lineno="94" slineno="2-29"/>Section <xref depth="3" refnumber="53F-10-403">53F-10-403</xref>;</amend></subsection><subsection ssid="2-29" dnum="_-o:b-i" numlevel="1" lineno="95" slineno="2-30" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="63" style="1" owner="ahaskell" level="1" amendtag="end">review requests by eligible districts for loans under this part;<marker pairid="117"> and</marker></amend></subsection><subsection ssid="2-30" dnum="_-o:c-i" numlevel="1" lineno="96" slineno="2-31" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">approve or reject each loan request; and</amend></subsection><subsection ssid="2-37" dnum="_-o:d-i" numlevel="1" lineno="97" slineno="2-32" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="95" style="1" owner="ahaskell" level="1" amendtag="end"><marker pairid="118">upon request, report to the Public Education Appropriations Subcommittee regarding</marker>:</amend><subsection ssid="2-31" dnum="_-o:i-i" numlevel="1" lineno="98" slineno="2-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="71" style="1" owner="ahaskell" level="1" amendtag="end">the number of applications received;</amend></subsection><subsection ssid="2-32" dnum="_-o:ii-i" numlevel="1" lineno="99" slineno="2-34" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="75" style="1" owner="ahaskell" level="1" amendtag="end">the amount of loans made from the account;</amend></subsection><subsection ssid="2-33" dnum="_-o:iii-i" numlevel="1" lineno="100" slineno="2-35" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="79" style="1" owner="ahaskell" level="1" amendtag="end">the status of loan repayments;</amend></subsection><subsection ssid="2-34" dnum="_-o:iv-i" numlevel="1" lineno="101" slineno="2-36" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="83" style="1" owner="ahaskell" level="1" amendtag="end">how eligible districts use loan proceeds; Eligibility requirements -- High growth district determination.</bold></catline><subsection ssid="15-1" dnum="_-o:1-i" numlevel="1" lineno="106" slineno="3-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="235" groupid="170" style="1" owner="ahaskell" level="1" amendtag="end">A school district is an eligible district if:</amend><subsection ssid="15-64" dnum="_-o:a-i" numlevel="1" lineno="107" slineno="3-4" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="240" groupid="174" style="1" owner="ahaskell" level="1" amendtag="end">the school district has a positive average annual net enrollment increase;</amend></subsection><subsection ssid="15-65" dnum="_-o:b-i" numlevel="1" lineno="108" slineno="3-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="178" style="1" owner="ahaskell" level="1" amendtag="end">the school district has an average annual enrollment growth rate of at least 1.0% over <ln numlevel="1" lineno="109" slineno="3-6"/>the three school years immediately <marker pairid="298">preceding</marker> the fiscal year for which the school <ln numlevel="1" lineno="110" slineno="3-7"/>district applies for a loan; and</amend></subsection><subsection ssid="15-66" dnum="_-o:c-i" numlevel="1" lineno="111" slineno="3-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="182" style="1" owner="ahaskell" level="1" amendtag="end">the state board determines that the school district is a high growth district under <ln numlevel="1" lineno="112" slineno="3-9"/>Subsection <xref depth="4" refnumber="53F-10-403(2)">(2)</xref>.</amend></subsection></subsection><subsection ssid="15-46" dnum="_-o:2-i" numlevel="1" lineno="113" slineno="3-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="15-47" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="296" groupid="219" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall determine which eligible districts qualify as high growth <ln numlevel="1" lineno="114" slineno="3-11"/>districts under the ranking methodology described in Subsection (2)(b), the <ln numlevel="1" lineno="115" slineno="3-12"/>proportional share methodology described in Subsection (2)(c), or both.</amend></subsection><subsection ssid="15-76" dnum="_-o:b-i" numlevel="1" lineno="116" slineno="3-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="306" groupid="223" style="1" owner="ahaskell" level="1" amendtag="end">Under the ranking methodology:</amend><subsection ssid="15-77" dnum="_-o:i-i" numlevel="1" lineno="117" slineno="3-14" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="311" groupid="227" style="1" owner="ahaskell" level="1" amendtag="end">if 10 or more school districts have positive average annual net enrollment <ln numlevel="1" lineno="118" slineno="3-15"/>increases, the state board shall:</amend><subsection ssid="15-78" dnum="_-o:A-i" numlevel="1" lineno="119" slineno="3-16" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="316" groupid="231" style="1" owner="ahaskell" level="1" amendtag="end">rank all school districts with positive average annual net enrollment increases <ln numlevel="1" lineno="120" slineno="3-17"/>in descending order;</amend></subsection><subsection ssid="15-79" dnum="_-o:B-i" numlevel="1" lineno="121" slineno="3-18" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="321" groupid="235" style="1" owner="ahaskell" level="1" amendtag="end">calculate the number of high growth districts by multiplying the total number <ln numlevel="1" lineno="122" slineno="3-19"/>of school districts with positive average annual net enrollment increases by <ln numlevel="1" lineno="123" slineno="3-20"/>0.10 and rounding up to the nearest whole number; and</amend></subsection><subsection ssid="15-80" dnum="_-o:C-i" numlevel="1" lineno="124" slineno="3-21" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="326" groupid="239" style="1" owner="ahaskell" level="1" amendtag="end">designate as high growth districts the number of school districts calculated <ln numlevel="1" lineno="125" slineno="3-22"/>under Subsection (2)(b)(i)(B), starting with the school district with the highest <ln numlevel="1" lineno="126" slineno="3-23"/>average annual net enrollment increase; or</amend></subsection></subsection><subsection ssid="15-81" dnum="_-o:ii-i" numlevel="1" lineno="127" slineno="3-24" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="331" groupid="243" style="1" owner="ahaskell" level="1" amendtag="end">if fewer than 10 school districts have positive average annual net enrollment <ln numlevel="1" lineno="128" slineno="3-25"/>increases, the state board shall designate as high growth districts those school <ln numlevel="1" lineno="129" slineno="3-26"/>districts that have an average annual net enrollment increase of:</amend><subsection ssid="15-82" dnum="_-o:A-i" numlevel="1" lineno="130" slineno="3-27" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="336" groupid="247" style="1" owner="ahaskell" level="1" amendtag="end">at least 100 students; or</amend></subsection><subsection ssid="15-83" dnum="_-o:B-i" numlevel="1" lineno="131" slineno="3-28" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="341" groupid="251" style="1" owner="ahaskell" level="1" amendtag="end">at least 2% of the school district's ADM.</amend></subsection></subsection></subsection><subsection ssid="15-84" dnum="_-o:c-i" numlevel="1" lineno="132" slineno="3-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="346" groupid="255" style="1" owner="ahaskell" level="1" amendtag="end">Under the proportional share methodology, the state board shall:</amend><subsection ssid="15-85" dnum="_-o:i-i" numlevel="1" lineno="133" slineno="3-30" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="351" groupid="259" style="1" owner="ahaskell" level="1" amendtag="end">calculate the sum of average annual net enrollment increases for all school <ln numlevel="1" lineno="134" slineno="3-31"/>districts that have a positive average annual net enrollment increase;</amend></subsection><subsection ssid="15-86" dnum="_-o:ii-i" numlevel="1" lineno="135" slineno="3-32" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="356" groupid="263" style="1" owner="ahaskell" level="1" amendtag="end">for each school district described in Subsection (2)(c)(i), calculate the ratio of the <ln numlevel="1" lineno="136" slineno="3-33"/>school district's average annual net enrollment increase to the sum calculated <ln numlevel="1" lineno="137" slineno="3-34"/>under Subsection (2)(c)(i); and</amend></subsection><subsection ssid="15-87" dnum="_-o:iii-i" numlevel="1" lineno="138" slineno="3-35" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="361" groupid="267" style="1" owner="ahaskell" level="1" amendtag="end">designate as a high growth district each school district whose ratio calculated <ln numlevel="1" lineno="139" slineno="3-36"/>under Subsection (2)(c)(ii) is equal to or greater than 0.10.</amend></subsection></subsection></subsection><subsection ssid="15-54" dnum="_-o:3-i" numlevel="1" lineno="140" slineno="3-37" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="133" style="1" owner="ahaskell" level="1" amendtag="end">In calculating net enrollment increases under this section, the state board:</amend><subsection ssid="15-55" dnum="_-o:a-i" numlevel="1" lineno="141" slineno="3-38" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="137" style="1" owner="ahaskell" level="1" amendtag="end">shall use ADM data from the three most recent fiscal years for which data is <ln numlevel="1" lineno="142" slineno="3-39"/>available; and</amend></subsection><subsection ssid="15-56" dnum="_-o:b-i" numlevel="1" lineno="143" slineno="3-40" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="199" groupid="141" style="1" owner="ahaskell" level="1" amendtag="end">may include projected enrollment data for the upcoming fiscal year if:</amend><subsection ssid="15-57" dnum="_-o:i-i" numlevel="1" lineno="144" slineno="3-41" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="145" style="1" owner="ahaskell" level="1" amendtag="end">the school district provides documentation supporting the projection; and</amend></subsection><subsection ssid="15-58" dnum="_-o:ii-i" numlevel="1" lineno="145" slineno="3-42" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="149" style="1" owner="ahaskell" level="1" amendtag="end">the state board determines the projection is reasonable based on:</amend><subsection ssid="15-59" dnum="_-o:A-i" numlevel="1" lineno="146" slineno="3-43" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="153" style="1" owner="ahaskell" level="1" amendtag="end">historical enrollment trends;</amend></subsection><subsection ssid="15-60" dnum="_-o:B-i" numlevel="1" lineno="147" slineno="3-44" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="157" style="1" owner="ahaskell" level="1" amendtag="end">residential construction permits issued within the school district's boundaries;</amend></subsection><subsection ssid="15-61" dnum="_-o:C-i" numlevel="1" lineno="148" slineno="3-45" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="161" style="1" owner="ahaskell" level="1" amendtag="end">population growth data from the Utah Population Committee created in <ln numlevel="1" lineno="149" slineno="3-46"/>Section <xref depth="3" refnumber="63C-20-103">63C-20-103</xref>; and</amend></subsection></subsection><subsection ssid="15-29" dnum="_-o:iii-i" numlevel="1" lineno="171" slineno="3-68" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="60" style="1" owner="ahaskell" level="1" amendtag="end">beginning with the third fiscal year after the creation or reorganization, the state <ln numlevel="1" lineno="172" slineno="3-69"/>board shall calculate the school district's average annual net enrollment increase <ln numlevel="1" lineno="173" slineno="3-70"/>using the standard methodology described in Subsection <xref depth="4" refnumber="53F-10-403(2)">(2)</xref>.</amend></subsection></subsection><subsection ssid="15-30" dnum="_-o:b-i" numlevel="1" lineno="174" slineno="3-71" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="62" style="1" owner="ahaskell" level="1" amendtag="end">For purposes of calculating net enrollment increase under this section, if a school <ln numlevel="1" lineno="175" slineno="3-72"/>district loses territory or students due to a split, consolidation, or reorganization:</amend><subsection ssid="15-31" dnum="_-o:i-i" numlevel="1" lineno="176" slineno="3-73" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="64" style="1" owner="ahaskell" level="1" amendtag="end">for the fiscal year in which the split, consolidation, or reorganization occurs, the <ln numlevel="1" lineno="177" slineno="3-74"/>state board shall calculate the remaining school district's net enrollment increase <ln numlevel="1" lineno="178" slineno="3-75"/>by:</amend><subsection ssid="15-32" dnum="_-o:A-i" numlevel="1" lineno="179" slineno="3-76" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="66" style="1" owner="ahaskell" level="1" amendtag="end">using as the baseline ADM the remaining school district's ADM for the fiscal <ln numlevel="1" lineno="180" slineno="3-77"/>year immediately <marker pairid="301">preceding</marker> the split, consolidation, or reorganization, adjusted <ln numlevel="1" lineno="181" slineno="3-78"/>to exclude the ADM of students who were transferred to another district; and</amend></subsection><subsection ssid="15-33" dnum="_-o:B-i" numlevel="1" lineno="182" slineno="3-79" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="68" style="1" owner="ahaskell" level="1" amendtag="end">comparing the adjusted baseline ADM under Subsection <xref depth="4" refnumber="53F-10-403(5)(b)(i)(a)">(5)(b)(i)(A)</xref> to the <ln numlevel="1" lineno="183" slineno="3-80"/>remaining school district's actual ADM for the fiscal year;</amend></subsection></subsection><subsection ssid="15-34" dnum="_-o:ii-i" numlevel="1" lineno="184" slineno="3-81" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="70" style="1" owner="ahaskell" level="1" amendtag="end">for the two fiscal years immediately following the fiscal year described in <ln numlevel="1" lineno="185" slineno="3-82"/>Subsection <xref depth="4" refnumber="53F-10-403(5)(b)(i)">(5)(b)(i)</xref>, the state board shall calculate the remaining school district's <ln numlevel="1" lineno="186" slineno="3-83"/>average annual net enrollment increase using:</amend><subsection ssid="15-35" dnum="_-o:A-i" numlevel="1" lineno="187" slineno="3-84" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">the calculation described in Subsection <xref depth="4" refnumber="53F-10-403(5)(b)(i)">(5)(b)(i)</xref> for the fiscal year in which <ln numlevel="1" lineno="188" slineno="3-85"/>the split, consolidation, or reorganization occurred;</amend></subsection><subsection ssid="15-36" dnum="_-o:B-i" numlevel="1" lineno="189" slineno="3-86" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="74" style="1" owner="ahaskell" level="1" amendtag="end">actual year-over-year ADM changes for each subsequent fiscal year; and</amend></subsection><subsection ssid="15-37" dnum="_-o:C-i" numlevel="1" lineno="190" slineno="3-87" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="76" style="1" owner="ahaskell" level="1" amendtag="end">projected enrollment data under Subsection <xref depth="4" refnumber="53F-10-403(3)(b)">(3)(b)</xref> if applicable; and</amend></subsection></subsection><subsection ssid="15-38" dnum="_-o:iii-i" numlevel="1" lineno="191" slineno="3-88" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="78" style="1" owner="ahaskell" level="1" amendtag="end">beginning with the third fiscal year after the split, consolidation, or <ln numlevel="1" lineno="192" slineno="3-89"/>reorganization, the state board shall calculate the school district's average annual <ln numlevel="1" lineno="193" slineno="3-90"/>net enrollment increase using the standard methodology described in Subsection <xref depth="4" refnumber="53F-10-403(2)"><ln numlevel="1" lineno="194" slineno="3-91"/>(2)</xref>.</amend></subsection></subsection><subsection ssid="15-39" dnum="_-o:c-i" numlevel="1" lineno="195" slineno="3-92" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="80" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="196" slineno="3-93"/>Administrative Rulemaking Act, to establish:</amend><subsection ssid="15-40" dnum="_-o:i-i" numlevel="1" lineno="197" slineno="3-94" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="82" style="1" owner="ahaskell" level="1" amendtag="end">procedures for implementing the calculations described in Subsections <xref depth="4" refnumber="53F-10-403(5)(a)">(5)(a)</xref> and <xref depth="4" refnumber="53F-10-403(5)(b)"><ln numlevel="1" lineno="198" slineno="3-95"/>(5)(b)</xref>;</amend></subsection><subsection ssid="15-41" dnum="_-o:ii-i" numlevel="1" lineno="199" slineno="3-96" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="84" style="1" owner="ahaskell" level="1" amendtag="end">documentation requirements for school districts affected by a split, consolidation, <ln numlevel="1" lineno="200" slineno="3-97"/>or reorganization;</amend></subsection><subsection ssid="15-42" dnum="_-o:iii-i" numlevel="1" lineno="201" slineno="3-98" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="86" style="1" owner="ahaskell" level="1" amendtag="end">methods for allocating historical enrollment growth among successor districts <ln numlevel="1" lineno="202" slineno="3-99"/>when necessary to implement this subsection; and</amend></subsection><subsection ssid="15-43" dnum="_-o:iv-i" numlevel="1" lineno="203" slineno="3-100" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="88" style="1" owner="ahaskell" level="1" amendtag="end">methods for determining the baseline ADM for each new or reorganized district's <ln numlevel="1" lineno="204" slineno="3-101"/>geographic territory when historical data for the specific territory is not readily <ln numlevel="1" lineno="205" slineno="3-102"/>available.</amend></subsection></subsection></subsection></section></bsec><bsec buid="13" num="53F-10-404" type="enact" src="code" uid="C53F-10-S404_2026050620260506" sort="53F10 04040020260506" numlevel="1" lineno="206" slineno="4-1" sn="4"><section numlevel="1" lineno="207" slineno="4-2" number="53F-10-404" type="enact"><secline lineno="206">Section 4. Section <bold>53F-10-404</bold> is enacted to read:</secline><catline lineno="207"><bold>53F-10-404<parens/>. Loan terms and conditions -- Allowable uses -- Limitations.</bold></catline><subsection ssid="13-3-81" dnum="_-o:1-i" numlevel="1" lineno="208" slineno="4-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">Subject to available money in the account, the state board may approve loans to eligible <ln numlevel="1" lineno="209" slineno="4-4"/>districts in accordance with this section.</amend></subsection><subsection ssid="13-3-82" dnum="_-o:2-i" numlevel="1" lineno="210" slineno="4-5" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall give priority to loan applications from eligible districts that <ln numlevel="1" lineno="211" slineno="4-6"/>demonstrate:</amend><subsection ssid="13-3-83" dnum="_-o:a-i" numlevel="1" lineno="212" slineno="4-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">qualification as a high growth district under Section <xref depth="3" refnumber="53F-10-403">53F-10-403</xref>;</amend></subsection><subsection ssid="13-3-84" dnum="_-o:b-i" numlevel="1" lineno="213" slineno="4-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">urgent facility needs due to enrollment growth; or</amend></subsection><subsection ssid="13-3-85" dnum="_-o:c-i" numlevel="1" lineno="214" slineno="4-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">limited financial capacity to meet capital needs through other sources.</amend></subsection></subsection><subsection ssid="13-3-86" dnum="_-o:3-i" numlevel="1" lineno="215" slineno="4-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">The state board may not approve loans to eligible districts under this part that exceed a <ln numlevel="1" lineno="216" slineno="4-11"/>total of $15,000,000 in any fiscal year.</amend></subsection><subsection ssid="13-3-87" dnum="_-o:4-i" numlevel="1" lineno="217" slineno="4-12" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">The term of a loan to an eligible district under this part may not exceed 10 years.</amend></subsection><subsection ssid="13-3-88" dnum="_-o:5-i" numlevel="1" lineno="218" slineno="4-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">The state board shall establish interest rates for loans under this part by rule in <ln numlevel="1" lineno="219" slineno="4-14"/>accordance with Section <xref depth="3" refnumber="53F-10-405">53F-10-405</xref>, considering:</amend><subsection ssid="13-3-89" dnum="_-o:a-i" numlevel="1" lineno="220" slineno="4-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="ahaskell" level="1" amendtag="end">the cost of funds to the state;</amend></subsection><subsection ssid="13-3-90" dnum="_-o:b-i" numlevel="1" lineno="221" slineno="4-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">administrative costs of the program; and</amend></subsection><subsection ssid="11-88" dnum="_-o:v-i" numlevel="1" lineno="296" slineno="5-41" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="108" style="1" owner="ahaskell" level="1" amendtag="end">the status of loan repayment;</amend></subsection></subsection><subsection ssid="11-89" dnum="_-o:f-i" numlevel="1" lineno="297" slineno="5-42" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">procedures for monitoring eligible districts' compliance with the requirements of this <ln numlevel="1" lineno="298" slineno="5-43"/>part, loan agreements, and rules made under this section; and</amend></subsection><subsection ssid="11-90" dnum="_-o:g-i" numlevel="1" lineno="299" slineno="5-44" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">procedures for addressing loan defaults or misuse of loan proceeds.</amend></subsection></subsection><subsection ssid="11-91" dnum="_-o:3-i" numlevel="1" lineno="300" slineno="5-45" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="120" style="1" owner="ahaskell" level="1" amendtag="end">An eligible district shall submit reports required under rules made under Subsection <xref depth="4" refnumber="53F-10-405(2)(d)"><ln numlevel="1" lineno="301" slineno="5-46"/>(2)(d)</xref>:</amend><subsection ssid="11-92" dnum="_-o:a-i" numlevel="1" lineno="302" slineno="5-47" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="124" style="1" owner="ahaskell" level="1" amendtag="end">annually while the eligible district is:</amend><subsection ssid="11-93" dnum="_-o:i-i" numlevel="1" lineno="303" slineno="5-48" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="128" style="1" owner="ahaskell" level="1" amendtag="end">using loan proceeds received under this part; or</amend></subsection><subsection ssid="11-94" dnum="_-o:ii-i" numlevel="1" lineno="304" slineno="5-49" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="132" style="1" owner="ahaskell" level="1" amendtag="end">repaying a loan received under this part; and</amend></subsection></subsection><subsection ssid="11-95" dnum="_-o:b-i" numlevel="1" lineno="305" slineno="5-50" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="136" style="1" owner="ahaskell" level="1" amendtag="end">within one year after the eligible district completes a project funded by loan proceeds.</amend></subsection></subsection><subsection ssid="11-96" dnum="_-o:4-i" numlevel="1" lineno="306" slineno="5-51" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="140" style="1" owner="ahaskell" level="1" amendtag="end">If an eligible district uses loan proceeds in a manner that does not comply with Section <xref depth="3" refnumber="53F-10-404"><ln numlevel="1" lineno="307" slineno="5-52"/>53F-10-404</xref>, or the loan agreement fails to make required loan payments, or fails to <ln numlevel="1" lineno="308" slineno="5-53"/>comply with reporting requirements under this section, the state board may:</amend><subsection ssid="11-100" dnum="_-o:a-i" numlevel="1" lineno="309" slineno="5-54" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="195" groupid="156" style="1" owner="ahaskell" level="1" amendtag="end">accelerate the repayment schedule;</amend></subsection><subsection ssid="11-101" dnum="_-o:b-i" numlevel="1" lineno="310" slineno="5-55" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="200" groupid="160" style="1" owner="ahaskell" level="1" amendtag="end">require immediate repayment of the outstanding loan balance;</amend></subsection><subsection ssid="11-102" dnum="_-o:c-i" numlevel="1" lineno="311" slineno="5-56" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="164" style="1" owner="ahaskell" level="1" amendtag="end">pursue legal remedies to recover outstanding amounts; or</amend></subsection><subsection ssid="11-103" dnum="_-o:d-i" numlevel="1" lineno="312" slineno="5-57" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="210" groupid="168" style="1" owner="ahaskell" level="1" amendtag="end">make the eligible district ineligible for future loans under this part for up to five <ln numlevel="1" lineno="313" slineno="5-58"/>years.</amend></subsection></subsection><subsection ssid="11-104" dnum="_-o:5-i" numlevel="1" lineno="314" slineno="5-59" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="215" groupid="172" style="1" owner="ahaskell" level="1" amendtag="end">All loan repayments, interest, and other charges collected under this part shall be <ln numlevel="1" lineno="315" slineno="5-60"/>deposited into the High Growth District Revolving Account.</amend></subsection></section></bsec><bsec buid="22" type="uncod" untype="approp" src="uncod" uid="APP2027" sort="UP0002027" langlock="false" numlevel="1" lineno="316" slineno="6-1" sn="6"><section type="uncod" nodeid="2" fy="2027" untype="approp" display="false" src="uncod"><secline lineno="316">Section 6.  <bold>FY 2027 Appropriations.</bold></secline><sectionText lineno="317"><summary numlevel="1" lineno="317" slineno="6-2">The following sums of money are appropriated for the fiscal year beginning July 1, <ln numlevel="1" lineno="318" slineno="6-3"/>2026, and ending June 30, 2027.
