Section <bold>53F-10-502</bold> is enacted to read:</secline><catline lineno="46"><bold>53F-10-502<parens/>. High growth successor district criteria -- State Board identification <ln numlevel="1" lineno="47" slineno="2-3"/>and reporting.</bold></catline><subsection ssid="4-1" dnum="_-o:1-i" numlevel="1" lineno="48" slineno="2-4" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">For purposes of this part, a successor district is a high growth successor district if:</amend><subsection ssid="4-2" dnum="_-o:a-i" numlevel="1" lineno="49" slineno="2-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">the successor district has been in operation for at least two full fiscal years since the <ln numlevel="1" lineno="50" slineno="2-6"/>allocation date and has had an average annual enrollment increase of at least 3%; or</amend></subsection><subsection ssid="4-3" dnum="_-o:b-i" numlevel="1" lineno="51" slineno="2-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">for a successor district that has been in operation for less than two full fiscal years <ln numlevel="1" lineno="52" slineno="2-8"/>since the allocation date, the successor district demonstrates projected enrollment <ln numlevel="1" lineno="53" slineno="2-9"/>growth of at least 5% annually based on:</amend><subsection ssid="4-4" dnum="_-o:i-i" numlevel="1" lineno="54" slineno="2-10" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">residential construction permits issued within the successor district's boundaries;</amend></subsection><subsection ssid="4-5" dnum="_-o:ii-i" numlevel="1" lineno="55" slineno="2-11" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">population growth projections from the Utah Population Committee created in <ln numlevel="1" lineno="56" slineno="2-12"/>Section 63C-20-103;</amend></subsection><subsection ssid="4-6" dnum="_-o:iii-i" numlevel="1" lineno="57" slineno="2-13" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">new housing development plans;</amend></subsection><subsection ssid="4-7" dnum="_-o:iv-i" numlevel="1" lineno="58" slineno="2-14" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">historical enrollment trends from the geographic area; and</amend></subsection><subsection ssid="4-8" dnum="_-o:v-i" numlevel="1" lineno="59" slineno="2-15" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">other relevant demographic data.</amend></subsection></subsection></subsection><subsection ssid="4-9" dnum="_-o:2-i" numlevel="1" lineno="60" slineno="2-16" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="ahaskell" level="1" amendtag="end">The State Board of Education shall, using existing enrollment data collection processes:</amend><subsection ssid="4-10" dnum="_-o:a-i" numlevel="1" lineno="61" slineno="2-17" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="39" style="1" owner="ahaskell" level="1" amendtag="end">identify which successor districts meet the high growth criteria annually;</amend></subsection><subsection ssid="4-11" dnum="_-o:b-i" numlevel="1" lineno="62" slineno="2-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="ahaskell" level="1" amendtag="end">calculate each successor district's proportional share of the divided school district <ln numlevel="1" lineno="63" slineno="2-19"/>based on the methodology established in Section 53G-3-302; and</amend></subsection><subsection ssid="4-12" dnum="_-o:c-i" numlevel="1" lineno="64" slineno="2-20" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="47" style="1" owner="ahaskell" level="1" amendtag="end">notify successor districts of their high growth status.</amend></subsection></subsection><subsection ssid="4-13" dnum="_-o:3-i" numlevel="1" lineno="65" slineno="2-21" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">The State Board shall report annually to the Public Education Appropriations <ln numlevel="1" lineno="66" slineno="2-22"/>Subcommittee regarding:</amend><subsection ssid="4-14" dnum="_-o:a-i" numlevel="1" lineno="67" slineno="2-23" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">the number of reorganizations that have occurred;</amend></subsection><subsection ssid="4-15" dnum="_-o:b-i" numlevel="1" lineno="68" slineno="2-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="ahaskell" level="1" amendtag="end">which successor districts qualify as high growth successor districts;</amend></subsection><subsection ssid="4-16" dnum="_-o:c-i" numlevel="1" lineno="69" slineno="2-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">enrollment growth patterns and trends in successor districts;</amend></subsection><subsection ssid="4-17" dnum="_-o:d-i" numlevel="1" lineno="70" slineno="2-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="65" style="1" owner="ahaskell" level="1" amendtag="end">facility capacity challenges identified in high growth transition plans submitted <ln numlevel="1" lineno="71" slineno="2-27"/>under Subsection 53G-3-302(13);</amend></subsection><subsection ssid="4-18" dnum="_-o:e-i" numlevel="1" lineno="72" slineno="2-28" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="69" style="1" owner="ahaskell" level="1" amendtag="end">strategies successor districts have used to address high growth, including any <ln numlevel="1" lineno="73" slineno="2-29"/>voluntary loan arrangements; slineno="5-11"/>property, a vehicle, an employee, or bonded indebtedness.</subsection></subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="136" slineno="5-12" level="2" numlevel="1" lineno="141" slineno="5-17" level="2"><display>(d)</display>"Physical asset" means a building, land, or water right together with revenue derived <ln numlevel="1" lineno="142" slineno="5-18"/>from the lease or use of the building, land, or water right.</subsection><subsection ssid="1-null-10" dnum="e-o" numlevel="1" lineno="143" slineno="5-19" level="2" space="false"><display>(e)</display><subsection ssid="1-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Physical liability" means a liability associated with a physical asset, including:<subsection ssid="1-null-12" dnum="A-o" numlevel="1" lineno="144" slineno="5-20" level="4" tab="1"><display>(A)</display>a seismic safety evaluation or mitigation; or</subsection><subsection ssid="1-null-13" dnum="B-o" numlevel="1" lineno="145" slineno="5-21" level="4" tab="1"><display>(B)</display>deferred maintenance.</subsection></subsection><subsection ssid="1-null-14" dnum="ii-o" numlevel="1" lineno="146" slineno="5-22" level="3"><display>(ii)</display>"Physical liability" does not include a liability associated with any debt, including <ln numlevel="1" lineno="147" slineno="5-23"/>a general obligation or lease revenue bond.</subsection></subsection></subsection><subsection ssid="1-null-15" dnum="2-o" numlevel="1" lineno="148" slineno="5-24" level="1" space="false"><display>(2)</display><subsection ssid="1-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If voters approve a proposal to create a new school district under this part:<subsection ssid="1-null-17" dnum="i-o" numlevel="1" lineno="149" slineno="5-25" level="3" tab="1"><display>(i)</display>the legislative body of each county where all or a part of the new school district <ln numlevel="1" lineno="150" slineno="5-26"/>and the reorganized new school district are located shall hold elections, during the <ln numlevel="1" lineno="151" slineno="5-27"/>year immediately following the year in which the voters approve the proposal or <ln numlevel="1" lineno="152" slineno="5-28"/>municipal legislative bodies or interlocal agreement participants create a new <ln numlevel="1" lineno="153" slineno="5-29"/>school district, to elect members to the local school board of the new school <ln numlevel="1" lineno="154" slineno="5-30"/>district and to the local school board of the reorganized new school district, as <ln numlevel="1" lineno="155" slineno="5-31"/>follows:<subsection ssid="1-null-18" dnum="A-o" numlevel="1" lineno="156" slineno="5-32" level="4"><display>(A)</display>the filing period for a declaration of candidacy is the same as the filing period <ln numlevel="1" lineno="157" slineno="5-33"/>for the next regular or municipal general election for the given year;</subsection><subsection ssid="1-null-19" dnum="B-o" numlevel="1" lineno="158" slineno="5-34" level="4"><display>(B)</display>the primary election is held on the same day as the primary election for the <ln numlevel="1" lineno="159" slineno="5-35"/>next regular or municipal general election for the given year; and</subsection><subsection ssid="1-null-20" dnum="C-o" numlevel="1" lineno="160" slineno="5-36" level="4"><display>(C)</display>the general election is held on the same day as the next regular or municipal <ln numlevel="1" lineno="161" slineno="5-37"/>general election for the given year;</subsection></subsection><subsection ssid="1-null-21" dnum="ii-o" numlevel="1" lineno="162" slineno="5-38" level="3" tab="1"><display>(ii)</display>any new school district and reorganized new school district shall divide the assets <ln numlevel="1" lineno="163" slineno="5-39"/>and liabilities of the divided school district between the school districts in <ln numlevel="1" lineno="164" slineno="5-40"/>accordance with Subsection <xref refnumber="53G-3-302(4)" depth="4">(4)</xref> and Section <xref depth="3" refnumber="53G-3-307">53G-3-307</xref>;</subsection><subsection ssid="1-null-22" dnum="iii-o" numlevel="1" lineno="165" slineno="5-41" level="3" tab="1"><display>(iii)</display>any new school district and reorganized new school district shall treat the <ln numlevel="1" lineno="166" slineno="5-42"/>employment of transferred employees from the divided school district in <ln numlevel="1" lineno="167" slineno="5-43"/>accordance with Sections <xref depth="3" refnumber="53G-3-205">53G-3-205</xref> and <xref depth="3" refnumber="53G-3-308">53G-3-308</xref>;</subsection><subsection ssid="1-null-23" dnum="iv-o" numlevel="1" lineno="168" slineno="5-44" level="3" tab="1"><display>(iv)</display>an individual residing within the boundaries of a new school district or <ln numlevel="1" lineno="169" slineno="5-45"/>reorganized new school district at the time the new school district is created may, <ln numlevel="1" lineno="170" slineno="5-46"/>for six school years following the creation of the new school district, elect to <ln numlevel="1" lineno="171" slineno="5-47"/>enroll in a secondary school located outside the boundaries of the school district if:<subsection ssid="1-null-24" dnum="A-o" numlevel="1" lineno="172" slineno="5-48" level="4"><display>(A)</display>the individual resides within the boundaries of the secondary school on the <ln numlevel="1" lineno="173" slineno="5-49"/>day before the creation of the new school district; and</subsection><subsection ssid="1-null-25" dnum="B-o" numlevel="1" lineno="174" slineno="5-50" level="4"><display>(B)</display>the individual would have been eligible to enroll in the secondary school if not <ln numlevel="1" lineno="175" slineno="5-51"/>for the creation of the new school district;</subsection><subsection ssid="1-null-26" dnum="C-o" numlevel="1" lineno="176" slineno="5-52" level="4"><display>(C)</display>the new school district shall provide educational services, including, if <ln numlevel="1" lineno="177" slineno="5-53"/>provided before the creation of the new school district, busing to each <ln numlevel="1" lineno="178" slineno="5-54"/>individual making an election under Subsection <xref depth="4" refnumber="53G-3-302(2)(a)(iv)">(2)(a)(iv)</xref> for each school year <ln numlevel="1" lineno="179" slineno="5-55"/>for which the individual makes the election; and</subsection></subsection><subsection ssid="1-null-27" dnum="v-o" numlevel="1" lineno="180" slineno="5-56" level="3" tab="1"><display>(v)</display>within one year following the date on which the new school district begins <ln numlevel="1" lineno="181" slineno="5-57"/>providing educational services, the superintendent of each affected school district <ln numlevel="1" lineno="182" slineno="5-58"/>shall meet, together with the state superintendent, to determine if further boundary <ln numlevel="1" lineno="183" slineno="5-59"/>changes should take place in accordance with Section <xref depth="3" refnumber="53G-3-501">53G-3-501</xref>.</subsection></subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="184" slineno="5-60" level="2" space="false"><display>(b)</display><subsection ssid="1-null-29" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The county or municipal legislative bodies that conduct redistricting for the <ln numlevel="1" lineno="185" slineno="5-61"/>new school district and the reorganized new school district shall, at the meeting <ln numlevel="1" lineno="186" slineno="5-62"/>where the county or municipal legislative bodies adopt the final redistricting <ln numlevel="1" lineno="187" slineno="5-63"/>maps, adjust the initial terms of the board members for the new school district and <ln numlevel="1" lineno="188" slineno="5-64"/>the reorganized new school district, by lot, so that approximately half of the board <ln numlevel="1" lineno="189" slineno="5-65"/>members on each board will have an initial term of three years with the other <ln numlevel="1" lineno="190" slineno="5-66"/>members having an initial term of five years.</subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="191" slineno="5-67" level="3"><display>(ii)</display>Notwithstanding the existence of the new school district local school board and <ln numlevel="1" lineno="192" slineno="5-68"/>the reorganized new school district local school board under Subsection <xref depth="4" refnumber="53G-3-302(2)(a)(i)">(2)(a)(i)</xref>, <ln numlevel="1" lineno="193" slineno="5-69"/>the divided school district local school board shall continue to function and <ln numlevel="1" lineno="194" slineno="5-70"/>exercise authority as a local school board until the allocation date to the extent <ln numlevel="1" lineno="195" slineno="5-71"/>necessary to continue to provide educational services to the entire divided school <ln numlevel="1" lineno="196" slineno="5-72"/>district.</subsection><subsection ssid="1-null-31" dnum="iii-o" numlevel="1" lineno="197" slineno="5-73" level="3"><display>(iii)</display>An individual may simultaneously serve as or be elected to be a member of the <ln numlevel="1" lineno="198" slineno="5-74"/>local school board of  a divided school district and a member of the local school <ln numlevel="1" lineno="199" slineno="5-75"/>board of:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="200" slineno="5-76" level="4"><display>(A)</display>a new school district; or</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="201" slineno="5-77" level="4"><display>(B)</display>a reorganized new school district.</subsection></subsection><subsection ssid="1-null-34" dnum="iv-o" numlevel="1" lineno="202" slineno="5-78" level="3"><display>(iv)</display>On the allocation date, the divided school district and the associated local school <ln numlevel="1" lineno="203" slineno="5-79"/>board cease to exist.</subsection></subsection><subsection ssid="1-null-35" dnum="c-o" numlevel="1" lineno="204" slineno="5-80" level="2" space="false"><display>(c)</display><subsection ssid="1-null-36" dnum="i-o" level="3" placement="sameline"><display>(i)</display>On the Tuesday immediately following certification of the election results for <ln numlevel="1" lineno="205" slineno="5-81"/>the first election for the members of the local school board described in <ln numlevel="1" lineno="206" slineno="5-82"/>Subsection <xref tempid="155" depth="4" refnumber="53G-3-302(2)(a)(i)">(2)(a)(i)</xref>, the newly elected members of the local school board for the <ln numlevel="1" lineno="207" slineno="5-83"/>new school district or reorganized new school district shall take the oath of office <ln numlevel="1" lineno="208" slineno="5-84"/>and begin serving.</subsection><subsection ssid="1-null-37" dnum="ii-o" numlevel="1" lineno="209" slineno="5-85" level="3"><display>(ii)</display>If the term of a member of the local school board of the divided school district <ln numlevel="1" lineno="210" slineno="5-86"/>ends within one year of the allocation date, the member's term shall extend to the <ln numlevel="1" lineno="211" slineno="5-87"/>allocation date.</subsection></subsection></subsection><subsection ssid="1-null-38" dnum="3-o" numlevel="1" lineno="212" slineno="5-88" level="1" space="false"><display>(3)</display><subsection ssid="1-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The divided school district local school board shall:<subsection ssid="1-null-40" dnum="i-o" numlevel="1" lineno="213" slineno="5-89" level="3" tab="1"><display>(i)</display>within 60 days after the creation date prepare an initial inventory of the divided <ln numlevel="1" lineno="214" slineno="5-90"/>school district's:<subsection ssid="1-null-41" dnum="A-o" numlevel="1" lineno="215" slineno="5-91" level="4"><display>(A)</display>assets, both tangible and intangible, real and personal; and</subsection><subsection ssid="1-null-42" dnum="B-o" numlevel="1" lineno="216" slineno="5-92" level="4"><display>(B)</display>liabilities;</subsection></subsection><subsection ssid="1-null-43" dnum="ii-o" numlevel="1" lineno="217" slineno="5-93" level="3" tab="1"><display>(ii)</display>on or before December 1 of the year following the creation date:<subsection ssid="1-null-44" dnum="A-o" numlevel="1" lineno="218" slineno="5-94" level="4"><display>(A)</display>prepare an asset inventory, with records, of the divided school district's assets <ln numlevel="1" lineno="219" slineno="5-95"/>and the location of each associated property, discretionary asset, <ln numlevel="1" lineno="220" slineno="5-96"/>nondiscretionary asset, and physical asset; and</subsection><subsection ssid="1-null-45" dnum="B-o" numlevel="1" lineno="221" slineno="5-97" level="4"><display>(B)</display>prepare an inventory of the divided school district's liabilities, with records, <ln numlevel="1" lineno="222" slineno="5-98"/>that includes a description of any liability, including an estimated cost to <ln numlevel="1" lineno="223" slineno="5-99"/>resolve the liability, for each associated property, discretionary asset, <ln numlevel="1" lineno="224" slineno="5-100"/>nondiscretionary asset, physical asset, and unresolved demands, claims, or suits <ln numlevel="1" lineno="225" slineno="5-101"/>with an estimated cost to resolve each liability;</subsection></subsection><subsection ssid="1-null-46" dnum="iii-o" numlevel="1" lineno="226" slineno="5-102" level="3" tab="1"><display>(iii)</display>mutually agree with the local school board of each relevant district to establish a <ln numlevel="1" lineno="227" slineno="5-103"/>regular schedule for the divided school district local school board to, between the <ln numlevel="1" lineno="228" slineno="5-104"/>creation date and the allocation date, prepare regular updates including any change <ln numlevel="1" lineno="229" slineno="5-105"/>in the information required in the inventory and liability reports described in this <ln numlevel="1" lineno="230" slineno="5-106"/>Subsection <xref refnumber="53G-3-302(3)(a)" depth="4">(3)(a)</xref>; and</subsection><subsection ssid="1-null-47" dnum="iv-o" numlevel="1" lineno="231" slineno="5-107" level="3" tab="1"><display>(iv)</display>deliver the reports described in this Subsection <xref refnumber="53G-3-302(3)(a)" depth="4">(3)(a)</xref> to:<subsection ssid="1-null-48" dnum="A-o" numlevel="1" lineno="232" slineno="5-108" level="4"><display>(A)</display>the Office of the Legislative Auditor General; and</subsection><subsection ssid="1-null-49" dnum="B-o" numlevel="1" lineno="233" slineno="5-109" level="4"><display>(B)</display>the local school board of each relevant new school district and reorganized <ln numlevel="1" lineno="234" slineno="5-110"/>new school district.</subsection></subsection></subsection><subsection ssid="1-null-50" dnum="b-o" numlevel="1" lineno="235" slineno="5-111" level="2"><display>(b)</display>Following the local school board election date described in Subsection <xref depth="4" refnumber="53G-3-302(2)(a)">(2)(a)</xref>, the <ln numlevel="1" lineno="236" slineno="5-112"/>new school district and reorganized new school district local school boards shall:<subsection ssid="1-null-51" dnum="i-o" numlevel="1" lineno="237" slineno="5-113" level="3"><display>(i)</display>in cooperation with the local school board of each new school district and <ln numlevel="1" lineno="238" slineno="5-114"/>reorganized new school district, determine the allocation of the divided school <ln numlevel="1" lineno="239" slineno="5-115"/>district's assets and, except for indebtedness under Section <xref depth="3" refnumber="53G-3-307">53G-3-307</xref>, liabilities <ln numlevel="1" lineno="240" slineno="5-116"/>of the new school district and reorganized new school district in accordance with <ln numlevel="1" lineno="241" slineno="5-117"/>Subsection <xref depth="4" refnumber="53G-3-302(4)">(4)</xref>;</subsection><subsection ssid="1-null-52" dnum="ii-o" numlevel="1" lineno="242" slineno="5-118" level="3"><display>(ii)</display>prepare a written report detailing the allocation under Subsection <xref depth="4" refnumber="53G-3-302(3)(b)(i)">(3)(b)(i)</xref>;</subsection><subsection ssid="1-null-53" dnum="iii-o" numlevel="1" lineno="243" slineno="5-119" level="3"><display>(iii)</display>prepare a written report of the disposition of assets and liabilities upon which the <ln numlevel="1" lineno="244" slineno="5-120"/>local school boards could not agree; and</subsection><subsection ssid="1-null-54" dnum="iv-o" numlevel="1" lineno="245" slineno="5-121" level="3"><display>(iv)</display>deliver a copy of the written report to the Office of the Legislative Auditor <ln numlevel="1" lineno="246" slineno="5-122"/>General and the local school board of the divided school district.</subsection></subsection><subsection ssid="1-null-55" dnum="c-o" numlevel="1" lineno="247" slineno="5-123" level="2"><display>(c)</display>The new school district and reorganized new school district local boards shall <ln numlevel="1" lineno="248" slineno="5-124"/>determine the allocation under Subsection <xref depth="4" refnumber="53G-3-302(3)(b)">(3)(b)</xref> and deliver the report required under <ln numlevel="1" lineno="249" slineno="5-125"/>Subsection <xref depth="4" refnumber="53G-3-302(3)(b)">(3)(b)</xref> on or before December 15 of the year following the school board <ln numlevel="1" lineno="250" slineno="5-126"/>election date described in Subsection <xref refnumber="53G-3-302(2)(a)" depth="4">(2)(a)</xref>, unless that deadline is extended by <ln numlevel="1" lineno="251" slineno="5-127"/>mutual agreement of the local school boards of the new school district and <ln numlevel="1" lineno="252" slineno="5-128"/>reorganized new school district.</subsection></subsection><subsection ssid="1-null-56" dnum="4-o" numlevel="1" lineno="253" slineno="5-129" level="1" space="false"><display>(4)</display><subsection ssid="1-null-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided under Subsection <xref depth="4" refnumber="53G-3-302(4)(c)">(4)(c)</xref>, the new school district and <ln numlevel="1" lineno="254" slineno="5-130"/>reorganized new school district local school boards shall allocate all assets and <ln numlevel="1" lineno="255" slineno="5-131"/>liabilities the divided school district owns on the allocation date, both tangible and <ln numlevel="1" lineno="256" slineno="5-132"/>intangible, real and personal, allocating:<subsection ssid="1-null-58" dnum="i-o" numlevel="1" lineno="257" slineno="5-133" level="3" tab="1"><display>(i)</display>a physical asset, physical liability, and associated property asset to the school <ln numlevel="1" lineno="258" slineno="5-134"/>district in which the physical asset is located;</subsection><subsection ssid="1-null-59" dnum="ii-o" numlevel="1" lineno="259" slineno="5-135" level="3" tab="1"><display>(ii)</display>a discretionary asset or liability between the new school district and reorganized <ln numlevel="1" lineno="260" slineno="5-136"/>new school district in proportion to the student population of the school districts;</subsection><subsection ssid="1-null-60" dnum="iii-o" numlevel="1" lineno="261" slineno="5-137" level="3" tab="1"><display>(iii)</display>vehicles used for pupil transportation:<subsection ssid="1-null-61" dnum="A-o" numlevel="1" lineno="262" slineno="5-138" level="4"><display>(A)</display>according to the transportation needs of schools, as measured by the number <ln numlevel="1" lineno="263" slineno="5-139"/>and assortment of vehicles used to serve eligible state supported transportation <ln numlevel="1" lineno="264" slineno="5-140"/>routes serving schools within the new school district and the reorganized new <ln numlevel="1" lineno="265" slineno="5-141"/>school district; and</subsection><subsection ssid="1-null-62" dnum="B-o" numlevel="1" lineno="266" slineno="5-142" level="4"><display>(B)</display>in a manner that gives each school district a fleet of vehicles for pupil <ln numlevel="1" lineno="267" slineno="5-143"/>transportation that is equivalent in terms of age, condition, and variety of <ln numlevel="1" lineno="268" slineno="5-144"/>carrying capacities; and</subsection></subsection><subsection ssid="1-null-63" dnum="iv-o" numlevel="1" lineno="269" slineno="5-145" level="3" tab="1"><display>(iv)</display>other vehicles:<subsection ssid="1-null-64" dnum="A-o" numlevel="1" lineno="270" slineno="5-146" level="4"><display>(A)</display>in proportion to the student population of the school districts; and</subsection><subsection ssid="1-null-65" dnum="B-o" numlevel="1" lineno="271" slineno="5-147" level="4"><display>(B)</display>in a manner that gives each district a fleet of vehicles that is similar in terms <ln numlevel="1" lineno="272" slineno="5-148"/>of age, condition, and carrying capacities.</subsection></subsection></subsection><subsection ssid="1-null-66" dnum="b-o" numlevel="1" lineno="273" slineno="5-149" level="2"><display>(b)</display>Each new and reorganized new school district retains the buildings, land, and water <ln numlevel="1" lineno="274" slineno="5-150"/>rights of the divided district within the boundaries of the relevant new or reorganized <ln numlevel="1" lineno="275" slineno="5-151"/>new school district.</subsection><subsection ssid="1-null-67" dnum="c-o" numlevel="1" lineno="276" slineno="5-152" level="2"><display>(c)</display>By mutual agreement, the new school district and reorganized new school district <ln numlevel="1" lineno="277" slineno="5-153"/>local school boards may allocate an asset or liability in a manner different than the <ln numlevel="1" lineno="278" slineno="5-154"/>allocation method specified in Subsection <xref depth="4" refnumber="53G-3-302(4)(a)">(4)(a)</xref>.</subsection></subsection><subsection ssid="1-null-68" dnum="5-o" numlevel="1" lineno="279" slineno="5-155" level="1" space="false"><display>(5)</display><subsection ssid="1-null-69" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-70" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>After the creation date, the local school board of the divided district may <ln numlevel="1" lineno="280" slineno="5-156"/>issue a lease revenue bond, in accordance with Section <xref depth="3" refnumber="11-14-103">11-14-103</xref>:<subsection ssid="1-null-71" dnum="A-o" numlevel="1" lineno="281" slineno="5-157" level="4" tab="2"><display>(A)</display>that records the date, terms, and amount of the lease revenue bond the divided <ln numlevel="1" lineno="282" slineno="5-158"/>school district provides;</subsection><subsection ssid="1-null-72" dnum="B-o" numlevel="1" lineno="283" slineno="5-159" level="4" tab="2"><display>(B)</display>that designates the new and reorganized new school districts that are the joint <ln numlevel="1" lineno="284" slineno="5-160"/>recipients of the bond proceeds, in proportion to the property tax values within <ln numlevel="1" lineno="285" slineno="5-161"/>each district, as the local political subdivisions receiving the bond proceeds;</subsection><subsection ssid="1-null-73" dnum="C-o" numlevel="1" lineno="286" slineno="5-162" level="4" tab="2"><display>(C)</display>that obligates the new and reorganized new school districts receiving the bond <ln numlevel="1" lineno="287" slineno="5-163"/>proceeds to proportionally repay the remainder of the bond debt after the <ln numlevel="1" lineno="288" slineno="5-164"/>allocation date, in proportion to the portion of the bond proceeds each new or <ln numlevel="1" lineno="289" slineno="5-165"/>reorganized new school district receives;</subsection><subsection ssid="1-null-74" dnum="D-o" numlevel="1" lineno="290" slineno="5-166" level="4" tab="2"><display>(D)</display>that prohibits the bond from inclusion in the outstanding bond indebtedness of <ln numlevel="1" lineno="291" slineno="5-167"/>the divided school district, in accordance with Section <xref depth="3" refnumber="53G-3-307">53G-3-307</xref>;</subsection><subsection ssid="1-null-75" dnum="E-o" numlevel="1" lineno="292" slineno="5-168" level="4" tab="2"><display>(E)</display>to which, if the relevant local school board has been seated, the local school <ln numlevel="1" lineno="293" slineno="5-169"/>board of the new school district or reorganized new school district consents in <ln numlevel="1" lineno="294" slineno="5-170"/>writing; and</subsection><subsection ssid="1-null-76" dnum="F-o" numlevel="1" lineno="295" slineno="5-171" level="4" tab="2"><display>(F)</display>that provides that the divided school district is responsible for the bond <ln numlevel="1" lineno="296" slineno="5-172"/>payments until the allocation date and that each new and reorganized new <ln numlevel="1" lineno="297" slineno="5-173"/>school district receiving the bond proceeds under this section is responsible for <ln numlevel="1" lineno="298" slineno="5-174"/>a proportional share of the bond payments after the allocation date.</subsection></subsection><subsection ssid="1-null-77" dnum="ii-o" numlevel="1" lineno="299" slineno="5-175" level="3" tab="1"><display>(ii)</display>This Subsection <xref refnumber="53G-3-302(5)(a)" depth="4">(5)(a)</xref> applies retrospectively to a lease revenue bond that a <ln numlevel="1" lineno="300" slineno="5-176"/>divided school district issued after November 4, 2024.</subsection></subsection><subsection ssid="1-null-78" dnum="b-o" numlevel="1" lineno="301" slineno="5-177" level="2" space="false"><display>(b)</display><subsection ssid="1-null-79" dnum="i-o" level="3" placement="sameline"><display>(i)</display>After the creation date, the local school board of the divided school district may <ln numlevel="1" lineno="302" slineno="5-178"/>issue a general obligation bond for the interlocal agreement participants on behalf <ln numlevel="1" lineno="303" slineno="5-179"/>of the relevant new and reorganized new school district within the divided school <ln numlevel="1" lineno="304" slineno="5-180"/>district, in accordance with Section <xref depth="3" refnumber="11-14-103">11-14-103</xref>.</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="305" slineno="5-181" level="3"><display>(ii)</display>The local school board shall ensure that the resolution submitting the question of <ln numlevel="1" lineno="306" slineno="5-182"/>the issuance of the bond by the divided school district, in accordance with Section <xref depth="3" refnumber="11-14-201"><ln numlevel="1" lineno="307" slineno="5-183"/>11-14-201</xref>:<subsection ssid="1-null-81" dnum="A-o" numlevel="1" lineno="308" slineno="5-184" level="4"><display>(A)</display>designates the new and reorganized new school districts that are the joint <ln numlevel="1" lineno="309" slineno="5-185"/>recipients of the bond proceeds, in proportion to the property tax values within <ln numlevel="1" lineno="310" slineno="5-186"/>each district, as the local political subdivisions receiving the bond proceeds;</subsection><subsection ssid="1-null-82" dnum="B-o" numlevel="1" lineno="311" slineno="5-187" level="4"><display>(B)</display>obligates the new and reorganized new school districts receiving the bond <ln numlevel="1" lineno="312" slineno="5-188"/>proceeds to proportionally repay the remainder of the bond debt after the <ln numlevel="1" lineno="313" slineno="5-189"/>allocation date, in proportion to the portion of the bond proceeds each new or <ln numlevel="1" lineno="314" slineno="5-190"/>reorganized new school district receives;</subsection><subsection ssid="1-null-83" dnum="C-o" numlevel="1" lineno="315" slineno="5-191" level="4"><display>(C)</display>prohibits the bond from inclusion in the outstanding bonded indebtedness of <ln numlevel="1" lineno="316" slineno="5-192"/>the divided school district, in accordance with Section <xref depth="3" refnumber="53G-3-307">53G-3-307</xref>;</subsection><subsection ssid="1-null-84" dnum="D-o" numlevel="1" lineno="317" slineno="5-193" level="4"><display>(D)</display>provides that the divided school district may not issue the bond unless the <ln numlevel="1" lineno="318" slineno="5-194"/>majority of the qualified voters of the divided school district who vote on the <ln numlevel="1" lineno="319" slineno="5-195"/>bond proposition approve the issuance of the bond; and</subsection><subsection ssid="1-null-85" dnum="E-o" numlevel="1" lineno="320" slineno="5-196" level="4"><display>(E)</display>provides that the divided school district is responsible for the bond payments <ln numlevel="1" lineno="321" slineno="5-197"/>until the allocation date and that each new and reorganized new school district <ln numlevel="1" lineno="322" slineno="5-198"/>receiving the bond proceeds under this section is responsible for a proportional <ln numlevel="1" lineno="323" slineno="5-199"/>share of the bond payments after the allocation date.</subsection></subsection><subsection ssid="1-null-86" dnum="iii-o" numlevel="1" lineno="324" slineno="5-200" level="3"><display>(iii)</display>This Subsection <xref refnumber="53G-3-302(5)(b)" depth="4">(5)(b)</xref> applies retrospectively to a general obligation bond that a <ln numlevel="1" lineno="325" slineno="5-201"/>divided school district issued after November 4, 2024.</subsection></subsection><subsection ssid="1-null-87" dnum="c-o" numlevel="1" lineno="326" slineno="5-202" level="2" space="false"><display>(c)</display><subsection ssid="1-null-88" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If, within the preceding three years, voters within the divided school district <ln numlevel="1" lineno="327" slineno="5-203"/>rejected a general obligation bond for which a majority of voters within the area <ln numlevel="1" lineno="328" slineno="5-204"/>now included in a new or reorganized new school district voted in favor of the <ln numlevel="1" lineno="329" slineno="5-205"/>general obligation bond, the local school board of the divided district shall issue a <ln numlevel="1" lineno="330" slineno="5-206"/>lease revenue bond in accordance with Subsection <xref tempid="208" depth="4" refnumber="53G-3-302(5)(a)(i)">(5)(a)(i)</xref> for the relevant new or <ln numlevel="1" lineno="331" slineno="5-207"/>reorganized new school district.</subsection><subsection ssid="1-null-89" dnum="ii-o" numlevel="1" lineno="332" slineno="5-208" level="3"><display>(ii)</display>A lease revenue bond described in Subsection <xref depth="4" refnumber="53G-3-302(5)(c)(i)">(5)(c)(i)</xref> is not subject to the <ln numlevel="1" lineno="333" slineno="5-209"/>combined total limitation described in Subsection <xref depth="4" refnumber="11-14-103(6)(b)(i)">11-14-103(6)(b)(i)</xref> due to the <ln numlevel="1" lineno="334" slineno="5-210"/>prior approval of voters within the new or reorganized new school district for the <ln numlevel="1" lineno="335" slineno="5-211"/>general obligation bond.</subsection></subsection><subsection ssid="1-null-90" dnum="d-o" numlevel="1" lineno="336" slineno="5-212" level="2"><display>(d)</display>The local school board of each new and reorganized new school district may access <ln numlevel="1" lineno="337" slineno="5-213"/>and spend funds made available under Subsections <xref depth="4" refnumber="53G-3-301.3(9)">53G-3-301.3(9)</xref> and <xref depth="4" refnumber="53G-3-301.4(11)"><ln numlevel="1" lineno="338" slineno="5-214"/>53G-3-301.4(11)</xref> and under this Subsection <xref refnumber="53G-3-302(5)" depth="4">(5)</xref>.</subsection></subsection><subsection ssid="1-null-91" dnum="6-o" numlevel="1" lineno="339" slineno="5-215" level="1" space="false"><display>(6)</display><subsection ssid="1-null-92" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The divided school district shall transfer title or, if applicable, partial title of <ln numlevel="1" lineno="340" slineno="5-216"/>property to the new school district and the reorganized new school district in <ln numlevel="1" lineno="341" slineno="5-217"/>accordance with the allocation of property as stated in the report under Subsection <xref depth="4" refnumber="53G-3-302(3)(b)(ii)"><ln numlevel="1" lineno="342" slineno="5-218"/>(3)(b)(ii)</xref>.</subsection><subsection ssid="1-null-93" dnum="b-o" numlevel="1" lineno="343" slineno="5-219" level="2"><display>(b)</display>The divided school district shall complete each transfer of title or, if applicable, <ln numlevel="1" lineno="344" slineno="5-220"/>partial title to real property and vehicles on the allocation date, except as that date is <ln numlevel="1" lineno="345" slineno="5-221"/>changed by the mutual agreement of:<subsection ssid="1-null-94" dnum="i-o" numlevel="1" lineno="346" slineno="5-222" level="3"><display>(i)</display>the local school board of the divided school district;</subsection><subsection ssid="1-null-95" dnum="ii-o" numlevel="1" lineno="347" slineno="5-223" level="3"><display>(ii)</display>the local school board of the reorganized new school district; and</subsection><subsection ssid="1-null-96" dnum="iii-o" numlevel="1" lineno="348" slineno="5-224" level="3"><display>(iii)</display>the local school board of the new school district.</subsection></subsection><subsection ssid="1-null-97" dnum="c-o" numlevel="1" lineno="349" slineno="5-225" level="2"><display>(c)</display>The divided school district shall complete the transfer of all property not included in <ln numlevel="1" lineno="350" slineno="5-226"/>Subsection <xref depth="4" refnumber="53G-3-302(6)(b)">(6)(b)</xref> on the allocation date.</subsection><subsection ssid="1-null-98" dnum="d-o" numlevel="1" lineno="351" slineno="5-227" level="2"><display>(d)</display>Except as provided in this Subsection <xref depth="4" refnumber="53G-3-302(6)">(6)</xref>, a divided school district may not transfer <ln numlevel="1" lineno="352" slineno="5-228"/>or agree to transfer title to district property beginning on the creation date, without <ln numlevel="1" lineno="353" slineno="5-229"/>the prior consent of:<subsection ssid="1-null-99" dnum="i-o" numlevel="1" lineno="354" slineno="5-230" level="3"><display>(i)</display>before the election of local school boards for the new or reorganized new school <ln numlevel="1" lineno="355" slineno="5-231"/>district:<subsection ssid="1-null-100" dnum="A-o" numlevel="1" lineno="356" slineno="5-232" level="4"><display>(A)</display>the legislative body of the municipality in which the boundaries for the new <ln numlevel="1" lineno="357" slineno="5-233"/>school district or reorganized new school district are entirely located; or</subsection><subsection ssid="1-null-101" dnum="B-o" numlevel="1" lineno="358" slineno="5-234" level="4"><display>(B)</display>the legislative bodies of all interlocal agreement participants in which the <ln numlevel="1" lineno="359" slineno="5-235"/>boundaries of the new school district or reorganized new school district are <ln numlevel="1" lineno="360" slineno="5-236"/>located; or</subsection></subsection><subsection ssid="1-null-102" dnum="ii-o" numlevel="1" lineno="361" slineno="5-237" level="3"><display>(ii)</display>after the election of local school boards for the new or reorganized new school <ln numlevel="1" lineno="362" slineno="5-238"/>district, the local school board of the school district where the physical property is <ln numlevel="1" lineno="363" slineno="5-239"/>located.</subsection></subsection><subsection ssid="1-null-103" dnum="e-o" numlevel="1" lineno="364" slineno="5-240" level="2" space="false"><display>(e)</display><subsection ssid="1-null-104" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A divided district may:<subsection ssid="1-null-105" dnum="A-o" numlevel="1" lineno="365" slineno="5-241" level="4" tab="1"><display>(A)</display>sell property associated with a career and technical education program; and</subsection><subsection ssid="1-null-106" dnum="B-o" numlevel="1" lineno="366" slineno="5-242" level="4" tab="1"><display>(B)</display>use proceeds from a sale described in this Subsection <xref tempid="907" depth="4" refnumber="53G-3-302(6)(e)">(6)(e)</xref> to fund the <ln numlevel="1" lineno="367" slineno="5-243"/>following year's career and technical education program project.</subsection></subsection><subsection ssid="1-null-107" dnum="ii-o" numlevel="1" lineno="368" slineno="5-244" level="3"><display>(ii)</display>A divided district shall distribute any proceeds from a sale described in this <ln numlevel="1" lineno="369" slineno="5-245"/>Subsection <xref tempid="717" depth="4" refnumber="53G-3-302(6)(e)">(6)(e)</xref> two years after the inaugural election of local school board <ln numlevel="1" lineno="370" slineno="5-246"/>members for the new and reorganized new school districts based on student <ln numlevel="1" lineno="371" slineno="5-247"/>population.</subsection></subsection></subsection><subsection ssid="1-null-108" dnum="7-o" numlevel="1" lineno="372" slineno="5-248" level="1" space="false"><display>(7)</display><subsection ssid="1-null-109" dnum="a-o" level="2" placement="sameline"><display>(a)</display>On July 1 of the second year following the local school board election date <ln numlevel="1" lineno="373" slineno="5-249"/>described in Subsection <xref refnumber="53G-3-302(2)(a)" depth="4">(2)(a)</xref>, the new school district or the reorganized new school <ln numlevel="1" lineno="374" slineno="5-250"/>district that receives title to the physical asset of the divided school district main <ln numlevel="1" lineno="375" slineno="5-251"/>office that existed at the creation date shall become the successor district to the <ln numlevel="1" lineno="376" slineno="5-252"/>records of the divided school district, unless the local school boards of any relevant <ln numlevel="1" lineno="377" slineno="5-253"/>new school district and reorganized new school district agree to a chosen successor <ln numlevel="1" lineno="378" slineno="5-254"/>district.</subsection><subsection ssid="1-null-110" dnum="b-o" numlevel="1" lineno="379" slineno="5-255" level="2"><display>(b)</display>As described in Subsection <xref depth="4" refnumber="63G-2-206(1)(a)">63G-2-206(1)(a)</xref>, the successor district shall serve as a <ln numlevel="1" lineno="380" slineno="5-256"/>repository of archives for purposes of historical preservation, administrative <ln numlevel="1" lineno="381" slineno="5-257"/>maintenance, or destruction of all the divided school district's books, accounts, and <ln numlevel="1" lineno="382" slineno="5-258"/>records.</subsection><subsection ssid="1-null-111" dnum="c-o" numlevel="1" lineno="383" slineno="5-259" level="2"><display>(c)</display>For one year after the allocation date, each new school district or reorganized new <ln numlevel="1" lineno="384" slineno="5-260"/>school district within the divided school district may access the records of the divided <ln numlevel="1" lineno="385" slineno="5-261"/>school district through an interlocal agreement and without cost.</subsection></subsection><subsection ssid="1-null-112" dnum="8-o" numlevel="1" lineno="386" slineno="5-262" level="1" space="false"><display>(8)</display><subsection ssid="1-null-113" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon the creation date, a divided school district may not, except by mutual <ln numlevel="1" lineno="387" slineno="5-263"/>agreement of the local school boards of the new and reorganized new school districts:<subsection ssid="1-null-114" dnum="i-o" numlevel="1" lineno="388" slineno="5-264" level="3" tab="1"><display>(i)</display>destroy a school district record;</subsection><subsection ssid="1-null-115" dnum="ii-o" numlevel="1" lineno="389" slineno="5-265" level="3" tab="1"><display>(ii)</display>enter into any employment agreement without including a statement providing <ln numlevel="1" lineno="390" slineno="5-266"/>that the contract does not bind any new school district or reorganized new school <ln numlevel="1" lineno="391" slineno="5-267"/>district;</subsection><subsection ssid="1-null-116" dnum="iii-o" numlevel="1" lineno="392" slineno="5-268" level="3" tab="1"><display>(iii)</display>pay any severance or bonuses, issue a retirement package, or provide buy-out <ln numlevel="1" lineno="393" slineno="5-269"/>compensation to any employee unless under a written agreement or policy that <ln numlevel="1" lineno="394" slineno="5-270"/>was executed before the creation date; or</subsection><subsection ssid="1-null-117" dnum="iv-o" numlevel="1" lineno="395" slineno="5-271" level="3" tab="1"><display>(iv)</display>increase compensation for any school district employee, other than:<subsection ssid="1-null-118" dnum="A-o" numlevel="1" lineno="396" slineno="5-272" level="4"><display>(A)</display>a yearly cost-of-living adjustment; or</subsection><subsection ssid="1-null-119" dnum="B-o" numlevel="1" lineno="397" slineno="5-273" level="4"><display>(B)</display>any pay structure increases the divided district established before the creation <ln numlevel="1" lineno="398" slineno="5-274"/>date for longevity, years of experience, or additional education and <ln numlevel="1" lineno="399" slineno="5-275"/>professional development.</subsection></subsection></subsection><subsection ssid="1-null-120" dnum="b-o" numlevel="1" lineno="400" slineno="5-276" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="53G-4-402(24)">53G-4-402(24)</xref>, upon the creation of a new school <ln numlevel="1" lineno="401" slineno="5-277"/>district or a reorganized new school district, a divided school district may not close a <ln numlevel="1" lineno="402" slineno="5-278"/>school, except with the consent of the relevant local school board of the new school <ln numlevel="1" lineno="403" slineno="5-279"/>district or relevant reorganized new school district once the members of the local <ln numlevel="1" lineno="404" slineno="5-280"/>school board take the oath of office.</subsection><subsection ssid="1-null-121" dnum="c-o" numlevel="1" lineno="405" slineno="5-281" level="2"><display>(c)</display>Any agreement or policy contrary to this Subsection <xref refnumber="53G-3-302(8)" depth="4">(8)</xref> is void, including <ln numlevel="1" lineno="406" slineno="5-282"/>retrospective operation to any agreement or policy that a divided school district <ln numlevel="1" lineno="407" slineno="5-283"/>created after November 4, 2024.</subsection></subsection><subsection ssid="1-null-122" dnum="9-o" numlevel="1" lineno="408" slineno="5-284" level="1"><display>(9)</display>The newly elected local school boards of any new school district and any reorganized <ln numlevel="1" lineno="409" slineno="5-285"/>new school district, by December 15 in the year following the local school board <ln numlevel="1" lineno="410" slineno="5-286"/>election for the new and reorganized new school districts, shall establish a transition <ln numlevel="1" lineno="411" slineno="5-287"/>plan with the local school board of the divided school district.</subsection><subsection ssid="1-null-123" dnum="10-o" numlevel="1" lineno="412" slineno="5-288" level="1"><display>(10)</display>Unless otherwise specified in this section, the following bear all costs and expenses to <ln numlevel="1" lineno="413" slineno="5-289"/>create a new school district or a reorganized new school district and to comply with this <ln numlevel="1" lineno="414" slineno="5-290"/>section:<subsection ssid="1-null-124" dnum="a-o" numlevel="1" lineno="415" slineno="5-291" level="2"><display>(a)</display>for costs that a new school district incurs, the new school district;</subsection><subsection ssid="1-null-125" dnum="b-o" numlevel="1" lineno="416" slineno="5-292" level="2"><display>(b)</display>for costs that a reorganized new school district incurs, the reorganized new school <ln numlevel="1" lineno="417" slineno="5-293"/>district; and</subsection><subsection ssid="1-null-126" dnum="c-o" numlevel="1" lineno="418" slineno="5-294" level="2"><display>(c)</display>for costs that a divided school district incurs, the divided school district.</subsection></subsection><subsection ssid="1-null-127" dnum="11-o" numlevel="1" lineno="419" slineno="5-295" level="1" space="false"><display>(11)</display><subsection ssid="1-null-128" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A mutually agreed upon arbiter shall resolve any disagreements between local <ln numlevel="1" lineno="420" slineno="5-296"/>school boards of the divided school district, any new school district, and any <ln numlevel="1" lineno="421" slineno="5-297"/>reorganized new school district.</subsection><subsection ssid="1-null-129" dnum="b-o" numlevel="1" lineno="422" slineno="5-298" level="2"><display>(b)</display>If the local school boards do not agree on an arbiter, the state board shall appoint an <ln numlevel="1" lineno="423" slineno="5-299"/>arbiter.</subsection><subsection ssid="1-null-130" dnum="c-o" numlevel="1" lineno="424" slineno="5-300" level="2"><display>(c)</display>The Office of the Legislative Auditor General shall provide information the office <ln numlevel="1" lineno="425" slineno="5-301"/>receives under this part to local school boards and the arbiter described in this <ln numlevel="1" lineno="426" slineno="5-302"/>Subsection <xref tempid="244" depth="4" refnumber="53G-3-302(11)">(11)</xref> during the dispute resolution process.</subsection></subsection><subsection ssid="1-131" dnum="_-o:12-i" numlevel="1" lineno="427" slineno="5-303" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><subsection ssid="1-132" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="end">As part of the asset allocation process under this section, the local school boards <ln numlevel="1" lineno="428" slineno="5-304"/>of the new school district and reorganized new school district shall develop a high <ln numlevel="1" lineno="429" slineno="5-305"/>growth transition plan that addresses enrollment growth disparities among successor <ln numlevel="1" lineno="430" slineno="5-306"/>districts.</amend></subsection><subsection ssid="1-133" dnum="_-o:b-i" numlevel="1" lineno="431" slineno="5-307" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">The plan shall include:</amend><subsection ssid="1-134" dnum="_-o:i-i" numlevel="1" lineno="432" slineno="5-308" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="11" style="1" owner="ahaskell" level="1" amendtag="end">projected enrollment for each successor district for the first five fiscal years after <ln numlevel="1" lineno="433" slineno="5-309"/>the allocation date, including documentation supporting the projections;</amend></subsection><subsection ssid="1-135" dnum="_-o:ii-i" numlevel="1" lineno="434" slineno="5-310" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">identification of any successor districts projected to have average annual <ln numlevel="1" lineno="435" slineno="5-311"/>enrollment growth of 5% or more;</amend></subsection><subsection ssid="1-136" dnum="_-o:iii-i" numlevel="1" lineno="436" slineno="5-312" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">assessment of facility capacity in each successor district relative to projected <ln numlevel="1" lineno="437" slineno="5-313"/>enrollment;</amend></subsection><subsection ssid="1-137" dnum="_-o:iv-i" numlevel="1" lineno="438" slineno="5-314" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">identification of facility or transportation infrastructure needs in high growth <ln numlevel="1" lineno="439" slineno="5-315"/>areas; and</amend></subsection><subsection ssid="1-138" dnum="_-o:v-i" numlevel="1" lineno="440" slineno="5-316" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">potential strategies for addressing high growth needs, which may include <ln numlevel="1" lineno="441" slineno="5-317"/>voluntary loan arrangements using discretionary assets.</amend></subsection></subsection><subsection ssid="1-139" dnum="_-o:c-i" numlevel="1" lineno="442" slineno="5-318" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="ahaskell" level="1" amendtag="end">The high growth transition plan shall be:</amend><subsection ssid="1-140" dnum="_-o:i-i" numlevel="1" lineno="443" slineno="5-319" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">completed before the allocation date;</amend></subsection><subsection ssid="1-141" dnum="_-o:ii-i" numlevel="1" lineno="444" slineno="5-320" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="ahaskell" level="1" amendtag="end">provided to the State Board of Education within 30 days after the allocation date; <ln numlevel="1" lineno="445" slineno="5-321"/>and</amend></subsection><subsection ssid="1-142" dnum="_-o:iii-i" numlevel="1" lineno="446" slineno="5-322" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="43" style="1" owner="ahaskell" level="1" amendtag="end">made available to the public upon request.</amend></subsection></subsection><subsection ssid="1-143" dnum="_-o:d-i" numlevel="1" lineno="447" slineno="5-323" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="ahaskell" level="1" amendtag="end">Development of the plan does not create any obligation for successor districts to <ln numlevel="1" lineno="448" slineno="5-324"/>implement any particular strategy identified in the plan.</amend></subsection></subsection></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="449" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="449">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="450"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1"
