Section <bold>53E-10-310</bold> is amended to read:</secline><catline lineno="41"><bold>53E-10-310<parens/>. Utah first credential program.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="42" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="43" slineno="1-4" level="2"><display>(a)</display>"Eligible institution" means an institution of higher education as defined in Section <xref depth="3" refnumber="53H-1-101"><ln numlevel="1" lineno="44" slineno="1-5"/>53H-1-101</xref>.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="45" slineno="1-6" level="2"><display>(b)</display>"First credential" means a certificate awarded by the state board to an eligible student <ln numlevel="1" lineno="46" slineno="1-7"/>who meets the criteria described in Subsection <xref depth="4" refnumber="53E-10-310(7)">(7)</xref>.</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="47" slineno="1-8" level="2" space="false"><display>(c)</display><subsection ssid="3-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Industry-recognized credential" means a credential that is:<subsection ssid="3-null-6" dnum="A-o" numlevel="1" lineno="48" slineno="1-9" level="4" tab="1"><display>(A)</display>developed and offered by, or endorsed by, a nationally recognized industry <ln numlevel="1" lineno="49" slineno="1-10"/>association or organization representing a sizable portion of the industry sector;</subsection><subsection ssid="3-null-7" dnum="B-o" numlevel="1" lineno="50" slineno="1-11" level="4" tab="1"><display>(B)</display>sought or accepted by employers within the industry or sector as a recognized, <ln numlevel="1" lineno="51" slineno="1-12"/>preferred, or required credential for recruitment, screening, hiring, retention, or <ln numlevel="1" lineno="52" slineno="1-13"/>advancement purposes; and</subsection><subsection ssid="3-null-8" dnum="C-o" numlevel="1" lineno="53" slineno="1-14" level="4" tab="1"><display>(C)</display>regularly reviewed, updated, and validated by the issuing body to ensure <ln numlevel="1" lineno="54" slineno="1-15"/>ongoing alignment with industry standards and labor market needs.</subsection></subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="55" slineno="1-16" level="3"><display>(ii)</display>"Industry-recognized credential" may also include a credential offered through a <ln numlevel="1" lineno="56" slineno="1-17"/>catalyst center as described in Section <xref depth="3" refnumber="53E-3-507.1">53E-3-507.1</xref>.</subsection></subsection><subsection ssid="3-null-10" dnum="d-o" numlevel="1" lineno="57" slineno="1-18" level="2"><display>(d)</display>"Master credential list" means the list of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">approved industry-recognized </amend><amendoutend style="2"/>credentials<amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> <ln numlevel="1" lineno="58" slineno="1-19"/>that meets the first credential certificate requirements described in Subsection <xref depth="4" refnumber="53E-10-310(7)">(7)</xref> and <ln numlevel="1" lineno="59" slineno="1-20"/>is</amend> maintained by the state board in accordance with this section.</subsection><subsection ssid="3-null-11" dnum="e-o" numlevel="1" lineno="60" slineno="1-21" level="2"><display>(e)</display>"Program" means the first credential program described in this section.</subsection><subsection ssid="3-null-12" dnum="f-o" numlevel="1" lineno="61" slineno="1-22" level="2"><display>(f)</display>"Technical college" means the same as that term is defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>.</subsection></subsection><subsection ssid="3-null-13" dnum="2-o" numlevel="1" lineno="62" slineno="1-23" level="1"><display>(2)</display>The commissioner of higher education, the state superintendent of public instruction, <ln numlevel="1" lineno="63" slineno="1-24"/>and the governor's education advisor shall establish the First Credential Oversight <ln numlevel="1" lineno="64" slineno="1-25"/>Committee comprised of:<subsection ssid="3-null-14" dnum="a-o" numlevel="1" lineno="65" slineno="1-26" level="2"><display>(a)</display>representatives from industries, including:<subsection ssid="3-null-15" dnum="i-o" numlevel="1" lineno="66" slineno="1-27" level="3"><display>(i)</display>members of professional associations or trade groups; and</subsection><subsection ssid="3-null-16" dnum="ii-o" numlevel="1" lineno="67" slineno="1-28" level="3"><display>(ii)</display>employers from high-demand sectors as the state board determines in <ln numlevel="1" lineno="68" slineno="1-29"/>collaboration with the Utah Board of Higher Education and the Department of <ln numlevel="1" lineno="69" slineno="1-30"/>Workforce Services;</subsection></subsection><subsection ssid="3-null-17" dnum="b-o" numlevel="1" lineno="70" slineno="1-31" level="2"><display>(b)</display>representatives from education including:<subsection ssid="3-null-18" dnum="i-o" numlevel="1" lineno="71" slineno="1-32" level="3"><display>(i)</display>members from the state board;</subsection><subsection ssid="3-null-19" dnum="ii-o" numlevel="1" lineno="72" slineno="1-33" level="3"><display>(ii)</display>the director of the Catalyst Center Grant Program described in Section <xref depth="3" refnumber="53E-3-507.1"><ln numlevel="1" lineno="73" slineno="1-34"/>53E-3-507.1</xref>;</subsection><subsection ssid="3-null-20" dnum="iii-o" numlevel="1" lineno="74" slineno="1-35" level="3"><display>(iii)</display>LEA administrators, such as a superintendent or charter school director;</subsection><subsection ssid="3-null-21" dnum="iv-o" numlevel="1" lineno="75" slineno="1-36" level="3"><display>(iv)</display>professionals from institutions of higher education, including technical colleges;</subsection><subsection ssid="3-null-22" dnum="v-o" numlevel="1" lineno="76" slineno="1-37" level="3"><display>(v)</display>career and technical education specialists; and</subsection><subsection ssid="3-null-23" dnum="vi-o" numlevel="1" lineno="77" slineno="1-38" level="3"><display>(vi)</display>Talent Ready Utah; and</subsection></subsection><subsection ssid="3-null-24" dnum="c-o" numlevel="1" lineno="78" slineno="1-39" level="2"><display>(c)</display>workforce development experts, including representatives from the Department of <ln numlevel="1" lineno="79" slineno="1-40"/>Workforce Services.</subsection></subsection><subsection ssid="3-null-25" dnum="3-o" numlevel="1" lineno="80" slineno="1-41" level="1"><display>(3)</display>The state board shall staff the First Credential Oversight Committee.</subsection><subsection ssid="3-null-26" dnum="4-o" numlevel="1" lineno="81" slineno="1-42" level="1"><display>(4)</display>The First Credential Oversight Committee shall develop a first credential master plan, <ln numlevel="1" lineno="82" slineno="1-43"/>which shall include:<subsection ssid="3-null-27" dnum="a-o" numlevel="1" lineno="83" slineno="1-44" level="2"><display>(a)</display>a framework for developing and maintaining the master credential list;</subsection><subsection ssid="3-null-28" dnum="b-o" numlevel="1" lineno="84" slineno="1-45" level="2"><display>(b)</display>a comprehensive needs assessment framework that evaluates:<subsection ssid="3-null-29" dnum="i-o" numlevel="1" lineno="85" slineno="1-46" level="3"><display>(i)</display>resources available through institutions of higher education, including:<subsection ssid="3-null-30" dnum="A-o" numlevel="1" lineno="86" slineno="1-47" level="4"><display>(A)</display>faculty expertise and availability;</subsection><subsection ssid="3-null-31" dnum="B-o" numlevel="1" lineno="87" slineno="1-48" level="4"><display>(B)</display>facilities and equipment;</subsection><subsection ssid="3-null-32" dnum="C-o" numlevel="1" lineno="88" slineno="1-49" level="4"><display>(C)</display>existing certification programs; and</subsection><subsection ssid="3-null-33" dnum="D-o" numlevel="1" lineno="89" slineno="1-50" level="4"><display>(D)</display>potential for program expansion;</subsection></subsection><subsection ssid="3-null-34" dnum="ii-o" numlevel="1" lineno="90" slineno="1-51" level="3"><display>(ii)</display> industry partnership opportunities, including:<subsection ssid="3-null-35" dnum="A-o" numlevel="1" lineno="91" slineno="1-52" level="4"><display>(A)</display>geographical proximity to potential partners;</subsection><subsection ssid="3-null-36" dnum="B-o" numlevel="1" lineno="92" slineno="1-53" level="4"><display>(B)</display>willingness of local industries to participate;</subsection><subsection ssid="3-null-37" dnum="C-o" numlevel="1" lineno="93" slineno="1-54" level="4"><display>(C)</display>capacity for work-based learning placements; and</subsection><subsection ssid="3-null-38" dnum="D-o" numlevel="1" lineno="94" slineno="1-55" level="4"><display>(D)</display>alignment between industry needs and educational capabilities; and</subsection></subsection><subsection ssid="3-null-39" dnum="iii-o" numlevel="1" lineno="95" slineno="1-56" level="3"><display>(iii)</display>general resource availability, including:<subsection ssid="3-null-40" dnum="A-o" numlevel="1" lineno="96" slineno="1-57" level="4"><display>(A)</display>current funding streams and potential funding sources;</subsection><subsection ssid="3-null-41" dnum="B-o" numlevel="1" lineno="97" slineno="1-58" level="4"><display>(B)</display>existing technology infrastructure;</subsection><subsection ssid="3-null-42" dnum="C-o" numlevel="1" lineno="98" slineno="1-59" level="4"><display>(C)</display>qualified personnel and staffing needs; and</subsection><subsection ssid="3-null-43" dnum="D-o" numlevel="1" lineno="99" slineno="1-60" level="4"><display>(D)</display>professional development requirements;</subsection></subsection></subsection><subsection ssid="3-null-44" dnum="c-o" numlevel="1" lineno="100" slineno="1-61" level="2"><display>(c)</display>credential approval processes;</subsection><subsection ssid="3-null-45" dnum="d-o" numlevel="1" lineno="101" slineno="1-62" level="2"><display>(d)</display>methods for ensuring industry demand alignment;</subsection><subsection ssid="3-null-46" dnum="e-o" numlevel="1" lineno="102" slineno="1-63" level="2"><display>(e)</display>wage considerations for occupations associated with approved credentials;</subsection><subsection ssid="3-null-47" dnum="f-o" numlevel="1" lineno="103" slineno="1-64" level="2"><display>(f)</display>clear definitions of industry-recognized credentials;</subsection><subsection ssid="3-null-48" dnum="g-o" numlevel="1" lineno="104" slineno="1-65" level="2"><display>(g)</display>strategies for promoting stackability and sequencing of credentials;</subsection><subsection ssid="3-null-49" dnum="h-o" numlevel="1" lineno="105" slineno="1-66" level="2"><display>(h)</display>approaches to ensure regional relevance of credentials;</subsection><subsection ssid="3-null-50" dnum="i-o" numlevel="1" lineno="106" slineno="1-67" level="2"><display>(i)</display>mechanisms for collaboration between educational institutions, industry partners, and <ln numlevel="1" lineno="107" slineno="1-68"/>workforce development agencies;</subsection><subsection ssid="3-null-51" dnum="j-o" numlevel="1" lineno="108" slineno="1-69" level="2"><display>(j)</display>strategies for continuous evaluation and improvement of the program;</subsection><subsection ssid="3-null-52" dnum="k-o" numlevel="1" lineno="109" slineno="1-70" level="2"><display>(k)</display>the creation of a credentials review committee, including membership and duties;</subsection><subsection ssid="3-null-53" dnum="l-o" numlevel="1" lineno="110" slineno="1-71" level="2"><display>(l)</display>in accordance with Subsection <xref depth="4" refnumber="53E-10-310(17)">(17)</xref>, an established framework of planning, <ln numlevel="1" lineno="111" slineno="1-72"/>implementation, and student outcome performance funding for an LEA administering <ln numlevel="1" lineno="112" slineno="1-73"/>first credential programming;</subsection><subsection ssid="3-null-54" dnum="m-o" numlevel="1" lineno="113" slineno="1-74" level="2"><display>(m)</display>a weighted system for the master credential list that:<subsection ssid="3-null-55" dnum="i-o" numlevel="1" lineno="114" slineno="1-75" level="3"><display>(i)</display>assigns higher values to credentials based on:<subsection ssid="3-null-56" dnum="A-o" numlevel="1" lineno="115" slineno="1-76" level="4"><display>(A)</display>alignment with high-demand, high-wage occupations;</subsection><subsection ssid="3-null-57" dnum="B-o" numlevel="1" lineno="116" slineno="1-77" level="4"><display>(B)</display>incorporation of multiple learning pathways, including coursework, <ln numlevel="1" lineno="117" slineno="1-78"/>apprenticeships, internships, work-based learning, and related service <ln numlevel="1" lineno="118" slineno="1-79"/>opportunities;</subsection><subsection ssid="3-null-58" dnum="C-o" numlevel="1" lineno="119" slineno="1-80" level="4"><display>(C)</display>industry recognition and portability; and</subsection><subsection ssid="3-null-59" dnum="D-o" numlevel="1" lineno="120" slineno="1-81" level="4"><display>(D)</display>stackability with other credentials or degrees; and</subsection></subsection><subsection ssid="3-null-60" dnum="ii-o" numlevel="1" lineno="121" slineno="1-82" level="3"><display>(ii)</display>uses the weighted values to:<subsection ssid="3-null-61" dnum="A-o" numlevel="1" lineno="122" slineno="1-83" level="4"><display>(A)</display>determine incentive funding levels;</subsection><subsection ssid="3-null-62" dnum="B-o" numlevel="1" lineno="123" slineno="1-84" level="4"><display>(B)</display>prioritize program expansion support; and</subsection><subsection ssid="3-null-63" dnum="C-o" numlevel="1" lineno="124" slineno="1-85" level="4"><display>(C)</display>guide student career planning; and</subsection></subsection></subsection><subsection ssid="3-null-64" dnum="n-o" numlevel="1" lineno="125" slineno="1-86" level="2"><display>(n)</display>guidelines for LEAs to procure industry-recognized certification program licenses, <ln numlevel="1" lineno="126" slineno="1-87"/>including:<subsection ssid="3-null-65" dnum="i-o" numlevel="1" lineno="127" slineno="1-88" level="3"><display>(i)</display>verification that certifications appear on the master credential list;</subsection><subsection ssid="3-null-66" dnum="ii-o" numlevel="1" lineno="128" slineno="1-89" level="3"><display>(ii)</display>requirement for competency-based assessments in proctored environments;</subsection><subsection ssid="3-null-67" dnum="iii-o" numlevel="1" lineno="129" slineno="1-90" level="3"><display>(iii)</display>documentation of local industry endorsement; and</subsection><subsection ssid="3-null-68" dnum="iv-o" numlevel="1" lineno="130" slineno="1-91" level="3"><display>(iv)</display>alignment with state and federal computer science initiatives where applicable, <ln numlevel="1" lineno="131" slineno="1-92"/>including the Computer Science for Utah Grant Program described in Section <xref depth="3" refnumber="53H-13-306"><ln numlevel="1" lineno="132" slineno="1-93"/>53H-13-306</xref>.</subsection></subsection></subsection><subsection ssid="3-null-69" dnum="5-o" numlevel="1" lineno="133" slineno="1-94" level="1"><display>(5)</display>In accordance with the Utah First Credential Master Plan, the state board shall:<subsection ssid="3-null-70" dnum="a-o" numlevel="1" lineno="134" slineno="1-95" level="2"><display>(a)</display>ensure that the credentials review committee membership reflects a balance of <ln numlevel="1" lineno="135" slineno="1-96"/>perspectives and expertise;</subsection><subsection ssid="3-null-71" dnum="b-o" numlevel="1" lineno="136" slineno="1-97" level="2"><display>(b)</display>develop an online application and submission system for credentialing organizations <ln numlevel="1" lineno="137" slineno="1-98"/>and providers to submit programs for inclusion in the master credential list;</subsection><subsection ssid="3-null-72" dnum="c-o" numlevel="1" lineno="138" slineno="1-99" level="2"><display>(c)</display>establish and maintain the master credential list based on the recommendations of the <ln numlevel="1" lineno="139" slineno="1-100"/>credentials review committee;</subsection><subsection ssid="3-null-73" dnum="d-o" numlevel="1" lineno="140" slineno="1-101" level="2"><display>(d)</display>develop clear mechanisms for students to understand how earning one credential can <ln numlevel="1" lineno="141" slineno="1-102"/>lead to higher-level certifications or degrees; and</subsection><subsection ssid="3-null-74" dnum="e-o" numlevel="1" lineno="142" slineno="1-103" level="2"><display>(e)</display>foster partnerships between high schools, technical colleges, employers, and <ln numlevel="1" lineno="143" slineno="1-104"/>apprenticeship programs to ensure students have access to meaningful work-based <ln numlevel="1" lineno="144" slineno="1-105"/>learning opportunities.</subsection></subsection><subsection ssid="3-null-75" dnum="6-o" numlevel="1" lineno="145" slineno="1-106" level="1"><display>(6)</display>The state board shall:<subsection ssid="3-null-76" dnum="a-o" numlevel="1" lineno="146" slineno="1-107" level="2"><display>(a)</display>automatically include on the initial master credential list any existing credential that:<subsection ssid="3-null-77" dnum="i-o" numlevel="1" lineno="147" slineno="1-108" level="3"><display>(i)</display>meets the definition of industry-recognized credential under this section; and</subsection><subsection ssid="3-null-78" dnum="ii-o" numlevel="1" lineno="148" slineno="1-109" level="3"><display>(ii)</display>is currently recognized by the state board or Utah Board of Higher Education as <ln numlevel="1" lineno="149" slineno="1-110"/>of July 1, 2024; and</subsection></subsection><subsection ssid="3-null-79" dnum="b-o" numlevel="1" lineno="150" slineno="1-111" level="2"><display>(b)</display>review all automatically included credentials within one year to ensure ongoing <ln numlevel="1" lineno="151" slineno="1-112"/>compliance with program requirements.</subsection></subsection><subsection ssid="3-null-80" dnum="7-o" numlevel="1" lineno="152" slineno="1-113" level="1"><display>(7)</display>The state board shall award a first credential certificate to an eligible student who <ln numlevel="1" lineno="153" slineno="1-114"/>completes one of the following:<subsection ssid="3-null-81" dnum="a-o" numlevel="1" lineno="154" slineno="1-115" level="2"><display>(a)</display>concurrent enrollment courses, composed of:<subsection ssid="3-null-82" dnum="i-o" numlevel="1" lineno="155" slineno="1-116" level="3"><display>(i)</display>between 12 and 18 core general education credits, or as industry standards dictate, <ln numlevel="1" lineno="156" slineno="1-117"/>with courses from different general education categories; or</subsection><subsection ssid="3-null-83" dnum="ii-o" numlevel="1" lineno="157" slineno="1-118" level="3"><display>(ii)</display>a prescribed set of courses as the Utah Board of Higher Education designates;</subsection></subsection><subsection ssid="3-null-84" dnum="b-o" numlevel="1" lineno="158" slineno="1-119" level="2"><display>(b)</display>an industry-recognized credential included on the master credential list;</subsection><subsection ssid="3-null-85" dnum="c-o" numlevel="1" lineno="159" slineno="1-120" level="2"><display>(c)</display>300 hours of completion through a youth apprenticeship program that:<subsection ssid="3-null-86" dnum="i-o" numlevel="1" lineno="160" slineno="1-121" level="3"><display>(i)</display>is described in Sections <xref depth="3" refnumber="35A-6-102">35A-6-102</xref> and <xref depth="3" refnumber="35A-6-104.5">35A-6-104.5</xref>; and</subsection><subsection ssid="3-null-87" dnum="ii-o" numlevel="1" lineno="161" slineno="1-122" level="3"><display>(ii)</display>includes courses that fulfill the requirements for an industry-recognized credential <ln numlevel="1" lineno="162" slineno="1-123"/>included on the master credential list;</subsection></subsection><subsection ssid="3-null-88" dnum="d-o" numlevel="1" lineno="163" slineno="1-124" level="2"><display>(d)</display>completion of a technical college certificate; or</subsection><subsection ssid="3-null-89" dnum="e-o" numlevel="1" lineno="164" slineno="1-125" level="2"><display>(e)</display>completion of a Career and Technical Education Pathway program.</subsection></subsection><subsection ssid="3-null-90" dnum="8-o" numlevel="1" lineno="165" slineno="1-126" level="1"><display>(8)</display>The Utah Board of Higher Education shall ensure that credits earned for a first <ln numlevel="1" lineno="166" slineno="1-127"/>credential certificate are:<subsection ssid="3-null-91" dnum="a-o" numlevel="1" lineno="167" slineno="1-128" level="2"><display>(a)</display>accepted and transferable to institutions of higher education, including technical <ln numlevel="1" lineno="168" slineno="1-129"/>colleges;</subsection><subsection ssid="3-null-92" dnum="b-o" numlevel="1" lineno="169" slineno="1-130" level="2"><display>(b)</display>applicable towards relevant degree programs; and</subsection><subsection ssid="3-null-93" dnum="c-o" numlevel="1" lineno="170" slineno="1-131" level="2"><display>(c)</display>recognized by relevant industries as adequate preparation for employment.</subsection></subsection><subsection ssid="3-null-94" dnum="9-o" numlevel="1" lineno="171" slineno="1-132" level="1"><display>(9)</display>Subject to legislative appropriations, the Utah Board of Higher Education shall award a <ln numlevel="1" lineno="172" slineno="1-133"/>first credential scholarship to each student who earns a first credential certificate.</subsection><subsection ssid="3-null-95" dnum="10-o" numlevel="1" lineno="173" slineno="1-134" level="1"><display>(10)</display>The first credential scholarship may be used at the following institutions:<subsection ssid="3-null-96" dnum="a-o" numlevel="1" lineno="174" slineno="1-135" level="2"><display>(a)</display>an institution of higher education as defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>; or</subsection><subsection ssid="3-null-97" dnum="b-o" numlevel="1" lineno="175" slineno="1-136" level="2"><display>(b)</display>a private, nonprofit college or university in the state that is accredited by the <ln numlevel="1" lineno="176" slineno="1-137"/>Northwest Commission on Colleges and Universities.</subsection></subsection><subsection ssid="3-null-98" dnum="11-o" numlevel="1" lineno="177" slineno="1-138" level="1"><display>(11)</display>The Utah Board of Higher Education shall annually determine the first credential <ln numlevel="1" lineno="178" slineno="1-139"/>scholarship amount based on:<subsection ssid="3-null-99" dnum="a-o" numlevel="1" lineno="179" slineno="1-140" level="2"><display>(a)</display>the number of eligible students; and</subsection><subsection ssid="3-null-100" dnum="b-o" numlevel="1" lineno="180" slineno="1-141" level="2"><display>(b)</display>appropriations made by the Legislature.</subsection></subsection><subsection ssid="3-null-101" dnum="12-o" numlevel="1" lineno="181" slineno="1-142" level="1"><display>(12)</display>A student may use the first credential scholarship for:<subsection ssid="3-null-102" dnum="a-o" numlevel="1" lineno="182" slineno="1-143" level="2"><display>(a)</display>tuition and fees;</subsection><subsection ssid="3-null-103" dnum="b-o" numlevel="1" lineno="183" slineno="1-144" level="2"><display>(b)</display>books and supplies; or</subsection><subsection ssid="3-null-104" dnum="c-o" numlevel="1" lineno="184" slineno="1-145" level="2"><display>(c)</display>other educational expenses as  the Utah Board of Higher Education determines.</subsection></subsection><subsection ssid="3-null-105" dnum="13-o" numlevel="1" lineno="185" slineno="1-146" level="1"><display>(13)</display>The Utah Board of Higher Education shall ensure the scholarship is valid for use <ln numlevel="1" lineno="186" slineno="1-147"/>within three years from the date the student graduates from high school.</subsection><subsection ssid="3-null-106" dnum="14-o" numlevel="1" lineno="187" slineno="1-148" level="1"><display>(14)</display>A student may earn the first credential scholarship in addition to any other <ln numlevel="1" lineno="188" slineno="1-149"/>state-sponsored scholarships for which the student may be eligible.</subsection><subsection ssid="3-null-107" dnum="15-o" numlevel="1" lineno="189" slineno="1-150" level="1"><display>(15)</display>The first credential oversight committee shall present the master plan described in <ln numlevel="1" lineno="190" slineno="1-151"/>Subsection <xref depth="4" refnumber="53E-10-310(4)">(4)</xref> to the Education Interim Committee by the November 2025 interim <ln numlevel="1" lineno="191" slineno="1-152"/>committee meeting.</subsection><subsection ssid="3-null-108" dnum="16-o" numlevel="1" lineno="192" slineno="1-153" level="1"><display>(16)</display>Every three years, the First Credential Oversight Committee shall:<subsection ssid="3-null-109" dnum="a-o" numlevel="1" lineno="193" slineno="1-154" level="2"><display>(a)</display>review the Utah First Credential Master Plan;</subsection><subsection ssid="3-null-110" dnum="b-o" numlevel="1" lineno="194" slineno="1-155" level="2"><display>(b)</display>as needed, create a list of recommendations and update the Utah First Credential <ln numlevel="1" lineno="195" slineno="1-156"/>Master Plan;</subsection><subsection ssid="3-null-111" dnum="c-o" numlevel="1" lineno="196" slineno="1-157" level="2"><display>(c)</display>report the list of recommendations and the updated Utah First Credential Master Plan <ln numlevel="1" lineno="197" slineno="1-158"/>to:<subsection ssid="3-null-112" dnum="i-o" numlevel="1" lineno="198" slineno="1-159" level="3"><display>(i)</display>the state board;</subsection><subsection ssid="3-null-113" dnum="ii-o" numlevel="1" lineno="199" slineno="1-160" level="3"><display>(ii)</display>the Utah Board of Higher Education;</subsection><subsection ssid="3-null-114" dnum="iii-o" numlevel="1" lineno="200" slineno="1-161" level="3"><display>(iii)</display>the Department of Workforce Services;</subsection><subsection ssid="3-null-115" dnum="iv-o" numlevel="1" lineno="201" slineno="1-162" level="3"><display>(iv)</display>the Education Interim Committee; and</subsection><subsection ssid="3-null-116" dnum="v-o" numlevel="1" lineno="202" slineno="1-163" level="3"><display>(v)</display>the Economic Development and Workforce Services Interim Committee.</subsection></subsection></subsection><subsection ssid="3-null-117" dnum="17-o" numlevel="1" lineno="203" slineno="1-164" level="1" space="false"><display>(17)</display><subsection ssid="3-null-118" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall administer a first credential grant program for an LEA and <ln numlevel="1" lineno="204" slineno="1-165"/>award a grant in accordance with the following process.</subsection><subsection ssid="3-null-119" dnum="b-o" numlevel="1" lineno="205" slineno="1-166" level="2"><display>(b)</display>The First Credential Oversight Committee shall establish:<subsection ssid="3-null-120" dnum="i-o" numlevel="1" lineno="206" slineno="1-167" level="3"><display>(i)</display>a needs assessment tool that evaluates:<subsection ssid="3-null-121" dnum="A-o" numlevel="1" lineno="207" slineno="1-168" level="4"><display>(A)</display>an LEA's current first credential offering;</subsection><subsection ssid="3-null-122" dnum="B-o" numlevel="1" lineno="208" slineno="1-169" level="4"><display>(B)</display>an LEA's capacity to develop or expand a first credential pathway;</subsection><subsection ssid="3-null-123" dnum="C-o" numlevel="1" lineno="209" slineno="1-170" level="4"><display>(C)</display>resources and support needed for a first credential program, including <ln numlevel="1" lineno="210" slineno="1-171"/>resources available through institutions of higher education, industry <ln numlevel="1" lineno="211" slineno="1-172"/>partnership opportunities, and general resource availability; and</subsection><subsection ssid="3-null-124" dnum="D-o" numlevel="1" lineno="212" slineno="1-173" level="4"><display>(D)</display>each potential barrier to implementation; and</subsection></subsection><subsection ssid="3-null-125" dnum="ii-o" numlevel="1" lineno="213" slineno="1-174" level="3"><display>(ii)</display>a continuum of need to place each applying LEA.</subsection></subsection><subsection ssid="3-null-126" dnum="c-o" numlevel="1" lineno="214" slineno="1-175" level="2"><display>(c)</display>An LEA seeking a first credential grant shall submit to the First Credential Oversight <ln numlevel="1" lineno="215" slineno="1-176"/>Committee:<subsection ssid="3-null-127" dnum="i-o" numlevel="1" lineno="216" slineno="1-177" level="3"><display>(i)</display>a completed needs assessment; and</subsection><subsection ssid="3-null-128" dnum="ii-o" numlevel="1" lineno="217" slineno="1-178" level="3"><display>(ii)</display>a grant application that contains:<subsection ssid="3-null-129" dnum="A-o" numlevel="1" lineno="218" slineno="1-179" level="4"><display>(A)</display>current first credential data, including current credentials offered;</subsection><subsection ssid="3-null-130" dnum="B-o" numlevel="1" lineno="219" slineno="1-180" level="4"><display>(B)</display>preliminary goals for creating or expanding first credential opportunities <ln numlevel="1" lineno="220" slineno="1-181"/>within the LEA; and</subsection><subsection ssid="3-null-131" dnum="C-o" numlevel="1" lineno="221" slineno="1-182" level="4"><display>(C)</display>if applicable, plans for procurement of industry certification program licenses, <ln numlevel="1" lineno="222" slineno="1-183"/>including certification details and alignment with master credential list, <ln numlevel="1" lineno="223" slineno="1-184"/>documentation of employer endorsements, assessment and proctoring <ln numlevel="1" lineno="224" slineno="1-185"/>procedures, and integration with existing computer science programs.</subsection></subsection></subsection><subsection ssid="3-null-132" dnum="d-o" numlevel="1" lineno="225" slineno="1-186" level="2"><display>(d)</display>The First Credential Oversight Committee shall:<subsection ssid="3-null-133" dnum="i-o" numlevel="1" lineno="226" slineno="1-187" level="3"><display>(i)</display>review each submitted application and needs assessment;</subsection><subsection ssid="3-null-134" dnum="ii-o" numlevel="1" lineno="227" slineno="1-188" level="3"><display>(ii)</display>assign the LEA a placement on the continuum of need; and</subsection><subsection ssid="3-null-135" dnum="iii-o" numlevel="1" lineno="228" slineno="1-189" level="3"><display>(iii)</display>provide to the LEA a specific requirement for an implementation plan based on:<subsection ssid="3-null-136" dnum="A-o" numlevel="1" lineno="229" slineno="1-190" level="4"><display>(A)</display>the LEA's continuum placement;</subsection><subsection ssid="3-null-137" dnum="B-o" numlevel="1" lineno="230" slineno="1-191" level="4"><display>(B)</display>each identified area for growth;</subsection><subsection ssid="3-null-138" dnum="C-o" numlevel="1" lineno="231" slineno="1-192" level="4"><display>(C)</display>each available resource; and</subsection><subsection ssid="3-null-139" dnum="D-o" numlevel="1" lineno="232" slineno="1-193" level="4"><display>(D)</display>each additional factor the First Credential Oversight Committee determines <ln numlevel="1" lineno="233" slineno="1-194"/>relevant.</subsection></subsection></subsection><subsection ssid="3-null-140" dnum="e-o" numlevel="1" lineno="234" slineno="1-195" level="2"><display>(e)</display>An LEA shall submit to the First Credential Oversight Committee an implementation <ln numlevel="1" lineno="235" slineno="1-196"/>plan that includes:<subsection ssid="3-null-141" dnum="i-o" numlevel="1" lineno="236" slineno="1-197" level="3"><display>(i)</display>specific goals for expanding a first credential opportunity;</subsection><subsection ssid="3-null-142" dnum="ii-o" numlevel="1" lineno="237" slineno="1-198" level="3"><display>(ii)</display>each implementation step and timeline;</subsection><subsection ssid="3-null-143" dnum="iii-o" numlevel="1" lineno="238" slineno="1-199" level="3"><display>(iii)</display>a detailed cost projection; and</subsection><subsection ssid="3-null-144" dnum="iv-o" numlevel="1" lineno="239" slineno="1-200" level="3"><display>(iv)</display>each additional element the committee requires based on the needs assessment <ln numlevel="1" lineno="240" slineno="1-201"/>results.</subsection></subsection><subsection ssid="3-null-145" dnum="f-o" numlevel="1" lineno="241" slineno="1-202" level="2"><display>(f)</display>The First Credential Oversight Committee shall:<subsection ssid="3-null-146" dnum="i-o" numlevel="1" lineno="242" slineno="1-203" level="3"><display>(i)</display>review the implementation plan;</subsection><subsection ssid="3-null-147" dnum="ii-o" numlevel="1" lineno="243" slineno="1-204" level="3"><display>(ii)</display>direct technical assistance to the LEA in accordance with the LEA's <ln numlevel="1" lineno="244" slineno="1-205"/>implementation plan;</subsection><subsection ssid="3-null-148" dnum="iii-o" numlevel="1" lineno="245" slineno="1-206" level="3"><display>(iii)</display>provide feedback to the LEA to improve the implementation plan;</subsection><subsection ssid="3-null-149" dnum="iv-o" numlevel="1" lineno="246" slineno="1-207" level="3"><display>(iv)</display>approve each implementation plan that meets the established criteria; and</subsection><subsection ssid="3-null-150" dnum="v-o" numlevel="1" lineno="247" slineno="1-208" level="3"><display>(v)</display>award an implementation grant for each approved plan.</subsection></subsection><subsection ssid="3-null-151" dnum="g-o" numlevel="1" lineno="248" slineno="1-209" level="2"><display>(g)</display>Subject to legislative appropriations, the state board shall:<subsection ssid="3-null-152" dnum="i-o" numlevel="1" lineno="249" slineno="1-210" level="3"><display>(i)</display>award an incentive grant to an LEA that:<subsection ssid="3-null-153" dnum="A-o" numlevel="1" lineno="250" slineno="1-211" level="4"><display>(A)</display>has implemented an approved plan;</subsection><subsection ssid="3-null-154" dnum="B-o" numlevel="1" lineno="251" slineno="1-212" level="4"><display>(B)</display>increases the number of students who earn a first credential certificate; and</subsection><subsection ssid="3-null-155" dnum="C-o" numlevel="1" lineno="252" slineno="1-213" level="4"><display>(C)</display>achieves each established implementation goal; and</subsection></subsection><subsection ssid="3-null-156" dnum="ii-o" numlevel="1" lineno="253" slineno="1-214" level="3"><display>(ii)</display>in accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="254" slineno="1-215"/>and in collaboration with the First Credential Oversight Committee, establish by <ln numlevel="1" lineno="255" slineno="1-216"/>rule:<subsection ssid="3-null-157" dnum="A-o" numlevel="1" lineno="256" slineno="1-217" level="4"><display>(A)</display>tiers for incentive grant awards;</subsection><subsection ssid="3-null-158" dnum="B-o" numlevel="1" lineno="257" slineno="1-218" level="4"><display>(B)</display>performance metrics for continued funding;</subsection><subsection ssid="3-null-159" dnum="C-o" numlevel="1" lineno="258" slineno="1-219" level="4"><display>(C)</display>reporting requirements for a grant recipient;</subsection><subsection ssid="3-null-160" dnum="D-o" numlevel="1" lineno="259" slineno="1-220" level="4"><display>(D)</display>requirements for reporting certification program outcomes and industry <ln numlevel="1" lineno="260" slineno="1-221"/>alignment;</subsection><subsection ssid="3-null-161" dnum="E-o" numlevel="1" lineno="261" slineno="1-222" level="4"><display>(E)</display>procedures for coordinating with computer science initiative grants; and</subsection><subsection ssid="3-null-162" dnum="F-o" numlevel="1" lineno="262" slineno="1-223" level="4"><display>(F)</display>guidelines for certification program procurement and implementation.</subsection></subsection></subsection></subsection><subsection ssid="3-null-163" dnum="18-o" numlevel="1" lineno="263" slineno="1-224" level="1"><display>(18)</display>In accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking Act, and in <ln numlevel="1" lineno="264" slineno="1-225"/>collaboration with the Utah Board of Higher Education and the Department of <ln numlevel="1" lineno="265" slineno="1-226"/>Workforce Services, the state board shall make rules to implement the provisions of this <ln numlevel="1" lineno="266" slineno="1-227"/>section.</subsection></section></bsec><bsec buid="15" num="53H-1-403" type="amend" src="code" uid="C53H-1-S403_2026050620260506" sort="53H01 04030020260506" numlevel="1" lineno="267" slineno="2-1" sn="2"><section number="53H-1-403" numlevel="1" lineno="268" slineno="2-2" type="amend"><secline lineno="267">Section 2. Other required reports to the Legislature or state level entities.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="269" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The following entities shall submit reports to the Education Interim Committee as <ln numlevel="1" lineno="270" slineno="2-4"/>described in each referenced section:<subsection ssid="15-null-2" dnum="a-o" numlevel="1" lineno="271" slineno="2-5" level="2"><display>(a)</display>the board shall submit:<subsection ssid="15-null-3" dnum="i-o" numlevel="1" lineno="272" slineno="2-6" level="3"><display>(i)</display>an annual report regarding the board's activities and performance against the <ln numlevel="1" lineno="273" slineno="2-7"/>board's goals and metrics as described in Section <xref depth="3" refnumber="53H-1-203">53H-1-203</xref>;</subsection><subsection ssid="15-null-4" dnum="ii-o" numlevel="1" lineno="274" slineno="2-8" level="3"><display>(ii)</display>an annual report detailing the board's progress and recommendations on <ln numlevel="1" lineno="275" slineno="2-9"/>workforce related issues as described in Section <xref depth="3" refnumber="53H-1-203">53H-1-203</xref>;</subsection><subsection ssid="15-null-5" dnum="iii-o" numlevel="1" lineno="276" slineno="2-10" level="3"><display>(iii)</display>a report regarding an institution compensating a student athlete for the use of the <ln numlevel="1" lineno="277" slineno="2-11"/>student athlete's name, image, or likeness as described in Section <xref depth="3" refnumber="53H-6-202">53H-6-202</xref>;</subsection><subsection ssid="15-null-6" dnum="iv-o" numlevel="1" lineno="278" slineno="2-12" level="3"><display>(iv)</display>an annual report regarding the talent advisory councils as described in Section <xref depth="3" refnumber="53H-13-309"><ln numlevel="1" lineno="279" slineno="2-13"/>53H-13-309</xref>;</subsection></subsection><subsection ssid="15-null-7" dnum="b-o" numlevel="1" lineno="280" slineno="2-14" level="2"><display>(b)</display>the Office of Legislative Research and General Counsel shall provide a summary <ln numlevel="1" lineno="281" slineno="2-15"/>regarding the data collected from campus expression climate surveys as described in <ln numlevel="1" lineno="282" slineno="2-16"/>Section <xref depth="3" refnumber="53H-1-504">53H-1-504</xref>;</subsection><subsection ssid="15-null-8" dnum="c-o" numlevel="1" lineno="283" slineno="2-17" level="2"><display>(c)</display>the Utah Education and Telehealth Network shall provide an annual report as <ln numlevel="1" lineno="284" slineno="2-18"/>described in Section <xref depth="3" refnumber="53H-4-213.7">53H-4-213.7</xref>;</subsection><subsection ssid="15-null-9" dnum="d-o" numlevel="1" lineno="285" slineno="2-19" level="2"><display>(d)</display>an institution with and without housing facilities shall provide an annual report <ln numlevel="1" lineno="286" slineno="2-20"/>regarding crime statistics as described in Section <xref depth="3" refnumber="53H-7-603">53H-7-603</xref>;</subsection><subsection ssid="15-null-10" dnum="e-o" numlevel="1" lineno="287" slineno="2-21" level="2"><display>(e)</display>the Center for Civic Excellence at Utah State University shall provide a report before <ln numlevel="1" lineno="288" slineno="2-22"/>July 1, 2029, regarding implementation as described in Section <xref depth="3" refnumber="53H-4-307.6">53H-4-307.6</xref>;</subsection><subsection ssid="15-null-11" dnum="f-o" numlevel="1" lineno="289" slineno="2-23" level="2"><display>(f)</display>the Rocky Mountain Center for Occupational and Environmental Health Advisory <ln numlevel="1" lineno="290" slineno="2-24"/>Board shall provide by July 1 each year a report as described in Section <xref depth="3" refnumber="53H-5-205">53H-5-205</xref>; </subsection><subsection ssid="15-null-12" dnum="g-o" numlevel="1" lineno="291" slineno="2-25" level="2"><display>(g)</display>the Utah Data Research Center shall provide an annual report as described in Section <xref depth="3" refnumber="53H-15-303"><ln numlevel="1" lineno="292" slineno="2-26"/>53H-15-303</xref><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> and 53H-15-306</amend>;</subsection><subsection ssid="15-null-13" dnum="h-o" numlevel="1" lineno="293" slineno="2-27" level="2"><display>(h)</display>the Higher Education and Corrections Council shall provide an annual report as <ln numlevel="1" lineno="294" slineno="2-28"/>described in Section <xref depth="3" refnumber="53H-1-604">53H-1-604</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="15-60" dnum="_-o:i-i" numlevel="1" lineno="295" slineno="2-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the youth apprenticeship council shall provide the written report as described in <ln numlevel="1" lineno="296" slineno="2-30"/>Section 53H-13-312; and</amend></subsection><subsection ssid="15-null-14" dnum="i-o:j-i" numlevel="1" lineno="297" slineno="2-31" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1177" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>the commissioner shall provide, in collaboration with the entities described in <ln numlevel="1" lineno="298" slineno="2-32"/>Subsection <xref depth="4" refnumber="53H-13-405(1)">53H-13-405(1)</xref>, an annual report regarding the cooperative education <ln numlevel="1" lineno="299" slineno="2-33"/>program as described in Section <xref depth="3" refnumber="53H-13-407">53H-13-407</xref>.</subsection></subsection><subsection ssid="15-null-15" dnum="2-o" numlevel="1" lineno="300" slineno="2-34" level="1"><display>(2)</display>The following entities shall submit reports to the Executive Appropriations Committee <ln numlevel="1" lineno="301" slineno="2-35"/>as described in each referenced section:<subsection ssid="15-null-16" dnum="a-o" numlevel="1" lineno="302" slineno="2-36" level="2"><display>(a)</display>the board shall submit:<subsection ssid="15-null-17" dnum="i-o" numlevel="1" lineno="303" slineno="2-37" level="3"><display>(i)</display>in the September 2025 meeting, a report regarding institutions' strategic <ln numlevel="1" lineno="304" slineno="2-38"/>reinvestment plans as described in Section <xref depth="3" refnumber="53H-8-210">53H-8-210</xref>; and</subsection><subsection ssid="15-null-18" dnum="ii-o" numlevel="1" lineno="305" slineno="2-39" level="3"><display>(ii)</display>in the September 2026 and 2027 meetings, a report regarding the progress of <ln numlevel="1" lineno="306" slineno="2-40"/>institutions in executing the institutions' strategic reinvestment plan as described <ln numlevel="1" lineno="307" slineno="2-41"/>in Section <xref depth="3" refnumber="53H-8-210">53H-8-210</xref>; and</subsection></subsection><subsection ssid="15-null-19" dnum="b-o" numlevel="1" lineno="308" slineno="2-42" level="2"><display>(b)</display>the Nucleus Institute shall provide an annual report as described in Section <xref depth="3" refnumber="53H-16-406"><ln numlevel="1" lineno="309" slineno="2-43"/>53H-16-406</xref>.</subsection></subsection><subsection ssid="15-null-20" dnum="3-o" numlevel="1" lineno="310" slineno="2-44" level="1"><display>(3)</display>The following entities shall submit reports to the Natural Resources, Agriculture, and <ln numlevel="1" lineno="311" slineno="2-45"/>Environment Interim Committee as described in each referenced section:<subsection ssid="15-null-21" dnum="a-o" numlevel="1" lineno="312" slineno="2-46" level="2"><display>(a)</display>the Utah State University Bingham Entrepreneurship and Energy Research Center <ln numlevel="1" lineno="313" slineno="2-47"/>shall annually report as described in Section <xref depth="3" refnumber="53H-4-316">53H-4-316</xref>; and</subsection><subsection ssid="15-null-22" dnum="b-o" numlevel="1" lineno="314" slineno="2-48" level="2"><display>(b)</display>the Utah State University Food Security Council shall prepare and submit an annual <ln numlevel="1" lineno="315" slineno="2-49"/>written report as described in Section <xref depth="3" refnumber="53H-4-313">53H-4-313</xref>.</subsection></subsection><subsection ssid="15-null-23" dnum="4-o" numlevel="1" lineno="316" slineno="2-50" level="1"><display>(4)</display>The following entities shall submit reports to the Economic Development and <ln numlevel="1" lineno="317" slineno="2-51"/>Workforce Services Interim Committee as described in each referenced section:<subsection ssid="15-null-24" dnum="a-o" numlevel="1" lineno="318" slineno="2-52" level="2"><display>(a)</display>the commissioner shall provide, in collaboration with the entities described in <ln numlevel="1" lineno="319" slineno="2-53"/>Subsection <xref depth="4" refnumber="53H-13-405(1)">53H-13-405(1)</xref>, an annual report regarding the cooperative education <ln numlevel="1" lineno="320" slineno="2-54"/>program as described in Section <xref depth="3" refnumber="53H-13-407">53H-13-407</xref>;</subsection><subsection ssid="15-null-25" dnum="b-o" numlevel="1" lineno="321" slineno="2-55" level="2"><display>(b)</display>Utah State University shall provide a report every three years regarding the remote <ln numlevel="1" lineno="322" slineno="2-56"/>online opportunities program as described in Section <xref depth="3" refnumber="53H-4-312">53H-4-312</xref>;</subsection><subsection ssid="15-null-26" dnum="c-o" numlevel="1" lineno="323" slineno="2-57" level="2"><display>(c)</display>the Utah State University Food Security Council shall prepare and submit an annual <ln numlevel="1" lineno="324" slineno="2-58"/>written report as described in Section <xref depth="3" refnumber="53H-4-313">53H-4-313</xref>; and</subsection><subsection ssid="15-null-27" dnum="d-o" numlevel="1" lineno="325" slineno="2-59" level="2"><display>(d)</display>the Nucleus Institute shall provide an annual report as described in Section <xref depth="3" refnumber="53H-16-406"><ln numlevel="1" lineno="326" slineno="2-60"/>53H-16-406</xref>.</subsection></subsection><subsection ssid="15-null-28" dnum="5-o" numlevel="1" lineno="327" slineno="2-61" level="1"><display>(5)</display>The ASPIRE Engineering Research Center at Utah State University shall provide an <ln numlevel="1" lineno="328" slineno="2-62"/>annual report to the Transportation and Infrastructure Appropriations Subcommittee as <ln numlevel="1" lineno="329" slineno="2-63"/>described in Section <xref depth="3" refnumber="53H-4-306.6">53H-4-306.6</xref>.</subsection><subsection ssid="15-null-29" dnum="6-o" numlevel="1" lineno="330" slineno="2-64" level="1"><display>(6)</display>The Utah Data Research Center shall provide an annual report to the Business and <ln numlevel="1" lineno="331" slineno="2-65"/>Labor Interim Committee as described in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="3" refnumber="53H-15-305">53H-15-305</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">53H-15-306</amend>.</subsection><subsection ssid="15-null-30" dnum="7-o" numlevel="1" lineno="332" slineno="2-66" level="1"><display>(7)</display>The board shall provide the following reports to state agencies and departments as <ln numlevel="1" lineno="333" slineno="2-67"/>described in each referenced section:<subsection ssid="15-null-31" dnum="a-o" numlevel="1" lineno="334" slineno="2-68" level="2"><display>(a)</display>to the Division of Facilities Construction and Management and others upon request, <ln numlevel="1" lineno="335" slineno="2-69"/>an annual technical college lease report as described in Section <xref depth="3" refnumber="53H-9-602">53H-9-602</xref>;</subsection><subsection ssid="15-null-32" dnum="b-o" numlevel="1" lineno="336" slineno="2-70" level="2"><display>(b)</display>to the Department of Veterans and Military Affairs, an annual report regarding <ln numlevel="1" lineno="337" slineno="2-71"/>number of credits awarded as described in Section <xref depth="3" refnumber="53H-3-703">53H-3-703</xref>; and</subsection><subsection ssid="15-null-33" dnum="c-o" numlevel="1" lineno="338" slineno="2-72" level="2"><display>(c)</display>to the Rules Review and General Oversight Committee, an annual report regarding <ln numlevel="1" lineno="339" slineno="2-73"/>civil liberties complaints as described in Section <xref depth="3" refnumber="53H-7-303">53H-7-303</xref>.</subsection></subsection><subsection ssid="15-null-34" dnum="8-o" numlevel="1" lineno="340" slineno="2-74" level="1"><display>(8)</display> The board shall provide to the general session of the Legislature for budget <ln numlevel="1" lineno="341" slineno="2-75"/>recommendation purposes an annual report regarding:<subsection ssid="15-null-35" dnum="a-o" numlevel="1" lineno="342" slineno="2-76" level="2"><display>(a)</display>waivers of tuition as described in Section <xref depth="3" refnumber="53H-11-307">53H-11-307</xref>; and</subsection><subsection ssid="15-null-36" dnum="b-o" numlevel="1" lineno="343" slineno="2-77" level="2"><display>(b)</display>nonresident tuition scholarships as described in Section <xref depth="3" refnumber="53H-11-405">53H-11-405</xref>.</subsection></subsection><subsection ssid="15-null-37" dnum="9-o" numlevel="1" lineno="344" slineno="2-78" level="1"><display>(9)</display>An institution shall provide the following reports as described in each referenced <ln numlevel="1" lineno="345" slineno="2-79"/>section:<subsection ssid="15-null-38" dnum="a-o" numlevel="1" lineno="346" slineno="2-80" level="2"><display>(a)</display>to the institution's governing board and published on the governing board's website, <ln numlevel="1" lineno="347" slineno="2-81"/>the institution's required prohibited submissions described in Section <xref depth="3" refnumber="53H-1-502">53H-1-502</xref>;</subsection><subsection ssid="15-null-39" dnum="b-o" numlevel="1" lineno="348" slineno="2-82" level="2"><display>(b)</display>to the board, disclosures of foreign gifts received as described in Section <xref depth="3" refnumber="53H-8-503">53H-8-503</xref>;</subsection><subsection ssid="15-null-40" dnum="c-o" numlevel="1" lineno="349" slineno="2-83" level="2"><display>(c)</display>for a qualifying institution, to the board annually regarding the faculty incentive <ln numlevel="1" lineno="350" slineno="2-84"/>component of the Engineering and Computer Science Initiative as described in <ln numlevel="1" lineno="351" slineno="2-85"/>Section <xref depth="3" refnumber="53H-1-603">53H-1-603</xref>;</subsection><subsection ssid="15-null-41" dnum="d-o" numlevel="1" lineno="352" slineno="2-86" level="2"><display>(d)</display>for a degree-granting institution:<subsection ssid="15-null-42" dnum="i-o" numlevel="1" lineno="353" slineno="2-87" level="3"><display>(i)</display>to the board annually regarding post-tenured data as described in Section <xref depth="3" refnumber="53H-3-406"><ln numlevel="1" lineno="354" slineno="2-88"/>53H-3-406</xref>;</subsection><subsection ssid="15-null-43" dnum="ii-o" numlevel="1" lineno="355" slineno="2-89" level="3"><display>(ii)</display>to the board annually regarding technical education as described in Section <xref depth="3" refnumber="53H-3-609"><ln numlevel="1" lineno="356" slineno="2-90"/>53H-3-609</xref>;</subsection></subsection><subsection ssid="15-null-44" dnum="e-o" numlevel="1" lineno="357" slineno="2-91" level="2"><display>(e)</display>for a technical college:<subsection ssid="15-null-45" dnum="i-o" numlevel="1" lineno="358" slineno="2-92" level="3"><display>(i)</display>to the board annually regarding secondary student needs and access to programs as <ln numlevel="1" lineno="359" slineno="2-93"/>described in Section <xref depth="3" refnumber="53H-3-1203">53H-3-1203</xref>;</subsection><subsection ssid="15-null-46" dnum="ii-o" numlevel="1" lineno="360" slineno="2-94" level="3"><display>(ii)</display>to the board annually regarding annual leases as described in Section <xref depth="3" refnumber="53H-9-602">53H-9-602</xref>;</subsection></subsection><subsection ssid="15-null-47" dnum="f-o" numlevel="1" lineno="361" slineno="2-95" level="2"><display>(f)</display>on a date the board determines for 2026 and 2027, regarding the institution's progress <ln numlevel="1" lineno="362" slineno="2-96"/>in executing the institution's strategic reinvestment plan as described in Section <xref depth="3" refnumber="53H-8-210"><ln numlevel="1" lineno="363" slineno="2-97"/>53H-8-210</xref>;</subsection><subsection ssid="15-null-48" dnum="g-o" numlevel="1" lineno="364" slineno="2-98" level="2"><display>(g)</display>in accordance with rules the board establishes, to the board annually regarding the <ln numlevel="1" lineno="365" slineno="2-99"/>Opportunity scholarships awarded as described in Section <xref depth="3" refnumber="53H-11-402">53H-11-402</xref>;</subsection><subsection ssid="15-null-49" dnum="h-o" numlevel="1" lineno="366" slineno="2-100" level="2"><display>(h)</display>in accordance with rules the board establishes, reports related to the promise grants <ln numlevel="1" lineno="367" slineno="2-101"/>as described in Section <xref depth="3" refnumber="53H-11-414">53H-11-414</xref>;</subsection><subsection ssid="15-null-50" dnum="i-o" numlevel="1" lineno="368" slineno="2-102" level="2"><display>(i)</display>to the board annually regarding credit for prior learning as described in Section <xref depth="3" refnumber="53H-3-702"><ln numlevel="1" lineno="369" slineno="2-103"/>53H-3-702</xref>; and</subsection><subsection ssid="15-null-51" dnum="j-o" numlevel="1" lineno="370" slineno="2-104" level="2"><display>(j)</display>for an institution with or without housing facilities, an annual report regarding crime <ln numlevel="1" lineno="371" slineno="2-105"/>statistics to the Law Enforcement and Criminal Justice Interim Committee as <ln numlevel="1" lineno="372" slineno="2-106"/>described in Section <xref depth="3" refnumber="53H-7-603">53H-7-603</xref>.</subsection></subsection><subsection ssid="15-null-52" dnum="10-o" numlevel="1" lineno="373" slineno="2-107" level="1"><display>(10)</display>An institution's board of trustees shall provide to the board annually a report regarding <ln numlevel="1" lineno="374" slineno="2-108"/>any approved contracts or grants as described in Section <xref depth="3" refnumber="53H-8-208">53H-8-208</xref>.</subsection><subsection ssid="15-null-53" dnum="11-o" numlevel="1" lineno="375" slineno="2-109" level="1"><display>(11)</display>The commissioner shall provide the following reports as described in each referenced <ln numlevel="1" lineno="376" slineno="2-110"/>section:<subsection ssid="15-null-54" dnum="a-o" numlevel="1" lineno="377" slineno="2-111" level="2"><display>(a)</display>an annual summary report regarding institutional matches for the faculty incentive <ln numlevel="1" lineno="378" slineno="2-112"/>component of the Engineering and Computer Science Initiative as described in <ln numlevel="1" lineno="379" slineno="2-113"/>Section <xref depth="3" refnumber="53H-1-603">53H-1-603</xref>; and</subsection><subsection ssid="15-null-55" dnum="b-o" numlevel="1" lineno="380" slineno="2-114" level="2"><display>(b)</display>in collaboration with the entities described in Subsection <xref depth="4" refnumber="53H-13-405(1)">53H-13-405(1)</xref>, an annual <ln numlevel="1" lineno="381" slineno="2-115"/>report regarding the cooperative education program as described in Section <xref depth="3" refnumber="53H-13-407"><ln numlevel="1" lineno="382" slineno="2-116"/>53H-13-407</xref> to the Talent, Education, and Industry Alignment Board and the board.</subsection></subsection><subsection ssid="15-null-56" dnum="12-o" numlevel="1" lineno="383" slineno="2-117" level="1"><display>(12)</display>The Talent Ready Utah Program shall provide an annual report to the board as <ln numlevel="1" lineno="384" slineno="2-118"/>described in Section <xref depth="3" refnumber="53H-13-304">53H-13-304</xref>.</subsection><subsection ssid="15-null-57" dnum="13-o" numlevel="1" lineno="385" slineno="2-119" level="1"><display>(13)</display>The Utah Works Program shall provide an annual report to the board as described in <ln numlevel="1" lineno="386" slineno="2-120"/>Section <xref depth="3" refnumber="53H-13-307">53H-13-307</xref>.</subsection><subsection ssid="15-null-58" dnum="14-o" numlevel="1" lineno="387" slineno="2-121" level="1"><display>(14)</display>The University of Utah shall provide an annual report to the governor regarding the <ln numlevel="1" lineno="388" slineno="2-122"/>engineering experiment station as described in Section <xref depth="3" refnumber="53H-4-208">53H-4-208</xref>.</subsection><subsection ssid="15-null-59" dnum="15-o" numlevel="1" lineno="389" slineno="2-123" level="1"><display>(15)</display>The Center for Civic Excellence at Utah State University vice provost shall annually <ln numlevel="1" lineno="390" slineno="2-124"/>report to the provost, the president of the institution, and the commissioner as described <ln numlevel="1" lineno="391" slineno="2-125"/>in Section <xref depth="3" refnumber="53H-4-307.6">53H-4-307.6</xref>.</subsection></section></bsec><bsec buid="1" num="53H-11-416" type="enact" src="code" uid="C53H-11-S416_2026050620260506" sort="53H11 04160020260506" numlevel="1" lineno="392" slineno="3-1" sn="3"><section numlevel="1" lineno="393" slineno="3-2" number="53H-11-416" type="enact"><secline lineno="392">Section 3. Section <bold>53H-11-416</bold> is enacted to read:</secline><catline lineno="393"><bold>53H-11-416<parens/>. Workforce Pell Grant program -- State participation authorized.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="394" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-2" dnum="_-o:a-i" numlevel="1" lineno="395" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"Eligible workforce program" means an educational program that:</amend><subsection ssid="1-3" dnum="_-o:i-i" numlevel="1" lineno="396" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">an institution of higher education offers; and</amend></subsection><subsection ssid="1-4" dnum="_-o:ii-i" numlevel="1" lineno="397" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">the board approves for submission to the United States Secretary of Education for <ln numlevel="1" lineno="398" slineno="3-7"/>consideration regarding participation in the federal Workforce Pell Grant program.</amend></subsection></subsection><subsection ssid="1-5" dnum="_-o:b-i" numlevel="1" lineno="399" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">"Federal Workforce Pell Grant program" means the program that Section 401 of the <ln numlevel="1" lineno="400" slineno="3-9"/>Higher Education Act of 1965, 20 U.S.C. Sec. 1070a, as amended, establishes to <ln numlevel="1" lineno="401" slineno="3-10"/>provide federal Pell Grant assistance to students the federal government determines <ln numlevel="1" lineno="402" slineno="3-11"/>are eligible and who enroll in eligible workforce programs.</amend></subsection><subsection ssid="1-54" dnum="_-o:c-i" numlevel="1" lineno="403" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="156" style="1" owner="jchristopherson" level="1" amendtag="end">"Secretary" means the United States Secretary of Education.</amend></subsection><subsection ssid="1-55" dnum="_-o:d-i" numlevel="1" lineno="404" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="220" groupid="158" style="1" owner="jchristopherson" level="1" amendtag="end">"Title IV programs" means federal student financial aid programs authorized under <ln numlevel="1" lineno="405" slineno="3-14"/>Title IV of the Higher Education Act of 1965, 20 U.S.C. Sec. 1070 et seq., including <ln numlevel="1" lineno="406" slineno="3-15"/>the federal Pell Grant program and the federal Workforce Pell Grant program.</amend></subsection></subsection><subsection ssid="1-6" dnum="_-o:2-i" numlevel="1" lineno="407" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">The governor delegates to the board the authority that federal law grants to the governor <ln numlevel="1" lineno="408" slineno="3-17"/>to approve eligible workforce programs to submit to the secretary for consideration <ln numlevel="1" lineno="409" slineno="3-18"/>regarding participation in the federal Workforce Pell Grant program.</amend></subsection><subsection ssid="1-7" dnum="_-o:3-i" numlevel="1" lineno="410" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">The board shall:</amend><subsection ssid="1-8" dnum="_-o:a-i" numlevel="1" lineno="411" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">receive applications from institutions of higher education that seek approval of <ln numlevel="1" lineno="412" slineno="3-21"/>eligible workforce programs;</amend></subsection><subsection ssid="1-9" dnum="_-o:b-i" numlevel="1" lineno="413" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">determine whether a program meets the requirements that federal law and regulations <ln numlevel="1" lineno="414" slineno="3-23"/>establish for eligible workforce programs;</amend></subsection><subsection ssid="1-10" dnum="_-o:c-i" numlevel="1" lineno="415" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">create an approved list of eligible programs to submit to the secretary for <ln numlevel="1" lineno="416" slineno="3-25"/>consideration regarding participation in the federal Workforce Pell Grant program;</amend></subsection><subsection ssid="1-11" dnum="_-o:d-i" numlevel="1" lineno="417" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">certify the eligibility of approved programs to the United States Secretary of <ln numlevel="1" lineno="418" slineno="3-27"/>Education;</amend></subsection><subsection ssid="1-12" dnum="_-o:e-i" numlevel="1" lineno="419" slineno="3-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">monitor programs that the board approves;</amend></subsection><subsection ssid="1-13" dnum="_-o:f-i" numlevel="1" lineno="420" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">reapprove programs as federal regulations require; and</amend></subsection><subsection ssid="1-14" dnum="_-o:g-i" numlevel="1" lineno="421" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">withdraw approval from programs that fail to meet federal or state requirements.</amend></subsection></subsection><subsection ssid="1-15" dnum="_-o:4-i" numlevel="1" lineno="422" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-16" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">The board may limit the number of programs the board approves or the number of <ln numlevel="1" lineno="423" slineno="3-32"/>institutions that may participate during any award year to ensure effective program <ln numlevel="1" lineno="424" slineno="3-33"/>administration and quality control.</amend></subsection><subsection ssid="1-17" dnum="_-o:b-i" numlevel="1" lineno="425" slineno="3-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">The commissioner of higher education acts as the board's designee to execute <ln numlevel="1" lineno="426" slineno="3-35"/>certifications, agreements, and other documents that federal regulations require.</amend></subsection><subsection ssid="1-51" dnum="_-o:c-i" numlevel="1" lineno="427" slineno="3-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">The board may contract with third-party vendors for data analysis, labor market <ln numlevel="1" lineno="428" slineno="3-37"/>information, outcome tracking, or technical assistance necessary to perform the <ln numlevel="1" lineno="429" slineno="3-38"/>board's duties under this section.</amend></subsection></subsection><subsection ssid="1-18" dnum="_-o:5-i" numlevel="1" lineno="430" slineno="3-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="1-19" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline" space="false"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1">(a)</amend></display><subsection ssid="1-52" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">The Department of Workforce Services shall provide to the board, upon the <ln numlevel="1" lineno="431" slineno="3-40"/>board's request, unemployment insurance wage record data that the board needs to:</amend><subsection ssid="1-20" dnum="_-o:A-i" numlevel="1" lineno="432" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="2"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">calculate completion rates and job placement rates for eligible workforce <ln numlevel="1" lineno="433" slineno="3-42"/>programs;</amend></subsection><subsection ssid="1-21" dnum="_-o:B-i" numlevel="1" lineno="434" slineno="3-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="2"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">certify completion rates and job placement rates to the United States Secretary <ln numlevel="1" lineno="435" slineno="3-44"/>of Education; and</amend></subsection><subsection ssid="1-57" dnum="_-o:C-i" numlevel="1" lineno="436" slineno="3-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="2"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="227" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="end">verify student enrollment, completion, employment, and earnings for purposes <ln numlevel="1" lineno="437" slineno="3-46"/>of administering Title IV programs.</amend></subsection></subsection><subsection ssid="1-53" dnum="_-o:ii-i" numlevel="1" lineno="438" slineno="3-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="216" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="end">The Department of Workforce Services may contract with third-party vendors for <ln numlevel="1" lineno="439" slineno="3-48"/>data analysis, technical assistance, or services necessary to perform the <ln numlevel="1" lineno="440" slineno="3-49"/>department's duties under this section.</amend></subsection></subsection><subsection ssid="1-22" dnum="_-o:b-i" numlevel="1" lineno="441" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">The board may request and a state agency may provide to the board administrative <ln numlevel="1" lineno="442" slineno="3-51"/>data, including personally identifiable information, that the board needs to perform <ln numlevel="1" lineno="443" slineno="3-52"/>the board's duties under this section.</amend></subsection><subsection ssid="1-23" dnum="_-o:c-i" numlevel="1" lineno="444" slineno="3-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">The board shall:</amend><subsection ssid="1-24" dnum="_-o:i-i" numlevel="1" lineno="445" slineno="3-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">use data the board receives under this Subsection <xref depth="4" refnumber="53H-11-416(5)">(5)</xref> only for purposes this section <ln numlevel="1" lineno="446" slineno="3-55"/>authorizes;</amend></subsection><subsection ssid="1-25" dnum="_-o:ii-i" numlevel="1" lineno="447" slineno="3-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1253" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">maintain the confidentiality and security of personally identifiable information <ln numlevel="1" lineno="448" slineno="3-57"/>the board receives;</amend></subsection><subsection ssid="1-26" dnum="_-o:iii-i" numlevel="1" lineno="449" slineno="3-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1254" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">comply with federal and state privacy laws; and</amend></subsection><subsection ssid="1-27" dnum="_-o:iv-i" numlevel="1" lineno="450" slineno="3-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">enter into data sharing agreements with state agencies that provide data under <ln numlevel="1" lineno="451" slineno="3-60"/>this Subsection <xref depth="4" refnumber="53H-11-416(5)">(5)</xref>.</amend></subsection></subsection><subsection ssid="1-28" dnum="_-o:d-i" numlevel="1" lineno="452" slineno="3-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">The board may share data with the United States Secretary of Education, the United <ln numlevel="1" lineno="453" slineno="3-62"/>States Secretary of Labor, or another state as federal law or an interstate agreement <ln numlevel="1" lineno="454" slineno="3-63"/>requires, subject to applicable privacy protections.</amend></subsection><subsection ssid="1-29" dnum="_-o:e-i" numlevel="1" lineno="455" slineno="3-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">An individual commits a class B misdemeanor if the individual knowingly or <ln numlevel="1" lineno="456" slineno="3-65"/>intentionally:</amend><subsection ssid="1-30" dnum="_-o:i-i" numlevel="1" lineno="457" slineno="3-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">discloses personally identifiable information the individual obtains under this <ln numlevel="1" lineno="458" slineno="3-67"/>Subsection <xref depth="4" refnumber="53H-11-416(5)">(5)</xref> for a purpose this section does not authorize;</amend></subsection><subsection ssid="1-31" dnum="_-o:ii-i" numlevel="1" lineno="459" slineno="3-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">uses personally identifiable information the individual obtains under this <ln numlevel="1" lineno="460" slineno="3-69"/>Subsection <xref depth="4" refnumber="53H-11-416(5)">(5)</xref> for a purpose this section does not authorize; or</amend></subsection><subsection ssid="1-32" dnum="_-o:iii-i" numlevel="1" lineno="461" slineno="3-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">accesses personally identifiable information the individual obtains under this <ln numlevel="1" lineno="462" slineno="3-71"/>Subsection <xref depth="4" refnumber="53H-11-416(5)">(5)</xref> without authorization.</amend></subsection></subsection></subsection><subsection ssid="1-33" dnum="_-o:6-i" numlevel="1" lineno="463" slineno="3-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">The board may enter into agreements with another state to allow:</amend><subsection ssid="1-34" dnum="_-o:a-i" numlevel="1" lineno="464" slineno="3-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">students who reside in the state to enroll in eligible workforce programs that the <ln numlevel="1" lineno="465" slineno="3-74"/>other state approves; amendtag="end">The youth apprenticeship council shall select a chair and vice chair from among the <ln numlevel="1" lineno="516" slineno="4-24"/>members of the youth apprenticeship amendtag="end">ensure aligned action across the talent program, the State Board of Education, the <ln numlevel="1" lineno="535" slineno="4-43"/>board, and the Department of Workforce Services;</amend></subsection></subsection><subsection ssid="7-26" dnum="_-o:b-i" numlevel="1" lineno="536" slineno="4-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">develop and maintain:</amend><subsection ssid="7-27" dnum="_-o:i-i" numlevel="1" lineno="537" slineno="4-45" ea="amend" anum="0" dnum="_-o:ii-i" numlevel="1" lineno="538" slineno="4-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="end">establish statewide priorities for which industry sectors to prioritize; and</amend></subsection><subsection ssid="7-47" dnum="_-o:iii-i" numlevel="1" lineno="562" slineno="4-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1325" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="232" groupid="184" style="1" owner="jchristopherson" level="1" amendtag="end">use workforce data and analysis of high-wage, in-demand careers to inform <ln numlevel="1" lineno="563" slineno="4-71"/>prioritization; and</amend></subsection></subsection><subsection ssid="7-48" dnum="_-o:h-i" numlevel="1" lineno="564" slineno="4-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1326" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="237" groupid="188" style="1" owner="jchristopherson" level="1" amendtag="end">perform other duties as directed by the talent board to support the development and <ln numlevel="1" lineno="565" slineno="4-73"/>sustainability of youth apprenticeship programs in the state.</amend></subsection></subsection><subsection ssid="7-49" dnum="_-o:9-i" numlevel="1" lineno="566" slineno="4-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1327" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="238" groupid="189" style="1" owner="jchristopherson" level="1" amendtag="end">The talent program shall provide staff support to the youth apprenticeship council.</amend></subsection><subsection ssid="7-50" dnum="_-o:10-i" numlevel="1" lineno="567" slineno="4-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1328" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="194" style="1" owner="jchristopherson" level="1" amendtag="end">The youth apprenticeship council shall report to the talent board:</amend><subsection ssid="7-51" dnum="_-o:a-i" numlevel="1" lineno="568" slineno="4-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1329" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="198" style="1" owner="jchristopherson" level="1" amendtag="end">on the activities and progress of the youth apprenticeship council; and</amend></subsection><subsection ssid="7-52" dnum="_-o:b-i" numlevel="1" lineno="569" slineno="4-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1330" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="255" groupid="202" style="1" owner="jchristopherson" level="1" amendtag="end">no less than twice each calendar year.</amend></subsection></subsection><subsection ssid="7-53" dnum="_-o:11-i" numlevel="1" lineno="570" slineno="4-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1331" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="256" groupid="203" style="1" owner="jchristopherson" level="1" amendtag="end">No later than November 1, 2027, the youth apprenticeship council shall submit a <ln numlevel="1" lineno="571" slineno="4-79"/>written report to the Education Interim Committee and the Economic Development and <ln numlevel="1" lineno="572" slineno="4-80"/>Workforce Services Interim Committee that includes:</amend><subsection ssid="7-54" dnum="_-o:a-i" numlevel="1" lineno="573" slineno="4-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="263" groupid="208" style="1" owner="jchristopherson" level="1" amendtag="end">recommendations on statewide funding needs for youth apprenticeship programs;</amend></subsection><subsection ssid="7-55" dnum="_-o:b-i" numlevel="1" lineno="574" slineno="4-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1333" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="268" groupid="212" style="1" owner="jchristopherson" level="1" amendtag="end">recommendations on employer incentive structures; and</amend></subsection><subsection ssid="7-56" dnum="_-o:c-i" numlevel="1" lineno="575" slineno="4-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1334" style="1" owner="i" level="1" expanding youth apprenticeship <ln numlevel="1" lineno="576" slineno="4-84"/>opportunities.</amend></subsection></subsection></section></bsec><bsec buid="9" num="53H-15-101" type="amend" src="code" uid="C53H-15-S101_2026050620260506" sort="53H15 01010020260506" numlevel="1" lineno="577" slineno="5-1" sn="5"><section number="53H-15-101" numlevel="1" lineno="578" slineno="5-2" type="amend"><secline lineno="577">Section 5. Section <bold>53H-15-101</bold> is amended to read:</secline><catline lineno="578"><bold>53H-15-101<parens/>. General provisions -- Definitions.</bold></catline><sectionText lineno="579"><tab/>As used in this chapter:</sectionText><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="580" slineno="5-4" level="1"><display>(1)</display>"Advisory board" means the Utah Data Research Advisory Board created in Section <xref depth="3" refnumber="53H-15-203"><ln numlevel="1" lineno="581" slineno="5-5"/>53H-15-203</xref>.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="582" slineno="5-6" level="1"><display>(2)</display>"Center" means the Utah Data Research Center created in Section <xref depth="3" refnumber="53H-15-202">53H-15-202</xref>.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="583" slineno="5-7" level="1"><display>(3)</display>"Data" means any information about a person stored in a physical or electronic record.</subsection><subsection ssid="9-null-4" dnum="4-o" numlevel="1" lineno="584" slineno="5-8" level="1"><display>(4)</display>"Data research program" means the data maintained by the center in accordance with <ln numlevel="1" lineno="585" slineno="5-9"/>Section <xref depth="3" refnumber="53H-15-302">53H-15-302</xref>.</subsection><subsection ssid="9-null-5" dnum="5-o" numlevel="1" lineno="586" slineno="5-10" level="1"><display>(5)</display>"De-identified data" means data about a person that cannot, without additional <ln numlevel="1" lineno="587" slineno="5-11"/>information, identify the person to another person or machine.</subsection><subsection ssid="9-null-6" dnum="6-o" numlevel="1" lineno="588" slineno="5-12" level="1"><display>(6)</display>"Director" means the director of the Utah Data Research Center created in Section <xref depth="3" refnumber="53H-15-202"><ln numlevel="1" lineno="589" slineno="5-13"/>53H-15-202</xref>.</subsection><subsection ssid="9-null-7" dnum="7-o" numlevel="1" lineno="590" slineno="5-14" level="1"><display>(7)</display>"Office" means the Office of the Legislative Auditor General created in Section <xref depth="3" refnumber="36-12-15"><ln numlevel="1" lineno="591" slineno="5-15"/>36-12-15</xref>.</subsection><subsection ssid="9-null-8" dnum="8-o" numlevel="1" lineno="592" slineno="5-16" level="1"><display>(8)</display>"Participating entity" means:<subsection ssid="9-null-9" dnum="a-o" numlevel="1" lineno="593" slineno="5-17" level="2"><display>(a)</display>the State Board of Education, which includes the director as defined in Section <xref depth="3" refnumber="53E-10-701"><ln numlevel="1" lineno="594" slineno="5-18"/>53E-10-701</xref>;</subsection><subsection ssid="9-null-10" dnum="b-o" numlevel="1" lineno="595" slineno="5-19" level="2"><display>(b)</display>the board;</subsection><subsection ssid="9-null-11" dnum="c-o" numlevel="1" lineno="596" slineno="5-20" level="2"><display>(c)</display>the Department of Workforce Services;</subsection><subsection ssid="9-null-12" dnum="d-o" numlevel="1" lineno="597" slineno="5-21" level="2"><display>(d)</display>the Department of Health and Human Services; Participating state agency access.</bold></catline><subsection ssid="11-1" dnum="_-o:1-i" numlevel="1" lineno="607" slineno="6-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1351" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">In addition to performing data research and responding to data research requests under <ln numlevel="1" lineno="608" slineno="6-4"/>Section <xref depth="3" refnumber="53H-15-303">53H-15-303</xref>, the center shall maintain a program to support data collection, <ln numlevel="1" lineno="609" slineno="6-5"/>analysis, exchange, and for operational transactional purposes among participating state <ln numlevel="1" lineno="610" slineno="6-6"/>agencies to provide access to data to promote the improvement of public health, <ln numlevel="1" lineno="611" slineno="6-7"/>education, safety, and well-being of the state's citizenry and improvement of the overall <ln numlevel="1" lineno="612" slineno="6-8"/>efficiency of state agencies.</amend></subsection><subsection ssid="11-2" dnum="_-o:2-i" numlevel="1" lineno="613" slineno="6-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1352" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">The director shall provide bi-annual updates to the advisory board about the program in <ln numlevel="1" lineno="614" slineno="6-10"/>Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref>.</amend></subsection><subsection ssid="11-3" dnum="_-o:3-i" numlevel="1" lineno="615" slineno="6-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1353" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">The program described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref>:</amend><subsection ssid="11-4" dnum="_-o:a-i" numlevel="1" lineno="616" slineno="6-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1354" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">may collect, store, and process personal data as allowed under state and federal law;</amend></subsection><subsection ssid="11-5" dnum="_-o:b-i" numlevel="1" lineno="617" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1355" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">shall include protections to prevent the unauthorized access, use, or redisclosure of <ln numlevel="1" lineno="618" slineno="6-14"/>personal data; and</amend></subsection><subsection ssid="11-6" dnum="_-o:c-i" numlevel="1" lineno="619" slineno="6-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1356" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">shall be considered a high-risk processing activity under Subsection <xref depth="4" refnumber="63A-19-101(17)">63A-19-101(17)</xref>.</amend></subsection></subsection><subsection ssid="11-7" dnum="_-o:4-i" numlevel="1" lineno="620" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1357" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">A participating state agency and the center shall include any contribution of personal <ln numlevel="1" lineno="621" slineno="6-17"/>data to the program described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref> in the applicable personal data collection <ln numlevel="1" lineno="622" slineno="6-18"/>notice required under Section <xref depth="3" refnumber="63A-19-402">63A-19-402</xref>.</amend></subsection><subsection ssid="11-8" dnum="_-o:5-i" numlevel="1" lineno="623" slineno="6-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1358" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">A participating state agency that chooses to contribute personal data to the program <ln numlevel="1" lineno="624" slineno="6-20"/>described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref> shall comply with:</amend><subsection ssid="11-9" dnum="_-o:a-i" numlevel="1" lineno="625" slineno="6-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1359" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">guidelines established by the center; and</amend></subsection><subsection ssid="11-10" dnum="_-o:b-i" numlevel="1" lineno="626" slineno="6-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1360" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">applicable state and federal data privacy laws.</amend></subsection></subsection><subsection ssid="11-11" dnum="_-o:6-i" numlevel="1" lineno="627" slineno="6-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1361" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="628" slineno="6-24"/>center may create rules to establish:</amend><subsection ssid="11-13" dnum="_-o:a-i" numlevel="1" lineno="629" slineno="6-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1362" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">procedures for submitting personal data under this section;</amend></subsection><subsection ssid="11-14" dnum="_-o:b-i" numlevel="1" lineno="630" slineno="6-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1363" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">procedures consistent with applicable federal and state data confidentiality and <ln numlevel="1" lineno="631" slineno="6-27"/>privacy provisions to prevent the unauthorized access, use, or redisclosure of <ln numlevel="1" lineno="632" slineno="6-28"/>personal data; and</amend></subsection><subsection ssid="11-15" dnum="_-o:c-i" numlevel="1" lineno="633" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1364" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">any additional requirements needed to administer this section.</amend></subsection></subsection><subsection ssid="11-16" dnum="_-o:7-i" numlevel="1" lineno="634" slineno="6-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1365" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">Prior to contributing personal data to the program described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref>, a <ln numlevel="1" lineno="635" slineno="6-31"/>participating state agency and the center shall enter into a written agreement that:</amend><subsection ssid="11-17" dnum="_-o:a-i" numlevel="1" lineno="636" slineno="6-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1366" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">specifies the personal data that the participating state agency will share with the <ln numlevel="1" lineno="637" slineno="6-33"/>center;</amend></subsection><subsection ssid="11-18" dnum="_-o:b-i" numlevel="1" lineno="638" slineno="6-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">defines the purposes for which the center may use the personal data contributed by <ln numlevel="1" lineno="639" slineno="6-35"/>the participating state agency; and</amend></subsection><subsection ssid="11-19" dnum="_-o:c-i" numlevel="1" lineno="640" slineno="6-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1368" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">establishes timelines for disposing of personal data the participating state agency <ln numlevel="1" lineno="641" slineno="6-37"/>discloses when:</amend><subsection ssid="11-20" dnum="_-o:i-i" numlevel="1" lineno="642" slineno="6-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">the personal data is no longer needed for the program described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref>; <ln numlevel="1" lineno="643" slineno="6-39"/>or</amend></subsection><subsection ssid="11-21" dnum="_-o:ii-i" numlevel="1" lineno="644" slineno="6-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1370" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">required by state or federal law.</amend></subsection></subsection></subsection><subsection ssid="11-22" dnum="_-o:8-i" numlevel="1" lineno="645" slineno="6-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1371" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">The center may create a fee schedule in accordance with Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref> for <ln numlevel="1" lineno="646" slineno="6-42"/>completing an operational transactional service.</amend></subsection><subsection ssid="11-23" dnum="_-o:9-i" numlevel="1" lineno="647" slineno="6-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1372" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this section shall be construed as requiring an entity to provide personal data <ln numlevel="1" lineno="648" slineno="6-44"/>to the program described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref>.</amend></subsection><subsection ssid="11-24" dnum="_-o:10-i" numlevel="1" lineno="649" slineno="6-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1373" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">The program described in Subsection <xref depth="4" refnumber="53H-15-305(1)">(1)</xref> is not subject to Title 63G, Chapter 2, <ln numlevel="1" lineno="650" slineno="6-46"/>Government Records Access and Management Act.</amend></subsection></section></bsec><bsec buid="13" num="53H-15-306" type="enact" src="code" uid="C53H-15-S306_2026050620260506" sort="53H15 03060020260506" numlevel="1" lineno="651" slineno="7-1" sn="7"><section numlevel="1" lineno="652" slineno="7-2" number="53H-15-306" type="enact"><secline lineno="651">Section 7. Reporting.</bold></catline><subsection ssid="13-1" dnum="_-o:1-i" numlevel="1" lineno="653" slineno="7-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1374" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">The center shall report to the Education Interim Committee and Business and Labor <ln numlevel="1" lineno="654" slineno="7-4"/>Interim Committee:</amend><subsection ssid="13-2" dnum="_-o:a-i" numlevel="1" lineno="655" slineno="7-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1375" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">before July 1 of each year regarding the center's:</amend><subsection ssid="13-3" dnum="_-o:i-i" numlevel="1" lineno="656" slineno="7-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1376" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">research and service priorities for the year;</amend></subsection><subsection ssid="13-4" dnum="_-o:ii-i" numlevel="1" lineno="657" slineno="7-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1377" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">completed research from the previous year; and</amend></subsection><subsection ssid="13-5" dnum="_-o:iii-i" numlevel="1" lineno="658" slineno="7-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1378" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">activities and accomplishments in the previous year; and</amend></subsection></subsection><subsection ssid="13-6" dnum="_-o:b-i" numlevel="1" lineno="659" slineno="7-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1379" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">before December 1 of each year, the center's ongoing data research and service <ln numlevel="1" lineno="660" slineno="7-10"/>priority list described in Subsection <xref depth="4" refnumber="53B-33-302(2)">53B-33-302(2)</xref>.</amend></subsection></subsection><subsection ssid="13-7" dnum="_-o:2-i" numlevel="1" lineno="661" slineno="7-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1380" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">The Education Interim Committee shall provide the center ongoing input regarding the <ln numlevel="1" lineno="662" slineno="7-12"/>center's activities and data research priorities.</amend></subsection></section></bsec><bsec buid="5" num="63G-2-305" type="amend" src="code" uid="C63G-2-S305_2026050620260506" sort="63G02 03050020260506" numlevel="1" lineno="663" slineno="8-1" sn="8"><section number="63G-2-305" numlevel="1" lineno="664" slineno="8-2" type="amend"><secline lineno="663">Section 8. Section <bold>63G-2-305</bold> is amended to read:</secline><catline lineno="664"><bold>63G-2-305<parens/>. Protected records.</bold></catline><sectionText lineno="665"><tab/>The following records are protected if properly classified by a governmental entity:</sectionText><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="666" slineno="8-4" level="1"><display>(1)</display>trade secrets as defined in Section <xref depth="3" refnumber="13-24-2">13-24-2</xref> if the person submitting the trade secret has <ln numlevel="1" lineno="667" slineno="8-5"/>provided the governmental entity with the information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="668" slineno="8-6" level="1"><display>(2)</display>commercial information or nonindividual financial information obtained from a person <ln numlevel="1" lineno="669" slineno="8-7"/>if:<subsection ssid="5-null-3" dnum="a-o" numlevel="1" lineno="670" slineno="8-8" level="2"><display>(a)</display>disclosure of the information could reasonably be expected to result in unfair <ln numlevel="1" lineno="671" slineno="8-9"/>competitive injury to the person submitting the information or would impair the <ln numlevel="1" lineno="672" slineno="8-10"/>ability of the governmental entity to obtain necessary information in the future;</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="673" slineno="8-11" level="2"><display>(b)</display>the person submitting the information has a greater interest in prohibiting access than <ln numlevel="1" lineno="674" slineno="8-12"/>the public in obtaining access; and</subsection><subsection ssid="5-null-5" dnum="c-o" numlevel="1" lineno="675" slineno="8-13" level="2"><display>(c)</display>the person submitting the information has provided the governmental entity with the <ln numlevel="1" lineno="676" slineno="8-14"/>information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection></subsection><subsection ssid="5-null-6" dnum="3-o" numlevel="1" lineno="677" slineno="8-15" level="1"><display>(3)</display>commercial or financial information acquired or prepared by a governmental entity to <ln numlevel="1" lineno="678" slineno="8-16"/>the extent that disclosure would lead to financial speculations in currencies, securities, or <ln numlevel="1" lineno="679" slineno="8-17"/>commodities that will interfere with a planned transaction by the governmental entity or <ln numlevel="1" lineno="680" slineno="8-18"/>cause substantial financial injury to the governmental entity or state economy;</subsection><subsection ssid="5-null-7" dnum="4-o" numlevel="1" lineno="681" slineno="8-19" level="1"><display>(4)</display>records, the disclosure of which could cause commercial injury to, or confer a <ln numlevel="1" lineno="682" slineno="8-20"/>competitive advantage upon a potential or actual competitor of, a commercial project <ln numlevel="1" lineno="683" slineno="8-21"/>entity as defined in Subsection <xref depth="4" refnumber="11-13-103(4)">11-13-103(4)</xref>;</subsection><subsection ssid="5-null-8" dnum="5-o" numlevel="1" lineno="684" slineno="8-22" level="1"><display>(5)</display>test questions and answers to be used in future license, certification, registration, <ln numlevel="1" lineno="685" slineno="8-23"/>employment, or academic examinations;</subsection><subsection ssid="5-null-9" dnum="6-o" numlevel="1" lineno="686" slineno="8-24" level="1"><display>(6)</display>records, the disclosure of which would impair governmental procurement proceedings <ln numlevel="1" lineno="687" slineno="8-25"/>or give an unfair advantage to any person proposing to enter into a contract or agreement <ln numlevel="1" lineno="688" slineno="8-26"/>with a governmental entity, except, subject to Subsections <xref depth="4" refnumber="63G-2-305(1)">(1)</xref> and <xref depth="4" refnumber="63G-2-305(2)">(2)</xref>, that this <ln numlevel="1" lineno="689" slineno="8-27"/>Subsection <xref depth="4" refnumber="63G-2-305(6)">(6)</xref> does not restrict the right of a person to have access to, after the contract <ln numlevel="1" lineno="690" slineno="8-28"/>or grant has been awarded and signed by all parties:<subsection ssid="5-null-10" dnum="a-o" numlevel="1" lineno="691" slineno="8-29" level="2"><display>(a)</display>a bid, proposal, application, or other information submitted to or by a governmental <ln numlevel="1" lineno="692" slineno="8-30"/>entity in response to:<subsection ssid="5-null-11" dnum="i-o" numlevel="1" lineno="693" slineno="8-31" level="3"><display>(i)</display>an invitation for bids;</subsection><subsection ssid="5-null-12" dnum="ii-o" numlevel="1" lineno="694" slineno="8-32" level="3"><display>(ii)</display>a request for proposals;</subsection><subsection ssid="5-null-13" dnum="iii-o" numlevel="1" lineno="695" slineno="8-33" level="3"><display>(iii)</display>a request for quotes;</subsection><subsection ssid="5-null-14" dnum="iv-o" numlevel="1" lineno="696" slineno="8-34" level="3"><display>(iv)</display>a grant; or</subsection><subsection ssid="5-null-15" dnum="v-o" numlevel="1" lineno="697" slineno="8-35" level="3"><display>(v)</display>other similar document; or</subsection></subsection><subsection ssid="5-null-16" dnum="b-o" numlevel="1" lineno="698" slineno="8-36" level="2"><display>(b)</display>an unsolicited proposal, as defined in Section <xref depth="3" refnumber="63G-6a-712">63G-6a-712</xref>;</subsection></subsection><subsection ssid="5-null-17" dnum="7-o" numlevel="1" lineno="699" slineno="8-37" level="1"><display>(7)</display>information submitted to or by a governmental entity in response to a request for <ln numlevel="1" lineno="700" slineno="8-38"/>information, except, subject to Subsections <xref depth="4" refnumber="63G-2-305(1)">(1)</xref> and <xref depth="4" refnumber="63G-2-305(2)">(2)</xref>, that this Subsection <xref depth="4" refnumber="63G-2-305(7)">(7)</xref> does not <ln numlevel="1" lineno="701" slineno="8-39"/>restrict the right of a person to have access to the information, after:<subsection ssid="5-null-18" dnum="a-o" numlevel="1" lineno="702" slineno="8-40" level="2"><display>(a)</display>a contract directly relating to the subject of the request for information has been <ln numlevel="1" lineno="703" slineno="8-41"/>awarded and signed by all parties; or</subsection><subsection ssid="5-null-19" dnum="b-o" numlevel="1" lineno="704" slineno="8-42" level="2" space="false"><display>(b)</display><subsection ssid="5-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a final determination is made not to enter into a contract that relates to the <ln numlevel="1" lineno="705" slineno="8-43"/>subject of the request for information; and</subsection><subsection ssid="5-null-21" dnum="ii-o" numlevel="1" lineno="706" slineno="8-44" level="3"><display>(ii)</display>at least two years have passed after the day on which the request for information <ln numlevel="1" lineno="707" slineno="8-45"/>is issued;</subsection></subsection></subsection><subsection ssid="5-null-22" dnum="8-o" numlevel="1" lineno="708" slineno="8-46" level="1"><display>(8)</display>records that would identify real property or the appraisal or estimated value of real or <ln numlevel="1" lineno="709" slineno="8-47"/>personal property, including intellectual property, under consideration for public <ln numlevel="1" lineno="710" slineno="8-48"/>acquisition before any rights to the property are acquired unless:<subsection ssid="5-null-23" dnum="a-o" numlevel="1" lineno="711" slineno="8-49" level="2"><display>(a)</display>public interest in obtaining access to the information is greater than or equal to the <ln numlevel="1" lineno="712" slineno="8-50"/>governmental entity's need to acquire the property on the best terms possible;</subsection><subsection ssid="5-null-24" dnum="b-o" numlevel="1" lineno="713" slineno="8-51" level="2"><display>(b)</display>the information has already been disclosed to persons not employed by or under a <ln numlevel="1" lineno="714" slineno="8-52"/>duty of confidentiality to the entity;</subsection><subsection ssid="5-null-25" dnum="c-o" numlevel="1" lineno="715" slineno="8-53" level="2"><display>(c)</display>in the case of records that would identify property, potential sellers of the described <ln numlevel="1" lineno="716" slineno="8-54"/>property have already learned of the governmental entity's plans to acquire the <ln numlevel="1" lineno="717" slineno="8-55"/>property;</subsection><subsection ssid="5-null-26" dnum="d-o" numlevel="1" lineno="718" slineno="8-56" level="2"><display>(d)</display>in the case of records that would identify the appraisal or estimated value of <ln numlevel="1" lineno="719" slineno="8-57"/>property, the potential sellers have already learned of the governmental entity's <ln numlevel="1" lineno="720" slineno="8-58"/>estimated value of the property; or</subsection><subsection ssid="5-null-27" dnum="e-o" numlevel="1" lineno="721" slineno="8-59" level="2"><display>(e)</display>the property under consideration for public acquisition is a single family residence <ln numlevel="1" lineno="722" slineno="8-60"/>and the governmental entity seeking to acquire the property has initiated negotiations <ln numlevel="1" lineno="723" slineno="8-61"/>to acquire the property as required under Section <xref depth="3" refnumber="78B-6-505">78B-6-505</xref>;</subsection></subsection><subsection ssid="5-null-28" dnum="9-o" numlevel="1" lineno="724" slineno="8-62" level="1"><display>(9)</display>records prepared in contemplation of sale, exchange, lease, rental, or other compensated <ln numlevel="1" lineno="725" slineno="8-63"/>transaction of real or personal property including intellectual property, which, if <ln numlevel="1" lineno="726" slineno="8-64"/>disclosed prior to completion of the transaction, would reveal the appraisal or estimated <ln numlevel="1" lineno="727" slineno="8-65"/>value of the subject property, unless:<subsection ssid="5-null-29" dnum="a-o" numlevel="1" lineno="728" slineno="8-66" level="2"><display>(a)</display>the public interest in access is greater than or equal to the interests in restricting <ln numlevel="1" lineno="729" slineno="8-67"/>access, including the governmental entity's interest in maximizing the financial <ln numlevel="1" lineno="730" slineno="8-68"/>benefit of the transaction; or</subsection><subsection ssid="5-null-30" dnum="b-o" numlevel="1" lineno="731" slineno="8-69" level="2"><display>(b)</display>when prepared by or on behalf of a governmental entity, appraisals or estimates of <ln numlevel="1" lineno="732" slineno="8-70"/>the value of the subject property have already been disclosed to persons not <ln numlevel="1" lineno="733" slineno="8-71"/>employed by or under a duty of confidentiality to the entity;</subsection></subsection><subsection ssid="5-null-31" dnum="10-o" numlevel="1" lineno="734" slineno="8-72" level="1"><display>(10)</display>records created or maintained for civil, criminal, or administrative enforcement <ln numlevel="1" lineno="735" slineno="8-73"/>purposes or audit purposes, or for discipline, licensing, certification, or registration <ln numlevel="1" lineno="736" slineno="8-74"/>purposes, if release of the records:<subsection ssid="5-null-32" dnum="a-o" numlevel="1" lineno="737" slineno="8-75" level="2"><display>(a)</display>reasonably could be expected to interfere with investigations undertaken for <ln numlevel="1" lineno="738" slineno="8-76"/>enforcement, discipline, licensing, certification, or registration purposes;</subsection><subsection ssid="5-null-33" dnum="b-o" numlevel="1" lineno="739" slineno="8-77" level="2"><display>(b)</display>reasonably could be expected to interfere with audits, disciplinary, or enforcement <ln numlevel="1" lineno="740" slineno="8-78"/>proceedings;</subsection><subsection ssid="5-null-34" dnum="c-o" numlevel="1" lineno="741" slineno="8-79" level="2"><display>(c)</display>would create a danger of depriving a person of a right to a fair trial or impartial <ln numlevel="1" lineno="742" slineno="8-80"/>hearing;</subsection><subsection ssid="5-null-35" dnum="d-o" numlevel="1" lineno="743" slineno="8-81" level="2"><display>(d)</display>reasonably could be expected to disclose the identity of a source who is not generally <ln numlevel="1" lineno="744" slineno="8-82"/>known outside of government and, in the case of a record compiled in the course of <ln numlevel="1" lineno="745" slineno="8-83"/>an investigation, disclose information furnished by a source not generally known <ln numlevel="1" lineno="746" slineno="8-84"/>outside of government if disclosure would compromise the source; or</subsection><subsection ssid="5-null-36" dnum="e-o" numlevel="1" lineno="747" slineno="8-85" level="2"><display>(e)</display>reasonably could be expected to disclose investigative or audit techniques, <ln numlevel="1" lineno="748" slineno="8-86"/>procedures, policies, or orders not generally known outside of government if <ln numlevel="1" lineno="749" slineno="8-87"/>disclosure would interfere with enforcement or audit efforts;</subsection></subsection><subsection ssid="5-null-37" dnum="11-o" numlevel="1" lineno="750" slineno="8-88" level="1"><display>(11)</display>records the disclosure of which would jeopardize the life or safety of an individual;</subsection><subsection ssid="5-null-38" dnum="12-o" numlevel="1" lineno="751" slineno="8-89" level="1"><display>(12)</display>records the disclosure of which would jeopardize the security of governmental <ln numlevel="1" lineno="752" slineno="8-90"/>property, governmental programs, or governmental recordkeeping systems from <ln numlevel="1" lineno="753" slineno="8-91"/>damage, theft, or other appropriation or use contrary to law or public policy;</subsection><subsection ssid="5-null-39" dnum="13-o" numlevel="1" lineno="754" slineno="8-92" level="1"><display>(13)</display>records that, if disclosed, would jeopardize the security or safety of a correctional <ln numlevel="1" lineno="755" slineno="8-93"/>facility, or records relating to incarceration, treatment, probation, or parole, that would <ln numlevel="1" lineno="756" slineno="8-94"/>interfere with the control and supervision of an offender's incarceration, treatment, <ln numlevel="1" lineno="757" slineno="8-95"/>probation, or parole;</subsection><subsection ssid="5-null-40" dnum="14-o" numlevel="1" lineno="758" slineno="8-96" level="1"><display>(14)</display>records that, if disclosed, would reveal recommendations made to the Board of <ln numlevel="1" lineno="759" slineno="8-97"/>Pardons and Parole by an employee of or contractor for the Department of Corrections, <ln numlevel="1" lineno="760" slineno="8-98"/>the Board of Pardons and Parole, or the Department of Health and Human Services that <ln numlevel="1" lineno="761" slineno="8-99"/>are based on the employee's or contractor's supervision, diagnosis, or treatment of any <ln numlevel="1" lineno="762" slineno="8-100"/>person within the board's jurisdiction;</subsection><subsection ssid="5-null-41" dnum="15-o" numlevel="1" lineno="763" slineno="8-101" level="1"><display>(15)</display>records and audit workpapers that identify audit, collection, and operational procedures <ln numlevel="1" lineno="764" slineno="8-102"/>and methods used by the State Tax Commission, if disclosure would interfere with <ln numlevel="1" lineno="765" slineno="8-103"/>audits or collections;</subsection><subsection ssid="5-null-42" dnum="16-o" numlevel="1" lineno="766" slineno="8-104" level="1"><display>(16)</display>records of a governmental audit agency relating to an ongoing or planned audit until <ln numlevel="1" lineno="767" slineno="8-105"/>the final audit is released;</subsection><subsection ssid="5-null-43" dnum="17-o" numlevel="1" lineno="768" slineno="8-106" level="1"><display>(17)</display>records that are subject to the attorney client privilege;</subsection><subsection ssid="5-null-44" dnum="18-o" numlevel="1" lineno="769" slineno="8-107" level="1"><display>(18)</display>records prepared for or by an attorney, consultant, surety, indemnitor, insurer, <ln numlevel="1" lineno="770" slineno="8-108"/>employee, or agent of a governmental entity for, or in anticipation of, litigation or a <ln numlevel="1" lineno="771" slineno="8-109"/>judicial, quasi-judicial, or administrative proceeding;</subsection><subsection ssid="5-null-45" dnum="19-o" numlevel="1" lineno="772" slineno="8-110" level="1" space="false"><display>(19)</display><subsection ssid="5-null-46" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="5-null-47" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>personal files of a state legislator, including personal correspondence to or <ln numlevel="1" lineno="773" slineno="8-111"/>from a member of the Legislature; and</subsection><subsection ssid="5-null-48" dnum="ii-o" numlevel="1" lineno="774" slineno="8-112" level="3" tab="1"><display>(ii)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-2-305(19)(a)(i)">(19)(a)(i)</xref>, correspondence that gives notice of <ln numlevel="1" lineno="775" slineno="8-113"/>legislative action or policy may not be classified as protected under this section; <ln numlevel="1" lineno="776" slineno="8-114"/>and</subsection></subsection><subsection ssid="5-null-49" dnum="b-o" numlevel="1" lineno="777" slineno="8-115" level="2" space="false"><display>(b)</display><subsection ssid="5-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>an internal communication that is part of the deliberative process in connection <ln numlevel="1" lineno="778" slineno="8-116"/>with the preparation of legislation between:<subsection ssid="5-null-51" dnum="A-o" numlevel="1" lineno="779" slineno="8-117" level="4" tab="1"><display>(A)</display>members of a legislative body;</subsection><subsection ssid="5-null-52" dnum="B-o" numlevel="1" lineno="780" slineno="8-118" level="4" tab="1"><display>(B)</display>a member of a legislative body and a member of the legislative body's staff; or</subsection><subsection ssid="5-null-53" dnum="C-o" numlevel="1" lineno="781" slineno="8-119" level="4" tab="1"><display>(C)</display>members of a legislative body's staff; and</subsection></subsection><subsection ssid="5-null-54" dnum="ii-o" numlevel="1" lineno="782" slineno="8-120" level="3"><display>(ii)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-2-305(19)(b)(i)">(19)(b)(i)</xref>, a communication that gives notice of <ln numlevel="1" lineno="783" slineno="8-121"/>legislative action or policy may not be classified as protected under this section;</subsection></subsection></subsection><subsection ssid="5-null-55" dnum="20-o" numlevel="1" lineno="784" slineno="8-122" level="1" space="false"><display>(20)</display><subsection ssid="5-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>records in the custody or control of the Office of Legislative Research and <ln numlevel="1" lineno="785" slineno="8-123"/>General Counsel, that, if disclosed, would reveal a particular legislator's <ln numlevel="1" lineno="786" slineno="8-124"/>contemplated legislation or contemplated course of action before the legislator has <ln numlevel="1" lineno="787" slineno="8-125"/>elected to support the legislation or course of action, or made the legislation or course <ln numlevel="1" lineno="788" slineno="8-126"/>of action public; and</subsection><subsection ssid="5-null-57" dnum="b-o" numlevel="1" lineno="789" slineno="8-127" level="2"><display>(b)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-2-305(20)(a)">(20)(a)</xref>, the form to request legislation submitted to the <ln numlevel="1" lineno="790" slineno="8-128"/>Office of Legislative Research and General Counsel is a public document unless a <ln numlevel="1" lineno="791" slineno="8-129"/>legislator asks that the records requesting the legislation be maintained as protected <ln numlevel="1" lineno="792" slineno="8-130"/>records until such time as the legislator elects to make the legislation or course of <ln numlevel="1" lineno="793" slineno="8-131"/>action public;</subsection></subsection><subsection ssid="5-null-58" dnum="21-o" numlevel="1" lineno="794" slineno="8-132" level="1"><display>(21)</display>a research request from a legislator to a legislative staff member and research findings <ln numlevel="1" lineno="795" slineno="8-133"/>prepared in response to the request;</subsection><subsection ssid="5-null-59" dnum="22-o" numlevel="1" lineno="796" slineno="8-134" level="1"><display>(22)</display>drafts, unless otherwise classified as public;</subsection><subsection ssid="5-null-60" dnum="23-o" numlevel="1" lineno="797" slineno="8-135" level="1"><display>(23)</display>records concerning a governmental entity's strategy about:<subsection ssid="5-null-61" dnum="a-o" numlevel="1" lineno="798" slineno="8-136" level="2"><display>(a)</display>collective bargaining; or</subsection><subsection ssid="5-null-62" dnum="b-o" numlevel="1" lineno="799" slineno="8-137" level="2"><display>(b)</display>imminent or pending litigation;</subsection></subsection><subsection ssid="5-null-63" dnum="24-o" numlevel="1" lineno="800" slineno="8-138" level="1"><display>(24)</display>records of investigations of loss occurrences and analyses of loss occurrences that may <ln numlevel="1" lineno="801" slineno="8-139"/>be covered by the Risk Management Fund, the Employers' Reinsurance Fund, the <ln numlevel="1" lineno="802" slineno="8-140"/>Uninsured Employers' Fund, or similar divisions in other governmental entities;</subsection><subsection ssid="5-null-64" dnum="25-o" numlevel="1" lineno="803" slineno="8-141" level="1"><display>(25)</display>records, other than personnel evaluations, that contain a personal recommendation <ln numlevel="1" lineno="804" slineno="8-142"/>concerning an individual if disclosure would constitute a clearly unwarranted invasion <ln numlevel="1" lineno="805" slineno="8-143"/>of personal privacy, or disclosure is not in the public interest;</subsection><subsection ssid="5-null-65" dnum="26-o" numlevel="1" lineno="806" slineno="8-144" level="1"><display>(26)</display>records that reveal the location of historic, prehistoric, paleontological, or biological <ln numlevel="1" lineno="807" slineno="8-145"/>resources that if known would jeopardize the security of those resources or of valuable <ln numlevel="1" lineno="808" slineno="8-146"/>historic, scientific, educational, or cultural information;</subsection><subsection ssid="5-null-66" dnum="27-o" numlevel="1" lineno="809" slineno="8-147" level="1"><display>(27)</display>records of independent state agencies if the disclosure of the records would conflict <ln numlevel="1" lineno="810" slineno="8-148"/>with the fiduciary obligations of the agency;</subsection><subsection ssid="5-null-67" dnum="28-o" numlevel="1" lineno="811" slineno="8-149" level="1"><display>(28)</display>records of an institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref> regarding <ln numlevel="1" lineno="812" slineno="8-150"/>tenure evaluations, appointments, applications for admissions, retention decisions, and <ln numlevel="1" lineno="813" slineno="8-151"/>promotions, which could be properly discussed in a meeting closed in accordance with <ln numlevel="1" lineno="814" slineno="8-152"/>Title <xref depth="1" refnumber="52-4">52, Chapter 4</xref>, Open and Public Meetings Act, provided that records of the final <ln numlevel="1" lineno="815" slineno="8-153"/>decisions about tenure, appointments, retention, promotions, or those students admitted, <ln numlevel="1" lineno="816" slineno="8-154"/>may not be classified as protected under this section;</subsection><subsection ssid="5-null-68" dnum="29-o" numlevel="1" lineno="817" slineno="8-155" level="1"><display>(29)</display>records of the governor's office, including budget recommendations, legislative <ln numlevel="1" lineno="818" slineno="8-156"/>proposals, and policy statements, that if disclosed would reveal the governor's <ln numlevel="1" lineno="819" slineno="8-157"/>contemplated policies or contemplated courses of action before the governor has <ln numlevel="1" lineno="820" slineno="8-158"/>implemented or rejected those policies or courses of action or made them public;</subsection><subsection ssid="5-null-69" dnum="30-o" numlevel="1" lineno="821" slineno="8-159" level="1"><display>(30)</display>records of the Office of the Legislative Fiscal Analyst relating to budget analysis, <ln numlevel="1" lineno="822" slineno="8-160"/>revenue estimates, and fiscal notes of proposed legislation before issuance of the final <ln numlevel="1" lineno="823" slineno="8-161"/>recommendations in these areas;</subsection><subsection ssid="5-null-70" dnum="31-o" numlevel="1" lineno="824" slineno="8-162" level="1"><display>(31)</display>records provided by the United States or by a government entity outside the state that <ln numlevel="1" lineno="825" slineno="8-163"/>are given to the governmental entity with a requirement that they be managed as <ln numlevel="1" lineno="826" slineno="8-164"/>protected records if the providing entity certifies that the record would not be subject to <ln numlevel="1" lineno="827" slineno="8-165"/>public disclosure if retained by it;</subsection><subsection ssid="5-null-71" dnum="32-o" numlevel="1" lineno="828" slineno="8-166" level="1"><display>(32)</display>transcripts, minutes, recordings, or reports of the closed portion of a meeting of a <ln numlevel="1" lineno="829" slineno="8-167"/>public body except as provided in Section <xref depth="3" refnumber="52-4-206">52-4-206</xref>;</subsection><subsection ssid="5-null-72" dnum="33-o" numlevel="1" lineno="830" slineno="8-168" level="1"><display>(33)</display>records that would reveal the contents of settlement negotiations but not including final <ln numlevel="1" lineno="831" slineno="8-169"/>settlements or empirical data to the extent that they are not otherwise exempt from <ln numlevel="1" lineno="832" slineno="8-170"/>disclosure;</subsection><subsection ssid="5-null-73" dnum="34-o" numlevel="1" lineno="833" slineno="8-171" level="1"><display>(34)</display>memoranda prepared by staff and used in the decision-making process by an <ln numlevel="1" lineno="834" slineno="8-172"/>administrative law judge, a member of the Board of Pardons and Parole, or a member of <ln numlevel="1" lineno="835" slineno="8-173"/>any other body charged by law with performing a quasi-judicial function;</subsection><subsection ssid="5-null-74" dnum="35-o" numlevel="1" lineno="836" slineno="8-174" level="1"><display>(35)</display>records that would reveal negotiations regarding assistance or incentives offered by or <ln numlevel="1" lineno="837" slineno="8-175"/>requested from a governmental entity for the purpose of encouraging a person to expand <ln numlevel="1" lineno="838" slineno="8-176"/>or locate a business in Utah, but only if disclosure would result in actual economic harm <ln numlevel="1" lineno="839" slineno="8-177"/>to the person or place the governmental entity at a competitive disadvantage, but this <ln numlevel="1" lineno="840" slineno="8-178"/>section may not be used to restrict access to a record evidencing a final contract;</subsection><subsection ssid="5-null-75" dnum="36-o" numlevel="1" lineno="841" slineno="8-179" level="1"><display>(36)</display>materials to which access must be limited for purposes of securing or maintaining the <ln numlevel="1" lineno="842" slineno="8-180"/>governmental entity's proprietary protection of intellectual property rights including <ln numlevel="1" lineno="843" slineno="8-181"/>patents, copyrights, and trade secrets;</subsection><subsection ssid="5-null-76" dnum="37-o" numlevel="1" lineno="844" slineno="8-182" level="1"><display>(37)</display>the name of a donor or a prospective donor to a governmental entity, including an <ln numlevel="1" lineno="845" slineno="8-183"/>institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, and other information <ln numlevel="1" lineno="846" slineno="8-184"/>concerning the donation that could reasonably be expected to reveal the identity of the <ln numlevel="1" lineno="847" slineno="8-185"/>donor, provided that:<subsection ssid="5-null-77" dnum="a-o" numlevel="1" lineno="848" slineno="8-186" level="2"><display>(a)</display>the donor requests anonymity in writing;</subsection><subsection ssid="5-null-78" dnum="b-o" numlevel="1" lineno="849" slineno="8-187" level="2"><display>(b)</display>any terms, conditions, restrictions, or privileges relating to the donation may not be <ln numlevel="1" lineno="850" slineno="8-188"/>classified protected by the governmental entity under this Subsection <xref depth="4" refnumber="63G-2-305(37)">(37)</xref>; and</subsection><subsection ssid="5-null-79" dnum="c-o" numlevel="1" lineno="851" slineno="8-189" level="2"><display>(c)</display>except for an institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, the <ln numlevel="1" lineno="852" slineno="8-190"/>governmental unit to which the donation is made is primarily engaged in educational, <ln numlevel="1" lineno="853" slineno="8-191"/>charitable, or artistic endeavors, and has no regulatory or legislative authority over <ln numlevel="1" lineno="854" slineno="8-192"/>the donor, a member of the donor's immediate family, or any entity owned or <ln numlevel="1" lineno="855" slineno="8-193"/>controlled by the donor or the donor's immediate family;</subsection></subsection><subsection ssid="5-null-80" dnum="38-o" numlevel="1" lineno="856" slineno="8-194" level="1"><display>(38)</display>accident reports, except as provided in Sections <xref depth="3" refnumber="41-6a-404">41-6a-404</xref>, <xref depth="3" refnumber="41-12a-202">41-12a-202</xref>, and <xref depth="3" refnumber="73-18-13">73-18-13</xref>;</subsection><subsection ssid="5-null-81" dnum="39-o" numlevel="1" lineno="857" slineno="8-195" level="1"><display>(39)</display>a notification of workers' compensation insurance coverage described in Section <xref depth="3" refnumber="34A-2-205"><ln numlevel="1" lineno="858" slineno="8-196"/>34A-2-205</xref>;</subsection><subsection ssid="5-null-82" dnum="40-o" numlevel="1" lineno="859" slineno="8-197" level="1"><display>(40)</display>subject to Subsections <xref provide detail as to the location of an explosive, including a map or other <ln numlevel="1" lineno="886" slineno="8-224"/>document that indicates the location of:<subsection ssid="5-null-99" dnum="a-o" numlevel="1" lineno="887" slineno="8-225" level="2"><display>(a)</display>a production facility; or</subsection><subsection ssid="5-null-100" dnum="b-o" numlevel="1" lineno="888" refnumber="41-1a-116">41-1a-116</xref>, an individual's home address, home telephone number, or <ln numlevel="1" lineno="923" slineno="8-261"/>personal mobile phone number, if:<subsection ssid="5-null-117" dnum="a-o" numlevel="1" lineno="924" slineno="8-262" level="2"><display>(a)</display>the individual is required to provide the information in order to comply with a law, <ln <ln numlevel="1" lineno="964" slineno="8-302"/>or allegation cannot be corroborated by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="965" slineno="8-303"/>Services through other documents or evidence, and the records relating to the <ln numlevel="1" lineno="966" slineno="8-304"/>allegation are not relied upon by the Office of Inspector General of Medicaid <ln numlevel="1" entity of the United States, if the <ln numlevel="1" lineno="973" slineno="8-311"/>information was disclosed on the condition that the identity of the person be <ln numlevel="1" lineno="974" slineno="8-312"/>protected;</subsection><subsection ssid="5-null-138" dnum="c-o" numlevel="1" lineno="975" slineno="8-313" level="2"><display>(c)</display>before the time that an investigation or audit is completed and the final investigation <ln numlevel="1" lineno="976" slineno="8-314"/>or final audit report is released, records or drafts circulated to a person who is not an <ln numlevel="1" lineno="977" slineno="8-315"/>employee or head of a governmental entity for the person's response or information;</subsection><subsection ssid="5-null-139" dnum="d-o" numlevel="1" lineno="978" slineno="8-316" level="2"><display>(d)</display>records that would disclose an outline or part of any investigation, audit survey plan, <ln numlevel="1" lineno="979" slineno="8-317"/>or audit program; or</subsection><subsection ssid="5-null-140" dnum="e-o" numlevel="1" lineno="980" slineno="8-318" level="2"><display>(e)</display>requests for an investigation or audit, if disclosure would risk circumvention of an <ln numlevel="1" lineno="981" slineno="8-319"/>investigation or audit;</subsection></subsection><subsection ssid="5-null-141" dnum="60-o" numlevel="1" lineno="982" slineno="8-320" lineno="992" slineno="8-330"/>Section <xref depth="3" refnumber="77-7a-103">77-7a-103</xref>, that records sound or images inside a hospital or health care facility <ln numlevel="1" lineno="993" slineno="8-331"/>as those terms are defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, inside a clinic of a health care provider, <ln numlevel="1" lineno="994" slineno="8-332"/>as that term is defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, or inside a human service program as that <ln numlevel="1" lineno="995" slineno="8-333"/>term is defined in Section <xref depth="3" refnumber="26B-2-101">26B-2-101</xref>, except for recordings that:<subsection ssid="5-null-146" dnum="a-o" numlevel="1" lineno="996" slineno="8-334" level="2"><display>(a)</display>depict the commission of an alleged crime;</subsection><subsection ssid="5-null-147" dnum="b-o" numlevel="1" lineno="997" slineno="8-335" level="2"><display>(b)</display>record any encounter between a law enforcement officer and a person that results in <ln numlevel="1" lineno="998" slineno="8-336"/>death or bodily injury, or includes an instance when an officer fires a weapon;</subsection><subsection ssid="5-null-148" dnum="c-o" numlevel="1" lineno="999" slineno="8-337" level="2"><display>(c)</display>record any encounter that is dnum="d-o" numlevel="1" lineno="1001" slineno="8-339" level="2"><display>(d)</display>contain an officer involved critical incident as defined in Subsection <xref depth="4" refnumber="76-2-408(1)(f)">76-2-408(1)(f)</xref>; <ln numlevel="1" lineno="1002" slineno="8-340"/>or</subsection><subsection ssid="5-null-150" dnum="e-o" numlevel="1" lineno="1003" slineno="8-341" level="2"><display>(e)</display>have been requested for reclassification as a public record by a subject or authorized <ln numlevel="1" lineno="1004" slineno="8-342"/>agent of a subject featured in the recording;</subsection></subsection><subsection ssid="5-null-151" dnum="65-o" numlevel="1" lineno="1005" slineno="8-343" level="1"><display>(65)</display>a record pertaining to the search process for a president of an institution of higher <ln numlevel="1" lineno="1006" slineno="8-344"/>education described in Section <xref depth="3" refnumber="53H-3-302">53H-3-302</xref>;</subsection><subsection ssid="5-null-152" dnum="66-o" numlevel="1" lineno="1007" slineno="8-345" level="1"><display>(66)</display>an audio recording that is:<subsection ssid="5-null-153" dnum="a-o" numlevel="1" lineno="1008" slineno="8-346" level="2"><display>(a)</display>produced by an audio recording device that is used in conjunction with a device or <ln numlevel="1" lineno="1009" slineno="8-347"/>piece of equipment designed or intended for resuscitating an individual or for treating <ln numlevel="1" lineno="1010" slineno="8-348"/>an individual with a life-threatening condition;</subsection><subsection ssid="5-null-154" dnum="b-o" numlevel="1" lineno="1011" slineno="8-349" level="2"><display>(b)</display>produced during an emergency event when an individual employed to provide law <ln numlevel="1" lineno="1012" slineno="8-350"/>enforcement, fire protection, paramedic, emergency medical, or other first responder <ln numlevel="1" lineno="1013" slineno="8-351"/>service:<subsection ssid="5-null-155" dnum="i-o" numlevel="1" lineno="1014" slineno="8-352" level="3"><display>(i)</display>is responding to an individual needing resuscitation or with a life-threatening <ln numlevel="1" lineno="1015" slineno="8-353"/>condition; and</subsection><subsection ssid="5-null-156" dnum="ii-o" numlevel="1" lineno="1016" slineno="8-354" level="3"><display>(ii)</display>uses a device or piece of equipment designed or intended for resuscitating an <ln numlevel="1" lineno="1017" slineno="8-355"/>individual or for treating an individual with a life-threatening condition; and</subsection></subsection><subsection ssid="5-null-157" dnum="c-o" numlevel="1" lineno="1018" slineno="8-356" level="2"><display>(c)</display>intended and used for purposes of training emergency responders how to improve <ln numlevel="1" lineno="1019" slineno="8-357"/>their response to an emergency situation;</subsection></subsection><subsection ssid="5-null-158" dnum="67-o" numlevel="1" lineno="1020" slineno="8-358" level="1"><display>(67)</display>records submitted by or prepared in relation to an applicant seeking a recommendation <ln numlevel="1" lineno="1021" slineno="8-359"/>by the Research and General Counsel Subcommittee, the Budget Subcommittee, or the <ln numlevel="1" lineno="1022" slineno="8-360"/>Legislative Audit defined in Section <xref depth="3" refnumber="63G-26-102">63G-26-102</xref>, to the extent disclosure is <ln numlevel="1" lineno="1051" slineno="8-389"/>prohibited under Section <xref depth="3" refnumber="63G-26-103">63G-26-103</xref>;</subsection><subsection ssid="5-null-176" dnum="80-o" numlevel="1" lineno="1052" slineno="8-390" level="1"><display>(80)</display>an image taken of an individual during the process of booking the individual into jail, <ln numlevel="1" lineno="1053" slineno="8-391"/>unless:<subsection ssid="5-null-177" dnum="a-o" numlevel="1" lineno="1054" slineno="8-392" level="2"><display>(a)</display>the individual is convicted of a criminal offense based upon the conduct for which <ln numlevel="1" lineno="1055" slineno="8-393"/>the individual was incarcerated at the time the image was taken;</subsection><subsection ssid="5-null-178" dnum="b-o" numlevel="1" lineno="1056" slineno="8-394" level="2"><display>(b)</display>a law enforcement agency releases or disseminates the image:<subsection ssid="5-null-179" dnum="i-o" numlevel="1" lineno="1057" slineno="8-395" level="3"><display>(i)</display>after determining that  the individual is a fugitive or an imminent threat to an <ln numlevel="1" lineno="1058" slineno="8-396"/>individual or to public safety and releasing or disseminating the image will assist <ln numlevel="1" lineno="1059" slineno="8-397"/>in apprehending the individual or reducing or eliminating the threat; or</subsection><subsection ssid="5-null-180" dnum="ii-o" numlevel="1" lineno="1060" slineno="8-398" level="3"><display>(ii)</display>to a potential witness or other individual with direct knowledge of events relevant <ln numlevel="1" lineno="1061" slineno="8-399"/>to a criminal investigation or criminal proceeding for the purpose of identifying or <ln numlevel="1" lineno="1062" slineno="8-400"/>locating an individual in connection with the criminal investigation or criminal <ln numlevel="1" lineno="1063" slineno="8-401"/>proceeding;</subsection></subsection><subsection ssid="5-null-181" dnum="c-o" numlevel="1" lineno="1064" slineno="8-402" level="2"><display>(c)</display>a judge orders the release or dissemination of the image based on a finding that the <ln numlevel="1" lineno="1065" slineno="8-403"/>release or dissemination is in furtherance of a legitimate law enforcement interest; or</subsection><subsection ssid="5-null-182" dnum="d-o" numlevel="1" lineno="1066" slineno="8-404" level="2"><display>(d)</display>the image is displayed to a person who is permitted to view the image under Section <xref depth="3" refnumber="17-72-802"><ln numlevel="1" lineno="1067" slineno="8-405"/>17-72-802</xref>;</subsection></subsection><subsection ssid="5-null-183" dnum="81-o" numlevel="1" lineno="1068" slineno="8-406" level="1"><display>(81)</display>a record:<subsection ssid="5-null-184" dnum="a-o" numlevel="1" lineno="1069" slineno="8-407" level="2"><display>(a)</display>concerning an interstate claim to the use of waters in the Colorado River system;</subsection><subsection ssid="5-null-185" dnum="b-o" numlevel="1" lineno="1070" slineno="8-408" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="1071" slineno="8-409"/>representative from another state or the federal government as provided in Section <xref depth="3" refnumber="63M-14-205"><ln numlevel="1" lineno="1072" slineno="8-410"/>63M-14-205</xref>; and</subsection><subsection ssid="5-null-186" dnum="c-o" numlevel="1" lineno="1073" slineno="8-411" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="5-null-187" dnum="i-o" numlevel="1" lineno="1074" slineno="8-412" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="1075" slineno="8-413"/>Colorado River system;</subsection><subsection ssid="5-null-188" dnum="ii-o" numlevel="1" lineno="1076" slineno="8-414" level="3"><display>(ii)</display>harm the ability of the Colorado River Authority of Utah or river commissioner to <ln numlevel="1" lineno="1077" slineno="8-415"/>negotiate the best terms and conditions regarding the use of water in the Colorado <ln numlevel="1" lineno="1078" slineno="8-416"/>River system; or</subsection><subsection ssid="5-null-189" dnum="iii-o" numlevel="1" lineno="1079" slineno="8-417" level="3"><display>(iii)</display>give an advantage to another state or to the federal government in negotiations <ln numlevel="1" lineno="1080" slineno="8-418"/>regarding the use of water in the Colorado River system;</subsection></subsection></subsection><subsection ssid="5-null-190" dnum="82-o" numlevel="1" lineno="1081" slineno="8-419" level="1"><display>(82)</display>any part of an application described in Section <xref depth="3" refnumber="63N-16-201">63N-16-201</xref> that the Governor's Office <ln numlevel="1" lineno="1082" slineno="8-420"/>of Economic Opportunity determines is nonpublic, confidential information that if <ln numlevel="1" lineno="1083" slineno="8-421"/>disclosed would result in actual economic harm to the applicant, but this Subsection <xref depth="4" refnumber="63G-2-305(82)">(82)</xref> <ln numlevel="1" lineno="1084" slineno="8-422"/>may not be used to restrict access to a record evidencing a final contract or approval <ln numlevel="1" lineno="1085" slineno="8-423"/>decision;</subsection><subsection ssid="5-null-191" dnum="83-o" numlevel="1" lineno="1086" slineno="8-424" level="1"><display>(83)</display>the following records of a drinking water or wastewater facility:<subsection ssid="5-null-192" dnum="a-o" numlevel="1" lineno="1087" slineno="8-425" level="2"><display>(a)</display>an engineering or architectural drawing of the drinking water or wastewater facility; <ln numlevel="1" lineno="1088" slineno="8-426"/>and</subsection><subsection ssid="5-null-193" dnum="b-o" numlevel="1" lineno="1089" slineno="8-427" level="2"><display>(b)</display>except as provided in Section <xref depth="3" refnumber="63G-2-106">63G-2-106</xref>, a record detailing tools or processes the <ln numlevel="1" lineno="1090" slineno="8-428"/>drinking water or wastewater facility uses to secure, or prohibit access to, the records <ln numlevel="1" lineno="1091" slineno="8-429"/>described in Subsection <xref depth="4" refnumber="63G-2-305(83)(a)">(83)(a)</xref>;</subsection></subsection><subsection ssid="5-null-194" dnum="84-o" numlevel="1" lineno="1092" slineno="8-430" level="1"><display>(84)</display>a statement that an employee of a governmental entity provides to the governmental <ln numlevel="1" lineno="1093" slineno="8-431"/>entity as part of the governmental entity's personnel or administrative investigation into <ln numlevel="1" lineno="1094" slineno="8-432"/>potential misconduct involving the employee if the governmental entity:<subsection ssid="5-null-195" dnum="a-o" numlevel="1" lineno="1095" slineno="8-433" level="2"><display>(a)</display>requires the statement under threat of employment disciplinary action, including <ln numlevel="1" lineno="1096" slineno="8-434"/>possible termination of employment, for the employee's refusal to provide the <ln numlevel="1" lineno="1097" slineno="8-435"/>statement; and</subsection><subsection ssid="5-null-196" dnum="b-o" numlevel="1" lineno="1098" slineno="8-436" level="2"><display>(b)</display>provides the employee assurance that the statement cannot be used against the <ln numlevel="1" lineno="1099" slineno="8-437"/>employee in any criminal proceeding;</subsection></subsection><subsection ssid="5-null-197" dnum="85-o" numlevel="1" lineno="1100" slineno="8-438" level="1"><display>(85)</display>any part of an application for a Utah Fits All Scholarship account described in Section <xref depth="3" refnumber="53F-6-402"><ln numlevel="1" lineno="1101" slineno="8-439"/>53F-6-402</xref> or other information identifying a scholarship student as defined in Section <xref depth="3" refnumber="53F-6-401"><ln numlevel="1" lineno="1102" slineno="8-440"/>53F-6-401</xref>; </subsection><subsection ssid="5-null-198" dnum="86-o" numlevel="1" lineno="1103" slineno="8-441" level="1"><display>(86)</display>a record:<subsection ssid="5-null-199" dnum="a-o" numlevel="1" lineno="1104" slineno="8-442" level="2"><display>(a)</display>concerning a claim to the use of waters in the Great Salt Lake;</subsection><subsection ssid="5-null-200" dnum="b-o" numlevel="1" lineno="1105" slineno="8-443" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="1106" slineno="8-444"/>person concerning the claim, including a representative from another state or the <ln numlevel="1" lineno="1107" slineno="8-445"/>federal government; and</subsection><subsection ssid="5-null-201" dnum="c-o" numlevel="1" lineno="1108" slineno="8-446" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="5-null-202" dnum="i-o" numlevel="1" lineno="1109" slineno="8-447" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="1110" slineno="8-448"/>Great Salt Lake;</subsection><subsection ssid="5-null-203" dnum="ii-o" numlevel="1" lineno="1111" slineno="8-449" level="3"><display>(ii)</display>harm the ability of the Great Salt Lake commissioner to negotiate the best terms <ln numlevel="1" lineno="1112" slineno="8-450"/>and conditions regarding the use of water in the Great Salt Lake; or</subsection><subsection ssid="5-null-204" dnum="iii-o" numlevel="1" lineno="1113" slineno="8-451" level="3"><display>(iii)</display>give an advantage to another person including another state or to the federal <ln numlevel="1" lineno="1114" slineno="8-452"/>government in negotiations regarding the use of water in the Great Salt Lake;</subsection></subsection></subsection><subsection ssid="5-null-205" dnum="87-o" numlevel="1" lineno="1115" slineno="8-453" level="1"><display>(87)</display>a consumer complaint described in Section <xref depth="3" refnumber="13-2-11">13-2-11</xref>, unless the consumer complaint is <ln numlevel="1" lineno="1116" slineno="8-454"/>reclassified as public as described in Subsection <xref depth="4" refnumber="13-2-11(4)">13-2-11(4)</xref>;</subsection><subsection ssid="5-null-206" dnum="88-o" numlevel="1" lineno="1117" slineno="8-455" level="1"><display>(88)</display>a record of the Utah water agent, appointed under Section <xref depth="3" refnumber="73-10g-702">73-10g-702</xref>:<subsection ssid="5-null-207" dnum="a-o" numlevel="1" lineno="1118" slineno="8-456" level="2"><display>(a)</display>concerning a claim to the use of waters;</subsection><subsection ssid="5-null-208" dnum="b-o" numlevel="1" lineno="1119" slineno="8-457" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="1120" slineno="8-458"/>representative from another state, a tribe, the federal government, or other <ln numlevel="1" lineno="1121" slineno="8-459"/>government entity as provided in <xref depth="2" refnumber="73-10g-7">Title </xref>73, Ch<xref depth="2" refnumber="63G-10g-7">apter </xref>10g, Part 7, Utah Water Agent; <ln numlevel="1" lineno="1122" slineno="8-460"/>and</subsection><subsection ssid="5-null-209" dnum="c-o" numlevel="1" lineno="1123" slineno="8-461" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="5-null-210" dnum="i-o" numlevel="1" lineno="1124" slineno="8-462" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water;</subsection><subsection ssid="5-null-211" dnum="ii-o" numlevel="1" lineno="1125" slineno="8-463" level="3"><display>(ii)</display>harm the ability of the Utah water agent to negotiate the best terms and conditions <ln numlevel="1" lineno="1126" slineno="8-464"/>regarding the use of water; or</subsection><subsection ssid="5-null-212" dnum="iii-o" numlevel="1" lineno="1127" slineno="8-465" level="3"><display>(iii)</display>give an advantage to another state, a tribe, the federal government, or other <ln numlevel="1" lineno="1128" slineno="8-466"/>government entity in negotiations regarding the use of water; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="5-null-213" dnum="89-o" numlevel="1" lineno="1129" slineno="8-467" level="1"><display>(89)</display>a record created or maintained for an investigation of the Prosecutor Conduct <ln numlevel="1" lineno="1130" slineno="8-468"/>Commission, created in Section <xref depth="3" refnumber="63M-7-1102">63M-7-1102</xref>, that contains any personal identifying <ln numlevel="1" lineno="1131" slineno="8-469"/>information of a prosecuting attorney, including:<subsection ssid="5-null-214" dnum="a-o" numlevel="1" lineno="1132" slineno="8-470" level="2"><display>(a)</display>a complaint, or a document that is submitted or created for a complaint, received by <ln numlevel="1" lineno="1133" slineno="8-471"/>the Prosecutor Conduct Commission; or</subsection><subsection ssid="5-null-215" dnum="b-o" numlevel="1" lineno="1134" slineno="8-472" level="2"><display>(b)</display>a finding by the Prosecutor Conduct Commission<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="5-216" dnum="_-o:90-i" numlevel="1" lineno="1135" slineno="8-473" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1596" style="1" owner="i" level="1" amendtag="start">(90)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">personally identifiable information, including individual student enrollment, <ln numlevel="1" lineno="1136" slineno="8-474"/>completion, employment, and earnings data, that the Utah Board of Higher Education <ln numlevel="1" lineno="1137" slineno="8-475"/>obtains under Section <xref depth="3" refnumber="53B-11-416">53B-11-416</xref>, except that the Utah Board of Higher Education may <ln numlevel="1" lineno="1138"
