Definitions.</bold></catline><sectionText lineno="27"><tab/>As used in this chapter:</sectionText><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1"><display>(1)</display>"Alley" means a street or highway intended to provide access to the rear or side of lots <ln numlevel="1" lineno="29" slineno="1-5"/>or buildings in urban districts and not intended for through vehicular traffic.</subsection><subsection ssid="13-null-2" dnum="2-o" numlevel="1" lineno="30" slineno="1-6" level="1"><display>(2)</display>"All-terrain type I vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="13-null-3" dnum="3-o" numlevel="1" lineno="31" slineno="1-7" level="1"><display>(3)</display>"All-terrain type II vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="13-null-4" dnum="4-o" numlevel="1" lineno="32" slineno="1-8" level="1"><display>(4)</display>"All-terrain type III vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="13-null-5" dnum="5-o" numlevel="1" lineno="33" slineno="1-9" level="1"><display>(5)</display>"Authorized emergency vehicle" includes:<subsection ssid="13-null-6" dnum="a-o" numlevel="1" lineno="34" slineno="1-10" level="2"><display>(a)</display>a fire department vehicle;</subsection><subsection ssid="13-null-7" dnum="b-o" numlevel="1" lineno="35" slineno="1-11" level="2"><display>(b)</display>a police vehicle;</subsection><subsection ssid="13-null-8" dnum="c-o" numlevel="1" lineno="36" slineno="1-12" level="2"><display>(c)</display>an ambulance; and</subsection><subsection ssid="13-null-9" dnum="d-o" numlevel="1" lineno="37" slineno="1-13" level="2"><display>(d)</display>other publicly or privately owned vehicles as designated by the commissioner of the <ln numlevel="1" lineno="38" slineno="1-14"/>Department of Public Safety.</subsection></subsection><subsection ssid="13-null-10" dnum="6-o" numlevel="1" lineno="39" slineno="1-15" level="1"><display>(6)</display>"Autocycle" means the same as that term is defined in Section <xref depth="3" refnumber="53-3-102">53-3-102</xref>.</subsection><subsection ssid="13-null-11" dnum="7-o" numlevel="1" lineno="40" slineno="1-16" level="1" space="false"><display>(7)</display><subsection ssid="13-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Bicycle" means a wheeled vehicle:<subsection ssid="13-null-13" dnum="i-o" numlevel="1" lineno="41" slineno="1-17" level="3" tab="1"><display>(i)</display>propelled by human power by feet or hands acting upon pedals or cranks;</subsection><subsection ssid="13-null-14" dnum="ii-o" numlevel="1" lineno="42" slineno="1-18" level="3" tab="1"><display>(ii)</display>with a seat or saddle designed for the use of the operator;</subsection><subsection ssid="13-null-15" dnum="iii-o" numlevel="1" lineno="43" slineno="1-19" level="3" tab="1"><display>(iii)</display>designed to be operated on the ground; and</subsection><subsection ssid="13-null-16" dnum="iv-o" numlevel="1" lineno="44" slineno="1-20" level="3" tab="1"><display>(iv)</display>whose wheels are not less than 14 inches in diameter.</subsection></subsection><subsection ssid="13-null-17" dnum="b-o" numlevel="1" lineno="45" slineno="1-21" level="2"><display>(b)</display>"Bicycle" includes an electric assisted bicycle.</subsection><subsection ssid="13-null-18" dnum="c-o" numlevel="1" lineno="46" slineno="1-22" level="2"><display>(c)</display>"Bicycle" does not include scooters and similar devices.</subsection></subsection><subsection ssid="13-null-19" dnum="8-o" numlevel="1" lineno="47" slineno="1-23" level="1" space="false"><display>(8)</display><subsection ssid="13-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Bicycle lane" means a portion of a highway that has been designated by a <ln numlevel="1" lineno="48" slineno="1-24"/>highway authority through striping, signage, pavement markings, or barriers for the <ln numlevel="1" lineno="49" slineno="1-25"/>preferential or exclusive use of bicycle, electric assisted bicycle, and motor assisted <ln numlevel="1" lineno="50" slineno="1-26"/>scooter traffic.</subsection><subsection ssid="13-null-21" dnum="b-o" numlevel="1" lineno="51" slineno="1-27" level="2"><display>(b)</display>"Bicycle lane" does not include shared lanes intended for both motor vehicle and <ln numlevel="1" lineno="52" slineno="1-28"/>bicycle travel.</subsection></subsection><subsection ssid="13-null-22" dnum="9-o" numlevel="1" lineno="53" slineno="1-29" level="1" space="false"><display>(9)</display><subsection ssid="13-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Bus" means a motor vehicle:<subsection ssid="13-null-24" dnum="i-o" numlevel="1" lineno="54" slineno="1-30" level="3" tab="1"><display>(i)</display>designed for carrying more than 15 passengers and used for the transportation of <ln numlevel="1" lineno="55" slineno="1-31"/>persons; or</subsection><subsection ssid="13-null-25" dnum="ii-o" numlevel="1" lineno="56" slineno="1-32" level="3" tab="1"><display>(ii)</display>designed and used for the transportation of persons for compensation.</subsection></subsection><subsection ssid="13-null-26" dnum="b-o" numlevel="1" lineno="57" slineno="1-33" level="2"><display>(b)</display>"Bus" does not include a taxicab.</subsection></subsection><subsection ssid="13-null-27" dnum="10-o" numlevel="1" lineno="58" slineno="1-34" level="1" space="false"><display>(10)</display><subsection ssid="13-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Circular intersection" means an intersection that has an island, generally <ln numlevel="1" lineno="59" slineno="1-35"/>circular in design, located in the center of the intersection where traffic passes to the <ln numlevel="1" lineno="60" slineno="1-36"/>right of the island.</subsection><subsection ssid="13-null-29" dnum="b-o" numlevel="1" lineno="61" slineno="1-37" level="2"><display>(b)</display>"Circular intersection" includes:<subsection ssid="13-null-30" dnum="i-o" numlevel="1" lineno="62" slineno="1-38" level="3"><display>(i)</display>roundabouts;</subsection><subsection ssid="13-null-31" dnum="ii-o" numlevel="1" lineno="63" slineno="1-39" level="3"><display>(ii)</display>rotaries; and</subsection><subsection ssid="13-null-32" dnum="iii-o" numlevel="1" lineno="64" slineno="1-40" level="3"><display>(iii)</display>traffic circles.</subsection></subsection></subsection><subsection ssid="13-null-33" dnum="11-o" numlevel="1" lineno="65" slineno="1-41" level="1"><display>(11)</display>"Class 1 electric assisted bicycle" means an electric assisted bicycle equipped with a <ln numlevel="1" lineno="66" slineno="1-42"/>motor or electronics that:<subsection ssid="13-null-34" dnum="a-o" numlevel="1" lineno="67" slineno="1-43" level="2"><display>(a)</display>provides assistance only when the rider is pedaling; and</subsection><subsection ssid="13-null-35" dnum="b-o" numlevel="1" lineno="68" slineno="1-44" level="2"><display>(b)</display>ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour.</subsection></subsection><subsection ssid="13-null-36" dnum="12-o" numlevel="1" lineno="69" slineno="1-45" level="1"><display>(12)</display>"Class 2 electric assisted bicycle" means an electric assisted bicycle equipped with a <ln numlevel="1" lineno="70" slineno="1-46"/>motor or electronics that:<subsection ssid="13-null-37" dnum="a-o" numlevel="1" lineno="71" slineno="1-47" level="2"><display>(a)</display>may be used exclusively to propel the bicycle; and</subsection><subsection ssid="13-null-38" dnum="b-o" numlevel="1" lineno="72" slineno="1-48" level="2"><display>(b)</display>is not capable of providing assistance when the bicycle reaches the speed of 20 miles <ln numlevel="1" lineno="73" slineno="1-49"/>per hour.</subsection></subsection><subsection ssid="13-null-39" dnum="13-o" numlevel="1" lineno="74" slineno="1-50" level="1"><display>(13)</display>"Class 3 electric assisted bicycle" means an electric assisted bicycle equipped with a <ln numlevel="1" lineno="75" slineno="1-51"/>motor or electronics that:<subsection ssid="13-null-40" dnum="a-o" numlevel="1" lineno="76" slineno="1-52" level="2"><display>(a)</display>provides assistance only when the rider is pedaling;</subsection><subsection ssid="13-null-41" dnum="b-o" numlevel="1" lineno="77" slineno="1-53" level="2"><display>(b)</display>ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour; <ln numlevel="1" lineno="78" slineno="1-54"/>and</subsection><subsection ssid="13-null-42" dnum="c-o" numlevel="1" lineno="79" slineno="1-55" level="2"><display>(c)</display>is equipped with a speedometer.</subsection></subsection><subsection ssid="13-null-43" dnum="14-o" numlevel="1" lineno="80" slineno="1-56" level="1"><display>(14)</display>"Commissioner" means the commissioner of the Department of Public Safety.</subsection><subsection ssid="13-null-44" dnum="15-o" numlevel="1" lineno="81" slineno="1-57" level="1"><display>(15)</display>"Controlled-access highway" means a highway, street, or roadway:<subsection ssid="13-null-45" dnum="a-o" numlevel="1" lineno="82" slineno="1-58" level="2"><display>(a)</display>designed primarily for through traffic; and</subsection><subsection ssid="13-null-46" dnum="b-o" numlevel="1" lineno="83" slineno="1-59" level="2"><display>(b)</display>to or from which owners or occupants of abutting lands and other persons have no <ln numlevel="1" lineno="84" slineno="1-60"/>legal right of access, except at points as determined by the highway authority having <ln numlevel="1" lineno="85" slineno="1-61"/>jurisdiction over the highway, street, or roadway.</subsection></subsection><subsection ssid="13-null-47" dnum="16-o" numlevel="1" lineno="86" slineno="1-62" level="1"><display>(16)</display>"Crosswalk" means:<subsection ssid="13-null-48" dnum="a-o" numlevel="1" lineno="87" slineno="1-63" level="2"><display>(a)</display>that part of a roadway at an intersection included within the connections of the lateral <ln numlevel="1" lineno="88" slineno="1-64"/>lines of the sidewalks on opposite sides of the highway measured from:<subsection ssid="13-null-49" dnum="i-o" numlevel="1" lineno="89" slineno="1-65" level="3" space="false"><display>(i)</display><subsection ssid="13-null-50" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the curbs; or</subsection><subsection ssid="13-null-51" dnum="B-o" numlevel="1" lineno="90" slineno="1-66" level="4"><display>(B)</display>in the absence of curbs, from the edges of the traversable roadway; and</subsection></subsection><subsection ssid="13-null-52" dnum="ii-o" numlevel="1" lineno="91" slineno="1-67" level="3"><display>(ii)</display>in the absence of a sidewalk on one side of the roadway, that part of a roadway <ln numlevel="1" lineno="92" slineno="1-68"/>included within the extension of the lateral lines of the existing sidewalk at right <ln numlevel="1" lineno="93" slineno="1-69"/>angles to the centerline; or</subsection></subsection><subsection ssid="13-null-53" dnum="b-o" numlevel="1" lineno="94" slineno="1-70" level="2"><display>(b)</display>any portion of a roadway at an intersection or elsewhere distinctly indicated for <ln numlevel="1" lineno="95" slineno="1-71"/>pedestrian crossing by lines or other markings on the surface.</subsection></subsection><subsection ssid="13-null-54" dnum="17-o" numlevel="1" lineno="96" slineno="1-72" level="1"><display>(17)</display>"Department" means the Department of Public Safety.</subsection><subsection ssid="13-null-55" dnum="18-o" numlevel="1" lineno="97" slineno="1-73" level="1"><display>(18)</display>"Direct supervision" means oversight at a distance within which:<subsection ssid="13-null-56" dnum="a-o" numlevel="1" lineno="98" slineno="1-74" level="2"><display>(a)</display>visual contact is maintained; and</subsection><subsection ssid="13-null-57" dnum="b-o" numlevel="1" lineno="99" slineno="1-75" level="2"><display>(b)</display>advice and assistance can be given and received.</subsection></subsection><subsection ssid="13-null-58" dnum="19-o" numlevel="1" lineno="100" slineno="1-76" level="1"><display>(19)</display>"Divided highway" means a highway divided into two or more roadways by:<subsection ssid="13-null-59" dnum="a-o" numlevel="1" lineno="101" slineno="1-77" level="2"><display>(a)</display>an unpaved intervening space;</subsection><subsection ssid="13-null-60" dnum="b-o" numlevel="1" lineno="102" slineno="1-78" level="2"><display>(b)</display>a physical barrier; or</subsection><subsection ssid="13-null-61" dnum="c-o" numlevel="1" lineno="103" slineno="1-79" level="2"><display>(c)</display>a clearly indicated dividing section constructed to impede vehicular traffic.</subsection></subsection><subsection ssid="13-null-62" dnum="20-o" numlevel="1" lineno="104" slineno="1-80" level="1"><display>(20)</display>"Echelon formation" means the operation of two or more snowplows arranged <ln numlevel="1" lineno="105" slineno="1-81"/>side-by-side or diagonally across multiple lanes of traffic of a multi-lane highway to <ln numlevel="1" lineno="106" slineno="1-82"/>clear snow from two or more lanes at once.</subsection><subsection ssid="13-null-63" dnum="21-o" numlevel="1" lineno="107" slineno="1-83" level="1" space="false"><display>(21)</display><subsection ssid="13-null-64" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Electric assisted bicycle" means a bicycle with an electric motor that:<subsection ssid="13-null-65" dnum="i-o" numlevel="1" lineno="108" slineno="1-84" level="3" tab="1"><display>(i)</display>has a power output of not more than 750 watts;</subsection><subsection ssid="13-null-66" dnum="ii-o" numlevel="1" lineno="109" slineno="1-85" level="3" tab="1"><display>(ii)</display>has fully operable pedals;</subsection><subsection ssid="13-null-67" dnum="iii-o" numlevel="1" lineno="110" slineno="1-86" level="3" tab="1"><display>(iii)</display>has permanently affixed cranks that were installed at the time of the original <ln numlevel="1" lineno="111" slineno="1-87"/>manufacture;</subsection><subsection ssid="13-null-68" dnum="iv-o" numlevel="1" lineno="112" slineno="1-88" level="3" tab="1"><display>(iv)</display>is fully operable as a bicycle without the use of the electric motor; and</subsection><subsection ssid="13-null-69" dnum="v-o" numlevel="1" lineno="113" slineno="1-89" level="3" tab="1"><display>(v)</display>is one of the following:<subsection ssid="13-null-70" dnum="A-o" numlevel="1" lineno="114" slineno="1-90" level="4"><display>(A)</display>a class 1 electric assisted bicycle;</subsection><subsection ssid="13-null-71" dnum="B-o" numlevel="1" lineno="115" slineno="1-91" level="4"><display>(B)</display>a class 2 electric assisted bicycle;</subsection><subsection ssid="13-null-72" dnum="C-o" numlevel="1" lineno="116" slineno="1-92" level="4"><display>(C)</display>a class 3 electric assisted bicycle; or</subsection><subsection ssid="13-null-73" dnum="D-o" numlevel="1" lineno="117" slineno="1-93" level="4"><display>(D)</display>a programmable electric assisted bicycle.</subsection></subsection></subsection><subsection ssid="13-null-74" dnum="b-o" numlevel="1" lineno="118" slineno="1-94" level="2"><display>(b)</display>"Electric assisted bicycle" does not include:<subsection ssid="13-null-75" dnum="i-o" numlevel="1" lineno="119" slineno="1-95" level="3"><display>(i)</display>a moped;</subsection><subsection ssid="13-null-76" dnum="ii-o" numlevel="1" lineno="120" slineno="1-96" level="3"><display>(ii)</display>a motor assisted scooter;</subsection><subsection ssid="13-null-77" dnum="iii-o" numlevel="1" lineno="121" slineno="1-97" level="3"><display>(iii)</display>a motorcycle;</subsection><subsection ssid="13-null-78" dnum="iv-o" numlevel="1" lineno="122" slineno="1-98" level="3"><display>(iv)</display>a motor-driven cycle; or</subsection><subsection ssid="13-null-79" dnum="v-o" numlevel="1" lineno="123" slineno="1-99" level="3"><display>(v)</display>any other vehicle with less than four wheels that is designed, manufactured, <ln numlevel="1" lineno="124" slineno="1-100"/>intended, or advertised by the seller to have any of the following capabilities or <ln numlevel="1" lineno="125" slineno="1-101"/>features, or that is modifiable or is modified to have any of the following <ln numlevel="1" lineno="126" slineno="1-102"/>capabilities or features:<subsection ssid="13-null-80" dnum="A-o" numlevel="1" lineno="127" slineno="1-103" level="4"><display>(A)</display>has the ability to attain the speed of 20 miles per hour or greater on motor <ln numlevel="1" lineno="128" slineno="1-104"/>power alone;</subsection><subsection ssid="13-null-81" dnum="B-o" numlevel="1" lineno="129" slineno="1-105" level="4"><display>(B)</display>is equipped with a continuous rated motor power of 750 watts or greater;</subsection><subsection ssid="13-null-82" dnum="C-o" numlevel="1" lineno="130" slineno="1-106" level="4"><display>(C)</display>is equipped with foot pegs for the operator at the time of manufacture, or <ln numlevel="1" lineno="131" slineno="1-107"/>requires installation of a pedal kit to have operable pedals; or</subsection><subsection ssid="13-null-83" dnum="D-o" numlevel="1" lineno="132" slineno="1-108" level="4"><display>(D)</display>if equipped with multiple operating modes and a throttle, has one or more <ln numlevel="1" lineno="133" slineno="1-109"/>modes that exceed space="false"><display>(22)</display><subsection ssid="13-null-85" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Electric personal assistive mobility device" means a self-balancing device with:<subsection ssid="13-null-86" dnum="i-o" numlevel="1" lineno="135" slineno="1-111" level="3" tab="1"><display>(i)</display>two nontandem wheels in contact with the ground;</subsection><subsection ssid="13-null-87" dnum="ii-o" numlevel="1" lineno="136" slineno="1-112" level="3" tab="1"><display>(ii)</display>a system capable of steering and stopping the unit under typical operating <ln numlevel="1" lineno="137" slineno="1-113"/>conditions;</subsection><subsection ssid="13-null-88" dnum="iii-o" numlevel="1" lineno="138" slineno="1-114" level="3" tab="1"><display>(iii)</display>an electric propulsion system with average power of one horsepower or 750 <ln numlevel="1" lineno="139" slineno="1-115"/>watts;</subsection><subsection ssid="13-null-89" dnum="iv-o" numlevel="1" lineno="140" slineno="1-116" level="3" tab="1"><display>(iv)</display>a maximum speed capacity on a paved, level surface of 12.5 miles per hour; and</subsection><subsection ssid="13-null-90" dnum="v-o" numlevel="1" lineno="141" slineno="1-117" level="3" tab="1"><display>(v)</display>a deck design for a person to stand while operating the device.</subsection></subsection><subsection ssid="13-null-91" dnum="b-o" numlevel="1" lineno="142" slineno="1-118" level="2"><display>(b)</display>"Electric personal assistive mobility device" does not include a wheelchair.</subsection></subsection><subsection ssid="13-null-92" dnum="23-o" numlevel="1" lineno="143" slineno="1-119" level="1"><display>(23)</display>"Electric unicycle" means a self-balancing personal transportation device that:<subsection ssid="13-null-93" dnum="a-o" numlevel="1" lineno="144" slineno="1-120" level="2"><display>(a)</display>has a single wheel;</subsection><subsection ssid="13-null-94" dnum="b-o" numlevel="1" lineno="145" slineno="1-121" level="2"><display>(b)</display>is powered by an electric motor that utilizes gyroscopes and accelerometers to <ln numlevel="1" lineno="146" slineno="1-122"/>stabilize the rider; and</subsection><subsection ssid="13-null-95" dnum="c-o" numlevel="1" lineno="147" slineno="1-123" level="2"><display>(c)</display>is designed for the operator to face in the direction of travel while operating the <ln numlevel="1" lineno="148" slineno="1-124"/>device.</subsection></subsection><subsection ssid="13-null-96" dnum="24-o" numlevel="1" lineno="149" slineno="1-125" level="1"><display>(24)</display>"Explosives" means a chemical compound or mechanical mixture commonly used or <ln numlevel="1" lineno="150" slineno="1-126"/>intended for the purpose of producing an explosion and that contains any oxidizing and <ln numlevel="1" lineno="151" slineno="1-127"/>combustive units or other ingredients in proportions, quantities, or packing so that an <ln numlevel="1" lineno="152" slineno="1-128"/>ignition by fire, friction, concussion, percussion, or detonator of any part of the <ln numlevel="1" lineno="153" slineno="1-129"/>compound or mixture may cause a sudden generation of highly heated gases, and the <ln numlevel="1" lineno="154" slineno="1-130"/>resultant gaseous pressures are capable of producing destructive effects on contiguous <ln numlevel="1" lineno="155" slineno="1-131"/>objects or of causing death or serious bodily injury.</subsection><subsection ssid="13-null-97" dnum="25-o" numlevel="1" lineno="156" slineno="1-132" level="1"><display>(25)</display>"Farm tractor" means a motor vehicle designed and used primarily as a farm <ln numlevel="1" lineno="157" slineno="1-133"/>implement, for drawing plows, mowing machines, and other implements of husbandry.</subsection><subsection ssid="13-null-98" dnum="26-o" numlevel="1" lineno="158" slineno="1-134" level="1"><display>(26)</display>"Flammable liquid" means a liquid that has a flashpoint of 100 degrees F. or less, as <ln numlevel="1" lineno="159" slineno="1-135"/>determined by a Tagliabue or equivalent closed-cup test device.</subsection><subsection ssid="13-null-99" dnum="27-o" numlevel="1" lineno="160" slineno="1-136" level="1"><display>(27)</display>"Freeway" means a controlled-access highway that is part of the interstate system as <ln numlevel="1" lineno="161" slineno="1-137"/>defined in Section <xref depth="3" refnumber="72-1-102">72-1-102</xref>.</subsection><subsection ssid="13-null-100" dnum="28-o" numlevel="1" lineno="162" slineno="1-138" level="1" space="false"><display>(28)</display><subsection ssid="13-null-101" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Golf cart" means a device that:<subsection ssid="13-null-102" dnum="i-o" numlevel="1" lineno="163" slineno="1-139" level="3" tab="1"><display>(i)</display>is designed for transportation by players on a golf course;</subsection><subsection ssid="13-null-103" dnum="ii-o" numlevel="1" lineno="164" slineno="1-140" level="3" tab="1"><display>(ii)</display>has not less than three wheels in contact with the ground;</subsection><subsection ssid="13-null-104" dnum="iii-o" numlevel="1" lineno="165" slineno="1-141" level="3" tab="1"><display>(iii)</display>has an unladen weight of less than 1,800 pounds;</subsection><subsection ssid="13-null-105" dnum="iv-o" numlevel="1" lineno="166" slineno="1-142" level="3" tab="1"><display>(iv)</display>is designed to operate at low speeds; and</subsection><subsection ssid="13-null-106" dnum="v-o" numlevel="1" lineno="167" slineno="1-143" level="3" tab="1"><display>(v)</display>is designed to carry not more than six persons including the driver.</subsection></subsection><subsection ssid="13-null-107" dnum="b-o" numlevel="1" lineno="168" slineno="1-144" level="2"><display>(b)</display>"Golf cart" does not include:<subsection ssid="13-null-108" dnum="i-o" numlevel="1" lineno="169" slineno="1-145" level="3"><display>(i)</display>a low-speed vehicle or an off-highway vehicle;</subsection><subsection ssid="13-null-109" dnum="ii-o" numlevel="1" lineno="170" slineno="1-146" level="3"><display>(ii)</display>a motorized wheelchair;</subsection><subsection ssid="13-null-110" dnum="iii-o" numlevel="1" lineno="171" slineno="1-147" level="3"><display>(iii)</display>an electric personal assistive mobility device;</subsection><subsection ssid="13-null-111" dnum="iv-o" numlevel="1" lineno="172" slineno="1-148" level="3"><display>(iv)</display>an electric assisted bicycle;</subsection><subsection ssid="13-null-112" dnum="v-o" numlevel="1" lineno="173" slineno="1-149" level="3"><display>(v)</display>a motor assisted scooter;</subsection><subsection ssid="13-null-113" dnum="vi-o" numlevel="1" lineno="174" slineno="1-150" level="3"><display>(vi)</display>a personal delivery device, as defined in Section <xref depth="3" refnumber="41-6a-1119">41-6a-1119</xref>; or</subsection><subsection ssid="13-null-114" dnum="vii-o" numlevel="1" lineno="175" slineno="1-151" level="3"><display>(vii)</display>a mobile carrier, as defined in Section <xref depth="3" refnumber="41-6a-1120">41-6a-1120</xref>.</subsection></subsection></subsection><subsection ssid="13-null-115" dnum="29-o" numlevel="1" lineno="176" slineno="1-152" level="1"><display>(29)</display>"Gore area" means the area delineated by two solid white lines that is between a <ln numlevel="1" lineno="177" slineno="1-153"/>continuing lane of a through roadway and a lane used to enter or exit the continuing lane <ln numlevel="1" lineno="178" slineno="1-154"/>including similar areas between merging or splitting highways.</subsection><subsection ssid="13-null-116" dnum="30-o" numlevel="1" lineno="179" slineno="1-155" level="1"><display>(30)</display>"Gross weight" means the weight of a vehicle without a load plus the weight of any <ln numlevel="1" lineno="180" slineno="1-156"/>load on the vehicle.</subsection><subsection ssid="13-null-117" dnum="31-o" numlevel="1" lineno="181" slineno="1-157" level="1"><display>(31)</display>"Hi-rail vehicle" means a roadway maintenance vehicle that is:<subsection ssid="13-null-118" dnum="a-o" numlevel="1" lineno="182" slineno="1-158" level="2"><display>(a)</display>manufactured to meet Federal Motor Vehicle Safety Standards; and</subsection><subsection ssid="13-null-119" dnum="b-o" numlevel="1" lineno="183" slineno="1-159" level="2"><display>(b)</display>equipped with retractable flanged wheels that allow the vehicle to travel on a <ln numlevel="1" lineno="184" slineno="1-160"/>highway or railroad tracks.</subsection></subsection><subsection ssid="13-null-120" dnum="32-o" numlevel="1" lineno="185" slineno="1-161" level="1"><display>(32)</display>"Highway" means the entire width between property lines of every way or place of any <ln numlevel="1" lineno="186" slineno="1-162"/>nature when any part of it is open to the use of the public as a matter of right for <ln numlevel="1" lineno="187" slineno="1-163"/>vehicular travel.</subsection><subsection ssid="13-null-121" dnum="33-o" numlevel="1" lineno="188" slineno="1-164" level="1"><display>(33)</display>"Highway authority" means the same as that term is defined in Section <xref depth="3" refnumber="72-1-102">72-1-102</xref>.</subsection><subsection ssid="13-null-122" dnum="34-o" numlevel="1" lineno="189" slineno="1-165" level="1"><display>(34)</display>"Interdicted person" means the same as that term is defined in Section <xref depth="3" refnumber="32B-1-102">32B-1-102</xref>.</subsection><subsection ssid="13-null-123" dnum="35-o" numlevel="1" lineno="190" slineno="1-166" level="1" space="false"><display>(35)</display><subsection ssid="13-null-124" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Intersection" means the area embraced within the prolongation or connection of <ln numlevel="1" lineno="191" slineno="1-167"/>the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of <ln numlevel="1" lineno="192" slineno="1-168"/>two or more highways that join one another.</subsection><subsection ssid="13-null-125" dnum="b-o" numlevel="1" lineno="193" slineno="1-169" level="2"><display>(b)</display>Where a highway includes two roadways 30 feet or more apart:<subsection ssid="13-null-126" dnum="i-o" numlevel="1" lineno="194" slineno="1-170" level="3"><display>(i)</display>every crossing of each roadway of the divided highway by an intersecting <ln numlevel="1" lineno="195" slineno="1-171"/>highway is a separate intersection; and</subsection><subsection ssid="13-null-127" dnum="ii-o" numlevel="1" lineno="196" slineno="1-172" level="3"><display>(ii)</display>if the intersecting highway also includes two roadways 30 feet or more apart, then <ln numlevel="1" lineno="197" slineno="1-173"/>every crossing of two roadways of the highways is a separate intersection.</subsection></subsection><subsection ssid="13-null-128" dnum="c-o" numlevel="1" lineno="198" slineno="1-174" level="2"><display>(c)</display>"Intersection" does not include the junction of an alley with a street or highway.</subsection></subsection><subsection ssid="13-null-129" dnum="36-o" numlevel="1" lineno="199" slineno="1-175" level="1"><display>(36)</display>"Island" means an area between traffic lanes or at an intersection for control of vehicle <ln numlevel="1" lineno="200" slineno="1-176"/>movements or for pedestrian refuge designated by:<subsection ssid="13-null-130" dnum="a-o" numlevel="1" lineno="201" slineno="1-177" level="2"><display>(a)</display>pavement markings, which may include an area designated by two solid yellow lines <ln numlevel="1" lineno="202" slineno="1-178"/>surrounding the perimeter of the area;</subsection><subsection ssid="13-null-131" dnum="b-o" numlevel="1" lineno="203" slineno="1-179" level="2"><display>(b)</display>channelizing devices;</subsection><subsection ssid="13-null-132" dnum="c-o" numlevel="1" lineno="204" slineno="1-180" level="2"><display>(c)</display>curbs;</subsection><subsection ssid="13-null-133" dnum="d-o" numlevel="1" lineno="205" slineno="1-181" level="2"><display>(d)</display>pavement edges; or</subsection><subsection ssid="13-null-134" dnum="e-o" numlevel="1" lineno="206" slineno="1-182" level="2"><display>(e)</display>other devices.</subsection></subsection><subsection ssid="13-null-135" dnum="37-o" numlevel="1" lineno="207" slineno="1-183" level="1" space="false"><display>(37)</display><subsection ssid="13-null-136" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Lane filtering" means, when operating a motorcycle other than an slineno="1-188"/>act of riding a motorcycle between clearly marked lanes for traffic traveling in the <ln numlevel="1" lineno="213" slineno="1-189"/>same direction of travel while traffic is in motion.</subsection><subsection ssid="13-null-140" dnum="b-o" numlevel="1" lineno="214" slineno="1-190" level="2"><display>(b)</display>"Lane splitting" does not include lane filtering.</subsection></subsection><subsection ssid="13-null-141" dnum="39-o" numlevel="1" lineno="215" slineno="1-191" level="1"><display>(39)</display>"Law enforcement agency" means the same as lineno="219" slineno="1-195"/>been towed or removed to request and document the release of life essential items from <ln numlevel="1" lineno="220" slineno="1-196"/>the impounded or towed vehicle, vessel, or outboard motor.</amend></subsection><subsection ssid="13-null-142" dnum="40-o:41-i" numlevel="1" lineno="221" slineno="1-197" level="1"><display><amendoutstart style="2"/><amend anum="0" level="2"><display>(b)</display>"Low-speed vehicle" does not include a golfcart or an off-highway vehicle.</subsection></subsection><subsection ssid="13-null-151" dnum="43-o:44-i" numlevel="1" level="3"><display>(i)</display>designed for off-highway use; and</subsection><subsection ssid="13-null-157" dnum="ii-o" numlevel="1" lineno="243" slineno="1-219" level="3"><display>(ii)</display>registered as an off-highway vehicle under Section <xref depth="3" refnumber="41-22-3">41-22-3</xref>.</subsection></subsection></subsection><subsection ssid="13-null-158" dnum="45-o:46-i" numlevel="1" lineno="244" slineno="1-220" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1158" style="2" owner="o" level="1" deltag="both">(45)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="both" space="true">(46)</amend></display>"Mobile home" trailer or a semitrailer whose chassis and exterior shell is designed and constructed <ln numlevel="1" lineno="250" slineno="1-226"/>for use as a mobile home, as defined in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="41-6a-102(45)(a)">(45)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(46)(a)</amend>, but that is instead <ln numlevel="1" lineno="251" slineno="1-227"/>used permanently or temporarily for:<subsection ssid="13-null-163" dnum="i-o" numlevel="1" lineno="252" slineno="1-228" level="3"><display>(i)</display>the advertising, sale, display, space="true">(47)</amend></display>"Mobility disability" means the inability of a person to use one or more of the <ln numlevel="1" lineno="256" slineno="1-232"/>person's extremities or difficulty with motor skills, that may include limitations with <ln numlevel="1" lineno="257" slineno="1-233"/>walking, grasping, or lifting an object, caused by a neuro-muscular, orthopedic, or other <ln Removal and <ln numlevel="1" lineno="466" slineno="2-3"/>impoundment of vehicles -- Reporting and notification requirements -- Administrative <ln numlevel="1" lineno="467" slineno="2-4"/>impound fee -- Refunds -- Possessory lien -- Rulemaking.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="468" slineno="2-5" level="1" placement="noreturn"><display>(1)</display>If a vehicle, vessel, or outboard motor is impounded as provided under Section <xref depth="3" refnumber="41-1a-1101"><ln numlevel="1" lineno="469" slineno="2-6"/>41-1a-1101</xref>, <xref depth="3" refnumber="41-6a-210">41-6a-210</xref>, <xref depth="3" refnumber="41-6a-527">41-6a-527</xref>, <xref depth="3" refnumber="41-6a-1405">41-6a-1405</xref>, <xref depth="3" refnumber="41-6a-1408">41-6a-1408</xref>, or <xref depth="3" refnumber="73-18-20.1">73-18-20.1</xref> by an order <ln numlevel="1" lineno="470" slineno="2-7"/>of a peace officer or by an order of a person acting on behalf of a law enforcement <ln numlevel="1" lineno="471" slineno="2-8"/>agency or highway authority, the impoundment of the vehicle, vessel, or outboard motor <ln numlevel="1" lineno="472" slineno="2-9"/>shall be at the expense of the owner.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="473" slineno="2-10" level="1"><display>(2)</display>The vehicle, vessel, or outboard motor under Subsection <xref depth="4" refnumber="41-6a-1406(1)">(1)</xref> shall be impounded to a <ln numlevel="1" lineno="474" slineno="2-11"/>state impound yard.</subsection><subsection ssid="2-null-3" dnum="3-o" numlevel="1" lineno="475" slineno="2-12" level="1"><display>(3)</display>The peace officer may move a vehicle, vessel, or outboard motor or cause it to be <ln numlevel="1" lineno="476" slineno="2-13"/>removed by a tow truck motor carrier that meets standards established:<subsection ssid="2-null-4" dnum="a-o" numlevel="1" lineno="477" slineno="2-14" level="2"><display>(a)</display>under Title 72, Chapter 9, Motor Carrier Safety Act; and</subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="478" slineno="2-15" level="2"><display>(b)</display>by the department under Subsection <xref depth="4" refnumber="41-6a-1406(11)">(11)</xref>.</subsection></subsection><subsection ssid="2-null-6" dnum="4-o" numlevel="1" lineno="479" slineno="2-16" level="1" space="false"><display>(4)</display><subsection ssid="2-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A report described in this Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref> is required for a vehicle, vessel, or <ln numlevel="1" lineno="480" slineno="2-17"/>outboard motor that is impounded as described in Subsection <xref depth="4" refnumber="41-6a-1406(1)">(1)</xref>.</subsection><subsection ssid="2-null-8" dnum="b-o" numlevel="1" lineno="481" slineno="2-18" level="2"><display>(b)</display>Before noon on the next business day after the date of the removal of the vehicle, <ln numlevel="1" lineno="482" slineno="2-19"/>vessel, or outboard motor, a report of the impoundment shall be sent to the Motor <ln numlevel="1" lineno="483" slineno="2-20"/>Vehicle Division, in an electronic format approved by the Motor Vehicle Division, <ln numlevel="1" lineno="484" slineno="2-21"/>by:<subsection ssid="2-null-9" dnum="i-o" numlevel="1" lineno="485" slineno="2-22" level="3"><display>(i)</display>the peace officer or agency by whom the peace officer is employed; and</subsection><subsection ssid="2-null-10" dnum="ii-o" numlevel="1" lineno="486" slineno="2-23" level="3"><display>(ii)</display>the tow truck operator or the tow truck motor carrier by whom the tow truck <ln numlevel="1" lineno="487" slineno="2-24"/>operator is employed.</subsection></subsection><subsection ssid="2-null-11" dnum="c-o" numlevel="1" lineno="488" slineno="2-25" level="2"><display>(c)</display>The report shall be in a form specified by the Motor Vehicle Division and shall <ln numlevel="1" lineno="489" slineno="2-26"/>include:<subsection ssid="2-null-12" dnum="i-o" numlevel="1" lineno="490" slineno="2-27" level="3"><display>(i)</display>the operator's name, if known;</subsection><subsection ssid="2-null-13" dnum="ii-o" numlevel="1" lineno="491" slineno="2-28" level="3"><display>(ii)</display>a description of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="2-null-14" dnum="iii-o" numlevel="1" lineno="492" slineno="2-29" level="3"><display>(iii)</display>the vehicle identification number or vessel or outboard motor identification <ln numlevel="1" lineno="493" slineno="2-30"/>number;</subsection><subsection ssid="2-null-15" dnum="iv-o" numlevel="1" lineno="494" slineno="2-31" level="3"><display>(iv)</display>the case number designated by the peace officer, law enforcement agency <ln numlevel="1" lineno="495" slineno="2-32"/>number, or government entity;</subsection><subsection ssid="2-null-16" dnum="v-o" numlevel="1" lineno="496" slineno="2-33" level="3"><display>(v)</display>the license number, temporary permit number, or other identification number <ln numlevel="1" lineno="497" slineno="2-34"/>issued by a state agency;</subsection><subsection ssid="2-null-17" dnum="vi-o" numlevel="1" lineno="498" slineno="2-35" level="3"><display>(vi)</display>the date, time, and place of impoundment;</subsection><subsection ssid="2-null-18" dnum="vii-o" numlevel="1" lineno="499" slineno="2-36" level="3"><display>(vii)</display>the reason for removal or impoundment;</subsection><subsection ssid="2-null-19" dnum="viii-o" numlevel="1" lineno="500" slineno="2-37" level="3"><display>(viii)</display>the name of the tow truck motor carrier who removed the vehicle, vessel, or <ln numlevel="1" lineno="501" slineno="2-38"/>outboard motor; and</subsection><subsection ssid="2-null-20" dnum="ix-o" numlevel="1" lineno="502" slineno="2-39" level="3"><display>(ix)</display>the place where the vehicle, vessel, or outboard motor is stored.</subsection></subsection><subsection ssid="2-null-21" dnum="d-o" numlevel="1" lineno="503" slineno="2-40" level="2" space="false"><display>(d)</display><subsection ssid="2-null-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="504" slineno="2-41"/>the State Tax Commission shall make rules to establish proper format and <ln numlevel="1" lineno="505" slineno="2-42"/>information required on the form described in this Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref>.</subsection><subsection ssid="2-null-23" dnum="ii-o" numlevel="1" lineno="506" slineno="2-43" level="3"><display>(ii)</display>The State Tax Commission shall ensure that the form described in this Subsection <xref depth="4" refnumber="41-6a-1406(4)"><ln numlevel="1" lineno="507" slineno="2-44"/>(4)</xref> is provided in an electronic format.</subsection></subsection><subsection ssid="2-null-24" dnum="e-o" numlevel="1" lineno="508" slineno="2-45" level="2"><display>(e)</display>Until the tow truck operator or tow truck motor carrier reports the removal as <ln numlevel="1" lineno="509" slineno="2-46"/>required under this Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref>, a tow truck motor carrier or impound yard may <ln numlevel="1" lineno="510" slineno="2-47"/>not:<subsection ssid="2-null-25" dnum="i-o" numlevel="1" lineno="511" slineno="2-48" level="3"><display>(i)</display>collect any fee associated with the removal; and</subsection><subsection ssid="2-null-26" dnum="ii-o" numlevel="1" lineno="512" slineno="2-49" level="3"><display>(ii)</display>begin charging storage fees.</subsection></subsection></subsection><subsection ssid="2-null-27" dnum="5-o" numlevel="1" lineno="513" slineno="2-50" level="1" space="false"><display>(5)</display><subsection ssid="2-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A report described in this Subsection <xref depth="4" refnumber="41-6a-1406(5)">(5)</xref> is required for any vehicle, vessel, or <ln numlevel="1" lineno="514" slineno="2-51"/>outboard motor that is removed, except for:<subsection ssid="2-null-29" dnum="i-o" numlevel="1" lineno="515" slineno="2-52" level="3" tab="1"><display>(i)</display>a vehicle, vessel, or outboard motor that is impounded for a reason described in <ln numlevel="1" lineno="516" slineno="2-53"/>Subsection <xref depth="4" refnumber="41-6a-1406(1)">(1)</xref>; or</subsection><subsection ssid="2-null-30" dnum="ii-o" numlevel="1" lineno="517" slineno="2-54" level="3" tab="1"><display>(ii)</display>a vehicle, vessel, or outboard motor for which a removal is performed in <ln numlevel="1" lineno="518" slineno="2-55"/>accordance with Section <xref depth="3" refnumber="72-9-603">72-9-603</xref>.</subsection></subsection><subsection ssid="2-null-31" dnum="b-o" numlevel="1" lineno="519" slineno="2-56" level="2"><display>(b)</display>For a removal described in Subsection <xref depth="4" refnumber="41-6a-1406(5)(a)">(5)(a)</xref>, the relevant law enforcement officer <ln numlevel="1" lineno="520" slineno="2-57"/>shall provide documentation to the tow truck operator or tow truck motor carrier that <ln numlevel="1" lineno="521" slineno="2-58"/>includes:<subsection ssid="2-null-32" dnum="i-o" numlevel="1" lineno="522" slineno="2-59" level="3"><display>(i)</display>the name and badge number of the peace officer;</subsection><subsection ssid="2-null-33" dnum="ii-o" numlevel="1" lineno="523" slineno="2-60" level="3"><display>(ii)</display>the name and originating agency identifier of the law enforcement agency; and</subsection><subsection ssid="2-null-34" dnum="iii-o" numlevel="1" lineno="524" slineno="2-61" level="3"><display>(iii)</display>the case number designated by the law enforcement officer or law enforcement <ln numlevel="1" lineno="525" slineno="2-62"/>agency.</subsection></subsection><subsection ssid="2-null-35" dnum="c-o" numlevel="1" lineno="526" slineno="2-63" level="2"><display>(c)</display>For a removal described in Subsection <xref depth="4" refnumber="41-6a-1406(5)(a)">(5)(a)</xref>, before noon on the next business day <ln numlevel="1" lineno="527" slineno="2-64"/>following the date of the removal of the vehicle, vessel, or outboard motor, the tow <ln numlevel="1" lineno="528" slineno="2-65"/>truck operator or tow truck motor carrier shall send to the Motor Vehicle Division in <ln numlevel="1" lineno="529" slineno="2-66"/>an electronic format approved by the Motor Vehicle Division:<subsection ssid="2-null-36" dnum="i-o" numlevel="1" lineno="530" slineno="2-67" level="3"><display>(i)</display>the report described in Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref>; or</subsection><subsection ssid="2-null-37" dnum="ii-o" numlevel="1" lineno="531" slineno="2-68" level="3"><display>(ii)</display>the report described in Subsection <xref depth="4" refnumber="41-6a-1406(5)(d)">(5)(d)</xref>.</subsection></subsection><subsection ssid="2-null-38" dnum="d-o" numlevel="1" lineno="532" slineno="2-69" level="2"><display>(d)</display>For a removal described in Subsection <xref depth="4" refnumber="41-6a-1406(5)(a)">(5)(a)</xref>, if the tow truck operator or tow truck <ln numlevel="1" lineno="533" slineno="2-70"/>motor carrier does not provide the report described in Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref>, the tow truck <ln numlevel="1" lineno="534" slineno="2-71"/>operator or tow truck motor carrier shall provide a report to the Motor Vehicle <ln numlevel="1" lineno="535" slineno="2-72"/>Division that includes:<subsection ssid="2-null-39" dnum="i-o" numlevel="1" lineno="536" slineno="2-73" level="3"><display>(i)</display>the name and badge number of the relevant peace officer;</subsection><subsection ssid="2-null-40" dnum="ii-o" numlevel="1" lineno="537" slineno="2-74" level="3"><display>(ii)</display>the name and originating agency identifier of the law enforcement agency;</subsection><subsection ssid="2-null-41" dnum="iii-o" numlevel="1" lineno="538" slineno="2-75" level="3"><display>(iii)</display>the law enforcement agency case number;</subsection><subsection ssid="2-null-42" dnum="iv-o" numlevel="1" lineno="539" slineno="2-76" level="3"><display>(iv)</display>subject to Subsection <xref depth="4" refnumber="41-6a-1406(5)(e)">(5)(e)</xref>, the vehicle identification number and the license <ln numlevel="1" lineno="540" slineno="2-77"/>number, temporary permit number, or other identification number issued by a <ln numlevel="1" lineno="541" slineno="2-78"/>state agency;</subsection><subsection ssid="2-null-43" dnum="v-o" numlevel="1" lineno="542" slineno="2-79" level="3"><display>(v)</display>the date and time of the removal of the vehicle, vessel, or outboard motor; and</subsection><subsection ssid="2-null-44" dnum="vi-o" numlevel="1" lineno="543" slineno="2-80" level="3"><display>(vi)</display>the reason for the removal of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="2-null-45" dnum="e-o" numlevel="1" lineno="544" slineno="2-81" level="2"><display>(e)</display>If either the vehicle identification number or the license number, temporary permit <ln numlevel="1" lineno="545" slineno="2-82"/>number, or other identification number issued by a state agency is not available, the <ln numlevel="1" lineno="546" slineno="2-83"/>report shall include:<subsection ssid="2-null-46" dnum="i-o" numlevel="1" lineno="547" slineno="2-84" level="3"><display>(i)</display>as much information as is available from both the vehicle identification number <ln numlevel="1" lineno="548" slineno="2-85"/>and the license plate number of the vehicle, vessel, or outboard motor; and</subsection><subsection ssid="2-null-47" dnum="ii-o" numlevel="1" lineno="549" slineno="2-86" level="3"><display>(ii)</display>a description of the vehicle, vessel, or outboard motor, including the color, make, <ln numlevel="1" lineno="550" slineno="2-87"/>model, and model year of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="2-null-48" dnum="f-o" numlevel="1" lineno="551" slineno="2-88" level="2"><display>(f)</display>Until the tow truck operator or tow truck motor carrier reports the removal as <ln numlevel="1" lineno="552" slineno="2-89"/>required under this Subsection <xref depth="4" refnumber="41-6a-1406(5)">(5)</xref>, a tow truck motor carrier may not:<subsection ssid="2-null-49" dnum="i-o" numlevel="1" lineno="553" slineno="2-90" level="3"><display>(i)</display>collect any fee associated with the removal; or</subsection><subsection ssid="2-null-50" dnum="ii-o" numlevel="1" lineno="554" slineno="2-91" level="3"><display>(ii)</display>begin charging storage fees.</subsection></subsection><subsection ssid="2-null-51" dnum="g-o" numlevel="1" lineno="555" slineno="2-92" level="2"><display>(g)</display>A vehicle, vessel, or outboard motor removed under this Subsection <xref depth="4" refnumber="41-6a-1406(5)">(5)</xref> shall be <ln numlevel="1" lineno="556" slineno="2-93"/>removed to:<subsection ssid="2-null-52" dnum="i-o" numlevel="1" lineno="557" slineno="2-94" level="3"><display>(i)</display>a state impound yard; or</subsection><subsection ssid="2-null-53" dnum="ii-o" numlevel="1" lineno="558" slineno="2-95" level="3"><display>(ii)</display>a location that has been requested by the registered owner at the time of removal, <ln numlevel="1" lineno="559" slineno="2-96"/>if payment is made to the tow truck motor carrier or tow truck operator at the time <ln numlevel="1" lineno="560" slineno="2-97"/>of removal.</subsection></subsection><subsection ssid="2-null-54" dnum="h-o" numlevel="1" lineno="561" slineno="2-98" level="2"><display>(h)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="562" slineno="2-99"/>State Tax Commission may make rules to establish proper format and information <ln numlevel="1" lineno="563" slineno="2-100"/>required on the form described in Subsection <xref depth="4" refnumber="41-6a-1406(5)(d)">(5)(d)</xref>, including submission in an <ln numlevel="1" lineno="564" slineno="2-101"/>electronic format.</subsection></subsection><subsection ssid="2-null-55" dnum="6-o" numlevel="1" lineno="565" slineno="2-102" level="1" space="false"><display>(6)</display><subsection ssid="2-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="41-6a-1406(6)(d)">(6)(d)</xref> and upon receipt of a report described in <ln numlevel="1" lineno="566" slineno="2-103"/>Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref> or <xref depth="4" refnumber="41-6a-1406(5)">(5)</xref>, the Motor Vehicle Division shall give notice, in the manner <ln numlevel="1" lineno="567" slineno="2-104"/>described in Section <xref depth="3" refnumber="41-1a-114">41-1a-114</xref>, to the following parties with an interest in the <ln numlevel="1" lineno="568" slineno="2-105"/>vehicle, vessel, or outboard motor, as applicable:<subsection ssid="2-null-57" dnum="i-o" numlevel="1" lineno="569" slineno="2-106" level="3" tab="1"><display>(i)</display>the registered owner;</subsection><subsection ssid="2-null-58" dnum="ii-o" numlevel="1" lineno="570" slineno="2-107" level="3" tab="1"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">any </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a </amend>lien holder; or</subsection><subsection ssid="2-null-59" dnum="iii-o" numlevel="1" lineno="571" slineno="2-108" level="3" tab="1"><display>(iii)</display>a dealer, as defined in Section <xref depth="3" refnumber="41-1a-102">41-1a-102</xref>, if the vehicle, vessel, or outboard <ln numlevel="1" lineno="572" slineno="2-109"/>motor is <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">currently </amend><amendoutend style="2"/>operating under a temporary permit issued by the dealer, as <ln numlevel="1" lineno="573" slineno="2-110"/>described in Section <xref depth="3" refnumber="41-3-302">41-3-302</xref>.</subsection></subsection><subsection ssid="2-null-60" dnum="b-o" numlevel="1" lineno="574" slineno="2-111" level="2"><display>(b)</display>The notice shall:<subsection ssid="2-null-61" dnum="i-o" numlevel="1" lineno="575" slineno="2-112" level="3"><display>(i)</display>state the date, time, and place of removal, the name, if applicable, of the<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both"> person </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> <ln numlevel="1" lineno="576" slineno="2-113"/>individual </amend>operating the vehicle, vessel, or outboard motor at the time of removal, <ln numlevel="1" lineno="577" slineno="2-114"/>the reason for removal, and the place where the vehicle, vessel, or outboard motor <ln numlevel="1" lineno="578" slineno="2-115"/>is stored;</subsection><subsection ssid="2-null-62" dnum="ii-o" numlevel="1" lineno="579" slineno="2-116" level="3"><display>(ii)</display>state that the registered owner is responsible for payment of towing, impound, <ln numlevel="1" lineno="580" slineno="2-117"/>and storage fees charged against the vehicle, vessel, or outboard motor;</subsection><subsection ssid="2-null-63" dnum="iii-o" numlevel="1" lineno="581" slineno="2-118" level="3"><display>(iii)</display>state the conditions that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">must</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="73" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall</amend> be satisfied before the vehicle, vessel, or <ln numlevel="1" lineno="582" slineno="2-119"/>outboard motor is released; and</subsection><subsection ssid="2-null-64" dnum="iv-o" numlevel="1" lineno="583" slineno="2-120" level="3"><display>(iv)</display>inform the parties described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> of the division's intent to sell the <ln numlevel="1" lineno="584" slineno="2-121"/>vehicle, vessel, or outboard motor, if, within 30 days after the day of the removal <ln numlevel="1" lineno="585" slineno="2-122"/>or impoundment under this section, one of the parties fails to make a claim for <ln numlevel="1" lineno="586" slineno="2-123"/>release of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="2-null-65" dnum="c-o" numlevel="1" lineno="587" slineno="2-124" level="2"><display>(c)</display>Except as provided in Subsection <xref depth="4" refnumber="41-6a-1406(6)(d)">(6)(d)</xref> and if the vehicle, vessel, or outboard motor <ln numlevel="1" lineno="588" slineno="2-125"/>is not registered in this state, the Motor Vehicle Division shall make a reasonable <ln numlevel="1" lineno="589" slineno="2-126"/>effort to notify the parties described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> of the removal and the place <ln numlevel="1" lineno="590" slineno="2-127"/>where the vehicle, vessel, or outboard motor is stored.</subsection><subsection ssid="2-null-66" dnum="d-o" numlevel="1" lineno="591" slineno="2-128" level="2"><display>(d)</display>The Motor Vehicle Division is not required to give notice under this Subsection <xref depth="4" refnumber="41-6a-1406(6)">(6)</xref> <ln numlevel="1" lineno="592" slineno="2-129"/>if a report was received by a tow truck operator or tow truck motor carrier reporting a <ln numlevel="1" lineno="593" slineno="2-130"/>tow truck service in accordance with Subsection <xref depth="4" refnumber="72-9-603(1)(a)(i)">72-9-603(1)(a)(i)</xref>.</subsection><subsection ssid="2-null-67" dnum="e-o" numlevel="1" lineno="594" slineno="2-131" level="2" space="false"><display>(e)</display><subsection ssid="2-null-68" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The Motor Vehicle Division shall disclose the information in the report <ln numlevel="1" lineno="595" slineno="2-132"/>described in Subsection <xref depth="4" refnumber="41-6a-1406(4)">(4)</xref> and Subsection <xref depth="4" refnumber="72-9-603(1)(a)(i)">72-9-603(1)(a)(i)</xref> to a designated agent <ln numlevel="1" lineno="596" slineno="2-133"/>as defined in Section <xref depth="3" refnumber="41-12a-802">41-12a-802</xref> regarding a tow that was initiated:<subsection ssid="2-null-69" dnum="A-o" numlevel="1" lineno="597" slineno="2-134" level="4" tab="1"><display>(A)</display>by law enforcement; or</subsection><subsection ssid="2-null-70" dnum="B-o" numlevel="1" lineno="598" slineno="2-135" level="4" tab="1"><display>(B)</display>without the vehicle owner's consent.</subsection></subsection><subsection ssid="2-null-71" dnum="ii-o" numlevel="1" lineno="599" slineno="2-136" level="3"><display>(ii)</display>The Motor Vehicle Division may rely on the information provided by the tow <ln numlevel="1" lineno="600" slineno="2-137"/>truck operator or tow truck motor carrier to determine if a tow meets the criteria <ln numlevel="1" lineno="601" slineno="2-138"/>described in Subsections <xref depth="4" refnumber="41-6a-1406(6)(e)(i)(a)">(6)(e)(i)(A)</xref> and <xref depth="4" refnumber="41-6a-1406(b)">(B)</xref>.</subsection><subsection ssid="2-null-72" dnum="iii-o" numlevel="1" lineno="602" slineno="2-139" level="3"><display>(iii)</display>The designated agent may disclose information received <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="64" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">regarding </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">concerning </amend><ln numlevel="1" lineno="603" slineno="2-140"/>a tow described in Subsections <xref depth="4" refnumber="41-6a-1406(6)(e)(i)(a)">(6)(e)(i)(A)</xref> and <xref depth="4" refnumber="41-6a-1406(b)">(B)</xref> to the vehicle owner and to the <ln numlevel="1" lineno="604" slineno="2-141"/>vehicle owner's verified insurance company.</subsection><subsection ssid="2-null-73" dnum="iv-o" numlevel="1" lineno="605" slineno="2-142" level="3"><display>(iv)</display>The designated agent may not disclose information to a vehicle owner's <ln numlevel="1" lineno="606" slineno="2-143"/>insurance company if the tow does not meet the criteria described in Subsections <xref depth="4" refnumber="41-6a-1406(6)(e)(i)(a)"><ln numlevel="1" lineno="607" slineno="2-144"/>(6)(e)(i)(A)</xref> and <xref depth="4" refnumber="41-6a-1406(b)">(B)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-74" dnum="7-o" numlevel="1" lineno="608" slineno="2-145" level="1" space="false"><display>(7)</display><subsection ssid="2-null-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The vehicle, vessel, or outboard motor impounded or removed to a state impound <ln numlevel="1" lineno="609" slineno="2-146"/>yard as described in this section shall be released after a party described in <ln numlevel="1" lineno="610" slineno="2-147"/>Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> or <xref depth="4" refnumber="41-6a-1406(7)(f)">(7)(f)</xref>:<subsection ssid="2-null-76" dnum="i-o" numlevel="1" lineno="611" slineno="2-148" level="3" tab="1"><display>(i)</display>makes a claim for release of the vehicle, vessel, or outboard motor at any office of <ln numlevel="1" lineno="612" slineno="2-149"/>the State Tax Commission;</subsection><subsection ssid="2-null-77" dnum="ii-o" numlevel="1" lineno="613" slineno="2-150" level="3" tab="1"><display>(ii)</display>presents identification sufficient to prove ownership of the impounded or <ln numlevel="1" lineno="614" slineno="2-151"/>removed vehicle, vessel, or outboard motor;</subsection><subsection ssid="2-null-78" dnum="iii-o" numlevel="1" lineno="615" slineno="2-152" level="3" tab="1"><display>(iii)</display>completes the registration, if needed, and pays the appropriate fees;</subsection><subsection ssid="2-null-79" dnum="iv-o" numlevel="1" lineno="616" slineno="2-153" level="3" tab="1"><display>(iv)</display>if the impoundment was made under Section <xref depth="3" refnumber="41-6a-527">41-6a-527</xref> or Subsection <xref depth="4" refnumber="41-1a-1101(3)"><ln numlevel="1" lineno="617" slineno="2-154"/>41-1a-1101(3)</xref>, pays:<subsection ssid="2-null-80" dnum="A-o" numlevel="1" lineno="618" slineno="2-155" level="4"><display>(A)</display>an administrative impound fee of $425; and</subsection><subsection ssid="2-null-81" dnum="B-o" numlevel="1" lineno="619" slineno="2-156" level="4"><display>(B)</display>in addition to the administrative fee described in Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)(a)">(7)(a)(iv)(A)</xref>, an <ln numlevel="1" lineno="620" slineno="2-157"/>administrative testing fee of $30; and</subsection></subsection><subsection ssid="2-null-82" dnum="v-o" numlevel="1" lineno="621" slineno="2-158" level="3" tab="1"><display>(v)</display>pays all towing and storage fees to the place where the vehicle, vessel, or <ln numlevel="1" lineno="622" slineno="2-159"/>outboard motor is stored.</subsection></subsection><subsection ssid="2-null-83" dnum="b-o" numlevel="1" lineno="623" slineno="2-160" level="2" space="false"><display>(b)</display><subsection ssid="2-null-84" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Twenty-nine dollars of the administrative impound fee assessed under <ln numlevel="1" lineno="624" slineno="2-161"/>Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)(a)">(7)(a)(iv)(A)</xref> shall be dedicated credits to the Motor Vehicle Division.</subsection><subsection ssid="2-null-85" dnum="ii-o" numlevel="1" lineno="625" slineno="2-162" level="3"><display>(ii)</display>One-hundred and forty-seven dollars of the administrative impound fee assessed <ln numlevel="1" lineno="626" slineno="2-163"/>under Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)(a)">(7)(a)(iv)(A)</xref> shall be deposited into the Department of Public <ln numlevel="1" lineno="627" slineno="2-164"/>Safety Restricted Account created in Section <xref depth="3" refnumber="53-3-106">53-3-106</xref>.</subsection><subsection ssid="2-null-86" dnum="iii-o" numlevel="1" lineno="628" slineno="2-165" level="3"><display>(iii)</display>Twenty dollars of the administrative impound fee assessed under Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)(a)"><ln numlevel="1" lineno="629" slineno="2-166"/>(7)(a)(iv)(A)</xref> shall be deposited into the Brain and Spinal Cord Injury Fund <ln numlevel="1" lineno="630" slineno="2-167"/>created in Section <xref depth="3" refnumber="26B-1-318">26B-1-318</xref>.</subsection><subsection ssid="2-null-87" dnum="iv-o" numlevel="1" lineno="631" slineno="2-168" level="3"><display>(iv)</display>After the distributions described in Subsections <xref tempid="672" depth="4" refnumber="41-6a-1406(7)(b)(i)">(7)(b)(i)</xref> through (iii), the <ln numlevel="1" lineno="632" slineno="2-169"/>remainder of the administrative impound fee assessed under Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)(a)"><ln numlevel="1" lineno="633" slineno="2-170"/>(7)(a)(iv)(A)</xref> shall be deposited into the General Fund.</subsection><subsection ssid="2-null-88" dnum="v-o" numlevel="1" lineno="634" slineno="2-171" level="3"><display>(v)</display>The administrative testing fee described in Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)(b)">(7)(a)(iv)(B)</xref> shall be <ln numlevel="1" lineno="635" slineno="2-172"/>deposited into the State Laboratory Drug Testing Account created in Section <xref depth="3" refnumber="26B-1-304"><ln numlevel="1" lineno="636" slineno="2-173"/>26B-1-304</xref>.</subsection></subsection><subsection ssid="2-null-89" dnum="c-o" numlevel="1" lineno="637" slineno="2-174" level="2"><display>(c)</display>The administrative impound fee and the administrative testing fee assessed under <ln numlevel="1" lineno="638" slineno="2-175"/>Subsection <xref depth="4" refnumber="41-6a-1406(7)(a)(iv)">(7)(a)(iv)</xref> shall be waived or refunded by the State Tax Commission if the <ln numlevel="1" lineno="639" slineno="2-176"/>registered owner, lien holder, or owner's agent presents written evidence to the State <ln numlevel="1" lineno="640" slineno="2-177"/>Tax Commission that:<subsection ssid="2-null-90" dnum="i-o" numlevel="1" lineno="641" slineno="2-178" level="3"><display>(i)</display>the Driver License Division determined that the arrested<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both"> person's </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> individual's </amend><ln numlevel="1" lineno="642" slineno="2-179"/>driver license should not be suspended or revoked under Section <xref depth="3" refnumber="53-3-223">53-3-223</xref> or <xref depth="3" refnumber="41-6a-521"><ln numlevel="1" lineno="643" slineno="2-180"/>41-6a-521</xref> as shown by a letter or other report from the Driver License Division <ln numlevel="1" lineno="644" slineno="2-181"/>presented within 180 days after the day on which the Driver License Division <ln numlevel="1" lineno="645" slineno="2-182"/>mailed the final notification; or</subsection><subsection ssid="2-null-91" dnum="ii-o" numlevel="1" lineno="646" slineno="2-183" level="3"><display>(ii)</display>the vehicle was stolen at the time of the impoundment as shown by a copy of the <ln numlevel="1" lineno="647" slineno="2-184"/>stolen vehicle report presented within 180 days after the day of the impoundment.</subsection></subsection><subsection ssid="2-null-92" dnum="d-o" numlevel="1" lineno="648" slineno="2-185" level="2"><display>(d)</display>A tow truck operator, a tow truck motor carrier, and an impound yard shall accept <ln numlevel="1" lineno="649" slineno="2-186"/>payment by cash and debit or credit card for a removal or impoundment under <ln numlevel="1" lineno="650" slineno="2-187"/>Subsection <xref depth="4" refnumber="41-6a-1406(1)">(1)</xref> or any service rendered, performed, or supplied in connection with a <ln numlevel="1" lineno="651" slineno="2-188"/>removal or impoundment under Subsection <xref depth="4" refnumber="41-6a-1406(1)">(1)</xref>.</subsection><subsection ssid="2-null-93" dnum="e-o" numlevel="1" lineno="652" slineno="2-189" level="2"><display>(e)</display>The owner of an impounded vehicle may not be charged a fee for the storage of the <ln numlevel="1" lineno="653" slineno="2-190"/>impounded vehicle, vessel, or outboard motor if:<subsection ssid="2-null-94" dnum="i-o" numlevel="1" lineno="654" slineno="2-191" level="3"><display>(i)</display>the vehicle, vessel, or outboard motor is being held as evidence; and</subsection><subsection ssid="2-null-95" dnum="ii-o" numlevel="1" lineno="655" slineno="2-192" level="3"><display>(ii)</display>the vehicle, vessel, or outboard motor is not being released to a party described in <ln numlevel="1" lineno="656" slineno="2-193"/>Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref>, even if the party satisfies the requirements to release the <ln numlevel="1" lineno="657" slineno="2-194"/>vehicle, vessel, or outboard motor under this Subsection <xref depth="4" refnumber="41-6a-1406(7)">(7)</xref>.</subsection></subsection><subsection ssid="2-null-96" dnum="f-o" numlevel="1" lineno="658" slineno="2-195" level="2"><display>(f)</display>In addition to the parties described in Subsection <xref refnumber="41-6a-1406(6)(a)" depth="4">(6)(a)</xref>, the vehicle, vessel, or <ln numlevel="1" lineno="659" slineno="2-196"/>outboard motor impounded or removed to a state impound yard as described in this <ln numlevel="1" lineno="660" slineno="2-197"/>section shall be released to an individual that is not described in Subsection <xref refnumber="41-6a-1406(6)(a)" depth="4">(6)(a)</xref> if <ln numlevel="1" lineno="661" slineno="2-198"/>the individual:<subsection ssid="2-null-97" dnum="i-o" numlevel="1" lineno="662" slineno="2-199" level="3" space="false"><display>(i)</display><subsection ssid="2-null-98" dnum="A-o" level="4" placement="sameline"><display>(A)</display>satisfies the requirements of Subsections <xref tempid="915" depth="4" refnumber="41-6a-1406(7)(a)(i)">(7)(a)(i)</xref> and (7)(a)(iii) through (v);</subsection><subsection ssid="2-null-99" dnum="B-o" numlevel="1" lineno="663" slineno="2-200" level="4"><display>(B)</display>presents the individual's driver license or other government-issued <ln numlevel="1" lineno="664" slineno="2-201"/>identification; and</subsection><subsection ssid="2-null-100" dnum="C-o" numlevel="1" lineno="665" slineno="2-202" level="4"><display>(C)</display>demonstrates that the individual has authority granted by a person described in <ln numlevel="1" lineno="666" slineno="2-203"/>Subsection <xref refnumber="41-6a-1406(6)(a)" depth="4">(6)(a)</xref> to obtain and operate the vehicle; or</subsection></subsection><subsection ssid="2-null-101" dnum="ii-o" numlevel="1" lineno="667" slineno="2-204" level="3"><display>(ii)</display>is a tow truck operator or tow truck motor carrier that:<subsection ssid="2-null-102" dnum="A-o" numlevel="1" lineno="668" slineno="2-205" level="4"><display>(A)</display>demonstrates that the tow truck operator or tow truck motor carrier has <ln numlevel="1" lineno="669" slineno="2-206"/>authority granted by a person described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> to obtain and <ln numlevel="1" lineno="670" slineno="2-207"/>operate the vehicle, vessel, or outboard motor;</subsection><subsection ssid="2-null-103" dnum="B-o" numlevel="1" lineno="671" slineno="2-208" level="4"><display>(B)</display>provides a towing certificate issued by the Department of Transportation <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="672" slineno="2-209"/>pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="76" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> Section <xref depth="3" refnumber="72-9-602">72-9-602</xref>;</subsection><subsection ssid="2-null-104" dnum="C-o" numlevel="1" lineno="673" slineno="2-210" level="4"><display>(C)</display>pays all towing and storage fees; and</subsection><subsection ssid="2-null-105" dnum="D-o" numlevel="1" lineno="674" slineno="2-211" level="4"><display>(D)</display>obtains or presents an impound release for the vehicle, vessel, or outboard <ln numlevel="1" lineno="675" slineno="2-212"/>motor <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> Subsection <xref refnumber="41-6a-1406(7)(a)" depth="4">(7)(a)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="2-null-106" dnum="8-o" numlevel="1" lineno="676" slineno="2-213" level="1" space="false"><display>(8)</display><subsection ssid="2-null-107" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For an impounded or a removed vehicle, vessel, or outboard motor not claimed by <ln numlevel="1" lineno="677" slineno="2-214"/>a party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> or <xref depth="4" refnumber="41-6a-1406(7)(f)">(7)(f)</xref> within the time prescribed by Section <xref depth="3" refnumber="41-1a-1103"><ln numlevel="1" lineno="678" slineno="2-215"/>41-1a-1103</xref>, the Motor Vehicle Division shall issue a certificate of sale for the <ln numlevel="1" lineno="679" slineno="2-216"/>impounded or removed vehicle, vessel, or outboard motor as described in Section <xref depth="3" refnumber="41-1a-1103"><ln numlevel="1" lineno="680" slineno="2-217"/>41-1a-1103</xref>.</subsection><subsection ssid="2-null-108" dnum="b-o" numlevel="1" lineno="681" slineno="2-218" level="2"><display>(b)</display>The date of impoundment or removal is considered the date of seizure for computing <ln numlevel="1" lineno="682" slineno="2-219"/>the time period provided under Section <xref depth="3" refnumber="41-1a-1103">41-1a-1103</xref>.</subsection></subsection><subsection ssid="2-null-109" dnum="9-o" numlevel="1" lineno="683" slineno="2-220" level="1"><display>(9)</display>A party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> that pays all fees and charges incurred in the <ln numlevel="1" lineno="684" slineno="2-221"/>impoundment or removal of the owner's vehicle, vessel, or outboard motor has a cause <ln numlevel="1" lineno="685" slineno="2-222"/>of action for all the fees and charges, together with damages, court costs, and attorney <ln numlevel="1" lineno="686" slineno="2-223"/>fees, against the operator of the vehicle, vessel, or outboard motor whose actions caused <ln numlevel="1" lineno="687" slineno="2-224"/>the removal or impoundment.</subsection><subsection ssid="2-null-110" dnum="10-o" numlevel="1" lineno="688" slineno="2-225" level="1" space="false"><display>(10)</display><subsection ssid="2-null-111" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="41-6a-1406(10)">(10)</xref>, "life essential item" means the same as that term <ln numlevel="1" lineno="689" slineno="2-226"/>is defined in Subsection <xref refnumber="72-9-603(13)" depth="4">72-9-603(13)</xref>.</subsection><subsection ssid="2-null-112" dnum="b-o" numlevel="1" lineno="690" slineno="2-227" level="2"><display>(b)</display>Towing, impound fees, and storage fees are a possessory lien on the vehicle, vessel, <ln numlevel="1" lineno="691" slineno="2-228"/>or outboard motor.</subsection><subsection ssid="2-null-113" dnum="c-o" numlevel="1" lineno="692" slineno="2-229" level="2"><display>(c)</display>Towing fees are a possessory lien on the vehicle, vessel, or outboard motor and any <ln numlevel="1" lineno="693" slineno="2-230"/>nonlife essential items contained in the vehicle, vessel, or outboard motor.</subsection><subsection ssid="2-null-114" dnum="d-o" numlevel="1" lineno="694" slineno="2-231" level="2" space="false"><display>(d)</display><subsection ssid="2-124" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1409" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Except for a vehicle, vessel, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/>outboard motor<amend anum="0" ea="amend" pairid="47" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both">, or an item</amend> being held as <ln numlevel="1" lineno="695" slineno="2-232"/>evidence, a tow truck operator, a tow truck motor carrier, or an impound yard <ln numlevel="1" lineno="696" slineno="2-233"/>shall allow a person described in Subsection <xref refnumber="41-6a-1406(6)(a)" depth="4">(6)(a)</xref> or an individual described in <ln numlevel="1" lineno="697" slineno="2-234"/>Subsection <xref depth="4" refnumber="41-6a-1406(7)(f)(i)">(7)(f)(i)</xref> to take possession of any life essential item within the vehicle, <ln numlevel="1" lineno="698" slineno="2-235"/>vessel, or outboard motor <amend anum="0" ea="amend" pairid="82" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="both">after completion of a life essential item retrieval form </amend><ln numlevel="1" lineno="699" slineno="2-236"/>during normal business hours regardless of whether the towing, impound fees, or <ln numlevel="1" lineno="700" slineno="2-237"/>storage fees have been paid.</subsection><subsection ssid="2-126" dnum="_-o:ii-i" numlevel="1" lineno="701" slineno="2-238" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1410" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">A tow truck operator, a tow truck motor carrier, or an impound yard may not <ln numlevel="1" lineno="702" slineno="2-239"/>allow an individual to retrieve the items described in Subsection <xref depth="4" refnumber="41-6a-1406(10)(d)(i)">(10)(d)(i)</xref> if the <ln numlevel="1" lineno="703" slineno="2-240"/>retrieval would cause an unreasonable delay to vehicle impounding or storage or <ln numlevel="1" lineno="704" slineno="2-241"/>create a safety risk.</amend></subsection></subsection><subsection ssid="2-null-115" dnum="e-o" numlevel="1" lineno="705" slineno="2-242" level="2"><display>(e)</display>Except for a vehicle, vessel, or outboard motor being held as evidence, upon <ln numlevel="1" lineno="706" slineno="2-243"/>payment of the towing fee, a tow truck operator, a tow truck motor carrier, or an <ln numlevel="1" lineno="707" slineno="2-244"/>impound yard shall allow a person described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">(6)(a)</xref> or an individual <ln numlevel="1" lineno="708" slineno="2-245"/>described in Subsection <xref tempid="186" depth="4" refnumber="41-6a-1406(7)(f)(i)">(7)(f)(i)</xref> to enter the vehicle, vessel, or outboard motor during <ln numlevel="1" lineno="709" slineno="2-246"/>normal business hours and remove personal property not attached to the vehicle, <ln numlevel="1" lineno="710" slineno="2-247"/>vessel, or outboard motor.</subsection></subsection><subsection ssid="2-null-116" dnum="11-o" numlevel="1" lineno="711" slineno="2-248" level="1"><display>(11)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="712" slineno="2-249"/>department shall make rules setting the performance standards for towing companies to <ln numlevel="1" lineno="713" slineno="2-250"/>be used by the department.</subsection><subsection ssid="2-null-117" dnum="12-o" numlevel="1" lineno="714" slineno="2-251" level="1" space="false"><display>(12)</display><subsection ssid="2-null-118" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Motor Vehicle Division may specify that a report required under Subsection <xref depth="4" refnumber="41-6a-1406(4)"><ln numlevel="1" lineno="715" slineno="2-252"/>(4)</xref> be submitted in electronic form <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both">utilizing </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">using </amend>a database for submission, <ln numlevel="1" lineno="716" slineno="2-253"/>storage, and retrieval of the information.</subsection><subsection ssid="2-null-119" dnum="b-o" numlevel="1" lineno="717" slineno="2-254" level="2" space="false"><display>(b)</display><subsection ssid="2-null-120" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Unless otherwise provided by statute, the Motor Vehicle Division or the <ln numlevel="1" lineno="718" slineno="2-255"/>administrator of the database may adopt a schedule of fees assessed for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="53" style="2" owner="jchristopherson" level="1" deltag="both">utilizing </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="55" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="719" slineno="2-256"/>using </amend>the database.</subsection><subsection ssid="2-null-121" dnum="ii-o" numlevel="1" lineno="720" slineno="2-257" level="3"><display>(ii)</display>The fees under this Subsection <xref depth="4" refnumber="41-6a-1406(12)(b)">(12)(b)</xref> shall:<subsection ssid="2-null-122" dnum="A-o" numlevel="1" lineno="721" slineno="2-258" level="4"><display>(A)</display>be reasonable and fair; and</subsection><subsection ssid="2-null-123" dnum="B-o" numlevel="1" lineno="722" slineno="2-259" level="4"><display>(B)</display>reflect the cost of administering the database.</subsection></subsection></subsection></subsection><subsection ssid="2-141" dnum="_-o:13-i" numlevel="1" lineno="723" slineno="2-260" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1420" style="1" owner="i" level="1" amendtag="start">(13)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">If an owner or authorized representative of a vehicle, vessel, or outboard motor that <ln numlevel="1" lineno="724" slineno="2-261"/>has been towed or removed requests to retrieve a life essential item, an operator of an <ln numlevel="1" lineno="725" slineno="2-262"/>impound yard shall provide a life essential item retrieval form.</amend></subsection><subsection ssid="2-128" dnum="_-o:14-i" numlevel="1" lineno="726" slineno="2-263" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1421" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><subsection ssid="2-130" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1422" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="727" slineno="2-264"/>the commission shall make rules creating, managing, and distributing a life essential <ln numlevel="1" lineno="728" slineno="2-265"/>retrieval form.</amend></subsection><subsection ssid="2-131" dnum="_-o:b-i" numlevel="1" lineno="729" slineno="2-266" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1423" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall ensure that a life essential item retrieval form includes:</amend><subsection ssid="2-132" dnum="_-o:i-i" numlevel="1" lineno="730" slineno="2-267" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1424" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">identifying information of:</amend><subsection ssid="2-133" dnum="_-o:A-i" numlevel="1" lineno="731" slineno="2-268" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1425" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">the individual requesting release of a life essential item;</amend></subsection><subsection ssid="2-134" dnum="_-o:B-i" numlevel="1" lineno="732" slineno="2-269" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1426" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">the vehicle, vessel, or outboard motor containing the life essential item; and</amend></subsection><subsection ssid="2-135" dnum="_-o:C-i" numlevel="1" lineno="733" slineno="2-270" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1427" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">the life essential item for which the individual is requesting release;</amend></subsection></subsection><subsection ssid="2-136" dnum="_-o:ii-i" numlevel="1" lineno="734" slineno="2-271" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1428" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">if the individual requesting release of a life essential item is not the registered <ln numlevel="1" lineno="735" slineno="2-272"/>owner of the vehicle, vessel, or outboard motor, proof of authority to retrieve a <ln numlevel="1" lineno="736" slineno="2-273"/>life essential item;</amend></subsection><subsection ssid="2-137" dnum="_-o:iii-i" numlevel="1" lineno="737" slineno="2-274" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1429" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">space for a representative of the impound yard to note the condition of a life <ln numlevel="1" lineno="738" slineno="2-275"/>essential item upon the item's release;</amend></subsection><subsection ssid="2-138" dnum="_-o:iv-i" numlevel="1" lineno="739" slineno="2-276" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1430" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">the date of request and release;</amend></subsection><subsection ssid="2-143" dnum="_-o:v-i" numlevel="1" lineno="740" slineno="2-277" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1431" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">if the individual requesting release of a life essential item is requesting an item <ln numlevel="1" lineno="741" slineno="2-278"/>specific to the individual's employment, the name and phone number of an <ln numlevel="1" lineno="742" slineno="2-279"/>employer of the individual;</amend></subsection><subsection ssid="2-139" dnum="_-o:vi-i" numlevel="1" lineno="743" slineno="2-280" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1432" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">space for signatures of the individual requesting release of a life essential item <ln numlevel="1" lineno="744" slineno="2-281"/>and a representative of the impound yard; and</amend></subsection><subsection ssid="2-140" dnum="_-o:vii-i" numlevel="1" lineno="745" slineno="2-282" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1433" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">other items deemed necessary and proper by the Definitions.</bold></catline><sectionText lineno="748"><tab/>As used in this chapter:</sectionText><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="749" slineno="3-4" level="1" space="false"><display>(1)</display><subsection ssid="10-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Commercial vehicle" includes:<subsection ssid="10-null-3" dnum="i-o" numlevel="1" lineno="750" slineno="3-5" level="3" tab="1"><display>(i)</display>an interstate commercial vehicle; </subsection><subsection ssid="10-null-4" dnum="ii-o" numlevel="1" lineno="751" slineno="3-6" level="3" tab="1"><display>(ii)</display>an intrastate commercial vehicle; and</subsection><subsection ssid="10-null-5" dnum="iii-o" numlevel="1" lineno="752" slineno="3-7" level="3" tab="1"><display>(iii)</display>a tow truck.</subsection></subsection><subsection ssid="10-null-6" dnum="b-o" numlevel="1" lineno="753" slineno="3-8" level="2"><display>(b)</display>"Commercial vehicle" does not include the following vehicles for purposes of this <ln numlevel="1" lineno="754" slineno="3-9"/>chapter:<subsection ssid="10-null-7" dnum="i-o" numlevel="1" lineno="755" slineno="3-10" level="3"><display>(i)</display>equipment owned and operated by the United States Department of Defense when <ln numlevel="1" lineno="756" slineno="3-11"/>driven by any active duty military personnel and members of the reserves and <ln numlevel="1" lineno="757" slineno="3-12"/>national guard on active duty including personnel on full-time national guard duty, <ln numlevel="1" lineno="758" slineno="3-13"/>personnel on part-time training, and national guard military technicians and <ln numlevel="1" lineno="759" slineno="3-14"/>civilians who are required to wear military uniforms and are subject to the code of <ln numlevel="1" lineno="760" slineno="3-15"/>military justice;</subsection><subsection ssid="10-null-8" dnum="ii-o" numlevel="1" lineno="761" slineno="3-16" level="3"><display>(ii)</display>firefighting and emergency vehicles, operated by emergency personnel, not <ln numlevel="1" lineno="762" slineno="3-17"/>including commercial tow trucks;</subsection><subsection ssid="10-null-9" dnum="iii-o" numlevel="1" lineno="763" slineno="3-18" level="3"><display>(iii)</display>recreational vehicles that are driven solely as family or personal conveyances for <ln numlevel="1" lineno="764" slineno="3-19"/>noncommercial purposes; or</subsection><subsection ssid="10-null-10" dnum="iv-o" numlevel="1" lineno="765" slineno="3-20" level="3"><display>(iv)</display>vehicles owned by the state or a local government.</subsection></subsection></subsection><subsection ssid="10-null-11" dnum="2-o" numlevel="1" lineno="766" slineno="3-21" level="1"><display>(2)</display>"Interstate commercial vehicle" means a self-propelled or towed motor vehicle used on <ln numlevel="1" lineno="767" slineno="3-22"/>a highway in interstate commerce to transport passengers or property if the vehicle:<subsection ssid="10-null-12" dnum="a-o" numlevel="1" lineno="768" slineno="3-23" level="2"><display>(a)</display>has a gross vehicle weight rating or gross vehicle weight of 10,001 or more pounds, <ln numlevel="1" lineno="769" slineno="3-24"/>or gross combination weight rating or gross combination weight of 10,001 or more <ln numlevel="1" lineno="770" slineno="3-25"/>pounds, whichever is greater;</subsection><subsection ssid="10-null-13" dnum="b-o" numlevel="1" lineno="771" slineno="3-26" level="2"><display>(b)</display>is designed or used to transport more than eight passengers, including the driver, for <ln numlevel="1" lineno="772" slineno="3-27"/>compensation;</subsection><subsection ssid="10-null-14" dnum="c-o" numlevel="1" lineno="773" slineno="3-28" level="2"><display>(c)</display>is designed or used to transport more than 15 passengers, including the driver, and is <ln numlevel="1" lineno="774" slineno="3-29"/>not used to transport passengers for compensation; or</subsection><subsection ssid="10-null-15" dnum="d-o" numlevel="1" lineno="775" slineno="3-30" level="2" space="false"><display>(d)</display><subsection ssid="10-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>is used to transport materials designated as hazardous in accordance with 49 <ln numlevel="1" lineno="776" slineno="3-31"/>U.S.C. Sec. 5103; and</subsection><subsection ssid="10-null-17" dnum="ii-o" numlevel="1" lineno="777" slineno="3-32" level="3"><display>(ii)</display>is required to be placarded in accordance with regulations under 49 C.F.R., <ln numlevel="1" lineno="778" slineno="3-33"/>Subtitle B, Chapter I, Subchapter C.</subsection></subsection></subsection><subsection ssid="10-null-18" dnum="3-o" numlevel="1" lineno="779" slineno="3-34" level="1"><display>(3)</display>"Intrastate commercial vehicle" means a motor vehicle, vehicle, trailer, or semitrailer <ln numlevel="1" lineno="780" slineno="3-35"/>used or maintained for business, compensation, or profit to transport passengers or <ln numlevel="1" lineno="781" slineno="3-36"/>property on a highway only within the boundaries of this state if the commercial vehicle:<subsection ssid="10-null-19" dnum="a-o" numlevel="1" lineno="782" slineno="3-37" level="2" space="false"><display>(a)</display><subsection ssid="10-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>has a manufacturer's gross vehicle weight rating or gross vehicle weight, or <ln numlevel="1" lineno="783" slineno="3-38"/>gross combination weight rating or gross combination weight of 26,001 or more <ln numlevel="1" lineno="784" slineno="3-39"/>pounds, whichever is greater, and is operated by an individual who is 18 years old <ln numlevel="1" lineno="785" slineno="3-40"/>or older; or</subsection><subsection ssid="10-null-21" dnum="ii-o" numlevel="1" lineno="786" slineno="3-41" level="3"><display>(ii)</display>has a manufacturer's gross vehicle weight rating or gross combination weight <ln numlevel="1" lineno="787" slineno="3-42"/>rating of 16,001 or more pounds and is operated by an individual who is under 18 <ln numlevel="1" lineno="788" slineno="3-43"/>years old;</subsection></subsection><subsection ssid="10-null-22" dnum="b-o" numlevel="1" lineno="789" slineno="3-44" level="2" space="false"><display>(b)</display><subsection ssid="10-null-23" dnum="i-o" level="3" placement="sameline"><display>(i)</display>is designed to transport more than 15 passengers, including the driver; or</subsection><subsection ssid="10-null-24" dnum="ii-o" numlevel="1" lineno="790" slineno="3-45" level="3"><display>(ii)</display>is designed to transport more than 12 passengers, including the driver, and has a <ln numlevel="1" lineno="791" slineno="3-46"/>manufacturer's gross vehicle weight rating or gross combination weight rating of <ln numlevel="1" lineno="792" slineno="3-47"/>13,000 or more pounds; or</subsection></subsection><subsection ssid="10-null-25" dnum="c-o" numlevel="1" lineno="793" slineno="3-48" level="2"><display>(c)</display>is used in the transportation of hazardous materials and is required to be placarded in <ln numlevel="1" lineno="794" slineno="3-49"/>accordance with 49 C.F.R. Part 172, Subpart F.</subsection></subsection><subsection ssid="10-35" dnum="_-o:4-i" numlevel="1" lineno="795" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1459" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Life essential item retrieval form" means the same as that term is defined in Section <xref depth="3" refnumber="41-6a-102"><ln numlevel="1" lineno="796" slineno="3-51"/>41-6a-102</xref>.</amend></subsection><subsection ssid="10-null-26" dnum="4-o:5-i" numlevel="1" lineno="797" slineno="3-52" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1460" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1461" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Motor carrier" means a person engaged in or transacting the business of <ln numlevel="1" lineno="798" slineno="3-53"/>transporting passengers, freight, merchandise, or other property by a commercial vehicle <ln numlevel="1" lineno="799" slineno="3-54"/>on a highway within this state and includes a tow truck business.</subsection><subsection ssid="10-null-27" dnum="5-o:6-i" numlevel="1" lineno="800" slineno="3-55" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1461" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1462" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Owner" as pertaining to a vehicle, vessel, or outboard motor, means the same as <ln numlevel="1" lineno="801" slineno="3-56"/>that term is defined in Section <xref depth="3" refnumber="41-1a-102">41-1a-102</xref>.</subsection><subsection ssid="10-null-28" dnum="6-o:7-i" numlevel="1" lineno="802" slineno="3-57" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1462" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1463" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Property owner" means the owner or lessee of real property.</subsection><subsection ssid="10-null-29" dnum="7-o:8-i" numlevel="1" lineno="803" slineno="3-58" space="true">(9)</amend></display>"Tow truck" means a motor vehicle constructed, designed, altered, or equipped <ln numlevel="1" lineno="805" slineno="3-60"/>primarily for the purpose of towing or removing damaged, disabled, abandoned, seized, <ln numlevel="1" lineno="806" slineno="3-61"/>or impounded vehicles from a highway or other place by means of a crane, hoist, tow <ln numlevel="1" lineno="807" slineno="3-62"/>bar, tow line, dolly, tilt bed, or other means.</subsection><subsection ssid="10-null-31" dnum="9-o:10-i" numlevel="1" lineno="808" slineno="3-63" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1465" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1466" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Tow truck motor carrier" means a motor carrier that is engaged in or transacting <ln numlevel="1" lineno="809" slineno="3-64"/>business for tow truck services.</subsection><subsection ssid="10-null-32" dnum="10-o:11-i" numlevel="1" lineno="810" slineno="3-65" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1466" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1467" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Tow truck operator" means an individual that performs operations related to a <ln numlevel="1" lineno="811" slineno="3-66"/>tow truck service as an employee or as an independent contractor on behalf of a tow <ln numlevel="1" lineno="812" slineno="3-67"/>truck motor carrier.</subsection><subsection ssid="10-null-33" dnum="11-o:12-i" numlevel="1" lineno="813" slineno="3-68" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1467" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1468" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>"Tow truck service" means the functions and any ancillary operations associated <ln numlevel="1" lineno="814" slineno="3-69"/>with recovering, removing, and towing a vehicle and its load from a highway or other <ln numlevel="1" lineno="815" slineno="3-70"/>place by means of a tow truck.</subsection><subsection ssid="10-null-34" dnum="12-o:13-i" numlevel="1" lineno="816" slineno="3-71" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1468" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1469" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Transportation" means the actual movement of property or passengers by motor <ln numlevel="1" lineno="817" slineno="3-72"/>vehicle, including loading, unloading, and any ancillary service provided by the motor <ln numlevel="1" lineno="818" slineno="3-73"/>carrier in connection with movement by motor vehicle, which is performed by or on <ln numlevel="1" lineno="819" slineno="3-74"/>behalf of the motor carrier, its employees or agents, or under the authority of the motor <ln numlevel="1" lineno="820" slineno="3-75"/>carrier, its employees or agents, or under the apparent authority and with the knowledge <ln numlevel="1" lineno="821" slineno="3-76"/>of the motor carrier.</subsection></section></bsec><bsec buid="6" num="72-9-603" type="amend" Towing notice requirements -- Cost <ln numlevel="1" lineno="824" slineno="4-3"/>responsibilities -- Abandoned vehicle title restrictions -- Rules for maximum rates and <ln numlevel="1" lineno="825" slineno="4-4"/>certification.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="826" slineno="4-5" level="1" placement="noreturn"><display>(1)</display>Except for a tow truck service that was ordered by a peace officer, a person acting on <ln numlevel="1" lineno="827" slineno="4-6"/>behalf of a law enforcement agency, or a highway authority, after performing a tow <ln numlevel="1" lineno="828" slineno="4-7"/>truck service that is being done without the vehicle, vessel, or outboard motor owner's <ln numlevel="1" lineno="829" slineno="4-8"/>knowledge, the tow truck operator or the tow truck motor carrier shall:<subsection ssid="6-null-2" dnum="a-o" numlevel="1" lineno="830" slineno="4-9" level="2"><display>(a)</display>immediately upon arriving at the place of storage or impound of the vehicle, vessel, <ln numlevel="1" lineno="831" slineno="4-10"/>or outboard motor:<subsection ssid="6-null-3" dnum="i-o" numlevel="1" lineno="832" slineno="4-11" level="3"><display>(i)</display>provide relevant information to the impound vehicle service system database <ln numlevel="1" lineno="833" slineno="4-12"/>administered by the Motor Vehicle Division, including:<subsection ssid="6-null-4" dnum="A-o" numlevel="1" lineno="834" slineno="4-13" level="4"><display>(A)</display>the date and time of the removal of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-null-5" dnum="B-o" numlevel="1" lineno="835" slineno="4-14" level="4"><display>(B)</display>a description of the vehicle, vessel, or outboard motor; and</subsection><subsection ssid="6-null-6" dnum="C-o" numlevel="1" lineno="836" slineno="4-15" level="4"><display>(C)</display>the vehicle identification number or vessel or outboard motor identification <ln numlevel="1" lineno="837" slineno="4-16"/>number; and</subsection></subsection><subsection ssid="6-null-7" dnum="ii-o" numlevel="1" lineno="838" slineno="4-17" level="3"><display>(ii)</display>contact the law enforcement agency having jurisdiction over the area where the <ln numlevel="1" lineno="839" slineno="4-18"/>vehicle, vessel, or outboard motor was picked up and notify the agency of the:<subsection ssid="6-null-8" dnum="A-o" numlevel="1" lineno="840" slineno="4-19" level="4"><display>(A)</display>location of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-null-9" dnum="B-o" numlevel="1" lineno="841" slineno="4-20" level="4"><display>(B)</display>date, time, and location from which the vehicle, vessel, or outboard motor was <ln numlevel="1" lineno="842" slineno="4-21"/>removed;</subsection><subsection ssid="6-null-10" dnum="C-o" numlevel="1" lineno="843" slineno="4-22" level="4"><display>(C)</display>reasons for the removal of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-null-11" dnum="D-o" numlevel="1" lineno="844" slineno="4-23" level="4"><display>(D)</display>person who requested the removal of the vehicle, vessel, or outboard motor; <ln numlevel="1" lineno="845" slineno="4-24"/>and</subsection><subsection ssid="6-null-12" dnum="E-o" numlevel="1" lineno="846" slineno="4-25" level="4"><display>(E)</display>description, including the identification number, license number, or other <ln numlevel="1" lineno="847" slineno="4-26"/>identification number issued by a state agency, of the vehicle, vessel, or <ln numlevel="1" lineno="848" slineno="4-27"/>outboard motor;</subsection></subsection></subsection><subsection ssid="6-null-13" dnum="b-o" numlevel="1" lineno="849" slineno="4-28" level="2"><display>(b)</display>except for a vehicle, vessel, or outboard motor that has been retrieved by the owner <ln numlevel="1" lineno="850" slineno="4-29"/>or operator, within two business days of performing the tow truck service under <ln numlevel="1" lineno="851" slineno="4-30"/>Subsection <xref depth="4" refnumber="72-9-603(1)(a)">(1)(a)</xref>, send a certified letter to the last-known address of each party <ln numlevel="1" lineno="852" slineno="4-31"/>described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> with an interest in the vehicle, vessel, or <ln numlevel="1" lineno="853" slineno="4-32"/>outboard motor obtained from the Motor Vehicle Division or, if the<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"> person </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> <ln numlevel="1" lineno="854" slineno="4-33"/>individual </amend>has actual knowledge of the party's address, to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">current </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">party's </amend><ln numlevel="1" lineno="855" slineno="4-34"/>address, notifying the party of the:<subsection ssid="6-null-14" dnum="i-o" numlevel="1" lineno="856" slineno="4-35" level="3"><display>(i)</display>location of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-null-15" dnum="ii-o" numlevel="1" lineno="857" slineno="4-36" level="3"><display>(ii)</display>date, time, and location from which the vehicle, vessel, or outboard motor was <ln numlevel="1" lineno="858" slineno="4-37"/>removed;</subsection><subsection ssid="6-null-16" dnum="iii-o" numlevel="1" lineno="859" slineno="4-38" level="3"><display>(iii)</display>reasons for the removal of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-null-17" dnum="iv-o" numlevel="1" lineno="860" slineno="4-39" level="3"><display>(iv)</display>person who requested the removal of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-null-18" dnum="v-o" numlevel="1" lineno="861" slineno="4-40" level="3"><display>(v)</display>a description, including <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> identification number and license number or other <ln numlevel="1" lineno="862" slineno="4-41"/>identification number issued by a state agency; and</subsection><subsection ssid="6-null-19" dnum="vi-o" numlevel="1" lineno="863" slineno="4-42" level="3"><display>(vi)</display>costs and procedures to retrieve the vehicle, vessel, or outboard motor; and</subsection></subsection><subsection ssid="6-null-20" dnum="c-o" numlevel="1" lineno="864" slineno="4-43" level="2"><display>(c)</display>upon initial contact with the owner or operator whose vehicle, vessel, or outboard <ln numlevel="1" lineno="865" slineno="4-44"/>motor was removed, provide the owner or operator with a copy of the Utah <ln numlevel="1" lineno="866" slineno="4-45"/>Consumer Bill of Rights Regarding Towing established by the department in <ln numlevel="1" lineno="867" slineno="4-46"/>Subsection <xref depth="4" refnumber="72-9-603(16)(e)">(16)(e)</xref>.</subsection></subsection><subsection ssid="6-null-21" dnum="2-o" numlevel="1" lineno="868" slineno="4-47" level="1"><display>(2)</display>Until the tow truck operator or tow truck motor carrier reports the information required <ln numlevel="1" lineno="869" slineno="4-48"/>under Subsection <xref depth="4" refnumber="72-9-603(1)(a)">(1)(a)</xref>, a tow truck operator, tow truck motor carrier, or impound yard <ln numlevel="1" lineno="870" slineno="4-49"/>may not:<subsection ssid="6-null-22" dnum="a-o" numlevel="1" lineno="871" slineno="4-50" level="2"><display>(a)</display>collect any fee associated with the removal; or</subsection><subsection ssid="6-null-23" dnum="b-o" numlevel="1" lineno="872" slineno="4-51" level="2"><display>(b)</display>begin charging storage fees.</subsection></subsection><subsection ssid="6-null-24" dnum="3-o" numlevel="1" lineno="873" slineno="4-52" level="1" space="false"><display>(3)</display><subsection ssid="6-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="72-9-603(3)(b)">(3)(b)</xref> or <xref depth="4" refnumber="72-9-603(9)">(9)</xref>, a tow truck operator or tow truck <ln numlevel="1" lineno="874" slineno="4-53"/>motor carrier may not perform a tow truck service at the request or direction of a <ln numlevel="1" lineno="875" slineno="4-54"/>private property owner or the property owner's agent unless:<subsection ssid="6-null-26" dnum="i-o" numlevel="1" lineno="876" slineno="4-55" level="3" tab="1"><display>(i)</display>the owner or a lien holder of the vehicle, vessel, or outboard motor consents to the <ln numlevel="1" lineno="877" slineno="4-56"/>tow truck service; or</subsection><subsection ssid="6-null-27" dnum="ii-o" numlevel="1" lineno="878" slineno="4-57" level="3" tab="1"><display>(ii)</display>the property owner erects signage that meets the requirements of:<subsection ssid="6-null-28" dnum="A-o" numlevel="1" lineno="879" slineno="4-58" level="4"><display>(A)</display>Subsection <xref depth="4" refnumber="72-9-603(4)(b)(ii)">(4)(b)(ii)</xref>; and</subsection><subsection ssid="6-null-29" dnum="B-o" numlevel="1" lineno="880" slineno="4-59" level="4"><display>(B)</display>Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref> or <xref depth="4" refnumber="72-9-603(8)">(8)</xref>.</subsection></subsection></subsection><subsection ssid="6-null-30" dnum="b-o" numlevel="1" lineno="881" slineno="4-60" level="2"><display>(b)</display>Subsections <xref depth="4" refnumber="72-9-603(7)">(7)</xref> through <xref depth="4" refnumber="72-9-603(9)">(9)</xref> do not apply to the removal of a vehicle, vessel, or <ln numlevel="1" lineno="882" slineno="4-61"/>outboard motor:<subsection ssid="6-null-31" dnum="i-o" numlevel="1" lineno="883" slineno="4-62" level="3"><display>(i)</display>from a location where parking is prohibited by law, including:<subsection ssid="6-null-32" dnum="A-o" numlevel="1" lineno="884" slineno="4-63" level="4"><display>(A)</display>a designated fire lane;</subsection><subsection ssid="6-null-33" dnum="B-o" numlevel="1" lineno="885" slineno="4-64" level="4"><display>(B)</display>within 15 feet of a fire hydrant, unless the vehicle is parked in a marked <ln numlevel="1" lineno="886" slineno="4-65"/>parking stall or space; or</subsection><subsection ssid="6-null-34" dnum="C-o" numlevel="1" lineno="887" slineno="4-66" level="4"><display>(C)</display>a marked parking stall or space legally designated for disabled <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">persons</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="888" slineno="4-67"/>individuals</amend>;</subsection></subsection><subsection ssid="6-null-35" dnum="ii-o" numlevel="1" lineno="889" slineno="4-68" level="3"><display>(ii)</display>from a location where it is reasonably apparent that the location is not open to <ln numlevel="1" lineno="890" slineno="4-69"/>parking;</subsection><subsection ssid="6-null-36" dnum="iii-o" numlevel="1" lineno="891" slineno="4-70" level="3"><display>(iii)</display>from a location where all public access points are controlled by:<subsection ssid="6-null-37" dnum="A-o" numlevel="1" lineno="892" slineno="4-71" level="4"><display>(A)</display>a permanent gate, door, or similar feature allowing the vehicle to access the <ln numlevel="1" lineno="893" slineno="4-72"/>facility; or</subsection><subsection ssid="6-null-38" dnum="B-o" numlevel="1" lineno="894" slineno="4-73" level="4"><display>(B)</display>a parking attendant;</subsection></subsection><subsection ssid="6-null-39" dnum="iv-o" numlevel="1" lineno="895" slineno="4-74" level="3"><display>(iv)</display>from a location that materially interferes with access to private property;</subsection><subsection ssid="6-null-40" dnum="v-o" numlevel="1" lineno="896" slineno="4-75" level="3"><display>(v)</display>from the property of a detached single-family dwelling or duplex; or</subsection><subsection ssid="6-null-41" dnum="vi-o" numlevel="1" lineno="897" slineno="4-76" level="3"><display>(vi)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> a legal repossession.</subsection></subsection></subsection><subsection ssid="6-null-42" dnum="4-o" numlevel="1" lineno="898" slineno="4-77" level="1" space="false"><display>(4)</display><subsection ssid="6-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A private property owner may, subject to the requirements of a local ordinance, <ln numlevel="1" lineno="899" slineno="4-78"/>enforce parking restrictions by:<subsection ssid="6-null-44" dnum="i-o" numlevel="1" lineno="900" slineno="4-79" level="3" tab="1"><display>(i)</display>authorizing a tow truck motor carrier to patrol and monitor the property and <ln numlevel="1" lineno="901" slineno="4-80"/>enforce parking restrictions on behalf of the property owner in accordance with <ln numlevel="1" lineno="902" slineno="4-81"/>Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref>;</subsection><subsection ssid="6-null-45" dnum="ii-o" numlevel="1" lineno="903" slineno="4-82" level="3" tab="1"><display>(ii)</display>enforcing parking restrictions as needed by requesting a tow from a tow truck <ln numlevel="1" lineno="904" slineno="4-83"/>motor carrier on a case-by-case basis in accordance with Subsection <xref depth="4" refnumber="72-9-603(8)">(8)</xref>; or</subsection><subsection ssid="6-null-46" dnum="iii-o" numlevel="1" lineno="905" slineno="4-84" level="3" tab="1"><display>(iii)</display>requesting a tow from a tow truck motor carrier after providing 24-hour written <ln numlevel="1" lineno="906" slineno="4-85"/>notice in accordance with Subsection <xref depth="4" refnumber="72-9-603(9)">(9)</xref>.</subsection></subsection><subsection ssid="6-null-47" dnum="b-o" numlevel="1" lineno="907" slineno="4-86" level="2" space="false"><display>(b)</display><subsection ssid="6-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Any agreement between a private property owner and tow truck motor carrier <ln numlevel="1" lineno="908" slineno="4-87"/>authorizing the tow truck motor carrier to patrol and monitor the property under <ln numlevel="1" lineno="909" slineno="4-88"/>Subsection <xref depth="4" refnumber="72-9-603(4)(a)(i)">(4)(a)(i)</xref> shall include specific terms and conditions for the tow truck <ln numlevel="1" lineno="910" slineno="4-89"/>motor carrier to remove a vehicle, vessel, or outboard motor from the property.</subsection><subsection ssid="6-null-49" dnum="ii-o" numlevel="1" lineno="911" slineno="4-90" level="3"><display>(ii)</display>In addition to the signage described in Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref> or <xref depth="4" refnumber="72-9-603(8)">(8)</xref>, a private property <ln numlevel="1" lineno="912" slineno="4-91"/>owner who allows public parking shall erect appropriate signage on the property <ln numlevel="1" lineno="913" slineno="4-92"/>indicating clear instructions for parking at the property.</subsection><subsection ssid="6-null-50" dnum="iii-o" numlevel="1" lineno="914" slineno="4-93" level="3"><display>(iii)</display>Where a single parking area includes abutting parcels of property owned by two <ln numlevel="1" lineno="915" slineno="4-94"/>or more private property owners who enforce different parking restrictions under <ln numlevel="1" lineno="916" slineno="4-95"/>Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref> or <xref depth="4" refnumber="72-9-603(8)">(8)</xref>, each property owner shall, in addition to the requirements <ln numlevel="1" lineno="917" slineno="4-96"/>under Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref> or <xref depth="4" refnumber="72-9-603(8)">(8)</xref>, erect signage as required by this section:<subsection ssid="6-null-51" dnum="A-o" numlevel="1" lineno="918" slineno="4-97" level="4"><display>(A)</display>at each entrance to the property owner's parcel from another property owner's <ln numlevel="1" lineno="919" slineno="4-98"/>parcel; and</subsection><subsection ssid="6-null-52" dnum="B-o" numlevel="1" lineno="920" slineno="4-99" level="4"><display>(B)</display>if there is no clearly defined entrance between one property owner's parcel and <ln numlevel="1" lineno="921" slineno="4-100"/>another property owner's parcel, at intervals of 40 feet or less along the line <ln numlevel="1" lineno="922" slineno="4-101"/>dividing the property owner's parcel from the other property owner's parcel.</subsection></subsection><subsection ssid="6-null-53" dnum="iv-o" numlevel="1" lineno="923" slineno="4-102" level="3"><display>(iv)</display>Where there is no clearly defined entrance to a parking area from a highway, the <ln numlevel="1" lineno="924" slineno="4-103"/>property owner shall erect signage as required by this section at intervals of 40 <ln numlevel="1" lineno="925" slineno="4-104"/>feet or less along any portion of a property line where a vehicle, vessel, or <ln numlevel="1" lineno="926" slineno="4-105"/>outboard motor may enter the parking area.</subsection></subsection></subsection><subsection ssid="6-null-54" dnum="5-o" numlevel="1" lineno="927" slineno="4-106" level="1"><display>(5)</display>Nothing in Subsection <xref depth="4" refnumber="72-9-603(3)">(3)</xref> or <xref depth="4" refnumber="72-9-603(4)">(4)</xref> restricts the ability of a private property owner from, <ln numlevel="1" lineno="928" slineno="4-107"/>subject to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">the provisions of </amend><amendoutend style="2"/>this section, instituting and enforcing regulations for <ln numlevel="1" lineno="929" slineno="4-108"/>parking at the property.</subsection><subsection ssid="6-null-55" dnum="6-o" numlevel="1" lineno="930" slineno="4-109" level="1"><display>(6)</display>In addition to any other powers provided by law, a political subdivision or state agency <ln numlevel="1" lineno="931" slineno="4-110"/>may:<subsection ssid="6-null-56" dnum="a-o" numlevel="1" lineno="932" slineno="4-111" level="2"><display>(a)</display>enforce parking restrictions in accordance with Subsections <xref depth="4" refnumber="72-9-603(7)">(7)</xref> through (9) on <ln numlevel="1" lineno="933" slineno="4-112"/>property that is:<subsection ssid="6-null-57" dnum="i-o" numlevel="1" lineno="934" slineno="4-113" level="3"><display>(i)</display>owned by the political subdivision or state agency;</subsection><subsection ssid="6-null-58" dnum="ii-o" numlevel="1" lineno="935" slineno="4-114" level="3"><display>(ii)</display>located outside of the public right-of-way; and</subsection><subsection ssid="6-null-59" dnum="iii-o" numlevel="1" lineno="936" slineno="4-115" level="3"><display>(iii)</display>open to public parking; and</subsection></subsection><subsection ssid="6-null-60" dnum="b-o" numlevel="1" lineno="937" slineno="4-116" level="2"><display>(b)</display>request or direct a tow truck service <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both">in order </amend><amendoutend style="2"/>to abate a public nuisance on private <ln numlevel="1" lineno="938" slineno="4-117"/>property over which the political subdivision or state agency has jurisdiction.</subsection></subsection><subsection ssid="6-null-61" dnum="7-o" numlevel="1" lineno="939" slineno="4-118" level="1"><display>(7)</display>For private property where parking is enforced under Subsection <xref depth="4" refnumber="72-9-603(4)(a)(i)">(4)(a)(i)</xref>, the property <ln numlevel="1" lineno="940" slineno="4-119"/>owner shall ensure that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">each </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an </amend>entrance to the property has signs located on the <ln numlevel="1" lineno="941" slineno="4-120"/>property and clearly visible to the driver of a vehicle entering the property that <ln numlevel="1" lineno="942" slineno="4-121"/>substantially comply with the following, as determined by the department:<subsection ssid="6-null-62" dnum="a-o" numlevel="1" lineno="943" slineno="4-122" level="2"><display>(a)</display>a top sign that is 24 inches tall by 18 inches wide and has:<subsection ssid="6-null-63" dnum="i-o" numlevel="1" lineno="944" slineno="4-123" level="3"><display>(i)</display>a blue, reflective background with a 1/2 inch white border;</subsection><subsection ssid="6-null-64" dnum="ii-o" numlevel="1" lineno="945" slineno="4-124" level="3"><display>(ii)</display>two-inch, white letters at the top of the sign with the capitalized words "Lot is <ln numlevel="1" lineno="946" slineno="4-125"/>Patrolled";</subsection><subsection ssid="6-null-65" dnum="iii-o" numlevel="1" lineno="947" slineno="4-126" level="3"><display>(iii)</display>a white towing logo that is six inches tall and 16 inches wide that depicts an <ln numlevel="1" lineno="948" slineno="4-127"/>entire tow truck, a tow hook, and an entire vehicle being towed; and</subsection><subsection ssid="6-null-66" dnum="iv-o" numlevel="1" lineno="949" slineno="4-128" level="3"><display>(iv)</display>two-inch, white letters at the bottom of the sign with the capitalized words <ln numlevel="1" lineno="950" slineno="4-129"/>"Towing Enforced"; and</subsection></subsection><subsection ssid="6-null-67" dnum="b-o" numlevel="1" lineno="951" slineno="4-130" level="2"><display>(b)</display>a bottom sign that is 24 inches tall by 18 inches wide with a 1/2 inch white, reflective <ln numlevel="1" lineno="952" slineno="4-131"/>border, and has:<subsection ssid="6-null-68" dnum="i-o" numlevel="1" lineno="953" slineno="4-132" level="3"><display>(i)</display>a top half that is red background with white, reflective letters indicating:<subsection ssid="6-null-69" dnum="A-o" numlevel="1" lineno="954" slineno="4-133" level="4"><display>(A)</display>who is authorized to park or restricted from parking at the property; and</subsection><subsection ssid="6-null-70" dnum="B-o" numlevel="1" lineno="955" slineno="4-134" level="4"><display>(B)</display>any type of vehicle prohibited from parking at the property; and</subsection></subsection><subsection ssid="6-null-71" dnum="ii-o" numlevel="1" lineno="956" slineno="4-135" level="3"><display>(ii)</display>a bottom half that has a white, reflective background with red letters indicating:<subsection ssid="6-null-72" dnum="A-o" numlevel="1" lineno="957" slineno="4-136" level="4"><display>(A)</display>the name and telephone number of the tow truck motor carrier that the <ln numlevel="1" lineno="958" slineno="4-137"/>property owner has authorized to patrol the property; and</subsection><subsection ssid="6-null-73" dnum="B-o" numlevel="1" lineno="959" slineno="4-138" level="4"><display>(B)</display>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="122" groupid="79" style="2" owner="jchristopherson" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="118" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">internet</amend> web address "tow.utah.gov".</subsection></subsection></subsection></subsection><subsection ssid="6-null-74" dnum="8-o" numlevel="1" lineno="960" slineno="4-139" level="1" space="false"><display>(8)</display><subsection ssid="6-null-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For private property where parking is enforced under Subsection <xref depth="4" refnumber="72-9-603(4)(a)(ii)">(4)(a)(ii)</xref><amend anum="0" ea="amend" pairid="136" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="both">, a tow <ln numlevel="1" lineno="961" slineno="4-140"/>truck motor carrier may not</amend>:<subsection ssid="6-null-76" dnum="i-o:_-i" numlevel="1" lineno="962" slineno="4-141" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1544" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="139" groupid="91" style="2" owner="jchristopherson" level="1" deltag="end">a tow truck motor carrier may not:</amend><amendoutend style="2"/><subsection ssid="6-null-77" dnum="A-o:i-i" numlevel="1" lineno="963" slineno="4-142" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1545" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1546" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>patrol and monitor the property;</subsection><subsection ssid="6-null-78" dnum="B-o:ii-i" numlevel="1" lineno="964" slineno="4-143" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1546" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1547" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>perform a tow truck service without the written or verbal request of the <ln numlevel="1" lineno="965" slineno="4-144"/>property owner or the property owner's agent; or</subsection><subsection ssid="6-null-79" dnum="C-o:iii-i" numlevel="1" lineno="966" slineno="4-145" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1547" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1548" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>act as the property owner's agent to request a tow truck service.</subsection></subsection></subsection><subsection ssid="6-null-80" dnum="b-o" numlevel="1" lineno="967" slineno="4-146" level="2"><display>(b)</display>For private property where parking is enforced under Subsection <xref tempid="537" depth="4" refnumber="72-9-603(4)(a)(ii)">(4)(a)(ii)</xref>, the <ln numlevel="1" lineno="968" slineno="4-147"/>property owner shall ensure that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both">each</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> entrance to the property has a clearly <ln numlevel="1" lineno="969" slineno="4-148"/>visible sign located on the property that substantially follows the following format, as <ln numlevel="1" lineno="970" slineno="4-149"/>determined by the department:<subsection ssid="6-null-81" dnum="i-o" numlevel="1" lineno="971" slineno="4-150" level="3"><display>(i)</display> the sign is 24 inches tall by 18 inches wide with a 1/2 inch white, reflective <ln numlevel="1" lineno="972" slineno="4-151"/>border, and has:<subsection ssid="6-null-82" dnum="A-o" numlevel="1" lineno="973" slineno="4-152" level="4"><display>(A)</display>at the top of the sign, a blue background with a white, reflective towing logo <ln numlevel="1" lineno="974" slineno="4-153"/>that is at least four inches tall and 16 inches wide that depicts an entire tow <ln numlevel="1" lineno="975" slineno="4-154"/>truck, a tow hook, and an entire vehicle being towed;</subsection><subsection ssid="6-null-83" dnum="B-o" numlevel="1" lineno="976" slineno="4-155" level="4"><display>(B)</display>immediately below the towing logo described in Subsection <xref depth="4" refnumber="72-9-603(8)(b)(i)(a)">(8)(b)(i)(A)</xref>, a <ln numlevel="1" lineno="977" slineno="4-156"/>blue background with white, reflective letters at least two inches tall with the <ln numlevel="1" lineno="978" slineno="4-157"/>capitalized words "Towing Enforced";<amend anum="0" ea="amend" pairid="119" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="6-null-84" dnum="C-o" numlevel="1" lineno="979" slineno="4-158" level="4"><display>(C)</display>in the middle of the sign, a red background with white, reflective letters at <ln numlevel="1" lineno="980" slineno="4-159"/>least one inch tall indicating who is authorized to park or restricted from <ln numlevel="1" lineno="981" slineno="4-160"/>parking at the property, and any type of vehicle prohibited from parking at the <ln numlevel="1" lineno="982" slineno="4-161"/>property; and</subsection></subsection><subsection ssid="6-null-85" dnum="ii-o" numlevel="1" lineno="983" slineno="4-162" level="3"><display>(ii)</display>at the bottom of the sign, a white, reflective background with red letters at least <ln numlevel="1" lineno="984" slineno="4-163"/>one inch tall indicating:<subsection ssid="6-null-86" dnum="A-o" numlevel="1" lineno="985" slineno="4-164" level="4"><display>(A)</display>either the name and telephone number of the property owner or the property <ln numlevel="1" lineno="986" slineno="4-165"/>owner's agent who is authorized to request a tow truck service, or the name and <ln numlevel="1" lineno="987" slineno="4-166"/>telephone number of the tow truck motor carrier that provides tow truck <ln numlevel="1" lineno="988" slineno="4-167"/>services for the property; and</subsection><subsection ssid="6-null-87" dnum="B-o" numlevel="1" lineno="989" slineno="4-168" level="4"><display>(B)</display>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="80" style="2" owner="jchristopherson" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="120" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">internet<marker pairid="116"/><marker pairid="117"/></amend> web address "tow.utah.gov".</subsection></subsection></subsection><subsection ssid="6-null-88" dnum="c-o" numlevel="1" lineno="990" slineno="4-169" level="2"><display>(c)</display>If a dispute arises regarding whether a sign required under this section substantially <ln numlevel="1" lineno="991" slineno="4-170"/>complies with the requirements of this section, the department shall determine <ln numlevel="1" lineno="992" slineno="4-171"/>whether the sign substantially complies.</subsection></subsection><subsection ssid="6-null-89" dnum="9-o" numlevel="1" lineno="993" slineno="4-172" level="1" space="false"><display>(9)</display><subsection ssid="6-null-90" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For private property without signage substantially meeting the requirements of <ln numlevel="1" lineno="994" slineno="4-173"/>Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref> or (8), as determined by the department, the property owner may <ln numlevel="1" lineno="995" slineno="4-174"/>request a tow truck motor carrier to remove a vehicle, vessel, or outboard motor from <ln numlevel="1" lineno="996" slineno="4-175"/>the private property 24 hours after the property owner or the property owner's agent <ln numlevel="1" lineno="997" slineno="4-176"/>affixes a written notice to the vehicle, vessel, or outboard motor in accordance with <ln numlevel="1" lineno="998" slineno="4-177"/>this Subsection <xref depth="4" refnumber="72-9-603(9)">(9)</xref>.</subsection><subsection ssid="6-null-91" dnum="b-o" numlevel="1" lineno="999" slineno="4-178" level="2"><display>(b)</display>The written notice described in Subsection <xref depth="4" refnumber="72-9-603(9)(a)">(9)(a)</xref> shall:<subsection ssid="6-null-92" dnum="i-o" numlevel="1" lineno="1000" slineno="4-179" level="3"><display>(i)</display>indicate the exact time when the written notice is affixed to the vehicle, vessel, or <ln numlevel="1" lineno="1001" slineno="4-180"/>outboard motor;</subsection><subsection ssid="6-null-93" dnum="ii-o" numlevel="1" lineno="1002" slineno="4-181" level="3"><display>(ii)</display>warn the owner of the vehicle, vessel, or outboard motor that the vehicle, vessel, <ln numlevel="1" lineno="1003" slineno="4-182"/>or outboard motor will be towed from the property if it is not removed within 24 <ln numlevel="1" lineno="1004" slineno="4-183"/>hours after the time indicated in Subsection <xref depth="4" refnumber="72-9-603(9)(b)(i)">(9)(b)(i)</xref>;</subsection><subsection ssid="6-null-94" dnum="iii-o" numlevel="1" lineno="1005" slineno="4-184" level="3"><display>(iii)</display>be at least four inches tall and four inches wide; and</subsection><subsection ssid="6-null-95" dnum="iv-o" numlevel="1" lineno="1006" slineno="4-185" level="3"><display>(iv)</display>be affixed to the vehicle, vessel, or outboard motor at a conspicuous location on <ln numlevel="1" lineno="1007" slineno="4-186"/>the driver's side window of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="6-null-96" dnum="c-o" numlevel="1" lineno="1008" slineno="4-187" level="2"><display>(c)</display>A property owner may authorize a tow truck motor carrier to act as the property <ln numlevel="1" lineno="1009" slineno="4-188"/>owner's agent for purposes of affixing the written notice described in Subsection <xref depth="4" refnumber="72-9-603(9)(a)"><ln numlevel="1" lineno="1010" slineno="4-189"/>(9)(a)</xref> to a vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="6-null-97" dnum="10-o" numlevel="1" lineno="1011" slineno="4-190" level="1"><display>(10)</display>The department shall publish on the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="146" groupid="97" style="2" owner="jchristopherson" level="1" deltag="both">department Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="121" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><marker pairid="100"/><marker pairid="102"/><marker pairid="101"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="147" groupid="98" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="141" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">department's </amend>website the <ln numlevel="1" lineno="1012" slineno="4-191"/>signage requirements and written notice requirements and illustrated or photographed <ln numlevel="1" lineno="1013" slineno="4-192"/>examples of the signage and written notice requirements described in Subsections <xref depth="4" refnumber="72-9-603(7)">(7)</xref> <ln numlevel="1" lineno="1014" slineno="4-193"/>through <xref depth="4" refnumber="72-9-603(9)">(9)</xref>.</subsection><subsection ssid="6-null-98" dnum="11-o" numlevel="1" lineno="1015" slineno="4-194" level="1"><display>(11)</display>It is an affirmative defense to any claim, based on the lack of notice, that arises from <ln numlevel="1" lineno="1016" slineno="4-195"/>the towing of a vehicle, vessel, or outboard motor from private property that the property <ln numlevel="1" lineno="1017" slineno="4-196"/>had signage meeting the requirements of:<subsection ssid="6-null-99" dnum="a-o" numlevel="1" lineno="1018" slineno="4-197" level="2"><display>(a)</display>Subsection <xref depth="4" refnumber="72-9-603(4)(b)(ii)">(4)(b)(ii)</xref>; and</subsection><subsection ssid="6-null-100" dnum="b-o" numlevel="1" lineno="1019" slineno="4-198" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="72-9-603(7)">(7)</xref> or <xref depth="4" refnumber="72-9-603(8)">(8)</xref>.</subsection></subsection><subsection ssid="6-null-101" dnum="12-o" numlevel="1" lineno="1020" slineno="4-199" level="1"><display>(12)</display>An individual described in Subsection <xref depth="4" refnumber="41-6a-1406(7)(f)(i)">41-6a-1406(7)(f)(i)</xref> or a party described in <ln numlevel="1" lineno="1021" slineno="4-200"/>Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> with an interest in a vehicle, vessel, or outboard motor <ln numlevel="1" lineno="1022" slineno="4-201"/>lawfully removed is only responsible for paying:<subsection ssid="6-null-102" dnum="a-o" numlevel="1" lineno="1023" slineno="4-202" level="2"><display>(a)</display>the tow truck service and storage fees set in accordance with Subsection <xref depth="4" refnumber="72-9-603(16)">(16)</xref>; and</subsection><subsection ssid="6-null-103" dnum="b-o" numlevel="1" lineno="1024" slineno="4-203" level="2"><display>(b)</display>the administrative impound fee set in Section <xref depth="3" refnumber="41-6a-1406">41-6a-1406</xref>, if applicable.</subsection></subsection><subsection ssid="6-null-104" dnum="13-o" numlevel="1" lineno="1025" slineno="4-204" level="1" space="false"><display>(13)</display><subsection ssid="6-null-105" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref refnumber="72-9-603(13)" depth="4">(13)</xref>, "life essential item" means:<subsection ssid="6-null-106" dnum="i-o" numlevel="1" lineno="1026" slineno="4-205" level="3" tab="1"><display>(i)</display>prescription medication;</subsection><subsection ssid="6-null-107" dnum="ii-o" numlevel="1" lineno="1027" slineno="4-206" level="3" tab="1"><display>(ii)</display>medical equipment;</subsection><subsection ssid="6-null-108" dnum="iii-o" numlevel="1" lineno="1028" slineno="4-207" level="3" tab="1"><display>(iii)</display>shoes;</subsection><subsection ssid="6-null-109" dnum="iv-o" numlevel="1" lineno="1029" slineno="4-208" level="3" tab="1"><display>(iv)</display>coats;</subsection><subsection ssid="6-null-110" dnum="v-o" numlevel="1" lineno="1030" slineno="4-209" level="3" tab="1"><display>(v)</display>food and water;</subsection><subsection ssid="6-null-111" dnum="vi-o" numlevel="1" lineno="1031" slineno="4-210" level="3" tab="1"><display>(vi)</display>child safety seats;</subsection><subsection ssid="6-165" dnum="_-o:vii-i" numlevel="1" lineno="1032" slineno="4-211" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1580" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">a cell phone;</amend></subsection><subsection ssid="6-166" dnum="_-o:viii-i" numlevel="1" lineno="1033" slineno="4-212" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1581" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">tools specific to the registered owner's current employment;</amend></subsection><subsection ssid="6-null-112" dnum="vii-o:ix-i" numlevel="1" lineno="1034" slineno="4-213" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1582" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1583" style="1" owner="i" level="1" amendtag="both" space="true">(ix)</amend></display>government-issued photo identification; and</subsection><subsection ssid="6-null-113" dnum="viii-o:x-i" numlevel="1" lineno="1035" slineno="4-214" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1583" style="2" owner="o" level="1" deltag="both">(viii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1584" style="1" owner="i" level="1" amendtag="both" space="true">(x)</amend></display>human remains.</subsection></subsection><subsection ssid="6-null-114" dnum="b-o" numlevel="1" lineno="1036" slineno="4-215" level="2"><display>(b)</display>The fees under Subsection <xref depth="4" refnumber="72-9-603(12)">(12)</xref> are a possessory lien on the vehicle, vessel, or <ln numlevel="1" lineno="1037" slineno="4-216"/>outboard motor.</subsection><subsection ssid="6-null-115" dnum="c-o" numlevel="1" lineno="1038" slineno="4-217" level="2"><display>(c)</display>Towing fees are a possessory lien on the vehicle, vessel, or outboard motor and any <ln numlevel="1" lineno="1039" slineno="4-218"/>nonlife essential items contained in the vehicle, vessel, or outboard motor.</subsection><subsection ssid="6-null-116" dnum="d-o" numlevel="1" lineno="1040" slineno="4-219" level="2"><display>(d)</display>Except for a vehicle, vessel, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/>outboard motor<amend anum="0" ea="amend" pairid="42" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both">, or</amend> <amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">an item </amend>being held as evidence, <ln numlevel="1" lineno="1041" slineno="4-220"/>a tow truck operator, a tow truck motor carrier, or an impound yard shall allow a <ln numlevel="1" lineno="1042" slineno="4-221"/>party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> with an interest in the vehicle, vessel, <ln numlevel="1" lineno="1043" slineno="4-222"/>or outboard motor or an individual described in Subsection <xref depth="4" refnumber="41-6a-1406(7)(f)(i)">41-6a-1406(7)(f)(i)</xref> to <ln numlevel="1" lineno="1044" slineno="4-223"/>take possession of any life essential item within the vehicle, vessel, or outboard <ln numlevel="1" lineno="1045" slineno="4-224"/>motor <amend anum="0" ea="amend" pairid="145" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="both">after completion of a life essential item retrieval form </amend>during normal business <ln numlevel="1" lineno="1046" slineno="4-225"/>hours regardless of whether the towing, impound fees, or storage fees have been paid.</subsection><subsection ssid="6-null-117" dnum="e-o" numlevel="1" lineno="1047" slineno="4-226" level="2"><display>(e)</display>Except for a vehicle, vessel, or outboard motor being held as evidence, upon <ln numlevel="1" lineno="1048" slineno="4-227"/>payment of the towing fee, a tow truck operator, a tow truck motor carrier, or an <ln numlevel="1" lineno="1049" slineno="4-228"/>impound yard shall allow a party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> with an <ln numlevel="1" lineno="1050" slineno="4-229"/>interest in the vehicle, vessel, or outboard motor or an individual described in <ln numlevel="1" lineno="1051" slineno="4-230"/>Subsection <xref depth="4" refnumber="41-6a-1406(7)(f)(i)">41-6a-1406(7)(f)(i)</xref> to enter the vehicle, vessel, or outboard motor during <ln numlevel="1" lineno="1052" slineno="4-231"/>normal business hours and remove personal property not attached to the vehicle, <ln numlevel="1" lineno="1053" slineno="4-232"/>vessel, or outboard motor.</subsection><subsection ssid="6-null-118" dnum="f-o" numlevel="1" lineno="1054" slineno="4-233" level="2"><display>(f)</display>The tow truck operator or tow truck motor carrier shall securely store the vehicle, <ln numlevel="1" lineno="1055" slineno="4-234"/>vessel, or outboard motor and items described in Subsection <xref depth="4" refnumber="72-9-603(13)(a)">(13)(a)</xref> in an approved <ln numlevel="1" lineno="1056" slineno="4-235"/>state impound yard until a party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> with an <ln numlevel="1" lineno="1057" slineno="4-236"/>interest in the vehicle, vessel, or outboard motor:<subsection ssid="6-null-119" dnum="i-o" numlevel="1" lineno="1058" slineno="4-237" level="3"><display>(i)</display>pays the fees described in Subsection <xref depth="4" refnumber="72-9-603(12)">(12)</xref>; and</subsection><subsection ssid="6-null-120" dnum="ii-o" numlevel="1" lineno="1059" slineno="4-238" level="3"><display>(ii)</display>removes the vehicle, vessel, or outboard motor from the state impound yard.</subsection></subsection></subsection><subsection ssid="6-null-121" dnum="14-o" numlevel="1" lineno="1060" slineno="4-239" level="1" space="false"><display>(14)</display><subsection ssid="6-null-122" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A vehicle, vessel, or outboard motor shall be considered abandoned if a party <ln numlevel="1" lineno="1061" slineno="4-240"/>described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> with an interest in the vehicle, vessel, or <ln numlevel="1" lineno="1062" slineno="4-241"/>outboard motor or an individual described in Subsection <xref depth="4" refnumber="41-6a-1406(7)(f)(i)">41-6a-1406(7)(f)(i)</xref> does not, <ln numlevel="1" lineno="1063" slineno="4-242"/>within 30 days after notice has been sent under Subsection <xref depth="4" refnumber="72-9-603(1)(b)">(1)(b)</xref>:<subsection ssid="6-null-123" dnum="i-o" numlevel="1" lineno="1064" slineno="4-243" level="3" tab="1"><display>(i)</display>pay the fees described in Subsection <xref depth="4" refnumber="72-9-603(12)">(12)</xref>; and</subsection><subsection ssid="6-null-124" dnum="ii-o" numlevel="1" lineno="1065" slineno="4-244" level="3" tab="1"><display>(ii)</display>remove the vehicle, vessel, or outboard motor from the secure storage facility.</subsection></subsection><subsection ssid="6-null-125" dnum="b-o" numlevel="1" lineno="1066" slineno="4-245" level="2"><display>(b)</display>A person may not request a transfer of title to an abandoned vehicle, vessel, or <ln numlevel="1" lineno="1067" slineno="4-246"/>outboard motor until at least 30 days after notice has been sent under Subsection <xref depth="4" refnumber="72-9-603(1)(b)"><ln numlevel="1" lineno="1068" slineno="4-247"/>(1)(b)</xref>.</subsection></subsection><subsection ssid="6-null-126" dnum="15-o" numlevel="1" lineno="1069" slineno="4-248" level="1" space="false"><display>(15)</display><subsection ssid="6-null-127" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A tow truck motor carrier or impound yard shall clearly and conspicuously post <ln numlevel="1" lineno="1070" slineno="4-249"/>and disclose all <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">its current </amend><amendoutend style="2"/>fees, rates, and acceptable forms of payment for tow <ln numlevel="1" lineno="1071" slineno="4-250"/>truck service and storage of a vehicle in accordance with rules established under <ln numlevel="1" lineno="1072" slineno="4-251"/>Subsection <xref depth="4" refnumber="72-9-603(16)">(16)</xref>.</subsection><subsection ssid="6-null-128" dnum="b-o" numlevel="1" lineno="1073" slineno="4-252" level="2"><display>(b)</display>A tow truck operator, a tow truck motor carrier, and an impound yard shall accept <ln numlevel="1" lineno="1074" slineno="4-253"/>payment by cash and debit or credit card for a tow truck service under Subsection <xref depth="4" refnumber="72-9-603(1)">(1)</xref> <ln numlevel="1" lineno="1075" slineno="4-254"/>or any service rendered, performed, or supplied in connection with a tow truck <ln numlevel="1" lineno="1076" slineno="4-255"/>service under Subsection <xref depth="4" refnumber="72-9-603(1)">(1)</xref>.</subsection></subsection><subsection ssid="6-null-129" dnum="16-o" numlevel="1" lineno="1077" slineno="4-256" level="1"><display>(16)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="1078" slineno="4-257"/>department shall:<subsection ssid="6-null-130" dnum="a-o" numlevel="1" lineno="1079" slineno="4-258" level="2"><display>(a)</display>subject to the restriction in Subsection <xref depth="4" refnumber="72-9-603(17)">(17)</xref>, set maximum rates that:<subsection ssid="6-null-131" dnum="i-o" numlevel="1" lineno="1080" slineno="4-259" level="3"><display>(i)</display>a tow truck motor carrier may charge for the tow truck service of a vehicle, vessel, <ln numlevel="1" lineno="1081" slineno="4-260"/>or outboard motor that are transported in response to:<subsection ssid="6-null-132" dnum="A-o" numlevel="1" lineno="1082" slineno="4-261" level="4"><display>(A)</display>a peace officer dispatch call;</subsection><subsection ssid="6-null-133" dnum="B-o" numlevel="1" lineno="1083" slineno="4-262" level="4"><display>(B)</display>a motor vehicle division call; and</subsection><subsection ssid="6-null-134" dnum="C-o" numlevel="1" lineno="1084" slineno="4-263" level="4"><display>(C)</display>any other call or request where the owner of the vehicle, vessel, or outboard <ln numlevel="1" lineno="1085" slineno="4-264"/>motor has not consented to the removal;</subsection></subsection><subsection ssid="6-null-135" dnum="ii-o" numlevel="1" lineno="1086" slineno="4-265" level="3"><display>(ii)</display>an impound yard may charge for the storage of a vehicle, vessel, or outboard <ln numlevel="1" lineno="1087" slineno="4-266"/>motor stored as a result of one of the conditions listed under Subsection <xref depth="4" refnumber="72-9-603(16)(a)(i)">(16)(a)(i)</xref>; <ln numlevel="1" lineno="1088" slineno="4-267"/>and</subsection><subsection ssid="6-null-136" dnum="iii-o" numlevel="1" lineno="1089" slineno="4-268" level="3"><display>(iii)</display>an impound yard may charge for the after-hours release of a vehicle, vessel, or <ln numlevel="1" lineno="1090" slineno="4-269"/>outboard motor stored as a result of one of the conditions described in Subsection <xref depth="4" refnumber="72-9-603(16)(a)(i)"><ln numlevel="1" lineno="1091" slineno="4-270"/>(16)(a)(i)</xref>;</subsection></subsection><subsection ssid="6-null-137" dnum="b-o" numlevel="1" lineno="1092" slineno="4-271" level="2"><display>(b)</display>establish authorized towing certification requirements, not in conflict with federal <ln numlevel="1" lineno="1093" slineno="4-272"/>law, related to incident safety, clean-up, and hazardous material handling;</subsection><subsection ssid="6-null-138" dnum="c-o" numlevel="1" lineno="1094" slineno="4-273" level="2"><display>(c)</display>specify the form and content of the posting and disclosure of fees and rates charged <ln numlevel="1" lineno="1095" slineno="4-274"/>and acceptable forms of payment by a tow truck motor carrier or impound yard;</subsection><subsection ssid="6-null-139" dnum="d-o" numlevel="1" lineno="1096" slineno="4-275" level="2"><display>(d)</display>set a maximum rate for an administrative fee that a tow truck motor carrier may <ln numlevel="1" lineno="1097" slineno="4-276"/>charge for reporting the information required under Subsection <xref depth="4" refnumber="72-9-603(1)(a)(i)">(1)(a)(i)</xref> and <ln numlevel="1" lineno="1098" slineno="4-277"/>providing notice of the removal to each party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)"><ln numlevel="1" lineno="1099" slineno="4-278"/>41-6a-1406(6)(a)</xref> with an interest in the vehicle, vessel, or outboard motor as required <ln numlevel="1" lineno="1100" slineno="4-279"/>in Subsection <xref depth="4" refnumber="72-9-603(1)(b)">(1)(b)</xref>;</subsection><subsection ssid="6-null-140" dnum="e-o" numlevel="1" lineno="1101" slineno="4-280" level="2"><display>(e)</display>establish a Utah Consumer Bill of Rights Regarding Towing form that contains <ln numlevel="1" lineno="1102" slineno="4-281"/>specific information regarding:<subsection ssid="6-null-141" dnum="i-o" numlevel="1" lineno="1103" slineno="4-282" level="3"><display>(i)</display>a vehicle owner's or operator's rights and responsibilities if the owner's vehicle is <ln numlevel="1" lineno="1104" slineno="4-283"/>towed;</subsection><subsection ssid="6-null-142" dnum="ii-o" numlevel="1" lineno="1105" slineno="4-284" level="3"><display>(ii)</display>identifies the maximum rates that a tow truck motor carrier may charge for the <ln numlevel="1" lineno="1106" slineno="4-285"/>tow truck service of a vehicle, vessel, or outboard motor that is transported in <ln numlevel="1" lineno="1107" slineno="4-286"/>response to a call or request where the owner of the vehicle, vessel, or outboard <ln numlevel="1" lineno="1108" slineno="4-287"/>motor has not consented to the removal; and</subsection><subsection ssid="6-null-143" dnum="iii-o" numlevel="1" lineno="1109" slineno="4-288" level="3"><display>(iii)</display>identifies the maximum rates that an impound yard may charge for the storage of <ln numlevel="1" lineno="1110" slineno="4-289"/>vehicle, vessel, or outboard motor that is transported in response to a call or <ln numlevel="1" lineno="1111" slineno="4-290"/>request where the owner of the vehicle, vessel, or outboard motor has not <ln numlevel="1" lineno="1112" slineno="4-291"/>consented to the removal; and</subsection></subsection><subsection ssid="6-null-144" dnum="f-o" numlevel="1" lineno="1113" slineno="4-292" level="2"><display>(f)</display>set a maximum rate for an after-hours fee allowed under Subsection <xref depth="4" refnumber="72-9-603(19)(b)">(19)(b)</xref>.</subsection></subsection><subsection ssid="6-null-145" dnum="17-o" numlevel="1" lineno="1114" slineno="4-293" level="1"><display>(17)</display>An impound yard may not charge a fee for the storage of an impounded vehicle, <ln numlevel="1" lineno="1115" slineno="4-294"/>vessel, or outboard motor if:<subsection ssid="6-null-146" dnum="a-o" numlevel="1" lineno="1116" slineno="4-295" level="2"><display>(a)</display>the vehicle, vessel, or outboard motor is being held as evidence; and</subsection><subsection ssid="6-null-147" dnum="b-o" numlevel="1" lineno="1117" slineno="4-296" level="2"><display>(b)</display>the vehicle, vessel, or outboard motor is not being released to a party described in <ln numlevel="1" lineno="1118" slineno="4-297"/>Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> or an individual described in Subsection <xref depth="4" refnumber="41-6a-1406(7)(f)(i)"><ln numlevel="1" lineno="1119" slineno="4-298"/>41-6a-1406(7)(f)(i)</xref>, even if the party satisfies the requirements to release the vehicle, <ln numlevel="1" lineno="1120" slineno="4-299"/>vessel, or outboard motor under Section <xref depth="3" refnumber="41-6a-1406">41-6a-1406</xref>.</subsection></subsection><subsection ssid="6-null-148" dnum="18-o" numlevel="1" lineno="1121" slineno="4-300" level="1" space="false"><display>(18)</display><subsection ssid="6-null-149" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="6-null-150" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A tow truck motor carrier may charge a rate up to the maximum rate set by <ln numlevel="1" lineno="1122" slineno="4-301"/>the department in rules made under Subsection <xref depth="4" refnumber="72-9-603(16)">(16)</xref>.</subsection><subsection ssid="6-null-151" dnum="ii-o" numlevel="1" lineno="1123" slineno="4-302" level="3" tab="1"><display>(ii)</display>In addition to the maximum rates established under Subsection <xref depth="4" refnumber="72-9-603(16)">(16)</xref> and when <ln numlevel="1" lineno="1124" slineno="4-303"/>receiving payment by credit card or debit card, a tow truck operator, a tow truck <ln numlevel="1" lineno="1125" slineno="4-304"/>motor carrier, or an impound yard may charge a card processing fee of 3% of the <ln numlevel="1" lineno="1126" slineno="4-305"/>transaction total.</subsection></subsection><subsection ssid="6-null-152" dnum="b-o" numlevel="1" lineno="1127" slineno="4-306" level="2"><display>(b)</display>A tow truck motor carrier may not be required to maintain insurance coverage at a <ln numlevel="1" lineno="1128" slineno="4-307"/>higher level than required in rules made <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="73" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> Subsection <xref depth="4" refnumber="72-9-603(16)"><ln numlevel="1" lineno="1129" slineno="4-308"/>(16)</xref>.</subsection></subsection><subsection ssid="6-null-153" dnum="19-o" numlevel="1" lineno="1130" slineno="4-309" level="1"><display>(19)</display>When a tow truck motor carrier or impound lot is in possession of a vehicle, vessel, or <ln numlevel="1" lineno="1131" slineno="4-310"/>outboard motor as a result of a tow service that was performed without the consent of <ln numlevel="1" lineno="1132" slineno="4-311"/>the owner, and that was not ordered by a peace officer or a person acting on behalf of a <ln numlevel="1" lineno="1133" slineno="4-312"/>law enforcement agency, the tow truck motor carrier or impound yard shall make <ln numlevel="1" lineno="1134" slineno="4-313"/>personnel available:<subsection ssid="6-null-154" dnum="a-o" numlevel="1" lineno="1135" slineno="4-314" level="2"><display>(a)</display>by phone 24 hours a day, seven days a week; and</subsection><subsection ssid="6-null-155" dnum="b-o" numlevel="1" lineno="1136" slineno="4-315" level="2"><display>(b)</display>to release the impounded vehicle, vessel, or outboard motor to the owner within one <ln numlevel="1" lineno="1137" slineno="4-316"/>hour of when the owner calls the tow truck motor carrier or impound yard.</subsection></subsection><subsection ssid="6-null-156" dnum="20-o" numlevel="1" lineno="1138" slineno="4-317" level="1"><display>(20)</display>A tow truck motor carrier or a tow truck operator may not:<subsection ssid="6-null-157" dnum="a-o" numlevel="1" lineno="1139" slineno="4-318" level="2"><display>(a)</display>share contact or other personal information of an owner of a vehicle, vessel, or <ln numlevel="1" lineno="1140" slineno="4-319"/>outboard motor or a party described in Subsection <xref depth="4" refnumber="41-6a-1406(6)(a)">41-6a-1406(6)(a)</xref> for which the <ln numlevel="1" lineno="1141" slineno="4-320"/>tow truck motor carrier or tow truck operator has performed a tow service; and</subsection><subsection ssid="6-null-158" dnum="b-o" numlevel="1" lineno="1142" slineno="4-321" level="2"><display>(b)</display>receive payment for referring a person for whom the tow truck motor carrier or tow <ln numlevel="1" lineno="1143" slineno="4-322"/>truck operator has performed a tow service to another service, including:<subsection ssid="6-null-159" dnum="i-o" numlevel="1" lineno="1144" slineno="4-323" level="3"><display>(i)</display>a lawyer referral service;</subsection><subsection ssid="6-null-160" dnum="ii-o" numlevel="1" lineno="1145" slineno="4-324" level="3"><display>(ii)</display>a medical provider;</subsection><subsection ssid="6-null-161" dnum="iii-o" numlevel="1" lineno="1146" slineno="4-325" level="3"><display>(iii)</display>a funding agency;</subsection><subsection ssid="6-null-162" dnum="iv-o" numlevel="1" lineno="1147" slineno="4-326" level="3"><display>(iv)</display>a marketer for any service described in Subsections <xref depth="4" refnumber="72-9-603(20)(b)(i)">(20)(b)(i)</xref> through <xref depth="4" refnumber="72-9-603(iii)">(iii)</xref>;</subsection><subsection ssid="6-null-163" dnum="v-o" numlevel="1" lineno="1148" slineno="4-327" level="3"><display>(v)</display>a marketer for any other service; or</subsection><subsection ssid="6-null-164" dnum="vi-o" numlevel="1" lineno="1149" slineno="4-328" level="3"><display>(vi)</display>a third party vendor.</subsection></subsection></subsection></section></bsec><bsec buid="15" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="1150" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="1150">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="1151"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-23-26 5:16 PM</tm></rev></foot></leg>
