Stratton</sponsorhead><otherSponsorhead>House Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to an action brought for a violation of the free exercise <ln numlevel="1" lineno="6" slineno="0-6"/>of religion.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">amends the Governmental Immunity Act of Utah to clarify that the government waives <ln numlevel="1" lineno="10" slineno="0-10"/>immunity in relation to a cause of action described in Title 63G, Chapter 33, Free <ln numlevel="1" lineno="11" slineno="0-11"/>Exercise of Religion; and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">amends Title 63G, Chapter 33, Free Exercise of Religion, to clarify that a cause of action <ln numlevel="1" lineno="13" slineno="0-13"/>described in that chapter makes multiple types of relief available to a person that brings <ln numlevel="1" lineno="14" slineno="0-14"/>the action, including:<hl numlevel="1" lineno="15" slineno="0-15" level="2">damages;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="2">declaratory relief;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="2">injunctive relief; and</hl><hl numlevel="1" lineno="18" slineno="0-18" level="2">all other types of legal relief.</hl></hl></hp><moni numlevel="1" lineno="19" slineno="0-19" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="20">None</moniNone><oc numlevel="1" lineno="21" slineno="0-21">Other Special Clauses:</oc><ocNone lineno="22">None</ocNone><sa numlevel="1" lineno="23" slineno="0-23">Utah Code Sections Affected:<saamd numlevel="1" lineno="24" slineno="0-24"><snhead>AMENDS:</snhead><sn num="63G-7-201" src="code" uid="C63G-7-S201_2026050620260506" buid="2" sort="63G07 02010020260506" numlevel="1" lineno="25" slineno="0-25"><bold>63G-7-201</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 15</sn><sn num="63G-7-301" src="code" uid="C63G-7-S301_2026050620260506" buid="6" sort="63G07 03010020260506" numlevel="1" lineno="26" slineno="0-26"><bold>63G-7-301</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 9</sn><sn num="63G-33-201" src="code" uid="C63G-33-S201_2026050620260506" buid="1" sort="63G33 02010020260506" numlevel="1" lineno="27" slineno="0-27"><bold>63G-33-201</bold>, as last amended by Laws of Utah 2025, Chapter 326</sn></saamd></sa></lt><enacthead lineno="28"/><enact numlevel="1" lineno="29" slineno="0-29">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="2" num="63G-7-201" type="amend" src="code" uid="C63G-7-S201_2026050620260506" sort="63G07 02010020260506" numlevel="1" lineno="30" slineno="1-1" sn="1"><section number="63G-7-201" numlevel="1" lineno="31" slineno="1-2" type="amend"><secline lineno="30">Section 1. Section <bold>63G-7-201</bold> is amended to read:</secline><catline lineno="31"><bold>63G-7-201<parens/>. Immunity of governmental entities and employees from suit.</bold></catline><subsection ssid="2-null-80" dnum="1-o" numlevel="1" lineno="32" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided in this chapter, each governmental entity and each <ln numlevel="1" lineno="33" slineno="1-4"/>employee of a governmental entity are immune from suit for any injury that results from <ln numlevel="1" lineno="34" slineno="1-5"/>the exercise of a governmental function.</subsection><subsection ssid="2-null-81" dnum="2-o" numlevel="1" lineno="35" slineno="1-6" level="1"><display>(2)</display>Notwithstanding the waiver of immunity provisions of Section <xref depth="3" refnumber="63G-7-301" start="0">63G-7-301</xref>, a <ln numlevel="1" lineno="36" slineno="1-7"/>governmental entity, its officers, and its employees are immune from suit:<subsection ssid="2-null-82" dnum="a-o" numlevel="1" lineno="37" slineno="1-8" level="2"><display>(a)</display>as provided in Section <xref depth="3" refnumber="78B-4-517" start="0">78B-4-517</xref>; and</subsection><subsection ssid="2-null-83" dnum="b-o" numlevel="1" lineno="38" slineno="1-9" level="2"><display>(b)</display>for any injury or damage resulting from the implementation of or the failure to <ln numlevel="1" lineno="39" slineno="1-10"/>implement measures to:<subsection ssid="2-null-84" dnum="i-o" numlevel="1" lineno="40" slineno="1-11" level="3"><display>(i)</display>control the causes of epidemic and communicable diseases and other conditions <ln numlevel="1" lineno="41" slineno="1-12"/>significantly affecting the public health or necessary to protect the public health as <ln numlevel="1" lineno="42" slineno="1-13"/>set out in <xref depth="1" refnumber="26A-1" start="0">Title 26A, Chapter 1, Local Health Departments</xref>;</subsection><subsection ssid="2-null-85" dnum="ii-o" numlevel="1" lineno="43" slineno="1-14" level="3"><display>(ii)</display>investigate and control suspected bioterrorism and disease as set out in Sections <xref depth="3" refnumber="26B-7-316" start="0"><ln numlevel="1" lineno="44" slineno="1-15"/>26B-7-316</xref> through <xref depth="3" refnumber="26B-7-324" start="0">26B-7-324</xref>;</subsection><subsection ssid="2-null-86" dnum="iii-o" numlevel="1" lineno="45" slineno="1-16" level="3"><display>(iii)</display>respond to a national, state, or local emergency, a public health emergency as <ln numlevel="1" lineno="46" slineno="1-17"/>defined in Section <xref depth="3" refnumber="26B-7-301" start="0">26B-7-301</xref>, or a declaration by the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">President</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">president</amend> of the <ln numlevel="1" lineno="47" slineno="1-18"/>United States or other federal official requesting public health related activities, <ln numlevel="1" lineno="48" slineno="1-19"/>including the use, provision, operation, and management of:<subsection ssid="2-null-87" dnum="A-o" numlevel="1" lineno="49" slineno="1-20" level="4"><display>(A)</display>an emergency shelter;</subsection><subsection ssid="2-null-88" dnum="B-o" numlevel="1" lineno="50" slineno="1-21" level="4"><display>(B)</display>housing;</subsection><subsection ssid="2-null-89" dnum="C-o" numlevel="1" lineno="51" slineno="1-22" level="4"><display>(C)</display>a staging place; or</subsection><subsection ssid="2-null-90" dnum="D-o" numlevel="1" lineno="52" slineno="1-23" level="4"><display>(D)</display>a medical facility; and</subsection></subsection><subsection ssid="2-null-91" dnum="iv-o" numlevel="1" lineno="53" slineno="1-24" level="3"><display>(iv)</display>adopt methods or measures, in accordance with Section <xref depth="3" refnumber="26B-1-202" start="0">26B-1-202</xref>, for health <ln numlevel="1" lineno="54" slineno="1-25"/>care providers, public health entities, and health care insurers to coordinate among <ln numlevel="1" lineno="55" slineno="1-26"/>themselves to verify the identity of the individuals they serve.</subsection></subsection></subsection><subsection ssid="2-null-92" dnum="3-o" numlevel="1" lineno="56" slineno="1-27" level="1" space="false"><display>(3)</display><subsection ssid="2-null-93" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity, its officers, and its employees are immune from suit, and <ln numlevel="1" lineno="57" slineno="1-28"/>immunity is not waived, for any injury if the injury arises out of or in connection <ln numlevel="1" lineno="58" slineno="1-29"/>with, or results from:<subsection ssid="2-null-94" dnum="i-o" numlevel="1" lineno="59" slineno="1-30" level="3" tab="1"><display>(i)</display>a latent dangerous or latent defective condition of:<subsection ssid="2-null-95" dnum="A-o" numlevel="1" lineno="60" slineno="1-31" level="4"><display>(A)</display>any highway, road, street, alley, crosswalk, sidewalk, culvert, tunnel, bridge, <ln numlevel="1" lineno="61" slineno="1-32"/>or viaduct; or</subsection><subsection ssid="2-null-96" dnum="B-o" numlevel="1" lineno="62" slineno="1-33" level="4"><display>(B)</display>another structure located on any of the items listed in this Subsection <xref depth="4" refnumber="63G-7-201(3)(a)(i)" start="0">(3)(a)(i)</xref>; <ln numlevel="1" lineno="63" slineno="1-34"/>or</subsection></subsection><subsection ssid="2-null-97" dnum="ii-o" numlevel="1" lineno="64" slineno="1-35" level="3" tab="1"><display>(ii)</display>a latent dangerous or latent defective condition of any public building, structure, <ln numlevel="1" lineno="65" slineno="1-36"/>dam, reservoir, or other public improvement.</subsection></subsection><subsection ssid="2-null-98" dnum="b-o" numlevel="1" lineno="66" slineno="1-37" level="2" space="false"><display>(b)</display><subsection ssid="2-null-99" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-201(3)(b)" start="0">(3)(b)</xref>:<subsection ssid="2-null-100" dnum="A-o" numlevel="1" lineno="67" slineno="1-38" level="4" tab="1"><display>(A)</display>"Contaminated land" means the same as that term is defined in Section <xref depth="3" refnumber="11-58-102" start="0"><ln numlevel="1" lineno="68" slineno="1-39"/>11-58-102</xref>.</subsection><subsection ssid="2-null-101" dnum="B-o" numlevel="1" lineno="69" slineno="1-40" level="4" tab="1"><display>(B)</display>"Contamination" means the condition of land that results from the placement, <ln numlevel="1" lineno="70" slineno="1-41"/>disposal, or release of hazardous matter on, in, or under the land, including any <ln numlevel="1" lineno="71" slineno="1-42"/>seeping or escaping of the hazardous matter from the land.</subsection><subsection ssid="2-null-102" dnum="C-o" numlevel="1" lineno="72" slineno="1-43" level="4" tab="1"><display>(C)</display>"Damage" means any property damage, personal injury, or other injury or any <ln numlevel="1" lineno="73" slineno="1-44"/>loss of any kind, however denominated.</subsection><subsection ssid="2-null-103" dnum="D-o" numlevel="1" lineno="74" slineno="1-45" level="4" tab="1"><display>(D)</display>"Environmentally compliant" means, as applicable, obtaining a certificate of <ln numlevel="1" lineno="75" slineno="1-46"/>completion from the Department of Environmental Quality under Section <xref depth="3" refnumber="19-8-111" start="0"><ln numlevel="1" lineno="76" slineno="1-47"/>19-8-111</xref> following participation in a voluntary cleanup under <xref depth="1" refnumber="19-8" start="0">Title 19, Chapter <ln numlevel="1" lineno="77" slineno="1-48"/>8, Voluntary Cleanup Program</xref>, obtaining an administrative letter from the <ln numlevel="1" lineno="78" slineno="1-49"/>Department of Environmental Quality for a discrete phase of a voluntary <ln numlevel="1" lineno="79" slineno="1-50"/>cleanup that is conducted under a remedial action plan as defined in Section <xref depth="3" refnumber="11-58-605" start="0"><ln numlevel="1" lineno="80" slineno="1-51"/>11-58-605</xref>, or complying with the terms of an environmental covenant, as <ln numlevel="1" lineno="81" slineno="1-52"/>defined in Section <xref depth="3" refnumber="57-25-102" start="0">57-25-102</xref>, signed by an agency, as defined in Section <xref depth="3" refnumber="57-25-102" start="0"><ln numlevel="1" lineno="82" slineno="1-53"/>57-25-102</xref>, and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">duly </amend><amendoutend style="2"/>recorded in the office of the recorder of the county in <ln numlevel="1" lineno="83" slineno="1-54"/>which the contaminated land is located.</subsection><subsection ssid="2-null-104" dnum="E-o" numlevel="1" lineno="84" slineno="1-55" level="4" tab="1"><display>(E)</display>"Government owner" means a governmental entity, including an independent <ln numlevel="1" lineno="85" slineno="1-56"/>entity, as defined in Section <xref depth="3" refnumber="63E-1-102" start="0">63E-1-102</xref>, that acquires an ownership interest in <ln numlevel="1" lineno="86" slineno="1-57"/>land that was contaminated land before the governmental entity or independent <ln numlevel="1" lineno="87" slineno="1-58"/>entity acquired an ownership interest in the land.</subsection><subsection ssid="2-null-105" dnum="F-o" numlevel="1" lineno="88" slineno="1-59" level="4" tab="1"><display>(F)</display>"Hazardous matter" means hazardous materials, as defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>,  <ln numlevel="1" lineno="89" slineno="1-60"/>hazardous substances, as defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>, or landfill material, as <ln numlevel="1" lineno="90" slineno="1-61"/>defined in Section <xref depth="3" refnumber="11-58-102" start="0">11-58-102</xref>.</subsection><subsection ssid="2-null-106" dnum="G-o" numlevel="1" lineno="91" slineno="1-62" level="4" tab="1"><display>(G)</display>"Remediation" means the same as that term is defined in Section <xref depth="3" refnumber="11-58-102" start="0">11-58-102</xref>.</subsection></subsection><subsection ssid="2-null-107" dnum="ii-o" numlevel="1" lineno="92" slineno="1-63" level="3" space="false"><display>(ii)</display><subsection ssid="2-null-108" dnum="A-o" level="4" placement="sameline"><display>(A)</display>A government owner and the government owner's officers and employees <ln numlevel="1" lineno="93" slineno="1-64"/>are immune from suit, and immunity is not waived, for any claim for damage <ln numlevel="1" lineno="94" slineno="1-65"/>that arises out of or in connection with, or results from, contamination of <ln numlevel="1" lineno="95" slineno="1-66"/>contaminated land.</subsection><subsection ssid="2-null-109" dnum="B-o" numlevel="1" lineno="96" slineno="1-67" level="4"><display>(B)</display>A government owner's ownership of contaminated land may not be the basis <ln numlevel="1" lineno="97" slineno="1-68"/>of a claim against the government owner for damage that arises out of or in <ln numlevel="1" lineno="98" slineno="1-69"/>connection with, or results from, contamination of contaminated land.</subsection></subsection><subsection ssid="2-null-110" dnum="iii-o" numlevel="1" lineno="99" slineno="1-70" level="3"><display>(iii)</display>Subsection <xref depth="4" refnumber="63G-7-201(3)(b)(ii)" start="0">(3)(b)(ii)</xref> does not limit or affect:<subsection ssid="2-null-111" dnum="A-o" numlevel="1" lineno="100" slineno="1-71" level="4"><display>(A)</display>the liability of a person that placed, disposed of, or released hazardous matter <ln numlevel="1" lineno="101" slineno="1-72"/>on, in, or under the land; or</subsection><subsection ssid="2-null-112" dnum="B-o" numlevel="1" lineno="102" slineno="1-73" level="4"><display>(B)</display>a worker compensation claim of an employee of an entity that conducts work <ln numlevel="1" lineno="103" slineno="1-74"/>on or related to contaminated land.</subsection></subsection><subsection ssid="2-null-113" dnum="iv-o" numlevel="1" lineno="104" slineno="1-75" level="3"><display>(iv)</display>Immunity under Subsection <xref depth="4" refnumber="63G-7-201(3)(b)(ii)(A)" start="0">(3)(b)(ii)(A)</xref> is not affected by a government owner's <ln numlevel="1" lineno="105" slineno="1-76"/>remediation of contaminated land if the government owner is environmentally <ln numlevel="1" lineno="106" slineno="1-77"/>compliant.</subsection></subsection></subsection><subsection ssid="2-null-114" dnum="4-o" numlevel="1" lineno="107" slineno="1-78" level="1"><display>(4)</display>A governmental entity, its officers, and its employees are immune from suit, and <ln numlevel="1" lineno="108" slineno="1-79"/>immunity is not waived, for any injury proximately caused by a negligent act or <ln numlevel="1" lineno="109" slineno="1-80"/>omission of an employee committed within the scope of employment, if the injury arises <ln numlevel="1" lineno="110" slineno="1-81"/>out of or in connection with, or results from:<subsection ssid="2-null-115" dnum="a-o" numlevel="1" lineno="111" slineno="1-82" level="2"><display>(a)</display>the exercise or performance, or the failure to exercise or perform, a discretionary <ln numlevel="1" lineno="112" slineno="1-83"/>function, <amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">regardless of </amend>whether<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> or not</amend><amendoutend style="2"/> the discretion is abused;</subsection><subsection ssid="2-null-116" dnum="b-o" numlevel="1" lineno="113" slineno="1-84" level="2"><display>(b)</display>except as provided in Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-7-301(2)(j)" start="0">63G-7-301(2)(j)</xref>, <xref depth="4" refnumber="63G-7-301(3)" start="0">(3)</xref>, and <xref depth="4" refnumber="63G-7-301(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63G-7-301(2)(k)">63G-7-301(2)(k)</xref>, <ln numlevel="1" lineno="114" slineno="1-85"/>(3), and (4)</amend>, assault, battery, false imprisonment, false arrest, malicious prosecution, <ln numlevel="1" lineno="115" slineno="1-86"/>intentional trespass, abuse of process, libel, slander, deceit, interference with contract <ln numlevel="1" lineno="116" slineno="1-87"/>rights, infliction of mental anguish, or violation of civil rights;</subsection><subsection ssid="2-null-117" dnum="c-o" numlevel="1" lineno="117" slineno="1-88" level="2"><display>(c)</display>the issuance, denial, suspension, or revocation of, or the failure or refusal to issue, <ln numlevel="1" lineno="118" slineno="1-89"/>deny, suspend, or revoke, any permit, license, certificate, approval, order, or similar <ln numlevel="1" lineno="119" slineno="1-90"/>authorization;</subsection><subsection ssid="2-null-118" dnum="d-o" numlevel="1" lineno="120" slineno="1-91" level="2"><display>(d)</display>a failure to make an inspection or making an inadequate or negligent inspection;</subsection><subsection ssid="2-null-119" dnum="e-o" numlevel="1" lineno="121" slineno="1-92" level="2"><display>(e)</display>the institution or prosecution of any judicial or administrative proceeding, even if <ln numlevel="1" lineno="122" slineno="1-93"/>malicious or without probable cause;</subsection><subsection ssid="2-null-120" dnum="f-o" numlevel="1" lineno="123" slineno="1-94" level="2"><display>(f)</display>a misrepresentation by an employee whether or not the misrepresentation is negligent <ln numlevel="1" lineno="124" slineno="1-95"/>or intentional;</subsection><subsection ssid="2-null-121" dnum="g-o" numlevel="1" lineno="125" slineno="1-96" level="2"><display>(g)</display>a riot, unlawful assembly, public demonstration, mob violence, or civil disturbance;</subsection><subsection ssid="2-null-122" dnum="h-o" numlevel="1" lineno="126" slineno="1-97" level="2"><display>(h)</display>the collection or assessment of taxes;</subsection><subsection ssid="2-null-123" dnum="i-o" numlevel="1" lineno="127" slineno="1-98" level="2"><display>(i)</display>an activity of the Utah National Guard;</subsection><subsection ssid="2-null-124" dnum="j-o" numlevel="1" lineno="128" slineno="1-99" level="2"><display>(j)</display>the incarceration of a person in a state prison, county or city jail, or other place of <ln numlevel="1" lineno="129" slineno="1-100"/>legal confinement;</subsection><subsection ssid="2-null-125" dnum="k-o" numlevel="1" lineno="130" slineno="1-101" level="2"><display>(k)</display>a natural condition on publicly owned or controlled land;</subsection><subsection ssid="2-null-126" dnum="l-o" numlevel="1" lineno="131" slineno="1-102" level="2"><display>(l)</display>a condition existing in connection with an abandoned mine or mining operation;</subsection><subsection ssid="2-null-127" dnum="m-o" numlevel="1" lineno="132" slineno="1-103" level="2"><display>(m)</display>an activity authorized by the School and Institutional Trust Lands Administration or <ln numlevel="1" lineno="133" slineno="1-104"/>the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="2-null-128" dnum="n-o" numlevel="1" lineno="134" slineno="1-105" level="2"><display>(n)</display>the operation or existence of a trail that is along a water facility, as defined in Section <xref depth="3" refnumber="73-1-8" start="0"><ln numlevel="1" lineno="135" slineno="1-106"/>73-1-8</xref>, stream, or river, regardless of ownership or operation of the water facility, <ln numlevel="1" lineno="136" slineno="1-107"/>stream, or river, if:<subsection ssid="2-null-129" dnum="i-o" numlevel="1" lineno="137" slineno="1-108" level="3"><display>(i)</display>the trail is designated under a general plan adopted by a municipality under <ln numlevel="1" lineno="138" slineno="1-109"/>Section <xref depth="3" refnumber="10-20-401">10-20-401</xref> or by a county under Section <xref depth="3" refnumber="17-79-401">17-79-401</xref>;</subsection><subsection ssid="2-null-130" dnum="ii-o" numlevel="1" lineno="139" slineno="1-110" level="3"><display>(ii)</display>the trail right-of-way or the right-of-way where the trail is located is open to <ln numlevel="1" lineno="140" slineno="1-111"/>public use as evidenced by a written agreement between:<subsection ssid="2-null-131" dnum="A-o" numlevel="1" lineno="141" slineno="1-112" level="4"><display>(A)</display>the owner or operator of the trail right-of-way or of the right-of-way where the <ln numlevel="1" lineno="142" slineno="1-113"/>trail is located; and</subsection><subsection ssid="2-null-132" dnum="B-o" numlevel="1" lineno="143" slineno="1-114" level="4"><display>(B)</display>the municipality or county where the trail is located; and</subsection></subsection><subsection ssid="2-null-133" dnum="iii-o" numlevel="1" lineno="144" slineno="1-115" level="3"><display>(iii)</display>the written agreement:<subsection ssid="2-null-134" dnum="A-o" numlevel="1" lineno="145" slineno="1-116" level="4"><display>(A)</display>contains a plan for operation and maintenance of the trail; and</subsection><subsection ssid="2-null-135" dnum="B-o" numlevel="1" lineno="146" slineno="1-117" level="4"><display>(B)</display>provides that an owner or operator of the trail right-of-way or of the <ln numlevel="1" lineno="147" slineno="1-118"/>right-of-way where the trail is located has, at a minimum, the same level of <ln numlevel="1" lineno="148" slineno="1-119"/>immunity from suit as the governmental entity in connection with or resulting <ln numlevel="1" lineno="149" slineno="1-120"/>from the use of the trail;</subsection></subsection></subsection><subsection ssid="2-null-136" dnum="o-o" numlevel="1" lineno="150" slineno="1-121" level="2"><display>(o)</display>research or implementation of cloud management or seeding for the clearing of fog;</subsection><subsection ssid="2-null-137" dnum="p-o" numlevel="1" lineno="151" slineno="1-122" level="2"><display>(p)</display>the management of flood waters, earthquakes, or natural disasters;</subsection><subsection ssid="2-null-138" dnum="q-o" numlevel="1" lineno="152" slineno="1-123" level="2"><display>(q)</display>the construction, repair, or operation of flood or storm systems;</subsection><subsection ssid="2-null-139" dnum="r-o" numlevel="1" lineno="153" slineno="1-124" level="2"><display>(r)</display>the operation of an emergency vehicle, while being driven in accordance with the <ln numlevel="1" lineno="154" slineno="1-125"/>requirements of Section <xref depth="3" refnumber="41-6a-212" start="0">41-6a-212</xref>;</subsection><subsection ssid="2-null-140" dnum="s-o" numlevel="1" lineno="155" slineno="1-126" level="2"><display>(s)</display>the activity of:<subsection ssid="2-null-141" dnum="i-o" numlevel="1" lineno="156" slineno="1-127" level="3"><display>(i)</display>providing emergency medical assistance;</subsection><subsection ssid="2-null-142" dnum="ii-o" numlevel="1" lineno="157" slineno="1-128" level="3"><display>(ii)</display>fighting fire;</subsection><subsection ssid="2-null-143" dnum="iii-o" numlevel="1" lineno="158" slineno="1-129" level="3"><display>(iii)</display>regulating, mitigating, or handling hazardous materials or hazardous wastes;</subsection><subsection ssid="2-null-144" dnum="iv-o" numlevel="1" lineno="159" slineno="1-130" level="3"><display>(iv)</display>an emergency evacuation;</subsection><subsection ssid="2-null-145" dnum="v-o" numlevel="1" lineno="160" slineno="1-131" level="3"><display>(v)</display>transporting or removing an injured person to a place where emergency medical <ln numlevel="1" lineno="161" slineno="1-132"/>assistance can be rendered or where the person can be transported by a licensed <ln numlevel="1" lineno="162" slineno="1-133"/>ambulance service; or</subsection><subsection ssid="2-null-146" dnum="vi-o" numlevel="1" lineno="163" slineno="1-134" level="3"><display>(vi)</display>intervening during a dam emergency;</subsection></subsection><subsection ssid="2-null-147" dnum="t-o" numlevel="1" lineno="164" slineno="1-135" level="2"><display>(t)</display>the exercise or performance, or the failure to exercise or perform, any function in <ln numlevel="1" lineno="165" slineno="1-136"/>accordance with <xref depth="1" refnumber="73-10" start="0">Title 73, Chapter 10, Board of Water Resources - Division of Water <ln numlevel="1" lineno="166" slineno="1-137"/>Resources</xref>;</subsection><subsection ssid="2-null-148" dnum="u-o" numlevel="1" lineno="167" slineno="1-138" level="2"><display>(u)</display>an unauthorized access to government records, data, or electronic information <ln numlevel="1" lineno="168" slineno="1-139"/>systems by any person or entity;</subsection><subsection ssid="2-null-149" dnum="v-o" numlevel="1" lineno="169" slineno="1-140" level="2"><display>(v)</display>an activity of wildlife, as defined in Section <xref depth="3" refnumber="23A-1-101" start="0">23A-1-101</xref>, that arises during the use of <ln numlevel="1" lineno="170" slineno="1-141"/>a public or private road;</subsection><subsection ssid="2-null-150" dnum="w-o" numlevel="1" lineno="171" slineno="1-142" level="2"><display>(w)</display>a communication between employees of one or more law enforcement agencies <ln numlevel="1" lineno="172" slineno="1-143"/>related to the employment, disciplinary history, character, professional competence, <ln numlevel="1" lineno="173" slineno="1-144"/>or physical or mental health of a peace officer, or a former, current, or prospective <ln numlevel="1" lineno="174" slineno="1-145"/>employee of a law enforcement agency, including any communication made in <ln numlevel="1" lineno="175" slineno="1-146"/>accordance with Section <xref depth="3" refnumber="53-14-103" start="0">53-14-103</xref>; or</subsection><subsection ssid="2-null-151" dnum="x-o" numlevel="1" lineno="176" slineno="1-147" level="2"><display>(x)</display>providing or failing to provide information under Section <xref depth="3" refnumber="53-27-102" start="0">53-27-102</xref> or Subsection <xref depth="4" refnumber="41-1a-213(6)" start="0"><ln numlevel="1" lineno="177" slineno="1-148"/>41-1a-213(6)</xref>, <xref depth="4" refnumber="41-1a-213(7)" start="0">(7)</xref>, or <xref depth="4" refnumber="41-1a-213(8)" start="0">(8)</xref>, <xref depth="4" refnumber="53-3-207(4)" start="0">53-3-207(4)</xref>, or <xref depth="4" refnumber="53-3-805(5)" start="0">53-3-805(5)</xref>.</subsection></subsection><subsection ssid="2-null-152" dnum="5-o" numlevel="1" lineno="178" slineno="1-149" level="1"><display>(5)</display>The following are immune from suit, and immunity is not waived for an action or <ln numlevel="1" lineno="179" slineno="1-150"/>failure to act within the scope of duties or employment, if the injury arises out of, in <ln numlevel="1" lineno="180" slineno="1-151"/>connection with, or results from the implementation of Section <xref depth="3" refnumber="17E-7-401">17E-7-401</xref> to the extent <ln numlevel="1" lineno="181" slineno="1-152"/>it addresses evaluating and classifying high risk wildland urban interface property, <ln numlevel="1" lineno="182" slineno="1-153"/>Section <xref depth="3" refnumber="31A-22-1310">31A-22-1310</xref>, or Title 65A, Chapter 8, Part 4, Wildland Urban Interface <ln numlevel="1" lineno="183" slineno="1-154"/>Property:<subsection ssid="2-null-153" dnum="a-o" numlevel="1" lineno="184" slineno="1-155" level="2"><display>(a)</display>the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="2-null-154" dnum="b-o" numlevel="1" lineno="185" slineno="1-156" level="2"><display>(b)</display>an officer, employee, or consultant of the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="2-null-155" dnum="c-o" numlevel="1" lineno="186" slineno="1-157" level="2"><display>(c)</display>a county;</subsection><subsection ssid="2-null-156" dnum="d-o" numlevel="1" lineno="187" slineno="1-158" level="2"><display>(d)</display>a wildland urban interface coordinator, as defined in Section <xref depth="3" refnumber="65A-8-401">65A-8-401</xref>;</subsection><subsection ssid="2-null-157" dnum="e-o" numlevel="1" lineno="188" slineno="1-159" level="2"><display>(e)</display>the Insurance Department; or</subsection><subsection ssid="2-null-158" dnum="f-o" numlevel="1" lineno="189" slineno="1-160" level="2"><display>(f)</display>an officer, employee, or consultant of the Insurance Department.</subsection></subsection></section></bsec><bsec buid="6" num="63G-7-301" type="amend" src="code" uid="C63G-7-S301_2026050620260506" sort="63G07 03010020260506" numlevel="1" lineno="190" slineno="2-1" sn="2"><section number="63G-7-301" numlevel="1" lineno="191" slineno="2-2" type="amend"><secline lineno="190">Section 2. Section <bold>63G-7-301</bold> is amended to read:</secline><catline lineno="191"><bold>63G-7-301<parens/>. Waivers of immunity.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="192" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Immunity from suit of each governmental entity is waived as to any contractual <ln numlevel="1" lineno="193" slineno="2-4"/>obligation.</subsection><subsection ssid="6-null-3" dnum="b-o" numlevel="1" lineno="194" slineno="2-5" level="2"><display>(b)</display>Actions arising out of contractual rights or dnum="c-o" numlevel="1" lineno="196" slineno="2-7" level="2"><display>(c)</display>The Division of Water Resources is not liable for failure to deliver water from a <ln numlevel="1" lineno="197" slineno="2-8"/>reservoir or associated facility authorized by Title <xref depth="1" refnumber="73-26">73, Chapter 26</xref>, Bear River <ln numlevel="1" lineno="198" slineno="2-9"/>Development Act, if the failure to deliver the contractual amount of water is due to <ln numlevel="1" lineno="199" slineno="2-10"/>drought, other natural condition, or safety condition that causes a deficiency in the <ln numlevel="1" lineno="200" slineno="2-11"/>amount of available water.</subsection></subsection><subsection ssid="6-null-5" dnum="2-o" numlevel="1" lineno="201" slineno="2-12" level="1"><display>(2)</display>Immunity from suit of each governmental entity is waived:<subsection ssid="6-null-6" dnum="a-o" numlevel="1" lineno="202" slineno="2-13" level="2"><display>(a)</display>as to any action brought to recover, obtain possession of, or quiet title to real or <ln numlevel="1" lineno="203" slineno="2-14"/>personal property;</subsection><subsection ssid="6-null-7" dnum="b-o" numlevel="1" lineno="204" slineno="2-15" level="2"><display>(b)</display>as to any action brought to foreclose mortgages or other liens on real or personal <ln numlevel="1" lineno="205" slineno="2-16"/>property, to determine any adverse claim on real or personal property, or to obtain an <ln numlevel="1" lineno="206" slineno="2-17"/>adjudication about any mortgage or other lien that the governmental entity may have <ln numlevel="1" lineno="207" slineno="2-18"/>or claim on real or personal property;</subsection><subsection ssid="6-null-8" dnum="c-o" numlevel="1" lineno="208" slineno="2-19" level="2"><display>(c)</display>as to any action based on the negligent destruction, damage, or loss of goods, <ln numlevel="1" lineno="209" slineno="2-20"/>merchandise, or other property while it is in the possession of any governmental <ln numlevel="1" lineno="210" slineno="2-21"/>entity or employee, if the property was seized for the purpose of forfeiture under any <ln numlevel="1" lineno="211" slineno="2-22"/>provision of state law;</subsection><subsection ssid="6-null-9" dnum="d-o" numlevel="1" lineno="212" slineno="2-23" level="2"><display>(d)</display>subject to Section <xref depth="3" refnumber="63G-7-302">63G-7-302</xref>, as to any action brought under the authority of Utah <ln numlevel="1" lineno="213" slineno="2-24"/>Constitution, Article I, Section 22, for the recovery of compensation from the <ln numlevel="1" lineno="214" slineno="2-25"/>governmental entity when the governmental entity has taken or damaged private <ln numlevel="1" lineno="215" slineno="2-26"/>property for public uses without just compensation;</subsection><subsection ssid="6-null-10" dnum="e-o" numlevel="1" lineno="216" slineno="2-27" level="2"><display>(e)</display>as to any claim for attorney fees or costs under Section <xref depth="3" refnumber="63G-2-209">63G-2-209</xref>, <xref Employees <ln numlevel="1" lineno="219" slineno="2-30"/>Act;</subsection><subsection ssid="6-null-12" dnum="g-o" numlevel="1" lineno="220" slineno="2-31" level="2"><display>(g)</display>as to any action brought to obtain relief from a land use regulation that imposes a <ln numlevel="1" lineno="221" slineno="2-32"/>substantial burden on the free exercise of religion under Title <xref depth="1" refnumber="63L-5">63L, Chapter 5</xref>, Utah <ln numlevel="1" lineno="222" slineno="2-33"/>Religious Land Use Act;</subsection><subsection ssid="6-71" dnum="_-o:h-i" numlevel="1" lineno="223" government action, as defined in <ln numlevel="1" lineno="224" slineno="2-35"/>Section <xref depth="3" refnumber="63G-33-101">63G-33-101</xref>, that substantially burdens, as defined in Section <xref depth="3" refnumber="63G-33-101">63G-33-101</xref>, <ln numlevel="1" lineno="225" slineno="2-36"/>the free exercise of religion under Title 63G, Chapter 33, Utah Religious Freedom <ln numlevel="1" lineno="226" slineno="2-37"/>Restoration Act;</amend></subsection><subsection ssid="6-null-13" dnum="h-o:i-i" numlevel="1" lineno="227" slineno="2-38" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1092" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>except as provided in Subsection <xref depth="4" refnumber="63G-7-201(3)">63G-7-201(3)</xref>, as to any injury caused by:<subsection ssid="6-null-14" dnum="i-o" numlevel="1" lineno="228" slineno="2-39" level="3"><display>(i)</display>a defective, unsafe, or dangerous condition of any highway, road, street, alley, <ln numlevel="1" lineno="229" slineno="2-40"/>crosswalk, sidewalk, culvert, tunnel, bridge, viaduct, or other structure located on <ln numlevel="1" lineno="230" slineno="2-41"/>them; or</subsection><subsection ssid="6-null-15" dnum="ii-o" numlevel="1" lineno="231" slineno="2-42" level="3"><display>(ii)</display>any defective or dangerous condition of a public building, structure, dam, <ln numlevel="1" lineno="232" slineno="2-43"/>reservoir, or other public improvement;</subsection></subsection><subsection ssid="6-null-16" dnum="i-o:j-i" numlevel="1" lineno="233" slineno="2-44" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1095" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>subject to Subsections <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref> and <xref depth="4" refnumber="63G-7-201(4)">63G-7-201(4)</xref>, as to any injury <ln numlevel="1" lineno="234" slineno="2-45"/>proximately caused by a negligent act or omission of an employee committed within <ln numlevel="1" lineno="235" slineno="2-46"/>the scope of employment;</subsection><subsection ssid="6-null-17" dnum="j-o:k-i" numlevel="1" lineno="236" slineno="2-47" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(j)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both" space="true">(k)</amend></display>notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, as to a claim for an injury resulting <ln numlevel="1" lineno="237" slineno="2-48"/>from a sexual battery, as provided in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, committed:<subsection ssid="6-null-18" dnum="i-o" numlevel="1" lineno="238" slineno="2-49" level="3"><display>(i)</display>against a student of a public elementary or secondary school, including a charter <ln numlevel="1" lineno="239" slineno="2-50"/>school; and</subsection><subsection ssid="6-null-19" dnum="ii-o" numlevel="1" lineno="240" slineno="2-51" level="3"><display>(ii)</display>by an employee of a public elementary or secondary school or charter school who:<subsection ssid="6-null-20" dnum="A-o" numlevel="1" lineno="241" slineno="2-52" level="4"><display>(A)</display>at the time of the sexual battery, held a position of special trust, as defined in <ln numlevel="1" lineno="242" slineno="2-53"/>Section <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, with respect to the student;</subsection><subsection ssid="6-null-21" dnum="B-o" numlevel="1" lineno="243" slineno="2-54" level="4"><display>(B)</display>is criminally charged in connection with the sexual battery; and</subsection><subsection ssid="6-null-22" dnum="C-o" numlevel="1" lineno="244" slineno="2-55" level="4"><display>(C)</display>the public elementary or secondary school or charter school knew or in the <ln numlevel="1" lineno="245" slineno="2-56"/>exercise of reasonable care should have known, at the time of the employee's <ln numlevel="1" lineno="246" slineno="2-57"/>hiring, to be a sex offender, a kidnap offender, or a child abuse offender as <ln numlevel="1" lineno="247" slineno="2-58"/>described in Section <xref depth="3" refnumber="53-29-202">53-29-202</xref>, required to register under Title 53, Chapter 29, <ln numlevel="1" lineno="248" slineno="2-59"/>Sex, Kidnap, and Child Abuse Offender Registry, whose status as a sex <ln numlevel="1" lineno="249" slineno="2-60"/>offender, kidnap offender, or child abuse offender would have been revealed in <ln numlevel="1" lineno="250" slineno="2-61"/>a background check under Section <xref depth="3" refnumber="53G-11-402">53G-11-402</xref>;</subsection></subsection></subsection><subsection ssid="6-null-23" dnum="k-o:l-i" numlevel="1" lineno="251" slineno="2-62" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1102" style="2" owner="o" level="1" deltag="both">(k)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="both" space="true">(l)</amend></display>as to any action brought under Section <xref depth="3" refnumber="78B-6-2303">78B-6-2303</xref>; </subsection><subsection ssid="6-null-24" dnum="l-o:m-i" numlevel="1" lineno="252" slineno="2-63" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1103" style="2" owner="o" level="1" deltag="both">(l)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="both" space="true">(m)</amend></display>as to any action brought to obtain relief under Title <xref depth="2" refnumber="53H-7-7">53H, Chapter 7, Part 7</xref>, <ln numlevel="1" lineno="253" slineno="2-64"/>Student Legal Representation;</subsection><subsection ssid="6-null-25" dnum="m-o:n-i" numlevel="1" lineno="254" slineno="2-65" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1104" style="2" owner="o" level="1" deltag="both">(m)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="both" space="true">(n)</amend></display>as to any action brought under Section <xref depth="3" refnumber="53-30-301">53-30-301</xref>; and</subsection><subsection ssid="6-null-26" dnum="n-o:o-i" numlevel="1" lineno="255" slineno="2-66" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1105" style="2" owner="o" level="1" deltag="both">(n)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="both" space="true">(o)</amend></display>as to any action or suit brought under Section <xref depth="3" refnumber="20A-19-301">20A-19-301</xref> and as to any <ln numlevel="1" lineno="256" slineno="2-67"/>compensation or expenses awarded under Subsection <xref depth="4" refnumber="20A-19-301(5)">20A-19-301(5)</xref>.</subsection></subsection><subsection ssid="6-null-27" dnum="3-o" numlevel="1" lineno="257" slineno="2-68" level="1" space="false"><display>(3)</display><subsection ssid="6-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-301(3)">(3)</xref>:<subsection ssid="6-null-29" dnum="i-o" numlevel="1" lineno="258" slineno="2-69" level="3" tab="1"><display>(i)</display>"Code of conduct" means a code of conduct that:<subsection ssid="6-null-30" dnum="A-o" numlevel="1" lineno="259" slineno="2-70" level="4"><display>(A)</display>is not less stringent than a model code of conduct, created by the State Board <ln numlevel="1" lineno="260" slineno="2-71"/>of Education, establishing a professional standard of care for preventing the <ln numlevel="1" lineno="261" slineno="2-72"/>conduct described in Subsection <xref depth="4" refnumber="63G-7-301(3)(a)(i)(d)">(3)(a)(i)(D)</xref>;</subsection><subsection ssid="6-null-31" dnum="B-o" numlevel="1" lineno="262" slineno="2-73" level="4"><display>(B)</display>is adopted by the applicable local education governing body;</subsection><subsection ssid="6-null-32" dnum="C-o" numlevel="1" lineno="263" slineno="2-74" level="4"><display>(C)</display>regulates behavior of a school employee toward a student; and</subsection><subsection ssid="6-null-33" dnum="D-o" numlevel="1" lineno="264" slineno="2-75" level="4"><display>(D)</display>includes a prohibition against any sexual conduct between an employee and a <ln numlevel="1" lineno="265" slineno="2-76"/>student and against the employee and student sharing any sexually explicit or <ln numlevel="1" lineno="266" slineno="2-77"/>lewd communication, image, or photograph.</subsection></subsection><subsection ssid="6-null-34" dnum="ii-o" numlevel="1" lineno="267" slineno="2-78" level="3" tab="1"><display>(ii)</display>"Local education agency" means:<subsection ssid="6-null-35" dnum="A-o" numlevel="1" lineno="268" slineno="2-79" level="4"><display>(A)</display>a school district;</subsection><subsection ssid="6-null-36" dnum="B-o" numlevel="1" lineno="269" slineno="2-80" level="4"><display>(B)</display>a charter school; or</subsection><subsection ssid="6-null-37" dnum="C-o" numlevel="1" lineno="270" slineno="2-81" level="4"><display>(C)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="6-null-38" dnum="iii-o" numlevel="1" lineno="271" slineno="2-82" level="3" tab="1"><display>(iii)</display>"Local education governing board" means:<subsection ssid="6-null-39" dnum="A-o" numlevel="1" lineno="272" slineno="2-83" level="4"><display>(A)</display>for a school district, the local school board;</subsection><subsection ssid="6-null-40" dnum="B-o" numlevel="1" lineno="273" slineno="2-84" level="4"><display>(B)</display>for a charter school, the charter school governing board; or</subsection><subsection ssid="6-null-41" dnum="C-o" numlevel="1" lineno="274" slineno="2-85" level="4"><display>(C)</display>for the Utah Schools for the Deaf and the Blind, the state board.</subsection></subsection><subsection ssid="6-null-42" dnum="iv-o" numlevel="1" lineno="275" slineno="2-86" level="3" tab="1"><display>(iv)</display>"Public school" means a public elementary or secondary school.</subsection><subsection ssid="6-null-43" dnum="v-o" numlevel="1" lineno="276" slineno="2-87" level="3" tab="1"><display>(v)</display>"Sexual abuse" means the offense described in Subsection <xref depth="4" refnumber="76-5-404.1(2)">76-5-404.1(2)</xref>.</subsection><subsection ssid="6-null-44" dnum="vi-o" numlevel="1" lineno="277" slineno="2-88" level="3" tab="1"><display>(vi)</display>"Sexual battery" means the offense described in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, considering <ln numlevel="1" lineno="278" slineno="2-89"/>the term "child" in that section to include an individual under 18 years old.</subsection></subsection><subsection ssid="6-null-45" dnum="b-o" numlevel="1" lineno="279" slineno="2-90" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, immunity from suit is waived as to a <ln numlevel="1" lineno="280" slineno="2-91"/>claim against a local education agency for an injury resulting from a sexual battery or <ln numlevel="1" lineno="281" slineno="2-92"/>sexual abuse committed against a student of a public school by a paid employee of <ln numlevel="1" lineno="282" slineno="2-93"/>the public school who is criminally charged in connection with the sexual battery or <ln numlevel="1" lineno="283" slineno="2-94"/>sexual abuse, unless:<subsection ssid="6-null-46" dnum="i-o" numlevel="1" lineno="284" slineno="2-95" level="3"><display>(i)</display>at the time of the sexual battery or sexual abuse, the public school was subject to a <ln numlevel="1" lineno="285" slineno="2-96"/>code of conduct; and</subsection><subsection ssid="6-null-47" dnum="ii-o" numlevel="1" lineno="286" slineno="2-97" level="3"><display>(ii)</display>before the sexual battery or sexual abuse occurred, the public school had:<subsection ssid="6-null-48" dnum="A-o" numlevel="1" lineno="287" slineno="2-98" level="4"><display>(A)</display>provided training on the code of conduct to the employee; and</subsection><subsection ssid="6-null-49" dnum="B-o" numlevel="1" lineno="288" slineno="2-99" level="4"><display>(B)</display>required the employee to sign a statement acknowledging that the employee <ln numlevel="1" lineno="289" slineno="2-100"/>has read and understands the code of conduct.</subsection></subsection></subsection></subsection><subsection ssid="6-null-50" dnum="4-o" numlevel="1" lineno="290" slineno="2-101" level="1" space="false"><display>(4)</display><subsection ssid="6-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-301(4)">(4)</xref>:<subsection ssid="6-null-52" dnum="i-o" numlevel="1" lineno="291" slineno="2-102" level="3" tab="1"><display>(i)</display>"Institution of higher education" means the same as that term is defined in Section <xref depth="3" refnumber="53H-1-101"><ln numlevel="1" lineno="292" slineno="2-103"/>53H-1-101</xref>.</subsection><subsection ssid="6-null-53" dnum="ii-o" numlevel="1" lineno="293" slineno="2-104" level="3" tab="1"><display>(ii)</display>"Policy governing behavior" means a policy adopted by a higher education <ln numlevel="1" lineno="294" slineno="2-105"/>institution or the Utah Board of Higher Education that:<subsection ssid="6-null-54" dnum="A-o" numlevel="1" lineno="295" slineno="2-106" level="4"><display>(A)</display>establishes a professional standard of care for preventing the conduct <ln numlevel="1" lineno="296" slineno="2-107"/>described in Subsections <xref depth="4" refnumber="63G-7-301(4)(a)(ii)(c)">(4)(a)(ii)(C)</xref> and <xref depth="4" refnumber="63G-7-301(d)">(D)</xref>;</subsection><subsection ssid="6-null-55" dnum="B-o" numlevel="1" lineno="297" slineno="2-108" level="4"><display>(B)</display>regulates behavior of a special trust employee toward a subordinate student;</subsection><subsection ssid="6-null-56" dnum="C-o" numlevel="1" lineno="298" slineno="2-109" level="4"><display>(C)</display>includes a prohibition against any sexual conduct between a special trust <ln numlevel="1" lineno="299" slineno="2-110"/>employee and a subordinate student; and</subsection><subsection ssid="6-null-57" dnum="D-o" numlevel="1" lineno="300" slineno="2-111" level="4"><display>(D)</display>includes a prohibition against a special trust employee and subordinate student <ln numlevel="1" lineno="301" slineno="2-112"/>sharing any sexually explicit or lewd communication, image, or photograph.</subsection></subsection><subsection ssid="6-null-58" dnum="iii-o" numlevel="1" lineno="302" slineno="2-113" level="3" tab="1"><display>(iii)</display>"Sexual battery" means the offense described in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>.</subsection><subsection ssid="6-null-59" dnum="iv-o" numlevel="1" lineno="303" slineno="2-114" level="3" tab="1"><display>(iv)</display>"Special trust employee" means an employee of an institution of higher education <ln numlevel="1" lineno="304" slineno="2-115"/>who is in a position of special trust, as defined in Section <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, with a <ln numlevel="1" lineno="305" slineno="2-116"/>higher education student.</subsection><subsection ssid="6-null-60" dnum="v-o" numlevel="1" lineno="306" slineno="2-117" level="3" tab="1"><display>(v)</display>"Subordinate student" means a student:<subsection ssid="6-null-61" dnum="A-o" numlevel="1" lineno="307" slineno="2-118" level="4"><display>(A)</display>of an institution of higher education; and</subsection><subsection ssid="6-null-62" dnum="B-o" numlevel="1" lineno="308" slineno="2-119" level="4"><display>(B)</display>whose educational opportunities could be adversely impacted by a special <ln numlevel="1" lineno="309" slineno="2-120"/>trust employee.</subsection></subsection></subsection><subsection ssid="6-null-63" dnum="b-o" numlevel="1" lineno="310" slineno="2-121" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, immunity from suit is waived as to a <ln numlevel="1" lineno="311" slineno="2-122"/>claim for an injury resulting from a sexual battery committed against a subordinate <ln numlevel="1" lineno="312" slineno="2-123"/>student by a special trust employee, unless:<subsection ssid="6-null-64" dnum="i-o" numlevel="1" lineno="313" slineno="2-124" level="3"><display>(i)</display>the institution of higher education proves that the special trust employee's <ln numlevel="1" lineno="314" slineno="2-125"/>behavior that otherwise would constitute a sexual battery was:<subsection ssid="6-null-65" dnum="A-o" numlevel="1" lineno="315" slineno="2-126" level="4"><display>(A)</display>with a subordinate student who was at least 18 years old at the time of the <ln numlevel="1" lineno="316" slineno="2-127"/>behavior; and</subsection><subsection ssid="6-null-66" dnum="B-o" numlevel="1" lineno="317" slineno="2-128" level="4"><display>(B)</display>with the student's consent; or</subsection></subsection><subsection ssid="6-null-67" dnum="ii-o" numlevel="1" lineno="318" slineno="2-129" level="3" space="false"><display>(ii)</display><subsection ssid="6-null-68" dnum="A-o" level="4" placement="sameline"><display>(A)</display>at the time of the sexual battery, the institution of higher education was <ln numlevel="1" lineno="319" slineno="2-130"/>subject to a policy governing behavior; and</subsection><subsection ssid="6-null-69" dnum="B-o" numlevel="1" lineno="320" slineno="2-131" level="4"><display>(B)</display>before the sexual battery occurred, the higher education institution had taken <ln numlevel="1" lineno="321" slineno="2-132"/>steps to implement and enforce the policy governing behavior.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="1" num="63G-33-201" type="amend" src="code" uid="C63G-33-S201_2026050620260506" sort="63G33 02010020260506" numlevel="1" lineno="322" slineno="3-1" sn="3"><section number="63G-33-201" numlevel="1" lineno="324" slineno="3-3" type="amend"><secline lineno="322">Section 3. Section <bold>63G-33-201</bold> is amended to read:</secline><headpart number="63G-33-2" numlevel="1" lineno="323" slineno="3-2">2. Utah Religious Freedom Restoration Act</headpart><catline lineno="324"><bold>63G-33-201<parens/>. Free exercise of religion -- Limitations on burdens imposed by <ln numlevel="1" lineno="325" slineno="3-4"/>government -- Claims or defenses -- Attorney fees and costs.</bold></catline><subsection ssid="1-null-25" dnum="1-o" numlevel="1" lineno="326" slineno="3-5" level="1" placement="noreturn"><display>(1)</display>The free exercise of religion is a fundamental right and applies to all government action, <ln numlevel="1" lineno="327" slineno="3-6"/>including action that is facially neutral.</subsection><subsection ssid="1-null-26" dnum="2-o" numlevel="1" lineno="328" slineno="3-7" level="1"><display>(2)</display>Except as provided in Subsection <xref depth="4" refnumber="63G-33-201(3)">(3)</xref>:<subsection ssid="1-null-27" dnum="a-o" numlevel="1" lineno="329" slineno="3-8" level="2"><display>(a)</display>a government entity may not substantially burden the free exercise of religion of a <ln numlevel="1" lineno="330" slineno="3-9"/>person, regardless of whether the burden results from a rule of general applicability; <ln numlevel="1" lineno="331" slineno="3-10"/>and</subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="332" slineno="3-11" level="2"><display>(b)</display>a person other than a government entity may not seek to apply or enforce <ln numlevel="1" lineno="333" slineno="3-12"/>government action against another person that substantially burdens the free exercise <ln numlevel="1" lineno="334" slineno="3-13"/>of religion of the other person, regardless of whether the burden results from a rule of <ln numlevel="1" lineno="335" slineno="3-14"/>general applicability.</subsection></subsection><subsection ssid="1-null-29" dnum="3-o" numlevel="1" lineno="336" slineno="3-15" level="1"><display>(3)</display>A government entity or government action may substantially burden a person's free <ln numlevel="1" lineno="337" slineno="3-16"/>exercise of religion only if the government entity, or any other person seeking to enforce <ln numlevel="1" lineno="338" slineno="3-17"/>government action, demonstrates that the burden on the person's free exercise of religion <ln numlevel="1" lineno="339" slineno="3-18"/>is:<subsection ssid="1-null-30" dnum="a-o" numlevel="1" lineno="340" slineno="3-19" level="2"><display>(a)</display>essential to furthering a compelling governmental interest; and</subsection><subsection ssid="1-null-31" dnum="b-o" numlevel="1" lineno="341" slineno="3-20" level="2"><display>(b)</display>the least restrictive means of furthering the compelling governmental interest.</subsection></subsection><subsection ssid="1-null-32" dnum="4-o" numlevel="1" lineno="342" slineno="3-21" level="1"><display>(4)</display>A person whose free exercise of religion is burdened in violation of this section:<subsection ssid="1-null-33" dnum="a-o" numlevel="1" lineno="343" slineno="3-22" level="2"><display>(a)</display>may assert the violation as a claim or defense in a judicial or administrative <ln numlevel="1" lineno="344" slineno="3-23"/>proceeding to obtain relief, regardless of whether a government entity is a party to the <ln numlevel="1" lineno="345" slineno="3-24"/>proceeding; and</subsection><subsection ssid="1-null-34" dnum="b-o" numlevel="1" lineno="346" slineno="3-25" level="2"><display>(b)</display>is not required to exhaust administrative remedies before bringing a claim, or raising <ln numlevel="1" lineno="347" slineno="3-26"/>a defense, described in this Subsection <xref depth="4" refnumber="63G-33-201(4)">(4)</xref>.</subsection></subsection><subsection ssid="1-null-35" dnum="_-o:5-i" numlevel="1" lineno="348" slineno="3-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">The relief available to a person under Subsection <xref depth="4" refnumber="63G-33-201(4)(a)">(4)(a)</xref> includes:</amend><subsection ssid="1-null-36" dnum="_-o:a-i" numlevel="1" lineno="349" slineno="3-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">damages;</amend></subsection><subsection ssid="1-null-37" dnum="_-o:b-i" numlevel="1" lineno="350" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">declaratory relief;</amend></subsection><subsection ssid="1-null-38" dnum="_-o:c-i" numlevel="1" lineno="351" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">injunctive relief; and</amend></subsection><subsection ssid="1-null-39" dnum="_-o:d-i" numlevel="1" lineno="352" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">all other types of legal relief.</amend></subsection></subsection><subsection ssid="1-null-40" dnum="5-o:6-i" numlevel="1" lineno="353" slineno="3-32" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1164" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="1-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">(5)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(6)(b)" depth="4">(6)(b)</xref></amend>, a person may not bring an <ln numlevel="1" lineno="354" slineno="3-33"/>action under this section against a government entity described in Subsections <xref depth="4" refnumber="63G-33-101(4)(a)(i)"><ln numlevel="1" lineno="355" slineno="3-34"/>63G-33-101(4)(a)(i)</xref> through (iii) unless, at least 60 days before the day on which the <ln numlevel="1" lineno="356" slineno="3-35"/>person brings the action, the person provides written notice to the government entity, <ln numlevel="1" lineno="357" slineno="3-36"/>in accordance with Subsections <xref depth="4" refnumber="63G-7-401(4)(b)">63G-7-401(4)(b)</xref> through (d), that:<subsection ssid="1-null-42" dnum="i-o" numlevel="1" lineno="358" slineno="3-37" level="3" tab="1"><display>(i)</display>states that the person intends to bring an action against the entity for a violation of <ln numlevel="1" lineno="359" slineno="3-38"/>this section;</subsection><subsection ssid="1-null-43" dnum="ii-o" numlevel="1" lineno="360" slineno="3-39" level="3" tab="1"><display>(ii)</display>describes the government action that has burdened or will burden the person's free <ln numlevel="1" lineno="361" slineno="3-40"/>exercise of religion; and</subsection><subsection ssid="1-null-44" dnum="iii-o" numlevel="1" lineno="362" slineno="3-41" level="3" tab="1"><display>(iii)</display>describes the manner in which the government action burdens or will burden the <ln numlevel="1" lineno="363" slineno="3-42"/>person's free exercise of religion.</subsection></subsection><subsection ssid="1-null-45" dnum="b-o" numlevel="1" lineno="364" slineno="3-43" level="2"><display>(b)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">(5)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(6)(a)" depth="4">(6)(a)</xref></amend> does not apply if the government action alleged in the <ln numlevel="1" lineno="365" slineno="3-44"/>action:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="366" slineno="3-45" level="3"><display>(i)</display>is ongoing, and complying with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-33-201(6)(a)">(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(6)(a)" depth="4">(6)(a)</xref></amend> will place an undue <ln numlevel="1" lineno="367" slineno="3-46"/>hardship on the person or increase the harm suffered by the person; or</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="368" slineno="3-47" level="3"><display>(ii)</display>is likely to occur or reoccur before the end of the 60-day period described in <ln numlevel="1" lineno="369" slineno="3-48"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-33-201(6)(a)">(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(6)(a)" depth="4">(6)(a)</xref></amend>.</subsection></subsection></subsection><subsection ssid="1-null-48" dnum="6-o:7-i" numlevel="1" lineno="370" slineno="3-49" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1172" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>A person who prevails in an action to enforce the provisions of this section against <ln numlevel="1" lineno="371" slineno="3-50"/>a government entity is entitled to recover reasonable attorney fees and costs.</subsection></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="372" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="372">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="373"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-28-26 9:32 AM</tm></rev></foot></leg>
