Musselman</sponsorhead><otherSponsorhead>House Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends certain restrictions on highway signage that is required to be relocated or <ln numlevel="1" lineno="6" slineno="0-6"/>remodeled because of the widening, construction, or reconstruction of a highway.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">allows the owner of a sign that is relocated or remodeled due to the widening, <ln numlevel="1" lineno="10" slineno="0-10"/>construction, or reconstruction to:<hl numlevel="1" lineno="11" slineno="0-11" level="2">exceed certain height limitations; and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">proceed with remodeling and relocating 30 days after the day on which the owner of <ln numlevel="1" lineno="13" slineno="0-13"/>the sign has sent notice of the requested relocation or remodel parameters to the <ln numlevel="1" lineno="14" slineno="0-14"/>relevant local government; and</hl></hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">makes technical changes.</hl></hp><moni numlevel="1" lineno="16" slineno="0-16" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="17">None</moniNone><oc numlevel="1" lineno="18" slineno="0-18">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="19" slineno="0-19">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="20" slineno="0-20">Utah Code Sections Affected:<saamd numlevel="1" lineno="21" slineno="0-21"><snhead>AMENDS:</snhead><sn num="72-7-510" src="code" uid="C72-7-S510_1800010118000101" buid="1" sort="72 07 05100018000101" numlevel="1" lineno="22" slineno="0-22"><bold>72-7-510</bold>, as last amended by Laws of Utah 2025, Chapter 436</sn><sn num="72-7-510.5" src="code" uid="C72-7-S510.5_1800010118000101" buid="3" sort="72 07 05100518000101" numlevel="1" lineno="23" slineno="0-23"><bold>72-7-510.5</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 15</sn></saamd></sa></lt><enacthead lineno="24"/><enact numlevel="1" lineno="25" slineno="0-25">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="72-7-510" type="amend" src="code" uid="C72-7-S510_1800010118000101" sort="72 07 05100018000101" numlevel="1" lineno="26" slineno="1-1" sn="1"><section number="72-7-510" numlevel="1" lineno="27" slineno="1-2" type="amend"><secline lineno="26">Section 1. Section <bold>72-7-510</bold> is amended to read:</secline><catline lineno="27"><bold>72-7-510<parens/>. Existing outdoor advertising not in conformity with part -- Procedure <ln numlevel="1" lineno="28" slineno="1-3"/>-- Eminent domain -- Compensation -- Relocation.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section, "nonconforming sign" means a sign that has been erected in a <ln numlevel="1" lineno="30" slineno="1-5"/>zone or area other than commercial or industrial or where outdoor advertising is not <ln numlevel="1" lineno="31" slineno="1-6"/>permitted under this part.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="32" slineno="1-7" level="1" space="false"><display>(2)</display><subsection ssid="1-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department may acquire by gift, purchase, agreement, exchange, or eminent <ln numlevel="1" lineno="33" slineno="1-8"/>domain, any existing outdoor advertising and all property rights pertaining to the <ln numlevel="1" lineno="34" slineno="1-9"/>outdoor advertising which were lawfully in existence on May 9, 1967, and which by <ln numlevel="1" lineno="35" slineno="1-10"/>reason of this part become nonconforming.</subsection><subsection ssid="1-null-4" dnum="b-o" numlevel="1" lineno="36" slineno="1-11" level="2"><display>(b)</display>If the department, or any town, city, county, governmental entity, public utility, or <ln numlevel="1" lineno="37" slineno="1-12"/>any agency or the United States Department of Transportation under this part, <ln numlevel="1" lineno="38" slineno="1-13"/>prevents the maintenance as defined in Section <xref depth="3" refid="C72-7-S502_1800010118000101" refnumber="72-7-502" start="0">72-7-502</xref>, or requires that <ln numlevel="1" lineno="39" slineno="1-14"/>maintenance of an existing sign be discontinued, the sign in question shall be <ln numlevel="1" lineno="40" slineno="1-15"/>considered acquired by the entity and just compensation will become immediately <ln numlevel="1" lineno="41" slineno="1-16"/>due and payable.</subsection><subsection ssid="1-null-5" dnum="c-o" numlevel="1" lineno="42" slineno="1-17" level="2"><display>(c)</display>Eminent domain shall be exercised in accordance with the provision of <xref depth="2" refid="C78B-6-P5_1800010118000101" refnumber="78B-6-5" start="0">Title 78B, <ln numlevel="1" lineno="43" slineno="1-18"/>Chapter 6, Part 5, Eminent Domain</xref>.</subsection></subsection><subsection ssid="1-null-6" dnum="3-o" numlevel="1" lineno="44" slineno="1-19" level="1" space="false"><display>(3)</display><subsection ssid="1-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Just compensation shall be paid for outdoor advertising and all property rights <ln numlevel="1" lineno="45" slineno="1-20"/>pertaining to the same, including the right of the landowner upon whose land a sign is <ln numlevel="1" lineno="46" slineno="1-21"/>located, acquired through the processes of eminent domain.</subsection><subsection ssid="1-null-8" dnum="b-o" numlevel="1" lineno="47" slineno="1-22" level="2"><display>(b)</display>For the purposes of this part, just compensation shall include the consideration of <ln numlevel="1" lineno="48" slineno="1-23"/>damages to remaining properties, contiguous and noncontiguous, of an outdoor <ln numlevel="1" lineno="49" slineno="1-24"/>advertising sign company's interest, which remaining properties, together with the <ln numlevel="1" lineno="50" slineno="1-25"/>properties actually condemned, constituted an economic unit.</subsection><subsection ssid="1-null-9" dnum="c-o" numlevel="1" lineno="51" slineno="1-26" level="2"><display>(c)</display>The department is empowered to remove signs found in violation of Section <xref depth="3" refid="C72-7-S508_1800010118000101" refnumber="72-7-508" start="0">72-7-508</xref> <ln numlevel="1" lineno="52" slineno="1-27"/>without payment of any compensation.</subsection></subsection><subsection ssid="1-null-10" dnum="4-o" numlevel="1" lineno="53" slineno="1-28" level="1"><display>(4)</display>Except as specifically provided in this section or Section <xref depth="3" refid="C72-7-S513_1800010118000101" refnumber="72-7-513" start="0">72-7-513</xref>, this part may not be <ln numlevel="1" lineno="54" slineno="1-29"/>construed to permit a person to place or maintain any outdoor advertising adjacent to <ln numlevel="1" lineno="55" slineno="1-30"/>any interstate or primary highway system which is prohibited by law or by any town, <ln numlevel="1" lineno="56" slineno="1-31"/>city, or county ordinance.  Any town, city, county, governmental entity, or public utility <ln numlevel="1" lineno="57" slineno="1-32"/>which requires the removal, relocation, alteration, change, or termination of outdoor <ln numlevel="1" lineno="58" slineno="1-33"/>advertising shall pay just compensation as defined in this part and in <xref depth="2" refid="C72-7-P5_1800010118000101" refnumber="78B-6-5" start="0">Title 78B, Chapter <ln numlevel="1" lineno="59" slineno="1-34"/>6, Part 5, Eminent Domain</xref>.</subsection><subsection ssid="1-null-11" dnum="5-o" numlevel="1" lineno="60" slineno="1-35" level="1"><display>(5)</display>Except as provided in Section <xref depth="3" refid="C72-7-S508_1800010118000101" refnumber="72-7-508" start="0">72-7-508</xref>, no sign shall be required to be removed by the <ln numlevel="1" lineno="61" slineno="1-36"/>department nor sign maintenance as described in this section be discontinued unless at <ln numlevel="1" lineno="62" slineno="1-37"/>the time of removal or discontinuance there are sufficient funds, from whatever source, <ln numlevel="1" lineno="63" slineno="1-38"/>appropriated and immediately available to pay the just compensation required under this <ln numlevel="1" lineno="64" slineno="1-39"/>section and unless at that time the federal funds required to be contributed under 23 <ln numlevel="1" lineno="65" slineno="1-40"/>U.S.C., Sec. 131, if any, with respect to the outdoor advertising being removed, have <ln numlevel="1" lineno="66" slineno="1-41"/>been appropriated and are immediately available to this state.</subsection><subsection ssid="1-null-12" dnum="6-o" numlevel="1" lineno="67" slineno="1-42" level="1" space="false"><display>(6)</display><subsection ssid="1-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If any outdoor advertising use, structure, or permit may not be continued because <ln numlevel="1" lineno="68" slineno="1-43"/>of the widening, construction, or reconstruction along an interstate, federal aid <ln numlevel="1" lineno="69" slineno="1-44"/>primary highway existing as of June 1, 1991, or national highway systems highway, <ln numlevel="1" lineno="70" slineno="1-45"/>the owner shall have the option to relocate and remodel the use, structure, or permit <ln numlevel="1" lineno="71" slineno="1-46"/>to another location:<subsection ssid="1-null-14" dnum="i-o" numlevel="1" lineno="72" slineno="1-47" level="3" tab="1"><display>(i)</display>within the same municipality or unincorporated county:<subsection ssid="1-null-15" dnum="A-o" numlevel="1" lineno="73" slineno="1-48" level="4"><display>(A)</display>on the same property;</subsection><subsection ssid="1-null-16" dnum="B-o" numlevel="1" lineno="74" slineno="1-49" level="4"><display>(B)</display>on adjacent property;</subsection><subsection ssid="1-null-17" dnum="C-o" numlevel="1" lineno="75" slineno="1-50" level="4"><display>(C)</display>on either side of the same highway; or</subsection><subsection ssid="1-null-18" dnum="D-o" numlevel="1" lineno="76" slineno="1-51" level="4"><display>(D)</display>mutually agreed upon by the owner and the county or municipality in which <ln numlevel="1" lineno="77" slineno="1-52"/>the use, structure, or permit is located; or</subsection></subsection><subsection ssid="1-null-19" dnum="ii-o" numlevel="1" lineno="78" slineno="1-53" level="3" tab="1"><display>(ii)</display>within a different municipality or unincorporated county mutually agreed upon by <ln numlevel="1" lineno="79" slineno="1-54"/>the owner and the different municipality or county.</subsection></subsection><subsection ssid="1-null-20" dnum="b-o" numlevel="1" lineno="80" slineno="1-55" level="2"><display>(b)</display>The relocation under Subsection <xref depth="4" refid="C72-7-S510_1800010118000101" refnumber="72-7-510(6)(a)" start="0">(6)(a)</xref> shall be in a commercial or industrial zoned <ln numlevel="1" lineno="81" slineno="1-56"/>area or where outdoor advertising is permitted under this part.</subsection><subsection ssid="1-null-21" dnum="c-o" numlevel="1" lineno="82" slineno="1-57" level="2"><display>(c)</display>The county or municipality in which the use or structure is located or is to be <ln numlevel="1" lineno="83" slineno="1-58"/>relocated as described in Subsection <xref depth="4" refnumber="72-7-510(6)(a)">(6)(a)</xref> <amend anum="0" ea="amend" pairid="40" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both">or <xref depth="4" refnumber="72-7-510(6)(d)">(6)(d)</xref> </amend>shall, if necessary, provide for <ln numlevel="1" lineno="84" slineno="1-59"/>the relocation and remodeling by ordinance for a special exception to its zoning <ln numlevel="1" lineno="85" slineno="1-60"/>ordinance.</subsection><subsection ssid="1-null-22" dnum="d-o:_-i" numlevel="1" lineno="86" slineno="1-61" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="95" groupid="75" style="2" owner="jchristopherson" level="1" deltag="end">The relocated and remodeled use or structure may be:</amend><amendoutend style="2"/><subsection ssid="1-null-23" dnum="i-o:_-i" numlevel="1" lineno="87" slineno="1-62" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="96" groupid="76" style="2" owner="jchristopherson" level="1" deltag="end">erected to a height and angle to make it clearly visible to traffic on the <ln numlevel="1" lineno="88" slineno="1-63"/>main-traveled way of the highway to which it is relocated or remodeled;</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-24" dnum="ii-o:_-i" numlevel="1" lineno="89" slineno="1-64" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="99" groupid="79" style="2" owner="jchristopherson" level="1" deltag="end">the same size and at least the same height as the previous use or structure, but the <ln numlevel="1" lineno="90" slineno="1-65"/>relocated use or structure may not exceed the size and height permitted under this <ln numlevel="1" lineno="91" slineno="1-66"/>part;</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-25" dnum="iii-o:_-i" numlevel="1" lineno="92" slineno="1-67" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="101" groupid="81" style="2" owner="jchristopherson" level="1" deltag="end">relocated to a comparable vehicular traffic count.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-32" dnum="_-o:d-i" numlevel="1" lineno="93" slineno="1-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">The owner of a relocated or remodeled use or structure may elect to relocate or <ln numlevel="1" lineno="94" slineno="1-69"/>remodel the use or structure with one or more of the following characteristics:</amend><subsection ssid="1-33" dnum="_-o:i-i" numlevel="1" lineno="95" slineno="1-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><subsection ssid="1-39" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">erected to a height up to 65 feet above the ground;</amend></subsection><subsection ssid="1-35" dnum="_-o:B-i" numlevel="1" lineno="96" slineno="1-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">erected to a height of more than 65 feet above the ground in order to make the <ln numlevel="1" lineno="97" slineno="1-72"/>entire advertising content clearly visible on the main-traveled way of the <ln numlevel="1" lineno="98" slineno="1-73"/>highway to which the structure is relocated or remodeled; or</amend></subsection><subsection ssid="1-40" dnum="_-o:C-i" numlevel="1" lineno="99" slineno="1-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">erected to the same height as the previous use or structure;</amend></subsection></subsection><subsection ssid="1-37" dnum="_-o:ii-i" numlevel="1" lineno="100" slineno="1-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">the same size as the previous use or structure, except that the relocated or <ln numlevel="1" lineno="101" slineno="1-76"/>remodeled use or structure may not exceed the size permitted under this part; or</amend></subsection><subsection ssid="1-38" dnum="_-o:iii-i" numlevel="1" lineno="102" slineno="1-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">relocated to a location with a comparable vehicular traffic count.</amend></subsection></subsection><subsection ssid="1-30" dnum="_-o:e-i" numlevel="1" lineno="103" slineno="1-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">For a relocated or remodeled use or structure described in this Subsection <xref depth="4" refnumber="72-7-510(6)">(6)</xref>, the <ln numlevel="1" lineno="104" slineno="1-79"/>height restrictions described in Subsection <xref depth="4" refnumber="72-7-505(2)">72-7-505(2)</xref> do not apply.</amend></subsection></subsection><subsection ssid="1-null-26" dnum="7-o" numlevel="1" lineno="105" slineno="1-80" level="1" space="false"><display>(7)</display><subsection ssid="1-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governmental entity, quasi-governmental entity, or public utility that causes <ln numlevel="1" lineno="106" slineno="1-81"/>the need for the outdoor advertising relocation or remodeling as provided in <ln numlevel="1" lineno="107" slineno="1-82"/>Subsection <xref depth="4" refid="C72-7-S510_1800010118000101" refnumber="72-7-510(6)(a)" start="0">(6)(a)</xref> shall pay the costs related to the relocation, remodeling, or <ln numlevel="1" lineno="108" slineno="1-83"/>acquisition.</subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="109" slineno="1-84" level="2"><display>(b)</display>If a governmental entity prohibits the relocation <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="45" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend> remodeling as provided in <ln numlevel="1" lineno="110" slineno="1-85"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="72-7-510(6)(a)">(6)(a)(i), it</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(a) and <xref depth="4" refnumber="72-7-510(6)(d)">(6)(d)</xref>, the government entity</amend> shall pay just <ln numlevel="1" lineno="111" slineno="1-86"/>compensation as provided in Subsection <xref depth="4" refid="C72-7-S510_1800010118000101" refnumber="72-7-510(3)" start="0">(3)</xref>.</subsection><subsection ssid="1-31" dnum="_-o:c-i" numlevel="1" lineno="112" slineno="1-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">If an owner of a use, structure, or permit affected by widening, construction, or <ln numlevel="1" lineno="113" slineno="1-88"/>reconstruction as described in Subsection <xref depth="4" refnumber="72-7-510(6)(a)">(6)(a)</xref> makes a written request to the <ln numlevel="1" lineno="114" slineno="1-89"/>municipality or county for approval to relocate or remodel the use or structure as <ln numlevel="1" lineno="115" slineno="1-90"/>described in Subsection <xref depth="4" refnumber="72-7-510(6)">(6)</xref>, the owner may take the requested action, without further <ln numlevel="1" lineno="116" slineno="1-91"/>municipal or county approval, 30 days after the day on which the structure or use <ln numlevel="1" lineno="117" slineno="1-92"/>owner makes the written request.</amend></subsection></subsection></section></bsec><bsec buid="3" num="72-7-510.5" type="amend" src="code" uid="C72-7-S510.5_1800010118000101" sort="72 07 05100518000101" numlevel="1" lineno="118" slineno="2-1" sn="2"><section number="72-7-510.5" numlevel="1" lineno="119" slineno="2-2" type="amend"><secline lineno="118">Section 2. Section <bold>72-7-510.5</bold> is amended to read:</secline><catline lineno="119"><bold>72-7-510.5<parens/>. Height adjustments for outdoor advertising signs.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="120" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>If the view and readability of an outdoor advertising sign, including a sign that is a <ln numlevel="1" lineno="121" slineno="2-4"/>nonconforming sign as defined in Section <xref depth="3" refnumber="72-7-510" start="0">72-7-510</xref>, a noncomplying structure as <ln numlevel="1" lineno="122" slineno="2-5"/>defined in Sections <xref depth="3" refnumber="10-20-102">10-20-102</xref> and <xref depth="3" refnumber="17-79-102">17-79-102</xref>, or a nonconforming use as defined in <ln numlevel="1" lineno="123" slineno="2-6"/>Sections <xref depth="3" refnumber="10-20-102">10-20-102</xref> and <xref depth="3" refnumber="17-79-102">17-79-102</xref> is obstructed due to a noise abatement or safety <ln numlevel="1" lineno="124" slineno="2-7"/>measure, grade change, construction, directional sign, highway widening, or aesthetic <ln numlevel="1" lineno="125" slineno="2-8"/>improvement made by an agency of this state, along an interstate, federal aid primary <ln numlevel="1" lineno="126" slineno="2-9"/>highway existing as of June 1, 1991, national highway systems highway, or state <ln numlevel="1" lineno="127" slineno="2-10"/>highway or by an improvement created on real property subsequent to the department's <ln numlevel="1" lineno="128" slineno="2-11"/>disposal of the property under Section <xref depth="3" refnumber="72-5-111" start="0">72-5-111</xref>, the owner of the sign may<amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both"> elect one or <ln numlevel="1" lineno="129" slineno="2-12"/>both of the following options</amend>:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="130" slineno="2-13" level="2"><display>(a)</display>adjust the height of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">sign;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">existing or relocated sign:</amend><subsection ssid="3-17" dnum="_-o:i-i" numlevel="1" lineno="131" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">up to 65 feet above the ground; or</amend></subsection><subsection ssid="3-18" dnum="_-o:ii-i" numlevel="1" lineno="132" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">to a height more than 65 feet above the ground in order to make the entire <ln numlevel="1" lineno="133" slineno="2-16"/>advertising content of the sign clearly visible; or</amend></subsection></subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="134" slineno="2-17" level="2"><display>(b)</display><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">relocate the sign as follows:</amend><subsection ssid="3-19" dnum="_-o:i-i" numlevel="1" lineno="135" slineno="2-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>if the sign is located along an interstate, federal aid primary highway existing as of <ln numlevel="1" lineno="136" slineno="2-19"/>June 1, 1991, or national highway systems highway, relocate the sign to either <ln numlevel="1" lineno="137" slineno="2-20"/>side of the same highway, within the same municipality or unincorporated county, <ln numlevel="1" lineno="138" slineno="2-21"/>if the sign complies with the spacing requirements under Section <xref depth="3" refnumber="72-7-505">72-7-505</xref> and is <ln numlevel="1" lineno="139" slineno="2-22"/>in a commercial or industrial zone;</subsection><subsection ssid="3-null-4" dnum="c-o:ii-i" numlevel="1" lineno="140" slineno="2-23" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1043" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>if the sign is located along a state highway, relocate the sign to either side of <ln numlevel="1" lineno="141" slineno="2-24"/>the same highway, within the same municipality or unincorporated county, to a <ln numlevel="1" lineno="142" slineno="2-25"/>point within one mile of the sign's prior location, if the sign complies with the <ln numlevel="1" lineno="143" slineno="2-26"/>spacing requirements under Section <xref depth="3" refnumber="72-7-505">72-7-505</xref> and is located in a commercial or <ln numlevel="1" lineno="144" slineno="2-27"/>industrial zone; or</subsection><subsection ssid="3-null-5" dnum="d-o:iii-i" numlevel="1" lineno="145" slineno="2-28" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1044" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>relocate the sign to a location that is mutually agreed upon by the owner and:<subsection ssid="3-null-6" dnum="i-o:A-i" numlevel="1" lineno="146" slineno="2-29" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>the same municipality or unincorporated county in which the obstructed <ln numlevel="1" lineno="147" slineno="2-30"/>sign is located; or</subsection><subsection ssid="3-null-7" dnum="ii-o:B-i" numlevel="1" lineno="148" slineno="2-31" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>any other municipality or unincorporated county.</subsection></subsection></subsection></subsection><subsection ssid="3-null-8" dnum="2-o" numlevel="1" lineno="149" slineno="2-32" level="1"><display>(2)</display>A height adjusted sign under this section does not constitute a substantial change to the <ln numlevel="1" lineno="150" slineno="2-33"/>sign.</subsection><subsection ssid="3-null-9" dnum="3-o" numlevel="1" lineno="151" slineno="2-34" level="1"><display>(3)</display>The county or municipality in which the obstructed sign is located or is to be relocated <ln numlevel="1" lineno="152" slineno="2-35"/>shall, if necessary, provide for the height adjustment or relocation by ordinance for a <ln numlevel="1" lineno="153" slineno="2-36"/>special exception to its zoning ordinance.</subsection><subsection ssid="3-null-10" dnum="4-o" numlevel="1" lineno="154" slineno="2-37" level="1" space="false"><display>(4)</display><subsection ssid="3-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The height adjusted sign:<subsection ssid="3-null-12" dnum="i-o" numlevel="1" lineno="155" slineno="2-38" level="3" tab="1"><display>(i)</display>may be erected:<subsection ssid="3-null-13" dnum="A-o" numlevel="1" lineno="156" slineno="2-39" level="4"><display>(A)</display>to a height to make the entire advertising content of the sign clearly visible; <ln numlevel="1" lineno="157" slineno="2-40"/>and</subsection><subsection ssid="3-null-14" dnum="B-o" numlevel="1" lineno="158" slineno="2-41" level="4"><display>(B)</display>to an angle to make the entire advertising content of the sign clearly visible; <ln numlevel="1" lineno="159" slineno="2-42"/>and</subsection></subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="160" slineno="2-43" level="3" tab="1"><display>(ii)</display>shall be the same size as the previous sign.</subsection></subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="161" slineno="2-44" level="2"><display>(b)</display>The provisions of <amend anum="0" ea="amend" pairid="31" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both">Subsection <xref depth="4" refnumber="72-7-510.5(1)(a)">(1)(a)</xref> and </amend>Subsection <xref depth="4" refnumber="72-7-510.5(4)(a)" start="0">(4)(a)</xref> are <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">an exception</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="162" slineno="2-45"/>exceptions</amend> to the height requirements under Section <xref depth="3" refnumber="72-7-505" start="0">72-7-505</xref>.</subsection></subsection></section></bsec><bsec buid="5" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="163" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="163">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="164"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect:</amend></sectionText><subsection ssid="5-1" dnum="_-o:1-i" numlevel="1" lineno="165" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="6" m-groupid="5" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">except as provided in Subsection (2), <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>;
