Section <bold>49-12-701</bold> is amended to read:</secline><catline lineno="41"><bold>49-12-701<parens/>. Early retirement incentive -- Eligibility -- Calculation of benefit -- <ln numlevel="1" lineno="42" slineno="1-3"/>Payment of costs -- Savings to be appropriated by Legislature -- Restrictions on <ln numlevel="1" lineno="43" slineno="1-4"/>reemployment.</bold></catline><subsection ssid="38-null-1" dnum="1-o" numlevel="1" lineno="44" slineno="1-5" level="1" placement="noreturn"><display>(1)</display>Any member of this system may retire and receive the allowance allowed under <ln numlevel="1" lineno="45" slineno="1-6"/>Subsection <xref depth="4" refnumber="49-12-701(2)" start="0">(2)</xref> if the member meets the following requirements as of the member's <ln numlevel="1" lineno="46" slineno="1-7"/>retirement date:<subsection ssid="38-null-2" dnum="a-o" numlevel="1" lineno="47" slineno="1-8" level="2"><display>(a)</display>the member is eligible for retirement under Section <xref depth="3" refnumber="49-12-401" start="0">49-12-401</xref>, or has 25 years of <ln numlevel="1" lineno="48" slineno="1-9"/>service credit;</subsection><subsection ssid="38-null-3" dnum="b-o" numlevel="1" lineno="49" slineno="1-10" level="2"><display>(b)</display>the member elects to forfeit any stipend for retirement offered by the participating <ln numlevel="1" lineno="50" slineno="1-11"/>employer; and</subsection><subsection ssid="38-null-4" dnum="c-o" numlevel="1" lineno="51" slineno="1-12" level="2"><display>(c)</display>the member elects to retire from this system by applying for retirement by the date <ln numlevel="1" lineno="52" slineno="1-13"/>established under Subsection <xref depth="4" refnumber="49-12-701(3)(a)" start="0">(3)(a)</xref> or <xref depth="4" refnumber="49-12-701(3)(b)" start="0">(3)(b)</xref>.</subsection></subsection><subsection ssid="38-null-5" dnum="2-o" numlevel="1" lineno="53" slineno="1-14" level="1" space="false"><display>(2)</display><subsection ssid="38-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A member who retires under Subsection <xref depth="4" refnumber="49-12-701(1)" start="0">(1)</xref> shall receive 2% of that member's <ln numlevel="1" lineno="54" slineno="1-15"/>final average salary for all years of service credit.</subsection><subsection ssid="38-null-7" dnum="b-o" numlevel="1" lineno="55" slineno="1-16" level="2"><display>(b)</display>An actuarial reduction may not be applied to the allowance granted under this section.</subsection></subsection><subsection ssid="38-null-8" dnum="3-o" numlevel="1" lineno="56" slineno="1-17" level="1"><display>(3)</display>In order to receive the allowance allowed by this section, a member shall submit an <ln numlevel="1" lineno="57" slineno="1-18"/>application to the office as follows:<subsection ssid="38-null-9" dnum="a-o" numlevel="1" lineno="58" slineno="1-19" level="2" space="false"><display>(a)</display><subsection ssid="38-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For state and school employees under Level A, the application shall be filed by <ln numlevel="1" lineno="59" slineno="1-20"/>May 31, 1987. The member's retirement date shall then be set by the member on <ln numlevel="1" lineno="60" slineno="1-21"/>the 1st or 16th day of July, August, or September, 1987.</subsection><subsection ssid="38-null-11" dnum="ii-o" numlevel="1" lineno="61" slineno="1-22" level="3"><display>(ii)</display>If a Level A member elects to retire, the executive director or participating <ln numlevel="1" lineno="62" slineno="1-23"/>employer may request the member to delay the retirement date until a later date, <ln numlevel="1" lineno="63" slineno="1-24"/>but no later than June 30, 1988.</subsection><subsection ssid="38-null-12" dnum="iii-o" numlevel="1" lineno="64" slineno="1-25" level="3"><display>(iii)</display>If the member agrees to delay the retirement date, the retirement date shall be <ln numlevel="1" lineno="65" slineno="1-26"/>delayed, but service credit may not be accrued after the member's original <ln numlevel="1" lineno="66" slineno="1-27"/>retirement date elected by the member, and compensation earned after the <ln numlevel="1" lineno="67" slineno="1-28"/>member's original retirement date may not be used in the calculation of the final <ln numlevel="1" lineno="68" slineno="1-29"/>average salary for determining the retirement allowance.</subsection></subsection><subsection ssid="38-null-13" dnum="b-o" numlevel="1" lineno="69" slineno="1-30" level="2" space="false"><display>(b)</display><subsection ssid="38-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For political subdivision employees under Level B, the application shall be <ln numlevel="1" lineno="70" slineno="1-31"/>filed by September 30, 1987.</subsection><subsection ssid="38-null-15" dnum="ii-o" numlevel="1" lineno="71" slineno="1-32" level="3"><display>(ii)</display>The retirement date shall then be set by the member on the 1st or 16th day of <ln numlevel="1" lineno="72" slineno="1-33"/>July, August, September, October, November, or December, 1987.</subsection></subsection></subsection><subsection ssid="38-null-16" dnum="4-o" numlevel="1" lineno="73" slineno="1-34" level="1" space="false"><display>(4)</display><subsection ssid="38-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The cost of providing the allowance under this section shall be funded in fiscal <ln numlevel="1" lineno="74" slineno="1-35"/>year 1987-88 by a supplemental appropriation in the 1988 General Session based on <ln numlevel="1" lineno="75" slineno="1-36"/>the retirement contribution rate increase established by the consulting actuary and <ln numlevel="1" lineno="76" slineno="1-37"/>approved by the board.</subsection><subsection ssid="38-null-18" dnum="b-o" numlevel="1" lineno="77" slineno="1-38" level="2"><display>(b)</display>The cost of providing the allowance under this section shall be funded beginning <ln numlevel="1" lineno="78" slineno="1-39"/>July 1, 1988, by means of an increase in the retirement contribution rate established <ln numlevel="1" lineno="79" slineno="1-40"/>by the consulting actuary and approved by the board.</subsection><subsection ssid="38-null-19" dnum="c-o" numlevel="1" lineno="80" slineno="1-41" level="2"><display>(c)</display>The rate increase under Subsections <xref depth="4" refnumber="49-12-701(4)(a)" start="0">(4)(a)</xref> and <xref depth="4" refnumber="49-12-701(4)(b)" start="0">(b)</xref> shall be funded:<subsection ssid="38-null-20" dnum="i-o" numlevel="1" lineno="81" slineno="1-42" level="3"><display>(i)</display>for state employees, by an appropriation from the account established by the <ln numlevel="1" lineno="82" slineno="1-43"/>Division of Finance under Subsection <xref depth="4" refnumber="49-12-701(4)(d)" start="0">(4)(d)</xref>, which is funded by savings derived <ln numlevel="1" lineno="83" slineno="1-44"/>from this early retirement incentive and a work force reduction;</subsection><subsection ssid="38-null-21" dnum="ii-o" numlevel="1" lineno="84" slineno="1-45" level="3"><display>(ii)</display>for school employees, by direct contributions from the employing unit, which <ln numlevel="1" lineno="85" slineno="1-46"/>may not be funded through an increase in the retirement contribution amount <ln numlevel="1" lineno="86" slineno="1-47"/>established in <xref depth="1" refnumber="53F-2" start="0">Title 53F, Chapter 2, State Funding -- Minimum School Program</xref>; <ln numlevel="1" lineno="87" slineno="1-48"/>and</subsection><subsection ssid="38-null-22" dnum="iii-o" numlevel="1" lineno="88" slineno="1-49" level="3"><display>(iii)</display>for political subdivisions under Level B, by direct contributions by the <ln numlevel="1" lineno="89" slineno="1-50"/>participating employer.</subsection></subsection><subsection ssid="38-null-23" dnum="d-o" numlevel="1" lineno="90" slineno="1-51" level="2" space="false"><display>(d)</display><subsection ssid="38-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Each year, any excess savings derived from this early retirement incentive <ln numlevel="1" lineno="91" slineno="1-52"/>which are above the costs of funding the increase and the costs of paying insurance<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="92" slineno="1-53"/>, sick leave, compensatory leave, and vacation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> and</amend> leave under Subsections <xref depth="4" refnumber="49-12-701(4)(c)(i)" start="0"><ln numlevel="1" lineno="93" slineno="1-54"/>(4)(c)(i)</xref> and <xref depth="4" refnumber="49-12-701(4)(c)(ii)" start="0">(ii)</xref> shall be reported to the Legislature and shall be appropriated as <ln numlevel="1" lineno="94" slineno="1-55"/>provided by law.</subsection><subsection ssid="38-null-25" dnum="ii-o" numlevel="1" lineno="95" slineno="1-56" level="3"><display>(ii)</display>In the case of Subsection <xref depth="4" refnumber="49-12-701(4)(c)(i)" start="0">(4)(c)(i)</xref>, the Division of Finance shall establish an <ln numlevel="1" lineno="96" slineno="1-57"/>account into which all savings derived from this early retirement incentive shall be <ln numlevel="1" lineno="97" slineno="1-58"/>deposited as the savings are realized.</subsection><subsection ssid="38-null-26" dnum="iii-o" numlevel="1" lineno="98" slineno="1-59" level="3"><display>(iii)</display>In the case of Subsection <xref depth="4" refnumber="49-12-701(4)(c)(ii)" start="0">(4)(c)(ii)</xref>, the State Board of Education shall certify the <ln numlevel="1" lineno="99" slineno="1-60"/>amount of savings derived from this early retirement incentive.</subsection><subsection ssid="38-null-27" dnum="iv-o" numlevel="1" lineno="100" slineno="1-61" level="3"><display>(iv)</display>The State Board of Education and the participating employer may not spend the <ln numlevel="1" lineno="101" slineno="1-62"/>savings until appropriated by the Legislature as provided by law.</subsection></subsection></subsection><subsection ssid="38-null-28" dnum="5-o" numlevel="1" lineno="102" slineno="1-63" level="1"><display>(5)</display>A member who retires under this section is subject to Section <xref depth="3" refnumber="49-11-504" start="0">49-11-504</xref> and <xref depth="2" refnumber="49-11-12" start="1">Chapter <ln numlevel="1" lineno="103" slineno="1-64"/>11, Part 12, Postretirement Reemployment Restrictions Act</xref>.</subsection><subsection ssid="38-null-29" dnum="6-o" numlevel="1" lineno="104" slineno="1-65" level="1"><display>(6)</display>The board may adopt rules to administer this section.</subsection><subsection ssid="38-null-30" dnum="7-o" numlevel="1" lineno="105" slineno="1-66" level="1"><display>(7)</display>The Legislative Auditor General shall perform an audit to ensure compliance with this <ln numlevel="1" lineno="106" slineno="1-67"/>section.</subsection></section></bsec><bsec buid="42" num="49-22-102" type="amend" src="code" uid="C49-22-S102_2026050620260506" sort="49 22 01020020260506" numlevel="1" lineno="107" slineno="2-1" sn="2"><section number="49-22-102" numlevel="1" lineno="108" slineno="2-2" type="amend"><secline lineno="107">Section 2. Section <bold>49-22-102</bold> is amended to read:</secline><catline lineno="108"><bold>49-22-102<parens/>. Definitions.</bold></catline><sectionText lineno="109"><tab/>As used in this chapter:</sectionText><subsection ssid="42-null-1" dnum="1-o" numlevel="1" lineno="110" slineno="2-4" level="1"><display>(1)</display>"Benefits normally provided" means the same as that term is defined in Section <xref depth="3" refnumber="49-12-102" start="0"><ln numlevel="1" lineno="111" slineno="2-5"/>49-12-102</xref>.</subsection><subsection ssid="42-null-2" dnum="2-o" numlevel="1" lineno="112" slineno="2-6" level="1" space="false"><display>(2)</display><subsection ssid="42-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Compensation" means the total amount of payments made by a participating <ln numlevel="1" lineno="113" slineno="2-7"/>employer to a member of this system for services rendered to the participating <ln numlevel="1" lineno="114" slineno="2-8"/>employer, including:<subsection ssid="42-null-4" dnum="i-o" numlevel="1" lineno="115" slineno="2-9" level="3" tab="1"><display>(i)</display>bonuses;</subsection><subsection ssid="42-null-5" dnum="ii-o" numlevel="1" lineno="116" slineno="2-10" level="3" tab="1"><display>(ii)</display>cost-of-living adjustments;</subsection><subsection ssid="42-null-6" dnum="iii-o" numlevel="1" lineno="117" slineno="2-11" level="3" tab="1"><display>(iii)</display>other payments currently includable in gross income and that are subject to social <ln numlevel="1" lineno="118" slineno="2-12"/>security deductions, including any payments in excess of the maximum amount <ln numlevel="1" lineno="119" slineno="2-13"/>subject to deduction under social security law;</subsection><subsection ssid="42-null-7" dnum="iv-o" numlevel="1" lineno="120" slineno="2-14" level="3" tab="1"><display>(iv)</display>amounts that the member authorizes to be deducted or reduced for salary deferral <ln numlevel="1" lineno="121" slineno="2-15"/>or other benefits authorized by federal law; and</subsection><subsection ssid="42-null-8" dnum="v-o" numlevel="1" lineno="122" slineno="2-16" level="3" tab="1"><display>(v)</display>member contributions.</subsection></subsection><subsection ssid="42-null-9" dnum="b-o" numlevel="1" lineno="123" slineno="2-17" level="2"><display>(b)</display>"Compensation" for purposes of this chapter may not exceed the amount allowed <ln numlevel="1" lineno="124" slineno="2-18"/>under Internal Revenue Code, Section 401(a)(17).</subsection><subsection ssid="42-null-10" dnum="c-o" numlevel="1" lineno="125" slineno="2-19" level="2"><display>(c)</display>"Compensation" does not include:<subsection ssid="42-null-11" dnum="i-o" numlevel="1" lineno="126" slineno="2-20" level="3"><display>(i)</display>the monetary value of remuneration paid in kind, including a residence or use of <ln numlevel="1" lineno="127" slineno="2-21"/>equipment;</subsection><subsection ssid="42-null-12" dnum="ii-o" numlevel="1" lineno="128" slineno="2-22" level="3"><display>(ii)</display>the cost of any employment benefits paid for by the participating employer;</subsection><subsection ssid="42-null-13" dnum="iii-o" numlevel="1" lineno="129" slineno="2-23" level="3"><display>(iii)</display>compensation paid to a temporary employee or an employee otherwise ineligible <ln numlevel="1" lineno="130" slineno="2-24"/>for service credit;</subsection><subsection ssid="42-null-14" dnum="iv-o" numlevel="1" lineno="131" slineno="2-25" level="3"><display>(iv)</display>any payments upon termination, including accumulated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">vacation, sick </amend><amendoutend style="2"/>leave <ln numlevel="1" lineno="132" slineno="2-26"/>payments, severance payments, compensatory time payments, or any other special <ln numlevel="1" lineno="133" slineno="2-27"/>payments;</subsection><subsection ssid="42-null-15" dnum="v-o" numlevel="1" lineno="134" slineno="2-28" level="3"><display>(v)</display>any allowances or payments to a member for costs or expenses paid by the <ln numlevel="1" lineno="135" slineno="2-29"/>participating employer, including automobile costs, uniform costs, travel costs, <ln numlevel="1" lineno="136" slineno="2-30"/>tuition costs, housing costs, insurance costs, equipment costs, and dependent care <ln numlevel="1" lineno="137" slineno="2-31"/>costs; or</subsection><subsection ssid="42-null-16" dnum="vi-o" numlevel="1" lineno="138" slineno="2-32" level="3"><display>(vi)</display>a teacher salary bonus described in Section <xref depth="3" refnumber="53F-2-513" start="0">53F-2-513</xref>.</subsection></subsection><subsection ssid="42-null-17" dnum="d-o" numlevel="1" lineno="139" slineno="2-33" level="2"><display>(d)</display>The executive director may determine if a payment not listed under this Subsection <xref depth="4" refnumber="49-22-102(2)" start="0"><ln numlevel="1" lineno="140" slineno="2-34"/>(2)</xref> falls within the definition of compensation.</subsection></subsection><subsection ssid="42-null-18" dnum="3-o" numlevel="1" lineno="141" slineno="2-35" level="1"><display>(3)</display>"Corresponding Tier I system" means the system or plan that would have covered the <ln numlevel="1" lineno="142" slineno="2-36"/>member if the member had initially entered employment before July 1, 2011.</subsection><subsection ssid="42-null-19" dnum="4-o" numlevel="1" lineno="143" slineno="2-37" level="1" space="false"><display>(4)</display><subsection ssid="42-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Final average salary" means the amount calculated by averaging the highest five <ln numlevel="1" lineno="144" slineno="2-38"/>years of annual compensation preceding retirement subject to Subsections <xref depth="4" refnumber="49-22-102(4)(b)" start="0">(4)(b)</xref>, <xref depth="4" refnumber="49-22-102(4)(c)" start="0">(c)</xref>, <xref depth="4" refnumber="49-22-102(4)(d)" start="0"><ln numlevel="1" lineno="145" slineno="2-39"/>(d)</xref>, <xref depth="4" refnumber="49-22-102(4)(e)" start="0">(e)</xref>, and <xref depth="4" refnumber="49-22-102(4)(f)" start="0">(f)</xref>.</subsection><subsection ssid="42-null-21" dnum="b-o" numlevel="1" lineno="146" slineno="2-40" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="49-22-102(4)(c)" start="0">(4)(c)</xref>, the percentage increase in annual <ln numlevel="1" lineno="147" slineno="2-41"/>compensation in any one of the years used may not exceed the previous year's <ln numlevel="1" lineno="148" slineno="2-42"/>compensation by more than 10% plus a cost-of-living adjustment equal to the <ln numlevel="1" lineno="149" slineno="2-43"/>decrease in the purchasing power of the dollar during the previous year, as measured <ln numlevel="1" lineno="150" slineno="2-44"/>by a United States Bureau of Labor Statistics Consumer Price Index average as <ln numlevel="1" lineno="151" slineno="2-45"/>determined by the board.</subsection><subsection ssid="42-null-22" dnum="c-o" numlevel="1" lineno="152" slineno="2-46" level="2"><display>(c)</display>In cases where the participating employer provides acceptable documentation to the <ln numlevel="1" lineno="153" slineno="2-47"/>office, the limitation in Subsection <xref depth="4" refnumber="49-22-102(4)(b)" start="0">(4)(b)</xref> may be exceeded if:<subsection ssid="42-null-23" dnum="i-o" numlevel="1" lineno="154" slineno="2-48" level="3"><display>(i)</display>the member has transferred from another agency; or</subsection><subsection ssid="42-null-24" dnum="ii-o" numlevel="1" lineno="155" slineno="2-49" level="3"><display>(ii)</display>the member has been promoted to a new position.</subsection></subsection><subsection ssid="42-null-25" dnum="d-o" numlevel="1" lineno="156" slineno="2-50" level="2"><display>(d)</display>If the member retires more than six months from the date of termination of <ln numlevel="1" lineno="157" slineno="2-51"/>employment, the member is considered to have been in service at the member's last <ln numlevel="1" lineno="158" slineno="2-52"/>rate of pay from the date of the termination of employment to the effective date of <ln numlevel="1" lineno="159" slineno="2-53"/>retirement for purposes of computing the member's final average salary only.</subsection><subsection ssid="42-null-26" dnum="e-o" numlevel="1" lineno="160" slineno="2-54" level="2"><display>(e)</display>If the member has less than five years of service credit in this system, final average <ln numlevel="1" lineno="161" slineno="2-55"/>salary means the average annual compensation paid to the member during the full <ln numlevel="1" lineno="162" slineno="2-56"/>period of service credit.</subsection><subsection ssid="42-null-27" dnum="f-o" numlevel="1" lineno="163" slineno="2-57" level="2"><display>(f)</display>The annual compensation used to calculate final average salary shall be based on a <ln numlevel="1" lineno="164" slineno="2-58"/>period, as determined by the board, consistent with the period used to determine <ln numlevel="1" lineno="165" slineno="2-59"/>years of service credit in accordance with Subsection <xref depth="4" refnumber="49-22-102(8)" start="0">(8)</xref>.</subsection></subsection><subsection ssid="42-null-28" dnum="5-o" numlevel="1" lineno="166" slineno="2-60" level="1"><display>(5)</display>"Participating employer" means an employer that meets the participation requirements <ln numlevel="1" lineno="167" slineno="2-61"/>of:<subsection ssid="42-null-29" dnum="a-o" numlevel="1" lineno="168" slineno="2-62" level="2"><display>(a)</display>Sections <xref depth="3" refnumber="49-12-201" start="0">49-12-201</xref> and <xref depth="3" refnumber="49-12-202" start="0">49-12-202</xref>;</subsection><subsection ssid="42-null-30" dnum="b-o" numlevel="1" lineno="169" slineno="2-63" level="2"><display>(b)</display>Sections <xref depth="3" refnumber="49-13-201" start="0">49-13-201</xref> and <xref depth="3" refnumber="49-13-202" start="0">49-13-202</xref>;</subsection><subsection ssid="42-null-31" dnum="c-o" numlevel="1" lineno="170" slineno="2-64" level="2"><display>(c)</display>Section <xref depth="3" refnumber="49-19-201" start="0">49-19-201</xref>; or</subsection><subsection ssid="42-null-32" dnum="d-o" numlevel="1" lineno="171" slineno="2-65" level="2"><display>(d)</display>Section <xref depth="3" refnumber="49-22-201" start="0">49-22-201</xref> or <xref depth="3" refnumber="49-22-202" start="0">49-22-202</xref>.</subsection></subsection><subsection ssid="42-null-33" dnum="6-o" numlevel="1" lineno="172" slineno="2-66" level="1" space="false"><display>(6)</display><subsection ssid="42-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Regular full-time employee" means an employee:<subsection ssid="42-null-35" dnum="i-o" numlevel="1" lineno="173" slineno="2-67" level="3" tab="1"><display>(i)</display>whose term of employment for a participating employer contemplates continued <ln numlevel="1" lineno="174" slineno="2-68"/>employment during a fiscal or calendar year;</subsection><subsection ssid="42-null-36" dnum="ii-o" numlevel="1" lineno="175" slineno="2-69" level="3" tab="1"><display>(ii)</display>whose employment normally requires an average of 20 hours or more per week, <ln numlevel="1" lineno="176" slineno="2-70"/>except as modified by the board; and</subsection><subsection ssid="42-null-37" dnum="iii-o" numlevel="1" lineno="177" slineno="2-71" level="3" tab="1"><display>(iii)</display>who receives benefits normally provided by the participating employer.</subsection></subsection><subsection ssid="42-null-38" dnum="b-o" numlevel="1" lineno="178" slineno="2-72" level="2"><display>(b)</display>"Regular full-time employee" includes:<subsection ssid="42-null-39" dnum="i-o" numlevel="1" lineno="179" slineno="2-73" level="3"><display>(i)</display>a teacher whose term of employment for a participating employer contemplates <ln numlevel="1" lineno="180" slineno="2-74"/>continued employment during a school year and who teaches half time or more;</subsection><subsection ssid="42-null-40" dnum="ii-o" numlevel="1" lineno="181" slineno="2-75" level="3"><display>(ii)</display>an education support professional:<subsection ssid="42-null-41" dnum="A-o" numlevel="1" lineno="182" slineno="2-76" level="4"><display>(A)</display>who is hired before July 1, 2013; and</subsection><subsection ssid="42-null-42" dnum="B-o" numlevel="1" lineno="183" slineno="2-77" level="4"><display>(B)</display>whose employment normally requires an average of 20 hours per week or <ln numlevel="1" lineno="184" slineno="2-78"/>more for a participating employer, regardless of benefits provided;</subsection></subsection><subsection ssid="42-null-43" dnum="iii-o" numlevel="1" lineno="185" slineno="2-79" level="3"><display>(iii)</display>an appointive officer whose appointed position is full time as certified by the <ln numlevel="1" lineno="186" slineno="2-80"/>participating employer;</subsection><subsection ssid="42-null-44" dnum="iv-o" numlevel="1" lineno="187" slineno="2-81" level="3"><display>(iv)</display>the governor, the lieutenant governor, the state auditor, the state treasurer, the <ln numlevel="1" lineno="188" slineno="2-82"/>attorney general, and a state legislator;</subsection><subsection ssid="42-null-45" dnum="v-o" numlevel="1" lineno="189" slineno="2-83" level="3"><display>(v)</display>an elected official not included under Subsection <xref depth="4" refnumber="49-22-102(6)(b)(iv)" start="0">(6)(b)(iv)</xref> whose elected position <ln numlevel="1" lineno="190" slineno="2-84"/>is full time as certified by the participating employer;</subsection><subsection ssid="42-null-46" dnum="vi-o" numlevel="1" lineno="191" slineno="2-85" level="3"><display>(vi)</display>a faculty member or employee of an institution of higher education who is <ln numlevel="1" lineno="192" slineno="2-86"/>considered full time by that institution of higher education; and</subsection><subsection ssid="42-null-47" dnum="vii-o" numlevel="1" lineno="193" slineno="2-87" level="3"><display>(vii)</display>an individual who otherwise meets the definition of this Subsection <xref depth="4" refnumber="49-22-102(6)" start="0">(6)</xref> who <ln numlevel="1" lineno="194" slineno="2-88"/>performs services for a participating employer through a professional employer <ln numlevel="1" lineno="195" slineno="2-89"/>organization or similar arrangement.</subsection></subsection><subsection ssid="42-null-48" dnum="c-o" numlevel="1" lineno="196" slineno="2-90" level="2"><display>(c)</display>"Regular full-time employee" does not include:<subsection ssid="42-null-49" dnum="i-o" numlevel="1" lineno="197" slineno="2-91" level="3"><display>(i)</display>a firefighter service employee as defined in Section <xref depth="3" refnumber="49-23-102" start="0">49-23-102</xref>;</subsection><subsection ssid="42-null-50" dnum="ii-o" numlevel="1" lineno="198" slineno="2-92" level="3"><display>(ii)</display>a public safety service employee as defined in Section <xref depth="3" refnumber="49-23-102" start="0">49-23-102</xref>;</subsection><subsection ssid="42-null-51" dnum="iii-o" numlevel="1" lineno="199" slineno="2-93" level="3"><display>(iii)</display>an education support professional:<subsection ssid="42-null-52" dnum="A-o" numlevel="1" lineno="200" slineno="2-94" level="4"><display>(A)</display>who is hired on or after July 1, 2013; and</subsection><subsection ssid="42-null-53" dnum="B-o" numlevel="1" lineno="201" slineno="2-95" level="4"><display>(B)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="202" slineno="2-96"/>employer even if the employment normally requires an average of 20 hours per <ln numlevel="1" lineno="203" slineno="2-97"/>week or more for a participating employer;</subsection></subsection><subsection ssid="42-null-54" dnum="iv-o" numlevel="1" lineno="204" slineno="2-98" level="3"><display>(iv)</display>an education support professional:<subsection ssid="42-null-55" dnum="A-o" numlevel="1" lineno="205" slineno="2-99" level="4"><display>(A)</display>who is hired before July 1, 2013;</subsection><subsection ssid="42-null-56" dnum="B-o" numlevel="1" lineno="206" slineno="2-100" level="4"><display>(B)</display>who did not qualify as a regular full-time employee before July 1, 2013;</subsection><subsection ssid="42-null-57" dnum="C-o" numlevel="1" lineno="207" slineno="2-101" level="4"><display>(C)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="208" slineno="2-102"/>employer; and</subsection><subsection ssid="42-null-58" dnum="D-o" numlevel="1" lineno="209" slineno="2-103" level="4"><display>(D)</display>whose employment hours are increased on or after July 1, 2013, to require an <ln numlevel="1" lineno="210" slineno="2-104"/>average of 20 hours per week or more for a participating employer; or</subsection><subsection ssid="42-null-59" dnum="E-o" numlevel="1" lineno="211" slineno="2-105" level="4"><display>(E)</display>who is a person working on a contract:<subsection ssid="42-null-60" dnum="I-o" numlevel="1" lineno="212" slineno="2-106" level="5"><display>(I)</display>for the purposes of vocational rehabilitation and the employment and <ln numlevel="1" lineno="213" slineno="2-107"/>training of people with significant disabilities; and</subsection><subsection ssid="42-null-61" dnum="II-o" numlevel="1" lineno="214" slineno="2-108" level="5"><display>(II)</display>that has been set aside from procurement requirements by the state <ln numlevel="1" lineno="215" slineno="2-109"/>pursuant to Section <xref depth="3" refnumber="63G-6a-805" start="0">63G-6a-805</xref> or the federal government pursuant to 41 <ln numlevel="1" lineno="216" slineno="2-110"/>U.S.C. Sec. 8501 et seq.</subsection></subsection></subsection></subsection></subsection><subsection ssid="42-null-62" dnum="7-o" numlevel="1" lineno="217" slineno="2-111" level="1"><display>(7)</display>"System" means the New Public Employees' Tier II Contributory Retirement System <ln numlevel="1" lineno="218" slineno="2-112"/>created under this chapter.</subsection><subsection ssid="42-null-63" dnum="8-o" numlevel="1" lineno="219" slineno="2-113" level="1"><display>(8)</display>"Years of service credit" means:<subsection ssid="42-null-64" dnum="a-o" numlevel="1" lineno="220" slineno="2-114" level="2"><display>(a)</display>a period consisting of 12 full months as determined by the board;</subsection><subsection ssid="42-null-65" dnum="b-o" numlevel="1" lineno="221" slineno="2-115" level="2"><display>(b)</display>a period determined by the board, whether consecutive or not, during which a regular <ln numlevel="1" lineno="222" slineno="2-116"/>full-time employee performed services for a participating employer, including any <ln numlevel="1" lineno="223" slineno="2-117"/>time the regular full-time employee was absent on a paid leave of absence granted by <ln numlevel="1" lineno="224" slineno="2-118"/>a participating employer or was absent in the service of the United States government <ln numlevel="1" lineno="225" slineno="2-119"/>on military duty as provided by this chapter; or</subsection><subsection ssid="42-null-66" dnum="c-o" numlevel="1" lineno="226" slineno="2-120" level="2"><display>(c)</display>the regular school year consisting of not less than eight months of full-time service <ln numlevel="1" lineno="227" slineno="2-121"/>for a regular full-time employee of an educational institution.</subsection></subsection></section></bsec><bsec buid="5" num="63A-17-501" type="amend" src="code" uid="C63A-17-S501_2026050620260506" sort="63A17 05010020260506" numlevel="1" lineno="228" slineno="3-1" sn="3"><section number="63A-17-501" numlevel="1" lineno="229" slineno="3-2" type="amend"><secline lineno="228">Section 3. Section <bold>63A-17-501</bold> is amended to read:</secline><catline lineno="229"><bold>63A-17-501<parens/>. Accumulated annual leave or paid time off -- Conversion to <ln numlevel="1" lineno="249" slineno="4-3"/>deferred compensation plan.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="250" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>The division shall implement a program whereby an employee may, upon termination <ln numlevel="1" lineno="251" slineno="4-5"/>of employment or retirement, elect to convert any unused annual leave<amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> or paid time off</amend> <ln numlevel="1" lineno="252" slineno="4-6"/>into any of the employee's designated deferred compensation accounts that:<subsection ssid="6-null-2" dnum="a-o" numlevel="1" lineno="253" slineno="4-7" level="2"><display>(a)</display>are sponsored by the Utah State Retirement Board; and</subsection><subsection ssid="6-null-3" dnum="b-o" numlevel="1" lineno="254" slineno="4-8" level="2"><display>(b)</display>are qualified under Section 401(k) or Section 457 of the Internal Revenue Code.</subsection></subsection><subsection ssid="6-null-4" dnum="2-o" numlevel="1" lineno="255" slineno="4-9" level="1"><display>(2)</display>Any annual leave <amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">or paid time off </amend>converted under Subsection <xref depth="4" refnumber="63A-17-503(1)" start="0">(1)</xref> shall be converted <ln numlevel="1" lineno="256" slineno="4-10"/>into the employee's deferred compensation account at the employee's pay rate at the time <ln numlevel="1" lineno="257" slineno="4-11"/>of termination or retirement.</subsection><subsection ssid="6-null-5" dnum="3-o" numlevel="1" lineno="258" slineno="4-12" level="1"><display>(3)</display>No employee may convert hours of accrued annual leave<amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"> or paid time off</amend> to the extent <ln numlevel="1" lineno="259" slineno="4-13"/>that any hours so converted would exceed the maximum amount authorized by the <ln numlevel="1" lineno="260" slineno="4-14"/>Internal Revenue Code for each calendar year.</subsection></section></bsec><bsec buid="7" num="63A-17-504" type="amend" src="code" uid="C63A-17-S504_2026050620260506" sort="63A17 05040020260506" numlevel="1" lineno="261" slineno="5-1" sn="5"><section number="63A-17-504" numlevel="1" lineno="262" slineno="5-2" type="amend"><secline lineno="261">Section 5. Section <bold>63A-17-504</bold> is amended to read:</secline><catline lineno="262"><bold>63A-17-504<parens/>. Accumulated annual leave or paid time off -- Annual conversion to <ln numlevel="1" lineno="263" slineno="5-3"/>deferred compensation plan.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="264" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>If the Legislature in an annual appropriations act with accompanying intent language <ln numlevel="1" lineno="265" slineno="5-5"/>specifically authorizes and fully funds the estimated costs of this use, the division shall <ln numlevel="1" lineno="266" slineno="5-6"/>implement a program that allows an employee, in the approved calendar year, to elect to <ln numlevel="1" lineno="267" slineno="5-7"/>convert up to 20 hours of annual leave<amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"> or paid time off</amend>, in whole hour increments not to <ln numlevel="1" lineno="268" slineno="5-8"/>exceed $250 in value, into any of the employee's designated deferred compensation <ln numlevel="1" lineno="269" slineno="5-9"/>accounts that:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="270" slineno="5-10" level="2"><display>(a)</display>are sponsored by the Utah State Retirement Board; and</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="271" slineno="5-11" level="2"><display>(b)</display>are qualified under Section 401(k) or Section 457 of the Internal Revenue Code.</subsection></subsection><subsection ssid="7-null-4" dnum="2-o" numlevel="1" lineno="272" slineno="5-12" level="1"><display>(2)</display>Any annual leave <amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">or paid time off </amend>converted under Subsection <xref depth="4" refnumber="63A-17-504(1)" start="0">(1)</xref> shall be:<subsection ssid="7-null-5" dnum="a-o" numlevel="1" lineno="273" slineno="5-13" level="2"><display>(a)</display>converted into the employee's deferred compensation account at the employee's pay <ln numlevel="1" lineno="274" slineno="5-14"/>rate at the time of conversion; and</subsection><subsection ssid="7-null-6" dnum="b-o" numlevel="1" lineno="275" slineno="5-15" level="2"><display>(b)</display>calculated in the last pay period of the leave year as determined by the Division of <ln numlevel="1" lineno="276" slineno="5-16"/>Finance.</subsection></subsection><subsection ssid="7-null-7" dnum="3-o" numlevel="1" lineno="277" slineno="5-17" level="1"><display>(3)</display>An employee may not convert hours of accrued annual leave <amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">or paid time off </amend>to the <ln numlevel="1" lineno="278" slineno="5-18"/>extent that any hours converted would:<subsection ssid="7-null-8" dnum="a-o" numlevel="1" lineno="279" slineno="5-19" level="2"><display>(a)</display>exceed the maximum amount authorized by the Internal Revenue Code for the <ln numlevel="1" lineno="280" slineno="5-20"/>calendar year; or</subsection><subsection ssid="7-null-9" dnum="b-o" numlevel="1" lineno="281" slineno="5-21" level="2"><display>(b)</display>cause the employee's balance of accumulated annual leave <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">or paid time off </amend>to drop <ln numlevel="1" lineno="282" slineno="5-22"/>below the maximum accrual limit provided by rule.</subsection></subsection></section></bsec><bsec buid="20" num="63A-17-510.1" type="enact" src="code" uid="C63A-17-S510.1_2026050620260506" sort="63A17 05100120260506" numlevel="1" lineno="283" slineno="6-1" sn="6"><section numlevel="1" lineno="284" slineno="6-2" number="63A-17-510.1" type="enact"><secline lineno="283">Section 6. Paid time off.</bold></catline><subsection ssid="20-1" dnum="_-o:1-i" numlevel="1" lineno="285" slineno="6-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="20-2" dnum="_-o:a-i" numlevel="1" lineno="286" slineno="6-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">"Annual leave II" means the same as that term is defined in Section <xref depth="3" refnumber="63A-17-510">63A-17-510</xref>.</amend></subsection><subsection ssid="20-42" dnum="_-o:b-i" numlevel="1" lineno="287" slineno="6-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="191" groupid="139" style="1" owner="jchristopherson" level="1" amendtag="end">"Change date" means the date established by the Division of Finance under <ln numlevel="1" lineno="288" slineno="6-6"/>Subsection <xref depth="4" refnumber="63A-17-510.1(2)">(2)</xref>.</amend></subsection><subsection ssid="20-18" dnum="_-o:c-i" numlevel="1" lineno="289" slineno="6-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="20-25" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">"Paid time off" means leave hours an agency provides to an employee <ln numlevel="1" lineno="290" slineno="6-8"/>beginning on the change date, as time off from work for personal use without <ln numlevel="1" lineno="291" slineno="6-9"/>affecting the employee's pay.</amend></subsection><subsection ssid="20-26" dnum="_-o:ii-i" numlevel="1" lineno="292" slineno="6-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">"Paid time off" does not include:</amend><subsection ssid="20-29" dnum="_-o:A-i" numlevel="1" lineno="293" slineno="6-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">legal holidays under Section <xref depth="3" refnumber="63G-1-301">63G-1-301</xref>;</amend></subsection><subsection ssid="20-30" dnum="_-o:B-i" numlevel="1" lineno="294" slineno="6-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">time off as compensation for actual time worked in excess of an employee's <ln numlevel="1" lineno="295" slineno="6-13"/>defined work period;</amend></subsection><subsection ssid="20-31" dnum="_-o:C-i" numlevel="1" lineno="296" slineno="6-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">sick leave;</amend></subsection><subsection ssid="20-32" dnum="_-o:D-i" numlevel="1" lineno="297" slineno="6-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">paid or unpaid administrative leave; or</amend></subsection><subsection ssid="20-33" dnum="_-o:E-i" numlevel="1" lineno="298" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">other paid or unpaid leave from work provided by state statute, administrative <ln numlevel="1" lineno="299" slineno="6-17"/>rule, or by federal law or regulation.</amend></subsection></subsection></subsection></subsection><subsection ssid="20-4" dnum="_-o:2-i" numlevel="1" lineno="300" slineno="6-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="301" slineno="6-19"/>Division of Finance shall establish a date that is not later than July 1, 2027, beginning on <ln numlevel="1" lineno="302" slineno="6-20"/>which an agency shall offer paid time off in lieu of:</amend><subsection ssid="20-5" dnum="_-o:a-i" numlevel="1" lineno="303" slineno="6-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">annual leave II; and</amend></subsection><subsection ssid="20-6" dnum="_-o:b-i" numlevel="1" lineno="304" slineno="6-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">the sick leave offered to employees as of the change date.</amend></subsection></subsection><subsection ssid="20-19" dnum="_-o:3-i" numlevel="1" lineno="305" slineno="6-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="20-38" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="185" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="63A-17-510.1(3)(b)">(3)(b)</xref>, the provisions of this section do not <ln numlevel="1" lineno="306" slineno="6-24"/>affect an employee's balance or use of leave hours accrued before the change date.</amend></subsection><subsection ssid="20-40" dnum="_-o:b-i" numlevel="1" lineno="307" slineno="6-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="183" groupid="132" style="1" owner="jchristopherson" level="1" amendtag="end">On the change date, the Division of Finance shall convert each employee's accrued <ln numlevel="1" lineno="308" slineno="6-26"/>annual leave balance to paid time off at a one-to-one ratio.</amend></subsection></subsection><subsection ssid="20-8" dnum="_-o:4-i" numlevel="1" lineno="309" slineno="6-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="20-9" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">At the time an employee accrues paid time off, the agency shall set aside the cost <ln numlevel="1" lineno="310" slineno="6-28"/>of each hour of paid time off for the employee in an amount determined in <ln numlevel="1" lineno="311" slineno="6-29"/>accordance with rules the Division of Finance makes in accordance with Title 63G, <ln numlevel="1" lineno="312" slineno="6-30"/>Chapter 3, Utah Administrative Rulemaking Act.</amend></subsection><subsection ssid="20-10" dnum="_-o:b-i" numlevel="1" lineno="313" slineno="6-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">In making rules under Subsection <xref depth="4" refnumber="63A-17-510.1(4)(a)">(4)(a)</xref>, the Division of Finance shall consider:</amend><subsection ssid="20-11" dnum="_-o:i-i" numlevel="1" lineno="314" slineno="6-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">the employee's hourly rate of pay;</amend></subsection><subsection ssid="20-12" dnum="_-o:ii-i" numlevel="1" lineno="315" slineno="6-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">applicable employer paid taxes that would be required if the employee were paid <ln numlevel="1" lineno="316" slineno="6-34"/>for the paid time off instead of the employee using it for leave;</amend></subsection><subsection ssid="20-13" dnum="_-o:iii-i" numlevel="1" lineno="317" slineno="6-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">other applicable employer paid benefits; and</amend></subsection><subsection ssid="20-14" dnum="_-o:iv-i" numlevel="1" lineno="318" slineno="6-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">adjustments due to employee hourly rate changes, including the effect on accrued <ln numlevel="1" lineno="319" slineno="6-37"/>paid time off balances.</amend></subsection></subsection><subsection ssid="20-15" dnum="_-o:c-i" numlevel="1" lineno="320" slineno="6-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">The Division of Finance shall deposit money set aside in accordance with Subsection <xref depth="4" refnumber="63A-17-510.1(4)"><ln numlevel="1" lineno="321" slineno="6-39"/>(4)</xref> into the State Employees' Leave Trust Fund created in Section <xref depth="3" refnumber="67-19f-201">67-19f-201</xref>.</amend></subsection><subsection ssid="20-22" dnum="_-o:d-i" numlevel="1" lineno="322" slineno="6-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">Subsection <xref depth="4" refnumber="63A-17-510.1(4)(a)">(4)(a)</xref> does not apply to paid time off hours that were converted from <ln numlevel="1" lineno="323" slineno="6-41"/>annual leave in accordance with Subsection <xref depth="4" refnumber="63A-17-510.1(3)">(3)</xref>, if:</amend><subsection ssid="20-36" dnum="_-o:i-i" numlevel="1" lineno="324" slineno="6-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">for converted hours that were not annual leave II hours, the agency continues to <ln numlevel="1" lineno="325" slineno="6-43"/>comply with the Division of Finance requirements for contributions to the <ln numlevel="1" lineno="326" slineno="6-44"/>termination pool; or</amend></subsection><subsection ssid="20-37" dnum="_-o:ii-i" numlevel="1" lineno="327" slineno="6-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="end">for converted hours that were annual leave II hours, the agency complied with the <ln numlevel="1" lineno="328" slineno="6-46"/>requirements of Subsection <xref depth="4" refnumber="63A-17-510(4)">63A-17-510(4)</xref> when the annual leave II hours were <ln numlevel="1" lineno="329" slineno="6-47"/>accrued.</amend></subsection></subsection></subsection><subsection ssid="20-17" dnum="_-o:5-i" numlevel="1" lineno="330" slineno="6-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="331" slineno="6-49"/>division shall make rules governing the accrual and use of paid time off provided under <ln numlevel="1" lineno="332" slineno="6-50"/>this section.</amend></subsection></section></bsec><bsec buid="14" num="63A-17-511" type="amend" src="code" uid="C63A-17-S511_2026050620260506" sort="63A17 05110020260506" numlevel="1" lineno="333" slineno="7-1" sn="7"><section number="63A-17-511" numlevel="1" lineno="334" slineno="7-2" type="amend"><secline lineno="333">Section 7. Section <bold>63A-17-511</bold> is amended to read:</secline><catline lineno="334"><bold>63A-17-511<parens/>. Parental leave -- Postpartum recovery leave.</bold></catline><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="335" slineno="7-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="14-null-2" dnum="a-o" numlevel="1" lineno="336" slineno="7-4" level="2"><display>(a)</display>"Child" means an individual who is younger than 18 years old.</subsection><subsection ssid="14-null-3" dnum="b-o" numlevel="1" lineno="337" slineno="7-5" level="2"><display>(b)</display>"Parental leave" means leave hours a state employer provides to a parental leave <ln numlevel="1" lineno="338" slineno="7-6"/>eligible employee to bond with a child or, in the case of a guardianship appointment, <ln numlevel="1" lineno="339" slineno="7-7"/>an incapacitated adult.</subsection><subsection ssid="14-null-4" dnum="c-o" numlevel="1" lineno="340" slineno="7-8" level="2"><display>(c)</display>"Parental leave eligible employee" means an employee who, on the date an event <ln numlevel="1" lineno="341" slineno="7-9"/>described in Subsections <xref depth="4" refnumber="63A-17-511(2)(a)(i)(a)">(2)(a)(i)(A)</xref> through <xref depth="4" refnumber="63A-17-511(d)">(D)</xref> occurs:<subsection ssid="14-null-5" dnum="i-o" numlevel="1" lineno="342" slineno="7-10" level="3"><display>(i)</display>is an employee of a state employer;</subsection><subsection ssid="14-null-6" dnum="ii-o" numlevel="1" lineno="343" slineno="7-11" level="3"><display>(ii)</display>is in a position that receives retirement benefits under Title 49, Utah State <ln numlevel="1" lineno="344" slineno="7-12"/>Retirement and Insurance Benefit Act;</subsection><subsection ssid="14-null-7" dnum="iii-o" numlevel="1" lineno="345" slineno="7-13" level="3"><display>(iii)</display>accrues paid leave benefits that can be used in the current and future calendar <ln numlevel="1" lineno="346" slineno="7-14"/>years;</subsection><subsection ssid="14-null-8" dnum="iv-o" numlevel="1" lineno="347" slineno="7-15" level="3"><display>(iv)</display>is not reemployed as defined in Section <xref depth="3" refnumber="49-11-1202">49-11-1202</xref>; </subsection><subsection ssid="14-null-9" dnum="v-o" numlevel="1" lineno="348" slineno="7-16" level="3"><display>(v)</display>is assuming a parental role with respect to the child or the incapacitated adult for <ln numlevel="1" lineno="349" slineno="7-17"/>which parental leave is requested; and</subsection><subsection ssid="14-null-10" dnum="vi-o" numlevel="1" lineno="350" slineno="7-18" level="3" space="false"><display>(vi)</display><subsection ssid="14-null-11" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is the child's biological parent;</subsection><subsection ssid="14-null-12" dnum="B-o" numlevel="1" lineno="351" slineno="7-19" level="4"><display>(B)</display>is the spouse of the person who gave birth to the child; </subsection><subsection ssid="14-null-13" dnum="C-o" numlevel="1" lineno="352" slineno="7-20" level="4"><display>(C)</display>is the adoptive parent of the child, unless the employee is the spouse of the <ln numlevel="1" lineno="353" slineno="7-21"/>pre-existing parent;</subsection><subsection ssid="14-null-14" dnum="D-o" numlevel="1" lineno="354" slineno="7-22" level="4"><display>(D)</display>is the intended parent of the child and the child is born under a validated <ln numlevel="1" lineno="355" slineno="7-23"/>gestational agreement in accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">Title 78B, Chapter 15, Part 8, <ln numlevel="1" lineno="356" slineno="7-24"/>Gestational Agreement</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Title 81, Chapter 5, Part 8, Gestational Agreement</amend>;</subsection><subsection ssid="14-null-15" dnum="E-o" numlevel="1" lineno="357" slineno="7-25" level="4"><display>(E)</display>is appointed the legal guardian of the child or the incapacitated adult; or</subsection><subsection ssid="14-null-16" dnum="F-o" numlevel="1" lineno="358" slineno="7-26" level="4"><display>(F)</display>is the foster parent of the child.</subsection></subsection></subsection><subsection ssid="14-null-17" dnum="d-o" numlevel="1" lineno="359" slineno="7-27" level="2"><display>(d)</display>"Postpartum recovery leave" means leave hours a state employer provides to a <ln numlevel="1" lineno="360" slineno="7-28"/>postpartum recovery leave eligible employee to recover from childbirth that occurs at <ln numlevel="1" lineno="361" slineno="7-29"/>20 weeks or greater gestation.</subsection><subsection ssid="14-null-18" dnum="e-o" numlevel="1" lineno="362" slineno="7-30" level="2"><display>(e)</display>"Retaliatory action" means to do any of the following to an employee:<subsection ssid="14-null-19" dnum="i-o" numlevel="1" lineno="363" slineno="7-31" level="3"><display>(i)</display>dismiss the employee;</subsection><subsection ssid="14-null-20" dnum="ii-o" numlevel="1" lineno="364" slineno="7-32" level="3"><display>(ii)</display>reduce the employee's compensation;</subsection><subsection ssid="14-null-21" dnum="iii-o" numlevel="1" lineno="365" slineno="7-33" level="3"><display>(iii)</display>fail to increase the employee's compensation by an amount that the employee is <ln numlevel="1" lineno="366" slineno="7-34"/>otherwise entitled to or was promised;</subsection><subsection ssid="14-null-22" dnum="iv-o" numlevel="1" lineno="367" slineno="7-35" level="3"><display>(iv)</display>fail to promote the employee if the employee would have otherwise been <ln numlevel="1" lineno="368" slineno="7-36"/>promoted; or</subsection><subsection ssid="14-null-23" dnum="v-o" numlevel="1" lineno="369" slineno="7-37" level="3"><display>(v)</display>threaten to take an action described in Subsections <xref depth="4" refnumber="63A-17-511(1)(e)(i)">(1)(e)(i)</xref> through <xref depth="4" refnumber="63A-17-511(iv)">(iv)</xref>.</subsection></subsection><subsection ssid="14-null-24" dnum="f-o" numlevel="1" lineno="370" slineno="7-38" level="2"><display>(f)</display>"Postpartum recovery leave eligible employee" means an employee who:<subsection ssid="14-null-25" dnum="i-o" numlevel="1" lineno="371" slineno="7-39" level="3"><display>(i)</display>is in a position that receives retirement benefits under Title 49, Utah State <ln numlevel="1" lineno="372" slineno="7-40"/>Retirement and Insurance Benefit Act;</subsection><subsection ssid="14-null-26" dnum="ii-o" numlevel="1" lineno="373" slineno="7-41" level="3"><display>(ii)</display>accrues paid leave benefits that can be used in the current and future calendar <ln numlevel="1" lineno="374" slineno="7-42"/>years;</subsection><subsection ssid="14-null-27" dnum="iii-o" numlevel="1" lineno="375" slineno="7-43" level="3"><display>(iii)</display>is not reemployed as defined in Section <xref depth="3" refnumber="49-11-1202">49-11-1202</xref>; and</subsection><subsection ssid="14-null-28" dnum="iv-o" numlevel="1" lineno="376" slineno="7-44" level="3"><display>(iv)</display>gives birth to a child.</subsection></subsection><subsection ssid="14-null-29" dnum="g-o" numlevel="1" lineno="377" slineno="7-45" level="2" space="false"><display>(g)</display><subsection ssid="14-null-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"State employer" means:<subsection ssid="14-null-31" dnum="A-o" numlevel="1" lineno="378" slineno="7-46" level="4" tab="1"><display>(A)</display>a state executive branch agency, including the State Tax Commission, the <ln numlevel="1" lineno="379" slineno="7-47"/>National Guard, and the Board of Pardons and Parole;</subsection><subsection ssid="14-null-32" dnum="B-o" numlevel="1" lineno="380" slineno="7-48" level="4" tab="1"><display>(B)</display>the legislative branch of the state;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="14-null-33" dnum="C-o" numlevel="1" lineno="381" slineno="7-49" level="4" tab="1"><display>(C)</display>the judicial branch of the state<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="14-101" dnum="_-o:D-i" numlevel="1" lineno="382" slineno="7-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">the State Board of Education.</amend></subsection></subsection><subsection ssid="14-null-34" dnum="ii-o" numlevel="1" lineno="383" slineno="7-51" level="3"><display>(ii)</display>"State employer" does not include:<subsection ssid="14-null-35" dnum="A-o" numlevel="1" lineno="384" slineno="7-52" level="4"><display>(A)</display>an institute of higher education;</subsection><subsection ssid="14-null-36" dnum="B-o" numlevel="1" lineno="385" slineno="7-53" level="4"><display>(B)</display>the Utah Board of Higher Education;</subsection><subsection ssid="14-null-37" dnum="C-o" numlevel="1" lineno="386" slineno="7-54" level="4"><display>(C)</display>an independent entity as defined in Section <xref depth="3" refnumber="63E-1-102">63E-1-102</xref>;</subsection><subsection ssid="14-null-38" dnum="D-o" numlevel="1" lineno="387" slineno="7-55" level="4"><display>(D)</display>the Attorney General's Office;</subsection><subsection ssid="14-null-39" dnum="E-o" numlevel="1" lineno="388" slineno="7-56" level="4"><display>(E)</display>the State Auditor's Office; or</subsection><subsection ssid="14-null-40" dnum="F-o" numlevel="1" lineno="389" slineno="7-57" level="4"><display>(F)</display>the State Treasurer's Office.</subsection></subsection></subsection><subsection ssid="14-null-41" dnum="h-o" numlevel="1" lineno="390" slineno="7-58" level="2"><display>(h)</display>"Qualified employee" means:<subsection ssid="14-null-42" dnum="i-o" numlevel="1" lineno="391" slineno="7-59" level="3"><display>(i)</display>a parental leave eligible employee; or</subsection><subsection ssid="14-null-43" dnum="ii-o" numlevel="1" lineno="392" slineno="7-60" level="3"><display>(ii)</display>a postpartum leave eligible employee.</subsection></subsection></subsection><subsection ssid="14-null-44" dnum="2-o" numlevel="1" lineno="393" slineno="7-61" level="1" space="false"><display>(2)</display><subsection ssid="14-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="63A-17-511(4)">(4)</xref> and <xref depth="4" refnumber="63A-17-511(5)">(5)</xref>, a state employer shall:<subsection ssid="14-null-46" dnum="i-o" numlevel="1" lineno="394" slineno="7-62" level="3" tab="1"><display>(i)</display>allow a parental leave eligible employee to use up to three work weeks of paid <ln numlevel="1" lineno="395" slineno="7-63"/>parental leave for:<subsection ssid="14-null-47" dnum="A-o" numlevel="1" lineno="396" slineno="7-64" level="4"><display>(A)</display>the birth of the parental leave eligible employee's child;</subsection><subsection ssid="14-null-48" dnum="B-o" numlevel="1" lineno="397" slineno="7-65" level="4"><display>(B)</display>the adoption of a child; </subsection><subsection ssid="14-null-49" dnum="C-o" numlevel="1" lineno="398" slineno="7-66" level="4"><display>(C)</display>the appointment of legal guardianship of a child or incapacitated adult; or</subsection><subsection ssid="14-null-50" dnum="D-o" numlevel="1" lineno="399" slineno="7-67" level="4"><display>(D)</display>the placement of a foster child in the parental leave eligible employee's care; <ln numlevel="1" lineno="400" slineno="7-68"/>and</subsection></subsection><subsection ssid="14-null-51" dnum="ii-o" numlevel="1" lineno="401" slineno="7-69" level="3" tab="1"><display>(ii)</display>allow a postpartum recovery leave eligible employee to use up to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">three</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">nine</amend> <ln numlevel="1" lineno="402" slineno="7-70"/>work weeks of paid postpartum recovery leave for recovery from childbirth.</subsection></subsection><subsection ssid="14-null-52" dnum="b-o" numlevel="1" lineno="403" slineno="7-71" level="2"><display>(b)</display>A state employer shall allow a qualified employee who is part-time or who works in <ln numlevel="1" lineno="404" slineno="7-72"/>excess of a 40-hour work week or its equivalent to use the amount of parental leave <ln numlevel="1" lineno="405" slineno="7-73"/>or postpartum recovery leave available to the qualified employee under this section <ln numlevel="1" lineno="406" slineno="7-74"/>on a pro rata basis as adopted by rule by the division under Subsection <xref depth="4" refnumber="63A-17-511(12)">(12)</xref>.</subsection></subsection><subsection ssid="14-null-53" dnum="3-o" numlevel="1" lineno="407" slineno="7-75" level="1" space="false"><display>(3)</display><subsection ssid="14-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Parental leave described in Subsection <xref depth="4" refnumber="63A-17-511(2)(a)(i)">(2)(a)(i)</xref>:<subsection ssid="14-null-55" dnum="i-o" numlevel="1" lineno="408" slineno="7-76" level="3" tab="1"><display>(i)</display>may not be used before the day on which:<subsection ssid="14-null-56" dnum="A-o" numlevel="1" lineno="409" slineno="7-77" level="4"><display>(A)</display>the parental leave eligible employee's child is born;</subsection><subsection ssid="14-null-57" dnum="B-o" numlevel="1" lineno="410" slineno="7-78" level="4"><display>(B)</display>the parental leave eligible employee adopts a child; </subsection><subsection ssid="14-null-58" dnum="C-o" numlevel="1" lineno="411" slineno="7-79" level="4"><display>(C)</display>the parental leave eligible employee is appointed legal guardian of a child or <ln numlevel="1" lineno="412" slineno="7-80"/>incapacitated adult; or</subsection><subsection ssid="14-null-59" dnum="D-o" numlevel="1" lineno="413" slineno="7-81" level="4"><display>(D)</display>a foster child is placed in the parental leave eligible employee's care<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection></subsection><subsection ssid="14-null-60" dnum="ii-o" numlevel="1" lineno="414" slineno="7-82" level="3" tab="1"><display>(ii)</display>may not be used more than six months after the date described in Subsection <xref depth="4" refnumber="63A-17-511(3)(a)(i)"><ln numlevel="1" lineno="415" slineno="7-83"/>(3)(a)(i)</xref>;</subsection><subsection ssid="14-null-61" dnum="iii-o" numlevel="1" lineno="416" slineno="7-84" level="3" tab="1"><display>(iii)</display>may not be used intermittently, unless:<subsection ssid="14-null-62" dnum="A-o" numlevel="1" lineno="417" slineno="7-85" level="4"><display>(A)</display>by mutual written agreement between the state employer and the parental <ln numlevel="1" lineno="418" slineno="7-86"/>leave eligible employee; or</subsection><subsection ssid="14-null-63" dnum="B-o" numlevel="1" lineno="419" slineno="7-87" level="4"><display>(B)</display>a health care provider certifies that intermittent leave is medically necessary <ln numlevel="1" lineno="420" slineno="7-88"/>due to a serious health condition of the child;</subsection></subsection><subsection ssid="14-null-64" dnum="iv-o" numlevel="1" lineno="421" slineno="7-89" level="3" tab="1"><display>(iv)</display>runs concurrently with any leave authorized under the Family and Medical Leave <ln numlevel="1" lineno="422" slineno="7-90"/>Act of 1993, 29 U.S.C. Sec. 2601 et seq.; and</subsection><subsection ssid="14-null-65" dnum="v-o" numlevel="1" lineno="423" slineno="7-91" level="3" tab="1"><display>(v)</display>runs consecutively to postpartum recovery leave.</subsection></subsection><subsection ssid="14-null-66" dnum="b-o" numlevel="1" lineno="424" slineno="7-92" level="2"><display>(b)</display>The amount of parental leave authorized under Subsection <xref depth="4" refnumber="63A-17-511(2)(a)(i)">(2)(a)(i)</xref> does not increase <ln numlevel="1" lineno="425" slineno="7-93"/>if a parental leave eligible employee:<subsection ssid="14-null-67" dnum="i-o" numlevel="1" lineno="426" slineno="7-94" level="3"><display>(i)</display>has more than one child born from the same pregnancy;</subsection><subsection ssid="14-null-68" dnum="ii-o" numlevel="1" lineno="427" slineno="7-95" level="3"><display>(ii)</display>adopts more than one child; </subsection><subsection ssid="14-null-69" dnum="iii-o" numlevel="1" lineno="428" slineno="7-96" level="3"><display>(iii)</display>has more than one foster child placed in the parental leave eligible employee's <ln numlevel="1" lineno="429" slineno="7-97"/>care; or</subsection><subsection ssid="14-null-70" dnum="iv-o" numlevel="1" lineno="430" slineno="7-98" level="3"><display>(iv)</display>is appointed legal guardian of more than one child or incapacitated adult.</subsection></subsection><subsection ssid="14-null-71" dnum="c-o" numlevel="1" lineno="431" slineno="7-99" level="2"><display>(c)</display>A parental leave eligible employee may not use more than three work weeks of paid <ln numlevel="1" lineno="432" slineno="7-100"/>parental leave within a single 12-month period, regardless of whether during that <ln numlevel="1" lineno="433" slineno="7-101"/>12-month period the parental leave eligible employee:<subsection ssid="14-null-72" dnum="i-o" numlevel="1" lineno="434" slineno="7-102" level="3"><display>(i)</display>becomes the parent of more than one child;</subsection><subsection ssid="14-null-73" dnum="ii-o" numlevel="1" lineno="435" slineno="7-103" level="3"><display>(ii)</display>adopts more than one child; </subsection><subsection ssid="14-null-74" dnum="iii-o" numlevel="1" lineno="436" slineno="7-104" level="3"><display>(iii)</display>has more than one foster child placed in the parental leave eligible employee's <ln numlevel="1" lineno="437" slineno="7-105"/>care; or</subsection><subsection ssid="14-null-75" dnum="iv-o" numlevel="1" lineno="438" slineno="7-106" level="3"><display>(iv)</display>is appointed legal guardian of more than one child or incapacitated adult.</subsection></subsection></subsection><subsection ssid="14-null-76" dnum="4-o" numlevel="1" lineno="439" slineno="7-107" level="1" space="false"><display>(4)</display><subsection ssid="14-null-77" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Postpartum recovery leave described in Subsection <xref depth="4" refnumber="63A-17-511(2)(a)(ii)">(2)(a)(ii)</xref>:<subsection ssid="14-null-78" dnum="i-o" numlevel="1" lineno="440" slineno="7-108" level="3" tab="1"><display>(i)</display>shall be used starting on the day on which the postpartum recovery leave eligible <ln numlevel="1" lineno="441" slineno="7-109"/>employee gives birth, unless a health care provider certifies that an earlier start <ln numlevel="1" lineno="442" slineno="7-110"/>date is medically necessary;</subsection><subsection ssid="14-null-79" dnum="ii-o" numlevel="1" lineno="443" slineno="7-111" level="3" tab="1"><display>(ii)</display>shall be used in a single continuous period, unless otherwise authorized in writing <ln numlevel="1" lineno="444" slineno="7-112"/>by the director of the division;</subsection><subsection ssid="14-null-80" dnum="iii-o" numlevel="1" lineno="445" slineno="7-113" level="3" tab="1"><display>(iii)</display>runs concurrently with any leave authorized under the Family and Medical Leave <ln numlevel="1" lineno="446" slineno="7-114"/>Act of 1993, 29 U.S.C. Sec. 2601 et seq.; and</subsection><subsection ssid="14-null-81" dnum="iv-o" numlevel="1" lineno="447" slineno="7-115" level="3" tab="1"><display>(iv)</display>runs consecutively to parental leave.</subsection></subsection><subsection ssid="14-null-82" dnum="b-o" numlevel="1" lineno="448" slineno="7-116" level="2"><display>(b)</display>The amount of postpartum recovery leave authorized under Subsection <xref depth="4" refnumber="63A-17-511(2)(a)(ii)">(2)(a)(ii)</xref> <ln numlevel="1" lineno="449" slineno="7-117"/>does not increase if a postpartum recovery leave eligible employee has more than one <ln numlevel="1" lineno="450" slineno="7-118"/>child born from the same pregnancy.</subsection></subsection><subsection ssid="14-null-83" dnum="5-o" numlevel="1" lineno="451" slineno="7-119" level="1" space="false"><display>(5)</display><subsection ssid="14-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="63A-17-511(5)(b)">(5)(b)</xref>, a qualified employee shall give the state <ln numlevel="1" lineno="452" slineno="7-120"/>employer notice at least 30 days before the day on which the qualified employee <ln numlevel="1" lineno="453" slineno="7-121"/>plans to:<subsection ssid="14-null-85" dnum="i-o" numlevel="1" lineno="454" slineno="7-122" level="3" tab="1"><display>(i)</display>begin using parental leave or postpartum recovery leave under this section; and</subsection><subsection ssid="14-null-86" dnum="ii-o" numlevel="1" lineno="455" slineno="7-123" level="3" tab="1"><display>(ii)</display>stop using postpartum recovery leave under this section.</subsection></subsection><subsection ssid="14-null-87" dnum="b-o" numlevel="1" lineno="456" slineno="7-124" level="2"><display>(b)</display>If circumstances beyond the qualified employee's control prevent the qualified <ln numlevel="1" lineno="457" slineno="7-125"/>employee from giving notice in accordance with Subsection <xref depth="4" refnumber="63A-17-511(5)(a)">(5)(a)</xref>, the qualified <ln numlevel="1" lineno="458" slineno="7-126"/>employee shall give each notice described in Subsection <xref depth="4" refnumber="63A-17-511(5)(a)">(5)(a)</xref> as soon as reasonably <ln numlevel="1" lineno="459" slineno="7-127"/>practicable.</subsection></subsection><subsection ssid="14-null-88" dnum="6-o" numlevel="1" lineno="460" slineno="7-128" level="1"><display>(6)</display>Except as provided in Subsections <xref depth="4" refnumber="63A-17-511(3)(a)(iv)">(3)(a)(iv)</xref> and <xref depth="4" refnumber="63A-17-511(4)(a)(iii)">(4)(a)(iii)</xref>, a state employer may not <ln numlevel="1" lineno="461" slineno="7-129"/>charge parental leave or postpartum recovery leave under this section against sick, <ln numlevel="1" lineno="462" slineno="7-130"/>annual, compensatory, excess, or other leave a qualified employee is entitled to.</subsection><subsection ssid="14-null-89" dnum="7-o" numlevel="1" lineno="463" slineno="7-131" level="1"><display>(7)</display>A state employer may not compensate a qualified employee for any unused parental <ln numlevel="1" lineno="464" slineno="7-132"/>leave or postpartum recovery leave upon termination of employment.</subsection><subsection ssid="14-null-90" dnum="8-o" numlevel="1" lineno="465" slineno="7-133" level="1" space="false"><display>(8)</display><subsection ssid="14-null-91" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Following the expiration of a qualified employee's parental leave or postpartum <ln numlevel="1" lineno="466" slineno="7-134"/>recovery leave under this section, the state employer shall ensure that the qualified <ln numlevel="1" lineno="467" slineno="7-135"/>employee may return to:<subsection ssid="14-null-92" dnum="i-o" numlevel="1" lineno="468" slineno="7-136" level="3" tab="1"><display>(i)</display>the position that the qualified employee held before using parental leave or <ln numlevel="1" lineno="469" slineno="7-137"/>postpartum recovery leave; or</subsection><subsection ssid="14-null-93" dnum="ii-o" numlevel="1" lineno="470" slineno="7-138" level="3" tab="1"><display>(ii)</display>a position within the state employer that is equivalent in seniority, status, benefits, <ln numlevel="1" lineno="471" slineno="7-139"/>and pay to the position that the qualified employee held before using parental <ln numlevel="1" lineno="472" slineno="7-140"/>leave or postpartum recovery leave.</subsection></subsection><subsection ssid="14-null-94" dnum="b-o" numlevel="1" lineno="473" slineno="7-141" level="2"><display>(b)</display>If during the time a qualified employee uses parental leave or postpartum recovery <ln numlevel="1" lineno="474" slineno="7-142"/>leave under this section the state employer experiences a reduction in force and, as <ln numlevel="1" lineno="475" slineno="7-143"/>part of the reduction in force, the qualified employee would have been separated had <ln numlevel="1" lineno="476" slineno="7-144"/>the qualified employee not been using the parental leave or postpartum recovery <ln numlevel="1" lineno="477" slineno="7-145"/>leave, the state employer may separate the qualified employee in accordance with any <ln numlevel="1" lineno="478" slineno="7-146"/>applicable process or procedure as if the qualified employee were not using the <ln numlevel="1" lineno="479" slineno="7-147"/>parental leave or postpartum recovery leave.</subsection></subsection><subsection ssid="14-null-95" dnum="9-o" numlevel="1" lineno="480" slineno="7-148" level="1"><display>(9)</display>During the time a qualified employee uses parental leave or postpartum recovery leave <ln numlevel="1" lineno="481" slineno="7-149"/>under this section, the qualified employee shall continue to receive all employment <ln numlevel="1" lineno="482" slineno="7-150"/>related benefits and payments at the same level that the qualified employee received <ln numlevel="1" lineno="483" slineno="7-151"/>immediately before beginning the parental leave or postpartum leave, provided that the <ln numlevel="1" lineno="484" slineno="7-152"/>qualified employee pays any required employee contributions.</subsection><subsection ssid="14-null-96" dnum="10-o" numlevel="1" lineno="485" slineno="7-153" level="1"><display>(10)</display>A state employer may not:<subsection ssid="14-null-97" dnum="a-o" numlevel="1" lineno="486" slineno="7-154" level="2"><display>(a)</display>interfere with or otherwise restrain a qualified employee from using parental leave or <ln numlevel="1" lineno="487" slineno="7-155"/>postpartum recovery leave in accordance with this section; or</subsection><subsection ssid="14-null-98" dnum="b-o" numlevel="1" lineno="488" slineno="7-156" level="2"><display>(b)</display>take retaliatory action against a qualified employee for using parental leave or <ln numlevel="1" lineno="489" slineno="7-157"/>postpartum recovery leave in accordance with this section.</subsection></subsection><subsection ssid="14-null-99" dnum="11-o" numlevel="1" lineno="490" slineno="7-158" level="1"><display>(11)</display>A state employer shall provide each employee written information regarding a <ln numlevel="1" lineno="491" slineno="7-159"/>qualified employee's right to use parental leave or postpartum recovery leave under this <ln numlevel="1" lineno="492" slineno="7-160"/>section.</subsection><subsection ssid="14-null-100" dnum="12-o" numlevel="1" lineno="493" slineno="7-161" level="1"><display>(12)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="494" slineno="7-162"/>division shall, on or before July 1, 2022, make rules for the use and administration of <ln numlevel="1" lineno="495" slineno="7-163"/>parental leave and postpartum recovery leave under this section, including a schedule <ln numlevel="1" lineno="496" slineno="7-164"/>that provides paid parental leave or postpartum recovery leave for a qualified employee <ln numlevel="1" lineno="497" slineno="7-165"/>who is part-time or who works in excess of a 40-hour work week on a pro rata basis.</subsection></section></bsec><bsec buid="1" num="63A-17-805" type="amend" src="code" uid="C63A-17-S805_2026050620260506" sort="63A17 08050020260506" numlevel="1" lineno="498" slineno="8-1" sn="8"><section number="63A-17-805" numlevel="1" lineno="499" slineno="8-2" type="amend"><secline lineno="498">Section 8. Section <bold>63A-17-805</bold> is amended to read:</secline><catline lineno="499"><bold>63A-17-805<parens/>. State employee matching supplemental defined contribution benefit.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="500" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-63" dnum="_-o:a-i" numlevel="1" lineno="501" slineno="8-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">"Active member" means the same as that term is defined in Section <xref depth="3" refnumber="49-11-102">49-11-102</xref>.</amend></subsection><subsection ssid="1-64" dnum="_-o:b-i" numlevel="1" lineno="502" slineno="8-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">"Change date" means the same as that term is defined in Section <xref depth="3" refnumber="63A-17-510.1">63A-17-510.1</xref>.</amend></subsection><subsection ssid="1-null-2" dnum="a-o:c-i" numlevel="1" lineno="503" slineno="8-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1251" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Qualifying account" means:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="504" slineno="8-7" level="3"><display>(i)</display>a defined contribution plan qualified under Section 401(k) of the Internal Revenue <ln numlevel="1" lineno="505" slineno="8-8"/>Code, which is sponsored by the Utah State Retirement Board;</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="506" slineno="8-9" level="3"><display>(ii)</display>a deemed Individual Retirement Account authorized under the Internal Revenue <ln numlevel="1" lineno="507" slineno="8-10"/>Code, which is sponsored by the Utah State Retirement Board; or</subsection><subsection ssid="1-null-5" dnum="iii-o" numlevel="1" lineno="508" slineno="8-11" level="3"><display>(iii)</display>a similar savings plan or account authorized under the Internal Revenue Code, <ln numlevel="1" lineno="509" slineno="8-12"/>which is sponsored by the Utah State Retirement Board.</subsection></subsection><subsection ssid="1-null-6" dnum="b-o:d-i" numlevel="1" lineno="510" slineno="8-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1255" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Qualifying employee" means an employee who is:<subsection ssid="1-null-7" dnum="i-o" numlevel="1" lineno="511" slineno="8-14" level="3"><display>(i)</display>in a position that is:<subsection ssid="1-null-8" dnum="A-o" numlevel="1" lineno="512" slineno="8-15" level="4"><display>(A)</display>receiving retirement benefits under <xref depth="0" refnumber="49" start="0">Title 49, Utah State Retirement and <ln numlevel="1" lineno="513" slineno="8-16"/>Insurance Benefit Act</xref>; and</subsection><subsection ssid="1-null-9" dnum="B-o" numlevel="1" lineno="514" slineno="8-17" level="4"><display>(B)</display>accruing paid leave benefits that can be used in the current and future calendar <ln numlevel="1" lineno="515" slineno="8-18"/>years; and</subsection></subsection><subsection ssid="1-null-10" dnum="ii-o" numlevel="1" lineno="516" slineno="8-19" level="3"><display>(ii)</display>not an employee who is reemployed as that term is:<subsection ssid="1-null-11" dnum="A-o" numlevel="1" lineno="517" slineno="8-20" level="4"><display>(A)</display>defined in Section <xref depth="3" refnumber="49-11-1202" start="0">49-11-1202</xref>; or</subsection><subsection ssid="1-null-12" dnum="B-o" numlevel="1" lineno="518" slineno="8-21" level="4"><display>(B)</display>used in Section <xref depth="3" refnumber="49-11-504" start="0">49-11-504</xref>.</subsection></subsection></subsection><subsection ssid="1-52" dnum="_-o:e-i" numlevel="1" lineno="519" slineno="8-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">"Tier I qualifying employee" means a qualifying employee who is an active member <ln numlevel="1" lineno="520" slineno="8-23"/>in Tier I, as defined in Section <xref depth="3" refnumber="49-11-102">49-11-102</xref>.</amend></subsection><subsection ssid="1-53" dnum="_-o:f-i" numlevel="1" lineno="521" slineno="8-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1263" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">"Tier II qualifying employee" means a qualifying employee who is an active member <ln numlevel="1" lineno="522" slineno="8-25"/>in Tier II, as defined in Section <xref depth="3" refnumber="49-11-102">49-11-102</xref>.</amend></subsection></subsection><subsection ssid="1-null-13" dnum="2-o" numlevel="1" lineno="523" slineno="8-26" level="1"><display>(2)</display>Subject to the requirements of Subsection <xref depth="4" refnumber="63A-17-805(3)" start="0">(3)</xref><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> and applicable federal law</amend>, an employer <ln numlevel="1" lineno="524" slineno="8-27"/>shall make a biweekly matching contribution to every qualifying employee's defined <ln numlevel="1" lineno="525" slineno="8-28"/>contribution plan qualified under Section 401(k) of the Internal Revenue Code, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">subject <ln numlevel="1" lineno="526" slineno="8-29"/>to federal requirements and limitations, </amend><amendoutend style="2"/>which is sponsored by the Utah State <ln numlevel="1" lineno="527" slineno="8-30"/>Retirement Board<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, as follows:</amend><subsection ssid="1-50" dnum="_-o:a-i" numlevel="1" lineno="528" slineno="8-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">before the change date, at a 100% match rate; or</amend></subsection><subsection ssid="1-57" dnum="_-o:b-i" numlevel="1" lineno="529" slineno="8-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1266" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">on or after the change date:</amend><subsection ssid="1-54" dnum="_-o:i-i" numlevel="1" lineno="530" slineno="8-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">for a Tier I qualifying employee, at a 100% match rate; and</amend></subsection><subsection ssid="1-66" dnum="_-o:ii-i" numlevel="1" lineno="531" slineno="8-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1268" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">for a Tier II qualifying employee, at a 100% match rate for the first $26 the <ln numlevel="1" lineno="532" slineno="8-35"/>employee contributes and at a 50% match rate for any amount the employee <ln numlevel="1" lineno="533" slineno="8-36"/>contributes above $26.</amend></subsection></subsection></subsection><subsection ssid="1-null-14" dnum="3-o" numlevel="1" lineno="534" slineno="8-37" level="1" space="false"><display>(3)</display><subsection ssid="1-null-15" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1270" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="12" style="2" owner="jchristopherson" level="1" deltag="end">In accordance with the requirements of this Subsection <xref depth="4" refnumber="63A-17-805(3)" start="0">(3)</xref>, each qualifying <ln numlevel="1" lineno="535" slineno="8-38"/>employee shall be eligible to receive the same dollar amount for the contribution <ln numlevel="1" lineno="536" slineno="8-39"/>under Subsection <xref depth="4" refnumber="63A-17-805(2)" start="0">(2)</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-16" dnum="b-o:a-i" numlevel="1" lineno="537" slineno="8-40" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1271" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1272" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>A qualifying employee who is hired before July 1, 2023:<subsection ssid="1-null-17" dnum="i-o" numlevel="1" lineno="538" slineno="8-41" level="3"><display>(i)</display>shall receive the contribution amount determined under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="79" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-805(3)(f)" start="0">(3)(f)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(e)</amend> if <ln numlevel="1" lineno="539" slineno="8-42"/>the qualifying employee makes a voluntary personal contribution to one or more <ln numlevel="1" lineno="540" slineno="8-43"/>qualifying accounts in an amount equal to or greater than the employer's <ln numlevel="1" lineno="541" slineno="8-44"/>contribution amount determined under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-805(3)(f)" start="0">(3)(f)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(e)</amend>;</subsection><subsection ssid="1-null-18" dnum="ii-o" numlevel="1" lineno="542" slineno="8-45" level="3"><display>(ii)</display>shall receive a partial contribution amount that is equal to the qualifying <ln numlevel="1" lineno="543" slineno="8-46"/>employee's personal contribution amount if the employee makes a voluntary <ln numlevel="1" lineno="544" slineno="8-47"/>personal contribution to one or more qualifying accounts in an amount less than <ln numlevel="1" lineno="545" slineno="8-48"/>the employer's contribution amount determined under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="81" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-805(3)(f)" start="0">(3)(f)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="71" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(e)</amend>; or</subsection><subsection ssid="1-null-19" dnum="iii-o" numlevel="1" lineno="546" slineno="8-49" level="3"><display>(iii)</display>may not receive a contribution under Subsection <xref depth="4" refnumber="63A-17-805(2)" start="0">(2)</xref> if the qualifying employee <ln numlevel="1" lineno="547" slineno="8-50"/>does not make a voluntary personal contribution to a qualifying account.</subsection></subsection><subsection ssid="1-null-20" dnum="c-o:b-i" numlevel="1" lineno="548" slineno="8-51" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1275" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display><subsection ssid="1-null-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An employer shall automatically enroll a qualifying employee who is hired <ln numlevel="1" lineno="549" slineno="8-52"/>on or after July 1, 2023, to make a personal contribution to a defined contribution <ln numlevel="1" lineno="550" slineno="8-53"/>plan qualified under Section 401(k) of the Internal Revenue Code, which is <ln numlevel="1" lineno="551" slineno="8-54"/>sponsored by the Utah State Retirement Board, in an amount equal to <amend anum="0" ea="amend" pairid="147" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="both">the lesser of:</amend><subsection ssid="1-68" dnum="_-o:A-i" numlevel="1" lineno="552" slineno="8-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1" amendtag="both">(A)</amend></display>the employer's contribution amount determined under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="150" groupid="127" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-805(3)(f)" start="0">(3)(f)</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="157" groupid="132" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="553" slineno="8-56"/>(3)(e); <ln numlevel="1" lineno="568" slineno="8-71"/>or</subsection><subsection ssid="1-null-29" dnum="B-o" numlevel="1" lineno="569" slineno="8-72" level="4" tab="1"><display>(B)</display>to a qualifying account other than the defined contribution plan qualified <ln numlevel="1" lineno="570" slineno="8-73"/>under Section 401(k) of the Internal Revenue Code, which is sponsored by the <ln numlevel="1" lineno="571" slineno="8-74"/>Utah State Retirement Board.</subsection></subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="572" slineno="8-75" level="3"><display>(ii)</display>A qualifying employee who opts to make a personal contribution for less than the <ln numlevel="1" lineno="573" slineno="8-76"/>amount determined under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="87" groupid="76" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-805(3)(e)">(3)(f)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="77" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(b)</amend> shall receive a partial <ln numlevel="1" lineno="574" slineno="8-77"/>contribution that is equal to the qualifying employee's personal contribution <ln numlevel="1" lineno="575" slineno="8-78"/>amount.</subsection></subsection><subsection ssid="1-null-31" dnum="f-o:e-i" numlevel="1" lineno="576" slineno="8-79" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1290" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1291" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display><subsection ssid="1-null-32" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Subject to the maximum limit under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="88" groupid="77" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-805(3)(e)(iii)">(3)(f)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="78" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(e)(iii) or (iv)</amend>, <ln numlevel="1" lineno="577" slineno="8-80"/>the Legislature shall annually determine the contribution amount that an employer <ln numlevel="1" lineno="578" slineno="8-81"/>shall provide to each qualifying employee under Subsection <xref depth="4" refnumber="63A-17-805(2)" start="0">(2)</xref>.</subsection><subsection ssid="1-null-33" dnum="ii-o" numlevel="1" lineno="579" slineno="8-82" level="3"><display>(ii)</display>The division shall make recommendations annually to the Legislature on the <ln numlevel="1" lineno="580" slineno="8-83"/>contribution amount required under Subsection <xref depth="4" refnumber="63A-17-805(2)" start="0">(2)</xref>, in consultation with the <ln numlevel="1" lineno="581" slineno="8-84"/>Governor's Office of Planning and Budget and the Division of Finance.</subsection><subsection ssid="1-null-34" dnum="iii-o" numlevel="1" lineno="582" slineno="8-85" level="3"><display>(iii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="113" groupid="98" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="112" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Before the change date, the</amend> biweekly matching contribution amount <ln numlevel="1" lineno="583" slineno="8-86"/>required under Subsection <xref depth="4" refnumber="63A-17-805(2)" start="0">(2)</xref> may not exceed $26 for each qualifying employee.</subsection><subsection ssid="1-59" dnum="_-o:iv-i" numlevel="1" lineno="584" slineno="8-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">On or after the change date, the biweekly matching contribution amount required <ln numlevel="1" lineno="585" slineno="8-88"/>under Subsection <xref depth="4" refnumber="63A-17-805(2)">(2)</xref> may not exceed:</amend><subsection ssid="1-46" dnum="_-o:A-i" numlevel="1" lineno="586" slineno="8-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">for a Tier I qualifying employee, $26; or</amend></subsection><subsection ssid="1-47" dnum="_-o:B-i" numlevel="1" lineno="587" slineno="8-90" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1296" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">for a Tier II qualifying employee, the greater of 2% of the qualifying <ln numlevel="1" lineno="588" slineno="8-91"/>employee's biweekly salary or $26.</amend></subsection></subsection></subsection></subsection><subsection ssid="1-null-35" dnum="4-o" numlevel="1" lineno="589" slineno="8-92" level="1"><display>(4)</display>A qualifying employee is eligible to receive the biweekly contribution under this section <ln numlevel="1" lineno="590" slineno="8-93"/>for any pay period in which the employee is in a paid status or other status protected by <ln numlevel="1" lineno="591" slineno="8-94"/>federal or state law.</subsection><subsection ssid="1-null-36" dnum="5-o" numlevel="1" lineno="592" slineno="8-95" level="1"><display>(5)</display>The employer and employee contributions made and related earnings under this section <ln numlevel="1" lineno="593" slineno="8-96"/>vest immediately upon deposit and can be withdrawn by the employee at any time, <ln numlevel="1" lineno="594" slineno="8-97"/>subject to Internal Revenue Code regulations on the withdrawals.</subsection><subsection ssid="1-null-37" dnum="6-o" numlevel="1" lineno="595" slineno="8-98" level="1"><display>(6)</display>In accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, the <ln numlevel="1" lineno="596" slineno="8-99"/>director shall make rules establishing procedures to implement the provisions of this <ln numlevel="1" lineno="597" slineno="8-100"/>section.</subsection></section></bsec><bsec buid="52" num="67-19f-102" type="amend" src="code" uid="C67-19f-S102_2026050620260506" sort="67 19f01020020260506" numlevel="1" lineno="598" slineno="9-1" sn="9"><section number="67-19f-102" numlevel="1" lineno="599" slineno="9-2" type="amend"><secline lineno="598">Section 9. Section <bold>67-19f-102</bold> is amended to read:</secline><catline lineno="599"><bold>67-19f-102<parens/>. State Employees' Leave Trust Fund -- Creation -- Oversight -- <ln numlevel="1" lineno="610" slineno="10-3"/>Dissolution.</bold></catline><subsection ssid="47-null-1" dnum="1-o" numlevel="1" lineno="611" slineno="10-4" level="1" placement="noreturn"><display>(1)</display>There is created a trust fund entitled the "State Employees' <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">Annual </amend><amendoutend style="2"/>Leave Trust Fund."</subsection><subsection ssid="47-null-2" dnum="2-o" numlevel="1" lineno="612" slineno="10-5" level="1"><display>(2)</display>The trust fund consists of:<subsection ssid="47-null-3" dnum="a-o" numlevel="1" lineno="613" slineno="10-6" level="2"><display>(a)</display>ongoing revenue provided from a state agency set aside for accrued annual leave II <ln numlevel="1" lineno="614" slineno="10-7"/>required under Section <xref depth="3" refnumber="63A-17-510" start="0">63A-17-510</xref>;</subsection><subsection ssid="47-25" dnum="_-o:b-i" numlevel="1" lineno="615" slineno="10-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">money set aside for accrued paid time off in accordance with Section <xref depth="3" refnumber="63A-17-510.1">63A-17-510.1</xref>;</amend></subsection><subsection ssid="47-null-4" dnum="b-o:c-i" numlevel="1" lineno="616" slineno="10-9" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1309" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>appropriations made to the trust fund by the Legislature, if any;</subsection><subsection ssid="47-null-5" dnum="c-o:d-i" numlevel="1" lineno="617" slineno="10-10" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1310" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1311" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>transfers from the termination pool described in Subsection <xref depth="4" refnumber="63A-17-510(6)" start="0">63A-17-510(6)</xref> <ln numlevel="1" lineno="618" slineno="10-11"/>made by the Division of Finance to the trust fund for annual leave liabilities accrued <ln numlevel="1" lineno="619" slineno="10-12"/>before the change date established under Section <xref depth="3" refnumber="63A-17-510" start="0">63A-17-510</xref>;</subsection><subsection ssid="47-null-6" dnum="d-o:e-i" numlevel="1" lineno="620" slineno="10-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1311" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>income; and</subsection><subsection ssid="47-null-7" dnum="e-o:f-i" numlevel="1" lineno="621" slineno="10-14" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1312" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>revenue received from other sources.</subsection></subsection><subsection ssid="47-null-8" dnum="3-o" numlevel="1" lineno="622" slineno="10-15" level="1" space="false"><display>(3)</display><subsection ssid="47-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Division of Finance shall account for the receipt and expenditures of trust <ln numlevel="1" lineno="623" slineno="10-16"/>fund money.</subsection><subsection ssid="47-null-10" dnum="b-o" numlevel="1" lineno="624" slineno="10-17" level="2"><display>(b)</display>The Division of Finance shall make the necessary adjustments to the amount of set <ln numlevel="1" lineno="625" slineno="10-18"/>aside costs required under Subsection <xref depth="4" refnumber="63A-17-510(4)(a)" start="0">63A-17-510(4)(a)</xref> to provide that upon the trust <ln numlevel="1" lineno="626" slineno="10-19"/>fund's accrual of funding equal to 10% of the annual leave liability, year-end trust <ln numlevel="1" lineno="627" slineno="10-20"/>fund balances remain equal to at least 10% of the total state employee annual leave <ln numlevel="1" lineno="628" slineno="10-21"/>liability.</subsection></subsection><subsection ssid="47-null-11" dnum="4-o" numlevel="1" lineno="629" slineno="10-22" level="1" space="false"><display>(4)</display><subsection ssid="47-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state treasurer shall invest trust fund money by following the procedures and <ln numlevel="1" lineno="630" slineno="10-23"/>requirements of <xref depth="2" refnumber="67-19f-3" start="2">Part 3, Investment of Trust Funds</xref>.</subsection><subsection ssid="47-null-13" dnum="b-o" numlevel="1" lineno="631" slineno="10-24" level="2" space="false"><display>(b)</display><subsection ssid="47-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The trust fund shall earn interest.</subsection><subsection ssid="47-null-15" dnum="ii-o" numlevel="1" lineno="632" slineno="10-25" level="3"><display>(ii)</display>The state treasurer shall deposit all interest or other income earned from <ln numlevel="1" lineno="633" slineno="10-26"/>investment of the trust fund back into the trust fund.</subsection></subsection></subsection><subsection ssid="47-null-16" dnum="5-o" numlevel="1" lineno="634" slineno="10-27" level="1"><display>(5)</display>The board of trustees created in Section <xref depth="3" refnumber="67-19f-202" start="0">67-19f-202</xref> may expend money from the trust <ln numlevel="1" lineno="635" slineno="10-28"/>fund for:<subsection ssid="47-null-17" dnum="a-o" numlevel="1" lineno="636" slineno="10-29" level="2"><display>(a)</display>reimbursement to the employer of the costs paid to the trust fund in accordance with <ln numlevel="1" lineno="637" slineno="10-30"/>Section <xref depth="3" refnumber="63A-17-510" start="0">63A-17-510</xref><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both"> or <xref depth="3" refnumber="63A-17-510.1">63A-17-510.1</xref></amend> as annual leave II <amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both">or paid time off </amend>is used by an <ln numlevel="1" lineno="638" slineno="10-31"/>employee;</subsection><subsection ssid="47-null-18" dnum="b-o" numlevel="1" lineno="639" slineno="10-32" level="2"><display>(b)</display>payments based on accrued annual leave<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both"> and on</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> accrued annual leave II<amend anum="0" ea="amend" pairid="20" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">, and <ln numlevel="1" lineno="640" slineno="10-33"/>accrued paid time off</amend> that are made upon termination of an employee;</subsection><subsection ssid="47-null-19" dnum="c-o" numlevel="1" lineno="641" slineno="10-34" level="2"><display>(c)</display>refunds for overpayments; and</subsection><subsection ssid="47-null-20" dnum="d-o" numlevel="1" lineno="642" slineno="10-35" level="2"><display>(d)</display>reasonable administrative costs that the board of trustees incurs in performing its <ln numlevel="1" lineno="643" slineno="10-36"/>duties as trustee of the trust fund.</subsection></subsection><subsection ssid="47-null-21" dnum="6-o" numlevel="1" lineno="644" slineno="10-37" level="1"><display>(6)</display>The board of trustees shall ensure that:<subsection ssid="47-null-22" dnum="a-o" numlevel="1" lineno="645" slineno="10-38" level="2"><display>(a)</display>money deposited into the trust fund is irrevocable and is expended only for the costs <ln numlevel="1" lineno="646" slineno="10-39"/>described in Subsection <xref depth="4" refnumber="67-19f-201(5)" start="0">(5)</xref>; and</subsection><subsection ssid="47-null-23" dnum="b-o" numlevel="1" lineno="647" slineno="10-40" level="2"><display>(b)</display>assets of the trust fund are dedicated to providing annual leave<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> annual leave II<amend anum="0" ea="amend" pairid="22" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both">, <ln numlevel="1" lineno="648" slineno="10-41"/>and paid time off</amend> established by statute and rule.</subsection></subsection><subsection ssid="47-null-24" dnum="7-o" numlevel="1" lineno="649" slineno="10-42" level="1"><display>(7)</display>A creditor of the board of trustees or a state agency liable for annual leave benefits may <ln numlevel="1" lineno="650" slineno="10-43"/>not seize, attach, or otherwise obtain assets of the trust fund.</subsection></section></bsec><bsec buid="34" num="67-22-2" type="amend" src="code" uid="C67-22-S2_2026050620260506" sort="67 22 00020020260506" numlevel="1" lineno="651" slineno="11-1" sn="11"><section number="67-22-2" numlevel="1" lineno="652" slineno="11-2" type="amend"><secline lineno="651">Section 11. commission executive" means:<subsection ssid="34-null-27" dnum="i-o" numlevel="1" lineno="680" slineno="11-30" level="3"><display>(i)</display>members, Board of Pardons and Parole;</subsection><subsection ssid="34-null-28" dnum="ii-o" numlevel="1" lineno="681" slineno="11-31" level="3"><display>(ii)</display>chair, State Tax Commission;</subsection><subsection ssid="34-null-29" dnum="iii-o" numlevel="1" lineno="682" slineno="11-32" level="3"><display>(iii)</display>commissioners, State Tax Commission;</subsection><subsection ssid="34-null-30" dnum="iv-o" numlevel="1" lineno="683" slineno="11-33" level="3"><display>(iv)</display>executive director, State Tax Commission;</subsection><subsection ssid="34-null-31" dnum="v-o" numlevel="1" lineno="684" slineno="11-34" level="3"><display>(v)</display>chair, Public Service Commission; and</subsection><subsection ssid="34-null-32" dnum="vi-o" numlevel="1" lineno="685" slineno="11-35" level="3"><display>(vi)</display>commissioners, Public Service Commission.</subsection></subsection><subsection ssid="34-null-33" dnum="c-o" numlevel="1" lineno="686" slineno="11-36" level="2"><display>(c)</display>"Deputy" means the person who acts as the appointed executive's second in <ln numlevel="1" lineno="687" slineno="11-37"/>command as determined by the Division of Human Resource Management.</subsection></subsection><subsection ssid="34-null-34" dnum="2-o" numlevel="1" lineno="688" slineno="11-38" level="1" space="false"><display>(2)</display><subsection ssid="34-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The director of the Division of Human Resource Management shall:<subsection ssid="34-null-36" dnum="i-o" numlevel="1" lineno="689" slineno="11-39" level="3" tab="1"><display>(i)</display>before October 31 of each year, recommend to the governor a compensation plan <ln numlevel="1" lineno="690" slineno="11-40"/>for the appointed executives and the board or commission executives; and</subsection><subsection ssid="34-null-37" dnum="ii-o" numlevel="1" lineno="691" slineno="11-41" level="3" tab="1"><display>(ii)</display>base those recommendations on market salary studies conducted by the Division <ln numlevel="1" lineno="692" slineno="11-42"/>of Human Resource Management.</subsection></subsection><subsection ssid="34-null-38" dnum="b-o" numlevel="1" lineno="693" slineno="11-43" level="2" space="false"><display>(b)</display><subsection ssid="34-null-39" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The Division of Human Resource Management shall determine the salary range <ln numlevel="1" lineno="694" slineno="11-44"/>for the appointed executives by:<subsection ssid="34-null-40" dnum="A-o" numlevel="1" lineno="695" slineno="11-45" level="4" tab="1"><display>(A)</display>identifying the salary range assigned to the appointed executive's deputy;</subsection><subsection ssid="34-null-41" dnum="B-o" numlevel="1" lineno="696" slineno="11-46" level="4" tab="1"><display>(B)</display>designating the lowest minimum salary from those deputies' salary ranges as <ln numlevel="1" lineno="697" slineno="11-47"/>the minimum salary for the appointed executives' salary range; and</subsection><subsection ssid="34-null-42" dnum="C-o" numlevel="1" lineno="698" slineno="11-48" level="4" tab="1"><display>(C)</display>designating 105% of the highest maximum salary range from those deputies' <ln numlevel="1" lineno="699" slineno="11-49"/>salary ranges as the maximum salary for the appointed executives' salary range.</subsection></subsection><subsection ssid="34-null-43" dnum="ii-o" numlevel="1" lineno="700" slineno="11-50" level="3"><display>(ii)</display>If the deputy is a medical doctor, the Division of Human Resource Management <ln numlevel="1" lineno="701" slineno="11-51"/>may not consider that deputy's salary range in designating the salary range for <ln numlevel="1" lineno="702" slineno="11-52"/>appointed executives.</subsection></subsection><subsection ssid="34-null-44" dnum="c-o" numlevel="1" lineno="703" slineno="11-53" level="2" space="false"><display>(c)</display><subsection ssid="34-null-45" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="67-22-2(2)(c)(ii)">(2)(c)(ii)</xref>, in establishing the salary ranges for <ln numlevel="1" lineno="704" slineno="11-54"/>board or commission executives, the Division of Human Resource Management <ln numlevel="1" lineno="705" slineno="11-55"/>shall set the maximum salary in the salary range for each of those positions at <ln numlevel="1" lineno="706" slineno="11-56"/>90% of the salary for district judges as established in the annual appropriation act <ln numlevel="1" lineno="707" slineno="11-57"/>under Section <xref depth="3" refnumber="67-8-2">67-8-2</xref>.</subsection><subsection ssid="34-null-46" dnum="ii-o" numlevel="1" lineno="708" slineno="11-58" level="3"><display>(ii)</display>In establishing the salary ranges for an individual described in Subsection <xref depth="4" refnumber="67-22-2(1)(b)(ii)"><ln numlevel="1" lineno="709" slineno="11-59"/>(1)(b)(ii)</xref>, <xref refnumber="(1)(b)(iii)" depth="4">(1)(b)(iii)</xref>, or <xref refnumber="(1)(b)(iv)" depth="4">(1)(b)(iv)</xref>, the Division of Human Resource Management <ln numlevel="1" lineno="710" slineno="11-60"/>shall set the maximum salary in the salary range for each of those positions at <ln numlevel="1" lineno="711" slineno="11-61"/>100% of the salary for district judges as established in the annual appropriation act <ln numlevel="1" lineno="712" slineno="11-62"/>under Section <xref depth="3" refnumber="67-8-2">67-8-2</xref>.</subsection></subsection></subsection><subsection ssid="34-null-47" dnum="3-o" numlevel="1" lineno="713" slineno="11-63" level="1" space="false"><display>(3)</display><subsection ssid="34-null-48" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="34-null-49" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="67-22-2(3)(a)(ii)">(3)(a)(ii)</xref> or Subsection <xref depth="4" refnumber="67-22-2(3)(d)">(3)(d)</xref>, the <ln numlevel="1" lineno="714" slineno="11-64"/>governor shall establish a specific salary for each appointed executive within the <ln numlevel="1" lineno="715" slineno="11-65"/>range established under Subsection <xref depth="4" refnumber="67-22-2(2)(b)">(2)(b)</xref>.</subsection><subsection ssid="34-null-50" dnum="ii-o" numlevel="1" lineno="716" slineno="11-66" level="3" tab="1"><display>(ii)</display>If the executive director of the Department of Health and Human Services is a <ln numlevel="1" lineno="717" slineno="11-67"/>physician, the governor shall establish a salary within the highest physician salary <ln numlevel="1" lineno="718" slineno="11-68"/>range established by the Division of Human Resource Management.</subsection><subsection ssid="34-null-51" dnum="iii-o" numlevel="1" lineno="719" slineno="11-69" level="3" tab="1"><display>(iii)</display>The governor may provide salary increases for appointed executives within the <ln numlevel="1" lineno="720" slineno="11-70"/>range established by Subsection <xref depth="4" refnumber="67-22-2(2)(b)">(2)(b)</xref> and identified in Subsection <xref depth="4" refnumber="67-22-2(3)(a)(ii)">(3)(a)(ii)</xref>.</subsection></subsection><subsection ssid="34-null-52" dnum="b-o" numlevel="1" lineno="721" slineno="11-71" level="2"><display>(b)</display>The governor shall apply the same overtime regulations applicable to other FLSA <ln numlevel="1" lineno="722" slineno="11-72"/>exempt positions.</subsection><subsection ssid="34-null-53" dnum="c-o" numlevel="1" lineno="723" slineno="11-73" level="2"><display>(c)</display>The governor may develop standards and criteria for reviewing the appointed <ln numlevel="1" lineno="724" slineno="11-74"/>executives.</subsection><subsection ssid="34-null-54" dnum="d-o" numlevel="1" lineno="725" slineno="11-75" level="2"><display>(d)</display>If under Section <xref depth="3" refnumber="73-10g-702">73-10g-702</xref> the governor appoints an individual who is serving in an <ln numlevel="1" lineno="726" slineno="11-76"/>appointed executive branch position to be the Utah water agent, the governor shall <ln numlevel="1" lineno="727" slineno="11-77"/>adjust the salary of the Utah water agent to account for salary received for the <ln numlevel="1" lineno="728" slineno="11-78"/>appointed executive branch position.</subsection></subsection><subsection ssid="34-null-55" dnum="4-o" numlevel="1" lineno="729" slineno="11-79" level="1"><display>(4)</display>Salaries for other Schedule A employees, as defined in Section <xref depth="3" refnumber="63A-17-301">63A-17-301</xref>, that are not <ln numlevel="1" lineno="730" slineno="11-80"/>provided for in this chapter, or in Title <xref depth="1" refnumber="67-8">67, Chapter 8</xref>, Utah Elected Official and Judicial <ln numlevel="1" lineno="731" slineno="11-81"/>Salary Act, shall be established as provided in Section <xref depth="3" refnumber="63A-17-301">63A-17-301</xref>.</subsection><subsection ssid="34-null-56" dnum="5-o" numlevel="1" lineno="732" slineno="11-82" level="1" space="false"><display>(5)</display><subsection ssid="34-null-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Legislature fixes benefits for the appointed executives and the board or <ln numlevel="1" lineno="733" slineno="11-83"/>commission executives as follows:<subsection ssid="34-null-58" dnum="i-o" numlevel="1" lineno="734" slineno="11-84" level="3" tab="1"><display>(i)</display>the option of participating in a state retirement system established by Title <xref depth="0" refnumber="49">49, <ln numlevel="1" lineno="735" slineno="11-85"/>Utah State Retirement and Insurance Benefit Act</xref>, or in a deferred compensation <ln numlevel="1" lineno="736" slineno="11-86"/>plan administered by the State Retirement Office in accordance with the Internal <ln numlevel="1" lineno="737" slineno="11-87"/>Revenue Code and its accompanying rules and regulations;</subsection><subsection ssid="34-null-59" dnum="ii-o" numlevel="1" lineno="738" slineno="11-88" level="3" tab="1"><display>(ii)</display>health insurance;</subsection><subsection ssid="34-null-60" dnum="iii-o" numlevel="1" lineno="739" slineno="11-89" level="3" tab="1"><display>(iii)</display>dental insurance;</subsection><subsection ssid="34-null-61" dnum="iv-o" numlevel="1" lineno="740" slineno="11-90" level="3" tab="1"><display>(iv)</display>basic life insurance;</subsection><subsection ssid="34-null-62" dnum="v-o" numlevel="1" lineno="741" slineno="11-91" level="3" tab="1"><display>(v)</display>unemployment compensation;</subsection><subsection ssid="34-null-63" dnum="vi-o" numlevel="1" lineno="742" slineno="11-92" level="3" tab="1"><display>(vi)</display>workers' compensation;</subsection><subsection ssid="34-null-64" dnum="vii-o" numlevel="1" lineno="743" slineno="11-93" level="3" tab="1"><display>(vii)</display>required employer contribution to Social Security;</subsection><subsection ssid="34-null-65" dnum="viii-o" numlevel="1" lineno="744" slineno="11-94" level="3" tab="1"><display>(viii)</display>long-term disability income insurance;</subsection><subsection ssid="34-null-66" dnum="ix-o" numlevel="1" lineno="745" slineno="11-95" level="3" tab="1"><display>(ix)</display>the same additional state-paid life insurance available to other noncareer service <ln numlevel="1" lineno="746" slineno="11-96"/>employees;</subsection><subsection ssid="34-null-67" dnum="x-o" numlevel="1" lineno="747" slineno="11-97" level="3" tab="1"><display>(x)</display>the same severance pay available to other noncareer service employees;</subsection><subsection ssid="34-null-68" dnum="xi-o" numlevel="1" lineno="748" slineno="11-98" level="3" tab="1"><display>(xi)</display>the same leave, holidays, and allowances granted to Schedule B state employees <ln numlevel="1" lineno="749" slineno="11-99"/>as follows:<subsection ssid="34-null-69" dnum="A-o" numlevel="1" lineno="750" slineno="11-100" level="4"><display>(A)</display>sick leave;</subsection><subsection ssid="34-null-70" dnum="B-o" numlevel="1" lineno="751" slineno="11-101" level="4"><display>(B)</display>converted sick leave if accrued prior to January 1, 2014;</subsection><subsection ssid="34-null-71" dnum="C-o" numlevel="1" lineno="752" slineno="11-102" level="4"><display>(C)</display>educational allowances;</subsection><subsection ssid="34-null-72" dnum="D-o" numlevel="1" lineno="753" slineno="11-103" level="4"><display>(D)</display>holidays;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="34-null-73" dnum="E-o" numlevel="1" lineno="754" slineno="11-104" level="4"><display>(E)</display>annual leave except that annual leave shall be accrued at the maximum rate <ln numlevel="1" lineno="755" slineno="11-105"/>provided to Schedule B state employees;<amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="34-90" dnum="_-o:F-i" numlevel="1" lineno="756" slineno="11-106" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1403" style="1" owner="i" level="1" amendtag="start">(F)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">paid time off;</amend></subsection></subsection><subsection ssid="34-null-74" dnum="xii-o" numlevel="1" lineno="757" slineno="11-107" level="3" tab="1"><display>(xii)</display>the option to convert accumulated sick leave to cash or insurance benefits as <ln numlevel="1" lineno="758" slineno="11-108"/>provided by law or rule upon resignation or retirement according to the same <ln numlevel="1" lineno="759" slineno="11-109"/>criteria and procedures applied to Schedule B state employees;</subsection><subsection ssid="34-null-75" dnum="xiii-o" numlevel="1" lineno="760" slineno="11-110" level="3" tab="1"><display>(xiii)</display>the option to purchase additional life insurance at group insurance rates <ln numlevel="1" lineno="761" slineno="11-111"/>according to the same criteria and procedures applied to Schedule B state <ln numlevel="1" lineno="762" slineno="11-112"/>employees; and</subsection><subsection ssid="34-null-76" dnum="xiv-o" numlevel="1" lineno="763" slineno="11-113" level="3" tab="1"><display>(xiv)</display>professional memberships if being a member of the professional organization is <ln numlevel="1" lineno="764" slineno="11-114"/>a requirement of the position.</subsection></subsection><subsection ssid="34-null-77" dnum="b-o" numlevel="1" lineno="765" slineno="11-115" level="2"><display>(b)</display>Each department shall pay the cost of additional state-paid life insurance for its <ln numlevel="1" lineno="766" slineno="11-116"/>executive director from its existing budget.</subsection></subsection><subsection ssid="34-null-78" dnum="6-o" numlevel="1" lineno="767" slineno="11-117" level="1"><display>(6)</display>The Legislature fixes the following additional benefits:<subsection ssid="34-null-79" dnum="a-o" numlevel="1" lineno="768" slineno="11-118" level="2"><display>(a)</display>for the executive director of the Department of Transportation a vehicle for official <ln numlevel="1" lineno="769" slineno="11-119"/>and personal use;</subsection><subsection ssid="34-null-80" dnum="b-o" numlevel="1" lineno="770" slineno="11-120" level="2"><display>(b)</display>for the executive director of the Department of Natural Resources a vehicle for <ln numlevel="1" lineno="771" slineno="11-121"/>commute and official use;</subsection><subsection ssid="34-null-81" dnum="c-o" numlevel="1" lineno="772" slineno="11-122" level="2"><display>(c)</display>for the commissioner of Public Safety:<subsection ssid="34-null-82" dnum="i-o" numlevel="1" lineno="773" slineno="11-123" level="3"><display>(i)</display>an accidental death insurance policy if POST certified; and</subsection><subsection ssid="34-null-83" dnum="ii-o" numlevel="1" lineno="774" slineno="11-124" level="3"><display>(ii)</display>a public safety vehicle for official and personal use;</subsection></subsection><subsection ssid="34-null-84" dnum="d-o" numlevel="1" lineno="775" slineno="11-125" level="2"><display>(d)</display>for the executive director of the Department of Corrections:<subsection ssid="34-null-85" dnum="i-o" numlevel="1" lineno="776" slineno="11-126" level="3"><display>(i)</display>an accidental death insurance policy if POST certified; and</subsection><subsection ssid="34-null-86" dnum="ii-o" numlevel="1" lineno="777" slineno="11-127" level="3"><display>(ii)</display>a public safety vehicle for official and personal use;</subsection></subsection><subsection ssid="34-null-87" dnum="e-o" numlevel="1" lineno="778" slineno="11-128" level="2"><display>(e)</display>for the adjutant general a vehicle for official and personal use; </subsection><subsection ssid="34-null-88" dnum="f-o" numlevel="1" lineno="779" slineno="11-129" level="2"><display>(f)</display>for each member of the Board of Pardons and Parole a vehicle for commute and <ln numlevel="1" lineno="780" slineno="11-130"/>official use; and</subsection><subsection ssid="34-null-89" dnum="g-o" numlevel="1" lineno="781" slineno="11-131" level="2"><display>(g)</display>for the executive director of the Department of Veterans and Military Affairs a <ln numlevel="1" lineno="782" slineno="11-132"/>vehicle for commute and official
