Section <bold>78B-6-501</bold> is amended to read:</secline><catline lineno="25"><bold>78B-6-501<parens/>. Eminent domain -- Uses for which right may be exercised -- <ln numlevel="1" lineno="26" slineno="1-3"/>Limitations on eminent domain.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="28" slineno="1-5" level="2"><display>(a)</display>"Century farm" means real property that is:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="29" slineno="1-6" level="3"><display>(i)</display>assessed under Title 59, Chapter 2, Part 5, Farmland Assessment Act; and</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="30" slineno="1-7" level="3"><display>(ii)</display>owned or held by the same family for a continuous period of 100 years or more.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="31" slineno="1-8" level="2"><display>(b)</display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both">"Energy generation" means the production of electricity from any source, including <ln numlevel="1" lineno="32" slineno="1-9"/>solar, wind, gas, geothermal, hydroelectric, or thermal.</amend></subsection><subsection ssid="1-100" dnum="_-o:c-i" numlevel="1" lineno="33" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="1-101" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">"Energy generation facility" means a building, structure, equipment, or system <ln numlevel="1" lineno="34" slineno="1-11"/>necessary for energy generation.</amend></subsection><subsection ssid="1-102" dnum="_-o:ii-i" numlevel="1" lineno="35" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">"Energy generation facility" includes a substation, an inverter, a transformer, a <ln numlevel="1" lineno="36" slineno="1-13"/>battery energy storage system, a collector system, or an interconnection facility.</amend></subsection></subsection><subsection ssid="1-85" dnum="_-o:d-i" numlevel="1" lineno="37" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both">(d)</amend></display>"Mineral or element" means the same as that term is defined in Section <xref depth="3" refnumber="65A-17-101">65A-17-101</xref>.</subsection><subsection ssid="1-null-6" dnum="c-o:e-i" numlevel="1" lineno="38" slineno="1-15" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display><subsection ssid="1-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Mining use" means:<subsection ssid="1-null-8" dnum="A-o" numlevel="1" lineno="39" slineno="1-16" level="4" tab="1"><display>(A)</display>the full range of permitted or active activities, from prospecting and <ln numlevel="1" lineno="40" slineno="1-17"/>exploration to reclamation and closure, associated with the exploitation of a <ln numlevel="1" lineno="41" slineno="1-18"/>mineral deposit; and</subsection><subsection ssid="1-null-9" dnum="B-o" numlevel="1" lineno="42" slineno="1-19" level="4" tab="1"><display>(B)</display>the use of the surface, subsurface, groundwater, and surface water of an area <ln numlevel="1" lineno="43" slineno="1-20"/>in connection with the activities described in Subsection<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="130" groupid="86" style="2" owner="jchristopherson" level="1" deltag="both"> <xref depth="4" refnumber="78B-6-501(1)(c)(i)(a)">(1)(c)(i)(A)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="129" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="44" slineno="1-21"/>(1)(e)(i)(A)</amend> that have been, are being, or will be conducted.</subsection></subsection><subsection ssid="1-null-10" dnum="ii-o" numlevel="1" lineno="45" slineno="1-22" level="3"><display>(ii)</display>"Mining use" includes, whether conducted on-site or off-site:<subsection ssid="1-null-11" dnum="A-o" numlevel="1" lineno="46" slineno="1-23" level="4"><display>(A)</display>sampling, staking, surveying, exploration, or development activity;</subsection><subsection ssid="1-null-12" dnum="B-o" numlevel="1" lineno="47" slineno="1-24" level="4"><display>(B)</display>drilling, blasting, excavating, or tunneling;</subsection><subsection ssid="1-null-13" dnum="C-o" numlevel="1" lineno="48" slineno="1-25" level="4"><display>(C)</display>the removal, transport, treatment, deposition, and reclamation of overburden, <ln numlevel="1" lineno="49" slineno="1-26"/>development rock, tailings, and other waste material;</subsection><subsection ssid="1-null-14" dnum="D-o" numlevel="1" lineno="50" slineno="1-27" level="4"><display>(D)</display>the recovery of sand and gravel;</subsection><subsection ssid="1-null-15" dnum="E-o" numlevel="1" lineno="51" slineno="1-28" level="4"><display>(E)</display>removal, transportation, extraction, beneficiation, or processing of ore;</subsection><subsection ssid="1-null-16" dnum="F-o" numlevel="1" lineno="52" slineno="1-29" level="4"><display>(F)</display>use of solar evaporation ponds and other facilities for the recovery of minerals <ln numlevel="1" lineno="53" slineno="1-30"/>in solution;</subsection><subsection ssid="1-null-17" dnum="G-o" numlevel="1" lineno="54" slineno="1-31" level="4"><display>(G)</display>smelting, refining, autoclaving, or other primary or secondary processing <ln numlevel="1" lineno="55" slineno="1-32"/>operation;</subsection><subsection ssid="1-null-18" dnum="H-o" numlevel="1" lineno="56" slineno="1-33" level="4"><display>(H)</display>the recovery of any mineral left in residue from a previous extraction or <ln numlevel="1" lineno="57" slineno="1-34"/>processing operation;</subsection><subsection ssid="1-null-19" dnum="I-o" numlevel="1" lineno="58" slineno="1-35" level="4"><display>(I)</display>a mining activity that is identified in a work plan or permitting document;</subsection><subsection ssid="1-null-20" dnum="J-o" numlevel="1" lineno="59" slineno="1-36" level="4"><display>(J)</display>the use, operation, maintenance, repair, replacement, construction, or alteration <ln numlevel="1" lineno="60" slineno="1-37"/>of a building, structure, facility, equipment, machine, tool, or other material or <ln numlevel="1" lineno="61" slineno="1-38"/>property that results from or is used in a surface or subsurface mining operation <ln numlevel="1" lineno="62" slineno="1-39"/>or activity;</subsection><subsection ssid="1-null-21" dnum="K-o" numlevel="1" lineno="63" slineno="1-40" level="4"><display>(K)</display>an accessory, incidental, or ancillary activity or use, both active and passive, <ln numlevel="1" lineno="64" slineno="1-41"/>including a utility, private way or road, pipeline, land excavation, working, <ln numlevel="1" lineno="65" slineno="1-42"/>embankment, pond, gravel excavation, mining waste, conveyor, power line, <ln numlevel="1" lineno="66" slineno="1-43"/>trackage, storage, reserve, passive use area, buffer zone, and power production <ln numlevel="1" lineno="67" slineno="1-44"/>facility;</subsection><subsection ssid="1-null-22" dnum="L-o" numlevel="1" lineno="68" slineno="1-45" level="4"><display>(L)</display>the construction of a storage, factory, processing, or maintenance facility; and</subsection><subsection ssid="1-null-23" dnum="M-o" numlevel="1" lineno="69" slineno="1-46" level="4"><display>(M)</display>an activity described in Subsection <xref tempid="203" depth="4" refnumber="40-8-4(19)(a)">40-8-4(19)(a)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-24" dnum="2-o:f-i" numlevel="1" lineno="70" slineno="1-47" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start" space="true">(f)</amend></display><subsection ssid="1-88" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">"Pipeline" means a pipeline, conduit, or related right-of-way or easement <ln numlevel="1" lineno="71" slineno="1-48"/>used to transport natural gas, petroleum, a petroleum product, hydrogen, carbon <ln numlevel="1" lineno="72" slineno="1-49"/>dioxide, or other gaseous or liquid substance.</amend></subsection><subsection ssid="1-89" dnum="_-o:ii-i" numlevel="1" lineno="73" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">"Pipeline" includes a facility that is reasonably necessary to the operation of the <ln numlevel="1" lineno="74" slineno="1-51"/>pipeline.</amend></subsection></subsection></subsection><subsection ssid="1-86" dnum="_-o:2-i" numlevel="1" lineno="75" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both">(2)</amend></display>Except as provided in Subsections <xref depth="4" refnumber="78B-6-501(3)">(3)</xref>, (4), <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">and </amend><amendoutend style="2"/>(5)<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">, and (7)</amend> and subject to the <ln numlevel="1" lineno="76" slineno="1-53"/>provisions of this part, the right of eminent domain may be exercised on behalf of the <ln numlevel="1" lineno="77" slineno="1-54"/>following public uses:<subsection ssid="1-null-25" dnum="a-o" numlevel="1" lineno="78" slineno="1-55" level="2"><display>(a)</display>all public uses authorized by the federal government;</subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="79" slineno="1-56" level="2"><display>(b)</display>public buildings and grounds for the use of the state, and all other public uses <ln numlevel="1" lineno="80" slineno="1-57"/>authorized by the Legislature;</subsection><subsection ssid="1-null-27" dnum="c-o" numlevel="1" lineno="81" slineno="1-58" level="2" space="false"><display>(c)</display><subsection ssid="1-null-28" dnum="i-o" level="3" placement="sameline"><display>(i)</display>public buildings and grounds for the use of any county, city, town, or board of <ln numlevel="1" lineno="82" slineno="1-59"/>education;</subsection><subsection ssid="1-null-29" dnum="ii-o" numlevel="1" lineno="83" slineno="1-60" level="3"><display>(ii)</display>reservoirs, canals, aqueducts, flumes, ditches, or pipes for conducting water or <ln numlevel="1" lineno="84" slineno="1-61"/>sewage, including to or from a development, for the use of the inhabitants of any <ln numlevel="1" lineno="85" slineno="1-62"/>county, city, or town, or for the draining of any county, city, or town;</subsection><subsection ssid="1-null-30" dnum="iii-o" numlevel="1" lineno="86" slineno="1-63" level="3"><display>(iii)</display>the raising of the banks of streams, removing obstructions from streams, and <ln numlevel="1" lineno="87" slineno="1-64"/>widening, deepening, or straightening their channels;</subsection><subsection ssid="1-null-31" dnum="iv-o" numlevel="1" lineno="88" slineno="1-65" level="3"><display>(iv)</display>bicycle paths and sidewalks adjacent to paved roads;</subsection><subsection ssid="1-null-32" dnum="v-o" numlevel="1" lineno="89" slineno="1-66" level="3"><display>(v)</display>roads, byroads, streets, and alleys for public vehicular use, including for access to <ln numlevel="1" lineno="90" slineno="1-67"/>a development; and</subsection><subsection ssid="1-null-33" dnum="vi-o" numlevel="1" lineno="91" slineno="1-68" level="3"><display>(vi)</display>all other public uses for the benefit of any county, city, or town, or its inhabitants;</subsection></subsection><subsection ssid="1-null-34" dnum="d-o" numlevel="1" lineno="92" slineno="1-69" level="2"><display>(d)</display>wharves, docks, piers, chutes, booms, ferries, bridges, toll roads, byroads, plank and <ln numlevel="1" lineno="93" slineno="1-70"/>turnpike roads, roads for transportation by traction engines or road locomotives, <ln numlevel="1" lineno="94" slineno="1-71"/>roads for logging or lumbering purposes, and railroads and street railways for public <ln numlevel="1" lineno="95" slineno="1-72"/>transportation;</subsection><subsection ssid="1-null-35" dnum="e-o" numlevel="1" lineno="96" slineno="1-73" level="2"><display>(e)</display>reservoirs, dams, watergates, canals, ditches, flumes, tunnels, aqueducts and pipes for <ln numlevel="1" lineno="97" slineno="1-74"/>the supplying of persons, mines, mills, smelters or other works for the reduction of <ln numlevel="1" lineno="98" slineno="1-75"/>ores, with water for domestic or other uses, or for irrigation purposes, or for the <ln numlevel="1" lineno="99" slineno="1-76"/>draining and reclaiming of lands, or for solar evaporation ponds and other facilities <ln numlevel="1" lineno="100" slineno="1-77"/>for the recovery of minerals or elements in solution;</subsection><subsection ssid="1-null-36" dnum="f-o" numlevel="1" lineno="101" slineno="1-78" level="2" space="false"><display>(f)</display><subsection ssid="1-null-37" dnum="i-o" level="3" placement="sameline"><display>(i)</display>roads, railroads, tramways, tunnels, ditches, flumes, pipes, and dumping places <ln numlevel="1" lineno="102" slineno="1-79"/>to access or facilitate the milling, smelting, or other reduction of ores, or the <ln numlevel="1" lineno="103" slineno="1-80"/>working of mines, quarries, coal mines, or mineral deposits including oil, gas, and <ln numlevel="1" lineno="104" slineno="1-81"/>minerals or elements in solution;</subsection><subsection ssid="1-null-38" dnum="ii-o" numlevel="1" lineno="105" slineno="1-82" level="3"><display>(ii)</display>outlets, natural or otherwise, for the deposit or conduct of tailings, refuse or water <ln numlevel="1" lineno="106" slineno="1-83"/>from mills, smelters or other works for the reduction of ores, or from mines, <ln numlevel="1" lineno="107" slineno="1-84"/>quarries, coal mines or mineral deposits including minerals or elements in solution;</subsection><subsection ssid="1-null-39" dnum="iii-o" numlevel="1" lineno="108" slineno="1-85" level="3"><display>(iii)</display>mill dams;</subsection><subsection ssid="1-null-40" dnum="iv-o" numlevel="1" lineno="109" slineno="1-86" level="3"><display>(iv)</display>gas, oil or coal pipelines, tanks or reservoirs, including any subsurface stratum or <ln numlevel="1" lineno="110" slineno="1-87"/>formation in any land for the underground storage of natural gas, and in <ln numlevel="1" lineno="111" slineno="1-88"/>connection with that, any other interests in property which may be required to <ln numlevel="1" lineno="112" slineno="1-89"/>adequately examine, prepare, maintain, and operate underground natural gas <ln numlevel="1" lineno="113" slineno="1-90"/>storage facilities;</subsection><subsection ssid="1-null-41" dnum="v-o" numlevel="1" lineno="114" slineno="1-91" level="3"><display>(v)</display>subject to Subsection <xref tempid="318" depth="4" refnumber="78B-6-501(6)">(6)</xref>, solar evaporation ponds and other facilities for the <ln numlevel="1" lineno="115" slineno="1-92"/>recovery of minerals in solution; and</subsection><subsection ssid="1-null-42" dnum="vi-o" numlevel="1" lineno="116" slineno="1-93" level="3"><display>(vi)</display>any occupancy in common by the owners or possessors of different mines, <ln numlevel="1" lineno="117" slineno="1-94"/>quarries, coal mines, mineral deposits, mills, smelters, or other places for the <ln numlevel="1" lineno="118" slineno="1-95"/>reduction of ores, or any place for the flow, deposit or conduct of tailings or refuse <ln numlevel="1" lineno="119" slineno="1-96"/>matter;</subsection></subsection><subsection ssid="1-null-43" dnum="g-o" numlevel="1" lineno="120" slineno="1-97" level="2"><display>(g)</display>byroads leading from a highway to:<subsection ssid="1-null-44" dnum="i-o" numlevel="1" lineno="121" slineno="1-98" level="3"><display>(i)</display>a residence; or</subsection><subsection ssid="1-null-45" dnum="ii-o" numlevel="1" lineno="122" slineno="1-99" level="3"><display>(ii)</display>a farm;</subsection></subsection><subsection ssid="1-null-46" dnum="h-o" numlevel="1" lineno="123" slineno="1-100" level="2"><display>(h)</display>telecommunications, electric light and electric power lines, sites for electric light and <ln numlevel="1" lineno="124" slineno="1-101"/>power plants, or sites for the transmission of broadcast signals from a station licensed <ln numlevel="1" lineno="125" slineno="1-102"/>by the Federal Communications Commission in accordance with 47 C.F.R. Part 73 <ln numlevel="1" lineno="126" slineno="1-103"/>and that provides emergency broadcast services;</subsection><subsection ssid="1-null-47" dnum="i-o" numlevel="1" lineno="127" slineno="1-104" level="2"><display>(i)</display>sewage service for:<subsection ssid="1-null-48" dnum="i-o" numlevel="1" lineno="128" slineno="1-105" level="3"><display>(i)</display>a city, a town, or any settlement of not fewer than 10 families;</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="129" slineno="1-106" level="3"><display>(ii)</display>a public building belonging to the state; or</subsection><subsection ssid="1-null-50" dnum="iii-o" numlevel="1" lineno="130" slineno="1-107" level="3"><display>(iii)</display>a college or university;</subsection></subsection><subsection ssid="1-null-51" dnum="j-o" numlevel="1" lineno="131" slineno="1-108" level="2"><display>(j)</display>canals, reservoirs, dams, ditches, flumes, aqueducts, and pipes for supplying and <ln numlevel="1" lineno="132" slineno="1-109"/>storing water for the operation of machinery for the purpose of generating and <ln numlevel="1" lineno="133" slineno="1-110"/>transmitting electricity for power, light or heat;</subsection><subsection ssid="1-null-52" dnum="k-o" numlevel="1" lineno="134" slineno="1-111" level="2"><display>(k)</display>cemeteries and public parks; and</subsection><subsection ssid="1-null-53" dnum="l-o" numlevel="1" lineno="135" slineno="1-112" level="2"><display>(l)</display>sites for mills, smelters or other works for the reduction of ores and necessary to their <ln numlevel="1" lineno="136" slineno="1-113"/>successful operation, including the right to take lands for the discharge and natural <ln numlevel="1" lineno="137" slineno="1-114"/>distribution of smoke, fumes, and dust, produced by the operation of works, provided <ln numlevel="1" lineno="138" slineno="1-115"/>that the powers granted by this section may not be exercised in any county where the <ln numlevel="1" lineno="139" slineno="1-116"/>population exceeds 20,000, or within one mile of the limits of any city or <ln numlevel="1" lineno="140" slineno="1-117"/>incorporated town nor unless the proposed condemner has the right to operate by <ln numlevel="1" lineno="141" slineno="1-118"/>purchase, option to purchase or easement, at least 75% in value of land acreage <ln numlevel="1" lineno="142" slineno="1-119"/>owned by persons or corporations situated within a radius of four miles from the mill, <ln numlevel="1" lineno="143" slineno="1-120"/>smelter or other works for the reduction of ores; nor beyond the limits of the <ln numlevel="1" lineno="144" slineno="1-121"/>four-mile radius; nor as to lands covered by contracts, easements, or agreements <ln numlevel="1" lineno="145" slineno="1-122"/>existing between the condemner and the owner of land within the limit and providing <ln numlevel="1" lineno="146" slineno="1-123"/>for the operation of such mill, smelter, or other works for the reduction of ores; nor <ln numlevel="1" lineno="147" slineno="1-124"/>until an action shall have been commenced to restrain the operation of such mill, <ln numlevel="1" lineno="148" slineno="1-125"/>smelter, or other works for the reduction of ores.</subsection></subsection><subsection ssid="1-null-54" dnum="3-o" numlevel="1" lineno="149" slineno="1-126" level="1"><display>(3)</display>The right of eminent domain may not be exercised on behalf of the following uses:<subsection ssid="1-null-55" dnum="a-o" numlevel="1" lineno="150" slineno="1-127" level="2"><display>(a)</display>except as provided in Subsection <xref depth="4" refnumber="78B-6-501(2)(c)(iv)">(2)(c)(iv)</xref>, trails, paths, or other ways for walking, <ln numlevel="1" lineno="151" slineno="1-128"/>hiking, bicycling, equestrian use, or other recreational uses, or whose primary <ln numlevel="1" lineno="152" slineno="1-129"/>purpose is as a foot path, equestrian trail, bicycle path, or walkway;</subsection><subsection ssid="1-null-56" dnum="b-o" numlevel="1" lineno="153" slineno="1-130" level="2" space="false"><display>(b)</display><subsection ssid="1-null-57" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a public park whose primary purpose is:<subsection ssid="1-null-58" dnum="A-o" numlevel="1" lineno="154" slineno="1-131" level="4" tab="1"><display>(A)</display>as a trail, path, or other way for walking, hiking, bicycling, or equestrian use; <ln numlevel="1" lineno="155" slineno="1-132"/>or</subsection><subsection ssid="1-null-59" dnum="B-o" numlevel="1" lineno="156" slineno="1-133" level="4" tab="1"><display>(B)</display>to connect other trails, paths, or other ways for walking, hiking, bicycling, or <ln numlevel="1" lineno="157" slineno="1-134"/>equestrian use; or</subsection></subsection><subsection ssid="1-null-60" dnum="ii-o" numlevel="1" lineno="158" slineno="1-135" level="3"><display>(ii)</display>a public park established on real property that is:<subsection ssid="1-null-61" dnum="A-o" numlevel="1" lineno="159" slineno="1-136" level="4"><display>(A)</display>a century farm; and</subsection><subsection ssid="1-null-62" dnum="B-o" numlevel="1" lineno="160" slineno="1-137" level="4"><display>(B)</display>located in a county of the first class.</subsection></subsection></subsection></subsection><subsection ssid="1-null-63" dnum="4-o" numlevel="1" lineno="161" slineno="1-138" level="1" space="false"><display>(4)</display><subsection ssid="1-null-64" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The right of eminent domain may not be exercised within a migratory bird <ln numlevel="1" lineno="162" slineno="1-139"/>production area created on or before December 31, 2020, under Title 23A, Chapter <ln numlevel="1" lineno="163" slineno="1-140"/>13, Migratory Bird Production Area, except as follows:<subsection ssid="1-null-65" dnum="i-o" numlevel="1" lineno="164" slineno="1-141" level="3" tab="1"><display>(i)</display>subject to Subsection <xref depth="4" refnumber="78B-6-501(4)(b)">(4)(b)</xref>, an electric utility may condemn land within a <ln numlevel="1" lineno="165" slineno="1-142"/>migratory bird production area located in a county of the first class only for the <ln numlevel="1" lineno="166" slineno="1-143"/>purpose of installing buried power lines;</subsection><subsection ssid="1-null-66" dnum="ii-o" numlevel="1" lineno="167" slineno="1-144" level="3" tab="1"><display>(ii)</display>an electric utility may condemn land within a migratory bird production area in a <ln numlevel="1" lineno="168" slineno="1-145"/>county other than a county of the first class to install:<subsection ssid="1-null-67" dnum="A-o" numlevel="1" lineno="169" slineno="1-146" level="4"><display>(A)</display>buried power lines; or</subsection><subsection ssid="1-null-68" dnum="B-o" numlevel="1" lineno="170" slineno="1-147" level="4"><display>(B)</display>a new overhead transmission line that is parallel to and abutting an existing <ln numlevel="1" lineno="171" slineno="1-148"/>overhead transmission line or collocated within an existing overhead <ln numlevel="1" lineno="172" slineno="1-149"/>transmission line right of way; or</subsection></subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="173" slineno="1-150" level="3" tab="1"><display>(iii)</display>the Department of Transportation may exercise eminent domain for the purpose <ln numlevel="1" lineno="174" slineno="1-151"/>of the construction of the West Davis Highway.</subsection></subsection><subsection ssid="1-null-70" dnum="b-o" numlevel="1" lineno="175" slineno="1-152" level="2"><display>(b)</display>Before exercising the right of eminent domain under Subsection <xref depth="4" refnumber="78B-6-501(4)(a)(i)">(4)(a)(i)</xref>, the electric <ln numlevel="1" lineno="176" slineno="1-153"/>utility shall demonstrate that:<subsection ssid="1-null-71" dnum="i-o" numlevel="1" lineno="177" slineno="1-154" level="3"><display>(i)</display>the proposed condemnation would not have an unreasonable adverse effect on the <ln numlevel="1" lineno="178" slineno="1-155"/>preservation, use, and enhancement of the migratory bird production area; and</subsection><subsection ssid="1-null-72" dnum="ii-o" numlevel="1" lineno="179" slineno="1-156" level="3"><display>(ii)</display>there is no reasonable alternative to constructing the power line within the <ln numlevel="1" lineno="180" slineno="1-157"/>boundaries of a migratory bird production area.</subsection></subsection></subsection><subsection ssid="1-null-73" dnum="5-o" numlevel="1" lineno="181" slineno="1-158" level="1"><display>(5)</display>If the intended public purpose is for a mining use, a private person may not exercise the <ln numlevel="1" lineno="182" slineno="1-159"/>power of eminent domain over property, or an interest in property, that is already used <ln numlevel="1" lineno="183" slineno="1-160"/>for a mining use within the boundary of:<subsection ssid="1-null-74" dnum="a-o" numlevel="1" lineno="184" slineno="1-161" level="2"><display>(a)</display>a permit area, as defined in Section <xref depth="3" refnumber="40-8-4">40-8-4</xref>;</subsection><subsection ssid="1-null-75" dnum="b-o" numlevel="1" lineno="185" slineno="1-162" level="2"><display>(b)</display>an area for which a permit has been issued by the Division of Water Quality, as part <ln numlevel="1" lineno="186" slineno="1-163"/>of the underground injection control program, under rules made by the Water Quality <ln numlevel="1" lineno="187" slineno="1-164"/>Board in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act;</subsection><subsection ssid="1-null-76" dnum="c-o" numlevel="1" lineno="188" slineno="1-165" level="2"><display>(c)</display>private property; or</subsection><subsection ssid="1-null-77" dnum="d-o" numlevel="1" lineno="189" slineno="1-166" level="2"><display>(d)</display>an area under a state or federal lease.</subsection></subsection><subsection ssid="1-null-78" dnum="6-o" numlevel="1" lineno="190" slineno="1-167" level="1" space="false"><display>(6)</display><subsection ssid="1-null-79" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For the purpose of solar evaporation ponds and other facilities for the recovery of <ln numlevel="1" lineno="191" slineno="1-168"/>minerals or elements in solution on or from the Great Salt Lake, a public use includes <ln numlevel="1" lineno="192" slineno="1-169"/>removal or extinguishment, by a state entity, in whole or in part, on Great Salt Lake <ln numlevel="1" lineno="193" slineno="1-170"/>Sovereign lands of:<subsection ssid="1-null-80" dnum="i-o" numlevel="1" lineno="194" slineno="1-171" level="3" tab="1"><display>(i)</display>a solar evaporation pond;</subsection><subsection ssid="1-null-81" dnum="ii-o" numlevel="1" lineno="195" slineno="1-172" level="3" tab="1"><display>(ii)</display>improvements, property, easements, or rights-of-way appurtenant to a solar <ln numlevel="1" lineno="196" slineno="1-173"/>evaporation pond, including a lease hold; or</subsection><subsection ssid="1-null-82" dnum="iii-o" numlevel="1" lineno="197" slineno="1-174" level="3" tab="1"><display>(iii)</display>other facilities for the recovery of minerals or elements in solution.</subsection></subsection><subsection ssid="1-null-83" dnum="b-o" numlevel="1" lineno="198" slineno="1-175" level="2"><display>(b)</display>The public use under this Subsection <xref refnumber="78B-6-501(6)" depth="4">(6)</xref> is in the furtherance of the benefits to public <ln numlevel="1" lineno="199" slineno="1-176"/>trust assets attributable to the Great Salt Lake under Section <xref depth="3" refnumber="65A-1-1">65A-1-1</xref>.</subsection></subsection><subsection ssid="1-84" dnum="_-o:7-i" numlevel="1" lineno="200" slineno="1-177" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="1-103" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">A private person may not exercise the power of eminent domain to acquire an <ln numlevel="1" lineno="201" slineno="1-178"/>estate or right for a pipeline to serve a property that is:</amend><subsection ssid="1-90" dnum="_-o:i-i" numlevel="1" lineno="202" slineno="1-179" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">used for energy generation for the energy generator's own use or an energy <ln numlevel="1" lineno="203" slineno="1-180"/>generation facility for use by the energy generation facility's beneficiary; or</amend></subsection><subsection ssid="1-91" dnum="_-o:ii-i" numlevel="1" lineno="204" slineno="1-181" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">planned to be used for energy generation for the energy generator's own use or an <ln numlevel="1" lineno="205" slineno="1-182"/>energy generation facility for use by the energy generation facility's beneficiary.</amend></subsection></subsection><subsection ssid="1-104" dnum="_-o:b-i" numlevel="1" lineno="206" slineno="1-183" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">The prohibition described in Subsection (7)(a) does not apply to an eminent domain <ln numlevel="1" lineno="207" slineno="1-184"/>action to acquire an easement to:</amend><subsection ssid="1-106" dnum="_-o:i-i" numlevel="1" lineno="208" slineno="1-185" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">locate a pipeline within an existing utility easement or immediately adjacent to <ln numlevel="1" lineno="209" slineno="1-186"/>and parallel with an existing utility line;</amend></subsection><subsection ssid="1-107" dnum="_-o:ii-i" numlevel="1" lineno="210" slineno="1-187" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">locate a pipeline within or immediately adjacent to and parallel with an existing <ln numlevel="1" lineno="211" slineno="1-188"/>or planned roadway; or</amend></subsection><subsection ssid="1-108" dnum="_-o:iii-i" numlevel="1" lineno="212" slineno="1-189" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">construct a pipeline that will, or has the ability to, serve more than one customer <ln numlevel="1" lineno="213" slineno="1-190"/>upon completion.</amend></subsection></subsection><subsection ssid="1-105" dnum="_-o:c-i" numlevel="1" lineno="214" slineno="1-191" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">The prohibition described in Subsection <xref depth="4" refnumber="78B-6-501(7)(a)">(7)(a)</xref> applies to an eminent domain action <ln numlevel="1" lineno="215" slineno="1-192"/>that is pending on, or occurs on or after, the effective date of this bill.</amend></subsection></subsection></section></bsec><bsec buid="5" num="78B-6-502" type="amend" src="code" uid="C78B-6-S502_1800010118000101" sort="78B06 05020018000101" numlevel="1" lineno="216" slineno="2-1" sn="2"><section number="78B-6-502" numlevel="1" lineno="217" slineno="2-2" type="amend"><secline lineno="216">Section 2. Section <bold>78B-6-502</bold> is amended to read:</secline><catline lineno="217"><bold>78B-6-502<parens/>. Estates and rights that may be taken.</bold></catline><sectionText lineno="218"><tab/>Except as provided in Subsection <xref depth="4" refnumber="78B-6-501(3)">78B-6-501(3)</xref>, (4), <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">or (5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5), or (7)</amend>, the following <ln numlevel="1" lineno="219" slineno="2-4"/>estates and rights in lands are subject to being taken for public use:</sectionText><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="220" slineno="2-5" level="1"><display>(1)</display>a fee simple, when taken for:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="221" slineno="2-6" level="2"><display>(a)</display>public buildings or grounds;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="222" slineno="2-7" level="2"><display>(b)</display>permanent buildings;</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="223" slineno="2-8" level="2"><display>(c)</display>reservoirs and dams, and permanent flooding occasioned by them;</subsection><subsection ssid="5-null-5" dnum="d-o" numlevel="1" lineno="224" slineno="2-9" level="2"><display>(d)</display>any permanent flood control structure affixed to the land;</subsection><subsection ssid="5-null-6" dnum="e-o" numlevel="1" lineno="225" slineno="2-10" level="2"><display>(e)</display>an outlet for a flow, a place for the deposit of debris or tailings of a mine, mill, <ln numlevel="1" lineno="226" slineno="2-11"/>smelter, or other place for the reduction of ores; and</subsection><subsection ssid="5-null-7" dnum="f-o" numlevel="1" lineno="227" slineno="2-12" level="2"><display>(f)</display>subject to Subsection <xref depth="4" refnumber="78B-6-501(6)">78B-6-501(6)</xref>,<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>solar evaporation ponds and other facilities for <ln numlevel="1" lineno="228" slineno="2-13"/>the recovery of minerals in solution, except when the surface ground is underlaid <ln numlevel="1" lineno="229" slineno="2-14"/>with minerals, coal, or other deposits sufficiently valuable to justify extraction, only a <ln numlevel="1" lineno="230" slineno="2-15"/>perpetual easement may be taken over the surface ground over the deposits;</subsection></subsection><subsection ssid="5-null-8" dnum="2-o" numlevel="1" lineno="231" slineno="2-16" level="1"><display>(2)</display>an easement, when taken for any other use; and</subsection><subsection ssid="5-null-9" dnum="3-o" numlevel="1" lineno="232" slineno="2-17" level="1"><display>(3)</display>the right of entry upon and occupation of lands, with the right to take from those lands <ln numlevel="1" lineno="233" slineno="2-18"/>earth, gravel, stones, trees, and timber as necessary for a public use.</subsection></section></bsec><bsec buid="6" num="78B-6-503" type="amend" src="code" uid="C78B-6-S503_1800010118000101" sort="78B06 05030018000101" numlevel="1" lineno="234" slineno="3-1" sn="3"><section number="78B-6-503" numlevel="1" lineno="235" slineno="3-2" type="amend"><secline lineno="234">Section 3. Section <bold>78B-6-503</bold> is amended to read:</secline><catline lineno="235"><bold>78B-6-503<parens/>. Private property which may be taken.</bold></catline><sectionText lineno="236"><tab/>Except as provided in Subsection <xref depth="4" refnumber="78B-6-501(3)">78B-6-501(3)</xref>, (4), <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">or (5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5), or (7)</amend>, private property <ln numlevel="1" lineno="237" slineno="3-4"/>that may be taken under this part includes:</sectionText><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="238" slineno="3-5" level="1"><display>(1)</display>all real property belonging to any person;</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="239" slineno="3-6" level="1"><display>(2)</display>lands belonging to the state, or to any county, city or incorporated town, not <ln numlevel="1" lineno="240" slineno="3-7"/>appropriated to some public use;</subsection><subsection ssid="6-null-3" dnum="3-o" numlevel="1" lineno="241" slineno="3-8" level="1"><display>(3)</display>property appropriated to public use, except that the property may not be taken unless for <ln numlevel="1" lineno="242" slineno="3-9"/>a more necessary public use than that to which the property has already been <ln numlevel="1" lineno="243" slineno="3-10"/>appropriated;</subsection><subsection ssid="6-null-4" dnum="4-o" numlevel="1" lineno="244" slineno="3-11" level="1"><display>(4)</display>franchises for toll roads, toll bridges, ferries, and all other franchises, except that the <ln numlevel="1" lineno="245" slineno="3-12"/>franchises may not be taken unless for free highways, railroads, or other more necessary <ln numlevel="1" lineno="246" slineno="3-13"/>public use;</subsection><subsection ssid="6-null-5" dnum="5-o" numlevel="1" lineno="247" slineno="3-14" level="1"><display>(5)</display>all rights of way for any and all purposes mentioned in Section <xref depth="3" refnumber="78B-6-501">78B-6-501</xref>, and any and <ln numlevel="1" lineno="248" slineno="3-15"/>all structures and improvements on the property, and the lands held or used in <ln numlevel="1" lineno="249" slineno="3-16"/>connection with the property, except that:<subsection ssid="6-null-6" dnum="a-o" numlevel="1" lineno="250" slineno="3-17" level="2"><display>(a)</display>the property is subject to be connected with, crossed, or intersected by any other right <ln numlevel="1" lineno="251" slineno="3-18"/>of way or improvement or structure; </subsection><subsection ssid="6-null-7" dnum="b-o" numlevel="1" lineno="252" slineno="3-19" level="2"><display>(b)</display>the property is subject to a limited use in common with the owners, when necessary; <ln numlevel="1" lineno="253" slineno="3-20"/>and</subsection><subsection ssid="6-null-8" dnum="c-o" numlevel="1" lineno="254" slineno="3-21" level="2"><display>(c)</display>uses of crossings, intersections, and connections shall be made in the manner most <ln numlevel="1" lineno="255" slineno="3-22"/>compatible with the greatest public benefit and the least private injury;
