Section <bold>63G-2-305</bold> is amended to read:</secline><catline lineno="46"><bold>63G-2-305<parens/>. Protected records.</bold></catline><sectionText lineno="47"><tab/>The following records are protected if properly classified by a governmental entity:</sectionText><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="48" slineno="1-4" level="1"><display>(1)</display>trade secrets as defined in Section <xref depth="3" refnumber="13-24-2">13-24-2</xref> if the person submitting the trade secret has <ln numlevel="1" lineno="49" slineno="1-5"/>provided the governmental entity with the information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection><subsection ssid="20-null-2" dnum="2-o" numlevel="1" lineno="50" slineno="1-6" level="1"><display>(2)</display>commercial information or nonindividual financial information obtained from a person <ln numlevel="1" lineno="51" slineno="1-7"/>if:<subsection ssid="20-null-3" dnum="a-o" numlevel="1" lineno="52" slineno="1-8" level="2"><display>(a)</display>disclosure of the information could reasonably be expected to result in unfair <ln numlevel="1" lineno="53" slineno="1-9"/>competitive injury to the person submitting the information or would impair the <ln numlevel="1" lineno="54" slineno="1-10"/>ability of the governmental entity to obtain necessary information in the future;</subsection><subsection ssid="20-null-4" dnum="b-o" numlevel="1" lineno="55" slineno="1-11" level="2"><display>(b)</display>the person submitting the information has a greater interest in prohibiting access than <ln numlevel="1" lineno="56" slineno="1-12"/>the public in obtaining access; and</subsection><subsection ssid="20-null-5" dnum="c-o" numlevel="1" lineno="57" slineno="1-13" level="2"><display>(c)</display>the person submitting the information has provided the governmental entity with the <ln numlevel="1" lineno="58" slineno="1-14"/>information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection></subsection><subsection ssid="20-null-6" dnum="3-o" numlevel="1" lineno="59" slineno="1-15" level="1"><display>(3)</display>commercial or financial information acquired or prepared by a governmental entity to <ln numlevel="1" lineno="60" slineno="1-16"/>the extent that disclosure would lead to financial speculations in currencies, securities, or <ln numlevel="1" lineno="61" slineno="1-17"/>commodities that will interfere with a planned transaction by the governmental entity or <ln numlevel="1" lineno="62" slineno="1-18"/>cause substantial financial injury to the governmental entity or state economy;</subsection><subsection ssid="20-null-7" dnum="4-o" numlevel="1" lineno="63" slineno="1-19" level="1"><display>(4)</display>records, the disclosure of which could cause commercial injury to, or confer a <ln numlevel="1" lineno="64" slineno="1-20"/>competitive advantage upon a potential or actual competitor of, a commercial project <ln numlevel="1" lineno="65" slineno="1-21"/>entity as defined in Subsection <xref depth="3" refnumber="11-13-103">11-13-103</xref>(4);</subsection><subsection ssid="20-null-8" dnum="5-o" numlevel="1" lineno="66" slineno="1-22" level="1"><display>(5)</display>test questions and answers to be used in future license, certification, registration, <ln numlevel="1" lineno="67" slineno="1-23"/>employment, or academic examinations;</subsection><subsection ssid="20-null-9" dnum="6-o" numlevel="1" lineno="68" slineno="1-24" level="1"><display>(6)</display>records, the disclosure of which would impair governmental procurement proceedings <ln numlevel="1" lineno="69" slineno="1-25"/>or give an unfair advantage to any person proposing to enter into a contract or agreement <ln numlevel="1" lineno="70" slineno="1-26"/>with a governmental entity, except, subject to Subsections <xref depth="4" refnumber="63G-2-305(1)">(1)</xref> and <xref depth="4" refnumber="63G-2-305(2)">(2)</xref>, that this <ln numlevel="1" lineno="71" slineno="1-27"/>Subsection <xref depth="4" refnumber="63G-2-305(6)">(6)</xref> does not restrict the right of a person to have access to, after the contract <ln numlevel="1" lineno="72" slineno="1-28"/>or grant has been awarded and signed by all parties:<subsection ssid="20-null-10" dnum="a-o" numlevel="1" lineno="73" slineno="1-29" level="2"><display>(a)</display>a bid, proposal, application, or other information submitted to or by a governmental <ln numlevel="1" lineno="74" slineno="1-30"/>entity in response to:<subsection ssid="20-null-11" dnum="i-o" numlevel="1" lineno="75" slineno="1-31" level="3"><display>(i)</display>an invitation for bids;</subsection><subsection ssid="20-null-12" dnum="ii-o" numlevel="1" lineno="76" slineno="1-32" level="3"><display>(ii)</display>a request for proposals;</subsection><subsection ssid="20-null-13" dnum="iii-o" numlevel="1" lineno="77" slineno="1-33" level="3"><display>(iii)</display>a request for quotes;</subsection><subsection ssid="20-null-14" dnum="iv-o" numlevel="1" lineno="78" slineno="1-34" level="3"><display>(iv)</display>a grant; or</subsection><subsection ssid="20-null-15" dnum="v-o" numlevel="1" lineno="79" slineno="1-35" level="3"><display>(v)</display>other similar document; or</subsection></subsection><subsection ssid="20-null-16" dnum="b-o" numlevel="1" lineno="80" slineno="1-36" level="2"><display>(b)</display>an unsolicited proposal, as defined in Section <xref depth="3" refnumber="63G-6a-712">63G-6a-712</xref>;</subsection></subsection><subsection ssid="20-null-17" dnum="7-o" numlevel="1" lineno="81" slineno="1-37" level="1"><display>(7)</display>information submitted to or by a governmental entity in response to a request for <ln numlevel="1" lineno="82" slineno="1-38"/>information, except, subject to Subsections <xref depth="4" refnumber="63G-2-305(1)">(1)</xref> and <xref depth="4" refnumber="63G-2-305(2)">(2)</xref>, that this Subsection <xref depth="4" refnumber="63G-2-305(7)">(7)</xref> does not <ln numlevel="1" lineno="83" slineno="1-39"/>restrict the right of a person to have access to the information, after:<subsection ssid="20-null-18" dnum="a-o" numlevel="1" lineno="84" slineno="1-40" level="2"><display>(a)</display>a contract directly relating to the subject of the request for information has been <ln numlevel="1" lineno="85" slineno="1-41"/>awarded and signed by all parties; or</subsection><subsection ssid="20-null-19" dnum="b-o" numlevel="1" lineno="86" slineno="1-42" level="2" space="false"><display>(b)</display><subsection ssid="20-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a final determination is made not to enter into a contract that relates to the <ln numlevel="1" lineno="87" slineno="1-43"/>subject of the request for information; and</subsection><subsection ssid="20-null-21" dnum="ii-o" numlevel="1" lineno="88" slineno="1-44" level="3"><display>(ii)</display>at least two years have passed after the day on which the request for information <ln numlevel="1" lineno="89" slineno="1-45"/>is issued;</subsection></subsection></subsection><subsection ssid="20-null-22" dnum="8-o" numlevel="1" lineno="90" slineno="1-46" level="1"><display>(8)</display>records that would identify real property or the appraisal or estimated value of real or <ln numlevel="1" lineno="91" slineno="1-47"/>personal property, including intellectual property, under consideration for public <ln numlevel="1" lineno="92" slineno="1-48"/>acquisition before any rights to the property are acquired unless:<subsection ssid="20-null-23" dnum="a-o" numlevel="1" lineno="93" slineno="1-49" level="2"><display>(a)</display>public interest in obtaining access to the information is greater than or equal to the <ln numlevel="1" lineno="94" slineno="1-50"/>governmental entity's need to acquire the property on the best terms possible;</subsection><subsection ssid="20-null-24" dnum="b-o" numlevel="1" lineno="95" slineno="1-51" level="2"><display>(b)</display>the information has already been disclosed to persons not employed by or under a <ln numlevel="1" lineno="96" slineno="1-52"/>duty of confidentiality to the entity;</subsection><subsection ssid="20-null-25" dnum="c-o" numlevel="1" lineno="97" slineno="1-53" level="2"><display>(c)</display>in the case of records that would identify property, potential sellers of the described <ln numlevel="1" lineno="98" slineno="1-54"/>property have already learned of the governmental entity's plans to acquire the <ln numlevel="1" lineno="99" slineno="1-55"/>property;</subsection><subsection ssid="20-null-26" dnum="d-o" numlevel="1" lineno="100" slineno="1-56" level="2"><display>(d)</display>in the case of records that would identify the appraisal or estimated value of <ln numlevel="1" lineno="101" slineno="1-57"/>property, the potential sellers have already learned of the governmental entity's <ln numlevel="1" lineno="102" slineno="1-58"/>estimated value of the property; or</subsection><subsection ssid="20-null-27" dnum="e-o" numlevel="1" lineno="103" slineno="1-59" level="2"><display>(e)</display>the property under consideration for public acquisition is a single family residence <ln numlevel="1" lineno="104" slineno="1-60"/>and the governmental entity seeking to acquire the property has initiated negotiations <ln numlevel="1" lineno="105" slineno="1-61"/>to acquire the property as required under Section <xref depth="3" refnumber="78B-6-505">78B-6-505</xref>;</subsection></subsection><subsection ssid="20-null-28" dnum="9-o" numlevel="1" lineno="106" slineno="1-62" level="1"><display>(9)</display>records prepared in contemplation of sale, exchange, lease, rental, or other compensated <ln numlevel="1" lineno="107" slineno="1-63"/>transaction of real or personal property including intellectual property, which, if <ln numlevel="1" lineno="108" slineno="1-64"/>disclosed prior to completion of the transaction, would reveal the appraisal or estimated <ln numlevel="1" lineno="109" slineno="1-65"/>value of the subject property, unless:<subsection ssid="20-null-29" dnum="a-o" numlevel="1" lineno="110" slineno="1-66" level="2"><display>(a)</display>the public interest in access is greater than or equal to the interests in restricting <ln numlevel="1" lineno="111" slineno="1-67"/>access, including the governmental entity's interest in maximizing the financial <ln numlevel="1" lineno="112" slineno="1-68"/>benefit of the transaction; or</subsection><subsection ssid="20-null-30" dnum="b-o" numlevel="1" lineno="113" slineno="1-69" level="2"><display>(b)</display>when prepared by or on behalf of a governmental entity, appraisals or estimates of <ln numlevel="1" lineno="114" slineno="1-70"/>the value of the subject property have already been disclosed to persons not <ln numlevel="1" lineno="115" slineno="1-71"/>employed by or under a duty of confidentiality to the entity;</subsection></subsection><subsection ssid="20-null-31" dnum="10-o" numlevel="1" lineno="116" slineno="1-72" level="1"><display>(10)</display>records created or maintained for civil, criminal, or administrative enforcement <ln numlevel="1" lineno="117" slineno="1-73"/>purposes or audit purposes, or for discipline, licensing, certification, or registration <ln numlevel="1" lineno="118" slineno="1-74"/>purposes, if release of the records:<subsection ssid="20-null-32" dnum="a-o" numlevel="1" lineno="119" slineno="1-75" level="2"><display>(a)</display>reasonably could be expected to interfere with investigations undertaken for <ln numlevel="1" lineno="120" slineno="1-76"/>enforcement, discipline, licensing, certification, or registration purposes;</subsection><subsection ssid="20-null-33" dnum="b-o" numlevel="1" lineno="121" slineno="1-77" level="2"><display>(b)</display>reasonably could be expected to interfere with audits, disciplinary, or enforcement <ln numlevel="1" lineno="122" slineno="1-78"/>proceedings;</subsection><subsection ssid="20-null-34" dnum="c-o" numlevel="1" lineno="123" slineno="1-79" level="2"><display>(c)</display>would create a danger of depriving a person of a right to a fair trial or impartial <ln numlevel="1" lineno="124" slineno="1-80"/>hearing;</subsection><subsection ssid="20-null-35" dnum="d-o" numlevel="1" lineno="125" slineno="1-81" level="2"><display>(d)</display>reasonably could be expected to disclose the identity of a source who is not generally <ln numlevel="1" lineno="126" slineno="1-82"/>known outside of government and, in the case of a record compiled in the course of <ln numlevel="1" lineno="127" slineno="1-83"/>an investigation, disclose information furnished by a source not generally known <ln numlevel="1" lineno="128" slineno="1-84"/>outside of government if disclosure would compromise the source; or</subsection><subsection ssid="20-null-36" dnum="e-o" numlevel="1" lineno="129" slineno="1-85" level="2"><display>(e)</display>reasonably could be expected to disclose investigative or audit techniques, <ln numlevel="1" lineno="130" slineno="1-86"/>procedures, policies, or orders not generally known outside of government if <ln numlevel="1" lineno="131" slineno="1-87"/>disclosure would interfere with enforcement or audit efforts;</subsection></subsection><subsection ssid="20-null-37" dnum="11-o" numlevel="1" lineno="132" slineno="1-88" level="1"><display>(11)</display>records the disclosure of which would jeopardize the life or safety of an individual;</subsection><subsection ssid="20-null-38" dnum="12-o" numlevel="1" lineno="133" slineno="1-89" level="1"><display>(12)</display>records the disclosure of which would jeopardize the security of governmental <ln numlevel="1" lineno="134" slineno="1-90"/>property, governmental programs, or governmental recordkeeping systems from <ln numlevel="1" lineno="135" slineno="1-91"/>damage, theft, or other appropriation or use contrary to law or public policy;</subsection><subsection ssid="20-null-39" dnum="13-o" numlevel="1" lineno="136" slineno="1-92" level="1"><display>(13)</display>records that, if disclosed, would jeopardize the security or safety of a correctional <ln numlevel="1" lineno="137" slineno="1-93"/>facility, or records relating to incarceration, treatment, probation, or parole, that would <ln numlevel="1" lineno="138" slineno="1-94"/>interfere with the control and supervision of an offender's incarceration, treatment, <ln numlevel="1" lineno="139" slineno="1-95"/>probation, or parole;</subsection><subsection ssid="20-null-40" dnum="14-o" numlevel="1" lineno="140" slineno="1-96" level="1"><display>(14)</display>records that, if disclosed, would reveal recommendations made to the Board of <ln numlevel="1" lineno="141" slineno="1-97"/>Pardons and Parole by an employee of or contractor for the Department of Corrections, <ln numlevel="1" lineno="142" slineno="1-98"/>the Board of Pardons and Parole, or the Department of Health and Human Services that <ln numlevel="1" lineno="143" slineno="1-99"/>are based on the employee's or contractor's supervision, diagnosis, or treatment of any <ln numlevel="1" lineno="144" slineno="1-100"/>person within the board's jurisdiction;</subsection><subsection ssid="20-null-41" dnum="15-o" numlevel="1" lineno="145" slineno="1-101" level="1"><display>(15)</display>records and audit workpapers that identify audit, collection, and operational procedures <ln numlevel="1" lineno="146" slineno="1-102"/>and methods used by the State Tax Commission, if disclosure would interfere with <ln numlevel="1" lineno="147" slineno="1-103"/>audits or ssid="20-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>an internal communication that is part of the deliberative process in connection <ln numlevel="1" lineno="160" slineno="1-116"/>with the preparation of legislation between:<subsection ssid="20-null-51" dnum="A-o" numlevel="1" lineno="161" slineno="1-117" level="4" tab="1"><display>(A)</display>members of a legislative body;</subsection><subsection ssid="20-null-52" dnum="B-o" numlevel="1" lineno="162" slineno="1-118" level="4" tab="1"><display>(B)</display>a member of a legislative body and a member of the legislative body's staff; or</subsection><subsection ssid="20-null-53" dnum="C-o" numlevel="1" lineno="163" slineno="1-119" level="4" tab="1"><display>(C)</display>members of a legislative body's ssid="20-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>records in the custody or control of the Office of Legislative Research and <ln numlevel="1" lineno="167" slineno="1-123"/>General Counsel, that, if disclosed, would reveal a particular legislator's <ln numlevel="1" lineno="168" slineno="1-124"/>contemplated legislation or contemplated course of action before the legislator has <ln numlevel="1" lineno="169" slineno="1-125"/>elected to support the legislation or course of action, or made the legislation or course <ln numlevel="1" lineno="170" slineno="1-126"/>of action public; and</subsection><subsection ssid="20-null-57" dnum="b-o" numlevel="1" lineno="171" slineno="1-127" level="2"><display>(b)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-2-305(20)(a)">(20)(a)</xref>, the form to request legislation submitted to the <ln numlevel="1" lineno="172" slineno="1-128"/>Office of Legislative Research and General Counsel is a public document unless a <ln numlevel="1" lineno="173" slineno="1-129"/>legislator asks that the records requesting the legislation be maintained as protected <ln numlevel="1" lineno="174" slineno="1-130"/>records until such time as the legislator elects to make the legislation or course of <ln numlevel="1" lineno="175" slineno="1-131"/>action public;</subsection></subsection><subsection ssid="20-null-58" dnum="21-o" numlevel="1" lineno="176" slineno="1-132" level="1"><display>(21)</display>a research request from a legislator to a legislative staff member and research findings <ln numlevel="1" lineno="177" slineno="1-133"/>prepared in response to the request;</subsection><subsection ssid="20-null-59" dnum="22-o" numlevel="1" lineno="178" slineno="1-134" level="1"><display>(22)</display>drafts, unless otherwise classified as public;</subsection><subsection ssid="20-null-60" dnum="23-o" numlevel="1" lineno="179" slineno="1-135" level="1"><display>(23)</display>records concerning a governmental entity's strategy about:<subsection ssid="20-null-61" dnum="a-o" numlevel="1" lineno="180" slineno="1-136" level="2"><display>(a)</display>collective bargaining; or</subsection><subsection ssid="20-null-62" dnum="b-o" numlevel="1" lineno="181" slineno="1-137" level="2"><display>(b)</display>imminent or pending litigation;</subsection></subsection><subsection ssid="20-null-63" dnum="24-o" numlevel="1" lineno="182" slineno="1-138" level="1"><display>(24)</display>records of investigations of loss occurrences and analyses of loss occurrences that may <ln numlevel="1" lineno="183" slineno="1-139"/>be covered by the Risk Management Fund, the Employers' Reinsurance Fund, the <ln numlevel="1" lineno="184" slineno="1-140"/>Uninsured Employers' Fund, or similar divisions in other governmental entities;</subsection><subsection ssid="20-null-64" dnum="25-o" numlevel="1" lineno="185" slineno="1-141" level="1"><display>(25)</display>records, other than personnel evaluations, that contain a personal recommendation <ln numlevel="1" lineno="186" slineno="1-142"/>concerning an individual if disclosure would constitute a clearly unwarranted invasion <ln numlevel="1" lineno="187" slineno="1-143"/>of personal privacy, or disclosure is not in the public interest;</subsection><subsection ssid="20-null-65" dnum="26-o" numlevel="1" lineno="188" slineno="1-144" level="1"><display>(26)</display>records that reveal the location of historic, prehistoric, paleontological, or biological <ln numlevel="1" lineno="189" slineno="1-145"/>resources that if known would jeopardize the security of those resources or of valuable <ln numlevel="1" lineno="190" slineno="1-146"/>historic, scientific, educational, or cultural information;</subsection><subsection ssid="20-null-66" dnum="27-o" numlevel="1" lineno="191" slineno="1-147" level="1"><display>(27)</display>records of independent state agencies if the disclosure of the records would conflict <ln numlevel="1" lineno="192" slineno="1-148"/>with the fiduciary obligations of the agency;</subsection><subsection ssid="20-null-67" dnum="28-o" numlevel="1" lineno="193" slineno="1-149" level="1"><display>(28)</display>records of an institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref> regarding <ln numlevel="1" lineno="194" slineno="1-150"/>tenure evaluations, appointments, applications for admissions, retention decisions, and <ln numlevel="1" lineno="195" slineno="1-151"/>promotions, which could be properly discussed in a meeting closed in accordance with <ln numlevel="1" lineno="196" slineno="1-152"/>Title <xref depth="1" refnumber="52-4">52, Chapter 4</xref>, Open and Public Meetings Act, provided that records of the final <ln numlevel="1" lineno="197" slineno="1-153"/>decisions about tenure, appointments, retention, promotions, or those students admitted, <ln numlevel="1" lineno="198" slineno="1-154"/>may not be classified as protected under this section;</subsection><subsection ssid="20-null-68" dnum="29-o" numlevel="1" lineno="199" slineno="1-155" level="1"><display>(29)</display>records of the governor's office, including budget recommendations, legislative <ln numlevel="1" lineno="200" slineno="1-156"/>proposals, and policy statements, that if disclosed would reveal the governor's <ln numlevel="1" lineno="201" slineno="1-157"/>contemplated policies or contemplated courses of action before the governor has <ln numlevel="1" lineno="202" slineno="1-158"/>implemented or rejected those policies or courses of action or made them public;</subsection><subsection ssid="20-null-69" dnum="30-o" numlevel="1" lineno="203" slineno="1-159" level="1"><display>(30)</display>records of the Office of the Legislative Fiscal Analyst relating to budget analysis, <ln numlevel="1" lineno="204" slineno="1-160"/>revenue estimates, and fiscal notes of proposed legislation before issuance of the final <ln numlevel="1" lineno="205" slineno="1-161"/>recommendations in these areas;</subsection><subsection ssid="20-null-70" dnum="31-o" numlevel="1" lineno="206" slineno="1-162" level="1"><display>(31)</display>records provided by the United States or by a government entity outside the state that <ln numlevel="1" lineno="207" slineno="1-163"/>are given to the governmental entity with a requirement that they be managed as <ln numlevel="1" lineno="208" slineno="1-164"/>protected records if the providing entity certifies that the record would not be subject to <ln numlevel="1" lineno="209" slineno="1-165"/>public disclosure if retained by it;</subsection><subsection ssid="20-null-71" dnum="32-o" numlevel="1" lineno="210" slineno="1-166" level="1"><display>(32)</display>transcripts, minutes, recordings, or reports of the closed portion of a meeting of a <ln numlevel="1" lineno="211" slineno="1-167"/>public body except as provided in Section <xref depth="3" refnumber="52-4-206">52-4-206</xref>;</subsection><subsection ssid="20-null-72" dnum="33-o" numlevel="1" lineno="212" slineno="1-168" level="1"><display>(33)</display>records that would reveal the contents of settlement negotiations but not including final <ln numlevel="1" lineno="213" slineno="1-169"/>settlements or empirical data to the extent that they are not otherwise exempt from <ln numlevel="1" lineno="214" slineno="1-170"/>disclosure;</subsection><subsection ssid="20-null-73" dnum="34-o" numlevel="1" lineno="215" slineno="1-171" level="1"><display>(34)</display>memoranda prepared by staff and used in the decision-making process by an <ln numlevel="1" lineno="216" slineno="1-172"/>administrative law judge, a member of the Board of Pardons and Parole, or a member of <ln numlevel="1" lineno="217" slineno="1-173"/>any other body charged by law with performing a quasi-judicial function;</subsection><subsection ssid="20-null-74" dnum="35-o" numlevel="1" lineno="218" slineno="1-174" level="1"><display>(35)</display>records that would reveal negotiations regarding assistance or incentives offered by or <ln numlevel="1" lineno="219" slineno="1-175"/>requested from a governmental entity for the purpose of encouraging a person to expand <ln numlevel="1" lineno="220" slineno="1-176"/>or locate a business in Utah, but only if disclosure would result in actual economic harm <ln numlevel="1" lineno="221" slineno="1-177"/>to the person or place the governmental entity at a competitive disadvantage, but this <ln numlevel="1" lineno="222" slineno="1-178"/>section may not be used to restrict access to a record evidencing a final contract;</subsection><subsection ssid="20-null-75" dnum="36-o" numlevel="1" lineno="223" slineno="1-179" level="1"><display>(36)</display>materials to which access must be limited for purposes of securing or maintaining the <ln numlevel="1" lineno="224" slineno="1-180"/>governmental entity's proprietary protection of intellectual property rights including <ln numlevel="1" lineno="225" slineno="1-181"/>patents, copyrights, and trade secrets;</subsection><subsection ssid="20-null-76" dnum="37-o" numlevel="1" lineno="226" slineno="1-182" level="1"><display>(37)</display>the name of a donor or a prospective donor to a governmental entity, including an <ln numlevel="1" lineno="227" slineno="1-183"/>institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, and other information <ln numlevel="1" lineno="228" slineno="1-184"/>concerning the donation that could reasonably be expected to reveal the identity of the <ln numlevel="1" lineno="229" slineno="1-185"/>donor, provided that:<subsection ssid="20-null-77" dnum="a-o" numlevel="1" lineno="230" slineno="1-186" level="2"><display>(a)</display>the donor requests anonymity in writing;</subsection><subsection ssid="20-null-78" dnum="b-o" numlevel="1" lineno="231" slineno="1-187" level="2"><display>(b)</display>any terms, conditions, restrictions, or privileges relating to the donation may not be <ln numlevel="1" lineno="232" slineno="1-188"/>classified protected by the governmental entity under this Subsection <xref depth="4" refnumber="63G-2-305(37)">(37)</xref>; and</subsection><subsection ssid="20-null-79" dnum="c-o" numlevel="1" lineno="233" slineno="1-189" level="2"><display>(c)</display>except for an institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, the <ln numlevel="1" lineno="234" slineno="1-190"/>governmental unit to which the donation is made is primarily engaged in educational, <ln numlevel="1" lineno="235" slineno="1-191"/>charitable, or artistic endeavors, and has no regulatory or legislative authority over <ln numlevel="1" lineno="236" slineno="1-192"/>the donor, a member of the donor's immediate family, or any entity owned or <ln numlevel="1" lineno="237" slineno="1-193"/>controlled by the donor or the donor's immediate family;</subsection></subsection><subsection ssid="20-null-80" dnum="38-o" numlevel="1" lineno="238" slineno="1-194" level="1"><display>(38)</display>accident reports, except as provided in Sections <xref depth="3" refnumber="41-6a-404">41-6a-404</xref>, <xref depth="3" refnumber="41-12a-202">41-12a-202</xref>, and <xref depth="3" refnumber="73-18-13">73-18-13</xref>;</subsection><subsection ssid="20-null-81" dnum="39-o" numlevel="1" lineno="239" slineno="1-195" level="1"><display>(39)</display>a notification of workers' compensation insurance coverage described in Section <xref depth="3" refnumber="34A-2-205"><ln numlevel="1" lineno="240" slineno="1-196"/>34A-2-205</xref>;</subsection><subsection dnum="a-o" numlevel="1" lineno="298" slineno="1-254" level="2"><display>(a)</display>information or records held by the Department of Health and Human Services related <ln numlevel="1" lineno="299" slineno="1-255"/>to a complaint regarding a provider, program, or facility which the department is <ln numlevel="1" lineno="300" slineno="1-256"/>unable to substantiate; and</subsection><subsection ssid="20-null-115" dnum="b-o" numlevel="1" lineno="301" slineno="1-257" level="2"><display>(b)</display>information or records related to a complaint received by the Department of Health <ln numlevel="1" lineno="302" slineno="1-258"/>and Human Services from an anonymous complainant regarding a provider, program, <ln numlevel="1" lineno="303" slineno="1-259"/>or facility;</subsection></subsection><subsection ssid="20-null-116" dnum="51-o" numlevel="1" lineno="304" slineno="1-260" level="1"><display>(51)</display>unless otherwise classified as public under Section <xref depth="3" refnumber="63G-2-301">63G-2-301</xref> and except as provided <ln numlevel="1" lineno="305" slineno="1-261"/>under Section <xref depth="3" refnumber="41-1a-116">41-1a-116</xref>, an individual's home address, home telephone number, or <ln numlevel="1" lineno="306" slineno="1-262"/>personal mobile phone number, if:<subsection ssid="20-null-117" dnum="a-o" numlevel="1" lineno="307" slineno="1-263" level="2"><display>(a)</display>the individual is required to provide the information in order to comply with a law, <ln numlevel="1" lineno="308" slineno="1-264"/>ordinance, rule, or order of a government entity; and</subsection><subsection ssid="20-null-118" dnum="b-o" numlevel="1" lineno="309" slineno="1-265" level="2"><display>(b)</display>the subject of the record has a reasonable expectation that this information will be <ln numlevel="1" lineno="310" slineno="1-266"/>kept confidential due to:<subsection ssid="20-null-119" dnum="i-o" numlevel="1" lineno="311" slineno="1-267" level="3"><display>(i)</display>the nature of the law, ordinance, rule, or order; and</subsection><subsection ssid="20-null-120" dnum="ii-o" numlevel="1" lineno="312" slineno="1-268" level="3"><display>(ii)</display>the individual complying with the law, ordinance, rule, or level="2"><display>(a)</display>a declaration of candidacy, a nomination petition, or a certificate of nomination, <ln numlevel="1" lineno="317" slineno="1-273"/>described in Section <xref depth="3" refnumber="20A-9-201">20A-9-201</xref>, <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>, <xref depth="3" refnumber="20A-9-203">20A-9-203</xref>, <xref depth="3" refnumber="20A-9-404">20A-9-404</xref>, <xref depth="3" refnumber="20A-9-405">20A-9-405</xref>, <xref depth="3" refnumber="20A-9-408"><ln numlevel="1" lineno="318" slineno="1-274"/>20A-9-408</xref>, signatures for candidacy, described in Section <xref depth="3" refnumber="20A-9-408">20A-9-408</xref>;</subsection></subsection><subsection ssid="20-null-125" dnum="53-o" numlevel="1" lineno="321" slineno="1-277" level="1"><display>(53)</display>the name, home address, work addresses, and telephone numbers of an individual that <ln numlevel="1" lineno="322" slineno="1-278"/>is engaged in, or that provides goods or services for, medical or scientific research that is:<subsection ssid="20-null-126" dnum="a-o" numlevel="1" lineno="323" slineno="1-279" level="2"><display>(a)</display>conducted within the state system of higher education, as described in Section <xref depth="3" refnumber="53H-1-102"><ln numlevel="1" lineno="324" slineno="1-280"/>53H-1-102</xref>; and</subsection><subsection ssid="20-null-127" dnum="b-o" numlevel="1" lineno="325" slineno="1-281" level="2"><display>(b)</display>conducted using animals;</subsection></subsection><subsection ssid="20-null-128" dnum="54-o" numlevel="1" lineno="326" slineno="1-282" level="1"><display>(54)</display>in accordance with Section <xref depth="3" refnumber="78A-12-203">78A-12-203</xref>, any record of the Judicial Performance <ln numlevel="1" lineno="327" slineno="1-283"/>Evaluation Commission concerning an individual commissioner's vote, in ssid="20-null-133" dnum="a-o" numlevel="1" lineno="339" slineno="1-295" level="2"><display>(a)</display>a management plan for a water conveyance facility in the possession of the Division <ln numlevel="1" lineno="340" slineno="1-296"/>of Water Resources or the Board of Water Resources; or</subsection><subsection ssid="20-null-134" dnum="b-o" numlevel="1" lineno="341" slineno="1-297" level="2"><display>(b)</display>an outline of an emergency response plan in possession of the state or a county or <ln numlevel="1" lineno="342" slineno="1-298"/>municipality;</subsection></subsection><subsection ssid="20-null-135" dnum="59-o" numlevel="1" lineno="343" slineno="1-299" level="1"><display>(59)</display>the following records in the custody or control of the Office of Inspector General of <ln numlevel="1" lineno="344" slineno="1-300"/>Medicaid Services, created in Section <xref depth="3" refnumber="63A-13-201">63A-13-201</xref>:<subsection ssid="20-null-136" dnum="a-o" numlevel="1" lineno="345" slineno="1-301" level="2"><display>(a)</display>records that would disclose information relating to allegations of personal <ln numlevel="1" lineno="346" slineno="1-302"/>misconduct, gross mismanagement, or illegal activity of a person if the information <ln numlevel="1" lineno="347" slineno="1-303"/>or allegation cannot be corroborated by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="348" slineno="1-304"/>Services through other documents or evidence, and the records relating to the <ln numlevel="1" lineno="349" slineno="1-305"/>allegation are not relied upon by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="350" slineno="1-306"/>Services in preparing a final investigation report or final audit report;</subsection><subsection ssid="20-null-137" dnum="b-o" numlevel="1" lineno="351" slineno="1-307" level="2"><display>(b)</display>records and audit workpapers to the extent they would disclose the identity of a <ln numlevel="1" lineno="352" slineno="1-308"/>person who, during the course of an investigation or audit, communicated the <ln numlevel="1" lineno="353" slineno="1-309"/>existence of any Medicaid fraud, waste, or abuse, or a violation or suspected <ln numlevel="1" lineno="354" slineno="1-310"/>violation of a law, rule, or regulation adopted under the laws of this state, a political <ln numlevel="1" lineno="355" slineno="1-311"/>subdivision of the state, or any recognized entity of the United States, if the <ln numlevel="1" lineno="356" slineno="1-312"/>information was disclosed on the condition that the identity of the person be <ln numlevel="1" lineno="357" slineno="1-313"/>protected;</subsection><subsection ssid="20-null-138" dnum="c-o" numlevel="1" lineno="358" slineno="1-314" level="2"><display>(c)</display>before the time that an investigation or audit is completed and the final investigation <ln numlevel="1" lineno="359" slineno="1-315"/>or final audit report is released, records or drafts circulated to a person who is not an <ln numlevel="1" lineno="360" slineno="1-316"/>employee or head of a governmental entity for the person's response or information;</subsection><subsection ssid="20-null-139" dnum="d-o" numlevel="1" lineno="361" slineno="1-317" level="2"><display>(d)</display>records that would disclose an outline or part of any investigation, audit survey plan, <ln numlevel="1" lineno="362" slineno="1-318"/>or audit program; or</subsection><subsection ssid="20-null-140" dnum="e-o" numlevel="1" lineno="363" slineno="1-319" level="2"><display>(e)</display>requests for an investigation or audit, if disclosure would risk circumvention of an <ln numlevel="1" lineno="364" slineno="1-320"/>investigation or audit;</subsection></subsection><subsection ssid="20-null-141" dnum="60-o" numlevel="1" lineno="365" slineno="1-321" level="1"><display>(60)</display>records that reveal methods used by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="366" slineno="1-322"/>Services, the fraud unit, or the Department of Health and Human Services, to discover <ln numlevel="1" lineno="367" slineno="1-323"/>Medicaid fraud, waste, or abuse;</subsection><subsection ssid="20-null-142" dnum="61-o" numlevel="1" lineno="368" slineno="1-324" level="1"><display>(61)</display>information provided to the Department of Health and Human Services or the Division <ln numlevel="1" lineno="369" slineno="1-325"/>of Professional Licensing under Subsections <xref depth="3" refnumber="58-67-304">58-67-304</xref>(3) and (4) and Subsections <xref depth="3" refnumber="58-68-304"><ln numlevel="1" lineno="370" slineno="1-326"/>58-68-304</xref>(3) and (4);</subsection><subsection ssid="20-null-143" dnum="62-o" numlevel="1" lineno="371" slineno="1-327" level="1"><display>(62)</display>a record described in Section <xref depth="3" refnumber="63G-12-210">63G-12-210</xref>;</subsection><subsection ssid="20-null-144" dnum="63-o" numlevel="1" lineno="372" slineno="1-328" level="1"><display>(63)</display>captured plate data that is obtained through an automatic license plate reader system <ln numlevel="1" lineno="373" slineno="1-329"/>used by a governmental entity as authorized in Section <xref depth="3" refnumber="41-6a-2003">41-6a-2003</xref>;</subsection><subsection ssid="20-null-145" dnum="64-o" numlevel="1" lineno="374" slineno="1-330" level="1"><display>(64)</display>an audio or video recording created by a body-worn camera, as that term is defined in <ln numlevel="1" lineno="375" slineno="1-331"/>Section <xref depth="3" refnumber="77-7a-103">77-7a-103</xref>, that records sound or images inside a hospital or health care facility <ln numlevel="1" lineno="376" slineno="1-332"/>as those terms are defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, inside a clinic of a health care provider, <ln numlevel="1" lineno="377" slineno="1-333"/>as that term is defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, or inside a human service program as that <ln numlevel="1" lineno="378" slineno="1-334"/>term is defined in Section <xref depth="3" refnumber="26B-2-101">26B-2-101</xref>, except for recordings that:<subsection ssid="20-null-146" dnum="a-o" numlevel="1" lineno="379" slineno="1-335" level="2"><display>(a)</display>depict the commission of an alleged crime;</subsection><subsection ssid="20-null-147" dnum="b-o" numlevel="1" lineno="380" slineno="1-336" level="2"><display>(b)</display>record any encounter between a law enforcement officer and a person that results in <ln numlevel="1" lineno="381" slineno="1-337"/>death or bodily injury, or includes an instance when an officer fires a weapon;</subsection><subsection ssid="20-null-148" dnum="c-o" numlevel="1" lineno="382" slineno="1-338" level="2"><display>(c)</display>record any encounter that is the subject of a complaint or a legal proceeding against a <ln numlevel="1" lineno="383" slineno="1-339"/>law enforcement officer or law enforcement agency;</subsection><subsection ssid="20-null-149" dnum="d-o" numlevel="1" lineno="384" slineno="1-340" level="2"><display>(d)</display>contain an officer involved critical incident as defined in Subsection <xref depth="3" refnumber="76-2-408">76-2-408</xref>(1)(f); <ln numlevel="1" lineno="385" slineno="1-341"/>or</subsection><subsection ssid="20-null-150" dnum="e-o" numlevel="1" lineno="386" slineno="1-342" level="2"><display>(e)</display>have been requested for reclassification as a public record by a subject or authorized <ln numlevel="1" lineno="387" slineno="1-343"/>agent of a subject featured in the recording;</subsection></subsection><subsection ssid="20-null-151" dnum="65-o" numlevel="1" lineno="388" slineno="1-344" level="1"><display>(65)</display>a record pertaining to the search process for a president of an institution of higher <ln numlevel="1" lineno="389" slineno="1-345"/>education described in Section <xref depth="3" refnumber="53H-3-302">53H-3-302</xref>;</subsection><subsection ssid="20-null-152" dnum="66-o" numlevel="1" lineno="390" slineno="1-346" level="1"><display>(66)</display>an audio recording that is:<subsection ssid="20-null-153" dnum="a-o" numlevel="1" lineno="391" slineno="1-347" level="2"><display>(a)</display>produced by an audio recording device that is used in conjunction with a device or <ln numlevel="1" lineno="392" slineno="1-348"/>piece of equipment designed or intended for resuscitating an individual or for treating <ln numlevel="1" lineno="393" slineno="1-349"/>an individual with a life-threatening condition;</subsection><subsection ssid="20-null-154" dnum="b-o" numlevel="1" lineno="394" slineno="1-350" level="2"><display>(b)</display>produced during an emergency event when an individual employed to provide law <ln numlevel="1" lineno="395" slineno="1-351"/>enforcement, fire protection, paramedic, emergency medical, or other first responder <ln numlevel="1" lineno="396" slineno="1-352"/>service:<subsection ssid="20-null-155" dnum="i-o" numlevel="1" lineno="397" slineno="1-353" level="3"><display>(i)</display>is responding to an individual needing resuscitation or with a life-threatening <ln numlevel="1" lineno="398" slineno="1-354"/>condition; and</subsection><subsection ssid="20-null-156" dnum="ii-o" numlevel="1" lineno="399" slineno="1-355" level="3"><display>(ii)</display>uses a device or piece of equipment designed or intended for resuscitating an <ln numlevel="1" lineno="400" slineno="1-356"/>individual or for treating an individual with a life-threatening condition; and</subsection></subsection><subsection ssid="20-null-157" dnum="c-o" numlevel="1" lineno="401" slineno="1-357" level="2"><display>(c)</display>intended and used for purposes of training emergency responders how to improve <ln numlevel="1" lineno="402" slineno="1-358"/>their response to an emergency situation;</subsection></subsection><subsection ssid="20-null-158" dnum="67-o" numlevel="1" lineno="403" slineno="1-359" level="1"><display>(67)</display>records submitted by or prepared in relation to an applicant seeking a recommendation <ln numlevel="1" lineno="404" slineno="1-360"/>by the Research and General Counsel Subcommittee, the Budget Subcommittee, or the <ln numlevel="1" lineno="405" slineno="1-361"/>Legislative Audit Subcommittee, established under Section <xref depth="3" refnumber="36-12-8">36-12-8</xref>, for an employment <ln numlevel="1" lineno="406" slineno="1-362"/>position with the Legislature;</subsection><subsection ssid="20-null-159" dnum="68-o" numlevel="1" lineno="407" slineno="1-363" level="1"><display>(68)</display>work papers as defined in Section <xref depth="3" refnumber="31A-2-204">31A-2-204</xref>;</subsection><subsection ssid="20-null-160" dnum="69-o" numlevel="1" lineno="408" slineno="1-364" level="1"><display>(69)</display>a record made available to Adult Protective Services or a law enforcement agency <ln numlevel="1" lineno="409" slineno="1-365"/>under Section <xref depth="3" refnumber="61-1-206">61-1-206</xref>;</subsection><subsection ssid="20-null-161" dnum="70-o" numlevel="1" lineno="410" slineno="1-366" level="1"><display>(70)</display>a record submitted to the Insurance Department in accordance with Section <xref depth="3" refnumber="31A-37-201"><ln numlevel="1" lineno="411" slineno="1-367"/>31A-37-201</xref>;</subsection><subsection ssid="20-null-162" slineno="1-393" level="2"><display>(a)</display>the individual is convicted of a criminal offense based upon the conduct for which <ln numlevel="1" lineno="438" slineno="1-394"/>the individual was incarcerated at the time the image was taken;</subsection><subsection ssid="20-null-178" dnum="b-o" numlevel="1" lineno="439" slineno="1-395" level="2"><display>(b)</display>a law enforcement agency releases or disseminates the image:<subsection ssid="20-null-179" dnum="i-o" numlevel="1" lineno="440" slineno="1-396" level="3"><display>(i)</display>after determining that  the individual is a fugitive or an imminent threat to an <ln numlevel="1" lineno="441" slineno="1-397"/>individual or to public safety and releasing or disseminating the image will assist <ln numlevel="1" lineno="442" slineno="1-398"/>in apprehending the individual or reducing or eliminating the threat; or</subsection><subsection ssid="20-null-180" dnum="ii-o" numlevel="1" lineno="443" slineno="1-399" level="3"><display>(ii)</display>to a potential witness or other individual with direct knowledge of events relevant <ln numlevel="1" lineno="444" slineno="1-400"/>to a criminal investigation or criminal proceeding for the purpose of identifying or <ln numlevel="1" lineno="445" slineno="1-401"/>locating an individual in connection with the criminal investigation or criminal <ln numlevel="1" lineno="446" slineno="1-402"/>proceeding;</subsection></subsection><subsection ssid="20-null-181" dnum="c-o" numlevel="1" lineno="447" slineno="1-403" level="2"><display>(c)</display>a judge orders the release or dissemination of the image based on a finding that the <ln numlevel="1" lineno="448" slineno="1-404"/>release or dissemination is in furtherance of a legitimate law enforcement interest; or</subsection><subsection ssid="20-null-182" dnum="d-o" numlevel="1" lineno="449" slineno="1-405" level="2"><display>(d)</display>the image is displayed to a person who is permitted to view the image under Section <xref depth="3" refnumber="17-72-802"><ln numlevel="1" lineno="450" slineno="1-406"/>17-72-802</xref>;</subsection></subsection><subsection ssid="20-null-183" dnum="81-o" numlevel="1" lineno="451" slineno="1-407" level="1"><display>(81)</display>a record:<subsection ssid="20-null-184" dnum="a-o" numlevel="1" lineno="452" slineno="1-408" level="2"><display>(a)</display>concerning an interstate claim to the use of waters in the Colorado River system;</subsection><subsection ssid="20-null-185" dnum="b-o" numlevel="1" lineno="453" slineno="1-409" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="454" slineno="1-410"/>representative from another state or the federal government as provided in Section <xref depth="3" refnumber="63M-14-205"><ln numlevel="1" lineno="455" slineno="1-411"/>63M-14-205</xref>; and</subsection><subsection ssid="20-null-186" dnum="c-o" numlevel="1" lineno="456" slineno="1-412" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="20-null-187" dnum="i-o" numlevel="1" lineno="457" slineno="1-413" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="458" slineno="1-414"/>Colorado River system;</subsection><subsection ssid="20-null-188" dnum="ii-o" numlevel="1" lineno="459" slineno="1-415" level="3"><display>(ii)</display>harm the ability of the Colorado River Authority of Utah or river commissioner to <ln numlevel="1" lineno="460" slineno="1-416"/>negotiate the best terms and conditions regarding the use of water in the Colorado <ln numlevel="1" lineno="461" slineno="1-417"/>River system; or</subsection><subsection ssid="20-null-189" dnum="iii-o" numlevel="1" lineno="462" slineno="1-418" level="3"><display>(iii)</display>give an advantage to another state or to the federal government in negotiations <ln numlevel="1" lineno="463" slineno="1-419"/>regarding the use of water in the Colorado River system;</subsection></subsection></subsection><subsection ssid="20-null-190" dnum="82-o" numlevel="1" lineno="464" slineno="1-420" level="1"><display>(82)</display>any part of an application described in Section <xref depth="3" refnumber="63N-16-201">63N-16-201</xref> that the Governor's Office <ln numlevel="1" lineno="465" slineno="1-421"/>of Economic Opportunity determines is nonpublic, confidential information that if <ln numlevel="1" lineno="466" slineno="1-422"/>disclosed would result in actual economic harm to the applicant, but this Subsection <xref depth="4" refnumber="63G-2-305(82)">(82)</xref> <ln numlevel="1" lineno="467" slineno="1-423"/>may not be used to restrict access to a record evidencing a final contract or approval <ln numlevel="1" lineno="468" slineno="1-424"/>decision;</subsection><subsection ssid="20-null-191" dnum="83-o" numlevel="1" lineno="469" slineno="1-425" level="1"><display>(83)</display>the following records of a drinking water or wastewater facility:<subsection ssid="20-null-192" dnum="a-o" numlevel="1" lineno="470" slineno="1-426" level="2"><display>(a)</display>an engineering or architectural drawing of the drinking water or wastewater facility; <ln numlevel="1" lineno="471" slineno="1-427"/>and</subsection><subsection ssid="20-null-193" dnum="b-o" numlevel="1" lineno="472" slineno="1-428" level="2"><display>(b)</display>except as provided in Section <xref depth="3" refnumber="63G-2-106">63G-2-106</xref>, a record detailing tools or processes the <ln numlevel="1" lineno="473" slineno="1-429"/>drinking water or wastewater facility uses to secure, or prohibit access to, the records <ln numlevel="1" lineno="474" slineno="1-430"/>described in Subsection <xref depth="4" refnumber="63G-2-305(83)(a)">(83)(a)</xref>;</subsection></subsection><subsection ssid="20-null-194" dnum="84-o" numlevel="1" lineno="475" slineno="1-431" level="1"><display>(84)</display>a statement that an employee of a governmental entity provides to the governmental <ln numlevel="1" lineno="476" slineno="1-432"/>entity as part of the governmental entity's personnel or administrative investigation into <ln numlevel="1" lineno="477" slineno="1-433"/>potential misconduct involving the employee if the governmental entity:<subsection ssid="20-null-195" dnum="a-o" numlevel="1" lineno="478" slineno="1-434" level="2"><display>(a)</display>requires the statement under threat of employment disciplinary action, including <ln numlevel="1" lineno="479" slineno="1-435"/>possible termination of employment, for the employee's refusal to provide the <ln numlevel="1" lineno="480" slineno="1-436"/>statement; and</subsection><subsection ssid="20-null-196" dnum="b-o" numlevel="1" lineno="481" slineno="1-437" level="2"><display>(b)</display>provides the employee assurance that the statement cannot be used against the <ln numlevel="1" lineno="482" slineno="1-438"/>employee in any criminal proceeding;</subsection></subsection><subsection ssid="20-null-197" dnum="85-o" numlevel="1" lineno="483" slineno="1-439" level="1"><display>(85)</display>any part of an application for a Utah Fits All Scholarship account described in Section <xref depth="3" refnumber="53F-6-402"><ln numlevel="1" lineno="484" slineno="1-440"/>53F-6-402</xref> or other information identifying a scholarship student as defined in Section <xref depth="3" refnumber="53F-6-401"><ln numlevel="1" lineno="485" slineno="1-441"/>53F-6-401</xref>; </subsection><subsection ssid="20-null-198" dnum="86-o" numlevel="1" lineno="486" slineno="1-442" level="1"><display>(86)</display>a record:<subsection ssid="20-null-199" dnum="a-o" numlevel="1" lineno="487" slineno="1-443" level="2"><display>(a)</display>concerning a claim to the use of waters in the Great Salt Lake;</subsection><subsection ssid="20-null-200" dnum="b-o" numlevel="1" lineno="488" slineno="1-444" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="489" slineno="1-445"/>person concerning the claim, including a representative from another state or the <ln numlevel="1" lineno="490" slineno="1-446"/>federal government; and</subsection><subsection ssid="20-null-201" dnum="c-o" numlevel="1" lineno="491" slineno="1-447" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="20-null-202" dnum="i-o" numlevel="1" lineno="492" slineno="1-448" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="493" slineno="1-449"/>Great Salt Lake;</subsection><subsection ssid="20-null-203" dnum="ii-o" numlevel="1" lineno="494" slineno="1-450" level="3"><display>(ii)</display>harm the ability of the Great Salt Lake commissioner to negotiate the best terms <ln numlevel="1" lineno="495" slineno="1-451"/>and conditions regarding the use of water in the Great Salt Lake; or</subsection><subsection ssid="20-null-204" dnum="iii-o" numlevel="1" lineno="496" slineno="1-452" level="3"><display>(iii)</display>give an advantage to another person including another state or to the federal <ln numlevel="1" lineno="497" slineno="1-453"/>government in negotiations regarding the use of water in the Great Salt Lake;</subsection></subsection></subsection><subsection ssid="20-null-205" dnum="87-o" numlevel="1" lineno="498" slineno="1-454" level="1"><display>(87)</display>a consumer complaint described in Section <xref depth="3" refnumber="13-2-11">13-2-11</xref>, unless the consumer complaint is <ln numlevel="1" lineno="499" slineno="1-455"/>reclassified as public as described in Subsection <xref depth="3" refnumber="13-2-11">13-2-11</xref>(4);</subsection><subsection ssid="20-null-206" dnum="88-o" numlevel="1" lineno="500" slineno="1-456" level="1"><display>(88)</display>a record of the Utah water agent, appointed under Section <xref depth="3" waters;</subsection><subsection ssid="20-null-208" dnum="b-o" numlevel="1" lineno="502" slineno="1-458" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or slineno="3-6"/>Commission consisting of 13 members, as follows:<subsection ssid="9-null-2" dnum="a-o" numlevel="1" lineno="555" slineno="3-7" level="2"><display>(a)</display>two members appointed by the president of the Senate, only one of whom may be a <ln numlevel="1" lineno="556" slineno="3-8"/>member of the Utah State Bar;</subsection><subsection ssid="9-null-3" dnum="b-o" numlevel="1" lineno="557" slineno="3-9" level="2"><display>(b)</display>two members appointed by the speaker of the House of Representatives, only one of <ln numlevel="1" lineno="558" slineno="3-10"/>whom may be a member of the Utah State Bar;</subsection><subsection ssid="9-null-4" dnum="c-o" numlevel="1" lineno="559" slineno="3-11" level="2"><display>(c)</display>four members appointed by the members of the Supreme Court, at least one of <ln numlevel="1" lineno="560" slineno="3-12"/>whom, but not more than two of whom, may be a member of the Utah State Bar;</subsection><subsection ssid="9-null-5" dnum="d-o" numlevel="1" lineno="561" slineno="3-13" level="2"><display>(d)</display>four members appointed by the governor, at least one of whom, but not more than <ln numlevel="1" lineno="562" slineno="3-14"/>two of whom, may be a member of the Utah State Bar; and</subsection><subsection ssid="9-null-6" dnum="e-o" numlevel="1" lineno="563" slineno="3-15" level="2"><display>(e)</display>the executive director of the <amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both">State </amend>Commission on Criminal and Juvenile Justice.</subsection></subsection><subsection ssid="9-null-7" dnum="2-o" numlevel="1" lineno="564" slineno="3-16" level="1" space="false"><display>(2)</display><subsection ssid="9-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The president of the Senate and the speaker of the House of Representatives shall <ln numlevel="1" lineno="565" slineno="3-17"/>confer when appointing members under Subsections <xref depth="4" refnumber="78A-12-201(1)(a)" start="0">(1)(a)</xref> and <xref depth="4" refnumber="78A-12-201(1)(b)" start="0">(b)</xref> to ensure that <ln numlevel="1" lineno="566" slineno="3-18"/>there is at least one member from among their four appointees who is a member of <ln numlevel="1" lineno="567" slineno="3-19"/>the Utah State Bar.</subsection><subsection ssid="9-null-9" dnum="b-o" numlevel="1" lineno="568" slineno="3-20" level="2"><display>(b)</display>A sitting legislator or a sitting judge may not serve as a commission member.</subsection></subsection><subsection ssid="9-null-10" dnum="3-o" numlevel="1" lineno="569" slineno="3-21" level="1" space="false"><display>(3)</display><subsection ssid="9-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A member appointed under Subsection <xref depth="4" refnumber="78A-12-201(1)" start="0">(1)</xref> shall be appointed for a four-year term.</subsection><subsection ssid="9-null-12" dnum="b-o" numlevel="1" lineno="570" slineno="3-22" level="2"><display>(b)</display>A member may serve no more than three consecutive terms.</subsection></subsection><subsection ssid="9-null-13" dnum="4-o" numlevel="1" lineno="571" slineno="3-23" level="1"><display>(4)</display>At the time of appointment, the terms of commission members shall be staggered so that <ln numlevel="1" lineno="572" slineno="3-24"/>approximately half of commission members' terms expire every two years.</subsection><subsection ssid="9-null-14" dnum="5-o" numlevel="1" lineno="573" slineno="3-25" level="1"><display>(5)</display>When a vacancy occurs in the membership for any reason, the replacement shall be <ln numlevel="1" lineno="574" slineno="3-26"/>appointed for the unexpired term by the same appointing authority that appointed the <ln numlevel="1" lineno="575" slineno="3-27"/>member creating the vacancy.</subsection><subsection ssid="9-null-15" dnum="6-o" numlevel="1" lineno="576" slineno="3-28" level="1" space="false"><display>(6)</display><subsection ssid="9-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Eight members of the commission constitute a quorum.</subsection><subsection ssid="9-null-17" dnum="b-o" numlevel="1" lineno="577" slineno="3-29" level="2"><display>(b)</display>The action of a majority of the quorum constitutes the action of the commission, <ln numlevel="1" lineno="578" slineno="3-30"/>except that the commission may not make a determination that a judge meets or <ln numlevel="1" lineno="579" slineno="3-31"/>exceeds minimum performance standards, or that a judge does not meet or exceed <ln numlevel="1" lineno="580" slineno="3-32"/>minimum performance standards, by a vote of less than six members.</subsection><subsection ssid="9-null-18" dnum="c-o" numlevel="1" lineno="581" slineno="3-33" level="2"><display>(c)</display>If, because of absences, the commission is unable to make a determination described <ln numlevel="1" lineno="582" slineno="3-34"/>in Subsection <xref depth="4" refnumber="78A-12-201(6)(b)" start="0">(6)(b)</xref> by at least six votes, the commission may meet a second time to <ln numlevel="1" lineno="583" slineno="3-35"/>make a determination.</subsection><subsection ssid="9-null-19" dnum="d-o" numlevel="1" lineno="584" slineno="3-36" level="2"><display>(d)</display>If a vote on the question of whether a judge meets or exceeds minimum performance <ln numlevel="1" lineno="585" slineno="3-37"/>standards or does not meet or exceed minimum performance standards ends in a tie <ln numlevel="1" lineno="586" slineno="3-38"/>or does not pass by at least six votes, the record shall reflect that the commission <ln numlevel="1" lineno="587" slineno="3-39"/>made no determination in relation to that judge.</subsection></subsection><subsection ssid="9-22" dnum="_-o:7-i" numlevel="1" lineno="588" slineno="3-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="9-25" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">Any meeting of the commission shall comply with Title 52, Chapter 4, Open and <ln numlevel="1" lineno="589" slineno="3-43"/>performance evaluation by complying with Title 52, Chapter 4, Open and Public <ln numlevel="1" lineno="592" slineno="3-44"/>Meetings Act.</amend></subsection><subsection ssid="9-24" dnum="_-o:c-i" numlevel="1" lineno="593" slineno="3-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="78A-12-201(7)(b)">(7)(b)</xref>, any vote of the commission on whether a judge <ln numlevel="1" lineno="594" slineno="3-46"/>meets or exceeds minimum performance standards shall occur in a Judicial performance evaluation.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="613" slineno="5-4" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">Beginning with the 2012 judicial retention elections, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The</amend> commission shall prepare <ln numlevel="1" lineno="614" slineno="5-5"/>a <amend anum="0" ea="amend" pairid="58" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both">judicial </amend>performance evaluation for:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="615" slineno="5-6" level="2"><display>(a)</display>each judge in the third and fifth year of the judge's term if the judge is not a justice of <ln numlevel="1" lineno="616" slineno="5-7"/>the Supreme Court; and</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="617" slineno="5-8" level="2"><display>(b)</display>each justice of the Utah Supreme Court in the third, seventh, and ninth year of the <ln numlevel="1" lineno="618" slineno="5-9"/>justice's term.</subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="619" slineno="5-10" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="32" style="2" owner="jchristopherson" level="1" owner="jchristopherson" level="1" deltag="both"> but shall give primary <ln numlevel="1" lineno="622" slineno="5-13"/>emphasis to the information that is gathered and relates to the performance of the <ln numlevel="1" lineno="623" slineno="5-14"/>judge during the period subsequent to the last judicial retention election of that judge <ln numlevel="1" lineno="624" slineno="5-15"/>or if the judge has not had a judicial retention election, during the period applicable <ln numlevel="1" lineno="625" slineno="5-16"/>to the first judicial retention election</amend><amendoutend style="2"/>:<subsection ssid="1-null-5" dnum="a-o:i-i" numlevel="1" lineno="626" slineno="5-17" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1264" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>the results of the judge's most recent judicial performance survey that is <ln numlevel="1" lineno="627" slineno="5-18"/>conducted by a third party <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">in accordance with</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">as described in</amend> Section <xref depth="3" refnumber="78A-12-204" start="0">78A-12-204</xref>;</subsection><subsection ssid="1-null-6" dnum="b-o:ii-i" numlevel="1" lineno="628" slineno="5-19" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1265" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1266" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>information concerning the judge's compliance with certification standards <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="629" slineno="5-20"/>established in accordance with</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="60" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">described in</amend> Section <xref depth="3" refnumber="78A-12-205" start="0">78A-12-205</xref>;</subsection><subsection ssid="1-null-7" dnum="c-o:iii-i" numlevel="1" lineno="630" slineno="5-21" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1266" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>courtroom observation;</subsection><subsection ssid="1-null-8" dnum="d-o:iv-i" numlevel="1" lineno="631" slineno="5-22" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1267" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1268" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>the judge's judicial disciplinary record, if any;</subsection><subsection ssid="1-null-9" dnum="e-o:v-i" numlevel="1" lineno="632" slineno="5-23" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1268" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1269" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>public comment solicited by the commission;</subsection><subsection ssid="1-null-10" dnum="f-o:vi-i" numlevel="1" lineno="633" slineno="5-24" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1269" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1270" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>information from an earlier judicial performance evaluation concerning the <ln numlevel="1" lineno="634" slineno="5-25"/>judge<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both"> except that the commission shall give primary emphasis to information <ln numlevel="1" lineno="635" slineno="5-26"/>gathered subsequent to the last judicial retention election</amend><amendoutend style="2"/>; and</subsection><subsection ssid="1-null-11" dnum="g-o:vii-i" numlevel="1" lineno="636" slineno="5-27" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1270" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1271" style="1" owner="i" level="1" amendtag="both" space="true">(vii)</amend></display>any other factor that the commission:<subsection ssid="1-null-12" dnum="i-o:A-i" numlevel="1" lineno="637" slineno="5-28" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1271" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1272" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>considers relevant to evaluating the judge's performance for the purpose <ln numlevel="1" lineno="638" slineno="5-29"/>of a retention election; and</subsection><subsection ssid="1-null-13" dnum="ii-o:B-i" numlevel="1" lineno="639" slineno="5-30" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1272" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1273" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>establishes by rule made in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="640" slineno="5-31"/>Administrative Rulemaking Act</xref>.</subsection></subsection></subsection><subsection ssid="1-64" dnum="_-o:b-i" numlevel="1" lineno="641" slineno="5-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1273" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">The judicial performance evaluation for a judge under Subsection <xref depth="4" refnumber="78A-12-203(1)">(1)</xref> shall give <ln numlevel="1" lineno="642" slineno="5-33"/>primary emphasis to the information that is gathered and relates to the performance <ln numlevel="1" lineno="643" slineno="5-34"/>of the judge during:</amend><subsection ssid="1-67" dnum="_-o:i-i" numlevel="1" lineno="644" slineno="5-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1274" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">the period subsequent to the last judicial retention election of that judge; or</amend></subsection><subsection ssid="1-68" dnum="_-o:ii-i" numlevel="1" lineno="645" slineno="5-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">the period applicable to the first judicial retention election if the judge has not had <ln numlevel="1" lineno="646" slineno="5-37"/>a judicial retention election.</amend></subsection></subsection></subsection><subsection ssid="1-null-14" dnum="3-o" numlevel="1" lineno="647" slineno="5-38" level="1"><display>(3)</display>The commission shall, in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="648" slineno="5-39"/>Rulemaking Act</xref>, make rules concerning the conduct of courtroom observation under <ln numlevel="1" lineno="649" slineno="5-40"/>Subsection <xref depth="4" refnumber="78A-12-203(2)" start="0">(2)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both">which shall include the following</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">including</amend>:<subsection ssid="1-null-15" dnum="a-o" numlevel="1" lineno="650" slineno="5-41" level="2"><display>(a)</display>an indication of who may perform the courtroom observation;</subsection><subsection ssid="1-null-16" dnum="b-o" numlevel="1" lineno="651" slineno="5-42" level="2"><display>(b)</display>a determination of whether the courtroom observation shall be made in person or <ln numlevel="1" lineno="652" slineno="5-43"/>may be made by electronic means; and</subsection><subsection ssid="1-null-17" dnum="c-o" numlevel="1" lineno="653" slineno="5-44" level="2"><display>(c)</display>a list of principles and standards used to evaluate the behavior observed.</subsection></subsection><subsection ssid="1-null-18" dnum="4-o" numlevel="1" lineno="654" slineno="5-45" level="1" space="false"><display>(4)</display><subsection ssid="1-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As part of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="79" groupid="72" style="2" owner="jchristopherson" level="1" deltag="both">the evaluation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="77" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a judicial performance evaluation</amend> conducted under this <ln numlevel="1" lineno="655" slineno="5-46"/>section, the commission shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both"> do one of the following</amend><amendoutend style="2"/>:<subsection ssid="1-null-20" dnum="i-o" numlevel="1" lineno="656" slineno="5-47" level="3" tab="1"><display>(i)</display>determine, by a vote of at least six members, that the judge meets or exceeds <ln numlevel="1" lineno="657" slineno="5-48"/>minimum performance standards;</subsection><subsection ssid="1-null-21" dnum="ii-o" numlevel="1" lineno="658" slineno="5-49" level="3" tab="1"><display>(ii)</display>determine, by a vote of at least six members, that the judge does not meet or <ln numlevel="1" lineno="659" slineno="5-50"/>exceed minimum performance standards;</subsection><subsection ssid="1-null-22" dnum="iii-o" numlevel="1" lineno="660" slineno="5-51" level="3" tab="1"><display>(iii)</display>determine, by a majority vote, that the information concerning the judge is <ln numlevel="1" lineno="661" slineno="5-52"/>insufficient to make a determination described in Subsection <xref depth="4" refnumber="78A-12-203(4)(a)(i)" start="0">(4)(a)(i)</xref> or <xref depth="4" refnumber="78A-12-203(4)(a)(ii)" start="0">(ii)</xref>; or</subsection><subsection ssid="1-null-23" dnum="iv-o" numlevel="1" lineno="662" slineno="5-53" level="3" tab="1"><display>(iv)</display>fail to make a determination described in Subsection <xref depth="4" refnumber="78A-12-203(4)(a)(i)" start="0">(4)(a)(i)</xref>, <xref depth="4" refnumber="78A-12-203(4)(a)(ii)" start="0">(ii)</xref>, or <xref depth="4" refnumber="78A-12-203(4)(a)(iii)" start="0">(iii)</xref> by the <ln numlevel="1" lineno="663" slineno="5-54"/>number of votes required for one of those determinations.</subsection></subsection><subsection ssid="1-null-24" dnum="b-o" numlevel="1" lineno="664" slineno="5-55" level="2" space="false"><display>(b)</display><subsection ssid="1-null-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a judge meets the certification standards established in accordance with <ln numlevel="1" lineno="665" slineno="5-56"/>Section <xref depth="3" refnumber="78A-12-205" start="0">78A-12-205</xref>, there is a rebuttable presumption that the judge meets or <ln numlevel="1" lineno="666" slineno="5-57"/>exceeds minimum performance standards.</subsection><subsection ssid="1-null-26" dnum="ii-o" numlevel="1" lineno="667" slineno="5-58" level="3"><display>(ii)</display>If a judge fails to meet the certification standards established in accordance with <ln numlevel="1" lineno="668" slineno="5-59"/>Section <xref depth="3" refnumber="78A-12-205" start="0">78A-12-205</xref>, there is a rebuttable presumption that the judge does not <ln numlevel="1" lineno="669" slineno="5-60"/>meet or exceed minimum performance standards.</subsection></subsection><subsection ssid="1-null-27" dnum="c-o" numlevel="1" lineno="670" slineno="5-61" level="2"><display>(c)</display>If the commission deviates from a presumption described in Subsection <xref depth="4" refnumber="78A-12-203(4)(b)" start="0">(4)(b)</xref>, the <ln numlevel="1" lineno="671" slineno="5-62"/>commission shall provide a detailed explanation of the reason for that deviation in the <ln numlevel="1" lineno="672" slineno="5-63"/>commission's report under Section <xref depth="3" refnumber="78A-12-206" start="0">78A-12-206</xref>.</subsection><subsection ssid="1-null-28" dnum="d-o" numlevel="1" lineno="673" slineno="5-64" level="2"><display>(d)</display>If the commission makes the determination described in Subsection <xref depth="4" refnumber="78A-12-203(4)(a)(iii)" start="0">(4)(a)(iii)</xref> or fails <ln numlevel="1" lineno="674" slineno="5-65"/>to make a determination described in Subsection <xref depth="4" refnumber="78A-12-203(4)(a)(i)" start="0">(4)(a)(i)</xref>, <xref depth="4" refnumber="78A-12-203(4)(a)(ii)" start="0">(ii)</xref>, or <xref depth="4" refnumber="78A-12-203(4)(a)(iii)" start="0">(iii)</xref> by the number <ln numlevel="1" lineno="675" slineno="5-66"/>of votes required for those determinations, the commission shall note that fact in the <ln numlevel="1" lineno="676" slineno="5-67"/>commission's report.</subsection></subsection><subsection ssid="1-null-29" dnum="5-o" numlevel="1" lineno="677" slineno="5-68" level="1" space="false"><display>(5)</display><subsection ssid="1-null-30" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1292" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">The commission shall allow a judge who is the subject of a judicial performance <ln numlevel="1" lineno="678" slineno="5-69"/>retention evaluation, and who has not passed one or more of the certification <ln numlevel="1" lineno="679" slineno="5-70"/>standards on the retention evaluation, to appear and speak at any commission meeting <ln numlevel="1" lineno="680" slineno="5-71"/>during which the judge's judicial performance evaluation is considered.</amend><amendoutend style="2"/></subsection><subsection ssid="1-66" dnum="_-o:a-i" numlevel="1" lineno="681" slineno="5-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1293" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">If a judge is the subject of a performance evaluation and has not passed one or more <ln numlevel="1" lineno="682" slineno="5-73"/>of the certification standards for that performance evaluation, the commission shall <ln numlevel="1" lineno="683" slineno="5-74"/>grant the judge time to appear and speak at a commission meeting during which the <ln numlevel="1" lineno="684" slineno="5-75"/>judge's performance evaluation will be considered.</amend></subsection><subsection ssid="1-null-31" dnum="b-o" numlevel="1" lineno="685" slineno="5-76" level="2"><display>(b)</display>The commission may invite any judge to appear before the commission to discuss <ln numlevel="1" lineno="686" slineno="5-77"/>concerns about the judge's judicial performance.</subsection><subsection ssid="1-null-32" dnum="c-o:_-i" numlevel="1" lineno="687" slineno="5-78" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1295" style="2" owner="o" level="1" deltag="start">(c)</amend></display><subsection ssid="1-null-33" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend of the Utah State Bar, <ln numlevel="1" lineno="695" slineno="5-86"/>may not be disqualified from voting under Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">(4)</xref> solely because the <ln numlevel="1" lineno="696" slineno="5-87"/>member appears before the judge as an attorney, a fact witness, or an expert, <ln numlevel="1" lineno="697" slineno="5-88"/>unless the member is a litigant in a case pending before the judge.</subsection><subsection ssid="1-null-38" dnum="ii-o" numlevel="1" lineno="698" slineno="5-89" level="3"><display>(ii)</display>Notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="140" groupid="117" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-12-203(5)(e)(i)" start="0">(5)(e)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="138" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(c)(i)</amend>, a member of the commission <ln numlevel="1" lineno="699" slineno="5-90"/>shall disclose any conflicts of interest with the judge being reviewed to the other <ln numlevel="1" lineno="700" slineno="5-91"/>members of the commission before the deliberation and vote under Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">(4)</xref>.</subsection><subsection ssid="1-null-39" dnum="iii-o" numlevel="1" lineno="701" slineno="5-92" level="3"><display>(iii)</display>Information disclosed under this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="141" groupid="118" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-12-203(5)(e)" start="0">(5)(e)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="139" groupid="116" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(c)</amend> is a protected record <ln numlevel="1" lineno="702" slineno="5-93"/>under <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and Management Act</xref>.</subsection></subsection><subsection ssid="1-null-40" dnum="f-o:_-i" numlevel="1" lineno="703" slineno="5-94" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1303" style="2" owner="o" level="1" deltag="start">(f)</amend></display><amend anum="0" ea="erase" pairid="135" groupid="112" style="2" owner="jchristopherson" level="1" deltag="end">The commission may only disclose the final commission vote described in <ln numlevel="1" lineno="704" slineno="5-95"/>Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">(4)</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-41" dnum="6-o" numlevel="1" lineno="705" slineno="5-96" level="1" space="false"><display>(6)</display><subsection ssid="1-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the Utah Supreme Court issues a public sanction of a judge after the <ln numlevel="1" lineno="706" slineno="5-97"/>commission makes or fails to make a determination described in Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">(4)</xref>, but <ln numlevel="1" lineno="707" slineno="5-98"/>before the publication of the voter information pamphlet in accordance with Section <xref depth="3" refnumber="20A-7-702" start="0"><ln numlevel="1" lineno="708" slineno="5-99"/>20A-7-702</xref>, the commission may elect to reconsider the commission's action.</subsection><subsection ssid="1-null-43" dnum="b-o" numlevel="1" lineno="709" slineno="5-100" level="2"><display>(b)</display>The commission shall invite the judge described in Subsection <xref depth="4" refnumber="78A-12-203(6)(a)" start="0">(6)(a)</xref> to appear <ln numlevel="1" lineno="710" slineno="5-101"/>before the commission during a closed meeting for the purpose of reconsidering the <ln numlevel="1" lineno="711" slineno="5-102"/>commission's action.</subsection><subsection ssid="1-null-44" dnum="c-o" numlevel="1" lineno="712" slineno="5-103" level="2"><display>(c)</display>The judge described in Subsection <xref depth="4" refnumber="78A-12-203(6)(a)" start="0">(6)(a)</xref> may provide a written statement, not to <ln numlevel="1" lineno="713" slineno="5-104"/>exceed 100 words, that shall be included in the judge's <amend anum="0" ea="amend" pairid="87" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both">judicial performance </amend><ln numlevel="1" lineno="714" slineno="5-105"/>evaluation report.</subsection><subsection ssid="1-null-45" dnum="d-o" numlevel="1" lineno="715" slineno="5-106" level="2"><display>(d)</display>The commission shall include in the judge's <amend anum="0" ea="amend" pairid="88" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="both">judicial performance </amend>evaluation report:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="716" slineno="5-107" level="3"><display>(i)</display>the date of the reconsideration;</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="717" slineno="5-108" level="3"><display>(ii)</display>any change in the action of the commission; and</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="718" slineno="5-109" level="3"><display>(iii)</display>a brief statement explaining the reconsideration.</subsection></subsection><subsection ssid="1-null-49" dnum="e-o" numlevel="1" lineno="719" slineno="5-110" level="2"><display>(e)</display>The commission shall<amend anum="0" ea="amend" pairid="89" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="1-69" dnum="_-o:i-i" numlevel="1" lineno="720" slineno="5-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>submit revisions to the judge's<amend anum="0" ea="amend" pairid="107" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="both"> judicial performance</amend> evaluation report to the <ln numlevel="1" lineno="721" slineno="5-112"/>lieutenant governor by no later than August 31 of a regular general election year <ln numlevel="1" lineno="722" slineno="5-113"/>for publication in the voter information pamphlet<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="98" groupid="88" style="2" owner="jchristopherson" level="1" deltag="both">, and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="96" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend> </subsection><subsection ssid="1-71" dnum="_-o:ii-i" numlevel="1" lineno="723" slineno="5-114" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>publish the revisions on the commission's website, and through any other means <ln numlevel="1" lineno="724" slineno="5-115"/>the commission considers appropriate and within budgetary constraints.</subsection></subsection></subsection><subsection ssid="1-null-50" dnum="7-o" numlevel="1" lineno="725" slineno="5-116" level="1" space="false"><display>(7)</display><subsection ssid="1-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission shall compile a midterm report of the commission's judicial <ln numlevel="1" lineno="726" slineno="5-117"/>performance evaluation of a judge.</subsection><subsection ssid="1-null-52" dnum="b-o" numlevel="1" lineno="727" slineno="5-118" level="2"><display>(b)</display>The midterm report of a judicial performance evaluation shall include information <ln numlevel="1" lineno="728" slineno="5-119"/>that the commission considers appropriate for purposes of judicial self-improvement.</subsection><subsection ssid="1-null-53" dnum="c-o" numlevel="1" lineno="729" slineno="5-120" level="2" space="false"><display>(c)</display><subsection ssid="1-72" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>The report shall be provided to the evaluated judge, the presiding judge of the <ln numlevel="1" lineno="730" slineno="5-121"/>district in which the evaluated judge serves, and the Judicial Council.  </subsection><subsection ssid="1-73" dnum="_-o:ii-i" numlevel="1" lineno="731" slineno="5-122" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1320" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>If the evaluated judge is the presiding judge, the midterm report shall be provided <ln numlevel="1" lineno="732" slineno="5-123"/>to the chair of the board of judges for the court level on which the evaluated judge <ln numlevel="1" lineno="733" slineno="5-124"/>serves.</subsection></subsection><subsection ssid="1-null-54" dnum="d-o" numlevel="1" lineno="734" slineno="5-125" level="2" space="false"><display>(d)</display><subsection ssid="1-null-55" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The commission may provide a partial midterm evaluation to a judge whose <ln numlevel="1" lineno="735" slineno="5-126"/>appointment date precludes the collection of complete midterm evaluation data.</subsection><subsection ssid="1-null-56" dnum="ii-o" numlevel="1" lineno="736" slineno="5-127" level="3"><display>(ii)</display>For a newly appointed judge, a midterm evaluation is considered partial when the <ln numlevel="1" lineno="737" slineno="5-128"/>midterm evaluation is missing a respondent group, including attorneys, court staff, <ln numlevel="1" lineno="738" slineno="5-129"/>court room observers, or intercept survey respondents.</subsection><subsection ssid="1-null-57" dnum="iii-o" numlevel="1" lineno="739" slineno="5-130" level="3"><display>(iii)</display>A judge who receives partial midterm evaluation data may receive a statement in <ln numlevel="1" lineno="740" slineno="5-131"/>acknowledgment of that fact on the judge's voter information pamphlet page.</subsection><subsection ssid="1-null-58" dnum="iv-o" numlevel="1" lineno="741" slineno="5-132" level="3"><display>(iv)</display>On or before the beginning of the retention evaluation cycle, the commission <ln numlevel="1" lineno="742" slineno="5-133"/>shall inform the Judicial Council of the name of any judge who receives a partial <ln numlevel="1" lineno="743" slineno="5-134"/>midterm evaluation.</subsection></subsection></subsection><subsection ssid="1-null-59" dnum="8-o" numlevel="1" lineno="744" slineno="5-135" level="1"><display>(8)</display>The commission shall identify a judge whose midterm evaluation:<subsection ssid="1-null-60" dnum="a-o" numlevel="1" lineno="745" slineno="5-136" level="2"><display>(a)</display>fails to meet certification standards in accordance with Section <xref depth="3" refnumber="78A-12-205" start="0">78A-12-205</xref> or as <ln numlevel="1" lineno="746" slineno="5-137"/>established by rule; or</subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="747" slineno="5-138" level="2"><display>(b)</display>otherwise demonstrates to the commission that the judge's performance would be of <ln numlevel="1" lineno="748" slineno="5-139"/>such concern if the performance occurred in a retention evaluation that the judge <ln numlevel="1" lineno="749" slineno="5-140"/>would be invited to appear before the commission in accordance with Subsection <xref depth="4" refnumber="78A-12-203(5)(b)" start="0"><ln numlevel="1" lineno="750" slineno="5-141"/>(5)(b)</xref>.</subsection></subsection><subsection ssid="1-null-62" dnum="9-o" numlevel="1" lineno="751" slineno="5-142" level="1"><display>(9)</display>The commission may make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="752" slineno="5-143"/>Administrative Rulemaking Act</xref>, as necessary to administer the evaluation required by <ln numlevel="1" lineno="753" slineno="5-144"/>this section.</subsection></section></bsec><bsec buid="5" num="78A-12-204" type="amend" src="code" uid="C78A-12-S204_2026050620260506" sort="78A12 02040020260506" numlevel="1" lineno="754" slineno="6-1" sn="6"><section number="78A-12-204" numlevel="1" lineno="755" slineno="6-2" type="amend"><secline lineno="754">Section 6. Section <bold>78A-12-204</bold> is amended to read:</secline><catline lineno="755"><bold>78A-12-204<parens/>. Judicial performance survey.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="756" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>A third party under contract to the commission shall conduct, on an ongoing basis <ln numlevel="1" lineno="757" slineno="6-4"/>during the judge's term in office, the judicial performance survey required by Section <xref depth="3" refnumber="78A-12-203" start="0"><ln numlevel="1" lineno="758" slineno="6-5"/>78A-12-203</xref> concerning a judge who is subject to a retention election.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="759" slineno="6-6" level="1" space="false"><display>(2)</display><subsection ssid="5-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The judicial performance survey shall include as respondents a sample of each of <ln numlevel="1" lineno="760" slineno="6-7"/>the following groups as applicable:<subsection ssid="5-null-4" dnum="i-o" numlevel="1" lineno="761" slineno="6-8" level="3" tab="1"><display>(i)</display>attorneys who have appeared before the judge as counsel;</subsection><subsection ssid="5-null-5" dnum="ii-o" numlevel="1" lineno="762" slineno="6-9" level="3" tab="1"><display>(ii)</display>jurors who have served in a case before the judge; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-6" dnum="iii-o" numlevel="1" lineno="763" slineno="6-10" level="3" tab="1"><display>(iii)</display>court staff who have worked with the judge<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="5-47" dnum="_-o:iv-i" numlevel="1" lineno="764" slineno="6-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1336" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">individuals who have appeared before the judge as a party in a case.</amend></subsection></subsection><subsection ssid="5-null-7" dnum="b-o" numlevel="1" lineno="765" slineno="6-12" level="2"><display>(b)</display>Only a respondent under Subsection <xref depth="4" refnumber="78A-12-204(2)(a)(i)" start="0">(2)(a)(i)</xref> who is admitted to practice law in the <ln numlevel="1" lineno="766" slineno="6-13"/>state and in good standing with the Utah State Bar may evaluate a judge's legal <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="240" groupid="189" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="767" slineno="6-14"/>ability</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="236" groupid="185" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">competence</amend> under Subsection <xref depth="4" refnumber="78A-12-204(7)(a)" start="0">(7)(a)</xref>.</subsection></subsection><subsection ssid="5-null-8" dnum="3-o" numlevel="1" lineno="768" slineno="6-15" level="1"><display>(3)</display>The commission may include an additional classification of respondents if the <ln numlevel="1" lineno="769" slineno="6-16"/>commission:<subsection ssid="5-null-9" dnum="a-o" numlevel="1" lineno="770" slineno="6-17" level="2"><display>(a)</display>considers a<amend anum="0" ea="amend" pairid="237" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="both"> judicial performance</amend> survey of that classification of respondents helpful <ln numlevel="1" lineno="771" slineno="6-18"/>to voters in determining whether to vote to retain a judge; and</subsection><subsection ssid="5-null-10" dnum="b-o" numlevel="1" lineno="772" slineno="6-19" level="2"><display>(b)</display>establishes the additional classification of respondents by rule.</subsection></subsection><subsection ssid="5-null-11" dnum="4-o" numlevel="1" lineno="773" slineno="6-20" level="1"><display>(4)</display>All survey responses<amend anum="0" ea="amend" pairid="238" groupid="187" style="1" owner="jchristopherson" level="1" amendtag="both"> for a judicial performance survey</amend> are confidential, including <ln numlevel="1" lineno="774" slineno="6-21"/>comments included with a survey response.</subsection><subsection ssid="5-null-12" dnum="5-o" numlevel="1" lineno="775" slineno="6-22" level="1"><display>(5)</display>If the commission provides information to a judge or the Judicial Council, the <ln numlevel="1" lineno="776" slineno="6-23"/>commission shall provide the information in such a way as to protect the anonymity of a <ln numlevel="1" lineno="777" slineno="6-24"/>survey respondent.</subsection><subsection ssid="5-null-13" dnum="6-o:_-i" numlevel="1" lineno="778" slineno="6-25" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1343" style="2" owner="o" level="1" deltag="start">(6)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">A survey shall be provided to a potential survey respondent within 30 days of the day <ln numlevel="1" lineno="779" slineno="6-26"/>on which the case in which the person appears in the judge's court is closed, exclusive of <ln numlevel="1" lineno="780" slineno="6-27"/>any appeal, except ssid="5-44" dnum="_-o:6-i" numlevel="1" lineno="782" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1344" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="231" groupid="180" style="1" owner="jchristopherson" level="1" amendtag="end">A judicial performance survey shall be provided to a potential survey respondent:</amend><subsection ssid="5-46" dnum="_-o:a-i" numlevel="1" lineno="783" slineno="6-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1345" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">if the potential survey respondent is court staff or an attorney, at any time during the <ln numlevel="1" lineno="784" slineno="6-31"/>survey numlevel="1" lineno="791" slineno="6-38"/>survey shall provide a survey respondent with the ability to evaluate</amend>:<subsection ssid="5-null-15" dnum="a-o" numlevel="1" lineno="792" slineno="6-39" level="2"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both">legal ability, including the following</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="46" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a judge's legal competence, including</amend>:<subsection ssid="5-null-16" dnum="i-o" numlevel="1" lineno="793" slineno="6-40" level="3"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" procedure and evidence;</subsection><subsection ssid="5-null-17" dnum="ii-o" numlevel="1" lineno="795" slineno="6-42" level="3"><display>(ii)</display>attentiveness to factual and legal issues before the court;</subsection><subsection ssid="5-null-18" dnum="iii-o" numlevel="1" lineno="796" slineno="6-43" level="3"><display>(iii)</display>adherence to precedent and ability to clearly explain departures from precedent;<amend anum="0" ea="amend" pairid="64" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both"> <ln numlevel="1" lineno="797" slineno="6-44"/>and</amend></subsection><subsection ssid="5-null-19" dnum="iv-o" numlevel="1" lineno="798" slineno="6-45" level="3"><display>(iv)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">grasp</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">awareness</amend> of the practical impact on the parties of the judge's rulings, <ln numlevel="1" lineno="799" slineno="6-46"/>including the effect of delay and increased litigation expense;</subsection><subsection ssid="5-null-20" dnum="v-o:_-i" numlevel="1" lineno="800" slineno="6-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1354" style="2" owner="o" level="1" deltag="start">(v)</amend></display><amend anum="0" ea="erase" pairid="55" groupid="47" style="2" owner="jchristopherson" level="1" deltag="end">ability to write clear judicial opinions; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-21" dnum="_-o:iii-i" numlevel="1" lineno="807" slineno="6-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1359" style="1" owner="i" the workload within the court or district; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-33" dnum="iii-o:_-i" numlevel="1" lineno="836" slineno="6-83" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1378" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="172" groupid="138" style="2" owner="jchristopherson" level="1" deltag="end">issuance of opinions and orders without unnecessary delay.</amend><amendoutend style="2"/></subsection><subsection ssid="5-62" dnum="_-o:i-i" numlevel="1" lineno="837" slineno="6-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1379" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">effective management of workload and the competent use of technology necessary <ln numlevel="1" lineno="838" slineno="6-85"/>to manage cases, court filings, and otherwise discharge judicial duties;</amend></subsection><subsection ssid="5-63" dnum="_-o:ii-i" numlevel="1" lineno="839" slineno="6-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1380" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">timely issuance of opinions, orders, and other judicial rulings without <ln numlevel="1" lineno="840" slineno="6-87"/>unnecessary delay; and</amend></subsection><subsection ssid="5-64" dnum="_-o:iii-i" numlevel="1" lineno="841" slineno="6-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1381" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">ability to set clear expectations and timelines and to regularly monitor cases and <ln numlevel="1" lineno="842" slineno="6-89"/>streamline procedures.</amend></subsection></subsection></subsection><subsection ssid="5-null-34" dnum="8-o" numlevel="1" lineno="843" slineno="6-90" level="1"><display>(8)</display>If the commission determines that a certain survey question or category of questions is <ln numlevel="1" lineno="844" slineno="6-91"/>not appropriate for a respondent group, the commission may omit that question or <ln numlevel="1" lineno="845" slineno="6-92"/>category of questions from the <amend anum="0" ea="amend" pairid="239" groupid="188" style="1" owner="jchristopherson" level="1" amendtag="both">judicial performance </amend>survey provided to that respondent <ln numlevel="1" lineno="846" slineno="6-93"/>group.</subsection><subsection ssid="5-null-35" dnum="9-o:_-i" numlevel="1" lineno="847" slineno="6-94" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1383" style="2" owner="o" level="1" deltag="start">(9)</amend></display><subsection ssid="5-null-36" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1384" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="187" groupid="146" style="2" owner="jchristopherson" level="1" deltag="end">The survey shall allow respondents to indicate responses in a manner determined <ln numlevel="1" lineno="848" slineno="6-95"/>by the commission, which shall be:</amend><amendoutend style="2"/><subsection ssid="5-null-37" dnum="i-o:_-i" numlevel="1" lineno="849" slineno="6-96" ea="erase" anum="0" style="2"/></subsection><subsection ssid="5-null-38" dnum="ii-o:_-i" numlevel="1" lineno="850" slineno="6-97" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" ea="erase" pairid="1397" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1398" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>The commission may make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="873" slineno="6-120"/>Administrative Rulemaking Act</xref>, as necessary to administer the judicial performance <ln numlevel="1" lineno="874" slineno="6-121"/>survey.</subsection></section></bsec><bsec or</amend></subsection><subsection ssid="23-15" dnum="_-o:iii-i" numlevel="1" lineno="884" slineno="7-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1403" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">if further briefing is required in the case after a hearing or oral argument, all <ln numlevel="1" lineno="885" slineno="7-11"/>briefing is completed, a request to submit is filed, or the matter is placed in the <ln numlevel="1" lineno="886" slineno="7-12"/>judge's personal electronic queue or inbox, personal possession, or any other <ln numlevel="1" lineno="887" slineno="7-13"/>equivalent.</amend></subsection></subsection></subsection><subsection ssid="23-null-1" dnum="1-o:2-i" numlevel="1" lineno="888" slineno="7-14" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1404" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1405" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display>The commission shall establish certification standards requiring that:<subsection ssid="23-null-2" dnum="a-o" numlevel="1" lineno="889" slineno="7-15" level="2"><display>(a)</display>the judge have no more than one public sanction issued by the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">Utah </amend><amendoutend style="2"/>Supreme Court <ln numlevel="1" lineno="890" slineno="7-16"/>during the judge's current term; and</subsection><subsection ssid="23-null-3" dnum="b-o" numlevel="1" lineno="891" slineno="7-17" level="2"><display>(b)</display>the judge receive a minimum score on the judicial performance survey as follows:<subsection ssid="23-null-4" dnum="i-o" numlevel="1" lineno="892" slineno="7-18" level="3"><display>(i)</display>an average score of no less than 65% on each survey category as provided in <ln numlevel="1" lineno="893" slineno="7-19"/>Subsection <xref depth="4" refnumber="78A-12-204(7)" start="0">78A-12-204(7)</xref>; and</subsection><subsection ssid="23-null-5" dnum="ii-o" numlevel="1" lineno="894" slineno="7-20" level="3"><display>(ii)</display>if the commission includes a question on the survey that does not use the <ln numlevel="1" lineno="895" slineno="7-21"/>numerical scale, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">the commission shall establish the certification standard for all <ln numlevel="1" lineno="896" slineno="7-22"/>questions that do not use the numerical scale to be substantially equivalent</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a <ln numlevel="1" lineno="897" slineno="7-23"/>substantial equivalent</amend> to the standard required under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-12-205(1)(b)(i)" start="0">(1)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(b)(i)</amend>.</subsection></subsection></subsection><subsection ssid="23-16" dnum="_-o:3-i" numlevel="1" lineno="898" slineno="7-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1409" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">In addition to Subsection <xref depth="4" refnumber="78A-12-205(2)">(2)</xref>, the commission shall establish certification standards for a <ln numlevel="1" lineno="899" slineno="7-25"/>judge of the Supreme Court or Court of Appeals that address timely management of the <ln numlevel="1" lineno="900" slineno="7-26"/>judge's caseload, including:</amend><subsection ssid="23-17" dnum="_-o:a-i" numlevel="1" lineno="901" slineno="7-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1410" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">for a justice of the Supreme Court, a certification standard that requires the justice to <ln numlevel="1" lineno="902" slineno="7-28"/>have distributed to other members of the Supreme Court:</amend><subsection ssid="23-19" dnum="_-o:i-i" numlevel="1" lineno="903" slineno="7-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1411" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">no more than 25% of opinions more than 150 days after submission;</amend></subsection><subsection ssid="23-18" dnum="_-o:ii-i" numlevel="1" lineno="904" slineno="7-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1412" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">no more than 10% of opinions more than 210 days after submission; and</amend></subsection><subsection ssid="23-20" dnum="_-o:iii-i" numlevel="1" lineno="905" slineno="7-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1413" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">100% of all opinions within one year after submission; and</amend></subsection></subsection><subsection ssid="23-21" dnum="_-o:b-i" numlevel="1" lineno="906" slineno="7-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1414" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">for a judge of the Court of Appeals, a certification standard that requires the judge to <ln numlevel="1" lineno="907" slineno="7-33"/>have distributed to other members of a Court of Appeals' panel:</amend><subsection ssid="23-22" dnum="_-o:i-i" numlevel="1" lineno="908" slineno="7-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1415" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">no more than 25% of opinions more than 120 days after submission;</amend></subsection><subsection ssid="23-23" dnum="_-o:ii-i" numlevel="1" lineno="909" slineno="7-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1416" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">no more than 10% of opinions more than 180 days after submission; and</amend></subsection><subsection ssid="23-24" dnum="_-o:iii-i" numlevel="1" lineno="910" slineno="7-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1417" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">100% of all opinions within 270 days after submission.</amend></subsection></subsection></subsection><subsection ssid="23-null-6" dnum="2-o:4-i" numlevel="1" lineno="911" slineno="7-37" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1418" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1419" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>The commission may establish an additional certification standard if the <ln numlevel="1" lineno="912" slineno="7-38"/>commission by at least two-thirds vote:<subsection ssid="23-null-7" dnum="a-o" numlevel="1" lineno="913" slineno="7-39" level="2"><display>(a)</display>determines that satisfaction of the standard is necessary to the satisfactory <ln numlevel="1" lineno="914" slineno="7-40"/>performance of the judge; and</subsection><subsection ssid="23-null-8" dnum="b-o" numlevel="1" lineno="915" slineno="7-41" level="2"><display>(b)</display>adopts the standard.</subsection></subsection><subsection ssid="23-null-9" dnum="3-o:5-i" numlevel="1" lineno="916" slineno="7-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1421" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1422" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>The commission may make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="917" slineno="7-43"/>Administrative Rulemaking Act</xref>, to establish a certification standard.</subsection></section></bsec><bsec buid="15" num="78A-12-206" type="amend" src="code" uid="C78A-12-S206_2026050620260506" sort="78A12 02060020260506" numlevel="1" lineno="918" slineno="8-1" sn="8"><section number="78A-12-206" numlevel="1" lineno="919" slineno="8-2" type="amend"><secline lineno="918">Section 8. Section <bold>78A-12-206</bold> is amended to read:</secline><catline lineno="919"><bold>78A-12-206<parens/>. Publication of the judicial performance evaluation -- Response by <ln numlevel="1" lineno="920" slineno="8-3"/>judge.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="921" slineno="8-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="15-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission shall compile a retention report of the commission's judicial <ln numlevel="1" lineno="922" slineno="8-5"/>performance evaluation of a judge.</subsection><subsection ssid="15-null-3" dnum="b-o" numlevel="1" lineno="923" slineno="8-6" level="2"><display>(b)</display>The report of a judicial performance evaluation nearest the judge's next scheduled <ln numlevel="1" lineno="924" slineno="8-7"/>retention election shall be provided to the judge at least 45 days before the last day on <ln numlevel="1" lineno="925" slineno="8-8"/>which the judge may file a declaration of the judge's candidacy in the retention <ln numlevel="1" lineno="926" slineno="8-9"/>election.</subsection><subsection ssid="15-null-4" dnum="c-o" numlevel="1" lineno="927" slineno="8-10" level="2"><display>(c)</display>A report prepared in accordance with Subsection <xref depth="4" refnumber="78A-12-206(1)(b)" start="0">(1)(b)</xref> and information obtained in <ln numlevel="1" lineno="928" slineno="8-11"/>connection with the evaluation becomes a public record under <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, <ln numlevel="1" lineno="929" slineno="8-12"/>Government Records Access and Management Act</xref>, on the day following the last day <ln numlevel="1" lineno="930" slineno="8-13"/>on which the judge who is the subject of the report may file a declaration of the <ln numlevel="1" lineno="931" slineno="8-14"/>judge's candidacy in the judge's scheduled retention election if the judge declares the <ln numlevel="1" lineno="932" slineno="8-15"/>judge's candidacy for the retention election.</subsection><subsection ssid="15-null-5" dnum="d-o" numlevel="1" lineno="933" slineno="8-16" level="2"><display>(d)</display>Information collected and a report that is not public under Subsection <xref depth="4" refnumber="78A-12-206(1)(c)" start="0">(1)(c)</xref> is a <ln numlevel="1" lineno="934" slineno="8-17"/>protected record under <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="935" slineno="8-18"/>Management Act</xref>.</subsection></subsection><subsection ssid="15-null-6" dnum="2-o" numlevel="1" lineno="936" slineno="8-19" level="1"><display>(2)</display>Within 15 days of receiving a copy of the commission's report under Subsection <xref depth="4" refnumber="78A-12-206(1)(b)" start="0">(1)(b)</xref>:<subsection ssid="15-null-7" dnum="a-o" numlevel="1" lineno="937" slineno="8-20" level="2"><display>(a)</display>a judge who is the subject of an unfavorable action under Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">78A-12-203(4)</xref> <ln numlevel="1" lineno="938" slineno="8-21"/>may:<subsection ssid="15-null-8" dnum="i-o" numlevel="1" lineno="939" slineno="8-22" level="3"><display>(i)</display>provide a written response to the commission about the report; and</subsection><subsection ssid="15-null-9" dnum="ii-o" numlevel="1" lineno="940" slineno="8-23" level="3"><display>(ii)</display>request an interview with the commission for the purpose of addressing the <ln numlevel="1" lineno="941" slineno="8-24"/>report; and</subsection></subsection><subsection ssid="15-null-10" dnum="b-o" numlevel="1" lineno="942" slineno="8-25" level="2"><display>(b)</display>a judge who is the subject of a favorable action under Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">78A-12-203(4)</xref> <ln numlevel="1" lineno="943" slineno="8-26"/>may provide a written response to the commission about the commission's report.</subsection></subsection><subsection ssid="15-null-11" dnum="3-o" numlevel="1" lineno="944" slineno="8-27" level="1" space="false"><display>(3)</display><subsection ssid="15-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After receiving a response from a judge in any form allowed by Subsection <xref depth="4" refnumber="78A-12-206(2)" start="0">(2)</xref>, <ln numlevel="1" lineno="945" slineno="8-28"/>the commission may meet and reconsider the commission's action.</subsection><subsection ssid="15-null-13" dnum="b-o" numlevel="1" lineno="946" slineno="8-29" level="2"><display>(b)</display>If the commission does not change the commission's action, the judge may provide a <ln numlevel="1" lineno="947" slineno="8-30"/>written statement, not to exceed 100 words, that shall be included in the commission's <ln numlevel="1" lineno="948" slineno="8-31"/>report.</subsection></subsection><subsection ssid="15-null-14" dnum="4-o" numlevel="1" lineno="949" slineno="8-32" level="1"><display>(4)</display>The retention report of a judicial performance evaluation shall include:<subsection ssid="15-null-15" dnum="a-o" numlevel="1" lineno="950" slineno="8-33" level="2"><display>(a)</display>the results of the judicial performance survey, in both raw and summary form;</subsection><subsection ssid="15-null-16" dnum="b-o" numlevel="1" lineno="951" slineno="8-34" level="2"><display>(b)</display>information concerning the judge's compliance with the certification standards, <ln numlevel="1" lineno="952" slineno="8-35"/>including stating how many of the certification standards the judge met;</subsection><subsection ssid="15-null-17" dnum="c-o" numlevel="1" lineno="953" slineno="8-36" level="2"><display>(c)</display>information concerning any public discipline that a judge has received that is not <ln numlevel="1" lineno="954" slineno="8-37"/>subject to restrictions on disclosure under <xref depth="1" refnumber="78A-11" start="0">Title 78A, Chapter 11, Judicial Conduct <ln numlevel="1" lineno="955" slineno="8-38"/>Commission</xref>;</subsection><subsection ssid="15-null-18" dnum="d-o" numlevel="1" lineno="956" slineno="8-39" level="2"><display>(d)</display>a narrative concerning the judge's performance;</subsection><subsection ssid="15-null-19" dnum="e-o" numlevel="1" lineno="957" slineno="8-40" level="2"><display>(e)</display>the commission's determination under Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0">78A-12-203(4)</xref>;</subsection><subsection ssid="15-null-20" dnum="f-o" numlevel="1" lineno="958" slineno="8-41" level="2"><display>(f)</display>the number of votes for and against a determination described in Subsection <xref depth="4" refnumber="78A-12-203(4)" start="0"><ln numlevel="1" lineno="959" slineno="8-42"/>78A-12-203(4)</xref>; and</subsection><subsection ssid="15-null-21" dnum="g-o" numlevel="1" lineno="960" slineno="8-43" level="2"><display>(g)</display>any other information the commission considers necessary to include in the report to <ln numlevel="1" lineno="961" slineno="8-44"/>explain the certification standards and the determination or lack of a determination <ln numlevel="1" lineno="962" slineno="8-45"/>made.</subsection></subsection><subsection ssid="15-32" dnum="_-o:5-i" numlevel="1" lineno="963" slineno="8-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1443" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">The retention report of a judicial performance evaluation may include the number of <ln numlevel="1" lineno="964" slineno="8-47"/>times that the judge has been overturned on appeal for an abuse of discretion for the <ln numlevel="1" lineno="965" slineno="8-48"/>current reporting period.</amend></subsection><subsection ssid="15-null-22" dnum="5-o:6-i" numlevel="1" lineno="966" slineno="8-49" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1444" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1445" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="15-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission may not include in the commission's retention report <ln numlevel="1" lineno="967" slineno="8-50"/>specific information concerning an earlier judicial performance evaluation.</subsection><subsection ssid="15-null-24" dnum="b-o" numlevel="1" lineno="968" slineno="8-51" level="2"><display>(b)</display>The commission may refer to information from an earlier judicial performance <ln numlevel="1" lineno="969" slineno="8-52"/>evaluation concerning the judge in the commission's report only if necessary to <ln numlevel="1" lineno="970" slineno="8-53"/>explain performance in the current reporting period and giving primary emphasis to <ln numlevel="1" lineno="971" slineno="8-54"/>the information gathered during the current reporting period.</subsection></subsection><subsection ssid="15-null-25" dnum="6-o:7-i" numlevel="1" lineno="972" slineno="8-55" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1447" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1448" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>The retention report of the commission's judicial performance evaluation shall be <ln numlevel="1" lineno="973" slineno="8-56"/>made publicly available on an <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">internet</amend> website.</subsection><subsection ssid="15-null-26" dnum="7-o:8-i" numlevel="1" lineno="974" slineno="8-57" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1448" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1449" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>The commission may make the report of the judicial performance evaluation <ln numlevel="1" lineno="975" slineno="8-58"/>immediately preceding the judge's retention election publicly available through other <ln numlevel="1" lineno="976" slineno="8-59"/>means within budgetary constraints.</subsection><subsection ssid="15-null-27" dnum="8-o:9-i" numlevel="1" lineno="977" slineno="8-60" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1449" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1450" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>The commission shall provide a summary of the judicial performance evaluation <ln numlevel="1" lineno="978" slineno="8-61"/>for each judge to the lieutenant governor for publication in the voter information <ln numlevel="1" lineno="979" slineno="8-62"/>pamphlet in the manner required by <xref depth="1" refnumber="20A-7" start="0">Title 20A, Chapter 7, Issues Submitted to the Voters</xref>.</subsection><subsection ssid="15-null-28" dnum="9-o:10-i" numlevel="1" lineno="980" slineno="8-63" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1450" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1451" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>The commission shall provide the Judicial Council with:<subsection ssid="15-null-29" dnum="a-o" numlevel="1" lineno="981" slineno="8-64" level="2"><display>(a)</display>the judicial performance survey results for each judge; and</subsection><subsection ssid="15-null-30" dnum="b-o" numlevel="1" lineno="982" slineno="8-65" level="2"><display>(b)</display>a copy of the retention report of each judicial performance evaluation.</subsection></subsection><subsection ssid="15-null-31" dnum="10-o:11-i" numlevel="1" lineno="983" slineno="8-66" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1453" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1454" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>The Judicial Council shall provide information obtained concerning a judge <ln numlevel="1" lineno="984" slineno="8-67"/>under Subsection <xref depth="4" refnumber="78A-12-206(9)" start="0">(9)</xref> to the subject judge's presiding judge, if any.</subsection></section></bsec><bsec buid="3" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="985" slineno="9-1" sn="9"><secline>Section 9. <bold>Repealer.</bold></secline><rhead
