McKell</sponsorhead><otherSponsorhead>House Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill removes a provision that allows a chemical substance to be used as a bonding <ln numlevel="1" lineno="6" slineno="0-6"/>agent to secure a load in a vehicle.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">removes a provision that allows a chemical substance to be used as a bonding agent to <ln numlevel="1" lineno="10" slineno="0-10"/>secure a load in a vehicle.</hl></hp><moni numlevel="1" lineno="11" slineno="0-11" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="12">None</moniNone><oc numlevel="1" lineno="13" slineno="0-13">Other Special Clauses:</oc><ocNone lineno="14">None</ocNone><sa numlevel="1" lineno="15" slineno="0-15">Utah Code Sections Affected:<saamd numlevel="1" lineno="16" slineno="0-16"><snhead>AMENDS:</snhead><sn num="72-7-409" src="code" uid="C72-7-S409_2026050620260506" buid="1" sort="72 07 04090020260506" numlevel="1" lineno="17" slineno="0-17"><bold>72-7-409</bold>, as last amended by Laws of Utah 2025, Chapter 393</sn></saamd></sa></lt><enacthead lineno="18"/><enact numlevel="1" lineno="19" slineno="0-19">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="72-7-409" type="amend" src="code" uid="C72-7-S409_2026050620260506" sort="72 07 04090020260506" numlevel="1" lineno="20" slineno="1-1" sn="1"><section number="72-7-409" numlevel="1" lineno="21" slineno="1-2" type="amend"><secline lineno="20">Section 1. Section <bold>72-7-409</bold> is amended to read:</secline><catline lineno="21"><bold>72-7-409<parens/>. Loads on vehicles -- Limitations -- Confining, securing, and fastening <ln numlevel="1" lineno="22" slineno="1-3"/>load required -- Penalty.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="23" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="24" slineno="1-5" level="2"><display>(a)</display>"Agricultural product" means any raw product which is derived from agriculture, <ln numlevel="1" lineno="25" slineno="1-6"/>including silage, hay, straw, grain, manure, and other similar product.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="26" slineno="1-7" level="2" space="false"><display>(b)</display><subsection ssid="1-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Unsecured load" means the contents of a vehicle, operated on a highway, not <ln numlevel="1" lineno="27" slineno="1-8"/>sufficiently covered, confined, fastened, or otherwise secured in a way to prevent <ln numlevel="1" lineno="28" slineno="1-9"/>the contents from escaping the vehicle.</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="29" slineno="1-10" level="3"><display>(ii)</display>"Unsecured load" includes materials such as dirt, sand, gravel, rock fragments, <ln numlevel="1" lineno="30" slineno="1-11"/>pebbles, crushed base, aggregate, any other similar material, or scrap metal or <ln numlevel="1" lineno="31" slineno="1-12"/>other loose material on any portion of the vehicle not designed to carry the <ln numlevel="1" lineno="32" slineno="1-13"/>material.</subsection></subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="33" slineno="1-14" level="2"><display>(c)</display>"Vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection></subsection><subsection ssid="1-null-7" dnum="2-o" numlevel="1" lineno="34" slineno="1-15" level="1"><display>(2)</display>Except as provided in Subsections <xref depth="4" refnumber="72-7-409(3)" start="0">(3)</xref> through <xref depth="4" refnumber="72-7-409(5)" start="0">(5)</xref>, a person may not:<subsection ssid="1-null-8" dnum="a-o" numlevel="1" lineno="35" slineno="1-16" level="2"><display>(a)</display>operate a vehicle with an unsecured load on any highway; or</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="36" slineno="1-17" level="2"><display>(b)</display>operate a vehicle carrying trash or garbage without a covering over the entire load.</subsection></subsection><subsection ssid="1-null-10" dnum="3-o" numlevel="1" lineno="37" slineno="1-18" level="1" space="false"><display>(3)</display><subsection ssid="1-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A vehicle carrying dirt, sand, gravel, rock fragments, pebbles, crushed base, <ln numlevel="1" lineno="38" slineno="1-19"/>aggregate, any other similar material, or scrap metal shall have a covering over the <ln numlevel="1" lineno="39" slineno="1-20"/>entire load unless:<subsection ssid="1-null-12" dnum="i-o" numlevel="1" lineno="40" slineno="1-21" level="3" tab="1"><display>(i)</display>the highest point of the load does not extend above the top of any exterior wall or <ln numlevel="1" lineno="41" slineno="1-22"/>sideboard of the cargo compartment of the vehicle; and</subsection><subsection ssid="1-null-13" dnum="ii-o" numlevel="1" lineno="42" slineno="1-23" level="3" tab="1"><display>(ii)</display>the outer edges of the load are at least six inches below the top inside edges of the <ln numlevel="1" lineno="43" slineno="1-24"/>exterior walls or sideboards of the cargo compartment of the vehicle.</subsection></subsection><subsection ssid="1-null-14" dnum="b-o" numlevel="1" lineno="44" slineno="1-25" level="2"><display>(b)</display>The following material is exempt from the provisions of Subsection <xref depth="4" refnumber="72-7-409(3)(a)" start="0">(3)(a)</xref>:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="45" slineno="1-26" level="3"><display>(i)</display>hot mix asphalt;</subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="46" slineno="1-27" level="3"><display>(ii)</display>construction debris or scrap metal if the debris or scrap metal is a size and in a <ln numlevel="1" lineno="47" slineno="1-28"/>form not susceptible to being blown out of the vehicle;</subsection><subsection ssid="1-null-17" dnum="iii-o" numlevel="1" lineno="48" slineno="1-29" level="3"><display>(iii)</display>material being transported across a highway between two parcels of property that <ln numlevel="1" lineno="49" slineno="1-30"/>would be contiguous but for the highway that is being crossed; and</subsection><subsection ssid="1-null-18" dnum="iv-o" numlevel="1" lineno="50" slineno="1-31" level="3"><display>(iv)</display>material listed under Subsection <xref depth="4" refnumber="72-7-409(3)(a)" start="0">(3)(a)</xref> that is enclosed on all sides by containers, <ln numlevel="1" lineno="51" slineno="1-32"/>bags, or packaging.</subsection></subsection><subsection ssid="1-null-19" dnum="c-o:_-i" numlevel="1" lineno="52" slineno="1-33" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">A chemical substance capable of coating or bonding a load so that the load is <ln numlevel="1" lineno="53" slineno="1-34"/>confined on a vehicle, may be considered a covering for purposes of Subsection <xref depth="4" refnumber="72-7-409(3)(a)" start="0">(3)(a)</xref> <ln numlevel="1" lineno="54" slineno="1-35"/>so long as the chemical substance remains effective at confining the load.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-20" dnum="4-o" numlevel="1" lineno="55" slineno="1-36" level="1"><display>(4)</display>Subsection <xref depth="4" refnumber="72-7-409(2)" start="0">(2)</xref> does not apply to a vehicle or implement of husbandry carrying an <ln numlevel="1" lineno="56" slineno="1-37"/>agricultural product, if the agricultural product is:<subsection ssid="1-null-21" dnum="a-o" numlevel="1" lineno="57" slineno="1-38" level="2"><display>(a)</display>being transported in a manner which is not a hazard or a potential hazard to the safe <ln numlevel="1" lineno="58" slineno="1-39"/>operation of the vehicle or to other highway users; and</subsection><subsection ssid="1-null-22" dnum="b-o" numlevel="1" lineno="59" slineno="1-40" level="2"><display>(b)</display>loaded in a manner that only allows minimal spillage.</subsection></subsection><subsection ssid="1-null-23" dnum="5-o" numlevel="1" lineno="60" slineno="1-41" level="1" space="false"><display>(5)</display><subsection ssid="1-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorized vehicle performing snow removal services on a highway is exempt <ln numlevel="1" lineno="61" slineno="1-42"/>from the requirements of this section.</subsection><subsection ssid="1-null-25" dnum="b-o" numlevel="1" lineno="62" slineno="1-43" level="2"><display>(b)</display>This section does not prohibit the necessary spreading of any substance connected <ln numlevel="1" lineno="63" slineno="1-44"/>with highway maintenance, construction, securing traction, or snow removal.</subsection></subsection><subsection ssid="1-null-26" dnum="6-o" numlevel="1" lineno="64" slineno="1-45" level="1" space="false"><display>(6)</display><subsection ssid="1-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any person suspected of operating a vehicle with an unsecured load on a highway <ln numlevel="1" lineno="65" slineno="1-46"/>may be issued a warning.</subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="66" slineno="1-47" level="2"><display>(b)</display>Any person who violates this section is guilty of:<subsection ssid="1-null-29" dnum="i-o" numlevel="1" lineno="67" slineno="1-48" level="3"><display>(i)</display>an infraction, if the violation creates a hazard but does not lead to a motor vehicle <ln numlevel="1" lineno="68" slineno="1-49"/>accident;</subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="69" slineno="1-50" level="3"><display>(ii)</display>a class B misdemeanor, if the violation creates a hazard that leads to a motor <ln numlevel="1" lineno="70" slineno="1-51"/>vehicle accident; or</subsection><subsection ssid="1-null-31" dnum="iii-o" numlevel="1" lineno="71" slineno="1-52" level="3"><display>(iii)</display>a class A misdemeanor, if the violation creates a hazard that leads to a motor <ln numlevel="1" lineno="72" slineno="1-53"/>vehicle accident that results in the serious bodily injury or death of a person.</subsection></subsection><subsection ssid="1-null-32" dnum="c-o" numlevel="1" lineno="73" slineno="1-54" level="2"><display>(c)</display>A person who violates a provision of this section shall be fined not less than:<subsection ssid="1-null-33" dnum="i-o" numlevel="1" lineno="74" slineno="1-55" level="3"><display>(i)</display>$200 for a violation; or</subsection><subsection ssid="1-null-34" dnum="ii-o" numlevel="1" lineno="75" slineno="1-56" level="3"><display>(ii)</display>$500 for a second or subsequent violation within six years of a previous violation <ln numlevel="1" lineno="76" slineno="1-57"/>of this section.</subsection></subsection><subsection ssid="1-null-35" dnum="d-o" numlevel="1" lineno="77" slineno="1-58" level="2"><display>(d)</display>A person who violates a provision of this section while operating a commercial <ln numlevel="1" lineno="78" slineno="1-59"/>vehicle as defined in Section <xref depth="3" refnumber="72-9-102" start="0">72-9-102</xref> shall be fined:<subsection ssid="1-null-36" dnum="i-o" numlevel="1" lineno="79" slineno="1-60" level="3"><display>(i)</display>not less than $500 for a violation; or</subsection><subsection ssid="1-null-37" dnum="ii-o" numlevel="1" lineno="80" slineno="1-61" level="3"><display>(ii)</display>$1,000 for a second or subsequent violation within six years of a previous <ln numlevel="1" lineno="81" slineno="1-62"/>violation of this section.</subsection></subsection></subsection><subsection ssid="1-null-38" dnum="7-o" numlevel="1" lineno="82" slineno="1-63" level="1"><display>(7)</display>As resources and opportunities allow, the department shall implement programs or <ln numlevel="1" lineno="83" slineno="1-64"/>activities that increase public awareness on the importance of properly securing loads.</subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="84" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="84">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="85"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-6-26 10:27 AM</tm></rev></foot></leg>
