Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill enacts the Uniform Community Property Disposition at Death Act.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">specifies which personal and real property is treated as community property at death <ln numlevel="1" lineno="10" slineno="0-10"/>based on the domicile of the spouses and the law of the jurisdiction where the property <ln numlevel="1" lineno="11" slineno="0-11"/>was acquired;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">excludes property that spouses partition, reclassify, or waive by agreement;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">establishes requirements for how community-property spouses may partition, reclassify, <ln numlevel="1" lineno="14" slineno="0-14"/>or waive rights to community property;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">creates a presumption that property acquired while domiciled in a community-property <ln numlevel="1" lineno="16" slineno="0-16"/>jurisdiction is community property unless rebutted by a preponderance of the evidence;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">provides that one-half of community property belongs to the surviving <ln numlevel="1" lineno="18" slineno="0-18"/>community-property spouse and one-half belongs to the decedent and is subject to <ln numlevel="1" lineno="19" slineno="0-19"/>disposition at death;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">clarifies that a decedent's share of community property is not subject to the elective-share <ln numlevel="1" lineno="21" slineno="0-21"/>right of the surviving community-property spouse;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">authorizes a court to apply equitable principles and consider the law of other jurisdictions <ln numlevel="1" lineno="23" slineno="0-23"/>when resolving community-property claims at death;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">establishes time limits and procedures for claims brought by a surviving <ln numlevel="1" lineno="25" slineno="0-25"/>community-property spouse, an heir, a devisee, and a nonprobate transferee;</hl><hl numlevel="1" lineno="26" slineno="0-26" level="1">protects third parties who transact in good faith and for value with a community-property <ln numlevel="1" lineno="27" slineno="0-27"/>spouse or estate representative;</hl><hl numlevel="1" lineno="28" slineno="0-28" level="1">directs the court to construe the chapter to promote uniformity with other states that enact Section <bold>75-2c-101</bold> is enacted to read:</secline><catline lineno="67"><bold>75-2c-101<parens/>. amendtag="end">"Community-property spouse" means an individual in a marriage or other relationship:</amend><subsection ssid="3-2" dnum="_-o:a-i" numlevel="1" lineno="70" slineno="1-5" ea="amend"
