Section <bold>17-62-204</bold> is amended to read:</secline><catline lineno="28"><bold>17-62-204<parens/>. Council-manager form of county government -- Establishment of <ln numlevel="1" lineno="29" slineno="1-3"/>voting districts.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section, "district" means a geographic area within the boundaries of a <ln numlevel="1" lineno="31" slineno="1-5"/>county with a council-manager form of government that is represented only by one <ln numlevel="1" lineno="32" slineno="1-6"/>council member who:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="33" slineno="1-7" level="2"><display>(a)</display>resides in the district;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="34" slineno="1-8" level="2"><display>(b)</display>represents only the district where the member resides; and</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="35" slineno="1-9" level="2"><display>(c)</display>is elected only by voters who reside in the same district as the district where the <ln numlevel="1" lineno="36" slineno="1-10"/>member resides, and that the member represents.</subsection></subsection><subsection ssid="5-null-5" dnum="2-o" numlevel="1" lineno="37" slineno="1-11" level="1" space="false"><display>(2)</display><subsection ssid="5-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The following shall govern a county operating under the form of government <ln numlevel="1" lineno="38" slineno="1-12"/>known as the "council-manager" form:<subsection ssid="5-null-7" dnum="i-o" numlevel="1" lineno="39" slineno="1-13" level="3" tab="1"><display>(i)</display>an elected county council;</subsection><subsection ssid="5-null-8" dnum="ii-o" numlevel="1" lineno="40" slineno="1-14" level="3" tab="1"><display>(ii)</display>a county manager appointed by the <amend anum="0" ea="amend" pairid="190" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>council; and</subsection><subsection ssid="5-null-9" dnum="iii-o" numlevel="1" lineno="41" slineno="1-15" level="3" tab="1"><display>(iii)</display>other <amend anum="0" ea="amend" pairid="191" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>officers and employees authorized by law.</subsection></subsection><subsection ssid="5-null-10" dnum="b-o" numlevel="1" lineno="42" slineno="1-16" level="2"><display>(b)</display>The optional plan shall provide for the <amend anum="0" ea="amend" pairid="303" groupid="214" style="1" owner="jchristopherson" level="1" amendtag="both">county manager's:</amend><subsection ssid="5-139" dnum="_-o:i-i" numlevel="1" lineno="43" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>qualifications<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="307" groupid="218" style="2" owner="jchristopherson" level="1" deltag="both">, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="305" groupid="216" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="5-138" dnum="_-o:ii-i" numlevel="1" lineno="44" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="316" groupid="226" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsection <xref level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both">(v)</amend></display>removal<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="410" groupid="306" style="2" owner="jchristopherson" level="1" deltag="both"> of the county manager</amend><amendoutend style="2"/>.</subsection></subsection></subsection><subsection ssid="5-107" dnum="_-o:3-i" numlevel="1" lineno="49" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="5-133" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">In a council-manager form of government, the county council:</amend><subsection ssid="5-131" dnum="_-o:i-i" numlevel="1" lineno="50" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="197" groupid="135" style="1" owner="jchristopherson" level="1" amendtag="end">is the legislative body; and</amend></subsection><subsection ssid="5-132" dnum="_-o:ii-i" numlevel="1" lineno="51" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="139" style="1" owner="jchristopherson" level="1" amendtag="end">is vested with the executive powers of the county.</amend></subsection></subsection><subsection ssid="5-113" dnum="_-o:b-i" numlevel="1" lineno="52" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">The chair of the legislative body shall ratify an executive action taken by the county <ln numlevel="1" lineno="53" slineno="1-27"/>council.</amend></subsection></subsection><subsection ssid="5-null-11" dnum="3-o:4-i" numlevel="1" lineno="54" slineno="1-28" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start" space="true">(4)</amend></display><subsection ssid="5-128" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="end">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="175" groupid="117" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="174" groupid="116" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A</amend> county manager is the administrative head of the county government <ln numlevel="1" lineno="55" slineno="1-29"/>and has the powers, functions, and duties<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both"> of a county executive, except:</amend><amendoutend style="2"/><subsection ssid="5-null-12" dnum="a-o:_-i" numlevel="1" lineno="56" slineno="1-30" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="23" groupid="18" style="2" owner="jchristopherson" level="1" deltag="end">as</amend><amendoutend style="2"/> the county legislative body<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both"> otherwise</amend><amendoutend style="2"/> provides by ordinance<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="412" groupid="308" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="5-null-13" dnum="b-o:_-i" numlevel="1" lineno="57" slineno="1-31" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="33" groupid="22" style="2" owner="jchristopherson" level="1" deltag="end">that the county manager may not veto any ordinances enacted by the council.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-127" dnum="_-o:b-i" numlevel="1" lineno="58" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">A county legislative body may not:</amend><subsection ssid="5-134" dnum="_-o:i-i" numlevel="1" lineno="59" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">delegate to a county manager the powers, functions, and duties of a county <ln numlevel="1" lineno="60" slineno="1-34"/>executive;</amend></subsection><subsection ssid="5-137" dnum="_-o:ii-i" numlevel="1" lineno="61" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="253" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="end">delegate to a county manager the powers, functions, and duties of an elected <ln numlevel="1" lineno="62" slineno="1-36"/>county officer, including the county officers described in Section <xref depth="3" refnumber="17-66-102">17-66-102</xref>; or</amend></subsection><subsection ssid="5-135" dnum="_-o:iii-i" numlevel="1" lineno="63" slineno="1-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">require an elected county officer or head of a county department to report to the <ln numlevel="1" lineno="64" slineno="1-38"/>county manager.</amend></subsection></subsection></subsection><subsection ssid="5-122" dnum="_-o:5-i" numlevel="1" lineno="65" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="5-129" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">A county manager is an at-will employee of the county.</amend></subsection><subsection ssid="5-123" dnum="_-o:b-i" numlevel="1" lineno="66" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">On or after May 6, 2026, a legislative body may not approve an employment contract <ln numlevel="1" lineno="67" slineno="1-41"/>with a county manager that includes:</amend><subsection ssid="5-124" dnum="_-o:i-i" numlevel="1" lineno="68" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">a term of employment that automatically renews, or that is longer than four years;</amend></subsection><subsection ssid="5-125" dnum="_-o:ii-i" numlevel="1" lineno="69" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">severance or other benefits to be provided to the county manager if the legislative <ln numlevel="1" lineno="70" slineno="1-44"/>body chooses to terminate the county manager's employment with the county; or</amend></subsection><subsection ssid="5-126" dnum="_-o:iii-i" numlevel="1" lineno="71" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">pay increases that are automatic or are different than county practices or policies <ln numlevel="1" lineno="72" slineno="1-46"/>governing pay increases for other at-will county employees.</amend></subsection></subsection></subsection><subsection ssid="5-null-14" dnum="4-o:6-i" numlevel="1" lineno="73" slineno="1-47" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="5-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual member of the <amend anum="0" ea="amend" pairid="254" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>council may not directly or indirectly, by <ln numlevel="1" lineno="74" slineno="1-48"/>suggestion or otherwise:<subsection ssid="5-null-16" dnum="i-o" numlevel="1" lineno="75" slineno="1-49" level="3" tab="1"><display>(i)</display>attempt to influence or coerce the <amend anum="0" ea="amend" pairid="186" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>manager in:<subsection ssid="5-null-17" dnum="A-o" numlevel="1" lineno="76" slineno="1-50" level="4"><display>(A)</display>making any appointment;</subsection><subsection ssid="5-null-18" dnum="B-o" numlevel="1" lineno="77" slineno="1-51" level="4"><display>(B)</display>removing any officer or employee; or</subsection><subsection ssid="5-null-19" dnum="C-o" numlevel="1" lineno="78" slineno="1-52" level="4"><display>(C)</display>purchasing supplies;</subsection></subsection><subsection ssid="5-null-20" dnum="ii-o" numlevel="1" lineno="79" slineno="1-53" level="3" tab="1"><display>(ii)</display>attempt to exact any promise relative to any appointment from any candidate for <ln numlevel="1" lineno="80" slineno="1-54"/>manager; or</subsection><subsection ssid="5-null-21" dnum="iii-o" numlevel="1" lineno="81" slineno="1-55" level="3" tab="1"><display>(iii)</display>discuss directly or indirectly with the <amend anum="0" ea="amend" pairid="275" groupid="187" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>manager the matter of specific <ln numlevel="1" lineno="82" slineno="1-56"/>appointments to any county office or employment<amend anum="0" ea="amend" pairid="187" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="both">, including a salary adjustment <ln numlevel="1" lineno="83" slineno="1-57"/>for an elected county officer</amend>.</subsection></subsection><subsection ssid="5-null-22" dnum="b-o" numlevel="1" lineno="84" slineno="1-58" level="2" space="false"><display>(b)</display><subsection ssid="5-null-23" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A member of the county council who violates the provisions of this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="290" groupid="202" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="17-52a-204(4)"><ln numlevel="1" lineno="85" slineno="1-59"/>(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="276" groupid="188" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)</amend> shall forfeit the member's county council office.</subsection><subsection ssid="5-null-24" dnum="ii-o" numlevel="1" lineno="86" slineno="1-60" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="291" groupid="203" style="2" owner="jchristopherson" level="1" deltag="both">Nothing in this section shall be construed, however, as prohibiting the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="277" groupid="189" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">This <ln numlevel="1" lineno="87" slineno="1-61"/>section does not prohibit the county</amend> council from fully and freely discussing with <ln numlevel="1" lineno="88" slineno="1-62"/>or suggesting to the <amend anum="0" ea="amend" pairid="278" groupid="190" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>manager anything pertaining to county affairs or the <ln numlevel="1" lineno="89" slineno="1-63"/>interests of the county.</subsection><subsection ssid="5-null-25" dnum="iii-o" numlevel="1" lineno="90" slineno="1-64" level="3"><display>(iii)</display>The county manager may not take part in securing, or contributing any money <ln numlevel="1" lineno="91" slineno="1-65"/>toward, the nomination or election of any candidate for a county office.</subsection><subsection ssid="5-null-26" dnum="iv-o" numlevel="1" lineno="92" slineno="1-66" level="3"><display>(iv)</display>The optional plan may provide procedures for implementing this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="292" groupid="204" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="17-52a-204(4)">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="279" groupid="191" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">If a county council appoints an interim county manager under Subsection <xref depth="4" refnumber="17-62-204(8)(b)(i)">(8)(b)(i)</xref>, <ln numlevel="1" lineno="117" slineno="1-91"/>the county council shall appoint a new county manager after the interim vacancy <ln numlevel="1" lineno="118" slineno="1-92"/>period ends</amend>.</subsection></subsection></subsection><subsection ssid="5-null-42" dnum="c-o" numlevel="1" lineno="119" slineno="1-93" level="2"><display>(c)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="295" groupid="207" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="17-52a-204(7)(b)">(7)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="284" groupid="196" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)(b)</amend> does not apply if all the county council members who held <ln numlevel="1" lineno="120" slineno="1-94"/>office on the day <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="380" groupid="281" style="2" owner="jchristopherson" level="1" deltag="both">of the county general election whose term of office was vacant for <ln numlevel="1" lineno="121" slineno="1-95"/>the election</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="378" groupid="279" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the interim vacancy period ends</amend> are re-elected to the council for the <ln numlevel="1" lineno="122" slineno="1-96"/>following term.</subsection></subsection><subsection ssid="5-null-43" dnum="8-o:_-i" numlevel="1" lineno="123" slineno="1-97" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="start">(8)</amend></display><amend anum="0" ea="erase" pairid="259" groupid="171" style="2" owner="jchristopherson" level="1" deltag="end">A county council that appoints a county manager in accordance with this section may <ln numlevel="1" lineno="124" slineno="1-98"/>not enter into an employment contract that contains an automatic renewal provision with <ln numlevel="1" lineno="125" slineno="1-99"/>the county manager.</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-44" dnum="9-o" numlevel="1" lineno="126" slineno="1-100" level="1" space="false"><display>(9)</display><subsection ssid="5-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="17-52a-204(9)(b)">(9)(b)</xref> and <xref depth="4" refnumber="17-52a-204(10)">(10)</xref>, beginning on May 7, 2025, a <ln numlevel="1" lineno="127" slineno="1-101"/>county with a council-manager form of government shall ensure that each <amend anum="0" ea="amend" pairid="285" groupid="197" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend><ln numlevel="1" lineno="128" slineno="1-102"/>council member:<subsection ssid="5-null-46" dnum="i-o" numlevel="1" lineno="129" slineno="1-103" level="3" tab="1"><display>(i)</display>represents a single district, rather than being elected at-large;</subsection><subsection ssid="5-null-47" dnum="ii-o" numlevel="1" lineno="130" slineno="1-104" level="3" tab="1"><display>(ii)</display>is elected by a majority vote of voters residing within the <amend anum="0" ea="amend" pairid="286" groupid="198" style="1" owner="jchristopherson" level="1" amendtag="both">county council </amend><ln numlevel="1" lineno="131" slineno="1-105"/>member's district; and</subsection><subsection ssid="5-null-48" dnum="iii-o" numlevel="1" lineno="132" slineno="1-106" level="3" tab="1"><display>(iii)</display>except as provided in Subsections <xref depth="4" refnumber="17-52a-204(12)(a)(iii)">(12)(a)(iii)</xref> and <xref depth="4" refnumber="17-52a-204(12)(b)">(12)(b)</xref>, resides in the district <ln numlevel="1" lineno="133" slineno="1-107"/>the <amend anum="0" ea="amend" pairid="287" groupid="199" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>council member represents.</subsection></subsection><subsection ssid="5-null-49" dnum="b-o" numlevel="1" lineno="134" slineno="1-108" level="2"><display>(b)</display>A county with a council-manager form of government where at least 65% of county <ln numlevel="1" lineno="135" slineno="1-109"/>council members meet the qualifications of Subsection <xref depth="4" refnumber="17-52a-204(9)(a)">(9)(a)</xref> on and after May 7, <ln numlevel="1" lineno="136" slineno="1-110"/>2025, may continue to have one or more county council members elected at-large.</subsection><subsection ssid="5-null-50" dnum="c-o" numlevel="1" lineno="137" slineno="1-111" level="2"><display>(c)</display>A county that adopts a council-manager form of government after May 7, 2025, shall <ln numlevel="1" lineno="138" slineno="1-112"/>ensure that all county council members meet the qualifications described in <ln numlevel="1" lineno="139" slineno="1-113"/>Subsection <xref depth="4" refnumber="17-52a-204(9)(a)">(9)(a)</xref>.</subsection></subsection><subsection ssid="5-null-51" dnum="10-o" numlevel="1" lineno="140" slineno="1-114" level="1"><display>(10)</display>For a county with a council-manager form of government that does not comply with <ln numlevel="1" lineno="141" slineno="1-115"/>Subsection <xref refnumber="17-52a-204(9)(a)" depth="4">(9)(a)</xref> on May 7, 2025, and to which the exception in Subsection <xref refnumber="17-52a-204(9)(b)" depth="4">(9)(b)</xref> does <ln numlevel="1" lineno="142" slineno="1-116"/>not apply, the county council shall:<subsection ssid="5-null-52" dnum="a-o" numlevel="1" lineno="143" slineno="1-117" level="2"><display>(a)</display>on or before June 1, 2025, establish a districting commission in accordance with <ln numlevel="1" lineno="144" slineno="1-118"/>Subsection <xref depth="4" refnumber="17-52a-204(11)">(11)</xref>;</subsection><subsection ssid="5-null-53" dnum="b-o" numlevel="1" lineno="145" slineno="1-119" level="2"><display>(b)</display>by October 15, 2025, hold a public meeting at which:<subsection ssid="5-null-54" dnum="i-o" numlevel="1" lineno="146" slineno="1-120" level="3"><display>(i)</display>the county council shall adopt the proposed district map submitted as described in <ln numlevel="1" lineno="147" slineno="1-121"/>Subsection <xref depth="4" refnumber="17-52a-204(11)(d)">(11)(d)</xref>; and</subsection><subsection ssid="5-null-55" dnum="ii-o" numlevel="1" lineno="148" slineno="1-122" level="3"><display>(ii)</display>the county clerk shall designate a current council member to represent each <ln numlevel="1" lineno="149" slineno="1-123"/>district for the remainder of the county council member's term of office in <ln numlevel="1" lineno="150" slineno="1-124"/>accordance with Subsection <xref depth="4" refnumber="17-52a-204(12)">(12)</xref>; and</subsection></subsection><subsection ssid="5-null-56" dnum="c-o" numlevel="1" lineno="151" slineno="1-125" level="2"><display>(c)</display>implement the district map adopted under Subsection <xref depth="4" refnumber="17-52a-204(10)(b)(i)">(10)(b)(i)</xref> for the next county <ln numlevel="1" lineno="152" slineno="1-126"/>council election.</subsection></subsection><subsection ssid="5-null-57" dnum="11-o" numlevel="1" lineno="153" slineno="1-127" level="1"><display>(11)</display>A county districting commission established under Subsection <xref depth="4" refnumber="17-52a-204(10)">(10)</xref> shall:<subsection ssid="5-null-58" dnum="a-o" numlevel="1" lineno="154" slineno="1-128" level="2"><display>(a)</display>consist of:<subsection ssid="5-null-59" dnum="i-o" numlevel="1" lineno="155" slineno="1-129" level="3"><display>(i)</display>one representative from each municipality located wholly within the county, who <ln numlevel="1" lineno="156" slineno="1-130"/>is either the municipality's mayor or a municipal resident whom the mayor <ln numlevel="1" lineno="157" slineno="1-131"/>appoints;</subsection><subsection ssid="5-null-60" dnum="ii-o" numlevel="1" lineno="158" slineno="1-132" level="3"><display>(ii)</display>one representative who resides in an unincorporated area of the county, appointed <ln numlevel="1" lineno="159" slineno="1-133"/>by the county council; and</subsection><subsection ssid="5-null-61" dnum="iii-o" numlevel="1" lineno="160" slineno="1-134" level="3"><display>(iii)</display>the county clerk, or the county clerk's designee, as a non-voting member;</subsection></subsection><subsection ssid="5-null-62" dnum="b-o" numlevel="1" lineno="161" slineno="1-135" level="2"><display>(b)</display>select by majority vote the chair of the districting commission from among the <ln numlevel="1" lineno="162" slineno="1-136"/>membership of the districting commission;</subsection><subsection ssid="5-null-63" dnum="c-o" numlevel="1" lineno="163" slineno="1-137" level="2"><display>(c)</display>divide the county into districts by:<subsection ssid="5-null-64" dnum="i-o" numlevel="1" lineno="164" slineno="1-138" level="3"><display>(i)</display>using the total population enumeration of the most recent decennial census to <ln numlevel="1" lineno="165" slineno="1-139"/>ensure that there is less than 10% total population deviation between each district;</subsection><subsection ssid="5-null-65" dnum="ii-o" numlevel="1" lineno="166" slineno="1-140" level="3"><display>(ii)</display>ensuring that each district is contiguous and reasonably compact;</subsection><subsection ssid="5-null-66" dnum="iii-o" numlevel="1" lineno="167" slineno="1-141" level="3"><display>(iii)</display>drawing district boundary lines that, to the extent practicable, do not divide <ln numlevel="1" lineno="168" slineno="1-142"/>existing voting precincts; and</subsection><subsection ssid="5-null-67" dnum="iv-o" numlevel="1" lineno="169" slineno="1-143" level="3"><display>(iv)</display>complying with the United States Constitution; and</subsection></subsection><subsection ssid="5-null-68" dnum="d-o" numlevel="1" lineno="170" slineno="1-144" level="2"><display>(d)</display>by no later than October 1, 2025, submit a proposed district map to the county <ln numlevel="1" lineno="171" slineno="1-145"/>council that:<subsection ssid="5-null-69" dnum="i-o" numlevel="1" lineno="172" slineno="1-146" level="3"><display>(i)</display>is recommended by a majority of districting commission members; and</subsection><subsection ssid="5-null-70" dnum="ii-o" numlevel="1" lineno="173" slineno="1-147" level="3"><display>(ii)</display>complies with the requirements of Subsection <xref depth="4" refnumber="17-52a-204(11)(c)">(11)(c)</xref>.</subsection></subsection></subsection><subsection ssid="5-null-71" dnum="12-o" numlevel="1" lineno="174" slineno="1-148" level="1" space="false"><display>(12)</display><subsection ssid="5-null-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For a county council that adopts a district map described in Subsection <xref depth="4" refnumber="17-52a-204(10)(b)">(10)(b)</xref>, <ln numlevel="1" lineno="175" slineno="1-149"/>the county clerk shall designate one current county council member to serve each <ln numlevel="1" lineno="176" slineno="1-150"/>district for the remainder of the county council member's term as follows:<subsection ssid="5-null-73" dnum="i-o" numlevel="1" lineno="177" slineno="1-151" level="3" tab="1"><display>(i)</display>if only one county council member lives in a district in an adopted district map, <ln numlevel="1" lineno="178" slineno="1-152"/>the county clerk shall assign that county council member to represent that district;</subsection><subsection ssid="5-null-74" dnum="ii-o" numlevel="1" lineno="179" slineno="1-153" level="3" tab="1"><display>(ii)</display>if more than one county council member lives in a district in an adopted district <ln numlevel="1" lineno="180" slineno="1-154"/>map, the county clerk shall draw lots and assign one county council member to <ln numlevel="1" lineno="181" slineno="1-155"/>represent the district; and</subsection><subsection ssid="5-null-75" dnum="iii-o" numlevel="1" lineno="182" slineno="1-156" level="3" tab="1"><display>(iii)</display>if no county council members live in a district in an adopted district map, the <ln numlevel="1" lineno="183" slineno="1-157"/>county clerk shall draw lots and assign from the county council members not <ln numlevel="1" lineno="184" slineno="1-158"/>already assigned under Subsections <xref depth="4" refnumber="17-52a-204(12)(a)(i)">(12)(a)(i)</xref> and <xref depth="4" refnumber="17-52a-204(ii)">(ii)</xref> one county council member <ln numlevel="1" lineno="185" slineno="1-159"/>to represent each district.</subsection></subsection><subsection ssid="5-null-76" dnum="b-o" numlevel="1" lineno="186" slineno="1-160" level="2"><display>(b)</display>For a county council member assigned under Subsection <xref depth="4" refnumber="17-52a-204(12)(a)(iii)">(12)(a)(iii)</xref> to represent a <ln numlevel="1" lineno="187" slineno="1-161"/>district in which the county council member does not live, the county council <ln numlevel="1" lineno="188" slineno="1-162"/>member is eligible to hold the county council member's seat in the assigned district <ln numlevel="1" lineno="189" slineno="1-163"/>until the end of the term that the county council member was in on October 15, 2025, <ln numlevel="1" lineno="190" slineno="1-164"/>unless earlier disqualified by another provision of law.</subsection></subsection><subsection ssid="5-null-77" dnum="13-o" numlevel="1" lineno="191" slineno="1-165" level="1" space="false"><display>(13)</display><subsection ssid="5-null-78" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After a county implements a district map for the election of county council <ln numlevel="1" lineno="192" slineno="1-166"/>members, a county may not redistrict until: <subsection ssid="5-null-79" dnum="i-o" numlevel="1" lineno="193" slineno="1-167" level="3" tab="1"><display>(i)</display>an official decennial census publicly releases population data for the county, <ln numlevel="1" lineno="194" slineno="1-168"/>unless otherwise required by law; or</subsection><subsection ssid="5-null-80" dnum="ii-o" numlevel="1" lineno="195" slineno="1-169" level="3" tab="1"><display>(ii)</display>population growth in the county results in greater than 10% population deviation <ln numlevel="1" lineno="196" slineno="1-170"/>between districts.</subsection></subsection><subsection ssid="5-null-81" dnum="b-o" numlevel="1" lineno="197" slineno="1-171" level="2"><display>(b)</display>Each time a county conducts redistricting for the county council districts, the county <ln numlevel="1" lineno="198" slineno="1-172"/>council shall redistrict by:<subsection ssid="5-null-82" dnum="i-o" numlevel="1" lineno="199" slineno="1-173" level="3"><display>(i)</display>adjusting districts in a proposed district map by:<subsection ssid="5-null-83" dnum="A-o" numlevel="1" lineno="200" slineno="1-174" level="4"><display>(A)</display>using the total population enumeration of the most recent decennial census to <ln numlevel="1" lineno="201" slineno="1-175"/>ensure that there is less than 10% total population deviation between each <ln numlevel="1" lineno="202" slineno="1-176"/>district;</subsection><subsection ssid="5-null-84" dnum="B-o" numlevel="1" lineno="203" slineno="1-177" level="4"><display>(B)</display>ensuring that each district is contiguous and reasonably compact;</subsection><subsection ssid="5-null-85" dnum="C-o" numlevel="1" lineno="204" slineno="1-178" level="4"><display>(C)</display>drawing district boundary lines that, to the extent practicable, do not divide <ln numlevel="1" lineno="205" slineno="1-179"/>existing voting precincts; and</subsection><subsection ssid="5-null-86" dnum="D-o" numlevel="1" lineno="206" slineno="1-180" level="4"><display>(D)</display>complying with the United States Constitution; and</subsection></subsection><subsection ssid="5-null-87" dnum="ii-o" numlevel="1" lineno="207" slineno="1-181" level="3"><display>(ii)</display>after drawing a proposed district map, holding a public meeting, at which the <ln numlevel="1" lineno="208" slineno="1-182"/>county council shall: <subsection ssid="5-null-88" dnum="A-o" numlevel="1" lineno="209" slineno="1-183" level="4"><display>(A)</display>adopt the map as proposed; or </subsection><subsection ssid="5-null-89" dnum="B-o" numlevel="1" lineno="210" slineno="1-184" level="4"><display>(B)</display>revise the map and, if the revised map fulfills the requirements of Subsection <xref depth="4" refnumber="17-52a-204(13)(b)(i)"><ln numlevel="1" lineno="211" slineno="1-185"/>(13)(b)(i)</xref>, adopt the revised map.</subsection></subsection></subsection></subsection><subsection ssid="5-null-90" dnum="14-o" numlevel="1" lineno="212" slineno="1-186" level="1" space="false"><display>(14)</display><subsection ssid="5-null-91" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A voter in a county that fails to comply with the requirements of Subsections <xref depth="4" refnumber="17-52a-204(9)">(9)</xref> <ln numlevel="1" lineno="213" slineno="1-187"/>through <xref depth="4" refnumber="17-52a-204(13)">(13)</xref> may commence suit in a court of competent jurisdiction to compel <ln numlevel="1" lineno="214" slineno="1-188"/>compliance with, or enjoin a violation of, Subsections <xref depth="4" refnumber="17-52a-204(9)">(9)</xref> through <xref depth="4" refnumber="17-52a-204(13)">(13)</xref>.</subsection><subsection ssid="5-null-92" dnum="b-o" numlevel="1" lineno="215" slineno="1-189" level="2"><display>(b)</display>The court may award reasonable attorney fees and court costs to a successful <ln numlevel="1" lineno="216" slineno="1-190"/>plaintiff.</subsection></subsection><subsection ssid="5-null-93" dnum="15-o" numlevel="1" lineno="217" slineno="1-191" level="1"><display>(15)</display>Beginning January 1, 2026, for a county that fails to comply with the requirements of <ln numlevel="1" lineno="218" slineno="1-192"/>Subsections <xref depth="4" refnumber="17-52a-204(9)">(9)</xref> through <xref depth="4" refnumber="17-52a-204(13)">(13)</xref>, in addition to the remedies described in Subsection <xref depth="4" refnumber="17-52a-204(14)">(14)</xref>, <ln numlevel="1" lineno="219" slineno="1-193"/>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="436" groupid="313" style="2" owner="jchristopherson" level="1" deltag="both">state tax commission</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="435" groupid="312" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">State Tax Commission</amend> may suspend disbursements of <ln numlevel="1" lineno="220" slineno="1-194"/>transient room tax revenue to the county until the county establishes that the county is in <ln numlevel="1" lineno="221" slineno="1-195"/>compliance with Subsections <xref depth="4" refnumber="17-52a-204(9)">(9)</xref> through <xref depth="4" refnumber="17-52a-204(13)">(13)</xref>.</subsection></section></bsec><bsec buid="1" num="17-65-301" type="amend" src="code" uid="C17-65-S301_2026050620260506" sort="17 65 03010020260506" numlevel="1" lineno="222" slineno="2-1" sn="2"><section number="17-65-301" numlevel="1" lineno="223" slineno="2-2" type="amend"><secline lineno="222">Section 2. Section <bold>17-65-301</bold> is amended to read:</secline><catline lineno="223"><bold>17-65-301<parens/>. General powers, duties, and functions.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="224" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The elected county executive is the chief executive officer of the county.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="225" slineno="2-4" level="1"><display>(2)</display>Each county executive shall exercise all executive powers, have all executive duties, <ln numlevel="1" lineno="226" slineno="2-5"/>and perform all executive functions of the county, including those enumerated in this <ln numlevel="1" lineno="227" slineno="2-6"/>chapter, except as expressly provided otherwise in statute and except as contrary to the <ln numlevel="1" lineno="228" slineno="2-7"/>powers,  duties, and functions of other county officers expressly provided for in:<subsection ssid="1-null-3" dnum="a-o" numlevel="1" lineno="229" slineno="2-8" level="2"><display>(a)</display><xref depth="1" refnumber="17-66">Chapter 66, County Officers and Officials Generally</xref>;</subsection><subsection ssid="1-null-4" dnum="b-o" numlevel="1" lineno="230" slineno="2-9" level="2"><display>(b)</display><xref depth="1" refnumber="17-67">Chapter 67, County Assessor</xref>;</subsection><subsection ssid="1-null-5" dnum="c-o" numlevel="1" lineno="231" slineno="2-10" level="2"><display>(c)</display><xref depth="1" refnumber="17-68">Chapter 68, County and District Attorney</xref>;</subsection><subsection ssid="1-null-6" dnum="d-o" numlevel="1" lineno="232" slineno="2-11" level="2"><display>(d)</display><xref depth="1" refnumber="17-69">Chapter 69, County Auditor</xref>;</subsection><subsection ssid="1-null-7" dnum="e-o" numlevel="1" lineno="233" slineno="2-12" level="2"><display>(e)</display><xref depth="1" refnumber="17-70">Chapter 70, County Clerk</xref>;</subsection><subsection ssid="1-null-8" dnum="f-o" numlevel="1" lineno="234" slineno="2-13" level="2"><display>(f)</display><xref depth="1" refnumber="17-71">Chapter 71, County Recorder</xref>;</subsection><subsection ssid="1-null-9" dnum="g-o" numlevel="1" lineno="235" slineno="2-14" level="2"><display>(g)</display><xref depth="1" refnumber="17-72">Chapter 72, County Sheriff</xref>;</subsection><subsection ssid="1-null-10" dnum="h-o" numlevel="1" lineno="236" slineno="2-15" level="2"><display>(h)</display><xref depth="1" refnumber="17-73">Chapter 73, County Surveyor</xref>; and</subsection><subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="237" slineno="2-16" level="2"><display>(i)</display><xref depth="1" refnumber="17-74">Chapter 74, County Treasurer</xref>.</subsection></subsection><subsection ssid="1-null-12" dnum="3-o" numlevel="1" lineno="238" slineno="2-17" level="1"><display>(3)</display>A county executive may take any action required by law and necessary to the full <ln numlevel="1" lineno="239" slineno="2-18"/>discharge of the <amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">county </amend>executive's duties, even though the action is not expressly <ln numlevel="1" lineno="240" slineno="2-19"/>authorized in statute.</subsection><subsection ssid="1-13" dnum="_-o:4-i" numlevel="1" lineno="241" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An unelected county employee or officer may not perform the duties of an elected <ln numlevel="1" lineno="242" slineno="2-21"/>county executive.</amend></subsection></section></bsec><bsec buid="10" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="243" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="243">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="244"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-6-26 10:57 AM</tm></rev></foot></leg>
