Section <bold>53E-3-203</bold> is amended to read:</secline><catline lineno="23"><bold>53E-3-203<parens/>. State board meetings -- Quorum requirements.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="24" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The state board shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-4" dnum="_-o:a-i" numlevel="1" lineno="25" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>meet at the call of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">chairman</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">chair</amend> and at least 11 times each year<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-5" dnum="_-o:b-i" numlevel="1" lineno="26" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">at least 72 hours before holding the meeting required under Subsection <xref depth="4" refnumber="53E-3-203(1)(a)">(1)(a)</xref>, <ln numlevel="1" lineno="27" slineno="1-6"/>publish an agenda for the meeting on the state board's website.</amend></subsection></subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="28" slineno="1-7" level="1"><display>(2)</display>A majority of all members is required to validate an act of the state board.</subsection></section></bsec><bsec buid="2" num="53G-4-202" type="amend" src="code" uid="C53G-4-S202_2026050620260506" sort="53G04 02020020260506" numlevel="1" lineno="29" slineno="2-1" sn="2"><section number="53G-4-202" numlevel="1" lineno="30" slineno="2-2" type="amend"><secline lineno="29">Section 2. Section <bold>53G-4-202</bold> is amended to read:</secline><catline lineno="30"><bold>53G-4-202<parens/>. Local school board meetings -- Rules of order and procedure -- <ln numlevel="1" lineno="31" slineno="2-3"/>Location requirements -- Expulsion of members prohibited -- Exceptions.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="32" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="33" slineno="2-5" level="2"><display>(a)</display>"Disaster" means an event that:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="34" slineno="2-6" level="3"><display>(i)</display>causes, or threatens to cause, loss of life, human suffering, public or private <ln numlevel="1" lineno="35" slineno="2-7"/>property damage, or economic or social disruption resulting from attack, internal <ln numlevel="1" lineno="36" slineno="2-8"/>disturbance, natural phenomenon, or technological hazard; and</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="37" slineno="2-9" level="3"><display>(ii)</display>requires resources that are beyond the scope of local agencies in routine responses <ln numlevel="1" lineno="38" slineno="2-10"/>to emergencies and accidents and may be of a magnitude or involve unusual <ln numlevel="1" lineno="39" slineno="2-11"/>circumstances that require a response by a governmental, not-for-profit, or private <ln numlevel="1" lineno="40" slineno="2-12"/>entity.</subsection></subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="41" slineno="2-13" level="2"><display>(b)</display>"Local emergency" means a condition in any municipality or county of the state that <ln numlevel="1" lineno="42" slineno="2-14"/>requires that emergency assistance be provided by the affected municipality or <ln numlevel="1" lineno="43" slineno="2-15"/>county or another political subdivision to save lives and protect property within its <ln numlevel="1" lineno="44" slineno="2-16"/>jurisdiction in response to a disaster or to avoid or reduce the threat of a disaster.</subsection><subsection ssid="2-null-6" dnum="c-o" numlevel="1" lineno="45" slineno="2-17" level="2"><display>(c)</display>"Rules of order and procedure" means a set of policies that governs and prescribes in <ln numlevel="1" lineno="46" slineno="2-18"/>a public meeting:<subsection ssid="2-null-7" dnum="i-o" numlevel="1" lineno="47" slineno="2-19" level="3"><display>(i)</display>parliamentary order and procedure;</subsection><subsection ssid="2-null-8" dnum="ii-o" numlevel="1" lineno="48" slineno="2-20" level="3"><display>(ii)</display>ethical behavior; and</subsection><subsection ssid="2-null-9" dnum="iii-o" numlevel="1" lineno="49" slineno="2-21" level="3"><display>(iii)</display>civil discourse.</subsection></subsection></subsection><subsection ssid="2-null-10" dnum="2-o" numlevel="1" lineno="50" slineno="2-22" level="1"><display>(2)</display>Subject to Subsection <xref depth="4" refnumber="53G-4-202(4)" start="0">(4)</xref>, a local school board shall:<subsection ssid="2-null-11" dnum="a-o" numlevel="1" lineno="51" slineno="2-23" level="2"><display>(a)</display>adopt rules of order and procedure to govern a public meeting of the local school <ln numlevel="1" lineno="52" slineno="2-24"/>board;</subsection><subsection ssid="2-null-12" dnum="b-o" numlevel="1" lineno="53" slineno="2-25" level="2"><display>(b)</display>conduct a public meeting in accordance with the rules of order and procedure <ln numlevel="1" lineno="54" slineno="2-26"/>described in Subsection <xref depth="4" refnumber="53G-4-202(2)(a)" start="0">(2)(a)</xref>;</subsection><subsection ssid="2-33" dnum="_-o:c-i" numlevel="1" lineno="55" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">at least 72 hours before holding a public meeting, publish an agenda for the meeting <ln numlevel="1" lineno="56" slineno="2-28"/>on the local school board's website;</amend> and</subsection><subsection ssid="2-null-13" dnum="c-o:d-i" numlevel="1" lineno="57" slineno="2-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>make the rules of order and procedure described in Subsection <xref depth="4" refnumber="53G-4-202(2)(a)" start="0">(2)(a)</xref> available to <ln numlevel="1" lineno="58" slineno="2-30"/>the public:<subsection ssid="2-null-14" dnum="i-o" numlevel="1" lineno="59" slineno="2-31" level="3"><display>(i)</display>at each public meeting of the local school board; and</subsection><subsection ssid="2-null-15" dnum="ii-o" numlevel="1" lineno="60" slineno="2-32" level="3"><display>(ii)</display>on the local school board's public website, if available.</subsection></subsection></subsection><subsection ssid="2-null-16" dnum="3-o" numlevel="1" lineno="61" slineno="2-33" level="1" space="false"><display>(3)</display><subsection ssid="2-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="53G-4-202(3)(b)" start="0">(3)(b)</xref> and <xref depth="4" refnumber="53G-4-202(3)(c)" start="0">(c)</xref>, a local school board may not <ln numlevel="1" lineno="62" slineno="2-34"/>hold a public meeting outside of the geographic boundary of the local school board's <ln numlevel="1" lineno="63" slineno="2-35"/>school district.</subsection><subsection ssid="2-null-18" dnum="b-o" numlevel="1" lineno="64" slineno="2-36" level="2"><display>(b)</display>A local school board may hold a public meeting outside of the geographic boundary <ln numlevel="1" lineno="65" slineno="2-37"/>of the local school board's school district if it is necessary for the local school board <ln numlevel="1" lineno="66" slineno="2-38"/>to hold a meeting during a disaster or local emergency.</subsection><subsection ssid="2-null-19" dnum="c-o" numlevel="1" lineno="67" slineno="2-39" level="2"><display>(c)</display>A local school board may hold a public meeting outside of the geographic boundary <ln numlevel="1" lineno="68" slineno="2-40"/>of the local school board's school district to conduct a site visit if:<subsection ssid="2-null-20" dnum="i-o" numlevel="1" lineno="69" slineno="2-41" level="3"><display>(i)</display>the location of the site visit provides the local school board members the <ln numlevel="1" lineno="70" slineno="2-42"/>opportunity to see or experience an activity that:<subsection ssid="2-null-21" dnum="A-o" numlevel="1" lineno="71" slineno="2-43" level="4"><display>(A)</display>relates to the local school board's responsibilities; and</subsection><subsection ssid="2-null-22" dnum="B-o" numlevel="1" lineno="72" slineno="2-44" level="4"><display>(B)</display>does not exist within the geographic boundaries of the local school board's <ln numlevel="1" lineno="73" slineno="2-45"/>school district; and</subsection></subsection><subsection ssid="2-null-23" dnum="ii-o" numlevel="1" lineno="74" slineno="2-46" level="3"><display>(ii)</display>the local school board does not vote or take other action during the public <ln numlevel="1" lineno="75" slineno="2-47"/>meeting held at the site visit location.</subsection></subsection><subsection ssid="2-null-24" dnum="d-o" numlevel="1" lineno="76" slineno="2-48" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="53G-4-202(3)" start="0">(3)</xref> does not apply to a charter school governing board.</subsection></subsection><subsection ssid="2-null-25" dnum="4-o" numlevel="1" lineno="77" slineno="2-49" level="1"><display>(4)</display>The requirements of this section do not affect a local school board's duty to comply with <xref depth="1" refnumber="52-4" start="0"><ln numlevel="1" lineno="78" slineno="2-50"/>Title 52, Chapter 4, Open and Public Meetings Act</xref>.</subsection><subsection ssid="2-null-26" dnum="5-o" numlevel="1" lineno="79" slineno="2-51" level="1" space="false"><display>(5)</display><subsection ssid="2-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-4-202(5)(b)" start="0">(5)(b)</xref>, a local school board may not expel a <ln numlevel="1" lineno="80" slineno="2-52"/>member of the local school board from an open public meeting or prohibit the <ln numlevel="1" lineno="81" slineno="2-53"/>member from attending an open public meeting.</subsection><subsection ssid="2-null-28" dnum="b-o" numlevel="1" lineno="82" slineno="2-54" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-4-202(5)(c)" start="0">(5)(c)</xref>, following a two-thirds vote of the members <ln numlevel="1" lineno="83" slineno="2-55"/>of the local school board, the local school board may fine or expel a member of the <ln numlevel="1" lineno="84" slineno="2-56"/>local school board for:<subsection ssid="2-null-29" dnum="i-o" numlevel="1" lineno="85" slineno="2-57" level="3"><display>(i)</display>disorderly conduct at the open public meeting;</subsection><subsection ssid="2-null-30" dnum="ii-o" numlevel="1" lineno="86" slineno="2-58" level="3"><display>(ii)</display>a member's direct or indirect financial conflict of interest regarding an issue <ln numlevel="1" lineno="87" slineno="2-59"/>discussed at or action proposed to be taken at the open public meeting; or</subsection><subsection ssid="2-null-31" dnum="iii-o" numlevel="1" lineno="88" slineno="2-60" level="3"><display>(iii)</display>a commission of a crime during the open public meeting.</subsection></subsection><subsection ssid="2-null-32" dnum="c-o" numlevel="1" lineno="89" slineno="2-61" level="2"><display>(c)</display>A local school board may adopt policies or ordinances that expand the reasons or <ln numlevel="1" lineno="90" slineno="2-62"/>establish more restrictive procedures for the expulsion of a member from a public <ln numlevel="1" lineno="91" slineno="2-63"/>meeting.</subsection></subsection></section></bsec><bsec buid="3" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="92" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="92">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="93"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-6-26 1:16 PM</tm></rev></foot></leg>
