Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill creates the Collections and Housing Court.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">establishes the Collections and Housing Court (court);</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">addresses the postjudgment interest rate of the court;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">addresses retention elections for judges of the court, including the ballot language for a <ln numlevel="1" lineno="11" slineno="0-11"/>retention election;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">adds a judge of the court to the definition of "public official" with respect to gifts;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">addresses the salary of the judge of the court;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">establishes the court as a court of record;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">provides that the court is not geographically divided into districts;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">provides that the court consists of one judge;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">amends the membership of the Judicial Council to include a member of the court;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">allows the presiding officer of the Judicial Council to assign a judge of the court to serve <ln numlevel="1" lineno="19" slineno="0-19"/>in the district court if the assignment does not interfere with actions before the <ln numlevel="1" lineno="20" slineno="0-20"/>Collections and Housing Court;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">amends provisions regarding the administration of the courts to address the creation of the <ln numlevel="1" lineno="22" slineno="0-22"/>court;</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">addresses a judicial hiring freeze for judges of the court;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">amends the jurisdiction of the district court to allow a district court judge to preside over <ln numlevel="1" lineno="25" slineno="0-25"/>an action of the court for purposes of disqualification and recusal; </hl><hl numlevel="1" lineno="26" slineno="0-26" level="1">defines terms related to the court; </hl><hl numlevel="1" lineno="27" slineno="0-27" level="1">provides that the court is a trial court with statewide jurisdiction;</hl><hl numlevel="1" lineno="28" slineno="0-28" level="1">addresses the organization and status of the court; </hl><hl numlevel="1" lineno="29" slineno="0-29" level="1">addresses the jurisdiction of the court; </hl><hl numlevel="1" lineno="30" slineno="0-30" level="1">addresses the administration of the court, including: <hl numlevel="1" lineno="31" slineno="0-31" level="2">the terms for judges of the court; </hl><hl numlevel="1" lineno="32" slineno="0-32" level="2">the presiding judge and associate presiding judge of the court; and </hl><hl numlevel="1" lineno="33" slineno="0-33" level="2">staff and management of the court; </hl></hl><hl numlevel="1" lineno="34" slineno="0-34" level="1">addresses the location and facilities of the court;</hl><hl numlevel="1" lineno="35" slineno="0-35" level="1">addresses the selection process for judges of the court, including the creation of the <ln numlevel="1" lineno="36" slineno="0-36"/>Collections and Housing Court Nominating Commission;</hl><hl numlevel="1" lineno="37" slineno="0-37" level="1">makes changes to provisions regarding judgments, mileage, and lis pendens to address the <ln numlevel="1" lineno="38" Sec. 1961, as amended.</subsection></subsection><subsection ssid="28-null-2" dnum="2-o" numlevel="1" lineno="91" slineno="1-8" level="1" space="false"><display>(2)</display><subsection ssid="28-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="15-1-4(2)(b)" start="0">(2)(b)</xref>, a judgment rendered on a lawful contract <ln numlevel="1" lineno="92" slineno="1-9"/>shall conform to the contract and shall bear the interest agreed upon by the parties, <ln numlevel="1" lineno="93" slineno="1-10"/>which shall be specified in the judgment.</subsection><subsection ssid="28-null-4" dnum="b-o" numlevel="1" lineno="94" slineno="1-11" level="2"><display>(b)</display>A judgment rendered on a deferred deposit loan subject to <xref depth="1" refnumber="7-23" start="0">Title 7, Chapter 23, Check <ln numlevel="1" lineno="95" slineno="1-12"/>Cashing and Deferred Deposit Lending Registration Act</xref>, shall bear interest at the rate <ln numlevel="1" lineno="96" slineno="1-13"/>imposed under Subsection <xref depth="4" refnumber="15-1-4(3)(a)" start="0">(3)(a)</xref> on an amount not exceeding the sum of:<subsection ssid="28-null-5" dnum="i-o" numlevel="1" lineno="97" slineno="1-14" level="3"><display>(i)</display>the total of the principal balance of the deferred deposit loan;</subsection><subsection ssid="28-null-6" dnum="ii-o" numlevel="1" lineno="98" slineno="1-15" level="3"><display>(ii)</display>interest at the rate imposed by the deferred deposit loan agreement for a period <ln numlevel="1" lineno="99" slineno="1-16"/>not exceeding 10 weeks as provided in Subsection <xref depth="4" refnumber="7-23-401(4)" start="0">7-23-401(4)</xref>;</subsection><subsection ssid="28-null-7" dnum="iii-o" numlevel="1" lineno="100" slineno="1-17" level="3"><display>(iii)</display>costs;</subsection><subsection ssid="28-null-8" dnum="iv-o" numlevel="1" lineno="101" slineno="1-18" level="3"><display>(iv)</display>attorney fees; and</subsection><subsection ssid="28-null-9" dnum="v-o" numlevel="1" lineno="102" slineno="1-19" level="3"><display>(v)</display>other amounts allowed by law and ordered by the court.</subsection></subsection></subsection><subsection ssid="28-null-10" dnum="3-o" numlevel="1" lineno="103" slineno="1-20" level="1" space="false"><display>(3)</display><subsection ssid="28-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as otherwise provided by law, or as governed by Subsection <xref depth="4" refnumber="15-1-4(4)" start="0">(4)</xref>, all other <ln numlevel="1" lineno="104" slineno="1-21"/>final civil and criminal judgments of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">the district court, the justice court, and the <ln numlevel="1" lineno="105" slineno="1-22"/>Business and Chancery Court</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a court</amend> shall bear interest at the federal postjudgment <ln numlevel="1" lineno="106" slineno="1-23"/>interest rate as of January 1 of each year, plus 2%.</subsection><subsection ssid="28-null-12" dnum="b-o" numlevel="1" lineno="107" slineno="1-24" level="2"><display>(b)</display>The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">postjudgment interest rate</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">interest rate described in Subsection <xref depth="4" refnumber="15-1-4(3)(a)">(3)(a)</xref> that is</amend> in <ln numlevel="1" lineno="108" slineno="1-25"/>effect at the time of the judgment shall remain the interest rate for the duration of the <ln numlevel="1" lineno="109" slineno="1-26"/>judgment.</subsection><subsection ssid="28-null-13" dnum="c-o" numlevel="1" lineno="110" slineno="1-27" level="2"><display>(c)</display>The interest on criminal judgments shall be calculated on the total amount of the <ln numlevel="1" lineno="111" slineno="1-28"/>judgment.</subsection><subsection ssid="28-null-14" dnum="d-o" numlevel="1" lineno="112" slineno="1-29" level="2"><display>(d)</display>Interest paid on state revenue shall be deposited in accordance with Section <xref depth="3" refnumber="63A-3-505" start="0"><ln numlevel="1" lineno="113" slineno="1-30"/>63A-3-505</xref>.</subsection><subsection ssid="28-null-15" dnum="e-o" numlevel="1" lineno="114" slineno="1-31" level="2"><display>(e)</display>Interest paid on revenue to a county or municipality shall be paid to the general fund <ln numlevel="1" lineno="115" slineno="1-32"/>of the county or municipality.</subsection></subsection><subsection ssid="28-null-16" dnum="4-o" numlevel="1" lineno="116" slineno="1-33" level="1"><display>(4)</display>A judgment under $10,000 in an action regarding the purchase of goods and services <ln numlevel="1" lineno="117" slineno="1-34"/>shall bear interest from the date on which the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">district court, the justice court, or the <ln numlevel="1" lineno="118" slineno="1-35"/>Business and Chancery Court</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">court</amend> enters the judgment at 10% plus the federal <ln numlevel="1" lineno="119" slineno="1-36"/>postjudgment interest rate in effect on January 1 of the year in which the judgment is <ln numlevel="1" lineno="120" slineno="1-37"/>entered.</subsection></section></bsec><bsec buid="17" num="20A-12-201" type="amend" src="code" uid="C20A-12-S201_2027010120270101" sort="20A12 02010020270101" numlevel="1" lineno="121" slineno="2-1" sn="2"><section number="20A-12-201" numlevel="1" lineno="122" slineno="2-2" type="amend"><secline lineno="121">Section 2. Section <bold>20A-12-201</bold> is amended to read:</secline><catline lineno="122"><bold>20A-12-201<parens/>. Judicial appointees -- Retention elections.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="123" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="17-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each judicial appointee to a court is subject to an unopposed retention election at <ln numlevel="1" lineno="124" slineno="2-4"/>the first general election held more than three years after the judge or justice was <ln numlevel="1" lineno="125" slineno="2-5"/>appointed.</subsection><subsection ssid="17-null-3" dnum="b-o" numlevel="1" lineno="126" slineno="2-6" level="2"><display>(b)</display>After the first retention election:<subsection ssid="17-null-4" dnum="i-o" numlevel="1" lineno="127" slineno="2-7" level="3"><display>(i)</display>each Supreme Court justice shall be on the regular general election ballot for an <ln numlevel="1" lineno="128" slineno="2-8"/>unopposed retention election every tenth year; and</subsection><subsection ssid="17-null-5" dnum="ii-o" numlevel="1" lineno="129" slineno="2-9" level="3"><display>(ii)</display>each judge of other courts shall be on the regular general election ballot for an <ln numlevel="1" lineno="130" slineno="2-10"/>unopposed retention election every sixth year.</subsection></subsection></subsection><subsection ssid="17-null-6" dnum="2-o" numlevel="1" lineno="131" slineno="2-11" level="1" space="false"><display>(2)</display><subsection ssid="17-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each justice or judge of a court of record who wishes to retain office shall, in the <ln numlevel="1" lineno="132" slineno="2-12"/>year the justice or judge is subject to a retention election:<subsection ssid="17-null-8" dnum="i-o" numlevel="1" lineno="133" slineno="2-13" level="3" tab="1"><display>(i)</display>file a declaration of candidacy with the lieutenant governor, or with the county <ln numlevel="1" lineno="134" slineno="2-14"/>clerk in the candidate's county of residence, within the period beginning on July 1 <ln numlevel="1" lineno="135" slineno="2-15"/>and ending at 5 p.m. on July 15 in the year of a regular general election; and</subsection><subsection ssid="17-null-9" dnum="ii-o" numlevel="1" lineno="136" slineno="2-16" level="3" tab="1"><display>(ii)</display>pay a filing fee of $50.</subsection></subsection><subsection ssid="17-null-10" dnum="b-o" numlevel="1" lineno="137" slineno="2-17" level="2" space="false"><display>(b)</display><subsection ssid="17-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Each justice court judge who wishes to retain office shall, in the year the justice <ln numlevel="1" lineno="138" slineno="2-18"/>court judge is subject to a retention election:<subsection ssid="17-null-12" dnum="A-o" numlevel="1" lineno="139" slineno="2-19" level="4" tab="1"><display>(A)</display>file a declaration of candidacy with the lieutenant governor, or with the county <ln numlevel="1" lineno="140" slineno="2-20"/>clerk in the candidate's county of residence, within the period beginning on <ln numlevel="1" lineno="141" slineno="2-21"/>July 1 and ending at 5 p.m. on July 15 in the year of a regular general election; <ln numlevel="1" lineno="142" slineno="2-22"/>and</subsection><subsection ssid="17-null-13" dnum="B-o" numlevel="1" lineno="143" slineno="2-23" level="4" tab="1"><display>(B)</display>pay a filing fee of $25 for each judicial office.</subsection></subsection><subsection ssid="17-null-14" dnum="ii-o" numlevel="1" lineno="144" slineno="2-24" level="3"><display>(ii)</display>If a justice court judge is appointed or elected to more than one judicial office, the <ln numlevel="1" lineno="145" slineno="2-25"/>declaration of candidacy shall identify all of the courts included in the same <ln numlevel="1" lineno="146" slineno="2-26"/>general election.</subsection><subsection ssid="17-null-15" dnum="iii-o" numlevel="1" lineno="147" slineno="2-27" level="3"><display>(iii)</display>If a justice court judge is appointed or elected to more than one judicial office, <ln numlevel="1" lineno="148" slineno="2-28"/>filing a declaration of candidacy in one county in which one of those courts is <ln numlevel="1" lineno="149" slineno="2-29"/>located is valid for the courts in any other county.</subsection></subsection></subsection><subsection ssid="17-null-16" dnum="3-o" numlevel="1" lineno="150" slineno="2-30" level="1" space="false"><display>(3)</display><subsection ssid="17-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The lieutenant governor shall, no later than August 31 of each regular general <ln numlevel="1" lineno="151" slineno="2-31"/>election year:<subsection ssid="17-null-18" dnum="i-o" numlevel="1" lineno="152" slineno="2-32" level="3" tab="1"><display>(i)</display>transmit a certified list containing the names of the justices of the Supreme Court, <ln numlevel="1" lineno="153" slineno="2-33"/>judges of the Court of Appeals, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">and </amend><amendoutend style="2"/>judges of the Business and Chancery Court<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">, <ln numlevel="1" lineno="154" slineno="2-34"/>and judges of the Collections and Housing Court</amend> declaring their candidacy to the <ln numlevel="1" lineno="155" slineno="2-35"/>county clerk of each county; and</subsection><subsection ssid="17-null-19" dnum="ii-o" numlevel="1" lineno="156" slineno="2-36" level="3" tab="1"><display>(ii)</display>transmit a certified list containing the names of judges of other courts declaring <ln numlevel="1" lineno="157" slineno="2-37"/>their candidacy to the county clerk of each county in the geographic division in <ln numlevel="1" lineno="158" slineno="2-38"/>which the judge filing the declaration holds office.</subsection></subsection><subsection ssid="17-null-20" dnum="b-o" numlevel="1" lineno="159" slineno="2-39" level="2"><display>(b)</display>Each county clerk shall place the names of justices and judges standing for retention <ln numlevel="1" lineno="160" slineno="2-40"/>election:<subsection ssid="17-null-21" dnum="i-o" numlevel="1" lineno="161" slineno="2-41" level="3"><display>(i)</display>in the nonpartisan section of the ballot; and</subsection><subsection ssid="17-null-22" dnum="ii-o" numlevel="1" lineno="162" slineno="2-42" level="3"><display>(ii)</display>in accordance with Section <xref depth="3" refnumber="20A-6-109">20A-6-109</xref>.</subsection></subsection></subsection><subsection ssid="17-null-23" dnum="4-o" numlevel="1" lineno="163" slineno="2-43" level="1" space="false"><display>(4)</display><subsection ssid="17-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At the general election, the ballots shall contain:<subsection ssid="17-null-25" dnum="i-o" numlevel="1" lineno="164" slineno="2-44" level="3" tab="1" format="full"><display>(i)</display>at the beginning of the judicial retention section of the ballot, the following statement:<eol numlevel="1" lineno="165" slineno="2-45"/><para/>"Visit judges.utah.gov to learn about the Judicial Performance Evaluation Commission's <ln numlevel="1" lineno="166" slineno="2-46"/>recommendations for each judge"; and</subsection><subsection ssid="17-35" dnum="_-o:ii-i" numlevel="1" lineno="167" slineno="2-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">for each justice or judge standing for a retention election in the county, the <ln numlevel="1" lineno="168" slineno="2-48"/>following question: "Shall [insert name of justice or judge] be retained in the <ln numlevel="1" lineno="169" slineno="2-49"/>office of [insert name of office and the applicable court or jurisdiction]? Yes ( ) or <ln numlevel="1" lineno="170" slineno="2-50"/>No ( ).<marker pairid="13"/>"</amend></subsection><subsection ssid="17-null-26" dnum="ii-o:_-i" numlevel="1" lineno="171" slineno="2-51" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1" format="full"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1044" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1">as to each justice or judge of any court to be voted on in the county, the following <ln numlevel="1" lineno="172" slineno="2-52"/>question:</amend><eol numlevel="1" lineno="173" slineno="2-53"/><para/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1">"Shall ______________________________(name of justice or judge) be retained in the <ln numlevel="1" lineno="174" slineno="2-54"/>office of ___________________________? (name of office, such as "Justice of the Supreme <ln numlevel="1" lineno="175" slineno="2-55"/>Court of Utah"; "Judge of the Court of Appeals of Utah"; "Judge of the Business and Chancery <ln numlevel="1" lineno="176" slineno="2-56"/>Court of Utah"; "Judge of the District Court of the Third Judicial District"; "Judge of the <ln numlevel="1" lineno="177" slineno="2-57"/>Juvenile Court of the Fourth Juvenile Court District"; "Justice Court Judge of (name of county) <ln numlevel="1" lineno="178" slineno="2-58"/>County or (name of municipality)")</amend><eol numlevel="1" lineno="179" slineno="2-59"/><para/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1">Yes ()</amend><eol numlevel="1" lineno="180" slineno="2-60"/><para/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">No ()."</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="17-null-27" dnum="b-o" numlevel="1" lineno="181" slineno="2-61" level="2"><display>(b)</display>If a justice court exists by means of an interlocal agreement under Section <xref depth="3" refnumber="78A-7-102" start="0">78A-7-102</xref>, <ln numlevel="1" lineno="182" slineno="2-62"/>the ballot question for the judge shall include the name of that court.</subsection></subsection><subsection ssid="17-null-28" dnum="5-o" numlevel="1" lineno="183" slineno="2-63" level="1" space="false"><display>(5)</display><subsection ssid="17-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the justice or judge receives more yes votes than no votes, the justice or judge is <ln numlevel="1" lineno="184" slineno="2-64"/>retained for the term of office provided by law.</subsection><subsection ssid="17-null-30" dnum="b-o" numlevel="1" lineno="185" slineno="2-65" level="2"><display>(b)</display>If the justice or judge does not receive more yes votes than no votes, the justice or <ln numlevel="1" lineno="186" slineno="2-66"/>judge is not retained, and a vacancy exists in the office on the first Monday in <ln numlevel="1" lineno="187" slineno="2-67"/>January after the regular general election.</subsection></subsection><subsection ssid="17-null-31" dnum="6-o" numlevel="1" lineno="188" slineno="2-68" level="1"><display>(6)</display>A justice or judge not retained is ineligible for appointment to the office for which the <ln numlevel="1" lineno="189" slineno="2-69"/>justice or judge was defeated until after the expiration of that term of office.</subsection><subsection ssid="17-null-32" dnum="7-o" numlevel="1" lineno="190" slineno="2-70" level="1" space="false"><display>(7)</display><subsection ssid="17-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a justice court judge is standing for retention for one or more judicial offices in <ln numlevel="1" lineno="191" slineno="2-71"/>a county in which the judge is a county justice court judge or a municipal justice <ln numlevel="1" lineno="192" slineno="2-72"/>court judge in a town or municipality of the fourth or fifth class, as described in <ln numlevel="1" lineno="193" slineno="2-73"/>Section <xref depth="3" refnumber="10-2-301" start="0">10-2-301</xref>, or any combination thereof, the election officer shall place the <ln numlevel="1" lineno="194" slineno="2-74"/>judge's name on the county ballot only once for all judicial offices for which the <ln numlevel="1" lineno="195" slineno="2-75"/>judge seeks to be retained.</subsection><subsection ssid="17-null-34" dnum="b-o" numlevel="1" lineno="196" slineno="2-76" level="2"><display>(b)</display>If a justice court judge is standing for retention for one or more judicial offices in a <ln numlevel="1" lineno="197" slineno="2-77"/>municipality of the first, second, or third class, as described in Section <xref depth="3" refnumber="10-2-301" start="0">10-2-301</xref>, the <ln numlevel="1" lineno="198" slineno="2-78"/>election officer shall place the judge's name only on the municipal ballot for the <ln numlevel="1" lineno="199" slineno="2-79"/>voters of the municipality that the judge serves.</subsection></subsection></section></bsec><bsec buid="32" num="63G-23-102" type="amend" src="code" uid="C63G-23-S102_2027010120270101" sort="63G23 01020020270101" numlevel="1" lineno="200" slineno="3-1" sn="3"><section number="63G-23-102" numlevel="1" lineno="201" slineno="3-2" type="amend"><secline lineno="200">Section 3. Section <bold>63G-23-102</bold> is amended to read:</secline><catline lineno="201"><bold>63G-23-102<parens/>. justice court judges; and</subsection><subsection ssid="21-null-9" dnum="h-o:i-i" numlevel="1" lineno="284" slineno="8-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1109" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>a member or ex officio member of the Board of Commissioners of the Utah State <ln numlevel="1" lineno="285" slineno="8-14"/>Bar who is an active member of the Utah State Bar in good standing at the time of <ln numlevel="1" lineno="286" slineno="8-15"/>election by the Board of Commissioners.</subsection></subsection><subsection ssid="21-null-10" dnum="2-o" numlevel="1" lineno="287" slineno="8-16" level="1"><display>(2)</display>The Judicial Council shall have a seal.</subsection><subsection ssid="21-null-11" dnum="3-o" numlevel="1" lineno="288" slineno="8-17" level="1" space="false"><display>(3)</display><subsection ssid="21-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The chief justice of the Supreme Court shall act as presiding officer of the Judicial <ln numlevel="1" lineno="289" slineno="8-18"/>Council and chief administrative officer for the courts.</subsection><subsection ssid="21-null-13" dnum="b-o" numlevel="1" lineno="290" slineno="8-19" level="2"><display>(b)</display>The chief justice shall vote only in the case of a tie.</subsection></subsection><subsection ssid="21-null-14" dnum="4-o" numlevel="1" lineno="291" slineno="8-20" level="1" space="false"><display>(4)</display><subsection ssid="21-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>All members of the Judicial Council shall serve for three-year terms.</subsection><subsection ssid="21-null-16" dnum="b-o" numlevel="1" lineno="292" slineno="8-21" level="2"><display>(b)</display>If a Judicial Council member should die, resign, retire, or otherwise fail to complete <ln numlevel="1" lineno="293" slineno="8-22"/>a term of office, the appropriate constituent group shall elect a member to complete <ln numlevel="1" lineno="294" slineno="8-23"/>the term of office.</subsection><subsection ssid="21-null-17" dnum="c-o" numlevel="1" lineno="295" slineno="8-24" level="2"><display>(c)</display>In courts having more than one member, the members shall be elected to staggered <ln numlevel="1" lineno="296" slineno="8-25"/>terms.</subsection><subsection ssid="21-null-18" dnum="d-o" numlevel="1" lineno="297" slineno="8-26" level="2"><display>(d)</display>The individual elected by the Board of Commissioners under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-2-104(1)(h)" start="0">(1)(h)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(i)</amend> <ln numlevel="1" lineno="298" slineno="8-27"/>may complete a three-year term of office on the Judicial Council even though the <ln numlevel="1" lineno="299" slineno="8-28"/>individual ceases to be a member or ex officio member of the Board of <ln numlevel="1" lineno="300" slineno="8-29"/>Commissioners.</subsection><subsection ssid="21-null-19" dnum="e-o" numlevel="1" lineno="301" slineno="8-30" level="2"><display>(e)</display>The individual elected by the Board of Commissioners under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-2-104(1)(h)" start="0">(1)(h)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(i)</amend> <ln numlevel="1" lineno="302" slineno="8-31"/>shall be an active member of the Utah State Bar in good standing for the entire term <ln numlevel="1" lineno="303" slineno="8-32"/>of the Judicial Council.</subsection><subsection ssid="21-null-20" dnum="f-o" numlevel="1" lineno="304" slineno="8-33" level="2"><display>(f)</display>Elections are held under rules made by the Judicial Council.</subsection></subsection><subsection ssid="21-null-21" dnum="5-o" numlevel="1" lineno="305" slineno="8-34" level="1" space="false"><display>(5)</display><subsection ssid="21-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Judicial Council is responsible for the development of uniform administrative <ln numlevel="1" lineno="306" slineno="8-35"/>policy for the courts throughout the state.</subsection><subsection ssid="21-null-23" dnum="b-o" numlevel="1" lineno="307" slineno="8-36" level="2"><display>(b)</display>The presiding officer of the Judicial Council is responsible for the implementation of <ln numlevel="1" lineno="308" slineno="8-37"/>the policies developed by the Judicial Council and for the general management of the <ln numlevel="1" lineno="309" slineno="8-38"/>courts, with the aid of the state court administrator.</subsection><subsection ssid="21-null-24" dnum="c-o" numlevel="1" lineno="310" slineno="8-39" level="2"><display>(c)</display>The Judicial Council has authority and responsibility to:<subsection ssid="21-null-25" dnum="i-o" numlevel="1" lineno="311" slineno="8-40" level="3"><display>(i)</display>establish and assure compliance with policies for the operation of the courts, <ln numlevel="1" lineno="312" slineno="8-41"/>including uniform rules and forms; and</subsection><subsection ssid="21-null-26" dnum="ii-o" numlevel="1" lineno="313" slineno="8-42" level="3"><display>(ii)</display>publish and submit to the governor, the chief justice of the Supreme Court, and <ln numlevel="1" lineno="314" slineno="8-43"/>the Legislature an annual report of the operations of the courts, which shall <ln numlevel="1" lineno="315" slineno="8-44"/>include financial and statistical data and may include suggestions and <ln numlevel="1" lineno="316" slineno="8-45"/>recommendations for legislation.</subsection></subsection></subsection><subsection ssid="21-null-27" dnum="6-o" numlevel="1" lineno="317" slineno="8-46" level="1"><display>(6)</display>The Judicial Council shall establish standards for the operation of the courts of the state, <ln numlevel="1" lineno="318" slineno="8-47"/>including facilities, court security, support services, and staff levels for judicial and <ln numlevel="1" lineno="319" slineno="8-48"/>support personnel.</subsection><subsection ssid="21-null-28" dnum="7-o" numlevel="1" lineno="320" slineno="8-49" level="1"><display>(7)</display>The Judicial Council shall by rule:<subsection ssid="21-null-29" dnum="a-o" numlevel="1" lineno="321" slineno="8-50" level="2"><display>(a)</display>establish the time and manner for destroying court records, including computer <ln numlevel="1" lineno="322" slineno="8-51"/>records; and</subsection><subsection ssid="21-null-30" dnum="b-o" numlevel="1" lineno="323" slineno="8-52" level="2"><display>(b)</display>establish retention periods for court records.</subsection></subsection><subsection ssid="21-null-31" dnum="8-o" numlevel="1" lineno="324" slineno="8-53" level="1" space="false"><display>(8)</display><subsection ssid="21-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Consistent with the requirements of judicial office and security policies, the <ln numlevel="1" lineno="325" slineno="8-54"/>Judicial Council shall establish procedures to govern the assignment of state vehicles <ln numlevel="1" lineno="326" slineno="8-55"/>to public officers of the judicial branch.</subsection><subsection ssid="21-null-33" dnum="b-o" numlevel="1" lineno="327" slineno="8-56" level="2"><display>(b)</display>The vehicles shall be marked in a manner consistent with Section <xref depth="3" refnumber="41-1a-407" start="0">41-1a-407</xref> and may <ln numlevel="1" lineno="328" slineno="8-57"/>be assigned for unlimited use, within the state only.</subsection></subsection><subsection ssid="21-null-34" dnum="9-o" numlevel="1" lineno="329" slineno="8-58" level="1" space="false"><display>(9)</display><subsection ssid="21-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Judicial Council shall:<subsection ssid="21-null-36" dnum="i-o" numlevel="1" lineno="330" slineno="8-59" level="3" tab="1"><display>(i)</display>advise judicial officers and employees concerning ethical issues; and</subsection><subsection ssid="21-null-37" dnum="ii-o" numlevel="1" lineno="331" slineno="8-60" level="3" tab="1"><display>(ii)</display>establish procedures for issuing informal and formal advisory opinions on ethical <ln numlevel="1" lineno="332" slineno="8-61"/>issues.</subsection></subsection><subsection ssid="21-null-38" dnum="b-o" numlevel="1" lineno="333" slineno="8-62" level="2"><display>(b)</display>Compliance with an informal opinion is evidence of good faith compliance with the <ln numlevel="1" lineno="334" slineno="8-63"/>Code of Judicial Conduct.</subsection><subsection ssid="21-null-39" dnum="c-o" numlevel="1" lineno="335" slineno="8-64" level="2"><display>(c)</display>A formal opinion constitutes a binding interpretation of the Code of Judicial Conduct.</subsection></subsection><subsection ssid="21-null-40" dnum="10-o" numlevel="1" lineno="336" slineno="8-65" level="1" space="false"><display>(10)</display><subsection ssid="21-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Judicial Council shall establish written procedures authorizing the presiding <ln numlevel="1" lineno="337" slineno="8-66"/>officer of the Judicial Council to appoint<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both"> judges of courts of record</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="21-63" dnum="_-o:i-i" numlevel="1" lineno="338" slineno="8-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">a judge of a court of record</amend> by special or general assignment to serve temporarily <ln numlevel="1" lineno="339" slineno="8-68"/>in another level of court in a specific court or generally within that level<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="21-62" dnum="_-o:ii-i" numlevel="1" lineno="340" slineno="8-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">a judge of the Collections and Housing Court to serve in the district court to the <ln numlevel="1" lineno="341" slineno="8-70"/>extent that the assignment does not interfere with actions before the Collections <ln numlevel="1" lineno="342" slineno="8-71"/>and Housing Court.</amend></subsection></subsection><subsection ssid="21-null-42" dnum="b-o" numlevel="1" lineno="343" slineno="8-72" level="2"><display>(b)</display>The appointment under Subsection <xref depth="4" refnumber="78A-2-104(10)(a)" start="0">(10)(a)</xref> shall be:<subsection ssid="21-null-43" dnum="i-o" numlevel="1" lineno="344" slineno="8-73" level="3"><display>(i)</display>for a specific period of time; and</subsection><subsection ssid="21-null-44" dnum="ii-o" numlevel="1" lineno="345" slineno="8-74" level="3"><display>(ii)</display>reported to the Judicial Council.</subsection></subsection><subsection ssid="21-null-45" dnum="c-o" numlevel="1" lineno="346" slineno="8-75" level="2"><display>(c)</display>The Judicial Council shall develop the procedures described in this Subsection <xref depth="4" refnumber="78A-2-104(10)" start="0">(10)</xref> <ln numlevel="1" lineno="347" slineno="8-76"/>in accordance with Subsection <xref depth="4" refnumber="78A-2-107(2)" start="0">78A-2-107(2)</xref> regarding the temporary appointment of <ln numlevel="1" lineno="348" slineno="8-77"/>judges.</subsection></subsection><subsection ssid="21-null-46" dnum="11-o" numlevel="1" lineno="349" slineno="8-78" level="1" space="false"><display>(11)</display><subsection ssid="21-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Judicial Council may by rule designate municipalities in addition to those <ln numlevel="1" lineno="350" slineno="8-79"/>designated by statute as a location of a trial court of record.</subsection><subsection ssid="21-null-48" dnum="b-o" numlevel="1" lineno="351" slineno="8-80" level="2"><display>(b)</display>There shall be at least one court clerk's office open during regular court hours in each <ln numlevel="1" lineno="352" slineno="8-81"/>county.</subsection><subsection ssid="21-null-49" dnum="c-o" numlevel="1" lineno="353" slineno="8-82" level="2"><display>(c)</display>Any trial court of record may hold court in any municipality designated as a location <ln numlevel="1" lineno="354" slineno="8-83"/>of a court of record.</subsection></subsection><subsection ssid="21-null-50" dnum="12-o" numlevel="1" lineno="355" slineno="8-84" level="1"><display>(12)</display>The Judicial Council shall by rule determine whether the administration of a court is <ln numlevel="1" lineno="356" slineno="8-85"/>the obligation of the Administrative Office of the Courts or whether the Administrative <ln numlevel="1" lineno="357" slineno="8-86"/>Office of the Courts should contract with local government for court support services.</subsection><subsection ssid="21-null-51" dnum="13-o" numlevel="1" lineno="358" slineno="8-87" level="1"><display>(13)</display>The Judicial Council may by rule direct that a district court location be administered <ln numlevel="1" lineno="359" slineno="8-88"/>from another court location within the county.</subsection><subsection ssid="21-null-52" dnum="14-o" numlevel="1" lineno="360" slineno="8-89" level="1" space="false"><display>(14)</display><subsection ssid="21-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Judicial Council shall:<subsection ssid="21-null-54" dnum="i-o" numlevel="1" lineno="361" slineno="8-90" level="3" tab="1"><display>(i)</display>establish the Office of Guardian Ad Litem in accordance with <xref depth="2" refnumber="78A-2-8" start="0">Title 78A, Chapter <ln numlevel="1" lineno="362" slineno="8-91"/>2, Part 8, Guardian Ad Litem</xref>; and</subsection><subsection ssid="21-null-55" dnum="ii-o" numlevel="1" lineno="363" slineno="8-92" level="3" tab="1"><display>(ii)</display>establish and supervise a Guardian Ad Litem Oversight Committee.</subsection></subsection><subsection ssid="21-null-56" dnum="b-o" numlevel="1" lineno="364" slineno="8-93" level="2"><display>(b)</display>The Guardian Ad Litem Oversight Committee described in Subsection <xref depth="4" refnumber="78A-2-104(14)(a)(ii)" start="0">(14)(a)(ii)</xref> <ln numlevel="1" lineno="365" slineno="8-94"/>shall oversee the Office of Guardian Ad Litem, established under Subsection <xref depth="4" refnumber="78A-2-104(14)(a)(i)" start="0"><ln numlevel="1" lineno="366" slineno="8-95"/>(14)(a)(i)</xref>, and assure that the Office of Guardian Ad Litem complies with state and <ln numlevel="1" lineno="367" slineno="8-96"/>federal law, regulation, policy, and court rules.</subsection></subsection><subsection ssid="21-null-57" dnum="15-o" numlevel="1" lineno="368" slineno="8-97" level="1"><display>(15)</display>The Judicial Council shall establish and maintain, in cooperation with the Office of <ln numlevel="1" lineno="369" slineno="8-98"/>Recovery Services within the Department of Health and Human Services, the part of the <ln numlevel="1" lineno="370" slineno="8-99"/>state case registry that contains records of each support order established or modified in <ln numlevel="1" lineno="371" slineno="8-100"/>the state on or after October 1, 1998, as is necessary to comply with the Social Security <ln numlevel="1" lineno="372" slineno="8-101"/>Act, 42 U.S.C. Sec. 654a.</subsection></section></bsec><bsec buid="22" num="78A-2-107" type="amend" src="code" uid="C78A-2-S107_2027010120270101" sort="78A02 01070020270101" numlevel="1" lineno="373" slineno="9-1" sn="9"><section number="78A-2-107" numlevel="1" lineno="374" slineno="9-2" type="amend"><secline lineno="373">Section 9. Section <bold>78A-2-107</bold> is amended to read:</secline><catline lineno="374"><bold>78A-2-107<parens/>. Court administrator -- Powers, duties, and responsibilities.</bold></catline><sectionText lineno="375"><tab/>Under the general supervision of the presiding officer of the Judicial Council, and within <ln numlevel="1" lineno="376" slineno="9-4"/>the policies established by the<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"> the</amend><amendoutend style="2"/> Judicial Council:</sectionText><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="377" slineno="9-5" level="1"><display>(1)</display>the state court administrator shall:<subsection ssid="22-null-2" dnum="a-o" numlevel="1" lineno="378" slineno="9-6" level="2"><display>(a)</display>organize and administer all of the nonjudicial activities of the courts;</subsection><subsection ssid="22-null-3" dnum="b-o" numlevel="1" lineno="379" slineno="9-7" level="2"><display>(b)</display>assign, supervise, and direct the work of the nonjudicial officers of the courts;</subsection><subsection ssid="22-null-4" dnum="c-o" numlevel="1" lineno="380" slineno="9-8" level="2"><display>(c)</display>implement the standards, policies, and rules established by the Judicial Council;</subsection><subsection ssid="22-null-5" dnum="d-o" numlevel="1" lineno="381" slineno="9-9" level="2"><display>(d)</display>formulate and administer a system of personnel administration, including in-service <ln numlevel="1" lineno="382" slineno="9-10"/>training programs;</subsection><subsection ssid="22-null-6" dnum="e-o" numlevel="1" lineno="383" slineno="9-11" level="2"><display>(e)</display>prepare and administer the state judicial budget, fiscal, accounting, and procurement <ln numlevel="1" lineno="384" slineno="9-12"/>activities for the operation of the courts of record;</subsection><subsection ssid="22-null-7" dnum="f-o" numlevel="1" lineno="385" slineno="9-13" level="2"><display>(f)</display>assist justice courts in budgetary, fiscal, and accounting procedures;</subsection><subsection ssid="22-null-8" dnum="g-o" numlevel="1" lineno="386" slineno="9-14" level="2"><display>(g)</display>conduct studies of the business of the courts, including the preparation of <ln numlevel="1" lineno="387" slineno="9-15"/>recommendations and reports relating to the studies;</subsection><subsection ssid="22-null-9" dnum="h-o" numlevel="1" lineno="388" slineno="9-16" level="2"><display>(h)</display>develop uniform procedures for the management of court business, including the <ln numlevel="1" lineno="389" slineno="9-17"/>management of court calendars;</subsection><subsection ssid="22-null-10" dnum="i-o" numlevel="1" lineno="390" slineno="9-18" level="2"><display>(i)</display>maintain liaison with the governmental and other public and private groups having an <ln numlevel="1" lineno="391" slineno="9-19"/>interest in the administration of the courts;</subsection><subsection ssid="22-null-11" dnum="j-o" numlevel="1" lineno="392" slineno="9-20" level="2"><display>(j)</display>establish uniform policy concerning vacations and sick leave for judges and <ln numlevel="1" lineno="393" slineno="9-21"/>nonjudicial officers of the courts;</subsection><subsection ssid="22-null-12" dnum="k-o" numlevel="1" lineno="394" slineno="9-22" level="2"><display>(k)</display>establish uniform hours for court sessions throughout the state;</subsection><subsection ssid="22-null-13" dnum="l-o" numlevel="1" lineno="395" slineno="9-23" level="2"><display>(l)</display>when necessary for administrative reasons, change the county for trial of any case if <ln numlevel="1" lineno="396" slineno="9-24"/>no party to the litigation files timely objections to this change;</subsection><subsection ssid="22-null-14" dnum="m-o" numlevel="1" lineno="397" slineno="9-25" level="2" space="false"><display>(m)</display><subsection ssid="22-null-15" dnum="i-o" level="3" placement="sameline"><display>(i)</display>organize and administer a program of continuing education for judges and <ln numlevel="1" lineno="398" slineno="9-26"/>support staff, including training for justice court judges; and</subsection><subsection ssid="22-null-16" dnum="ii-o" numlevel="1" lineno="399" slineno="9-27" level="3"><display>(ii)</display>ensure that any training or continuing education described in Subsection <xref depth="4" refnumber="78A-2-107(1)(m)(i)" start="0">(1)(m)(i)</xref> <ln numlevel="1" lineno="400" slineno="9-28"/>complies with <xref depth="1" refnumber="63G-22" start="0">Title 63G, Chapter 22, State Training and Certification <ln numlevel="1" lineno="401" slineno="9-29"/>Requirements</xref>;</subsection></subsection><subsection ssid="22-null-17" dnum="n-o" numlevel="1" lineno="402" slineno="9-30" level="2"><display>(n)</display>provide for an annual meeting for each level of the courts of record and the annual <ln numlevel="1" lineno="403" slineno="9-31"/>judicial conference; and</subsection><subsection ssid="22-null-18" dnum="o-o" numlevel="1" lineno="404" slineno="9-32" level="2"><display>(o)</display>perform other duties as assigned by the presiding officer of the Judicial Council; and</subsection></subsection><subsection ssid="22-null-19" dnum="2-o" numlevel="1" lineno="405" slineno="9-33" level="1"><display>(2)</display>with the consent of the presiding officer of the Judicial Council, the state court <ln numlevel="1" lineno="406" slineno="9-34"/>administrator may:<subsection ssid="22-null-20" dnum="a-o" numlevel="1" lineno="407" slineno="9-35" level="2"><display>(a)</display>call and appoint a justice or judge of a court of record to serve temporarily as a judge <ln numlevel="1" lineno="408" slineno="9-36"/>of the Court of Appeals, the Business and Chancery Court,<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> the Collections and <ln numlevel="1" lineno="409" slineno="9-37"/>Housing Court,</amend> a district court, or a juvenile court; and</subsection><subsection ssid="22-null-21" dnum="b-o" numlevel="1" lineno="410" slineno="9-38" level="2"><display>(b)</display>set reasonable compensation for the service of a justice or judge under Subsection <xref depth="4" refnumber="78A-2-107(2)(a)" start="0"><ln numlevel="1" lineno="411" slineno="9-39"/>(2)(a)</xref>.</subsection></subsection></section></bsec><bsec buid="23" num="78A-2-108" type="amend" src="code" uid="C78A-2-S108_2027010120270101" sort="78A02 01080020270101" numlevel="1" lineno="412" slineno="10-1" sn="10"><section number="78A-2-108" numlevel="1" lineno="413" slineno="10-2" type="amend"><secline lineno="412">Section 10. Section <bold>78A-2-108</bold> is amended to read:</secline><catline lineno="413"><bold>78A-2-108<parens/>. Assistants for state court administrator -- Appointment of trial court <ln numlevel="1" lineno="414" slineno="10-3"/>executives.</bold></catline><subsection ssid="23-null-1" dnum="1-o" numlevel="1" lineno="415" slineno="10-4" level="1" placement="noreturn"><display>(1)</display>The state court administrator, with the approval of the presiding officer of the Judicial <ln numlevel="1" lineno="416" slineno="10-5"/>Council, is responsible for the establishment of positions and salaries of assistants as <ln numlevel="1" lineno="417" slineno="10-6"/>necessary to enable the state court administrator to perform the powers and duties vested <ln numlevel="1" lineno="418" slineno="10-7"/>in the state court administrator by this chapter, including the positions of appellate court <ln numlevel="1" lineno="419" slineno="10-8"/>administrator, business and chancery court administrator,<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"> collections and housing court <ln numlevel="1" lineno="420" slineno="10-9"/>administrator,</amend> district court administrator, juvenile court administrator, and justice court <ln numlevel="1" lineno="421" slineno="10-10"/>administrator.</subsection><subsection ssid="23-null-2" dnum="2-o" numlevel="1" lineno="422" slineno="10-11" level="1"><display>(2)</display>The state court administrator shall appoint an appellate court administrator, a business <ln numlevel="1" lineno="423" slineno="10-12"/>and chancery court administrator,<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> a collections and housing court administrator,</amend> a <ln numlevel="1" lineno="424" slineno="10-13"/>district court administrator, a juvenile court administrator, and a justice court <ln numlevel="1" lineno="425" slineno="10-14"/>administrator with the concurrence of the respective boards as established by the Judicial <ln numlevel="1" lineno="426" slineno="10-15"/>Council.</subsection><subsection ssid="23-null-3" dnum="3-o" numlevel="1" lineno="427" slineno="10-16" level="1" space="false"><display>(3)</display><subsection ssid="23-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The district court administrator, with the concurrence of the presiding judge of a <ln numlevel="1" lineno="428" slineno="10-17"/>district or the district court judge in single judge districts, may appoint a trial court <ln numlevel="1" lineno="429" slineno="10-18"/>executive in each district.</subsection><subsection ssid="23-null-5" dnum="b-o" numlevel="1" lineno="430" slineno="10-19" level="2"><display>(b)</display>The trial court executive may appoint, subject to budget limitations, necessary <ln numlevel="1" lineno="431" slineno="10-20"/>support personnel including clerks, research clerks, secretaries, and other persons <ln numlevel="1" lineno="432" slineno="10-21"/>required to carry out the work of the court.</subsection><subsection ssid="23-null-6" dnum="c-o" numlevel="1" lineno="433" slineno="10-22" level="2"><display>(c)</display>The trial court executive shall supervise the work of all nonjudicial court staff and <ln numlevel="1" lineno="434" slineno="10-23"/>serve as administrative officer of the district.</subsection></subsection><subsection ssid="23-null-7" dnum="4-o" numlevel="1" lineno="435" slineno="10-24" level="1"><display>(4)</display>Administrators and assistants appointed under this section are known collectively as the <ln numlevel="1" lineno="436" slineno="10-25"/>Administrative Office of the Courts.</subsection></section></bsec><bsec buid="24" num="78A-2-110" type="amend" src="code" uid="C78A-2-S110_2027010120270101" sort="78A02 01100020270101" numlevel="1" lineno="437" slineno="11-1" sn="11"><section number="78A-2-110" numlevel="1" lineno="438" slineno="11-2" type="amend"><secline lineno="437">Section 11. Section <bold>78A-2-110</bold> is amended to read:</secline><catline lineno="438"><bold>78A-2-110<parens/>. Databases for judicial boards.</bold></catline><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="439" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "judicial board" means any judicial branch board, commission, <ln numlevel="1" lineno="440" slineno="11-4"/>council, committee, working group, task force, study group, advisory group, or other <ln numlevel="1" lineno="441" slineno="11-5"/>body with a defined limited membership that is created to operate for more than six <ln numlevel="1" lineno="442" slineno="11-6"/>months by:<subsection ssid="24-null-2" dnum="a-o" numlevel="1" lineno="443" slineno="11-7" level="2"><display>(a)</display>the constitution;</subsection><subsection ssid="24-null-3" dnum="b-o" numlevel="1" lineno="444" slineno="11-8" level="2"><display>(b)</display>statute;</subsection><subsection ssid="24-null-4" dnum="c-o" numlevel="1" lineno="445" slineno="11-9" level="2"><display>(c)</display>judicial order;</subsection><subsection ssid="24-null-5" dnum="d-o" numlevel="1" lineno="446" slineno="11-10" level="2"><display>(d)</display>any justice or judge;</subsection><subsection ssid="24-null-6" dnum="e-o" numlevel="1" lineno="447" slineno="11-11" level="2"><display>(e)</display>the Judicial Council;</subsection><subsection ssid="24-null-7" dnum="f-o" numlevel="1" lineno="448" slineno="11-12" level="2"><display>(f)</display>the state court administrator, a district court administrator, <amend anum="0" ea="amend" pairid="8" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">a </amend>trial court executive, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/><ln numlevel="1" lineno="449" slineno="11-13"/>a business and chancery court administrator<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">, a collections and housing court <ln numlevel="1" lineno="450" slineno="11-14"/>administrator</amend>; or</subsection><subsection ssid="24-null-8" dnum="g-o" numlevel="1" lineno="451" slineno="11-15" level="2"><display>(g)</display>any clerk or administrator in the judicial branch of state government.</subsection></subsection><subsection ssid="24-null-9" dnum="2-o" numlevel="1" lineno="452" slineno="11-16" level="1"><display>(2)</display>The Judicial Council shall designate an individual from the Judicial Council's staff to <ln numlevel="1" lineno="453" slineno="11-17"/>maintain a computerized database containing information about all judicial boards.</subsection><subsection ssid="24-null-10" dnum="3-o" numlevel="1" lineno="454" slineno="11-18" level="1"><display>(3)</display>The individual designated to maintain the database shall:<subsection ssid="24-null-11" dnum="a-o" numlevel="1" lineno="455" slineno="11-19" level="2"><display>(a)</display>ensure that the database contains:<subsection ssid="24-null-12" dnum="i-o" numlevel="1" lineno="456" slineno="11-20" level="3"><display>(i)</display>the name of the judicial board;</subsection><subsection ssid="24-null-13" dnum="ii-o" numlevel="1" lineno="457" slineno="11-21" level="3"><display>(ii)</display>the statutory or constitutional authority for the creation of the judicial board;</subsection><subsection ssid="24-null-14" dnum="iii-o" numlevel="1" lineno="458" slineno="11-22" level="3"><display>(iii)</display>the court or other judicial entity under whose jurisdiction the judicial board <ln numlevel="1" lineno="459" slineno="11-23"/>operates or with which the judicial board is affiliated, if any;</subsection><subsection ssid="24-null-15" dnum="iv-o" numlevel="1" lineno="460" slineno="11-24" level="3"><display>(iv)</display>the name, address, gender, telephone number, and county of each individual <ln numlevel="1" lineno="461" slineno="11-25"/>currently serving on the judicial board, along with a notation of all vacant or <ln numlevel="1" lineno="462" slineno="11-26"/>unfilled positions;</subsection><subsection ssid="24-null-16" dnum="v-o" numlevel="1" lineno="463" slineno="11-27" level="3"><display>(v)</display>the title of the position held by the individual who appointed each member of the <ln numlevel="1" lineno="464" slineno="11-28"/>judicial board;</subsection><subsection ssid="24-null-17" dnum="vi-o" numlevel="1" lineno="465" slineno="11-29" level="3"><display>(vi)</display>the length of the term to which each member of the judicial board was appointed <ln numlevel="1" lineno="466" slineno="11-30"/>and the month and year that each judicial board member's term expires;</subsection><subsection ssid="24-null-18" dnum="vii-o" numlevel="1" lineno="467" slineno="11-31" level="3"><display>(vii)</display>the organization, interest group, profession, local government entity, or <ln numlevel="1" lineno="468" slineno="11-32"/>geographic area that the member of the judicial board represents, if any;</subsection><subsection ssid="24-null-19" dnum="viii-o" numlevel="1" lineno="469" slineno="11-33" level="3"><display>(viii)</display>whether or not the judicial board allocates state or federal funds and the amount <ln numlevel="1" lineno="470" slineno="11-34"/>of those funds allocated during the last fiscal year;</subsection><subsection ssid="24-null-20" dnum="ix-o" numlevel="1" lineno="471" slineno="11-35" level="3"><display>(ix)</display>whether the judicial board is a policy board or an advisory board;</subsection><subsection ssid="24-null-21" dnum="x-o" numlevel="1" lineno="472" slineno="11-36" level="3"><display>(x)</display>whether or not the judicial board has or exercises rulemaking authority; and</subsection><subsection ssid="24-null-22" dnum="xi-o" numlevel="1" lineno="473" slineno="11-37" level="3"><display>(xi)</display>any compensation and expense reimbursement that members of the executive <ln numlevel="1" lineno="474" slineno="11-38"/>board are authorized to receive;</subsection></subsection><subsection ssid="24-null-23" dnum="b-o" numlevel="1" lineno="475" slineno="11-39" level="2"><display>(b)</display>make the information contained in the database available to the public upon request; </subsection><subsection ssid="24-null-24" dnum="c-o" numlevel="1" lineno="476" slineno="11-40" level="2"><display>(c)</display>cooperate with other entities of state government to publish the data or useful <ln numlevel="1" lineno="477" slineno="11-41"/>summaries of the data;</subsection><subsection ssid="24-null-25" dnum="d-o" numlevel="1" lineno="478" slineno="11-42" level="2"><display>(d)</display>prepare, publish, and distribute an annual report by April 1 of each year that <ln numlevel="1" lineno="479" slineno="11-43"/>includes, as of March 1 of that year:<subsection ssid="24-null-26" dnum="i-o" numlevel="1" lineno="480" slineno="11-44" level="3"><display>(i)</display>the total number of judicial boards;</subsection><subsection ssid="24-null-27" dnum="ii-o" numlevel="1" lineno="481" slineno="11-45" level="3"><display>(ii)</display>the name of each of those judicial boards and the court, council, administrator, <ln numlevel="1" lineno="482" slineno="11-46"/>executive, or clerk under whose jurisdiction the executive board operates or with <ln numlevel="1" lineno="483" slineno="11-47"/>which the judicial board is affiliated, if any;</subsection><subsection ssid="24-null-28" dnum="iii-o" numlevel="1" lineno="484" slineno="11-48" level="3"><display>(iii)</display>for each court, council, administrator, executive, or clerk, the total number of <ln numlevel="1" lineno="485" slineno="11-49"/>judicial boards under the jurisdiction of or affiliated with that court, council, <ln numlevel="1" lineno="486" slineno="11-50"/>administrator, executive, or clerk;</subsection><subsection ssid="24-null-29" dnum="iv-o" numlevel="1" lineno="487" slineno="11-51" level="3"><display>(iv)</display>the total number of members for each of those judicial boards;</subsection><subsection ssid="24-null-30" dnum="v-o" numlevel="1" lineno="488" slineno="11-52" level="3"><display>(v)</display>whether each board is a policymaking board or an advisory board and the total <ln numlevel="1" lineno="489" slineno="11-53"/>number of policy boards and the total number of advisory boards; and</subsection><subsection ssid="24-null-31" dnum="vi-o" numlevel="1" lineno="490" slineno="11-54" level="3"><display>(vi)</display>the compensation, if any, paid to the members of each of those judicial boards; <ln numlevel="1" lineno="491" slineno="11-55"/>and</subsection></subsection><subsection ssid="24-null-32" dnum="e-o" numlevel="1" lineno="492" slineno="11-56" level="2"><display>(e)</display>distribute copies of the report described in Subsection <xref depth="4" refnumber="78A-2-110(3)(d)" start="0">(3)(d)</xref> to:<subsection ssid="24-null-33" dnum="i-o" numlevel="1" lineno="493" slineno="11-57" level="3"><display>(i)</display>the chief justice of the Utah Supreme Court;</subsection><subsection ssid="24-null-34" dnum="ii-o" numlevel="1" lineno="494" slineno="11-58" level="3"><display>(ii)</display>the state court administrator;</subsection><subsection ssid="24-null-35" dnum="iii-o" numlevel="1" lineno="495" slineno="11-59" level="3"><display>(iii)</display>the governor;</subsection><subsection ssid="24-null-36" dnum="iv-o" numlevel="1" lineno="496" slineno="11-60" level="3"><display>(iv)</display>the president of the Utah Senate;</subsection><subsection ssid="24-null-37" dnum="v-o" numlevel="1" lineno="497" slineno="11-61" level="3"><display>(v)</display>the speaker of the Utah House;</subsection><subsection ssid="24-null-38" dnum="vi-o" numlevel="1" lineno="498" slineno="11-62" level="3"><display>(vi)</display>the Office of Legislative Research and General Counsel; and</subsection><subsection ssid="24-null-39" dnum="vii-o" numlevel="1" lineno="499" slineno="11-63" level="3"><display>(vii)</display>any other persons who request a copy of the annual report.</subsection></subsection></subsection></section></bsec><bsec buid="25" num="78A-2-113" type="amend" src="code" uid="C78A-2-S113_2027010120270101" sort="78A02 01130020270101" numlevel="1" lineno="500" slineno="12-1" sn="12"><section number="78A-2-113" numlevel="1" lineno="501" slineno="12-2" type="amend"><secline lineno="500">Section 12. Section <bold>78A-2-113</bold> is amended to read:</secline><catline lineno="501"><bold>78A-2-113<parens/>. Judicial hiring freeze authorized.</bold></catline><subsection ssid="25-null-1" dnum="1-o" numlevel="1" lineno="502" slineno="12-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "General Fund budget deficit" means a situation where General <ln numlevel="1" lineno="503" slineno="12-4"/>Fund appropriations made by the Legislature for a fiscal year exceed the estimated <ln numlevel="1" lineno="504" slineno="12-5"/>revenues adopted by the Executive Appropriations Committee of the Legislature for the <ln numlevel="1" lineno="505" slineno="12-6"/>General Fund in that fiscal year.</subsection><subsection ssid="25-null-2" dnum="2-o" numlevel="1" lineno="506" slineno="12-7" level="1"><display>(2)</display>During a General Fund budget deficit, the governor, president of the Senate, speaker of <ln numlevel="1" lineno="507" slineno="12-8"/>the House, and chief justice of the Supreme Court, may, by unanimous vote, implement <ln numlevel="1" lineno="508" slineno="12-9"/>a judicial hiring freeze for judicial vacancies for:<subsection ssid="25-null-3" dnum="a-o" numlevel="1" lineno="509" slineno="12-10" level="2"><display>(a)</display>a juvenile court district with three or more juvenile court judges;</subsection><subsection ssid="25-null-4" dnum="b-o" numlevel="1" lineno="510" slineno="12-11" level="2"><display>(b)</display>a district court district with three or more district court judges;</subsection><subsection ssid="25-null-5" dnum="c-o" numlevel="1" lineno="511" slineno="12-12" level="2"><display>(c)</display>all Business and Chancery Court judges;</subsection><subsection ssid="25-11" dnum="_-o:d-i" numlevel="1" lineno="512" slineno="12-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">all Collections and Housing Court judges;</amend></subsection><subsection ssid="25-null-6" dnum="d-o:e-i" numlevel="1" lineno="513" slineno="12-14" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1233" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>all appellate court judges; or</subsection><subsection ssid="25-null-7" dnum="e-o:f-i" numlevel="1" lineno="514" slineno="12-15" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1234" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>any combination of Subsections <xref depth="4" refnumber="78A-2-113(2)(a)" start="0">(2)(a)</xref> through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-2-113(2)(d)" start="0">(d)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(e)</amend>.</subsection></subsection><subsection ssid="25-null-8" dnum="3-o" numlevel="1" lineno="515" slineno="12-16" level="1"><display>(3)</display>In implementing a judicial hiring freeze, the governor, president of the Senate, speaker <ln numlevel="1" lineno="516" slineno="12-17"/>of the House, and chief justice of the Supreme Court shall:<subsection ssid="25-null-9" dnum="a-o" numlevel="1" lineno="517" slineno="12-18" level="2"><display>(a)</display>establish the length of that hiring freeze; and</subsection><subsection ssid="25-null-10" dnum="b-o" numlevel="1" lineno="518" slineno="12-19" level="2"><display>(b)</display>ensure that the hiring freeze lasts at least 90 days, but not longer than the last day of <ln numlevel="1" lineno="519" slineno="12-20"/>the annual general session of the Legislature.</subsection></subsection></section></bsec><bsec buid="34" num="78A-5-102" type="amend" src="code" uid="C78A-5-S102_2027010120270101" sort="78A05 01020020270101" numlevel="1" lineno="520" slineno="13-1" sn="13"><section number="78A-5-102" numlevel="1" lineno="521" slineno="13-2" type="amend"><secline lineno="520">Section 13. Section <bold>78A-5-102</bold> is amended to read:</secline><catline lineno="521"><bold>78A-5-102<parens/>. Jurisdiction of the district court -- Appeals.</bold></catline><subsection ssid="34-null-1" dnum="1-o" numlevel="1" lineno="522" slineno="13-3" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided by the Utah Constitution or by statute, the district court <ln numlevel="1" lineno="523" slineno="13-4"/>has original jurisdiction in all matters civil and criminal.</subsection><subsection ssid="34-null-2" dnum="2-o" numlevel="1" lineno="524" slineno="13-5" level="1"><display>(2)</display>A district court judge may:<subsection ssid="34-null-3" dnum="a-o" numlevel="1" lineno="525" slineno="13-6" level="2"><display>(a)</display>issue all extraordinary writs and other writs necessary to carry into effect the district <ln numlevel="1" lineno="526" slineno="13-7"/>court judge's  orders, judgments, and decrees; and</subsection><subsection ssid="34-null-4" dnum="b-o" numlevel="1" lineno="527" slineno="13-8" level="2"><display>(b)</display>preside over an action for which the Business and Chancery Court<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> or Collections and <ln numlevel="1" lineno="528" slineno="13-9"/>Housing Court</amend> has jurisdiction if:<subsection ssid="34-null-5" dnum="i-o" numlevel="1" lineno="529" slineno="13-10" level="3"><display>(i)</display>the district court judge is designated by the presiding officer of the Judicial <ln numlevel="1" lineno="530" slineno="13-11"/>Council to preside over an action in the Business and Chancery Court as described <ln numlevel="1" lineno="531" slineno="13-12"/>in Section <xref depth="3" refnumber="78A-1-103.5">78A-1-103.5</xref><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> or the Collections and Housing Court as described in <ln numlevel="1" lineno="532" slineno="13-13"/>Section <xref depth="3" refnumber="78A-1-103.7">78A-1-103.7</xref></amend>; and</subsection><subsection ssid="34-null-6" dnum="ii-o" numlevel="1" lineno="533" slineno="13-14" level="3"><display>(ii)</display>a Business and Chancery Court judge<amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"> or a Collections and Housing Court judge</amend> is <ln numlevel="1" lineno="534" slineno="13-15"/>unable to preside over the action due to recusal or disqualification.</subsection></subsection></subsection><subsection ssid="34-null-7" dnum="3-o" numlevel="1" lineno="535" slineno="13-16" level="1"><display>(3)</display>The district court has jurisdiction:<subsection ssid="34-null-8" dnum="a-o" numlevel="1" lineno="536" slineno="13-17" level="2"><display>(a)</display>over matters of lawyer discipline consistent with the rules of the Supreme Court;</subsection><subsection ssid="34-null-9" dnum="b-o" numlevel="1" lineno="537" slineno="13-18" level="2"><display>(b)</display>over all matters properly filed in the circuit court prior to July 1, 1996;</subsection><subsection ssid="34-null-10" dnum="c-o" numlevel="1" lineno="538" slineno="13-19" level="2"><display>(c)</display>to enforce foreign protective orders as described in Subsection <xref depth="4" refnumber="78B-7-303(8)">78B-7-303(8)</xref>;</subsection><subsection ssid="34-null-11" dnum="d-o" numlevel="1" lineno="539" slineno="13-20" level="2"><display>(d)</display>to enjoin a violation of Title 58, Chapter 37, Utah Controlled Substances Act;</subsection><subsection ssid="34-null-12" dnum="e-o" numlevel="1" lineno="540" slineno="13-21" level="2"><display>(e)</display>over a petition seeking to terminate parental rights as described in Section <xref depth="3" refnumber="81-13-205">81-13-205</xref>;</subsection><subsection ssid="34-null-13" dnum="f-o" numlevel="1" lineno="541" slineno="13-22" level="2"><display>(f)</display>except as provided in Subsection <xref depth="4" refnumber="78A-6-103(2)(a)(xiv)">78A-6-103(2)(a)(xiv)</xref> or <xref depth="4" refnumber="78A-5-102(xv)">(xv)</xref>, over an adoption <ln numlevel="1" lineno="542" slineno="13-23"/>proceeding; and</subsection><subsection ssid="34-null-14" dnum="g-o" numlevel="1" lineno="543" slineno="13-24" level="2"><display>(g)</display>to issue a declaratory judgment as described in Title 78B, Chapter 6, Part 4, <ln numlevel="1" lineno="544" slineno="13-25"/>Declaratory Judgments.</subsection></subsection><subsection ssid="34-null-15" dnum="4-o" numlevel="1" lineno="545" slineno="13-26" level="1"><display>(4)</display>The district court has appellate jurisdiction over judgments and orders of the justice <ln numlevel="1" lineno="546" slineno="13-27"/>court as outlined in Section <xref depth="3" refnumber="78A-7-118">78A-7-118</xref> and small claims appeals filed in accordance <ln numlevel="1" lineno="547" slineno="13-28"/>with Section <xref depth="3" refnumber="78A-8-106">78A-8-106</xref>.</subsection><subsection ssid="34-null-16" dnum="5-o" numlevel="1" lineno="548" slineno="13-29" level="1"><display>(5)</display>The district court has jurisdiction to review:<subsection ssid="34-null-17" dnum="a-o" numlevel="1" lineno="549" slineno="13-30" level="2"><display>(a)</display>a municipal administrative proceeding as described in Section <xref depth="3" refnumber="10-3-703.7">10-3-703.7</xref>;</subsection><subsection ssid="34-null-18" dnum="b-o" numlevel="1" lineno="550" slineno="13-31" level="2"><display>(b)</display>a decision resulting from a formal adjudicative proceeding by the State Tax <ln numlevel="1" lineno="551" slineno="13-32"/>Commission as described in Section <xref depth="3" refnumber="59-1-601">59-1-601</xref>;</subsection><subsection ssid="34-null-19" dnum="c-o" numlevel="1" lineno="552" slineno="13-33" level="2"><display>(c)</display>except as provided in Section <xref depth="3" refnumber="63G-4-402">63G-4-402</xref>, a final agency action resulting from an <ln numlevel="1" lineno="553" slineno="13-34"/>informal adjudicative proceeding as described in Title 63G, Chapter 4, <ln numlevel="1" lineno="554" slineno="13-35"/>Administrative Procedures Act; and</subsection><subsection ssid="34-null-20" dnum="d-o" numlevel="1" lineno="555" slineno="13-36" level="2"><display>(d)</display>by trial de novo, a final order of the Department of Transportation resulting from <ln numlevel="1" lineno="556" slineno="13-37"/>formal and informal adjudicative proceedings under Title 72, Chapter 7, Part 2, <ln numlevel="1" lineno="557" slineno="13-38"/>Junkyard Control Act.</subsection></subsection><subsection ssid="34-null-21" dnum="6-o" numlevel="1" lineno="558" slineno="13-39" level="1"><display>(6)</display>The district court has original and exclusive jurisdiction over an action brought under <ln numlevel="1" lineno="559" slineno="13-40"/>Title 63G, Chapter 7, Governmental Immunity Act of Utah.</subsection><subsection ssid="34-null-22" dnum="7-o" numlevel="1" lineno="560" slineno="13-41" level="1"><display>(7)</display>The district court has exclusive jurisdiction to modify a juvenile court's permanent <ln numlevel="1" lineno="561" slineno="13-42"/>custody and guardianship order as described in Subsection <xref depth="4" refnumber="78A-6-357(3)(e)(ii)">78A-6-357(3)(e)(ii)</xref>.</subsection><subsection ssid="34-null-23" dnum="8-o" numlevel="1" lineno="562" slineno="13-43" level="1"><display>(8)</display>Notwithstanding Section <xref depth="3" refnumber="78A-7-106">78A-7-106</xref>, the district court has original jurisdiction over a <ln numlevel="1" lineno="563" slineno="13-44"/>class B misdemeanor, a class C misdemeanor, an infraction, or a violation of an <ln numlevel="1" lineno="564" slineno="13-45"/>ordinance for which a justice court has original jurisdiction under Section <xref depth="3" refnumber="78A-7-106">78A-7-106</xref> if:<subsection ssid="34-null-24" dnum="a-o" numlevel="1" lineno="565" slineno="13-46" level="2"><display>(a)</display>there is no justice court with territorial jurisdiction;</subsection><subsection ssid="34-null-25" dnum="b-o" numlevel="1" lineno="566" slineno="13-47" level="2"><display>(b)</display>the offense occurred within the boundaries of the municipality in which the district <ln numlevel="1" lineno="567" slineno="13-48"/>courthouse is located and that municipality has not formed, or has formed and <ln numlevel="1" lineno="568" slineno="13-49"/>dissolved, a justice court; or</subsection><subsection ssid="34-null-26" dnum="c-o" numlevel="1" lineno="569" slineno="13-50" level="2"><display>(c)</display>the offense is  included in an indictment or information covering a single criminal <ln numlevel="1" lineno="570" slineno="13-51"/>episode alleging the commission of a felony or a class A misdemeanor by an <ln numlevel="1" lineno="571" slineno="13-52"/>individual who is 18 years old or older.</subsection></subsection><subsection ssid="34-null-27" dnum="9-o" numlevel="1" lineno="572" slineno="13-53" level="1"><display>(9)</display>If a district court has jurisdiction in accordance with Subsection <xref depth="4" refnumber="78A-5-102(4)">(4)</xref>, (8)(a), or (8)(b), the <ln numlevel="1" lineno="573" slineno="13-54"/>district court has jurisdiction over an offense listed in Subsection <xref depth="4" refnumber="78A-7-106(2)">78A-7-106(2)</xref> even if <ln numlevel="1" lineno="574" slineno="13-55"/>the offense is committed by an individual who is 16 or 17 years old.</subsection><subsection ssid="34-null-28" dnum="10-o" numlevel="1" lineno="575" slineno="13-56" level="1"><display>(10)</display>The district court has subject matter jurisdiction over an action under Title 78B, <ln numlevel="1" lineno="576" slineno="13-57"/>Chapter 7, Part 2, Child Protective Orders, if the juvenile court transfers the action to the <ln numlevel="1" lineno="577" slineno="13-58"/>district court.</subsection><subsection ssid="34-null-29" dnum="11-o" numlevel="1" lineno="578" slineno="13-59" level="1" space="false"><display>(11)</display><subsection ssid="34-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The district court has subject matter jurisdiction over a criminal action that the <ln numlevel="1" lineno="579" slineno="13-60"/>justice court transfers to the district court.</subsection><subsection ssid="34-null-31" dnum="b-o" numlevel="1" lineno="580" slineno="13-61" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="78A-7-106(1)">78A-7-106(1)</xref>, the district court has original jurisdiction <ln numlevel="1" lineno="581" slineno="13-62"/>over any refiled case of a criminal action transferred to the district court if the district <ln numlevel="1" lineno="582" slineno="13-63"/>court dismissed the transferred case without prejudice.</subsection></subsection><subsection ssid="34-null-32" dnum="12-o" numlevel="1" lineno="583" slineno="13-64" level="1"><display>(12)</display>If the juvenile court has concurrent jurisdiction under Subsection <xref depth="4" refnumber="78A-6-104(1)(a)(i)">78A-6-104(1)(a)(i)</xref> <ln numlevel="1" lineno="584" slineno="13-65"/>over a parentage action filed in the district court, the district court may transfer <ln numlevel="1" lineno="585" slineno="13-66"/>jurisdiction over the parentage action to the juvenile court.</subsection><subsection ssid="34-null-33" dnum="13-o" numlevel="1" lineno="586" slineno="13-67" level="1"><display>(13)</display>The Supreme Court and Court of Appeals have jurisdiction over an appeal from a final <ln numlevel="1" lineno="587" slineno="13-68"/>order, judgment, and decree of the district court as described in Sections <xref depth="3" refnumber="78A-3-102">78A-3-102</xref> and <xref depth="3" refnumber="78A-4-103"><ln numlevel="1" lineno="588" slineno="13-69"/>78A-4-103</xref>.</subsection></section></bsec><bsec buid="1" num="78A-5b-101" type="enact" src="code" uid="C78A-5b-S101_2027010120270101" sort="78A05b01010020270101" numlevel="1" lineno="589" slineno="14-1" sn="14"><section numlevel="1" lineno="592" slineno="14-4" number="78A-5b-101" type="enact"><secline lineno="589">Section 14. and</amend></subsection><subsection ssid="11-5" dnum="_-o:b-i" numlevel="1" lineno="658" slineno="20-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">exercising powers and performing administrative duties as authorized by the Judicial <ln numlevel="1" lineno="659" slineno="20-11"/>Council.</amend></subsection></subsection><subsection ssid="11-6" dnum="_-o:4-i" numlevel="1" lineno="660" slineno="20-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1296" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="11-8" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1297" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">If the Collections and Housing Court has more than two judges, the judges of the <ln numlevel="1" lineno="661" slineno="20-13"/>Collections and Housing Court may elect an associate presiding judge from among <ln numlevel="1" lineno="662" slineno="20-14"/>the members of the court by majority vote of all judges.</amend></subsection><subsection ssid="11-7" dnum="_-o:b-i" numlevel="1" lineno="663" slineno="20-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1298" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">The associate presiding judge shall receive $1,000 per annum as additional <ln numlevel="1" lineno="664" slineno="20-16"/>compensation for the period served as associate presiding judge.</amend></subsection></subsection><subsection ssid="11-9" dnum="_-o:5-i" numlevel="1" lineno="665" slineno="20-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1299" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="11-11" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1300" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">When the presiding judge is unavailable, the associate presiding judge shall <ln numlevel="1" lineno="666" slineno="20-18"/>assume the responsibilities of the presiding judge.</amend></subsection><subsection ssid="11-10" dnum="_-o:b-i" numlevel="1" lineno="667" slineno="20-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1301" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">The associate presiding judge shall perform other duties assigned by the presiding <ln numlevel="1" lineno="668" slineno="20-20"/>judge.</amend></subsection></subsection></section></bsec><bsec buid="12" num="78A-5b-203" type="enact" src="code" uid="C78A-5b-S203_2027010120270101" sort="78A05b02030020270101" numlevel="1" lineno="669" slineno="21-1" sn="21"><section numlevel="1" lineno="670" slineno="21-2" number="78A-5b-203" type="enact"><secline lineno="669">Section 21. Section <bold>78A-5b-203</bold> is enacted to read:</secline><catline lineno="670"><bold>78A-5b-203<parens/>. Administrative system -- Case management -- Clerk of the court -- <ln numlevel="1" lineno="671" slineno="21-3"/>Employees.</bold></catline><subsection ssid="12-1" dnum="_-o:1-i" numlevel="1" lineno="672" slineno="21-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn" space="false"><display><amend anum="0" ea="amend" pairid="1302" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><subsection ssid="12-14" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1303" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">There is established the State Collections and Housing Court Administrative <ln numlevel="1" lineno="673" slineno="21-5"/>System.</amend></subsection><subsection ssid="12-2" dnum="_-o:b-i" numlevel="1" lineno="674" slineno="21-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">The Judicial Council shall administer the operation of the State Collections and <ln numlevel="1" lineno="675" slineno="21-7"/>Housing Court Administrative System.</amend></subsection></subsection><subsection ssid="12-3" dnum="_-o:2-i" numlevel="1" lineno="676" slineno="21-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1305" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">The Collections and Housing Court shall develop a case management system that:</amend><subsection ssid="12-4" dnum="_-o:a-i" numlevel="1" lineno="677" slineno="21-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">ensures judicial accountability for the just and timely disposition of cases; and</amend></subsection><subsection ssid="12-5" dnum="_-o:b-i" numlevel="1" lineno="678" slineno="21-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">provides each judge of the Collections and Housing Court a full judicial workload <ln numlevel="1" lineno="679" slineno="21-11"/>that accommodates differences in the subject matter or complexity of cases assigned <ln numlevel="1" lineno="680" slineno="21-12"/>to different judges of the Collections and Housing Court.</amend></subsection></subsection><subsection ssid="12-6" dnum="_-o:3-i" numlevel="1" lineno="681" slineno="21-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">The clerk of the Collections and Housing Court shall:</amend><subsection ssid="12-7" dnum="_-o:a-i" numlevel="1" lineno="682" slineno="21-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1309" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">take charge of and safely keep the court seal;</amend></subsection><subsection ssid="12-8" dnum="_-o:b-i" numlevel="1" lineno="683" slineno="21-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">take charge of and safely keep or dispose of all books, papers, and records filed or <ln numlevel="1" lineno="684" slineno="21-16"/>deposited with the clerk and all other records required by law or the rules of the <ln numlevel="1" lineno="685" slineno="21-17"/>Judicial Council;</amend></subsection><subsection ssid="12-9" dnum="_-o:c-i" numlevel="1" lineno="686" slineno="21-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1311" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">issue all notices, processes, and summonses as authorized by law;</amend></subsection><subsection ssid="12-10" dnum="_-o:d-i" numlevel="1" lineno="687" slineno="21-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">keep a record of all proceedings, actions, orders, judgments, and decrees of the court;</amend></subsection><subsection ssid="12-11" dnum="_-o:e-i" numlevel="1" lineno="688" slineno="21-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">supervise the deputy clerks as required to perform the duties of the clerk's office; and</amend></subsection><subsection ssid="12-12" dnum="_-o:f-i" numlevel="1" lineno="689" slineno="21-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">perform other duties as required by the presiding judge, the collections and housing <ln numlevel="1" lineno="690" slineno="21-22"/>court administrator, applicable law, and the rules of the Judicial Council.</amend></subsection></subsection><subsection ssid="12-13" dnum="_-o:4-i" numlevel="1" lineno="691" slineno="21-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1315" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">All employees, except judges of the Collections and Housing Court, are selected, <ln numlevel="1" lineno="692" slineno="21-24"/>promoted, and discharged through the state courts personnel system for the Collections <ln numlevel="1" lineno="693" slineno="21-25"/>and Housing Court under the direction and rules of the Judicial Council.</amend></subsection></section></bsec><bsec buid="13" num="78A-5b-204" type="enact" src="code" uid="C78A-5b-S204_2027010120270101" sort="78A05b02040020270101" numlevel="1" lineno="694" slineno="22-1" sn="22"><section numlevel="1" lineno="695" slineno="22-2" number="78A-5b-204" type="enact"><secline lineno="694">Section 22. Section <bold>78A-5b-204</bold> is enacted to read:</secline><catline lineno="695"><bold>78A-5b-204<parens/>. Location of the Collections and Housing Court.</bold></catline><subsection ssid="13-1" dnum="_-o:1-i" numlevel="1" lineno="696" slineno="22-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">The Collections and Housing Court may perform any of the Collections and Housing <ln numlevel="1" lineno="697" slineno="22-4"/>Court's functions in any location within the state.</amend></subsection><subsection ssid="13-2" dnum="_-o:2-i" numlevel="1" lineno="698" slineno="22-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">The Judicial Council shall provide, from appropriations made by the Legislature, court <ln numlevel="1" lineno="699" slineno="22-6"/>space suitable for the conduct of court business for the Collections and Housing Court.</amend></subsection><subsection ssid="13-3" dnum="_-o:3-i" numlevel="1" lineno="700" slineno="22-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1318" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">In order to carry out the Judicial Council's obligation to provide facilities for the <ln numlevel="1" lineno="701" slineno="22-8"/>Collections and Housing Court, the Judicial Council may lease space to be used by the <ln numlevel="1" lineno="702" slineno="22-9"/>Collections and Housing Court.</amend></subsection><subsection ssid="13-4" dnum="_-o:4-i" numlevel="1" lineno="703" slineno="22-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">A lease or reimbursement for the Collections and Housing Court must comply with the <ln numlevel="1" lineno="704" slineno="22-11"/>standards of the Division of Facilities Construction and Management that are applicable <ln numlevel="1" lineno="705" slineno="22-12"/>to state agencies.</amend></subsection><subsection ssid="13-5" dnum="_-o:5-i" numlevel="1" lineno="706" slineno="22-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1320" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">The cost of salaries, travel, and training required for the discharge of the duties of <ln numlevel="1" lineno="707" slineno="22-14"/>judges, secretaries of judges or court executives, court executives, and court reporters <ln numlevel="1" lineno="708" slineno="22-15"/>for the Collections and Housing Court are paid from appropriations made by the <ln numlevel="1" lineno="709" slineno="22-16"/>Legislature.</amend></subsection></section></bsec><bsec buid="14" num="78A-5b-205" type="enact" src="code" uid="C78A-5b-S205_2027010120270101" sort="78A05b02050020270101" numlevel="1" lineno="710" slineno="23-1" sn="23"><section numlevel="1" lineno="711" slineno="23-2" number="78A-5b-205" type="enact"><secline lineno="710">Section 23. Section <bold>78A-5b-205</bold> is enacted to read:</secline><catline lineno="711"><bold>78A-5b-205<parens/>. Court sessions.</bold></catline><sectionText lineno="712"><para/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">The Collections and Housing Court shall:</amend></sectionText><subsection ssid="14-3" dnum="_-o:1-i" numlevel="1" lineno="713" slineno="23-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1321" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">hold court regularly; and</amend></subsection><subsection ssid="14-2" dnum="_-o:2-i" numlevel="1" lineno="714" slineno="23-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1322" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">make every effort to hold remote hearings for an action before the Collections and <ln numlevel="1" lineno="715" slineno="23-6"/>Housing Court.</amend></subsection></section></bsec><bsec buid="36" num="78A-10a-203" type="amend" src="code" uid="C78A-10a-S203_2027010120270101" sort="78A10a02030020270101" numlevel="1" lineno="716" slineno="24-1" sn="24"><section number="78A-10a-203" numlevel="1" lineno="717" slineno="24-2" type="amend"><secline lineno="716">Section 24. Section <bold>78A-10a-203</bold> is amended to read:</secline><catline lineno="717"><bold>78A-10a-203<parens/>. Procedures for judicial nomination commission -- Meetings -- <ln numlevel="1" lineno="718" slineno="24-3"/>Certification -- Governor appointment.</bold></catline><subsection ssid="36-null-1" dnum="1-o" numlevel="1" lineno="719" slineno="24-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="36-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A commission may:<subsection ssid="36-null-3" dnum="i-o" numlevel="1" lineno="720" slineno="24-5" level="3" tab="1"><display>(i)</display>meet as necessary to perform the commission's function; and</subsection><subsection ssid="36-null-4" dnum="ii-o" numlevel="1" lineno="721" slineno="24-6" level="3" tab="1"><display>(ii)</display>investigate the applicants of a judicial vacancy, including seeking input from <ln numlevel="1" lineno="722" slineno="24-7"/>members and employees of the judiciary and the community.</subsection></subsection><subsection ssid="36-null-5" dnum="b-o" numlevel="1" lineno="723" slineno="24-8" level="2"><display>(b)</display>A commission may consult with the Judicial Council regarding the applicants for a <ln numlevel="1" lineno="724" slineno="24-9"/>judicial vacancy.</subsection><subsection ssid="36-null-6" dnum="c-o" numlevel="1" lineno="725" slineno="24-10" level="2"><display>(c)</display>A commission is exempt from the requirements of <xref depth="1" refnumber="52-4" start="0">Title 52, Chapter 4, Open and <ln numlevel="1" lineno="726" slineno="24-11"/>Public Meetings Act</xref>.</subsection></subsection><subsection ssid="36-null-7" dnum="2-o" numlevel="1" lineno="727" slineno="24-12" level="1"><display>(2)</display>In determining which of the applicants are the most qualified, a commission shall <ln numlevel="1" lineno="728" slineno="24-13"/>determine by a majority vote of the commissioners present which of the applicants best <ln numlevel="1" lineno="729" slineno="24-14"/>possess the ability, temperament, training, and experience that qualifies an applicant for <ln numlevel="1" lineno="730" slineno="24-15"/>the office.</subsection><subsection ssid="36-null-8" dnum="3-o" numlevel="1" lineno="731" slineno="24-16" level="1" space="false"><display>(3)</display><subsection ssid="36-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided under Subsection <xref depth="4" refnumber="78A-10a-203(3)(b)" start="0">(3)(b)</xref>:<subsection ssid="36-null-10" dnum="i-o" numlevel="1" lineno="732" slineno="24-17" level="3" tab="1"><display>(i)</display>the appellate court nominating commission shall certify to the governor a list of <ln numlevel="1" lineno="733" slineno="24-18"/>the seven most qualified applicants per judicial vacancy;</subsection><subsection ssid="36-null-11" dnum="ii-o" numlevel="1" lineno="734" slineno="24-19" level="3" tab="1"><display>(ii)</display>a district and juvenile court nominating commission shall certify to the governor a <ln numlevel="1" lineno="735" slineno="24-20"/>list of the five most qualified applicants per judicial vacancy;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="36-null-12" dnum="iii-o" numlevel="1" lineno="736" slineno="24-21" level="3" tab="1"><display>(iii)</display>the business and chancery court nominating commission shall certify to the <ln numlevel="1" lineno="737" slineno="24-22"/>governor a list of the seven most qualified applicants per judicial vacancy<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="36-28" dnum="_-o:iv-i" numlevel="1" lineno="738" slineno="24-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1335" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">the collections and housing court nominating commission shall certify to the <ln numlevel="1" lineno="739" slineno="24-24"/>governor a list of the seven most qualified applicants per judicial vacancy.</amend></subsection></subsection><subsection ssid="36-null-13" dnum="b-o" numlevel="1" lineno="740" slineno="24-25" level="2"><display>(b)</display>If a commission is considering applicants for more than one judicial vacancy existing <ln numlevel="1" lineno="741" slineno="24-26"/>at the same time and for the same court, the commission shall include one additional <ln numlevel="1" lineno="742" slineno="24-27"/>applicant for each additional judicial vacancy in the court in the list of applicants the <ln numlevel="1" lineno="743" slineno="24-28"/>commission certifies to the governor.</subsection></subsection><subsection ssid="36-null-14" dnum="4-o" numlevel="1" lineno="744" slineno="24-29" level="1"><display>(4)</display>A commission shall certify a list to the governor under Subsection <xref depth="4" refnumber="78A-10a-203(3)" start="0">(3)</xref> no more than 45 <ln numlevel="1" lineno="745" slineno="24-30"/>days after convening in accordance with Section <xref depth="3" refnumber="78A-10a-202" start="0">78A-10a-202</xref>.</subsection><subsection ssid="36-null-15" dnum="5-o" numlevel="1" lineno="746" slineno="24-31" level="1"><display>(5)</display>A commission shall, at the time that the commission certifies a list of the most qualified <ln numlevel="1" lineno="747" slineno="24-32"/>applicants to the governor, submit the same list to the president of the Senate, the Senate <ln numlevel="1" lineno="748" slineno="24-33"/>minority leader, and the Office of Legislative Research and General Counsel.</subsection><subsection ssid="36-null-16" dnum="6-o" numlevel="1" lineno="749" slineno="24-34" level="1"><display>(6)</display>A commission shall ensure that the list of applicants certified to the governor:<subsection ssid="36-null-17" dnum="a-o" numlevel="1" lineno="750" slineno="24-35" level="2"><display>(a)</display>meet the qualifications required by law to fill the office; and</subsection><subsection ssid="36-null-18" dnum="b-o" numlevel="1" lineno="751" slineno="24-36" level="2"><display>(b)</display>are willing to serve.</subsection></subsection><subsection ssid="36-null-19" dnum="7-o" numlevel="1" lineno="752" slineno="24-37" level="1"><display>(7)</display>In determining which of the applicants are the most qualified, a commission may not <ln numlevel="1" lineno="753" slineno="24-38"/>decline to certify an applicant's name to the governor because:<subsection ssid="36-null-20" dnum="a-o" numlevel="1" lineno="754" slineno="24-39" level="2"><display>(a)</display>the commission declined to submit that applicant's name to the governor to fill a <ln numlevel="1" lineno="755" slineno="24-40"/>previous judicial vacancy;</subsection><subsection ssid="36-null-21" dnum="b-o" numlevel="1" lineno="756" slineno="24-41" level="2"><display>(b)</display>a previous commission declined to submit that applicant's name to the governor; or</subsection><subsection ssid="36-null-22" dnum="c-o" numlevel="1" lineno="757" slineno="24-42" level="2"><display>(c)</display>the commission or a previous commission submitted the applicant's name to the <ln numlevel="1" lineno="758" slineno="24-43"/>governor and the governor selected another individual to fill the judicial vacancy.</subsection></subsection><subsection ssid="36-null-23" dnum="8-o" numlevel="1" lineno="759" slineno="24-44" level="1"><display>(8)</display>A commission may not certify:<subsection ssid="36-null-24" dnum="a-o" numlevel="1" lineno="760" slineno="24-45" level="2"><display>(a)</display>an applicant who is a justice or judge that was not retained by the voters for the <ln numlevel="1" lineno="761" slineno="24-46"/>office for which the justice or judge was defeated until after the expiration of that <ln numlevel="1" lineno="762" slineno="24-47"/>justice's or judge's term of office; and</subsection><subsection ssid="36-null-25" dnum="b-o" numlevel="1" lineno="763" slineno="24-48" level="2"><display>(b)</display>an applicant who has served on a commission within six months after the day on <ln numlevel="1" lineno="764" slineno="24-49"/>which the commission was last convened.</subsection></subsection><subsection ssid="36-null-26" dnum="9-o" numlevel="1" lineno="765" slineno="24-50" level="1"><display>(9)</display>The governor shall fill a judicial vacancy within 30 days after the day on which the <ln numlevel="1" lineno="766" slineno="24-51"/>governor received the list of nominees from the commission.</subsection><subsection ssid="36-null-27" dnum="10-o" numlevel="1" lineno="767" slineno="24-52" level="1"><display>(10)</display>If the governor fails to fill a judicial vacancy within 30 days after the day on which the <ln numlevel="1" lineno="768" slineno="24-53"/>governor received the list of nominees from the commission, the chief justice of the <ln numlevel="1" lineno="769" slineno="24-54"/>Supreme Court shall, within 20 days, appoint an applicant from the list of nominees <ln numlevel="1" lineno="770" slineno="24-55"/>certified to the governor by the commission.</subsection></section></bsec><bsec buid="43" num="78A-10a-601" type="enact" src="code" uid="C78A-10a-S601_2027010120270101" sort="78A10a06010020270101" numlevel="1" lineno="771" slineno="25-1" sn="25"><section numlevel="1" lineno="773" slineno="25-3" number="78A-10a-601" type="enact"><secline lineno="771">Section 25. Section <bold>78A-10a-603</bold> is enacted to read:</secline><catline lineno="785"><bold>78A-10a-603<parens/>. Membership -- Appointment -- Vacancies -- Removal.</bold></catline><subsection ssid="45-1" dnum="_-o:1-i" numlevel="1" lineno="786" slineno="27-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1355" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The Collections and Housing Court Nominating Commission shall consist of seven <ln numlevel="1" lineno="787" slineno="27-4"/>commissioners, each appointed by the governor to serve a four-year term.</amend></subsection><subsection ssid="45-2" dnum="_-o:2-i" numlevel="1" lineno="788" slineno="27-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1356" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">A commissioner shall:</amend><subsection ssid="45-3" dnum="_-o:a-i" numlevel="1" lineno="789" slineno="27-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1357" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">be a United States citizen;</amend></subsection><subsection ssid="45-4" dnum="_-o:b-i" numlevel="1" lineno="790" slineno="27-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1358" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">be a resident of Utah; and</amend></subsection><subsection ssid="45-5" dnum="_-o:c-i" numlevel="1" lineno="791" slineno="27-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1359" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">serve until the commissioner's successor is appointed.</amend></subsection></subsection><subsection ssid="45-6" dnum="_-o:3-i" numlevel="1" lineno="792" slineno="27-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1360" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">The governor may not appoint:</amend><subsection ssid="45-7" dnum="_-o:a-i" numlevel="1" lineno="793" slineno="27-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1361" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">a commissioner to serve successive terms; or</amend></subsection><subsection ssid="45-8" dnum="_-o:b-i" numlevel="1" lineno="794" slineno="27-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1362" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">a member of the Legislature to serve as a member of the commission.</amend></subsection></subsection><subsection ssid="45-9" dnum="_-o:4-i" numlevel="1" lineno="795" slineno="27-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1363" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">In determining whether to appoint an individual to serve as a commissioner, the <ln numlevel="1" lineno="796" slineno="27-13"/>governor shall consider whether the individual's appointment would ensure that the <ln numlevel="1" lineno="797" slineno="27-14"/>commission selects applicants without any regard to partisan political consideration.</amend></subsection><subsection ssid="45-10" dnum="_-o:5-i" numlevel="1" lineno="798" slineno="27-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1364" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">The governor shall appoint the chair of the commission from among the membership of <ln numlevel="1" lineno="799" slineno="27-16"/>the commission.</amend></subsection><subsection ssid="45-11" dnum="_-o:6-i" numlevel="1" lineno="800" slineno="27-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1365" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">The governor shall fill any vacancy in the commission caused by the expiration of a <ln numlevel="1" lineno="801" slineno="27-18"/>commissioner's term.</amend></subsection><subsection ssid="45-12" dnum="_-o:7-i" numlevel="1" lineno="802" slineno="27-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1366" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="45-13" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">If a commissioner is disqualified, removed, or is otherwise unable to serve, the <ln numlevel="1" lineno="803" slineno="27-20"/>governor shall appoint a replacement commissioner to fill the vacancy for the <ln numlevel="1" lineno="804" slineno="27-21"/>unexpired term.</amend></subsection><subsection ssid="45-14" dnum="_-o:b-i" numlevel="1" lineno="805" slineno="27-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1368" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">A replacement commissioner appointed under Subsection <xref depth="4" refnumber="78A-10a-603(7)(a)">(7)(a)</xref> may not be <ln numlevel="1" lineno="806" slineno="27-23"/>reappointed upon expiration of the term of service.</amend></subsection></subsection><subsection ssid="45-15" dnum="_-o:8-i" numlevel="1" lineno="807" slineno="27-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">The governor may remove a commissioner from the commission at any time with or <ln numlevel="1" lineno="808" slineno="27-25"/>without cause.</amend></subsection></section></bsec><bsec buid="46" num="78A-10a-604" type="enact" src="code" uid="C78A-10a-S604_2027010120270101" sort="78A10a06040020270101" numlevel="1" lineno="809" slineno="28-1" sn="28"><section numlevel="1" lineno="810" slineno="28-2" number="78A-10a-604" type="enact"><secline lineno="809">Section 28. level="1"><display>(1)</display>"Commission" means the Judicial Conduct Commission established by Utah <ln numlevel="1" lineno="832" slineno="30-5"/>Constitution Article VIII, Section 13, and this chapter.</subsection><subsection ssid="37-null-2" dnum="2-o" numlevel="1" lineno="833" slineno="30-6" level="1" space="false"><display>(2)</display><subsection ssid="37-null-3" dnum="a-o" level="2" slineno="30-11" level="2"><display>(b)</display>"Complaint" does not include an allegation initiated by the commission or its staff.</subsection></subsection><subsection ssid="37-null-7" dnum="3-o" numlevel="1" lineno="839" slineno="30-12" level="1"><display>(3)</display>"Investigation" means an inquiry into an allegation of misconduct, including a search <ln numlevel="1" lineno="840" slineno="30-13"/>for and examination of evidence concerning the allegations, which begins upon the <ln numlevel="1" lineno="841" slineno="30-14"/>receipt of a complaint and is completed when either the complaint is dismissed by a <ln numlevel="1" lineno="842" slineno="30-15"/>majority vote of the commission or when an order is sent to the Supreme Court for its <ln numlevel="1" lineno="843" slineno="30-16"/>review in accordance with Utah Constitution Article VIII, Section 13.</subsection><subsection ssid="37-null-8" dnum="4-o" numlevel="1" lineno="844" slineno="30-17" Duration of judgment -- Judgment as a lien upon real property -- <ln numlevel="1" lineno="865" slineno="32-3"/>Abstract of judgment -- Small claims judgment not a lien -- Appeal of judgment -- Child <ln numlevel="1" lineno="866" slineno="32-4"/>support orders.</bold></catline><subsection ssid="39-null-1" dnum="1-o" numlevel="1" lineno="867" slineno="32-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="39-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Judgments shall continue for eight years from the date of entry in a court unless <ln numlevel="1" lineno="868" slineno="32-6"/>previously satisfied, renewed, or unless enforcement of the judgment is stayed in <ln numlevel="1" lineno="869" slineno="32-7"/>accordance with law.</subsection><subsection ssid="39-null-3" dnum="b-o" numlevel="1" lineno="870" slineno="32-8" level="2"><display>(b)</display>Entry of an order renewing a judgment:<subsection ssid="39-null-4" dnum="i-o" numlevel="1" lineno="871" slineno="32-9" level="3"><display>(i)</display>maintains the date of the original judgment;</subsection><subsection ssid="39-null-5" dnum="ii-o" numlevel="1" lineno="872" slineno="32-10" level="3"><display>(ii)</display>maintains the priority of collection of the judgment; and</subsection><subsection ssid="39-null-6" dnum="iii-o" numlevel="1" lineno="873" slineno="32-11" level="3"><display>(iii)</display>except as explicitly provided otherwise by law or contract, begins anew the time <ln numlevel="1" lineno="874" slineno="32-12"/>limitation for an action upon the judgment.</subsection></subsection></subsection><subsection ssid="39-null-7" dnum="2-o" numlevel="1" lineno="875" slineno="32-13" level="1"><display>(2)</display>Before July 1, 1997, except as limited by Subsections <xref depth="4" refnumber="78B-5-202(4)" start="0">(4)</xref> and <xref depth="4" refnumber="78B-5-202(5)" start="0">(5)</xref>, the entry of judgment <ln numlevel="1" lineno="876" slineno="32-14"/>by a district court creates a lien upon the real property of the judgment debtor, not <ln numlevel="1" lineno="877" slineno="32-15"/>exempt from execution, owned or acquired during the existence of the judgment, located <ln numlevel="1" lineno="878" slineno="32-16"/>in the county in which the judgment is entered.</subsection><subsection ssid="39-null-8" dnum="3-o" numlevel="1" lineno="879" slineno="32-17" level="1"><display>(3)</display>An abstract of judgment issued by the court in which the judgment is entered may be <ln numlevel="1" lineno="880" slineno="32-18"/>filed in any court of this state and shall have the same force and effect as a judgment <ln numlevel="1" lineno="881" slineno="32-19"/>entered in that court.</subsection><subsection ssid="39-null-9" dnum="4-o" numlevel="1" lineno="882" slineno="32-20" level="1"><display>(4)</display>Before July 1, 1997, and after May 15, 1998, a judgment entered in a small claims <ln numlevel="1" lineno="883" slineno="32-21"/>action may not qualify as a lien upon real property unless abstracted to the district court <ln numlevel="1" lineno="884" slineno="32-22"/>and recorded in accordance with Subsection <xref depth="4" refnumber="78B-5-202(3)" start="0">(3)</xref>.</subsection><subsection ssid="39-null-10" dnum="5-o" numlevel="1" lineno="885" slineno="32-23" level="1" space="false"><display>(5)</display><subsection ssid="39-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If any judgment is appealed, upon deposit with the court where the notice of <ln numlevel="1" lineno="886" slineno="32-24"/>appeal is filed of cash or other security in a form and amount considered sufficient by <ln numlevel="1" lineno="887" slineno="32-25"/>the court that rendered the judgment to secure the full amount of the judgment, <ln numlevel="1" lineno="888" slineno="32-26"/>together with ongoing interest and any other anticipated damages or costs, including <ln numlevel="1" lineno="889" slineno="32-27"/>attorney fees and costs on appeal, the lien created by the judgment shall be <ln numlevel="1" lineno="890" slineno="32-28"/>terminated as provided in Subsection <xref depth="4" refnumber="78B-5-202(5)(b)" start="0">(5)(b)</xref>.</subsection><subsection ssid="39-null-12" dnum="b-o" numlevel="1" lineno="891" slineno="32-29" level="2"><display>(b)</display>Upon the deposit of sufficient security as provided in Subsection <xref depth="4" refnumber="78B-5-202(5)(a)" start="0">(5)(a)</xref>, the court <ln numlevel="1" lineno="892" slineno="32-30"/>shall enter an order terminating the lien created by the judgment and granting the <ln numlevel="1" lineno="893" slineno="32-31"/>judgment creditor a perfected lien in the deposited security as of the date of the <ln numlevel="1" lineno="894" slineno="32-32"/>original judgment.</subsection></subsection><subsection ssid="39-null-13" dnum="6-o" numlevel="1" lineno="895" slineno="32-33" level="1" space="false"><display>(6)</display><subsection ssid="39-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A child support order, including an order or judgment for guardian ad litem <ln numlevel="1" lineno="896" slineno="32-34"/>attorney fees and costs, or a sum certain judgment for past due support may be <ln numlevel="1" lineno="897" slineno="32-35"/>enforced:<subsection ssid="39-null-15" dnum="i-o" numlevel="1" lineno="898" slineno="32-36" level="3" tab="1"><display>(i)</display>within four years after the date the youngest child reaches majority; or</subsection><subsection ssid="39-null-16" dnum="ii-o" numlevel="1" lineno="899" slineno="32-37" level="3" tab="1"><display>(ii)</display>eight years from the date of entry of the sum certain judgment entered by a <ln numlevel="1" lineno="900" slineno="32-38"/>tribunal.</subsection></subsection><subsection ssid="39-null-17" dnum="b-o" numlevel="1" lineno="901" slineno="32-39" level="2"><display>(b)</display>The longer period of duration shall apply in every order.</subsection><subsection ssid="39-null-18" dnum="c-o" numlevel="1" lineno="902" slineno="32-40" level="2"><display>(c)</display>A sum certain judgment may be renewed to extend the duration.</subsection></subsection><subsection ssid="39-null-19" dnum="7-o" numlevel="1" lineno="903" slineno="32-41" level="1" space="false"><display>(7)</display><subsection ssid="39-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After July 1, 2002, a judgment entered by a district court, a justice court, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/>the <ln numlevel="1" lineno="904" slineno="32-42"/>Business and Chancery Court<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">, or the Collections and Housing Court</amend>, becomes a lien <ln numlevel="1" lineno="905" slineno="32-43"/>upon real property if:<subsection ssid="39-null-21" dnum="i-o" numlevel="1" lineno="906" slineno="32-44" level="3" tab="1"><display>(i)</display>the judgment or an abstract of the judgment containing the information identifying <ln numlevel="1" lineno="907" slineno="32-45"/>the judgment debtor as described in Subsection <xref depth="4" refnumber="78B-5-201(4)(b)" start="0">78B-5-201(4)(b)</xref> is recorded in the <ln numlevel="1" lineno="908" slineno="32-46"/>office of the county recorder; or</subsection><subsection ssid="39-null-22" dnum="ii-o" numlevel="1" lineno="909" slineno="32-47" level="3" tab="1"><display>(ii)</display>the judgment or an abstract of the judgment and a separate information statement <ln numlevel="1" lineno="910" slineno="32-48"/>of the judgment creditor as described in Subsection <xref depth="4" refnumber="78B-5-201(5)" start="0">78B-5-201(5)</xref> is recorded in <ln numlevel="1" lineno="911" slineno="32-49"/>the office of the county recorder.</subsection></subsection><subsection ssid="39-null-23" dnum="b-o" numlevel="1" lineno="912" slineno="32-50" level="2"><display>(b)</display>The judgment shall run from the date of entry by the court.</subsection><subsection ssid="39-null-24" dnum="c-o" numlevel="1" lineno="913" slineno="32-51" level="2"><display>(c)</display>The real property subject to the lien includes all the real property of the judgment <ln numlevel="1" lineno="914" slineno="32-52"/>debtor:<subsection ssid="39-null-25" dnum="i-o" numlevel="1" lineno="915" slineno="32-53" level="3"><display>(i)</display>in the county in which the recording under Subsection <xref depth="4" refnumber="78B-5-202(7)(a)(i)" start="0">(7)(a)(i)</xref> or <xref depth="4" refnumber="78B-5-202(7)(a)(ii)" start="0">(ii)</xref> occurs; and</subsection><subsection ssid="39-null-26" dnum="ii-o" numlevel="1" lineno="916" slineno="32-54" level="3"><display>(ii)</display>owned or acquired at any time by the judgment debtor during the time the <ln numlevel="1" lineno="917" slineno="32-55"/>judgment is effective.</subsection></subsection><subsection ssid="39-null-27" dnum="d-o" numlevel="1" lineno="918" slineno="32-56" level="2"><display>(d)</display>If the judgment that gives rise to a lien described in Subsection <xref refnumber="78B-5-202(7)(a)" depth="4">(7)(a)</xref> is a judgment <ln numlevel="1" lineno="919" slineno="32-57"/>in favor of a state agency, the real property subject to the lien includes all real <ln numlevel="1" lineno="920" slineno="32-58"/>property of the judgment debtor in the state.</subsection><subsection ssid="39-null-28" dnum="e-o" numlevel="1" lineno="921" slineno="32-59" level="2"><display>(e)</display>State agencies are exempt from the recording requirement of Subsection <xref depth="4" refnumber="78B-5-202(7)(a)" start="0">(7)(a)</xref>.</subsection></subsection><subsection ssid="39-null-29" dnum="8-o" numlevel="1" lineno="922" slineno="32-60" level="1" space="false"><display>(8)</display><subsection ssid="39-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A judgment referred to in Subsection <xref depth="4" refnumber="78B-5-202(7)" start="0">(7)</xref> shall be entered under the name of the <ln numlevel="1" lineno="923" slineno="32-61"/>judgment debtor in the judgment index in the office of the county recorder as <ln numlevel="1" lineno="924" slineno="32-62"/>required in Section <xref depth="3" refnumber="17-71-302">17-71-302</xref>.</subsection><subsection ssid="39-null-31" dnum="b-o" numlevel="1" lineno="925" slineno="32-63" level="2"><display>(b)</display>A judgment containing a legal description shall also be abstracted in the appropriate <ln numlevel="1" lineno="926" slineno="32-64"/>tract index in the office of the county recorder.</subsection></subsection><subsection ssid="39-null-32" dnum="9-o" numlevel="1" lineno="927" slineno="32-65" level="1" space="false"><display>(9)</display><subsection ssid="39-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To release, assign, renew, or extend a lien created by a judgment recorded in the <ln numlevel="1" lineno="928" slineno="32-66"/>office of a county recorder, a person shall, in the office of the county recorder of each <ln numlevel="1" lineno="929" slineno="32-67"/>county in which an instrument creating the lien is recorded, record a document <ln numlevel="1" lineno="930" slineno="32-68"/>releasing, assigning, renewing, or extending the lien.</subsection><subsection ssid="39-null-34" dnum="b-o" numlevel="1" lineno="931" slineno="32-69" level="2"><display>(b)</display>The document described in Subsection <xref depth="4" refnumber="78B-5-202(9)(a)" start="0">(9)(a)</xref> shall include:<subsection ssid="39-null-35" dnum="i-o" numlevel="1" lineno="932" slineno="32-70" level="3"><display>(i)</display>the date of the release, assignment, renewal, or extension;</subsection><subsection ssid="39-null-36" dnum="ii-o" numlevel="1" lineno="933" slineno="32-71" level="3"><display>(ii)</display>the name of any judgment creditor, debtor, assignor, or assignee; and</subsection><subsection ssid="39-null-37" dnum="iii-o" numlevel="1" lineno="934" slineno="32-72" level="3"><display>(iii)</display>for the county in which the document is recorded in accordance with Subsection <xref depth="4" refnumber="78B-5-202(9)(a)" start="0"><ln numlevel="1" lineno="935" slineno="32-73"/>(9)(a)</xref>:<subsection ssid="39-null-38" dnum="A-o" numlevel="1" lineno="936" slineno="32-74" level="4"><display>(A)</display>the date on which the instrument creating the lien was recorded in that <ln numlevel="1" lineno="937" slineno="32-75"/>county's office of the county recorder; and</subsection><subsection ssid="39-null-39" dnum="B-o" numlevel="1" lineno="938" slineno="32-76" level="4"><display>(B)</display>in accordance with Section <xref depth="3" refnumber="57-3-106" start="0">57-3-106</xref>, that county recorder's entry number and <ln numlevel="1" lineno="939" slineno="32-77"/>book and page of the recorded instrument creating the judgment lien.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="40" num="78B-5-206" type="amend" src="code" uid="C78B-5-S206_2027010120270101" sort="78B05 02060020270101" numlevel="1" lineno="940" slineno="33-1" sn="33"><section number="78B-5-206" numlevel="1" lineno="941" slineno="33-2" type="amend"><secline lineno="940">Section 33. Mileage allowance for judgment debtor required to appear.</bold></catline><subsection ssid="40-null-1" dnum="1-o" numlevel="1" lineno="942" slineno="33-3" level="1" placement="noreturn"><display>(1)</display>A judgment debtor legally required to appear before a district court<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> the Business <ln numlevel="1" lineno="943" slineno="33-4"/>and Chancery Court<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">, or the Collections and Housing Court</amend> to answer concerning the <ln numlevel="1" lineno="944" slineno="33-5"/>debtor's property is entitled, on a sufficient showing of need, to mileage of 15 cents per <ln numlevel="1" lineno="945" slineno="33-6"/>mile for each mile actually and necessarily traveled in going only, to be paid by the <ln numlevel="1" lineno="946" slineno="33-7"/>judgment creditor at whose instance the judgment debtor was required to appear.</subsection><subsection ssid="40-null-2" dnum="2-o" numlevel="1" lineno="947" slineno="33-8" level="1"><display>(2)</display>The judgment creditor is not required to make any payment for such mileage until the <ln numlevel="1" lineno="948" slineno="33-9"/>judgment debtor has actually appeared before the court.</subsection></section></bsec><bsec buid="41" num="78B-6-1303" type="amend" src="code" uid="C78B-6-S1303_2027010120270101" sort="78B06 13030020270101" numlevel="1" lineno="949" slineno="34-1" sn="34"><section number="78B-6-1303" numlevel="1" lineno="950" slineno="34-2" type="amend"><secline lineno="949">Section 34. Section <bold>78B-6-1303</bold> is amended to read:</secline><catline lineno="950"><bold>78B-6-1303<parens/>. Lis pendens -- Notice.</bold></catline><subsection ssid="41-null-1" dnum="1-o" numlevel="1" lineno="951" slineno="34-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="41-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any party to an action filed in the United States District Court for the District of <ln numlevel="1" lineno="952" slineno="34-4"/>Utah, the United States Bankruptcy Court for the District of Utah, a district court of <ln numlevel="1" lineno="953" slineno="34-5"/>this state, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/>the Business and Chancery Court of this state,<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"> or the Collections and <ln numlevel="1" lineno="954" slineno="34-6"/>Housing Court of this state</amend> that affects the title to, or the right of possession of, real <ln numlevel="1" lineno="955" slineno="34-7"/>property may file a notice of pendency of action.</subsection><subsection ssid="41-null-3" dnum="b-o" numlevel="1" lineno="956" slineno="34-8" level="2"><display>(b)</display>A party that chooses to file a notice of pendency of action shall:<subsection ssid="41-null-4" dnum="i-o" numlevel="1" lineno="957" slineno="34-9" level="3"><display>(i)</display>first, file the notice with the court that has jurisdiction of the action; and</subsection><subsection ssid="41-null-5" dnum="ii-o" numlevel="1" lineno="958" slineno="34-10" level="3"><display>(ii)</display>second, record a copy of the notice filed with the court with the county recorder <ln numlevel="1" lineno="959" slineno="34-11"/>in the county where the property or any portion of the property is located.</subsection></subsection><subsection ssid="41-null-6" dnum="c-o" numlevel="1" lineno="960" slineno="34-12" level="2"><display>(c)</display>A person may not file a notice of pendency of action unless a case has been filed and <ln numlevel="1" lineno="961" slineno="34-13"/>is pending in the United States District Court for the District of Utah, the United <ln numlevel="1" lineno="962" slineno="34-14"/>States Bankruptcy Court for the District of Utah, a district court of this state, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/>the <ln numlevel="1" lineno="963" slineno="34-15"/>Business and Chancery Court of this state<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">, or the Collections and Housing Court of <ln numlevel="1" lineno="964" slineno="34-16"/>this state</amend>.</subsection></subsection><subsection ssid="41-null-7" dnum="2-o" numlevel="1" lineno="965" slineno="34-17" level="1"><display>(2)</display>The notice shall contain:<subsection ssid="41-null-8" dnum="a-o" numlevel="1" lineno="966" slineno="34-18" level="2"><display>(a)</display>the caption of the case, with the names of the parties and the case number;</subsection><subsection ssid="41-null-9" dnum="b-o" numlevel="1" lineno="967" slineno="34-19" level="2"><display>(b)</display>the object of the action or defense; and</subsection><subsection ssid="41-null-10" dnum="c-o" numlevel="1" lineno="968" slineno="34-20" level="2"><display>(c)</display>the specific legal description of only the property affected.</subsection></subsection><subsection ssid="41-null-11" dnum="3-o" numlevel="1" lineno="969" slineno="34-21" level="1"><display>(3)</display>From the time of filing the notice, a purchaser, an encumbrancer of the property, or any <ln numlevel="1" lineno="970" slineno="34-22"/>other party in interest that may be affected by the action is considered to have <ln numlevel="1" lineno="971" slineno="34-23"/>constructive notice of pendency of action.</subsection></section></bsec><bsec buid="50" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="972" slineno="35-1" sn="35"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="972">Section 35.  <bold>Effective Date.</bold></secline><sectionText lineno="973"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="1/1/2027">January 1, 2027</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-6-26 1:23 PM</tm></rev></foot></leg>
