bill establishes the Office of Interscholastic Activities within the State Board of <ln numlevel="1" lineno="6" slineno="0-6"/>Education to govern interscholastic activities.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">establishes the Office of Interscholastic Activities (office) within the State Board of <ln numlevel="1" lineno="11" slineno="0-11"/>Education (state board) to govern interscholastic activities and provides the office's <ln numlevel="1" lineno="12" slineno="0-12"/>duties;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">allows the office to contract with a Definitions.</bold></catline><sectionText lineno="50"><tab/>As used in this chapter:</sectionText><subsection ssid="35-null-1" dnum="1-o" numlevel="1" lineno="51" slineno="1-4" level="1"><display>(1)</display>"Anchor location" means:<subsection ssid="35-null-2" dnum="a-o" numlevel="1" lineno="52" slineno="1-5" level="2"><display>(a)</display>the physical location where the public body conducting an electronic meeting under <ln numlevel="1" lineno="53" slineno="1-6"/>Section <xref depth="3" refnumber="52-4-207">52-4-207</xref> normally conducts meetings of the public body; or</subsection><subsection ssid="35-null-3" dnum="b-o" numlevel="1" lineno="54" slineno="1-7" level="2"><display>(b)</display>a location other than the location described in Subsection <xref depth="4" refnumber="52-4-103(1)(a)">(1)(a)</xref> that is reasonably as <ln numlevel="1" lineno="55" slineno="1-8"/>accessible to the public as the location described in Subsection <xref depth="4" refnumber="52-4-103(1)(a)">(1)(a)</xref>.</subsection></subsection><subsection ssid="35-null-4" dnum="2-o" numlevel="1" lineno="56" slineno="1-9" level="1"><display>(2)</display>"Capitol hill complex" means the grounds and buildings within the area bounded by 300 <ln numlevel="1" lineno="57" slineno="1-10"/>North Street, Columbus Street, 500 North Street, and East Capitol Boulevard in Salt <ln numlevel="1" lineno="58" slineno="1-11"/>Lake City.</subsection><subsection ssid="35-null-5" dnum="3-o" numlevel="1" lineno="59" slineno="1-12" level="1"><display>(3)</display>"Electronic meeting" means a meeting that some or all public body members attend <ln numlevel="1" lineno="60" slineno="1-13"/>through an electronic video, audio, or both video and audio connection, as provided in <ln numlevel="1" lineno="61" slineno="1-14"/>Section <xref depth="3" refnumber="52-4-207">52-4-207</xref>.</subsection><subsection ssid="35-null-6" dnum="4-o" numlevel="1" lineno="62" slineno="1-15" level="1"><display>(4)</display>"Fiduciary or commercial information" means information:<subsection ssid="35-null-7" dnum="a-o" numlevel="1" lineno="63" slineno="1-16" level="2"><display>(a)</display>related to any subject if disclosure:<subsection ssid="35-null-8" dnum="i-o" numlevel="1" lineno="64" slineno="1-17" level="3"><display>(i)</display>would conflict with a fiduciary obligation; or</subsection><subsection ssid="35-null-9" dnum="ii-o" numlevel="1" lineno="65" slineno="1-18" level="3"><display>(ii)</display>is prohibited by insider trading provisions; or</subsection></subsection><subsection ssid="35-null-10" dnum="b-o" numlevel="1" lineno="66" slineno="1-19" level="2"><display>(b)</display>that is commercial in nature including:<subsection ssid="35-null-11" dnum="i-o" numlevel="1" lineno="67" slineno="1-20" level="3"><display>(i)</display>account owners or borrowers;</subsection><subsection ssid="35-null-12" dnum="ii-o" numlevel="1" lineno="68" slineno="1-21" level="3"><display>(ii)</display>demographic data;</subsection><subsection ssid="35-null-13" dnum="iii-o" numlevel="1" lineno="69" slineno="1-22" level="3"><display>(iii)</display>contracts and related payments;</subsection><subsection ssid="35-null-14" dnum="iv-o" numlevel="1" lineno="70" slineno="1-23" level="3"><display>(iv)</display>negotiations;</subsection><subsection ssid="35-null-15" dnum="v-o" numlevel="1" lineno="71" slineno="1-24" level="3"><display>(v)</display>proposals or bids;</subsection><subsection ssid="35-null-16" dnum="vi-o" numlevel="1" lineno="72" slineno="1-25" level="3"><display>(vi)</display>investments;</subsection><subsection ssid="35-null-17" dnum="vii-o" numlevel="1" lineno="73" slineno="1-26" level="3"><display>(vii)</display>management of funds;</subsection><subsection ssid="35-null-18" dnum="viii-o" numlevel="1" lineno="74" slineno="1-27" level="3"><display>(viii)</display>fees and charges;</subsection><subsection ssid="35-null-19" dnum="ix-o" numlevel="1" lineno="75" slineno="1-28" level="3"><display>(ix)</display>plan and program design;</subsection><subsection ssid="35-null-20" dnum="x-o" numlevel="1" lineno="76" slineno="1-29" level="3"><display>(x)</display>investment options and underlying investments offered to account owners;</subsection><subsection ssid="35-null-21" dnum="xi-o" numlevel="1" lineno="77" slineno="1-30" level="3"><display>(xi)</display>marketing and outreach efforts;</subsection><subsection ssid="35-null-22" dnum="xii-o" numlevel="1" lineno="78" slineno="1-31" level="3"><display>(xii)</display>financial plans; or</subsection><subsection ssid="35-null-23" dnum="xiii-o" numlevel="1" lineno="79" slineno="1-32" level="3"><display>(xiii)</display>reviews and audits.</subsection></subsection></subsection><subsection ssid="35-null-24" dnum="5-o" numlevel="1" lineno="80" slineno="1-33" level="1"><display>(5)</display>"Meeting" means a gathering:<subsection ssid="35-null-25" dnum="a-o" numlevel="1" lineno="81" slineno="1-34" level="2"><display>(a)</display>of a public body or specified body;</subsection><subsection ssid="35-null-26" dnum="b-o" numlevel="1" lineno="82" slineno="1-35" level="2"><display>(b)</display>with a quorum present; and</subsection><subsection ssid="35-null-27" dnum="c-o" numlevel="1" lineno="83" slineno="1-36" level="2"><display>(c)</display>that is convened:<subsection ssid="35-null-28" dnum="i-o" numlevel="1" lineno="84" slineno="1-37" level="3"><display>(i)</display>by an individual:<subsection ssid="35-null-29" dnum="A-o" numlevel="1" lineno="85" slineno="1-38" level="4"><display>(A)</display>with authority to convene the public body or specified body; and</subsection><subsection ssid="35-null-30" dnum="B-o" numlevel="1" lineno="86" slineno="1-39" level="4"><display>(B)</display>following the process provided by law for convening the public body or <ln numlevel="1" lineno="87" slineno="1-40"/>specified body; and</subsection></subsection><subsection ssid="35-null-31" dnum="ii-o" numlevel="1" lineno="88" slineno="1-41" level="3"><display>(ii)</display>for the express purpose of acting as a public body or specified body to:<subsection ssid="35-null-32" dnum="A-o" numlevel="1" lineno="89" slineno="1-42" level="4"><display>(A)</display>receive public comment about a relevant matter;</subsection><subsection ssid="35-null-33" dnum="B-o" numlevel="1" lineno="90" slineno="1-43" level="4"><display>(B)</display>deliberate about a relevant matter; or</subsection><subsection ssid="35-null-34" dnum="C-o" numlevel="1" lineno="91" slineno="1-44" level="4"><display>(C)</display>take action upon a relevant matter.</subsection></subsection></subsection></subsection><subsection ssid="35-null-35" dnum="6-o" numlevel="1" lineno="92" slineno="1-45" level="1"><display>(6)</display>"Participate" means the ability to communicate with all of the members of a public <ln numlevel="1" lineno="93" slineno="1-46"/>body, either verbally or electronically, so that each member of the public body can hear <ln numlevel="1" lineno="94" slineno="1-47"/>or observe the communication.</subsection><subsection ssid="35-null-36" dnum="7-o" numlevel="1" lineno="95" slineno="1-48" level="1" space="false"><display>(7)</display><subsection ssid="35-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Public body" means:<subsection ssid="35-null-38" dnum="i-o" numlevel="1" lineno="96" slineno="1-49" level="3" tab="1"><display>(i)</display>any administrative, advisory, executive, or legislative body of the state or its <ln numlevel="1" lineno="97" slineno="1-50"/>political subdivisions that:<subsection ssid="35-null-39" dnum="A-o" numlevel="1" lineno="98" slineno="1-51" level="4"><display>(A)</display>is created by the Utah Constitution, statute, rule, ordinance, or resolution;</subsection><subsection ssid="35-null-40" dnum="B-o" numlevel="1" lineno="99" slineno="1-52" level="4"><display>(B)</display>consists of two or more individuals;</subsection><subsection ssid="35-null-41" dnum="C-o" numlevel="1" lineno="100" slineno="1-53" level="4"><display>(C)</display>expends, disburses, or is supported in whole or in part by tax revenue; and</subsection><subsection ssid="35-null-42" dnum="D-o" numlevel="1" lineno="101" slineno="1-54" level="4"><display>(D)</display>is vested with the authority to make decisions regarding the public's business; <ln numlevel="1" lineno="102" slineno="1-55"/>or</subsection></subsection><subsection ssid="35-null-43" dnum="ii-o" numlevel="1" lineno="103" slineno="1-56" level="3" tab="1"><display>(ii)</display>any administrative, advisory, executive, or policymaking body of an association, <ln numlevel="1" lineno="104" slineno="1-57"/>as that term is defined in Section <xref depth="3" refnumber="53G-7-1101">53G-7-1101</xref>, that:<subsection ssid="35-null-44" dnum="A-o" numlevel="1" lineno="105" slineno="1-58" level="4"><display>(A)</display>consists of two or more individuals;</subsection><subsection ssid="35-null-45" dnum="B-o" numlevel="1" lineno="106" slineno="1-59" level="4"><display>(B)</display>expends, disburses, or is supported in whole or in part by dues paid by a <ln numlevel="1" lineno="107" slineno="1-60"/>public school or whose employees participate in a benefit or program described <ln numlevel="1" lineno="108" slineno="1-61"/>in Title <xref depth="0" refnumber="49">49, Utah State Retirement and Insurance Benefit Act</xref>; and</subsection><subsection ssid="35-null-51" dnum="iv-o" numlevel="1" lineno="119" slineno="1-72" level="3"><display>(iv)</display>a project entity, as that term is defined in Section <xref depth="3" refnumber="11-13-103">11-13-103</xref>.</subsection></subsection><subsection ssid="35-null-52" dnum="c-o" numlevel="1" lineno="120" slineno="1-73" level="2"><display>(c)</display>"Public body" does not include:<subsection ssid="35-null-53" dnum="i-o" numlevel="1" lineno="121" slineno="1-74" level="3"><display>(i)</display>a political party, a political group, or a political caucus;</subsection><subsection ssid="35-null-54" dnum="ii-o" numlevel="1" lineno="122" slineno="1-75" level="3"><display>(ii)</display>a conference committee, a rules committee, a sifting committee, or an <ln numlevel="1" lineno="123" slineno="1-76"/>administrative staff committee of the Legislature;</subsection><subsection ssid="35-null-55" dnum="iii-o" numlevel="1" lineno="124" slineno="1-77" level="3"><display>(iii)</display>a school community council or charter trust land council, as that term is defined <ln numlevel="1" lineno="125" slineno="1-78"/>in Section <xref depth="3" refnumber="53G-7-1203">53G-7-1203</xref>;</subsection><subsection ssid="35-null-56" dnum="iv-o" numlevel="1" lineno="126" slineno="1-79" level="3"><display>(iv)</display>a taxed interlocal entity, as that term is defined in Section <xref depth="3" refnumber="11-13-602">11-13-602</xref>, if the taxed <ln numlevel="1" lineno="127" slineno="1-80"/>interlocal entity is not a project entity;</subsection><subsection ssid="35-null-57" dnum="v-o" numlevel="1" lineno="128" slineno="1-81" level="3"><display>(v)</display>the following Legislative Management subcommittees, which are established in <ln numlevel="1" lineno="129" slineno="1-82"/>Section <xref depth="3" refnumber="36-12-8">36-12-8</xref>, when meeting for the purpose of selecting or evaluating a <ln numlevel="1" lineno="130" slineno="1-83"/>candidate to recommend for employment, except that the meeting in which a <ln numlevel="1" lineno="131" slineno="1-84"/>subcommittee votes to recommend that a candidate be employed shall be subject <ln numlevel="1" lineno="132" slineno="1-85"/>to the provisions of this act:<subsection ssid="35-null-58" dnum="A-o" numlevel="1" lineno="133" slineno="1-86" level="4"><display>(A)</display>the Research and General Counsel Subcommittee;</subsection><subsection ssid="35-null-59" dnum="B-o" numlevel="1" lineno="134" slineno="1-87" level="4"><display>(B)</display>the Budget Subcommittee; and</subsection><subsection ssid="35-null-60" dnum="C-o" numlevel="1" lineno="135" slineno="1-88" level="4"><display>(C)</display>the Audit Subcommittee; or</subsection></subsection><subsection ssid="35-null-61" dnum="vi-o" numlevel="1" lineno="136" slineno="1-89" level="3"><display>(vi)</display>a search committee that selects finalists for a position as an institution of higher <ln numlevel="1" lineno="137" slineno="1-90"/>education president under Section <xref depth="3" refnumber="53H-3-302">53H-3-302</xref>.</subsection></subsection></subsection><subsection ssid="35-null-62" dnum="8-o" numlevel="1" lineno="138" slineno="1-91" level="1"><display>(8)</display>"Public statement" means a statement made in the ordinary course of business of the <ln numlevel="1" lineno="139" slineno="1-92"/>public body with the intent that all other members of the public body receive it.</subsection><subsection ssid="35-null-63" dnum="9-o" numlevel="1" lineno="140" slineno="1-93" level="1"><display>(9)</display>"Quorum" means a simple majority of the membership of a public body, unless <ln numlevel="1" lineno="141" slineno="1-94"/>otherwise defined by applicable law.</subsection><subsection ssid="35-null-64" dnum="10-o" numlevel="1" lineno="142" slineno="1-95" level="1"><display>(10)</display>"Recording" means an audio, or an audio and video, record of the proceedings of a <ln numlevel="1" lineno="143" slineno="1-96"/>meeting that can be used to review the proceedings of the meeting.</subsection><subsection ssid="35-null-65" dnum="11-o" numlevel="1" lineno="144" slineno="1-97" level="1" space="false"><display>(11)</display><subsection ssid="35-null-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Relevant matter" means a matter that is within the scope of the authority of a <ln numlevel="1" lineno="145" slineno="1-98"/>public body or specified body.</subsection><subsection ssid="35-null-67" dnum="b-o" numlevel="1" lineno="146" slineno="1-99" level="2"><display>(b)</display>"Relevant matter" does not include, for a public body with both executive and <ln numlevel="1" lineno="147" slineno="1-100"/>legislative responsibilities, a managerial or operational matter.</subsection></subsection><subsection ssid="35-null-68" dnum="12-o" numlevel="1" lineno="148" slineno="1-101" level="1"><display>(12)</display>"Specified body":<subsection ssid="35-null-69" dnum="a-o" numlevel="1" lineno="149" slineno="1-102" level="2"><display>(a)</display>means an administrative, advisory, executive, or legislative body that:<subsection ssid="35-null-70" dnum="i-o" numlevel="1" lineno="150" slineno="1-103" level="3"><display>(i)</display>is not a public body;</subsection><subsection ssid="35-null-71" dnum="ii-o" numlevel="1" lineno="151" slineno="1-104" level="3"><display>(ii)</display>consists of three or more members; and</subsection><subsection ssid="35-null-72" dnum="iii-o" numlevel="1" lineno="152" slineno="1-105" level="3"><display>(iii)</display>includes at least one member who is:<subsection ssid="35-null-73" dnum="A-o" numlevel="1" lineno="153" slineno="1-106" level="4"><display>(A)</display>a legislator; and</subsection><subsection ssid="35-null-74" dnum="B-o" numlevel="1" lineno="154" slineno="1-107" level="4"><display>(B)</display>officially appointed to the body by the president of the Senate, speaker of the <ln numlevel="1" lineno="155" slineno="1-108"/>House of Representatives, or governor; described in Section <xref depth="3" refnumber="53F-2-513">53F-2-513</xref> by the state board evaluating <ln numlevel="1" lineno="224" slineno="2-68"/>the effects of salary bonuses on the recruitment and retention of effective teachers in <ln numlevel="1" lineno="225" slineno="2-69"/>high-poverty schools;</subsection><subsection ssid="17-null-29" dnum="g-o" numlevel="1" lineno="226" slineno="2-70" level="2"><display>(g)</display>upon request, the report described in Section <xref depth="3" refnumber="53F-10-303">53F-10-303</xref> by the state board <ln numlevel="1" lineno="227" slineno="2-71"/>regarding the Rural School Sports Facilities Grant Program;</subsection><subsection ssid="17-null-30" dnum="h-o" numlevel="1" lineno="228" slineno="2-72" level="2"><display>(h)</display>upon request, a report described in Section <xref depth="3" refnumber="53G-7-222">53G-7-222</xref> by an LEA regarding <ln numlevel="1" lineno="229" slineno="2-73"/>expenditure of a percentage of state restricted funds to support an innovative <ln numlevel="1" lineno="230" slineno="2-74"/>education program;</subsection><subsection ssid="17-null-31" dnum="i-o" numlevel="1" lineno="231" slineno="2-75" level="2"><display>(i)</display>the reports described in Section <xref depth="3" refnumber="53G-11-304">53G-11-304</xref> by the state board regarding proposed <ln numlevel="1" lineno="232" slineno="2-76"/>rules and results related to educator exit surveys; and</subsection><subsection ssid="17-null-32" dnum="j-o" numlevel="1" lineno="233" slineno="2-77" level="2"><display>(j)</display>the report described in Section <xref depth="3" refnumber="26B-5-113">26B-5-113</xref> by the Office of Substance Use and Mental <ln numlevel="1" lineno="234" slineno="2-78"/>Health, the state board, and the Department of Health and Human Services regarding <ln numlevel="1" lineno="235" slineno="2-79"/>recommendations related to Medicaid reimbursement for school-based health <ln numlevel="1" lineno="236" slineno="2-80"/>services.</subsection></subsection><subsection ssid="17-null-33" dnum="3-o" numlevel="1" lineno="237" slineno="2-81" level="1"><display>(3)</display>In accordance with applicable provisions and Section <xref depth="3" refnumber="68-3-14">68-3-14</xref>, every five years the <ln numlevel="1" and</amend></subsection></subsection><subsection ssid="9-13" dnum="_-o:ii-i" numlevel="1" lineno="289" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">providing for the organization and classification of schools competing in <ln numlevel="1" lineno="290" slineno="4-18"/>interscholastic activities.</amend></subsection></subsection><subsection ssid="9-16" dnum="_-o:b-i" numlevel="1" lineno="291" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">The office shall:</amend><subsection ssid="9-20" dnum="_-o:i-i" numlevel="1" lineno="292" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">facilitate the drafting of rules described in Subsection <xref depth="4" refnumber="53E-3-1302(2)(a)">(2)(a)</xref>;</amend></subsection><subsection ssid="9-21" dnum="_-o:ii-i" numlevel="1" lineno="293" slineno="4-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">in coordination with the Office of the Attorney General or a neutral third-party <ln numlevel="1" lineno="294" slineno="4-22"/>who has not previously assisted an association with appeals, facilitate advisory <ln numlevel="1" lineno="295" slineno="4-23"/>council hearings on appeals described in Subsection <xref depth="4" refnumber="53E-3-1303(3)(b)">53E-3-1303(3)(b)</xref>;</amend></subsection><subsection ssid="9-22" dnum="_-o:iii-i" numlevel="1" lineno="296" slineno="4-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">control all public and media communications regarding an interscholastic <ln numlevel="1" lineno="297" slineno="4-25"/>activity;</amend></subsection><subsection ssid="9-23" dnum="_-o:iv-i" numlevel="1" lineno="298" slineno="4-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">facilitate the advisory council's analysis and adoption of classification models;</amend></subsection><subsection ssid="9-24" dnum="_-o:v-i" numlevel="1" lineno="299" slineno="4-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">conduct audits and compliance reviews, including mechanisms for receiving, <ln numlevel="1" lineno="300" slineno="4-28"/>investigating, and addressing alleged violations of interscholastic activity rules; <ln numlevel="1" lineno="301" slineno="4-29"/>and</amend></subsection><subsection ssid="9-25" dnum="_-o:vi-i" numlevel="1" lineno="302" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">facilitate advisory council hearings and stakeholder town halls.</amend></subsection></subsection><subsection ssid="9-18" dnum="_-o:c-i" numlevel="1" lineno="303" slineno="4-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="9-26" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">The office may contract with an association through a memorandum of <ln numlevel="1" lineno="304" slineno="4-32"/>understanding to manage day-to-day operations regarding interscholastic activities <ln numlevel="1" lineno="305" slineno="4-33"/>that do not relate to the creation of rules described in this part or appeals.</amend></subsection><subsection ssid="9-27" dnum="_-o:ii-i" numlevel="1" lineno="306" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">The office shall ensure that a memorandum of understanding described in <ln numlevel="1" lineno="307" slineno="4-35"/>Subsection <xref depth="4" refnumber="53E-3-1302(2)(c)(i)">(2)(c)(i)</xref> addresses responsibilities regarding:</amend><subsection ssid="9-28" dnum="_-o:A-i" numlevel="1" lineno="308" slineno="4-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">scheduling events, including regular season and post-season events;</amend></subsection><subsection ssid="9-29" dnum="_-o:B-i" numlevel="1" lineno="309" slineno="4-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">managing venue logistics and tournament staffing;</amend></subsection><subsection ssid="9-30" dnum="_-o:C-i" numlevel="1" lineno="310" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">maintaining a system for recruitment, training, and assignment of activity <ln numlevel="1" lineno="311" slineno="4-39"/>officials;</amend></subsection><subsection ssid="9-31" dnum="_-o:D-i" numlevel="1" lineno="312" slineno="4-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">training for athletic directors, coaches, and school liaisons; and</amend></subsection><subsection ssid="9-32" dnum="_-o:E-i" numlevel="1" lineno="313" slineno="4-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">submitting implementation reports and compliance updates to the office and <ln numlevel="1" lineno="314" slineno="4-42"/>the state board, including an annual financial statement that includes the total <ln numlevel="1" lineno="315" slineno="4-43"/>revenue and operational costs of the association.</amend></subsection></subsection><subsection ssid="9-33" dnum="_-o:iii-i" numlevel="1" lineno="316" slineno="4-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">The office shall:</amend><subsection ssid="9-34" dnum="_-o:A-i" numlevel="1" lineno="317" slineno="4-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">review and, if necessary, modify the memorandum of understanding described <ln numlevel="1" lineno="318" slineno="4-46"/>in this Subsection <xref depth="4" refnumber="53E-3-1302(2)(c)">(2)(c)</xref> at least once every four years; and</amend></subsection><subsection ssid="9-35" dnum="_-o:B-i" numlevel="1" lineno="319" slineno="4-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">submit the memorandum of understanding to the state board for review.</amend></subsection></subsection></subsection></subsection><subsection ssid="9-2" dnum="_-o:3-i" numlevel="1" lineno="320" slineno="4-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="9-3" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="9-5" dnum="_-o:i-i" numlevel="1" lineno="321" slineno="4-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">as the state board determines necessary, establish committees, policies, or <ln numlevel="1" lineno="322" slineno="4-50"/>processes necessary to the function and oversight of the office;</amend></subsection><subsection ssid="9-4" dnum="_-o:ii-i" numlevel="1" lineno="323" slineno="4-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">appoint a director of interscholastic activities who serves as the director of the <ln numlevel="1" lineno="324" slineno="4-52"/>office; or</amend></subsection><subsection ssid="9-6" dnum="_-o:iii-i" numlevel="1" lineno="325" slineno="4-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">authorize the state superintendent to appoint and supervise the director described <ln numlevel="1" lineno="326" slineno="4-54"/>in Subsection <xref depth="4" refnumber="53E-3-1302(3)(a)(ii)">(3)(a)(ii)</xref>, under the approval of the state board.</amend></subsection></subsection><subsection ssid="9-7" dnum="_-o:b-i" numlevel="1" lineno="327" slineno="4-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">The state board may make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="328" slineno="4-56"/>Administrative Rulemaking Act, regarding the qualifications, terms of employment, <ln numlevel="1" lineno="329" slineno="4-57"/>and duties of the director.</amend></subsection></subsection><subsection ssid="9-17" dnum="_-o:4-i" numlevel="1" lineno="330" slineno="4-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to legislative appropriations and to state board budgeting, the director may hire <ln numlevel="1" lineno="331" slineno="4-59"/>staff necessary to carry out the functions of the office.</amend></subsection></section></bsec><bsec buid="10" num="53E-3-1303" type="enact" src="code" uid="C53E-3-S1303_2027070120270701" sort="53E03 13030020270701" numlevel="1" lineno="332" slineno="5-1" sn="5"><section numlevel="1" lineno="333" slineno="5-2" number="53E-3-1303" type="enact"><secline lineno="332">Section 5. and</amend></subsection><subsection ssid="10-8" dnum="_-o:f-i" numlevel="1" lineno="342" slineno="5-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">if the office contracts with an association in accordance with Subsection <xref depth="4" refnumber="53E-3-1302(2)(c)"><ln numlevel="1" lineno="343" slineno="5-12"/>53E-3-1302(2)(c)</xref>, a representative of the association.</amend></subsection></subsection><subsection ssid="10-9" dnum="_-o:3-i" numlevel="1" lineno="344" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">Under the direction of the director and the office, the advisory council shall:</amend><subsection ssid="10-10" dnum="_-o:a-i" numlevel="1" lineno="345" slineno="5-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">subject to modification or rejection by the state board, draft and adopt the rules <ln numlevel="1" lineno="346" slineno="5-15"/>described in Subsection <xref depth="4" refnumber="53E-3-1302(2)(a)">53E-3-1302(2)(a)</xref>, including:</amend><subsection ssid="10-20" dnum="_-o:i-i" numlevel="1" lineno="347" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">eligibility policies that reflect the most inclusive possible interpretation of student <ln numlevel="1" lineno="348" slineno="5-17"/>circumstances, mobility, and school choice;</amend></subsection><subsection ssid="10-21" dnum="_-o:ii-i" numlevel="1" lineno="349" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">transfer policies that create minimal friction, honoring the principle that students <ln numlevel="1" lineno="350" slineno="5-19"/>and families may transfer for many valid reasons; and</amend></subsection><subsection ssid="10-22" dnum="_-o:iii-i" numlevel="1" lineno="351" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">exceptions or restrictions in the rural alignment track described in Subsection <xref depth="4" refnumber="53E-3-1303(3)(c)(iii)"><ln numlevel="1" lineno="352" slineno="5-21"/>(3)(c)(iii)</xref> where student movement is less common;</amend></subsection></subsection><subsection ssid="10-11" dnum="_-o:b-i" numlevel="1" lineno="353" slineno="5-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">resolve appeals regarding the application of a rule described in Subsection <xref depth="4" refnumber="53E-3-1303(3)(a)">(3)(a)</xref>;</amend></subsection><subsection ssid="10-12" dnum="_-o:c-i" numlevel="1" lineno="354" slineno="5-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">subject to modification or rejection by the state board, analyze and adopt <ln numlevel="1" lineno="355" slineno="5-24"/>classification models for regions that:</amend><subsection ssid="10-16" dnum="_-o:i-i" numlevel="1" lineno="356" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">include:</amend><subsection ssid="10-13" dnum="_-o:A-i" numlevel="1" lineno="357" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">each year, minor modifications as necessary; and</amend></subsection><subsection ssid="10-14" dnum="_-o:B-i" numlevel="1" lineno="358" slineno="5-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">no sooner than once every four years, a third-party contracted classification <ln numlevel="1" lineno="359" slineno="5-28"/>model to assess travel logistics, historical performance, and enrollment <ln numlevel="1" lineno="360" slineno="5-29"/>volatility;</amend></subsection></subsection><subsection ssid="10-15" dnum="_-o:ii-i" numlevel="1" lineno="361" slineno="5-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">prioritize a competitive balance above raw population size and geography; and</amend></subsection><subsection ssid="10-17" dnum="_-o:iii-i" numlevel="1" lineno="362" slineno="5-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">considers the creation of:</amend><subsection ssid="10-18" dnum="_-o:A-i" numlevel="1" lineno="363" slineno="5-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">a rural alignment track that follows traditional classification and transfer <ln numlevel="1" lineno="364" slineno="5-33"/>policies and acknowledges geographical distance and limited access; and</amend></subsection><subsection ssid="10-19" dnum="_-o:B-i" numlevel="1" lineno="365" slineno="5-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">an urban alignment track that adopts an expansive and fluid model for <ln numlevel="1" lineno="366" slineno="5-35"/>transfers and alignment, reflecting modern student mobility; and</amend></subsection></subsection></subsection><subsection ssid="10-23" dnum="_-o:d-i" numlevel="1" lineno="367" slineno="5-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">in conjunction with the office, hold hearings and town halls regarding:</amend><subsection ssid="10-24" dnum="_-o:i-i" numlevel="1" lineno="368" slineno="5-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">interscholastic activities;</amend></subsection><subsection ssid="10-25" dnum="_-o:ii-i" numlevel="1" lineno="369" slineno="5-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">the duties described in this section; Private school and home school students' <ln numlevel="1" lineno="398" slineno="7-3"/>participation in extracurricular activities in a public school.</bold></catline><subsection ssid="37-null-1" dnum="1-o" numlevel="1" lineno="399" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="37-null-2" dnum="a-o" numlevel="1" lineno="400" slineno="7-5" level="2"><display>(a)</display>"Academic eligibility requirements" means the academic eligibility requirements that <ln numlevel="1" lineno="401" slineno="7-6"/>a home school student is required to meet to participate in an extracurricular activity <ln numlevel="1" lineno="402" slineno="7-7"/>in a public school.</subsection><subsection ssid="37-null-3" dnum="b-o" numlevel="1" lineno="403" slineno="7-8" level="2"><display>(b)</display>"Association" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-1101" start="0">53G-7-1101</xref>.</subsection><subsection ssid="37-null-4" dnum="c-o" numlevel="1" lineno="404" slineno="7-9" level="2"><display>(c)</display>"Extracurricular activity" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-501" start="0"><ln numlevel="1" lineno="405" slineno="7-10"/>53G-7-501</xref>.</subsection><subsection ssid="37-null-5" dnum="d-o" numlevel="1" lineno="406" slineno="7-11" level="2"><display>(d)</display>"Initial establishment of eligibility requirements" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">an association's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> <ln numlevel="1" lineno="407" slineno="7-12"/>eligibility requirements, policies, procedures, and transfer rules<amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> of the Office of <ln numlevel="1" lineno="408" slineno="7-13"/>Interscholastic Activities described in Section <xref depth="3" refnumber="53E-3-1302">53E-3-1302</xref></amend> that a school student in <ln numlevel="1" lineno="409" slineno="7-14"/>grade 9 or 10 must meet, and to which the student is bound, to participate on a high <ln numlevel="1" lineno="410" slineno="7-15"/>school sports team when the student:<subsection ssid="37-null-6" dnum="i-o" numlevel="1" lineno="411" slineno="7-16" level="3"><display>(i)</display>attends the high school in which the student is selected for membership on a high <ln numlevel="1" lineno="412" slineno="7-17"/>school sports team; or</subsection><subsection ssid="37-null-7" dnum="ii-o" numlevel="1" lineno="413" slineno="7-18" level="3"><display>(ii)</display>does not attend the high school in which the student tries out for and is selected <ln numlevel="1" lineno="414" slineno="7-19"/>for membership on a high school sports team.</subsection></subsection><subsection ssid="37-null-8" dnum="e-o" numlevel="1" lineno="415" slineno="7-20" level="2"><display>(e)</display>"Minor" means the same as that term is defined in Section <xref depth="3" refnumber="53G-6-201" start="0">53G-6-201</xref>.</subsection><subsection ssid="37-null-9" dnum="f-o" numlevel="1" lineno="416" slineno="7-21" level="2"><display>(f)</display>"Parent" means the same as that term is defined in Section <xref depth="3" refnumber="53G-6-201" start="0">53G-6-201</xref>.</subsection><subsection ssid="37-null-10" dnum="g-o" numlevel="1" lineno="417" slineno="7-22" level="2"><display>(g)</display>"Principal" means the principal of the school in which a home school student <ln numlevel="1" lineno="418" slineno="7-23"/>participates or intends to participate in an extracurricular activity.</subsection></subsection><subsection ssid="37-null-11" dnum="2-o" numlevel="1" lineno="419" slineno="7-24" level="1" space="false"><display>(2)</display><subsection ssid="37-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A minor who is enrolled in a private school or a home school is eligible to <ln numlevel="1" lineno="420" slineno="7-25"/>participate in an extracurricular activity at a public school as provided in this section.</subsection><subsection ssid="37-null-13" dnum="b-o" numlevel="1" lineno="421" slineno="7-26" level="2"><display>(b)</display>A private school student may only participate in an extracurricular activity at a <ln numlevel="1" lineno="422" slineno="7-27"/>public school that is not offered by the student's private school.</subsection><subsection ssid="37-null-14" dnum="c-o" numlevel="1" lineno="423" slineno="7-28" level="2" space="false"><display>(c)</display><subsection ssid="37-null-15" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-6-703(2)(d)" start="0">(2)(d)</xref>, a private school student or a home <ln numlevel="1" lineno="424" slineno="7-29"/>school student may only participate in an extracurricular activity at:<subsection ssid="37-null-16" dnum="A-o" numlevel="1" lineno="425" slineno="7-30" level="4" tab="1"><display>(A)</display>the school with attendance boundaries within which the student's custodial <ln numlevel="1" lineno="426" slineno="7-31"/>parent resides; or</subsection><subsection ssid="37-null-17" dnum="B-o" numlevel="1" lineno="427" slineno="7-32" level="4" tab="1"><display>(B)</display>the school from which the student withdrew for the purpose of attending a <ln numlevel="1" lineno="428" slineno="7-33"/>private or home school.</subsection></subsection><subsection ssid="37-null-18" dnum="ii-o" numlevel="1" lineno="429" slineno="7-34" level="3"><display>(ii)</display>A private school student or a home school student retains the ability to participate <ln numlevel="1" lineno="430" slineno="7-35"/>in an extracurricular activity at a school described in Subsection <xref depth="4" refnumber="53G-6-703(2)(c)(i)" start="0">(2)(c)(i)</xref> if the <ln numlevel="1" lineno="431" slineno="7-36"/>student did not initially establish the student's eligibility at another school in grade <ln numlevel="1" lineno="432" slineno="7-37"/>9 or 10.</subsection></subsection><subsection ssid="37-null-19" dnum="d-o" numlevel="1" lineno="433" slineno="7-38" level="2"><display>(d)</display>A school other than a school described in Subsection <xref depth="4" refnumber="53G-6-703(2)(c)(i)" start="0">(2)(c)(i)</xref> may allow a private <ln numlevel="1" lineno="434" slineno="7-39"/>school student or a home school student to participate in an extracurricular activity <ln numlevel="1" lineno="435" slineno="7-40"/>that the public school sponsors and supports if:<subsection ssid="37-null-20" dnum="i-o" numlevel="1" lineno="436" slineno="7-41" level="3"><display>(i)</display>for an interscholastic competition of athletic teams, the private school student or <ln numlevel="1" lineno="437" slineno="7-42"/>the home school student meets the initial establishment of eligibility requirements;</subsection><subsection ssid="37-null-21" dnum="ii-o" numlevel="1" lineno="438" slineno="7-43" level="3"><display>(ii)</display>for an interscholastic contest or competition for music, drama, or forensic groups <ln numlevel="1" lineno="439" slineno="7-44"/>or teams, the private school student, subject to Subsection <xref depth="4" refnumber="53G-6-703(2)(b)" start="0">(2)(b)</xref>, or the home <ln numlevel="1" lineno="440" slineno="7-45"/>school student meets the entry requirements for participation;</subsection><subsection ssid="37-null-22" dnum="iii-o" numlevel="1" lineno="441" slineno="7-46" level="3"><display>(iii)</display>the private school student or the home school student meets the eligibility <ln numlevel="1" lineno="442" slineno="7-47"/>requirements under this section; and</subsection><subsection ssid="37-null-23" dnum="iv-o" numlevel="1" lineno="443" slineno="7-48" level="3"><display>(iv)</display>the private school student or the home school student meets the enrollment <ln numlevel="1" lineno="444" slineno="7-49"/>requirements for public school in accordance with <xref depth="2" refnumber="53G-6-4" start="2">Part 4, School District <ln numlevel="1" lineno="445" slineno="7-50"/>Enrollment</xref>.</subsection></subsection></subsection><subsection ssid="37-null-24" dnum="3-o" numlevel="1" lineno="446" slineno="7-51" level="1" space="false"><display>(3)</display><subsection ssid="37-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="53G-6-703(4)" start="0">(4)</xref> through <xref depth="4" refnumber="53G-6-703(13)" start="0">(13)</xref>, a private school student or a <ln numlevel="1" lineno="447" slineno="7-52"/>home school student is eligible to participate in an extracurricular activity at a public <ln numlevel="1" lineno="448" slineno="7-53"/>school consistent with eligibility standards:<subsection ssid="37-null-26" dnum="i-o" numlevel="1" lineno="449" slineno="7-54" level="3" tab="1"><display>(i)</display>applied to a fully enrolled public school student;</subsection><subsection ssid="37-null-27" dnum="ii-o" numlevel="1" lineno="450" slineno="7-55" level="3" tab="1"><display>(ii)</display>of the public school where the private school student or the home school student <ln numlevel="1" lineno="451" slineno="7-56"/>participates in an extracurricular activity; and</subsection><subsection ssid="37-null-28" dnum="iii-o" numlevel="1" lineno="452" slineno="7-57" level="3" tab="1"><display>(iii)</display>for the extracurricular activity in which the private school or the home school <ln numlevel="1" lineno="453" slineno="7-58"/>student participates.</subsection></subsection><subsection ssid="37-null-29" dnum="b-o" numlevel="1" lineno="454" slineno="7-59" level="2"><display>(b)</display>A school district or public school may not impose additional requirements on a <ln numlevel="1" lineno="455" slineno="7-60"/>private school student or a home school student to participate in an extracurricular <ln numlevel="1" lineno="456" slineno="7-61"/>activity that are not imposed on a fully enrolled public school student.</subsection><subsection ssid="37-null-30" dnum="c-o" numlevel="1" lineno="457" slineno="7-62" level="2" space="false"><display>(c)</display><subsection ssid="37-null-31" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A private school student or a home school student who participates in an <ln numlevel="1" lineno="458" slineno="7-63"/>extracurricular activity at a public school shall pay the same fees as required of a <ln numlevel="1" lineno="459" slineno="7-64"/>fully enrolled public school student to participate in an extracurricular activity.</subsection><subsection ssid="37-null-32" dnum="ii-o" numlevel="1" lineno="460" slineno="7-65" level="3"><display>(ii)</display>If a local school board or a charter school governing board imposes a mandatory <ln numlevel="1" lineno="461" slineno="7-66"/>student activity fee for a student enrolled in a public school, the fee may be <ln numlevel="1" lineno="462" slineno="7-67"/>imposed on a private school student or a home school student who participates in <ln numlevel="1" lineno="463" slineno="7-68"/>an extracurricular activity at the public school if the same benefits of paying the <ln numlevel="1" lineno="464" slineno="7-69"/>mandatory student activity fee that are available to a fully enrolled public school <ln numlevel="1" lineno="465" slineno="7-70"/>student are available to a private school student or a home school student who <ln numlevel="1" lineno="466" slineno="7-71"/>participates in an extracurricular activity at the public school.</subsection></subsection></subsection><subsection ssid="37-null-33" dnum="4-o" numlevel="1" lineno="467" slineno="7-72" level="1"><display>(4)</display>Eligibility requirements based on school attendance are not applicable to a home school <ln numlevel="1" lineno="468" slineno="7-73"/>student.</subsection><subsection ssid="37-null-34" dnum="5-o" numlevel="1" lineno="469" slineno="7-74" level="1"><display>(5)</display>A home school student meets academic eligibility requirements to participate in an <ln numlevel="1" lineno="470" slineno="7-75"/>extracurricular activity if:<subsection ssid="37-null-35" dnum="a-o" numlevel="1" lineno="471" slineno="7-76" level="2"><display>(a)</display>the student is mastering the material in each course or subject being taught; and</subsection><subsection ssid="37-null-36" dnum="b-o" numlevel="1" lineno="472" slineno="7-77" level="2"><display>(b)</display>the student is maintaining satisfactory progress towards achievement or promotion.</subsection></subsection><subsection ssid="37-null-37" dnum="6-o" numlevel="1" lineno="473" slineno="7-78" level="1" space="false"><display>(6)</display><subsection ssid="37-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To establish a home school student's academic eligibility, a parent, teacher, or <ln numlevel="1" lineno="474" slineno="7-79"/>organization providing instruction to the student shall submit an affidavit to the <ln numlevel="1" lineno="475" slineno="7-80"/>principal indicating the student meets academic eligibility requirements.</subsection><subsection ssid="37-null-39" dnum="b-o" numlevel="1" lineno="476" slineno="7-81" level="2"><display>(b)</display>Upon submission of an affidavit pursuant to Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref>, a home school student <ln numlevel="1" lineno="477" slineno="7-82"/>shall:<subsection ssid="37-null-40" dnum="i-o" numlevel="1" lineno="478" slineno="7-83" level="3"><display>(i)</display>be considered to meet academic eligibility requirements; and</subsection><subsection ssid="37-null-41" dnum="ii-o" numlevel="1" lineno="479" slineno="7-84" level="3"><display>(ii)</display>retain academic eligibility for all extracurricular activities during the activity <ln numlevel="1" lineno="480" slineno="7-85"/>season for which the affidavit is submitted, until:<subsection ssid="37-null-42" dnum="A-o" numlevel="1" lineno="481" slineno="7-86" level="4"><display>(A)</display>a panel established under Subsection <xref depth="4" refnumber="53G-6-703(10)" start="0">(10)</xref> determines the home school student <ln numlevel="1" lineno="482" slineno="7-87"/>does not meet academic eligibility requirements; or</subsection><subsection ssid="37-null-43" dnum="B-o" numlevel="1" lineno="483" slineno="7-88" level="4"><display>(B)</display>the person who submitted the affidavit under Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref> provides <ln numlevel="1" lineno="484" slineno="7-89"/>written notice to the school principal that the student no longer meets academic <ln numlevel="1" lineno="485" slineno="7-90"/>eligibility requirements.</subsection></subsection></subsection></subsection><subsection ssid="37-null-44" dnum="7-o" numlevel="1" lineno="486" slineno="7-91" level="1" space="false"><display>(7)</display><subsection ssid="37-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A home school student who loses academic eligibility pursuant to Subsection <xref depth="4" refnumber="53G-6-703(6)(b)(ii)(B)" start="0"><ln numlevel="1" lineno="487" slineno="7-92"/>(6)(b)(ii)(B)</xref> may not participate in an extracurricular activity until the person who <ln numlevel="1" lineno="488" slineno="7-93"/>submitted the affidavit under Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref> provides written notice to the school <ln numlevel="1" lineno="489" slineno="7-94"/>principal that the home school student has reestablished academic eligibility.</subsection><subsection ssid="37-null-46" dnum="b-o" numlevel="1" lineno="490" slineno="7-95" level="2"><display>(b)</display>If a home school student reestablishes academic eligibility pursuant to Subsection <xref depth="4" refnumber="53G-6-703(7)(a)" start="0"><ln numlevel="1" lineno="491" slineno="7-96"/>(7)(a)</xref>, the home school student may participate in extracurricular activities for the <ln numlevel="1" lineno="492" slineno="7-97"/>remainder of the activity season for which an affidavit was submitted under <ln numlevel="1" lineno="493" slineno="7-98"/>Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref>.</subsection></subsection><subsection ssid="37-null-47" dnum="8-o" numlevel="1" lineno="494" slineno="7-99" level="1"><display>(8)</display>A person who has probable cause to believe a home school student does not meet <ln numlevel="1" lineno="495" slineno="7-100"/>academic eligibility requirements may submit an affidavit to the principal:<subsection ssid="37-null-48" dnum="a-o" numlevel="1" lineno="496" slineno="7-101" level="2"><display>(a)</display>asserting the home school student does not meet academic eligibility requirements; <ln numlevel="1" lineno="497" slineno="7-102"/>and</subsection><subsection ssid="37-null-49" dnum="b-o" numlevel="1" lineno="498" slineno="7-103" level="2"><display>(b)</display>providing information indicating that the home school student does not meet the <ln numlevel="1" lineno="499" slineno="7-104"/>academic eligibility requirements.</subsection></subsection><subsection ssid="37-null-50" dnum="9-o" numlevel="1" lineno="500" slineno="7-105" level="1"><display>(9)</display>A principal shall review the affidavit submitted under Subsection <xref depth="4" refnumber="53G-6-703(8)" start="0">(8)</xref>, and if the <ln numlevel="1" lineno="501" slineno="7-106"/>principal determines it contains information which constitutes probable cause to believe <ln numlevel="1" lineno="502" slineno="7-107"/>a home school student may not meet academic eligibility requirements, the principal <ln numlevel="1" lineno="503" slineno="7-108"/>shall request a panel established pursuant to Subsection <xref depth="4" refnumber="53G-6-703(10)" start="0">(10)</xref> to verify the student's <ln numlevel="1" lineno="504" slineno="7-109"/>compliance with academic eligibility requirements.</subsection><subsection ssid="37-null-51" dnum="10-o" numlevel="1" lineno="505" slineno="7-110" level="1" space="false"><display>(10)</display><subsection ssid="37-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A school district superintendent shall:<subsection ssid="37-null-53" dnum="i-o" numlevel="1" lineno="506" slineno="7-111" level="3" tab="1"><display>(i)</display>appoint a panel of three individuals to verify a home school student's compliance <ln numlevel="1" lineno="507" slineno="7-112"/>with academic eligibility requirements when requested by a principal pursuant to <ln numlevel="1" lineno="508" slineno="7-113"/>Subsection <xref depth="4" refnumber="53G-6-703(9)" start="0">(9)</xref>; and</subsection><subsection ssid="37-null-54" dnum="ii-o" numlevel="1" lineno="509" slineno="7-114" level="3" tab="1"><display>(ii)</display>select the panel members from nominees submitted by national, state, or regional <ln numlevel="1" lineno="510" slineno="7-115"/>organizations whose members are home school students and parents.</subsection></subsection><subsection ssid="37-null-55" dnum="b-o" numlevel="1" lineno="511" slineno="7-116" level="2"><display>(b)</display>Of the members appointed to a panel under Subsection <xref depth="4" refnumber="53G-6-703(10)(a)" start="0">(10)(a)</xref>:<subsection ssid="37-null-56" dnum="i-o" numlevel="1" lineno="512" slineno="7-117" level="3"><display>(i)</display>one member shall have experience teaching in a public school as a licensed <ln numlevel="1" lineno="513" slineno="7-118"/>teacher and in home schooling high school-age students;</subsection><subsection ssid="37-null-57" dnum="ii-o" numlevel="1" lineno="514" slineno="7-119" level="3"><display>(ii)</display>one member shall have experience teaching in a higher education institution and <ln numlevel="1" lineno="515" slineno="7-120"/>in home schooling; and</subsection><subsection ssid="37-null-58" dnum="iii-o" numlevel="1" lineno="516" slineno="7-121" level="3"><display>(iii)</display>one member shall have experience in home schooling high school-age students.</subsection></subsection></subsection><subsection ssid="37-null-59" dnum="11-o" numlevel="1" lineno="517" slineno="7-122" level="1"><display>(11)</display>A panel appointed under Subsection <xref depth="4" refnumber="53G-6-703(10)" start="0">(10)</xref>:<subsection ssid="37-null-60" dnum="a-o" numlevel="1" lineno="518" slineno="7-123" level="2"><display>(a)</display>shall review the affidavit submitted under Subsection <xref depth="4" refnumber="53G-6-703(8)" start="0">(8)</xref>;</subsection><subsection ssid="37-null-61" dnum="b-o" numlevel="1" lineno="519" slineno="7-124" level="2"><display>(b)</display>may confer with the person who submitted the affidavit under Subsection <xref depth="4" refnumber="53G-6-703(8)" start="0">(8)</xref>;</subsection><subsection ssid="37-null-62" dnum="c-o" numlevel="1" lineno="520" slineno="7-125" level="2"><display>(c)</display>shall request the home school student to submit test scores or a portfolio of work <ln numlevel="1" lineno="521" slineno="7-126"/>documenting the student's academic achievement to the panel;</subsection><subsection ssid="37-null-63" dnum="d-o" numlevel="1" lineno="522" slineno="7-127" level="2"><display>(d)</display>shall review the test scores or portfolio of work; and</subsection><subsection ssid="37-null-64" dnum="e-o" numlevel="1" lineno="523" slineno="7-128" level="2"><display>(e)</display>shall determine whether the home school student meets academic eligibility <ln numlevel="1" lineno="524" slineno="7-129"/>requirements.</subsection></subsection><subsection ssid="37-null-65" dnum="12-o" numlevel="1" lineno="525" slineno="7-130" level="1"><display>(12)</display>A home school student who meets academic eligibility requirements pursuant to <ln numlevel="1" lineno="526" slineno="7-131"/>Subsection <xref depth="4" refnumber="53G-6-703(11)" start="0">(11)</xref>, retains academic eligibility for all extracurricular activities during the <ln numlevel="1" lineno="527" slineno="7-132"/>activity season for which an affidavit is submitted pursuant to Subsection <xref depth="4" refnumber="53G-6-703(6)" start="0">(6)</xref>.</subsection><subsection ssid="37-null-66" dnum="13-o" numlevel="1" lineno="528" slineno="7-133" level="1" space="false"><display>(13)</display><subsection ssid="37-null-67" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A panel's determination that a home school student does not comply with <ln numlevel="1" lineno="529" slineno="7-134"/>academic eligibility requirements is effective for an activity season and all <ln numlevel="1" lineno="530" slineno="7-135"/>extracurricular activities that have academic eligibility requirements.</subsection><subsection ssid="37-null-68" dnum="b-o" numlevel="1" lineno="531" slineno="7-136" level="2"><display>(b)</display>A home school student who is not in compliance with academic eligibility <ln numlevel="1" lineno="532" slineno="7-137"/>requirements as determined by a panel appointed under Subsection <xref depth="4" refnumber="53G-6-703(11)" start="0">(11)</xref> may seek to <ln numlevel="1" lineno="533" slineno="7-138"/>establish academic eligibility under this section for the next activity season.</subsection></subsection><subsection ssid="37-null-69" dnum="14-o" numlevel="1" lineno="534" slineno="7-139" level="1" space="false"><display>(14)</display><subsection ssid="37-null-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A public school student who has been declared to be academically ineligible to <ln numlevel="1" lineno="535" slineno="7-140"/>participate in an extracurricular activity and who subsequently enrolls in a home <ln numlevel="1" lineno="536" slineno="7-141"/>school shall lose eligibility for participation in the extracurricular activity until the <ln numlevel="1" lineno="537" slineno="7-142"/>student:<subsection ssid="37-null-71" dnum="i-o" numlevel="1" lineno="538" slineno="7-143" level="3" tab="1"><display>(i)</display>demonstrates academic eligibility by providing test results or a portfolio of the <ln numlevel="1" lineno="539" slineno="7-144"/>student's work to the school principal, provided that a student may not reestablish <ln numlevel="1" lineno="540" slineno="7-145"/>academic eligibility under this Subsection <xref depth="4" refnumber="53G-6-703(14)(a)" start="0">(14)(a)</xref> during the same activity season <ln numlevel="1" lineno="541" slineno="7-146"/>in which the student was declared to be academically ineligible;</subsection><subsection ssid="37-null-72" dnum="ii-o" numlevel="1" lineno="542" slineno="7-147" level="3" tab="1"><display>(ii)</display>returns to public school and reestablishes academic eligibility; or</subsection><subsection ssid="37-null-73" dnum="iii-o" numlevel="1" lineno="543" slineno="7-148" level="3" tab="1"><display>(iii)</display>enrolls in a private school and establishes academic eligibility.</subsection></subsection><subsection ssid="37-null-74" dnum="b-o" numlevel="1" lineno="544" slineno="7-149" level="2"><display>(b)</display>A public school student who has been declared to be behaviorally ineligible to <ln numlevel="1" lineno="545" slineno="7-150"/>participate in an extracurricular activity and who subsequently enrolls in a home <ln numlevel="1" lineno="546" slineno="7-151"/>school shall lose eligibility for participation in the extracurricular activity until the <ln numlevel="1" lineno="547" slineno="7-152"/>student meets eligibility standards as provided in Subsection <xref depth="4" refnumber="53G-6-703(3)" start="0">(3)</xref>.</subsection></subsection><subsection ssid="37-null-75" dnum="15-o" numlevel="1" lineno="548" slineno="7-153" level="1"><display>(15)</display>When selection to participate in an extracurricular activity at a public school is made <ln numlevel="1" lineno="549" slineno="7-154"/>on a competitive basis, a private school student or a home school student is eligible to <ln numlevel="1" lineno="550" slineno="7-155"/>try out for and participate in the activity as provided in this section.</subsection><subsection ssid="37-null-76" dnum="16-o" numlevel="1" lineno="551" slineno="7-156" level="1" space="false"><display>(16)</display><subsection ssid="37-null-77" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a student exits a public school to enroll in a private school or a home school <ln numlevel="1" lineno="552" slineno="7-157"/>mid-semester or during an activity season, and the student desires to participate in an <ln numlevel="1" lineno="553" slineno="7-158"/>extracurricular activity at the public school, the public school shall issue an interim <ln numlevel="1" lineno="554" slineno="7-159"/>academic assessment based on the student's work in each class.</subsection><subsection ssid="37-null-78" dnum="b-o" numlevel="1" lineno="555" slineno="7-160" level="2"><display>(b)</display>A student's academic eligibility to participate in an extracurricular activity under the <ln numlevel="1" lineno="556" slineno="7-161"/>circumstances described in Subsection <xref depth="4" refnumber="53G-6-703(16)(a)" start="0">(16)(a)</xref> is dependent on the student meeting <ln numlevel="1" lineno="557" slineno="7-162"/>public school academic eligibility standards at the time of exiting public school.</subsection><subsection ssid="37-null-79" dnum="c-o" numlevel="1" lineno="558" slineno="7-163" level="2"><display>(c)</display>A student may appeal an academic eligibility determination made under Subsection <xref depth="4" refnumber="53G-6-703(16)(b)" start="0"><ln numlevel="1" lineno="559" slineno="7-164"/>(16)(b)</xref> in accordance with procedures for appealing a public school student's <ln numlevel="1" lineno="560" slineno="7-165"/>academic eligibility.</subsection></subsection></section></bsec><bsec buid="39" num="53G-6-704" type="amend" src="code" uid="C53G-6-S704_2027070120270701" sort="53G06 07040020270701" numlevel="1" lineno="561" slineno="8-1" sn="8"><section number="53G-6-704" numlevel="1" lineno="562" slineno="8-2" type="amend"><secline lineno="561">Section 8. Section <bold>53G-6-704</bold> is amended to read:</secline><catline lineno="562"><bold>53G-6-704<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/27</date></paren></parens>. Charter school students' participation in <ln numlevel="1" lineno="563" slineno="8-3"/>extracurricular activities at other public schools.</bold></catline><subsection ssid="39-null-1" dnum="1-o" numlevel="1" lineno="564" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="39-null-2" dnum="a-o:_-i" numlevel="1" lineno="565" slineno="8-5" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1289" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">"Association" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-1101" start="0">53G-7-1101</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="39-null-3" dnum="b-o:a-i" numlevel="1" lineno="566" slineno="8-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1290" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1291" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>"Extracurricular activity" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-501" start="0"><ln numlevel="1" lineno="567" slineno="8-7"/>53G-7-501</xref>.</subsection><subsection ssid="39-null-4" dnum="c-o:b-i" numlevel="1" lineno="568" slineno="8-8" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1291" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1292" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>"Initial establishment of eligibility requirements" means the same as that term is <ln numlevel="1" lineno="569" slineno="8-9"/>defined in Section <xref depth="3" refnumber="53G-6-703" start="0">53G-6-703</xref>.</subsection></subsection><subsection ssid="39-null-5" dnum="2-o" numlevel="1" lineno="570" slineno="8-10" level="1"><display>(2)</display>A charter school student is eligible to participate in an extracurricular activity not <ln numlevel="1" lineno="571" slineno="8-11"/>offered by the student's charter school at:<subsection ssid="39-null-6" dnum="a-o" numlevel="1" lineno="572" slineno="8-12" level="2"><display>(a)</display>the school with attendance boundaries within which the student's custodial parent <ln numlevel="1" lineno="573" slineno="8-13"/>resides, if, for an interscholastic competition of athletic teams, the student did not <ln numlevel="1" lineno="574" slineno="8-14"/>initially establish the student's eligibility at another public school in grade 9 or 10;</subsection><subsection ssid="39-null-7" dnum="b-o" numlevel="1" lineno="575" slineno="8-15" level="2"><display>(b)</display>the public school from which the student withdrew for the purpose of attending a <ln numlevel="1" lineno="576" slineno="8-16"/>charter school; or</subsection><subsection ssid="39-null-8" dnum="c-o" numlevel="1" lineno="577" slineno="8-17" level="2"><display>(c)</display>a public school that is not a charter school if the student's charter school is located on <ln numlevel="1" lineno="578" slineno="8-18"/>the campus of the public school or has local school board approval to locate on the <ln numlevel="1" lineno="579" slineno="8-19"/>campus of the public school.</subsection></subsection><subsection ssid="39-null-9" dnum="3-o" numlevel="1" lineno="580" slineno="8-20" level="1"><display>(3)</display>In addition to the public schools listed in Subsection <xref depth="4" refnumber="53G-6-704(2)" start="0">(2)</xref>, the state board may establish <ln numlevel="1" lineno="581" slineno="8-21"/>rules to allow a charter school student to participate in an extracurricular activity at a <ln numlevel="1" lineno="582" slineno="8-22"/>public school other than a public school listed in Subsection <xref depth="4" refnumber="53G-6-704(2)" start="0">(2)</xref>.</subsection><subsection ssid="39-null-10" dnum="4-o" numlevel="1" lineno="583" slineno="8-23" level="1"><display>(4)</display>A school other than a school described in Subsection <xref depth="4" refnumber="53G-6-704(2)" start="0">(2)</xref> may allow a charter school <ln numlevel="1" lineno="584" slineno="8-24"/>student to participate in an extracurricular activity a public school sponsors and supports <ln numlevel="1" lineno="585" slineno="8-25"/>if:<subsection ssid="39-null-11" dnum="a-o" numlevel="1" lineno="586" slineno="8-26" level="2"><display>(a)</display>for interschool competitions of athletic teams, the charter school student meets the <ln numlevel="1" lineno="587" slineno="8-27"/>initial establishment of eligibility requirements;</subsection><subsection ssid="39-null-12" dnum="b-o" numlevel="1" lineno="588" slineno="8-28" level="2"><display>(b)</display>for interschool contests or competitions for music, drama, or forensic groups or <ln numlevel="1" lineno="589" slineno="8-29"/>teams, the charter school student meets the entry requirements for participation;</subsection><subsection ssid="39-null-13" dnum="c-o" numlevel="1" lineno="590" slineno="8-30" level="2"><display>(c)</display>the charter school student meets the eligibility requirements under this section; and</subsection><subsection ssid="39-null-14" dnum="d-o" numlevel="1" lineno="591" slineno="8-31" level="2"><display>(d)</display>the charter school student meets the enrollment requirements for public school in <ln numlevel="1" lineno="592" slineno="8-32"/>accordance with <xref depth="2" refnumber="53G-6-4" start="2">Part 4, School District Enrollment</xref>.</subsection></subsection><subsection ssid="39-null-15" dnum="5-o" numlevel="1" lineno="593" slineno="8-33" level="1"><display>(5)</display>A charter school student is eligible for an extracurricular activity at a public school <ln numlevel="1" lineno="594" slineno="8-34"/>consistent with eligibility standards as applied to full-time students of the public school.</subsection><subsection ssid="39-null-16" dnum="6-o" numlevel="1" lineno="595" slineno="8-35" level="1"><display>(6)</display>A school district or a public school may not impose additional requirements on a charter <ln numlevel="1" lineno="596" slineno="8-36"/>school student to participate in an extracurricular activity that are not imposed on <ln numlevel="1" lineno="597" slineno="8-37"/>full-time students of the public school.</subsection><subsection ssid="39-null-17" dnum="7-o" numlevel="1" lineno="598" slineno="8-38" level="1" space="false"><display>(7)</display><subsection ssid="39-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall make rules establishing fees for charter school students' <ln numlevel="1" lineno="599" slineno="8-39"/>participation in an extracurricular activity at school district schools.</subsection><subsection ssid="39-null-19" dnum="b-o" numlevel="1" lineno="600" slineno="8-40" level="2"><display>(b)</display>The rules shall provide that:<subsection ssid="39-null-20" dnum="i-o" numlevel="1" lineno="601" slineno="8-41" level="3"><display>(i)</display>charter school students pay the same fees as other students to participate in an <ln numlevel="1" lineno="602" slineno="8-42"/>extracurricular activity;</subsection><subsection ssid="39-null-21" dnum="ii-o" numlevel="1" lineno="603" slineno="8-43" level="3"><display>(ii)</display>charter school students are eligible for fee waivers pursuant to Section <xref depth="3" refnumber="53G-7-504" start="0">53G-7-504</xref>;</subsection><subsection ssid="39-null-22" dnum="iii-o" numlevel="1" lineno="604" slineno="8-44" level="3"><display>(iii)</display>for each charter school student who participates in an extracurricular activity at a <ln numlevel="1" lineno="605" slineno="8-45"/>school district school, the charter school shall pay a share of the school district's <ln numlevel="1" lineno="606" slineno="8-46"/>costs for the extracurricular activity; and</subsection><subsection ssid="39-null-23" dnum="iv-o" numlevel="1" lineno="607" slineno="8-47" level="3"><display>(iv)</display>a charter school's share of the costs of an extracurricular activity shall reflect <ln numlevel="1" lineno="608" slineno="8-48"/>state and local tax revenues expended, except capital facilities expenditures, for an <ln numlevel="1" lineno="609" slineno="8-49"/>extracurricular activity in a school district or a school divided by total student <ln numlevel="1" lineno="610" slineno="8-50"/>enrollment of the school district or the school.</subsection></subsection><subsection ssid="39-null-24" dnum="c-o" numlevel="1" lineno="611" slineno="8-51" level="2"><display>(c)</display>In determining a charter school's share of the costs of an extracurricular activity <ln numlevel="1" lineno="612" slineno="8-52"/>under Subsections <xref depth="4" refnumber="53G-6-704(7)(b)(iii)" start="0">(7)(b)(iii)</xref> and <xref depth="4" refnumber="53G-6-704(7)(b)(iv)" start="0">(iv)</xref>, the state board may establish uniform fees <ln numlevel="1" lineno="613" slineno="8-53"/>statewide based on average costs statewide or average costs within a sample of <ln numlevel="1" lineno="614" slineno="8-54"/>school districts.</subsection></subsection><subsection ssid="39-null-25" dnum="8-o" numlevel="1" lineno="615" slineno="8-55" level="1"><display>(8)</display>When selection to participate in an extracurricular activity at a public school is made on <ln numlevel="1" lineno="616" slineno="8-56"/>a competitive basis, a charter school student is eligible to try out for and participate in <ln numlevel="1" lineno="617" slineno="8-57"/>the activity as provided in this section.</subsection></section></bsec><bsec buid="41" num="53G-6-705" type="amend" src="code" uid="C53G-6-S705_2027070120270701" sort="53G06 07050020270701" numlevel="1" lineno="618" slineno="9-1" sn="9"><section number="53G-6-705" numlevel="1" lineno="619" slineno="9-2" type="amend"><secline lineno="618">Section 9. Online students' participation in extracurricular <ln numlevel="1" lineno="620" slineno="9-3"/>activities.</bold></catline><subsection ssid="41-null-1" dnum="1-o" numlevel="1" lineno="621" slineno="9-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="41-null-2" dnum="a-o:_-i" numlevel="1" lineno="622" slineno="9-5" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1314" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">"Association" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-1101" start="0">53G-7-1101</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="41-null-3" dnum="b-o:a-i" numlevel="1" lineno="623" slineno="9-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1315" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>"Extracurricular activity" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-501" start="0"><ln numlevel="1" lineno="624" slineno="9-7"/>53G-7-501</xref>.</subsection><subsection ssid="41-null-4" dnum="c-o:b-i" numlevel="1" lineno="625" slineno="9-8" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1316" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>"Initial establishment of eligibility requirements" means the same as that term is <ln numlevel="1" lineno="626" slineno="9-9"/>defined in Section <xref depth="3" refnumber="53G-6-703" start="0">53G-6-703</xref>.</subsection><subsection ssid="41-null-5" dnum="d-o:c-i" numlevel="1" lineno="627" slineno="9-10" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1317" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1318" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Online education" means the use of information and communication <ln numlevel="1" lineno="628" slineno="9-11"/>technologies to deliver educational opportunities to a student in a location other than <ln numlevel="1" lineno="629" slineno="9-12"/>a school.</subsection><subsection ssid="41-null-6" dnum="e-o:d-i" numlevel="1" lineno="630" slineno="9-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1318" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Online student" means a student who:<subsection ssid="41-null-7" dnum="i-o" numlevel="1" lineno="631" slineno="9-14" level="3"><display>(i)</display>participates in an online education program sponsored or supported by the state <ln numlevel="1" lineno="632" slineno="9-15"/>board, a school district, or a charter school; and</subsection><subsection ssid="41-null-8" dnum="ii-o" numlevel="1" lineno="633" slineno="9-16" level="3"><display>(ii)</display>generates funding for the school district or the school pursuant to Subsection <xref depth="4" refnumber="53F-2-102(4)" start="0"><ln numlevel="1" lineno="634" slineno="9-17"/>53F-2-102(4)</xref> and rules of the state board.</subsection></subsection></subsection><subsection ssid="41-null-9" dnum="2-o" numlevel="1" lineno="635" slineno="9-18" level="1"><display>(2)</display>An online student is eligible to participate in an extracurricular activity at:<subsection ssid="41-null-10" dnum="a-o" numlevel="1" lineno="636" slineno="9-19" level="2"><display>(a)</display>the school with attendance boundaries within which the student's custodial parent <ln numlevel="1" lineno="637" slineno="9-20"/>resides, if, for an interscholastic competition of athletic teams, the student did not <ln numlevel="1" lineno="638" slineno="9-21"/>initially establish the student's eligibility at another public school in grade 9 or 10; or</subsection><subsection ssid="41-null-11" dnum="b-o" numlevel="1" lineno="639" slineno="9-22" level="2"><display>(b)</display>the public school from which the student withdrew for the purpose of participating in <ln numlevel="1" lineno="640" slineno="9-23"/>an online education program.</subsection></subsection><subsection ssid="41-null-12" dnum="3-o" numlevel="1" lineno="641" slineno="9-24" level="1"><display>(3)</display>A public school other than a school described in Subsection <xref depth="4" refnumber="53G-6-705(2)" start="0">(2)</xref> may allow an online <ln numlevel="1" lineno="642" slineno="9-25"/>student to participate in an extracurricular activity that the public school sponsors and <ln numlevel="1" lineno="643" slineno="9-26"/>supports if:<subsection ssid="41-null-13" dnum="a-o" numlevel="1" lineno="644" slineno="9-27" level="2"><display>(a)</display>for interschool competitions of athletic teams sponsored and supported by a public <ln numlevel="1" lineno="645" slineno="9-28"/>school, the online school student meets the initial establishment of eligibility <ln numlevel="1" lineno="646" slineno="9-29"/>requirements;</subsection><subsection ssid="41-null-14" dnum="b-o" numlevel="1" lineno="647" slineno="9-30" level="2"><display>(b)</display>for interschool contests or competitions for music, drama, or forensic groups or <ln numlevel="1" lineno="648" slineno="9-31"/>teams sponsored and supported by a public school, the online school student meets <ln numlevel="1" lineno="649" slineno="9-32"/>the entry requirements for participation;</subsection><subsection ssid="41-null-15" dnum="c-o" numlevel="1" lineno="650" slineno="9-33" level="2"><display>(c)</display>the online school student meets the eligibility requirements under this section; and</subsection><subsection ssid="41-null-16" dnum="d-o" numlevel="1" lineno="651" slineno="9-34" level="2"><display>(d)</display>the online school student meets the enrollment requirements for public school in <ln numlevel="1" lineno="652" slineno="9-35"/>accordance with <xref depth="2" refnumber="53G-6-4" start="2">Part 4, School District Enrollment</xref>.</subsection></subsection><subsection ssid="41-null-17" dnum="4-o" numlevel="1" lineno="653" slineno="9-36" level="1"><display>(4)</display>An online student is eligible to participate in an extracurricular activity at a public <ln numlevel="1" lineno="654" slineno="9-37"/>school consistent with eligibility standards as applied to full-time students of the public <ln numlevel="1" lineno="655" slineno="9-38"/>school.</subsection><subsection ssid="41-null-18" dnum="5-o" numlevel="1" lineno="656" slineno="9-39" level="1"><display>(5)</display>A school district or public school may not impose additional requirements on an online <ln numlevel="1" lineno="657" slineno="9-40"/>school student to participate in an extracurricular activity that are not imposed on <ln numlevel="1" lineno="658" slineno="9-41"/>full-time students of the public school.</subsection><subsection ssid="41-null-19" dnum="6-o" numlevel="1" lineno="659" slineno="9-42" level="1" space="false"><display>(6)</display><subsection ssid="41-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall make rules establishing fees for an online school student's <ln numlevel="1" lineno="660" slineno="9-43"/>participation in an extracurricular activity at school district schools.</subsection><subsection ssid="41-null-21" dnum="b-o" numlevel="1" lineno="661" slineno="9-44" level="2"><display>(b)</display>The rules shall provide that:<subsection ssid="41-null-22" dnum="i-o" numlevel="1" lineno="662" slineno="9-45" level="3"><display>(i)</display>online school students pay the same fees as other students to participate in an <ln numlevel="1" lineno="663" slineno="9-46"/>extracurricular activity;</subsection><subsection ssid="41-null-23" dnum="ii-o" numlevel="1" lineno="664" slineno="9-47" level="3"><display>(ii)</display>online school students are eligible for fee waivers pursuant to Section <xref depth="3" refnumber="53G-7-504" start="0">53G-7-504</xref>;</subsection><subsection ssid="41-null-24" dnum="iii-o" numlevel="1" lineno="665" slineno="9-48" level="3"><display>(iii)</display>for each online school student who participates in an extracurricular activity at a <ln numlevel="1" lineno="666" slineno="9-49"/>school district school, the online school shall pay a share of the school district's <ln numlevel="1" lineno="667" slineno="9-50"/>costs for the extracurricular activity; and</subsection><subsection ssid="41-null-25" dnum="iv-o" numlevel="1" lineno="668" slineno="9-51" level="3"><display>(iv)</display>an online school's share of the costs of an extracurricular activity shall reflect <ln numlevel="1" lineno="669" slineno="9-52"/>state and local tax revenues expended, except capital facilities expenditures, for an <ln numlevel="1" lineno="670" slineno="9-53"/>extracurricular activity in a school district or school divided by total student <ln numlevel="1" lineno="671" slineno="9-54"/>enrollment of the school district or school.</subsection></subsection><subsection ssid="41-null-26" dnum="c-o" numlevel="1" lineno="672" slineno="9-55" level="2"><display>(c)</display>In determining an online school's share of the costs of an extracurricular activity <ln numlevel="1" lineno="673" slineno="9-56"/>under Subsections <xref depth="4" refnumber="53G-6-705(6)(b)(iii)" start="0">(6)(b)(iii)</xref> and <xref depth="4" refnumber="53G-6-705(6)(b)(iv)" start="0">(iv)</xref>, the state board may establish uniform fees <ln numlevel="1" lineno="674" slineno="9-57"/>statewide based on average costs statewide or average costs within a sample of <ln numlevel="1" lineno="675" slineno="9-58"/>school districts.</subsection></subsection><subsection ssid="41-null-27" dnum="7-o" numlevel="1" lineno="676" slineno="9-59" level="1"><display>(7)</display>When selection to participate in an extracurricular activity at a public school is made on <ln numlevel="1" lineno="677" slineno="9-60"/>a competitive basis, an online student is eligible to try out for and participate in the <ln numlevel="1" lineno="678" slineno="9-61"/>activity as provided in this section.</subsection></section></bsec><bsec buid="1" num="53G-7-1101" type="amend" src="code" uid="C53G-7-S1101_2027070120270701" sort="53G07 11010020270701" numlevel="1" lineno="679" slineno="10-1" sn="10"><section number="53G-7-1101" numlevel="1" lineno="680" slineno="10-2" type="amend"><secline lineno="679">Section 10. numlevel="1" lineno="689" slineno="10-11"/>Interscholastic Activities described in Subsection <xref depth="4" refnumber="53E-3-1302(2)(c)">53E-3-1302(2)(c)</xref></amend>.</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="690" slineno="10-12" level="2"><display>(b)</display>"Association" does not include an institution of higher education described in <ln numlevel="1" lineno="691" slineno="10-13"/>Section <xref depth="3" refnumber="53H-1-102">53H-1-102</xref>.</subsection></subsection><subsection ssid="1-null-6" dnum="4-o:3-i" numlevel="1" lineno="692" or bylaws;</subsection><subsection ssid="1-null-12" dnum="iii-o" numlevel="1" lineno="702" slineno="10-24" level="3"><display>(iii)</display>enforcing the standards and policies of the association; and</subsection><subsection ssid="1-null-13" dnum="iv-o" numlevel="1" lineno="703" slineno="10-25" level="3"><display>(iv)</display>adopting the association's budget; and</subsection></subsection><subsection ssid="1-null-14" dnum="b-o" numlevel="1" lineno="704" slineno="10-26" level="2"><display>(b)</display>has oversight of other boards, committees, councils, or bodies within the association.</subsection></subsection><subsection ssid="1-null-15" dnum="7-o:6-i" numlevel="1" lineno="705" slineno="10-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1354" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1355" style="1" owner="i" level="1" amendtag="both" Public schools prohibited from membership.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="715" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>A public school may not be a member of or pay dues to an association that:<subsection ssid="2-37" dnum="_-o:a-i" numlevel="1" lineno="716" slineno="11-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1360" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">operates outside a memorandum of understanding described in Subsection <xref depth="4" refnumber="53E-3-1302(2)(c)"><ln numlevel="1" lineno="717" slineno="11-5"/>53E-3-1302(2)(c)</xref>;</amend></subsection><subsection ssid="2-null-2" dnum="a-o:b-i" numlevel="1" lineno="718" slineno="11-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1361" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1362" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>is not in compliance with:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="719" slineno="11-7" level="3"><display>(i)</display>this part;</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="720" slineno="11-8" level="3"><display>(ii)</display>Title 52, Chapter 4, Open and Public Meetings Act;</subsection><subsection ssid="2-null-5" dnum="iii-o" numlevel="1" lineno="721" slineno="11-9" level="3"><display>(iii)</display>Title 63G, Chapter 2, Government Records Access and Management Act; and</subsection><subsection ssid="2-null-6" dnum="iv-o" numlevel="1" lineno="722" slineno="11-10" level="3"><display>(iv)</display>Title 67, Chapter 16, Utah Public Officers' and Employees' Ethics Act;<amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both"> or</amend></subsection></subsection><subsection ssid="2-null-7" dnum="b-o:c-i" numlevel="1" lineno="723" slineno="11-11" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1366" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="start" space="true">(c)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">to the extent the memorandum of understanding described in Subsection <xref depth="4" refnumber="53E-3-1302(2)(c)"><ln numlevel="1" lineno="724" slineno="11-12"/>53E-3-1302(2)(c)</xref> authorizes<marker pairid="45"/><marker pairid="46"/><marker pairid="47"/><marker pairid="48"/><marker pairid="49"/><marker pairid="50"/> the association's involvement:</amend><subsection ssid="2-38" dnum="_-o:i-i" numlevel="1" lineno="725" slineno="11-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>does not collect each student's unamended birth certificate, as that term is defined <ln numlevel="1" lineno="726" slineno="11-14"/>in Section <xref depth="3" refnumber="53G-6-1001">53G-6-1001</xref>, or subject to Subsection <xref depth="4" refnumber="53G-7-1102(3)">(3)</xref>, equivalent documentation, as <ln numlevel="1" lineno="727" slineno="11-15"/>described in Subsection <xref depth="4" refnumber="53G-7-1102(2)(a)">(2)(a)</xref>, to determine eligibility as a condition of the <ln numlevel="1" lineno="728" slineno="11-16"/>association's registration process for an athletic team, event, or category; or</subsection><subsection ssid="2-null-8" dnum="c-o:ii-i" numlevel="1" lineno="729" slineno="11-17" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1368" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>does not require a student to provide the student's date of birth and sex as a <ln numlevel="1" lineno="730" slineno="11-18"/>condition of the registration process for an athletic team, event, or category.</subsection></subsection></subsection><subsection ssid="2-null-9" dnum="2-o" numlevel="1" lineno="731" slineno="11-19" level="1" space="false"><display>(2)</display><subsection ssid="2-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For a student who is not a United States citizen and who is unable to provide an <ln numlevel="1" lineno="732" slineno="11-20"/>unamended birth certificate, as that term is defined in Section <xref depth="3" refnumber="53G-6-1001">53G-6-1001</xref>, the <ln numlevel="1" lineno="733" slineno="11-21"/>association may collect the student's:<subsection ssid="2-null-11" dnum="i-o" numlevel="1" lineno="734" slineno="11-22" level="3" tab="1"><display>(i)</display>state-issued identification document, including a driver's license or passport; or</subsection><subsection ssid="2-null-12" dnum="ii-o" numlevel="1" lineno="735" slineno="11-23" level="3" tab="1"><display>(ii)</display>federally recognized identification document, including a document that the <ln numlevel="1" lineno="736" slineno="11-24"/>Department of Homeland Security issues.</subsection></subsection><subsection ssid="2-null-13" dnum="b-o" numlevel="1" lineno="737" slineno="11-25" level="2"><display>(b)</display>If a student who is not a United States citizen is unable to provide a document under <ln numlevel="1" lineno="738" slineno="11-26"/>Subsection <xref depth="4" refnumber="53G-7-1102(2)(a)">(2)(a)</xref>, the association may collect other reliable proof of a student's date <ln numlevel="1" lineno="739" slineno="11-27"/>of birth and sex, including:<subsection ssid="2-null-14" dnum="i-o" numlevel="1" lineno="740" slineno="11-28" level="3"><display>(i)</display>an affidavit from the student's parent or legal guardian attesting:<subsection ssid="2-null-15" dnum="A-o" numlevel="1" lineno="741" slineno="11-29" level="4"><display>(A)</display>to the student's date of birth and sex; and</subsection><subsection ssid="2-null-16" dnum="B-o" numlevel="1" lineno="742" slineno="11-30" level="4"><display>(B)</display>that the parent or legal guardian is unable to obtain a document described in <ln numlevel="1" lineno="743" slineno="11-31"/>Subsection <xref depth="4" refnumber="53G-7-1102(2)(a)">(2)(a)</xref>; and</subsection></subsection><subsection ssid="2-null-17" dnum="ii-o" numlevel="1" lineno="744" slineno="11-32" level="3"><display>(ii)</display>one of the following:<subsection ssid="2-null-18" dnum="A-o" numlevel="1" lineno="745" slineno="11-33" level="4"><display>(A)</display>a religious, hospital, or physician certificate;</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="746" slineno="11-34" level="4"><display>(B)</display>verified school records;</subsection><subsection ssid="2-null-20" dnum="C-o" numlevel="1" lineno="747" slineno="11-35" level="4"><display>(C)</display>verified immunization records; or</subsection><subsection ssid="2-null-21" dnum="D-o" numlevel="1" lineno="748" slineno="11-36" level="4"><display>(D)</display>documentation from a social service provider.</subsection></subsection></subsection></subsection><subsection ssid="2-null-22" dnum="3-o" numlevel="1" lineno="749" slineno="11-37" level="1" space="false"><display>(3)</display><subsection ssid="2-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53G-7-1102(1)(c)(i)">(1)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(c)(i)</amend> does not apply to an association for a student who is a <ln numlevel="1" lineno="750" slineno="11-38"/>homeless child or youth, as defined in the McKinney-Vento Homeless Assistance <ln numlevel="1" lineno="751" slineno="11-39"/>Act, 42 U.S.C. Sec. 11431 et seq.</subsection><subsection ssid="2-null-24" dnum="b-o" numlevel="1" lineno="752" slineno="11-40" level="2"><display>(b)</display>For a student who is a homeless child or youth, including an unaccompanied <ln numlevel="1" lineno="753" slineno="11-41"/>homeless child or youth, an association may collect:<subsection ssid="2-null-25" dnum="i-o" numlevel="1" lineno="754" slineno="11-42" level="3"><display>(i)</display>an affidavit from the student's parent or guardian, or the student if the student is an <ln numlevel="1" lineno="755" slineno="11-43"/>unaccompanied homeless child or youth, indicating that the student does not meet <ln numlevel="1" lineno="756" slineno="11-44"/>the necessary requirements to obtain a document described in Subsection <xref depth="4" refnumber="53G-7-1102(2)(a)">(2)(a)</xref>; <ln numlevel="1" lineno="757" slineno="11-45"/>and</subsection><subsection ssid="2-null-26" dnum="ii-o" numlevel="1" lineno="758" slineno="11-46" level="3"><display>(ii)</display>a document described in Subsection <xref depth="4" refnumber="53G-7-1102(2)(b)(ii)">(2)(b)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-27" dnum="4-o" numlevel="1" lineno="759" slineno="11-47" level="1"><display>(4)</display>Nothing in this section limits or impairs an LEA's requirement to verify a student's <ln numlevel="1" lineno="760" slineno="11-48"/>initial review of eligibility to participate in an athletic team, event, or category under <ln numlevel="1" lineno="761" slineno="11-49"/>applicable state or federal law or state board rule, including the student's:<subsection ssid="2-null-28" dnum="a-o" numlevel="1" lineno="762" slineno="11-50" level="2"><display>(a)</display>residency status;</subsection><subsection ssid="2-null-29" dnum="b-o" numlevel="1" lineno="763" slineno="11-51" level="2"><display>(b)</display>age;</subsection><subsection ssid="2-null-30" dnum="c-o" numlevel="1" lineno="764" slineno="11-52" level="2"><display>(c)</display>sex, verified by the student's unamended birth certificate, as that term is defined in <ln numlevel="1" lineno="765" slineno="11-53"/>Section <xref depth="3" refnumber="53G-6-1001">53G-6-1001</xref>;</subsection><subsection ssid="2-null-31" dnum="d-o" numlevel="1" lineno="766" slineno="11-54" level="2"><display>(d)</display>academic requirements; or</subsection><subsection ssid="2-null-32" dnum="e-o" numlevel="1" lineno="767" slineno="11-55" level="2"><display>(e)</display>school enrollment capacity.</subsection></subsection><subsection ssid="2-null-33" dnum="5-o" numlevel="1" lineno="768" slineno="11-56" level="1"><display>(5)</display>Unless otherwise specified, an association's compliance with or an association employee <ln numlevel="1" lineno="769" slineno="11-57"/>or officer's compliance with the provisions described in Subsection <xref depth="4" refnumber="53G-7-1102(1)">(1)</xref> does not alter:<subsection ssid="2-null-34" dnum="a-o" numlevel="1" lineno="770" slineno="11-58" level="2"><display>(a)</display>the association's public or private status; or</subsection><subsection ssid="2-null-35" dnum="b-o" numlevel="1" lineno="771" slineno="11-59" level="2"><display>(b)</display>the public or private employment status of the employee or officer.</subsection></subsection><subsection ssid="2-39" dnum="_-o:6-i" numlevel="1" lineno="772" slineno="11-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1396" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">A power described in this part applies to the extent a memorandum of understanding <ln numlevel="1" lineno="773" slineno="11-61"/>described in Section <xref depth="3" refnumber="53E-3-1302">53E-3-1302</xref> involves an association in the operation of <ln numlevel="1" lineno="774" slineno="11-62"/>interscholastic activities.</amend></subsection></section></bsec><bsec buid="43" num="63G-2-103" type="amend" src="code" uid="C63G-2-S103_2027070120270701" sort="63G02 01030020270701" numlevel="1" lineno="775" slineno="12-1" sn="12"><section number="63G-2-103" numlevel="1" lineno="776" slineno="12-2" type="amend"><secline lineno="775">Section 12. Section <bold>63G-2-103</bold> is amended to read:</secline><catline lineno="776"><bold>63G-2-103<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/27</date></paren></parens>. Definitions.</bold></catline><sectionText lineno="777"><tab/>As used in this chapter:</sectionText><subsection ssid="43-null-1" dnum="1-o" numlevel="1" lineno="778" slineno="12-4" level="1"><display>(1)</display>"Audit" means:<subsection ssid="43-null-2" dnum="a-o" numlevel="1" lineno="779" slineno="12-5" level="2"><display>(a)</display>a systematic examination of financial, management, program, and related records for <ln numlevel="1" lineno="780" slineno="12-6"/>the purpose of determining the fair presentation of financial statements, adequacy of <ln numlevel="1" lineno="781" slineno="12-7"/>internal controls, or compliance with laws and regulations; or</subsection><subsection ssid="43-null-3" dnum="b-o" numlevel="1" lineno="782" slineno="12-8" level="2"><display>(b)</display>a systematic examination of program procedures and operations for the purpose of <ln numlevel="1" lineno="783" slineno="12-9"/>determining their effectiveness, economy, efficiency, and compliance with statutes <ln numlevel="1" lineno="784" slineno="12-10"/>and regulations.</subsection></subsection><subsection ssid="43-null-4" dnum="2-o" numlevel="1" lineno="785" slineno="12-11" level="1"><display>(2)</display>"Chief administrative officer" means the chief administrative officer of a governmental <ln numlevel="1" lineno="786" slineno="12-12"/>entity who is responsible to fulfill the duties described in Section <xref depth="3" refnumber="63A-12-103">63A-12-103</xref>.</subsection><subsection ssid="43-null-5" dnum="3-o" numlevel="1" lineno="787" slineno="12-13" level="1"><display>(3)</display>"Chronological logs" mean the regular and customary summary records of law <ln numlevel="1" lineno="788" slineno="12-14"/>enforcement agencies and other public safety agencies that show:<subsection ssid="43-null-6" dnum="a-o" numlevel="1" lineno="789" slineno="12-15" level="2"><display>(a)</display>the time and general nature of police, fire, and paramedic calls made to the agency; <ln numlevel="1" lineno="790" slineno="12-16"/>and</subsection><subsection ssid="43-null-7" dnum="b-o" numlevel="1" lineno="791" slineno="12-17" level="2"><display>(b)</display>any arrests or jail bookings made by the agency.</subsection></subsection><subsection ssid="43-null-8" dnum="4-o" numlevel="1" lineno="792" slineno="12-18" level="1"><display>(4)</display>"Classification," "classify," and their derivative forms mean determining whether a <ln numlevel="1" lineno="793" slineno="12-19"/>record series, record, or information within a record is public, private, controlled, <ln numlevel="1" lineno="794" slineno="12-20"/>protected, or exempt from disclosure under Subsection <xref depth="4" refnumber="63G-2-201(3)(b)">63G-2-201(3)(b)</xref>.</subsection><subsection ssid="43-null-9" dnum="5-o" numlevel="1" lineno="795" slineno="12-21" level="1" space="false"><display>(5)</display><subsection ssid="43-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Computer program" means:<subsection ssid="43-null-11" dnum="i-o" numlevel="1" lineno="796" slineno="12-22" level="3" tab="1"><display>(i)</display>a series of instructions or statements that permit the functioning of a computer <ln numlevel="1" lineno="797" slineno="12-23"/>system in a manner designed to provide storage, retrieval, and manipulation of <ln numlevel="1" lineno="798" slineno="12-24"/>data from the computer system; and</subsection><subsection ssid="43-null-12" dnum="ii-o" numlevel="1" lineno="799" slineno="12-25" level="3" tab="1"><display>(ii)</display>any associated documentation and source material that explain how to operate the <ln numlevel="1" lineno="800" slineno="12-26"/>computer program.</subsection></subsection><subsection ssid="43-null-13" dnum="b-o" numlevel="1" lineno="801" slineno="12-27" level="2"><display>(b)</display>"Computer program" does not mean:<subsection ssid="43-null-14" dnum="i-o" numlevel="1" lineno="802" slineno="12-28" level="3"><display>(i)</display>the original data, including numbers, text, voice, graphics, and images;</subsection><subsection ssid="43-null-15" dnum="ii-o" numlevel="1" lineno="803" slineno="12-29" level="3"><display>(ii)</display>analysis, compilation, and other manipulated forms of the original data produced <ln numlevel="1" lineno="804" slineno="12-30"/>by use of the program; or</subsection><subsection ssid="43-null-16" dnum="iii-o" numlevel="1" lineno="805" slineno="12-31" level="3"><display>(iii)</display>the mathematical or statistical formulas, excluding the underlying mathematical <ln numlevel="1" lineno="806" slineno="12-32"/>algorithms contained in the program, that would be used if the manipulated forms <ln numlevel="1" lineno="807" slineno="12-33"/>of the original data were to be produced manually.</subsection></subsection></subsection><subsection ssid="43-null-17" dnum="6-o" numlevel="1" lineno="808" slineno="12-34" level="1" space="false"><display>(6)</display><subsection ssid="43-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Contractor" means:<subsection ssid="43-null-19" dnum="i-o" numlevel="1" lineno="809" slineno="12-35" level="3" tab="1"><display>(i)</display>any person who contracts with a governmental entity to provide goods or services <ln numlevel="1" lineno="810" slineno="12-36"/>directly to a governmental entity; or</subsection><subsection ssid="43-null-20" dnum="ii-o" numlevel="1" lineno="811" slineno="12-37" level="3" tab="1"><display>(ii)</display>any private, nonprofit organization that receives funds from a governmental entity.</subsection></subsection><subsection ssid="43-null-21" dnum="b-o" numlevel="1" lineno="812" slineno="12-38" level="2"><display>(b)</display>"Contractor" does not mean a private provider.</subsection></subsection><subsection ssid="43-null-22" dnum="7-o" numlevel="1" lineno="813" slineno="12-39" level="1"><display>(7)</display>"Controlled record" means a record containing data on individuals that is controlled as <ln numlevel="1" lineno="814" slineno="12-40"/>provided by Section <xref depth="3" refnumber="63G-2-304">63G-2-304</xref>.</subsection><subsection ssid="43-null-23" dnum="8-o" numlevel="1" lineno="815" slineno="12-41" level="1"><display>(8)</display>"Designation," "designate," and their derivative forms mean indicating, based on a <ln numlevel="1" lineno="816" slineno="12-42"/>governmental entity's familiarity with a record series or based on a governmental entity's <ln numlevel="1" lineno="817" slineno="12-43"/>review of a reasonable sample of a record series, the primary classification that a <ln numlevel="1" lineno="818" slineno="12-44"/>majority of records in a record series would be given if classified and the classification <ln numlevel="1" lineno="819" slineno="12-45"/>that other records typically present in the record series would be given if classified.</subsection><subsection ssid="43-null-24" dnum="9-o" numlevel="1" lineno="820" slineno="12-46" level="1"><display>(9)</display>"Elected official" means each person elected to a state office, county office, municipal <ln numlevel="1" lineno="821" slineno="12-47"/>office, school board or school district office, special district office, or special service <ln numlevel="1" lineno="822" slineno="12-48"/>district office, but does not include judges.</subsection><subsection ssid="43-null-25" dnum="10-o" numlevel="1" lineno="823" slineno="12-49" level="1"><display>(10)</display>"Explosive" means a chemical compound, device, or mixture:<subsection ssid="43-null-26" dnum="a-o" numlevel="1" lineno="824" slineno="12-50" level="2"><display>(a)</display>commonly used or intended for the purpose of producing an explosion; and</subsection><subsection ssid="43-null-27" dnum="b-o" numlevel="1" lineno="825" slineno="12-51" level="2"><display>(b)</display>that contains oxidizing or combustive units or other ingredients in proportions, <ln numlevel="1" lineno="826" slineno="12-52"/>quantities, or packing so that:<subsection ssid="43-null-28" dnum="i-o" numlevel="1" lineno="827" slineno="12-53" level="3"><display>(i)</display>an ignition by fire, friction, concussion, percussion, or detonator of any part of the <ln numlevel="1" lineno="828" slineno="12-54"/>compound or mixture may cause a sudden generation of highly heated gases; and</subsection><subsection ssid="43-null-29" dnum="ii-o" numlevel="1" lineno="829" slineno="12-55" level="3"><display>(ii)</display>the resultant gaseous pressures are capable of:<subsection ssid="43-null-30" dnum="A-o" numlevel="1" lineno="830" slineno="12-56" level="4"><display>(A)</display>producing destructive effects on contiguous objects; or</subsection><subsection ssid="43-null-31" dnum="B-o" numlevel="1" lineno="831" slineno="12-57" level="4"><display>(B)</display>causing death or serious bodily injury.</subsection></subsection></subsection></subsection><subsection ssid="43-null-32" dnum="11-o" numlevel="1" lineno="832" slineno="12-58" level="1"><display>(11)</display>"Government audit agency" means any governmental entity that conducts an audit.</subsection><subsection ssid="43-null-33" dnum="12-o" numlevel="1" lineno="833" slineno="12-59" level="1" space="false"><display>(12)</display><subsection ssid="43-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Governmental entity" means:<subsection ssid="43-null-35" dnum="i-o" numlevel="1" lineno="834" slineno="12-60" level="3" tab="1"><display>(i)</display>executive department agencies of the state, the offices of the governor, lieutenant <ln numlevel="1" lineno="835" slineno="12-61"/>governor, state auditor, attorney general, and state treasurer, the Board of Pardons <ln numlevel="1" lineno="836" slineno="12-62"/>and Parole, the Board of Examiners, the National Guard, the Career Service <ln numlevel="1" lineno="837" slineno="12-63"/>Review Office, the State Board of Education, the Utah Board of Higher <ln numlevel="1" lineno="838" slineno="12-64"/>Education, and the State Archives;</subsection><subsection ssid="43-null-36" dnum="ii-o" numlevel="1" lineno="839" slineno="12-65" level="3" tab="1"><display>(ii)</display>the Office of the Legislative Auditor General, Office of the Legislative Fiscal <ln numlevel="1" lineno="840" slineno="12-66"/>Analyst, Office of Legislative Research and General Counsel, the Legislature, and <ln numlevel="1" lineno="841" slineno="12-67"/>legislative committees, except any political party, group, caucus, or rules or sifting <ln numlevel="1" lineno="842" slineno="12-68"/>committee of the Legislature;</subsection><subsection ssid="43-null-37" dnum="iii-o" numlevel="1" lineno="843" slineno="12-69" level="3" tab="1"><display>(iii)</display>courts, the Judicial Council, the Administrative Office of the Courts, and similar <ln numlevel="1" lineno="844" slineno="12-70"/>administrative units in the judicial branch;</subsection><subsection ssid="43-null-38" dnum="iv-o" numlevel="1" lineno="845" slineno="12-71" level="3" tab="1"><display>(iv)</display>any state-funded institution of higher education or public education; or</subsection><subsection ssid="43-null-39" dnum="v-o" numlevel="1" lineno="846" slineno="12-72" level="3" tab="1"><display>(v)</display>any political subdivision of the state, but, if a political subdivision has adopted an <ln numlevel="1" lineno="847" slineno="12-73"/>ordinance or a policy relating to information practices pursuant to Section <xref depth="3" refnumber="63G-2-701"><ln numlevel="1" lineno="848" slineno="12-74"/>63G-2-701</xref>, this chapter shall apply to the political subdivision to the extent <ln numlevel="1" lineno="849" slineno="12-75"/>specified in Section <xref depth="3" refnumber="63G-2-701">63G-2-701</xref> or as specified in any other section of this chapter <ln numlevel="1" lineno="850" slineno="12-76"/>that specifically refers to political subdivisions.</subsection></subsection><subsection ssid="43-null-40" dnum="b-o" numlevel="1" lineno="851" slineno="12-77" level="2"><display>(b)</display>"Governmental entity" also means:<subsection ssid="43-null-41" dnum="i-o" numlevel="1" lineno="852" slineno="12-78" level="3"><display>(i)</display>every office, agency, board, bureau, committee, department, advisory board, or <ln numlevel="1" lineno="853" slineno="12-79"/>commission of an entity listed in Subsection <xref depth="4" refnumber="63G-2-103(12)(a)">(12)(a)</xref> that is funded or established <ln numlevel="1" lineno="854" slineno="12-80"/>by the government to carry out the public's business;</subsection><subsection ssid="43-null-42" dnum="ii-o" numlevel="1" lineno="855" slineno="12-81" level="3"><display>(ii)</display>as defined in Section <xref depth="3" refnumber="11-13-103">11-13-103</xref>, an interlocal entity or joint or cooperative <ln numlevel="1" lineno="856" slineno="12-82"/>undertaking, except for the Water District Water Development Council created <ln numlevel="1" lineno="857" slineno="12-83"/>pursuant to Section <xref depth="3" refnumber="11-13-228">11-13-228</xref>;</subsection><subsection ssid="43-null-43" dnum="iii-o" numlevel="1" lineno="858" slineno="12-84" level="3"><display>(iii)</display>as defined in Section <xref depth="3" refnumber="11-13a-102">11-13a-102</xref>, a governmental nonprofit corporation;</subsection><subsection ssid="43-null-44" dnum="iv-o" numlevel="1" lineno="859" slineno="12-85" level="3"><display>(iv)</display>an association as defined in Section <xref depth="3" refnumber="53G-7-1101">53G-7-1101</xref>;</subsection><subsection ssid="43-null-45" dnum="v-o" numlevel="1" lineno="860" slineno="12-86" level="3"><display>(v)</display>the Utah Independent Redistricting Commission; and</subsection><subsection ssid="43-null-46" dnum="vi-o" numlevel="1" lineno="861" slineno="12-87" level="3"><display>(vi)</display>a law enforcement agency, as defined in Section <xref depth="3" refnumber="53-1-102">53-1-102</xref>, that employs one or <ln numlevel="1" lineno="862" slineno="12-88"/>more law enforcement officers, as defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>.</subsection></subsection><subsection ssid="43-null-47" dnum="c-o" numlevel="1" lineno="863" slineno="12-89" level="2"><display>(c)</display>"Governmental entity" does not include the Utah Educational Savings Plan created in <ln numlevel="1" lineno="864" slineno="12-90"/>Section <xref depth="3" refnumber="53H-10-202">53H-10-202</xref>.</subsection></subsection><subsection ssid="43-null-48" dnum="13-o" numlevel="1" lineno="865" slineno="12-91" level="1"><display>(13)</display>"Government Records Office" means the same as that term is defined in Section <xref depth="3" refnumber="63A-12-201"><ln numlevel="1" lineno="866" slineno="12-92"/>63A-12-201</xref>.</subsection><subsection ssid="43-null-49" dnum="14-o" numlevel="1" lineno="867" slineno="12-93" level="1"><display>(14)</display>"Gross compensation" means every form of remuneration payable for a given period to <ln numlevel="1" lineno="868" slineno="12-94"/>an individual for services provided including salaries, commissions, vacation pay, <ln numlevel="1" lineno="869" slineno="12-95"/>severance pay, bonuses, and any board, rent, housing, lodging, payments in kind, and <ln numlevel="1" lineno="870" slineno="12-96"/>any similar benefit received from the individual's employer.</subsection><subsection ssid="43-null-50" dnum="15-o" numlevel="1" lineno="871" slineno="12-97" level="1"><display>(15)</display>"Individual" means a human being.</subsection><subsection ssid="43-null-51" dnum="16-o" numlevel="1" lineno="872" slineno="12-98" level="1" space="false"><display>(16)</display><subsection ssid="43-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Initial contact report" means an initial written or recorded report, however <ln numlevel="1" lineno="873" slineno="12-99"/>titled, prepared by peace officers engaged in public patrol or response duties <ln numlevel="1" lineno="874" slineno="12-100"/>describing official actions initially taken in response to either a public complaint <ln numlevel="1" lineno="875" slineno="12-101"/>about or the discovery of an apparent violation of law, which report may describe:<subsection ssid="43-null-53" dnum="i-o" numlevel="1" lineno="876" slineno="12-102" level="3" tab="1"><display>(i)</display>the date, time, location, and nature of the complaint, the incident, or offense;</subsection><subsection ssid="43-null-54" dnum="ii-o" numlevel="1" lineno="877" slineno="12-103" level="3" tab="1"><display>(ii)</display>names of victims;</subsection><subsection ssid="43-null-55" dnum="iii-o" numlevel="1" lineno="878" slineno="12-104" level="3" tab="1"><display>(iii)</display>the nature or general scope of the agency's initial actions taken in response to the <ln numlevel="1" lineno="879" slineno="12-105"/>incident;</subsection><subsection ssid="43-null-56" dnum="iv-o" numlevel="1" lineno="880" slineno="12-106" level="3" tab="1"><display>(iv)</display>the general nature of any injuries or estimate of damages sustained in the incident;</subsection><subsection ssid="43-null-57" dnum="v-o" numlevel="1" lineno="881" slineno="12-107" level="3" tab="1"><display>(v)</display>the name, address, and other identifying information about any person arrested or <ln numlevel="1" lineno="882" slineno="12-108"/>charged in connection with the incident; or</subsection><subsection ssid="43-null-58" dnum="vi-o" numlevel="1" lineno="883" slineno="12-109" level="3" tab="1"><display>(vi)</display>the identity of the public safety personnel, except undercover personnel, or <ln numlevel="1" lineno="884" slineno="12-110"/>prosecuting attorney involved in responding to the initial incident.</subsection></subsection><subsection ssid="43-null-59" dnum="b-o" numlevel="1" lineno="885" slineno="12-111" level="2"><display>(b)</display><amend anum="0" ea="amend" pairid="16" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">"</amend>Initial contact reports<amend anum="0" ea="amend" pairid="18" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">"</amend> do not include follow-up or investigative reports prepared <ln numlevel="1" lineno="886" slineno="12-112"/>after the initial contact report.  However, if the information specified in Subsection <xref depth="4" refnumber="63G-2-103(16)(a)"><ln numlevel="1" lineno="887" slineno="12-113"/>(16)(a)</xref> appears in follow-up or investigative reports, it may only be treated <ln numlevel="1" lineno="888" slineno="12-114"/>confidentially if it is private, controlled, protected, or exempt from disclosure under <ln numlevel="1" lineno="889" slineno="12-115"/>Subsection <xref depth="4" refnumber="63G-2-201(3)(b)">63G-2-201(3)(b)</xref>.</subsection><subsection ssid="43-null-60" dnum="c-o" numlevel="1" lineno="890" slineno="12-116" level="2"><display>(c)</display><amend anum="0" ea="amend" pairid="19" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both">"</amend>Initial contact reports<amend anum="0" ea="amend" pairid="20" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both">"</amend> do not include accident reports, as that term is described in <ln numlevel="1" lineno="891" slineno="12-117"/>Title <xref depth="2" refnumber="41-6a-4">41, Chapter 6a, Part 4</xref>, Accident Responsibilities.</subsection></subsection><subsection ssid="43-null-61" dnum="17-o" numlevel="1" lineno="892" slineno="12-118" level="1"><display>(17)</display>"Legislative body" means the Legislature.</subsection><subsection ssid="43-null-62" dnum="18-o" numlevel="1" lineno="893" slineno="12-119" level="1"><display>(18)</display>"Notice of compliance" means a statement confirming that a governmental entity has <ln numlevel="1" lineno="894" slineno="12-120"/>complied with an order of the director of the Government Records Office.</subsection><subsection ssid="43-null-63" dnum="19-o" numlevel="1" lineno="895" slineno="12-121" level="1"><display>(19)</display>"Person" means:<subsection ssid="43-null-64" dnum="a-o" numlevel="1" lineno="896" slineno="12-122" level="2"><display>(a)</display>an individual;</subsection><subsection ssid="43-null-65" dnum="b-o" numlevel="1" lineno="897" slineno="12-123" level="2"><display>(b)</display>a nonprofit or profit corporation;</subsection><subsection ssid="43-null-66" dnum="c-o" numlevel="1" lineno="898" slineno="12-124" level="2"><display>(c)</display>a partnership;</subsection><subsection ssid="43-null-67" dnum="d-o" numlevel="1" lineno="899" slineno="12-125" level="2"><display>(d)</display>a sole proprietorship;</subsection><subsection ssid="43-null-68" dnum="e-o" numlevel="1" lineno="900" slineno="12-126" level="2"><display>(e)</display>other type of business organization; or</subsection><subsection ssid="43-null-69" dnum="f-o" numlevel="1" lineno="901" slineno="12-127" level="2"><display>(f)</display>any combination acting in concert with one another.</subsection></subsection><subsection ssid="43-null-70" dnum="20-o" numlevel="1" lineno="902" slineno="12-128" level="1"><display>(20)</display>"Private provider" means any person who contracts with a governmental entity to <ln numlevel="1" lineno="903" slineno="12-129"/>provide services directly to the public.</subsection><subsection ssid="43-null-71" dnum="21-o" numlevel="1" lineno="904" slineno="12-130" level="1"><display>(21)</display>"Private record" means a record containing data on individuals that is private as <ln numlevel="1" lineno="905" slineno="12-131"/>provided by Section <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>.</subsection><subsection ssid="43-null-72" dnum="22-o" numlevel="1" lineno="906" slineno="12-132" level="1"><display>(22)</display>"Protected record" means a record that is classified protected as provided by Section <xref depth="3" refnumber="63G-2-305"><ln numlevel="1" lineno="907" slineno="12-133"/>63G-2-305</xref>.</subsection><subsection ssid="43-null-73" dnum="23-o" numlevel="1" lineno="908" slineno="12-134" level="1"><display>(23)</display>"Public record" means a record that is not private, controlled, or protected and that is <ln numlevel="1" lineno="909" slineno="12-135"/>not exempt from disclosure as provided in Subsection <xref depth="4" refnumber="63G-2-201(3)(b)">63G-2-201(3)(b)</xref>.</subsection><subsection ssid="43-null-74" dnum="24-o" numlevel="1" lineno="910" slineno="12-136" level="1"><display>(24)</display>"Reasonable search" means a search that is:<subsection ssid="43-null-75" dnum="a-o" numlevel="1" lineno="911" slineno="12-137" level="2"><display>(a)</display>reasonable in scope and intensity; and</subsection><subsection ssid="43-null-76" dnum="b-o" numlevel="1" lineno="912" slineno="12-138" level="2"><display>(b)</display>not unreasonably burdensome for the government entity.</subsection></subsection><subsection ssid="43-null-77" dnum="25-o" numlevel="1" lineno="913" slineno="12-139" level="1" space="false"><display>(25)</display><subsection ssid="43-null-78" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Record" means a book, letter, document, paper, map, plan, photograph, film, <ln numlevel="1" lineno="914" slineno="12-140"/>card, tape, recording, electronic data, or other documentary material regardless of <ln numlevel="1" lineno="915" slineno="12-141"/>physical form or characteristics:<subsection ssid="43-null-79" dnum="i-o" numlevel="1" lineno="916" slineno="12-142" level="3" tab="1"><display>(i)</display>that is prepared, owned, received, or retained by a governmental entity or political <ln numlevel="1" lineno="917" slineno="12-143"/>subdivision; and</subsection><subsection ssid="43-null-80" dnum="ii-o" numlevel="1" lineno="918" slineno="12-144" level="3" tab="1"><display>(ii)</display>where all of the information in the original is reproducible by photocopy or other <ln numlevel="1" lineno="919" slineno="12-145"/>mechanical or electronic means.</subsection></subsection><subsection ssid="43-null-81" dnum="b-o" numlevel="1" lineno="920" slineno="12-146" level="2"><display>(b)</display>"Record" does not include:<subsection ssid="43-null-82" dnum="i-o" numlevel="1" lineno="921" slineno="12-147" level="3"><display>(i)</display>a personal note or personal communication prepared or received by an employee <ln numlevel="1" lineno="922" slineno="12-148"/>or officer of a governmental entity:<subsection ssid="43-null-83" dnum="A-o" numlevel="1" lineno="923" slineno="12-149" level="4"><display>(A)</display>in a capacity other than the employee's or officer's governmental capacity; or</subsection><subsection ssid="43-null-84" dnum="B-o" numlevel="1" lineno="924" slineno="12-150" level="4"><display>(B)</display>that is unrelated to the conduct of the public's business;</subsection></subsection><subsection ssid="43-null-85" dnum="ii-o" numlevel="1" lineno="925" slineno="12-151" level="3"><display>(ii)</display>a temporary draft or similar material prepared for the originator's personal use or <ln numlevel="1" lineno="926" slineno="12-152"/>prepared by the originator for the personal use of an individual for whom the <ln numlevel="1" lineno="927" slineno="12-153"/>originator is working;</subsection><subsection ssid="43-null-86" dnum="iii-o" numlevel="1" lineno="928" slineno="12-154" level="3"><display>(iii)</display>material that is legally owned by an individual in the individual's private capacity;</subsection><subsection ssid="43-null-87" dnum="iv-o" numlevel="1" lineno="929" slineno="12-155" level="3"><display>(iv)</display>material to which access is limited by the laws of copyright or patent unless the <ln numlevel="1" lineno="930" slineno="12-156"/>copyright or patent is owned by a governmental entity or political subdivision;</subsection><subsection ssid="43-null-88" dnum="v-o" numlevel="1" lineno="931" slineno="12-157" level="3"><display>(v)</display>proprietary software;</subsection><subsection ssid="43-null-89" dnum="vi-o" numlevel="1" lineno="932" slineno="12-158" level="3"><display>(vi)</display>junk mail or a commercial publication received by a governmental entity or an <ln numlevel="1" lineno="933" slineno="12-159"/>official or employee of a governmental entity;</subsection><subsection ssid="43-null-90" dnum="vii-o" numlevel="1" lineno="934" slineno="12-160" level="3"><display>(vii)</display>a book that is cataloged, indexed, or inventoried and contained in the collections <ln numlevel="1" lineno="935" slineno="12-161"/>of a library open to the public;</subsection><subsection ssid="43-null-91" dnum="viii-o" numlevel="1" lineno="936" slineno="12-162" level="3"><display>(viii)</display>material that is cataloged, indexed, or inventoried and contained in the <ln numlevel="1" lineno="937" slineno="12-163"/>collections of a library open to the public, regardless of physical form or <ln numlevel="1" lineno="938" slineno="12-164"/>characteristics of the material;</subsection><subsection ssid="43-null-92" dnum="ix-o" numlevel="1" lineno="939" slineno="12-165" level="3"><display>(ix)</display>a daily calendar ;</subsection><subsection ssid="43-null-93" dnum="x-o" numlevel="1" lineno="940" slineno="12-166" level="3"><display>(x)</display>a note prepared by the originator for the originator's own use or for the sole use of <ln numlevel="1" lineno="941" slineno="12-167"/>an individual for whom the originator is working;</subsection><subsection ssid="43-null-94" dnum="xi-o" numlevel="1" lineno="942" slineno="12-168" level="3"><display>(xi)</display>a computer program that is developed or purchased by or for any governmental <ln numlevel="1" lineno="943" slineno="12-169"/>entity for its own use;</subsection><subsection ssid="43-null-95" dnum="xii-o" numlevel="1" lineno="944" slineno="12-170" level="3"><display>(xii)</display>a note or internal memorandum prepared as part of the deliberative process by:<subsection ssid="43-null-96" dnum="A-o" numlevel="1" lineno="945" slineno="12-171" level="4"><display>(A)</display>a member of the judiciary;</subsection><subsection ssid="43-null-97" dnum="B-o" numlevel="1" lineno="946" slineno="12-172" level="4"><display>(B)</display>an administrative law judge;</subsection><subsection ssid="43-null-98" dnum="C-o" numlevel="1" lineno="947" slineno="12-173" level="4"><display>(C)</display>a member of the Board of Pardons and Parole; or</subsection><subsection ssid="43-null-99" dnum="D-o" numlevel="1" lineno="948" slineno="12-174" level="4"><display>(D)</display>a member of any other body, other than an association <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">or appeals panel </amend><amendoutend style="2"/>as <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"><ln numlevel="1" lineno="949" slineno="12-175"/>that term is </amend>defined in Section <xref depth="3" refnumber="53G-7-1101">53G-7-1101</xref>, charged by law with performing a <ln numlevel="1" lineno="950" slineno="12-176"/>quasi-judicial function;</subsection></subsection><subsection ssid="43-null-100" dnum="xiii-o" numlevel="1" lineno="951" slineno="12-177" level="3"><display>(xiii)</display>a telephone number or similar code used to access a mobile communication <ln numlevel="1" lineno="952" slineno="12-178"/>device that is used by an employee or officer of a governmental entity, provided <ln numlevel="1" lineno="953" slineno="12-179"/>that the employee or officer of the governmental entity has designated at least one <ln numlevel="1" lineno="954" slineno="12-180"/>business telephone number that is a public record as provided in Section <xref depth="3" refnumber="63G-2-301"><ln numlevel="1" lineno="955" slineno="12-181"/>63G-2-301</xref>;</subsection><subsection ssid="43-null-101" dnum="xiv-o" numlevel="1" lineno="956" slineno="12-182" level="3"><display>(xiv)</display>information provided by the Public Employees' Benefit and Insurance Program, <ln numlevel="1" lineno="957" slineno="12-183"/>created in Section <xref depth="3" refnumber="49-20-103">49-20-103</xref>, to a county to enable the county to calculate the <ln numlevel="1" lineno="958" slineno="12-184"/>amount to be paid to a health care provider under Subsection <xref depth="4" refnumber="17-63-706(2)(e)(ii)">17-63-706(2)(e)(ii)</xref>;</subsection><subsection ssid="43-null-102" dnum="xv-o" numlevel="1" lineno="959" slineno="12-185" level="3"><display>(xv)</display>information that an owner of unimproved property provides to a local entity as <ln numlevel="1" lineno="960" slineno="12-186"/>provided in Section <xref depth="3" refnumber="11-42-205">11-42-205</xref>;</subsection><subsection ssid="43-null-103" dnum="xvi-o" numlevel="1" lineno="961" slineno="12-187" level="3"><display>(xvi)</display>a video or audio recording of an interview, or a transcript of the video or audio <ln numlevel="1" lineno="962" slineno="12-188"/>recording, that is conducted at a Children's Justice Center established under <ln numlevel="1" lineno="963" slineno="12-189"/>Section <xref depth="3" refnumber="67-5b-102">67-5b-102</xref>;</subsection><subsection ssid="43-null-104" dnum="xvii-o" numlevel="1" lineno="964" slineno="12-190" level="3"><display>(xvii)</display>child sexual abuse material, as defined by Section <xref depth="3" refnumber="76-5b-103">76-5b-103</xref>;</subsection><subsection ssid="43-null-105" dnum="xviii-o" numlevel="1" lineno="965" slineno="12-191" level="3"><display>(xviii)</display>before final disposition of an ethics complaint occurs, a video or audio <ln numlevel="1" lineno="966" slineno="12-192"/>recording of the closed portion of a meeting or hearing of:<subsection ssid="43-null-106" dnum="A-o" numlevel="1" lineno="967" slineno="12-193" level="4"><display>(A)</display>a Senate or House Ethics Committee;</subsection><subsection ssid="43-null-107" dnum="B-o" numlevel="1" lineno="968" slineno="12-194" level="4"><display>(B)</display>the Independent Legislative Ethics Commission;</subsection><subsection ssid="43-null-108" dnum="C-o" numlevel="1" lineno="969" slineno="12-195" level="4"><display>(C)</display>the Independent Executive Branch Ethics Commission, created in Section <xref depth="3" refnumber="63A-14-202"><ln numlevel="1" lineno="970" slineno="12-196"/>63A-14-202</xref>; or</subsection><subsection ssid="43-null-109" dnum="D-o" numlevel="1" lineno="971" slineno="12-197" level="4"><display>(D)</display>the Political Subdivisions Ethics Review Commission established in Section <xref depth="3" refnumber="63A-15-201"><ln numlevel="1" lineno="972" slineno="12-198"/>63A-15-201</xref>; </subsection></subsection><subsection ssid="43-null-110" dnum="xix-o" numlevel="1" lineno="973" slineno="12-199" level="3"><display>(xix)</display>confidential communication described in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>, <xref depth="3" refnumber="58-61-102">58-61-102</xref>, or <xref depth="3" refnumber="58-61-702"><ln numlevel="1" lineno="974" slineno="12-200"/>58-61-702</xref>;</subsection><subsection ssid="43-null-111" dnum="xx-o" numlevel="1" lineno="975" slineno="12-201" level="3"><display>(xx)</display>any item described in Subsection <xref depth="4" refnumber="63G-2-103(25)(a)">(25)(a)</xref> that is:<subsection ssid="43-null-112" dnum="A-o" numlevel="1" lineno="976" slineno="12-202" level="4"><display>(A)</display>described in Subsection <xref depth="4" refnumber="63G-2-305(17)">63G-2-305(17)</xref>, <xref refnumber="63G-2-305(18)" depth="4">(18), </xref>or <xref refnumber="63G-2-305(23)(b)" depth="4">(23)(b)</xref>; and</subsection><subsection ssid="43-null-113" dnum="B-o" numlevel="1" lineno="977" slineno="12-203" level="4"><display>(B)</display>shared between any of the following entities:<subsection ssid="43-null-114" dnum="I-o" numlevel="1" lineno="978" slineno="12-204" level="5"><display>(I)</display>the Division of Risk Management;</subsection><subsection ssid="43-null-115" dnum="II-o" numlevel="1" lineno="979" slineno="12-205" level="5"><display>(II)</display>the Office of the Attorney General;</subsection><subsection ssid="43-null-116" dnum="III-o" numlevel="1" lineno="980" slineno="12-206" level="5"><display>(III)</display>the governor's office; or</subsection><subsection ssid="43-null-117" dnum="IV-o" numlevel="1" lineno="981" slineno="12-207" level="5"><display>(IV)</display>the Legislature;</subsection></subsection></subsection><subsection ssid="43-null-118" dnum="xxi-o" numlevel="1" lineno="982" slineno="12-208" level="3"><display>(xxi)</display>the email address that a candidate for elective office provides to a filing officer <ln numlevel="1" lineno="983" slineno="12-209"/>under Subsection <xref depth="4" refnumber="20A-9-201(5)(c)(ii)">20A-9-201(5)(c)(ii)</xref> or <xref depth="4" refnumber="20A-9-203(4)(c)(iv)">20A-9-203(4)(c)(iv)</xref>; or</subsection><subsection ssid="43-null-119" dnum="xxii-o" numlevel="1" lineno="984" slineno="12-210" level="3"><display>(xxii)</display>except as provided in Sections <xref depth="3" refnumber="31A-16-105">31A-16-105</xref>, <xref depth="3" refnumber="31A-16-107.5">31A-16-107.5</xref>, and <xref depth="3" refnumber="27A-3-303">27a-3-303</xref>, an <ln numlevel="1" lineno="985" slineno="12-211"/>investment policy, or information related to an investment policy, provided to the <ln numlevel="1" lineno="986" slineno="12-212"/>insurance commissioner as described in Title <xref depth="1" refnumber="31A-18">31A, Chapter 18</xref>, Investments.</subsection></subsection></subsection><subsection ssid="43-null-120" dnum="26-o" numlevel="1" lineno="987" slineno="12-213" level="1"><display>(26)</display>"Record series" means a group of records that may be treated as a unit for purposes of <ln numlevel="1" lineno="988" slineno="12-214"/>designation, description, management, or disposition.</subsection><subsection ssid="43-null-121" dnum="27-o" numlevel="1" lineno="989" slineno="12-215" level="1"><display>(27)</display>"Records officer" means the individual appointed by the chief administrative officer of <ln numlevel="1" lineno="990" slineno="12-216"/>each governmental entity, or the political subdivision to work with state archives in the <ln numlevel="1" lineno="991" slineno="12-217"/>care, maintenance, scheduling, designation, classification, disposal, and preservation of <ln numlevel="1" lineno="992" slineno="12-218"/>records.</subsection><subsection ssid="43-null-122" dnum="28-o" numlevel="1" lineno="993" slineno="12-219" level="1"><display>(28)</display>"Schedule," "scheduling," and their derivative forms mean the process of specifying <ln numlevel="1" lineno="994" slineno="12-220"/>the length of time each record series should be retained by a governmental entity for <ln numlevel="1" lineno="995" slineno="12-221"/>administrative, legal, fiscal, or historical purposes and when each record series should be <ln numlevel="1" lineno="996" slineno="12-222"/>transferred to the state archives or destroyed.</subsection><subsection ssid="43-null-123" dnum="29-o" numlevel="1" lineno="997" slineno="12-223" level="1"><display>(29)</display>"Sponsored research" means research, training, and other sponsored activities as <ln numlevel="1" lineno="998" slineno="12-224"/>defined by the federal Executive Office of the President, Office of Management and <ln numlevel="1" lineno="999" slineno="12-225"/>Budget:<subsection ssid="43-null-124" dnum="a-o" numlevel="1" lineno="1000" slineno="12-226" level="2"><display>(a)</display>conducted:<subsection ssid="43-null-125" dnum="i-o" numlevel="1" lineno="1001" slineno="12-227" level="3"><display>(i)</display>by an institution within the state system of higher education described in Section <xref depth="3" refnumber="53H-1-102"><ln numlevel="1" lineno="1002" slineno="12-228"/>53H-1-102</xref>; and</subsection><subsection ssid="43-null-126" dnum="ii-o" numlevel="1" lineno="1003" slineno="12-229" level="3"><display>(ii)</display>through an office responsible for sponsored projects or programs; and</subsection></subsection><subsection ssid="43-null-127" dnum="b-o" numlevel="1" lineno="1004" slineno="12-230" level="2"><display>(b)</display>funded or otherwise supported by an external:<subsection ssid="43-null-128" dnum="i-o" numlevel="1" lineno="1005" slineno="12-231" level="3"><display>(i)</display>person that is not created or controlled by the institution within the state system of <ln numlevel="1" lineno="1006" slineno="12-232"/>higher education;
